        <heading>Preliminary</heading>

          <heading>Short title</heading>
          <content>
            <p>		This Act may be cited as the <i>Census and Statistics Act 1905</i>.</p>
          </content>
        </section>
        <section eId="part-I__sec-2">
          <num>2</num>
          <heading>Application to external Territories</heading>
          <content>
            <p>This Act extends to such external Territories as are prescribed.</p>
          </content>
        </section>
        <section eId="part-I__sec-3">
          <num>3</num>
          <heading>Interpretation</heading>
          <content>
            <p>In this Act, unless the contrary intention appears:</p>
            <p><term refersTo="#term-agency">Agency</term> has the meaning given by <def><ref href="#sec-19A">section 19A</ref>.</def></p>
            <p><term refersTo="#term-archives">Archives</term> means <def>the National Archives of Australia mentioned in subsection 5(1) of <ref href="">the Archives Act 1983</ref>.</def></p>
            <p><term refersTo="#term-authorized-officer">authorized officer</term> means <def>an officer who, by virtue of an appointment under <ref href="#sec-16">section 16</ref>, is an authorized officer for the purposes of this Act.</def></p>
            <p><term refersTo="#term-bureau">Bureau</term> means <def><ref class="unresolved">the Australian Bureau of Statistics established by the Australian Bureau of Statistics Act 1975</ref>.</def></p>
            <p><term refersTo="#term-census-day">Census day</term> has the meaning given by <def><ref href="#sec-19A">section 19A</ref>.</def></p>
            <p><term refersTo="#term-determination">determination</term> means <def>a determination made under <ref href="#sec-13">section 13</ref>.</def></p>
            <p><term refersTo="#term-form">form</term> means <def>a form prepared by the Statistician under subsection 10(1).</def></p>
            <p><b><i>officer</i></b> means:</p>
          </content>
          <paragraph eId="part-I__sec-3__para-a">
            <num>a</num>
            <content>
              <p>	(a)	a member of the staff of the Bureau referred to in subsection 16(1) of the <i>Australian Bureau of Statistics Act 1975</i>; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-I__sec-3__para-b">
            <num>b</num>
            <content>
              <p>a person engaged in accordance with the regulations to assist in the carrying out of the functions of the Statistician; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-I__sec-3__para-c">
            <num>c</num>
            <content>
              <p>	(c)	a person who performs services in accordance with an arrangement made under <i>Australian Bureau of Statistics Act 1975</i>.<ref href="#sec-16A">section 16A</ref> of the </p>
            </content>
            <content>
              <p><term refersTo="#term-statistician">Statistician</term> means <def>the Australian Statistician referred to in subsection 5(2) of <ref href="">the Australian Bureau of Statistics Act 1975</ref>.</def></p>
            </content>
          </paragraph>
        </section>
        <section eId="part-I__sec-6">
          <num>6</num>
          <heading>Arrangements with State Governments as to execution of Act</heading>
          <subsection eId="part-I__sec-6__subsec-1">
            <num>1</num>
            <content>
              <p>The Governor-General may enter into any arrangement with the Governor of any State providing for any matter necessary or convenient for the purpose of carrying out or giving effect to this Act and in particular for all or any of the following matters:</p>
            </content>
            <paragraph eId="part-I__sec-6__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>the execution by State Officers of any power or duty conferred or imposed on any officer under this Act or the regulations;</p>
              </content>
            </paragraph>
            <paragraph eId="part-I__sec-6__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>the collection by any State Department or officer of any statistical or other information required for the purpose of carrying out this Act; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-I__sec-6__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>the supplying of statistical information by any State Department or officer to the Statistician.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-I__sec-6__subsec-2">
            <num>2</num>
            <content>
              <p>Officers executing any power or duty conferred or imposed on any officer under this Act or the regulations, in pursuance of any arrangement entered into under this section, shall for the purposes of the execution of that power or duty be deemed to be officers under this Act.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-I__sec-7">
          <num>7</num>
          <heading>Undertaking of fidelity and secrecy</heading>
          <content>
            <p>Every officer executing any power or duty conferred or imposed on any officer under this Act or the regulations, shall, before entering upon his or her duties or exercising any power under this Act, sign, in the presence of a witness, an undertaking of fidelity and secrecy in accordance with the prescribed form.</p>
          </content>
        </section>
      </part>
      <part eId="part-II">
        <num>II</num>
        <heading>The Census</heading>
        <section eId="part-II__sec-8">
          <num>8</num>
          <heading>Taking of Census</heading>
          <subsection eId="part-II__sec-8__subsec-1">
            <num>1</num>
            <content>
              <p>The Census shall be taken in the year 1981 and in every fifth year thereafter, and at such other times as are prescribed.</p>
            </content>
          </subsection>
          <subsection eId="part-II__sec-8__subsec-2">
            <num>2</num>
            <content>
              <p>The Census day shall be a day appointed for that purpose by proclamation.</p>
            </content>
          </subsection>
          <subsection eId="part-II__sec-8__subsec-3">
            <num>3</num>
            <content>
              <p>For the purposes of the taking of the Census, the Statistician shall collect statistical information in relation to the matters prescribed for the purposes of this section.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-II__sec-8A">
          <num>8A</num>
          <heading>Transfer of Census information to the Archives</heading>
          <content>
            <p>If:</p>
          </content>
          <paragraph eId="part-II__sec-8A__para-a">
            <num>a</num>
            <content>
              <p>a form is given to the Statistician or an authorised officer under <ref href="#sec-10">section 10</ref> in relation to the Census taken in the year 2001 or a later year; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-II__sec-8A__para-b">
            <num>b</num>
            <content>
              <p>a person has consented, in accordance with the form, to the information contained in the form being transferred to the custody of the Archives under this section;</p>
            </content>
            <content>
              <p>the Statistician must transfer the information to the custody of the Archives in a form and manner agreed by the Statistician and the Director-General of the Archives.</p>
            </content>
          </paragraph>
        </section>
      </part>
      <part eId="part-III">
        <num>III</num>
        <heading>Statistics</heading>
        <section eId="part-III__sec-9">
          <num>9</num>
          <heading>Statistical information to be collected</heading>
          <subsection eId="part-III__sec-9__subsec-1">
            <num>1</num>
            <content>
              <p>The Statistician:</p>
            </content>
            <paragraph eId="part-III__sec-9__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>may from time to time collect such statistical information in relation to the matters prescribed for the purposes of this section as he or she considers appropriate; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-III__sec-9__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>shall, if <role refersTo="#minister">the Minister</role> so directs by legislative instrument, collect such statistical information in relation to the matters so prescribed as is specified in the instrument.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-III__sec-9__subsec-2">
            <num>2</num>
            <content>
              <p>The Statistician shall collect such statistical information as is necessary for the purposes of the compilation and analysis, under <ref href="#sec-12">section 12</ref>, of statistics of the number of the people of each State as on the last day of March, June, September and December in each year, but nothing in this subsection shall be taken to limit the generality of subsection (1).</p>
            </content>
          </subsection>
        </section>
      </part>
      <part eId="part-IV">
        <num>IV</num>
        <heading>Administration</heading>
        <section eId="part-IV__sec-10">
          <num>10</num>
          <heading>Forms to be filled up</heading>
          <subsection eId="part-IV__sec-10__subsec-1">
            <num>1</num>
            <content>
              <p>The Statistician may prepare forms relating to the collection of statistical information in relation to any matter referred to in <ref href="#sec-8">section 8</ref> or 9.</p>
            </content>
          </subsection>
          <subsection eId="part-IV__sec-10__subsec-2">
            <num>2</num>
            <content>
              <p>For the purposes of <ref href="#sec-8">section 8</ref>, the Statistician may, by notifiable instrument, require persons included in a specified class of persons to fill up and supply, in accordance with instructions contained in or accompanying a specified form, the particulars specified in that form and to cause the form so filled up to be furnished to the Statistician, or to an authorized officer, in accordance with those instructions.</p>
            </content>
          </subsection>
          <subsection eId="part-IV__sec-10__subsec-3">
            <num>3</num>
            <content>
              <p>For the purposes of <ref href="#sec-8">section 8</ref> or 9, the Statistician or an authorized officer may, either orally or in writing, request a person:</p>
            </content>
            <paragraph eId="part-IV__sec-10__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>to fill up and supply, in accordance with instructions contained in or accompanying a form, the particulars specified in that form; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-IV__sec-10__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>to cause the form so filled up to be furnished to the Statistician, or to an authorized officer, in accordance with those instructions.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-IV__sec-10__subsec-4">
            <num>4</num>
            <content>
              <p>For the purposes of <ref href="#sec-8">section 8</ref> or 9, the Statistician may, by notice in writing served either personally or by post on a person, direct the person:</p>
            </content>
            <paragraph eId="part-IV__sec-10__subsec-4__para-a">
              <num>a</num>
              <content>
                <p>to fill up and supply, in accordance with instructions contained in or accompanying a form accompanying the notice, within such period after the service of the notice, being not less than 14 days, as is specified in the notice, the particulars specified in that form; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-IV__sec-10__subsec-4__para-b">
              <num>b</num>
              <content>
                <p>to cause the form so filled up to be furnished to the Statistician, or to an authorized officer, in accordance with those instructions.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-IV__sec-10__subsec-5">
            <num>5</num>
            <content>
              <p>A notice referred to in subsection (4) shall set out the effect of the provisions of <ref href="#sec-14">section 14</ref>.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-IV__sec-11">
          <num>11</num>
          <heading>Answering of questions</heading>
          <subsection eId="part-IV__sec-11__subsec-1">
            <num>1</num>
            <content>
              <p>For the purposes of <ref href="#sec-8">section 8</ref> or 9, the Statistician or an authorized officer may, either orally or in writing, request a person to answer a question that is necessary to obtain any statistical information in relation to any matter referred to in <ref href="#sec-8">section 8</ref> or 9.</p>
            </content>
          </subsection>
          <subsection eId="part-IV__sec-11__subsec-2">
            <num>2</num>
            <content>
              <p>For the purposes of <ref href="#sec-8">section 8</ref> or 9, the Statistician may, by notice in writing served either personally or by post on a person, direct the person to answer, within such period after service of the notice, being not less than 14 days, as is specified in the notice, a specified question that is necessary to obtain any statistical information in relation to any matter referred to in <ref href="#sec-8">section 8</ref> or 9.</p>
            </content>
          </subsection>
          <subsection eId="part-IV__sec-11__subsec-3">
            <num>3</num>
            <content>
              <p>A notice referred to in subsection (2) shall set out the effect of the provisions of <ref href="#sec-14">section 14</ref>.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-IV__sec-12">
          <num>12</num>
          <heading>Publication etc. of statistics</heading>
          <subsection eId="part-IV__sec-12__subsec-1">
            <num>1</num>
            <content>
              <p>The Statistician shall compile and analyse the statistical information collected under this Act and shall publish and disseminate the results of any such compilation and analysis, or abstracts of those results.</p>
            </content>
          </subsection>
          <subsection eId="part-IV__sec-12__subsec-2">
            <num>2</num>
            <content>
              <p>The results or abstracts referred to in subsection (1) shall not be published or disseminated in a manner that is likely to enable the identification of a particular person or organization.</p>
            </content>
          </subsection>
          <subsection eId="part-IV__sec-12__subsec-3">
            <num>3</num>
            <content>
              <p>The Statistician may make charges for results and abstracts published and disseminated under this section.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-IV__sec-13">
          <num>13</num>
          <heading>Release of information</heading>
          <subsection eId="part-IV__sec-13__subsec-1">
            <num>1</num>
            <content>
              <p>Notwithstanding anything in this Act (other than this section), <role refersTo="#minister">the Minister</role> may, by legislative instrument, make determinations providing for and in relation to the disclosure, with the approval in writing of the Statistician, of information included in a specified class of information furnished in pursuance of this Act.</p>
            </content>
          </subsection>
          <subsection eId="part-IV__sec-13__subsec-2">
            <num>2</num>
            <content>
              <p>Without limiting the generality of subsection (1), determinations may make provision:</p>
            </content>
            <paragraph eId="part-IV__sec-13__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>as to the persons to whom the information may be disclosed;</p>
              </content>
            </paragraph>
            <paragraph eId="part-IV__sec-13__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>as to the persons, being the persons from whom the information has been obtained, whose consent is required for the disclosure of the information; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-IV__sec-13__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>specifying terms and conditions subject to which the information may be disclosed, including, but without limiting the generality of the foregoing, terms and conditions as to the requiring of a person to whom the information is, or is to be, disclosed to give an undertaking, in writing with respect to the disclosure of the information by that person, including an undertaking not to disclose any of the information to any person.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-IV__sec-13__subsec-3">
            <num>3</num>
            <content>
              <p>Information of a personal or domestic nature relating to a person shall not be disclosed in accordance with a determination in a manner that is likely to enable the identification of that person.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-IV__sec-14">
          <num>14</num>
          <heading>Failure to answer questions etc.</heading>
          <subsection eId="part-IV__sec-14__subsec-1">
            <num>1</num>
            <content>
              <p>A person commits an offence if:</p>
            </content>
            <paragraph eId="part-IV__sec-14__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>the person is served a direction under subsection 10(4) or 11(2); and</p>
              </content>
            </paragraph>
            <paragraph eId="part-IV__sec-14__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>the person fails to comply with the direction.</p>
              </content>

          <subsection eId="part-IV__sec-14__subsec-2">
            <num>2</num>

              <p>the person:</p>
            </content>
          </paragraph>
          <paragraph eId="part-IV__sec-15__para-i">
            <num>i</num>
            <content>
              <p>is required, requested or directed to fill up and supply particulars under subsection 10(2), (3) or (4); or</p>
            </content>
          </paragraph>
          <paragraph eId="part-IV__sec-15__para-ii">
            <num>ii</num>
            <content>
              <p>is requested or directed to answer a question under subsection 11(1) or (2); and</p>
            </content>
          </paragraph>
          <paragraph eId="part-IV__sec-15__para-b">
            <num>b</num>
            <content>
              <p>the person makes a statement, either orally or in writing, or provides a document containing information, in connection with the requirement, request or direction; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-IV__sec-15__para-c">

              <p>the person knows that the statement or information is false or misleading in a material particular.</p>

          <heading>Authorized officers</heading>
          <subsection eId="part-IV__sec-16__subsec-1">
            <num>1</num>

              <p>The Statistician may, by instrument in writing, appoint a specified officer, or officers included in a specified class of officers, to be an authorized officer or authorized officers, as the case may be, for the purposes of this Act.</p>

          </subsection>
          <subsection eId="part-IV__sec-16__subsec-2">
            <num>2</num>
            <content>
              <p>	(2)	However, the Statistician must not appoint as an authorised officer a person who performs services in accordance with an arrangement made under <i>Australian Bureau of Statistics Act 1975</i>.<ref href="#sec-16A">section 16A</ref> of the </p>

          </subsection>
        </section>
        <section eId="part-IV__sec-17">
          <num>17</num>
          <heading>Delegation</heading>
          <subsection eId="part-IV__sec-17__subsec-1">
            <num>1</num>
            <content>
              <p>The Statistician may, by signed instrument, delegate to an officer all or any of his or her powers under this Act or any other law.</p>
            </content>
          </subsection>
          <subsection eId="part-IV__sec-17__subsec-1A">
            <num>1A</num>
            <content>
              <p>	(1A)	However, the Statistician must not delegate a power under subsection 10(2), (3) or (4) or <i>Australian Bureau of Statistics Act 1975</i>.<ref href="#sec-11">section 11</ref> or 18 to a person who performs services in accordance with an arrangement made under <ref href="#sec-16A">section 16A</ref> of the </p>
            </content>
          </subsection>
          <subsection eId="part-IV__sec-17__subsec-2">
            <num>2</num>
            <content>
              <p>A power so delegated, when exercised by the delegate, shall, for the purposes of this Act or that other law, as the case may be, be deemed to have been exercised by the Statistician.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-IV__sec-18">
          <num>18</num>
          <heading>Powers of entry</heading>
          <subsection eId="part-IV__sec-18__subsec-1">
            <num>1</num>
            <content>
              <p>The Statistician or an authorized officer may, at all reasonable times, enter any premises included in a prescribed class of premises for the purpose of:</p>
            </content>
            <paragraph eId="part-IV__sec-18__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>supplying persons with forms;</p>
              </content>
            </paragraph>
            <paragraph eId="part-IV__sec-18__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>collecting forms that have been supplied to persons; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-IV__sec-18__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>making inquiries for the purposes of this Act.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-IV__sec-18__subsec-2">
            <num>2</num>
            <content>
              <p>	(2)	In subsection (1), <b><i>premises</i></b> means premises other than:</p>
            </content>
            <paragraph eId="part-IV__sec-18__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>a dwelling-house (including a flat or home unit); or</p>
              </content>
            </paragraph>
            <paragraph eId="part-IV__sec-18__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>a part of any other premises that is separately occupied or used for the purposes of the residence or sleeping accommodation of a person or persons.</p>
              </content>
            </paragraph>
          </subsection>
        </section>
        <section eId="part-IV__sec-19">
          <num>19</num>
          <heading>Secrecy</heading>
          <subsection eId="part-IV__sec-19__subsec-1">
            <num>1</num>
            <content>
              <p>A person commits an offence if:</p>
            </content>
            <paragraph eId="part-IV__sec-19__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>the person is, or has been, the Statistician or an officer; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-IV__sec-19__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>the person, either directly or indirectly, divulges or communicates to another person (other than the person from whom the information was obtained) any information given under this Act.</p>
              </content>
              <hcontainer name="penalty">
                <content>
                  <p>Penalty:	<quantity refersTo="#penaltyUnit">120 penalty units</quantity> or <quantity refersTo="#custodialSentence">imprisonment for 2 years</quantity>, or both.</p>

              <p>Subsection (1) does not apply if the person divulges or communicates the information:</p>

                <p>in accordance with a determination under <ref href="#sec-13">section 13</ref>; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-IV__sec-19__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>for the purposes of this Act.</p>
              </content>

              <content>
                <p>the person fails to comply with the undertaking.</p>

          <heading>Non-disclosure of Census information</heading>

            <p>Non-disclosure of Census information to Agencies</p>

            <num>1</num>
            <content>
              <p>A person who is or has been the Statistician or an officer must not, at any time during the period of 99 years beginning on the Census day for a Census:</p>
            </content>
            <paragraph eId="part-IV__sec-19A__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>be required to divulge or communicate to an Agency any information that is contained in a form that is given to the Statistician or an authorised officer under <ref href="#sec-10">section 10</ref> in relation to that Census; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-IV__sec-19A__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>voluntarily give such information to an Agency;</p>
              </content>
              <content>
                <p>other than in accordance with this Act.</p>
                <p>Non-disclosure of Census information to a court or tribunal</p>

          </subsection>

            <num>2</num>

              <num>b</num>
              <content>
                <p>voluntarily give such information in evidence in proceedings before a court or tribunal.</p>
              </content>
              <content>
                <p>Definitions</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-IV__sec-19A__subsec-3">
            <num>3</num>
            <content>
              <p>In this Act:</p>
            </content>
            <content>
              <p><b><i>Agency</i></b> has the meaning given by section 7 of the <i>Public Service Act 1999</i>.</p>
              <p><b><i>Census day</i></b>, for a Census, means the day appointed, under subsection 8(2), as the Census day for that Census.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-IV__sec-19B">
          <num>19B</num>
          <heading>Former officers</heading>
          <subsection eId="part-IV__sec-19B__subsec-1">
            <num>1</num>
            <content>
              <p>	(1)	This section applies if, at a particular time before 5 December 1999, a person was a member of the staff of the Bureau referred to in subsection 16(1) of the <i>Australian Bureau of Statistics Act 1975</i> as in force at that time.</p>
            </content>
          </subsection>
          <subsection eId="part-IV__sec-19B__subsec-2">
            <num>2</num>
            <content>
              <p>For the purposes of sections 19 and 19A, the person is taken to have been an officer at that time.</p>
            </content>

          <num>20</num>
          <heading>Prosecution of offences</heading>
          <subsection eId="part-IV__sec-20__subsec-1">
            <num>1</num>
            <content>
              <p>An offence against this Act, other than an offence against <ref href="#sec-19">section 19</ref>, shall be prosecuted summarily.</p>
            </content>
          </subsection>
          <subsection eId="part-IV__sec-20__subsec-2">
            <num>2</num>
            <content>
              <p>Notwithstanding that an offence against <ref href="#sec-19">section 19</ref> is expressed by this Act to be an indictable offence, a court of summary jurisdiction may hear and determine proceedings in respect of such an offence if the court is satisfied that it is proper to do so and the defendant and the prosecutor consent.</p>
            </content>
          </subsection>
          <subsection eId="part-IV__sec-20__subsec-3">
            <num>3</num>
            <content>
              <p>Where, in accordance with subsection (2), a court of summary jurisdiction convicts a person of an offence against <quantity refersTo="#penaltyUnit">20 penalty units</quantity>, or both.<ref href="#sec-19">section 19</ref>, the penalty that the court may impose is imprisonment for a period not exceeding 12 months or a fine not exceeding </p>
            </content>
          </subsection>
        </section>
        <section eId="part-IV__sec-21">
          <num>21</num>
          <heading>Continuing offences</heading>
          <content>
            <p>Where under subsection 10(4) or 11(2) an act or thing is required to be done within a particular period or before a particular time, the obligation to do that act or thing continues, notwithstanding that that period has expired or that time has passed, until that act or thing is done.</p>
          </content>
        </section>
        <section eId="part-IV__sec-22">
          <num>22</num>
          <heading>Joinder of charges and penalties for certain offences</heading>
          <subsection eId="part-IV__sec-22__subsec-1">
            <num>1</num>
            <content>
              <p>Charges against the same person for any number of offences against <ref href="#sec-14">section 14</ref> may be joined in the same information or complaint if those offences relate to a failure to do the same act or thing.</p>
            </content>
          </subsection>
          <subsection eId="part-IV__sec-22__subsec-2">
            <num>2</num>
            <content>
              <p>If a person is convicted of 2 or more offences referred to in subsection (1), being offences related to a failure to do the same act or thing, the court may impose one penalty in respect of both or all of those offences, but that penalty shall not exceed the sum of the maximum penalties that could be imposed if a penalty were imposed in respect of each offence separately.</p>

          </subsection>
        </section>
        <section eId="part-IV__sec-27">
          <num>27</num>
          <heading>Regulations</heading>
          <content>
            <p>The Governor-General may make regulations, not inconsistent with this Act, prescribing all matters and things which, by this Act, are required or permitted to be prescribed, or which are necessary or convenient to be prescribed for carrying out or giving effect to this Act and in particular for prescribing penalties not exceeding <quantity refersTo="#penaltyUnit">5 penalty units</quantity> for offences against the regulations.</p>
