          <heading>Short title</heading>
          <content>
            <p>		This Act may be cited as the <i>Foreign Passports (Law Enforcement and Security) Act 2005</i>.</p>
          </content>
        </section>
        <section eId="part-1__sec-2">
          <num>2</num>
          <heading>Commencement</heading>
          <content>
            <p>This Act shall commence on a date to be fixed by Proclamation.</p>
          </content>
        </section>
        <section eId="part-1__sec-4">
          <num>4</num>
          <heading>Extension of Act to Territories</heading>
          <content>
            <p>This Act shall extend to the Territories.</p>
          </content>
        </section>
        <section eId="part-1__sec-5">
          <num>5</num>
          <heading>Interpretation</heading>
          <content>
            <p>In this Act, unless the contrary intention appears:</p>
            <p><term refersTo="#term-asio">ASIO</term> means <def>the Australian Security Intelligence Organisation.</def></p>
            <p>includes the Territories.</p>
            <p><term refersTo="#term-competent-authority">competent authority</term> means <def>a competent authority for the purposes of <ref href="#sec-13">section 13</ref>, 14 or 15.</def></p>
            <p><b><i>document </i></b>includes:</p>
          </content>
          <paragraph eId="part-1__sec-5__para-a">
            <num>a</num>
            <content>
              <p>any paper or other material on which there is writing; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-b">
            <num>b</num>
            <content>
              <p>any paper or other material on which there are marks, figures, symbols or perforations that are:</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-i">
            <num>i</num>
            <content>
              <p>capable of being given a meaning by persons qualified to interpret them; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-ii">
            <num>ii</num>
            <content>
              <p>capable of being responded to by a computer, a machine or an electronic device; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-c">
            <num>c</num>
            <content>
              <p>any article or material (for example, a disk or a tape) from which information is capable of being reproduced with or without the aid of any other article or device.</p>
            </content>
            <content>
              <p><b><i>enforcement officer </i></b>means:</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-a">
            <num>a</num>
            <content>
              <p>	(a)	an officer of Customs within the meaning of the <i>Customs Act 1901</i>; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-b">
            <num>b</num>
            <content>
              <p>a member or a special member of the Australian Federal Police; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-c">
            <num>c</num>
            <content>
              <p>an officer of the police force of a State or Territory; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-d">
            <num>d</num>
            <content>
              <p>a person, or a person who is one of a class of persons, authorised in writing by <role refersTo="#minister">the Minister</role> to exercise the powers and perform the functions of an enforcement officer.</p>
            </content>
            <content>
              <p><term refersTo="#term-foreign-passport">foreign passport</term> means <def>a passport issued by or on behalf of the government of a foreign country.</def></p>
              <p><b><i>foreign travel document</i></b><b> </b>means:</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-a">
            <num>a</num>
            <content>
              <p>a foreign passport; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-b">
            <num>b</num>
            <content>
              <p>a document of identity issued for travel purposes by or on behalf of the government of a foreign country (whether or not also issued for another purpose).</p>
            </content>
            <content>
              <p><term refersTo="#term-minister-s-determination">Minister’s determination</term> means <def>an instrument made by the Minister for the purposes of this Act under <ref href="#sec-24">section 24</ref>.</def></p>
            </content>
          </paragraph>
        </section>

          <num>5A</num>
          <heading>Application of the Criminal Code</heading>
          <content>
            <p><i>	</i><i>	</i>Chapter 2 of the <i>Criminal Code</i> applies to all offences against this Act.</p>
          </content>

        <heading>Enforcement officers’ powers in relation to foreign travel documents</heading>

          <heading>Requesting the Minister to order surrender of foreign travel documents</heading>

            <num>13</num>
            <heading>Request relating to Australian law enforcement matters</heading>
            <subsection eId="part-2__dvs-1__sec-13__subsec-1">
              <num>1</num>
              <content>
                <p>If a competent authority believes on reasonable grounds that:</p>
              </content>
              <paragraph eId="part-2__dvs-1__sec-13__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>a person is the subject of an arrest warrant issued in Australia in respect of an indictable offence against a law of the Commonwealth, a State or Territory; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-1__sec-13__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>a person (including a person who is in prison) is prevented from travelling internationally by force of:</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-1__sec-13__subsec-1__para-i">
                <num>i</num>
                <content>
                  <p>an order of a court of the Commonwealth, a State or Territory; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-1__sec-13__subsec-1__para-ii">
                <num>ii</num>
                <content>
                  <p>a condition of parole, or of a recognisance, surety, bail bond or licence for early release from prison, granted under a law of the Commonwealth, a State or Territory; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-1__sec-13__subsec-1__para-iii">
                <num>iii</num>
                <content>
                  <p>a law of the Commonwealth, or an order or other direction (however described) under a law of the Commonwealth;</p>
                </content>
                <content>
                  <p>the competent authority may request <role refersTo="#minister">the Minister</role> to make an order under section 16 in relation to the person’s foreign travel documents.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-1__sec-13__subsec-1A">
              <num>1A</num>
              <content>
                <p>A competent authority may request <role refersTo="#minister">the Minister</role> to make an order under section 16 in relation to the person’s foreign travel documents if the person is:</p>
              </content>
              <paragraph eId="part-2__dvs-1__sec-13__subsec-1A__para-a">
                <num>a</num>
                <content>
                  <p>an Australian citizen; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-1__sec-13__subsec-1A__para-b">
                <num>b</num>
                <content>
                  <p>a reportable offender.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-1__sec-13__subsec-2">
              <num>2</num>
              <content>
                <p>In this section:</p>
              </content>
              <content>
                <p><b><i>competent authority</i></b>, in relation to a circumstance mentioned in paragraph (1)(a) or (b) or (1A)(b), means:</p>
              </content>
              <paragraph eId="part-2__dvs-1__sec-13__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>a person who has responsibility for, or powers, functions or duties in relation to, that circumstance under a law of the Commonwealth, a State or Territory (other than a person who is specified in a Minister’s determination as not being a competent authority in relation to the circumstance); or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-1__sec-13__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>a person specified in a Minister’s determination as a competent authority in relation to the circumstance.</p>
                </content>
                <content>
                  <p><b><i>prevented from travelling internationally</i></b> includes:</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-1__sec-13__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>required to remain in ; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-1__sec-13__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>required to surrender a passport or document issued for the purposes of travel; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-1__sec-13__subsec-2__para-c">
                <num>c</num>
                <content>
                  <p>not permitted to apply for a passport or document issued for the purposes of travel; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-1__sec-13__subsec-2__para-d">
                <num>d</num>
                <content>
                  <p>not permitted to obtain a passport or document issued for the purposes of travel.</p>
                </content>
                <content>
                  <p><b><i>reportable offender</i></b> means a person:</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-1__sec-13__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>whose name is entered on a child protection offender register (however described) of a State or Territory; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-1__sec-13__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>who has reporting obligations (however described) in connection with that entry on the register.</p>
                </content>
              </paragraph>
            </subsection>
          </section>
          <section eId="part-2__dvs-1__sec-14">
            <num>14</num>
            <heading>Request relating to international law enforcement co-operation</heading>
            <subsection eId="part-2__dvs-1__sec-14__subsec-1">
              <num>1</num>
              <content>
                <p>If a competent authority believes on reasonable grounds that:</p>
              </content>
              <paragraph eId="part-2__dvs-1__sec-14__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>a person is the subject of an arrest warrant issued in a foreign country in respect of a serious foreign offence; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-1__sec-14__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>a person (including a person who is in prison) is prevented from travelling internationally by force of:</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-1__sec-14__subsec-1__para-i">
                <num>i</num>
                <content>
                  <p>an order of a court of a foreign country; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-1__sec-14__subsec-1__para-ii">
                <num>ii</num>
                <content>
                  <p>a condition of parole, or of a recognisance, surety, bail bond or licence for early release from prison, granted under a law of a foreign country, or other similar arrangement made under a law of a foreign country; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-1__sec-14__subsec-1__para-iii">
                <num>iii</num>
                <content>
                  <p>a law of a foreign country, or an order or other direction (however described) under a law of a foreign country.</p>
                </content>
                <content>
                  <p>the competent authority may request <role refersTo="#minister">the Minister</role> to make an order under section 16 in relation to the person’s foreign travel documents.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-1__sec-14__subsec-2">
              <num>2</num>
              <content>
                <p>In this section:</p>
              </content>
              <content>
                <p><b><i>competent authority</i></b>, in relation to a circumstance mentioned in paragraph (1)(a) or (b), means:</p>
              </content>
              <paragraph eId="part-2__dvs-1__sec-14__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>a member of the diplomatic staff of an Australian mission, being a person who is a member of the diplomatic staff of the mission within the meaning of the Vienna Convention on Diplomatic Relations; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-1__sec-14__subsec-2__para-aa">
                <num>aa</num>
                <content>
                  <p>a consular officer of an Australian consulate, being a person who is a consular officer (but not an honorary consular officer) within the meaning of the Vienna Convention on Consular Relations; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-1__sec-14__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>an employee of the Commonwealth who is specified in a Minister’s determination as a competent authority in relation to the circumstance; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-1__sec-14__subsec-2__para-c">
                <num>c</num>
                <content>
                  <p>	(c)	a non-corporate Commonwealth entity (within the meaning of the <i>Public Governance, Performance and Accountability Act 2013</i>) that is specified in a Minister’s determination as a competent authority in relation to the circumstance.</p>

                  <p>required to surrender a passport or document issued for the purposes of travel; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-1__sec-14__subsec-2__para-c">
                <num>c</num>
                <content>
                  <p>not permitted to apply for a passport or document issued for the purposes of travel; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-1__sec-14__subsec-2__para-d">
                <num>d</num>
                <content>

                  <p><b><i>serious foreign offence</i></b> means an offence against the law of a foreign country:</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-1__sec-14__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>for which the maximum penalty is death or imprisonment, or other deprivation of liberty, for a period of not less than 12 months; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-1__sec-14__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>if the offence does not carry a penalty under the law of the country—the conduct constituting which is, under a treaty to which the country and Australia are parties (being a treaty relating in whole or in part to the surrender of persons accused or convicted of offences), required to be treated as an offence for which the surrender of persons is allowed by the country or Australia; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-1__sec-14__subsec-2__para-c">
                <num>c</num>
                <content>
                  <p>the conduct constituting which would, if engaged in in , constitute an indictable offence against this Act; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-1__sec-14__subsec-2__para-d">
                <num>d</num>
                <content>
                  <p>the conduct constituting which would, if engaged in in , constitute an offence specified in a Minister’s determination made for the purposes of subparagraph 15(1)(a)(v).</p>

              </paragraph>
            </subsection>
          </section>
          <section eId="part-2__dvs-1__sec-15">
            <num>15</num>
            <heading>Request relating to potential for harmful conduct</heading>
            <subsection eId="part-2__dvs-1__sec-15__subsec-1">
              <num>1</num>
              <content>
                <p>If a competent authority suspects on reasonable grounds that:</p>
              </content>
              <paragraph eId="part-2__dvs-1__sec-15__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>unless a person’s foreign travel documents are surrendered, the person would be likely to engage in conduct that:</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-1__sec-15__subsec-1__para-i">
                <num>i</num>
                <content>
                  <p>might prejudice the security of  or a foreign country; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-1__sec-15__subsec-1__para-ii">
                <num>ii</num>
                <content>
                  <p>might endanger the health or physical safety of other persons (whether in  or a foreign country); or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-1__sec-15__subsec-1__para-iii">
                <num>iii</num>
                <content>
                  <p>might interfere with the rights or freedoms of other persons (whether in  or a foreign country) set out in the International Covenant on Civil and Political Rights; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-1__sec-15__subsec-1__para-iv">
                <num>iv</num>
                <content>
                  <p>might constitute an indictable offence against this Act; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-1__sec-15__subsec-1__para-v">
                <num>v</num>
                <content>
                  <p>might constitute an indictable offence against a law of the Commonwealth, being an offence specified in a Minister’s determination; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-1__sec-15__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>the person should be required to surrender the person’s foreign travel documents in order to prevent the person from engaging in the conduct;</p>
                </content>
                <content>
                  <p>the competent authority may request <role refersTo="#minister">the Minister</role> to make an order under section 16 in relation to the person’s foreign travel documents.</p>
                </content>

                <p>In this section:</p>
              </content>
              <content>
                <p><b><i>competent authority</i></b>, in relation to a circumstance mentioned in subsection (1), means:</p>
              </content>
              <paragraph eId="part-2__dvs-1__sec-15__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>a member of the diplomatic staff of an Australian mission, being a person who is a member of the diplomatic staff of the mission within the meaning of the Vienna Convention on Diplomatic Relations; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-1__sec-15__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>a consular officer of an Australian consulate, being a person who is a consular officer (but not an honorary consular officer) within the meaning of the Vienna Convention on Consular Relations; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-1__sec-15__subsec-2__para-c">
                <num>c</num>
                <content>
                  <p>an employee of the Commonwealth who is specified in a Minister’s determination as a competent authority in relation to the circumstance; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-1__sec-15__subsec-2__para-d">
                <num>d</num>
                <content>
                  <p>	(d)	a non-corporate Commonwealth entity (within the meaning of the <i>Public Governance, Performance and Accountability Act 2013</i>) that is specified in a Minister’s determination as a competent authority in relation to the circumstance; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-1__sec-15__subsec-2__para-e">
                <num>e</num>
                <content>
                  <p>a person who has responsibility for, or powers, duties or functions in relation to, the circumstance under a law of the Commonwealth, a State or Territory (other than a person who is specified in a Minister’s determination as not being a competent authority in relation to the circumstance); or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-1__sec-15__subsec-2__para-f">
                <num>f</num>
                <content>
                  <p>any person specified in a Minister’s determination as a competent authority in relation to the circumstance.</p>

            <num>15A</num>
            <heading>Request for 28 day surrender relating to security risk</heading>
            <subsection eId="part-2__dvs-1__sec-15A__subsec-1">
              <num>1</num>
              <content>
                <p>The Director-General of Security may request <role refersTo="#minister">the Minister</role> to make an order under section 16A in relation to a person’s foreign travel documents if the Director-General suspects on reasonable grounds that:</p>
              </content>
              <paragraph eId="part-2__dvs-1__sec-15A__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>the person may leave Australia to engage in conduct that might prejudice the security of Australia or a foreign country; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-1__sec-15A__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>the person should be required to surrender the person’s foreign travel documents in order to prevent the person from engaging in the conduct.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-1__sec-15A__subsec-2">
              <num>2</num>
              <content>
                <p>If <role refersTo="#minister">the Minister</role> has made an order under section 16A in relation to a person’s foreign travel documents, another request under subsection (1) of this section relating to the person must not be made unless the grounds for suspicion mentioned in that subsection include information first obtained by the Director-General of Security or an officer or employee of ASIO more than 28 days after <role refersTo="#minister">the Minister</role> made the order.</p>
              </content>
            </subsection>
            <subsection eId="part-2__dvs-1__sec-15A__subsec-3">
              <num>3</num>
              <content>
                <p>	(3)	The Director-General of Security may, in writing, delegate his or her power under subsection (1) to a Deputy Director-General of Security (within the meaning of the <i>Australian Security Intelligence Organisation Act 1979</i>).</p>
              </content>
            </subsection>
            <subsection eId="part-2__dvs-1__sec-15A__subsec-4">
              <num>4</num>
              <content>
                <p>In exercising power under a delegation, the delegate must comply with any directions of the Director-General of Security.</p>
              </content>
            </subsection>
          </section>
        </division>
        <division eId="part-2__dvs-2">
          <num>2</num>
          <heading>Demands for foreign travel documents</heading>
          <section eId="part-2__dvs-2__sec-16">
            <num>16</num>
            <heading>Demand for surrender of foreign travel document ordered by Minister on request under section 13, 14 or 15</heading>
            <subsection eId="part-2__dvs-2__sec-16__subsec-1">
              <num>1</num>
              <content>
                <p>If a competent authority makes a request under <role refersTo="#minister">the Minister</role> may order the surrender of the person’s foreign travel documents.<ref href="#sec-13">section 13</ref> (other than subsection 13(1A)), 14 or 15 in relation to a person, </p>
              </content>
            </subsection>
            <subsection eId="part-2__dvs-2__sec-16__subsec-1A">
              <num>1A</num>
              <content>
                <p>If a competent authority makes a request under subsection 13(1A) in relation to a person, <role refersTo="#minister">the Minister</role> must order the surrender of the person’s foreign travel documents.</p>
              </content>
            </subsection>
            <subsection eId="part-2__dvs-2__sec-16__subsec-2">
              <num>2</num>
              <content>
                <p>If <role refersTo="#minister">the Minister</role> has made an order under subsection (1) or (1A), an enforcement officer may demand that the person surrender to the officer the person’s foreign travel documents.</p>
              </content>
            </subsection>
            <subsection eId="part-2__dvs-2__sec-16__subsec-3">
              <num>3</num>
              <content>
                <p>If the person does not immediately surrender the person’s foreign travel documents, the officer may:</p>
              </content>
              <paragraph eId="part-2__dvs-2__sec-16__subsec-3__para-a">
                <num>a</num>
                <content>
                  <p>seize the person’s foreign travel documents; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-16__subsec-3__para-b">
                <num>b</num>
                <content>
                  <p>seize any foreign travel document of the person that is not in the possession or control of any person.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-2__sec-16__subsec-4">
              <num>4</num>
              <content>
                <p>Subsection (3) does not authorise an enforcement officer to enter premises that the officer would not otherwise be authorised to enter.</p>
              </content>
            </subsection>
            <subsection eId="part-2__dvs-2__sec-16__subsec-5">
              <num>5</num>
              <content>
                <p>A person commits an offence if:</p>
              </content>
              <paragraph eId="part-2__dvs-2__sec-16__subsec-5__para-a">
                <num>a</num>
                <content>
                  <p>an enforcement officer demands under subsection (2) that the person surrender the person’s foreign travel documents; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-16__subsec-5__para-b">
                <num>b</num>
                <content>
                  <p>the officer informs the person that <role refersTo="#minister">the Minister</role> has ordered the surrender of the person’s foreign travel documents and that the officer is authorised to make the demand; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-16__subsec-5__para-c">
                <num>c</num>
                <content>
                  <p>the officer informs the person that it may be an offence not to comply with the demand; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-16__subsec-5__para-d">
                <num>d</num>
                <content>
                  <p>the person has possession or control of one or more of the person’s foreign travel documents; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-16__subsec-5__para-e">
                <num>e</num>
                <content>
                  <p>the person fails to surrender those documents to the officer immediately.</p>
                </content>
                <hcontainer name="penalty">
                  <content>
                    <p>Penalty:	<quantity refersTo="#custodialSentence">Imprisonment for 1 year</quantity> or <quantity refersTo="#penaltyUnit">20 penalty units</quantity>, or both.</p>
                  </content>
                </hcontainer>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-2__sec-16__subsec-6">
              <num>6</num>
              <content>
                <p>A foreign travel document obtained by an enforcement officer under this section may be retained for so long as there is a competent authority who:</p>
              </content>
              <paragraph eId="part-2__dvs-2__sec-16__subsec-6__para-a">
                <num>a</num>
                <content>
                  <p>believes on reasonable grounds that a circumstance mentioned in <ref href="#sec-13">section 13</ref> or 14 applies in relation to the person; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-16__subsec-6__para-b">
                <num>b</num>
                <content>
                  <p>suspects on reasonable grounds that a circumstance mentioned in <ref href="#sec-15">section 15</ref> applies in relation to the person.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-2__sec-16__subsec-7">
              <num>7</num>
              <content>
                <p>Despite subsection (6), a foreign travel document must be returned to the person to whom it was issued if, on review by the Administrative Review Tribunal:</p>
              </content>
              <paragraph eId="part-2__dvs-2__sec-16__subsec-7__para-a">
                <num>a</num>
                <content>
                  <p>the Tribunal sets aside the decision of <role refersTo="#minister">the Minister</role> to order the surrender of the document; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-16__subsec-7__para-b">
                <num>b</num>
                <content>
                  <p>either:</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-16__subsec-7__para-i">
                <num>i</num>
                <content>
                  <p>the Tribunal substitutes a decision not to order the surrender of the document; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-16__subsec-7__para-ii">
                <num>ii</num>
                <content>
                  <p>the Tribunal remits the matter for reconsideration and, on that reconsideration, <role refersTo="#minister">the Minister</role> decides not to order the surrender of the document.</p>
                </content>
              </paragraph>
            </subsection>
          </section>
          <section eId="part-2__dvs-2__sec-16A">
            <num>16A</num>
            <heading>Demand for 28 day surrender of foreign travel document ordered by Minister on request under section 15A</heading>
            <subsection eId="part-2__dvs-2__sec-16A__subsec-1">
              <num>1</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> may, on request under section 15A relating to a person’s foreign travel documents, order the surrender of the documents.</p>
              </content>
            </subsection>
            <subsection eId="part-2__dvs-2__sec-16A__subsec-2">
              <num>2</num>
              <content>
                <p>If <role refersTo="#minister">the Minister</role> has made an order under subsection (1), an enforcement officer may demand that the person surrender to the officer the person’s foreign travel documents.</p>
              </content>
            </subsection>
            <subsection eId="part-2__dvs-2__sec-16A__subsec-3">
              <num>3</num>
              <content>
                <p>If the person does not immediately surrender the person’s foreign travel documents, the officer may:</p>
              </content>
              <paragraph eId="part-2__dvs-2__sec-16A__subsec-3__para-a">
                <num>a</num>
                <content>
                  <p>seize the person’s foreign travel documents; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-16A__subsec-3__para-b">
                <num>b</num>
                <content>
                  <p>seize any foreign travel document of the person that is not in the possession or control of any person.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-2__sec-16A__subsec-4">
              <num>4</num>
              <content>
                <p>Subsection (3) does not authorise an enforcement officer to enter premises that the officer would not otherwise be authorised to enter.</p>
              </content>
            </subsection>
            <subsection eId="part-2__dvs-2__sec-16A__subsec-5">
              <num>5</num>
              <content>
                <p>A person commits an offence if:</p>
              </content>
              <paragraph eId="part-2__dvs-2__sec-16A__subsec-5__para-a">
                <num>a</num>
                <content>
                  <p>an enforcement officer demands under subsection (2) that the person surrender the person’s foreign travel documents; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-16A__subsec-5__para-b">
                <num>b</num>
                <content>
                  <p>the officer informs the person that <role refersTo="#minister">the Minister</role> has ordered the surrender of the person’s foreign travel documents and that the officer is authorised to make the demand; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-16A__subsec-5__para-c">
                <num>c</num>
                <content>
                  <p>the officer informs the person that it may be an offence not to comply with the demand; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-16A__subsec-5__para-d">
                <num>d</num>
                <content>
                  <p>the person has possession or control of one or more of the person’s foreign travel documents; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-16A__subsec-5__para-e">
                <num>e</num>
                <content>
                  <p>the person fails to surrender those documents to the officer immediately.</p>
                </content>
                <hcontainer name="penalty">
                  <content>
                    <p>Penalty:	<quantity refersTo="#custodialSentence">Imprisonment for 6 months</quantity> or <quantity refersTo="#penaltyUnit">10 penalty units</quantity>, or both.</p>
                  </content>
                </hcontainer>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-2__sec-16A__subsec-6">
              <num>6</num>
              <content>
                <p>A foreign travel document obtained by an enforcement officer under this section must be returned, to the person to whom it was issued, 28 days after <role refersTo="#minister">the Minister</role> made the order under subsection (1) relating to the document.</p>
              </content>
            </subsection>
            <subsection eId="part-2__dvs-2__sec-16A__subsec-7">
              <num>7</num>
              <content>
                <p>However, subsection (6) does not apply if, within the 28 days described in that subsection, <role refersTo="#minister">the Minister</role> makes an order under subsection 16(1). In that case, subsections 16(6) and (7) apply in relation to the foreign travel document as if it had been obtained by an enforcement officer under section 16.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-2__dvs-2__sec-17">
            <num>17</num>
            <heading>Demand for suspicious foreign travel document</heading>
            <subsection eId="part-2__dvs-2__sec-17__subsec-1">
              <num>1</num>
              <content>
                <p>An enforcement officer may demand that a person surrender to the officer:</p>
              </content>
              <paragraph eId="part-2__dvs-2__sec-17__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>a foreign travel document that has been obtained, or that the officer suspects on reasonable grounds has been obtained, by means of a false or misleading statement, false or misleading information or a false or misleading document; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-17__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>a foreign travel document or other document that has been used, or that the officer suspects on reasonable grounds has been used, in the commission of an offence against this Act.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-2__sec-17__subsec-2">
              <num>2</num>
              <content>
                <p>A person commits an offence if:</p>
              </content>
              <paragraph eId="part-2__dvs-2__sec-17__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>an enforcement officer demands under subsection (1) that the person surrender a document; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-17__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>the officer informs the person that the officer is authorised to demand that document; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-17__subsec-2__para-c">
                <num>c</num>
                <content>
                  <p>the officer informs the person that it may be an offence not to comply with the demand; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-17__subsec-2__para-d">
                <num>d</num>
                <content>
                  <p>the person has possession or control of the document; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-17__subsec-2__para-e">
                <num>e</num>
                <content>
                  <p>the person fails to surrender the document to the officer immediately.</p>
                </content>
                <hcontainer name="penalty">

                <p>A document surrendered to an enforcement officer under this section may be retained for so long as there is an enforcement officer who suspects on reasonable grounds:</p>
              </content>
              <paragraph eId="part-2__dvs-2__sec-17__subsec-3__para-a">
                <num>a</num>
                <content>
                  <p>that the document was obtained by means of a false or misleading statement, false or misleading information or a false or misleading document; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-17__subsec-3__para-b">
                <num>b</num>
                <content>
                  <p>that the document has been used in the commission of an offence against this Act.</p>
                </content>
              </paragraph>
            </subsection>
          </section>

        <heading>Offences relating to foreign travel documents</heading>
        <section eId="part-3__sec-18">
          <num>18</num>
          <heading>Making false or misleading statements in relation to foreign travel document applications</heading>
          <subsection eId="part-3__sec-18__subsec-1">
            <num>1</num>
            <content>
              <p>A person commits an offence if:</p>
            </content>
            <paragraph eId="part-3__sec-18__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>the person makes a statement (whether orally, in writing or any other way) to another person; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-18__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>the statement:</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-18__subsec-1__para-i">
              <num>i</num>
              <content>
                <p>is false or misleading; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-18__subsec-1__para-ii">
              <num>ii</num>
              <content>
                <p>omits any matter or thing without which the statement is misleading; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-18__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>the statement is made in, or in connection with, an application for a foreign travel document.</p>
              </content>
              <hcontainer name="penalty">
                <content>
                  <p>Penalty:	<quantity refersTo="#custodialSentence">Imprisonment for 10 years</quantity> or <quantity refersTo="#penaltyUnit">1,000 penalty units</quantity>, or both.</p>

            <content>
              <p>Subsection (1) does not apply:</p>
            </content>
            <paragraph eId="part-3__sec-18__subsec-2__para-a">
              <num>a</num>
              <content>

                <p>the person does so with the intention that the false foreign travel document may be used, acted on or accepted as if it were a passport or document of identity issued by or on behalf of the government of a foreign country.</p>

                <p>that purports to be a passport issued by or on behalf of the government of a foreign country but that was not issued by or on behalf of that government; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-22__subsec-4__para-ii">
              <num>ii</num>
              <content>
                <p>that purports to be a document of identity issued for travel purposes by or on behalf of the government of a foreign country for the purposes of travel but that was not issued by or on behalf of that government; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-22__subsec-4__para-b">
              <num>b</num>
              <content>
                <p>includes a foreign travel document that has been altered by a person who is not authorised to alter that foreign travel document.</p>
              </content>
              <content>
                <p><b><i>make</i></b>, in relation to a false foreign travel document, includes alter a document so as to make it a false document (whether or not it was already a false document before the alteration).</p>
              </content>

        <heading>Miscellaneous</heading>

          <num>23</num>
          <heading>Administrative review</heading>
          <subsection eId="part-4__sec-23__subsec-1">
            <num>1</num>
            <content>
              <p>Application may be made to the Administrative Review Tribunal for review of a decision by <role refersTo="#minister">the Minister</role> under section 16 (other than subsection 16(1A)) to order the surrender of a person’s foreign travel documents.</p>
            </content>
          </subsection>
          <subsection eId="part-4__sec-23__subsec-2">
            <num>2</num>
            <content>
              <p>	(2)	For the purposes of <i>Administrative Review Tribunal Act 2024</i>, the only person whose interests are taken to be affected by the decision is the person whose foreign travel documents are ordered to be surrendered.<ref href="#sec-17">section 17</ref> of the </p>

            <num>3</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> may, if <role refersTo="#minister">the Minister</role> makes a decision in response to a request under section 15, certify that the decision involved matters of international relations or criminal intelligence.</p>

            <num>4</num>

              <p>	(4)	Despite <i> Administrative Review Tribunal Act 2024</i>, if the Minister has given a certificate under subsection (3) in relation to a decision, then in any review of that decision the Administrative Review Tribunal may only make a decision:<ref href="#sec-105">section 105</ref> of the</p>

              <p><role refersTo="#minister">The Minister</role> may delegate to an SES employee <role refersTo="#minister">the Minister</role>’s power to make an order under subsection 16(1) or (1A) in response to a request made under section 13.</p>
