        <heading>Short title</heading>
        <content>
          <p>		This Act may be cited as the <i>Immigration (Guardianship of Children) Act 1946</i>.</p>
        </content>
      </section>
      <section eId="sec-2">
        <num>2</num>
        <heading>Commencement</heading>
        <content>
          <p>This Act shall come into operation on a date to be fixed by Proclamation.</p>
        </content>
      </section>
      <section eId="sec-3">
        <num>3</num>
        <heading>Application of the Criminal Code</heading>
        <content>
          <p>		Chapter 2 of the <i>Criminal Code</i> applies to all offences against this Act.</p>
        </content>

        <num>4</num>
        <heading>Definitions</heading>
        <content>
          <p>In this Act, unless the contrary intention appears:</p>
          <p><b><i>Australia</i></b>, when used in a geographical sense,<b><i> </i></b>includes Norfolk Island, the Territory of Cocos (Keeling) Islands and the Territory of Christmas Island.</p>
          <p><term refersTo="#term-custodian">custodian</term> means <def>a person who, by or under this Act, is the custodian of a non-citizen child.</def></p>
          <p><term refersTo="#term-declared-state-or-territory">declared State or Territory</term> means <def>a State or Territory in respect of which a declaration under <ref href="#sec-4A">section 4A</ref>AB is in force.</def></p>
          <p><term refersTo="#term-intending-adoptive-parent">intending adoptive parent</term> means <def>a person who intends to: adopt the child under the laws in force in a declared State or Territory; or secure the recognition, under the laws in force in a declared State or Territory, of an adoption of the child by the person under the laws of a foreign country.</def></p>

        <paragraph eId="sec-4__para-a">
          <num>a</num>
          <content>
            <p>adopt the child under the laws in force in a declared State or Territory; or</p>
          </content>
        </paragraph>
        <paragraph eId="sec-4__para-b">
          <num>b</num>
          <content>
            <p>secure the recognition, under the laws in force in a declared State or Territory, of an adoption of the child by the person under the laws of a foreign country.</p>
          </content>
          <content>
            <p><term refersTo="#term-migration-law">migration law</term> means <def>any of the following: 	(a)	the <i>Migration Act 1958</i>; regulations made under that Act; any instrument made under that Act or those regulations.</def></p>
          </content>
        </paragraph>
        <paragraph eId="sec-4__para-a">
          <num>a</num>
          <content>
            <p>	(a)	the <i>Migration Act 1958</i>;</p>
          </content>
        </paragraph>
        <paragraph eId="sec-4__para-b">
          <num>b</num>
          <content>
            <p>regulations made under that Act;</p>
          </content>
        </paragraph>
        <paragraph eId="sec-4__para-c">
          <num>c</num>
          <content>
            <p>any instrument made under that Act or those regulations.</p>
          </content>
          <content>
            <p><term refersTo="#term-non-citizen">non-citizen</term> means <def>a person who is not an Australian citizen.</def></p>
            <p><term refersTo="#term-non-citizen-child">non-citizen child</term> means <def>a person who is a non-citizen child under subsection 4AAA(1) or (4).</def></p>
            <p><b><i>parent</i></b>: without limiting who is a parent of anyone for the purposes of this Act, a person is the <b><i>parent</i></b> of another person if the other person is a child of the person within the meaning of the <i>Family Law Act 1975</i>.</p>
            <p><term refersTo="#term-prescribed-adoption-class-visa">prescribed adoption class visa</term> means <def>a visa under <ref href="">the Migration Act 1958</ref> that is declared by the regulations to be an adoption class visa for the purposes of this Act.</def></p>
            <p><term refersTo="#term-regional-processing-country">regional processing country</term> has the same meaning as <def>in <ref href="">the Migration Act 1958</ref>.</def></p>
            <p><b><i>relative</i></b> of a person includes:</p>
          </content>
        </paragraph>
        <paragraph eId="sec-4__para-a">
          <num>a</num>
          <content>
            <p>a parent of the person; and</p>
          </content>
        </paragraph>
        <paragraph eId="sec-4__para-b">
          <num>b</num>
          <content>
            <p>	(b)	anyone who is a step-parent of the person or would be except that he or she is not legally married to his or her de facto partner (within the meaning of the <i>Acts Interpretation Act 1901</i>); and</p>
          </content>
        </paragraph>
        <paragraph eId="sec-4__para-c">
          <num>c</num>
          <content>
            <p>anyone else who would be a relative of the person if someone mentioned in paragraph (a) or (b) were a relative of the person.</p>
          </content>
        </paragraph>
      </section>
      <section eId="sec-4AAA">
        <num>4AAA</num>
        <heading>Non-citizen child</heading>
        <subsection eId="sec-4AAA__subsec-1">
          <num>1</num>
          <content>
            <p>	(1)	Subject to subsections (2) and (3), a person (the <b><i>child</i></b>) is a non-citizen child if the child:</p>
          </content>
          <paragraph eId="sec-4AAA__subsec-1__para-a">
            <num>a</num>
            <content>
              <p>has not turned 18; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-4AAA__subsec-1__para-b">
            <num>b</num>
            <content>
              <p>enters Australia as a non-citizen; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-4AAA__subsec-1__para-c">
            <num>c</num>
            <content>
              <p>intends, or is intended, to become a permanent resident of Australia.</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-4AAA__subsec-2">
          <num>2</num>
          <content>
            <p>Subsection (1) does not apply if the child enters Australia in the charge of, or for the purposes of living in Australia under the care of:</p>
          </content>
          <paragraph eId="sec-4AAA__subsec-2__para-a">
            <num>a</num>
            <content>
              <p>a parent of the child; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-4AAA__subsec-2__para-b">
            <num>b</num>
            <content>
              <p>a relative of the child who has turned 21; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-4AAA__subsec-2__para-c">
            <num>c</num>
            <content>
              <p>an intending adoptive parent of the child.</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-4AAA__subsec-3">
          <num>3</num>
          <content>
            <p>Subsection (1) does not apply if:</p>
          </content>
          <paragraph eId="sec-4AAA__subsec-3__para-a">
            <num>a</num>
            <content>
              <p>	(a)	the child enters Australia in the charge of, or for the purposes of living in Australia under the care of, a person who is not less than 21 years of age (the <b><i>adult</i></b>); and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-4AAA__subsec-3__para-b">
            <num>b</num>
            <content>
              <p>a prescribed adoption class visa is in force in relation to the child when the child enters Australia; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-4AAA__subsec-3__para-c">
            <num>c</num>
            <content>
              <p>the adult intends to reside with the child in a declared State or Territory.</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-4AAA__subsec-4">
          <num>4</num>
          <content>
            <p>A person is a non-citizen child if:</p>
          </content>
          <paragraph eId="sec-4AAA__subsec-4__para-a">
            <num>a</num>
            <content>

        <heading>Declared States and Territories</heading>
        <subsection eId="sec-4AAB__subsec-1">
          <num>1</num>
          <content>
            <p><role refersTo="#minister">The Minister</role> may declare a State or Territory to be a declared State or Territory for the purposes of this Act.</p>
          </content>
        </subsection>
        <subsection eId="sec-4AAB__subsec-2">
          <num>2</num>
          <content>
            <p>A declaration under subsection (1) is to be:</p>
          </content>
          <paragraph eId="sec-4AAB__subsec-2__para-a">
            <num>a</num>
            <content>
              <p>made in writing; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-4AAB__subsec-2__para-b">
            <num>b</num>
            <content>
              <p>	(b)	published in the <i>Gazette</i>.</p>
            </content>
          </paragraph>
        </subsection>
      </section>
      <section eId="sec-4AAC">
        <num>4AAC</num>
        <heading>Norfolk Island</heading>
        <content>
          <p>This Act extends to Norfolk Island.</p>
        </content>
      </section>
      <section eId="sec-4AA">
        <num>4AA</num>
        <heading>Orders for guardianship of certain children</heading>
        <subsection eId="sec-4AA__subsec-1">
          <num>1</num>
          <content>
            <p>Subject to subsection (2), where:</p>
          </content>
          <paragraph eId="sec-4AA__subsec-1__para-a">
            <num>a</num>
            <content>
              <p>a person under the age of 18 years enters Australia as a non-citizen in the charge of, or for the purpose of living in Australia under the care of, a relative of the person (other than a parent) not less than 21 years of age; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-4AA__subsec-1__para-b">
            <num>b</num>
            <content>
              <p>the person intends to become, or is intended to become, a permanent resident of Australia;</p>
            </content>
            <content>
              <p><role refersTo="#minister">the Minister</role> may, if <role refersTo="#minister">the Minister</role> is satisfied that it is necessary in the interests of the person to do so, direct, in writing, that the person shall be <role refersTo="#minister">the Minister</role>’s ward.</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-4AA__subsec-2">
          <num>2</num>
          <content>
            <p><role refersTo="#minister">The Minister</role> shall not give a direction under subsection (1) unless the relative consents to <role refersTo="#minister">the Minister</role> doing so.</p>
          </content>
        </subsection>
      </section>
      <section eId="sec-4A">
        <num>4A</num>
        <heading>Evidence</heading>
        <content>
          <p>For the purposes of this Act (including proceedings arising under this Act or in which a question arises as to the application of this Act to a person), a certificate in writing by a prescribed officer of the Commonwealth or of a State or Territory that a person named in the certificate is a non-citizen child, or was, at a date specified in the certificate, a non-citizen child, is prima facie evidence of the fact so certified.</p>
        </content>
      </section>
      <section eId="sec-5">
        <num>5</num>
        <heading>Delegation</heading>
        <subsection eId="sec-5__subsec-1">
          <num>1</num>
          <content>
            <p><role refersTo="#minister">The Minister</role> may, in relation to any matters or class of matters, or in relation to any non-citizen child or class of non-citizen children, by writing under his or her hand, delegate to any officer or authority of the Commonwealth or of any State or Territory all or any of his or her powers and functions under this Act (except this power of delegation) so that the delegated powers and functions may be exercised by the delegate with respect to the matters or class of matters, or the child or class of children, specified in the instrument of delegation.</p>
          </content>
        </subsection>
        <subsection eId="sec-5__subsec-2">
          <num>2</num>
          <content>
            <p>Where under this Act the exercise of any power or function by <role refersTo="#minister">the Minister</role> or the operation of any provision of this Act is dependent upon the opinion or state of mind of <role refersTo="#minister">the Minister</role> in relation to any matter, that power or function may be exercised by the delegate or that provision may operate (as the case may be) upon the opinion or state of mind of the delegate in relation to that matter.</p>
          </content>
        </subsection>
        <subsection eId="sec-5__subsec-3">
          <num>3</num>
          <content>
            <p>A delegation under this section shall be revocable at will, and no delegation shall prevent the exercise of any power or function by <role refersTo="#minister">the Minister</role>.</p>
          </content>
        </subsection>
      </section>
      <section eId="sec-6">
        <num>6</num>
        <heading>Guardianship of non-citizen children</heading>
        <subsection eId="sec-6__subsec-1">
          <num>1</num>
          <content>
            <p><role refersTo="#minister">The Minister</role> shall be the guardian of the person, and of the estate in Australia, of every non-citizen child who arrives in Australia after the commencement of this Act to the exclusion of the parents and every other guardian of the child, and shall have, as guardian, the same rights, powers, duties, obligations and liabilities as a natural guardian of the child would have, until the child reaches the age of 18 years or leaves Australia permanently, or until the provisions of this Act cease to apply to and in relation to the child, whichever first happens.</p>
          </content>
        </subsection>
        <subsection eId="sec-6__subsec-2">
          <num>2</num>
          <content>
            <p>	(2)	Without limiting the meaning of the expression <b><i>leaves Australia permanently</i></b> in subsection (1), a non-citizen child <b><i>leaves Australia permanently </i></b>if:</p>
          </content>
          <paragraph eId="sec-6__subsec-2__para-a">
            <num>a</num>
            <content>
              <p>	(a)	the child is removed from Australia under <i>Migration Act 1958</i>; or<ref href="#sec-198">section 198</ref> or 199 of the </p>
            </content>
          </paragraph>
          <paragraph eId="sec-6__subsec-2__para-b">
            <num>b</num>
            <content>
              <p>the child is taken from Australia to a regional processing country under <ref href="#sec-198A">section 198A</ref>D of that Act; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-6__subsec-2__para-c">
            <num>c</num>
            <content>
              <p>the child is deported under <ref href="#sec-200">section 200</ref> of that Act; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-6__subsec-2__para-d">
            <num>d</num>
            <content>
              <p>	(d)	the child is taken to a place outside Australia under paragraph 245F(9)(b) of that Act, or under <i>Maritime Powers Act 2013</i>.<ref href="#dvs-7">Division 7</ref> or 8 of Part 3 of the </p>
            </content>
          </paragraph>
        </subsection>
      </section>
      <section eId="sec-6A">
        <num>6A</num>
        <heading>Non-citizen child not to leave Australia without consent</heading>
        <subsection eId="sec-6A__subsec-1">
          <num>1</num>
          <content>
            <p>A non-citizen child shall not leave Australia except with the consent in writing of <role refersTo="#minister">the Minister</role>.</p>
          </content>
        </subsection>
        <subsection eId="sec-6A__subsec-2">
          <num>2</num>
          <content>
            <p><role refersTo="#minister">The Minister</role> shall not refuse to grant any such consent unless he or she is satisfied that the granting of the consent would be prejudicial to the interests of the non-citizen child.</p>
          </content>
        </subsection>
        <subsection eId="sec-6A__subsec-3">
          <num>3</num>
          <content>
            <p>A person shall not aid, abet, counsel or procure a non-citizen child to leave Australia contrary to the provisions of this section.</p>
          </content>
          <hcontainer name="penalty">
            <content>
              <p>Penalty for a contravention of this subsection:	<quantity refersTo="#custodialSentence">Imprisonment for 6 months</quantity> or <quantity refersTo="#penaltyUnit">2 penalty units</quantity>.</p>
            </content>
          </hcontainer>
        </subsection>
      </section>
      <section eId="sec-7">
        <num>7</num>
        <heading>Custody of non-citizen children</heading>
        <subsection eId="sec-7__subsec-1">
          <num>1</num>
          <content>
            <p><role refersTo="#minister">The Minister</role> may place a non-citizen child in the custody of a person who:</p>
          </content>
          <paragraph eId="sec-7__subsec-1__para-a">
            <num>a</num>
            <content>
              <p>is willing to be the custodian of that child; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-7__subsec-1__para-b">
            <num>b</num>
            <content>
              <p>is, in the opinion of <role refersTo="#minister">the Minister</role>, a suitable person to be the custodian of that child;</p>
            </content>
            <content>
              <p>and that person shall thereupon become the custodian of that child.</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-7__subsec-2">
          <num>2</num>
          <content>
            <p><role refersTo="#minister">The Minister</role> may, at any time, if he or she considers it necessary so to do in the interests of a non-citizen child, remove the child from the custody of his or her custodian and place the child in the custody of some other person, who shall thereupon be the custodian of that child.</p>
          </content>
        </subsection>
      </section>
      <section eId="sec-8">
        <num>8</num>
        <heading>Operation of other laws</heading>
        <subsection eId="sec-8__subsec-1">
          <num>1</num>
          <content>
            <p>Except as prescribed, nothing in this Act shall affect the operation in relation to non-citizen children of any provision of the laws of any State or Territory relating to child welfare.</p>
          </content>
        </subsection>
        <subsection eId="sec-8__subsec-2">
          <num>2</num>
          <content>
            <p>Nothing in this Act:</p>
          </content>
          <paragraph eId="sec-8__subsec-2__para-a">
            <num>a</num>
            <content>
              <p>affects the operation of the migration law; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-8__subsec-2__para-b">
            <num>b</num>
            <content>
              <p>	(b)	affects the performance or exercise, or the purported performance or exercise, of any function, duty or power under the migration law or the <i>Maritime Powers Act 2013</i>; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-8__subsec-2__para-c">
            <num>c</num>
            <content>
              <p>	(c)	imposes any obligation on the Minister or another Minister to exercise, or to consider exercising, any power conferred by or under the migration law or the <i>Maritime Powers Act 2013</i>.</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-8__subsec-3">
          <num>3</num>
          <content>
            <p>Without limiting subsection (2), nothing in this Act affects the performance or exercise, or the purported performance or exercise, of any function, duty or power relating to:</p>
          </content>
          <paragraph eId="sec-8__subsec-3__para-a">
            <num>a</num>
            <content>
              <p>	(a)	the removal of a non-citizen child from Australia under <i>Migration Act 1958</i>; or<ref href="#sec-198">section 198</ref> or 199 of the </p>
            </content>
          </paragraph>
          <paragraph eId="sec-8__subsec-3__para-b">
            <num>b</num>
            <content>
              <p>the taking of a non-citizen child from Australia to a regional processing country under <ref href="#sec-198A">section 198A</ref>D of that Act; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-8__subsec-3__para-c">
            <num>c</num>
            <content>
              <p>the deportation of a non-citizen child under <ref href="#sec-200">section 200</ref> of that Act; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-8__subsec-3__para-d">
            <num>d</num>
            <content>
              <p>	(d)	the taking of a non-citizen child to a place outside Australia under paragraph 245F(9)(b) of that Act, or under <i>Maritime Powers Act 2013</i>.<ref href="#dvs-7">Division 7</ref> or 8 of Part 3 of the </p>
            </content>
          </paragraph>
        </subsection>
      </section>
      <section eId="sec-9">
        <num>9</num>
        <heading>Offences in respect of non-citizen child</heading>
        <content>
          <p>A person shall not, without lawful excuse (proof whereof shall lie upon him or her):</p>
        </content>
        <paragraph eId="sec-9__para-a">
          <num>a</num>
          <content>
            <p>remove any non-citizen child, or counsel or cause any non-citizen child to be withdrawn or to abscond, from the custody of his or her custodian; or</p>
          </content>
        </paragraph>
        <paragraph eId="sec-9__para-b">
          <num>b</num>
          <content>
            <p>knowing any non-citizen child to have been so removed or withdrawn or to have so absconded, harbour or conceal the child or prevent him or her from returning to his or her custodian.</p>
          </content>
          <hcontainer name="penalty">
            <content>
              <p>Penalty:	<quantity refersTo="#custodialSentence">Imprisonment for 6 months</quantity> or <quantity refersTo="#penaltyUnit">2 penalty units</quantity>.</p>
            </content>
          </hcontainer>
        </paragraph>
      </section>
      <section eId="sec-10">
        <num>10</num>
        <heading>False statements in applications</heading>
        <content>
          <p>		For the purposes of <i>Criminal Code</i>, an application made for the purposes of this Act is taken to be an application for a benefit.<ref href="#sec-136">section 136</ref>.1 of the </p>
        </content>
      </section>
      <section eId="sec-11">
        <num>11</num>
        <heading>Exemption of children from Act</heading>
        <content>
          <p><role refersTo="#minister">The Minister</role> may, by order in writing under his or her hand, direct that the provisions of this Act shall not apply in respect of a child specified in the order, or a child included in a class of children so specified, and, while the order is in force, the provisions of this Act do not apply to or in relation to that child or to a child included in that class of children.</p>
        </content>
      </section>
      <section eId="sec-11A">
        <num>11A</num>
        <heading>Reconsideration and review of certain decisions</heading>
        <subsection eId="sec-11A__subsec-1">
          <num>1</num>
          <content>
            <p>In this section, unless the contrary intention appears:</p>
          </content>
          <content>
            <p><b><i>decision</i></b> has the same meaning as in the <i>Administrative Review Tribunal Act 2024</i>.</p>
            <p><b><i>relevant decision</i></b> means a decision of a delegate of the Minister under section 4AA or 11.</p>
            <p><b><i>reviewable decision</i></b> means:</p>
          </content>
          <paragraph eId="sec-11A__subsec-1__para-a">
            <num>a</num>
            <content>
              <p>a decision of <role refersTo="#minister">the Minister</role> under section 4AA or 11; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-11A__subsec-1__para-b">
            <num>b</num>
            <content>
              <p>a decision of <role refersTo="#minister">the Minister</role> under subparagraph (3)(a)(ii) or subsection (4).</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-11A__subsec-2">
          <num>2</num>
          <content>
            <p>Subject to subsection (3), a person affected by a relevant decision may request <role refersTo="#minister">the Minister</role> to reconsider the decision.</p>
          </content>
        </subsection>
        <subsection eId="sec-11A__subsec-3">
          <num>3</num>
          <content>
            <p>The request shall:</p>
          </content>
          <paragraph eId="sec-11A__subsec-3__para-a">
            <num>a</num>
            <content>
              <p>be made by notice in writing given to <role refersTo="#minister">the Minister</role> within:</p>
            </content>
          </paragraph>
          <paragraph eId="sec-11A__subsec-3__para-i">
            <num>i</num>
            <content>
              <p>the period of 28 days after the decision first comes to the notice of the person; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-11A__subsec-3__para-ii">
            <num>ii</num>
            <content>
              <p>such further period as <role refersTo="#minister">the Minister</role> (whether before or after the expiration of that period of 28 days), by notice in writing served on the person, allows; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-11A__subsec-3__para-b">
            <num>b</num>
            <content>
              <p>shall set out the reasons for making the request.</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-11A__subsec-4">
          <num>4</num>
          <content>
            <p>The Minister shall, <quantity refersTo="#deadline">within 45 days</quantity> after receipt of the request, reconsider the relevant decision and may:</p>
          </content>
          <paragraph eId="sec-11A__subsec-4__para-a">
            <num>a</num>
            <content>
              <p>confirm the decision;</p>
            </content>
          </paragraph>
          <paragraph eId="sec-11A__subsec-4__para-b">
            <num>b</num>
            <content>
              <p>vary the decision; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-11A__subsec-4__para-c">
            <num>c</num>
            <content>
              <p>set the decision aside and make a new decision in substitution for the decision set aside.</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-11A__subsec-5">
          <num>5</num>
          <content>
            <p>Where, pursuant to a request under subsection (2), <role refersTo="#minister">the Minister</role> reconsiders a relevant decision, <role refersTo="#minister">the Minister</role> shall, by notice in writing served on the person who made the request, inform the person of the result of the reconsideration.</p>
          </content>
        </subsection>
        <subsection eId="sec-11A__subsec-6">
          <num>6</num>
          <content>
            <p>Applications may be made to the Administrative Review Tribunal for review of reviewable decisions.</p>
          </content>

        <num>12</num>
        <heading>Regulations</heading>
        <content>
          <p>The Governor-General may make regulations, not inconsistent with this Act, prescribing all matters which by this Act are required or permitted to be prescribed or which are necessary or convenient to be prescribed for carrying out or giving effect to this Act, and in particular for:</p>

        <paragraph eId="sec-12__para-aa">
          <num>aa</num>
          <content>
            <p>prescribing principles to be observed in considering whether or not to give a direction under <ref href="#sec-4A">section 4A</ref>A;</p>
          </content>
        </paragraph>
        <paragraph eId="sec-12__para-a">
          <num>a</num>
          <content>
            <p>prescribing the principles to be observed in relation to the placing of non-citizen children with custodians;</p>
          </content>
        </paragraph>
        <paragraph eId="sec-12__para-b">
          <num>b</num>
          <content>
            <p>regulating the placing of such children with custodians and the transfer of such children from one custodian to another;</p>
          </content>
        </paragraph>
        <paragraph eId="sec-12__para-c">
          <num>c</num>
          <content>
            <p>prescribing provisions to be observed by custodians in relation to the custody, control, welfare, care, education, training and employment of non-citizen children;</p>
          </content>
        </paragraph>
        <paragraph eId="sec-12__para-d">
          <num>d</num>
          <content>
            <p>providing that any provision of the laws of any State or Territory relating to child welfare shall not apply in relation to non-citizen children, and making provision in lieu of any such provision;</p>
          </content>
        </paragraph>
        <paragraph eId="sec-12__para-da">
          <num>da</num>
          <content>
            <p>prescribing powers, rights, duties and liabilities of or in relation to <role refersTo="#minister">the Minister</role> as guardian of the estate in Australia of non-citizen children, including provisions for the receipt, disposition, management and control of property of non-citizen children, and of property of deceased non-citizen children from their deaths until the grant of administration;</p>
          </content>
        </paragraph>
        <paragraph eId="sec-12__para-db">
          <num>db</num>
          <content>
            <p>making provision for preventing non-citizen children from leaving Australia without the consent in writing of <role refersTo="#minister">the Minister</role>; and</p>
          </content>
        </paragraph>
        <paragraph eId="sec-12__para-f">
          <num>f</num>
          <content>
            <p>prescribing penalties not exceeding <quantity refersTo="#penaltyUnit">1 penalty unit</quantity>, for any offence against the regulations.</p>
