        <heading>Short title</heading>
        <content>
          <p>		This Act is the <i>Statutory Declarations Act 1959</i>.</p>
        </content>
      </section>
      <section eId="sec-3">
        <num>3</num>
        <heading>Saving</heading>
        <content>
          <p><i>	</i>	A statutory declaration purporting to be made, after the commencement of this Act, by virtue of the <i>Statutory Declarations Act 1911</i>, or by virtue of that Act as amended, has the same force and effect, and entails the same consequences, as if it had been expressed to be made by virtue of this Act.</p>

        <num>4</num>
        <heading>Interpretation</heading>
        <content>
          <p>In this Act, unless the contrary intention appears:</p>
          <p><term refersTo="#term-approved-form">approved form</term> means <def>a form approved under <ref href="#sec-15">section 15</ref>.</def></p>
          <p><term refersTo="#term-approved-identity-service">approved identity service</term> has the meaning given by <def>subsection 9A(3).</def></p>
          <p><term refersTo="#term-approved-online-platform">approved online platform</term> has the meaning given by <def>subsection 9A(2).</def></p>
          <p><term refersTo="#term-declarant">declarant</term> means <def>the person who is making the declaration.</def></p>
          <p><term refersTo="#term-magistrate">Magistrate</term> means <def>a Chief, Police, Stipendiary, Resident or Special Magistrate.</def></p>
          <p><term refersTo="#term-prescribed-person">prescribed person</term> means <def>a person prescribed by the regulations to be a prescribed person.</def></p>
          <p><term refersTo="#term-state">State</term> includes <def>the Northern Territory.</def></p>
          <p><b><i>Territory</i></b> does not include the Northern Territory.</p>
          <p><term refersTo="#term-video-link">video link</term> means <def>facilities that enable audio and visual communication between persons in different places.</def></p>

      <section eId="sec-5">
        <num>5</num>
        <heading>Application</heading>
        <subsection eId="sec-5__subsec-1">
          <num>1</num>
          <content>
            <p>Subject to this section, this Act applies both within and without the Commonwealth.</p>
          </content>
        </subsection>
        <subsection eId="sec-5__subsec-2">
          <num>2</num>
          <content>
            <p>Except as provided by subsection 12(8), this Act does not apply in a Territory not forming part of the Commonwealth unless this Act extends to that Territory by virtue of <ref href="#sec-13">section 13</ref>.</p>

        <num>5A</num>
        <heading>Application of the Criminal Code</heading>
        <content>
          <p>		Chapter 2 of the <i>Criminal Code</i> applies to all offences against this Act.</p>
        </content>

        <num>6</num>
        <heading>Authority to make and use statutory declarations</heading>
        <subsection eId="sec-6__subsec-1">
          <num>1</num>
          <content>
            <p>A person may, if the person so desires, make a statutory declaration in relation to any matter.</p>
          </content>
        </subsection>
        <subsection eId="sec-6__subsec-2">
          <num>2</num>
          <content>
            <p>Subject to subsection (3), a statutory declaration may be used:</p>
          </content>
          <paragraph eId="sec-6__subsec-2__para-a">
            <num>a</num>
            <content>
              <p>for the purposes of a law of the Commonwealth or of a Territory, unless the contrary intention appears in that law;</p>
            </content>
          </paragraph>
          <paragraph eId="sec-6__subsec-2__para-b">
            <num>b</num>
            <content>
              <p>in connection with any matter arising under a law of the Commonwealth or of a Territory, unless the contrary intention appears in that law; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-6__subsec-2__para-c">
            <num>c</num>
            <content>
              <p>in connection with the administration of any Department of State of the Commonwealth.</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-6__subsec-3">
          <num>3</num>
          <content>
            <p>Subsection (2) does not authorise a statutory declaration to be used as evidence in a judicial proceeding but nothing in this section prevents a statutory declaration from being so used.</p>
          </content>
        </subsection>
      </section>
      <section eId="sec-7">
        <num>7</num>
        <heading>References to statutory declarations</heading>
        <content>
          <p>Where, in a law of the Commonwealth or of a Territory (whether passed or made before or after the commencement of this Act), a reference is made to a statutory declaration, the reference includes a reference to a statutory declaration made under this Act, unless the contrary intention appears in that law.</p>
        </content>
      </section>
      <section eId="sec-7A">
        <num>7A</num>
        <heading>Technology neutral signing</heading>
        <subsection eId="sec-7A__subsec-1">
          <num>1</num>
          <content>
            <p>For the purposes of this Act, a person may sign a statutory declaration by signing:</p>
          </content>
          <paragraph eId="sec-7A__subsec-1__para-a">
            <num>a</num>
            <content>
              <p>a physical form of the declaration by hand; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-7A__subsec-1__para-b">
            <num>b</num>
            <content>
              <p>an electronic form of the declaration using electronic means;</p>
            </content>
            <content>
              <p>if the method of signing satisfies subsection (2).</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-7A__subsec-2">
          <num>2</num>
          <content>
            <p>A method of signing satisfies this subsection if:</p>
          </content>
          <paragraph eId="sec-7A__subsec-2__para-a">
            <num>a</num>
            <content>
              <p>the method identifies the person and indicates the person’s intention in respect of the information recorded in the declaration; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-7A__subsec-2__para-b">
            <num>b</num>
            <content>
              <p>the method was either:</p>
            </content>
          </paragraph>
          <paragraph eId="sec-7A__subsec-2__para-i">
            <num>i</num>
            <content>
              <p>as reliable as appropriate for the purpose for which the information was recorded, in light of all the circumstances, including any relevant agreement; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-7A__subsec-2__para-ii">
            <num>ii</num>
            <content>
              <p>proven in fact to have fulfilled the functions described in paragraph (a), by itself or together with further evidence.</p>
            </content>
          </paragraph>
        </subsection>
      </section>
      <section eId="sec-8">
        <num>8</num>
        <heading>How statutory declarations are made</heading>
        <content>
          <p>A statutory declaration made under this Act must satisfy the requirements of either:</p>
        </content>
        <paragraph eId="sec-8__para-a">
          <num>a</num>
          <content>
            <p><ref href="#sec-9">section 9</ref> (observation by prescribed person); or</p>
          </content>
        </paragraph>
        <paragraph eId="sec-8__para-b">
          <num>b</num>
          <content>
            <p><ref href="#sec-9A">section 9A</ref> (digital verification).</p>
          </content>
        </paragraph>
      </section>
      <section eId="sec-9">
        <num>9</num>
        <heading>Statutory declarations—observation by prescribed person</heading>
        <content>
          <p>A statutory declaration satisfies the requirements of this section if:</p>
        </content>
        <paragraph eId="sec-9__para-a">
          <num>a</num>
          <content>
            <p>the declaration is in the approved form; and</p>
          </content>
        </paragraph>
        <paragraph eId="sec-9__para-b">
          <num>b</num>
          <content>
            <p>the declaration is signed by the declarant under the observation of a prescribed person in either of the following cases:</p>
          </content>
        </paragraph>
        <paragraph eId="sec-9__para-i">
          <num>i</num>
          <content>
            <p>in person;</p>
          </content>
        </paragraph>
        <paragraph eId="sec-9__para-ii">
          <num>ii</num>
          <content>
            <p>by video link; and</p>
          </content>
        </paragraph>
        <paragraph eId="sec-9__para-c">
          <num>c</num>
          <content>
            <p>either:</p>
          </content>
        </paragraph>
        <paragraph eId="sec-9__para-i">
          <num>i</num>
          <content>
            <p>in any case—the declaration is signed by the prescribed person; or</p>
          </content>
        </paragraph>
        <paragraph eId="sec-9__para-ii">
          <num>ii</num>
          <content>
            <p>in the case where the prescribed person observes the declarant sign the declaration by video link and is satisfied that a copy of the declaration is a true copy of the declaration signed by the declarant (whether or not the copy includes the declarant’s signature)—that copy is signed by the prescribed person.</p>

        <heading>Statutory declarations—digital verification</heading>
        <subsection eId="sec-9A__subsec-1">
          <num>1</num>
          <content>
            <p>A statutory declaration satisfies the requirements of this section if:</p>
          </content>
          <paragraph eId="sec-9A__subsec-1__para-a">
            <num>a</num>
            <content>
              <p>the declaration:</p>
            </content>
          </paragraph>
          <paragraph eId="sec-9A__subsec-1__para-i">
            <num>i</num>
            <content>
              <p>is in the approved form; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-9A__subsec-1__para-ii">
            <num>ii</num>
            <content>
              <p>is completed and signed by the declarant using an approved online platform; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-9A__subsec-1__para-b">
            <num>b</num>
            <content>
              <p>the identity of the declarant is verified:</p>
            </content>
          </paragraph>
          <paragraph eId="sec-9A__subsec-1__para-i">
            <num>i</num>
            <content>
              <p>using an approved identity service; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-9A__subsec-1__para-ii">
            <num>ii</num>
            <content>
              <p>in accordance with the conditions prescribed by the regulations; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-9A__subsec-1__para-c">
            <num>c</num>
            <content>
              <p>the declaration includes information that:</p>
            </content>
          </paragraph>
          <paragraph eId="sec-9A__subsec-1__para-i">
            <num>i</num>
            <content>
              <p>is provided by the approved online platform; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-9A__subsec-1__para-ii">
            <num>ii</num>
            <content>
              <p>is of a kind prescribed by the regulations.</p>
            </content>

            <p>	(2)	An <b><i>approved online platform</i></b> is a digital service that is prescribed by the regulations to be an approved online platform.</p>
          </content>

            <p>	(3)	An <b><i>approved identity service</i></b> is a digital service that is prescribed by the regulations to be an approved identity service.</p>

        <heading>Special obligations applying to approved online platforms</heading>
        <content>
          <p>Prohibition on retaining copies of statutory declarations</p>
        </content>
        <subsection eId="sec-9B__subsec-1">
          <num>1</num>
          <content>
            <p>The provider of an approved online platform must not retain any copy of a statutory declaration that is made using the online platform.</p>
          </content>
          <content>
            <p>Requirement for annual reporting</p>
          </content>
        </subsection>
        <subsection eId="sec-9B__subsec-2">
          <num>2</num>
          <content>
            <p>After the end of each financial year, the provider of an approved online platform must prepare and give a report to <role refersTo="#minister">the Minister</role>, for presentation to the Parliament, relating to the use of the platform to make statutory declarations during the financial year.</p>

          <content>
            <p>The report must include:</p>
          </content>
          <paragraph eId="sec-9B__subsec-3__para-a">
            <num>a</num>
            <content>
              <p>the number of statutory declarations made using the platform during the financial year; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-9B__subsec-3__para-b">
            <num>b</num>
            <content>
              <p>information about the provider’s compliance with subsection (1) during the financial year; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-9B__subsec-3__para-c">
            <num>c</num>
            <content>
              <p>	(c)	information about whether there has been any actual eligible data breach (within the meaning of the <i>Privacy Act 1988</i>) during the financial year; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-9B__subsec-3__para-d">
            <num>d</num>
            <content>
              <p>information about any matter prescribed by the regulations (including a matter related to paragraph (a), (b) or (c)).</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-9B__subsec-4">
          <num>4</num>
          <content>
            <p>The annual report must be given to <role refersTo="#minister">the Minister</role> by:</p>
          </content>
          <paragraph eId="sec-9B__subsec-4__para-a">
            <num>a</num>
            <content>
              <p>15 October after the end of the financial year; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-9B__subsec-4__para-b">
            <num>b</num>
            <content>
              <p>	(b)	the end of any further period granted under subsection 34C(5) of the <i>Acts Interpretation Act 1901</i>.</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-9B__subsec-5">
          <num>5</num>
          <content>
            <p>The report must comply with any requirements prescribed by the regulations.</p>
          </content>
        </subsection>
      </section>
      <section eId="sec-10">
        <num>10</num>
        <heading>Declarations under other laws</heading>
        <content>
          <p>Where, by a law of the Commonwealth or of a Territory (whether passed or made before or after the commencement of this Act), a declaration is required to be made by a person before some other person, the declaration may, unless the contrary intention appears in that law, be made before the person mentioned in that law or under the observation of a prescribed person in accordance with <ref href="#sec-9">section 9</ref>.</p>
        </content>
      </section>
      <section eId="sec-11">
        <num>11</num>
        <heading>False declarations</heading>
        <content>
          <p>A person must not intentionally make a false statement in a statutory declaration.</p>
        </content>
        <hcontainer name="penalty">

            <p>Penalty:	<quantity refersTo="#custodialSentence">Imprisonment for 4 years</quantity>.</p>
          </content>
        </hcontainer>
      </section>
      <section eId="sec-12">
        <num>12</num>
        <heading>Jurisdiction of courts</heading>
        <subsection eId="sec-12__subsec-1">
          <num>1</num>
          <content>
            <p>Subject to this section:</p>
          </content>
          <paragraph eId="sec-12__subsec-1__para-a">
            <num>a</num>
            <content>
              <p>the several courts of the States (other than the Northern Territory) are invested with federal jurisdiction; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-12__subsec-1__para-b">
            <num>b</num>
            <content>
              <p>jurisdiction is conferred on the several courts of the Territories and of the Northern Territory;</p>
            </content>
            <content>
              <p>with respect to offences against this Act.</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-12__subsec-2">
          <num>2</num>
          <content>
            <p>	(2)	The jurisdiction invested in or conferred on courts by subsection (1) is invested or conferred within the limits (other than limits having effect by reference to the places at which offences are committed) of their several jurisdictions, whether those limits are as to subject matter or otherwise, but subject to the conditions and restrictions specified in paragraphs 39(2)(a) and (c) of the <i>Judiciary Act 1903</i>.</p>
          </content>
        </subsection>
        <subsection eId="sec-12__subsec-3">
          <num>3</num>
          <content>
            <p>The jurisdiction invested in, or conferred on, a court of summary jurisdiction by this section shall not be judicially exercised except by a Judge, a Magistrate, or a District Officer or Assistant District Officer of a Territory.</p>
          </content>
        </subsection>
        <subsection eId="sec-12__subsec-4">
          <num>4</num>
          <content>
            <p>The trial on indictment of an offence against this Act, not being an offence committed within a State, may be held in any State or Territory.</p>
          </content>
        </subsection>
        <subsection eId="sec-12__subsec-5">
          <num>5</num>
          <content>
            <p>Subject to this Act, the laws of a State or Territory with respect to the arrest and custody of offenders or persons charged with offences and the procedure for:</p>
          </content>
          <paragraph eId="sec-12__subsec-5__para-a">
            <num>a</num>
            <content>
              <p>their summary conviction;</p>
            </content>
          </paragraph>
          <paragraph eId="sec-12__subsec-5__para-b">
            <num>b</num>
            <content>
              <p>their examination and commitment for trial on indictment;</p>
            </content>
          </paragraph>
          <paragraph eId="sec-12__subsec-5__para-c">
            <num>c</num>
            <content>
              <p>their trial and conviction on indictment; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-12__subsec-5__para-d">
            <num>d</num>
            <content>
              <p>the hearing and determination of appeals arising out of any such trial or conviction or out of any proceedings connected therewith;</p>
            </content>
            <content>
              <p>and for holding accused persons to bail apply, so far as they are applicable, to a person who is charged in that State or Territory with an offence against this Act.</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-12__subsec-6">
          <num>6</num>
          <content>
            <p>	(6)	Except as provided by this section, the<i> Judiciary Act </i><i>1903</i><i> </i>applies in relation to offences against this Act.</p>
          </content>
        </subsection>
        <subsection eId="sec-12__subsec-7">
          <num>7</num>
          <content>
            <p>	(7)	For the purposes of this section, <b><i>court of summary jurisdiction</i></b> includes a court of a Territory sitting as a court for the making of summary orders or the summary punishment of offences under the law of the Territory.</p>
          </content>
        </subsection>
        <subsection eId="sec-12__subsec-8">
          <num>8</num>
          <content>
            <p>This section extends to all the Territories not forming part of the Commonwealth.</p>
          </content>
        </subsection>
      </section>
      <section eId="sec-13">
        <num>13</num>
        <heading>Extension of Act to Territories</heading>
        <content>
          <p>Subject to subsection 12(8), this Act extends to Norfolk Island and to such other Territories not forming part of the Commonwealth as the Governor-General, by Proclamation, declares.</p>
        </content>
      </section>
      <section eId="sec-14">
        <num>14</num>
        <heading>Regulations</heading>
        <subsection eId="sec-14__subsec-1">
          <num>1</num>
          <content>
            <p>The Governor-General may make regulations, not inconsistent with this Act:</p>
          </content>
          <paragraph eId="sec-14__subsec-1__para-a">
            <num>a</num>
            <content>
              <p>prescribing matters required or permitted by this Act to be prescribed; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-14__subsec-1__para-b">
            <num>b</num>
            <content>
              <p>prescribing matters necessary or convenient to be prescribed for carrying out or giving effect to this Act.</p>
            </content>

              <p>Special requirements relating to digital verification</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-14__subsec-2">
          <num>2</num>
          <content>
            <p>Before the Governor-General makes regulations for the purposes of subparagraph 9A(1)(b)(ii) or (c)(ii), <role refersTo="#minister">the Minister</role> must take into account any matters that are prescribed by the regulations.</p>
          </content>
        </subsection>
        <subsection eId="sec-14__subsec-3">
          <num>3</num>
          <content>
            <p>Before the Governor-General makes regulations for the purposes of subsection 9A(2) or (3) prescribing a digital service to be an approved online platform or an approved identity service, <role refersTo="#minister">the Minister</role> must:</p>
          </content>
          <paragraph eId="sec-14__subsec-3__para-a">
            <num>a</num>
            <content>
              <p>	(a)	be satisfied that the digital service will operate in a way that complies with the <i>Privacy Act 1988</i>, and any corresponding law of a State or Territory that the Minister considers is relevant; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-14__subsec-3__para-b">
            <num>b</num>
            <content>
              <p>be satisfied of the effectiveness of the digital service’s protective security (including security governance, information security, personnel security and physical security) and fraud control arrangements; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-14__subsec-3__para-c">
            <num>c</num>
            <content>
              <p>be satisfied of any matters that are prescribed by the regulations; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-14__subsec-3__para-d">
            <num>d</num>
            <content>
              <p>take into account any matters that are prescribed by the regulations.</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-14__subsec-4">
          <num>4</num>
          <content>
            <p>The Governor-General may repeal regulations made for the purposes of subparagraph 9A(1)(b)(ii) or (c)(ii), or subsection 9A(2) or (3).</p>
          </content>
        </subsection>
        <subsection eId="sec-14__subsec-5">
          <num>5</num>
          <content>
            <p>Without limiting subsection (4), the Governor-General may repeal a regulation prescribing a digital service to be an approved online platform if the provider of the service contravenes subsection 9B(1) (prohibition on retaining copies of statutory declarations).</p>
          </content>
        </subsection>
      </section>
      <section eId="sec-15">
        <num>15</num>
        <heading>Approved forms for statutory declarations</heading>
        <content>
          <p><role refersTo="#minister">The Minister</role> may, in writing, approve one or more forms for the purposes of paragraph 9(a) or subparagraph 9A(1)(a)(i).</p>
        </content>
      </section>
      <section eId="sec-16">
        <num>16</num>
        <heading>Review of the operation of this Act</heading>
        <subsection eId="sec-16__subsec-1">
          <num>1</num>
          <content>
            <p>	(1)	The Minister must cause a review of the operation of this Act to be conducted as soon as practicable after the end of 2 years after the commencement of the <i>Statutory Declarations Amendment Act 2023</i>.</p>
          </content>
        </subsection>
        <subsection eId="sec-16__subsec-2">
          <num>2</num>
          <content>
            <p>Without limiting the matters that may be considered when conducting the review, the review must consider:</p>
          </content>
          <paragraph eId="sec-16__subsec-2__para-a">
            <num>a</num>
            <content>
              <p>whether the operation of this Act is effective; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-16__subsec-2__para-b">
            <num>b</num>
            <content>
              <p>whether amendments to this Act are necessary or desirable to improve the operation of this Act.</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-16__subsec-3">
          <num>3</num>
          <content>
            <p>The persons who conduct the review must give the Minister a written report of the review <quantity refersTo="#deadline">within 6 months</quantity> of the commencement of the review.</p>
          </content>
        </subsection>
        <subsection eId="sec-16__subsec-4">
          <num>4</num>
          <content>
            <p><role refersTo="#minister">The Minister</role> must cause a copy of the report of the review to be tabled in each House of the Parliament within 15 sitting days of that House after <role refersTo="#minister">the Minister</role> receives the report.</p>
