      <p>An Act to provide for the Government of certain  acquired by the Commonwealth</p>
      <p>Preamble</p>
      <p>All the islands in the following areas are territories acquired by the Commonwealth:</p>
      <p>the area the boundary of which commences at the point of the intersection of the line following the outer edge of the  by the parallel of Latitude 12° 00´ South and runs:</p>
      <p>then south-easterly along the geodesic to the point of Latitude 16° 00´ South, Longitude 156° 06´ East; and</p>
      <p>then south along the meridian of Longitude 156° 06´ East to its intersection by the parallel of Latitude 24° 00´ South; and</p>
      <p>then west along that parallel to its intersection by the meridian of Longitude 154° 00´ East; and</p>
      <p>then north along that meridian to its intersection by the parallel of Latitude 22° 00´ South; and</p>
      <p>then west along that parallel to its intersection by the line following the outer edge of the ; and</p>
      <p>then generally north-westerly along that line to the point of commencement; and</p>
      <p>the area the boundary of which commences at the point of Latitude 29° 21´ South, Longitude 158° 59´ East and runs:</p>
      <p>then east along the parallel of Latitude 29° 21´ South to its intersection by the meridian of Longitude 159° 14´ East; and</p>
      <p>then south-westerly along the geodesic to the point of Latitude 30° 3´ South, Longitude 159° 10´ East; and</p>
      <p>then west along the parallel of Latitude 30° 3´ South to its intersection by the meridian of Longitude 158° 55´ East; and</p>
      <p>then north-easterly along the geodesic to the point of commencement.</p>
      <p>It is desirable to make provision for the government of those islands as one Territory.</p>
      <p>BE IT THEREFORE enacted by the Queen’s Most Excellent Majesty, the Senate, and the House of Representatives of the Commonwealth of Australia, as follows:</p>

        <num>1</num>
        <heading>Short title</heading>
        <content>
          <p>		This Act may be cited as the <i> Act 1969</i>.</p>
        </content>
      </section>
      <section eId="sec-2">
        <num>2</num>
        <heading>Interpretation</heading>
        <subsection eId="sec-2__subsec-1">
          <num>1</num>
          <content>
            <p>In this Act, unless the contrary intention appears:</p>
          </content>
          <content>
            <p><b><i>Act</i></b> does not include an enactment.</p>
            <p><term refersTo="#term-enactment">enactment</term> has the same meaning as <def>in the  (Self-Government) Act 1988.</def></p>
            <p><term refersTo="#term-ordinance">Ordinance</term> means <def>an Ordinance made under this Act.</def></p>
            <p><term refersTo="#term-prescribed-state-or-territory">prescribed State or Territory</term> has the meaning given by <def><ref href="">the Norfolk Island Act 1979</ref>.</def></p>
            <p><term refersTo="#term-the-territory">the Territory</term> means <def>the .</def></p>
          </content>
        </subsection>
        <subsection eId="sec-2__subsec-2">
          <num>2</num>
          <content>
            <p>	(2)	Where, for the purposes of this Act, it is necessary to determine the position on the surface of the Earth of a point, line or area, that position must be determined by reference to the Geocentric Datum of Australia (GDA) as defined in the <i>Gazette</i> No. GN 35, .</p>
          </content>
          <content>
            <p>3</p>
            <p>The , that is to say, the islands described in the Preamble, are declared to be a Territory by the name of .</p>
          </content>
        </subsection>
      </section>
      <section eId="sec-4">
        <num>4</num>
        <heading>Continuance of laws</heading>
        <content>
          <p>Subject to this Act, the laws in force in the  at the commencement of this Act continue in force, but may be altered or repealed by Ordinance made in pursuance of this Act.</p>
        </content>
      </section>
      <section eId="sec-5">
        <num>5</num>
        <heading>Ordinances</heading>
        <subsection eId="sec-5__subsec-1">
          <num>1</num>
          <content>
            <p>The Governor-General may make Ordinances for the peace, order and good government of the Territory.</p>
          </content>
        </subsection>
        <subsection eId="sec-5__subsec-2">
          <num>2</num>
          <content>
            <p>	(2)	Notice of the making of an Ordinance shall be published in the <i>Gazette</i>, and an Ordinance shall, unless the contrary intention appears in the Ordinance, come into operation on the date of publication of the notice.</p>
          </content>
        </subsection>
      </section>
      <section eId="sec-6">
        <num>6</num>
        <heading>Application of Commonwealth Acts</heading>
        <subsection eId="sec-6__subsec-1">
          <num>1</num>
          <content>
            <p>An Act or a provision of an Act (whether passed before or after the commencement of this Act) is not in force as such in the Territory unless it is expressed to extend to the Territory.</p>
          </content>
        </subsection>
        <subsection eId="sec-6__subsec-2">
          <num>2</num>
          <content>
            <p>An Ordinance shall not be made so as to affect the application of its own force in, or in relation to, the Territory of an Act or a provision of an Act.</p>
          </content>
        </subsection>
      </section>
      <section eId="sec-7">
        <num>7</num>
        <heading>Tabling of Ordinances</heading>
        <subsection eId="sec-7__subsec-1">
          <num>1</num>
          <content>
            <p>An Ordinance shall be laid before each House of the Parliament within 15 sitting days of that House after the making of the Ordinance, and, if it is not so laid before each House of the Parliament, ceases to have effect.</p>
          </content>
        </subsection>
        <subsection eId="sec-7__subsec-2">
          <num>2</num>
          <content>
            <p>If either House of the Parliament, in pursuance of a motion of which notice has been given within 15 sitting days after an Ordinance has been laid before that House, passes a resolution disallowing the Ordinance or a part of the Ordinance, the Ordinance or part so disallowed thereupon ceases to have effect.</p>
          </content>
        </subsection>
        <subsection eId="sec-7__subsec-3">
          <num>3</num>
          <content>
            <p>If, at the expiration of 15 sitting days after notice of a motion to disallow an Ordinance or part of an Ordinance has been given in a House of the Parliament, being notice given within 15 sitting days after the Ordinance has been laid before that House:</p>
          </content>
          <paragraph eId="sec-7__subsec-3__para-a">
            <num>a</num>
            <content>
              <p>the notice has not been withdrawn and the motion has not been called on; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-7__subsec-3__para-b">
            <num>b</num>
            <content>
              <p>the motion has been called on, moved and seconded and has not been withdrawn or otherwise disposed of;</p>
            </content>
            <content>
              <p>the Ordinance or part, as the case may be, specified in the motion shall thereupon be deemed to have been disallowed.</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-7__subsec-4">
          <num>4</num>
          <content>
            <p>If, before the expiration of 15 sitting days after notice of a motion to disallow an Ordinance or part of an Ordinance has been given in a House of the Parliament:</p>
          </content>
          <paragraph eId="sec-7__subsec-4__para-a">
            <num>a</num>
            <content>
              <p>the House of Representatives is dissolved or expires, or the Parliament is prorogued; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-7__subsec-4__para-b">
            <num>b</num>
            <content>
              <p>at the time of the dissolution, expiry or prorogation, as the case may be:</p>
            </content>
          </paragraph>
          <paragraph eId="sec-7__subsec-4__para-i">
            <num>i</num>
            <content>
              <p>the notice has not been withdrawn and the motion has not been called on; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-7__subsec-4__para-ii">
            <num>ii</num>
            <content>
              <p>the motion has been called on, moved and seconded and has not been withdrawn or otherwise disposed of;</p>
            </content>
            <content>
              <p>the Ordinance shall, for the purposes of subsections (2) and (3), be deemed to have been laid before that first-mentioned House on the first sitting day of that first-mentioned House after the dissolution, expiry or prorogation, as the case may be.</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-7__subsec-5">
          <num>5</num>
          <content>
            <p>Where an Ordinance is disallowed, or is deemed to have been disallowed, under this section or ceases to have effect by virtue of the operation of subsection (1), the disallowance of the Ordinance or the operation of subsection (1) in relation to the Ordinance, as the case may be, has the same effect as a repeal of the Ordinance.</p>
          </content>
        </subsection>
        <subsection eId="sec-7__subsec-5A">
          <num>5A</num>
          <content>
            <p>Where:</p>
          </content>
          <paragraph eId="sec-7__subsec-5A__para-a">
            <num>a</num>
            <content>
              <p>	(a)	an Ordinance (in this subsection referred to as the <b><i>relevant Ordinance</i></b>) is disallowed, or is deemed to have been disallowed, under this section or ceases to have effect by virtue of the operation of subsection (1); and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-7__subsec-5A__para-b">
            <num>b</num>
            <content>
              <p>the relevant Ordinance repealed, in whole or in part, another Ordinance or any other law that was in force immediately before the relevant Ordinance came into operation;</p>
            </content>
            <content>
              <p>the disallowance of the relevant Ordinance or the operation of subsection (1) in relation to the relevant Ordinance, as the case may be, has the effect of reviving that other Ordinance or law, as the case may be, from and including the date of the disallowance or the date on which the relevant Ordinance ceased to have effect by virtue of that operation of subsection (1), as the case may be, as if the relevant Ordinance had not been made.</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-7__subsec-5B">
          <num>5B</num>
          <content>
            <p>A reference in subsection (5) or (5A) to an Ordinance shall be read as including a reference to a part of an Ordinance, and a reference in subsection (5A) to a law has a corresponding meaning.</p>
          </content>
        </subsection>
      </section>
      <section eId="sec-7A">
        <num>7A</num>
        <heading>Ordinance not to be re-made while required to be tabled</heading>
        <subsection eId="sec-7A__subsec-1">
          <num>1</num>
          <content>
            <p>	(1)	Where an Ordinance (in this section called the <b><i>original Ordinance</i></b>) has been made, no Ordinance containing a provision being the same in substance as a provision of the original Ordinance shall be made during the period defined by subsection (2) unless both Houses of the Parliament by resolution approve the making of an Ordinance containing a provision the same in substance as that provision of the original Ordinance.</p>
          </content>
        </subsection>
        <subsection eId="sec-7A__subsec-2">
          <num>2</num>
          <content>
            <p>The period referred to in subsection (1) is the period starting on the day on which the original Ordinance was made and ending at the end of 7 days after:</p>
          </content>
          <paragraph eId="sec-7A__subsec-2__para-a">
            <num>a</num>
            <content>
              <p>if the original Ordinance has been laid, in accordance with subsection 7(1), before both Houses of the Parliament on the same day—that day;</p>
            </content>
          </paragraph>
          <paragraph eId="sec-7A__subsec-2__para-b">
            <num>b</num>
            <content>
              <p>if the original Ordinance has been so laid before both Houses on different days—the later of those days; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-7A__subsec-2__para-c">
            <num>c</num>
            <content>
              <p>if the original Ordinance has not been so laid before both Houses—the last day on which subsection 7(1) could have been complied with.</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-7A__subsec-3">
          <num>3</num>
          <content>
            <p>If a provision of an Ordinance is made in contravention of this section, the provision has not effect.</p>
          </content>
        </subsection>
      </section>
      <section eId="sec-7B">
        <num>7B</num>
        <heading>Ordinance not to be re-made while subject to disallowance</heading>
        <subsection eId="sec-7B__subsec-1">
          <num>1</num>
          <content>
            <p>Where notice of a motion to disallow an Ordinance has been given in a House of the Parliament within 15 sitting days after the Ordinance has been laid before that House, no Ordinance containing a provision being the same in substance as a provision of the first-mentioned Ordinance shall be made unless:</p>
          </content>
          <paragraph eId="sec-7B__subsec-1__para-a">
            <num>a</num>
            <content>
              <p>the notice has been withdrawn;</p>
            </content>
          </paragraph>
          <paragraph eId="sec-7B__subsec-1__para-b">
            <num>b</num>
            <content>
              <p>the Ordinance is deemed to have been disallowed under subsection 7(3);</p>
            </content>
          </paragraph>
          <paragraph eId="sec-7B__subsec-1__para-c">
            <num>c</num>
            <content>
              <p>the motion has been withdrawn or otherwise disposed of; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-7B__subsec-1__para-d">
            <num>d</num>
            <content>
              <p>subsection 7(4) has applied in relation to the Ordinance.</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-7B__subsec-2">
          <num>2</num>
          <content>
            <p>Where:</p>
          </content>
          <paragraph eId="sec-7B__subsec-2__para-a">
            <num>a</num>
            <content>
              <p>because of subsection 7(4), an Ordinance is deemed to have been laid before a House of the Parliament on a particular day; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-7B__subsec-2__para-b">
            <num>b</num>
            <content>
              <p>notice of a motion to disallow the Ordinance has been given in that House within 15 sitting days after that day;</p>
            </content>
            <content>
              <p>no Ordinance containing a provision being the same in substance as a provision of the first-mentioned Ordinance shall be made unless:</p>
            </content>
          </paragraph>
          <paragraph eId="sec-7B__subsec-2__para-c">
            <num>c</num>
            <content>
              <p>the notice has been withdrawn;</p>
            </content>
          </paragraph>
          <paragraph eId="sec-7B__subsec-2__para-d">
            <num>d</num>
            <content>
              <p>the Ordinance is deemed to have been disallowed under subsection 7(3);</p>
            </content>
          </paragraph>
          <paragraph eId="sec-7B__subsec-2__para-e">
            <num>e</num>
            <content>
              <p>the motion has been withdrawn or otherwise disposed of; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-7B__subsec-2__para-f">
            <num>f</num>
            <content>
              <p>subsection 7(4) has applied again in relation to the Ordinance.</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-7B__subsec-3">
          <num>3</num>
          <content>
            <p>If a provision of an Ordinance is made in contravention of this section, the provision has no effect.</p>
          </content>
        </subsection>
        <subsection eId="sec-7B__subsec-4">
          <num>4</num>
          <content>

        <num>7C</num>
        <heading>Disallowed Ordinance not to be re-made unless resolution rescinded or House approves</heading>
        <content>
          <p>If an Ordinance or a part of an Ordinance is disallowed, or is deemed to have been disallowed, under <quantity refersTo="#deadline">within 6 months</quantity> after the date of the disallowance, that provision has no effect, unless:<ref href="#sec-7">section 7</ref>, and an Ordinance containing a provision being the same in substance as a provision so disallowed, or deemed to have been disallowed, is made </p>
        </content>
        <paragraph eId="sec-7C__para-a">
          <num>a</num>
          <content>
            <p>in the case of an Ordinance, or a part of an Ordinance, disallowed by resolution—the resolution has been rescinded by the House of the Parliament by which it was passed; or</p>
          </content>
        </paragraph>
        <paragraph eId="sec-7C__para-b">
          <num>b</num>
          <content>
            <p>in the case of an Ordinance, or a part of an Ordinance, deemed to have been disallowed—the House of the Parliament in which notice of the motion to disallow the Ordinance or part was given has approved, by resolution, the making of a provision the same in substance as the provision deemed to have been disallowed.</p>

        </paragraph>
      </section>
      <section eId="sec-7D">
        <num>7D</num>
        <heading>Regulations, rules and by-laws</heading>
        <subsection eId="sec-7D__subsec-1">
          <num>1</num>
          <content>
            <p>All regulations made under an Ordinance shall be laid before each House of the Parliament within 15 sitting days of that House after the day on which the regulations are made and, if they are not so laid before each House of the Parliament, have no effect.</p>
          </content>
        </subsection>
        <subsection eId="sec-7D__subsec-2">
          <num>2</num>
          <content>
            <p>Subsections 7(2) to (5B), inclusive, and sections 7A, 7B and 7C apply in relation to regulations laid before a House of the Parliament as if, in those provisions, references to an Ordinance were references to regulations and references to a provision of an Ordinance were references to a regulation.</p>
          </content>
        </subsection>
        <subsection eId="sec-7D__subsec-3">
          <num>3</num>
          <content>
            <p>	(3)	In this section, <b><i>regulations</i></b> includes rules and by-laws.</p>

        </subsection>
      </section>
      <section eId="sec-8">
        <num>8</num>
        <heading>Courts having jurisdiction in the Territory</heading>
        <subsection eId="sec-8__subsec-1A">
          <num>1A</num>
          <content>
            <p>Subject to subsection (3), the courts of the prescribed State or Territory also have jurisdiction in and in relation to the Territory.</p>
          </content>
        </subsection>
        <subsection eId="sec-8__subsec-1B">
          <num>1B</num>
          <content>
            <p>In the exercise of its jurisdiction under this section, a court of the prescribed State or Territory may sit in the Coral Sea Islands Territory, in Norfolk Island or in the prescribed State or Territory.</p>

        </subsection>
        <subsection eId="sec-8__subsec-1">
          <num>1</num>
          <content>
            <p>	(1)	Subject to subsection (3) of this section and <i>Norfolk Island Act 1979</i>, the courts of Norfolk Island have jurisdiction in and in relation to the Territory.<ref href="#part-VI">Part VI</ref>I of the </p>

        </subsection>
        <subsection eId="sec-8__subsec-2">
          <num>2</num>
          <content>
            <p>In the exercise of its jurisdiction under this section a court of Norfolk Island may sit in the Territory, in  or in .</p>

          <num>3</num>
          <content>
            <p>This section does not confer jurisdiction on any court in relation to matters arising under or by virtue of the provisions of:</p>

            <num>a</num>
            <content>
              <p>	(a)	the <i>Offshore Electricity Infrastructure Act 2021</i>; or</p>
            </content>
          </paragraph>

              <p>	(b)	the <i>Offshore Petroleum and Greenhouse Gas Storage Act 2006</i>.</p>

                <b>Editorial changes</b>
              </p>
              <p>The <i>Legislation Act 2003</i> authorises First Parliamentary Counsel to make editorial and presentational changes to a compiled law in preparing a compilation of the law for registration. The changes must not change the effect of the law. Editorial changes take effect from the compilation registration date.</p>
              <p>If the compilation includes editorial changes, the endnotes include a brief outline of the changes in general terms. Full details of any changes can be obtained from the Office of Parliamentary Counsel.</p>

                <b>Misdescribed amendments</b>
              </p>
              <p>A misdescribed amendment is an amendment that does not accurately describe how an amendment is to be made. If, despite the misdescription, the amendment can be given effect as intended, then the misdescribed amendment can be incorporated through an editorial change made under <i>Legislation Act 2003</i>.<ref href="#sec-15V">section 15V</ref> of the </p>
