          <heading>Short title</heading>
          <content>
            <p>		This Act may be cited as the <i>Criminology Research Act 1971</i>.</p>
          </content>
        </section>
        <section eId="part-I__sec-2">
          <num>2</num>
          <heading>Commencement</heading>
          <content>
            <p>This Act shall come into operation on a date to be fixed by Proclamation.</p>
          </content>
        </section>
        <section eId="part-I__sec-4">
          <num>4</num>
          <heading>Interpretation</heading>
          <content>
            <p>In this Act, unless the contrary intention appears:</p>
            <p><term refersTo="#term-acting-director">Acting Director</term> means <def>an Acting Director of the Institute appointed under <ref href="#sec-22">section 22</ref>.</def></p>
            <p><term refersTo="#term-advisory-council">Advisory Council</term> means <def>the Criminology Research Advisory Council established under <ref href="#sec-33">section 33</ref>.</def></p>
            <p><term refersTo="#term-appoint">appoint</term> includes <def>re-appoint.</def></p>
            <p><term refersTo="#term-criminological-research">criminological research</term> means <def>research in connexion with: the causes, correction and prevention of criminal behaviour; and any related matter.</def></p>
          </content>

            <num>a</num>
            <content>
              <p>the causes, correction and prevention of criminal behaviour; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-I__sec-4__para-b">
            <num>b</num>
            <content>
              <p>any related matter.</p>
            </content>
            <content>
              <p><term refersTo="#term-finance-minister">Finance Minister</term> means <def>the Minister administering the Public Governance, Performance and Accountability Act 2013.</def></p>
              <p><b><i>the appropriate Minister</i></b> means:</p>
            </content>
          </paragraph>
          <paragraph eId="part-I__sec-4__para-a">
            <num>a</num>
            <content>
              <p>in relation to a State, such Minister of the Crown of that State as is prescribed, and includes any Minister of the Crown for the time being acting for and on behalf of that Minister; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-I__sec-4__para-aa">
            <num>aa</num>
            <content>
              <p>in relation to the Australian Capital Territory, such Minister of the Australian Capital Territory as is prescribed, and includes any Minister of the Australian Capital Territory for the time being acting for and on behalf of that Minister; and</p>

            <num>b</num>
            <content>
              <p>in relation to the , such Minister of the  as is prescribed, and includes any Minister of the  for the time being acting for and on behalf of that Minister.</p>

              <p><term refersTo="#term-the-director">the Director</term> means <def>the Director of the Institute appointed under <ref href="#sec-15">section 15</ref>.</def></p>
              <p><term refersTo="#term-the-institute">the Institute</term> means <def>the Australian Institute of Criminology established by <ref href="#sec-5">section 5</ref>.</def></p>

        <heading>The Australian Institute of Criminology</heading>

          <num>1</num>
          <heading>Establishment, functions and powers of Institute</heading>

            <heading>Establishment of Institute</heading>
            <subsection eId="part-II__dvs-1__sec-5__subsec-1">
              <num>1</num>
              <content>
                <p>There is hereby established an institute to be known as the Australian Institute of Criminology.</p>
              </content>
            </subsection>
            <subsection eId="part-II__dvs-1__sec-5__subsec-2">
              <num>2</num>
              <content>
                <p>The Institute consists of:</p>
              </content>
              <paragraph eId="part-II__dvs-1__sec-5__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>the Director; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-II__dvs-1__sec-5__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>the staff of the Institute.</p>
                </content>
              </paragraph>
            </subsection>
          </section>
          <section eId="part-II__dvs-1__sec-6">
            <num>6</num>
            <heading>Functions of Institute</heading>
            <content>
              <p>The Institute has the following functions:</p>
            </content>
            <paragraph eId="part-II__dvs-1__sec-6__para-a">
              <num>a</num>
              <content>
                <p>to promote justice and reduce crime by:</p>
              </content>
            </paragraph>
            <paragraph eId="part-II__dvs-1__sec-6__para-i">
              <num>i</num>
              <content>
                <p>conducting criminological research; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-II__dvs-1__sec-6__para-ii">
              <num>ii</num>
              <content>
                <p>communicating the results of that research to the Commonwealth, the States, the Australian Capital Territory, the Northern Territory and the community;</p>
              </content>
            </paragraph>
            <paragraph eId="part-II__dvs-1__sec-6__para-b">
              <num>b</num>
              <content>
                <p>to assist the Director in performing the Director’s functions;</p>
              </content>
            </paragraph>
            <paragraph eId="part-II__dvs-1__sec-6__para-c">
              <num>c</num>
              <content>
                <p>to administer programs for awarding grants, and engaging specialists, for:</p>
              </content>
            </paragraph>
            <paragraph eId="part-II__dvs-1__sec-6__para-i">
              <num>i</num>
              <content>
                <p>criminological research that is relevant to the public policy of the States, the Australian Capital Territory and the Northern Territory; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-II__dvs-1__sec-6__para-ii">
              <num>ii</num>
              <content>
                <p>activities related to that research (including the publication of that research, for example).</p>
              </content>
            </paragraph>
          </section>
          <section eId="part-II__dvs-1__sec-6A">
            <num>6A</num>
            <heading>Power of Minister to request Institute to perform certain functions</heading>
            <subsection eId="part-II__dvs-1__sec-6A__subsec-1">
              <num>1</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> may request the Institute to:</p>
              </content>
              <paragraph eId="part-II__dvs-1__sec-6A__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>conduct, or arrange for the conduct of, criminological research into a matter specified by <role refersTo="#minister">the Minister</role>; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-II__dvs-1__sec-6A__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>to conduct seminars or courses of training or instruction in a matter specified by <role refersTo="#minister">the Minister</role>, being seminars or courses of training or instruction for persons engaged, or to be engaged, in criminological research or in work related to the prevention or correction of criminal behaviour.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-II__dvs-1__sec-6A__subsec-2">
              <num>2</num>
              <content>
                <p>Where <role refersTo="#minister">the Minister</role> so requests the Institute to conduct, or arrange for the conduct of, criminological research, or to conduct seminars or courses of training or instruction, <role refersTo="#minister">the Minister</role> may also require the Director to ensure that such priority is given to the conduct of that research, or to the conduct of those seminars or courses of training or instruction, as <role refersTo="#minister">the Minister</role> specifies.</p>
              </content>
            </subsection>
          </section>
        </division>
        <division eId="part-II__dvs-3">
          <num>3</num>
          <heading>Director, Acting Director and staff of Institute</heading>
          <section eId="part-II__dvs-3__sec-15">
            <num>15</num>
            <heading>Director of Institute</heading>
            <subsection eId="part-II__dvs-3__sec-15__subsec-1">
              <num>1</num>
              <content>
                <p>There shall be a Director of the Institute, who shall be appointed by <role refersTo="#minister">the Minister</role>.</p>
              </content>
            </subsection>
            <subsection eId="part-II__dvs-3__sec-15__subsec-2">
              <num>2</num>
              <content>
                <p>The appointment of the Director is subject to such terms and conditions (if any) in respect of matters not provided for by this Act as are determined by <role refersTo="#minister">the Minister</role>.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-II__dvs-3__sec-16">
            <num>16</num>
            <heading>Functions of Director</heading>
            <content>
              <p>The Director has the following functions:</p>
            </content>
            <paragraph eId="part-II__dvs-3__sec-16__para-a">
              <num>a</num>
              <content>
                <p>to conduct, or arrange for the conduct of, the criminological research that is:</p>
              </content>
            </paragraph>
            <paragraph eId="part-II__dvs-3__sec-16__para-i">
              <num>i</num>
              <content>
                <p>approved by the Director, taking the advice of the Advisory Council into account; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-II__dvs-3__sec-16__para-ii">
              <num>ii</num>
              <content>
                <p>requested by <role refersTo="#minister">the Minister</role>;</p>
              </content>
            </paragraph>
            <paragraph eId="part-II__dvs-3__sec-16__para-b">
              <num>b</num>
              <content>
                <p>to communicate the results of that research to the Commonwealth, the States, the Australian Capital Territory, the Northern Territory and the community;</p>
              </content>
            </paragraph>
            <paragraph eId="part-II__dvs-3__sec-16__para-c">
              <num>c</num>
              <content>
                <p>to conduct, or arrange for the conduct of, the seminars and courses of training or instruction for persons engaged, or to be engaged, in criminological research or in work related to the prevention or correction of criminal behaviour that are:</p>
              </content>
            </paragraph>
            <paragraph eId="part-II__dvs-3__sec-16__para-i">
              <num>i</num>
              <content>
                <p>approved by the Director, taking the advice of the Advisory Council into account; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-II__dvs-3__sec-16__para-ii">
              <num>ii</num>
              <content>
                <p>requested by <role refersTo="#minister">the Minister</role>;</p>
              </content>
            </paragraph>
            <paragraph eId="part-II__dvs-3__sec-16__para-d">
              <num>d</num>
              <content>
                <p>to advise the Advisory Council in relation to needs for, and programs of, criminological research;</p>
              </content>
            </paragraph>
            <paragraph eId="part-II__dvs-3__sec-16__para-e">
              <num>e</num>
              <content>
                <p>to provide secretarial and administrative services for the Advisory Council;</p>
              </content>
            </paragraph>
            <paragraph eId="part-II__dvs-3__sec-16__para-f">
              <num>f</num>
              <content>
                <p>to give advice and assistance in relation to any research performed wholly or partly with money provided out of the grants program;</p>
              </content>
            </paragraph>
            <paragraph eId="part-II__dvs-3__sec-16__para-g">
              <num>g</num>
              <content>
                <p>to give advice in relation to the compilation of statistics relating to crime;</p>
              </content>
            </paragraph>
            <paragraph eId="part-II__dvs-3__sec-16__para-h">
              <num>h</num>
              <content>
                <p>to publish the material resulting from or connected with the performance of the Institute’s functions that is approved by the Director, taking the advice of the Advisory Council into account;</p>
              </content>
            </paragraph>
            <paragraph eId="part-II__dvs-3__sec-16__para-i">
              <num>i</num>
              <content>
                <p>to collect information and statistics (without detracting from, and in the context of, the overall collecting and coordinating role of the Australian Bureau of Statistics);</p>
              </content>
            </paragraph>
            <paragraph eId="part-II__dvs-3__sec-16__para-j">
              <num>j</num>
              <content>
                <p>to provide information and advice to Departments, agencies and authorities of the Commonwealth, of the States, of the Australian Capital Territory and of the Northern Territory dealing with the administration of criminal justice;</p>
              </content>
            </paragraph>
            <paragraph eId="part-II__dvs-3__sec-16__para-k">
              <num>k</num>
              <content>
                <p>to collaborate, in and outside Australia, with governments, institutions and authorities, and with bodies and persons, in relation to research, or the training of persons, in or in connection with the administration of criminal justice;</p>
              </content>
            </paragraph>
            <paragraph eId="part-II__dvs-3__sec-16__para-l">
              <num>l</num>
              <content>
                <p>to approve payments for grants and engaging specialists, taking the advice of the Advisory Council into account;</p>
              </content>
            </paragraph>
            <paragraph eId="part-II__dvs-3__sec-16__para-m">
              <num>m</num>
              <content>
                <p>to do anything incidental or conducive to the performance of any of these functions.</p>
              </content>
            </paragraph>
          </section>
          <section eId="part-II__dvs-3__sec-17">
            <num>17</num>
            <heading>Tenure of office of Director</heading>
            <subsection eId="part-II__dvs-3__sec-17__subsec-1">
              <num>1</num>
              <content>
                <p>Subject to this Act, the person appointed as the Director holds office for such period, not exceeding 5 years, as is specified in the instrument of the person’s appointment, but is eligible for re-appointment.</p>
              </content>
            </subsection>
            <subsection eId="part-II__dvs-3__sec-17__subsec-4">
              <num>4</num>
              <content>
                <p>The Director may resign from office by writing signed by the Director and addressed to <role refersTo="#minister">the Minister</role>.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-II__dvs-3__sec-18">
            <num>18</num>
            <heading>Remuneration and allowances of Director</heading>
            <subsection eId="part-II__dvs-3__sec-18__subsec-1">
              <num>1</num>
              <content>
                <p>The Director shall be paid such remuneration as is determined by the Remuneration Tribunal.</p>
              </content>
            </subsection>
            <subsection eId="part-II__dvs-3__sec-18__subsec-2">
              <num>2</num>
              <content>
                <p>The Director shall be paid such allowances as are prescribed.</p>
              </content>
            </subsection>
            <subsection eId="part-II__dvs-3__sec-18__subsec-3">
              <num>3</num>
              <content>
                <p>	(3)	Subsections (1) and (2) have effect subject to the <i>Remuneration Tribunal Act 1973</i>.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-II__dvs-3__sec-19">
            <num>19</num>
            <heading>Leave of absence of Director</heading>
            <subsection eId="part-II__dvs-3__sec-19__subsec-1">
              <num>1</num>
              <content>
                <p>The Director has such recreation leave entitlements as are determined by the Remuneration Tribunal.</p>
              </content>
            </subsection>
            <subsection eId="part-II__dvs-3__sec-19__subsec-2">
              <num>2</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> may grant the Director leave of absence, other than recreation leave, on such terms and conditions as to remuneration or otherwise as <role refersTo="#minister">the Minister</role> determines.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-II__dvs-3__sec-20">
            <num>20</num>
            <heading>Termination of appointment of Director</heading>
            <content>
              <p><role refersTo="#minister">The Minister</role> may terminate the appointment of the Director for misbehaviour of physical or mental incapacity.</p>
            </content>
          </section>
          <section eId="part-II__dvs-3__sec-21">
            <num>21</num>
            <heading>Vacation of office of Director</heading>
            <content>
              <p>If the Director:</p>
            </content>
            <paragraph eId="part-II__dvs-3__sec-21__para-a">
              <num>a</num>
              <content>
                <p>becomes bankrupt, applies to take the benefit of any law for the relief of bankrupt or insolvent debtors, compounds with creditors or makes an assignment of remuneration for their benefit; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-II__dvs-3__sec-21__para-b">
              <num>b</num>
              <content>

              <p>The Criminology Research Advisory Council is established.</p>

              <p>The Advisory Council has the functions of advising the Director in relation to:</p>

            </paragraph>

              <p>The Advisory Council consists of the following members:</p>

                <p>any remuneration and allowances payable to a person under this Act;</p>

            </paragraph>

              <p>The Director, by signed instrument, may delegate all or any of the Director’s functions or powers to an SES employee, or acting SES employee, of the Institute.</p>

              <p>A delegate must comply with any written directions that the Director gives to the delegate when performing a function, or exercising a power, of the Director.</p>
