        <heading>Preliminary</heading>

          <heading>Short title</heading>
          <content>
            <p>		This Act may be cited as the <i>Child Care Act 1972</i>.</p>
          </content>
        </section>
        <section eId="part-I__sec-2">
          <num>2</num>
          <heading>Commencement</heading>
          <content>
            <p>This Act shall come into operation on the day on which it receives the Royal Assent.</p>
          </content>
        </section>
        <section eId="part-I__sec-4">
          <num>4</num>
          <heading>Interpretation</heading>
          <subsection eId="part-I__sec-4__subsec-1">
            <num>1</num>
            <content>
              <p>In this Act, unless the contrary intention appears:</p>
            </content>
            <content>
              <p><term refersTo="#term-acnc-type-of-entity">ACNC type of entity</term> means <def>an entity that meets the description of a type of entity in column 1 of the table in subsection 25-5(5) of the Australian Charities and Not-for-profits Commission Act 2012.</def></p>
              <p><term refersTo="#term-body">body</term> includes <def>an association and society.</def></p>
              <p><term refersTo="#term-building">building</term> includes <def>a part of a building and an addition to a building and, in <ref href="#part-VI">Part VI</ref>, includes any other improvement on land.</def></p>
              <p><term refersTo="#term-child-care">child care</term> means <def>the care of children at a time or times when they are not being cared for in their own homes or in the homes of other persons.</def></p>
              <p><term refersTo="#term-child-care-centre">child care centre</term> has the meaning given by <def><ref href="#sec-4A">section 4A</ref>.</def></p>
              <p><term refersTo="#term-child-care-standards-committee">Child Care Standards Committee</term> means <def>the committee established under <ref href="#sec-14">section 14</ref>.</def></p>
              <p><term refersTo="#term-eligible-child-care-centre">eligible child care centre</term> has the meaning given by <def><ref href="#sec-4B">section 4B</ref>.</def></p>
              <p><term refersTo="#term-family-assistance-law">family assistance law</term> means <def>any one or more of the following: 	(a)	the <i>A New Tax System (Family Assistance) Act 1999</i>; 	(b)	the <i>A New Tax System (Family Assistance) (Administration) Act 1999</i>; 	(c)	any instrument (including regulations) made under the <i>A New Tax System (Family Assistance) Act 1999</i> or the <i>A New Tax System (Family Assistance) (Administration) Act 1999</i>. <b><i>home</i></b> does not include an orphanage or like institution.</def></p>

              <num>a</num>
              <content>
                <p>	(a)	the <i>A New Tax System (Family Assistance) Act 1999</i>;</p>
              </content>
            </paragraph>
            <paragraph eId="part-I__sec-4__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>	(b)	the <i>A New Tax System (Family Assistance) (Administration) Act 1999</i>;</p>
              </content>
            </paragraph>
            <paragraph eId="part-I__sec-4__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>	(c)	any instrument (including regulations) made under the <i>A New Tax System (Family Assistance) Act 1999</i> or the <i>A New Tax System (Family Assistance) (Administration) Act 1999</i>.</p>
              </content>
              <content>
                <p><b><i>home</i></b> does not include an orphanage or like institution.</p>
                <p><term refersTo="#term-information">information</term> includes <def>estimates.</def></p>
                <p><term refersTo="#term-officer">officer</term> means <def>a person performing duties, or exercising powers or functions, under or in relation to this Act and, in relation to a provision of <ref href="#part-IIIA">Part IIIA</ref>, includes: a person who has been such a person; and a person who is or has been appointed or employed by the Commonwealth and who, as a result of that appointment or employment, may acquire or has acquired information about a person under this Act; and a person who, although not appointed or employed by the Commonwealth, performs or performed services for the Commonwealth and who, as a result of performing those services, may acquire or has acquired information about a person under this Act.</def></p>

            </paragraph>
            <paragraph eId="part-I__sec-4__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>a person who has been such a person; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-I__sec-4__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>a person who is or has been appointed or employed by the Commonwealth and who, as a result of that appointment or employment, may acquire or has acquired information about a person under this Act; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-I__sec-4__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>a person who, although not appointed or employed by the Commonwealth, performs or performed services for the Commonwealth and who, as a result of performing those services, may acquire or has acquired information about a person under this Act.</p>
              </content>
              <content>
                <p><term refersTo="#term-operator">operator</term> means <def>the person or body operating, or proposing to operate, the centre.</def></p>
                <p><term refersTo="#term-place">place</term> includes <def>a proposed place.</def></p>
                <p><b><i>protected information</i></b> means:</p>
              </content>
            </paragraph>
            <paragraph eId="part-I__sec-4__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>information about a person or a child care service that is or was held in the records of the Department; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-I__sec-4__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>information that there is no information about a person or a child care service held in such records.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-I__sec-4__subsec-2">
            <num>2</num>
            <content>
              <p>For the purposes of this Act, a thing is taken to be done or required for a permitted purpose if it is done or required:</p>
            </content>
            <paragraph eId="part-I__sec-4__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>for the purposes of this Act; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-I__sec-4__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>for the purposes of a family assistance law;</p>
              </content>
            </paragraph>
          </subsection>
        </section>
        <section eId="part-I__sec-4A">
          <num>4A</num>
          <heading>Child care centres</heading>
          <subsection eId="part-I__sec-4A__subsec-1">
            <num>1</num>
            <content>
              <p>Subject to subsection (2), a child care centre is a place:</p>
            </content>
            <paragraph eId="part-I__sec-4A__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>that provides, or proposes to provide, child care for children:</p>
              </content>
            </paragraph>
            <paragraph eId="part-I__sec-4A__subsec-1__para-i">
              <num>i</num>
              <content>
                <p>all of whom are residing in their own homes; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-I__sec-4A__subsec-1__para-ii">
              <num>ii</num>
              <content>
                <p>all or the majority of whom are of pre-school age; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-I__sec-4A__subsec-1__para-iii">
              <num>iii</num>
              <content>
                <p>all or the majority of whom attend the place on a regular basis; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-I__sec-4A__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>in relation to which either of the following subparagraphs applies:</p>
              </content>
            </paragraph>
            <paragraph eId="part-I__sec-4A__subsec-1__para-i">
              <num>i</num>
              <content>
                <p>the place provides, or proposes to provide, that child care:</p>
              </content>
              <content>
                <p>(A)	for not less than 8 hours on each normal working day; and</p>
                <p>(B) 	on all normal working days in not less than 48 weeks in the year;</p>
              </content>
            </paragraph>
            <paragraph eId="part-I__sec-4A__subsec-1__para-ii">
              <num>ii</num>
              <content>
                <p>the place is a place that <role refersTo="#minister">the Minister</role> determines should be treated as a child care centre for the purposes of this Act.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-I__sec-4A__subsec-2">
            <num>2</num>
            <content>
              <p>For the purposes of <ref href="#part-IVA">Part IVA</ref>, a place is a child care centre whether or not all or the majority of the children for whom child care is provided at the place attend the place on a regular basis.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-I__sec-4B">
          <num>4B</num>
          <heading>Eligible child care centres</heading>
          <content>
            <p>		For the purposes of this Act, a child care centre is an <b><i>eligible child care centre</i></b> if:</p>
          </content>
          <paragraph eId="part-I__sec-4B__para-a">
            <num>a</num>
            <content>
              <p>the centre is operated, or proposed to be operated, by an entity that meets the requirements of columns 1 and (if applicable) 2 of an item of the following table; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-I__sec-4B__para-b">
            <num>b</num>
            <content>
              <p><role refersTo="#minister">the Minister</role> determines that the centre is an eligible child care centre for the purposes of this Act:</p>

          <heading>Guidelines for eligible child care centres</heading>
          <content>
            <p><role refersTo="#minister">The Minister</role> may, by legislative instrument, make guidelines with respect to the exercise of <role refersTo="#minister">the Minister</role>’s powers under section 4B.</p>

            <heading>Interpretation of Division 1</heading>
            <subsection eId="part-II__dvs-1__sec-5__subsec-1">
              <num>1</num>
              <content>
                <p>In this Division, unless the contrary intention appears:</p>
              </content>
              <content>
                <p><term refersTo="#term-alteration">alteration</term> includes <def>an addition to the building or improvement.</def></p>
                <p><term refersTo="#term-approved-project">approved project</term> means <def>the purchase or proposed purchase of land, or the construction or alteration or proposed construction or alteration of a building or other improvement on land, approved under <ref href="#sec-6">section 6</ref>.</def></p>
                <p><b><i>capital cost</i></b>, in relation to an approved project, means:</p>

                  <p>where the approved project is the purchase or proposed purchase of land, the sum of:</p>
                </content>

                  <p>such amount in respect of the land, not including any buildings or other improvements on the land, as <role refersTo="#minister">the Minister</role> determines;</p>

                <content>
                  <p>such amount in respect of any buildings or other improvements on the land (being buildings or improvements that <role refersTo="#minister">the Minister</role> is satisfied are used, or are to be used, for or in connexion with an eligible child care centre) as <role refersTo="#minister">the Minister</role> considers represents that part of the cost of purchasing the land that is attributable to those buildings or improvements; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-II__dvs-1__sec-5__subsec-1__para-iii">
                <num>iii</num>
                <content>
                  <p>such amount as <role refersTo="#minister">the Minister</role> is satisfied is the cost of making any alterations to any building or other improvements on the land that <role refersTo="#minister">the Minister</role> is satisfied are necessary for or in connexion with the provision of an eligible child care centre; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-II__dvs-1__sec-5__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>where the approved project is the construction or alteration of a building or other improvement on land, such amount as <role refersTo="#minister">the Minister</role> is satisfied is the cost of constructing or altering the building or other improvement.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-II__dvs-1__sec-5__subsec-2">
              <num>2</num>
              <content>
                <p>For the purposes of this Division, the cost of constructing, altering or adding to a building includes the cost of installing such fixtures (including the cost of the fixtures) as <role refersTo="#minister">the Minister</role> approves.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-II__dvs-1__sec-6">
            <num>6</num>
            <heading>Approval of projects</heading>
            <subsection eId="part-II__dvs-1__sec-6__subsec-1">
              <num>1</num>
              <content>
                <p>Subject to this section, where <role refersTo="#minister">the Minister</role> is satisfied that:</p>
              </content>
              <paragraph eId="part-II__dvs-1__sec-6__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>the operator of an eligible child care centre:</p>
                </content>
              </paragraph>
              <paragraph eId="part-II__dvs-1__sec-6__subsec-1__para-i">
                <num>i</num>
                <content>
                  <p>has purchased, or proposes to purchase, any land, including land on which buildings or other improvements are constructed; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-II__dvs-1__sec-6__subsec-1__para-ii">
                <num>ii</num>
                <content>
                  <p>has constructed or altered, or proposes to construct or alter, a building or any other improvement on any land; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-II__dvs-1__sec-6__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>the land purchased or proposed to be purchased, or the building or improvement constructed or altered or proposed to be constructed or altered, is used, or is to be used, permanently by the operator in relation to the centre;</p>
                </content>
                <content>
                  <p><role refersTo="#minister">the Minister</role> may approve, for the purposes of this Division, the purchase or proposed purchase or the construction or alteration or the proposed construction or alteration, as the case may be.</p>
                </content>
              </paragraph>
            </subsection>
          </section>
          <section eId="part-II__dvs-1__sec-7">
            <num>7</num>
            <heading>Grants for approved projects</heading>
            <subsection eId="part-II__dvs-1__sec-7__subsec-1">
              <num>1</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> may, on behalf of the Commonwealth, approve the making of a grant to the operator of an eligible child care centre of an amount not exceeding the capital cost of an approved project.</p>
              </content>
            </subsection>
          </section>
        </division>
        <division eId="part-II__dvs-2">
          <num>2</num>
          <heading>Approved equipment</heading>
          <section eId="part-II__dvs-2__sec-8">
            <num>8</num>
            <heading>Interpretation of Division 2</heading>
            <content>
              <p>In this Division, unless the contrary intention appears:</p>
              <p><term refersTo="#term-acquisition">acquisition</term> includes <def>acquisition by way of exchange or purchase or by way of taking on lease, on hire, on hire-purchase or on lease and purchase.</def></p>
              <p><term refersTo="#term-approved-equipment">approved equipment</term> means <def>equipment approved under <ref href="#sec-9">section 9</ref> or equipment included in a class of equipment approved under that section.</def></p>
              <p><b><i>cost</i></b>, in relation to the acquisition by the operator of an eligible child care centre of approved equipment, means the sum of the amounts that the Minister is satisfied is the cost of acquiring the equipment and such amount (if any) in respect of altering, adding to or installing the equipment as the Minister determines.</p>
            </content>
          </section>
          <section eId="part-II__dvs-2__sec-9">
            <num>9</num>
            <heading>Approval of equipment</heading>
            <content>
              <p><role refersTo="#minister">The Minister</role> may approve equipment or classes of equipment for the purposes of this Division.</p>
            </content>
          </section>
          <section eId="part-II__dvs-2__sec-10">
            <num>10</num>
            <heading>Grants for approved equipment</heading>
            <content>
              <p><role refersTo="#minister">The Minister</role> may, on behalf of the Commonwealth, approve the making of a grant to the operator of an eligible child care centre of an amount not exceeding the cost of the acquisition by the operator of approved equipment.</p>
            </content>
          </section>
        </division>
      </part>
      <part eId="part-III">
        <num>III</num>
        <heading>Recurrent grants</heading>
        <division eId="part-III__dvs-1">
          <num>1</num>
          <heading>Grants for new eligible child care centres</heading>
          <section eId="part-III__dvs-1__sec-12">
            <num>12</num>
            <heading>Grants in relation to establishment of new eligible child care centres</heading>
            <subsection eId="part-III__dvs-1__sec-12__subsec-1">
              <num>1</num>
              <content>
                <p>Where, at any time during the 6 weeks immediately before an eligible child care centre first begins to provide child care, a person is employed by the operator of the centre to establish it, <role refersTo="#minister">the Minister</role> may, on behalf of the Commonwealth, approve the making of a grant to the operator of an amount not exceeding the amount of the salary or wages paid to the person in respect of that period by the operator.</p>
              </content>
            </subsection>
            <subsection eId="part-III__dvs-1__sec-12__subsec-2">
              <num>2</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> may authorize the payment to the operator of an eligible child care centre of an advance or advances in respect of a grant that may become payable to the operator under subsection (1).</p>
              </content>
            </subsection>
            <subsection eId="part-III__dvs-1__sec-12__subsec-3">
              <num>3</num>
              <content>
                <p>	(3)	In this section <b><i>salary or wages</i></b> in relation to a person referred to in subsection (1), means salary or wages at the rate fixed by an award, order, determination or agreement made, or having effect under, a law of the Commonwealth, of a State or of a Territory, or if no such rate is applicable, the rate of salary or wages determined by the Minister. </p>

            </subsection>
          </section>
        </division>
      </part>
      <part eId="part-IIIA">
        <num>IIIA</num>
        <heading>Confidentiality</heading>
        <section eId="part-IIIA__sec-12J">
          <num>12J</num>
          <heading>Authorised access to and use of protected information</heading>
          <subsection eId="part-IIIA__sec-12J__subsec-1">
            <num>1</num>
            <content>
              <p>A person may obtain protected information if the information is obtained for a permitted purpose.</p>
            </content>

              <p>A person may:</p>

                <p>make a record of protected information; or</p>
              </content>

            <paragraph eId="part-IIIA__sec-12J__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>disclose protected information to any person; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-IIIA__sec-12J__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>otherwise use protected information;</p>
              </content>
              <content>
                <p>if the record, disclosure or use made of the information by the person is made:</p>
              </content>
            </paragraph>
            <paragraph eId="part-IIIA__sec-12J__subsec-2__para-d">
              <num>d</num>
              <content>
                <p>for a permitted purpose; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-IIIA__sec-12J__subsec-2__para-e">

                <p>for the purpose for which the information was disclosed to the person under <ref href="#sec-12M">section 12M</ref> or 12N.</p>

          </paragraph>

              <p>the person:</p>

              <p>is not authorised or required by or under this Act or a family assistance law; and</p>

              <p>has no other lawful authority;</p>

              <p>to obtain the information; and</p>

          </paragraph>

              <p>the person knows, or is reckless as to whether, the information is protected information.</p>

              <p>discloses to any other person; or</p>

            <p>An officer must not, except for a permitted purpose, be required:</p>
          </content>
          <paragraph eId="part-IIIA__sec-12M__para-a">
            <num>a</num>
            <content>
              <p>to produce any document in his or her possession; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-IIIA__sec-12M__para-b">
            <num>b</num>
            <content>
              <p>to disclose any matter or thing of which he or she had notice;</p>
            </content>
            <content>
              <p>by reason of the performance or exercise of his or her duties, functions or powers under this Act or a family assistance law to:</p>
            </content>
          </paragraph>
          <paragraph eId="part-IIIA__sec-12M__para-c">
            <num>c</num>
            <content>
              <p>a court; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-IIIA__sec-12M__para-d">
            <num>d</num>
            <content>
              <p>a tribunal; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-IIIA__sec-12M__para-e">
            <num>e</num>
            <content>
              <p>an authority; or</p>
            </content>
          </paragraph>

              <p>having power to require the production of documents or the answering of questions.</p>
            </content>
          </paragraph>
        </section>
        <section eId="part-IIIA__sec-12N">

          <heading>Secretary’s certificate</heading>
          <subsection eId="part-IIIA__sec-12N__subsec-1">
            <num>1</num>
            <content>
              <p>Despite sections 12L and 12M, <role refersTo="#secretary">the Secretary</role> may:</p>
            </content>
            <paragraph eId="part-IIIA__sec-12N__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>if <role refersTo="#secretary">the Secretary</role> certifies that it is necessary in the public interest to do so in a particular case or class of cases—disclose information acquired by an officer in the performance of his or her functions or duties or in the exercise of his or her powers under this Act or a family assistance law to such persons and for such purposes as <role refersTo="#secretary">the Secretary</role> determines; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-IIIA__sec-12N__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>disclose any such information to <role refersTo="#secretary">the Secretary</role> of a Department of State of the Commonwealth or to the head of an authority of the Commonwealth for the purposes of that Department or authority; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-IIIA__sec-12N__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>disclose any such information to a person who is expressly or impliedly authorised by the person to whom the information relates to obtain it.</p>

              <p>In giving certificates for the purposes of paragraph (1)(a), <role refersTo="#secretary">the Secretary</role> must act in accordance with guidelines in force under subsection 12P(1).</p>

            <num>3</num>
            <content>
              <p>In disclosing information under paragraph (1)(b), <role refersTo="#secretary">the Secretary</role> must act in accordance with guidelines in force under subsection 12P(1).</p>

          <heading>Guidelines for exercise of Secretary’s disclosure power</heading>
          <subsection eId="part-IIIA__sec-12P__subsec-1">
            <num>1</num>

              <p><role refersTo="#minister">The Minister</role>, by legislative instrument:</p>
            </content>
            <paragraph eId="part-IIIA__sec-12P__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>may make guidelines for the exercise of <role refersTo="#secretary">the Secretary</role>’s power to give certificates for the purposes of paragraph 12N(1)(a); and</p>
              </content>
            </paragraph>
            <paragraph eId="part-IIIA__sec-12P__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>may make guidelines for the exercise of <role refersTo="#secretary">the Secretary</role>’s power under paragraph 12N(1)(b).</p>

            </paragraph>
          </subsection>
          <subsection eId="part-IIIA__sec-12P__subsec-2">
            <num>2</num>
            <content>
              <p>	(2)	The guidelines must not be inconsistent with the provisions of the <i>Privacy Act 1988</i>.</p>

          </subsection>

              <p>	(3)	Before making an instrument under subsection (1), the Minister must consult the Information Commissioner in relation to matters that relate to the privacy functions (within the meaning of the <i>Australian Information Commissioner Act 2010</i>).</p>

          <heading>Offence—soliciting disclosure of protected information</heading>
          <content>
            <p>A person commits an offence if:</p>

              <p>the person solicits the disclosure of information from an officer or another person; and</p>
            </content>
          </paragraph>

              <p>the disclosure would be in contravention of this Part; and</p>

          </paragraph>

          <heading>Freedom of Information Act not affected</heading>

            <p>		The provisions of this Part that relate to the disclosure of information do not affect the operation of the <i>Freedom of Information Act 1982</i>.</p>

          <num>12U</num>
          <heading>Application of the Criminal Code</heading>
          <content>

          <heading>Interpretation</heading>

            <p>In this Part, unless the contrary intention appears:</p>
            <p><term refersTo="#term-approved-project">approved project</term> means <def>a project approved by the Minister under <ref href="#sec-13B">section 13B</ref>.</def></p>

            <p><role refersTo="#minister">The Minister</role> may approve, for the purposes of this Part, projects for the development of child care centres that are being carried out, or are proposed to be carried out, in a State or Territory.</p>

          <num>13C</num>
          <heading>Grants for projects related to the development of child care centres</heading>
          <content>
            <p><role refersTo="#minister">The Minister</role> may, on behalf of the Commonwealth, approve the making of a grant to a State or Territory, by way of financial assistance to the State or Territory, in respect of approved projects that are, or are proposed to be, carried out in the State or Territory.</p>

        <heading>Advisory committees</heading>

          <heading>Establishment of committees</heading>

                <p><role refersTo="#minister">The Minister</role> may establish a committee, to be known as the Child Care Standards Committee, which shall consist of such number of members as <role refersTo="#minister">the Minister</role> thinks fit.</p>

              <num>2</num>
              <content>
                <p>The functions of the Committee are:</p>

                <num>b</num>
                <content>
                  <p>to give advice to <role refersTo="#minister">the Minister</role> on any other matter referred to the Committee by <role refersTo="#minister">the Minister</role> in connexion with the administration of this Act.</p>

              </paragraph>
            </subsection>
          </section>
          <section eId="part-V__dvs-1__sec-15">
            <num>15</num>
            <heading>Convenor of Child Care Standards Committee</heading>
            <content>
              <p><role refersTo="#minister">The Minister</role> shall appoint one of the members of the Child Care Standards Committee to be Convenor of the Committee.</p>
            </content>
          </section>
          <section eId="part-V__dvs-1__sec-16">
            <num>16</num>
            <heading>Other committees</heading>
            <content>
              <p>In addition to the Child Care Standards Committee, <role refersTo="#minister">the Minister</role> may establish such other committees as <role refersTo="#minister">the Minister</role> thinks fit for the purposes of this Act.</p>

          </section>
        </division>

          <num>2</num>
          <heading>General</heading>
          <section eId="part-V__dvs-2__sec-17">
            <num>17</num>
            <heading>Definition of committee</heading>
            <content>
              <p>		In this Division, <b><i>committee</i></b> means a committee established under this Part.</p>
            </content>
          </section>
          <section eId="part-V__dvs-2__sec-18">
            <num>18</num>
            <heading>Appointment of members of committees</heading>
            <content>
              <p>A member of a committee shall be appointed by <role refersTo="#minister">the Minister</role> as a part-time member and holds office during <role refersTo="#minister">the Minister</role>’s pleasure.</p>
            </content>

          <section eId="part-V__dvs-2__sec-19">
            <num>19</num>
            <heading>Remuneration and allowances of members of committees</heading>
            <subsection eId="part-V__dvs-2__sec-19__subsec-1">
              <num>1</num>
              <content>
                <p>A member of a committee shall be paid such remuneration as is determined by the Remuneration Tribunal.</p>
              </content>
            </subsection>
            <subsection eId="part-V__dvs-2__sec-19__subsec-2">
              <num>2</num>
              <content>
                <p>A member of a committee shall be paid such allowances as are prescribed.</p>
              </content>
            </subsection>

                <p>	(3)	This section has effect subject to the<i> Remuneration Tribunal Act</i><i> </i><i>1973</i>. </p>

        <heading>Miscellaneous</heading>
        <section eId="part-VI__sec-20">
          <num>20</num>
          <heading>Conditions relating to grants</heading>
          <subsection eId="part-VI__sec-20__subsec-1">
            <num>1</num>
            <content>
              <p>A grant under this Act may be made upon such terms and conditions, not inconsistent with this Act, as <role refersTo="#minister">the Minister</role> thinks fit.</p>
            </content>
          </subsection>
          <subsection eId="part-VI__sec-20__subsec-2">
            <num>2</num>
            <content>
              <p>Before a grant is made under this Act, <role refersTo="#minister">the Minister</role> may require the grantee to enter into an agreement with respect to the terms and conditions upon which the grant is to be made.</p>
            </content>
          </subsection>
          <subsection eId="part-VI__sec-20__subsec-3">
            <num>3</num>
            <content>
              <p>An agreement may include provision for:</p>
            </content>
            <paragraph eId="part-VI__sec-20__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>the repayment of the whole or a part of a grant; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-VI__sec-20__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>the giving of security for:</p>
              </content>
            </paragraph>
            <paragraph eId="part-VI__sec-20__subsec-3__para-i">
              <num>i</num>
              <content>
                <p>the repayment of the whole or a part of a grant; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-VI__sec-20__subsec-3__para-ii">
              <num>ii</num>
              <content>
                <p>the payment to the Commonwealth of the amount that under the terms and conditions is taken to represent the Commonwealth’s interest in:</p>
              </content>
              <content>
                <p>(A)	land purchased (with or without buildings); and</p>
                <p>(B)	buildings constructed or altered; and</p>
                <p>(C)	equipment acquired, altered, added to or installed;</p>
                <p>as a result of the application of a grant or a grant and other money (whether or not that amount is more than the amount of the grant); and</p>
              </content>
            </paragraph>
            <paragraph eId="part-VI__sec-20__subsec-3__para-c">
              <num>c</num>
              <content>
                <p>the use and disposal of, and the recovery of, the amount that under the terms and conditions is taken to represent the Commonwealth’s interest in:</p>
              </content>
            </paragraph>
            <paragraph eId="part-VI__sec-20__subsec-3__para-i">
              <num>i</num>
              <content>
                <p>land purchased (with or without buildings); and</p>
              </content>
            </paragraph>

          </subsection>
          <subsection eId="part-VI__sec-20__subsec-5">
            <num>5</num>
            <content>
              <p>Where a grant under this Act has, in accordance with this section, been made on terms and conditions, <role refersTo="#minister">the Minister</role>, with the agreement of the grantee, may, by writing, vary those terms and conditions and, where there is an agreement under subsection (2) with respect to the terms and conditions so varied, that agreement shall be taken to be varied accordingly.</p>
            </content>
          </subsection>
          <subsection eId="part-VI__sec-20__subsec-6">
            <num>6</num>
            <content>
              <p>	(6)	In this section, <b><i>grant</i></b> includes an advance on account of grant under subsection 12(2). </p>
            </content>
          </subsection>
        </section>
        <section eId="part-VI__sec-20A">
          <num>20A</num>
          <heading>Agreements may be entered into with transferees of land etc.</heading>
          <subsection eId="part-VI__sec-20A__subsec-1">
            <num>1</num>
            <content>
              <p>If:</p>
            </content>
            <paragraph eId="part-VI__sec-20A__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>either of the following subparagraphs applies:</p>
              </content>
            </paragraph>
            <paragraph eId="part-VI__sec-20A__subsec-1__para-i">
              <num>i</num>
              <content>
                <p>a grant under <ref href="#part-II">Part II</ref> has been made to the operator of an eligible child care centre on terms and conditions with respect to any land, building or equipment;</p>
              </content>
            </paragraph>
            <paragraph eId="part-VI__sec-20A__subsec-1__para-ii">
              <num>ii</num>
              <content>
                <p>the operator of an eligible child care centre has entered into an agreement under this section under which it is required to comply with terms and conditions with respect to any land, building or equipment; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-VI__sec-20A__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>the operator has transferred, or proposes to transfer, the whole or a part of its interest in the land, building or equipment to another person or body;</p>
              </content>
              <content>
                <p><role refersTo="#minister">the Minister</role> may enter into an agreement with the other person or body under which the other person or body is required to comply, or will, on the transfer being effected, be required to comply, with terms and conditions (whether with respect to the land, building, equipment or otherwise).</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-VI__sec-20A__subsec-2">
            <num>2</num>
            <content>
              <p>Where an agreement under subsection (1) between <role refersTo="#minister">the Minister</role> and a person or body is in force, <role refersTo="#minister">the Minister</role> may vary the agreement with the consent of the person or body.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-VI__sec-20B">
          <num>20B</num>
          <heading>Overpayments</heading>
          <subsection eId="part-VI__sec-20B__subsec-1">
            <num>1</num>
            <content>
              <p>	(1)	The payment of an amount to the operator of an eligible child care centre under this Act is, in addition to any conditions imposed under <b><i>recoverable amount</i></b>) has been paid to the operator by way of grant or advance on account of grant under this Act that should not have been paid, the operator will, on demand by the Minister by written notice given to the operator, repay to the Commonwealth the recoverable amount or that part of the recoverable amount specified in the notice. <ref href="#sec-20">section 20</ref>, subject to the condition that if, for any reason, an amount (in this subsection referred to as the </p>
            </content>
          </subsection>
          <subsection eId="part-VI__sec-20B__subsec-2">
            <num>2</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> may deduct an amount repayable by the operator of an eligible child care centre under subsection (1) or part of such an amount from an amount (including an advance) payable to the operator under this Act.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-VI__sec-21">
          <num>21</num>
          <heading>Delegations by the Minister</heading>
          <subsection eId="part-VI__sec-21__subsec-1">
            <num>1</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> may, by signed instrument, delegate any or all of <role refersTo="#minister">the Minister</role>’s powers under this Act to a person holding or performing the duties of an office in the Department.</p>
            </content>
          </subsection>
          <subsection eId="part-VI__sec-21__subsec-5">
            <num>5</num>
            <content>
              <p>In subsection (1), a reference to this Act includes a reference to an agreement entered into under this Act.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-VI__sec-22">
          <num>22</num>
          <heading>Approvals and determinations to be in writing</heading>
          <content>
            <p>An approval or determination under this Act must be made in writing.</p>
          </content>
        </section>
        <section eId="part-VI__sec-22A">
          <num>22A</num>
          <heading>Exercise of powers in Minister’s discretion</heading>
          <content>
            <p>		Where a provision of this Act provides that the Minister may do a particular act or thing, and the word <b><i>may</i></b> is used, the act or thing may be done at the Minister’s discretion.</p>
          </content>
        </section>
        <section eId="part-VI__sec-23">
          <num>23</num>
          <heading>Manner of payment of grants</heading>
          <content>
            <p>A grant under this Act shall be made at such time as is, or by such instalments and at such times as are, determined by agreement between <role refersTo="#minister">the Minister</role> and the operator of the eligible child care centre concerned or, in the absence of such an agreement, by <role refersTo="#minister">the Minister</role>.</p>
          </content>
        </section>
        <section eId="part-VI__sec-24">
          <num>24</num>
          <heading>Money to be appropriated</heading>
          <content>
            <p>Grants under this Act and advances on account of grants under subsection 12(2) are payable out of money appropriated by the Parliament for the purposes of this Act.</p>
          </content>
        </section>
        <section eId="part-VI__sec-25">
          <num>25</num>
          <heading>Regulations</heading>
          <content>
            <p>The Governor-General may make regulations, not inconsistent with this Act, prescribing all matters that are required or permitted by this Act to be prescribed or are necessary or convenient to be prescribed for carrying out or giving effect to this Act.</p>
