        <heading>Short title</heading>
        <content>
          <p>		This Act may be cited as the <i>Passenger Movement Charge Collection Act 1978</i>.</p>
        </content>
      </section>
      <section eId="sec-2">
        <num>2</num>
        <heading>Commencement</heading>
        <content>
          <p>		This Act shall come into operation on the day on which the <i>Departure Tax Act 1978 </i>comes into operation.</p>
        </content>
      </section>
      <section eId="sec-3">
        <num>3</num>
        <heading>Interpretation</heading>
        <content>
          <p>In this Act, unless the contrary intention appears:</p>
          <p><term refersTo="#term-aircraft">aircraft</term> means <def>any machine or craft that can derive support in the atmosphere from the reactions of the air.</def></p>
          <p><b><i>authorised officer</i></b><i> </i>means:</p>
        </content>
        <paragraph eId="sec-3__para-a">
          <num>a</num>
          <content>
            <p>an officer of Customs; or</p>
          </content>
        </paragraph>
        <paragraph eId="sec-3__para-b">
          <num>b</num>
          <content>
            <p>any other person authorised in writing by the Comptroller-General of Customs to be an authorised officer for the purposes of this Act.</p>
          </content>
          <content>
            <p><term refersTo="#term-charge">charge</term> means <def>the charge, called passenger movement charge, imposed by <ref href="">the Passenger Movement Charge Act 1978</ref>.</def></p>
            <p><term refersTo="#term-charge-stamp">charge stamp</term> means <def>a charge stamp issued under this Act.</def></p>
            <p><b><i>child</i></b>: without limiting who is a child of a person for the purposes of this Act, each of the following who is under 18 years old is the <b><i>child </i></b>of a person:</p>
          </content>
        </paragraph>
        <paragraph eId="sec-3__para-a">
          <num>a</num>
          <content>
            <p>an adopted child, stepchild or exnuptial child of the person;</p>
          </content>
        </paragraph>
        <paragraph eId="sec-3__para-b">
          <num>b</num>
          <content>
            <p>	(b)	someone who is a child of the person within the meaning of the <i>Family Law Act 1975</i>.</p>
          </content>
          <content>
            <p><term refersTo="#term-comptroller-general-of-customs">Comptroller-General of Customs</term> means <def>the person who is the Comptroller-General of Customs in accordance with subsection 11(3) or 14(2) of <ref href="">the Australian Border Force Act 2015</ref>.</def></p>
            <p><term refersTo="#term-crew-member">crew member</term> includes <def>the person in charge of the aircraft or ship.</def></p>
            <p><term refersTo="#term-de-facto-partner">de facto partner</term> has the meaning given by <def><ref href="">the Acts Interpretation Act 1901</ref>.</def></p>
            <p><term refersTo="#term-emergency-passenger">emergency passenger</term> means <def>a person: who arrives in  as a passenger on an aircraft or a ship only because of: the illness of a person (including that person) on board the aircraft or ship; or bad weather conditions; or another kind of emergency; and who departs from  as soon as it is reasonably practicable for the person to do so.</def></p>
          </content>
        </paragraph>
        <paragraph eId="sec-3__para-a">
          <num>a</num>
          <content>
            <p>who arrives in  as a passenger on an aircraft or a ship only because of:</p>
          </content>
        </paragraph>
        <paragraph eId="sec-3__para-i">
          <num>i</num>
          <content>
            <p>the illness of a person (including that person) on board the aircraft or ship; or</p>
          </content>
        </paragraph>
        <paragraph eId="sec-3__para-ii">
          <num>ii</num>
          <content>
            <p>bad weather conditions; or</p>
          </content>
        </paragraph>
        <paragraph eId="sec-3__para-iii">
          <num>iii</num>
          <content>
            <p>another kind of emergency; and</p>
          </content>
        </paragraph>
        <paragraph eId="sec-3__para-b">
          <num>b</num>
          <content>
            <p>who departs from  as soon as it is reasonably practicable for the person to do so.</p>
          </content>
          <content>
            <p><term refersTo="#term-exemption-stamp">exemption stamp</term> means <def>a stamp issued under this Act for denoting exemption from liability to charge.</def></p>
            <p><b><i>external Territory</i></b> does not include:</p>
          </content>
        </paragraph>
        <paragraph eId="sec-3__para-aa">
          <num>aa</num>
          <content>
            <p>Norfolk Island; or</p>
          </content>
        </paragraph>
        <paragraph eId="sec-3__para-a">
          <num>a</num>
          <content>
            <p>the ; or</p>
          </content>
        </paragraph>
        <paragraph eId="sec-3__para-b">
          <num>b</num>
          <content>
            <p>the  (Keeling) .</p>
          </content>
          <content>
            <p><term refersTo="#term-officer-of-customs">officer of Customs</term> has the same meaning as <def>in subsection 4(1) of <ref href="">the Customs Act 1901</ref>.</def></p>
            <p><b><i>positioning crew member</i></b><i> </i>means:</p>
          </content>
        </paragraph>
        <paragraph eId="sec-3__para-a">
          <num>a</num>
          <content>
            <p>a passenger on an aircraft whose departure from Australia is undertaken for the purpose of later becoming a crew member of that aircraft, another aircraft or a ship; or</p>
          </content>
        </paragraph>
        <paragraph eId="sec-3__para-b">
          <num>b</num>
          <content>
            <p>a passenger on a ship whose departure from  is undertaken for the purpose of later becoming a crew member of that ship or another ship.</p>
          </content>
          <content>
            <p><term refersTo="#term-refund">refund</term> means <def>refund of charge under this Act.</def></p>
            <p><term refersTo="#term-ship">ship</term> means <def>any vessel used in navigation, other than air navigation.</def></p>
            <p><term refersTo="#term-spouse-of-a-person">spouse of a person</term> includes <def>a de facto partner of the person.</def></p>
            <p><b><i>stepchild</i></b>: without limiting who is a stepchild of a person for the purposes of this Act, someone is the <b><i>stepchild </i></b>of a person if he or she would be the person’s stepchild except that the person is not legally married to the person’s de facto partner.</p>
            <p><term refersTo="#term-torres-strait-treaty">Torres Strait Treaty</term> means <def>the Treaty between  and the Independent State of Papua New Guinea: that was signed at  on <date date="1978-12-18">18 December 1978</date>; and 	(b)	the text of which is set out in the Schedule to the <i> Fisheries Act 1984.</i></def></p>

          <num>a</num>
          <content>
            <p>that was signed at  on <date date="1978-12-18">18 December 1978</date>; and</p>
          </content>
        </paragraph>
        <paragraph eId="sec-3__para-b">
          <num>b</num>
          <content>

            <p><term refersTo="#term-traditional-activities">traditional activities</term> has the same meaning as <def>in the Torres Strait Treaty.</def></p>
            <p><term refersTo="#term-traditional-inhabitants">traditional inhabitants</term> has the same meaning as <def>in <ref class="unresolved">the  Fisheries Act 1984</ref>.</def></p>
            <p><term refersTo="#term-transit-passenger">transit passenger</term> means <def>a person who arrives in  from a place outside  for the purpose only of a journey from that place to a place outside  and who departs from : in the case of a person who arrives in  on an aircraft and who departs from  on that aircraft or another aircraft: 	(i)	without being immigration cleared <i>Migration Act 1958</i>; or<ref href="#sec-172">within the meaning of section 172</ref> of the  if the person is so immigration cleared to enter Australia for reasons beyond the person’s control—as soon as it is reasonably practicable for the person to do so after those reasons no longer exist; or in any other case: less than 48 hours after the person arrived in ; or if the person is prevented from departing from  less than 48 hours after the person arrived in  for reasons beyond the person’s control—as soon as it is reasonably practicable for the person to do so after those reasons no longer exist.</def></p>

        </paragraph>
        <paragraph eId="sec-3__para-a">
          <num>a</num>
          <content>
            <p>in the case of a person who arrives in  on an aircraft and who departs from  on that aircraft or another aircraft:</p>
          </content>
        </paragraph>
        <paragraph eId="sec-3__para-i">
          <num>i</num>
          <content>
            <p>	(i)	without being immigration cleared <i>Migration Act 1958</i>; or<ref href="#sec-172">within the meaning of section 172</ref> of the </p>

      </section>
      <section eId="sec-4">
        <num>4</num>
        <heading>Act binds the Crown</heading>
        <content>
          <p>This Act binds the Crown in right of the Commonwealth, of each of the States, of the Australian Capital Territory and of the Northern Territory.</p>
        </content>
      </section>
      <section eId="sec-4A">
        <num>4A</num>
        <heading>Application of the Criminal Code</heading>
        <content>
          <p>		Chapter 2 of the <i>Criminal Code</i> applies to all offences against this Act.</p>
        </content>

      </section>
      <section eId="sec-5">
        <num>5</num>
        <heading>Persons exempt from passenger movement charge</heading>
        <content>
          <p>A person departing from  does not have to pay the charge in relation to his or her departure if, at the time of his or her departure, the person:</p>
        </content>
        <paragraph eId="sec-5__para-a">
          <num>a</num>
          <content>
            <p>is under 12 years old; or</p>
          </content>
        </paragraph>
        <paragraph eId="sec-5__para-b">
          <num>b</num>
          <content>
            <p>is a traditional inhabitant whose departure is undertaken in connection with the performance of traditional activities; or</p>
          </content>
        </paragraph>
        <paragraph eId="sec-5__para-c">
          <num>c</num>
          <content>
            <p>is a member of the defence force of a country other than  whose departure is undertaken:</p>
          </content>
        </paragraph>
        <paragraph eId="sec-5__para-i">
          <num>i</num>
          <content>
            <p>in the course of his or her duty as such a member; and</p>
          </content>
        </paragraph>
        <paragraph eId="sec-5__para-ii">
          <num>ii</num>
          <content>
            <p>on an aircraft or a ship of a defence force; or</p>
          </content>
        </paragraph>
        <paragraph eId="sec-5__para-d">
          <num>d</num>
          <content>
            <p>is a spouse or a child:</p>
          </content>
        </paragraph>
        <paragraph eId="sec-5__para-i">
          <num>i</num>
          <content>
            <p>of a member of the defence force of a country other than  to whom paragraph (c) applies; and</p>
          </content>
        </paragraph>
        <paragraph eId="sec-5__para-ii">
          <num>ii</num>
          <content>
            <p>whose departure from  is undertaken in the company of the member; or</p>
          </content>
        </paragraph>
        <paragraph eId="sec-5__para-e">
          <num>e</num>
          <content>
            <p>is a crew member of an aircraft or a ship whose departure from  is on the aircraft or ship; or</p>
          </content>
        </paragraph>
        <paragraph eId="sec-5__para-f">
          <num>f</num>
          <content>
            <p>is a spouse or a child:</p>
          </content>
        </paragraph>
        <paragraph eId="sec-5__para-i">
          <num>i</num>
          <content>
            <p>of a crew member of a ship to whom paragraph (e) applies; and</p>
          </content>
        </paragraph>
        <paragraph eId="sec-5__para-ii">
          <num>ii</num>
          <content>
            <p>whose departure from  is undertaken in the company of the member; or</p>
          </content>
        </paragraph>
        <paragraph eId="sec-5__para-g">
          <num>g</num>
          <content>
            <p>is a positioning crew member; or</p>
          </content>
        </paragraph>
        <paragraph eId="sec-5__para-h">
          <num>h</num>
          <content>
            <p>is a transit passenger; or</p>
          </content>
        </paragraph>
        <paragraph eId="sec-5__para-i">
          <num>i</num>
          <content>
            <p>is an emergency passenger; or</p>
          </content>
        </paragraph>
        <paragraph eId="sec-5__para-j">
          <num>j</num>
          <content>
            <p>is in the course of a journey that has involved a previous departure by the person from  by ship in respect of which the person paid the charge; or</p>
          </content>
        </paragraph>
        <paragraph eId="sec-5__para-k">
          <num>k</num>
          <content>
            <p>does not have to pay the charge because of the operation of:</p>
          </content>
        </paragraph>
        <paragraph eId="sec-5__para-i">
          <num>i</num>
          <content>
            <p>	(i)	the <i>Consular Privileges and Immunities Act 1972</i>; or</p>
          </content>
        </paragraph>
        <paragraph eId="sec-5__para-ii">
          <num>ii</num>
          <content>
            <p>	(ii)	the <i>Diplomatic Privileges and Immunities Act 1967</i>; or</p>
          </content>
        </paragraph>
        <paragraph eId="sec-5__para-iii">
          <num>iii</num>
          <content>
            <p>	(iii)	the <i>International Organisations (Privileges and Immunities) Act 1963</i>; or</p>
          </content>
        </paragraph>
        <paragraph eId="sec-5__para-iv">
          <num>iv</num>
          <content>
            <p>	(iv)	the <i>Overseas Missions (Privileges and Immunities) Act 1995</i>; or</p>
          </content>
        </paragraph>
        <paragraph eId="sec-5__para-l">
          <num>l</num>
          <content>
            <p>	(l)	is a passenger whose departure from Australia is undertaken for the purpose of travelling to the Greater Sunrise special regime area (within the meaning of the <i>Seas and Submerged Lands Act 1973</i>) in connection with Petroleum Activities (within the meaning of the Treaty between Australia and the Democratic Republic of Timor-Leste Establishing their Maritime Boundaries in the Timor Sea done at New York on 6 March 2018, as in force from time to time); or</p>
          </content>
        </paragraph>
        <paragraph eId="sec-5__para-m">
          <num>m</num>
          <content>
            <p>	(m)	is a protective service officer (as defined in the <i>Australian Federal Police Act 1979</i>) on an aircraft for the purpose of enhancing the security of the aircraft.</p>
          </content>

      <section eId="sec-6">
        <num>6</num>
        <heading>Liability to pay passenger movement charge</heading>
        <subsection eId="sec-6__subsec-1">
          <num>1</num>
          <content>
            <p>Charge in respect of the departure of a person from  is payable by the person before the departure.</p>
          </content>
        </subsection>
        <subsection eId="sec-6__subsec-2">
          <num>2</num>
          <content>
            <p>Where charge in respect of the departure of a person from  is not paid before the departure, the person commits an offence punishable upon conviction by a fine not exceeding <quantity refersTo="#penaltyUnit">1 penalty unit</quantity>.</p>
          </content>
        </subsection>
        <subsection eId="sec-6__subsec-2A">
          <num>2A</num>
          <content>
            <p>Subsection (2) is an offence of strict liability.</p>
          </content>

            <p>Where a person is convicted of an offence against subsection (2), the court may, in addition to imposing a penalty under that subsection, order the person to pay to the Commonwealth the amount of charge not paid by the person.</p>
          </content>
        </subsection>
      </section>
      <section eId="sec-7">
        <num>7</num>
        <heading>Powers of authorised officers</heading>
        <content>
          <p>An authorised officer may, for the purpose of ascertaining whether charge has been or will be paid in respect of the departure from Australia of a person who, in the opinion of the authorised officer, is about to depart from Australia for another country or for an external Territory, require that person, or any other person who may, in the opinion of the authorised officer, have information with respect to the matter, to answer questions or produce documents to him or her, or both.</p>
        </content>
      </section>
      <section eId="sec-8">
        <num>8</num>
        <heading>Offences</heading>
        <subsection eId="sec-8__subsec-1">
          <num>1</num>
          <content>
            <p>A person shall not fail to answer a question or produce a document when required to do so in pursuance of <ref href="#sec-7">section 7</ref>.</p>
          </content>

        </subsection>
        <subsection eId="sec-8__subsec-1A">

            <p>A person shall not assault or threaten an authorised officer acting in the performance of his or her functions or the exercise of his or her powers under this Act.</p>
          </content>
          <hcontainer name="penalty">

              <p>Penalty:	<quantity refersTo="#penaltyUnit">10 penalty units</quantity> or <quantity refersTo="#custodialSentence">imprisonment for 6 months</quantity>, or both.</p>
            </content>
          </hcontainer>
        </subsection>
        <subsection eId="sec-8__subsec-5">
          <num>5</num>
          <content>
            <p>For the purposes of an offence against subsection (3) or (4), strict liability applies to the following physical elements of circumstance of the offence:</p>
          </content>
          <paragraph eId="sec-8__subsec-5__para-a">
            <num>a</num>
            <content>
              <p>that the person obstructed or hindered is an authorised officer;</p>
            </content>
          </paragraph>
          <paragraph eId="sec-8__subsec-5__para-b">
            <num>b</num>
            <content>
              <p>that the authorised officer is acting in the performance of his or her functions or the exercise of his or her powers under this Act.</p>
            </content>

        <num>9</num>
        <heading>Refunds of passenger movement charge</heading>
        <subsection eId="sec-9__subsec-1">
          <num>1</num>
          <content>
            <p>A person is entitled to a refund of charge paid by the person if:</p>
          </content>
          <paragraph eId="sec-9__subsec-1__para-a">
            <num>a</num>
            <content>
              <p>the departure in respect of which the charge was paid does not take place;</p>
            </content>
          </paragraph>
          <paragraph eId="sec-9__subsec-1__para-b">
            <num>b</num>
            <content>
              <p>the departure in respect of which the charge was paid takes place, but the person returns to  without having entered another country;</p>
            </content>
          </paragraph>
          <paragraph eId="sec-9__subsec-1__para-c">
            <num>c</num>
            <content>
              <p>by virtue of <ref href="#sec-5">section 5</ref>, charge was not payable in respect of the departure in respect of which the charge was paid; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-9__subsec-1__para-d">
            <num>d</num>
            <content>
              <p>the person is entitled to a refund under the regulations.</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-9__subsec-2">
          <num>2</num>
          <content>
            <p>If an authorised officer, by instrument in writing, so directs, a refund to which a person is entitled by virtue of subsection (1) shall be applied in discharge of the liability of the person for charge payable by the person in respect of a departure specified in the instrument, and a refund that is so applied shall be deemed to have been paid to the person.</p>
          </content>
        </subsection>
        <subsection eId="sec-9__subsec-3">
          <num>3</num>
          <content>
            <p>A person shall not:</p>
          </content>
          <paragraph eId="sec-9__subsec-3__para-a">
            <num>a</num>
            <content>
              <p>obtain a refund that is not payable;</p>
            </content>
          </paragraph>
          <paragraph eId="sec-9__subsec-3__para-b">
            <num>b</num>
            <content>
              <p>make a statement, in or in connection with a claim for a refund, reckless as to the fact that the statement is false or misleading in a material particular; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-9__subsec-3__para-c">
            <num>c</num>
            <content>
              <p>present a document, in connection with an application for a refund, reckless as to the fact that the document is false or misleading in a material particular.</p>
            </content>
            <hcontainer name="penalty">
              <content>
                <p>Penalty:	<quantity refersTo="#penaltyUnit">5 penalty units</quantity>.</p>
              </content>
            </hcontainer>
          </paragraph>
        </subsection>
        <subsection eId="sec-9__subsec-4">
          <num>4</num>
          <content>
            <p>Where a person is convicted of an offence against subsection (3), the court may, in addition to imposing a penalty under that subsection, order the person to repay to the Commonwealth the amount of any refund incorrectly paid to the person.</p>
          </content>
        </subsection>
      </section>
      <section eId="sec-10">
        <num>10</num>
        <heading>Special arrangements for payment of passenger movement charge</heading>
        <subsection eId="sec-10__subsec-1">
          <num>1</num>
          <content>
            <p><role refersTo="#minister">The Minister</role> may make an arrangement with a person under which the person agrees to pay to the Commonwealth, in the manner provided in the arrangement, an amount equal to any charge that may become payable by any person to whom the arrangement applies.</p>
          </content>
        </subsection>
        <subsection eId="sec-10__subsec-2">
          <num>2</num>
          <content>
            <p>Where an arrangement under subsection (1) applies to a person who departs from  for another country, the person shall, for the purposes of this Act, be deemed to have paid any charge payable in respect of that departure.</p>
          </content>
        </subsection>
        <subsection eId="sec-10__subsec-3">
          <num>3</num>
          <content>
            <p>An amount payable by a person to the Commonwealth under an arrangement under subsection (1) may be recovered by the Commonwealth by action against the person in a court of competent jurisdiction.</p>
          </content>
        </subsection>
        <subsection eId="sec-10__subsec-4">
          <num>4</num>
          <content>
            <p>Despite anything in this section, the Minister must not make an arrangement under this section that is to apply in respect of any person departing from  for another country on an aircraft before <date date="1995-07-01">1 July 1995</date>.</p>
          </content>
        </subsection>
      </section>
      <section eId="sec-11">
        <num>11</num>
        <heading>Charge stamps and exemption stamps</heading>
        <subsection eId="sec-11__subsec-1">
          <num>1</num>
          <content>
            <p>The regulations may make provision for and in relation to the payment of charge by the production to authorised officers or such other officers as are prescribed of charge stamps by or on behalf of persons liable to pay charge and, in particular, without limiting the generality of the foregoing, may make provision for and in relation to:</p>
          </content>
          <paragraph eId="sec-11__subsec-1__para-a">
            <num>a</num>
            <content>
              <p>the issue of charge stamps by the Commonwealth;</p>
            </content>
          </paragraph>
          <paragraph eId="sec-11__subsec-1__para-aa">
            <num>aa</num>
            <content>
              <p>the supply (whether by way of sale or otherwise) of charge stamps by the Commonwealth to approved agents;</p>
            </content>
          </paragraph>
          <paragraph eId="sec-11__subsec-1__para-ab">
            <num>ab</num>
            <content>
              <p>the terms and conditions upon which charge stamps may be supplied by the Commonwealth to approved agents;</p>
            </content>
          </paragraph>
          <paragraph eId="sec-11__subsec-1__para-ac">
            <num>ac</num>
            <content>
              <p>the sale of charge stamps by approved agents;</p>
            </content>
          </paragraph>
          <paragraph eId="sec-11__subsec-1__para-ad">
            <num>ad</num>
            <content>
              <p>the terms and conditions upon which charge stamps may be sold by approved agents;</p>
            </content>
          </paragraph>
          <paragraph eId="sec-11__subsec-1__para-b">
            <num>b</num>
            <content>
              <p>refunds, by the Commonwealth or by approved agents specified in the regulations, of amounts paid for the purchase of charge stamps that are not produced for the purpose of payment of charge or in respect of which a refund is otherwise payable under the regulations; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-11__subsec-1__para-c">
            <num>c</num>
            <content>
              <p>the reimbursement of approved agents who pay refunds in accordance with regulations made for the purposes of paragraph (b).</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-11__subsec-2">
          <num>2</num>
          <content>
            <p>	(2)	The regulations may make provision for and in relation to the issue by the Commonwealth of stamps (in this subsection referred to as <b><i>exemption stamps</i></b>) to or in respect of persons in respect of the departure of whom from Australia charge would be payable but for the operation of section 5 and, in particular, without limiting the generality of the foregoing, may make provision for and in relation to the production to authorised officers or such other officers as are prescribed of exemption stamps by or on behalf of such persons.</p>
          </content>
        </subsection>
        <subsection eId="sec-11__subsec-3">
          <num>3</num>
          <content>
            <p>Without limiting the generality of subsection (2), the regulations may make provision for and in relation to:</p>
          </content>
          <paragraph eId="sec-11__subsec-3__para-a">
            <num>a</num>
            <content>
              <p>the supply of exemption stamps by the Commonwealth to approved agents;</p>
            </content>
          </paragraph>
          <paragraph eId="sec-11__subsec-3__para-b">
            <num>b</num>
            <content>
              <p>the terms and conditions upon which exemption stamps may be supplied by the Commonwealth to approved agents;</p>
            </content>
          </paragraph>
          <paragraph eId="sec-11__subsec-3__para-c">
            <num>c</num>
            <content>
              <p>the supply of exemption stamps by approved agents; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-11__subsec-3__para-d">
            <num>d</num>
            <content>
              <p>the terms and conditions upon which exemption stamps may be supplied by approved agents.</p>
            </content>
          </paragraph>
        </subsection>
      </section>
      <section eId="sec-12">
        <num>12</num>
        <heading>Recovery of passenger movement charge</heading>
        <content>
          <p>Charge that a person has become liable to pay and has not paid is a debt due to the Commonwealth by the person by whom the charge is payable.</p>
        </content>
      </section>
      <section eId="sec-13">
        <num>13</num>
        <heading>Averment</heading>
        <subsection eId="sec-13__subsec-1">
          <num>1</num>
          <content>
            <p>In any prosecution for an offence against subsection 6(2) or in any proceedings for the recovery of charge, a statement or averment of the prosecutor or plaintiff in the information, complaint, claim or declaration is prima facie evidence of the matter so stated or averred.</p>
          </content>
        </subsection>
        <subsection eId="sec-13__subsec-2">
          <num>2</num>
          <content>
            <p>This section shall apply to any matter so averred although:</p>
          </content>
          <paragraph eId="sec-13__subsec-2__para-a">
            <num>a</num>
            <content>
              <p>evidence in support or rebuttal of the matter averred or any other matter is given; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-13__subsec-2__para-b">
            <num>b</num>
            <content>
              <p>the matter averred is a mixed question of law and fact, but in that case the averment shall be prima facie evidence of the fact only.</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-13__subsec-3">
          <num>3</num>
          <content>
            <p>Any evidence given in support or rebuttal of a matter so averred shall be considered on its merits, and the credibility and probative value of such evidence shall be neither increased nor diminished by reason of this section.</p>
          </content>
        </subsection>
        <subsection eId="sec-13__subsec-4">
          <num>4</num>
          <content>
            <p>This section shall not lessen or affect any onus of proof otherwise falling on the defendant.</p>
          </content>
        </subsection>
      </section>
      <section eId="sec-14">
        <num>14</num>
        <heading>Delegation</heading>
        <subsection eId="sec-14__subsec-1">
          <num>1</num>
          <content>
            <p><role refersTo="#minister">The Minister</role> may, either generally or as otherwise provided by the instrument of delegation, by instrument in writing, delegate to an officer of the Department any of his or her powers under this Act, other than this power of delegation.</p>
          </content>
        </subsection>
        <subsection eId="sec-14__subsec-2">
          <num>2</num>
          <content>
            <p>A power so delegated, when exercised by the delegate, shall, for the purposes of this Act, be deemed to have been exercised by <role refersTo="#minister">the Minister</role>.</p>
          </content>
        </subsection>
        <subsection eId="sec-14__subsec-3">
          <num>3</num>
          <content>
            <p>A delegation under this section does not prevent the exercise of a power by <role refersTo="#minister">the Minister</role>.</p>
          </content>
        </subsection>

        <heading>Regulations</heading>
        <subsection eId="sec-15__subsec-1">
          <num>1</num>
          <content>
            <p>The Governor-General may make regulations, not inconsistent with this Act, prescribing all matters required or permitted by this Act to be prescribed or necessary or convenient to be prescribed for carrying out or giving effect to this Act, and, in particular:</p>
          </content>
          <paragraph eId="sec-15__subsec-1__para-a">
            <num>a</num>
            <content>
              <p>making provision for and in relation to claims for refunds, the allowance or payment of refunds and the recovery of refunds paid incorrectly;</p>
            </content>
          </paragraph>
          <paragraph eId="sec-15__subsec-1__para-aa">
            <num>aa</num>
            <content>
              <p>making provision for and in relation to the appointment of bodies or persons as approved agents; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-15__subsec-1__para-b">
            <num>b</num>
            <content>
              <p>prescribing penalties not exceeding <quantity refersTo="#penaltyUnit">5 penalty units</quantity> for offences against the regulations.</p>

          </paragraph>
        </subsection>
        <subsection eId="sec-15__subsec-2">
          <num>2</num>
          <content>
            <p>The regulations may make provision for and in relation to the following:</p>
          </content>
          <paragraph eId="sec-15__subsec-2__para-a">
            <num>a</num>
            <content>
              <p>the charging and recovery of fees in respect of:</p>
            </content>
          </paragraph>
          <paragraph eId="sec-15__subsec-2__para-i">
            <num>i</num>
            <content>
              <p>the payment of charge; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-15__subsec-2__para-ii">
            <num>ii</num>
            <content>
              <p>the payment of an amount to the Commonwealth under an arrangement under subsection 10(1);</p>
            </content>
          </paragraph>
          <paragraph eId="sec-15__subsec-2__para-b">
            <num>b</num>
            <content>
              <p>the way in which such fees are to be paid;</p>
            </content>
          </paragraph>
          <paragraph eId="sec-15__subsec-2__para-c">
            <num>c</num>

              <p>the refund of such fees.</p>

                <b>Editorial changes</b>
              </p>
              <p>The <i>Legislation Act 2003</i> authorises First Parliamentary Counsel to make editorial and presentational changes to a compiled law in preparing a compilation of the law for registration. The changes must not change the effect of the law. Editorial changes take effect from the compilation registration date.</p>
              <p>If the compilation includes editorial changes, the endnotes include a brief outline of the changes in general terms. Full details of any changes can be obtained from the Office of Parliamentary Counsel.</p>
              <p>
                <b>Misdescribed amendments</b>
              </p>
              <p>A misdescribed amendment is an amendment that does not accurately describe the amendment to be made. If, despite the misdescription, the amendment can be given effect as intended, the amendment is incorporated into the compiled law and the abbreviation “(md)” added to the details of the amendment included in the amendment history.</p>
              <p>If a misdescribed amendment cannot be given effect as intended, the abbreviation “(md not incorp)” is added to the details of the amendment included in the amendment history.</p>
