          <heading>Short title</heading>
          <content>
            <p>		This Act may be cited as the <i>High Court of Australia Act 1979</i>.</p>
          </content>
        </section>
        <section eId="part-I__sec-2">
          <num>2</num>
          <heading>Commencement</heading>
          <content>
            <p>This Act shall come into operation on a date to be fixed by Proclamation.</p>
          </content>
        </section>
        <section eId="part-I__sec-3">
          <num>3</num>
          <heading>Repeal</heading>
          <content>
            <p>The following Acts are repealed:</p>
            <p><i>High Court Procedure Act 1903</i>;</p>
            <p><i>High Court Procedure Amendment Act 1903</i>;</p>
            <p><i>High Court Procedure Act 1915</i>;</p>
            <p><i>High Court Procedure Act 1921</i>;</p>
            <p><i>High Court Procedure Act 1925</i>;</p>
            <p><i>High Court Procedure Act 1933</i>.</p>

          <heading>Interpretation</heading>
          <subsection eId="part-I__sec-4__subsec-1">
            <num>1</num>
            <content>
              <p>In this Act, unless the contrary intention appears:</p>
            </content>
            <intro>
              <p><term refersTo="#term-adi-authorised-deposit-taking-institution">ADI (authorised deposit-taking institution)</term> means:</p>
            </intro>
            <paragraph eId="part-I__sec-4__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>the Reserve Bank of Australia; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-I__sec-4__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>	(b)	a body corporate that is an ADI for the purposes of the <i>Banking Act 1959</i> and that is approved in writing for the purposes of the provision in which the expression occurs:</p>
              </content>
            </paragraph>
            <paragraph eId="part-I__sec-4__subsec-1__para-i">
              <num>i</num>
              <content>
                <p>by the Treasurer; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-I__sec-4__subsec-1__para-ii">
              <num>ii</num>
              <content>
                <p>by a person authorised in writing by the Treasurer to give the approval; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-I__sec-4__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>any other bank approved in writing for the purposes of the provision in which the expression occurs:</p>
              </content>
            </paragraph>
            <paragraph eId="part-I__sec-4__subsec-1__para-i">
              <num>i</num>
              <content>
                <p>by the Treasurer; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-I__sec-4__subsec-1__para-ii">
              <num>ii</num>
              <content>
                <p>by a person authorised in writing by the Treasurer to give the approval.</p>
              </content>
              <content>
                <p><term refersTo="#term-appoint">appoint</term> includes <def>re-appoint.</def></p>
                <p><term refersTo="#term-chief-executive-and-principal-registrar">Chief Executive and Principal Registrar</term> means <def>the Chief Executive and Principal Registrar of the Court appointed under <ref href="#sec-18">section 18</ref>.</def></p>
                <p><term refersTo="#term-chief-justice">Chief Justice</term> includes <def>a Justice for the time being performing the duties and exercising the powers of the Chief Justice.</def></p>
                <p><term refersTo="#term-court">Court</term> means <def>the High Court.</def></p>
                <p><term refersTo="#term-deputy-marshal">Deputy Marshal</term> means <def>a Deputy Marshal of the Court appointed under subsection 26(1).</def></p>
                <p><term refersTo="#term-deputy-registrar">Deputy Registrar</term> means <def>a Deputy Registrar of the Court appointed under subsection 26(1).</def></p>
                <p><term refersTo="#term-finance-minister">Finance Minister</term> means <def>the Minister who administers the Public Governance, Performance and Accountability Act 2013.</def></p>
                <p><term refersTo="#term-justice">Justice</term> means <def>a Justice of the Court and includes the Chief Justice.</def></p>
                <p><term refersTo="#term-marshal">Marshal</term> means <def>the Marshal of the Court appointed under subsection 26(1).</def></p>
                <p><b><i>Minister</i></b>, in relation to a State or the Northern Territory, means:</p>
              </content>
            </paragraph>
            <paragraph eId="part-I__sec-4__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>in the case of a State—a Minister of the Crown of that State; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-I__sec-4__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>	(b)	in the case of the Northern Territory—a person holding Ministerial Office under <i>Northern Territory (Self</i><i>-</i><i>Government) Act 1978</i>.<ref href="#sec-36">section 36</ref> of the </p>
              </content>
              <content>
                <p><term refersTo="#term-proceeding">proceeding</term> means <def>any proceeding in the Court whether civil or criminal and whether in the original or appellate jurisdiction of the Court.</def></p>
                <p><term refersTo="#term-rules-of-court">Rules of Court</term> means <def>Rules of Court under <ref href="#sec-86">section 86</ref> of <ref href="">the Judiciary Act 1903</ref>.</def></p>
                <p><term refersTo="#term-senior-registrar">Senior Registrar</term> means <def>the Senior Registrar of the Court appointed under subsection 26(1).</def></p>

          </subsection>

            <num>2</num>
            <content>
              <p>Any reference in this Act to moneys or property does not include a reference to moneys or property received by the High Court in connection with a proceeding.</p>
            </content>
          </subsection>
        </section>

          <num>4A</num>
          <heading>Application of the Criminal Code</heading>
          <content>
            <p>		Chapter 2 of the <i>Criminal Code</i> applies to all offences against this Act.</p>

        <heading>Constitution and seat of the High Court</heading>

          <heading>Justices of the High Court</heading>

            <num>5</num>
            <heading>The High Court</heading>
            <content>
              <p>The High Court is a superior court of record and consists of the Chief Justice and six other Justices appointed by the Governor-General by commission.</p>
            </content>
          </section>
          <section eId="part-II__dvs-1__sec-6">
            <num>6</num>
            <heading>Consultation with State Attorneys-General on appointment of Justices</heading>
            <content>
              <p>Where there is a vacancy in an office of Justice, the Attorney-General shall, before an appointment is made to the vacant office, consult with the Attorneys-General of the States in relation to the appointment.</p>
            </content>
          </section>
          <section eId="part-II__dvs-1__sec-7">
            <num>7</num>
            <heading>Qualification of Justices</heading>
            <content>
              <p>A person shall not be appointed as a Justice unless:</p>
            </content>
            <paragraph eId="part-II__dvs-1__sec-7__para-a">
              <num>a</num>
              <content>
                <p>he or she is or has been a Judge of a court created by the Parliament or of a court of a State or Territory (other than a Judge or acting Judge of the Local Court of New South Wales or of the Local Court of the Northern Territory); or</p>
              </content>
            </paragraph>
            <paragraph eId="part-II__dvs-1__sec-7__para-b">
              <num>b</num>
              <content>
                <p>he or she has been enrolled as a barrister or solicitor, as a barrister and solicitor, or as a legal practitioner, of the High Court or of the Supreme Court of a State or Territory for not less than 5 years.</p>
              </content>
            </paragraph>
          </section>
          <section eId="part-II__dvs-1__sec-8">
            <num>8</num>
            <heading>Seniority</heading>
            <content>
              <p>The Justices other than the Chief Justice have seniority according to the dates of their commissions or, where the commissions of two or more Justices bear the same date, according to the precedence assigned to them by their commissions.</p>
            </content>
          </section>
          <section eId="part-II__dvs-1__sec-9">
            <num>9</num>
            <heading>Acting Chief Justice</heading>
            <content>
              <p>Whenever:</p>
            </content>
            <paragraph eId="part-II__dvs-1__sec-9__para-a">
              <num>a</num>
              <content>
                <p>the Chief Justice is absent from Australia or is unable or unavailable to perform the duties of his or her office; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-II__dvs-1__sec-9__para-b">
              <num>b</num>
              <content>
                <p>there is a vacancy in the office of Chief Justice;</p>
              </content>
              <content>
                <p>the next senior Justice who is in Australia and is able and willing to do so shall perform the duties, and may exercise the powers, of the Chief Justice, and shall, during any period of absence of the Chief Justice from Australia or during a vacancy in the office of Chief Justice, be designated Acting Chief Justice.</p>
              </content>
            </paragraph>
          </section>
          <section eId="part-II__dvs-1__sec-10">
            <num>10</num>
            <heading>Justices not to hold other office</heading>
            <content>
              <p>A Justice is not capable of accepting or holding any other office of profit within Australia.</p>
            </content>
          </section>
          <section eId="part-II__dvs-1__sec-11">
            <num>11</num>
            <heading>Oath or affirmation of allegiance and of office</heading>
            <content>
              <p>A person who is appointed as a Justice after the commencement of this Act shall, before proceeding to discharge the duties of his or her office, take an oath or make an affirmation in accordance with the form in the Schedule.</p>
            </content>
          </section>
          <section eId="part-II__dvs-1__sec-12">
            <num>12</num>
            <heading>Salary and allowances</heading>
            <subsection eId="part-II__dvs-1__sec-12__subsec-1">
              <num>1</num>
              <content>
                <p>The Chief Justice and the other Justices shall receive salary and annual allowances at such respective rates as are fixed from time to time by the Parliament.</p>
              </content>
            </subsection>
            <subsection eId="part-II__dvs-1__sec-12__subsec-2">
              <num>2</num>
              <content>
                <p>The salary and annual allowance of a Justice accrue from day to day and are payable monthly.</p>
              </content>
            </subsection>
            <subsection eId="part-II__dvs-1__sec-12__subsec-3">
              <num>3</num>
              <content>
                <p>The Chief Justice and the other Justices shall receive such respective allowances in respect of travelling expenses as are provided by the Parliament.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-II__dvs-1__sec-13">
            <num>13</num>
            <heading>Appropriation</heading>
            <content>
              <p>The salaries, annual allowances and other allowances referred to in <ref href="#sec-12">section 12</ref> are payable out of the Consolidated Revenue Fund, which, to the necessary extent, is appropriated accordingly.</p>
            </content>
          </section>
        </division>
        <division eId="part-II__dvs-2">
          <num>2</num>
          <heading>Seat of the High Court</heading>
          <section eId="part-II__dvs-2__sec-14">
            <num>14</num>
            <heading>Seat</heading>
            <content>
              <p>On and after a date to be fixed by Proclamation, the seat of the High Court shall be at the seat of Government in the Australian Capital Territory.</p>
            </content>
          </section>
          <section eId="part-II__dvs-2__sec-15">
            <num>15</num>
            <heading>Places of sittings</heading>
            <content>
              <p>Sittings of the High Court shall be held from time to time as required at the seat of the Court but the Court may sit at other places within Australia and the external Territories.</p>
            </content>
          </section>
          <section eId="part-II__dvs-2__sec-16">
            <num>16</num>
            <heading>Judgment may be pronounced at any sitting</heading>
            <content>
              <p>The High Court may pronounce judgment at a sitting of the Court held at a place other than the place at which the relevant proceeding was held by the Court.</p>
            </content>

        <heading>Administration of the High Court</heading>

          <heading>Administration of the Court</heading>
          <subsection eId="part-III__sec-17__subsec-1">
            <num>1</num>
            <content>
              <p>The High Court shall administer its own affairs subject to, and in accordance with, this Act.</p>
            </content>
          </subsection>
          <subsection eId="part-III__sec-17__subsec-2">
            <num>2</num>
            <content>
              <p>The Court has power for the purposes of the Court to do all things that are necessary or convenient to be done for or in connection with the administration of its affairs and, without limiting the generality of the foregoing, has power:</p>

                <p>to take on hire, to exchange, and to accept on deposit or loan, library material, and also furnishings, equipment and goods needed for the purposes of the Court;</p>
              </content>
            </paragraph>

              <content>
                <p>to control and manage any land or building occupied by the Court and any adjacent land or building that is declared by Proclamation to be part of the precincts of the Court;</p>
              </content>
            </paragraph>
            <paragraph eId="part-III__sec-17__subsec-2__para-e">
              <num>e</num>
              <content>
                <p>to accept gifts, devises and bequests made to the Court upon trust and act as trustee of moneys or other property vested in the Court upon trust; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-III__sec-17__subsec-2__para-f">
              <num>f</num>
              <content>
                <p>to do such other things as it is authorized by this Act to do.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-III__sec-17__subsec-3">
            <num>3</num>
            <content>
              <p>Any real property, and any personal property (other than money), held by the Court shall be deemed to be the property of the Commonwealth.</p>
            </content>
          </subsection>
          <subsection eId="part-III__sec-17__subsec-4">
            <num>4</num>
            <content>
              <p>	(4)	For the purposes of the <i>Lands Acquisition Act 1989</i>, the Court shall be deemed to be an authority incorporated by a law of the Commonwealth.</p>
            </content>
          </subsection>
          <subsection eId="part-III__sec-17__subsec-5">
            <num>5</num>
            <content>
              <p>The Court may appoint committees consisting of Justices, or of Justices and other persons, for the purpose of advising the Court in relation to:</p>
            </content>
            <paragraph eId="part-III__sec-17__subsec-5__para-a">
              <num>a</num>
              <content>
                <p>the exercise of the powers of the Court under this Act; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-III__sec-17__subsec-5__para-b">
              <num>b</num>
              <content>
                <p>the making of Rules of Court.</p>
              </content>
            </paragraph>
          </subsection>
        </section>
        <section eId="part-III__sec-18">
          <num>18</num>
          <heading>Chief Executive and Principal Registrar of the Court</heading>
          <content>
            <p>There shall be a Chief Executive and Principal Registrar of the High Court, who shall be appointed by the Governor-General upon the nomination of the Court.</p>
          </content>
        </section>
        <section eId="part-III__sec-19">
          <num>19</num>
          <heading>Functions and powers of the Chief Executive and Principal Registrar</heading>
          <subsection eId="part-III__sec-19__subsec-1">
            <num>1</num>
            <content>
              <p>The Chief Executive and Principal Registrar has the function of acting on behalf of, and assisting, the Justices in the administration of the affairs of the High Court under <ref href="#sec-17">section 17</ref> and has such other functions as are conferred on him or her by this Act or are assigned to him or her by the Court.</p>
            </content>
          </subsection>
          <subsection eId="part-III__sec-19__subsec-2">
            <num>2</num>
            <content>
              <p>The Chief Executive and Principal Registrar has power to do all things that are necessary or convenient to be done for or in connection with the performance of his or her functions and, in particular, has power, on behalf of the Court, to give directions, by legislative instrument, for the purpose of regulating the conduct of persons on any land or in any building referred to in paragraph 17(2)(d).</p>
            </content>
          </subsection>
          <subsection eId="part-III__sec-19__subsec-3">
            <num>3</num>
            <content>
              <p>	(3)	Directions under subsection (2) commence at the start of the day after the day they are registered under the <i>Legislation Act 2003</i>.</p>
            </content>
          </subsection>
          <subsection eId="part-III__sec-19__subsec-6">
            <num>6</num>
            <content>
              <p>A person who contravenes or fails to comply with a direction in force under subsection (2) commits an offence.</p>
            </content>
            <hcontainer name="penalty">
              <content>
                <p>Penalty:	<quantity refersTo="#penaltyUnit">1 penalty unit</quantity>.</p>
              </content>
            </hcontainer>
          </subsection>
          <subsection eId="part-III__sec-19__subsec-6A">

              <p>Subsection (6) is an offence of strict liability.</p>

              <p>In the performance of his or her functions and the exercise of his or her powers the Chief Executive and Principal Registrar shall comply with any directions given to him or her by the Court.</p>
            </content>
          </subsection>
          <subsection eId="part-III__sec-19__subsec-8">
            <num>8</num>
            <content>
              <p>Nothing in this section affects the power of the Court to punish contempts of the Court.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-III__sec-20">
          <num>20</num>
          <heading>Terms and conditions of appointment</heading>
          <subsection eId="part-III__sec-20__subsec-1">
            <num>1</num>
            <content>
              <p>The Chief Executive and Principal Registrar holds office for such period, not exceeding 5 years, as is specified in the instrument of his or her appointment, but is eligible for re-appointment.</p>
            </content>
          </subsection>
          <subsection eId="part-III__sec-20__subsec-3">
            <num>3</num>
            <content>
              <p>The Chief Executive and Principal Registrar holds office on such terms and conditions (if any) in respect of matters not provided for by this Act as are determined by the Court.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-III__sec-21">
          <num>21</num>
          <heading>Remuneration and allowances</heading>
          <subsection eId="part-III__sec-21__subsec-1">
            <num>1</num>
            <content>
              <p>The Chief Executive and Principal Registrar shall be paid such remuneration as is determined by the Remuneration Tribunal, but, if no determination of that remuneration by the Tribunal is in operation, he or she shall be paid such remuneration as is prescribed by Rules of Court.</p>
            </content>
          </subsection>
          <subsection eId="part-III__sec-21__subsec-2">
            <num>2</num>
            <content>
              <p>The Chief Executive and Principal Registrar shall be paid such allowances as are prescribed by Rules of Court.</p>
            </content>
          </subsection>
          <subsection eId="part-III__sec-21__subsec-3">
            <num>3</num>
            <content>
              <p>	(3)	This section has effect subject to the<i> Remuneration Tribunal Act 1973</i>.</p>
            </content>
          </subsection>
          <subsection eId="part-III__sec-21__subsec-4">
            <num>4</num>
            <content>
              <p>	(4)	Subsection 7(9) of the <i>Remuneration Tribunal Act 1973 </i>has effect in relation to the remuneration and allowances payable to the Chief Executive and Principal Registrar, as if the High Court were a public statutory corporation and the Chief Executive and Principal Registrar held an office in the service of that corporation.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-III__sec-22">
          <num>22</num>
          <heading>Leave of absence</heading>
          <subsection eId="part-III__sec-22__subsec-1">
            <num>1</num>
            <content>
              <p>The Chief Executive and Principal Registrar has such recreation leave entitlements as are determined by the Remuneration Tribunal.</p>
            </content>
          </subsection>
          <subsection eId="part-III__sec-22__subsec-2">
            <num>2</num>
            <content>
              <p>The High Court may grant the Chief Executive and Principal Registrar leave of absence, other than recreation leave, on such terms and conditions as to remuneration or otherwise as the Court determines.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-III__sec-23">
          <num>23</num>
          <heading>Resignation</heading>
          <content>
            <p>The Chief Executive and Principal Registrar may resign his or her office by writing signed by him or her and delivered to the Governor-General.</p>
          </content>
        </section>
        <section eId="part-III__sec-24">
          <num>24</num>
          <heading>Termination of appointment</heading>
          <subsection eId="part-III__sec-24__subsec-1">
            <num>1</num>
            <content>
              <p>The Governor-General may terminate the appointment of the Chief Executive and Principal Registrar by reason of the misbehaviour or the physical or mental incapacity of the Chief Executive and Principal Registrar.</p>
            </content>
          </subsection>
          <subsection eId="part-III__sec-24__subsec-2">
            <num>2</num>
            <content>
              <p>If the Chief Executive and Principal Registrar:</p>
            </content>
            <paragraph eId="part-III__sec-24__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>becomes bankrupt, applies to take the benefit of any law for the relief of bankrupt or insolvent debtors, compounds with his or her creditors or makes an assignment of his or her remuneration for their benefit;</p>
              </content>
            </paragraph>
            <paragraph eId="part-III__sec-24__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>is absent from duty, except with leave of absence, for 14 consecutive days or for 28 days in any 12 months; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-III__sec-24__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>without the approval of the Court, engages in paid employment outside the duties of his or her office;</p>
              </content>
              <content>
                <p>the Governor-General shall terminate the appointment of the Chief Executive and Principal Registrar.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-III__sec-24__subsec-3">
            <num>3</num>
            <content>
              <p>The powers of the Governor-General under subsection (1) shall be exercised only in accordance with advice that is consistent with recommendations by the Court.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-III__sec-25">
          <num>25</num>
          <heading>Acting Chief Executive and Principal Registrar</heading>
          <subsection eId="part-III__sec-25__subsec-1">
            <num>1</num>
            <content>
              <p>The High Court may appoint a person to act as Chief Executive and Principal Registrar:</p>
            </content>
            <paragraph eId="part-III__sec-25__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>during a vacancy in the office of Chief Executive and Principal Registrar, whether or not an appointment has previously been made to the office; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-III__sec-25__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>during any period, or during all periods, when the Chief Executive and Principal Registrar is absent from duty or from Australia or is, for any other reason, unable to perform the duties of his or her office;</p>
              </content>
              <content>
                <p>but a person appointed to act during a vacancy shall not continue so to act for more than 12 months.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-III__sec-25__subsec-2">
            <num>2</num>
            <content>
              <p>An appointment of a person under subsection (1) may be expressed to have effect only in such circumstances as are specified in the instrument of his or her appointment.</p>
            </content>
          </subsection>
          <subsection eId="part-III__sec-25__subsec-3">
            <num>3</num>
            <content>
              <p>The Court may:</p>
            </content>
            <paragraph eId="part-III__sec-25__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>determine the terms and conditions of appointment, including remuneration and allowances, of a person acting as Chief Executive and Principal Registrar; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-III__sec-25__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>terminate such an appointment at any time.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-III__sec-25__subsec-4">
            <num>4</num>
            <content>
              <p>Where a person is acting as Chief Executive and Principal Registrar in accordance with paragraph (1)(b) and the office of Chief Executive and Principal Registrar becomes vacant while that person is so acting, then, subject to subsection (2), that person may continue so to act until the Court otherwise directs, the vacancy is filled or a period of 12 months from the date on which the vacancy occurred expires, whichever first happens.</p>
            </content>
          </subsection>
          <subsection eId="part-III__sec-25__subsec-5">
            <num>5</num>
            <content>
              <p>The appointment of a person to act as Chief Executive and Principal Registrar ceases to have effect if he or she resigns his or her office by writing signed by him or her and delivered to the Chief Justice.</p>
            </content>
          </subsection>
          <subsection eId="part-III__sec-25__subsec-6">
            <num>6</num>
            <content>
              <p>While a person is acting as Chief Executive and Principal Registrar, he or she has and may exercise all the powers of, and shall perform all the functions of, the Chief Executive and Principal Registrar under this Act or any other law.</p>
            </content>
          </subsection>
          <subsection eId="part-III__sec-25__subsec-7">
            <num>7</num>
            <content>
              <p>The validity of anything done by a person purporting to act under subsection (1) shall not be called in question on the ground that the occasion for his or her appointment had not arisen, that there is a defect or irregularity in or in connection with his or her appointment, that the appointment had ceased to have effect or that the occasion for him or her to act had not arisen or had passed.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-III__sec-26">
          <num>26</num>
          <heading>Officers and employees</heading>
          <subsection eId="part-III__sec-26__subsec-1">
            <num>1</num>
            <content>
              <p>The Chief Executive and Principal Registrar is to appoint such other officers of the High Court as the Court considers necessary.</p>
            </content>
          </subsection>
          <subsection eId="part-III__sec-26__subsec-3">
            <num>3</num>
            <content>
              <p>The Chief Executive and Principal Registrar may engage such employees as the Court considers necessary for the purposes of the Court.</p>
            </content>
          </subsection>
          <subsection eId="part-III__sec-26__subsec-4">
            <num>4</num>
            <content>
              <p>The terms and conditions of employment (including terms and conditions as to remuneration and allowances) of officers or employees appointed or engaged in accordance with this section are such as are determined by the Court.</p>
            </content>
          </subsection>
          <subsection eId="part-III__sec-26__subsec-5">
            <num>5</num>
            <content>
              <p>	(5)	An appointment under subsection (1) is not a public office for the purposes of the <i>Remuneration Tribunal Act 1973</i>.</p>
            </content>
          </subsection>
          <subsection eId="part-III__sec-26__subsec-6">
            <num>6</num>
            <content>
              <p>	(6)	The Chief Executive and Principal Registrar may, on behalf of the Court, arrange with an Agency Head within the meaning of the <i>Public Service Act 1999</i>, or with an authority of the Commonwealth, for the services of officers or employees of the Agency or of the authority, as the case may be, to be made available for the purposes of the Court.</p>
            </content>
          </subsection>
          <subsection eId="part-III__sec-26__subsec-7">
            <num>7</num>
            <content>
              <p>The Senior Registrar and Deputy Registrars are to perform such duties in respect of proceedings in the Court as are assigned to them by Rules of Court, by an order of the Court or by the Chief Executive and Principal Registrar.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-III__sec-27">
          <num>27</num>
          <heading>Marshal and Deputy Marshals</heading>
          <subsection eId="part-III__sec-27__subsec-1">
            <num>1</num>
            <content>
              <p>The Marshal:</p>
            </content>
            <paragraph eId="part-III__sec-27__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>is charged with the service and execution of all writs, summonses, orders, warrants, precepts, process and commands of the Court that are directed to him or her; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-III__sec-27__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>shall take, receive and detain all persons who are committed to his or her custody by the Court, and shall discharge all such persons when directed by the Court or otherwise required by law.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-III__sec-27__subsec-2">
            <num>2</num>
            <content>
              <p>A Deputy Marshal may, subject to any directions of the Marshal, exercise any power or perform any function of the Marshal.</p>
            </content>
          </subsection>
          <subsection eId="part-III__sec-27__subsec-3">
            <num>3</num>
            <content>
              <p>The Marshal or a Deputy Marshal may authorize such persons as he or she thinks fit to assist him or her in the exercise of any power or performance of any function by him or her, and any act done by a person so appointed shall be deemed to be done by and under <role refersTo="#authority">the authority</role> of the Marshal or Deputy Marshal, as the case may be.</p>
            </content>
          </subsection>
          <subsection eId="part-III__sec-27__subsec-4">
            <num>4</num>
            <content>
              <p>If the Marshal or a Deputy Marshal is a party to a proceeding in the Court, all writs, summonses, orders, warrants, precepts, process and commands in the proceeding that should, in the ordinary course, be directed to the Marshal or Deputy Marshal shall be directed to such disinterested person as the Court appoints, and the person so appointed may execute and return them.</p>
            </content>
          </subsection>
          <subsection eId="part-III__sec-27__subsec-5">
            <num>5</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> may arrange with the appropriate Minister of a State or of the Northern Territory for an officer or officers of that State or Territory to perform the functions of a Deputy Marshal in that State or Territory.</p>
            </content>
          </subsection>
          <subsection eId="part-III__sec-27__subsec-6">
            <num>6</num>
            <content>
              <p>	(6)	A copy of an arrangement made under subsection (5) shall be published in the <i>Gazette</i>.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-III__sec-28">
          <num>28</num>
          <heading>Certain officers may administer oaths and affirmations</heading>
          <content>
            <p>The Chief Executive and Principal Registrar, the Senior Registrar, the Deputy Registrars and any other persons authorized by Rules of Court may administer oaths and affirmations for the purposes of any proceedings in the Court.</p>
          </content>
        </section>
      </part>

        <num>IV</num>
        <heading>Registry and procedure</heading>
        <section eId="part-IV__sec-30">
          <num>30</num>
          <heading>Registry</heading>
          <subsection eId="part-IV__sec-30__subsec-1">
            <num>1</num>
            <content>
              <p>There shall be a Registry of the High Court, which shall be at the seat of the Court.</p>
            </content>
          </subsection>
          <subsection eId="part-IV__sec-30__subsec-2">
            <num>2</num>
            <content>
              <p>The Registry shall be under the control of the Chief Executive and Principal Registrar.</p>
            </content>
          </subsection>
          <subsection eId="part-IV__sec-30__subsec-3">
            <num>3</num>
            <content>
              <p>There shall be an office of the Registry at the seat of the Court, at the capital city of each State, at Darwin in the Northern Territory and at such other places as the Court deems necessary.</p>
            </content>
          </subsection>
          <subsection eId="part-IV__sec-30__subsec-4">
            <num>4</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> may arrange with the appropriate Minister of a State or of the Northern Territory for an officer or officers of that State or Territory to perform on behalf of the Court at any office in that State or Territory of the Registry of the Court all or any of the functions referred to in subsection (6).</p>
            </content>
          </subsection>
          <subsection eId="part-IV__sec-30__subsec-5">
            <num>5</num>
            <content>
              <p>The Chief Justice may arrange with the Chief Justice of the Federal Court of Australia for an officer or officers of the Federal Court of Australia to perform on behalf of the High Court at an office or offices of the Registry of the High Court referred to in the arrangement all or any of the functions referred to in subsection (6).</p>
            </content>
          </subsection>
          <subsection eId="part-IV__sec-30__subsec-6">
            <num>6</num>
            <content>
              <p>The functions to which an arrangement under subsection (4) or (5) may relate are:</p>
            </content>
            <paragraph eId="part-IV__sec-30__subsec-6__para-a">
              <num>a</num>
              <content>
                <p>the receipt of documents to be lodged with or filed in the High Court;</p>
              </content>
            </paragraph>
            <paragraph eId="part-IV__sec-30__subsec-6__para-b">
              <num>b</num>
              <content>
                <p>the signing and issuing of writs, commissions and process;</p>
              </content>
            </paragraph>
            <paragraph eId="part-IV__sec-30__subsec-6__para-c">
              <num>c</num>
              <content>
                <p>the administration of oaths and affirmations for the purposes of any proceedings in the High Court; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-IV__sec-30__subsec-6__para-d">
              <num>d</num>
              <content>
                <p>such other functions as are permitted by Rules of Court to be performed in pursuance of such an arrangement.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-IV__sec-30__subsec-7">
            <num>7</num>
            <content>
              <p>Documents received at any office of the Registry for lodgment with or filing in the Court shall be deemed to be received at the Registry.</p>
            </content>
          </subsection>
          <subsection eId="part-IV__sec-30__subsec-8">
            <num>8</num>
            <content>
              <p>	(8)	A copy of an arrangement made under subsection (4) or (5) shall be published in the <i>Gazette.</i></p>
            </content>
          </subsection>
          <subsection eId="part-IV__sec-30__subsec-9">
            <num>9</num>
            <content>
              <p><i>	</i>(9)	Where an office of the Registry is established at a place not specifically mentioned in subsection (3), a notice stating that an office of the Registry has been established at that place shall be published in the Gazette.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-IV__sec-31">
          <num>31</num>
          <heading>Transfer of proceedings</heading>
          <subsection eId="part-IV__sec-31__subsec-1">
            <num>1</num>
            <content>
              <p>Subject to <ref href="#sec-80">section 80</ref> of the Constitution, the High Court may, at any stage of a proceeding, direct that the proceeding or a part of the proceeding be held or continued at a place specified in the order, subject to such conditions (if any) as the Court imposes.</p>
            </content>
          </subsection>
          <subsection eId="part-IV__sec-31__subsec-2">
            <num>2</num>
            <content>
              <p>The Rules of Court may make provision for the transmission of documents between offices of the Registry of the Court, including transmission by telegraph, telex or any similar means of communication.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-IV__sec-32">
          <num>32</num>
          <heading>Seals</heading>
          <subsection eId="part-IV__sec-32__subsec-1">
            <num>1</num>
            <content>
              <p>The High Court shall have a seal on which are inscribed the words “The Seal of the High Court of Australia”.</p>
            </content>
          </subsection>
          <subsection eId="part-IV__sec-32__subsec-2">
            <num>2</num>
            <content>
              <p>A duplicate of the seal of the Court shall be kept at each office of the Registry of the Court.</p>
            </content>
          </subsection>
          <subsection eId="part-IV__sec-32__subsec-3">
            <num>3</num>
            <content>
              <p>Such other seals as are required for the business of the Court shall be kept and used at each office of the Registry and shall be in such form and kept in such custody as the Chief Justice directs.</p>
            </content>
          </subsection>
          <subsection eId="part-IV__sec-32__subsec-4">
            <num>4</num>
            <content>
              <p>A document, a copy of a document or an exemplification purporting to be sealed with the seal of the High Court or a duplicate of that seal, or with a seal referred to in subsection (3), is receivable in evidence without further proof of the seal.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-IV__sec-33">
          <num>33</num>
          <heading>Writs etc.</heading>
          <content>
            <p>All writs, commissions and process issued from the High Court shall be:</p>
          </content>
          <paragraph eId="part-IV__sec-33__para-a">
            <num>a</num>
            <content>
              <p>in the name of the Sovereign;</p>
            </content>
          </paragraph>
          <paragraph eId="part-IV__sec-33__para-b">
            <num>b</num>
            <content>
              <p>under the seal of the Court or a duplicate of that seal or such other seal as is prescribed by Rules of Court; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-IV__sec-33__para-c">
            <num>c</num>
            <content>
              <p>signed by:</p>
            </content>
          </paragraph>
          <paragraph eId="part-IV__sec-33__para-i">
            <num>i</num>
            <content>
              <p>the Chief Executive and Principal Registrar or an officer acting with <role refersTo="#authority">the authority</role> of the Chief Executive and Principal Registrar; or</p>
            </content>
          </paragraph>

        <heading>Finance</heading>
        <section eId="part-V__sec-35">
          <num>35</num>
          <heading>Moneys appropriated for the Court</heading>
          <subsection eId="part-V__sec-35__subsec-1">
            <num>1</num>
            <content>
              <p>There are payable to the High Court such moneys as are appropriated by the Parliament for the purposes of the Court.</p>
            </content>
          </subsection>
          <subsection eId="part-V__sec-35__subsec-2">
            <num>2</num>
            <content>
              <p>The Finance Minister may give directions as to the amounts in which, and the times at which, moneys referred to in subsection (1) are to be paid to the Court.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-V__sec-36">
          <num>36</num>
          <heading>Estimates</heading>
          <subsection eId="part-V__sec-36__subsec-1">
            <num>1</num>
            <content>
              <p>The High Court shall prepare estimates, in such form as <role refersTo="#minister">the Minister</role> approves, of receipts and expenditure in respect of the administration of the affairs of the Court under section 17 for each financial year and, if so requested by <role refersTo="#minister">the Minister</role>, for any other period, and shall submit estimates so prepared to <role refersTo="#minister">the Minister</role> not later than such date as <role refersTo="#minister">the Minister</role> specifies.</p>
            </content>
          </subsection>
          <subsection eId="part-V__sec-36__subsec-2">
            <num>2</num>
            <content>
              <p>Moneys paid to the Court under <role refersTo="#minister">the Minister</role>.<ref href="#sec-35">section 35</ref> shall not be expended otherwise than in accordance with the estimates of expenditure approved by </p>
            </content>
          </subsection>
        </section>
        <section eId="part-V__sec-37">
          <num>37</num>
          <heading>Application of moneys appropriated for the Court</heading>
          <content>
            <p>Moneys paid to the High Court under <ref href="#sec-35">section 35</ref> shall be applied only:</p>
          </content>
          <paragraph eId="part-V__sec-37__para-a">
            <num>a</num>
            <content>
              <p>in payment or discharge of the costs and expenses of the administration of the affairs of the Court under <ref href="#sec-17">section 17</ref>; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-V__sec-37__para-b">
            <num>b</num>
            <content>
              <p>in payment of any remuneration and allowances payable under this Act to any person other than a Justice.</p>
            </content>
          </paragraph>
        </section>
        <section eId="part-V__sec-38">
          <num>38</num>
          <heading>Trust moneys</heading>
          <subsection eId="part-V__sec-38__subsec-1">
            <num>1</num>
            <content>
              <p>A separate account or separate accounts shall be kept in the books of the High Court in respect of moneys held by the Court upon trust.</p>
            </content>
          </subsection>
          <subsection eId="part-V__sec-38__subsec-2">
            <num>2</num>
            <content>
              <p>Any moneys or other property held by the Court upon trust shall be dealt with in accordance with the powers and duties of the Court as trustee.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-V__sec-39">
          <num>39</num>
          <heading>Other moneys</heading>
          <subsection eId="part-V__sec-39__subsec-1">
            <num>1</num>
            <content>
              <p>Any moneys held by the Court other than:</p>
            </content>
            <paragraph eId="part-V__sec-39__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>moneys held by the Court upon trust; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-V__sec-39__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>moneys paid to the Court under <ref href="#sec-35">section 35</ref>;</p>
              </content>
              <content>
                <p>may be expended for the purposes of the Court.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-V__sec-39__subsec-2">
            <num>2</num>
            <content>
              <p>Moneys to which subsection (1) applies that are not immediately required to be expended may be invested:</p>
            </content>
            <paragraph eId="part-V__sec-39__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>on deposit with an ADI;</p>
              </content>
            </paragraph>
            <paragraph eId="part-V__sec-39__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>in securities of the Commonwealth; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-V__sec-39__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>in any other manner approved by the Finance Minister.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-V__sec-39__subsec-3">
            <num>3</num>
            <content>
              <p>	(3)	The Finance Minister may, by written instrument, delegate any of the Finance Minister’s powers or functions under this section to an official (within the meaning of the <i>Public Governance, Performance and Accountability Act 2013</i>) of a non-corporate Commonwealth entity (within the meaning of that Act). In exercising powers or functions under a delegation, the official must comply with any directions of the Finance Minister.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-V__sec-40">
          <num>40</num>
          <heading>Limitation on contracts</heading>
          <content>
            <p>The High Court shall not, except with the approval of <role refersTo="#minister">the Minister</role>, enter into a contract under which the Court is to pay or to receive an amount exceeding $250,000 or, if a higher amount is prescribed, that higher amount.</p>
          </content>
        </section>
        <section eId="part-V__sec-41">
          <num>41</num>
          <heading>Accounts with ADIs</heading>
          <subsection eId="part-V__sec-41__subsec-1">
            <num>1</num>
            <content>
              <p>The Chief Executive and Principal Registrar may, on behalf of and in the name of the High Court, open and maintain an account or accounts with an ADI or ADIs and shall maintain at all times at least one such account.</p>
            </content>
          </subsection>
          <subsection eId="part-V__sec-41__subsec-2">
            <num>2</num>
            <content>
              <p>The Chief Executive and Principal Registrar shall pay all moneys received by the Court into an account referred to in this section.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-V__sec-42">
          <num>42</num>
          <heading>Proper accounts to be kept</heading>
          <content>
            <p>The High Court shall cause to be kept proper accounts and records of the transactions and affairs relating to the administration of the affairs of the Court under <ref href="#sec-17">section 17</ref> and shall do all things necessary to ensure that all payments out of the moneys held by the Court are correctly made and properly authorized and that adequate control is maintained over the assets held by, or in the custody of, the Court and over the incurring of liabilities by the Court.</p>
          </content>
        </section>
        <section eId="part-V__sec-43">
          <num>43</num>
          <heading>Audit</heading>
          <subsection eId="part-V__sec-43__subsec-1">
            <num>1</num>
            <content>
              <p>The Auditor-General shall inspect and audit the accounts and records of financial transactions relating to the administration of the affairs of the High Court under <role refersTo="#minister">the Minister</role> to any irregularity disclosed by the inspection and audit that, in the opinion of the Auditor-General, is of sufficient importance to justify his or her so doing.<ref href="#sec-17">section 17</ref> and the records relating to assets held by, or in the custody of, the Court and shall forthwith draw the attention of </p>
            </content>
          </subsection>
          <subsection eId="part-V__sec-43__subsec-2">
            <num>2</num>
            <content>
              <p>The Auditor-General may, at his or her discretion, dispense with all or any part of the detailed inspection and audit of any accounts or records referred to in subsection (1).</p>
            </content>
          </subsection>
          <subsection eId="part-V__sec-43__subsec-3">
            <num>3</num>
            <content>
              <p>The Auditor-General shall, at least once in each financial year, report to <role refersTo="#minister">the Minister</role> the results of the inspection and audit carried out under subsection (1).</p>
            </content>
          </subsection>
          <subsection eId="part-V__sec-43__subsec-4">
            <num>4</num>
            <content>
              <p>The Auditor-General or a person authorized by him or her is entitled at all reasonable times to full and free access to all accounts and records maintained by the Court relating directly or indirectly to the receipt or payment of moneys, or to the acquisition, receipt, custody or disposal of assets, by the Court.</p>
            </content>
          </subsection>
          <subsection eId="part-V__sec-43__subsec-5">
            <num>5</num>
            <content>
              <p>The Auditor-General or a person authorized by him or her may make copies of, or take extracts from, any such accounts and records.</p>
            </content>
          </subsection>
          <subsection eId="part-V__sec-43__subsec-6">
            <num>6</num>
            <content>
              <p>The Auditor-General or a person authorized by him or her may require any person to furnish him or her with such information in the possession of the person or to which the person has access as the Auditor-General or authorized person considers necessary for the purposes of the functions of the Auditor-General under this Act, and the person shall comply with the requirement.</p>
            </content>
          </subsection>
          <subsection eId="part-V__sec-43__subsec-7">
            <num>7</num>
            <content>
              <p>A person who contravenes subsection (6) commits an offence and is punishable, upon conviction, by a fine not exceeding <quantity refersTo="#penaltyUnit">2 penalty units</quantity>.</p>
            </content>
          </subsection>
          <subsection eId="part-V__sec-43__subsec-8">
            <num>8</num>
            <content>
              <p>Subsection (7) is an offence of strict liability.</p>

            <p>The High Court is not subject to taxation under any law of the Commonwealth or of a State or Territory.</p>
          </content>
        </section>
      </part>

        <num>VI</num>
        <heading>Miscellaneous</heading>
        <section eId="part-VI__sec-45">
          <num>45</num>
          <heading>Proceedings in respect of administration of the Court</heading>
          <content>
            <p>Any judicial or other proceedings relating to matters arising out of the administration of the affairs of the High Court under <ref href="#sec-17">section 17</ref>, including any proceedings relating to matters arising out of the performance of the functions or the exercise of the powers of the Chief Executive and Principal Registrar under this Act, may be instituted by or against the Commonwealth, as the case requires.</p>
          </content>
        </section>
        <section eId="part-VI__sec-46">
          <num>46</num>
          <heading>Exercise of powers of the Court in administrative matters</heading>
          <subsection eId="part-VI__sec-46__subsec-1">
            <num>1</num>
            <content>
              <p>Subject to this section, the powers of the High Court under this Act may be exercised by the Justices or by a majority of them.</p>
            </content>
          </subsection>
          <subsection eId="part-VI__sec-46__subsec-2">
            <num>2</num>
            <content>
              <p>The Court may, either generally or as otherwise provided by the instrument of delegation, by writing signed by the Justices or a majority of them, delegate all or any of the powers of the Court under this Act (except this power of delegation) to any one or more of the Justices.</p>
            </content>
          </subsection>
          <subsection eId="part-VI__sec-46__subsec-3">
            <num>3</num>
            <content>
              <p>A power so delegated, when exercised by the delegate or delegates, shall, for the purposes of this Act, be deemed to have been exercised by the Court.</p>
            </content>
          </subsection>
          <subsection eId="part-VI__sec-46__subsec-4">
            <num>4</num>
            <content>
              <p>A delegation under this section does not prevent the exercise of a power by the Court.</p>
            </content>
          </subsection>
          <subsection eId="part-VI__sec-46__subsec-5">
            <num>5</num>
            <content>
              <p>A decision of the Court, or of a delegate or delegates of the Court, in exercise of a power under this Act may be made known by the Chief Justice, who may give any directions or take any other action necessary to give effect to the decision.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-VI__sec-47">
          <num>47</num>
          <heading>Annual reports and financial statements</heading>
          <subsection eId="part-VI__sec-47__subsec-1">
            <num>1</num>
            <content>
              <p>The High Court shall, as soon as practicable after 30 June in each year, prepare and submit to <role refersTo="#minister">the Minister</role> a report relating to the administration of the affairs of the Court under section 17 during the year that ended on that 30 June, together with financial statements in respect of that year in such form as the Finance Minister approves.</p>
            </content>
          </subsection>
          <subsection eId="part-VI__sec-47__subsec-2">
            <num>2</num>
            <content>
              <p>Before submitting financial statements to <role refersTo="#minister">the Minister</role> under subsection (1), the Court shall submit them to the Auditor-General, who shall report to <role refersTo="#minister">the Minister</role>:</p>
            </content>
            <paragraph eId="part-VI__sec-47__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>whether, in his or her opinion, the statements are based on proper accounts and records;</p>
              </content>
            </paragraph>
            <paragraph eId="part-VI__sec-47__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>whether the statements are in agreement with the accounts and records;</p>
              </content>
            </paragraph>
            <paragraph eId="part-VI__sec-47__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>whether, in his or her opinion, the receipt, expenditure and investment of moneys, and the acquisition and disposal of assets, by the Court during the year have been in accordance with this Act; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-VI__sec-47__subsec-2__para-d">
              <num>d</num>
              <content>
                <p>as to such other matters arising out of the statements as the Auditor-General considers should be reported to <role refersTo="#minister">the Minister</role>.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-VI__sec-47__subsec-3">
            <num>3</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> shall cause a copy of the report and financial statements of the Court together with a copy of the report of the Auditor-General to be laid before each House of the Parliament within 15 sitting days of that House after their receipt by <role refersTo="#minister">the Minister</role>.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-VI__sec-48">
          <num>48</num>
          <heading>Rules of Court</heading>
          <content>
            <p>		The power of the Justices or of a majority of them to make Rules of Court under <i>Judiciary Act 1903 </i>extends to making any Rules of Court required or permitted by this Act to be made or necessary or convenient to be made for carrying into effect the provisions of this Act.<ref href="#sec-86">section 86</ref> of the </p>

        </section>
        <section eId="part-VI__sec-49">
          <num>49</num>
          <heading>Regulations</heading>
          <content>
            <p>The Governor-General may make regulations prescribing matters:</p>
