        <heading>Short title</heading>
        <content>
          <p>		This Act may be cited as the <i>Customs Securities (Penalties) Act 1981</i>.</p>
        </content>

        <num>2</num>
        <heading>Commencement</heading>
        <content>
          <p>		This Act shall come into operation on the day on which the <i>Customs Amendment (Tenders) Act 1981 </i>comes into operation.</p>

      <section eId="sec-2A">
        <num>2A</num>
        <heading>General administration of Act</heading>
        <content>
          <p>		The Comptroller-General of Customs (within the meaning of the <i>Customs Act 1901</i>) has the general administration of this Act.</p>

      </section>
      <section eId="sec-3">
        <num>3</num>
        <heading>Interpretation</heading>
        <subsection eId="sec-3__subsec-1">
          <num>1</num>
          <content>
            <p>In this Act, unless the contrary intention appears:</p>
          </content>
          <content>
            <p><term refersTo="#term-customs-undertaking">Customs undertaking</term> means <def>an undertaking given, in accordance with subsection 267(1) of <ref href="">the Customs Act 1901</ref>, by a person who furnishes a tender in accordance with a call for tenders made under a scheme under <ref href="#part-X">Part X</ref>V of <ref href="">the Customs Act 1901</ref>.</def></p>
            <p><term refersTo="#term-prescribed-percentage">prescribed percentage</term> means <def>the prescribed percentage set out in the Customs undertaking that relates to the goods.</def></p>
            <p><b><i>relevant Customs undertaking</i></b>, in relation to a tender furnished in accordance with a call for tenders made under a scheme under Part XV of the <i>Customs Act 1901</i>, means the undertaking relating to that tender that is given in accordance with subsection 267(1) of the <i>Customs Act 1901</i>.</p>

        </subsection>
        <subsection eId="sec-3__subsec-2">
          <num>2</num>
          <content>
            <p>For the purposes of this Act, where a Customs undertaking sets out the value of a unit of the goods to which the undertaking relates, the value of the goods shall be calculated in accordance with that value.</p>

        </subsection>
      </section>
      <section eId="sec-3A">
        <num>3A</num>
        <heading>Act does not extend to Norfolk Island</heading>
        <content>
          <p>This Act does not extend to Norfolk Island.</p>

      <section eId="sec-4">
        <num>4</num>
        <heading>Penalty</heading>
        <content>
          <p>Where:</p>
        </content>
        <paragraph eId="sec-4__para-a">
          <num>a</num>
          <content>
            <p>	(a)	a tender furnished by a person in accordance with a call for tenders made under a scheme under <i>Customs Act 1901 </i>has been accepted; and<ref href="#part-X">Part X</ref>V of the </p>
          </content>
        </paragraph>
        <paragraph eId="sec-4__para-b">
          <num>b</num>
          <content>
            <p>	(b)	the person refuses, or fails, when required by a Collector under <i>Customs Undertakings (Penalties) Act 1981</i>;<ref href="#sec-42">section 42</ref> of that Act to do so, to give a security for payment of any penalty in connection with the relevant Customs undertaking that the person may become liable to pay to the Commonwealth under the </p>
          </content>
          <content>
            <p>there is payable by that person to the Commonwealth, by way of penalty, an amount equal to the prescribed percentage of the value of the goods to which that undertaking relates.</p>

              <b>Editorial changes</b>
            </p>
            <p>The <i>Legislation Act 2003</i> authorises First Parliamentary Counsel to make editorial and presentational changes to a compiled law in preparing a compilation of the law for registration. The changes must not change the effect of the law. Editorial changes take effect from the compilation registration date.</p>
            <p>If the compilation includes editorial changes, the endnotes include a brief outline of the changes in general terms. Full details of any changes can be obtained from the Office of Parliamentary Counsel.</p>

              <b>Misdescribed amendments</b>
            </p>
            <p>A misdescribed amendment is an amendment that does not accurately describe the amendment to be made. If, despite the misdescription, the amendment can be given effect as intended, the amendment is incorporated into the compiled law and the abbreviation “(md)” added to the details of the amendment included in the amendment history.</p>
            <p>If a misdescribed amendment cannot be given effect as intended, the abbreviation “(md not incorp)” is added to the details of the amendment included in the amendment history.</p>
