          <heading>Short title</heading>
          <content>
            <p>		This Act may be cited as the <i>Australian Centre for International Agricultural Research Act 1982</i>.</p>
          </content>
        </section>
        <section eId="part-I__sec-2">
          <num>2</num>
          <heading>Commencement</heading>
          <content>
            <p>This Act shall come into operation on a date to be fixed by Proclamation.</p>
          </content>
        </section>
        <section eId="part-I__sec-3">
          <num>3</num>
          <heading>Interpretation</heading>
          <content>
            <p>In this Act, unless the contrary intention appears:</p>
            <p><term refersTo="#term-account">Account</term> means <def>the account continued in existence by <ref href="#sec-33">section 33</ref>.</def></p>
            <p><term refersTo="#term-agricultural-research">agricultural research</term> means <def>scientific, technical, economic or socio-economic research in connection with agriculture, and includes the publication of reports, periodicals, books and papers in connection with any such research.</def></p>
            <p><term refersTo="#term-agriculture">agriculture</term> includes <def>such uses of land as are prescribed for the purposes of this definition.</def></p>
            <p><term refersTo="#term-annual-report">annual report</term> means <def>the report referred to in <ref href="#sec-39">section 39</ref>.</def></p>
            <p><term refersTo="#term-appointed-member-of-the-council">appointed member of the Council</term> means <def>a member of the Council appointed under subsection 19(2).</def></p>
            <p><term refersTo="#term-aps-code-of-conduct">APS Code of Conduct</term> means <def>the Code of Conduct (within the meaning of <ref href="">the Public Service Act 1999</ref>).</def></p>
            <p><term refersTo="#term-centre">Centre</term> means <def>the Australian Centre for International Agricultural Research.</def></p>
            <p><term refersTo="#term-ceo">CEO</term> means <def>the Chief Executive Officer of the Centre.</def></p>
            <p><term refersTo="#term-chair">Chair</term> means <def>the Chair of the Commission.</def></p>
            <p><term refersTo="#term-commission">Commission</term> means <def>the Commission for International Agricultural Research established by <ref href="#sec-7">section 7</ref>.</def></p>
            <p><term refersTo="#term-commissioner">Commissioner</term> means <def>a Commissioner of the Commission appointed in accordance with <ref href="#sec-10">section 10</ref> and includes the Chair.</def></p>
            <p><term refersTo="#term-council">Council</term> means <def>the Policy Advisory Council.</def></p>
            <p><b><i>institution</i></b> includes:</p>
          </content>

            <num>a</num>
            <content>
              <p>an organization, group or body, whether incorporated or unincorporated; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-I__sec-3__para-b">
            <num>b</num>
            <content>
              <p>a Department of State, or an authority, of the Commonwealth or of a State or Territory.</p>
            </content>
            <content>
              <p><term refersTo="#term-international-agricultural-research-centre">international agricultural research centre</term> means <def>an independent, non-profit organisation that: is internationally funded; and carries out: research into sustainable improvements in the productivity of agriculture, forestry and fisheries in developing countries; and activities related to such research.</def></p>

          </paragraph>

            <num>a</num>
            <content>
              <p>is internationally funded; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-I__sec-3__para-b">
            <num>b</num>
            <content>
              <p>carries out:</p>
            </content>
          </paragraph>
          <paragraph eId="part-I__sec-3__para-i">
            <num>i</num>
            <content>
              <p>research into sustainable improvements in the productivity of agriculture, forestry and fisheries in developing countries; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-I__sec-3__para-ii">
            <num>ii</num>
            <content>
              <p>activities related to such research.</p>
            </content>
            <content>
              <p><term refersTo="#term-paid-work">paid work</term> means <def>work for financial gain or reward (whether as an employee, a self-employed person or otherwise).</def></p>
              <p><term refersTo="#term-performance-standard">performance standard</term> means <def>the performance standard determined under subsection 24(4).</def></p>
              <p><term refersTo="#term-president">President</term> means <def>the President of the Council.</def></p>
              <p><b><i>serious misconduct</i></b> has a meaning affected by subsection 29C(1A).</p>

        <num>II</num>
        <heading>The Australian Centre for International Agricultural Research</heading>
        <section eId="part-II__sec-4">
          <num>4</num>
          <heading>Establishment of Centre</heading>
          <subsection eId="part-II__sec-4__subsec-1">
            <num>1</num>
            <content>
              <p>There is hereby established a Centre by the name of the Australian Centre for International Agricultural Research.</p>
            </content>
          </subsection>
          <subsection eId="part-II__sec-4__subsec-2">
            <num>2</num>
            <content>
              <p>The Centre consists of:</p>
            </content>
            <paragraph eId="part-II__sec-4__subsec-2__para-a">
              <num>a</num>
              <content>
                <p><role refersTo="#ceo">the CEO</role>; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-II__sec-4__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>the staff of the Centre referred to in <ref href="#sec-30">section 30</ref>.</p>
              </content>
            </paragraph>
          </subsection>
        </section>
        <section eId="part-II__sec-4A">
          <num>4A</num>
          <heading>The Chief Executive Officer</heading>
          <content>
            <p>There is to be a Chief Executive Officer of the Centre.</p>
          </content>

          <heading>Functions of the CEO</heading>
          <subsection eId="part-II__sec-5__subsec-1">
            <num>1</num>
            <content>
              <p>The functions of <role refersTo="#ceo">the CEO</role> are:</p>
            </content>
            <paragraph eId="part-II__sec-5__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>to formulate programs and policies with respect to agricultural research for either or both of the following purposes:</p>
              </content>
            </paragraph>
            <paragraph eId="part-II__sec-5__subsec-1__para-i">
              <num>i</num>
              <content>
                <p>identifying agricultural problems of developing countries;</p>
              </content>
            </paragraph>
            <paragraph eId="part-II__sec-5__subsec-1__para-ii">
              <num>ii</num>
              <content>
                <p>finding solutions to agricultural problems of developing countries;</p>
              </content>
            </paragraph>
            <paragraph eId="part-II__sec-5__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>to commission agricultural research by persons or institutions (whether the research is to be conducted in Australia or overseas) in accordance with such programs and policies; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-II__sec-5__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>to communicate to persons and institutions the results of such agricultural research; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-II__sec-5__subsec-1__para-d">
              <num>d</num>
              <content>
                <p>to establish and fund training schemes related to the research programs referred to in paragraph (a); and</p>
              </content>
            </paragraph>
            <paragraph eId="part-II__sec-5__subsec-1__para-e">
              <num>e</num>
              <content>
                <p>to conduct and fund development activities related to those research programs; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-II__sec-5__subsec-1__para-f">
              <num>f</num>
              <content>
                <p>to fund international agricultural research centres.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-II__sec-5__subsec-2">
            <num>2</num>
            <content>
              <p><role refersTo="#ceo">The CEO</role> must, in performing his or her functions with respect to agricultural research, have regard to the need for persons or institutions in developing countries to share in that research.</p>
            </content>
          </subsection>
          <subsection eId="part-II__sec-5__subsec-3">
            <num>3</num>
            <content>
              <p>Nothing in this section authorises, or permits, <role refersTo="#ceo">the CEO</role> to carry out research on behalf of the Commonwealth.</p>
            </content>
          </subsection>
          <subsection eId="part-II__sec-5__subsec-4">
            <num>4</num>
            <content>
              <p><role refersTo="#ceo">The CEO</role> must, in performing his or her functions, comply with any directions given to <role refersTo="#ceo">the CEO</role> under section 5A.</p>

          </subsection>
        </section>

          <num>5A</num>
          <heading>Power of Minister to give directions</heading>
          <subsection eId="part-II__sec-5A__subsec-1">
            <num>1</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> may, by writing, give directions to <role refersTo="#ceo">the CEO</role> with respect to the performance of <role refersTo="#ceo">the CEO</role>’s functions under this Act (including in relation to the appropriate strategic direction <role refersTo="#ceo">the CEO</role> should take in performing his or her functions).</p>

              <p>The Commission for International Agricultural Research is established by this section.</p>

            <heading>Constitution of the Commission</heading>
            <content>
              <p>The Commission consists of:</p>
            </content>
            <paragraph eId="part-III__dvs-1__sec-8__para-a">

                <p>a Chair; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-III__dvs-1__sec-8__para-b">
              <num>b</num>

                <p>6 other Commissioners.</p>

            <heading>Functions of the Commission</heading>
            <content>
              <p>The functions of the Commission are:</p>
            </content>

                <p>to provide advice to <role refersTo="#minister">the Minister</role> in relation to the formulation of programs of the kind referred to in paragraph 5(1)(a); and</p>
              </content>
            </paragraph>

              <num>b</num>
              <content>
                <p>to provide advice to <role refersTo="#minister">the Minister</role> in relation to the funding of things referred to in paragraphs 5(1)(d), (e) and (f); and</p>

              <p>A Commissioner holds office on the terms and conditions (if any) in relation to matters not covered by this Act that are determined by the Governor-General.</p>

            <heading>Remuneration and allowances</heading>
            <subsection eId="part-III__dvs-2__sec-13__subsec-1">
              <num>1</num>

                <p>A Commissioner is to be paid the remuneration that is determined by the Remuneration Tribunal. If no determination of that remuneration by the Tribunal is in operation, <role refersTo="#commissioner">the Commissioner</role> is to be paid the remuneration that is prescribed by the regulations.</p>

            </subsection>

              <num>2</num>

                <p>A Commissioner is to be paid the allowances that are prescribed by the regulations.</p>

            <heading>Acting Commissioner</heading>

              <p><role refersTo="#minister">The Minister</role> may appoint a person to act as a Commissioner:</p>

                <p>during a vacancy in the office of <role refersTo="#commissioner">the Commissioner</role> (whether or not an appointment has previously been made to the office); or</p>

              <num>b</num>
              <content>
                <p>during any period, or during all periods, when <role refersTo="#commissioner">the Commissioner</role> is absent from duty or from Australia, or is, for any reason, unable to perform the duties of the office.</p>

          </section>

            <heading>Resignation</heading>
            <content>
              <p>A Commissioner may resign his or her appointment by giving the Governor-General a written resignation.</p>
            </content>
          </section>

            <heading>Termination of appointment</heading>
            <subsection eId="part-III__dvs-2__sec-16A__subsec-1">
              <num>1</num>
              <content>
                <p>The Governor-General may terminate the appointment of a Commissioner for misbehaviour or physical or mental incapacity.</p>
              </content>
            </subsection>
            <subsection eId="part-III__dvs-2__sec-16A__subsec-2">
              <num>2</num>
              <content>
                <p>The Governor-General must terminate the appointment of a Commissioner if:</p>
              </content>
              <paragraph eId="part-III__dvs-2__sec-16A__subsec-2__para-a">

                <content>
                  <p><role refersTo="#commissioner">the Commissioner</role>:</p>
                </content>
              </paragraph>
              <paragraph eId="part-III__dvs-2__sec-16A__subsec-2__para-i">

                  <p>becomes bankrupt; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-III__dvs-2__sec-16A__subsec-2__para-ii">

                  <p>applies to take the benefit of any law for the relief of bankrupt or insolvent debtors; or</p>
                </content>
              </paragraph>

                  <p>compounds with his or her creditors; or</p>
                </content>
              </paragraph>

                <p>The Commission must hold such meetings as are necessary for the efficient performance of its functions.</p>

                <p>Meetings are to be held at the times and places determined by the Commission.</p>

                <p><role refersTo="#commissioner">The Commissioner</role> presiding at a meeting of the Commission has a deliberative vote and, if necessary, also a casting vote.</p>

            <heading>Conduct of meetings</heading>

                <p>The Commission may, subject to this Division, regulate proceedings at its meetings as it considers appropriate.</p>

                <p>The Commission must ensure that minutes of its meetings are kept.</p>

            </subsection>

        <heading>The Policy Advisory Council</heading>

            <p>There is hereby established a Council by the name of the Policy Advisory Council.</p>
          </content>
        </section>
        <section eId="part-IV__sec-18">

          <heading>Function of Council</heading>
          <subsection eId="part-IV__sec-18__subsec-1">
            <num>1</num>
            <content>
              <p>The function of the Council is to provide advice to <role refersTo="#minister">the Minister</role> regarding:</p>
            </content>
            <paragraph eId="part-IV__sec-18__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>agricultural problems of developing countries; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-IV__sec-18__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>programs and policies with respect to agricultural research for either or both of the following purposes:</p>
              </content>
            </paragraph>
            <paragraph eId="part-IV__sec-18__subsec-1__para-i">
              <num>i</num>
              <content>
                <p>identifying agricultural problems of developing countries;</p>
              </content>
            </paragraph>
            <paragraph eId="part-IV__sec-18__subsec-1__para-ii">
              <num>ii</num>
              <content>
                <p>finding solutions to agricultural problems of developing countries.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-IV__sec-18__subsec-2">
            <num>2</num>
            <content>
              <p>The Council shall provide advice under subsection (1) on such occasions as it thinks fit and on request by <role refersTo="#minister">the Minister</role>.</p>
            </content>
          </subsection>
          <subsection eId="part-IV__sec-18__subsec-3">
            <num>3</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> shall arrange for a copy of any advice provided by the Council to be furnished to the Commission.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-IV__sec-19">

          <heading>Constitution of Council</heading>
          <subsection eId="part-IV__sec-19__subsec-1">
            <num>1</num>
            <content>
              <p>The Council shall consist of:</p>
            </content>

              <num>a</num>
              <content>
                <p>a President;</p>
              </content>
            </paragraph>
            <paragraph eId="part-IV__sec-19__subsec-1__para-c">
              <num>c</num>

                <p>the person for the time being occupying, or performing the duties of, the position in the Australian Public Service known as Director-General, Australian International Development Assistance Bureau, or a person nominated by the Director-General; and</p>

            </paragraph>

              <num>d</num>
              <content>
                <p>not fewer than 9 nor more than 11 other members.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-IV__sec-19__subsec-2">

              <p>The members referred to in paragraphs (1)(a) and (d) shall be appointed by <role refersTo="#minister">the Minister</role>.</p>
            </content>
          </subsection>
          <subsection eId="part-IV__sec-19__subsec-2A">
            <num>2A</num>
            <content>
              <p>A person cannot be appointed as a member of the Council if the person is a Commissioner.</p>
            </content>
          </subsection>
          <subsection eId="part-IV__sec-19__subsec-3">

            <content>
              <p>In appointing persons under subsection (2):</p>
            </content>
            <paragraph eId="part-IV__sec-19__subsec-3__para-a">
              <num>a</num>
              <content>
                <p><role refersTo="#minister">the Minister</role> shall have regard to:</p>
              </content>
            </paragraph>
            <paragraph eId="part-IV__sec-19__subsec-3__para-i">
              <num>i</num>
              <content>
                <p>the knowledge of the persons concerning agricultural problems of developing countries; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-IV__sec-19__subsec-3__para-ii">
              <num>ii</num>
              <content>
                <p>the experience of the persons in organizing or conducting agricultural research; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-IV__sec-19__subsec-3__para-b">
              <num>b</num>
              <content>
                <p><role refersTo="#minister">the Minister</role> shall ensure that a substantial number of the members of the Council are residents of countries other than Australia.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-IV__sec-19__subsec-4">
            <num>4</num>
            <content>
              <p>An appointed member of the Council:</p>
            </content>
            <paragraph eId="part-IV__sec-19__subsec-4__para-a">
              <num>a</num>
              <content>
                <p>shall be appointed to be a part-time member; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-IV__sec-19__subsec-4__para-b">
              <num>b</num>
              <content>
                <p>holds office for such term, not exceeding 3 years, as is specified in the instrument of his or her appointment.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-IV__sec-19__subsec-5">
            <num>5</num>
            <content>
              <p>The performance of the functions of the Council is not affected by reason only of the existence of either or both of the following circumstances:</p>
            </content>
            <paragraph eId="part-IV__sec-19__subsec-5__para-a">
              <num>a</num>
              <content>
                <p>a vacancy in the office of President;</p>
              </content>
            </paragraph>
            <paragraph eId="part-IV__sec-19__subsec-5__para-c">
              <num>c</num>
              <content>
                <p>the number of members referred to in paragraph (1)(d) having fallen below 9 for a period of not more than 3 months.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-IV__sec-19__subsec-6">
            <num>6</num>
            <content>
              <p>The appointment of a person under subsection (2) is not invalidated, and shall not be called in question, by reason of a defect or irregularity in, or in connection with, his or her appointment.</p>
            </content>
          </subsection>
        </section>

          <heading>President to keep Council informed</heading>

            <p>The President shall ensure that the Council is kept adequately informed with respect to the affairs of the Centre.</p>
          </content>
        </section>
        <section eId="part-IV__sec-21">
          <num>21</num>
          <heading>Termination of appointment</heading>
          <subsection eId="part-IV__sec-21__subsec-1">
            <num>1</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> may terminate the appointment of an appointed member of the Council by reason of misbehaviour or physical or mental incapacity.</p>
            </content>
          </subsection>
          <subsection eId="part-IV__sec-21__subsec-2">
            <num>2</num>
            <content>
              <p>If an appointed member of the Council:</p>
            </content>
            <paragraph eId="part-IV__sec-21__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>becomes bankrupt, applies to take the benefit of any law for the relief of bankrupt or insolvent debtors, compounds with his or her creditors or makes an assignment of his or her remuneration for their benefit; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-IV__sec-21__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>is absent, except on leave granted by the Council, from 3 consecutive meetings of the Council otherwise than on business of the Council undertaken with the approval of the Council;</p>

                <p><role refersTo="#minister">the Minister</role> shall terminate the appointment of that member.</p>
              </content>
            </paragraph>
          </subsection>
        </section>
        <section eId="part-IV__sec-22">
          <num>22</num>
          <heading>Resignation</heading>

            <p>An appointed member of the Council may resign his or her office by writing signed by him or her and delivered to <role refersTo="#minister">the Minister</role>.</p>

          <heading>Meetings of Council</heading>
          <subsection eId="part-IV__sec-23__subsec-1">
            <num>1</num>
            <content>
              <p>The President:</p>
            </content>

              <num>a</num>
              <content>
                <p>shall convene such meetings of the Council as he or she considers necessary for the conduct of its business; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-IV__sec-23__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>shall, on receipt of a written request signed by no fewer than 6 members of the Council, convene a meeting of the Council.</p>

              <p>Subject to subsection (7), all questions arising at a meeting of the Council shall be decided by a majority of the votes of the members present and voting, including the member presiding.</p>

              <p>In the event of an equality of votes on a motion proposed at a meeting of the Council, the motion shall be taken not to be passed.</p>

          <heading>Appointment of CEO</heading>

              <p><role refersTo="#ceo">The CEO</role> is to be appointed by the Governor-General by written instrument.</p>
            </content>
          </subsection>
          <subsection eId="part-V__sec-24__subsec-2">

              <p><role refersTo="#ceo">The CEO</role> holds office for the period specified in the instrument of appointment. The period must not exceed 5 years.</p>
            </content>
          </subsection>

              <p>A person may be appointed as both <role refersTo="#ceo">the CEO</role> and a Commissioner (including the Chair).</p>

            <p><role refersTo="#ceo">The CEO</role> holds office on the terms and conditions (if any) in relation to matters not covered by this Act that are determined by the Governor-General.</p>

          <num>27</num>
          <heading>Remuneration and allowances</heading>
          <subsection eId="part-V__sec-27__subsec-1">
            <num>1</num>
            <content>
              <p><role refersTo="#ceo">The CEO</role> is to be paid the remuneration that is determined by the Remuneration Tribunal. If no determination of that remuneration by the Tribunal is in operation, <role refersTo="#ceo">the CEO</role> is to be paid the remuneration that is prescribed by the regulations.</p>

          </subsection>
          <subsection eId="part-V__sec-27__subsec-2">
            <num>2</num>
            <content>
              <p><role refersTo="#ceo">The CEO</role> is to be paid the allowances that are prescribed by the regulations.</p>

          </subsection>

              <p>	(3)	This section has effect subject to the <i>Remuneration Tribunal Act 1973</i>.</p>

          </subsection>
        </section>

          <heading>Other paid work</heading>

            <p><role refersTo="#ceo">The CEO</role> must not engage in paid work outside the duties of <role refersTo="#ceo">the CEO</role> without <role refersTo="#minister">the Minister</role>’s approval.</p>
          </content>
        </section>
        <section eId="part-V__sec-29">
          <num>29</num>
          <heading>Acting CEO</heading>
          <content>
            <p><role refersTo="#minister">The Minister</role> may appoint a person to act as <role refersTo="#ceo">the CEO</role>:</p>
          </content>
          <paragraph eId="part-V__sec-29__para-a">
            <num>a</num>
            <content>
              <p>during a vacancy in the office of <role refersTo="#ceo">the CEO</role> (whether or not an appointment has previously been made to the office); or</p>
            </content>
          </paragraph>
          <paragraph eId="part-V__sec-29__para-b">
            <num>b</num>
            <content>
              <p>during any period, or during all periods, when <role refersTo="#ceo">the CEO</role> is suspended from office, is absent from duty or from Australia, or is, for any reason, unable to perform the duties of the office.</p>

          </subsection>
          <subsection eId="part-V__sec-29A__subsec-2">
            <num>2</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> may grant <role refersTo="#ceo">the CEO</role> leave of absence, other than recreation leave, on the terms and conditions as to remuneration or otherwise that <role refersTo="#minister">the Minister</role> determines.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-V__sec-29B">
          <num>29B</num>
          <heading>Resignation</heading>
          <content>
            <p><role refersTo="#ceo">The CEO</role> may resign his or her appointment by giving the Governor-General a written resignation.</p>
          </content>
        </section>
        <section eId="part-V__sec-29BA">
          <num>29BA</num>
          <heading>Suspension of appointment</heading>
          <subsection eId="part-V__sec-29BA__subsec-1">
            <num>1</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> may, by notice in writing, suspend the appointment of <role refersTo="#ceo">the CEO</role> if <role refersTo="#minister">the Minister</role> believes that the suspension would be in the interests of the Centre.</p>
            </content>
          </subsection>
          <subsection eId="part-V__sec-29BA__subsec-2">
            <num>2</num>
            <content>
              <p>The appointment is suspended for such period (not exceeding 3 months) as <role refersTo="#minister">the Minister</role> considers appropriate in all of the circumstances. That period must be specified in the notice.</p>
            </content>
          </subsection>
          <subsection eId="part-V__sec-29BA__subsec-3">
            <num>3</num>
            <content>
              <p>The suspension of the appointment of <role refersTo="#ceo">the CEO</role> does not affect any entitlement of <role refersTo="#ceo">the CEO</role> to be paid remuneration and allowances.</p>
            </content>
            <content>
              <p>Extension of suspension</p>
            </content>
          </subsection>
          <subsection eId="part-V__sec-29BA__subsec-4">
            <num>4</num>
            <content>
              <p>Before the end of the period of suspension (including that period as previously extended under this subsection), <role refersTo="#minister">the Minister</role> may, by notice in writing, extend the period of suspension if:</p>
            </content>
            <paragraph eId="part-V__sec-29BA__subsec-4__para-a">
              <num>a</num>
              <content>
                <p><role refersTo="#minister">the Minister</role> believes that the extension would be in the interests of the Centre; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-V__sec-29BA__subsec-4__para-b">
              <num>b</num>
              <content>
                <p>subsection (7) applies.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-V__sec-29BA__subsec-5">
            <num>5</num>
            <content>
              <p>The suspension is extended for such period as <role refersTo="#minister">the Minister</role> considers appropriate in all of the circumstances. The period of suspension, as extended, must be specified in the notice.</p>
            </content>
          </subsection>
          <subsection eId="part-V__sec-29BA__subsec-6">
            <num>6</num>
            <content>
              <p>The period of suspension, as extended, must not exceed:</p>
            </content>
            <paragraph eId="part-V__sec-29BA__subsec-6__para-a">
              <num>a</num>
              <content>
                <p>if subsection (7) applies—12 months; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-V__sec-29BA__subsec-6__para-b">
              <num>b</num>
              <content>
                <p>otherwise—3 months.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-V__sec-29BA__subsec-7">
            <num>7</num>
            <content>
              <p>For the purposes of paragraphs (4)(b) and (6)(a), this subsection applies if:</p>
            </content>
            <paragraph eId="part-V__sec-29BA__subsec-7__para-a">
              <num>a</num>
              <content>
                <p>when <role refersTo="#minister">the Minister</role> extends the period of suspension:</p>
              </content>
            </paragraph>
            <paragraph eId="part-V__sec-29BA__subsec-7__para-i">
              <num>i</num>
              <content>
                <p>an inquiry to which subsection (8) applies is being conducted; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-V__sec-29BA__subsec-7__para-ii">
              <num>ii</num>
              <content>
                <p><role refersTo="#minister">the Minister</role> is satisfied that extending the period of suspension is necessary for the purposes of the conduct of the inquiry, <role refersTo="#minister">the Minister</role> considering the findings or report of the inquiry or action being taken in response to the findings or report; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-V__sec-29BA__subsec-7__para-b">
              <num>b</num>
              <content>
                <p>both:</p>
              </content>
            </paragraph>
            <paragraph eId="part-V__sec-29BA__subsec-7__para-i">
              <num>i</num>
              <content>
                <p>an inquiry to which subsection (8) applies was being conducted at any time in the 4 weeks before <role refersTo="#minister">the Minister</role> extends the period of suspension; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-V__sec-29BA__subsec-7__para-ii">
              <num>ii</num>
              <content>
                <p>when <role refersTo="#minister">the Minister</role> extends the period of suspension, <role refersTo="#minister">the Minister</role> is satisfied that extending the period of suspension is necessary for the purposes of <role refersTo="#minister">the Minister</role> considering the findings or report of the inquiry or action being taken in response to the findings or report.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-V__sec-29BA__subsec-8">
            <num>8</num>
            <content>
              <p>This subsection applies to an inquiry if:</p>
            </content>
            <paragraph eId="part-V__sec-29BA__subsec-8__para-a">
              <num>a</num>
              <content>
                <p>the inquiry commences before the end of 3 months starting at the start of the period of suspension; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-V__sec-29BA__subsec-8__para-b">
              <num>b</num>
              <content>
                <p>the inquiry is any of the following:</p>
              </content>
            </paragraph>
            <paragraph eId="part-V__sec-29BA__subsec-8__para-i">
              <num>i</num>
              <content>
                <p>	(i)	an inquiry by the Australian Public Service Commissioner under <i>Public Service Act 1999</i> into whether the CEO has breached the APS Code of Conduct;<ref href="#sec-41A">section 41A</ref> of the </p>
              </content>
            </paragraph>
            <paragraph eId="part-V__sec-29BA__subsec-8__para-ii">
              <num>ii</num>
              <content>
                <p>	(ii)	a corruption investigation (within the meaning of the <i>National Anti</i><i>-</i><i>Corruption Commission Act 2022</i>) into a corruption issue involving conduct of the CEO;</p>
              </content>
            </paragraph>
            <paragraph eId="part-V__sec-29BA__subsec-8__para-iii">
              <num>iii</num>
              <content>
                <p>an inquiry, conducted at the request or direction of <role refersTo="#minister">the Minister</role>, into whether <role refersTo="#ceo">the CEO</role>’s conduct or behaviour amounts to serious misconduct by <role refersTo="#ceo">the CEO</role>.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-V__sec-29BA__subsec-9">
            <num>9</num>
            <content>
              <p>	(9)	Subsections (4) to (8) do not limit the application of subsection 33(3) of the <i>Acts Interpretation Act 1901</i> in relation to a notice under subsection (1) of this section.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-V__sec-29C">
          <num>29C</num>
          <heading>Termination of appointment</heading>
          <subsection eId="part-V__sec-29C__subsec-1">
            <num>1</num>
            <content>
              <p>The Governor-General may terminate the appointment of <role refersTo="#ceo">the CEO</role>:</p>
            </content>
            <paragraph eId="part-V__sec-29C__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>for misbehaviour; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-V__sec-29C__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>if <role refersTo="#ceo">the CEO</role> is unable to perform the duties of <role refersTo="#ceo">the CEO</role>’s office because of physical or mental incapacity; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-V__sec-29C__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>if <role refersTo="#ceo">the CEO</role>’s conduct or behaviour amounts to serious misconduct by <role refersTo="#ceo">the CEO</role>.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-V__sec-29C__subsec-1A">
            <num>1A</num>
            <content>
              <p>	(1A)	Without limiting the circumstances in which the CEO’s conduct or behaviour amounts to serious misconduct by the CEO, the CEO’s conduct or behaviour amounts to <b><i>serious misconduct</i></b> by the CEO in the following circumstances:</p>
            </content>
            <paragraph eId="part-V__sec-29C__subsec-1A__para-a">
              <num>a</num>
              <content>
                <p>both:</p>
              </content>
            </paragraph>
            <paragraph eId="part-V__sec-29C__subsec-1A__para-i">
              <num>i</num>
              <content>
                <p>the conduct or behaviour constitutes a breach of the APS Code of Conduct; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-V__sec-29C__subsec-1A__para-ii">
              <num>ii</num>
              <content>
                <p><role refersTo="#minister">the Minister</role> is satisfied that the breach is serious enough to justify termination of <role refersTo="#ceo">the CEO</role>’s appointment;</p>
              </content>
            </paragraph>
            <paragraph eId="part-V__sec-29C__subsec-1A__para-b">
              <num>b</num>
              <content>
                <p>	(b)	the conduct or behaviour constitutes unlawful discrimination (within the meaning of the <i>Australian Human Rights Commission Act 1986</i>);</p>
              </content>
            </paragraph>
            <paragraph eId="part-V__sec-29C__subsec-1A__para-c">
              <num>c</num>
              <content>
                <p>	(c)	an investigation report (within the meaning of the <i>National Anti</i><i>-</i><i>Corruption Commission Act 2022</i>) includes a finding or opinion that the CEO has engaged, is engaging or will engage in:</p>
              </content>
            </paragraph>
            <paragraph eId="part-V__sec-29C__subsec-1A__para-i">
              <num>i</num>
              <content>
                <p>corrupt conduct (within the meaning of that Act); or</p>
              </content>
            </paragraph>
            <paragraph eId="part-V__sec-29C__subsec-1A__para-ii">
              <num>ii</num>
              <content>
                <p>conduct that could constitute or involve corrupt conduct.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-V__sec-29C__subsec-2">
            <num>2</num>
            <content>
              <p>The Governor-General must terminate the appointment of <role refersTo="#ceo">the CEO</role> if:</p>
            </content>
            <paragraph eId="part-V__sec-29C__subsec-2__para-a">
              <num>a</num>
              <content>
                <p><role refersTo="#ceo">the CEO</role>:</p>
              </content>
            </paragraph>
            <paragraph eId="part-V__sec-29C__subsec-2__para-i">
              <num>i</num>
              <content>
                <p>becomes bankrupt; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-V__sec-29C__subsec-2__para-ii">
              <num>ii</num>
              <content>
                <p>applies to take the benefit of any law for the relief of bankrupt or insolvent debtors; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-V__sec-29C__subsec-2__para-iii">
              <num>iii</num>
              <content>
                <p>compounds with his or her creditors; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-V__sec-29C__subsec-2__para-iv">
              <num>iv</num>
              <content>
                <p>makes an assignment of his or her remuneration for the benefit of his or her creditors; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-V__sec-29C__subsec-2__para-b">
              <num>b</num>
              <content>
                <p><role refersTo="#ceo">the CEO</role> is absent, except on leave of absence, for 14 consecutive days or for 28 days in any 12 months; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-V__sec-29C__subsec-2__para-c">
              <num>c</num>
              <content>
                <p><role refersTo="#ceo">the CEO</role> engages, except with <role refersTo="#minister">the Minister</role>’s approval, in paid work outside the duties of his or her office; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-V__sec-29C__subsec-2__para-d">
              <num>d</num>
              <content>
                <p>	(d)	the CEO fails, without reasonable excuse, to comply with <i>Public Governance, Performance and Accountability Act 2013</i> (which deals with the duty to disclose interests) or rules made for the purposes of that section.<ref href="#sec-29">section 29</ref> of the </p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-V__sec-29C__subsec-3">
            <num>3</num>
            <content>
              <p>The Governor-General may terminate the appointment of <role refersTo="#ceo">the CEO</role> if, in <role refersTo="#minister">the Minister</role>’s opinion, having regard to the performance standard (if any), the performance of <role refersTo="#ceo">the CEO</role> has been unsatisfactory.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-V__sec-29E">
          <num>29E</num>
          <heading>CEO not subject to direction by the Commission on certain matters</heading>
          <content>
            <p>To avoid doubt, <role refersTo="#ceo">the CEO</role> is not subject to direction by the Commission in relation to <role refersTo="#ceo">the CEO</role>’s performance of functions, or exercise of powers, under:</p>
          </content>
          <paragraph eId="part-V__sec-29E__para-a">
            <num>a</num>
            <content>
              <p>	(a)	the <i>Public Governance, Performance and Accountability Act 2013</i>; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-V__sec-29E__para-b">
            <num>b</num>
            <content>
              <p>	(b)	the <i>Public Service Act 1999</i>;</p>
            </content>
            <content>
              <p>in relation to the Centre.</p>
            </content>
          </paragraph>
        </section>
      </part>

        <heading>Staff and consultants</heading>
        <section eId="part-VI__sec-30">
          <num>30</num>
          <heading>Staff</heading>
          <subsection eId="part-VI__sec-30__subsec-1">
            <num>1</num>
            <content>
              <p>	(1)	The staff of the Centre shall be persons engaged under the <i>Public Service Act 1999</i>.</p>
            </content>
          </subsection>
          <subsection eId="part-VI__sec-30__subsec-2">
            <num>2</num>
            <content>
              <p>	(2)	For the purposes of the <i>Public Service Act 1999</i>:</p>
            </content>
            <paragraph eId="part-VI__sec-30__subsec-2__para-a">
              <num>a</num>
              <content>
                <p><role refersTo="#ceo">the CEO</role> and the APS employees assisting <role refersTo="#ceo">the CEO</role> together constitute a Statutory Agency; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-VI__sec-30__subsec-2__para-b">
              <num>b</num>
              <content>
                <p><role refersTo="#ceo">the CEO</role> is the Head of that Statutory Agency.</p>
              </content>
            </paragraph>
          </subsection>
        </section>
        <section eId="part-VI__sec-31">
          <num>31</num>
          <heading>Arrangements relating to staff</heading>
          <subsection eId="part-VI__sec-31__subsec-1">
            <num>1</num>
            <content>
              <p>	(1)	The CEO may arrange with an Agency Head (within the meaning of the <i>Public Service Act 1999</i>) or with a body (other than a company or an association) established for a public purpose by or under a law of the Commonwealth for the services of officers or employees of the Agency or body to be made available to the CEO in relation to the CEO’s functions.</p>
            </content>
          </subsection>
          <subsection eId="part-VI__sec-31__subsec-2">
            <num>2</num>
            <content>
              <p><role refersTo="#ceo">The CEO</role> may enter into an arrangement with the appropriate authority of a State or Territory for the services of officers or employees of the Public Service of the State or Territory, or of a body established for a public purpose by or under a law of the State or Territory, to be made available to <role refersTo="#ceo">the CEO</role> in relation to <role refersTo="#ceo">the CEO</role>’s functions.</p>

          </subsection>
        </section>

          <heading>Consultants</heading>
          <content>
            <p><role refersTo="#ceo">The CEO</role> may, on behalf of the Commonwealth, engage consultants to perform services for <role refersTo="#ceo">the CEO</role> related to <role refersTo="#ceo">the CEO</role>’s functions.</p>
          </content>
        </section>

            <p>A misdescribed amendment is an amendment that does not accurately describe how an amendment is to be made.
