      <p>BE IT ENACTED by the Queen, and the Senate and the House of Representatives of the Commonwealth of Australia, as follows:</p>

        <heading>Short title</heading>
        <content>
          <p><b>1.</b> This Act may be cited as the <i>Customs Administration (Transitional Provisions and Consequential Amendments) Act 1986.</i></p>
          <p>
            <b>Commencement</b>
          </p>
        </content>

        <num>2</num>
        <subsection eId="sec-2__subsec-1">
          <num>1</num>
          <content>
            <p><b>2.</b> <b>(1) </b>Subject to sub-section (2), this Act shall come into operation on the day on which it receives the Royal Assent.</p>

        </subsection>
        <subsection eId="sec-2__subsec-2">
          <num>2</num>
          <content>
            <p><b>(2) </b>The amendments made by this Act to sub-section 10 (5) of the <i>Bounty (Electric Motors) Act 1984</i>,<i> </i>paragraph 7 (4) (a) of the <i>Bounty (High Alloy Steel Products) Act 1983</i>, paragraph 7 (4) (a) of the <i>Bounty</i></p>
          </content>
          <content>
            <p><i>(Injection-</i><i>moulding</i><i> Equipment) Act 1979</i>,<i> </i>sub-section 6 (5) of the <i>Bounty (Two-Stroke Engines) Act 1984 </i>and sub-sections 267 (2) and (3) of the <i>Customs Act 1901 </i>shall be deemed to have come into operation immediately after the commencement of the <i>Customs Administration (Transitional Provisions and Consequential Amendments) Act 1985.</i></p>

      <section eId="sec-3">
        <num>3</num>
        <heading>Amendments</heading>
        <content>
          <p><b>3.</b> The Acts specified in the Schedule are amended as set out in the Schedule.</p>
          <p>
            <b>Transitional</b>
          </p>
        </content>
      </section>
      <section eId="sec-4">
        <num>4</num>
        <subsection eId="sec-4__subsec-1">
          <num>1</num>
          <content>
            <p><b>4.</b> <b>(1) </b>Where—</p>
          </content>
          <content>
            <p>(a) a Minister, or a delegate of a Minister, made an appointment, gave an authorisation or direction, granted a permission, approval or exemption, made a determination, declaration, order, requirement or by-law, gave or published a notice or signed or issued any other instrument before the commencement of this section under a power conferred on that Minister by a provision of an Act;</p>
            <p>(b) that provision is amended by this Act with effect from that commencement so as to confer that power on the Comptroller-General of Customs; and</p>
            <p>(c) that appointment, authorisation, direction, permission, approval, exemption, determination, declaration, order, requirement, by-law, notice or other instrument was in force immediately before that commencement,</p>
            <p>the appointment, authorisation, direction, permission, approval, exemption, determination, declaration, order, requirement, by-law, notice or other instrument continues in force after that commencement as if it had been duly made, given, granted, published, signed or issued, as the case may be, by the Comptroller-General of Customs under that provision as so amended.</p>

        </subsection>
        <subsection eId="sec-4__subsec-2">
          <num>2</num>
          <content>
            <p><b>(2)</b> Where—</p>
          </content>
          <content>
            <p>(a) a Minister, or a delegate of a Minister, did, or refused to do, before the commencement of this section any act or thing not mentioned in sub-section (1) under a power conferred on that Minister by a provision of an Act; and</p>
            <p>(b) that provision is amended by this Act with effect from that commencement so as to confer that power on the Comptroller-General of Customs,</p>
            <p>the Act in which that provision was included, as that Act has effect as amended by this Act, applies as if the Comptroller-General had duly done, or refused to do, as the case may be, that act or thing.</p>

        </subsection>
        <subsection eId="sec-4__subsec-3">
          <num>3</num>
          <content>
            <p><b>(3)</b> Where the Comptroller-General of Customs, or a delegate of the Comptroller-General of Customs, published a notice in the <i>Gazette </i>before the commencement of this section under the power conferred on the</p>
          </content>
          <content>
            <p>Comptroller-General of Customs by sub-<i>Customs Tariff Act 1982, </i>the notice continues in force after that commencement as if it had been duly published by the Minister for Industry, Technology and Commerce under sub-section 25 (1) of the <i>Customs Tariff Act 1982 </i>as amended by this Act and may be revoked by that Minister in accordance with sub-section 25 (3) of that Act as so amended.<ref href="#sec-25">section 25</ref> (1) of the </p>
          </content>
        </subsection>
        <subsection eId="sec-4__subsec-4">
          <num>4</num>
          <content>
            <p><b>(4) </b>Where a notice that was published in the <i>Gazette </i>by a Minister, or a delegate of a Minister, before the commencement of the <i>Customs Administration (Transitional Provisions and Consequential Amendments) Act 1985 </i>under the power conferred on that Minister by sub-section 25 (1) of the <i>Customs Tariff Act 1982—</i></p>
          </content>
          <content>
            <p>(a) has, by virtue of <i>Customs Administration (Transitional Provisions and Consequential Amendments) Act 1985, </i>continued in force after that commencement as if it had been published by the Comptroller-General of Customs under sub-section 25 (1) of the <i>Customs Tariff Act 1982 </i>as amended by the <i>Customs Administration (Transitional Provisions and Consequential Amendments) Act 1985</i>; and<ref href="#sec-4">section 4</ref> of the </p>
            <p>(b) was in force immediately before the commencement of this section,</p>
            <p>the notice has, after the commencement of this section, the effect that it would have if sub-<i>Customs Tariff Act 1982 </i>had not been amended by the <i>Customs Administration (Transitional Provisions and Consequential Amendments) Act 1985 </i>and section 4 of that last-mentioned Act had not been enacted.<ref href="#sec-25">section 25</ref> (1) of the </p>
