          <heading>Short title</heading>
          <content>
            <p>		This Act may be cited as the <i>Aboriginal Land </i><i>and Waters</i><i> (Jervis Bay Territory) Act 1986</i>.</p>
          </content>
        </section>
        <section eId="part-I__sec-2">
          <num>2</num>
          <heading>Interpretation</heading>
          <content>
            <p>In this Act, unless the contrary intention appears:</p>
            <p><term refersTo="#term-aboriginal">Aboriginal</term> means <def>a person who is a member of the Aboriginal race of Australia.</def></p>
            <p><term refersTo="#term-aboriginal-land">Aboriginal Land</term> means <def>land that is Aboriginal Land because of a declaration under <ref href="#part-III">Part III</ref>.</def></p>
            <p><term refersTo="#term-agency">Agency</term> has the meaning given by <def><ref href="#sec-7">section 7</ref> of <ref href="">the Public Service Act 1999</ref>.</def></p>
            <p><term refersTo="#term-agency-head">Agency Head</term> has the meaning given by <def><ref href="#sec-7">section 7</ref> of <ref href="">the Public Service Act 1999</ref>.</def></p>
            <p><term refersTo="#term-agency-minister">Agency Minister</term> has the meaning given by <def><ref href="#sec-7">section 7</ref> of <ref href="">the Public Service Act 1999</ref>.</def></p>
            <p><term refersTo="#term-annual-general-meeting">annual general meeting</term> means <def>a meeting of the Council convened under <ref href="#sec-20">section 20</ref> or 21.</def></p>
            <p><term refersTo="#term-australian-national-botanic-gardens">Australian National Botanic Gardens</term> means <def>the areas declared to be a reserve, and to which that name was assigned, by Proclamation under subsection 7(2) of <ref class="unresolved">the National Parks and Wildlife Conservation Act 1975</ref>.</def></p>
            <p><term refersTo="#term-authority">Authority</term> means <def>an Authority established by or under a law of the Commonwealth or a law in force in the Territory.</def></p>
            <p><term refersTo="#term-booderee-botanic-gardens">Booderee Botanic Gardens</term> means <def>the part of the Australian National Botanic Gardens in the Jervis Bay Territory.</def></p>
            <p><term refersTo="#term-booderee-national-park">Booderee National Park</term> means <def>the Commonwealth reserve of that name within the Jervis Bay Territory under <ref href="#dvs-4">Division 4</ref> of <ref href="#part-1">Part 1</ref>5 of <ref href="">the Environment Protection and Biodiversity Conservation Act 1999</ref>.</def></p>
            <p><term refersTo="#term-chairperson">Chairperson</term> means <def>the Chairperson of the Council.</def></p>
            <p><term refersTo="#term-chief-executive-officer">Chief Executive Officer</term> means <def>the Chief Executive Officer of the Council.</def></p>
            <p><term refersTo="#term-child">child</term> means <def>an individual who has not reached 18 years.</def></p>
            <p><term refersTo="#term-community">Community</term> means <def>the community known as the Wreck Bay Aboriginal Community.</def></p>
            <p><term refersTo="#term-council">Council</term> means <def>the Wreck Bay Aboriginal Community Council established by <ref href="#sec-4">section 4</ref>.</def></p>
            <p><term refersTo="#term-deputy-chairperson">Deputy Chairperson</term> means <def>the Deputy Chairperson of the Council.</def></p>
            <p><term refersTo="#term-director">Director</term> has the meaning given by <def><ref href="">the Environment Protection and Biodiversity Conservation Act 1999</ref>.</def></p>
            <p><term refersTo="#term-eligible-child">eligible child</term> means <def>a child with a connection to the Community.</def></p>
            <p><term refersTo="#term-executive-committee">executive committee</term> means <def>the committee established by <ref href="#sec-28">section 28</ref>.</def></p>
            <p><term refersTo="#term-executive-member">executive member</term> means <def>a member of the executive committee and includes the Chairperson, the Deputy Chairperson and the Secretary.</def></p>
            <p><term refersTo="#term-fit-and-proper-person">fit and proper person</term> has the meaning given by <def><ref href="#sec-34F">section 34F</ref>.</def></p>
            <p><b><i>general meeting</i></b> means:</p>

              <p>an annual general meeting; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-I__sec-2__para-b">
            <num>b</num>
            <content>
              <p>a special general meeting.</p>
            </content>
            <content>
              <p><b><i>land</i></b>, unless the contrary intention appears, includes any seabed or any subsoil.</p>
              <p><b><i>minerals</i></b> includes:</p>
            </content>
          </paragraph>
          <paragraph eId="part-I__sec-2__para-a">
            <num>a</num>
            <content>
              <p>gold, silver, copper, tin and other metals;</p>
            </content>
          </paragraph>
          <paragraph eId="part-I__sec-2__para-b">
            <num>b</num>
            <content>
              <p>coal, shale, petroleum and valuable earths and substances;</p>
            </content>
          </paragraph>
          <paragraph eId="part-I__sec-2__para-c">
            <num>c</num>
            <content>
              <p>mineral substances;</p>
            </content>
          </paragraph>
          <paragraph eId="part-I__sec-2__para-d">
            <num>d</num>
            <content>
              <p>gems and precious stones; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-I__sec-2__para-e">
            <num>e</num>
            <content>
              <p>ores and other substances containing minerals;</p>
            </content>
            <content>
              <p>whether suspended in water or not, but does not include water.</p>
              <p><term refersTo="#term-register">Register</term> means <def>the register kept in accordance with <ref href="#dvs-2">Division 2</ref> of <ref href="#part-IV">Part IV</ref>.</def></p>
              <p><term refersTo="#term-registered-member">registered member</term> means <def>a person whose name is on the Register.</def></p>
              <p><term refersTo="#term-registrar">Registrar</term> means <def>the Registrar of the Wreck Bay Aboriginal Community Council.</def></p>
              <p><term refersTo="#term-schedule-land">Schedule Land</term> means <def>the land described in the Schedule.</def></p>
              <p><term refersTo="#term-secretary">Secretary</term> means <def>the Secretary of the Council.</def></p>
              <p><term refersTo="#term-special-general-meeting">special general meeting</term> means <def>a meeting of the Council convened under <ref href="#sec-23">section 23</ref>.</def></p>
              <p><term refersTo="#term-territory">Territory</term> means <def>the Jervis Bay Territory.</def></p>

          <heading>Act to bind Crown</heading>
          <subsection eId="part-I__sec-3__subsec-1">

            <content>
              <p>This Act binds the Crown in right of the Commonwealth.</p>
            </content>
          </subsection>

            <num>2</num>
            <content>
              <p>Nothing in this Act renders the Crown in right of the Commonwealth liable to be prosecuted for an offence.</p>

          <heading>Application of the Criminal Code</heading>
          <content>
            <p>		Chapter 2 of the <i>Criminal Code </i>applies to all offences against this Act.</p>

        <heading>Establishment, constitution, functions and powers of Council</heading>

          <heading>Establishment of Council</heading>
          <subsection eId="part-II__sec-4__subsec-1">
            <num>1</num>
            <content>
              <p>There is established by this Act a council by the name of the Wreck Bay Aboriginal Community Council.</p>
            </content>
          </subsection>
          <subsection eId="part-II__sec-4__subsec-2">
            <num>2</num>
            <content>
              <p>The Council:</p>
            </content>
            <paragraph eId="part-II__sec-4__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>is a body corporate with perpetual succession;</p>
              </content>
            </paragraph>
            <paragraph eId="part-II__sec-4__subsec-2__para-b">
              <num>b</num>

              <p>All courts, judges and persons acting judicially shall take judicial notice of the imprint of the common seal of the Council appearing on a document and shall presume that the document was duly sealed.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-II__sec-4A">
          <num>4A</num>
          <heading>Accountable authority</heading>
          <subsection eId="part-II__sec-4A__subsec-1">
            <num>1</num>
            <content>
              <p>	(1)	For the purposes of the <i>Public Governance, Performance and Accountability Act 2013</i>, the accountable authority of the Council consists of:</p>
            </content>
            <paragraph eId="part-II__sec-4A__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>the executive committee; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-II__sec-4A__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>the Chief Executive Officer.</p>
              </content>

          </subsection>

              <p>The Chairperson must preside at all meetings of the members of the accountable authority of the Council at which the Chairperson is present.</p>
            </content>
          </subsection>
          <subsection eId="part-II__sec-4A__subsec-3">
            <num>3</num>
            <content>
              <p>Where the Chairperson is not present at a meeting of the members of the accountable authority of the Council:</p>
            </content>
            <paragraph eId="part-II__sec-4A__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>the Deputy Chairperson must preside at the meeting; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-II__sec-4A__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>if the Deputy Chairperson is not present at the meeting—the members present must appoint one of their number to preside at the meeting.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-II__sec-4A__subsec-4">
            <num>4</num>
            <content>
              <p>At a meeting of the members of the accountable authority of the Council:</p>
            </content>
            <paragraph eId="part-II__sec-4A__subsec-4__para-a">
              <num>a</num>
              <content>
                <p>questions arising must be determined by a majority of the votes of the members present and voting; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-II__sec-4A__subsec-4__para-b">
              <num>b</num>
              <content>
                <p>the person presiding at the meeting has a deliberative vote and, in the case of an equality of votes, also has a casting vote.</p>
              </content>
            </paragraph>
          </subsection>
        </section>
        <section eId="part-II__sec-5">
          <num>5</num>
          <heading>Constitution of Council</heading>
          <content>
            <p>The Council at any time shall consist of the persons who are registered members at that time.</p>
          </content>
        </section>
        <section eId="part-II__sec-6">
          <num>6</num>
          <heading>Functions of Council</heading>
          <content>
            <p>The functions of the Council are, subject to and in accordance with this Act:</p>
          </content>
          <paragraph eId="part-II__sec-6__para-a">
            <num>a</num>
            <content>
              <p>to hold title to Aboriginal Land;</p>
            </content>
          </paragraph>
          <paragraph eId="part-II__sec-6__para-b">
            <num>b</num>
            <content>
              <p>to exercise, for the benefit of registered members and eligible children, the Council’s powers as owner of Aboriginal Land and of any other land owned by the Council;</p>
            </content>
          </paragraph>
          <paragraph eId="part-II__sec-6__para-c">
            <num>c</num>
            <content>
              <p>to make representations to <role refersTo="#minister">the Minister</role> in relation to land that the Council considers should become Aboriginal Land and in relation to other matters relevant to this Act;</p>
            </content>
          </paragraph>
          <paragraph eId="part-II__sec-6__para-ca">
            <num>ca</num>
            <content>
              <p>in consultation with <role refersTo="#minister">the Minister</role>, to consider and, where practicable, take action for the benefit of registered members and eligible children in relation to the housing, social welfare, education, training or health needs of registered members and eligible children;</p>
            </content>
          </paragraph>
          <paragraph eId="part-II__sec-6__para-cb">
            <num>cb</num>
            <content>
              <p>to provide community services to registered members and eligible children;</p>
            </content>
          </paragraph>
          <paragraph eId="part-II__sec-6__para-cc">
            <num>cc</num>
            <content>
              <p>to protect and conserve natural and cultural sites on Aboriginal Land;</p>
            </content>
          </paragraph>
          <paragraph eId="part-II__sec-6__para-cd">
            <num>cd</num>
            <content>
              <p>to engage in land use planning in relation to Aboriginal Land;</p>
            </content>
          </paragraph>
          <paragraph eId="part-II__sec-6__para-ce">
            <num>ce</num>
            <content>
              <p>to manage and maintain Aboriginal Land; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-II__sec-6__para-cf">
            <num>cf</num>
            <content>
              <p>to conduct business enterprises for the economic or social benefit of registered members and eligible children;</p>
            </content>
          </paragraph>
          <paragraph eId="part-II__sec-6__para-d">
            <num>d</num>
            <content>
              <p>such functions as are conferred on it by a provision of this Act (other than this section); and</p>
            </content>
          </paragraph>
          <paragraph eId="part-II__sec-6__para-e">
            <num>e</num>
            <content>
              <p>any functions relating to registered members and eligible children conferred on the Council by the regulations.</p>
            </content>
          </paragraph>
        </section>
        <section eId="part-II__sec-7">
          <num>7</num>
          <heading>Powers of Council</heading>
          <subsection eId="part-II__sec-7__subsec-1">
            <num>1</num>
            <content>
              <p>In addition to any other powers conferred on it by this Act, the Council has, subject to this Act, power to do all things necessary or convenient to be done for or in connection with the performance of its functions.</p>
            </content>
          </subsection>
          <subsection eId="part-II__sec-7__subsec-2">
            <num>2</num>
            <content>
              <p>Without limiting the generality of subsection (1), the powers of the Council referred to in subsection (1) include, subject to this Act, power:</p>
            </content>
            <paragraph eId="part-II__sec-7__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>to acquire, hold or dispose of real and personal property;</p>
              </content>
            </paragraph>
            <paragraph eId="part-II__sec-7__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>to enter into contracts for the purposes of this Act; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-II__sec-7__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>to employ staff.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-II__sec-7__subsec-3">
            <num>3</num>
            <content>
              <p>The Council shall not, except with the approval of <role refersTo="#minister">the Minister</role>, enter into a contract involving the payment by the Council of an amount exceeding $1 million, or, if a higher amount is prescribed, that amount.</p>
            </content>
          </subsection>
        </section>
      </part>
      <part eId="part-III">
        <num>III</num>
        <heading>Grant of land to Council</heading>
        <section eId="part-III__sec-8">
          <num>8</num>
          <heading>Initial grant of land</heading>
          <subsection eId="part-III__sec-8__subsec-1">
            <num>1</num>
            <content>
              <p>As soon as practicable after the first annual general meeting, <role refersTo="#minister">the Minister</role>:</p>
            </content>
            <paragraph eId="part-III__sec-8__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>shall sign an instrument that declares that, at the time at which a copy of the instrument is given to the Chairperson, the Schedule Land shall become Aboriginal Land; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-III__sec-8__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>shall give a copy of the instrument, or cause a copy of the instrument to be given, to the Chairperson.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-III__sec-8__subsec-2">
            <num>2</num>
            <content>
              <p>At the time at which the instrument referred to in subsection (1) is given to the Chairperson in accordance with paragraph (1)(b), the Schedule Land becomes Aboriginal Land.</p>
            </content>
          </subsection>
          <subsection eId="part-III__sec-8__subsec-3">
            <num>3</num>
            <content>
              <p>	(3)	As soon as practicable after the Minister has complied with subsection (1), the Minister shall cause to be published in the <i>Gazette </i>a notice stating that the Schedule Land has become Aboriginal Land.</p>
            </content>
          </subsection>
          <subsection eId="part-III__sec-8__subsec-4">
            <num>4</num>
            <content>
              <p>Any failure to comply with the requirements of subsection (3) does not affect the operation of subsection (1).</p>
            </content>
          </subsection>
        </section>
        <section eId="part-III__sec-9">
          <num>9</num>
          <heading>Later grants of land</heading>
          <subsection eId="part-III__sec-9__subsec-1">
            <num>1</num>
            <content>
              <p>Where, at any time after the Schedule Land has become Aboriginal Land, <role refersTo="#minister">the Minister</role> becomes satisfied that:</p>
            </content>
            <paragraph eId="part-III__sec-9__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>vacant Crown land in the Territory that adjoins Aboriginal Land is of significance to the Aboriginals who are members of the Community; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-III__sec-9__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>it would be appropriate to grant the first-mentioned land to the Council;</p>
              </content>
              <content>
                <p><role refersTo="#minister">the Minister</role> may, by instrument in writing specifying the first-mentioned land, declare that the first-mentioned land is Aboriginal Land.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-III__sec-9__subsec-2">
            <num>2</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> shall, as soon as practicable after making an instrument under subsection (1):</p>
            </content>
            <paragraph eId="part-III__sec-9__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>	(a)	cause a copy of the instrument to be published in the <i>Gazette</i>; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-III__sec-9__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>cause a copy of the instrument to be laid before each House of the Parliament.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-III__sec-9__subsec-3">
            <num>3</num>
            <content>
              <p>Either House of the Parliament, within 15 sitting days of that House after a copy of an instrument has been laid before that House under subsection (2), may, in pursuance of a motion upon notice, pass a resolution disallowing the instrument.</p>
            </content>
          </subsection>
          <subsection eId="part-III__sec-9__subsec-4">
            <num>4</num>
            <content>
              <p>Where:</p>
            </content>
            <paragraph eId="part-III__sec-9__subsec-4__para-a">
              <num>a</num>
              <content>
                <p>a notice referred to in subsection (3) is given with respect to an instrument; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-III__sec-9__subsec-4__para-b">
              <num>b</num>
              <content>
                <p>at the expiration of the period during which a resolution disallowing the instrument could have been passed:</p>
              </content>
            </paragraph>
            <paragraph eId="part-III__sec-9__subsec-4__para-i">
              <num>i</num>
              <content>
                <p>the notice has not been withdrawn and the relevant motion has not been called on; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-III__sec-9__subsec-4__para-ii">
              <num>ii</num>
              <content>
                <p>the relevant motion has been called on, moved and seconded and has not been withdrawn or otherwise disposed of;</p>
              </content>
              <content>
                <p>the instrument shall be deemed to have been disallowed.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-III__sec-9__subsec-5">
            <num>5</num>
            <content>
              <p>If:</p>
            </content>
            <paragraph eId="part-III__sec-9__subsec-5__para-a">
              <num>a</num>
              <content>
                <p>neither House of the Parliament passes a resolution in accordance with subsection (3) disallowing an instrument made under subsection (1); and</p>
              </content>
            </paragraph>
            <paragraph eId="part-III__sec-9__subsec-5__para-b">
              <num>b</num>
              <content>
                <p>the instrument has not been deemed to have been disallowed under subsection (4);</p>
              </content>
              <content>
                <p>the instrument takes effect, and the land specified in the instrument becomes Aboriginal Land, on the day immediately following the last day upon which a resolution disallowing the instrument could have been passed.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-III__sec-9__subsec-6">
            <num>6</num>
            <content>
              <p>If, before the expiration of 15 sitting days of a House of the Parliament after a copy of an instrument made under subsection (1) has been laid before that House:</p>
            </content>
            <paragraph eId="part-III__sec-9__subsec-6__para-a">
              <num>a</num>
              <content>
                <p>the House of Representatives is dissolved or expires, or the Parliament is prorogued; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-III__sec-9__subsec-6__para-b">
              <num>b</num>
              <content>
                <p>a resolution for the disallowance of the instrument has not been passed by the first-mentioned House;</p>
              </content>
              <content>
                <p>the copy of the instrument shall, for the purposes of this section, be deemed to have been laid before that first-mentioned House on the first sitting day of that first-mentioned House after the dissolution, expiry or prorogation, as the case may be.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-III__sec-9__subsec-7">
            <num>7</num>
            <content>
              <p>	(7)	Where an instrument made under subsection (1) takes effect, the Minister shall cause a notice to that effect to be published in the <i>Gazette.</i></p>
            </content>
          </subsection>
          <subsection eId="part-III__sec-9__subsec-8">
            <num>8</num>
            <content>
              <p><i>	</i>(8)	Any failure to comply with the requirements of subsection (7) does not affect the operation of subsection (5).</p>
            </content>
          </subsection>
        </section>
        <section eId="part-III__sec-9A">
          <num>9A</num>
          <heading>Grants of land within Booderee National Park etc. to Council</heading>
          <subsection eId="part-III__sec-9A__subsec-1">
            <num>1</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> may, by legislative instrument, declare that land within the Booderee National Park is Aboriginal Land if he or she is satisfied that:</p>
            </content>
            <paragraph eId="part-III__sec-9A__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>the land is of significance to the Aboriginals who are members of the Community; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-III__sec-9A__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>it would be appropriate to grant the land to the Council.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-III__sec-9A__subsec-3">
            <num>3</num>
            <content>
              <p>	(3)	If the Minister proposes to make a declaration under subsection (1), the Minister must publish a notice in the <i>Gazette</i>:</p>
            </content>
            <paragraph eId="part-III__sec-9A__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>stating his or her intention to do so; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-III__sec-9A__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>describing the land that would become Aboriginal Land under the declaration.</p>
              </content>
            </paragraph>
          </subsection>
        </section>
        <section eId="part-III__sec-10">
          <num>10</num>
          <heading>Vesting of land</heading>
          <content>
            <p>Where, because of <ref href="#sec-8">section 8</ref>, 9 or 9A, land becomes Aboriginal Land, that land (including all rights, title and interests in that land) is vested in the Council without any conveyance, transfer or assignment.</p>
          </content>
        </section>
        <section eId="part-III__sec-11">
          <num>11</num>
          <heading>Registration of vesting</heading>
          <content>
            <p>Where <role refersTo="#secretary">the Secretary</role> of the Department that deals with the administration of the Territory becomes aware that land (including any right, title or interest in land) has vested in the Council because of section 10, <role refersTo="#secretary">the Secretary</role> of that Department shall cause such action to be taken as he or she considers necessary to register the vesting under the laws in force in the Territory.</p>
          </content>
        </section>
        <section eId="part-III__sec-12">
          <num>12</num>
          <heading>Buildings etc. vest automatically</heading>
          <content>
            <p>Subject to <ref href="#sec-13">section 13</ref>, where, because of <ref href="#sec-10">section 10</ref>, land vests in the Council, buildings and improvements on that land vest in the Council.</p>
          </content>
        </section>
        <section eId="part-III__sec-13">
          <num>13</num>
          <heading>Occupation by Commonwealth etc.</heading>
          <subsection eId="part-III__sec-13__subsec-1">
            <num>1</num>
            <content>
              <p>Where, on the vesting of land in the Council because of <role refersTo="#authority">the Authority</role>, as the case may be, is entitled to continue that occupation or use for such period as the land or part of the land, as the case may be, is required by the Commonwealth or <role refersTo="#authority">the Authority</role>.<ref href="#sec-10">section 10</ref>, the land or part of the land is being occupied or used by the Commonwealth or by an Authority, the Commonwealth or </p>
            </content>
          </subsection>
          <subsection eId="part-III__sec-13__subsec-2">
            <num>2</num>
            <content>
              <p>During the period for which, because of subsection (1), the Commonwealth or an Authority is entitled to the occupation or use of land, or part of land, vested in the Council, any buildings or improvements on that land, or part of land, as the case may be, shall be deemed to be the property of the Commonwealth or <role refersTo="#authority">the Authority</role>, as the case may be.</p>
            </content>
          </subsection>
          <subsection eId="part-III__sec-13__subsec-3">
            <num>3</num>
            <content>
              <p>Nothing in this section prevents the granting by the Council under <ref href="#sec-38">section 38</ref> of a lease of land to which subsection (1) applies to the Commonwealth or an Authority and, if such a lease is granted, the land ceases to be land to which this section applies.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-III__sec-14">
          <num>14</num>
          <heading>Reservation of minerals</heading>
          <content>
            <p>Where, because of this Part, land vests in the Council, the vesting is subject to the reservation that the right to any minerals existing in their natural condition on or below the surface of the land remains with the Commonwealth.</p>
          </content>
        </section>
      </part>
      <part eId="part-IV">
        <num>IV</num>
        <heading>Administration of Council</heading>
        <division eId="part-IV__dvs-1">
          <num>1</num>
          <heading>Registrar of Council</heading>
          <section eId="part-IV__dvs-1__sec-15">
            <num>15</num>
            <heading>Registrar of Council</heading>
            <subsection eId="part-IV__dvs-1__sec-15__subsec-1">
              <num>1</num>
              <content>
                <p>There shall be a Registrar of the Wreck Bay Aboriginal Community Council.</p>
              </content>
            </subsection>
            <subsection eId="part-IV__dvs-1__sec-15__subsec-2">
              <num>2</num>
              <content>
                <p>The functions of <role refersTo="#registrar">the Registrar</role> are such functions as are conferred on <role refersTo="#registrar">the Registrar</role> by a provision of this Act or by the regulations.</p>
              </content>
            </subsection>
            <subsection eId="part-IV__dvs-1__sec-15__subsec-3">
              <num>3</num>
              <content>
                <p><role refersTo="#registrar">The Registrar</role> is to be a person who is appointed by <role refersTo="#minister">the Minister</role> in writing and who:</p>
              </content>
              <paragraph eId="part-IV__dvs-1__sec-15__subsec-3__para-a">
                <num>a</num>
                <content>
                  <p>is an APS employee in an Agency for which <role refersTo="#minister">the Minister</role> is the Agency Minister; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-IV__dvs-1__sec-15__subsec-3__para-b">
                <num>b</num>
                <content>
                  <p>holds or performs the duties of an office in a body established by or under an Act administered by <role refersTo="#minister">the Minister</role>.</p>
                </content>
              </paragraph>
            </subsection>
          </section>
          <section eId="part-IV__dvs-1__sec-16">
            <num>16</num>
            <heading>Delegation by Registrar</heading>
            <subsection eId="part-IV__dvs-1__sec-16__subsec-1">
              <num>1</num>
              <content>
                <p><role refersTo="#registrar">The Registrar</role> may, either generally or as otherwise provided by the instrument of delegation, by writing signed by <role refersTo="#registrar">the Registrar</role>, delegate to:</p>
              </content>
              <paragraph eId="part-IV__dvs-1__sec-16__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>an APS employee in an Agency for which <role refersTo="#minister">the Minister</role> is the Agency Minister, being an APS employee approved for the purpose by the Agency Head; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-IV__dvs-1__sec-16__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>a person holding or performing the duties of an office in a body established by or under an Act administered by <role refersTo="#minister">the Minister</role>, being a person approved for the purpose by the person in charge of the body;</p>
                </content>
                <content>
                  <p>all or any of the functions and powers of <role refersTo="#registrar">the Registrar</role> under this Act, other than this power of delegation.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-IV__dvs-1__sec-16__subsec-2">
              <num>2</num>
              <content>
                <p>A function or power so delegated, when performed or exercised by the delegate, shall, for the purposes of this Act, be deemed to have been performed or exercised by <role refersTo="#registrar">the Registrar</role>.</p>
              </content>
            </subsection>
            <subsection eId="part-IV__dvs-1__sec-16__subsec-3">
              <num>3</num>
              <content>
                <p>A delegation under subsection (1) does not prevent the performance of a function or the exercise of a power by <role refersTo="#registrar">the Registrar</role>.</p>
              </content>
            </subsection>
          </section>
        </division>
        <division eId="part-IV__dvs-2">
          <num>2</num>
          <heading>Register of members of Council</heading>
          <section eId="part-IV__dvs-2__sec-17">
            <num>17</num>
            <heading>Register</heading>
            <subsection eId="part-IV__dvs-2__sec-17__subsec-1">
              <num>1</num>
              <content>
                <p>There shall be prepared and kept in accordance with this Part a register to be known as the Register of Members of the Wreck Bay Aboriginal Community Council.</p>
              </content>
            </subsection>
            <subsection eId="part-IV__dvs-2__sec-17__subsec-2">
              <num>2</num>
              <content>
                <p>As soon as practicable after the commencement of this Act, the Department shall prepare and give to <role refersTo="#registrar">the Registrar</role> a list of the persons who the Department is satisfied are Aboriginals who:</p>
              </content>
              <paragraph eId="part-IV__dvs-2__sec-17__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>resided in the Territory on <date date="1986-05-24">24 May 1986</date>; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-IV__dvs-2__sec-17__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>have attained the age of 18 years.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-IV__dvs-2__sec-17__subsec-3">
              <num>3</num>
              <content>
                <p>As soon as practicable after the Department has given <role refersTo="#registrar">the Registrar</role> the list referred to in subsection (2), <role refersTo="#registrar">the Registrar</role> shall prepare the Register and enter on it the names on the list.</p>
              </content>
            </subsection>

                <p>Subject to subsection (2), where, at a general meeting, a motion that a specified person is an Aboriginal member of the Community is passed in accordance with subsection 26(2), <role refersTo="#secretary">the Secretary</role> shall enter the name of that person on the Register.</p>

                <p><role refersTo="#secretary">The Secretary</role> shall not enter the name of a person on the Register in accordance with subsection (1) unless and until <role refersTo="#secretary">the Secretary</role> is satisfied that the person has attained the age of 18 years.</p>

                  <p><role refersTo="#secretary">the Secretary</role> shall remove the name of that person from the Register.</p>

            <heading>Particulars on Register etc.</heading>

              </paragraph>
            </subsection>

                <p>Where the name of a person is entered on the Register in accordance with this Part, <role refersTo="#secretary">the Secretary</role> may enter next to that name particulars of the place of living of that person.</p>

            </subsection>

        </division>

          <num>3</num>
          <heading>Meetings of Council</heading>
          <section eId="part-IV__dvs-3__sec-20">
            <num>20</num>
            <heading>First annual general meeting</heading>
            <subsection eId="part-IV__dvs-3__sec-20__subsec-1">
              <num>1</num>
              <content>
                <p>As soon as practicable after the preparation of the Register, <role refersTo="#registrar">the Registrar</role> shall convene the first annual general meeting of the Council.</p>
              </content>
            </subsection>
            <subsection eId="part-IV__dvs-3__sec-20__subsec-2">
              <num>2</num>
              <content>
                <p>Not later than 30 days before the first annual general meeting, <role refersTo="#registrar">the Registrar</role> shall cause notice of the day, time and place of the meeting to be given to the registered members in such manner as <role refersTo="#registrar">the Registrar</role> considers appropriate.</p>
              </content>
            </subsection>
            <subsection eId="part-IV__dvs-3__sec-20__subsec-3">
              <num>3</num>
              <content>
                <p><role refersTo="#registrar">The Registrar</role> shall preside at the first annual general meeting until a person is declared to have been elected as the Chairperson.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-IV__dvs-3__sec-21">
            <num>21</num>
            <heading>Convening of subsequent annual general meetings</heading>
            <subsection eId="part-IV__dvs-3__sec-21__subsec-1">
              <num>1</num>
              <content>
                <p>The Chairperson shall, not later than 30 days before the expiration of 12 months from the day on which an annual general meeting finished, convene an annual general meeting of the Council to be held on a day not later than the expiration of the 12 months.</p>
              </content>
            </subsection>
            <subsection eId="part-IV__dvs-3__sec-21__subsec-2">
              <num>2</num>
              <content>
                <p>If <role refersTo="#registrar">the Registrar</role> becomes satisfied that, because of vacancies in the offices of Chairperson and Deputy Chairperson or because the holders of those offices are unable to perform the duties of those offices, an annual general meeting required to be convened in accordance with subsection (1) would not be convened, <role refersTo="#registrar">the Registrar</role> shall convene that meeting.</p>
              </content>
            </subsection>
            <subsection eId="part-IV__dvs-3__sec-21__subsec-3">
              <num>3</num>
              <content>
                <p>The person convening an annual general meeting under this section shall, not later than 30 days before the day fixed for the meeting, cause notice of the day, time and place of the meeting to be given to the registered members, in such manner as has been determined by the Council, or, if no manner has been determined, such manner as the person considers appropriate.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-IV__dvs-3__sec-22">
            <num>22</num>
            <heading>Purpose of annual general meetings</heading>
            <subsection eId="part-IV__dvs-3__sec-22__subsec-1">
              <num>1</num>
              <content>
                <p>A purpose of an annual general meeting is the conduct of the elections of the executive members in accordance with <ref href="#dvs-4">Division 4</ref>.</p>
              </content>
            </subsection>
            <subsection eId="part-IV__dvs-3__sec-22__subsec-2">
              <num>2</num>
              <content>
                <p>An annual general meeting may deal with any matters relating to the functions of the Council.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-IV__dvs-3__sec-23">
            <num>23</num>
            <heading>Convening of special general meetings</heading>
            <subsection eId="part-IV__dvs-3__sec-23__subsec-1">
              <num>1</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> or the Chairperson may convene a special general meeting of the Council.</p>
              </content>
            </subsection>
            <subsection eId="part-IV__dvs-3__sec-23__subsec-2">
              <num>2</num>
              <content>
                <p>The Chairperson shall, on receipt of a written request signed by not less than 10% of the registered members, convene a special general meeting of the Council.</p>
              </content>
            </subsection>
            <subsection eId="part-IV__dvs-3__sec-23__subsec-2A">
              <num>2A</num>
              <content>
                <p>A registered member may, on receipt of a written request signed by not less than 10% of the registered members, convene a special general meeting of the Council to consider and vote on a motion that all executive members be removed from office.</p>

                  <p>if the registered member does not attend the meeting—a motion that all executive members be removed from office must not be moved at the meeting.</p>

              </paragraph>
            </subsection>
            <subsection eId="part-IV__dvs-3__sec-23__subsec-2C">

                <p><role refersTo="#registrar">The Registrar</role> must convene a special general meeting if required to do so by subsection 29(3A).</p>

            <heading>Purpose of special general meetings</heading>

              <p>A special general meeting convened under subsection 23(1) or (2) may deal with any matters relating to the functions of the Council.</p>
            </content>
          </section>
          <section eId="part-IV__dvs-3__sec-25">
            <num>25</num>
            <heading>Procedure at general meetings</heading>
            <subsection eId="part-IV__dvs-3__sec-25__subsec-1">
              <num>1</num>
              <content>
                <p>Without limiting subsections 20(3) and 30(2), a general meeting may be attended by:</p>
              </content>
              <paragraph eId="part-IV__dvs-3__sec-25__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>the registered members; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-IV__dvs-3__sec-25__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>such persons as the meeting determines by resolution may be present at the meeting.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-IV__dvs-3__sec-25__subsec-2">
              <num>2</num>
              <content>
                <p>The Chairperson shall preside at all general meetings at which he or she is present.</p>
              </content>
            </subsection>
            <subsection eId="part-IV__dvs-3__sec-25__subsec-3">
              <num>3</num>
              <content>
                <p>Where the Chairperson is not present at a general meeting:</p>
              </content>
              <paragraph eId="part-IV__dvs-3__sec-25__subsec-3__para-a">
                <num>a</num>
                <content>
                  <p>the Deputy Chairperson shall preside at the meeting; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-IV__dvs-3__sec-25__subsec-3__para-b">
                <num>b</num>
                <content>
                  <p>if the Deputy Chairperson is not present at the meeting, the registered members present at the meeting shall elect one of their number to preside at the meeting.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-IV__dvs-3__sec-25__subsec-4">
              <num>4</num>
              <content>
                <p>Subject to <ref href="#sec-26A">section 26A</ref>, at a general meeting a quorum is constituted by a majority of the registered members.</p>
              </content>
            </subsection>
            <subsection eId="part-IV__dvs-3__sec-25__subsec-5">
              <num>5</num>
              <content>
                <p>Subject to this Act, the procedure at general meetings shall be determined by the Council.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-IV__dvs-3__sec-26">
            <num>26</num>
            <heading>Voting on motions at general meetings</heading>
            <subsection eId="part-IV__dvs-3__sec-26__subsec-1">
              <num>1</num>
              <content>
                <p>Subject to subsection (2), <ref href="#sec-26A">section 26A</ref> and subsection 33(4), motions moved at a general meeting shall be determined by a majority of the votes of the registered members present at the meeting and voting.</p>
              </content>
            </subsection>
            <subsection eId="part-IV__dvs-3__sec-26__subsec-2">
              <num>2</num>
              <content>
                <p>A motion referred to in subsection 18(1) or (3) moved at a general meeting shall be taken to be passed only if it is supported by not less than two-thirds of the registered members present at the meeting and voting.</p>
              </content>
            </subsection>
            <subsection eId="part-IV__dvs-3__sec-26__subsec-3">
              <num>3</num>
              <content>
                <p>A motion referred to in subsection 18(3) shall not be moved at a general meeting unless notice of the motion was given with, and in the same manner as, the notice of the day, time and place of the meeting given in accordance with this Act.</p>
              </content>
            </subsection>
            <subsection eId="part-IV__dvs-3__sec-26__subsec-4">
              <num>4</num>
              <content>
                <p>The person presiding at a general meeting has a deliberative vote and, in the event of an equality of votes on a motion, other than a motion referred to in subsection 18(1) or (3), also has a casting vote.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-IV__dvs-3__sec-26A">
            <num>26A</num>
            <heading>Quorum at general meetings</heading>
            <subsection eId="part-IV__dvs-3__sec-26A__subsec-1">
              <num>1</num>
              <content>
                <p>Where a general meeting fails because a quorum has not formed within 60 minutes of the notified time of the meeting:</p>
              </content>
              <paragraph eId="part-IV__dvs-3__sec-26A__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>the Chairperson must reconvene the meeting in the same manner, for the same time, in the same place and for the same day of the following week, as the failed meeting; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-IV__dvs-3__sec-26A__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>at the reconvened meeting, a quorum is constituted by 10% of the registered members.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-IV__dvs-3__sec-26A__subsec-2">
              <num>2</num>
              <content>
                <p>Where a general meeting convened under subsection (1) fails because a quorum has not formed within 60 minutes of the notified time of the meeting:</p>
              </content>
              <paragraph eId="part-IV__dvs-3__sec-26A__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>the Chairperson must reconvene the meeting in the same manner, for the same time, in the same place and for the same day of the following week, as the failed meeting; and</p>

                <p>Where it would be unreasonable or impracticable for a meeting to be reconvened at or on the time, day or place referred to in subsection (1) or (2) (as the case may be), the Chairperson may specify another time, day or place, provided the time and day specified are not earlier than the seventh day after the failed meeting, and the place is at, or in the proximity of the place referred to in subsection (1) or (2).</p>
              </content>
            </subsection>
            <subsection eId="part-IV__dvs-3__sec-26A__subsec-4">
              <num>4</num>
              <content>
                <p>	(4)	A reference in subsection (1) or (2) to <b><i>the same manner</i></b> means the manner in which the general meeting would normally be convened, except that notice of the meeting is to be given at least 6 days before the day of the meeting provided for in subsection (1), (2) or (3) (as the case may be).</p>
              </content>
            </subsection>
            <subsection eId="part-IV__dvs-3__sec-26A__subsec-5">

                <p>This section does not affect the operation of subsections 26(2) to (4).</p>

            <paragraph eId="part-IV__dvs-4__sec-27__para-b">

                <p>a Deputy Chairperson of the Council; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-IV__dvs-4__sec-27__para-c">
              <num>c</num>
              <content>
                <p>a Secretary of the Council.</p>
              </content>
            </paragraph>
          </section>
          <section eId="part-IV__dvs-4__sec-28">
            <num>28</num>
            <heading>Executive committee</heading>
            <subsection eId="part-IV__dvs-4__sec-28__subsec-1">
              <num>1</num>
              <content>
                <p>There is established by this Act an executive committee of the Council.</p>
              </content>
            </subsection>
            <subsection eId="part-IV__dvs-4__sec-28__subsec-3">
              <num>3</num>
              <content>
                <p>The executive committee shall consist of:</p>
              </content>
              <paragraph eId="part-IV__dvs-4__sec-28__subsec-3__para-a">
                <num>a</num>
                <content>
                  <p>the Chairperson;</p>
                </content>
              </paragraph>
              <paragraph eId="part-IV__dvs-4__sec-28__subsec-3__para-b">
                <num>b</num>
                <content>
                  <p>the Deputy Chairperson;</p>
                </content>
              </paragraph>
              <paragraph eId="part-IV__dvs-4__sec-28__subsec-3__para-c">
                <num>c</num>
                <content>
                  <p><role refersTo="#secretary">the Secretary</role>; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-IV__dvs-4__sec-28__subsec-3__para-d">
                <num>d</num>
                <content>
                  <p>6 other members.</p>

            <heading>Functions of the executive committee</heading>

                <p>The functions of the executive committee are such functions as are conferred on it by:</p>
              </content>
              <paragraph eId="part-IV__dvs-4__sec-28A__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>a provision of this Act (other than this subsection); or</p>
                </content>
              </paragraph>
              <paragraph eId="part-IV__dvs-4__sec-28A__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>the regulations; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-IV__dvs-4__sec-28A__subsec-1__para-c">
                <num>c</num>
                <content>
                  <p>	(c)	the <i>Public Governance, Performance and Accountability Act 2013</i>.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-IV__dvs-4__sec-28A__subsec-2">
              <num>2</num>
              <content>
                <p>The executive committee may perform any of the functions, and exercise any of the powers, of the Council.</p>
              </content>
            </subsection>
            <subsection eId="part-IV__dvs-4__sec-28A__subsec-3">
              <num>3</num>
              <content>
                <p>In performing any of the functions, or exercising any of the powers, of the Council, the executive committee is to act in accordance with any policies determined by the Council.</p>
              </content>
            </subsection>
            <subsection eId="part-IV__dvs-4__sec-28A__subsec-4">
              <num>4</num>
              <content>
                <p>All acts and things done in the name of, or on behalf of, the Council by the executive committee are to be taken to have been done by the Council.</p>
              </content>
            </subsection>
            <subsection eId="part-IV__dvs-4__sec-28A__subsec-5">
              <num>5</num>
              <content>
                <p>A policy mentioned in subsection (3) is not a legislative instrument.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-IV__dvs-4__sec-29">
            <num>29</num>
            <heading>Executive members</heading>
            <subsection eId="part-IV__dvs-4__sec-29__subsec-1">
              <num>1</num>
              <content>
                <p>A person is not eligible to be an executive member unless:</p>
              </content>
              <paragraph eId="part-IV__dvs-4__sec-29__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>the person is a registered member; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-IV__dvs-4__sec-29__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>the person is a fit and proper person.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-IV__dvs-4__sec-29__subsec-1A">
              <num>1A</num>
              <content>
                <p>Anything done by or in relation to a person purporting to hold the office of an executive member is not invalid merely because the person is not a fit and proper person.</p>
              </content>

            </subsection>

                <p>Subject to subsections (3) and (3A), executive members shall be elected at annual general meetings.</p>
              </content>
            </subsection>
            <subsection eId="part-IV__dvs-4__sec-29__subsec-3">
              <num>3</num>
              <content>
                <p>Where a vacancy occurs in the office of an executive member earlier than 30 days before the next annual general meeting, the Chairperson, or, if there is no Chairperson, <role refersTo="#minister">the Minister</role>, shall convene a special general meeting and an election to fill that vacancy shall be held at that special general meeting.</p>
              </content>
            </subsection>
            <subsection eId="part-IV__dvs-4__sec-29__subsec-3A">
              <num>3A</num>
              <content>
                <p>If all executive members are removed from office under subsection 33(3):</p>
              </content>
              <paragraph eId="part-IV__dvs-4__sec-29__subsec-3A__para-a">
                <num>a</num>
                <content>
                  <p><role refersTo="#registrar">the Registrar</role> must convene a special general meeting; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-IV__dvs-4__sec-29__subsec-3A__para-b">
                <num>b</num>
                <content>
                  <p>an election to fill each of the offices of the executive members must be held at that special general meeting; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-IV__dvs-4__sec-29__subsec-3A__para-c">
                <num>c</num>
                <content>
                  <p>that special general meeting must be held:</p>
                </content>
              </paragraph>
              <paragraph eId="part-IV__dvs-4__sec-29__subsec-3A__para-i">
                <num>i</num>
                <content>
                  <p>not earlier than 30 days after the removal from office of the executive members; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-IV__dvs-4__sec-29__subsec-3A__para-ii">
                <num>ii</num>
                <content>
                  <p>not later than 60 days after the removal from office of the executive members.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-IV__dvs-4__sec-29__subsec-4">
              <num>4</num>
              <content>
                <p>Subject to this Act, an executive member holds his or her office from the time at which he or she is declared to have been elected to the office at an annual general meeting until the time, at the first or second annual general meeting, as the case may be, after that meeting, at which a person is declared to have been elected to that office.</p>
              </content>
            </subsection>
            <subsection eId="part-IV__dvs-4__sec-29__subsec-5">
              <num>5</num>
              <content>
                <p>An executive member is eligible for re-election.</p>
              </content>
            </subsection>
            <subsection eId="part-IV__dvs-4__sec-29__subsec-6">
              <num>6</num>
              <content>
                <p>The functions of <role refersTo="#secretary">the Secretary</role> are:</p>
              </content>
              <paragraph eId="part-IV__dvs-4__sec-29__subsec-6__para-a">
                <num>a</num>
                <content>
                  <p>such functions as are conferred on <role refersTo="#secretary">the Secretary</role> by a provision of this Act (other than this section) or by the regulations; and</p>
                </content>
              </paragraph>

            <num>30</num>
            <heading>Election of executive members</heading>
            <subsection eId="part-IV__dvs-4__sec-30__subsec-1">
              <num>1</num>
              <content>
                <p>	(1)	In this section, <b><i>office</i></b> means the office of an executive member.</p>
              </content>
            </subsection>
            <subsection eId="part-IV__dvs-4__sec-30__subsec-2">
              <num>2</num>
              <content>
                <p>An election to fill an office shall be conducted by:</p>
              </content>
              <paragraph eId="part-IV__dvs-4__sec-30__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>a person appointed, not less than 30 days before the election by a unanimous resolution of the executive members present at a meeting of the executive committee, to conduct the election; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-IV__dvs-4__sec-30__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>if a person has not been appointed in accordance with paragraph (a) or a person so appointed is unable to conduct the election—<role refersTo="#registrar">the Registrar</role>.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-IV__dvs-4__sec-30__subsec-3">
              <num>3</num>
              <content>
                <p>Where an election to fill an office is to be conducted at a general meeting, the notice required by this Act to be given in relation to the meeting shall identify, and call for nominations for, the office.</p>
              </content>
            </subsection>
            <subsection eId="part-IV__dvs-4__sec-30__subsec-4">
              <num>4</num>
              <content>
                <p>Where nominations are called for an office under subsection (3), 2 or more registered members may nominate another registered member for the office.</p>
              </content>
            </subsection>
            <subsection eId="part-IV__dvs-4__sec-30__subsec-5">
              <num>5</num>
              <content>
                <p>A nomination of a person for an office shall:</p>
              </content>
              <paragraph eId="part-IV__dvs-4__sec-30__subsec-5__para-a">
                <num>a</num>
                <content>
                  <p>be in writing;</p>
                </content>
              </paragraph>
              <paragraph eId="part-IV__dvs-4__sec-30__subsec-5__para-b">
                <num>b</num>
                <content>
                  <p>be signed by the person and by the persons nominating the person; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-IV__dvs-4__sec-30__subsec-5__para-c">
                <num>c</num>
                <content>
                  <p>be given, at least 24 hours before the time of the general meeting at which the election is to take place, to the person conducting the election; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-IV__dvs-4__sec-30__subsec-5__para-d">
                <num>d</num>
                <content>
                  <p>be accompanied by a declaration signed by the person that the person is a fit and proper person; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-IV__dvs-4__sec-30__subsec-5__para-e">
                <num>e</num>
                <content>
                  <p>be accompanied by an undertaking signed by the person that, in the event that the person is elected to the office, the person will notify <role refersTo="#registrar">the Registrar</role> if the person ceases to be a fit and proper person while the person holds the office.</p>
                </content>

            </subsection>

              <content>
                <p>Where only one person eligible to be elected to an office is nominated for election to that office, that person shall be taken to be elected to that office.</p>
              </content>
            </subsection>
            <subsection eId="part-IV__dvs-4__sec-30__subsec-7">
              <num>7</num>
              <content>
                <p>Where 2 or more persons eligible for election to an office are nominated for election to that office, a secret ballot shall be conducted to determine which of those persons is to be elected to that office.</p>
              </content>
            </subsection>
            <subsection eId="part-IV__dvs-4__sec-30__subsec-8">
              <num>8</num>
              <content>
                <p>The persons eligible to vote in an election under subsection (7) at a general meeting are the registered members present at that meeting and each such registered member shall have one vote.</p>
              </content>
            </subsection>
            <subsection eId="part-IV__dvs-4__sec-30__subsec-9">
              <num>9</num>
              <content>
                <p>If, in an election of persons to an office, one of the candidates receives more votes than any other candidate, that candidate shall be taken to be elected to that office.</p>
              </content>
            </subsection>
            <subsection eId="part-IV__dvs-4__sec-30__subsec-10">
              <num>10</num>
              <content>
                <p>If, because 2 or more candidates have received the same number of votes at an election for an office, there is a failure of the election, one of those candidates shall be chosen by lot to fill the vacant office concerned and the candidate so chosen shall be taken to have been elected to that office.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-IV__dvs-4__sec-31">
            <num>31</num>
            <heading>Deputy Chairperson to act as Chairperson</heading>
            <subsection eId="part-IV__dvs-4__sec-31__subsec-1">
              <num>1</num>
              <content>
                <p>The Deputy Chairperson shall act as the Chairperson:</p>
              </content>
              <paragraph eId="part-IV__dvs-4__sec-31__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>during a vacancy in the office of Chairperson; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-IV__dvs-4__sec-31__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>during any period, or during all periods, when the Chairperson is absent from Australia, or is, for any reason, unable to perform the duties of the office of Chairperson.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-IV__dvs-4__sec-31__subsec-2">
              <num>2</num>
              <content>
                <p>While the Deputy Chairperson is acting as the Chairperson, the Deputy Chairperson has and may exercise all the powers, and shall perform all the duties, of the Chairperson.</p>
              </content>
            </subsection>
            <subsection eId="part-IV__dvs-4__sec-31__subsec-3">
              <num>3</num>
              <content>
                <p>The validity of anything done by or in relation to the Deputy Chairperson purporting to act in the office of Chairperson under this section shall not be called in question on the ground that the occasion for the person to act had not arisen or had ceased.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-IV__dvs-4__sec-32">
            <num>32</num>
            <heading>Resignation</heading>
            <content>
              <p>An executive member may resign his or her office by writing signed by him or her and delivered to <role refersTo="#registrar">the Registrar</role>.</p>
            </content>
          </section>
          <section eId="part-IV__dvs-4__sec-32A">
            <num>32A</num>
            <heading>Leave of absence</heading>
            <subsection eId="part-IV__dvs-4__sec-32A__subsec-1">
              <num>1</num>
              <content>
                <p>The executive committee may grant leave of absence to any executive member on the terms and conditions that the executive committee determines.</p>
              </content>
            </subsection>
            <subsection eId="part-IV__dvs-4__sec-32A__subsec-2">
              <num>2</num>
              <content>
                <p>To avoid doubt, leave may be granted in respect of a period that occurred wholly or partly before the day on which leave was granted.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-IV__dvs-4__sec-33">
            <num>33</num>
            <heading>Removal of executive members</heading>
            <subsection eId="part-IV__dvs-4__sec-33__subsec-1">
              <num>1</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> may, by writing signed by <role refersTo="#minister">the Minister</role>, remove an executive member from office:</p>
              </content>
              <paragraph eId="part-IV__dvs-4__sec-33__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>for misbehaviour; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-IV__dvs-4__sec-33__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>if the executive member is unable to perform the duties of the executive member’s office because of physical or mental incapacity; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-IV__dvs-4__sec-33__subsec-1__para-c">
                <num>c</num>
                <content>
                  <p>if the executive member ceases to be a registered member.</p>
                </content>

                <p>	(2)	Section 30 of the <i>Public Governance, Performance and Accountability Act 2013</i> applies to an election of an executive member under section 30 of this Act as if the election were an appointment by the Minister.</p>
              </content>
            </subsection>
            <subsection eId="part-IV__dvs-4__sec-33__subsec-3">
              <num>3</num>
              <content>
                <p>If, at a special general meeting, a motion that all executive members be removed from office is passed in accordance with subsection (4), all executive members are removed from office.</p>
              </content>
            </subsection>
            <subsection eId="part-IV__dvs-4__sec-33__subsec-4">
              <num>4</num>
              <content>
                <p>A motion referred to in subsection (3) moved at a special general meeting is taken to be passed only if it is supported by not less than two-thirds of the registered members present at the meeting and voting.</p>
              </content>
            </subsection>
            <subsection eId="part-IV__dvs-4__sec-33__subsec-5">
              <num>5</num>
              <content>
                <p>If an executive member (other than the Chairperson) is absent from 3 consecutive meetings of the executive committee without leave of absence and without reasonable excuse, the Chairperson may, by writing signed by the Chairperson, remove the executive member from office.</p>

                <p>If the Chairperson is absent from 3 consecutive meetings of the executive committee without leave of absence and without reasonable excuse, <role refersTo="#registrar">the Registrar</role> may, by writing signed by <role refersTo="#registrar">the Registrar</role>, remove the Chairperson from office.</p>
              </content>

                <p><role refersTo="#registrar">The Registrar</role> must, by writing signed by <role refersTo="#registrar">the Registrar</role>, remove an executive member from office if:</p>
              </content>
              <paragraph eId="part-IV__dvs-4__sec-33__subsec-7__para-a">
                <num>a</num>
                <content>
                  <p>the executive member is not a fit and proper person; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-IV__dvs-4__sec-33__subsec-7__para-b">
                <num>b</num>
                <content>
                  <p>the executive member was not a fit and proper person at the time when the executive member was nominated for the office of executive member; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-IV__dvs-4__sec-33__subsec-7__para-c">
                <num>c</num>
                <content>
                  <p>the executive member fails, without reasonable excuse, to comply with a notice under subsection 34G(2) or (4).</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-IV__dvs-4__sec-33__subsec-8">
              <num>8</num>
              <content>
                <p>If <role refersTo="#registrar">the Registrar</role> removes the Chairperson from office under subsection (6), <role refersTo="#registrar">the Registrar</role> must:</p>
              </content>
              <paragraph eId="part-IV__dvs-4__sec-33__subsec-8__para-a">
                <num>a</num>
                <content>
                  <p>notify <role refersTo="#minister">the Minister</role>, the Chairperson and the Chief Executive Officer, in writing, of the removal; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-IV__dvs-4__sec-33__subsec-8__para-b">
                <num>b</num>
                <content>
                  <p>do so as soon as practicable after the removal.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-IV__dvs-4__sec-33__subsec-9">
              <num>9</num>
              <content>
                <p>	(9)	Subsection (7) does not affect the operation of <i>Crimes Act 1914</i> (which includes provisions that, in certain circumstances, relieve persons from the requirement to disclose spent convictions and require persons aware of such convictions to disregard them).<ref href="#part-VII">Part VII</ref>C of the </p>

            <heading>Registrar to be the administrator of the Council if all executive members are removed from office</heading>

                <p>	(1)	If all executive members are removed from office under subsection 33(3), the Registrar is to be the administrator of the Council during the period (the <b><i>interim period</i></b>):</p>
              </content>
              <paragraph eId="part-IV__dvs-4__sec-33A__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>beginning at the time of that removal from office; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-IV__dvs-4__sec-33A__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>ending at the start of the first meeting of the executive committee that is held after that removal from office.</p>

              <content>
                <p>All acts and things done during the interim period in the name of, or on behalf of, the Council by <role refersTo="#registrar">the Registrar</role> are to be taken to have been done by the Council.</p>

            </subsection>
            <subsection eId="part-IV__dvs-4__sec-33A__subsec-4">
              <num>4</num>
              <content>
                <p>All acts and things done during the interim period in the name of, or on behalf of, the executive committee by <role refersTo="#registrar">the Registrar</role> are to be taken to have been done by the executive committee.</p>
              </content>
            </subsection>
            <subsection eId="part-IV__dvs-4__sec-33A__subsec-5">
              <num>5</num>
              <content>
                <p>During the interim period:</p>
              </content>
              <paragraph eId="part-IV__dvs-4__sec-33A__subsec-5__para-a">
                <num>a</num>
                <content>
                  <p>	(a)	for the purposes of the <i>Public Governance, Performance and Accountability Act 2013</i>, the accountable authority of the Council consists of:</p>
                </content>
              </paragraph>
              <paragraph eId="part-IV__dvs-4__sec-33A__subsec-5__para-i">
                <num>i</num>
                <content>
                  <p><role refersTo="#registrar">the Registrar</role>; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-IV__dvs-4__sec-33A__subsec-5__para-ii">
                <num>ii</num>
                <content>
                  <p>the Chief Executive Officer; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-IV__dvs-4__sec-33A__subsec-5__para-b">
                <num>b</num>

                  <p><ref href="#sec-4A">section 4A</ref> of this Act does not apply.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-IV__dvs-4__sec-33A__subsec-6">

                <p>This section does not authorise <role refersTo="#registrar">the Registrar</role> to exercise a power conferred by section 38 or 39.</p>
              </content>
            </subsection>
          </section>

            <heading>Meetings of executive committee</heading>
            <subsection eId="part-IV__dvs-4__sec-34__subsec-1">
              <num>1</num>
              <content>
                <p>The Chairperson:</p>
              </content>
              <paragraph eId="part-IV__dvs-4__sec-34__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>may, at any time, convene a meeting of the executive committee; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-IV__dvs-4__sec-34__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>shall, on receipt of a written request signed by not fewer than 4 other executive members, convene a meeting of the executive committee.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-IV__dvs-4__sec-34__subsec-2">
              <num>2</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> may, at any time, convene a meeting of the executive committee.</p>
              </content>
            </subsection>
            <subsection eId="part-IV__dvs-4__sec-34__subsec-3">
              <num>3</num>
              <content>
                <p>The Chairperson shall preside at all meetings of the executive committee at which he or she is present.</p>
              </content>
            </subsection>
            <subsection eId="part-IV__dvs-4__sec-34__subsec-4">
              <num>4</num>
              <content>
                <p>Where the Chairperson is not present at a meeting of the executive committee:</p>
              </content>
              <paragraph eId="part-IV__dvs-4__sec-34__subsec-4__para-a">
                <num>a</num>
                <content>
                  <p>the Deputy Chairperson shall preside at the meeting; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-IV__dvs-4__sec-34__subsec-4__para-b">
                <num>b</num>
                <content>
                  <p>if the Deputy Chairperson is not present at the meeting—the executive members present shall appoint one of their number to preside at the meeting.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-IV__dvs-4__sec-34__subsec-5">
              <num>5</num>
              <content>
                <p>At a meeting of the executive committee, 5 executive members constitute a quorum.</p>
              </content>
            </subsection>
            <subsection eId="part-IV__dvs-4__sec-34__subsec-6">
              <num>6</num>
              <content>
                <p>Subject to subsection 34A(4), questions arising at a meeting of the executive committee shall be determined by a majority of the votes of the executive members present and voting and the person presiding at the meeting has a deliberative vote and, in the case of an equality of votes, also has a casting vote.</p>

          <heading>Chief Executive Officer</heading>

              <content>
                <p>There is to be a Chief Executive Officer of the Council.</p>
              </content>
            </subsection>
            <subsection eId="part-IV__dvs-4A__sec-34A__subsec-2">
              <num>2</num>
              <content>
                <p>The Chief Executive Officer is to be a person who is:</p>
              </content>
              <paragraph eId="part-IV__dvs-4A__sec-34A__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>appointed, in writing, by the executive committee; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-IV__dvs-4A__sec-34A__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>employed by the Council (otherwise than on a casual basis).</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-IV__dvs-4A__sec-34A__subsec-3">
              <num>3</num>
              <content>
                <p>The appointment continues in force despite a change in the membership of the executive committee.</p>
              </content>
            </subsection>
            <subsection eId="part-IV__dvs-4A__sec-34A__subsec-4">
              <num>4</num>
              <content>
                <p>The appointment may be revoked by the executive committee (whether or not there has been a change in the membership of the executive committee) by a unanimous resolution of the executive members present at a meeting of the executive committee.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-IV__dvs-4A__sec-34B">
            <num>34B</num>
            <heading>Functions of the Chief Executive Officer</heading>
            <subsection eId="part-IV__dvs-4A__sec-34B__subsec-1">
              <num>1</num>
              <content>
                <p>The Chief Executive Officer is responsible for the day-to-day administration of the Council.</p>
              </content>
            </subsection>
            <subsection eId="part-IV__dvs-4A__sec-34B__subsec-2">
              <num>2</num>
              <content>
                <p>The Chief Executive Officer may, on behalf of the Council:</p>
              </content>
              <paragraph eId="part-IV__dvs-4A__sec-34B__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>enter into contracts for the purposes of this Act; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-IV__dvs-4A__sec-34B__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>employ staff.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-IV__dvs-4A__sec-34B__subsec-3">
              <num>3</num>
              <content>
                <p>The Chief Executive Officer, on behalf of the Council, has all the rights, duties and powers of an employer in respect of the engagement, and employment, of employees of the Council.</p>
              </content>
            </subsection>
            <subsection eId="part-IV__dvs-4A__sec-34B__subsec-4">
              <num>4</num>
              <content>
                <p>The Chief Executive Officer, on behalf of the Council, has all the rights, duties and powers of the Council in relation to the Council’s capacity as a party to a contract.</p>
              </content>
            </subsection>
            <subsection eId="part-IV__dvs-4A__sec-34B__subsec-5">
              <num>5</num>
              <content>
                <p>The Chief Executive Officer has power to do all things necessary or convenient to be done for or in connection with the performance of the Chief Executive Officer’s duties.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-IV__dvs-4A__sec-34C">
            <num>34C</num>
            <heading>Executive committee may give general directions to the Chief Executive Officer</heading>
            <subsection eId="part-IV__dvs-4A__sec-34C__subsec-1">
              <num>1</num>
              <content>
                <p>The executive committee may give written directions to the Chief Executive Officer in relation to the performance of the Chief Executive Officer’s functions and the exercise of the Chief Executive Officer’s powers.</p>
              </content>
            </subsection>
            <subsection eId="part-IV__dvs-4A__sec-34C__subsec-2">
              <num>2</num>
              <content>
                <p>However, such a direction can only be of a general nature.</p>
              </content>
            </subsection>
            <subsection eId="part-IV__dvs-4A__sec-34C__subsec-3">
              <num>3</num>
              <content>
                <p>The Chief Executive Officer is to act in accordance with any directions given under subsection (1).</p>
              </content>
            </subsection>
            <subsection eId="part-IV__dvs-4A__sec-34C__subsec-4">
              <num>4</num>
              <content>
                <p>A direction given under subsection (1) is not a legislative instrument.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-IV__dvs-4A__sec-34D">
            <num>34D</num>
            <heading>Acting appointments</heading>
            <subsection eId="part-IV__dvs-4A__sec-34D__subsec-1">
              <num>1</num>
              <content>
                <p>The executive committee may, by written instrument, appoint a person who is employed by the Council (otherwise than on a casual basis) to act as the Chief Executive Officer:</p>
              </content>
              <paragraph eId="part-IV__dvs-4A__sec-34D__subsec-1__para-a">
                <num>a</num>
                <content>

                <p><role refersTo="#registrar">The Registrar</role> must, if requested to do so by <role refersTo="#minister">the Minister</role>, the Chief Executive Officer or an executive member:</p>

                  <p>investigate whether an executive member is a fit and proper person; or</p>
                </content>
              </paragraph>

                  <p>investigate whether a person nominated under subsection 30(4) is a fit and proper person.</p>

                  <p>Criminal history check</p>

                <p><role refersTo="#registrar">The Registrar</role> may, by written notice given to a person who is the subject of an investigation under subsection (1) request the person to:</p>

              <paragraph eId="part-IV__dvs-5__sec-34G__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>obtain a specified kind of criminal history check and give that criminal history check to <role refersTo="#registrar">the Registrar</role>; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-IV__dvs-5__sec-34G__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>do so within the period specified in the notice.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-IV__dvs-5__sec-34G__subsec-3">

              <content>
                <p>If a person has been given a notice under subsection (2), <role refersTo="#registrar">the Registrar</role> may vary the notice by extending the period specified in the notice.</p>

                <p>Consent for checking</p>

            </subsection>
            <subsection eId="part-IV__dvs-5__sec-34G__subsec-4">
              <num>4</num>
              <content>
                <p><role refersTo="#registrar">The Registrar</role> may, by written notice given to a person who is the subject of an investigation under subsection (1), request the person to give to <role refersTo="#registrar">the Registrar</role>, within the period specified in the notice, a specified kind of written consent that <role refersTo="#registrar">the Registrar</role> requires to enable:</p>
              </content>
              <paragraph eId="part-IV__dvs-5__sec-34G__subsec-4__para-a">
                <num>a</num>
                <content>
                  <p>criminal records to be checked for the purposes of the investigation; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-IV__dvs-5__sec-34G__subsec-4__para-b">
                <num>b</num>
                <content>
                  <p>bankruptcy or insolvency records to be checked for the purposes of the investigation.</p>
                </content>

                  <p>Other matters</p>

                <p>A period specified in a notice under subsection (2) or (4) must not be shorter than 30 days.</p>

            <heading>Committees established by the Council</heading>
            <subsection eId="part-IV__dvs-5__sec-35__subsec-1">

                <p>The Council may, from time to time, by resolution establish such committees as the Council considers necessary or desirable for the purposes of this Act.</p>
              </content>
            </subsection>
            <subsection eId="part-IV__dvs-5__sec-35__subsec-2">
              <num>2</num>
              <content>
                <p>A committee shall consist of not fewer than 4, nor more than 7, registered members.</p>
              </content>
            </subsection>
            <subsection eId="part-IV__dvs-5__sec-35__subsec-3">
              <num>3</num>
              <content>
                <p>Where the Chairperson is a member of a committee, the Chairperson shall convene, and preside at, meetings of the committee.</p>
              </content>
            </subsection>
            <subsection eId="part-IV__dvs-5__sec-35__subsec-4">
              <num>4</num>
              <content>
                <p>Where the Deputy Chairperson is a member of a committee and the Chairperson is not a member of the committee, the Deputy Chairperson shall convene, and preside at, meetings of the committee.</p>

            </subsection>

              <num>5</num>
              <content>
                <p>Where neither the Chairperson nor the Deputy Chairperson is a member of a committee, the committee shall elect a member of the committee to convene, and preside at, meetings of the committee.</p>

              <content>
                <p>A member of a committee may resign by writing signed by the member and given to the executive committee.</p>

                <p>The executive committee may, from time to time, by resolution establish such subcommittees as the executive committee considers necessary or desirable for the purposes of this Act.</p>

                <p>A subcommittee is to be constituted:</p>
              </content>
              <paragraph eId="part-IV__dvs-5__sec-35A__subsec-2__para-a">

                  <p>by not fewer than 2, nor more than 5, executive members; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-IV__dvs-5__sec-35A__subsec-2__para-b">

        <heading>Dealings with Aboriginal Land</heading>

          <heading>Interpretation</heading>

              <p>In this Part, unless the contrary intention appears:</p>

              <p><term refersTo="#term-adopted">adopted</term> means <def>adopted: under the law of a State or a Territory relating to the adoption of children; or under the law of any other place relating to the adoption of children, if the validity of the adoption would be recognised under the law of any State or any Territory. <b><i>child</i></b>: without limiting who is a child of a person for the purposes of this Act, someone is the <b><i>child</i></b> of a person if he or she is a child of the person within the meaning of the <i>Family Law Act 1975</i>. <b><i>p</i></b><b><i>arent</i></b>: without limiting who is a parent of a person for the purposes of this Act, someone is the <b><i>parent </i></b>of a person if the person is his or her child because of the definition of <b><i>child</i></b> in this subsection.</def></p>

              <p>For the purposes of this Part, Aboriginal Land in respect of which a lease has been granted shall be taken to be used for domestic purposes if, and only if:</p>

              <num>a</num>
              <content>
                <p>in a case where a sub-lease of the land has not been granted, the person or persons who have the benefit of the lease usually reside on the land or intend to begin to usually reside on the land as soon as practicable; or</p>

            <paragraph eId="part-V__sec-37__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>in a case where a sub-lease of the land has been granted, the person or persons who have the benefit of the sub-lease usually reside on the land or intend to begin to usually reside on the land as soon as practicable.</p>

            </paragraph>
          </subsection>
          <subsection eId="part-V__sec-37__subsec-3">

              <p>For the purposes of this Part, Aboriginal Land in respect of which a lease has been granted shall be taken to be used for business purposes if, and only if:</p>
            </content>
            <paragraph eId="part-V__sec-37__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>in a case where a sub-lease of the land has not been granted, the person or persons who have the benefit of the lease conduct a business on the land or intend to begin to conduct a business on the land as soon as practicable; or</p>

              <num>b</num>
              <content>
                <p>in a case where a sub-lease of the land has been granted, the person or persons who have the benefit of the sub-lease conduct a business on the land or intend to begin to conduct a business on the land as soon as practicable.</p>

          </subsection>
          <subsection eId="part-V__sec-37__subsec-4">
            <num>4</num>
            <content>
              <p>	(4)	Any relationship referred to in the definition of <b><i>relative</i></b> in subsection (1) includes a relationship traced through, or to, a person who is or was an adopted child, and, for that purpose, the relationship between an adopted child and his or her adoptive parent, or each of his or her adoptive parents, shall be deemed to be or to have been the natural relationship of child and parent.</p>
            </content>
          </subsection>
          <subsection eId="part-V__sec-37__subsec-5">
            <num>5</num>
            <content>
              <p>	(5)	For the purposes of the definition of <b><i>relative</i></b> in subsection (1), if one person is the child of another person because of the definition of <b><i>child </i></b>in that subsection, relationships traced to or through the person are to be determined on the basis that the person is the child of the other person.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-V__sec-38">
          <num>38</num>
          <heading>Dealings in Aboriginal Land by Council</heading>
          <subsection eId="part-V__sec-38__subsec-1">
            <num>1</num>
            <content>
              <p>Except as provided by this Part, the Council shall not deal with or dispose of, or agree to deal with or dispose of, any estate or interest in Aboriginal Land.</p>
            </content>
          </subsection>
          <subsection eId="part-V__sec-38__subsec-2">
            <num>2</num>
            <content>
              <p>Subject to this section, the Council may grant a lease of Aboriginal Land (other than land within the Booderee National Park or the Booderee Botanic Gardens):</p>
            </content>
            <paragraph eId="part-V__sec-38__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>to a registered member or registered members for use for domestic purposes;</p>
              </content>
            </paragraph>
            <paragraph eId="part-V__sec-38__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>to a registered member or registered members for use for business purposes;</p>
              </content>
            </paragraph>
            <paragraph eId="part-V__sec-38__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>to a registered member or registered members for use for the benefit of the members, or of a significant number of the members, of the Community;</p>
              </content>
            </paragraph>
            <paragraph eId="part-V__sec-38__subsec-2__para-d">
              <num>d</num>
              <content>
                <p>with the consent in writing of <role refersTo="#minister">the Minister</role>—to a person other than a registered member, or to persons at least one of whom is not a registered member, for use for domestic purposes;</p>
              </content>
            </paragraph>
            <paragraph eId="part-V__sec-38__subsec-2__para-e">
              <num>e</num>
              <content>
                <p>with the consent in writing of <role refersTo="#minister">the Minister</role>—to a person other than a registered member, or to persons at least one of whom is not a registered member, for use for business purposes; or</p>

            <paragraph eId="part-V__sec-38__subsec-2__para-f">
              <num>f</num>
              <content>
                <p>to the Commonwealth or an Authority.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-V__sec-38__subsec-3">
            <num>3</num>
            <content>
              <p>Except with the consent of <role refersTo="#minister">the Minister</role>, the term of a lease shall not exceed:</p>
            </content>
            <paragraph eId="part-V__sec-38__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>in the case of a lease to which paragraph (2)(a) applies—99 years;</p>
              </content>
            </paragraph>
            <paragraph eId="part-V__sec-38__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>in the case of a lease to which paragraph (2)(b) or (c) applies—25 years; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-V__sec-38__subsec-3__para-c">
              <num>c</num>
              <content>
                <p>in any other case—15 years.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-V__sec-38__subsec-4">
            <num>4</num>
            <content>
              <p>The Council may grant a person a licence to use Aboriginal Land (other than land within the Booderee National Park or the Booderee Botanic Gardens).</p>
            </content>
          </subsection>
          <subsection eId="part-V__sec-38__subsec-5">
            <num>5</num>
            <content>
              <p>Where the Council grants a lease of, or a licence to use, Aboriginal Land to the Commonwealth or to an Authority under this section, the rent and other amounts payable under the lease or licence shall be determined by <role refersTo="#minister">the Minister</role>.</p>
            </content>
          </subsection>
          <subsection eId="part-V__sec-38__subsec-5A">
            <num>5A</num>
            <content>
              <p>A lease granted under this section must:</p>
            </content>
            <paragraph eId="part-V__sec-38__subsec-5A__para-a">
              <num>a</num>
              <content>
                <p>be in writing; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-V__sec-38__subsec-5A__para-b">
              <num>b</num>
              <content>
                <p>include the term of the lease; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-V__sec-38__subsec-5A__para-c">
              <num>c</num>
              <content>
                <p>include the other terms and conditions of the lease.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-V__sec-38__subsec-6">
            <num>6</num>
            <content>
              <p>	(6)	The <i>Lands Acquisition Act 1989 </i>does not apply to the grant of a lease under this section.</p>
            </content>
          </subsection>
          <subsection eId="part-V__sec-38__subsec-7">
            <num>7</num>
            <content>
              <p>	(7)	The <i>Residential Tenancies Act 1997</i> (ACT) does not apply to a lease granted under this section if:</p>
            </content>
            <paragraph eId="part-V__sec-38__subsec-7__para-a">
              <num>a</num>
              <content>
                <p>the lease is a lease to which paragraph (2)(a), (c) or (d) applies; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-V__sec-38__subsec-7__para-b">
              <num>b</num>
              <content>
                <p>the term of the lease is 40 years or more.</p>
              </content>
            </paragraph>
          </subsection>
        </section>
        <section eId="part-V__sec-38A">
          <num>38A</num>
          <heading>Agreement to lease land within Booderee National Park etc. to Director</heading>
          <content>
            <p>		If a notice is published in the <i>Gazette </i>under subsection 9A(3), the Council and the Director must, as soon as practicable after the notice is published, enter into an agreement under which the Council agrees to grant to the Director a lease of the land described in the notice so as to enable the Director to hold the land for the purposes of Division 4 of Part 15 of the <i>Environment Protection and Biodiversity Conservation Act 1999</i>.</p>
          </content>
        </section>
        <section eId="part-V__sec-38B">
          <num>38B</num>
          <heading>Lease of Booderee National Park etc. to Director</heading>
          <subsection eId="part-V__sec-38B__subsec-1">
            <num>1</num>
            <content>
              <p>As soon as practicable after a declaration by <role refersTo="#minister">the Minister</role> under subsection 9A(1) has come into force, the Council must grant to the Director a lease of the land that has become Aboriginal Land under the declaration.</p>
            </content>
          </subsection>
          <subsection eId="part-V__sec-38B__subsec-2">
            <num>2</num>
            <content>
              <p>The terms and conditions of the lease are those set out in the agreement between the Council and the Director under <ref href="#sec-38A">section 38A</ref>.</p>
            </content>
          </subsection>
          <subsection eId="part-V__sec-38B__subsec-3">
            <num>3</num>
            <content>
              <p>Except with the consent of <role refersTo="#minister">the Minister</role>, the term of a lease must not be more than 99 years.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-V__sec-38C">
          <num>38C</num>
          <heading>Minister may grant lease</heading>
          <content>
            <p>If <role refersTo="#minister">the Minister</role> is satisfied that the Council has refused, or is unwilling, to grant to the Director a lease of Aboriginal Land within the Booderee National Park as required under the agreement entered into with the Director under section 38A, <role refersTo="#minister">the Minister</role> may, on behalf of the Council, grant the lease to the Director as set out in the agreement.</p>
          </content>
        </section>
        <section eId="part-V__sec-39">
          <num>39</num>
          <heading>Surrender of Aboriginal Land</heading>
          <content>
            <p>With the consent in writing of <role refersTo="#minister">the Minister</role>, the Council may surrender to the Crown the whole of its estate or interest in any part of Aboriginal Land.</p>
          </content>
        </section>
        <section eId="part-V__sec-40">
          <num>40</num>
          <heading>Rights of existing occupiers</heading>
          <content>
            <p>Where, immediately before land became Aboriginal Land, a registered member was in occupation of the land with the consent, express or implied, of the Commonwealth or of an Authority, the Council shall, in accordance with <ref href="#sec-38">section 38</ref>, grant that person a lease of that land, being a lease:</p>
          </content>
          <paragraph eId="part-V__sec-40__para-a">
            <num>a</num>
            <content>
              <p>the term of which:</p>
            </content>
          </paragraph>
          <paragraph eId="part-V__sec-40__para-i">
            <num>i</num>
            <content>
              <p>commences at the time at which the land became Aboriginal Land; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-V__sec-40__para-ii">
            <num>ii</num>
            <content>
              <p>is for the maximum period permitted for the lease by subsection 38(3);</p>
            </content>
          </paragraph>
          <paragraph eId="part-V__sec-40__para-b">
            <num>b</num>
            <content>
              <p>the terms and conditions of which do not provide for any payment by the person in respect of a building or improvements erected on the land solely at the expense of the person; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-V__sec-40__para-c">
            <num>c</num>
            <content>
              <p>the terms and conditions of which may include terms and conditions approved by <role refersTo="#minister">the Minister</role> in writing under which the person is to pay to the Council in respect of buildings and improvements on the land (other than buildings or improvements to which paragraph (b) applies) amounts amounting in the aggregate to the value of those buildings and improvements at the time at which the land became Aboriginal Land.</p>
            </content>
          </paragraph>
        </section>
        <section eId="part-V__sec-41">
          <num>41</num>
          <heading>Dealings in land leased from Council</heading>
          <subsection eId="part-V__sec-41__subsec-1">
            <num>1</num>
            <content>
              <p>Subject to this section, where the Council has granted a lease of Aboriginal Land to a person, that person, or a person who has been granted a sub-lease of the land under this section, may grant a sub-lease of the whole of the land.</p>
            </content>
          </subsection>
          <subsection eId="part-V__sec-41__subsec-2">
            <num>2</num>
            <content>
              <p>Except with the consent in writing of <role refersTo="#minister">the Minister</role>, a person shall not grant a sub-lease of Aboriginal Land to a person other than a registered member, the Commonwealth or an Authority.</p>
            </content>
          </subsection>
          <subsection eId="part-V__sec-41__subsec-3">
            <num>3</num>
            <content>
              <p>Except with the consent in writing of <role refersTo="#minister">the Minister</role>, a person shall not grant a sub-lease of Aboriginal Land for use for purposes other than the purposes for which the land is required to be used by the lease in respect of the land.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-V__sec-42">
          <num>42</num>
          <heading>Devise of interests in Aboriginal Land etc.</heading>
          <subsection eId="part-V__sec-42__subsec-1">
            <num>1</num>
            <content>
              <p>Where a registered member has the benefit, or a share in the benefit, of a lease or sub-lease of Aboriginal Land for use for domestic purposes, that benefit or share is capable of transmission, by will or under a law relating to intestacy in force in the Territory, to a relative of the member.</p>
            </content>
          </subsection>
          <subsection eId="part-V__sec-42__subsec-2">
            <num>2</num>
            <content>
              <p>Where the benefit, or a share in the benefit, of a lease or sub-lease of Aboriginal Land is transmitted because of subsection (1), the purposes for which the land is required to be used by the lease or sub-lease, as the case may be, shall not be taken to be altered.</p>
            </content>
          </subsection>
        </section>
      </part>
      <part eId="part-VI">
        <num>VI</num>
        <heading>Miscellaneous</heading>
        <section eId="part-VI__sec-43">
          <num>43</num>
          <heading>Laws relating to mining</heading>
          <content>
            <p>Any law in force in the Territory authorising mining or exploration for minerals (including any law providing for rights known as miner’s rights) does not apply in relation to Aboriginal Land so as to authorise the entry or remaining of a person on the land or the doing of any act by a person on the land.</p>
          </content>
        </section>
        <section eId="part-VI__sec-44">
          <num>44</num>
          <heading>Mining operations</heading>
          <content>
            <p>If minerals, in their natural state and capable of being exploited for commercial purposes, are discovered on or below the surface of Aboriginal Land, operations for the recovery of the minerals shall not be carried on by a person otherwise than in accordance with an agreement to which the Commonwealth, the Council and that person are parties.</p>
          </content>
        </section>
        <section eId="part-VI__sec-45">
          <num>45</num>
          <heading>Exemption from rates etc.</heading>
          <content>
            <p>The Council is not liable to pay in respect of Aboriginal Land any rates or other taxes imposed by or under a law in force in the Territory.</p>
          </content>
        </section>
        <section eId="part-VI__sec-46">
          <num>46</num>
          <heading>Application of laws of Territory to Aboriginal Land</heading>
          <content>
            <p>This Act does not affect the application to Aboriginal Land of a law in force in the Territory to the extent that that law is capable of operating concurrently with this Act.</p>
          </content>
        </section>
        <section eId="part-VI__sec-47">
          <num>47</num>
          <heading>Protection of environment</heading>
          <subsection eId="part-VI__sec-47__subsec-1">
            <num>1</num>
            <content>
              <p>In the performance of its functions the Council shall have regard to the preservation of the environment.</p>
            </content>
          </subsection>
          <subsection eId="part-VI__sec-47__subsec-2">
            <num>2</num>
            <content>
              <p>Where the Council proposes to carry out any works or projects that could have a significant effect on the environment, the Council shall give <role refersTo="#minister">the Minister</role> particulars in writing of the works or project.</p>
            </content>
          </subsection>
          <subsection eId="part-VI__sec-47__subsec-3">
            <num>3</num>
            <content>
              <p>	(3)	In this section, <b><i>environment</i></b> includes all aspects of the surroundings of a natural person, whether affecting the person as an individual or in the person’s social groupings.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-VI__sec-48">
          <num>48</num>
          <heading>Significant sites</heading>
          <subsection eId="part-VI__sec-48__subsec-1">
            <num>1</num>
            <content>
              <p>	(1)	Where the Minister is satisfied that a place on Aboriginal Land is of special significance to Aboriginal members of the Community, the Minister may, by notice in writing published in the <i>Gazette </i>specifying that place, declare that that place is a significant place for the purposes of this Act.</p>
            </content>
          </subsection>
          <subsection eId="part-VI__sec-48__subsec-2">
            <num>2</num>
            <content>
              <p>Where a declaration under subsection (1) is in force in relation to a place, the Council may cause signs to be displayed at or near the place identifying the place and stating that entry into it by persons other than Aboriginal members of the Community is prohibited by this Act.</p>
            </content>
          </subsection>
          <subsection eId="part-VI__sec-48__subsec-3">
            <num>3</num>
            <content>
              <p>A person commits an offence if:</p>
            </content>
            <paragraph eId="part-VI__sec-48__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>the person enters or remains in a place; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-VI__sec-48__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>a declaration under subsection (1) is in force in relation to the place; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-VI__sec-48__subsec-3__para-c">
              <num>c</num>
              <content>
                <p>a sign is displayed in relation to the place; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-VI__sec-48__subsec-3__para-d">
              <num>d</num>

                <p>the sign is displayed under subsection (2).</p>

              <p>Without limiting the generality of subsection (4), a person shall be taken, for the purposes of that subsection, to have damaged or disturbed a place in relation to which a sign is displayed under subsection (2) if, by reason of any act done by that person, the special significance of the place to Aboriginal members of the Community has been adversely affected.</p>
            </content>
          </subsection>
          <subsection eId="part-VI__sec-48__subsec-7">
            <num>7</num>
            <content>
              <p>In any proceedings for the prosecution of a person for an offence against subsection (3) or (4), evidence that a sign stating that entry into the place by persons other than Aboriginal members of the Community is prohibited by this Act was displayed at or near that place at a particular time is evidence that the sign was so displayed at that time in accordance with subsection (2).</p>
            </content>
          </subsection>
          <subsection eId="part-VI__sec-48__subsec-8">
            <num>8</num>
            <content>
              <p>Nothing in this section shall be read as extending the right of access to any Aboriginal Land to which this section does not apply.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-VI__sec-49">
          <num>49</num>
          <heading>Public access</heading>
          <subsection eId="part-VI__sec-49__subsec-1">
            <num>1</num>
            <content>
              <p>Subject to this section, where <role refersTo="#minister">the Minister</role> is satisfied that:</p>
            </content>
            <paragraph eId="part-VI__sec-49__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>a place that forms part of Aboriginal Land was, immediately before it became part of such land, a place to which the public had access; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-VI__sec-49__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>it is desirable that the public should continue to have access to that place;</p>
              </content>
              <content>
                <p>the Minister may, by notice in writing published in the <i>Gazette </i>specifying that place, declare that that place is a place to which this section applies.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-VI__sec-49__subsec-2">
            <num>2</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> shall not make a declaration under subsection (1) in relation to:</p>
            </content>
            <paragraph eId="part-VI__sec-49__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>a place to which a declaration under subsection 48(1) applies; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-VI__sec-49__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>a place that is the subject of a lease to a person for use for domestic purposes within the meaning of <ref href="#part-V">Part V</ref>.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-VI__sec-49__subsec-3">
            <num>3</num>
            <content>
              <p>The public shall have right of access to a place in respect of which a declaration under subsection (1) is in force (other than a place that has become a place referred to in subsection (2)), but that access is subject to the regulations.</p>
            </content>
          </subsection>
          <subsection eId="part-VI__sec-49__subsec-4">
            <num>4</num>
            <content>
              <p>	(4)	In this section, <b><i>place</i></b> includes a road, a path and a trail.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-VI__sec-50">
          <num>50</num>
          <heading>Registrar may inquire into grievances</heading>
          <content>
            <p>Where a person who is or has been a registered member informs <role refersTo="#registrar">the Registrar</role> that the person is aggrieved by action taken under this Act (other than action taken by <role refersTo="#minister">the Minister</role> or action taken in compliance with a judgment, order or decree of a court or of a person acting judicially) and requests <role refersTo="#registrar">the Registrar</role> to inquire into that action, <role refersTo="#registrar">the Registrar</role> may, in <role refersTo="#registrar">the Registrar</role>’s discretion, comply with that request and, if <role refersTo="#registrar">the Registrar</role> considers it appropriate to do so, may inform <role refersTo="#minister">the Minister</role> or the Council of the result of the inquiries.</p>
          </content>
        </section>
        <section eId="part-VI__sec-52">
          <num>52</num>
          <heading>Annual report to be laid before meeting of Council</heading>
          <content>
            <p>		The accountable authority must table a copy of the annual report on the Council at the next general meeting of the Council held after the deadline for the period to which the report relates. The report is prepared under <i>Public Governance, Performance and Accountability Act 2013</i>, and the period and deadline are as specified in that section.<ref href="#sec-46">section 46</ref> of the </p>
          </content>
        </section>
        <section eId="part-VI__sec-52A">
          <num>52A</num>
          <heading>By-laws</heading>
          <subsection eId="part-VI__sec-52A__subsec-1">
            <num>1</num>
            <content>
              <p>	(1)	In this section <b><i>Aboriginal Land</i></b> does not include land declared under section 9A.</p>
            </content>
          </subsection>
          <subsection eId="part-VI__sec-52A__subsec-2">
            <num>2</num>
            <content>
              <p>The Council may make by-laws for or with respect to:</p>
            </content>
            <paragraph eId="part-VI__sec-52A__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>economic enterprise on Aboriginal Land;</p>
              </content>
            </paragraph>
            <paragraph eId="part-VI__sec-52A__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>cultural activities on Aboriginal Land;</p>
              </content>
            </paragraph>
            <paragraph eId="part-VI__sec-52A__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>the management, access, conservation, fire protection, development and use of Aboriginal Land;</p>
              </content>
            </paragraph>
            <paragraph eId="part-VI__sec-52A__subsec-2__para-d">
              <num>d</num>
              <content>
                <p>the declaration of sacred or significant sites or other areas of significance to Aboriginal people on Aboriginal Land;</p>
              </content>
            </paragraph>
            <paragraph eId="part-VI__sec-52A__subsec-2__para-e">
              <num>e</num>
              <content>
                <p>the activities to be permitted on Aboriginal Land or any part of it;</p>
              </content>
            </paragraph>
            <paragraph eId="part-VI__sec-52A__subsec-2__para-f">
              <num>f</num>
              <content>
                <p>protection and conservation of flora or fauna found on Aboriginal Land;</p>
              </content>
            </paragraph>
            <paragraph eId="part-VI__sec-52A__subsec-2__para-g">
              <num>g</num>
              <content>
                <p>in relation to Aboriginal Land, the cutting, removal and sale of timber, the granting of revocable licences and the payment of royalties for timber to the Council;</p>
              </content>
            </paragraph>
            <paragraph eId="part-VI__sec-52A__subsec-2__para-h">
              <num>h</num>
              <content>
                <p>hunting, shooting and fishing on Aboriginal Land;</p>
              </content>
            </paragraph>
            <paragraph eId="part-VI__sec-52A__subsec-2__para-i">
              <num>i</num>
              <content>
                <p>control of visitors in, and charging fees (to be paid to the Council) for entrance to, Aboriginal Land;</p>
              </content>
            </paragraph>
            <paragraph eId="part-VI__sec-52A__subsec-2__para-j">
              <num>j</num>
              <content>
                <p>the regulation and control of motor traffic and parking on Aboriginal Land;</p>
              </content>
            </paragraph>
            <paragraph eId="part-VI__sec-52A__subsec-2__para-k">
              <num>k</num>
              <content>
                <p>the appointment of persons to enforce the by-laws, and the powers and duties of those persons.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-VI__sec-52A__subsec-3">
            <num>3</num>
            <content>
              <p>	(3)	The by-laws may apply any regulation made under the <i>Environment Protection and Biodiversity Conservation Act 1999 </i>to Aboriginal Land, with whatever changes are needed for that purpose.</p>
            </content>
          </subsection>
          <subsection eId="part-VI__sec-52A__subsec-4">
            <num>4</num>
            <content>
              <p>A by-law, in applying a regulation referred to in subsection (3) relating to an offence, must not change the penalty for that offence.</p>
            </content>
          </subsection>
          <subsection eId="part-VI__sec-52A__subsec-5">
            <num>5</num>
            <content>
              <p>A by-law must not be inconsistent with a law of the Commonwealth or a law in force in the Territory, but a regulation referred to in subsection (3) may, in its application to Aboriginal Land, be inconsistent with a law in force in the Territory.</p>
            </content>
          </subsection>
          <subsection eId="part-VI__sec-52A__subsec-6">
            <num>6</num>
            <content>
              <p>The by-laws may provide that a contravention of a by-law is an offence.</p>
            </content>
          </subsection>
          <subsection eId="part-VI__sec-52A__subsec-7">
            <num>7</num>
            <content>
              <p>The regulations may provide, in respect of an offence against the by-laws, for the imposition of:</p>
            </content>
            <paragraph eId="part-VI__sec-52A__subsec-7__para-a">
              <num>a</num>
              <content>
                <p>if the offender is a natural person—a fine not exceeding <quantity refersTo="#penaltyUnit">5 penalty units</quantity>; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-VI__sec-52A__subsec-7__para-b">
              <num>b</num>
              <content>
                <p>if the offender is a corporation—a fine not exceeding <quantity refersTo="#penaltyUnit">25 penalty units</quantity>.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-VI__sec-52A__subsec-8">
            <num>8</num>
            <content>
              <p>The regulations may make provision for and in relation to enabling a person who is alleged to have committed an offence against the by-laws to pay to the Commonwealth, as an alternative to prosecution, a penalty not exceeding:</p>
            </content>
            <paragraph eId="part-VI__sec-52A__subsec-8__para-a">
              <num>a</num>
              <content>
                <p>in the case of a natural person—<quantity refersTo="#penaltyUnit">1 penalty unit</quantity>; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-VI__sec-52A__subsec-8__para-b">
              <num>b</num>
              <content>
                <p>in the case of a corporation—<quantity refersTo="#penaltyUnit">5 penalty units</quantity>.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-VI__sec-52A__subsec-9">
            <num>9</num>
            <content>
              <p>Subsections (7) and (8) do not apply in relation to an offence against a regulation referred to in subsection (3) in its application to Aboriginal Land.</p>
            </content>
          </subsection>
          <subsection eId="part-VI__sec-52A__subsec-10">
            <num>10</num>
            <content>
              <p>If the Council makes a by-law, it shall, <quantity refersTo="#deadline">within 21 days</quantity> after making it, give a copy of the by-law to the Minister.</p>
            </content>
          </subsection>
          <subsection eId="part-VI__sec-52A__subsec-11">
            <num>11</num>
            <content>
              <p>	(11)	For the purposes of the <i>Legislation Act 2003</i>, a by-law made by the Council and received by the Minister is a legislative instrument made by the Minister on the day the by-law is received.</p>

          <heading>Regulations</heading>

            <num>1</num>
            <content>
              <p>The Governor-General may make regulations, not inconsistent with this Act, prescribing matters:</p>
            </content>
            <paragraph eId="part-VI__sec-53__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>required or permitted by this Act to be prescribed; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-VI__sec-53__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>necessary or convenient to be prescribed for carrying out or giving effect to this Act.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-VI__sec-53__subsec-2">
            <num>2</num>
            <content>
              <p>Before the Governor-General makes regulations for the purposes of <role refersTo="#minister">the Minister</role> must consider any representations made to <role refersTo="#minister">the Minister</role> by the Council or the executive committee in relation to public access to the place.<ref href="#sec-49">section 49</ref> in relation to a place that forms part of Aboriginal Land, </p>

              <p>Schedule—Definition of Schedule Land</p>
              <p>Subsection 2(1)
(definition of <b><i>Schedule Land</i></b>) </p>
              <p>		All that piece of land in the Territory <i>commencing </i>at the south eastern most corner of Block 61 Jervis Bay Territory as shown in the plan catalogued in the Office of the Registrar of Titles Canberra as Deposited Plan 4480 and being a point at high water mark of the South Pacific Ocean and bounded <i>thence </i>on the south west by that high water mark generally in a north westerly direction being the south western boundary of Block 61 and of Block 60 as shown in the said Deposited Plan 4480 to the most westerly point of Block 60 and bounded thence by that high water mark generally in a westerly direction to a point at a bearing of 283 degrees 44 minutes 30 seconds distant 918.5 metres from that most westerly point of Block 60 and bounded <i>thence </i>on the north west by a line bearing north easterly 32 degrees 51 minutes 40 seconds distant 2142 metres to a corner post of a south west boundary fence of the Royal Australian Navy Airfield <i>thence </i>on the north east by that boundary fence bearing south easterly 138 degrees 20 minutes distant 683.2 metres and 138 degrees 11 minutes 10 seconds distant 451 metres and by that boundary fence and its prolongation bearing 136 degrees 37 minutes 30 seconds distant 1245.1 metres and <i>thence </i>on the south east by lines bearing 215 degrees 41 minutes 50 seconds distant 1114.1 metres and 215 degrees 59 minutes 40 seconds distant 769.6 metres to the point of commencement and containing an area of 403 hectares more or less, excluding the reserves of width 20 metres for the public roads known variously as Wreck Bay Road and Summercloud Bay Road and that part of Boorarla Road leading from Wreck Bay Road south easterly and south westerly to the boat ramp at Summercloud Bay.</p>
