            <heading>Simplified outline</heading>

              <p>The following is a simplified outline of this Act:</p>
              <p>•	Chapter 2 of this Act protects the olympic insignia by:</p>
            </content>

              <num>a</num>
              <content>
                <p>making the AOC the owner of copyright in the olympic symbol; and</p>
              </content>
            </paragraph>
            <paragraph eId="chapter-1__part-1.1__sec-1A__para-b">
              <num>b</num>
              <content>
                <p>making the AOC the owner of certain olympic designs; and</p>
              </content>
            </paragraph>
            <paragraph eId="chapter-1__part-1.1__sec-1A__para-c">
              <num>c</num>
              <content>
                <p>providing that the use of the olympic motto, the olympic symbol and certain other olympic images is to be taken to be contrary to law in certain circumstances.</p>

                <p>•	Chapter 3 of this Act prohibits the commercial use of certain olympic expressions unless the user holds a licence granted by the AOC.</p>

        <heading>Copyright and design protection</heading>

          <heading>Introduction</heading>

            <heading>Interpretation</heading>
            <subsection eId="chapter-2__part-2.1__sec-2__subsec-1">
              <num>1</num>
              <content>
                <p>In this Chapter, unless the contrary intention appears:</p>
              </content>
              <content>
                <p><term refersTo="#term-aoc-or-australian-olympic-committee">AOC or Australian Olympic Committee</term> means <def>the Australian Olympic Committee Incorporated, being an association incorporated on 24 April 1985 under <ref class="unresolved">the Associations Incorporation Act 1981</ref> of Victoria.</def></p>
                <p><b><i>Australia</i></b>, when used in a geographical sense, includes the external Territories.</p>
                <p><term refersTo="#term-australian-consumer-law">Australian Consumer Law</term> means <def>Schedule 2 to <ref href="">the Competition and Consumer Act 2010</ref> as applied under Subdivision A of <ref href="#dvs-2">Division 2</ref> of <ref href="#part-XI">Part XI</ref> of that Act.</def></p>
                <p><term refersTo="#term-charge">charge</term> means <def>a charge created in any way and includes a mortgage and an agreement to give or execute a charge or mortgage, whether upon demand or otherwise.</def></p>
                <p><term refersTo="#term-corresponding-design">corresponding design</term> means <def>a design that, when applied to an article, results in a reproduction of that work.</def></p>
                <p><term refersTo="#term-design-of-the-olympic-symbol">design of the olympic symbol</term> means <def>the design that, when applied to any article, results in a reproduction of the olympic symbol.</def></p>
                <p><term refersTo="#term-federal-court">Federal Court</term> means <def>the Federal Court of Australia.</def></p>
                <p><term refersTo="#term-ioc-or-international-olympic-committee">IOC or International Olympic Committee</term> means <def>the organisation created by the Congress of Paris on 23 June 1894, being the organisation entrusted with the control and development of the modern Olympic Games.</def></p>
                <p><term refersTo="#term-monopoly">monopoly</term> means <def>the exclusive right to apply the design to any article to which the design is capable of being applied.</def></p>
                <p><b><i>olympic artistic work</i></b> means:</p>

                <num>a</num>
                <content>
                  <p>a prescribed olympic torch and flame; or</p>
                </content>
              </paragraph>
              <paragraph eId="chapter-2__part-2.1__sec-2__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>an artistic work that incorporates either but not both of the following:</p>
                </content>
              </paragraph>
              <paragraph eId="chapter-2__part-2.1__sec-2__subsec-1__para-i">
                <num>i</num>
                <content>
                  <p>the olympic symbol;</p>
                </content>
              </paragraph>
              <paragraph eId="chapter-2__part-2.1__sec-2__subsec-1__para-ii">
                <num>ii</num>
                <content>
                  <p>a prescribed olympic torch and flame.</p>
                </content>
                <content>
                  <p><b><i>olympic motto</i></b> means:</p>
                </content>
              </paragraph>
              <paragraph eId="chapter-2__part-2.1__sec-2__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>	(a)	the motto expressed in Latin as <b><i>citius, altius, fortius</i></b>; and</p>
                </content>
              </paragraph>
              <paragraph eId="chapter-2__part-2.1__sec-2__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>	(b)	the motto expressed in English as <b><i>faster, higher, stronger</i></b>.</p>
                </content>
                <content>
                  <p><term refersTo="#term-olympic-symbol">olympic symbol</term> means <def>the symbol an outline of which is set out in the Schedule.</def></p>
                  <p><term refersTo="#term-prescribed-olympic-torch-and-flame">prescribed olympic torch and flame</term> means <def>an artistic work prescribed under <ref href="#sec-2A">section 2A</ref>.</def></p>
                  <p><term refersTo="#term-protected-design">protected design</term> means <def>each of the following: the design of the olympic symbol; a registered olympic design; a registered torch and flame design.</def></p>

                <num>a</num>
                <content>
                  <p>the design of the olympic symbol;</p>
                </content>
              </paragraph>
              <paragraph eId="chapter-2__part-2.1__sec-2__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>a registered olympic design;</p>
                </content>
              </paragraph>
              <paragraph eId="chapter-2__part-2.1__sec-2__subsec-1__para-c">
                <num>c</num>
                <content>
                  <p>a registered torch and flame design.</p>
                </content>
                <content>
                  <p><term refersTo="#term-protected-trade-mark">protected trade mark</term> means <def>a trade mark that contains, or consists of, any of the following signs or a sign so nearly resembling any of those signs as to be likely to be taken for that sign: the olympic motto; the olympic symbol; if an artistic work of an olympic torch and flame is prescribed for the purposes of <ref href="#sec-2A">section 2A</ref>—the artistic work; if the design in relation to an artistic work is registered under this Act—the artistic work.</def></p>

                  <p>in relation to a registered olympic design—the period of 12 years starting on the day the design was registered, as extended or reduced under <ref href="#sec-11">section 11</ref>; or</p>

                <num>b</num>
                <content>
                  <p>in relation to a registered torch and flame design for a particular Summer or Winter Olympic Games—the period starting:</p>

              <paragraph eId="chapter-2__part-2.1__sec-2__subsec-1__para-i">
                <num>i</num>
                <content>
                  <p>on the 1 January that is at least 3 years but less than 4 years before the opening of those Olympic Games; or</p>
                </content>
              </paragraph>
              <paragraph eId="chapter-2__part-2.1__sec-2__subsec-1__para-ii">
                <num>ii</num>
                <content>
                  <p>when the design is registered;</p>
                </content>
                <content>
                  <p>whichever is later, and ending on 31 December next after the closing of those Olympic Games, as reduced under <ref href="#sec-11A">section 11A</ref>.</p>
                  <p><term refersTo="#term-registered-design">registered design</term> means <def>a design registered under <ref href="#sec-10">section 10</ref>.</def></p>
                  <p><term refersTo="#term-registered-olympic-design">registered olympic design</term> means <def>a design registered under this Act in relation to an artistic work that incorporates the olympic symbol.</def></p>
                  <p><term refersTo="#term-registered-torch-and-flame-design">registered torch and flame design</term> means <def>a design registered under this Act in relation to an artistic work that is or incorporates a prescribed olympic torch and flame.</def></p>
                  <p><term refersTo="#term-registrar">Registrar</term> means <def><ref class="unresolved">the Registrar of Designs holding office under the Designs Act 2003</ref>.</def></p>
                  <p><b><i>reproduction</i></b>, in relation to an artistic work, has the same meaning as in the <i>Copyright Act 1968</i>.</p>
                  <p><term refersTo="#term-sign">sign</term> has the same meaning as <def>in <ref href="">the Trade Marks Act 1995</ref>.</def></p>
                  <p><term refersTo="#term-trade-mark">trade mark</term> has the same meaning as <def>in <ref href="">the Trade Marks Act 1995</ref>.</def></p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="chapter-2__part-2.1__sec-2__subsec-3">
              <num>3</num>
              <content>
                <p>	(3)	Unless the contrary intention appears, an expression used in this Chapter and the <i>Designs Act 2003</i> has the same meaning in this Chapter as in the <i>Designs Act 2003</i>.</p>

            </subsection>
          </section>
          <section eId="chapter-2__part-2.1__sec-2A">
            <num>2A</num>
            <heading>Artistic work of olympic torch and flame may be prescribed</heading>
            <subsection eId="chapter-2__part-2.1__sec-2A__subsec-1">
              <num>1</num>
              <content>
                <p>The regulations may prescribe a single artistic work of an olympic torch and flame for a particular Summer Olympic Games or for a particular Winter Olympic Games. The artistic work must not incorporate the olympic symbol.</p>
              </content>
            </subsection>
            <subsection eId="chapter-2__part-2.1__sec-2A__subsec-2">
              <num>2</num>
              <content>
                <p>The regulations must not prescribe an artistic work unless:</p>
              </content>
              <paragraph eId="chapter-2__part-2.1__sec-2A__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>	(a)	copyright under the <i>Copyright Act 1968</i> subsists in the artistic work; and</p>
                </content>
              </paragraph>
              <paragraph eId="chapter-2__part-2.1__sec-2A__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>the AOC is the owner of the copyright in the artistic work.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="chapter-2__part-2.1__sec-2A__subsec-3">
              <num>3</num>
              <content>
                <p>The Governor-General may not make a regulation prescribing an artistic work for a particular Olympic Games before the 1 July that is at least 31/2 years but less than 41/2 years before the opening of those Olympic Games (that is, 6 months before the earliest date on which the protection period for a registered torch and flame design for those Olympic Games could start).</p>
              </content>
            </subsection>
          </section>
          <section eId="chapter-2__part-2.1__sec-3">
            <num>3</num>
            <heading>Act to bind Crown</heading>
            <content>
              <p>		Subject to <i>Copyright Act 1968</i>, this Chapter binds the Crown in right of the Commonwealth, of each of the States and of the Northern Territory.<ref href="#part-VI">Part VI</ref>I of the </p>
            </content>
          </section>
          <section eId="chapter-2__part-2.1__sec-4">
            <num>4</num>
            <heading>Extension of Act to external Territories</heading>
            <content>
              <p>This Chapter extends to the external Territories.</p>
            </content>
          </section>
        </part>

          <heading>Copyright protection</heading>
          <section eId="chapter-2__part-2.2__sec-5">
            <num>5</num>
            <heading>Ownership etc. of copyright in the olympic symbol</heading>
            <subsection eId="chapter-2__part-2.2__sec-5__subsec-1">
              <num>1</num>
              <content>
                <p>	(1)	For the purposes of the <i>Copyright Act 1968</i>:</p>
              </content>
              <paragraph eId="chapter-2__part-2.2__sec-5__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>the olympic symbol shall be taken to be an original artistic work in which copyright subsists; and</p>
                </content>
              </paragraph>
              <paragraph eId="chapter-2__part-2.2__sec-5__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>the AOC shall be taken to be the owner of the copyright in the olympic symbol.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="chapter-2__part-2.2__sec-5__subsec-2">
              <num>2</num>
              <content>
                <p>	(2)	Notwithstanding anything in the <i>Copyright Act 1968</i>:</p>
              </content>
              <paragraph eId="chapter-2__part-2.2__sec-5__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>copyright in the olympic symbol subsists indefinitely; and</p>
                </content>
              </paragraph>
              <paragraph eId="chapter-2__part-2.2__sec-5__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>a fair dealing with the olympic symbol does not constitute an infringement of the copyright in the olympic symbol if it is for the purpose of, or is associated with, the giving of information (including the reporting of news):</p>
                </content>
              </paragraph>
              <paragraph eId="chapter-2__part-2.2__sec-5__subsec-2__para-i">
                <num>i</num>
                <content>
                  <p>in a newspaper, magazine or similar periodical; or</p>
                </content>
              </paragraph>
              <paragraph eId="chapter-2__part-2.2__sec-5__subsec-2__para-ii">
                <num>ii</num>
                <content>
                  <p>by means of broadcasting or in a cinematograph film.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="chapter-2__part-2.2__sec-5__subsec-3">
              <num>3</num>
              <content>
                <p>	(3)	An expression used in this section and in the <i>Copyright Act 1968</i> has the same meaning in this section as it has in that Act.</p>
              </content>
            </subsection>
            <subsection eId="chapter-2__part-2.2__sec-5__subsec-4">
              <num>4</num>
              <content>
                <p>The AOC does not have the capacity to bring an action or proceeding under the law of a foreign country for an infringement of copyright in the olympic symbol.</p>
              </content>
            </subsection>
          </section>
        </part>
        <part eId="chapter-2__part-2.3">
          <num>2.3</num>
          <heading>Design protection</heading>
          <section eId="chapter-2__part-2.3__sec-6">
            <num>6</num>
            <heading>Ownership of design of olympic symbol</heading>
            <content>
              <p>The AOC is taken to be the owner of:</p>
            </content>
            <paragraph eId="chapter-2__part-2.3__sec-6__para-a">
              <num>a</num>
              <content>
                <p>the design of the olympic symbol; and</p>
              </content>
            </paragraph>
            <paragraph eId="chapter-2__part-2.3__sec-6__para-b">
              <num>b</num>
              <content>
                <p>	(b)	any registered olympic design that was registered under this Act immediately before the commencement of the <i>Olympic Insignia Protection Amendment Act 1994</i>.</p>
              </content>
            </paragraph>
          </section>
          <section eId="chapter-2__part-2.3__sec-7">
            <num>7</num>
            <heading>Monopoly of design</heading>
            <subsection eId="chapter-2__part-2.3__sec-7__subsec-1">
              <num>1</num>
              <content>
                <p>The AOC has a monopoly in a protected design.</p>
              </content>
            </subsection>
            <subsection eId="chapter-2__part-2.3__sec-7__subsec-2">
              <num>2</num>
              <content>
                <p>The rights of the AOC with respect to a protected design are personal property and, subject to this Chapter, the laws applicable to ownership of personal property apply in relation to the monopoly in the design as they apply in relation to other choses in action.</p>
              </content>
            </subsection>
          </section>
          <section eId="chapter-2__part-2.3__sec-8">
            <num>8</num>
            <heading>Infringement of monopoly in protected design</heading>
            <subsection eId="chapter-2__part-2.3__sec-8__subsec-1">
              <num>1</num>
              <content>
                <p>A person infringes the monopoly in a protected design if:</p>
              </content>
              <paragraph eId="chapter-2__part-2.3__sec-8__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>in the case of the design of the olympic symbol—at any time; or</p>
                </content>
              </paragraph>
              <paragraph eId="chapter-2__part-2.3__sec-8__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>in the case of a registered olympic design or registered torch and flame design—during the protection period in relation to that design;</p>
                </content>
                <content>
                  <p>the person, without the licence of the AOC:</p>
                </content>
              </paragraph>
              <paragraph eId="chapter-2__part-2.3__sec-8__subsec-1__para-c">
                <num>c</num>
                <content>
                  <p>applies the design or any fraudulent or obvious imitation of it to any article;</p>
                </content>
              </paragraph>
              <paragraph eId="chapter-2__part-2.3__sec-8__subsec-1__para-d">
                <num>d</num>
                <content>
                  <p>imports into Australia for sale, or for use for the purposes of any trade or business, any article to which the design or any fraudulent or obvious imitation of it has been applied, whether before or after the commencement of this Act, outside Australia; or</p>
                </content>
              </paragraph>
              <paragraph eId="chapter-2__part-2.3__sec-8__subsec-1__para-e">
                <num>e</num>
                <content>
                  <p>sells, or offers or keeps for sale, or hires, or offers or keeps for hire:</p>
                </content>
              </paragraph>
              <paragraph eId="chapter-2__part-2.3__sec-8__subsec-1__para-i">
                <num>i</num>
                <content>
                  <p>any article to which the design or any fraudulent or obvious imitation of it has been applied in infringement of the monopoly in the design; or</p>
                </content>
              </paragraph>
              <paragraph eId="chapter-2__part-2.3__sec-8__subsec-1__para-ii">
                <num>ii</num>
                <content>
                  <p>any article:</p>
                </content>
                <content>
                  <p>(A)	to which the design or any fraudulent or obvious imitation of it has been applied; and</p>
                  <p>(B)	that has been imported into Australia in infringement of the monopoly in the design.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="chapter-2__part-2.3__sec-8__subsec-2">
              <num>2</num>
              <content>
                <p>A person does not infringe the monopoly in a protected design by virtue of the application of paragraph (1)(c) or subparagraph (1)(e)(i) in relation to an article if, at the time when the person did the act that, but for this subsection, would have constituted the infringement, the person did not intend that the article would be used in Australia at a later time by any person.</p>
              </content>
            </subsection>
            <subsection eId="chapter-2__part-2.3__sec-8__subsec-3">
              <num>3</num>
              <content>
                <p>Subject to subsection (4), if a person infringes the monopoly in a protected design:</p>
              </content>
              <paragraph eId="chapter-2__part-2.3__sec-8__subsec-3__para-a">
                <num>a</num>
                <content>
                  <p>the AOC; or</p>
                </content>
              </paragraph>
              <paragraph eId="chapter-2__part-2.3__sec-8__subsec-3__para-b">
                <num>b</num>
                <content>
                  <p>a holder of a licence in relation to the design whose interests have been, are or would be affected by the infringement;</p>
                </content>
                <content>
                  <p>may bring an action or proceeding against the person in the Federal Court for infringement of the monopoly in the design.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="chapter-2__part-2.3__sec-8__subsec-4">
              <num>4</num>
              <content>
                <p>An action or proceeding for infringement of the monopoly in a protected design shall not be instituted by the holder of a licence in relation to the design without the consent of the AOC.</p>
              </content>
            </subsection>
            <subsection eId="chapter-2__part-2.3__sec-8__subsec-5">
              <num>5</num>
              <content>
                <p>Where:</p>
              </content>
              <paragraph eId="chapter-2__part-2.3__sec-8__subsec-5__para-a">
                <num>a</num>
                <content>
                  <p>a person, being the holder of a licence in relation to a protected design, applies, by notice in writing served on the AOC, for the consent of the AOC under subsection (4) to the institution by the person of an action or proceeding for infringement of the monopoly in the design; and</p>
                </content>
              </paragraph>
              <paragraph eId="chapter-2__part-2.3__sec-8__subsec-5__para-b">
                <num>b</num>
                <content>
                  <p>the AOC does not grant or refuse that consent before the end of the period of 7 days after the day on which the notice was served;</p>
                </content>
                <content>
                  <p>the AOC shall, at the end of that period, be deemed to have granted that consent under subsection (4).</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="chapter-2__part-2.3__sec-8__subsec-6">
              <num>6</num>
              <content>
                <p>Consent under subsection (4) to the institution of an action or proceeding shall not be unreasonably refused.</p>
              </content>
            </subsection>
            <subsection eId="chapter-2__part-2.3__sec-8__subsec-7">
              <num>7</num>
              <content>
                <p>Subsection (4) does not affect the granting of an interlocutory injunction on the application of a holder of a licence in relation to a protected design.</p>
              </content>
            </subsection>
            <subsection eId="chapter-2__part-2.3__sec-8__subsec-8">
              <num>8</num>
              <content>
                <p>For the purposes of this section, a design shall not be taken not to be a fraudulent or obvious imitation of a registered olympic design by reason only that the first-mentioned design does not incorporate the design of the olympic symbol.</p>
              </content>
            </subsection>
            <subsection eId="chapter-2__part-2.3__sec-8__subsec-9">
              <num>9</num>
              <content>
                <p>For the purposes of this section, a design may be a fraudulent or obvious imitation of a registered torch and flame design in relation to an artistic work that incorporates a prescribed torch and flame even though the first-mentioned design relates to an artistic work that does not include the prescribed olympic torch and flame.</p>
              </content>
            </subsection>
          </section>
          <section eId="chapter-2__part-2.3__sec-9">
            <num>9</num>
            <heading>Remedies for infringement of monopoly in protected design</heading>
            <content>
              <p>The relief that the Federal Court may grant in an action or proceeding for the infringement of the monopoly in a protected design includes an injunction (subject to such terms, if any, as the Court thinks fit) and, at the option of the plaintiff, either damages or an account of profits.</p>
            </content>
          </section>
          <section eId="chapter-2__part-2.3__sec-9A">
            <num>9A</num>
            <heading>Australian Consumer Law provides further remedies</heading>
            <subsection eId="chapter-2__part-2.3__sec-9A__subsec-1">
              <num>1</num>
              <content>
                <p>The remedies provided under this Chapter in relation to protected designs are in addition to the remedies provided by the Australian Consumer Law in relation to engaging in conduct that is misleading or deceptive (see <ref href="#sec-18">section 18</ref> of the Australian Consumer Law) and, in particular, in relation to representations:</p>
              </content>
              <paragraph eId="chapter-2__part-2.3__sec-9A__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>that goods or services have sponsorship or approval that they do not have (see paragraph 29(1)(g) of the Australian Consumer Law); or</p>
                </content>
              </paragraph>
              <paragraph eId="chapter-2__part-2.3__sec-9A__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>that a corporation as defined in that Act has a sponsorship, approval or affiliation that it does not have (see paragraph 29(1)(h) of the Australian Consumer Law).</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="chapter-2__part-2.3__sec-9A__subsec-2">
              <num>2</num>
              <content>
                <p>The references in subsection (1) to particular provisions of the Australian Consumer Law do not imply that other provisions of the Australian Consumer Law do not apply in relation to conduct that is also covered by this Chapter.</p>
              </content>
            </subsection>
          </section>
          <section eId="chapter-2__part-2.3__sec-10">
            <num>10</num>
            <heading>Registration of designs</heading>
            <subsection eId="chapter-2__part-2.3__sec-10__subsec-1">
              <num>1</num>
              <content>
                <p>The AOC may apply to <role refersTo="#registrar">the Registrar</role> to register under this Act the design that, when applied to any article, results in a reproduction of an olympic artistic work.</p>
              </content>
            </subsection>
            <subsection eId="chapter-2__part-2.3__sec-10__subsec-2">
              <num>2</num>
              <content>
                <p>An application:</p>
              </content>
              <paragraph eId="chapter-2__part-2.3__sec-10__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>must be in accordance with an approved form; and</p>
                </content>
              </paragraph>
              <paragraph eId="chapter-2__part-2.3__sec-10__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>must be accompanied by the prescribed fee; and</p>
                </content>
              </paragraph>
              <paragraph eId="chapter-2__part-2.3__sec-10__subsec-2__para-c">
                <num>c</num>
                <content>
                  <p>must be lodged by being left at, or delivered by post to, the Designs Office.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="chapter-2__part-2.3__sec-10__subsec-3">
              <num>3</num>
              <content>
                <p>	(3)	The Registrar must cause notice of an application to be published in the <i>Gazette</i> and in the <i>Official Journal</i>.</p>
              </content>
            </subsection>
            <subsection eId="chapter-2__part-2.3__sec-10__subsec-4">
              <num>4</num>
              <content>
                <p>A notice of an application must invite persons who wish to object to the grant of the application on any relevant grounds to make representations in connection with the application by a day specified in the notice.</p>
              </content>
            </subsection>
            <subsection eId="chapter-2__part-2.3__sec-10__subsec-5">
              <num>5</num>
              <content>
                <p>The day specified in the notice must be at least 60 days after the date of the notice.</p>
              </content>
            </subsection>
            <subsection eId="chapter-2__part-2.3__sec-10__subsec-6">
              <num>6</num>
              <content>
                <p>A person may, not later than the day specified in the notice, make representations to <role refersTo="#registrar">the Registrar</role> about the application in accordance with an approved form.</p>
              </content>
            </subsection>
            <subsection eId="chapter-2__part-2.3__sec-10__subsec-7">
              <num>7</num>
              <content>
                <p>Subject to subsection (8), after <role refersTo="#registrar">the Registrar</role> has considered any representations made about the application, <role refersTo="#registrar">the Registrar</role> must register the design if, and only if:</p>
              </content>
              <paragraph eId="chapter-2__part-2.3__sec-10__subsec-7__para-a">
                <num>a</num>
                <content>
                  <p>	(a)	copyright under the <i>Copyright Act 1968</i> subsists in the olympic artistic work; and</p>
                </content>
              </paragraph>
              <paragraph eId="chapter-2__part-2.3__sec-10__subsec-7__para-b">
                <num>b</num>
                <content>
                  <p>the AOC is the owner of the copyright in the olympic artistic work; and</p>
                </content>
              </paragraph>
              <paragraph eId="chapter-2__part-2.3__sec-10__subsec-7__para-c">
                <num>c</num>
                <content>
                  <p>the AOC is the owner of the design; and</p>
                </content>
              </paragraph>
              <paragraph eId="chapter-2__part-2.3__sec-10__subsec-7__para-d">
                <num>d</num>
                <content>
                  <p>no other person has an interest in the design; and</p>
                </content>
              </paragraph>
              <paragraph eId="chapter-2__part-2.3__sec-10__subsec-7__para-e">
                <num>e</num>
                <content>
                  <p>	(e)	no corresponding design in relation to the olympic artistic work is registered under the <i>Designs Act 2003</i>; and</p>
                </content>
              </paragraph>
              <paragraph eId="chapter-2__part-2.3__sec-10__subsec-7__para-f">
                <num>f</num>
                <content>
                  <p>upon registration of the design, there would be no more than 10 registered designs with unexpired protection periods (including registered designs whose protection periods have not yet started).</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="chapter-2__part-2.3__sec-10__subsec-8">
              <num>8</num>
              <content>
                <p>A design must not be registered under this section unless it is a new or original design and in particular, must not be registered if the design:</p>
              </content>
              <paragraph eId="chapter-2__part-2.3__sec-10__subsec-8__para-a">
                <num>a</num>
                <content>
                  <p>differs from a published design only in immaterial details or in features commonly used in a relevant trade; or</p>
                </content>
              </paragraph>
              <paragraph eId="chapter-2__part-2.3__sec-10__subsec-8__para-b">
                <num>b</num>
                <content>
                  <p>is an obvious adaptation of a published design.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="chapter-2__part-2.3__sec-10__subsec-9">
              <num>9</num>
              <content>
                <p>For the purposes of subsection (8), a design in relation to an artistic work is not to be treated:</p>
              </content>
              <paragraph eId="chapter-2__part-2.3__sec-10__subsec-9__para-a">
                <num>a</num>
                <content>
                  <p>as other than new or original; or</p>
                </content>
              </paragraph>
              <paragraph eId="chapter-2__part-2.3__sec-10__subsec-9__para-b">
                <num>b</num>
                <content>
                  <p>as having been published or used;</p>
                </content>
                <content>
                  <p>merely because of any use made of the artistic work by the AOC before the day on which the application for registration of the design was lodged.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="chapter-2__part-2.3__sec-10__subsec-10">
              <num>10</num>
              <content>
                <p>	(10)	Where the Registrar decides under subsection (7) to register, or to refuse to register, a design, the Registrar must cause notice of that decision to be published in the <i>Gazette</i> and in the <i>Official Journal</i>.</p>
              </content>
            </subsection>
            <subsection eId="chapter-2__part-2.3__sec-10__subsec-11">
              <num>11</num>
              <content>
                <p>An appeal lies to the Federal Court from the decision of <role refersTo="#registrar">the Registrar</role> to register, or to refuse to register, a design.</p>
              </content>
            </subsection>
            <subsection eId="chapter-2__part-2.3__sec-10__subsec-12">
              <num>12</num>
              <content>
                <p>In this section:</p>
              </content>
              <content>
                <p><b><i>published design</i></b>, in relation to an application under this section, means a design that:</p>
              </content>
              <paragraph eId="chapter-2__part-2.3__sec-10__subsec-12__para-a">
                <num>a</num>
                <content>
                  <p>	(a)	was registered under the <i>Designs Act 2003</i>; or</p>
                </content>
              </paragraph>
              <paragraph eId="chapter-2__part-2.3__sec-10__subsec-12__para-b">
                <num>b</num>
                <content>
                  <p>was published or used in Australia in respect of any article;</p>
                </content>
                <content>
                  <p>before the day on which the application was lodged.</p>

            <heading>Extension or reduction of protection periods in relation to registered olympic designs</heading>
            <subsection eId="chapter-2__part-2.3__sec-11__subsec-1">

                <p>The AOC may, not later than 6 months before the end of the protection period in relation to a registered olympic design (including a protection period that has been extended or reduced under this section), apply to <role refersTo="#registrar">the Registrar</role> for that period to be extended by a further period of 12 years.</p>
              </content>
            </subsection>
            <subsection eId="chapter-2__part-2.3__sec-11__subsec-2">
              <num>2</num>
              <content>
                <p>An application under subsection (1):</p>
              </content>
              <paragraph eId="chapter-2__part-2.3__sec-11__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>must be in accordance with an approved form; and</p>
                </content>
              </paragraph>
              <paragraph eId="chapter-2__part-2.3__sec-11__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>must be accompanied by the prescribed fee; and</p>
                </content>
              </paragraph>
              <paragraph eId="chapter-2__part-2.3__sec-11__subsec-2__para-c">
                <num>c</num>
                <content>
                  <p>must be lodged by being left at, or delivered by post to, the Designs Office.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="chapter-2__part-2.3__sec-11__subsec-3">
              <num>3</num>
              <content>
                <p>	(3)	Where an application is made under subsection (1), the Registrar shall cause notice of the application to be published in the <i>Gazette</i> and in the <i>Official Journal</i>.</p>
              </content>
            </subsection>
            <subsection eId="chapter-2__part-2.3__sec-11__subsec-4">
              <num>4</num>
              <content>
                <p>A notice of an application shall invite persons who wish to object to the grant of the application on any relevant grounds to make representations in connection with the application by such date, not being a date earlier than 60 days after the date of the notice, as is specified in the notice.</p>
              </content>
            </subsection>
            <subsection eId="chapter-2__part-2.3__sec-11__subsec-5">
              <num>5</num>
              <content>
                <p>A person may, not later than the date specified in the notice, make representations to <role refersTo="#registrar">the Registrar</role> in connection with the application in accordance with an approved form.</p>
              </content>
            </subsection>
            <subsection eId="chapter-2__part-2.3__sec-11__subsec-6">
              <num>6</num>
              <content>
                <p>After <role refersTo="#registrar">the Registrar</role> has considered any such representations made in respect of an application for the extension of the protection period in relation to a registered olympic design, <role refersTo="#registrar">the Registrar</role> shall, before the end of the protection period, extend the protection period for a further period of 12 years if <role refersTo="#registrar">the Registrar</role> would be required to register the design if an application for registration of the design had been made immediately after the end of the protection period.</p>
              </content>
            </subsection>
            <subsection eId="chapter-2__part-2.3__sec-11__subsec-7">
              <num>7</num>
              <content>
                <p><role refersTo="#registrar">The Registrar</role> shall, on the application of the AOC made in accordance with an approved form, reduce the duration of the protection period in relation to a registered olympic design.</p>
              </content>
            </subsection>
            <subsection eId="chapter-2__part-2.3__sec-11__subsec-8">
              <num>8</num>
              <content>
                <p>	(8)	Where the protection period in relation to a registered olympic design ends or is extended, the Registrar shall cause notice of the end or extension to be published in the <i>Gazette</i> and in the <i>Official Journal</i>.</p>
              </content>
            </subsection>
            <subsection eId="chapter-2__part-2.3__sec-11__subsec-9">
              <num>9</num>
              <content>
                <p>	(9)	Where the Registrar makes a decision under subsection (6) refusing to extend a protection period, the Registrar shall cause notice of the decision to be published in the <i>Gazette</i> and in the <i>Official Journal</i>.</p>
              </content>
            </subsection>
            <subsection eId="chapter-2__part-2.3__sec-11__subsec-10">
              <num>10</num>
              <content>
                <p>An appeal lies to the Federal Court from a decision of <role refersTo="#registrar">the Registrar</role> under subsection (6) to extend or to refuse to extend a protection period.</p>
              </content>
            </subsection>
          </section>
          <section eId="chapter-2__part-2.3__sec-11A">
            <num>11A</num>
            <heading>Reduction of protection periods for registered torch and flame designs</heading>
            <subsection eId="chapter-2__part-2.3__sec-11A__subsec-1">
              <num>1</num>
              <content>
                <p><role refersTo="#registrar">The Registrar</role> must, on the application of the AOC made in accordance with an approved form, reduce the duration of the protection period in relation to a registered torch and flame design.</p>
              </content>
            </subsection>
            <subsection eId="chapter-2__part-2.3__sec-11A__subsec-2">
              <num>2</num>
              <content>
                <p>	(2)	Where the protection period in relation to a registered torch and flame design ends, the Registrar must cause notice of the end of that period to be published in the <i>Gazette</i> and in the <i>Official Journal</i>.</p>
              </content>
            </subsection>
          </section>
          <section eId="chapter-2__part-2.3__sec-12">
            <num>12</num>
            <heading>Register of Olympic Designs</heading>
            <subsection eId="chapter-2__part-2.3__sec-12__subsec-1">
              <num>1</num>
              <content>
                <p>There shall be kept at the Designs Office a Register of Olympic Designs.</p>
              </content>
            </subsection>
            <subsection eId="chapter-2__part-2.3__sec-12__subsec-2">
              <num>2</num>
              <content>
                <p><role refersTo="#registrar">The Registrar</role> shall enter in the Register of Olympic Designs particulars of:</p>
              </content>
              <paragraph eId="chapter-2__part-2.3__sec-12__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>registered olympic designs; and</p>
                </content>
              </paragraph>
              <paragraph eId="chapter-2__part-2.3__sec-12__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>the end and extension of protection periods in relation to registered olympic designs; and</p>
                </content>
              </paragraph>
              <paragraph eId="chapter-2__part-2.3__sec-12__subsec-2__para-ba">
                <num>ba</num>
                <content>
                  <p>registered torch and flame designs; and</p>
                </content>
              </paragraph>
              <paragraph eId="chapter-2__part-2.3__sec-12__subsec-2__para-bb">
                <num>bb</num>
                <content>
                  <p>the end of protection periods in relation to registered torch and flame designs; and</p>
                </content>
              </paragraph>
              <paragraph eId="chapter-2__part-2.3__sec-12__subsec-2__para-c">
                <num>c</num>
                <content>
                  <p>any other prescribed matters.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="chapter-2__part-2.3__sec-12__subsec-3">
              <num>3</num>
              <content>
                <p>The Register of Olympic Designs shall be open to the inspection of the public at the times, and on payment of the fees (if any), prescribed for the purposes of this section.</p>
              </content>
            </subsection>
            <subsection eId="chapter-2__part-2.3__sec-12__subsec-4">
              <num>4</num>
              <content>
                <p>The regulations may make further provision with respect to the Register of Olympic Designs, including, but without limiting the generality of the foregoing, provision for the correction of errors in the Register of Olympic Designs.</p>
              </content>
            </subsection>
            <subsection eId="chapter-2__part-2.3__sec-12__subsec-5">
              <num>5</num>
              <content>
                <p>	(5)	Section 131 of the <i>Designs Act 2003</i> applies in relation to the Register of Olympic Designs in the same manner as it applies in relation to the Register of Designs.</p>
              </content>
            </subsection>
            <subsection eId="chapter-2__part-2.3__sec-12__subsec-6">
              <num>6</num>
              <content>
                <p>The Federal Court, on the application of a person aggrieved, may order the rectification of the Register of Olympic Designs by:</p>
              </content>
              <paragraph eId="chapter-2__part-2.3__sec-12__subsec-6__para-a">
                <num>a</num>
                <content>
                  <p>the making of any entry wrongly omitted to be made in the Register of Olympic Designs; or</p>
                </content>
              </paragraph>
              <paragraph eId="chapter-2__part-2.3__sec-12__subsec-6__para-b">
                <num>b</num>
                <content>
                  <p>the expunging or amendment of any entry wrongly made in or remaining on the Register of Olympic Designs; or</p>
                </content>
              </paragraph>
              <paragraph eId="chapter-2__part-2.3__sec-12__subsec-6__para-c">
                <num>c</num>
                <content>
                  <p>the correcting of any error or defect in the Register of Olympic Designs.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="chapter-2__part-2.3__sec-12__subsec-7">
              <num>7</num>
              <content>
                <p>Notice of each application under subsection (6) shall be given to <role refersTo="#registrar">the Registrar</role>, who may be heard on the application.</p>
              </content>
            </subsection>
            <subsection eId="chapter-2__part-2.3__sec-12__subsec-8">
              <num>8</num>
              <content>
                <p>A copy of an order under subsection (6) shall be served on <role refersTo="#registrar">the Registrar</role>, who shall, on receipt of the order, take such steps as are necessary to give effect to the order.</p>
              </content>
            </subsection>
            <subsection eId="chapter-2__part-2.3__sec-12__subsec-9">
              <num>9</num>
              <content>
                <p>A defendant in an action or proceeding for the infringement of the monopoly in a protected design may apply, by way of counter-claim in the action or proceeding, for the rectification of the Register of Olympic Designs by the expunging of the entry of the registration of the design from the Register of Olympic Designs.</p>
              </content>
            </subsection>
          </section>
          <section eId="chapter-2__part-2.3__sec-13">
            <num>13</num>
            <heading>Delegation</heading>
            <content>
              <p>		Section 124 of the <i>Designs Act 2003</i> applies in relation to the Registrar’s powers under this Part in the same manner in which it applies in relation to the Registrar’s powers under that Act.</p>
            </content>

          <section eId="chapter-2__part-2.3__sec-14">

            <heading>Approved forms</heading>
            <subsection eId="chapter-2__part-2.3__sec-14__subsec-1">
              <num>1</num>
              <content>
                <p>A reference in this Part to an approved form is a reference to a form approved by <role refersTo="#registrar">the Registrar</role> in writing.</p>
              </content>
            </subsection>
            <subsection eId="chapter-2__part-2.3__sec-14__subsec-2">
              <num>2</num>
              <content>
                <p>An approved form may require any statement in the form to be verified by a statutory declaration accompanying the form.</p>
              </content>
            </subsection>
          </section>
          <section eId="chapter-2__part-2.3__sec-14A">

            <heading>Doing act when Designs Office reopens after end of period otherwise provided for doing act</heading>
            <subsection eId="chapter-2__part-2.3__sec-14A__subsec-1">

                <p>If the last day of a period provided by this Chapter (except this section), or regulations made for the purposes of this Chapter, for doing an act is a day when the Designs Office is not open for business, the act may be done in prescribed circumstances on the next day when the office is open for business.</p>
              </content>
            </subsection>
            <subsection eId="chapter-2__part-2.3__sec-14A__subsec-2">
              <num>2</num>
              <content>
                <p>For the purposes of this section, the Designs Office is taken not to be open for business on a day:</p>
              </content>

                  <p>declared by regulations to be a day on which the office is not open for business; or</p>
                </content>
              </paragraph>

                  <p>declared, by a prescribed person in writing published in the prescribed way, to be a day on which the office is not open for business.</p>

                  <p>Declarations</p>

            <heading>Application of the Copyright Act 1968</heading>

                  <p>it is not an infringement of the copyright in the artistic work to apply a design to an article, being:</p>

                <num>d</num>

                  <p>a design that is a corresponding design in relation to an artistic work that is a public domain version of the first-mentioned artistic work; or</p>

                  <p>a design that differs from the design referred to in paragraph (d) only in immaterial details or in features commonly used in a relevant trade.</p>

                <p>For the purposes of subsection (4), where an artistic work incorporates the olympic symbol, the artistic work (if any) that would result from the omission of the olympic symbol from the first-mentioned artistic work shall be taken to be the public domain version of the first-mentioned artistic work.</p>

            </subsection>
            <subsection eId="chapter-2__part-2.4__sec-17__subsec-5A">
              <num>5A</num>
              <content>
                <p>Where the protection period in relation to a registered torch and flame design has ended, it is not an infringement of the copyright in the artistic work concerned to apply the design to an article.</p>
              </content>
            </subsection>
            <subsection eId="chapter-2__part-2.4__sec-17__subsec-6">
              <num>6</num>
              <content>
                <p>Where, by virtue of this section, it is not an infringement of the copyright in an artistic work to apply a particular design to an article at a particular time, it is not an infringement of the copyright in the artistic work to do any of the following acts or things at that time:</p>
              </content>
              <paragraph eId="chapter-2__part-2.4__sec-17__subsec-6__para-a">
                <num>a</num>
                <content>
                  <p>import into Australia any article to which the design has been applied;</p>
                </content>
              </paragraph>
              <paragraph eId="chapter-2__part-2.4__sec-17__subsec-6__para-b">
                <num>b</num>
                <content>
                  <p>sell, offer or keep for sale, or hire, or offer or keep for hire, any article to which the design has been applied.</p>
                </content>
              </paragraph>
            </subsection>
          </section>
          <section eId="chapter-2__part-2.4__sec-18">
            <num>18</num>
            <heading>Protected designs not to be registered under the Designs Act 2003</heading>
            <content>
              <p>		The Registrar shall not register under the <i>Designs Act 2003</i>:</p>
            </content>
            <paragraph eId="chapter-2__part-2.4__sec-18__para-a">
              <num>a</num>
              <content>
                <p>a protected design;</p>
              </content>
            </paragraph>
            <paragraph eId="chapter-2__part-2.4__sec-18__para-b">
              <num>b</num>
              <content>
                <p>a design incorporating a protected design;</p>
              </content>
            </paragraph>
            <paragraph eId="chapter-2__part-2.4__sec-18__para-c">
              <num>c</num>
              <content>
                <p>a design that differs from a protected design only in immaterial details or in features commonly used in a relevant trade; or</p>
              </content>
            </paragraph>
            <paragraph eId="chapter-2__part-2.4__sec-18__para-d">
              <num>d</num>
              <content>
                <p>a design that is an obvious adaptation of a protected design.</p>
              </content>
            </paragraph>
          </section>
          <section eId="chapter-2__part-2.4__sec-18A">
            <num>18A</num>
            <heading>AOC to maintain Register of licences</heading>
            <subsection eId="chapter-2__part-2.4__sec-18A__subsec-1">
              <num>1</num>
              <content>
                <p>The AOC is to maintain a Register in which the AOC includes prescribed particulars of:</p>
              </content>
              <paragraph eId="chapter-2__part-2.4__sec-18A__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>licences granted by the AOC in relation to copyright in the olympic symbol; and</p>
                </content>
              </paragraph>
              <paragraph eId="chapter-2__part-2.4__sec-18A__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>licences granted by the AOC in relation to the protected designs.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="chapter-2__part-2.4__sec-18A__subsec-2">
              <num>2</num>
              <content>
                <p>The Register may be maintained by electronic means.</p>
              </content>
            </subsection>
            <subsection eId="chapter-2__part-2.4__sec-18A__subsec-3">
              <num>3</num>
              <content>
                <p>The Register is to be made available for inspection on the internet.</p>
              </content>
            </subsection>
          </section>
          <section eId="chapter-2__part-2.4__sec-19">
            <num>19</num>
            <heading>Use of protected trade mark contrary to law in certain circumstances</heading>
            <content>
              <p>		For the purposes of paragraph 42(b) of the <i>Trade Marks Act 1995</i>, it is to be taken that the use of a protected trade mark by a person or body other than the following would be contrary to law:</p>
            </content>
            <paragraph eId="chapter-2__part-2.4__sec-19__para-a">
              <num>a</num>
              <content>
                <p>the AOC;</p>
              </content>
            </paragraph>
            <paragraph eId="chapter-2__part-2.4__sec-19__para-b">
              <num>b</num>
              <content>
                <p>the IOC.</p>
              </content>

                <p>Subject to subsection (3), nothing in this Chapter affects any rights conferred by law on a person in respect of:</p>

                  <p>	(a)	a trade mark registered under the <i>Trade Marks Act 1995</i>; or</p>
                </content>
              </paragraph>

                <num>b</num>
                <content>
                  <p>	(b)	a design registered under the <i>Designs Act 2003</i>.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="chapter-2__part-2.4__sec-20__subsec-2">
              <num>2</num>
              <content>
                <p>Subject to subsection (3), nothing in this Chapter affects the use of a symbol by a person on or after a relevant date if, immediately before that date, the person would have been entitled to prevent another person from passing off, by means of the use of that symbol or of a similar symbol, goods or services as the goods or services of that first-mentioned person.</p>
              </content>
            </subsection>
            <subsection eId="chapter-2__part-2.4__sec-20__subsec-2A">
              <num>2A</num>
              <content>
                <p>In subsection (2):</p>
              </content>
              <content>
                <p><b><i>relevant date</i></b> means each of the following:</p>
              </content>
              <paragraph eId="chapter-2__part-2.4__sec-20__subsec-2A__para-a">
                <num>a</num>
                <content>
                  <p>the date of commencement of this Act (<date date="1987-06-23">23 June 1987</date>);</p>
                </content>
              </paragraph>
              <paragraph eId="chapter-2__part-2.4__sec-20__subsec-2A__para-b">
                <num>b</num>
                <content>
                  <p>	(b)	the date of commencement of the <i>Olympic Insignia Protection Amendment Act 1994</i>;</p>
                </content>
              </paragraph>
              <paragraph eId="chapter-2__part-2.4__sec-20__subsec-2A__para-c">
                <num>c</num>
                <content>
                  <p>the date of registration of a registered torch and flame design.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="chapter-2__part-2.4__sec-20__subsec-3">
              <num>3</num>
              <content>
                <p>In an action or proceeding against:</p>
              </content>
              <paragraph eId="chapter-2__part-2.4__sec-20__subsec-3__para-a">
                <num>a</num>
                <content>
                  <p>the AOC; or</p>
                </content>
              </paragraph>
              <paragraph eId="chapter-2__part-2.4__sec-20__subsec-3__para-b">
                <num>b</num>
                <content>
                  <p>the holder of a licence granted by the AOC in respect of:</p>
                </content>
              </paragraph>
              <paragraph eId="chapter-2__part-2.4__sec-20__subsec-3__para-i">
                <num>i</num>
                <content>
                  <p>the copyright in, or the design of, the olympic symbol; or</p>
                </content>
              </paragraph>
              <paragraph eId="chapter-2__part-2.4__sec-20__subsec-3__para-ia">
                <num>ia</num>
                <content>
                  <p>the copyright in a prescribed olympic torch and flame; or</p>
                </content>
              </paragraph>
              <paragraph eId="chapter-2__part-2.4__sec-20__subsec-3__para-ii">
                <num>ii</num>
                <content>
                  <p>a design registered, or purporting to be registered, under this Act;</p>
                </content>
                <content>
                  <p>for:</p>
                </content>
              </paragraph>
              <paragraph eId="chapter-2__part-2.4__sec-20__subsec-3__para-c">
                <num>c</num>
                <content>
                  <p>	(c)	the infringement of a trade mark registered under the <i>Trade Marks Act 1995</i>;</p>
                </content>
              </paragraph>
              <paragraph eId="chapter-2__part-2.4__sec-20__subsec-3__para-d">
                <num>d</num>
                <content>
                  <p>	(d)	the infringement of the monopoly of a design registered under the <i>Designs Act 2003</i>; or</p>
                </content>
              </paragraph>
              <paragraph eId="chapter-2__part-2.4__sec-20__subsec-3__para-e">
                <num>e</num>
                <content>
                  <p>passing off arising out of the use of a symbol as mentioned in subsection (2);</p>
                </content>
                <content>
                  <p>it is a defence if the defendant satisfies the court:</p>
                </content>
              </paragraph>
              <paragraph eId="chapter-2__part-2.4__sec-20__subsec-3__para-f">
                <num>f</num>
                <content>
                  <p>that, at the time of the infringement or use, the defendant was not aware that the trade mark or design was so registered, or that the plaintiff was entitled to prevent the passing off, as the case may be; and</p>
                </content>
              </paragraph>
              <paragraph eId="chapter-2__part-2.4__sec-20__subsec-3__para-g">
                <num>g</num>
                <content>
                  <p>that the defendant had, before that time, taken all reasonable steps to ascertain whether the trade mark was so registered, a monopoly in the design so existed or the plaintiff had such an entitlement to prevent a passing off, as the case may be.</p>
                </content>
              </paragraph>
            </subsection>
          </section>
          <section eId="chapter-2__part-2.4__sec-21">
            <num>21</num>
            <heading>Compensation for acquisition of property</heading>
            <subsection eId="chapter-2__part-2.4__sec-21__subsec-1">
              <num>1</num>
              <content>
                <p>Where, but for this subsection, the operation of a provision of this Chapter would result in the acquisition of property from a person by another person otherwise than on just terms, there is payable to the first-mentioned person by that other person such amount of compensation as is agreed upon between those persons, or, failing agreement, as is determined by the Federal Court.</p>
              </content>
            </subsection>
            <subsection eId="chapter-2__part-2.4__sec-21__subsec-2">
              <num>2</num>
              <content>
                <p>Any compensation recovered in proceedings that are instituted under this section shall be taken into account in assessing damages or compensation or giving any other remedy in proceedings that are instituted otherwise than by virtue of this Chapter and that arise out of the same event or transaction.</p>
              </content>
            </subsection>
            <subsection eId="chapter-2__part-2.4__sec-21__subsec-3">
              <num>3</num>
              <content>
                <p>Any damages or compensation recovered or other remedy given in proceedings that are instituted otherwise than by virtue of this Chapter shall be taken into account in assessing compensation payable in proceedings that are instituted under this section and that arise out of the same event or transaction.</p>

                  <p>The object of this Chapter is to protect, and to further, the position of Australia as a participant in, and a supporter of, the world Olympic movement.</p>
                </content>
              </subsection>
              <subsection eId="chapter-3__part-3.1__dvs-1__sec-22__subsec-2">
                <num>2</num>
                <content>
                  <p>This object is to be achieved by facilitating the raising of licensing revenue through the regulation of the use for commercial purposes of certain expressions associated with the world Olympic movement.</p>
                </content>
              </subsection>
            </section>
            <section eId="chapter-3__part-3.1__dvs-1__sec-23">
              <num>23</num>
              <heading>Definitions</heading>
              <content>
                <p>In this Chapter, unless the contrary intention appears:</p>
                <p><term refersTo="#term-advertisement">advertisement</term> means <def>any writing, still or moving picture, sign, symbol or other visual image, or any audible message, or any combination of 2 or more of those things, that promotes: goods or services; or a person. An advertisement may: be in the form of a signboard; or be in a newspaper or periodical; or be broadcast on radio or television; or be placed on a website; or be in any other form.</def></p>
              </content>
              <paragraph eId="chapter-3__part-3.1__dvs-1__sec-23__para-a">
                <num>a</num>
                <content>
                  <p>goods or services; or</p>
                </content>
              </paragraph>
              <paragraph eId="chapter-3__part-3.1__dvs-1__sec-23__para-b">
                <num>b</num>
                <content>
                  <p>a person.</p>
                </content>
                <content>
                  <p>An advertisement may:</p>
                </content>
              </paragraph>
              <paragraph eId="chapter-3__part-3.1__dvs-1__sec-23__para-c">
                <num>c</num>
                <content>
                  <p>be in the form of a signboard; or</p>
                </content>
              </paragraph>
              <paragraph eId="chapter-3__part-3.1__dvs-1__sec-23__para-d">
                <num>d</num>
                <content>
                  <p>be in a newspaper or periodical; or</p>
                </content>
              </paragraph>
              <paragraph eId="chapter-3__part-3.1__dvs-1__sec-23__para-e">
                <num>e</num>
                <content>
                  <p>be broadcast on radio or television; or</p>
                </content>
              </paragraph>
              <paragraph eId="chapter-3__part-3.1__dvs-1__sec-23__para-f">

                  <p>be in any other form.</p>
                </content>
                <content>
                  <p><term refersTo="#term-aoc-or-australian-olympic-committee">AOC or Australian Olympic Committee</term> means <def>the Australian Olympic Committee Incorporated, being an association incorporated on 24 April 1985 under <ref class="unresolved">the Associations Incorporation Act 1981</ref> of Victoria.</def></p>
                  <p><b><i>Australia</i></b>, when used in a geographical sense, includes the following external Territories:</p>
                </content>
              </paragraph>
              <paragraph eId="chapter-3__part-3.1__dvs-1__sec-23__para-a">
                <num>a</num>
                <content>
                  <p>Christmas Island;</p>
                </content>
              </paragraph>
              <paragraph eId="chapter-3__part-3.1__dvs-1__sec-23__para-b">

                  <p>Cocos (Keeling) Islands;</p>
                </content>
              </paragraph>
              <paragraph eId="chapter-3__part-3.1__dvs-1__sec-23__para-c">

                  <p><term refersTo="#term-broadcast">broadcast</term> means <def>a transmission by means of: 	(a)	a broadcasting service within the meaning of the <i>Broadcasting Services Act 1992</i>; or 	(b)	something that would be such a broadcasting service if the definition of <b><i>broadcasting service</i></b> in subsection 6(1) of that Act were amended by omitting all the words from and including “but does not include” to the end of the definition.</def></p>

              </paragraph>
              <paragraph eId="chapter-3__part-3.1__dvs-1__sec-23__para-a">
                <num>a</num>
                <content>
                  <p>	(a)	a broadcasting service within the meaning of the <i>Broadcasting Services Act 1992</i>; or</p>
                </content>
              </paragraph>
              <paragraph eId="chapter-3__part-3.1__dvs-1__sec-23__para-b">
                <num>b</num>
                <content>

                  <p><b><i>designated owner</i></b>, in relation to goods imported into Australia, means:</p>
                </content>
              </paragraph>
              <paragraph eId="chapter-3__part-3.1__dvs-1__sec-23__para-a">

                  <p>	(a)	the person identified as the owner of the goods on the entry made in relation to the goods under <i>Customs Act 1901</i>; or<ref href="#sec-68">section 68</ref> of the </p>

              </paragraph>
              <paragraph eId="chapter-3__part-3.1__dvs-1__sec-23__para-b">
                <num>b</num>
                <content>
                  <p>if no such entry exists—the person determined to be the owner of the goods under <ref href="#sec-50">section 50</ref> of this Act.</p>
                </content>
                <content>
                  <p><term refersTo="#term-expression">expression</term> includes <def>a single word.</def></p>
                  <p><term refersTo="#term-federal-court">Federal Court</term> means <def>the Federal Court of Australia.</def></p>
                  <p><term refersTo="#term-ioc-or-international-olympic-committee">IOC or International Olympic Committee</term> means <def>the organisation created by the Congress of Paris on 23 June 1894, being the organisation entrusted with the control and development of the modern Olympic Games.</def></p>
                  <p><term refersTo="#term-licence">licence</term> means <def>a licence in force under <ref href="#sec-38">section 38</ref>.</def></p>
                  <p><term refersTo="#term-licensed-user">licensed user</term> means <def>a person in relation to whom a licence is in force.</def></p>
                  <p><term refersTo="#term-national-sporting-organisation">national sporting organisation</term> has the same meaning as <def>in <ref href="">the Sport Integrity Australia Act 2020</ref>.</def></p>
                  <p><term refersTo="#term-olympian">Olympian</term> means <def>a person who: was accredited by the IOC as a competitor in a sports competition in a Summer or Winter Olympic Games; and has competed in that sports competition.</def></p>
                </content>
              </paragraph>
              <paragraph eId="chapter-3__part-3.1__dvs-1__sec-23__para-a">
                <num>a</num>
                <content>
                  <p>was accredited by the IOC as a competitor in a sports competition in a Summer or Winter Olympic Games; and</p>
                </content>
              </paragraph>
              <paragraph eId="chapter-3__part-3.1__dvs-1__sec-23__para-b">
                <num>b</num>
                <content>
                  <p>has competed in that sports competition.</p>
                </content>
                <content>
                  <p><term refersTo="#term-prescribed-court">prescribed court</term> means <def>a court that is a prescribed court under <ref href="#sec-66">section 66</ref>.</def></p>
                  <p><term refersTo="#term-promote">promote</term> includes <def>give publicity to.</def></p>
                  <p><term refersTo="#term-protected-olympic-expression">protected olympic expression</term> has the meaning given by <def><ref href="#sec-24">section 24</ref>.</def></p>
                  <p><term refersTo="#term-sponsorship-like-support">sponsorship-like support</term> has the meaning given by <def><ref href="#sec-29">section 29</ref>.</def></p>
                  <p><term refersTo="#term-statement">statement</term> includes <def>a statement made orally, in writing or in any other way.</def></p>
                  <p><b><i>use for commercial purposes</i></b>, in relation to a protected olympic expression, has the meaning given by section 30.</p>

              <heading>Protected olympic expressions</heading>
              <subsection eId="chapter-3__part-3.1__dvs-1__sec-24__subsec-1">

                  <p>	(1)	For the purposes of this Chapter, each of the following expressions is a <b><i>protected olympic expression</i></b>:</p>

                  <p>For the purposes of this Chapter, an expression so closely resembling a protected olympic expression mentioned in subsection (1) as to be likely to be mistaken, by a reasonable person, for such a protected olympic expression is taken to be a protected olympic expression.</p>

                  <p>To avoid doubt, for the purposes of this Chapter, the expressions “Olympian” and “Olympians” are taken not to resemble a protected olympic expression mentioned in subsection (1).</p>

                  <p>This Chapter has, by force of this subsection, the effect it would have if each reference to use for commercial purposes were a reference to:</p>

                    <p>use for commercial purposes by a corporation to which paragraph 51(xx) of the Constitution applies; or</p>

                  <p>For the purposes of this Chapter, if:</p>

                  </content>
                </paragraph>

              <heading>Sponsorship-like support</heading>

                  <p>	(1)	For the purposes of this Chapter, a person provides <b><i>sponsorship</i></b><b><i>-</i></b><b><i>like support</i></b> for:</p>

              <heading>Use for commercial purposes</heading>
              <subsection eId="chapter-3__part-3.1__dvs-2__sec-30__subsec-1">

                  <p>This section sets out the 2 situations in which a person is said to use a protected olympic expression for commercial purposes.</p>
                </content>
                <content>
                  <p>Use for commercial purposes—situation (1)</p>
                </content>
              </subsection>
              <subsection eId="chapter-3__part-3.1__dvs-2__sec-30__subsec-2">
                <num>2</num>
                <content>
                  <p>For the purposes of this Chapter, if:</p>
                </content>
                <paragraph eId="chapter-3__part-3.1__dvs-2__sec-30__subsec-2__para-a">
                  <num>a</num>
                  <content>
                    <p>	(a)	a person (the <b><i>first person</i></b>) causes a protected olympic expression to be applied to goods or services of the first person; and</p>
                  </content>
                </paragraph>

                  <num>b</num>
                  <content>
                    <p>the application is for advertising or promotional purposes, or is likely to enhance the demand for the goods or services; and</p>

                    <p>the application, to a reasonable person, would suggest that the first person is or was a sponsor of, or is or was the provider of sponsorship-like support for:</p>

                    <p>if the expression is applied in Australia—the application is use by the first person of the expression for commercial purposes; or</p>

                    <p>there is a designated owner of the goods;</p>
                  </content>

                    <p>the importation is use by the designated owner of the expression for commercial purposes.</p>

              <heading>Exemption—statements about past participation of Olympians</heading>
              <content>
                <p>For the purposes of this Chapter, if:</p>

                  <p>a person has been involved in a Summer or Winter Olympic Games as an Olympian; and</p>
                </content>
              </paragraph>
              <paragraph eId="chapter-3__part-3.1__dvs-2__sec-31__para-b">
                <num>b</num>
                <content>
                  <p>the Games have ended; and</p>
                </content>
              </paragraph>
              <paragraph eId="chapter-3__part-3.1__dvs-2__sec-31__para-c">

                <content>
                  <p>the person makes, or authorises another person to make, a statement that consists of, or includes, a factual reference to that involvement; and</p>
                </content>
              </paragraph>
              <paragraph eId="chapter-3__part-3.1__dvs-2__sec-31__para-d">

                  <p>the statement includes a protected olympic expression; and</p>
                </content>
              </paragraph>

                  <p>For the purposes of this Chapter, if:</p>
                </content>
                <paragraph eId="chapter-3__part-3.1__dvs-2__sec-32__subsec-1__para-a">

                    <p>a body that is:</p>
                  </content>
                </paragraph>
                <paragraph eId="chapter-3__part-3.1__dvs-2__sec-32__subsec-1__para-i">
                  <num>i</num>
                  <content>
                    <p>a national sporting organisation in relation to a sport; or</p>
                  </content>
                </paragraph>
                <paragraph eId="chapter-3__part-3.1__dvs-2__sec-32__subsec-1__para-ii">
                  <num>ii</num>

                    <p>the Australian Sports Commission; or</p>
                  </content>
                </paragraph>

              <subsection eId="chapter-3__part-3.1__dvs-2__sec-32__subsec-2">

                  <p>For the purposes of this section, a State/Territory institute or academy of sport is a body that is recognised by the Government of a State or Territory as the principal organisation within the State or Territory that has responsibility for preparing elite sportsmen and sportswomen for sporting competition at the elite level.</p>
                </content>
              </subsection>
              <subsection eId="chapter-3__part-3.1__dvs-2__sec-32__subsec-3">
                <num>3</num>
                <content>
                  <p>For the purposes of this section:</p>
                </content>
                <paragraph eId="chapter-3__part-3.1__dvs-2__sec-32__subsec-3__para-a">
                  <num>a</num>
                  <content>
                    <p>an organisation that is a part of another body is taken to be a body in its own right; and</p>
                  </content>
                </paragraph>
                <paragraph eId="chapter-3__part-3.1__dvs-2__sec-32__subsec-3__para-b">
                  <num>b</num>
                  <content>
                    <p>anything done on behalf of, or in the name of, the organisation by the other body is taken to have been done by the organisation.</p>

              <heading>Exemption—statements about sports-related personal services</heading>
              <subsection eId="chapter-3__part-3.1__dvs-2__sec-33__subsec-1">

                  <p>For the purposes of this Chapter, if:</p>
                </content>
                <paragraph eId="chapter-3__part-3.1__dvs-2__sec-33__subsec-1__para-a">
                  <num>a</num>
                  <content>
                    <p>	(a)	a person has provided sports-related personal services (the <b><i>athlete services</i></b>) to one or more Olympians in the person’s capacity as a member of an Olympic team that participated in a Summer or Winter Olympic Games; and</p>
                  </content>
                </paragraph>
                <paragraph eId="chapter-3__part-3.1__dvs-2__sec-33__subsec-1__para-b">
                  <num>b</num>
                  <content>
                    <p>the Games have ended; and</p>
                  </content>
                </paragraph>
                <paragraph eId="chapter-3__part-3.1__dvs-2__sec-33__subsec-1__para-c">
                  <num>c</num>
                  <content>
                    <p>the person makes, or authorises another person to make, a factual statement about the provision of the athlete services; and</p>

                    <p>the application of the statement is for advertising or promotional purposes in relation to the ordinary services, or is likely to enhance the demand for the ordinary services;</p>

                    <p>the application of the statement is to be disregarded for the purposes of this Chapter.</p>

                </paragraph>
              </subsection>
              <subsection eId="chapter-3__part-3.1__dvs-2__sec-33__subsec-2">

                <content>
                  <p>In this section:</p>
                </content>
                <content>
                  <p><b><i>sports</i></b><b><i>-</i></b><b><i>related personal services</i></b> means any of the following:</p>
                </content>
                <paragraph eId="chapter-3__part-3.1__dvs-2__sec-33__subsec-2__para-a">
                  <num>a</num>
                  <content>
                    <p>coaching services;</p>
                  </content>
                </paragraph>
                <paragraph eId="chapter-3__part-3.1__dvs-2__sec-33__subsec-2__para-b">
                  <num>b</num>
                  <content>
                    <p>medical or other health services;</p>
                  </content>
                </paragraph>
                <paragraph eId="chapter-3__part-3.1__dvs-2__sec-33__subsec-2__para-c">
                  <num>c</num>
                  <content>
                    <p>dietary consultative services;</p>
                  </content>
                </paragraph>
                <paragraph eId="chapter-3__part-3.1__dvs-2__sec-33__subsec-2__para-d">
                  <num>d</num>
                  <content>
                    <p>psychological or other counselling services;</p>
                  </content>
                </paragraph>
                <paragraph eId="chapter-3__part-3.1__dvs-2__sec-33__subsec-2__para-e">
                  <num>e</num>
                  <content>
                    <p>any similar services designed to maintain or enhance a person’s sporting performance.</p>
                  </content>
                </paragraph>
              </subsection>
            </section>
            <section eId="chapter-3__part-3.1__dvs-2__sec-34">
              <num>34</num>
              <heading>Exemption—statements about supply of goods or services to past teams or Games</heading>
              <content>
                <p>For the purposes of this Chapter, if:</p>
              </content>
              <paragraph eId="chapter-3__part-3.1__dvs-2__sec-34__para-a">
                <num>a</num>
                <content>
                  <p>a person supplied goods or services (other than services covered by paragraph 33(1)(a)) to:</p>
                </content>
              </paragraph>
              <paragraph eId="chapter-3__part-3.1__dvs-2__sec-34__para-i">
                <num>i</num>
                <content>
                  <p>an Olympic team that participated in a Summer or Winter Olympic Games; or</p>
                </content>
              </paragraph>
              <paragraph eId="chapter-3__part-3.1__dvs-2__sec-34__para-ii">
                <num>ii</num>
                <content>
                  <p>the organising committee for a Summer or Winter Olympic Games; and</p>
                </content>
              </paragraph>
              <paragraph eId="chapter-3__part-3.1__dvs-2__sec-34__para-b">
                <num>b</num>
                <content>
                  <p>the Games have ended; and</p>
                </content>
              </paragraph>
              <paragraph eId="chapter-3__part-3.1__dvs-2__sec-34__para-c">
                <num>c</num>
                <content>
                  <p>the person makes, or authorises another person to make, a factual statement about that supply; and</p>
                </content>
              </paragraph>
              <paragraph eId="chapter-3__part-3.1__dvs-2__sec-34__para-d">
                <num>d</num>
                <content>
                  <p>the subject matter of the statement is limited to that supply; and</p>
                </content>
              </paragraph>
              <paragraph eId="chapter-3__part-3.1__dvs-2__sec-34__para-e">
                <num>e</num>
                <content>
                  <p>the statement identifies the Games in relation to which the supply was made; and</p>
                </content>
              </paragraph>
              <paragraph eId="chapter-3__part-3.1__dvs-2__sec-34__para-f">
                <num>f</num>
                <content>
                  <p>the statement includes a protected olympic expression; and</p>
                </content>
              </paragraph>
              <paragraph eId="chapter-3__part-3.1__dvs-2__sec-34__para-g">
                <num>g</num>
                <content>
                  <p>	(g)	the statement is applied to goods or services of the person (the <b><i>ordinary goods or services</i></b>) that are the same as, or similar to, the goods or services mentioned in paragraph (a); and</p>
                </content>
              </paragraph>
              <paragraph eId="chapter-3__part-3.1__dvs-2__sec-34__para-h">
                <num>h</num>
                <content>
                  <p>the application of the statement is for advertising or promotional purposes in relation to the ordinary goods or services, or is likely to enhance the demand for the ordinary goods or services;</p>

                  <p>the application of the statement is to be disregarded for the purposes of this Chapter.</p>
                </content>
              </paragraph>
            </section>
            <section eId="chapter-3__part-3.1__dvs-2__sec-35">
              <num>35</num>
              <heading>Certain uses not alone sufficient to suggest sponsorship or sponsorship-like support</heading>
              <subsection eId="chapter-3__part-3.1__dvs-2__sec-35__subsec-1">
                <num>1</num>
                <content>
                  <p>To avoid doubt, for the purposes of this Chapter, the use of a protected olympic expression for the purposes of, or in connection with, the provision of information or for the purposes of criticism or review is not alone sufficient to suggest a sponsorship, or the provision of sponsorship-like support, for the purposes of paragraph 30(2)(c) or (3)(c).</p>

              </subsection>
              <subsection eId="chapter-3__part-3.1__dvs-2__sec-35__subsec-2">

                  <p>In subsection (1):</p>
                </content>
                <paragraph eId="chapter-3__part-3.1__dvs-2__sec-35__subsec-2__para-a">
                  <num>a</num>
                  <content>
                    <p>a reference to the provision of information includes a reference to the reporting of news and the presentation of current affairs; and</p>
                  </content>
                </paragraph>
                <paragraph eId="chapter-3__part-3.1__dvs-2__sec-35__subsec-2__para-b">
                  <num>b</num>
                  <content>
                    <p>a reference to criticism or review includes a reference to criticism or review:</p>
                  </content>
                </paragraph>
                <paragraph eId="chapter-3__part-3.1__dvs-2__sec-35__subsec-2__para-i">
                  <num>i</num>
                  <content>
                    <p>in a newspaper, magazine or similar periodical; or</p>
                  </content>
                </paragraph>
                <paragraph eId="chapter-3__part-3.1__dvs-2__sec-35__subsec-2__para-ii">
                  <num>ii</num>
                  <content>
                    <p>in a broadcast; or</p>
                  </content>
                </paragraph>
                <paragraph eId="chapter-3__part-3.1__dvs-2__sec-35__subsec-2__para-iii">
                  <num>iii</num>
                  <content>
                    <p>on the internet; or</p>
                  </content>
                </paragraph>
                <paragraph eId="chapter-3__part-3.1__dvs-2__sec-35__subsec-2__para-iv">
                  <num>iv</num>
                  <content>
                    <p>in a video recording or a film.</p>
                  </content>
                </paragraph>
              </subsection>
            </section>
          </division>
        </part>
        <part eId="chapter-3__part-3.2">
          <num>3.2</num>
          <heading>Protection of protected olympic expressions</heading>
          <section eId="chapter-3__part-3.2__sec-36">
            <num>36</num>
            <heading>Regulation of use of protected olympic expressions</heading>
            <subsection eId="chapter-3__part-3.2__sec-36__subsec-1">
              <num>1</num>
              <content>
                <p>A person, other than the AOC, must not use a protected olympic expression for commercial purposes.</p>
              </content>
            </subsection>
            <subsection eId="chapter-3__part-3.2__sec-36__subsec-2">
              <num>2</num>
              <content>
                <p>Subsection (1) does not apply to the use by a person of a protected olympic expression if:</p>
              </content>
              <paragraph eId="chapter-3__part-3.2__sec-36__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>the person is a licensed user; and</p>
                </content>
              </paragraph>
              <paragraph eId="chapter-3__part-3.2__sec-36__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>the protected olympic expression is an expression that the person is licensed to use; and</p>
                </content>
              </paragraph>
              <paragraph eId="chapter-3__part-3.2__sec-36__subsec-2__para-c">
                <num>c</num>
                <content>
                  <p>that use is in accordance with the terms and conditions of the licence.</p>
                </content>
              </paragraph>
            </subsection>
          </section>
          <section eId="chapter-3__part-3.2__sec-37">
            <num>37</num>
            <heading>Persons involved in contraventions of section 36</heading>
            <content>
              <p>For the purposes of this Chapter, a person is taken to have contravened <ref href="#sec-36">section 36</ref> if the person:</p>
            </content>
            <paragraph eId="chapter-3__part-3.2__sec-37__para-a">
              <num>a</num>
              <content>
                <p>has attempted to contravene <ref href="#sec-36">section 36</ref>; or</p>
              </content>
            </paragraph>
            <paragraph eId="chapter-3__part-3.2__sec-37__para-b">
              <num>b</num>
              <content>
                <p>has aided, abetted, counselled or procured a person to contravene <ref href="#sec-36">section 36</ref>; or</p>
              </content>
            </paragraph>
            <paragraph eId="chapter-3__part-3.2__sec-37__para-c">
              <num>c</num>
              <content>
                <p>has induced, or attempted to induce, a person, whether by threats or promises or otherwise, to contravene <ref href="#sec-36">section 36</ref>; or</p>
              </content>
            </paragraph>
            <paragraph eId="chapter-3__part-3.2__sec-37__para-d">
              <num>d</num>
              <content>
                <p>has been in any way, directly or indirectly, knowingly concerned in, or party to, the contravention by a person of <ref href="#sec-36">section 36</ref>; or</p>
              </content>
            </paragraph>
            <paragraph eId="chapter-3__part-3.2__sec-37__para-e">
              <num>e</num>
              <content>
                <p>has conspired with others to contravene <ref href="#sec-36">section 36</ref>.</p>
              </content>
            </paragraph>
          </section>
        </part>
        <part eId="chapter-3__part-3.3">
          <num>3.3</num>
          <heading>Licensing</heading>
          <section eId="chapter-3__part-3.3__sec-38">
            <num>38</num>
            <heading>Licensing by the AOC</heading>
            <subsection eId="chapter-3__part-3.3__sec-38__subsec-1">
              <num>1</num>
              <content>
                <p>For the purposes of this Chapter, the AOC may license a person to use all, or any one or more, of the protected olympic expressions mentioned in subsection 24(1) for commercial purposes:</p>
              </content>
              <paragraph eId="chapter-3__part-3.3__sec-38__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>in all circumstances or in specified circumstances; or</p>
                </content>
              </paragraph>
              <paragraph eId="chapter-3__part-3.3__sec-38__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>during a specified period or without any limitation as to time.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="chapter-3__part-3.3__sec-38__subsec-2">
              <num>2</num>
              <content>
                <p>This section is not intended to affect the capacity of the AOC to determine the terms and conditions on which a person is licensed, including terms and conditions relating to the payment of money.</p>
              </content>
            </subsection>
          </section>
          <section eId="chapter-3__part-3.3__sec-39">
            <num>39</num>
            <heading>Limitation on licence</heading>
            <content>
              <p>A licence does not authorise the use of a protected olympic expression for commercial purposes if the use is covered by subsection 30(3).</p>
            </content>
          </section>
          <section eId="chapter-3__part-3.3__sec-40">
            <num>40</num>
            <heading>AOC to maintain Register of licences</heading>
            <subsection eId="chapter-3__part-3.3__sec-40__subsec-1">
              <num>1</num>
              <content>
                <p>The AOC is to maintain a Register in which the AOC includes prescribed particulars of licences.</p>
              </content>
            </subsection>
            <subsection eId="chapter-3__part-3.3__sec-40__subsec-2">
              <num>2</num>
              <content>
                <p>The Register may be maintained by electronic means.</p>
              </content>
            </subsection>
            <subsection eId="chapter-3__part-3.3__sec-40__subsec-3">
              <num>3</num>
              <content>
                <p>The Register is to be made available for inspection on the internet.</p>
              </content>
            </subsection>
          </section>
        </part>

          <num>3.4</num>
          <heading>Enforcement</heading>

                  <p>If a person has engaged, is engaging, or is proposing to engage, in conduct in contravention of <ref href="#sec-36">section 36</ref>, a prescribed court may grant an injunction:</p>
                </content>
                <paragraph eId="chapter-3__part-3.4__dvs-1__sec-41__subsec-1__para-a">
                  <num>a</num>
                  <content>
                    <p>restraining the person from engaging in the conduct; and</p>
                  </content>
                </paragraph>
                <paragraph eId="chapter-3__part-3.4__dvs-1__sec-41__subsec-1__para-b">
                  <num>b</num>
                  <content>
                    <p>if, in the court’s opinion, it is desirable to do so—requiring the person to do something.</p>
                  </content>
                </paragraph>
              </subsection>
              <subsection eId="chapter-3__part-3.4__dvs-1__sec-41__subsec-2">
                <num>2</num>
                <content>
                  <p>The power of the court to grant an injunction may be exercised:</p>
                </content>
                <paragraph eId="chapter-3__part-3.4__dvs-1__sec-41__subsec-2__para-a">
                  <num>a</num>
                  <content>
                    <p>whether or not it appears to the court that the person intends to engage again, or to continue to engage, in conduct of that kind; and</p>
                  </content>
                </paragraph>
                <paragraph eId="chapter-3__part-3.4__dvs-1__sec-41__subsec-2__para-b">
                  <num>b</num>
                  <content>
                    <p>whether or not the person has previously engaged in conduct of that kind.</p>
                  </content>
                </paragraph>
              </subsection>
              <subsection eId="chapter-3__part-3.4__dvs-1__sec-41__subsec-3">
                <num>3</num>
                <content>
                  <p>An injunction under this section may only be granted on the application of the AOC or a licensed user.</p>
                </content>
              </subsection>
              <subsection eId="chapter-3__part-3.4__dvs-1__sec-41__subsec-4">
                <num>4</num>
                <content>
                  <p>An injunction granted under this section on the application of a person who is a licensed user may only relate to:</p>
                </content>
                <paragraph eId="chapter-3__part-3.4__dvs-1__sec-41__subsec-4__para-a">
                  <num>a</num>
                  <content>
                    <p>a protected olympic expression to which the person’s licence relates; or</p>
                  </content>
                </paragraph>
                <paragraph eId="chapter-3__part-3.4__dvs-1__sec-41__subsec-4__para-b">
                  <num>b</num>
                  <content>
                    <p>an expression so closely resembling the protected olympic expression to which the person’s licence relates as is likely to be mistaken, by a reasonable person, for that expression.</p>
                  </content>
                </paragraph>
              </subsection>
              <subsection eId="chapter-3__part-3.4__dvs-1__sec-41__subsec-5">
                <num>5</num>
                <content>
                  <p>The court may discharge or vary an injunction granted under this section.</p>
                </content>
              </subsection>
              <subsection eId="chapter-3__part-3.4__dvs-1__sec-41__subsec-6">
                <num>6</num>
                <content>
                  <p>The powers conferred on the court by this section are in addition to, and not instead of, any other powers of the court, whether conferred by this Chapter or otherwise.</p>
                </content>
              </subsection>
            </section>
            <section eId="chapter-3__part-3.4__dvs-1__sec-42">
              <num>42</num>
              <heading>Interim injunctions</heading>
              <subsection eId="chapter-3__part-3.4__dvs-1__sec-42__subsec-1">

                  <p>A prescribed court may grant an interim injunction pending the determination of an application under <ref href="#sec-41">section 41</ref>.</p>
                </content>
              </subsection>
              <subsection eId="chapter-3__part-3.4__dvs-1__sec-42__subsec-2">
                <num>2</num>
                <content>
                  <p>For the purposes of subsection (1) of this section, a contravention of <ref href="#sec-36">section 36</ref> is taken to have caused immediate and irreparable damage to the applicant.</p>
                </content>
              </subsection>
            </section>
            <section eId="chapter-3__part-3.4__dvs-1__sec-43">
              <num>43</num>
              <heading>Corrective advertisements</heading>
              <subsection eId="chapter-3__part-3.4__dvs-1__sec-43__subsec-1">
                <num>1</num>
                <content>
                  <p>If, on the application of the AOC, a prescribed court is satisfied that a person has engaged in conduct constituting a contravention of <ref href="#sec-36">section 36</ref>, the court may make an order requiring the person:</p>
                </content>
                <paragraph eId="chapter-3__part-3.4__dvs-1__sec-43__subsec-1__para-a">
                  <num>a</num>
                  <content>
                    <p>by such means (including a broadcast or internet publication) as the court thinks fit; and</p>
                  </content>
                </paragraph>
                <paragraph eId="chapter-3__part-3.4__dvs-1__sec-43__subsec-1__para-b">
                  <num>b</num>
                  <content>
                    <p>at the person’s own expense; and</p>
                  </content>
                </paragraph>
                <paragraph eId="chapter-3__part-3.4__dvs-1__sec-43__subsec-1__para-c">
                  <num>c</num>
                  <content>
                    <p>at times specified in the order;</p>
                  </content>
                  <content>
                    <p>to publish advertisements the terms of which are specified in, or are to be determined in accordance with, the order.</p>
                  </content>
                </paragraph>
              </subsection>
              <subsection eId="chapter-3__part-3.4__dvs-1__sec-43__subsec-2">
                <num>2</num>
                <content>
                  <p>Subsection (1) does not limit <ref href="#sec-41">section 41</ref>.</p>
                </content>
              </subsection>
              <subsection eId="chapter-3__part-3.4__dvs-1__sec-43__subsec-3">
                <num>3</num>
                <content>
                  <p>A court may make an order under subsection (1) whether or not relief is granted under <ref href="#sec-41">section 41</ref>.</p>
                </content>
              </subsection>
            </section>
            <section eId="chapter-3__part-3.4__dvs-1__sec-44">

              <heading>Damages</heading>
              <subsection eId="chapter-3__part-3.4__dvs-1__sec-44__subsec-1">
                <num>1</num>

                  <p>If the AOC or a licensed user suffers loss or damage as a result of anything done by a person in contravention of <ref href="#sec-36">section 36</ref>, the amount of the loss or damage may be recovered by action in a prescribed court.</p>
                </content>
              </subsection>
              <subsection eId="chapter-3__part-3.4__dvs-1__sec-44__subsec-2">
                <num>2</num>
                <content>
                  <p>The action must be brought within 3 years after the day on which the contravention occurred.</p>
                </content>
              </subsection>
              <subsection eId="chapter-3__part-3.4__dvs-1__sec-44__subsec-3">
                <num>3</num>
                <content>
                  <p>The grant of an injunction under <ref href="#sec-41">section 41</ref> does not prevent the recovery of loss or damages under this section.</p>
                </content>
              </subsection>
              <subsection eId="chapter-3__part-3.4__dvs-1__sec-44__subsec-4">
                <num>4</num>
                <content>
                  <p>The AOC or a licensed user is not entitled to both:</p>
                </content>
                <paragraph eId="chapter-3__part-3.4__dvs-1__sec-44__subsec-4__para-a">
                  <num>a</num>
                  <content>
                    <p>the recovery of loss or damages under this section; and</p>
                  </content>
                </paragraph>
                <paragraph eId="chapter-3__part-3.4__dvs-1__sec-44__subsec-4__para-b">
                  <num>b</num>
                  <content>
                    <p>an account of profits under <ref href="#sec-45">section 45</ref>;</p>
                  </content>
                  <content>
                    <p>in respect of the same contravention of <ref href="#sec-36">section 36</ref>.</p>
                  </content>
                </paragraph>
              </subsection>
            </section>
            <section eId="chapter-3__part-3.4__dvs-1__sec-45">
              <num>45</num>
              <heading>Account of profits</heading>
              <subsection eId="chapter-3__part-3.4__dvs-1__sec-45__subsec-1">
                <num>1</num>

                  <p>If, on the application of the AOC or a licensed user, a prescribed court is satisfied that a person has engaged in conduct in contravention of <ref href="#sec-36">section 36</ref>, the court may make an order granting relief by way of an account of profits.</p>
                </content>
              </subsection>
              <subsection eId="chapter-3__part-3.4__dvs-1__sec-45__subsec-2">
                <num>2</num>
                <content>
                  <p>The application must be made within 3 years after the day on which the contravention occurred.</p>
                </content>
              </subsection>
              <subsection eId="chapter-3__part-3.4__dvs-1__sec-45__subsec-3">
                <num>3</num>
                <content>
                  <p>An order made under this section on the application of a person who is a licensed user may only relate to:</p>
                </content>
                <paragraph eId="chapter-3__part-3.4__dvs-1__sec-45__subsec-3__para-a">
                  <num>a</num>
                  <content>
                    <p>a protected olympic expression to which the person’s licence relates; or</p>
                  </content>
                </paragraph>
                <paragraph eId="chapter-3__part-3.4__dvs-1__sec-45__subsec-3__para-b">
                  <num>b</num>
                  <content>
                    <p>an expression so closely resembling the protected olympic expression to which the person’s licence relates as is likely to be mistaken, by a reasonable person, for that expression.</p>
                  </content>
                </paragraph>
              </subsection>
              <subsection eId="chapter-3__part-3.4__dvs-1__sec-45__subsec-4">
                <num>4</num>
                <content>
                  <p>A court may make an order under this section whether or not an injunction is granted under <ref href="#sec-41">section 41</ref>.</p>
                </content>
              </subsection>
              <subsection eId="chapter-3__part-3.4__dvs-1__sec-45__subsec-5">
                <num>5</num>
                <content>
                  <p>The AOC or a licensed user is not entitled to both:</p>
                </content>
                <paragraph eId="chapter-3__part-3.4__dvs-1__sec-45__subsec-5__para-a">
                  <num>a</num>
                  <content>
                    <p>an account of profits under this section; and</p>
                  </content>
                </paragraph>
                <paragraph eId="chapter-3__part-3.4__dvs-1__sec-45__subsec-5__para-b">
                  <num>b</num>
                  <content>
                    <p>the recovery of loss or damages under <ref href="#sec-44">section 44</ref>;</p>
                  </content>
                  <content>
                    <p>in respect of the same contravention of <ref href="#sec-36">section 36</ref>.</p>
                  </content>
                </paragraph>

            </section>

              <heading>Destruction or delivery of goods</heading>
              <subsection eId="chapter-3__part-3.4__dvs-1__sec-46__subsec-1">
                <num>1</num>
                <content>
                  <p>If, on the application of the AOC or a licensed user, a prescribed court is satisfied that a person has engaged in conduct constituting a contravention of <ref href="#sec-36">section 36</ref> in relation to goods, the court may order that the goods be:</p>
                </content>
                <paragraph eId="chapter-3__part-3.4__dvs-1__sec-46__subsec-1__para-a">
                  <num>a</num>
                  <content>
                    <p>destroyed; or</p>
                  </content>
                </paragraph>
                <paragraph eId="chapter-3__part-3.4__dvs-1__sec-46__subsec-1__para-b">

                  <p>An order made under this section on the application of a person who is a licensed user may only relate to:</p>
                </content>

                  <content>
                    <p>a protected olympic expression to which the person’s licence relates; or</p>
                  </content>
                </paragraph>
                <paragraph eId="chapter-3__part-3.4__dvs-1__sec-46__subsec-2__para-b">
                  <num>b</num>
                  <content>
                    <p>an expression so closely resembling the protected olympic expression to which the person’s licence relates as is likely to be mistaken, by a reasonable person, for that expression.</p>
                  </content>
                </paragraph>
              </subsection>
              <subsection eId="chapter-3__part-3.4__dvs-1__sec-46__subsec-3">
                <num>3</num>
                <content>
                  <p>A court may make an order under this section whether or not an injunction is granted under <ref href="#sec-41">section 41</ref>.</p>
                </content>
              </subsection>
            </section>
            <section eId="chapter-3__part-3.4__dvs-1__sec-47">
              <num>47</num>
              <heading>Consent of the AOC to institute remedial proceedings</heading>
              <subsection eId="chapter-3__part-3.4__dvs-1__sec-47__subsec-1">
                <num>1</num>
                <content>
                  <p>A licensed user must not:</p>
                </content>
                <paragraph eId="chapter-3__part-3.4__dvs-1__sec-47__subsec-1__para-a">
                  <num>a</num>
                  <content>
                    <p>make an application for an injunction (other than an interim injunction) under <ref href="#sec-41">section 41</ref>; or</p>
                  </content>
                </paragraph>
                <paragraph eId="chapter-3__part-3.4__dvs-1__sec-47__subsec-1__para-b">
                  <num>b</num>
                  <content>
                    <p>bring an action for damages under <ref href="#sec-44">section 44</ref>; or</p>
                  </content>
                </paragraph>
                <paragraph eId="chapter-3__part-3.4__dvs-1__sec-47__subsec-1__para-c">
                  <num>c</num>
                  <content>
                    <p>make an application for an order under <ref href="#sec-45">section 45</ref>; or</p>
                  </content>
                </paragraph>
                <paragraph eId="chapter-3__part-3.4__dvs-1__sec-47__subsec-1__para-d">
                  <num>d</num>
                  <content>
                    <p>make an application for an order under <ref href="#sec-46">section 46</ref>;</p>
                  </content>
                  <content>
                    <p>except with the written consent of the AOC.</p>
                  </content>
                </paragraph>
              </subsection>
              <subsection eId="chapter-3__part-3.4__dvs-1__sec-47__subsec-2">
                <num>2</num>
                <content>
                  <p>If:</p>
                </content>
                <paragraph eId="chapter-3__part-3.4__dvs-1__sec-47__subsec-2__para-a">
                  <num>a</num>
                  <content>
                    <p>a licensed user gives the AOC a written request for consent under subsection (1); and</p>
                  </content>
                </paragraph>
                <paragraph eId="chapter-3__part-3.4__dvs-1__sec-47__subsec-2__para-b">
                  <num>b</num>
                  <content>
                    <p>the AOC neither gives nor refuses that consent before the end of the period of 8 days beginning on the day on which the request was given;</p>
                  </content>
                  <content>
                    <p>the AOC is taken to have given the consent.</p>
                  </content>
                </paragraph>
              </subsection>
              <subsection eId="chapter-3__part-3.4__dvs-1__sec-47__subsec-3">
                <num>3</num>
                <content>
                  <p>Consent under subsection (1) must not be unreasonably refused.</p>
                </content>
              </subsection>
            </section>
            <section eId="chapter-3__part-3.4__dvs-1__sec-48">
              <num>48</num>
              <heading>Other remedies</heading>
              <subsection eId="chapter-3__part-3.4__dvs-1__sec-48__subsec-1">
                <num>1</num>
                <content>
                  <p>The remedies provided under this Division are in addition to remedies provided by any law (whether a law of the Commonwealth or a law of a State or Territory) that confers any rights or powers on the AOC or a licensed user in relation to conduct of a kind that constitutes a contravention of <ref href="#sec-36">section 36</ref>.</p>
                </content>
              </subsection>
              <subsection eId="chapter-3__part-3.4__dvs-1__sec-48__subsec-2">
                <num>2</num>
                <content>
                  <p>The remedies provided under this Division are in addition to the remedies provided by the Australian Consumer Law in relation to engaging in conduct that is misleading or deceptive (see <ref href="#sec-18">section 18</ref> of the Australian Consumer Law) and, in particular, in relation to representations:</p>
                </content>
                <paragraph eId="chapter-3__part-3.4__dvs-1__sec-48__subsec-2__para-a">
                  <num>a</num>
                  <content>
                    <p>that goods or services have sponsorship or approval that they do not have (see paragraph 29(1)(g) of the Australian Consumer Law); or</p>
                  </content>
                </paragraph>
                <paragraph eId="chapter-3__part-3.4__dvs-1__sec-48__subsec-2__para-b">
                  <num>b</num>
                  <content>
                    <p>that a corporation (as defined in that Act) has a sponsorship, approval or affiliation that it does not have (see paragraph 29(1)(h) of the Australian Consumer Law).</p>
                  </content>
                </paragraph>
              </subsection>
              <subsection eId="chapter-3__part-3.4__dvs-1__sec-48__subsec-3">
                <num>3</num>
                <content>
                  <p>Subsection (2) does not limit subsection (1).</p>
                </content>
              </subsection>
              <subsection eId="chapter-3__part-3.4__dvs-1__sec-48__subsec-4">

                  <p>The references in subsection (2) to particular provisions of the Australian Consumer Law do not imply that other provisions of the Australian Consumer Law do not apply in relation to conduct of a kind that constitutes a contravention of <ref href="#sec-36">section 36</ref> of this Act.</p>

          </division>
          <division eId="chapter-3__part-3.4__dvs-2">
            <num>2</num>
            <heading>Importation of goods</heading>
            <section eId="chapter-3__part-3.4__dvs-2__sec-49">
              <num>49</num>
              <heading>Definitions</heading>
              <content>
                <p>In this Division, unless the contrary intention appears:</p>
                <p><b><i>application period</i></b>, in relation to seized goods, means:</p>
              </content>
              <paragraph eId="chapter-3__part-3.4__dvs-2__sec-49__para-a">
                <num>a</num>
                <content>
                  <p>if there is only one objector to the importation of the goods—the period specified in the notice given to the objector under <ref href="#sec-55">section 55</ref> or, if that period is extended under subsection 55(5), that period as so extended; or</p>
                </content>
              </paragraph>
              <paragraph eId="chapter-3__part-3.4__dvs-2__sec-49__para-b">
                <num>b</num>
                <content>
                  <p>if there is more than one objector to the importation of the goods—the period beginning on the earliest day on which a period specified in a notice given to an objector under <ref href="#sec-55">section 55</ref> commences and ending:</p>
                </content>
              </paragraph>
              <paragraph eId="chapter-3__part-3.4__dvs-2__sec-49__para-i">
                <num>i</num>
                <content>
                  <p>on the last day on which a period specified in such a notice ends; or</p>
                </content>
              </paragraph>
              <paragraph eId="chapter-3__part-3.4__dvs-2__sec-49__para-ii">
                <num>ii</num>
                <content>
                  <p>on the last day on which such a period as extended under subsection 55(5) ends;</p>
                </content>
                <content>
                  <p>whichever is the later.</p>
                  <p><term refersTo="#term-comptroller-general-of-customs">Comptroller-General of Customs</term> means <def>the person who is the Comptroller-General of Customs in accordance with subsection 11(3) or 14(2) of <ref href="">the Australian Border Force Act 2015</ref>.</def></p>
                  <p><term refersTo="#term-objector">objector</term> means <def>the person by whom a notice in force under <ref href="#sec-52">section 52</ref> in relation to the goods was given.</def></p>
                  <p><term refersTo="#term-officer-of-customs">officer of Customs</term> has the meaning given by <def>subsection 4(1) of <ref href="">the Customs Act 1901</ref>.</def></p>
                  <p><term refersTo="#term-seized-goods">seized goods</term> means <def>goods seized under <ref href="#sec-54">section 54</ref>.</def></p>
                  <p><term refersTo="#term-working-day">working day</term> means <def>a day that is not: a Saturday; or a Sunday; or a public holiday in the Australian Capital Territory.</def></p>
                </content>
              </paragraph>
              <paragraph eId="chapter-3__part-3.4__dvs-2__sec-49__para-a">
                <num>a</num>
                <content>
                  <p>a Saturday; or</p>
                </content>
              </paragraph>
              <paragraph eId="chapter-3__part-3.4__dvs-2__sec-49__para-b">

                  <p>a Sunday; or</p>
                </content>
              </paragraph>
              <paragraph eId="chapter-3__part-3.4__dvs-2__sec-49__para-c">

            </section>
            <section eId="chapter-3__part-3.4__dvs-2__sec-50">
              <num>50</num>
              <heading>Determinations about owners of goods</heading>
              <content>
                <p>		An officer of Customs may determine that a person is the owner of goods for the purposes of paragraph (b) of the definition of <b><i>designated owner</i></b> in section 23 if the person is an owner (within the meaning of subsection 4(1) of the <i>Customs Act 1901</i>) of the goods.</p>
              </content>
            </section>
            <section eId="chapter-3__part-3.4__dvs-2__sec-51">
              <num>51</num>
              <heading>Importation of goods by the AOC</heading>
              <content>
                <p>The AOC may import goods to which a protected olympic expression has been applied, so long as the importation does not contravene a law of the Commonwealth other than this Chapter.</p>
              </content>
            </section>
            <section eId="chapter-3__part-3.4__dvs-2__sec-52">
              <num>52</num>
              <heading>Notice of objection to importation</heading>
              <subsection eId="chapter-3__part-3.4__dvs-2__sec-52__subsec-1">
                <num>1</num>
                <content>
                  <p>Subject to this section, the AOC or a licensed user may give the Comptroller-General of Customs a written notice objecting to the importation, after the day on which the notice is given, of goods that have applied to them a protected olympic expression that the designated owner of the goods is not authorised by, or licensed under, this Chapter to use for commercial purposes in relation to the goods.</p>
                </content>
              </subsection>
              <subsection eId="chapter-3__part-3.4__dvs-2__sec-52__subsec-2">
                <num>2</num>
                <content>
                  <p>A notice:</p>
                </content>
                <paragraph eId="chapter-3__part-3.4__dvs-2__sec-52__subsec-2__para-a">
                  <num>a</num>
                  <content>
                    <p>is to be given together with any prescribed document; and</p>
                  </content>
                </paragraph>
                <paragraph eId="chapter-3__part-3.4__dvs-2__sec-52__subsec-2__para-b">
                  <num>b</num>
                  <content>
                    <p>is to be accompanied by the prescribed fee (if any).</p>
                  </content>
                </paragraph>
              </subsection>
              <subsection eId="chapter-3__part-3.4__dvs-2__sec-52__subsec-3">
                <num>3</num>
                <content>
                  <p>A licensed user may only give a notice in relation to a protected olympic expression that the person is licensed to use.</p>
                </content>
              </subsection>
              <subsection eId="chapter-3__part-3.4__dvs-2__sec-52__subsec-4">
                <num>4</num>
                <content>
                  <p>A notice given by the AOC or a licensed user may be revoked at any time by written notice given to the Comptroller-General of Customs by the person who gave the original notice.</p>
                </content>
              </subsection>
              <subsection eId="chapter-3__part-3.4__dvs-2__sec-52__subsec-5">
                <num>5</num>
                <content>
                  <p>Unless sooner revoked, a notice ceases to have effect at the end of the prescribed period. This subsection has effect subject to subsection (6).</p>
                </content>
              </subsection>
              <subsection eId="chapter-3__part-3.4__dvs-2__sec-52__subsec-6">
                <num>6</num>
                <content>
                  <p>If:</p>
                </content>
                <paragraph eId="chapter-3__part-3.4__dvs-2__sec-52__subsec-6__para-a">
                  <num>a</num>
                  <content>
                    <p>a notice given by a licensed user is not revoked under subsection (4); and</p>
                  </content>
                </paragraph>
                <paragraph eId="chapter-3__part-3.4__dvs-2__sec-52__subsec-6__para-b">
                  <num>b</num>
                  <content>
                    <p>the licence expires or is revoked;</p>
                  </content>
                  <content>
                    <p>the notice ceases to have effect on the day on which the licence ceases to be in force.</p>
                  </content>
                </paragraph>
              </subsection>
              <subsection eId="chapter-3__part-3.4__dvs-2__sec-52__subsec-7">
                <num>7</num>
                <content>
                  <p>A reference in this section to the use of protected olympic expressions for commercial purposes does not include a reference to use covered by subsection 30(3).</p>
                </content>
              </subsection>
            </section>
            <section eId="chapter-3__part-3.4__dvs-2__sec-53">
              <num>53</num>
              <heading>Consent of the AOC to giving of notices</heading>
              <subsection eId="chapter-3__part-3.4__dvs-2__sec-53__subsec-1">
                <num>1</num>
                <content>
                  <p>A licensed user must not give a notice of objection to importation under <ref href="#sec-52">section 52</ref> except with the written consent of the AOC.</p>
                </content>
              </subsection>
              <subsection eId="chapter-3__part-3.4__dvs-2__sec-53__subsec-2">
                <num>2</num>
                <content>
                  <p>If:</p>
                </content>
                <paragraph eId="chapter-3__part-3.4__dvs-2__sec-53__subsec-2__para-a">
                  <num>a</num>
                  <content>
                    <p>a licensed user gives the AOC a written request for consent under subsection (1); and</p>
                  </content>
                </paragraph>
                <paragraph eId="chapter-3__part-3.4__dvs-2__sec-53__subsec-2__para-b">
                  <num>b</num>
                  <content>
                    <p>the AOC neither gives nor refuses that consent before the end of the period of 8 days beginning on the day on which the request was given;</p>
                  </content>
                  <content>
                    <p>the AOC is taken to have given the consent.</p>
                  </content>
                </paragraph>
              </subsection>
              <subsection eId="chapter-3__part-3.4__dvs-2__sec-53__subsec-3">
                <num>3</num>
                <content>
                  <p>Consent under subsection (1) must not be unreasonably refused.</p>
                </content>
              </subsection>
            </section>
            <section eId="chapter-3__part-3.4__dvs-2__sec-54">
              <num>54</num>
              <heading>Comptroller-General of Customs may seize goods</heading>
              <subsection eId="chapter-3__part-3.4__dvs-2__sec-54__subsec-1">
                <num>1</num>
                <content>
                  <p>This section applies to goods manufactured outside Australia that:</p>
                </content>
                <paragraph eId="chapter-3__part-3.4__dvs-2__sec-54__subsec-1__para-a">
                  <num>a</num>
                  <content>
                    <p>are imported into Australia; and</p>
                  </content>
                </paragraph>
                <paragraph eId="chapter-3__part-3.4__dvs-2__sec-54__subsec-1__para-b">
                  <num>b</num>
                  <content>
                    <p>	(b)	are subject to customs control under the <i>Customs Act 1901</i>.</p>
                  </content>
                </paragraph>
              </subsection>
              <subsection eId="chapter-3__part-3.4__dvs-2__sec-54__subsec-2">
                <num>2</num>
                <content>
                  <p>If:</p>
                </content>
                <paragraph eId="chapter-3__part-3.4__dvs-2__sec-54__subsec-2__para-a">
                  <num>a</num>
                  <content>
                    <p>goods have had applied to them one or more protected olympic expressions; and</p>
                  </content>
                </paragraph>
                <paragraph eId="chapter-3__part-3.4__dvs-2__sec-54__subsec-2__para-b">
                  <num>b</num>
                  <content>
                    <p>a notice in force under <ref href="#sec-52">section 52</ref> relates to the goods; and</p>
                  </content>
                </paragraph>
                <paragraph eId="chapter-3__part-3.4__dvs-2__sec-54__subsec-2__para-c">
                  <num>c</num>
                  <content>
                    <p>it appears to the Comptroller-General of Customs that the designated owner is not authorised by, or licensed under, this Chapter, to use the expressions for commercial purposes in relation to the goods;</p>
                  </content>
                  <content>
                    <p>the Comptroller-General of Customs must seize the goods unless the Comptroller-General of Customs has no reasonable grounds for believing that <ref href="#sec-36">section 36</ref> would be contravened by the use of the expressions by the designated owner for commercial purposes.</p>
                  </content>
                </paragraph>
              </subsection>
              <subsection eId="chapter-3__part-3.4__dvs-2__sec-54__subsec-3">
                <num>3</num>
                <content>
                  <p>The Comptroller-General of Customs may refuse to seize the goods unless the Comptroller-General of Customs has been given by the objector, or by one or more of the objectors, security in an amount that the Comptroller-General of Customs considers sufficient to reimburse the Commonwealth for the reasonable expenses that may be incurred by the Commonwealth if the goods were seized.</p>
                </content>
              </subsection>
              <subsection eId="chapter-3__part-3.4__dvs-2__sec-54__subsec-4">
                <num>4</num>
                <content>
                  <p>Goods seized under this section must be kept in a secure place as directed by the Comptroller-General of Customs.</p>
                </content>
              </subsection>
              <subsection eId="chapter-3__part-3.4__dvs-2__sec-54__subsec-5">
                <num>5</num>
                <content>
                  <p>A reference in this section to the use of protected olympic expressions for commercial purposes does not include a reference to use covered by subsection 30(3).</p>
                </content>
              </subsection>
            </section>
            <section eId="chapter-3__part-3.4__dvs-2__sec-55">
              <num>55</num>
              <heading>Notice of seizure</heading>
              <subsection eId="chapter-3__part-3.4__dvs-2__sec-55__subsec-1">
                <num>1</num>
                <content>
                  <p>As soon as practicable after goods are seized under <ref href="#sec-54">section 54</ref>, the Comptroller-General of Customs must give the designated owner and each objector, by any means of communication (including by electronic means), a notice identifying the goods and stating that they have been seized under <ref href="#sec-54">section 54</ref>.</p>
                </content>
              </subsection>
              <subsection eId="chapter-3__part-3.4__dvs-2__sec-55__subsec-2">
                <num>2</num>
                <content>
                  <p>A notice under subsection (1) that is given to each objector must also:</p>
                </content>
                <paragraph eId="chapter-3__part-3.4__dvs-2__sec-55__subsec-2__para-a">
                  <num>a</num>
                  <content>
                    <p>state the name and the address of the place of business or residence of the designated owner (if known), unless the Comptroller-General of Customs is satisfied, for reasons of confidentiality, that it is not desirable to do so; and</p>
                  </content>
                </paragraph>
                <paragraph eId="chapter-3__part-3.4__dvs-2__sec-55__subsec-2__para-b">
                  <num>b</num>
                  <content>
                    <p>state that the goods will be released to the designated owner unless:</p>
                  </content>
                </paragraph>
                <paragraph eId="chapter-3__part-3.4__dvs-2__sec-55__subsec-2__para-i">
                  <num>i</num>
                  <content>
                    <p>an application for an injunction under <ref href="#sec-41">section 41</ref> in relation to the goods is made by the objector, or by one of the objectors, within the period of 10 working days beginning on a specified day; and</p>
                  </content>
                </paragraph>
                <paragraph eId="chapter-3__part-3.4__dvs-2__sec-55__subsec-2__para-ii">
                  <num>ii</num>
                  <content>
                    <p>written notice of the making of the application is given to the Comptroller-General of Customs within that period.</p>
                  </content>
                </paragraph>
              </subsection>
              <subsection eId="chapter-3__part-3.4__dvs-2__sec-55__subsec-3">
                <num>3</num>
                <content>
                  <p>The day specified for the purpose of subparagraph (2)(b)(i) must not be earlier than the day on which the notice is given.</p>
                </content>
              </subsection>
              <subsection eId="chapter-3__part-3.4__dvs-2__sec-55__subsec-4">
                <num>4</num>
                <content>
                  <p>An objector may, by written notice given to the Comptroller-General of Customs before the end of the period specified in a notice for the purposes of subparagraph (2)(b)(i), request that the period be extended.</p>
                </content>
              </subsection>
              <subsection eId="chapter-3__part-3.4__dvs-2__sec-55__subsec-5">
                <num>5</num>
                <content>
                  <p>If:</p>
                </content>
                <paragraph eId="chapter-3__part-3.4__dvs-2__sec-55__subsec-5__para-a">
                  <num>a</num>
                  <content>
                    <p>a request is made in accordance with subsection (4); and</p>
                  </content>
                </paragraph>
                <paragraph eId="chapter-3__part-3.4__dvs-2__sec-55__subsec-5__para-b">
                  <num>b</num>
                  <content>
                    <p>the Comptroller-General of Customs is satisfied that it is reasonable that the request be granted;</p>
                  </content>
                  <content>
                    <p>the Comptroller-General of Customs may extend the period by not more than 10 working days.</p>
                  </content>
                </paragraph>
              </subsection>
            </section>
            <section eId="chapter-3__part-3.4__dvs-2__sec-56">
              <num>56</num>
              <heading>Forfeiture of goods—by consent</heading>
              <subsection eId="chapter-3__part-3.4__dvs-2__sec-56__subsec-1">
                <num>1</num>
                <content>
                  <p>The designated owner of any seized goods may, at any time before an objector makes an application for an injunction under <ref href="#sec-41">section 41</ref> in relation to the goods, consent to the goods being forfeited to the Commonwealth by giving a written notice to that effect to the Comptroller-General of Customs.</p>
                </content>
              </subsection>
              <subsection eId="chapter-3__part-3.4__dvs-2__sec-56__subsec-2">
                <num>2</num>
                <content>
                  <p>If the designated owner gives such a notice, the goods are forfeited to the Commonwealth and must be disposed of as the Comptroller-General of Customs directs.</p>
                </content>
              </subsection>
            </section>
            <section eId="chapter-3__part-3.4__dvs-2__sec-57">
              <num>57</num>
              <heading>Release of goods—no application for injunction</heading>
              <subsection eId="chapter-3__part-3.4__dvs-2__sec-57__subsec-1">
                <num>1</num>
                <content>
                  <p>The Comptroller-General of Customs must release seized goods (other than goods forfeited to the Commonwealth under <ref href="#sec-56">section 56</ref>) to their designated owner at the end of the application period unless, within that period, the objector, or one of the objectors, has:</p>
                </content>
                <paragraph eId="chapter-3__part-3.4__dvs-2__sec-57__subsec-1__para-a">
                  <num>a</num>
                  <content>
                    <p>made an application for an injunction under <ref href="#sec-41">section 41</ref> in relation to the goods; and</p>
                  </content>
                </paragraph>
                <paragraph eId="chapter-3__part-3.4__dvs-2__sec-57__subsec-1__para-b">
                  <num>b</num>
                  <content>
                    <p>given to the Comptroller-General of Customs written notice of the application.</p>
                  </content>
                </paragraph>
              </subsection>
              <subsection eId="chapter-3__part-3.4__dvs-2__sec-57__subsec-2">
                <num>2</num>
                <content>
                  <p>The Comptroller-General of Customs must also release the seized goods to their designated owner if, before the end of the application period, the objector, or each of the objectors, has, by written notice given to the Comptroller-General of Customs, consented to the release of the goods.</p>
                </content>
              </subsection>
              <subsection eId="chapter-3__part-3.4__dvs-2__sec-57__subsec-3">
                <num>3</num>
                <content>
                  <p>The Comptroller-General of Customs may release the seized goods to their designated owner at any time before the end of the application period if:</p>
                </content>
                <paragraph eId="chapter-3__part-3.4__dvs-2__sec-57__subsec-3__para-a">
                  <num>a</num>
                  <content>
                    <p>the Comptroller-General of Customs, having regard to information that has come to his or her knowledge after the goods were seized, does not have reasonable grounds for believing that <ref href="#sec-36">section 36</ref> would be contravened by the importation of the goods; and</p>
                  </content>
                </paragraph>
                <paragraph eId="chapter-3__part-3.4__dvs-2__sec-57__subsec-3__para-b">

              <heading>Application for injunction—additional parties, relief etc.</heading>
              <subsection eId="chapter-3__part-3.4__dvs-2__sec-58__subsec-1">
                <num>1</num>
                <content>
                  <p>In this section, a reference to an application for an injunction under <ref href="#sec-41">section 41</ref> is a reference to such an application made, in relation to seized goods, by a person who is an objector in relation to the goods.</p>
                </content>
              </subsection>
              <subsection eId="chapter-3__part-3.4__dvs-2__sec-58__subsec-2">
                <num>2</num>
                <content>
                  <p>A prescribed court in which an application for an injunction under <ref href="#sec-41">section 41</ref> is pending:</p>
                </content>
                <paragraph eId="chapter-3__part-3.4__dvs-2__sec-58__subsec-2__para-a">
                  <num>a</num>
                  <content>
                    <p>may, on the application of a person having a sufficient interest in the subject matter of the application, allow the person to be joined as a respondent to the application; and</p>
                  </content>
                </paragraph>
                <paragraph eId="chapter-3__part-3.4__dvs-2__sec-58__subsec-2__para-b">
                  <num>b</num>
                  <content>
                    <p>must allow the Comptroller-General of Customs to appear and be heard.</p>
                  </content>
                </paragraph>
              </subsection>
              <subsection eId="chapter-3__part-3.4__dvs-2__sec-58__subsec-3">
                <num>3</num>
                <content>
                  <p>In addition to any relief that the court may grant apart from this section, the court may:</p>
                </content>
                <paragraph eId="chapter-3__part-3.4__dvs-2__sec-58__subsec-3__para-a">
                  <num>a</num>
                  <content>
                    <p>at any time, if it thinks it just, order that the seized goods be released to their designated owner subject to such conditions (if any) as the court thinks fit; or</p>
                  </content>
                </paragraph>
                <paragraph eId="chapter-3__part-3.4__dvs-2__sec-58__subsec-3__para-b">
                  <num>b</num>
                  <content>
                    <p>order that the seized goods be forfeited to the Commonwealth.</p>
                  </content>
                </paragraph>
              </subsection>
              <subsection eId="chapter-3__part-3.4__dvs-2__sec-58__subsec-4">
                <num>4</num>
                <content>
                  <p>If:</p>
                </content>
                <paragraph eId="chapter-3__part-3.4__dvs-2__sec-58__subsec-4__para-a">
                  <num>a</num>
                  <content>
                    <p>the court decides that an injunction should not be granted under <ref href="#sec-41">section 41</ref>; and</p>
                  </content>
                </paragraph>
                <paragraph eId="chapter-3__part-3.4__dvs-2__sec-58__subsec-4__para-b">
                  <num>b</num>
                  <content>
                    <p>the designated owner of the goods, or any other respondent, satisfies the court that he or she has suffered loss or damage because the goods were seized;</p>
                  </content>
                  <content>
                    <p>the court may order the objector to pay to the designated owner or other respondent compensation, in the amount determined by the court, for any part of that loss or damage that is attributable to any period beginning on or after the day on which the application under <ref href="#sec-41">section 41</ref> was made.</p>
                  </content>
                </paragraph>
              </subsection>
              <subsection eId="chapter-3__part-3.4__dvs-2__sec-58__subsec-5">
                <num>5</num>
                <content>
                  <p>If, at the end of 20 working days beginning on the day on which the application for an injunction under <ref href="#sec-41">section 41</ref> was made, there is not in force an order of the court directed at the Comptroller-General of Customs preventing the goods from being released, the Comptroller-General of Customs must release the goods to their designated owner.</p>
                </content>
              </subsection>
              <subsection eId="chapter-3__part-3.4__dvs-2__sec-58__subsec-6">
                <num>6</num>
                <content>
                  <p>If the court orders that the goods be released, the Comptroller-General of Customs must, subject to <ref href="#sec-60">section 60</ref>, comply with the order.</p>
                </content>
              </subsection>
            </section>
            <section eId="chapter-3__part-3.4__dvs-2__sec-59">
              <num>59</num>
              <heading>Disposal of goods ordered to be forfeited</heading>
              <content>
                <p>If the court orders under <ref href="#sec-58">section 58</ref> that goods be forfeited to the Commonwealth, the goods are to be disposed of as the Comptroller-General of Customs directs.</p>
              </content>
            </section>
            <section eId="chapter-3__part-3.4__dvs-2__sec-60">
              <num>60</num>
              <heading>Power of Comptroller-General of Customs to retain control of goods</heading>
              <content>
                <p>Despite anything in this Part, the Comptroller-General of Customs must not:</p>
              </content>
              <paragraph eId="chapter-3__part-3.4__dvs-2__sec-60__para-a">
                <num>a</num>
                <content>
                  <p>release, or dispose of, any seized goods; or</p>
                </content>
              </paragraph>
              <paragraph eId="chapter-3__part-3.4__dvs-2__sec-60__para-b">
                <num>b</num>
                <content>
                  <p>take any action in relation to the goods to give effect to any order of a court under <ref href="#sec-58">section 58</ref>;</p>
                </content>
                <content>
                  <p>if the Comptroller-General of Customs is required or allowed to retain control of the goods under any other law of the Commonwealth.</p>
                </content>
              </paragraph>
            </section>
            <section eId="chapter-3__part-3.4__dvs-2__sec-61">
              <num>61</num>
              <heading>Insufficient security</heading>
              <content>
                <p>If security given under subsection 54(3) by the objector or objectors who gave notice under <ref href="#sec-52">section 52</ref> is not sufficient to meet the expenses incurred by the Commonwealth as a result of the action taken by the Comptroller-General of Customs under this Division because of the notice, the amount of the difference between those expenses and the amount of security:</p>
              </content>
              <paragraph eId="chapter-3__part-3.4__dvs-2__sec-61__para-a">
                <num>a</num>
                <content>
                  <p>is a debt due by the objector, or by the objectors jointly and severally, to the Commonwealth; and</p>
                </content>
              </paragraph>
              <paragraph eId="chapter-3__part-3.4__dvs-2__sec-61__para-b">
                <num>b</num>
                <content>
                  <p>may be recovered by action in any court of competent jurisdiction.</p>
                </content>
              </paragraph>
            </section>
            <section eId="chapter-3__part-3.4__dvs-2__sec-62">
              <num>62</num>
              <heading>Commonwealth not liable for loss etc. suffered because of seizure</heading>
              <content>
                <p>The Commonwealth is not liable for any loss or damage suffered by a person:</p>
              </content>
              <paragraph eId="chapter-3__part-3.4__dvs-2__sec-62__para-a">
                <num>a</num>
                <content>
                  <p>because the Comptroller-General of Customs seized, or failed to seize, goods under this Division; or</p>
                </content>
              </paragraph>
              <paragraph eId="chapter-3__part-3.4__dvs-2__sec-62__para-b">
                <num>b</num>
                <content>
                  <p>because of the release of any seized goods.</p>
                </content>
              </paragraph>
            </section>
            <section eId="chapter-3__part-3.4__dvs-2__sec-63">
              <num>63</num>
              <heading>Modification in relation to Christmas Island etc.</heading>
              <content>
                <p>The regulations may provide for the modification or adaptation of this Division in its application to:</p>
              </content>
              <paragraph eId="chapter-3__part-3.4__dvs-2__sec-63__para-a">
                <num>a</num>
                <content>
                  <p>Christmas Island; or</p>
                </content>
              </paragraph>
              <paragraph eId="chapter-3__part-3.4__dvs-2__sec-63__para-b">
                <num>b</num>
                <content>
                  <p>Cocos (Keeling) Islands; or</p>
                </content>
              </paragraph>

            <heading>Unjustified threats</heading>
            <section eId="chapter-3__part-3.4__dvs-3__sec-64">
              <num>64</num>
              <heading>Unjustified threats of legal proceedings</heading>
              <subsection eId="chapter-3__part-3.4__dvs-3__sec-64__subsec-1">
                <num>1</num>
                <content>
                  <p>	(1)	If the AOC or a licensed user threatens to make an application, or bring an action, against a person (the <b><i>threatened person</i></b>) on the ground that the threatened person has engaged, is engaging, or is proposing to engage in conduct in contravention of section 36, any person aggrieved by the threat may bring an action in a prescribed court against the AOC or the licensed user, as the case may be.</p>
                </content>
              </subsection>
              <subsection eId="chapter-3__part-3.4__dvs-3__sec-64__subsec-2">
                <num>2</num>
                <content>
                  <p>In an action under subsection (1), the court may:</p>
                </content>
                <paragraph eId="chapter-3__part-3.4__dvs-3__sec-64__subsec-2__para-a">
                  <num>a</num>
                  <content>
                    <p>make a declaration that the threat is unjustified; and</p>
                  </content>
                </paragraph>
                <paragraph eId="chapter-3__part-3.4__dvs-3__sec-64__subsec-2__para-b">
                  <num>b</num>
                  <content>
                    <p>grant an injunction restraining the AOC or the licensed user from continuing to make the threat.</p>
                  </content>
                  <content>
                    <p>The court may also award damages for loss that the person aggrieved has suffered as a result of the making of the threat.</p>
                  </content>
                </paragraph>
              </subsection>
              <subsection eId="chapter-3__part-3.4__dvs-3__sec-64__subsec-3">
                <num>3</num>
                <content>
                  <p>An action may not be brought under this section if the person who made the threat has made an application, or brought an action, under <ref href="#dvs-1">Division 1</ref> against the threatened person in relation to the act, or proposed act, to which the threat related.</p>
                </content>
              </subsection>
              <subsection eId="chapter-3__part-3.4__dvs-3__sec-64__subsec-4">
                <num>4</num>
                <content>
                  <p>An action under this section may not be continued if the person who made the threat makes an application, or brings an action, under <ref href="#dvs-1">Division 1</ref> against the threatened person in relation to the act, or proposed act, to which the threat related.</p>
                </content>
              </subsection>
              <subsection eId="chapter-3__part-3.4__dvs-3__sec-64__subsec-5">
                <num>5</num>
                <content>
                  <p>It is a defence to an action under subsection (1) that the conduct of the threatened person, in relation to which the threat was made, constitutes a contravention of <ref href="#sec-36">section 36</ref>.</p>
                </content>
              </subsection>
            </section>
            <section eId="chapter-3__part-3.4__dvs-3__sec-65">
              <num>65</num>
              <heading>Counterclaim</heading>
              <subsection eId="chapter-3__part-3.4__dvs-3__sec-65__subsec-1">
                <num>1</num>
                <content>
                  <p>If the AOC or a licensed user would be entitled to make an application, or bring an action, against a person for a contravention of <ref href="#sec-36">section 36</ref>, the AOC, or the licensed user may, in an action under <ref href="#sec-64">section 64</ref>, make a counterclaim for any relief to which the AOC or the licensed user would be entitled under <ref href="#dvs-1">Division 1</ref>.</p>
                </content>
              </subsection>
              <subsection eId="chapter-3__part-3.4__dvs-3__sec-65__subsec-2">
                <num>2</num>
                <content>
                  <p>The provisions of Divisions 1 and 2 apply as if a counterclaim were an application or action made or brought by the AOC or a licensed user under <ref href="#dvs-1">Division 1</ref>.</p>

                <p>The jurisdiction conferred by subsection (1) on the Supreme Court of a Territory is conferred to the extent that the Constitution permits.</p>

                <p>A prescribed court in which an application has been made, or an action brought, under this Chapter may, on the application of a party made at any stage, by order, transfer the application or action to another prescribed court having jurisdiction to hear and determine the application or action.</p>

                <p>When a court transfers an application or action to another court:</p>
              </content>

                  <p>all relevant documents of record filed in the transferring court must be sent to the other court by <role refersTo="#registrar">the Registrar</role> or other appropriate officer of the transferring court; and</p>

                  <b>Editorial changes</b>
                </p>
                <p>The <i>Legislation Act 2003</i> authorises First Parliamentary Counsel to make editorial and presentational changes to a compiled law in preparing a compilation of the law for registration. The changes must not change the effect of the law. Editorial changes take effect from the compilation registration date.</p>
                <p>If the compilation includes editorial changes, the endnotes include a brief outline of the changes in general terms. Full details of any changes can be obtained from the Office of Parliamentary Counsel.</p>

                  <b>Misdescribed amendments</b>
                </p>
                <p>A misdescribed amendment is an amendment that does not accurately describe how an amendment is to be made. If, despite the misdescription, the amendment can be given effect as intended, then the misdescribed amendment can be incorporated through an editorial change made under <i>Legislation Act 2003</i>.<ref href="#sec-15V">section 15V</ref> of the </p>
