            <p>		This Act may be cited as the <i> (Planning and Land Management) Act 1988</i>. </p>
          </content>
        </section>

          <heading>Commencement</heading>
          <subsection eId="part-I__sec-2__subsec-1">
            <num>1</num>
            <content>
              <p>Sections 1, 2 and 55 commence on the day on which this Act receives the Royal Assent.</p>
            </content>
          </subsection>

            <content>
              <p>	(2)	The amendment of the <i>Seat of Government (Administration) Act 1910 </i>contained in the Schedule commences on the day declared under section 57.</p>

            <content>
              <p>The remaining provisions of this Act (including the other amendments in the Schedule) commence on a day or days to be fixed by Proclamation.</p>

        </section>
        <section eId="part-I__sec-4">

          <heading>Definitions for whole Act</heading>
          <content>
            <p>In this Act, unless the contrary intention appears:</p>
            <p><term refersTo="#term-assembly">Assembly</term> means <def>the Legislative Assembly for the  established by the Self-Government Act.</def></p>
            <p><term refersTo="#term-authority">Authority</term> means <def>the National Capital Authority established by this Act.</def></p>
            <p><term refersTo="#term-chief-executive">Chief Executive</term> means <def>the Chief Executive of the Authority referred to in <ref href="#sec-45">section 45</ref>.</def></p>
            <p><b><i>Commonwealth authority</i></b> means:</p>
          </content>

            <content>
              <p>a body, whether corporate or not, established by or under a law of the Commonwealth other than the Self-Government Act;</p>
            </content>
          </paragraph>
          <paragraph eId="part-I__sec-4__para-b">
            <num>b</num>
            <content>
              <p>any other body, whether corporate or not, established by the Commonwealth;</p>
            </content>
          </paragraph>
          <paragraph eId="part-I__sec-4__para-c">
            <num>c</num>
            <content>
              <p>an office established by, or appointment made under, a law of the Commonwealth other than the Self-Government Act; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-I__sec-4__para-d">
            <num>d</num>
            <content>
              <p>an appointment made by the Commonwealth.</p>
            </content>
            <content>
              <p><term refersTo="#term-commonwealth-gazette">Commonwealth Gazette</term> means <def>the Commonwealth of Australia Gazette.</def></p>
              <p><term refersTo="#term-designated-area">Designated Area</term> means <def>an area of land specified in the Plan under <ref href="#sec-10">section 10</ref>.</def></p>
              <p><term refersTo="#term-enactment">enactment</term> has the same meaning as <def>in the Self-Government Act.</def></p>
              <p><term refersTo="#term-executive">Executive</term> has the same meaning as <def>in the Self-Government Act.</def></p>
              <p><b><i>full</i></b><b><i>-</i></b><b><i>time member</i></b> means:</p>

              <p>if there is a full-time Chairperson—the Chairperson; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-I__sec-4__para-b">
            <num>b</num>
            <content>
              <p>if there is a part-time Chairperson—the Chief Executive.</p>
            </content>
            <content>
              <p><term refersTo="#term-lands-acquisition-act">Lands Acquisition Act</term> means <def>the Act for the time being in force relating to the acquisition of land by the Commonwealth and associated matters.</def></p>
              <p><term refersTo="#term-land">land</term> includes <def>water.</def></p>
              <p><term refersTo="#term-liability">liability</term> includes <def>obligation.</def></p>
              <p><term refersTo="#term-management">management</term> includes <def>care, control and maintenance.</def></p>
              <p><term refersTo="#term-member">member</term> means <def>a member of the Authority.</def></p>
              <p>has the meaning given by <ref href="#sec-27">section 27</ref>.</p>
              <p><term refersTo="#term-plan">Plan</term> means <def>the National Capital Plan prepared by the Authority under <ref href="#part-III">Part III</ref>.</def></p>
              <p><term refersTo="#term-self-government-act">Self-Government Act</term> means <def>the  (Self-Government) Act 1988.</def></p>
              <p><term refersTo="#term-self-government-day">Self-Government Day</term> means <def>the day on which the Assembly becomes empowered to make laws.</def></p>
              <p><b><i>take</i></b>, in relation to water, has the same meaning as in the <i>Water Resources Act 2007</i> (ACT), as in force at the time this definition commences.</p>
              <p><term refersTo="#term-territory">Territory</term> has the same meaning as <def>in the Self-Government Act.</def></p>
              <p><b><i>Territory authority</i></b> means:</p>

              <p>any other body, whether corporate or not, established by the Executive;</p>
            </content>
          </paragraph>
          <paragraph eId="part-I__sec-4__para-c">

              <p>an office established by, or appointment made under, an enactment; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-I__sec-4__para-d">
            <num>d</num>
            <content>
              <p>an appointment made by the Executive or by a Minister as defined by the Self-Government Act.</p>
            </content>
            <content>
              <p><term refersTo="#term-territory-gazette">Territory Gazette</term> means <def>the Australian Capital Territory Gazette.</def></p>
              <p><term refersTo="#term-territory-plan">Territory Plan</term> means <def>the plan referred to in <ref href="#sec-25">section 25</ref>, and includes a stage or part of that plan.</def></p>
              <p><term refersTo="#term-territory-planning-authority">Territory planning authority</term> means <def>the authority referred to in <ref href="#sec-25">section 25</ref>.</def></p>
              <p>has the meaning given by <ref href="#sec-28">section 28</ref>.</p>
              <p><b><i>works</i></b> includes:</p>

          </paragraph>

            <num>a</num>
            <content>
              <p>the construction, alteration, extension or demolition of buildings or structures;</p>
            </content>
          </paragraph>
          <paragraph eId="part-I__sec-4__para-b">
            <num>b</num>
            <content>
              <p>landscaping;</p>
            </content>
          </paragraph>
          <paragraph eId="part-I__sec-4__para-c">

            </paragraph>
          </subsection>
        </section>
        <section eId="part-II__sec-6">
          <num>6</num>
          <heading>Functions of the Authority</heading>
          <subsection eId="part-II__sec-6__subsec-1">
            <num>1</num>
            <content>
              <p>The functions of <role refersTo="#authority">the Authority</role> are:</p>
            </content>
            <paragraph eId="part-II__sec-6__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>to prepare and administer a National Capital Plan;</p>
              </content>
            </paragraph>
            <paragraph eId="part-II__sec-6__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>to keep the Plan under constant review and to propose amendments to it when necessary;</p>
              </content>
            </paragraph>
            <paragraph eId="part-II__sec-6__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>on behalf of the Commonwealth, to commission works to be carried out in Designated Areas in accordance with the Plan where neither a Department of State of the Commonwealth nor any Commonwealth authority has the responsibility to commission those works;</p>
              </content>
            </paragraph>
            <paragraph eId="part-II__sec-6__subsec-1__para-d">
              <num>d</num>
              <content>
                <p>to recommend to <role refersTo="#minister">the Minister</role> the carrying out of works that it considers desirable to maintain or enhance the character of the National Capital;</p>
              </content>
            </paragraph>
            <paragraph eId="part-II__sec-6__subsec-1__para-e">
              <num>e</num>
              <content>
                <p>to foster an awareness of  as the National Capital;</p>
              </content>
            </paragraph>
            <paragraph eId="part-II__sec-6__subsec-1__para-f">
              <num>f</num>
              <content>
                <p>with the approval of <role refersTo="#minister">the Minister</role>, to perform planning services for any person or body, whether within  or overseas; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-II__sec-6__subsec-1__para-g">
              <num>g</num>
              <content>
                <p>subject to subsection (2) and with <role refersTo="#minister">the Minister</role>’s approval, on behalf of the Commonwealth, to manage  designated in writing by <role refersTo="#minister">the Minister</role> as land required for the special purposes of  as the National Capital.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-II__sec-6__subsec-2">
            <num>2</num>
            <content>
              <p>The functions of <role refersTo="#authority">the Authority</role> under paragraph (1)(g) do not include:</p>
            </content>
            <paragraph eId="part-II__sec-6__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>the management of the taking of water on National Land; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-II__sec-6__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>the regulation of the taking of water on National Land.</p>
              </content>

          <heading>Ministerial directions</heading>

              <p><role refersTo="#minister">The Minister</role> may, by legislative instrument, give general directions in writing to <role refersTo="#authority">the Authority</role> about the performance of <role refersTo="#authority">the Authority</role>’s functions.</p>
            </content>

          <heading>Powers of Authority</heading>
          <content>
            <p>Subject to this Act, <role refersTo="#authority">the Authority</role> has power to do all things necessary or convenient to be done for or in connection with the performance of its functions.</p>
          </content>
        </section>
      </part>

        <num>III</num>
        <heading>The National Capital Plan</heading>
        <division eId="part-III__dvs-1">
          <num>1</num>
          <heading>Object and effect of National Capital Plan</heading>
          <section eId="part-III__dvs-1__sec-9">
            <num>9</num>
            <heading>Object of Plan</heading>
            <content>
              <p>The object of the Plan is to ensure that  and the Territory are planned and developed in accordance with their national significance.</p>
            </content>
          </section>
          <section eId="part-III__dvs-1__sec-10">
            <num>10</num>
            <heading>Matters to be covered in Plan</heading>
            <subsection eId="part-III__dvs-1__sec-10__subsec-1">
              <num>1</num>
              <content>
                <p>The Plan may specify areas of land that have the special characteristics of the National Capital to be Designated Areas.</p>
              </content>
            </subsection>
            <subsection eId="part-III__dvs-1__sec-10__subsec-2">
              <num>2</num>
              <content>
                <p>The Plan:</p>
              </content>
              <paragraph eId="part-III__dvs-1__sec-10__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>shall define the planning principles and policies for giving effect to the object of the Plan and, in particular, shall set standards for the maintenance and enhancement of the character of the National Capital and set general standards and aesthetic principles to be adhered to in the development of the National Capital;</p>
                </content>
              </paragraph>
              <paragraph eId="part-III__dvs-1__sec-10__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>shall set out the general policies to be implemented throughout the Territory, being policies of:</p>
                </content>
              </paragraph>
              <paragraph eId="part-III__dvs-1__sec-10__subsec-2__para-i">
                <num>i</num>
                <content>
                  <p>land use (including the range and nature of permitted land use); and</p>
                </content>
              </paragraph>
              <paragraph eId="part-III__dvs-1__sec-10__subsec-2__para-ii">
                <num>ii</num>
                <content>
                  <p>the planning of national and arterial road systems;</p>
                </content>
              </paragraph>
              <paragraph eId="part-III__dvs-1__sec-10__subsec-2__para-c">
                <num>c</num>
                <content>
                  <p>may set out the detailed conditions of planning, design and development in Designated Areas and the priorities in carrying out such planning, design and development; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-III__dvs-1__sec-10__subsec-2__para-d">
                <num>d</num>
                <content>
                  <p>may set out special requirements for the development of any area (not being a Designated Area), being requirements that are desirable in the interests of the National Capital.</p>
                </content>

            <num>11</num>
            <heading>Effect of Plan</heading>
            <subsection eId="part-III__dvs-1__sec-11__subsec-1">
              <num>1</num>
              <content>
                <p>An enactment that is inconsistent with the Plan has no effect to the extent of the inconsistency, but an enactment shall be taken to be consistent with the Plan to the extent that it is capable of operating concurrently with the Plan.</p>
              </content>
            </subsection>
            <subsection eId="part-III__dvs-1__sec-11__subsec-2">
              <num>2</num>
              <content>
                <p>The Commonwealth, a Commonwealth authority, the Territory or a Territory authority shall not do any act that is inconsistent with the Plan.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-III__dvs-1__sec-12">
            <num>12</num>
            <heading>Works in Designated Areas to be subject to Plan and approval by the Authority</heading>
            <subsection eId="part-III__dvs-1__sec-12__subsec-1">
              <num>1</num>
              <content>
                <p>No works shall be performed in a Designated Area unless:</p>
              </content>
              <paragraph eId="part-III__dvs-1__sec-12__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>the proposal to perform the works has been submitted to <role refersTo="#authority">the Authority</role> together with such plans and specifications as are required by <role refersTo="#authority">the Authority</role>;</p>
                </content>
              </paragraph>
              <paragraph eId="part-III__dvs-1__sec-12__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p><role refersTo="#authority">the Authority</role> has approved the works in writing; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-III__dvs-1__sec-12__subsec-1__para-c">
                <num>c</num>
                <content>
                  <p>the works are in accordance with the Plan.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-III__dvs-1__sec-12__subsec-2">
              <num>2</num>
              <content>
                <p>	(2)	Subsection (1) does not affect <i>Parliament Act 1974.</i><ref href="#sec-5">section 5</ref> of the </p>
              </content>
            </subsection>
          </section>
          <section eId="part-III__dvs-1__sec-13">
            <num>13</num>
            <heading>Plan not to have retrospective effect</heading>
            <content>
              <p>Where, immediately before the Plan comes into effect, it would be lawful to use any land in a particular way in the exercise of a right derived from an estate in that land, the Plan does not prevent the use of that land in that way during the term of that estate.</p>
            </content>
          </section>
        </division>
        <division eId="part-III__dvs-2">
          <num>2</num>
          <heading>Preparation of National Capital Plan</heading>
          <section eId="part-III__dvs-2__sec-14">
            <num>14</num>
            <heading>Draft Plan to be prepared</heading>
            <content>
              <p><role refersTo="#authority">The Authority</role> shall prepare a draft Plan in accordance with this Division.</p>
            </content>
          </section>
          <section eId="part-III__dvs-2__sec-15">
            <num>15</num>
            <heading>Public consultation</heading>
            <subsection eId="part-III__dvs-2__sec-15__subsec-1">
              <num>1</num>
              <content>
                <p>After preparing the draft Plan, <role refersTo="#authority">the Authority</role> shall:</p>
              </content>
              <paragraph eId="part-III__dvs-2__sec-15__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>submit a copy to the Territory planning authority;</p>
                </content>
              </paragraph>
              <paragraph eId="part-III__dvs-2__sec-15__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>	(b)	by notice published in the <i>Commonwealth Gazette </i>and in the principal daily newspaper published and circulated in the Territory:</p>
                </content>
              </paragraph>
              <paragraph eId="part-III__dvs-2__sec-15__subsec-1__para-i">
                <num>i</num>
                <content>
                  <p>state that the draft Plan has been prepared, and that copies will be available for public inspection at the places and times, and during the period, specified in the notice; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-III__dvs-2__sec-15__subsec-1__para-ii">
                <num>ii</num>
                <content>
                  <p>invite interested persons to make written representations about the draft Plan within a reasonable period specified in the notice and specify the address to which the representations may be forwarded; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-III__dvs-2__sec-15__subsec-1__para-c">
                <num>c</num>
                <content>
                  <p>make the draft Plan available for inspection accordingly.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-III__dvs-2__sec-15__subsec-2">
              <num>2</num>
              <content>
                <p><role refersTo="#authority">The Authority</role> shall:</p>
              </content>
              <paragraph eId="part-III__dvs-2__sec-15__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>consult with the Territory planning authority about the draft Plan and have regard to any views expressed by it; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-III__dvs-2__sec-15__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>have regard to any representations made by the public;</p>
                </content>
                <content>
                  <p>and, if it thinks fit, may alter the draft Plan.</p>
                </content>
              </paragraph>
            </subsection>
          </section>
          <section eId="part-III__dvs-2__sec-16">
            <num>16</num>
            <heading>Certification of draft Plan</heading>
            <subsection eId="part-III__dvs-2__sec-16__subsec-1">
              <num>1</num>
              <content>
                <p>After <role refersTo="#authority">the Authority</role> has:</p>
              </content>
              <paragraph eId="part-III__dvs-2__sec-16__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>made the draft Plan available for public inspection;</p>
                </content>
              </paragraph>
              <paragraph eId="part-III__dvs-2__sec-16__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>consulted with the Territory planning authority; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-III__dvs-2__sec-16__subsec-1__para-c">
                <num>c</num>
                <content>
                  <p>reported in writing to <role refersTo="#minister">the Minister</role> on the consultation and the views expressed by that authority;</p>
                </content>
                <content>
                  <p><role refersTo="#authority">the Authority</role> may apply to <role refersTo="#minister">the Minister</role> to certify the draft Plan under this section while it is being further considered.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-III__dvs-2__sec-16__subsec-2">
              <num>2</num>
              <content>
                <p>After considering the report by <role refersTo="#authority">the Authority</role>, <role refersTo="#minister">the Minister</role> may, subject to subsection (3), declare, by written instrument, that the draft Plan is certified.</p>
              </content>
            </subsection>
            <subsection eId="part-III__dvs-2__sec-16__subsec-3">
              <num>3</num>
              <content>
                <p>If <role refersTo="#authority">the Authority</role> reports under subsection (1) that the Territory planning authority objects to the certification of the draft Plan, <role refersTo="#minister">the Minister</role> shall not act under subsection (2) except after consultation with the Executive.</p>
              </content>
            </subsection>
            <subsection eId="part-III__dvs-2__sec-16__subsec-4">
              <num>4</num>
              <content>
                <p>The certification remains in force for 6 months unless sooner revoked, but <role refersTo="#minister">the Minister</role> may, by written instrument, extend that period for one or more further periods of 6 months.</p>
              </content>
            </subsection>
            <subsection eId="part-III__dvs-2__sec-16__subsec-5">
              <num>5</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> shall cause a copy of each instrument to be laid before each House of the Parliament within 15 sitting days of that House after the instrument is made.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-III__dvs-2__sec-17">
            <num>17</num>
            <heading>Effect of certification of draft Plan</heading>
            <content>
              <p>So long as the draft Plan is certified, <ref href="#sec-11">section 11</ref> applies as if the Plan were in effect.</p>
            </content>
          </section>
          <section eId="part-III__dvs-2__sec-18">
            <num>18</num>
            <heading>Submission to Minister for approval</heading>
            <content>
              <p><role refersTo="#authority">The Authority</role> shall submit the draft Plan to <role refersTo="#minister">the Minister</role> for approval, together with a written report on its consultations under section 15.</p>
            </content>
          </section>
          <section eId="part-III__dvs-2__sec-19">
            <num>19</num>
            <heading>Minister’s powers</heading>
            <subsection eId="part-III__dvs-2__sec-19__subsec-1">
              <num>1</num>
              <content>
                <p>Subject to subsection (2), on receipt of the draft Plan submitted for approval, <role refersTo="#minister">the Minister</role> shall, after such consultation, if any, as <role refersTo="#minister">the Minister</role> thinks necessary:</p>
              </content>
              <paragraph eId="part-III__dvs-2__sec-19__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>approve the draft Plan without alteration; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-III__dvs-2__sec-19__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>refer the draft Plan to <role refersTo="#authority">the Authority</role> with either or both of the following:</p>
                </content>
              </paragraph>
              <paragraph eId="part-III__dvs-2__sec-19__subsec-1__para-i">
                <num>i</num>
                <content>
                  <p>directions to conduct further consultations;</p>
                </content>
              </paragraph>
              <paragraph eId="part-III__dvs-2__sec-19__subsec-1__para-ii">
                <num>ii</num>
                <content>
                  <p>suggested alterations.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-III__dvs-2__sec-19__subsec-2">
              <num>2</num>
              <content>
                <p>If <role refersTo="#authority">the Authority</role> reports under section 18 that the Territory planning authority objects to any aspect of the draft Plan, <role refersTo="#minister">the Minister</role> shall not act under subsection (1) except after consultation with the Executive.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-III__dvs-2__sec-20">
            <num>20</num>
            <heading>Action on referral by Minister</heading>
            <content>
              <p>If <role refersTo="#minister">the Minister</role> refers the draft Plan to <role refersTo="#authority">the Authority</role>, <role refersTo="#authority">the Authority</role> shall:</p>
            </content>
            <paragraph eId="part-III__dvs-2__sec-20__para-a">
              <num>a</num>
              <content>
                <p>reconsider the draft Plan;</p>
              </content>
            </paragraph>
            <paragraph eId="part-III__dvs-2__sec-20__para-b">
              <num>b</num>
              <content>
                <p>have any further consultations directed by <role refersTo="#minister">the Minister</role> and such other consultations as <role refersTo="#authority">the Authority</role> thinks necessary;</p>
              </content>
            </paragraph>
            <paragraph eId="part-III__dvs-2__sec-20__para-c">
              <num>c</num>
              <content>
                <p>consider any suggestions made by <role refersTo="#minister">the Minister</role>;</p>
              </content>
            </paragraph>
            <paragraph eId="part-III__dvs-2__sec-20__para-d">
              <num>d</num>
              <content>
                <p>if it thinks fit, alter the draft Plan; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-III__dvs-2__sec-20__para-e">
              <num>e</num>
              <content>
                <p>re-submit the draft Plan to <role refersTo="#minister">the Minister</role> for approval;</p>
              </content>
              <content>
                <p>and subsection 19(1) and, if necessary, this section, apply again.</p>
              </content>
            </paragraph>
          </section>
          <section eId="part-III__dvs-2__sec-20A">
            <num>20A</num>
            <heading>Objections to re-submitted draft Plan</heading>
            <subsection eId="part-III__dvs-2__sec-20A__subsec-1">
              <num>1</num>
              <content>
                <p>If the Territory planning authority continues to object to any aspect of the draft Plan re-submitted to <role refersTo="#minister">the Minister</role>, <role refersTo="#authority">the Authority</role> must attach to the draft Plan a statement of its reasons for not accommodating the objection.</p>
              </content>
            </subsection>
            <subsection eId="part-III__dvs-2__sec-20A__subsec-2">
              <num>2</num>
              <content>
                <p>If <role refersTo="#minister">the Minister</role> receives a statement from <role refersTo="#authority">the Authority</role> under subsection (1), <role refersTo="#minister">the Minister</role>, after consultation with the Executive, must give a written direction to <role refersTo="#authority">the Authority</role>:</p>
              </content>
              <paragraph eId="part-III__dvs-2__sec-20A__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>to disregard the objection; or</p>
                </content>
              </paragraph>

                <p><role refersTo="#minister">The Minister</role> must cause a copy of each direction given under subsection (2) to be laid before each House of the Parliament within 6 sitting days of that House after <role refersTo="#minister">the Minister</role> gives the direction.</p>

            <num>21</num>
            <heading>Publication and commencement of approved Plan</heading>
            <subsection eId="part-III__dvs-2__sec-21__subsec-1">
              <num>1</num>
              <content>
                <p>	(1)	Where the Minister approves the draft Plan, the Minister shall publish notice of the approval in the <i>Commonwealth Gazette </i>and specify the address where copies of the Plan may be inspected and bought.</p>
              </content>
            </subsection>
            <subsection eId="part-III__dvs-2__sec-21__subsec-2">
              <num>2</num>
              <content>
                <p>The Plan takes effect on publication of the notice of approval.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-III__dvs-2__sec-22">
            <num>22</num>
            <heading>Parliamentary scrutiny of Plan</heading>
            <subsection eId="part-III__dvs-2__sec-22__subsec-1">
              <num>1</num>
              <content>
                <p>The Plan shall be laid before each House of the Parliament within 6 sitting days of that House after the Plan has taken effect, and, if it is not so laid before each House of the Parliament, ceases to have effect.</p>
              </content>
            </subsection>
            <subsection eId="part-III__dvs-2__sec-22__subsec-2">
              <num>2</num>
              <content>
                <p>If either House of the Parliament, in pursuance of a motion of which notice has been given within 6 sitting days after the Plan has been laid before that House, passes a resolution disallowing the Plan or a part of the Plan, the Plan or part so disallowed thereupon ceases to have effect.</p>
              </content>
            </subsection>
            <subsection eId="part-III__dvs-2__sec-22__subsec-3">
              <num>3</num>
              <content>
                <p>If, before the end of 6 sitting days after notice of a motion to disallow the Plan or part of the Plan has been given in a House of the Parliament:</p>
              </content>
              <paragraph eId="part-III__dvs-2__sec-22__subsec-3__para-a">
                <num>a</num>
                <content>
                  <p>the House of Representatives is dissolved or expires, or the Parliament is prorogued; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-III__dvs-2__sec-22__subsec-3__para-b">
                <num>b</num>
                <content>
                  <p>at the time of the dissolution, expiry or prorogation, as the case may be:</p>
                </content>
              </paragraph>
              <paragraph eId="part-III__dvs-2__sec-22__subsec-3__para-i">
                <num>i</num>
                <content>
                  <p>the notice has not been withdrawn and the motion has not been called on; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-III__dvs-2__sec-22__subsec-3__para-ii">
                <num>ii</num>
                <content>
                  <p>the motion has been called on, moved and seconded and has not been withdrawn or otherwise disposed of;</p>
                </content>
                <content>
                  <p>the Plan shall, for the purposes of subsection (2), be taken to have been laid before the first-mentioned House on the first sitting day of that House after the dissolution, expiry or prorogation, as the case may be.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-III__dvs-2__sec-22__subsec-4">
              <num>4</num>
              <content>
                <p>If:</p>
              </content>
              <paragraph eId="part-III__dvs-2__sec-22__subsec-4__para-a">
                <num>a</num>
                <content>
                  <p>	(a)	a part of the Plan (in this subsection called the <b><i>later part</i></b>) is disallowed; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-III__dvs-2__sec-22__subsec-4__para-b">
                <num>b</num>
                <content>
                  <p>	(b)	the later part amended or revoked another part of the Plan (in this subsection called the <b><i>earlier part</i></b>) that was in effect immediately before the later part took effect;</p>
                </content>
                <content>
                  <p>the disallowance revives the earlier part from the date of the disallowance as if the later part had not taken effect.</p>
                </content>
              </paragraph>
            </subsection>
          </section>
          <section eId="part-III__dvs-2__sec-23">
            <num>23</num>
            <heading>Amendments of Plan</heading>
            <content>
              <p>Amendments of the Plan shall be prepared in the same way as the Plan, and sections 14 to 22 (both inclusive) apply to amendments as if references in those sections to the Plan were references to amendments.</p>
            </content>
          </section>
          <section eId="part-III__dvs-2__sec-24">
            <num>24</num>
            <heading>Plan may be prepared in stages or parts</heading>
            <content>
              <p>The Plan may be prepared in separate stages or parts and, in such a case, sections 14 to 23 (both inclusive) apply as if references in those sections to the Plan were references to such a stage or part of the Plan.</p>
            </content>
          </section>
        </division>
      </part>
      <part eId="part-IV">
        <num>IV</num>
        <heading>The Territory Plan</heading>
        <section eId="part-IV__sec-25">
          <num>25</num>
          <heading>Territory Plan</heading>
          <subsection eId="part-IV__sec-25__subsec-1">
            <num>1</num>
            <content>
              <p>The Assembly shall, as soon as practicable, make laws providing for:</p>
            </content>
            <paragraph eId="part-IV__sec-25__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>establishing a Territory planning authority; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-IV__sec-25__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>conferring functions on <role refersTo="#authority">the authority</role>, including the functions of:</p>
              </content>
            </paragraph>
            <paragraph eId="part-IV__sec-25__subsec-1__para-i">
              <num>i</num>
              <content>
                <p>preparing and administering a plan in respect of land, not inconsistent with the National Capital Plan; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-IV__sec-25__subsec-1__para-ii">
              <num>ii</num>
              <content>
                <p>keeping the plan under constant review and proposing amendments to it when necessary.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-IV__sec-25__subsec-2">
            <num>2</num>
            <content>
              <p>The object of the plan is to ensure, in a manner not inconsistent with the National Capital Plan, the planning and development of the Territory to provide the people of the Territory with an attractive, safe and efficient environment in which to live and work and have their recreation.</p>
            </content>
          </subsection>
          <subsection eId="part-IV__sec-25__subsec-3">
            <num>3</num>
            <content>
              <p>The plan:</p>
            </content>
            <paragraph eId="part-IV__sec-25__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>shall define the planning principles and policies for giving effect to the object of the plan; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-IV__sec-25__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>may include the detailed conditions of planning, design and development of land and the priorities in carrying out such planning, design and development.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-IV__sec-25__subsec-4">
            <num>4</num>
            <content>
              <p>The laws shall include provision for:</p>
            </content>
            <paragraph eId="part-IV__sec-25__subsec-4__para-a">
              <num>a</num>
              <content>
                <p>the procedure for making the plan and amendments of the plan, including a procedure for ascertaining and considering the views of the public;</p>
              </content>
            </paragraph>
            <paragraph eId="part-IV__sec-25__subsec-4__para-b">
              <num>b</num>
              <content>
                <p>public notification of any directions given to the Territory planning authority by the Executive;</p>
              </content>
            </paragraph>
            <paragraph eId="part-IV__sec-25__subsec-4__para-c">
              <num>c</num>
              <content>
                <p>the procedures for just and timely review, without unnecessary formality, of appropriate classes of decisions on planning, design and development of land; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-IV__sec-25__subsec-4__para-d">
              <num>d</num>
              <content>
                <p>requiring <role refersTo="#authority">the authority</role> to:</p>
              </content>
            </paragraph>
            <paragraph eId="part-IV__sec-25__subsec-4__para-i">
              <num>i</num>
              <content>
                <p>consult with <role refersTo="#authority">the Authority</role> about making the plan and any amendments; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-IV__sec-25__subsec-4__para-ii">
              <num>ii</num>
              <content>
                <p>report in writing to the Executive on such consultations and the views expressed by <role refersTo="#authority">the Authority</role>.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-IV__sec-25__subsec-5">
            <num>5</num>
            <content>
              <p>This section does not limit the power of the Assembly to make laws otherwise than under this section.</p>
            </content>
          </subsection>
          <subsection eId="part-IV__sec-25__subsec-6">
            <num>6</num>
            <content>
              <p>In this section:</p>
            </content>
            <content>
              <p><b><i>land</i></b> does not include Designated Areas.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-IV__sec-26">
          <num>26</num>
          <heading>Territory Plan not to be inconsistent with National Capital Plan</heading>
          <content>
            <p>The Territory Plan has no effect to the extent that it is inconsistent with the National Capital Plan, but the Territory Plan shall be taken to be consistent with the National Capital Plan to the extent that it is capable of operating concurrently with the National Capital Plan.</p>
          </content>
        </section>
      </part>
      <part eId="part-V">
        <num>V</num>
        <heading>Land management</heading>
        <content>
          <p>27</p>
        </content>
        <subsection eId="part-V__subsec-1">
          <num>1</num>
          <content>
            <p>	(1)	The Minister may, by notice published in the <i>Commonwealth Gazette </i>declare specified areas of land in the Territory to be .</p>
          </content>
        </subsection>
        <subsection eId="part-V__subsec-2">
          <num>2</num>
          <content>
            <p><role refersTo="#minister">The Minister</role> shall not declare an area to be  unless the land is, or is intended to be, used by or on behalf of the Commonwealth.</p>
          </content>
        </subsection>
        <subsection eId="part-V__subsec-3">
          <num>3</num>
          <content>
            <p>If an Act vests the management (however described) of specified land in the Territory in a person or body, the land is  for the purposes of this Act.</p>
          </content>
        </subsection>
        <subsection eId="part-V__subsec-4">
          <num>4</num>
          <content>
            <p>Subsection (3) does not apply to the vesting of an estate in land.</p>
          </content>
          <content>
            <p>28</p>
            <p>At any time when any land in the Territory is not , that land is  for the purposes of this Act.</p>
          </content>
        </subsection>
        <section eId="part-V__sec-29">
          <num>29</num>
          <heading>Administration of Territory Land and the taking of water on National Land</heading>
          <subsection eId="part-V__sec-29__subsec-1">
            <num>1</num>
            <content>
              <p>The Executive, on behalf of the Commonwealth:</p>
            </content>
            <paragraph eId="part-V__sec-29__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>has responsibility for the management of ; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-V__sec-29__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>	(b)	subject to <i>Seat of Government (Administration) Act 1910</i>, may grant, dispose of, acquire, hold and administer estates in  Land; and<ref href="#sec-9">section 9</ref> of the </p>
              </content>
            </paragraph>
            <paragraph eId="part-V__sec-29__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>has responsibility for:</p>
              </content>
            </paragraph>
            <paragraph eId="part-V__sec-29__subsec-1__para-i">
              <num>i</num>
              <content>
                <p>the management of the taking of water on National Land; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-V__sec-29__subsec-1__para-ii">
              <num>ii</num>
              <content>
                <p>the regulation of the taking of water on National Land.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-V__sec-29__subsec-2">
            <num>2</num>
            <content>
              <p>The Executive shall perform its functions under subsection (1) subject to enactment and in accordance with the principles:</p>
            </content>
            <paragraph eId="part-V__sec-29__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>that new estates in  shall be granted only in accordance with procedures that are notified to the public; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-V__sec-29__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>that appropriate classes of decisions relating to the administration of estates in  shall be subject to just and timely review without unnecessary formality.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-V__sec-29__subsec-3">
            <num>3</num>
            <content>
              <p>The term of an estate in  granted on or after Self-Government Day shall not exceed 99 years or such longer period as is prescribed, but the estate may be renewed.</p>
            </content>
          </subsection>
          <subsection eId="part-V__sec-29__subsec-4">
            <num>4</num>
            <content>
              <p><role refersTo="#authority">The Authority</role> may intervene in any proceedings for review of a decision relating to the administration of an estate in .</p>
            </content>
          </subsection>
        </section>
        <section eId="part-V__sec-30">
          <num>30</num>
          <heading>Territory liable as manager</heading>
          <subsection eId="part-V__sec-30__subsec-1">
            <num>1</num>
            <content>
              <p>Where, apart from this section, the Commonwealth would be liable in respect of an act done or omitted to be done by the Territory in the performance of its functions under <ref href="#sec-29">section 29</ref>, the liability is vested in the Territory and ceases to be a liability of the Commonwealth.</p>
            </content>
          </subsection>
          <subsection eId="part-V__sec-30__subsec-2">
            <num>2</num>
            <content>
              <p>Where:</p>
            </content>
            <paragraph eId="part-V__sec-30__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>a liability arises in respect of:</p>
              </content>
            </paragraph>
            <paragraph eId="part-V__sec-30__subsec-2__para-i">
              <num>i</num>
              <content>
                <p>land at a time when it is Territory Land; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-V__sec-30__subsec-2__para-ii">
              <num>ii</num>
              <content>
                <p>the management of the taking of water on National Land; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-V__sec-30__subsec-2__para-iii">
              <num>iii</num>
              <content>
                <p>the regulation of the taking of water on National Land; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-V__sec-30__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>the liability arises from a covenant given by the Commonwealth at any time in its capacity as owner of the land;</p>
              </content>
              <content>
                <p>the liability is vested in the Territory and ceases to be a liability of the Commonwealth.</p>
              </content>
            </paragraph>
          </subsection>
        </section>
        <section eId="part-V__sec-31">
          <num>31</num>
          <heading>Money in respect of land</heading>
          <subsection eId="part-V__sec-31__subsec-1">
            <num>1</num>
            <content>
              <p>Where any money would, apart from this section, be payable to the Commonwealth in respect of any land in discharge of a liability existing at a time when the land is , the money is payable to the Territory instead of the Commonwealth.</p>
            </content>
          </subsection>
          <subsection eId="part-V__sec-31__subsec-2">
            <num>2</num>
            <content>
              <p>Where any Territory Land that is not subject to a leasehold interest becomes National Land, the Commonwealth shall pay to the Territory an amount equal to the reasonable compensation that would be payable to the Territory under the Lands Acquisition Act if:</p>
            </content>
            <paragraph eId="part-V__sec-31__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>immediately before the land became , the Territory had been granted a leasehold interest in the land by the Commonwealth for the maximum term allowable under subsection 29(3);</p>
              </content>
            </paragraph>
            <paragraph eId="part-V__sec-31__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>that interest was granted for any purpose for which a leasehold interest in that land could be granted;</p>
              </content>
            </paragraph>
            <paragraph eId="part-V__sec-31__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>that interest was subject to any estate in the land existing immediately before it became ;</p>
              </content>
            </paragraph>
            <paragraph eId="part-V__sec-31__subsec-2__para-d">
              <num>d</num>
              <content>
                <p>subject to paragraph (c), the Territory was not bound by any express or implied covenants (including covenants to pay rent or rates) in relation to that interest; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-V__sec-31__subsec-2__para-e">
              <num>e</num>
              <content>
                <p>when the land became , that interest was acquired by the Commonwealth.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-V__sec-31__subsec-3">
            <num>3</num>
            <content>
              <p>Subsection (2) applies only to  that becomes  at any time after the first declaration of .</p>
            </content>
          </subsection>
        </section>
        <section eId="part-V__sec-31A">
          <num>31A</num>
          <heading>Minerals in</heading>
          <subsection eId="part-V__sec-31A__subsec-1">
            <num>1</num>
            <content>
              <p>In this section:</p>
            </content>
            <content>
              <p><b><i>mineral</i></b> means a naturally occurring substance or mixture of substances, whether in a solid, liquid or gaseous state.</p>
            </content>
          </subsection>
          <subsection eId="part-V__sec-31A__subsec-2">
            <num>2</num>
            <content>
              <p>So long as any land in the Territory is , all rights of the Commonwealth in relation to minerals in that land are vested in the Territory.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-V__sec-32">
          <num>32</num>
          <heading>Application of Lands Acquisition Act to</heading>
          <subsection eId="part-V__sec-32__subsec-1">
            <num>1</num>
            <content>
              <p>The Lands Acquisition Act does not apply in relation to:</p>
            </content>
            <paragraph eId="part-V__sec-32__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>anything done by or on behalf of the Commonwealth or a Commonwealth authority in respect of an interest in Territory Land while the interest is vested in the Commonwealth or a Commonwealth authority; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-V__sec-32__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>the acquisition (compulsory or not) of an estate in  by the Territory, whether acting on behalf of the Commonwealth or not.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-V__sec-32__subsec-2">
            <num>2</num>
            <content>
              <p>In subsection (1):</p>
            </content>
            <content>
              <p><b><i>estate</i></b> includes the interest of the Commonwealth in land in which no person other than the Commonwealth holds an estate.</p>
            </content>
          </subsection>
        </section>
      </part>

        <num>VI</num>
        <heading>Constitution and meetings of authority</heading>
        <section eId="part-VI__sec-33">
          <num>33</num>
          <heading>Constitution of Authority</heading>
          <subsection eId="part-VI__sec-33__subsec-1">
            <num>1</num>
            <content>
              <p><role refersTo="#authority">The Authority</role> shall consist of a Chairperson and 4 other members, as provided by this section.</p>
            </content>
          </subsection>
          <subsection eId="part-VI__sec-33__subsec-2">
            <num>2</num>
            <content>
              <p>The Chairperson may be appointed on a full-time or part-time basis.</p>
            </content>
          </subsection>
          <subsection eId="part-VI__sec-33__subsec-3">
            <num>3</num>
            <content>
              <p>If the Chairperson is appointed on a full-time basis, the Chairperson shall also be the Chief Executive and there shall be 4 non-executive members.</p>
            </content>
          </subsection>
          <subsection eId="part-VI__sec-33__subsec-4">
            <num>4</num>
            <content>
              <p>If the Chairperson is appointed on a part-time basis, there shall be a separate Chief Executive and 3 other non-executive members.</p>
            </content>
          </subsection>
          <subsection eId="part-VI__sec-33__subsec-5">
            <num>5</num>
            <content>
              <p>The Chief Executive (if any) appointed under subsection (4) shall be appointed on a full-time basis.</p>
            </content>
          </subsection>
          <subsection eId="part-VI__sec-33__subsec-6">
            <num>6</num>
            <content>
              <p>The non-executive members shall be appointed on a part-time basis.</p>
            </content>
          </subsection>
          <subsection eId="part-VI__sec-33__subsec-7">
            <num>7</num>
            <content>
              <p>The members shall be appointed by the Governor-General, and hold office on such terms and conditions (in respect of matters not provided for by this Act) as are determined by the Governor-General.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-VI__sec-34">
          <num>34</num>
          <heading>Vacancies not to invalidate actions of Authority</heading>
          <content>
            <p>An act done by <role refersTo="#authority">the Authority</role> is not invalid merely because of a vacancy or vacancies in the membership of <role refersTo="#authority">the Authority</role>.</p>
          </content>
        </section>
        <section eId="part-VI__sec-35">
          <num>35</num>
          <heading>Remuneration</heading>
          <subsection eId="part-VI__sec-35__subsec-1">
            <num>1</num>
            <content>
              <p>A member shall be paid such remuneration as is determined by the Remuneration Tribunal, but, if no determination of that remuneration by the Tribunal is in operation, shall be paid such remuneration as is prescribed.</p>
            </content>
          </subsection>
          <subsection eId="part-VI__sec-35__subsec-2">
            <num>2</num>
            <content>
              <p>A member shall be paid such allowances as are prescribed.</p>
            </content>
          </subsection>
          <subsection eId="part-VI__sec-35__subsec-3">
            <num>3</num>
            <content>
              <p>	(3)	This section has effect subject to the <i>Remuneration Tribunal Act 1973</i>.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-VI__sec-36">
          <num>36</num>
          <heading>Period of appointment of members</heading>
          <subsection eId="part-VI__sec-36__subsec-1">
            <num>1</num>
            <content>
              <p>Subject to this Part, a member holds office for the period, not exceeding 5 years, specified in the instrument of appointment.</p>
            </content>
          </subsection>
          <subsection eId="part-VI__sec-36__subsec-2">
            <num>2</num>
            <content>
              <p>A person appointed as a member is eligible for re-appointment.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-VI__sec-37">
          <num>37</num>
          <heading>Acting appointments</heading>
          <subsection eId="part-VI__sec-37__subsec-1">
            <num>1</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> may appoint a person to act as the full-time member during any period, or during all periods:</p>
            </content>
            <paragraph eId="part-VI__sec-37__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>when there is a vacancy in the office of that member, whether or not an appointment has previously been made to the office; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-VI__sec-37__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>when that member is absent from duty or from  or is, for any other reason, unable to perform the duties of the office.</p>
              </content>

              <p>A full-time member has such recreation leave entitlements as are determined by the Remuneration Tribunal.</p>

              <p><role refersTo="#minister">The Minister</role> may:</p>
            </content>

                <p>grant a full-time member leave of absence, other than recreation leave, on such terms and conditions as to remuneration or otherwise as <role refersTo="#minister">the Minister</role> determines in writing; and</p>

                <p>grant a part-time member leave to be absent from a meeting or meetings of <role refersTo="#authority">the Authority</role>.</p>

        </section>

          <heading>Outside employment</heading>
          <subsection eId="part-VI__sec-39__subsec-1">
            <num>1</num>
            <content>
              <p>A full-time member shall not engage in paid employment outside his or her duties except with the approval of <role refersTo="#minister">the Minister</role>.</p>
            </content>
          </subsection>
          <subsection eId="part-VI__sec-39__subsec-2">
            <num>2</num>
            <content>
              <p>If a part-time member engages in paid employment that, in the opinion of <role refersTo="#minister">the Minister</role>, conflicts with the proper performance of his or her duties, <role refersTo="#minister">the Minister</role> may, in writing, direct the member to cease that employment.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-VI__sec-40">
          <num>40</num>
          <heading>Resignation of members</heading>
          <content>
            <p>A member may resign by written instrument delivered to the Governor-General.</p>
          </content>
        </section>
        <section eId="part-VI__sec-41">
          <num>41</num>
          <heading>Termination of appointments</heading>
          <subsection eId="part-VI__sec-41__subsec-1">
            <num>1</num>
            <content>
              <p>The Governor-General may terminate the appointment of a member for misbehaviour or physical or mental incapacity.</p>
            </content>
          </subsection>
          <subsection eId="part-VI__sec-41__subsec-2">
            <num>2</num>
            <content>
              <p>If:</p>
            </content>
            <paragraph eId="part-VI__sec-41__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>a member becomes bankrupt, applies to take the benefit of any law for relief of bankrupt or insolvent debtors, compounds with creditors or makes an assignment of remuneration for their benefit;</p>
              </content>
            </paragraph>
            <paragraph eId="part-VI__sec-41__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>a full-time member is absent from duty, except on leave of absence, for 14 consecutive days or 28 days in any 12 months;</p>
              </content>
            </paragraph>
            <paragraph eId="part-VI__sec-41__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>a part-time member is absent, except on leave of absence granted under <role refersTo="#authority">the Authority</role>; or<ref href="#sec-38">section 38</ref>, from 3 consecutive meetings of </p>
              </content>
            </paragraph>

              <num>d</num>
              <content>
                <p>a member fails, without reasonable excuse, to comply with subsection 42(1), (2) or (3); or</p>
              </content>

                <p>	(e)	in the case of the Chairperson—the Chairperson fails, without reasonable excuse, to comply with <i>Public Governance, Performance and Accountability Act 2013</i> (which deals with the duty to disclose interests) or rules made for the purposes of that section;<ref href="#sec-29">section 29</ref> of the </p>
              </content>
              <content>
                <p>the Governor-General may terminate the appointment of the member.</p>
              </content>
            </paragraph>
          </subsection>
        </section>
        <section eId="part-VI__sec-42">
          <num>42</num>
          <heading>Disclosure of interests</heading>
          <subsection eId="part-VI__sec-42__subsec-1">
            <num>1</num>
            <content>
              <p>A member who has a direct or indirect pecuniary interest in a matter being considered or about to be considered by <role refersTo="#authority">the Authority</role> shall, as soon as possible after the relevant facts have come to the member’s knowledge, disclose the nature of the interest at a meeting of <role refersTo="#authority">the Authority</role>.</p>
            </content>
          </subsection>
          <subsection eId="part-VI__sec-42__subsec-2">
            <num>2</num>
            <content>
              <p>A disclosure shall be recorded in the minutes of the meeting and the member shall not, unless <role refersTo="#minister">the Minister</role> or <role refersTo="#authority">the Authority</role> otherwise determines:</p>
            </content>
            <paragraph eId="part-VI__sec-42__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>be present during any deliberation of <role refersTo="#authority">the Authority</role> with respect to that matter; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-VI__sec-42__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>take part in any decision of <role refersTo="#authority">the Authority</role> with respect to that matter.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-VI__sec-42__subsec-3">
            <num>3</num>
            <content>
              <p>For the purpose of making such a determination by <role refersTo="#authority">the Authority</role> in relation to a member who has made a disclosure, a member who has a direct or indirect pecuniary interest in the matter to which the disclosure relates shall not:</p>
            </content>
            <paragraph eId="part-VI__sec-42__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>be present during any deliberation of <role refersTo="#authority">the Authority</role> for the purpose of making the determination; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-VI__sec-42__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>take part in making the determination.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-VI__sec-42__subsec-4">
            <num>4</num>
            <content>
              <p>	(4)	Subsections (1) to (3) apply to the Chairperson in addition to <i>Public Governance, Performance and Accountability Act 2013</i> (which deals with the duty to disclose interests).<ref href="#sec-29">section 29</ref> of the </p>
            </content>
          </subsection>
        </section>
        <section eId="part-VI__sec-43">
          <num>43</num>
          <heading>Meetings</heading>
          <subsection eId="part-VI__sec-43__subsec-1">
            <num>1</num>
            <content>
              <p><role refersTo="#authority">The Authority</role> shall hold such meetings as are necessary for the efficient performance of its functions.</p>
            </content>
          </subsection>
          <subsection eId="part-VI__sec-43__subsec-2">
            <num>2</num>
            <content>
              <p>The Chairperson:</p>
            </content>
            <paragraph eId="part-VI__sec-43__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>may convene a meeting at any time; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-VI__sec-43__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>shall convene a meeting on receipt of a written request signed by not less than 2 other members.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-VI__sec-43__subsec-3">
            <num>3</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> may convene a meeting at any time.</p>
            </content>
          </subsection>
          <subsection eId="part-VI__sec-43__subsec-4">
            <num>4</num>
            <content>
              <p>The Chairperson shall preside at all meetings at which he or she is present.</p>
            </content>
          </subsection>
          <subsection eId="part-VI__sec-43__subsec-5">
            <num>5</num>
            <content>
              <p>Where the Chairperson is not present at a meeting, the members present shall appoint one of their number to preside.</p>
            </content>
          </subsection>
          <subsection eId="part-VI__sec-43__subsec-6">
            <num>6</num>
            <content>
              <p>At a meeting, 3 members constitute a quorum, but, subject to subsection (6A), one of them must be the full-time member.</p>
            </content>
          </subsection>
          <subsection eId="part-VI__sec-43__subsec-6A">
            <num>6A</num>
            <content>
              <p>If the full-time member is precluded from being present by <ref href="#sec-42">section 42</ref>, then:</p>
            </content>

                <p>if the full-time member is the Chairperson—any 3 members constitute a quorum; or</p>
              </content>
            </paragraph>

                <p>if the full-time member is not the Chairperson—the Chairperson and any other 2 members constitute a quorum.</p>

              <p>Questions arising at a meeting shall be decided by a majority of the votes of the members present and voting.</p>
            </content>
          </subsection>
          <subsection eId="part-VI__sec-43__subsec-8">

            <content>
              <p>The person presiding at a meeting has a deliberative vote and, if necessary, also has a casting vote.</p>
            </content>
          </subsection>
          <subsection eId="part-VI__sec-43__subsec-9">
            <num>9</num>
            <content>
              <p><role refersTo="#authority">The Authority</role> shall keep minutes of its meetings.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-VI__sec-44">
          <num>44</num>
          <heading>Advisory committees</heading>
          <content>
            <p>On the recommendation of <role refersTo="#authority">the Authority</role>, <role refersTo="#minister">the Minister</role> may appoint committees to give advice to <role refersTo="#authority">the Authority</role> or to assist it in the performance of its functions.</p>
          </content>
        </section>
      </part>

        <num>VII</num>
        <heading>Administration of authority</heading>
        <section eId="part-VII__sec-45">
          <num>45</num>
          <heading>Chief Executive</heading>
          <content>
            <p>There shall be a Chief Executive of <role refersTo="#authority">the Authority</role>, who shall be appointed as provided by section 33.</p>
          </content>
        </section>
        <section eId="part-VII__sec-46">
          <num>46</num>
          <heading>Functions of Chief Executive</heading>
          <subsection eId="part-VII__sec-46__subsec-1">
            <num>1</num>
            <content>
              <p>The Chief Executive has the responsibility of managing the affairs of <role refersTo="#authority">the Authority</role>.</p>
            </content>
          </subsection>
          <subsection eId="part-VII__sec-46__subsec-2">
            <num>2</num>
            <content>
              <p><role refersTo="#authority">The Authority</role> may give written directions to the Chief Executive about the management of <role refersTo="#authority">the Authority</role>’s affairs.</p>
            </content>
          </subsection>
          <subsection eId="part-VII__sec-46__subsec-3">
            <num>3</num>
            <content>
              <p>The Chief Executive must comply with a direction under subsection (2).</p>
            </content>
          </subsection>
          <subsection eId="part-VII__sec-46__subsec-4">
            <num>4</num>
            <content>
              <p>	(4)	Subsection (3) does not apply to the extent that the direction relates to the Chief Executive’s performance of functions or exercise of powers under the <i>Public Service Act 1999</i>.</p>
            </content>
          </subsection>

              <p>	(1)	The staff of the Authority shall be persons engaged under the <i>Public Service Act 1999.</i></p>

          </subsection>
          <subsection eId="part-VII__sec-47__subsec-2">
            <num>2</num>
            <content>
              <p>	(2)	For the purposes of the <i>Public Service Act 1999</i>:</p>
            </content>
            <paragraph eId="part-VII__sec-47__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>the Chief Executive and the APS employees assisting the Chief Executive together constitute a Statutory Agency; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-VII__sec-47__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>the Chief Executive is the Head of that Statutory Agency.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-VII__sec-47__subsec-3">
            <num>3</num>
            <content>
              <p>The Chief Executive may, on behalf of <role refersTo="#authority">the Authority</role>, arrange with a person:</p>
            </content>
            <paragraph eId="part-VII__sec-47__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>for the services of officers or employees of the person to be made available for the purposes of <role refersTo="#authority">the Authority</role>; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-VII__sec-47__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>for the services of a member of the staff of <role refersTo="#authority">the Authority</role> to be made available for the purposes of the person.</p>
              </content>
            </paragraph>
          </subsection>
        </section>
        <section eId="part-VII__sec-48">
          <num>48</num>
          <heading>Consultants</heading>
          <content>
            <p><role refersTo="#authority">The Authority</role> may engage such consultants as it thinks necessary.</p>
          </content>
        </section>
        <section eId="part-VII__sec-49">

          <heading>Delegations</heading>
          <content>
            <p><role refersTo="#authority">The Authority</role> may delegate all or any of its powers under this Act to:</p>
          </content>
          <paragraph eId="part-VII__sec-49__para-a">

            <content>
              <p>the Chief Executive;</p>
            </content>
          </paragraph>
          <paragraph eId="part-VII__sec-49__para-b">
            <num>b</num>
            <content>
              <p>a member of the staff of <role refersTo="#authority">the Authority</role>; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-VII__sec-49__para-c">
            <num>c</num>
            <content>
              <p>a person whose services have been made available under <ref href="#sec-47">section 47</ref>.</p>
            </content>
          </paragraph>
        </section>
      </part>

        <heading>Miscellaneous</heading>
        <section eId="part-VIII__sec-51">
          <num>51</num>
          <heading>Commonwealth to indemnify Territory</heading>
          <subsection eId="part-VIII__sec-51__subsec-1">
            <num>1</num>
            <content>
              <p>The Commonwealth shall indemnify the Territory, and keep the Territory indemnified, against any action, claim or demand brought or made against the Territory in respect of any act done or omitted to be done by or on behalf of the Commonwealth, being an action, claim or demand that, apart from this Act, could be brought or made against the Commonwealth.</p>
            </content>
          </subsection>
          <subsection eId="part-VIII__sec-51__subsec-2">
            <num>2</num>
            <content>
              <p>The indemnity extends to damages, expenses and costs arising from, connected with or consequential upon such an action, claim or demand.</p>
            </content>
          </subsection>

              <p>This section does not apply to an action, claim or demand in respect of a liability referred to in <ref href="#sec-30">section 30</ref>.</p>

          <heading>Regulations</heading>

              <p>The Governor-General may make regulations, not inconsistent with this Act, prescribing matters:</p>

                <p>required or permitted by this Act to be prescribed; or</p>
              </content>
            </paragraph>

                <p>necessary or convenient to be prescribed for carrying out or giving effect to this Act.</p>
              </content>
            </paragraph>
          </subsection>

              <p>In particular, the regulations may provide for:</p>

                <p>the charging and recovery of fees in relation to proposals submitted to <role refersTo="#authority">the Authority</role> for approval under this Act; and</p>

              <content>
                <p>the remission, refund or waiver of those fees, or the exemption of persons from payment of those fees.</p>
              </content>
            </paragraph>
          </subsection>

              <p>The amount of a fee:</p>

              <p>In this Part:</p>
              <p><term refersTo="#term-commencing-day">commencing day</term> means <def>the day on which this Part commences.</def></p>
              <p><term refersTo="#term-finance-minister">Finance Minister</term> means <def>the Minister administering the Public Governance, Performance and Accountability Act 2013.</def></p>
              <p><term refersTo="#term-interim-authority">interim authority</term> means <def>the authority established by the  Planning Ordinance 1988 of the Territory.</def></p>
              <p><term refersTo="#term-national-capital-plan">National Capital Plan</term> means <def>the Plan prepared under <ref href="#part-III">Part III</ref>, and includes a stage or part of that Plan.</def></p>
              <p><term refersTo="#term-ncdc">NCDC</term> means <def>the National Capital Development Commission established under the NCDC Act.</def></p>
              <p><term refersTo="#term-ncdc-act">NCDC Act</term> means <def><ref class="unresolved">the National Capital Development Commission Act 1957</ref>.</def></p>
              <p><term refersTo="#term-ncdc-policy">NCDC policy</term> means <def>a policy that: relates to the planning and development of the Territory; and has been established by the NCDC under the NCDC Act;</def></p>

                <p>relates to the planning and development of the Territory; and</p>
              </content>
            </paragraph>

            <heading>Declaration of end of transition period</heading>

                <p>When the Governor-General is satisfied that the National Capital Plan sufficiently covers the Territory, the Governor-General shall, by Proclamation, declare that the transition period ends on a day specified in the Proclamation.</p>

            </subsection>

              <num>2</num>

                <p>The day specified shall not be later than 2 years after Self-Government Day.</p>
              </content>
            </subsection>

                  <p>a copy of the Proclamation; and</p>

              <num>a</num>

                <p>	(a)	before the commencing day, an NCDC policy was in published form and had been notified in the <i>Commonwealth Gazette</i>; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-X__dvs-3__sec-62__para-b">
              <num>b</num>
              <content>
                <p>the policy was in operation immediately before that day;</p>
              </content>
              <content>
                <p>the policy continues in effect, subject to sections 65 and 66.</p>
              </content>
            </paragraph>
          </section>
          <section eId="part-X__dvs-3__sec-63">

            <heading>Administration of NCDC policies</heading>
            <subsection eId="part-X__dvs-3__sec-63__subsec-1">
              <num>1</num>
              <content>
                <p><role refersTo="#authority">The Authority</role> shall administer each NCDC policy to the extent that it relates to:</p>
              </content>
              <paragraph eId="part-X__dvs-3__sec-63__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>Designated Areas; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-X__dvs-3__sec-63__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>any other functions of <role refersTo="#authority">the Authority</role>.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-X__dvs-3__sec-63__subsec-2">
              <num>2</num>
              <content>
                <p>The Territory planning authority shall administer each NCDC policy to the extent that it does not relate to the matters referred to in subsection (1).</p>
              </content>
            </subsection>
          </section>
          <section eId="part-X__dvs-3__sec-64">
            <num>64</num>
            <heading>Effect of NCDC policies during transition period</heading>
            <content>
              <p>During the transition period, <role refersTo="#authority">the Authority</role>, the Territory or a Territory authority shall not do any act that is inconsistent with an NCDC policy while it is in effect under this Part.</p>
            </content>
          </section>
          <section eId="part-X__dvs-3__sec-65">
            <num>65</num>
            <heading>Variation or revocation of NCDC policies during transition period</heading>
            <subsection eId="part-X__dvs-3__sec-65__subsec-1">
              <num>1</num>
              <content>
                <p>During the transition period, an NCDC policy still in effect may be:</p>
              </content>
              <paragraph eId="part-X__dvs-3__sec-65__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>revoked wholly or partly by the National Capital Plan; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-X__dvs-3__sec-65__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>varied under <ref href="#dvs-4">Division 4</ref> or 5.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-X__dvs-3__sec-65__subsec-2">
              <num>2</num>
              <content>
                <p>If:</p>
              </content>
              <paragraph eId="part-X__dvs-3__sec-65__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>	(a)	a provision of the National Capital Plan (in this subsection called the <b><i>revoking provision</i></b>) has revoked an NCDC policy or part of such a policy; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-X__dvs-3__sec-65__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>the revoking provision is disallowed under <ref href="#sec-22">section 22</ref>;</p>
                </content>
                <content>
                  <p>the disallowance revives the policy, or the part of the policy, as the case may be, from the date of the disallowance as if the revoking provision had not taken effect.</p>
                </content>
              </paragraph>
            </subsection>
          </section>
          <section eId="part-X__dvs-3__sec-66">
            <num>66</num>
            <heading>NCDC policies after transition period</heading>
            <subsection eId="part-X__dvs-3__sec-66__subsec-1">
              <num>1</num>
              <content>
                <p>If:</p>
              </content>
              <paragraph eId="part-X__dvs-3__sec-66__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>at the end of the transition period, an NCDC policy, or part of such a policy, is still in effect;</p>
                </content>
              </paragraph>
              <paragraph eId="part-X__dvs-3__sec-66__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>the policy, or that part of the policy, is such that it could be part of the National Capital Plan; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-X__dvs-3__sec-66__subsec-1__para-c">
                <num>c</num>
                <content>
                  <p>either House of the Parliament, within 6 sitting days of that House after the end of the transition period, passes a resolution that the policy, or that part of the policy, is to become part of the National Capital Plan;</p>
                </content>
                <content>
                  <p>the policy, or that part of the policy, becomes part of the National Capital Plan, and may be varied or revoked accordingly.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-X__dvs-3__sec-66__subsec-2">
              <num>2</num>
              <content>
                <p>On the day after the last day on which a resolution could be passed as described in paragraph (1)(c), an NCDC policy, or part of such a policy, that is still in effect and has not become part of the National Capital Plan under subsection (1) shall be taken to be part of the Territory Plan, and may be varied or revoked accordingly.</p>
              </content>
            </subsection>
          </section>
        </division>

          <num>4</num>
          <heading>Variation of NCDC policies by Authority</heading>

            <num>67</num>
            <heading>Variation of NCDC policies by Authority during transition period</heading>
            <subsection eId="part-X__dvs-4__sec-67__subsec-1">
              <num>1</num>
              <content>
                <p>At any time during the transition period, <role refersTo="#authority">the Authority</role> may vary an NCDC policy if it considers that it is in the interests of the National Capital to do so.</p>
              </content>
            </subsection>
            <subsection eId="part-X__dvs-4__sec-67__subsec-2">
              <num>2</num>
              <content>
                <p>A variation by <role refersTo="#authority">the Authority</role>:</p>
              </content>
              <paragraph eId="part-X__dvs-4__sec-67__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>shall relate to one or more particular blocks or sections of land in the Territory; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-X__dvs-4__sec-67__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>shall be made in accordance with this Division.</p>
                </content>
              </paragraph>
            </subsection>
          </section>
          <section eId="part-X__dvs-4__sec-68">
            <num>68</num>
            <heading>Public consultation</heading>
            <subsection eId="part-X__dvs-4__sec-68__subsec-1">
              <num>1</num>
              <content>
                <p>After preparing a draft variation, <role refersTo="#authority">the Authority</role> shall:</p>
              </content>
              <paragraph eId="part-X__dvs-4__sec-68__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>submit a copy to the Territory planning authority;</p>
                </content>
              </paragraph>
              <paragraph eId="part-X__dvs-4__sec-68__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>	(b)	by notice published in the <i>Commonwealth Gazette</i> and in the principal daily newspaper published and circulated in the Territory:</p>
                </content>
              </paragraph>
              <paragraph eId="part-X__dvs-4__sec-68__subsec-1__para-i">
                <num>i</num>
                <content>
                  <p>state that the draft variation has been prepared, and that copies will be available for public inspection at the places and times, and during the period, specified in the notice; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-X__dvs-4__sec-68__subsec-1__para-ii">
                <num>ii</num>
                <content>
                  <p>invite interested persons to make written representations about the draft variation within a reasonable period specified in the notice and specify the address to which the representations may be forwarded; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-X__dvs-4__sec-68__subsec-1__para-c">
                <num>c</num>
                <content>
                  <p>make the draft variation available for inspection accordingly.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-X__dvs-4__sec-68__subsec-2">
              <num>2</num>
              <content>
                <p><role refersTo="#authority">The Authority</role> shall:</p>
              </content>
              <paragraph eId="part-X__dvs-4__sec-68__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>consult with the Territory planning authority about the draft variation and have regard to any views expressed by it; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-X__dvs-4__sec-68__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>have regard to any representations made by the public;</p>
                </content>
                <content>
                  <p>and, if it thinks fit, may alter the draft variation.</p>
                </content>
              </paragraph>
            </subsection>
          </section>
          <section eId="part-X__dvs-4__sec-69">
            <num>69</num>
            <heading>Submission to Minister for approval</heading>
            <content>
              <p><role refersTo="#authority">The Authority</role> shall submit the draft variation to <role refersTo="#minister">the Minister</role> for approval, together with a written report on its consultations under section 68.</p>
            </content>
          </section>
          <section eId="part-X__dvs-4__sec-70">
            <num>70</num>
            <heading>Minister’s powers</heading>
            <subsection eId="part-X__dvs-4__sec-70__subsec-1">
              <num>1</num>
              <content>
                <p>Subject to subsection (2), on receipt of the draft variation submitted for approval, <role refersTo="#minister">the Minister</role> shall, after such consultation, if any, as <role refersTo="#minister">the Minister</role> thinks necessary:</p>
              </content>
              <paragraph eId="part-X__dvs-4__sec-70__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>approve the draft variation without alteration; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-X__dvs-4__sec-70__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>refer the draft variation to <role refersTo="#authority">the Authority</role> with either or both of the following:</p>
                </content>
              </paragraph>
              <paragraph eId="part-X__dvs-4__sec-70__subsec-1__para-i">
                <num>i</num>
                <content>
                  <p>directions to conduct further consultations;</p>
                </content>
              </paragraph>
              <paragraph eId="part-X__dvs-4__sec-70__subsec-1__para-ii">
                <num>ii</num>
                <content>
                  <p>suggested alterations.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-X__dvs-4__sec-70__subsec-2">
              <num>2</num>
              <content>
                <p>If <role refersTo="#authority">the Authority</role> reports under section 69 that the Territory planning authority objects to any aspect of the draft variation, <role refersTo="#minister">the Minister</role> shall not act under subsection (1) except after consultation with the Executive.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-X__dvs-4__sec-71">
            <num>71</num>
            <heading>Action on referral by Minister</heading>
            <content>
              <p>If <role refersTo="#minister">the Minister</role> refers the draft variation to <role refersTo="#authority">the Authority</role>, <role refersTo="#authority">the Authority</role> shall:</p>
            </content>
            <paragraph eId="part-X__dvs-4__sec-71__para-a">
              <num>a</num>
              <content>
                <p>reconsider the draft variation;</p>
              </content>
            </paragraph>
            <paragraph eId="part-X__dvs-4__sec-71__para-b">
              <num>b</num>
              <content>
                <p>have any further consultations directed by <role refersTo="#minister">the Minister</role> and such other consultations as <role refersTo="#authority">the Authority</role> thinks necessary;</p>
              </content>
            </paragraph>
            <paragraph eId="part-X__dvs-4__sec-71__para-c">
              <num>c</num>
              <content>
                <p>consider any suggestions made by <role refersTo="#minister">the Minister</role>;</p>
              </content>
            </paragraph>
            <paragraph eId="part-X__dvs-4__sec-71__para-d">
              <num>d</num>
              <content>
                <p>if it thinks fit, alter the draft variation; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-X__dvs-4__sec-71__para-e">
              <num>e</num>
              <content>
                <p>re-submit the draft variation to <role refersTo="#minister">the Minister</role> for approval;</p>
              </content>
              <content>
                <p>and subsection 70(1) and, if necessary, this section, apply again.</p>
              </content>

            <heading>Publication and commencement of approved variation</heading>
            <subsection eId="part-X__dvs-4__sec-72__subsec-1">

                <p>	(1)	Where the Minister approves the draft variation, the Minister shall publish notice of the approval in the <i>Commonwealth Gazette </i>and specify the address where copies of the variation may be inspected and bought.</p>

                <p>The variation takes effect on publication of the notice of approval.</p>

                <p>At any time during the transition period, the Territory planning authority may vary an NCDC policy.</p>

            </subsection>
            <subsection eId="part-X__dvs-5__sec-73__subsec-2">

                <p>A variation by the Territory planning authority:</p>
              </content>
              <paragraph eId="part-X__dvs-5__sec-73__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>shall relate to one or more particular blocks or sections of land in the Territory; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-X__dvs-5__sec-73__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>shall be made in accordance with this Division.</p>

            </subsection>

                </content>
              </paragraph>
              <paragraph eId="part-X__dvs-5__sec-74__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>have regard to any representations made by the public;</p>
                </content>
                <content>
                  <p>and, if it thinks fit, may alter the draft variation.</p>
                </content>
              </paragraph>
            </subsection>
          </section>
          <section eId="part-X__dvs-5__sec-75">
            <num>75</num>
            <heading>Submission to Executive for approval</heading>
            <content>
              <p>The Territory planning authority shall submit the draft variation to the Executive for approval, together with a written report on its consultations under <ref href="#sec-74">section 74</ref>.</p>

            <num>76</num>
            <heading>Executive’s powers</heading>
            <content>
              <p>After receipt of the draft variation submitted for approval, the Executive shall, after such consultation, if any, as the Executive thinks necessary:</p>

              <num>a</num>
              <content>
                <p>approve the draft variation without alteration; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-X__dvs-5__sec-76__para-b">

                <p>refer the draft variation to the Territory planning authority with either or both of the following:</p>
              </content>
            </paragraph>
            <paragraph eId="part-X__dvs-5__sec-76__para-i">

                <p>directions to conduct further consultations;</p>

            </paragraph>
            <paragraph eId="part-X__dvs-5__sec-76__para-ii">

            <heading>Action on referral by Executive</heading>

              <p>If the Executive refers the draft variation to the Territory planning authority, <role refersTo="#authority">the authority</role> shall:</p>

              <num>a</num>
              <content>
                <p>reconsider the draft variation;</p>
              </content>
            </paragraph>
            <paragraph eId="part-X__dvs-5__sec-77__para-b">
              <num>b</num>
              <content>
                <p>have any further consultations directed by the Executive and such other consultations as <role refersTo="#authority">the authority</role> thinks necessary;</p>
              </content>
            </paragraph>
            <paragraph eId="part-X__dvs-5__sec-77__para-c">
              <num>c</num>
              <content>
                <p>consider any suggestions made by the Executive;</p>
              </content>
            </paragraph>
            <paragraph eId="part-X__dvs-5__sec-77__para-d">
              <num>d</num>
              <content>
                <p>if it thinks fit, alter the draft variation; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-X__dvs-5__sec-77__para-e">
              <num>e</num>
              <content>
                <p>re-submit the draft variation to the Executive for approval;</p>
              </content>
              <content>
                <p>and <ref href="#sec-76">section 76</ref> and, if necessary, this section, apply again.</p>
              </content>
            </paragraph>
          </section>
          <section eId="part-X__dvs-5__sec-78">
            <num>78</num>
            <heading>Submission to Minister</heading>
            <subsection eId="part-X__dvs-5__sec-78__subsec-1">
              <num>1</num>

                <p>If the Executive approves the draft variation, the Executive shall submit it to <role refersTo="#minister">the Minister</role>.</p>
              </content>
            </subsection>
            <subsection eId="part-X__dvs-5__sec-78__subsec-2">
              <num>2</num>
              <content>
                <p><quantity refersTo="#deadline">Within 14 days</quantity> after receipt of the draft variation, the Minister may give a certificate in writing that, in the interests of the National Capital, it would be undesirable to approve the variation.</p>
              </content>
            </subsection>
            <subsection eId="part-X__dvs-5__sec-78__subsec-3">
              <num>3</num>
              <content>

          <heading>Transfers following repeal of NCDC Act</heading>

            <heading>Transfer of persons employed by NCDC</heading>
            <content>
              <p>		For the purposes of the application of subsection 81B(3) of the <i>Public Service Act 1922 </i>a person who, immediately before the repeal of the NCDC Act by this Act:</p>
            </content>
            <paragraph eId="part-X__dvs-7__sec-81__para-a">
              <num>a</num>
              <content>
                <p>was employed by the NCDC; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-X__dvs-7__sec-81__para-b">
              <num>b</num>
              <content>
                <p>	(b)	was an unattached officer for the purposes of the <i>Public Service Act 1922</i>;</p>
              </content>
              <content>
                <p>shall be taken to have ceased, immediately before that repeal, to be a person appointed or employed under the <i>Public Service Act 1922.</i></p>
              </content>
            </paragraph>
          </section>
          <section eId="part-X__dvs-7__sec-82">
            <num>82</num>
            <heading>Contracts</heading>
            <content>
              <p>Where, immediately before the repeal of the NCDC Act, a contract was subsisting and the NCDC was a party to the contract, the Commonwealth is substituted for the NCDC as a party to the contract.</p>

          </section>
          <section eId="part-X__dvs-7__sec-83">
            <num>83</num>
            <heading>Assets, rights and liabilities</heading>
            <subsection eId="part-X__dvs-7__sec-83__subsec-1">
              <num>1</num>
              <content>
                <p>Subject to <role refersTo="#minister">the Minister</role>.<ref href="#sec-82">section 82</ref>, assets, rights and liabilities of the NCDC existing immediately before the repeal of the NCDC Act vest in a body or bodies specified in writing by </p>
              </content>
            </subsection>
            <subsection eId="part-X__dvs-7__sec-83__subsec-2">
              <num>2</num>
              <content>
                <p>In specifying a body for the purposes of subsection (1), <role refersTo="#minister">the Minister</role> shall have regard to which body or bodies will perform the relevant functions of the NCDC after the repeal of the NCDC Act.</p>

            </subsection>
            <subsection eId="part-X__dvs-7__sec-83__subsec-3">
              <num>3</num>
              <content>
                <p>In this section:</p>

                <p><b><i>body</i></b> includes the Commonwealth.</p>

            <num>84</num>
            <heading>Court proceedings</heading>
            <content>
              <p>Where:</p>
            </content>
            <paragraph eId="part-X__dvs-7__sec-84__para-a">
              <num>a</num>
              <content>
                <p>proceedings in a court by or against the NCDC were pending immediately before the repeal of the NCDC Act; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-X__dvs-7__sec-84__para-b">
              <num>b</num>
              <content>
                <p>the proceedings concern a right or liability vested in the Commonwealth or another body, or both, under <ref href="#sec-82">section 82</ref> or 83;</p>
              </content>
              <content>
                <p>the proceedings may be continued, subject to the direction of the court, by or against the Commonwealth, that other body, or both, as the case requires.</p>
              </content>
            </paragraph>
          </section>
          <section eId="part-X__dvs-7__sec-85">
            <num>85</num>
            <heading>Transfer of appropriated money</heading>
            <subsection eId="part-X__dvs-7__sec-85__subsec-1">
              <num>1</num>
              <content>
                <p>Where any money has been, or is, appropriated by an Appropriation Act for the purposes of the NCDC, the Act shall be taken to have appropriated, or to appropriate, the money for the purposes of the Department of Administrative Services as set out in Subdivision 6 of <ref href="#dvs-805">Division 805</ref> in the relevant Schedule to that Act.</p>
              </content>
            </subsection>
            <subsection eId="part-X__dvs-7__sec-85__subsec-2">
              <num>2</num>
              <content>
                <p>The money shall be apportioned between any or all of the items of that Subdivision as the Finance Minister determines in writing.</p>
              </content>
            </subsection>
            <subsection eId="part-X__dvs-7__sec-85__subsec-3">
              <num>3</num>
              <content>
                <p>This section does not apply to:</p>
              </content>
              <paragraph eId="part-X__dvs-7__sec-85__subsec-3__para-a">
                <num>a</num>
                <content>
                  <p>money drawn by the NCDC before the repeal of the NCDC Act; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-X__dvs-7__sec-85__subsec-3__para-b">
                <num>b</num>
                <content>
                  <p>money paid or payable at any time in discharge of expenditure incurred by the NCDC before the repeal of the NCDC Act.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-X__dvs-7__sec-85__subsec-4">
              <num>4</num>
