          <heading>Short title</heading>
          <content>
            <p>		This Act may be cited as the <i>Remuneration and Allowances Act 1990</i>.</p>
          </content>
        </section>

          <num>2</num>
          <heading>Commencement</heading>
          <subsection eId="part-1__sec-2__subsec-1">
            <num>1</num>
            <content>
              <p>Subject to subsection (2), this Act commences on the day on which it receives the Royal Assent.</p>
            </content>
          </subsection>
          <subsection eId="part-1__sec-2__subsec-2">
            <num>2</num>
            <content>
              <p><date date="1990-07-01">1 July 1990</date>.<ref href="#part-3">Part 3</ref> commences on </p>

        <heading>Remuneration and allowances</heading>
        <section eId="part-2__sec-3">
          <num>3</num>
          <heading>Operation of Part</heading>
          <subsection eId="part-2__sec-3__subsec-1">
            <num>1</num>
            <content>
              <p>This Part has effect in spite of:</p>
            </content>
            <paragraph eId="part-2__sec-3__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>anything in any Determination of the Remuneration Tribunal made on or before <date date="1990-06-01">1 June 1990</date>; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-3__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>	(b)	any provision of an Act, being a provision providing for the remuneration or allowances of the holder of an office to be determined by the Remuneration Tribunal (including <i>Workplace Relations Act 1996</i>); or<ref href="#sec-21">section 21</ref> of the </p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-3__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>	(c)	any provision in the <i>Judicial and Statutory Officers (Remuneration and Allowances) Act 1984</i> that is inconsistent with this Part.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-3__subsec-2">
            <num>2</num>
            <content>
              <p>Where, after <date date="1990-06-01">1 June 1990</date>, the Remuneration Tribunal has made, or makes, a Determination that is inconsistent with a provision of this Act:</p>
            </content>
            <paragraph eId="part-2__sec-3__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>subject to subsection (3), the Determination operates according to its terms in spite of the provision of this Act; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-3__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>the provision of this Act ceases to operate.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-3__subsec-3">
            <num>3</num>
            <content>
              <p>A Determination referred to in subsection (2) that purports to take effect from a day earlier than <date date="1990-06-01">1 June 1990</date> takes effect on <date date="1990-06-01">1 June 1990</date>.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-3__subsec-4">
            <num>4</num>
            <content>
              <p>	(4)	Where a resolution disapproving of a Determination referred to in subsection (2) is passed as mentioned in subsection 7(8) of the <i>Remuneration Tribunal Act 1973</i>, the provision of the Act overridden by the Determination operates with effect from the day on which the resolution is passed.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-2__sec-3A">
          <num>3A</num>
          <heading>Operation of Remuneration Tribunal Determination</heading>
          <content>
            <p>Determination No. 12 of 1994 of the Remuneration Tribunal, dated <date date="1994-06-30">30 June 1994</date>, does not operate on or after the date of commencement of this section.</p>
          </content>
        </section>
        <section eId="part-2__sec-4">
          <num>4</num>
          <heading>Remuneration and allowances of holders of judicial offices etc.</heading>
          <content>
            <p>The holders of the offices specified in Schedule 1 are entitled to remuneration and allowances in accordance with the provisions of that Schedule.</p>
          </content>
        </section>
        <section eId="part-2__sec-5">
          <num>5</num>
          <heading>Remuneration and allowances of Secretaries of Departments and holders of public offices</heading>
          <content>
            <p>The holders of the offices specified in Schedule 2 are entitled to remuneration and allowances in accordance with the provisions of that Schedule.</p>
          </content>
        </section>
        <section eId="part-2__sec-8">
          <num>8</num>
          <heading>Appropriation</heading>
          <content>
            <p>The salaries, allowances and contributions payable under this Act are to be paid out of the Consolidated Revenue Fund, and the Fund is accordingly appropriated for that purpose.</p>

        </section>
        <section eId="part-2__sec-8A">
          <num>8A</num>
          <heading>Regulations</heading>
          <content>
            <p>The Governor-General may make regulations prescribing matters:</p>
          </content>
          <paragraph eId="part-2__sec-8A__para-a">
            <num>a</num>
            <content>
              <p>required or permitted by this Act to be prescribed; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-8A__para-b">
            <num>b</num>
            <content>
              <p>necessary or convenient to be prescribed for carrying out or giving effect to this Act.</p>
            </content>
          </paragraph>

          <heading>Holders of Judicial and other offices</heading>
          <content>
            <p>Section 4</p>
            <p>1.	In respect of the period starting on <date date="1990-01-01">1 January 1990</date> and ending on <date date="1990-06-30">30 June 1990</date>, the holders of the offices specified in this Schedule are taken to have been, and to be, entitled to remuneration and allowances at the rates, and subject to the conditions, that would have been applicable to them from <date date="1990-01-01">1 January 1990</date> if Determination No. 11 of the Remuneration Tribunal dated <date date="1990-05-23">23 May 1990</date> had not been made.</p>
            <p>2.	In respect of periods from or after <date date="1990-07-01">1 July 1990</date>, the holders of the offices specified in this Schedule are entitled to salary at the rates set out below with effect from the dates specified.</p>
            <p>3.	Additional Remuneration</p>
            <p>A Judge who is also Aboriginal Land Commissioner, Chairperson of the Australian Electoral Commission, Chief Judge of the Supreme Court of Norfolk Island, President of the Administrative Appeals Tribunal, President of the Law Reform Commission or President of the Australian Competition Tribunal is to receive $750 per annum in addition to the rate per annum of salary of the office of Judge.</p>
            <p>4.	High Court Canberra Allowance</p>
            <p>An allowance at the rate of $16,524 per annum is payable from <date date="1989-12-05">5 December 1989</date> to the Chief Justice and Justices of the High Court of Australia who do not establish their places of residence in Canberra.</p>
            <p>5.	Travelling Allowance</p>
            <p>The rates and conditions of payment of travelling allowance for holders of offices specified in Parts 1 and 2 of clause 2, President of the Administrative Appeals Tribunal, President of the Australian Competition Tribunal, President of the Law Reform Commission, President of the Australian Industrial Relations Commission and Deputy Presidents of the Australian Industrial Relations Commission are as determined in Determination No. 3 of 1990 of the Remuneration Tribunal. The rates of payment of travelling allowance for Commissioners of the Australian Industrial Relations Commission are as determined in Determination No. 18 of 1989 of the Remuneration Tribunal. Other office holders are to have the same rates and conditions of payment of travelling allowance as are determined in clause 4.1 of <ref href="#part-4">Part 4</ref> of Determination No. 2 of 1990 of the Remuneration Tribunal.</p>
            <p>6.	Wage Adjustments</p>
            <p>The rates of salary specified in clause 2 are to be adjusted in accordance with safety net review decisions relating to allowances made by the Australian Industrial Relations Commission after the commencement of this Act.</p>
            <p>7.	Annual Leave Loading</p>
            <p>An annual leave loading is payable to:</p>
            <p>on the same terms and conditions applying to persons engaged under the <i>Public Service Act 1999</i>.</p>

              <p>the holder of an office specified in <ref href="#part-4">Part 4</ref> of clause 2; and</p>
            </content>

              <p>the holder of an office of Commissioner, Australian Industrial Relations Commission;</p>

          <heading>Secretaries of Departments and holders of public offices</heading>

            <p>Section 5</p>
            <p>1.	Subject to clause 2, in respect of the period starting on <date date="1990-01-01">1 January 1990</date> and ending on <date date="1990-06-30">30 June 1990</date>, the holders of the offices specified in this Schedule are taken to have been, and to be, entitled to remuneration and allowances at the rates, and subject to the conditions, that would have been applicable to them from <date date="1990-01-01">1 January 1990</date> if Determination No. 12 of the Remuneration Tribunal dated <date date="1990-05-23">23 May 1990</date> had not been made.</p>
            <p>2.	(1)	In respect of the period:</p>
            <p>the holder of that office is taken to have been, and to be, entitled to salary at the rate set out below.</p>
            <p>3.	With effect from <date date="1990-07-01">1 July 1990</date>, the holders of the offices specified in this Schedule are entitled to salary at the rates set out below.</p>
            <p>
              <b>Salaries</b>
            </p>
            <p>4.	The rates of salary specified in clause 3 as applicable from <date date="1990-07-01">1 July 1990</date> are to be adjusted in accordance with:</p>
            <p>5.	An annual leave loading is payable to Secretaries of Departments and holders of full-time Public Offices on the same terms and conditions applying to persons engaged under the <i>Public Service Act 1999</i>.</p>
            <p>6.	Where a Secretary of a Department or a holder of a full-time Public Office holds an office located in a region or district which is classified for the purposes of District Allowance, the holder of the office is to be paid a District Allowance at the rates and on the conditions prescribed for officers of the Australian Public Service.</p>
            <p>7.	The rates and conditions of payment of travelling allowance for the holders of offices specified in clause 3 are as determined in <ref href="#part-4">Part 4</ref> of Determination No. 2 of 1990 and in <ref href="#part-1">Part 1</ref> of Determination No. 18 of 1989 of the Remuneration Tribunal.</p>

            </p>
            <p>The <i>Legislation Act 2003</i> authorises First Parliamentary Counsel to make editorial and presentational changes to a compiled law in preparing a compilation of the law for registration. The changes must not change the effect of the law. Editorial changes take effect from the compilation registration date.</p>

              <b>Misdescribed amendments</b>
            </p>
            <p>A misdescribed amendment is an amendment that does not accurately describe the amendment to be made. If, despite the misdescription, the amendment can be given effect as intended, the amendment is incorporated into the compiled law and the abbreviation “(md)” added to the details of the amendment included in the amendment history.</p>
            <p>If a misdescribed amendment cannot be given effect as intended, the abbreviation “(md not incorp)” is added to the details of the amendment included in the amendment history.</p>
