          <p>The Parliament of Australia enacts:</p>

        <heading>INTRODUCTORY</heading>

          <heading>Short tide</heading>
          <content>
            <p><b>1. </b>This Act may be cited as the <i>Law and Justice Legislation Amendment Act 1991.</i></p>
            <p>
              <b>Commencement</b>
            </p>
            <p><b>2.(1) </b>Subject to this section, this Act commences on the 28th day after the day on which it receives the Royal Assent.</p>
          </content>

            <b>Application and savings</b>
          </p>
          <p><b>3.(1) </b>A direction under section 35A of the <i>Australian Capital Territory Supreme Court Act 1933 </i>that was in force immediately before the commencement of this subsection has effect after that commencement as if it were a direction under that section as amended by this Act.</p>

            <p>The amendment of <ref href="#sec-19">section 19</ref> of <ref class="unresolved">the Bills of Exchange Act 1909</ref> made by this Act does not apply to bills of exchange and promissory notes in existence before the commencement of this subsection.</p>

          <item eId="part-4 commences on 24 September 1991.__list-2__item-2">
            <p>A declaration under <ref href="#sec-8">section 8</ref> of <ref href="">the Statutory Declarations Act 1959</ref> that was in force immediately before the commencement of this subsection has effect after that commencement as if it were made under that section as amended by this Act.</p>

          <item eId="part-4 commences on 24 September 1991.__list-2__item-3">
            <p>In spite of anything in this Act, a person who held office as a Commissioner for Declarations under <ref href="">the Statutory Declarations Act 1959</ref> immediately before the commencement of this subsection continues to hold that office after that commencement during the Attorney-General’s pleasure.</p>

        <heading>AMENDMENTS OF THE AUSTRALIAN SECURITY INTELLIGENCE ORGANIZATION ACT 1979</heading>
        <section eId="part-2__sec-4">
          <num>4</num>
          <heading>Principal Act</heading>
          <content>
            <p><b>4.</b><b>	</b>In this Part, <b>“</b><b>Principal Act</b><b>”</b><b> </b>means the <i>Australian Security</i><i> </i><i>Intelligence Organization Act 1979</i><sup>1</sup><i>.</i></p>
          </content>
        </section>

          <num>5</num>
          <heading>Interpretation</heading>
          <content>
            <p><b>5.</b><b>	</b>Section 4 of the Principal Act is amended:</p>
            <p><b>(a)</b> by inserting “, the <i>Crimes (Hostages) Act 1989</i>”<i> </i>after “<i>1972</i>”</p>
            <p>in paragraph (c) of the definition of “politically motivated violence”;</p>
            <p><b>(b)</b>	by omitting the definitions of “State” and “Territory” and substituting respectively the following definitions:</p>
            <p>“ <b>‘</b><b>State</b><b>’</b> includes the Australian Capital Territory and the Northern Territory;</p>
            <p><b>‘</b><b>Territory</b><b>’</b><b> </b>does not include the Australian Capital Territory or the Northern Territory;”;</p>
            <p><b>(c)</b>	by inserting the following definitions:</p>
            <p>“ <b>‘</b><b>certified copy</b><b>’</b><b>, </b>in relation to a warrant or an instrument revoking a warrant, means a copy of the warrant or instrument that has been certified in writing by the Director-General or a Deputy Director-General to be a true copy of the warrant or instrument;</p>
            <p><b>‘</b><b>Deputy Director-General</b><b>’</b><b> </b>means an officer of the Organization who holds office as Deputy Director-General of Security;”.</p>

        </section>

          <num>6</num>
          <heading>Inspection of postal articles</heading>
          <content>
            <p><b>6.</b><b>	</b>Section 27 of the Principal Act is amended by omitting subsection (6) and substituting the following subsections:</p>
            <p>“(6) Where the Director-General is informed under <ref href="#sec-32">section 32</ref> of the issue of a warrant under this section, the Director-General must:</p>

              <p>cause the Australian Postal Corporation to be informed of the issue of the warrant without delay; and</p>
            </item>
            <item eId="part-2__sec-6__list-1__item-2">
              <p>where, under <ref href="#sec-32">section 32</ref>, the Director-General receives the warrant—cause a certified copy of the warrant to be given to the Australian Postal Corporation as soon as practicable.</p>
            </item>

              <p>where, under <ref href="#sec-32">section 32</ref>, the Director-General receives the instrument of revocation—cause a certified copy of the instrument of revocation to be given to the Australian Postal Corporation as soon as practicable.”.</p>

          <heading>Warrants for the performance of functions under paragraph 17(1)(e)</heading>
          <content>
            <p><b>7.</b><b>	</b>Section 27A of the Principal Act is amended by omitting subsection (6) and substituting the following subsections:</p>
            <p>“(6) Where the Director-General is informed under <ref href="#sec-32">section 32</ref> of the issue of a warrant under this section authorising the doing of acts</p>
            <p>or things referred to in subsection 27(2) or (3), the Director-General must:</p>
          </content>

              <p>cause the Australian Postal Corporation to be informed of the issue of the warrant without delay; and</p>
            </item>

              <p>where, under <ref href="#sec-32">section 32</ref>, the Director-General receives the warrant—cause a certified copy of the warrant to be given to the Australian Postal Corporation as soon as practicable.</p>
            </item>

              <p>the Director-General is informed under <ref href="#sec-32">section 32</ref> that the warrant has been revoked;</p>
            </item>

        <heading>AMENDMENTS OF THE PRIVACY ACT 1988</heading>
        <section eId="part-3__sec-10">
          <num>10</num>
          <heading>Principal Act</heading>
          <content>
            <p><b>10.</b><b>	</b>In this Part, <b>“</b><b>Principal Act</b><b>”</b><b> </b>means the <i>Privacy Act 1988</i><sup>2</sup><i>.</i></p>
          </content>
        </section>
        <section eId="part-3__sec-11">
          <num>11</num>
          <heading>Interpretation</heading>
          <content>
            <p><b>11.</b><b>	</b>Section 6 of the Principal Act is amended by omitting from the definition of <b>“</b><b>credit reporting business</b><b>”</b><b> </b>in subsection (1) “, or for purposes that include the purpose, of” and substituting “of, or for purposes that include as the dominant purpose the purpose of,”.</p>

        </section>
        <section eId="part-3__sec-12">
          <num>12</num>
          <heading>Credit providers</heading>
          <content>
            <p><b>12.</b><b>	</b>Section 11B of the Principal Act is amended by adding at the end the following subsections:</p>
            <p><b>“</b><b>(5)</b> Subject to subsection (6), while a person is acting as an agent of a credit provider in performing, on behalf of the credit provider, a task that is necessary:</p>
          </content>

              <p>in processing an application for a loan; or</p>
            </item>
            <item eId="part-3__sec-12__list-1__item-2">
              <p>in managing:</p>
            </item>
          </blockList>

            <p>(i) a loan given by the credit provider; or</p>
            <p>(ii) an account maintained by any person with the credit provider;</p>
            <p>the first-mentioned person:</p>
          </content>
          <blockList eId="part-3__sec-12__list-2">
            <item eId="part-3__sec-12__list-2__item-1">
              <p>is taken, for the purposes of this Act, to be another credit provider; and</p>
            </item>
            <item eId="part-3__sec-12__list-2__item-2">
              <p>is subject to the same obligations under this Act as any other credit provider.</p>
            </item>
          </blockList>
          <content>
            <p>“<b>(6)</b> Nothing in this Act prevents such an agent of a credit provider disclosing to the credit provider, in the agent’s capacity as such an agent, a report (within the meaning of subsection 18N(9)) to which section 18N applies.</p>
            <p>“<b>(7)</b> The reference in subsection (5) to the management of a loan does not include a reference to any act relating to the collection of payments that are overdue in respect of the loan.”.</p>

        </section>
        <section eId="part-3__sec-13">
          <num>13</num>
          <heading>Access to credit information files and credit reports</heading>
          <content>
            <p><b>13.</b><b>	</b>Section 18H of the Principal Act is amended by adding at the end the following subsection:</p>
            <p>“<b>(3)</b> An individual’s rights of access under this section may also be exercised by a person (other than a credit provider, mortgage insurer or trade insurer) authorised, in writing, by the individual to exercise those rights on the individual’s behalf in connection with:</p>
          </content>

              <p>an application, or a proposed application, by the individual for a loan; or</p>
            </item>
            <item eId="part-3__sec-13__list-1__item-2">
              <p>the individual having sought advice in relation to a loan.”.</p>
            </item>

        <section eId="part-3__sec-14">
          <num>14</num>
          <heading>Limits on disclosure of personal information by credit reporting agencies</heading>
          <content>
            <p><b>14.</b><b>	</b>Section 18K of the Principal Act is amended:</p>
          </content>

            <item eId="part-3__sec-14__list-1__item-1">
              <p>by omitting from paragraph (1)(b) “, in writing,”;</p>
            </item>
            <item eId="part-3__sec-14__list-1__item-2">
              <p>by inserting after subsection (1) the following subsection:</p>
            </item>

            <p>“(1A) For the purposes of paragraph (1)(b), the individual’s agreement to the report being given to the credit provider must be in writing unless:</p>
          </content>

              <p>the report is requested for the purpose of assessing an application for commercial credit that was at first instance made orally; and</p>
            </item>
            <item eId="part-3__sec-14__list-2__item-2">
              <p>the application has not yet been made in writing.”;</p>
            </item>
          </blockList>
          <content>
            <p><b>(c)</b> by adding at the end of subsection (6) “(other than information that the credit reporting agency is permitted under section 18E to include in the individual’s credit information file)”.</p>
          </content>
        </section>
        <section eId="part-3__sec-15">
          <num>15</num>
          <heading>Limits on use by credit providers of present information contained in credit reports etc.</heading>
          <content>
            <p><b>15.</b><b>	</b>Section 18L of the Principal Act is amended:</p>
            <p><b>(a)</b>	by inserting after paragraph (1)(b) the following paragraph:</p>
            <p>“(ba) the report was obtained under paragraph 18K(1)(a), (b) or (c) and the credit provider uses the report or information for the internal management purposes of the credit provider, being purposes directly related to the provision or management of loans by the credit provider; or”;</p>

              <p>by omitting from subsection (4) “, in writing,”;</p>
            </item>

            <p>“(4A) For the purposes of subsection (4), the individual’s agreement to the information being obtained by the credit provider must be in writing unless:</p>

              <p>the information is obtained for the purpose of assessing an application for credit that was at first instance made orally; and</p>
            </item>

            </item>

            <p><b>16.</b>	Section 18M of the Principal Act is repealed and the following section is substituted:</p>
            <p>
              <b>Information to be given if an individual</b>
              <b>’</b>
              <b>s application for credit is refused</b>
            </p>
            <p>“18M.(1) If:</p>
          </content>

            <item eId="part-3__sec-15__list-3__item-1">
              <p>a credit provider refuses an application by an individual for credit (including an application made jointly by that individual and one or more other persons); and</p>
            </item>
            <item eId="part-3__sec-15__list-3__item-2">
              <p>the refusal is based wholly or partly on information derived from a credit report relating to that individual that a credit reporting agency has given to the credit provider for the purpose of assessing the application;</p>
            </item>
          </blockList>
          <content>
            <p>the credit provider must give the individual a written notice:</p>
            <p>(c)	stating:</p>
            <p>(i) that the application has been refused; and</p>
            <p>(ii) that the refusal was based wholly or partly, as the case</p>
            <p>requires, on information derived from a credit report relating to that individual that a credit reporting agency has given to the credit provider; and</p>
            <p>(iii) the name and address of the credit reporting agency; and</p>
            <p>(d) notifying that individual of his or her right under this Act to obtain access to his or her credit information file maintained by the credit reporting agency.</p>
            <p>“(2) If:</p>

            <p>(iii) for any purpose arising under a contract for mortgage insurance that has been entered into between the credit provider and the mortgage insurer; or</p>
            <p>(bc) the report or information is disclosed:</p>
            <p>(i) to a person or body generally recognised and accepted in the community as being a person appointed, or a body established, for the purpose of settling disputes between credit providers, acting in their capacity as credit providers, and their customers; and</p>
            <p>(ii) for the purpose of settling a dispute between the credit provider and the individual concerned; or</p>
            <p>(bd)	the report or information is disclosed:</p>
            <p>(i) to an authority of a State or Territory whose functions include giving assistance (directly or indirectly) that facilitates the giving of mortgage credit to individuals; and</p>
            <p>(ii) for the purpose of enabling <role refersTo="#authority">the authority</role> to determine the extent of assistance (if any) it will give in relation to the giving of mortgage credit to the individual concerned; or</p>
            <p>(be)	the report or information:</p>
            <p>(i) is disclosed to a person or body carrying on a business of supplying goods or services; and</p>
            <p>(ii) is disclosed for the purpose of enabling that person or body to decide whether to accept, as payment for goods or services supplied to the individual concerned, payment by means of credit card or electronic transfer of funds; and</p>
            <p>(iii) does not contain or include any personal information derived from a credit report, other than:</p>

            <p>(i) in connection with an application for mortgage credit by the individual concerned, being credit that the credit provider proposes will be funded by means of an arrangement involving mortgage securitisation; and</p>
            <p>(ii) to a person or body that carries on a business that is involved in the funding of mortgage credit by means of such arrangements; and</p>
            <p>(iii) for the purpose of enabling the person or body to perform a task that is necessary in the funding of the mortgage credit concerned by means of that arrangement;</p>
            <p>and the individual concerned has specifically agreed to the disclosure of the report or information to any such person or body for that purpose; or”;</p>
            <p><b>(c)</b>	by inserting after paragraph (1)(g) the following paragraph:</p>
            <p>“(ga) the report or information is given to:</p>
            <p>(i) the individual; or</p>
            <p>(ii) a person (other than a credit provider, mortgage insurer or trade insurer) authorised, in writing, by the individual to seek access to the report or information; or”;</p>
            <p>(d)	by inserting after subsection (1) the following subsections:</p>
            <p>“(1A) For the purposes of paragraph (1)(b), the individual’s agreement to the disclosure of the report or information to another credit provider:</p>
            <p>(a)	must be in writing unless:</p>
            <p>(i) the disclosure is sought for the purpose of assessing an application for credit or commercial credit that was initially made orally; and</p>
            <p>(ii) the application has not yet been made in writing; and</p>
            <p>(b)	must be given to:</p>
            <p>(i) the credit provider with possession or control of the report or information; or</p>
            <p>(ii) the other credit provider.</p>
            <p>“(1B) For the purposes of paragraph (1)(bg), the individual’s agreement to the disclosure of the report or information must be in writing unless:</p>
