        <heading>Short title</heading>
        <content>
          <p>		This Act may be cited as the <i>Marine Navigation (Regulatory Functions) Levy Act 1991</i>.</p>
        </content>

        <num>2</num>
        <heading>Commencement</heading>
        <content>
          <p>This Act commences on <date date="1991-07-01">1 July 1991</date>.</p>
        </content>
      </section>
      <section eId="sec-3">
        <num>3</num>
        <heading>Definitions</heading>
        <content>
          <p>In this Act, unless the contrary intention appears:</p>
          <p><term refersTo="#term-collection-act">Collection Act</term> means <def>the Marine Navigation (Regulatory Functions) Levy Collection Act 1991.</def></p>
          <p><term refersTo="#term-ton">ton</term> means <def>a whole ton.</def></p>
          <p><b><i>tonnage</i></b>, in relation to a ship, means:</p>

          <num>a</num>
          <content>
            <p>where the net tonnage of the ship has been determined by a method consistent with the provisions of the International Convention on Tonnage Measurement of Ships, 1969—the net tonnage so determined; or</p>
          </content>
        </paragraph>
        <paragraph eId="sec-3__para-b">
          <num>b</num>
          <content>
            <p>in any other case—the net registered tonnage of the ship.</p>

        <num>4</num>
        <heading>Interpretation</heading>
        <content>
          <p>In this Act, expressions have the same meaning as in the Collection Act.</p>
        </content>
      </section>
      <section eId="sec-5">
        <num>5</num>
        <heading>Application to Crown</heading>
        <content>
          <p>This Act binds the Crown in right of each of the States, of the Australian Capital Territory and of the Northern Territory.</p>
        </content>
      </section>
      <section eId="sec-6">
        <num>6</num>
        <heading>Imposition of levy</heading>
        <content>
          <p>Levy payable in respect of a sea-going ship in accordance with the Collection Act is imposed.</p>
        </content>
      </section>
      <section eId="sec-7">
        <num>7</num>
        <heading>Amount of levy</heading>
        <subsection eId="sec-7__subsec-1">
          <num>1</num>
          <content>
            <p>Where levy is payable in respect of a ship, the amount of levy is the amount, or the total of the amounts, worked out using whichever of the levy rates apply to the ship.</p>
          </content>
        </subsection>
        <subsection eId="sec-7__subsec-2">
          <num>2</num>
          <content>
            <p>For the purposes of this Act, each of the following rates is a levy rate in relation to a ship:</p>
          </content>
          <paragraph eId="sec-7__subsec-2__para-a">
            <num>a</num>
            <content>
              <p>4 cents, or such other amount as is from time to time prescribed, for each of the first 5,000 tons of the ship’s tonnage;</p>
            </content>
          </paragraph>
          <paragraph eId="sec-7__subsec-2__para-b">
            <num>b</num>
            <content>
              <p>3 cents, or such other amount as is from time to time prescribed, for each ton by which the ship’s tonnage is more than 5,000 tons but not more than 20,000 tons;</p>
            </content>
          </paragraph>
          <paragraph eId="sec-7__subsec-2__para-c">
            <num>c</num>
            <content>
              <p>3 cents, or such other amount as is from time to time prescribed, for each ton by which the ship’s tonnage is more than 20,000 tons but not more than 50,000 tons;</p>
            </content>
          </paragraph>
          <paragraph eId="sec-7__subsec-2__para-d">
            <num>d</num>
            <content>
              <p>2 cents, or such other amount as is from time to time prescribed, for each ton by which the ship’s tonnage is more than 50,000 tons.</p>

        </subsection>
      </section>

        <num>8</num>
        <heading>Regulations</heading>
        <subsection eId="sec-8__subsec-1">
          <num>1</num>
          <content>
            <p>Subject to subsection (2), the Governor-General may make regulations for the purposes of subsection 7(2).</p>
          </content>
        </subsection>
        <subsection eId="sec-8__subsec-2">
          <num>2</num>
          <content>
            <p>After <date date="1993-06-30">30 June 1993</date>, an amount applicable under paragraph 7(2)(a), (b), (c) or (d) must not be increased by more than 15% in any 12 consecutive months.</p>

              <b>Editorial changes</b>
            </p>
            <p>The <i>Legislation Act 2003</i> authorises First Parliamentary Counsel to make editorial and presentational changes to a compiled law in preparing a compilation of the law for registration. The changes must not change the effect of the law. Editorial changes take effect from the compilation registration date.</p>
            <p>If the compilation includes editorial changes, the endnotes include a brief outline of the changes in general terms. Full details of any changes can be obtained from the Office of Parliamentary Counsel.</p>

              <b>Misdescribed amendments</b>
            </p>
            <p>A misdescribed amendment is an amendment that does not accurately describe the amendment to be made. If, despite the misdescription, the amendment can be given effect as intended, the amendment is incorporated into the compiled law and the abbreviation “(md)” added to the details of the amendment included in the amendment history.</p>
            <p>If a misdescribed amendment cannot be given effect as intended, the abbreviation “(md not incorp)” is added to the details of the amendment included in the amendment history.</p>
