          <heading>Short title</heading>
          <content>
            <p>		This Act may be cited as the <i>International Air Services Commission Act 1992</i>.</p>
          </content>
        </section>

          <num>2</num>
          <heading>Commencement</heading>
          <content>
            <p>This Act commences on <date date="1992-07-01">1 July 1992</date>.</p>
          </content>
        </section>
        <section eId="part-1__sec-3">
          <num>3</num>
          <heading>Object of Act</heading>
          <content>
            <p>The object of this Act is to enhance the welfare of Australians by promoting economic efficiency through competition in the provision of international air services, resulting in:</p>
          </content>
          <paragraph eId="part-1__sec-3__para-a">
            <num>a</num>
            <content>
              <p>increased responsiveness by airlines to the needs of consumers, including an increased range of choices and benefits; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-b">
            <num>b</num>
            <content>
              <p>growth in Australian tourism and trade; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-c">
            <num>c</num>
            <content>
              <p>the maintenance of Australian carriers capable of competing effectively with airlines of foreign countries.</p>
            </content>
          </paragraph>
        </section>
        <section eId="part-1__sec-4">
          <num>4</num>
          <heading>Interpretation</heading>
          <subsection eId="part-1__sec-4__subsec-1">
            <num>1</num>
            <content>
              <p>In this Act, unless the contrary intention appears:</p>
            </content>
            <content>
              <p><term refersTo="#term-another-country">another country</term> includes <def>any region: that is part of a foreign country; or that is under the protection of a foreign country; or for whose international relations a foreign country is responsible.</def></p>
            </content>
            <paragraph eId="part-1__sec-4__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>that is part of a foreign country; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>that is under the protection of a foreign country; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>for whose international relations a foreign country is responsible.</p>
              </content>
              <content>
                <p><term refersTo="#term-australian-carrier">Australian carrier</term> means <def>a person who: conducts, or proposes to conduct, an international airline service to and from ; and under the bilateral arrangement to which the capacity relates, may be permitted to carry passengers or freight, or both passengers and freight, under that arrangement as an airline designated, nominated or otherwise similarly authorised by Australia. <b><i>available capacity</i></b> has the meaning given in subsection 5(1).</def></p>

            <paragraph eId="part-1__sec-4__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>conducts, or proposes to conduct, an international airline service to and from ; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>under the bilateral arrangement to which the capacity relates, may be permitted to carry passengers or freight, or both passengers and freight, under that arrangement as an airline designated, nominated or otherwise similarly authorised by Australia.</p>
              </content>
              <content>
                <p><b><i>available capacity</i></b> has the meaning given in subsection 5(1).</p>
                <p><term refersTo="#term-bilateral-arrangement">bilateral arrangement</term> means <def>an agreement or arrangement between: , or an entity or organisation nominated or otherwise similarly authorised by  to enter into the agreement or arrangement; and another country; under which the carriage by air of passengers or freight (or both) is permitted.</def></p>

            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>, or an entity or organisation nominated or otherwise similarly authorised by  to enter into the agreement or arrangement; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>another country;</p>
              </content>
              <content>
                <p>under which the carriage by air of passengers or freight (or both) is permitted.</p>
                <p><term refersTo="#term-blocked-space-arrangements">blocked space arrangements</term> means <def>arrangements under which capacity is acquired by a carrier for the carriage of passengers or freight on an aircraft of another carrier.</def></p>
                <p><term refersTo="#term-capacity">capacity</term> means <def>an amount of space (however worked out or described) for the carriage of passengers or freight (or both) by persons designated, nominated or otherwise similarly authorised by , being carriage permitted under a bilateral arrangement, or a combination of bilateral arrangements.</def></p>
                <p><term refersTo="#term-chairperson">Chairperson</term> means <def>the Chairperson of the Commission.</def></p>
                <p><term refersTo="#term-code-sharing">code sharing</term> means <def>an arrangement under which a carrier sells capacity under its own designator code on a flight operated by another airline.</def></p>
                <p><term refersTo="#term-commission">Commission</term> means <def>the International Air Services Commission established by <ref href="#sec-6">section 6</ref>.</def></p>
                <p><term refersTo="#term-determination">determination</term> means <def>a determination made by the Commission under <ref href="#sec-7">section 7</ref> or 8 concerning the allocation of capacity.</def></p>
                <p><term refersTo="#term-interim-determination">interim determination</term> means <def>a determination that includes a statement, under paragraph 15(2)(b), 19(1)(b) or 54(4)(a), to the effect that it is an interim determination.</def></p>
                <p><b><i>joint international air services</i></b> includes, but is not limited to, the provision of international air services by an Australian carrier involving code sharing, blocked space arrangements, joint pricing, revenue and cost sharing, revenue and cost pooling, or the sale of capacity to another airline.</p>
                <p><term refersTo="#term-member">member</term> means <def>a member of the Commission.</def></p>
                <p><term refersTo="#term-operational-decision">operational decision</term> means <def>a decision (including the granting of any licence or the giving of any approval) under <ref href="">the Air Navigation Act 1920</ref>, or the regulations made under that Act, that must be made if an Australian carrier is to be permitted to operate an international airline service using that capacity.</def></p>
                <p><term refersTo="#term-reduce">reduce</term> includes <def>reduce to nil.</def></p>
                <p><term refersTo="#term-renewal">renewal</term> means <def>renewal of a determination under <ref href="#sec-8">section 8</ref>.</def></p>
                <p><term refersTo="#term-review">review</term> means <def>review of a determination under <ref href="#sec-10">section 10</ref>.</def></p>
                <p><term refersTo="#term-secretary">Secretary</term> means <def>the Secretary of the Department.</def></p>
                <p><term refersTo="#term-transfer-application">transfer application</term> means <def>an application, by an Australian carrier to whom a determination allocates capacity, for one or both of the following: a variation of the determination in a way that allocates, or has the effect of allocating, that capacity to another Australian carrier; a variation of the determination that varies, or has the effect of varying, one or more conditions of a kind referred to in paragraph 15(2)(d), (e) or (f).</def></p>

              <num>a</num>
              <content>
                <p>a variation of the determination in a way that allocates, or has the effect of allocating, that capacity to another Australian carrier;</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>a variation of the determination that varies, or has the effect of varying, one or more conditions of a kind referred to in paragraph 15(2)(d), (e) or (f).</p>
              </content>
              <content>
                <p><term refersTo="#term-wholly-owned-subsidiary">wholly-owned subsidiary</term> has the same meaning as <def>in <ref href="">the Corporations Act 2001</ref>.</def></p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-1__sec-4__subsec-2">
            <num>2</num>
            <content>
              <p>A reference in this Act to an allocation of capacity is a reference to a finding, included in a determination, that a specified Australian carrier should be permitted to use that capacity.</p>
            </content>
          </subsection>
          <subsection eId="part-1__sec-4__subsec-3">
            <num>3</num>
            <content>
              <p>A reference in this Act to the benefit to the public in relation to an allocation of capacity is a reference to the benefit to the public that would occur if the Australian carrier to whom the capacity is allocated were permitted to use that capacity.</p>
            </content>
          </subsection>
          <subsection eId="part-1__sec-4__subsec-4">
            <num>4</num>
            <content>
              <p>A reference in this Act to use of capacity is a reference to the operation of an international air service to provide the carriage of passengers or freight, or both passengers and freight, to which the capacity relates.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-1__sec-5">
          <num>5</num>
          <heading>Available capacity</heading>
          <subsection eId="part-1__sec-5__subsec-1">
            <num>1</num>
            <content>
              <p>Subject to subsection (2) of this section and subsection 9(2A), capacity is taken to be available capacity for the purposes of this Act if operational decisions are not in force in relation to that capacity.</p>
            </content>
          </subsection>
          <subsection eId="part-1__sec-5__subsec-2">
            <num>2</num>
            <content>
              <p>If the Commission makes a determination, the capacity to which it relates is taken not to be available capacity during the period beginning when the determination is made and ending when <role refersTo="#secretary">the Secretary</role> advises the Commission under section 50 in relation to the capacity.</p>
            </content>
          </subsection>
        </section>

          <num>5A</num>
          <heading>Application of the Criminal Code</heading>
          <content>
            <p>		Chapter 2 of the <i>Criminal Code</i> applies to all offences created by this Act.</p>

        <heading>Key provisions</heading>

          <heading>The International Air Services Commission</heading>
          <subsection eId="part-2__sec-6__subsec-1">
            <num>1</num>
            <content>
              <p>The International Air Services Commission is established.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-6__subsec-2">
            <num>2</num>
            <content>
              <p>The functions of the Commission are:</p>
            </content>
            <paragraph eId="part-2__sec-6__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>to make determinations under sections 7 and 8; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-6__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>to conduct reviews of those determinations; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-6__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>to provide advice to <role refersTo="#minister">the Minister</role> about any matter referred to the Commission by <role refersTo="#minister">the Minister</role> concerning international air operations.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-6__subsec-2A">
            <num>2A</num>
            <content>
              <p>To remove any doubt, it is declared that the Commission may, at the same time, consider and decide more than one matter in relation to particular capacity.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-6__subsec-3">
            <num>3</num>
            <content>
              <p>In performing its functions, the Commission must:</p>
            </content>
            <paragraph eId="part-2__sec-6__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>comply with any applicable policy statements made by <role refersTo="#minister">the Minister</role> under section 11; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-6__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>have regard to ’s international obligations concerning the operation of international air services.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-6__subsec-4">
            <num>4</num>
            <content>
              <p>The Commission has the power to do everything necessary or convenient to be done for or in connection with the performance of its functions.</p>
            </content>

              <p>The Commission may make a determination allocating available capacity.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-7__subsec-2">
            <num>2</num>
            <content>
              <p>The determination:</p>
            </content>
            <paragraph eId="part-2__sec-7__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>must not allocate available capacity unless the Commission is satisfied that the allocation would be of benefit to the public; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-7__subsec-2__para-aa">
              <num>aa</num>
              <content>
                <p>must not allocate available capacity contrary to any restrictions on capacity contained in a bilateral arrangement, or a combination of bilateral arrangements, permitting the carriage to which the capacity relates; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-7__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>if more than one application was made under <ref href="#dvs-1">Division 1</ref> of <ref href="#part-3">Part 3</ref> relating to the allocation—must make the allocation that the Commission is satisfied, having regard to the applications made, would be of the greatest benefit to the public.</p>

          </subsection>

            <num>3</num>
            <content>
              <p>In assessing the benefit to the public of an allocation of capacity, the Commission must apply the criteria set out for that purpose in the policy statements made by <role refersTo="#minister">the Minister</role> under section 11.</p>

          <heading>Renewal of determinations</heading>
          <subsection eId="part-2__sec-8__subsec-1">
            <num>1</num>
            <content>
              <p>The Commission may, at any time while a determination is in force, make a fresh determination allocating the capacity to which the original determination relates.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-8__subsec-2">
            <num>2</num>
            <content>
              <p>The fresh determination:</p>
            </content>
            <paragraph eId="part-2__sec-8__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>must make the same allocation of capacity as the original determination unless:</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-2__para-i">
              <num>i</num>
              <content>
                <p>the Commission is satisfied that that allocation is no longer of benefit to the public; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-2__para-ii">
              <num>ii</num>
              <content>
                <p>the original determination is an interim determination; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>comes into force immediately after the end of the period during which the original determination was in force.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-8__subsec-3">
            <num>3</num>
            <content>
              <p>If the fresh determination does not make the same allocation of capacity as the original determination, it must not make a different allocation of capacity unless the Commission is satisfied that that allocation would be of benefit to the public.</p>

          </subsection>

            <num>4</num>
            <content>

          <heading>Effect of determinations on the making of operational decisions</heading>
          <subsection eId="part-2__sec-9__subsec-1">
            <num>1</num>
            <content>
              <p><role refersTo="#secretary">The Secretary</role> must not make an operational decision in relation to capacity that is inconsistent with a determination relating to the allocation of that capacity.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-9__subsec-2">
            <num>2</num>
            <content>
              <p>The Secretary must not make an operational decision in relation to capacity that comes into existence on or after <date date="1992-07-01">1 July 1992</date> unless:</p>
            </content>
            <paragraph eId="part-2__sec-9__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>a determination is in force relating to the allocation of that capacity; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-9__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>	(b)	the capacity relates to a non-scheduled flight within the meaning of the <i>Air Navigation Act 1920</i>; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-9__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>the decision is made in other circumstances prescribed by the regulations.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-9__subsec-2A">
            <num>2A</num>
            <content>
              <p>An operational decision made in relation to capacity as mentioned in paragraph (2)(c) is not taken to be an operational decision for the purposes of subsection 5(1).</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-9__subsec-3">
            <num>3</num>
            <content>
              <p>Nothing in this Act obliges <role refersTo="#secretary">the Secretary</role> to make an operational decision implementing a determination.</p>

          <heading>Review of determinations</heading>

              <p>The Commission may, at any time, conduct a review of a determination if it believes that there may be grounds for varying, suspending or revoking the determination.</p>
            </content>
          </subsection>

            <num>2</num>
            <content>
              <p>The Commission must conduct a review of a determination if an Australian carrier to whom the determination allocates capacity applies to the Commission under <ref href="#sec-21">section 21</ref> for the determination to be varied.</p>

          <heading>Policy statements</heading>
          <subsection eId="part-2__sec-11__subsec-1">
            <num>1</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> may, by legislative instrument, make policy statements about the way in which the Commission is to perform its functions.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-11__subsec-2">
            <num>2</num>
            <content>
              <p>In particular, the policy statements may set out:</p>
            </content>
            <paragraph eId="part-2__sec-11__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>the criteria to be applied by the Commission in assessing the benefit to the public of allocations of capacity; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-11__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>how the Commission is to fix the periods during which determinations are to be in force; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-11__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>matters relating to the Commission’s consideration of whether determinations should be interim determinations; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-11__subsec-2__para-d">
              <num>d</num>
              <content>
                <p>matters relating to the inclusion of conditions in determinations and the variation or revocation of such conditions.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-11__subsec-3">
            <num>3</num>
            <content>
              <p>Without limiting the criteria that, under paragraph (2)(a), may be set out in the policy statements, the policy statements may set out:</p>
            </content>
            <paragraph eId="part-2__sec-11__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>criteria that relate to the matters referred to in <ref href="#sec-3">section 3</ref>; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-11__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>criteria that apply in relation to particular circumstances, including where:</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-11__subsec-3__para-i">
              <num>i</num>
              <content>
                <p>capacity is not limited under bilateral arrangements; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-11__subsec-3__para-ii">
              <num>ii</num>

                <p>only one application has been made for the allocation of capacity; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-11__subsec-3__para-iii">
              <num>iii</num>
              <content>
                <p>no submissions are received opposing allocation of capacity to an applicant; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-11__subsec-3__para-iv">
              <num>iv</num>
              <content>
                <p>an application for the allocation of capacity is opposed on particular grounds.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-11__subsec-4">
            <num>4</num>
            <content>
              <p>A policy statement:</p>
            </content>
            <paragraph eId="part-2__sec-11__subsec-4__para-a">
              <num>a</num>
              <content>
                <p>must not deal with the making of a particular determination or decision by the Commission; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-11__subsec-4__para-b">
              <num>b</num>
              <content>
                <p>is invalid to the extent that it purports to deal with such a matter.</p>
              </content>
            </paragraph>
          </subsection>
        </section>

        <heading>Allocation of available capacity</heading>

                <p>Before making a determination allocating available capacity, the Commission must, by notice, invite:</p>
              </content>
              <paragraph eId="part-3__dvs-1__sec-12__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>applications for a determination allocating the capacity; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-12__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>if the regulations so require—submissions about the allocation of the capacity.</p>
                </content>

                <p>Without limiting the matters that may be included in the notice, the notice must:</p>
              </content>
              <paragraph eId="part-3__dvs-1__sec-12__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>set out the matters that the regulations require to be set out in the notice; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-12__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>specify the period within which applications are required to be made; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-12__subsec-2__para-c">
                <num>c</num>
                <content>
                  <p>may include guidance as to:</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-12__subsec-2__para-i">
                <num>i</num>
                <content>
                  <p>any matters that the Commission considers to be particularly important in making its determination in relation to that available capacity; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-12__subsec-2__para-ii">
                <num>ii</num>
                <content>
                  <p>the weight that the Commission is likely to give to such matters.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-12__subsec-3">
              <num>3</num>
              <content>
                <p>Any person may apply to the Commission for a determination allocating the capacity.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-3__dvs-1__sec-14">
            <num>14</num>
            <heading>Requirements of applications</heading>
            <subsection eId="part-3__dvs-1__sec-14__subsec-1">
              <num>1</num>
              <content>
                <p>An application under this Division:</p>
              </content>
              <paragraph eId="part-3__dvs-1__sec-14__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>must be in writing; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-14__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>must be delivered at the address specified in the regulations as the Commission’s address for receiving applications; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-14__subsec-1__para-c">
                <num>c</num>
                <content>
                  <p>must be so delivered within the period referred to in paragraph 12(2)(b).</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-14__subsec-3">
              <num>3</num>
              <content>
                <p>The Commission may reject an application without considering it further if it does not comply with subsection (1).</p>
              </content>
            </subsection>
          </section>
          <section eId="part-3__dvs-1__sec-15">
            <num>15</num>
            <heading>Content of determinations</heading>
            <subsection eId="part-3__dvs-1__sec-15__subsec-1">
              <num>1</num>
              <content>
                <p>A determination may include such terms and conditions as the Commission thinks fit.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-15__subsec-2">
              <num>2</num>
              <content>
                <p>Without limiting subsection (1), the determination:</p>
              </content>
              <paragraph eId="part-3__dvs-1__sec-15__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>must specify the period, under subsection (3), during which the determination is to be in force; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-15__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>may include a statement to the effect that the determination is an interim determination; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-15__subsec-2__para-c">
                <num>c</num>
                <content>
                  <p>must include a condition that the capacity be fully used, except so far as:</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-15__subsec-2__para-i">
                <num>i</num>
                <content>
                  <p>the determination provides otherwise in relation to a specified period commencing when the determination comes into force; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-15__subsec-2__para-ii">
                <num>ii</num>
                <content>
                  <p>the regulations otherwise permit; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-15__subsec-2__para-d">
                <num>d</num>
                <content>
                  <p>must include a condition that, except to the extent permitted by the condition referred to in paragraphs (e) and (ea), the available capacity in question is only to be used by the one or more Australian carriers to whom the capacity is allocated; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-15__subsec-2__para-e">
                <num>e</num>
                <content>
                  <p>must include a condition stating the extent (if any) to which any such carrier may use that capacity by providing joint international air services with another Australian carrier or any other person; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-15__subsec-2__para-ea">
                <num>ea</num>
                <content>
                  <p>may include a condition that, to the extent that any of the capacity is allocated to a particular Australian carrier, it may be used in whole or in part by any one or more of the following:</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-15__subsec-2__para-i">
                <num>i</num>
                <content>
                  <p>the carrier;</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-15__subsec-2__para-ii">
                <num>ii</num>
                <content>
                  <p>a wholly-owned subsidiary of the carrier;</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-15__subsec-2__para-iii">
                <num>iii</num>
                <content>
                  <p>if the carrier is a wholly-owned subsidiary of another Australian carrier—that other carrier; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-15__subsec-2__para-f">
                <num>f</num>
                <content>
                  <p>must include a condition stating the extent to which changes in the ownership or control of any such carrier are permitted while the determination is in force.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-15__subsec-2A">
              <num>2A</num>
              <content>
                <p>If a determination includes a condition of a kind mentioned in paragraph (2)(ea), the determination may include conditions that are applicable to all, or some only, of the persons who are permitted to use the capacity concerned.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-15__subsec-2B">
              <num>2B</num>
              <content>
                <p>If:</p>
              </content>
              <paragraph eId="part-3__dvs-1__sec-15__subsec-2B__para-a">
                <num>a</num>
                <content>
                  <p>a carrier is a wholly-owned subsidiary of another Australian carrier; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-15__subsec-2B__para-b">
                <num>b</num>
                <content>
                  <p>that other carrier would, apart from any condition included under this subsection in a determination, be permitted by a condition referred to in paragraph (2)(ea) to use any capacity allocated to the subsidiary;</p>
                </content>
                <content>
                  <p>the determination must include a condition stating the extent to which changes in the ownership or control of that other carrier are permitted if that other carrier is to continue to be permitted to use that capacity while the determination is in force.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-15__subsec-3">
              <num>3</num>
              <content>
                <p>The period referred to in paragraph (2)(a) is:</p>
              </content>
              <paragraph eId="part-3__dvs-1__sec-15__subsec-3__para-a">
                <num>a</num>
                <content>
                  <p>if the policy statements made by <role refersTo="#minister">the Minister</role> under section 11 set out how the period is to be fixed—the period as so fixed; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-15__subsec-3__para-b">
                <num>b</num>
                <content>
                  <p>in any other case:</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-15__subsec-3__para-i">

                  <p>if the determination is an interim determination—3 years; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-15__subsec-3__para-ii">
                <num>ii</num>

                  <p>if the determination is not an interim determination—5 years.</p>
                </content>
              </paragraph>
            </subsection>
          </section>
          <section eId="part-3__dvs-1__sec-16">
            <num>16</num>
            <heading>Notification of determinations</heading>
            <content>
              <p>As soon as practicable after the making of a determination, the Commission must:</p>
            </content>
            <paragraph eId="part-3__dvs-1__sec-16__para-a">
              <num>a</num>
              <content>
                <p>make copies of the determination and its reasons for the determination available to the public; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__dvs-1__sec-16__para-b">
              <num>b</num>
              <content>
                <p>publish, in such manner as it thinks appropriate, a notice stating:</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__dvs-1__sec-16__para-i">
              <num>i</num>
              <content>
                <p>that the determination has been made; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__dvs-1__sec-16__para-ii">
              <num>ii</num>
              <content>
                <p>where copies of the determination and reasons may be obtained.</p>
              </content>
            </paragraph>
          </section>
        </division>
        <division eId="part-3__dvs-2">

          <heading>Renewal of determinations</heading>

            <heading>Consideration of renewals</heading>

                <p>The Commission must start its consideration of the renewal of a determination (other than an interim determination) at least 12 months before the end of the period during which the determination is in force.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-2__sec-17__subsec-2">
              <num>2</num>
              <content>
                <p>Sections 12 and 14 apply in relation to the renewal of a determination in the same way they apply in relation to the making of a determination allocating available capacity.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-3__dvs-2__sec-18">
            <num>18</num>
            <heading>Renewal of interim determinations</heading>
            <subsection eId="part-3__dvs-2__sec-18__subsec-1">
              <num>1</num>
              <content>
                <p>The Commission must start its consideration of the renewal of an interim determination as soon as practicable after the determination is made.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-2__sec-18__subsec-2">
              <num>2</num>
              <content>
                <p>Sections 12 and 14 apply in relation to the renewal of an interim determination in the same way they apply in relation to the making of a determination under <ref href="#sec-7">section 7</ref> allocating available capacity.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-2__sec-18__subsec-3">
              <num>3</num>
              <content>
                <p>If no applications are made under subsection 12(3) (as it applies by virtue of subsection (2) of this section) in relation to the interim determination, the Commission must issue a notice stating that:</p>
              </content>
              <paragraph eId="part-3__dvs-2__sec-18__subsec-3__para-a">
                <num>a</num>
                <content>
                  <p>no such applications were made; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-2__sec-18__subsec-3__para-b">

                  <p>the determination is no longer to be treated as an interim determination.</p>

                  <p>may include a statement to the effect that the determination is an interim determination; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-2__sec-19__subsec-1__para-c">

                  <p>subject to subsection (3), must include the same terms and conditions as the original determination to which it relates.</p>
                </content>
              </paragraph>

                <p>The period referred to in paragraph (1)(a) is:</p>

                <p>In including terms and conditions in the determination, the Commission may make such changes (if any) to the terms and conditions included in the original determination (including adding or deleting terms and conditions) as it is satisfied are warranted because of changes in circumstances since the original determination was made.</p>

            <heading>Notification of renewals</heading>

              <p>As soon as practicable after the making of a determination, the Commission must:</p>
            </content>

                <p>make copies of the determination and its reasons for the determination available to the public; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__dvs-2__sec-20__para-b">

                <p>publish, in such manner as it thinks appropriate, a notice stating:</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__dvs-2__sec-20__para-i">

                <p>that the determination has been made; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__dvs-2__sec-20__para-ii">

                <p>The application:</p>
              </content>
              <paragraph eId="part-3__dvs-3__sec-21__subsec-2__para-a">

                  <p>must be in writing; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-21__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>must specify the variation being requested; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-21__subsec-2__para-c">
                <num>c</num>
                <content>
                  <p>must be delivered at the address specified in the regulations as the Commission’s address for receiving applications.</p>
                </content>
              </paragraph>
            </subsection>
          </section>

            <heading>Submissions about reviews</heading>
            <subsection eId="part-3__dvs-3__sec-22__subsec-1">

                <p>Before conducting a review under <ref href="#sec-10">section 10</ref>, the Commission must, by notice, invite submissions about the review of the determination.</p>

                  <p>the review is made as a result of an application (other than a transfer application) by the carrier to which the capacity was allocated requesting a variation of the determination; and</p>
                </content>

                <content>
                  <p>the only effect of the variation would be to reduce the capacity allocated to the carrier.</p>
                </content>
              </paragraph>
            </subsection>

                <p>Any person may make submissions to the Commission about the review of the determination.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-3__dvs-3__sec-23">

            <heading>Decisions on review for cause</heading>
            <subsection eId="part-3__dvs-3__sec-23__subsec-1">
              <num>1</num>
              <content>
                <p>Subject to subsection (2), the Commission must, having conducted a review under subsection 10(1) in relation to a determination, make a decision:</p>
              </content>
              <paragraph eId="part-3__dvs-3__sec-23__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>confirming the determination; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-23__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>varying the determination; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-23__subsec-1__para-c">
                <num>c</num>
                <content>
                  <p>suspending the determination; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-23__subsec-1__para-d">
                <num>d</num>
                <content>
                  <p>revoking the determination.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-3__sec-23__subsec-2">

              <content>
                <p>The Commission may only make a decision varying, suspending or revoking the determination if it is satisfied that:</p>
              </content>
              <paragraph eId="part-3__dvs-3__sec-23__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>a term or condition of the determination has been breached; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-23__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>due to a change of circumstances, it is inevitable that a breach of such a term or condition will occur; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-23__subsec-2__para-c">
                <num>c</num>
                <content>
                  <p>an Australian carrier that, under the determination, is to use capacity to which the determination relates no longer intends to use fully that capacity.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-3__sec-23__subsec-3">
              <num>3</num>
              <content>
                <p>The Commission must not make a decision varying the determination in a way that varies, or has the effect of varying, an allocation of capacity unless the Commission is satisfied that the allocation, as so varied, would be of benefit to the public.</p>
              </content>
            </subsection>
          </section>

            <num>24</num>
            <heading>Decisions on applications for variation</heading>
            <subsection eId="part-3__dvs-3__sec-24__subsec-1">

                <p>Subject to this section, the Commission must, having conducted a review to decide an application (other than a transfer application) for a determination to be varied, make a decision:</p>

                  <p>an Australian carrier to which a determination allocates capacity applies in accordance with <ref href="#sec-21">section 21</ref> for the determination to be varied; and</p>

              </paragraph>

                <num>b</num>
                <content>
                  <p>the only effect of the variation would be to reduce the capacity allocated to the carrier;</p>
                </content>
                <content>
                  <p>the Commission must vary the determination as requested in the application.</p>
                </content>
              </paragraph>
            </subsection>
          </section>

            <num>25</num>
            <heading>Decisions on transfer applications</heading>
            <subsection eId="part-3__dvs-3__sec-25__subsec-1">
              <num>1</num>
              <content>
                <p>Subject to subsection (2), the Commission must, having conducted a review to decide a transfer application, make a decision varying the determination concerned in a way that gives effect to the variation requested in the transfer application.</p>
              </content>
            </subsection>

              <num>2</num>
              <content>
                <p>The Commission must not make a decision varying the determination in a way that varies, or has the effect of varying, an allocation of capacity if the Commission is satisfied that the allocation, as so varied, would not be of benefit to the public.</p>

            <heading>Assessments of public benefit</heading>
            <content>
              <p>In assessing the benefit to the public of a variation of an allocation of capacity, the Commission must apply the criteria set out for that purpose in any policy statements made by <role refersTo="#minister">the Minister</role> under section 11.</p>

            <num>27</num>
            <heading>Notification of decisions</heading>
            <content>
              <p>As soon as practicable after the making of a decision on a review of a determination, the Commission must:</p>
            </content>

                <p>make copies of the decision and its reasons for the decision available to the public; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__dvs-3__sec-27__para-b">

            </paragraph>

                  <p>be in writing and contain the prescribed particulars; and</p>

              <paragraph eId="part-3__dvs-4__sec-27AA__subsec-2__para-b">
                <num>b</num>

                  <p>be delivered at the address specified in the regulations as the Commission’s address for receiving applications.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-4__sec-27AA__subsec-3">

                <p>On receipt of a request in relation to a determination, the Commission must make a decision revoking the determination.</p>
              </content>
            </subsection>

                <p>As soon as practicable after making a decision revoking a determination under this section, the Commission must:</p>

              <p>The members of the Commission are to be appointed by the Governor-General.</p>

              <p>A member may be appointed on a full-time or a part-time basis.</p>
            </content>
          </subsection>
          <subsection eId="part-5__sec-40__subsec-3">

              <p>A member holds office on such terms and conditions (if any) in respect of matters not provided for by this Act as <role refersTo="#minister">the Minister</role> determines.</p>
            </content>
          </subsection>
        </section>

          <heading>Qualification of members</heading>
          <content>
            <p>The Governor-General must not appoint a person to the Commission unless the Governor-General is satisfied that the person is suitably qualified for appointment because of substantial experience or expertise in one or more of the following fields:</p>

              <p>law;</p>
            </content>
          </paragraph>

              <p>business;</p>

          <heading>Term of appointment</heading>

              <p>A member is to be appointed for the period, not exceeding 5 years, as specified in the instrument of appointment.</p>

              <p>A member is eligible for re-appointment.</p>
            </content>
          </subsection>
        </section>

              <p>The members are to be paid such remuneration as the Remuneration Tribunal determines.</p>

              <p>The members are to be paid such allowances as are prescribed.</p>
            </content>
          </subsection>
          <subsection eId="part-5__sec-43__subsec-3">

              <p>	(3)	This section has effect subject to the <i>Remuneration Tribunal Act 1973</i>.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-5__sec-44">

          <heading>Leave of absence</heading>
          <subsection eId="part-5__sec-44__subsec-1">
            <num>1</num>
            <content>
              <p>If a member is appointed on a full-time basis, the member has such recreation leave entitlements as the Remuneration Tribunal determines.</p>
            </content>
          </subsection>
          <subsection eId="part-5__sec-44__subsec-2">
            <num>2</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> may grant the Chairperson leave of absence, other than recreation leave, on such terms and conditions as to remuneration or otherwise as <role refersTo="#minister">the Minister</role> determines in writing.</p>
            </content>
          </subsection>
          <subsection eId="part-5__sec-44__subsec-3">
            <num>3</num>
            <content>
              <p>The Chairperson may grant leave of absence to any other member on such terms and conditions as the Chairperson determines.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-5__sec-45">

          <heading>Resignation</heading>
          <content>
            <p>A member may resign from office by writing signed and delivered to the Governor-General.</p>
          </content>
        </section>
        <section eId="part-5__sec-46">
          <num>46</num>
          <heading>Termination of appointment</heading>
          <subsection eId="part-5__sec-46__subsec-1">
            <num>1</num>
            <content>
              <p>The Governor-General may terminate the appointment of a member for misbehaviour or physical or mental incapacity.</p>
            </content>
          </subsection>
          <subsection eId="part-5__sec-46__subsec-2">
            <num>2</num>
            <content>
              <p>The Governor-General may terminate the appointment of a member if the member:</p>
            </content>
            <paragraph eId="part-5__sec-46__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>becomes bankrupt, applies to take the benefit of any law for the relief of bankrupt or insolvent debtors, compounds with creditors or makes an assignment of remuneration for their benefit; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-46__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>is absent from duty, except on leave of absence, for 14 consecutive days or for 28 days in any 12 months; or</p>
              </content>
            </paragraph>

              <num>c</num>
              <content>
                <p>fails, without reasonable excuse, to comply with his or her obligations under <ref href="#sec-47">section 47</ref>.</p>
              </content>
            </paragraph>
          </subsection>
        </section>

          <heading>Disclosure of interests</heading>
          <subsection eId="part-5__sec-47__subsec-1">
            <num>1</num>
            <content>
              <p>If a member has or acquires any interest, whether monetary or otherwise, that could conflict with the proper performance of his or her functions in relation to proceedings conducted by the Commission:</p>
            </content>
            <paragraph eId="part-5__sec-47__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>the member must disclose the interest to the other members and to any parties to the proceedings; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-47__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>except with the consent of the other members and the parties (if any), the member must not take part, or any further part, as the case may be, in the proceedings.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-5__sec-47__subsec-2">
            <num>2</num>
            <content>
              <p>If:</p>
            </content>
            <paragraph eId="part-5__sec-47__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>a member becomes aware that another member has, in relation to proceedings conducted by the Commission, an interest of a kind referred to in subsection (1); and</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-47__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>the other member has not disclosed the interest as required by paragraph (1)(a);</p>
              </content>
              <content>
                <p>then:</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-47__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>the first-mentioned member must tell the other member that he or she has become aware that the other member has the interest; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-47__subsec-2__para-d">
              <num>d</num>
              <content>
                <p>if the other member does not then disclose the interest as required by paragraph (1)(a), the first-mentioned member must disclose the interest to the remaining member (if any) and the parties (if any) to the proceedings; and</p>

                <p>except with the consent of the other members and the parties (if any), the member who has the interest must not take part, or any further part, as the case may be, in the proceedings.</p>

                <p>during a vacancy in the office of Chairperson, whether or not an appointment has previously been made to the office; or</p>
              </content>
            </paragraph>

                <p>during any period, or during all periods, when the Chairperson is absent from duty or from , or is for any other reason unable to perform the functions of the office.</p>

              <p><role refersTo="#secretary">The Secretary</role> must cause a register of all available capacity to be prepared and kept up to date.</p>

              <p><role refersTo="#secretary">The Secretary</role> must take all reasonable steps to ensure that the register is available for inspection by any person without charge.</p>

          <heading>Secretary to notify Commission of making etc. of operational decisions</heading>

            </content>
          </paragraph>

              <p><role refersTo="#secretary">the Secretary</role> makes, or decides not to make, an operational decision relating to that capacity;</p>

              <p><role refersTo="#secretary">the Secretary</role> must give written notice to the Commission of the operational decision or of the decision not to make the operational decision.</p>

          </paragraph>
        </section>

          <heading>Protection of members etc.</heading>
          <subsection eId="part-6__sec-51__subsec-1">
            <num>1</num>
            <content>
              <p>A member has, in the performance of his or her duty as a member, the same protection and immunity as a Justice of the High Court.</p>
            </content>
          </subsection>
          <subsection eId="part-6__sec-51__subsec-2">
            <num>2</num>
            <content>
              <p>A legal practitioner or other person appearing before the Commission has the same protection and immunity as a barrister has in appearing for a party in proceedings in the High Court.</p>
            </content>
          </subsection>
          <subsection eId="part-6__sec-51__subsec-3">
            <num>3</num>
            <content>
              <p>A person summoned to attend before or appearing before the Commission as a witness has the same protection, and is, in addition to the penalties provided by this Act, subject to the same liabilities, as a witness in proceedings in the High Court.</p>

          </subsection>
        </section>

          <heading>Publication of notices</heading>
          <content>
            <p>Notices issued under subsection 12(1), <ref href="#sec-16">section 16</ref>, subsection 17(2) or 18(3), <ref href="#sec-20">section 20</ref>, subsection 22(1), <ref href="#sec-27">section 27</ref> or 27AA must be published:</p>

              <p>The Commission must, as soon as practicable after the end of each financial year, prepare and give to <role refersTo="#minister">the Minister</role> a report of its operations during the financial year.</p>

              <p><role refersTo="#minister">The Minister</role> must cause a copy of each such report to be laid before each House of the Parliament within 15 sitting days of that House after <role refersTo="#minister">the Minister</role> received the report.</p>

          <heading>Pre-existing capacity</heading>
          <subsection eId="part-6__sec-54__subsec-1">

              <p><b><i>pre</i></b><b><i>-</i></b><b><i>existing capacity</i></b> means capacity that came into existence before the commencement of this Act.</p>
            </content>
          </subsection>

              <p><role refersTo="#minister">The Minister</role> may, by legislative instrument, declare that this Act applies to the pre-existing capacity specified in the instrument as if, immediately after the commencement of this Act, the Commission had made a determination in the terms set out in the instrument.</p>

          </subsection>
          <subsection eId="part-6__sec-54__subsec-3">
            <num>3</num>
            <content>
              <p>Subject to subsection (5), this Act (other than <ref href="#sec-7">section 7</ref> and <ref href="#dvs-1">Division 1</ref> of <ref href="#part-3">Part 3</ref>) has effect in relation to that capacity as if the Commission had made a determination accordingly.</p>
            </content>
          </subsection>
          <subsection eId="part-6__sec-54__subsec-4">

              <p>The terms set out in the instrument as the terms and conditions of the determination:</p>

          <heading>Pre-existing capacity under special bilateral arrangement</heading>
          <subsection eId="part-6__sec-54A__subsec-1">
            <num>1</num>
            <content>
              <p>In this section:</p>
            </content>
            <content>
              <p><b><i>pre</i></b><b><i>-</i></b><b><i>existing capacity</i></b> means capacity:</p>
            </content>
            <paragraph eId="part-6__sec-54A__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>that came into existence before the commencement of this section; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-54A__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>to which an agreement or arrangement entered into between:</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-54A__subsec-1__para-i">
              <num>i</num>
              <content>
                <p>an entity or organisation nominated or otherwise similarly authorised by ; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-54A__subsec-1__para-ii">
              <num>ii</num>
              <content>
                <p>another country;</p>
              </content>
              <content>
                <p>relates.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-6__sec-54A__subsec-2">
            <num>2</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> may, by legislative instrument, declare that this Act applies to the pre-existing capacity referred to in the declaration as if, immediately after the commencement of this section, the Commission had made a determination in the terms set out in the declaration.</p>
            </content>
          </subsection>
          <subsection eId="part-6__sec-54A__subsec-3">
            <num>3</num>
            <content>
              <p>This Act (other than <ref href="#sec-7">section 7</ref> and <ref href="#dvs-1">Division 1</ref> of <ref href="#part-3">Part 3</ref>) has effect in relation to that capacity as if the Commission had made a determination accordingly.</p>
            </content>
          </subsection>
          <subsection eId="part-6__sec-54A__subsec-4">
            <num>4</num>
            <content>
              <p>The terms set out in the declaration as the terms and conditions of the determination:</p>
            </content>
            <paragraph eId="part-6__sec-54A__subsec-4__para-a">
              <num>a</num>
              <content>
                <p>may include a statement to the effect that the determination is an interim determination; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-54A__subsec-4__para-b">
              <num>b</num>
              <content>
                <p>must state as the period during which the determination is to be in force:</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-54A__subsec-4__para-i">
              <num>i</num>
              <content>
                <p>if the determination is an interim determination—the period of 3 years starting on the date of commencement of this section; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-54A__subsec-4__para-ii">
              <num>ii</num>
              <content>
                <p>otherwise—the period of 5 years starting on that date.</p>
              </content>
            </paragraph>
          </subsection>
        </section>
        <section eId="part-6__sec-54B">
          <num>54B</num>
          <heading>Pre-existing capacity</heading>
          <subsection eId="part-6__sec-54B__subsec-1">
            <num>1</num>
            <content>
              <p>In this section:</p>
            </content>
            <content>
              <p><b><i>pre</i></b><b><i>-</i></b><b><i>existing capacity</i></b> means capacity that came into existence before the commencement of this section, other than pre-existing capacity to which section 54 or 54A applies.</p>
            </content>
          </subsection>
          <subsection eId="part-6__sec-54B__subsec-2">
            <num>2</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> may, by legislative instrument, declare that this Act applies to the pre-existing capacity specified in the instrument as if, immediately after the commencement of this section, the Commission had made a determination in the terms set out in the instrument.</p>

          <subsection eId="part-6__sec-54B__subsec-3">
            <num>3</num>
            <content>
              <p>This Act (other than <ref href="#sec-7">section 7</ref> and <ref href="#dvs-1">Division 1</ref> of <ref href="#part-3">Part 3</ref>) has effect in relation to that capacity as if the Commission had made a determination accordingly.</p>

          </subsection>
          <subsection eId="part-6__sec-54B__subsec-4">
            <num>4</num>
            <content>
              <p>The terms set out in the instrument as the terms and conditions of the determination must state that the determination is to be in force for the period of 5 years starting on the date of commencement of this section.</p>

          <num>55</num>
          <heading>Regulations</heading>
          <subsection eId="part-6__sec-55__subsec-1">
            <num>1</num>
            <content>
              <p>The Governor-General may make regulations prescribing matters:</p>
            </content>
            <paragraph eId="part-6__sec-55__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>required or permitted by this Act to be prescribed; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-55__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>necessary or convenient to be prescribed for carrying out or giving effect to this Act.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-6__sec-55__subsec-2">
            <num>2</num>
            <content>
              <p>In particular, the Governor-General may make regulations providing for procedures to be followed by the Commission in performing its functions, including time limits within which such procedures must be completed.</p>

                <b>Editorial changes</b>
              </p>
              <p>The <i>Legislation Act 2003</i> authorises First Parliamentary Counsel to make editorial and presentational changes to a compiled law in preparing a compilation of the law for registration. The changes must not change the effect of the law. Editorial changes take effect from the compilation registration date.</p>
              <p>If the compilation includes editorial changes, the endnotes include a brief outline of the changes in general terms. Full details of any changes can be obtained from the Office of Parliamentary Counsel.</p>
              <p>
                <b>Misdescribed amendments</b>
              </p>
              <p>A misdescribed amendment is an amendment that does not accurately describe how an amendment is to be made. If, despite the misdescription, the amendment can be given effect as intended, then the misdescribed amendment can be incorporated through an editorial change made under <i>Legislation Act 2003</i>.<ref href="#sec-15V">section 15V</ref> of the </p>
              <p>If a misdescribed amendment cannot be given effect as intended, the amendment is not incorporated and “(md not incorp)” is added to the amendment history.</p>
