        <heading>Short title</heading>
        <content>
          <p><b>1.</b><b>	</b>This Act may be cited as the <i>Service and Execution of Process</i><i> </i><i>(Transitional Provisions and Consequential Amendments) Act 1992.</i></p>

        <num>2</num>
        <heading>Commencement</heading>
        <content>
          <p><b>2.</b><b>	</b>This Act commences on the day fixed by Proclamation under subsection 2(4) of the <i>Service and Execution of Process Act 1992.</i></p>
        </content>
      </section>
      <section eId="sec-3">
        <num>3</num>
        <heading>Repeal</heading>
        <content>
          <p><b>3.</b>	The <i>Service and Execution of Process Act 1901 </i>is repealed.</p>
          <p>
            <b>Transitional provisions</b>
          </p>
          <p><b>4.(1)</b> If a process was served under Part II of the <i>Service and Execution of Process Act 1901 </i>before this Act commenced, that Part and any rules or regulations relating to the operation of that Part continue to apply with respect to the process, and any action taken in connection with the process, as if the <i>Service and Execution of Process Act 1901 </i>had not been repealed.</p>

        <subsection eId="sec-3__subsec-2">
          <num>2</num>
          <content>
            <p><b>(2)</b>	If, before this Act commenced:</p>
          </content>
          <blockList eId="sec-3__subsec-2__list-1">
            <item eId="sec-3__subsec-2__list-1__item-1">
              <p>a warrant was endorsed under <ref href="#sec-18">section 18</ref> of <ref class="unresolved">the Service and Execution of Process Act 1901</ref>; or</p>
            </item>
            <item eId="sec-3__subsec-2__list-1__item-2">
              <p>a provisional warrant was issued under <ref href="#sec-19A">section 19A</ref> of that Act; or</p>
            </item>
            <item eId="sec-3__subsec-2__list-1__item-3">
              <p>leave was given under <ref href="#sec-19C">section 19C</ref> of that Act;</p>
            </item>
          </blockList>
        </subsection>
      </section>
      <part eId="part-III of that Act and any rules or regulations relating to the operation of that Part continue to apply with respect to the warrant, provisional warrant or leave, and any action taken in connection with the warrant, provisional warrant or leave, as if that Act had not been repealed.">
        <num>III of that Act and any rules or regulations relating to the operation of that Part continue to apply with respect to the warrant, provisional warrant or leave, and any action taken in connection with the warrant, provisional warrant or leave, as if that Act had not been repealed.</num>

          <num>3</num>
          <content>
            <p><b>(3)</b>	If, before this Act commenced:</p>

            <item eId="part-III of that Act and any rules or regulations relating to the operation of that Part continue to apply with respect to the warrant, provisional warrant or leave, and any action taken in connection with the warrant, provisional warrant or leave, as if that Act had not been repealed.__subsec-3__list-1__item-1">
              <p>leave was given under <ref href="#sec-19M">section 19M</ref> of <ref class="unresolved">the Service and Execution of Process Act 1901</ref> in relation to a subpoena; or</p>
            </item>
            <item eId="part-III of that Act and any rules or regulations relating to the operation of that Part continue to apply with respect to the warrant, provisional warrant or leave, and any action taken in connection with the warrant, provisional warrant or leave, as if that Act had not been repealed.__subsec-3__list-1__item-2">
              <p>an order was made under <ref href="#sec-19T">section 19T</ref> of that Act; or</p>
            </item>
            <item eId="part-III of that Act and any rules or regulations relating to the operation of that Part continue to apply with respect to the warrant, provisional warrant or leave, and any action taken in connection with the warrant, provisional warrant or leave, as if that Act had not been repealed.__subsec-3__list-1__item-3">
              <p>a warrant to which <ref href="#dvs-4">Division 4</ref> of <ref href="#part-3A">Part 3A</ref> of that Act applies was issued;</p>
            </item>

        </subsection>
      </part>
      <part eId="part-IIIA of that Act and any rules or regulations relating to the operation of that Part continue to apply with respect to the subpoena, order or warrant, and any action taken in connection with the subpoena, order or warrant, as if that Act had not been repealed.">

            <p>If a certificate of judgment was registered under <ref href="#sec-21">section 21</ref> of <ref class="unresolved">the Service and Execution of Process Act 1901</ref> before this Act commenced, <ref href="#part-IV">Part IV</ref> of that Act and any rules or regulations relating to the operation of that Part continue to apply with respect to the judgment, and any action taken in connection with the judgment, as if that Act had not been repealed.</p>
          </item>
          <item eId="part-IIIA of that Act and any rules or regulations relating to the operation of that Part continue to apply with respect to the subpoena, order or warrant, and any action taken in connection with the subpoena, order or warrant, as if that Act had not been repealed.__list-1__item-2">
            <p>If a warrant was issued under <ref href="#sec-26D">section 26D</ref> of <ref class="unresolved">the Service and Execution of Process Act 1901</ref> before this Act commenced, <ref href="#part-IVA">Part IVA</ref> of that Act and any rules or regulations relating to the operation of that Part continue to apply with respect to the warrant, and any action taken in connection with the warrant, as if that Act had not been repealed.</p>
          </item>
          <item eId="part-IIIA of that Act and any rules or regulations relating to the operation of that Part continue to apply with respect to the subpoena, order or warrant, and any action taken in connection with the subpoena, order or warrant, as if that Act had not been repealed.__list-1__item-3">
            <p>In this section:</p>

          <p><b>“</b><b>regulations</b><b>”</b><b> </b>means the regulations made under section 28 of the <i>Service and Execution of Process Act 1901 </i>that were in force immediately before this Act commenced;</p>
          <p><b> </b><b>“</b><b>rules</b><b>”</b><b> </b>means the rules of court made under section 27 of the <i>Service and Execution of Process Act 1901 </i>that were in force immediately before this Act commenced.</p>

        <section eId="part-IIIA of that Act and any rules or regulations relating to the operation of that Part continue to apply with respect to the subpoena, order or warrant, and any action taken in connection with the subpoena, order or warrant, as if that Act had not been repealed.__sec-5">
          <num>5</num>
          <heading>Consequential amendments of other Acts</heading>

            <p><b>5. </b>The Acts specified in the Schedule are amended as set out in the Schedule.</p>
