          <heading>Short title</heading>
          <content>
            <p>		This Act may be cited as the <i>Radiocommunications (Transitional Provisions and Consequential Amendments) Act 1992</i>.</p>
          </content>

          <heading>Commencement</heading>
          <content>
            <p>This Act commences on <date date="1993-07-01">1 July 1993</date>.</p>
          </content>

        <heading>Transitional provisions</heading>
        <section eId="part-2__sec-3">
          <num>3</num>
          <heading>Interpretation</heading>
          <subsection eId="part-2__sec-3__subsec-1">
            <num>1</num>
            <content>
              <p>In this Part, unless the contrary intention appears:</p>
            </content>
            <content>
              <p><term refersTo="#term-old-act">old Act</term> means <def><ref class="unresolved">the Radiocommunications Act 1983</ref>.</def></p>
              <p><term refersTo="#term-new-act">new Act</term> means <def><ref href="">the Radiocommunications Act 1992</ref>.</def></p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-3__subsec-2">
            <num>2</num>
            <content>
              <p>Subject to subsection (3), terms and expressions used in this Part have the same meaning as they have in the new Act.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-3__subsec-3">
            <num>3</num>
            <content>
              <p>Terms and expressions used in this Part that relate to the old Act or anything done under the old Act have the same meaning as they have in the old Act.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-2__sec-4">
          <num>4</num>
          <heading>Saving of instruments under the old Act</heading>
          <content>
            <p>Subject to <role refersTo="#minister">the Minister</role> that:<ref href="#sec-5">section 5</ref>, if an instrument is made by </p>
          </content>
          <paragraph eId="part-2__sec-4__para-a">
            <num>a</num>
            <content>
              <p>is an instrument of a kind referred to in column 2 of the following table; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-4__para-b">
            <num>b</num>
            <content>
              <p>was in force immediately before the commencement of this Act;</p>
            </content>
            <content>
              <p>then the instrument:</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-4__para-c">
            <num>c</num>
            <content>
              <p>continues in force immediately after that commencement as if, at the time it had been made, it had been made, in the same terms, by the SMA as an instrument of the kind referred to in the corresponding item in column 3 of the following table; and</p>
            </content>
          </paragraph>

            <num>d</num>
            <content>
              <p>is taken, for all purposes, to have been issued by the SMA as such an instrument.</p>

          <heading>Instruments subject to suspension</heading>
          <content>
            <p>If, immediately before the commencement of this Act:</p>
          </content>
          <paragraph eId="part-2__sec-5__para-a">
            <num>a</num>
            <content>
              <p>a compliance statement certificate issued under <ref href="#sec-12">section 12</ref> of the old Act is the subject of suspension under <ref href="#sec-13">section 13</ref> of the old Act; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-5__para-b">
            <num>b</num>
            <content>
              <p>a transmitter licence granted under <ref href="#sec-24">section 24</ref> or 24B of the old Act is the subject of suspension under <ref href="#sec-28">section 28</ref> of the old Act;</p>
            </content>
            <content>
              <p><ref href="#sec-4">section 4</ref> of this Act does not apply to the certificate or licence until the suspension ceases to have effect (otherwise than because of the expiry or cancellation of the certificate or licence).</p>
            </content>
          </paragraph>
        </section>
        <section eId="part-2__sec-6">
          <num>6</num>
          <heading>Authorities under transmitter licences</heading>
          <content>
            <p>An authority given by a person, under <ref href="#sec-26">section 26</ref> of the old Act, that was in force immediately before the commencement of this Act continues in force immediately after that commencement as if it had been an authorisation given by that person under <ref href="#sec-114">section 114</ref> of the new Act.</p>
          </content>
        </section>
        <section eId="part-2__sec-7">
          <num>7</num>
          <heading>Frequency reservation certificates</heading>
          <subsection eId="part-2__sec-7__subsec-1">
            <num>1</num>
            <content>
              <p>Subject to subsection (4), despite the repeal of the old Act by <ref href="#sec-13">section 13</ref> of this Act, a frequency reservation certificate granted under <ref href="#sec-21">section 21</ref> of the old Act that was in force immediately before the commencement of this Act remains in force after that commencement for the period for which it would have remained in force if the old Act were not repealed.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-7__subsec-2">
            <num>2</num>
            <content>
              <p>If an unallocated frequency is reserved in the name of a person in accordance with a frequency reservation certificate in force under subsection (1), the SMA must not issue to a person other than that person a permit or transmitter licence authorising the operation of a transmitter in a manner inconsistent with that reservation.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-7__subsec-3">
            <num>3</num>
            <content>
              <p>For the purposes of subsection (2), issuing a permit or transmitter licence that authorises the operation of a transmitter for a period not exceeding 14 days is taken to be not inconsistent with a reservation.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-7__subsec-4">
            <num>4</num>
            <content>
              <p>The SMA has the same power to cancel a frequency reservation certificate to which subsection (1) applies as <role refersTo="#minister">the Minister</role> had, immediately before the commencement of this Act, to cancel frequency reservation certificates.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-2__sec-11">
          <num>11</num>
          <heading>Regulations under the Radiocommunications Act</heading>
          <subsection eId="part-2__sec-11__subsec-1">
            <num>1</num>
            <content>
              <p>Subject to subsection (3), any regulations made under the old Act and in force immediately before the commencement of this Act continue in force as if made under the new Act.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-11__subsec-2">
            <num>2</num>
            <content>
              <p>A reference in a regulation so continued in force to a provision of the old Act is taken to be a reference to the corresponding provision in the new Act.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-11__subsec-3">
            <num>3</num>
            <content>
              <p>This section does not apply to a regulation the making of which would not be authorised by the new Act.</p>
            </content>
          </subsection>

              <p>	(2)	References in subsection 362(4) of the <i>Commonwealth Electoral Act 1918</i> as amended by this Act, and in section 108A of the <i>Referendum (Machinery Provisions) Act 1984</i> as so amended, to contraventions of the <i>Radiocommunications Act 1992</i> are taken to include references to contraventions of the <i>Radiocommunications Act 1983</i> that took place before the commencement of this Act.</p>

            <num>3</num>
            <content>
              <p>Without limiting the application of <ref href="#sec-4">section 4</ref> of this Act:</p>

                <p>	(a)	a reference in subparagraphs 91(a)(iii) and (c)(iii) of the <i>Copyright Act 1968</i>, as amended by this Act, to a transmitter licence issued under the <i>Radiocommunications Act 1992</i>;</p>

                <p>is taken to include:</p>
