        <heading>Short title</heading>
        <content>
          <p>		This Act may be cited as the <i>Witness Protection Act 1994</i>.</p>
        </content>
      </section>
      <section eId="sec-2">
        <num>2</num>
        <heading>Commencement</heading>
        <subsection eId="sec-2__subsec-1">
          <num>1</num>
          <content>
            <p>This Act commences on a day to be fixed by Proclamation.</p>
          </content>
        </subsection>
        <subsection eId="sec-2__subsec-2">
          <num>2</num>
          <content>
            <p>If this Act does not commence under subsection (1) within the period of 6 months beginning on the day on which it receives the Royal Assent, it commences on the first day after the end of that period.</p>
          </content>
        </subsection>
      </section>
      <section eId="sec-3">
        <num>3</num>
        <heading>Interpretation</heading>
        <content>
          <p>In this Act, unless the contrary intention appears:</p>
          <p><term refersTo="#term-afp-employee">AFP employee</term> has the same meaning as <def>in <ref href="">the Australian Federal Police Act 1979</ref>.</def></p>
          <p><b><i>approved authority</i></b> means:</p>
        </content>
        <paragraph eId="sec-3__para-a">
          <num>a</num>
          <content>
            <p>a Commissioner (however designated) of the police force of a State or Territory; or</p>
          </content>
        </paragraph>
        <paragraph eId="sec-3__para-aa">
          <num>aa</num>
          <content>
            <p>	(aa)	the National Anti-Corruption Commissioner (within the meaning of the <i>National Anti</i><i>-</i><i>Corruption Commission Act 2022</i>); or</p>
          </content>
        </paragraph>
        <paragraph eId="sec-3__para-b">
          <num>b</num>
          <content>
            <p>the Chief Executive Officer of the Australian Crime Commission; or</p>
          </content>
        </paragraph>
        <paragraph eId="sec-3__para-c">
          <num>c</num>
          <content>
            <p>an authority or body of the Commonwealth or of a State or Territory that:</p>
          </content>
        </paragraph>
        <paragraph eId="sec-3__para-i">
          <num>i</num>
          <content>
            <p>is authorised to conduct inquiries or investigations in relation to conduct that constitutes, or is alleged to constitute, criminal conduct, misconduct or corruption; and</p>
          </content>
        </paragraph>
        <paragraph eId="sec-3__para-ii">
          <num>ii</num>
          <content>
            <p>	(ii)	is declared by the Minister by notice in the <i>Gazette </i>to be an approved authority for the purposes of this Act.</p>
          </content>
          <content>
            <p><term refersTo="#term-assistant-commissioner">Assistant Commissioner</term> means <def>an Assistant Commissioner of the Australian Federal Police.</def></p>
            <p><term refersTo="#term-commissioner">Commissioner</term> means <def>the Commissioner of the Australian Federal Police.</def></p>
            <p><term refersTo="#term-commonwealth-identity-document">Commonwealth identity document</term> means <def>a passport, a tax file number <ref href="#sec-202A">within the meaning of section 202A</ref> of <ref href="">the Income Tax Assessment Act 1936</ref> or another document prescribed for the purposes of this definition.</def></p>
            <p><term refersTo="#term-commonwealth-officer">Commonwealth officer</term> has the same meaning as <def>in <ref href="#sec-3">section 3</ref> of <ref href="">the Crimes Act 1914</ref>.</def></p>
            <p><term refersTo="#term-commonwealth-participant">Commonwealth participant</term> means <def>a person who is a participant: in relation to an offence against a law of the Commonwealth; or 	(b)	in relation to a Royal Commission under the <i>Royal Commissions Act 1902 </i>or another commission or inquiry under a law of the Commonwealth; or in relation to an inquiry instituted by a House of the Parliament; or under <ref href="#sec-10">section 10</ref> or 10A.</def></p>
          </content>
        </paragraph>
        <paragraph eId="sec-3__para-a">
          <num>a</num>
          <content>
            <p>in relation to an offence against a law of the Commonwealth; or</p>
          </content>
        </paragraph>
        <paragraph eId="sec-3__para-b">
          <num>b</num>
          <content>
            <p>	(b)	in relation to a Royal Commission under the <i>Royal Commissions Act 1902 </i>or another commission or inquiry under a law of the Commonwealth; or</p>
          </content>
        </paragraph>
        <paragraph eId="sec-3__para-c">
          <num>c</num>
          <content>
            <p>in relation to an inquiry instituted by a House of the Parliament; or</p>
          </content>
        </paragraph>
        <paragraph eId="sec-3__para-d">
          <num>d</num>
          <content>
            <p>under <ref href="#sec-10">section 10</ref> or 10A.</p>
          </content>
          <content>
            <p><term refersTo="#term-complementary-witness-protection-law">complementary witness protection law</term> means <def>a law of a State or Territory that: makes provision for the protection of witnesses; and 	(b)	is declared under <i> </i>to be a complementary witness protection law.<ref href="#sec-3A">section 3A</ref>A</def></p>
          </content>
        </paragraph>
        <paragraph eId="sec-3__para-a">
          <num>a</num>
          <content>
            <p>makes provision for the protection of witnesses; and</p>
          </content>
        </paragraph>
        <paragraph eId="sec-3__para-b">
          <num>b</num>
          <content>
            <p>	(b)	is declared under <i> </i>to be a complementary witness protection law.<ref href="#sec-3A">section 3A</ref>A</p>
          </content>
          <content>
            <p><term refersTo="#term-current-nwpp-identity">current NWPP identity</term> means <def>an identity: provided to the participant under the NWPP; and being used by the participant at that time.</def></p>
          </content>
        </paragraph>
        <paragraph eId="sec-3__para-a">
          <num>a</num>
          <content>
            <p>provided to the participant under the NWPP; and</p>
          </content>
        </paragraph>
        <paragraph eId="sec-3__para-b">
          <num>b</num>
          <content>
            <p>being used by the participant at that time.</p>
          </content>
          <content>
            <p><term refersTo="#term-deputy-commissioner">Deputy Commissioner</term> means <def>a Deputy Commissioner of the Australian Federal Police.</def></p>
            <p><term refersTo="#term-designated-position">designated position</term> means <def>a position of a Deputy Commissioner, an AFP employee or a special member of the Australian Federal Police: the duties of which relate to the NWPP and require the occupant to have an eligible national security clearance; and that has been declared in writing by <role refersTo="#commissioner">the Commissioner</role> to be a designated position for the purposes of this Act.</def></p>
          </content>
        </paragraph>
        <paragraph eId="sec-3__para-a">
          <num>a</num>
          <content>
            <p>the duties of which relate to the NWPP and require the occupant to have an eligible national security clearance; and</p>
          </content>
        </paragraph>
        <paragraph eId="sec-3__para-b">
          <num>b</num>
          <content>
            <p>that has been declared in writing by <role refersTo="#commissioner">the Commissioner</role> to be a designated position for the purposes of this Act.</p>
          </content>
          <content>
            <p><term refersTo="#term-eligible-national-security-clearance">eligible national security clearance</term> means <def>a clearance prescribed by the regulations for the purposes of this definition.</def></p>
            <p><term refersTo="#term-former-nwpp-identity">former NWPP identity</term> means <def>an identity that: was provided to the person under the NWPP before that time; and is not the participant’s current NWPP identity at that time.</def></p>
          </content>
        </paragraph>
        <paragraph eId="sec-3__para-a">
          <num>a</num>
          <content>
            <p>was provided to the person under the NWPP before that time; and</p>
          </content>
        </paragraph>
        <paragraph eId="sec-3__para-b">
          <num>b</num>
          <content>
            <p>is not the participant’s current NWPP identity at that time.</p>
          </content>
          <content>
            <p><term refersTo="#term-former-participant">former participant</term> means <def>a person who has ceased to be included in the NWPP.</def></p>
            <p><term refersTo="#term-immigration-secretary">Immigration Secretary</term> means <def><ref class="unresolved">the Secretary of the Department administered by the Minister who administers the Migration Act 1958</ref>.</def></p>
            <p><b><i>information</i></b>,<b><i> </i></b>in relation to the identity of a person includes, but is not limited to, information about one or more of the following in relation to the person:</p>
          </content>
        </paragraph>
        <paragraph eId="sec-3__para-a">
          <num>a</num>
          <content>
            <p>appearance;</p>
          </content>
        </paragraph>
        <paragraph eId="sec-3__para-b">
          <num>b</num>
          <content>
            <p>voice quality or accent;</p>
          </content>
        </paragraph>
        <paragraph eId="sec-3__para-c">
          <num>c</num>
          <content>
            <p>mannerisms;</p>
          </content>
        </paragraph>
        <paragraph eId="sec-3__para-d">
          <num>d</num>
          <content>
            <p>address or location;</p>
          </content>
        </paragraph>
        <paragraph eId="sec-3__para-e">
          <num>e</num>
          <content>
            <p>particular skills and qualifications;</p>
          </content>
        </paragraph>
        <paragraph eId="sec-3__para-f">
          <num>f</num>
          <content>
            <p>personal history.</p>
          </content>
          <content>
            <p><term refersTo="#term-member">member</term> means <def>a member or special member of the Australian Federal Police.</def></p>
            <p><term refersTo="#term-national-security-clearance">national security clearance</term> means <def>a clearance that enables a person to have access to national security information or to an area that has been designated as secure.</def></p>
            <p><term refersTo="#term-national-security-information">national security information</term> means <def>information affecting the defence, security or international relations of Australia.</def></p>
            <p><term refersTo="#term-nwpp">NWPP</term> means <def>the National Witness Protection Program established by this Act.</def></p>
            <p><term refersTo="#term-original-identity">original identity</term> means <def>the identity of the participant at the time immediately before he or she was first provided with an identity under the NWPP.</def></p>
            <p><b><i>parent</i></b>: without limiting who is a parent of anyone for the purposes of this Act, a person is the <b><i>parent </i></b>of another person if the other person is a child of the person within the meaning of the <i>Family Law Act 1975</i>.</p>
            <p><term refersTo="#term-participant">participant</term> means <def>a person included in the NWPP and, unless the contrary intention appears, includes a former participant.</def></p>
            <p><term refersTo="#term-registrar">Registrar</term> means <def>a person who occupies the position of Registrar of births, deaths and marriages, however described, of a State or Territory.</def></p>
            <p><term refersTo="#term-state-offence-that-has-a-federal-aspect">State offence that has a federal aspect</term> has the meaning given by <def><ref href="#sec-3A">section 3A</ref>B.</def></p>
            <p><term refersTo="#term-state-participant">State participant</term> means <def>a participant: in relation to a State offence that has a federal aspect; or in relation to a State offence that does not have a federal aspect; or in relation to a commission or inquiry under a law of a State.</def></p>

        </paragraph>
        <paragraph eId="sec-3__para-a">
          <num>a</num>
          <content>
            <p>in relation to a State offence that has a federal aspect; or</p>
          </content>
        </paragraph>
        <paragraph eId="sec-3__para-b">
          <num>b</num>

            <p>in relation to a State offence that does not have a federal aspect; or</p>
          </content>
        </paragraph>
        <paragraph eId="sec-3__para-c">
          <num>c</num>
          <content>
            <p>in relation to a commission or inquiry under a law of a State.</p>
          </content>
          <content>
            <p><term refersTo="#term-territory-participant">Territory participant</term> means <def>a participant: in relation to an offence against a law of a Territory; or in relation to a commission or inquiry under a law of a Territory.</def></p>
          </content>
        </paragraph>
        <paragraph eId="sec-3__para-a">
          <num>a</num>
          <content>
            <p>in relation to an offence against a law of a Territory; or</p>
          </content>
        </paragraph>
        <paragraph eId="sec-3__para-b">
          <num>b</num>
          <content>
            <p>in relation to a commission or inquiry under a law of a Territory.</p>
          </content>
          <content>
            <p><b><i>witness</i></b> means:</p>
          </content>
        </paragraph>
        <paragraph eId="sec-3__para-a">
          <num>a</num>
          <content>
            <p>a person who has given, or who has agreed to give, evidence on behalf of the Crown in right of the Commonwealth or of a State or Territory in:</p>
          </content>
        </paragraph>
        <paragraph eId="sec-3__para-i">
          <num>i</num>
          <content>
            <p>proceedings for an offence; or</p>
          </content>
        </paragraph>
        <paragraph eId="sec-3__para-ii">
          <num>ii</num>
          <content>
            <p>	(ii)	hearings or proceedings before an authority that is declared by the Minister by notice in the <i>Gazette </i>to be an authority to which this paragraph applies; or</p>
          </content>
        </paragraph>
        <paragraph eId="sec-3__para-b">
          <num>b</num>
          <content>
            <p>a person who has given, or who has agreed to give, evidence otherwise than as mentioned in paragraph (a) in relation to the commission or possible commission of an offence against a law of the Commonwealth or of a State or Territory; or</p>
          </content>
        </paragraph>
        <paragraph eId="sec-3__para-c">
          <num>c</num>
          <content>
            <p>a person who has made a statement to the Australian Federal Police or an approved authority in relation to an offence against a law of the Commonwealth or of a State or Territory; or</p>
          </content>
        </paragraph>
        <paragraph eId="sec-3__para-d">
          <num>d</num>
          <content>
            <p>a person who, for any other reason, may require protection or other assistance under the NWPP; or</p>
          </content>
        </paragraph>
        <paragraph eId="sec-3__para-e">
          <num>e</num>
          <content>
            <p>a person who, because of his or her relationship to, or association with, a person referred to in paragraph (a), (b), (c) or (d) may require protection or other assistance under the NWPP.</p>
          </content>
        </paragraph>
      </section>
      <section eId="sec-3AA">
        <num>3AA</num>
        <heading>Declaration of complementary witness protection law</heading>
        <content>
          <p>		For the purposes of this Act, the Minister may, by legislative instrument, declare a law of a State or Territory to be a <b><i>complementary witness protection law</i></b>.</p>
        </content>
      </section>
      <section eId="sec-3AB">
        <num>3AB</num>
        <heading>State offence that has a federal aspect</heading>
        <content>
          <p>		An offence against a law of a State is taken, for the purposes of this Act, to be a <b><i>State offence that has a federal aspect</i></b>:</p>
        </content>
        <paragraph eId="sec-3AB__para-a">
          <num>a</num>
          <content>
            <p>	(a)	in a case where the offence is being investigated by the Australian Federal Police—if it would be taken to be a State offence that has a federal aspect under <i>Australian Federal Police Act 1979</i>; and<ref href="#sec-4A">section 4A</ref>A of the </p>
          </content>
        </paragraph>
        <paragraph eId="sec-3AB__para-b">
          <num>b</num>
          <content>
            <p>	(b)	in a case where the offence is being investigated by the Australian Crime Commission—if it would be taken to be a State offence that has a federal aspect under <i>Australian Crime Commission Act 2002</i>; and<ref href="#sec-4A">section 4A</ref> of the </p>
          </content>
        </paragraph>
        <paragraph eId="sec-3AB__para-c">
          <num>c</num>
          <content>
            <p>in any other case—if it would be taken to be a State offence that has a federal aspect if either of the sections referred to in paragraphs (a) and (b) were to apply.</p>
          </content>
        </paragraph>
      </section>
      <section eId="sec-3A">
        <num>3A</num>
        <heading>Application of the Criminal Code</heading>
        <content>
          <p>		Chapter 2 of the <i>Criminal Code</i> applies to all offences against this Act.</p>
        </content>

      </section>
      <section eId="sec-4">
        <num>4</num>
        <heading>Establishment of the National Witness Protection Program</heading>
        <subsection eId="sec-4__subsec-1">
          <num>1</num>
          <content>
            <p><role refersTo="#commissioner">The Commissioner</role> is to maintain a program, to be known as the National Witness Protection Program, under which <role refersTo="#commissioner">the Commissioner</role>, and persons who hold or occupy designated positions, arrange or provide protection and other assistance for witnesses.</p>
          </content>
        </subsection>
        <subsection eId="sec-4__subsec-2">
          <num>2</num>
          <content>
            <p>That protection and assistance may include things done as a result of powers and functions conferred on <role refersTo="#commissioner">the Commissioner</role> under a complementary witness protection law.</p>
          </content>
        </subsection>
      </section>
      <section eId="sec-5">
        <num>5</num>
        <heading>Inclusion in NWPP not to be done as a reward for giving evidence etc.</heading>
        <content>
          <p>The inclusion of a witness in the NWPP is not to be done as a reward or as a means of persuading or encouraging the witness to give evidence or to make a statement.</p>
        </content>
      </section>
      <section eId="sec-6">
        <num>6</num>
        <heading>Arrangements with approved authorities</heading>
        <subsection eId="sec-6__subsec-1">
          <num>1</num>
          <content>
            <p><role refersTo="#commissioner">The Commissioner</role> may make arrangements with an approved authority about any matter in connection with the administration of a complementary witness protection law.</p>
          </content>
        </subsection>
        <subsection eId="sec-6__subsec-2">
          <num>2</num>
          <content>
            <p>Without limiting the coverage of those arrangements, those arrangements:</p>
          </content>
          <paragraph eId="sec-6__subsec-2__para-a">
            <num>a</num>
            <content>
              <p>may provide for <role refersTo="#commissioner">the Commissioner</role> or a member to perform functions or exercise powers conferred by a complementary witness protection law; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-6__subsec-2__para-b">
            <num>b</num>
            <content>
              <p>must include procedures under which <role refersTo="#authority">the authority</role> shares with the Commonwealth the costs incurred in providing those services; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-6__subsec-2__para-c">
            <num>c</num>
            <content>
              <p>may provide for <role refersTo="#authority">the authority</role> to make available to <role refersTo="#commissioner">the Commissioner</role> such statements, transcripts of evidence and other documents as will assist <role refersTo="#commissioner">the Commissioner</role> in deciding:</p>
            </content>
          </paragraph>
          <paragraph eId="sec-6__subsec-2__para-i">
            <num>i</num>
            <content>
              <p>whether to include a witness in the NWPP; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-6__subsec-2__para-ii">
            <num>ii</num>
            <content>
              <p>what protection and assistance is appropriate for a participant; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-6__subsec-2__para-d">
            <num>d</num>
            <content>
              <p>may confer powers and functions under complementary witness protection laws on <role refersTo="#commissioner">the Commissioner</role>.</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-6__subsec-3">
          <num>3</num>
          <content>
            <p>The functions of <role refersTo="#commissioner">the Commissioner</role> under this Act do not include the provision of services under such an arrangement in relation to a law of a State or Territory unless the provision of those services is authorised to the extent necessary by the State or Territory concerned.</p>
          </content>
        </subsection>
      </section>
      <section eId="sec-7">
        <num>7</num>
        <heading>Witness to disclose certain matters before being included in the NWPP</heading>
        <subsection eId="sec-7__subsec-1">
          <num>1</num>
          <content>
            <p><role refersTo="#commissioner">The Commissioner</role> is not to include a witness in the NWPP unless <role refersTo="#commissioner">the Commissioner</role> is satisfied that the witness has provided <role refersTo="#commissioner">the Commissioner</role> with all information necessary for <role refersTo="#commissioner">the Commissioner</role> to decide whether the witness should be included.</p>
          </content>
        </subsection>
        <subsection eId="sec-7__subsec-2">
          <num>2</num>
          <content>
            <p>Without limiting the generality of subsection (1), a witness must:</p>
          </content>
          <paragraph eId="sec-7__subsec-2__para-a">
            <num>a</num>
            <content>
              <p>disclose to <role refersTo="#commissioner">the Commissioner</role> details of all outstanding legal obligations of the witness; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-7__subsec-2__para-b">
            <num>b</num>
            <content>
              <p>disclose to <role refersTo="#commissioner">the Commissioner</role> details of any outstanding debts of the witness, including amounts outstanding for any tax, including a tax under a law of a State or Territory; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-7__subsec-2__para-c">
            <num>c</num>
            <content>
              <p>disclose to <role refersTo="#commissioner">the Commissioner</role> details of the witness’s criminal history; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-7__subsec-2__para-d">
            <num>d</num>
            <content>
              <p>disclose to <role refersTo="#commissioner">the Commissioner</role> details of any civil proceedings that have been instituted by or against the witness; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-7__subsec-2__para-e">
            <num>e</num>
            <content>
              <p>disclose to <role refersTo="#commissioner">the Commissioner</role> details of any bankruptcy proceedings that have been instituted against the witness; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-7__subsec-2__para-f">
            <num>f</num>
            <content>
              <p>	(f)	inform the Commissioner whether the witness is an undischarged bankrupt under the<i> Bankruptcy Act 1966 </i>and, if the witness is, give to the Commissioner copies of all documents relating to the bankruptcy; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-7__subsec-2__para-g">
            <num>g</num>
            <content>
              <p>	(g)	inform the Commissioner whether the witness has entered into or intends to enter into a personal insolvency agreement under Part X of the <i>Bankruptcy Act 1966 </i>and, if the witness has done or intends to do such a thing, give to the Commissioner copies of all documents relating to that thing; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-7__subsec-2__para-h">
            <num>h</num>
            <content>
              <p>inform <role refersTo="#commissioner">the Commissioner</role> whether there are any restrictions on the witness’s holding positions in companies, whether public or private and, if there are, give to <role refersTo="#commissioner">the Commissioner</role> copies of all documents relating to those restrictions; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-7__subsec-2__para-i">
            <num>i</num>
            <content>
              <p>disclose to <role refersTo="#commissioner">the Commissioner</role> details of the witness’s immigration status; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-7__subsec-2__para-j">
            <num>j</num>
            <content>
              <p>disclose to <role refersTo="#commissioner">the Commissioner</role> details of financial liabilities and assets (whether real or personal) of the witness in relation to which:</p>
            </content>
          </paragraph>
          <paragraph eId="sec-7__subsec-2__para-i">
            <num>i</num>
            <content>
              <p>a record is kept under a law of a State or Territory; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-7__subsec-2__para-ii">
            <num>ii</num>
            <content>
              <p>the witness has entered into a contractual arrangement; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-7__subsec-2__para-k">
            <num>k</num>
            <content>
              <p>disclose to <role refersTo="#commissioner">the Commissioner</role> details of any cash held by the witness, whether in accounts or otherwise; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-7__subsec-2__para-l">
            <num>l</num>
            <content>
              <p>disclose to <role refersTo="#commissioner">the Commissioner</role> details of any reparation order that is in force against the witness; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-7__subsec-2__para-m">
            <num>m</num>
            <content>
              <p>inform <role refersTo="#commissioner">the Commissioner</role> whether any of the witness’s property (whether real or personal) is liable to forfeiture or confiscation or is subject to restraint under a law of the Commonwealth or of a State or Territory; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-7__subsec-2__para-n">
            <num>n</num>
            <content>
              <p>inform <role refersTo="#commissioner">the Commissioner</role> of the witness’s general medical condition; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-7__subsec-2__para-o">
            <num>o</num>
            <content>
              <p>disclose to <role refersTo="#commissioner">the Commissioner</role> details of any relevant court orders or arrangements relating to custody or access to children; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-7__subsec-2__para-p">
            <num>p</num>
            <content>
              <p>disclose to <role refersTo="#commissioner">the Commissioner</role> details of any business dealings in which the witness is involved; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-7__subsec-2__para-q">
            <num>q</num>
            <content>
              <p>disclose to <role refersTo="#commissioner">the Commissioner</role> details of court orders relating to sentences imposed on the witness to which the witness is subject in relation to criminal prosecutions; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-7__subsec-2__para-r">
            <num>r</num>
            <content>
              <p>disclose to <role refersTo="#commissioner">the Commissioner</role> details of any parole or licence to which the witness is subject; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-7__subsec-2__para-s">
            <num>s</num>
            <content>
              <p>give to <role refersTo="#commissioner">the Commissioner</role> copies of any documents relating to any such orders, parole or licence; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-7__subsec-2__para-t">
            <num>t</num>
            <content>
              <p>disclose to <role refersTo="#commissioner">the Commissioner</role> details of any arrangements that the witness has made for:</p>
            </content>
          </paragraph>
          <paragraph eId="sec-7__subsec-2__para-i">
            <num>i</num>
            <content>
              <p>the service of documents on the witness; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-7__subsec-2__para-ii">
            <num>ii</num>
            <content>
              <p>representation in proceedings in a court; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-7__subsec-2__para-iii">
            <num>iii</num>
            <content>
              <p>enforcement of judgments in the witness’s favour; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-7__subsec-2__para-iv">
            <num>iv</num>
            <content>
              <p>compliance with the enforcement of judgments against the witness.</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-7__subsec-3">
          <num>3</num>
          <content>
            <p><role refersTo="#commissioner">The Commissioner</role> may also:</p>
          </content>
          <paragraph eId="sec-7__subsec-3__para-a">
            <num>a</num>
            <content>
              <p>require the witness to undergo:</p>
            </content>
          </paragraph>
          <paragraph eId="sec-7__subsec-3__para-i">
            <num>i</num>
            <content>
              <p>medical tests or examinations; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-7__subsec-3__para-ii">
            <num>ii</num>
            <content>
              <p>psychological or psychiatric examinations;</p>
            </content>
            <content>
              <p>and to make the results available to <role refersTo="#commissioner">the Commissioner</role>; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-7__subsec-3__para-b">
            <num>b</num>
            <content>
              <p>make such other inquiries and investigations as <role refersTo="#commissioner">the Commissioner</role> considers necessary;</p>
            </content>
            <content>
              <p>for the purposes of assessing whether the witness should be included in the NWPP.</p>
            </content>
          </paragraph>
        </subsection>
      </section>
      <section eId="sec-8">
        <num>8</num>
        <heading>Selection for inclusion in the NWPP</heading>
        <subsection eId="sec-8__subsec-1">
          <num>1</num>
          <content>
            <p><role refersTo="#commissioner">The Commissioner</role> has the sole responsibility of deciding whether to include a witness in the NWPP, including cases where an approved authority has requested that a witness be included in the NWPP.</p>
          </content>
        </subsection>
        <subsection eId="sec-8__subsec-2">
          <num>2</num>
          <content>
            <p>A witness may be included in the NWPP only if:</p>
          </content>
          <paragraph eId="sec-8__subsec-2__para-a">
            <num>a</num>
            <content>
              <p><role refersTo="#commissioner">the Commissioner</role> has decided that the witness be included; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-8__subsec-2__para-b">
            <num>b</num>
            <content>
              <p>the witness agrees to be included; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-8__subsec-2__para-c">
            <num>c</num>
            <content>
              <p>the witness signs a memorandum of understanding in accordance with <ref href="#sec-9">section 9</ref> or:</p>
            </content>
          </paragraph>
          <paragraph eId="sec-8__subsec-2__para-i">
            <num>i</num>
            <content>
              <p>if the witness is under 18 years—a parent or guardian of the witness signs such a memorandum; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-8__subsec-2__para-ii">
            <num>ii</num>
            <content>
              <p>if the witness otherwise lacks legal capacity to sign the memorandum—a guardian or other person who is usually responsible for the care and control of the witness signs such a memorandum.</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-8__subsec-3">
          <num>3</num>
          <content>
            <p><role refersTo="#commissioner">The Commissioner</role> must, in deciding whether to include a witness in the NWPP, have regard to:</p>
          </content>
          <paragraph eId="sec-8__subsec-3__para-a">
            <num>a</num>
            <content>
              <p>whether the witness has a criminal record, particularly in respect of crimes of violence, and whether that record indicates a risk to the public if the witness is included in the NWPP; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-8__subsec-3__para-b">
            <num>b</num>
            <content>
              <p>if a psychological or psychiatric examination or evaluation of the witness has been conducted to determine the witness’s suitability for inclusion in the NWPP—that examination or evaluation; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-8__subsec-3__para-c">
            <num>c</num>
            <content>
              <p>the seriousness of the offence to which any relevant evidence or statement relates; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-8__subsec-3__para-d">
            <num>d</num>
            <content>
              <p>the nature and importance of any relevant evidence or statement; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-8__subsec-3__para-e">
            <num>e</num>
            <content>
              <p>whether there are viable alternative methods of protecting the witness; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-8__subsec-3__para-f">
            <num>f</num>
            <content>
              <p>the nature of the perceived danger to the witness; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-8__subsec-3__para-g">
            <num>g</num>
            <content>
              <p>the nature of the witness’s relationship to other witnesses being assessed for inclusion in the NWPP;</p>
            </content>
            <content>
              <p>and may have regard to such other matters as <role refersTo="#commissioner">the Commissioner</role> considers relevant.</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-8__subsec-4">
          <num>4</num>
          <content>
            <p><role refersTo="#commissioner">The Commissioner</role> must not include a witness in the NWPP if <role refersTo="#commissioner">the Commissioner</role> does not, in his or her opinion, have enough information to assess the matters referred to in subsection (3) in relation to the witness.</p>
          </content>
        </subsection>
        <subsection eId="sec-8__subsec-5">
          <num>5</num>
          <content>
            <p>If:</p>
          </content>
          <paragraph eId="sec-8__subsec-5__para-a">
            <num>a</num>
            <content>
              <p>a parent or guardian of a witness signs a memorandum of understanding because the witness was under 18 years; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-8__subsec-5__para-b">
            <num>b</num>
            <content>
              <p>the witness is included in the NWPP and remains a participant until after he or she turns 18;</p>
            </content>
            <content>
              <p><role refersTo="#commissioner">the Commissioner</role> may require the participant to sign another memorandum of understanding.</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-8__subsec-6">
          <num>6</num>
          <content>
            <p>In this section:</p>
          </content>
          <content>
            <p><b><i>participant </i></b>does not include a former participant.</p>
          </content>
        </subsection>
      </section>
      <section eId="sec-9">
        <num>9</num>
        <heading>Memorandum of understanding</heading>
        <subsection eId="sec-9__subsec-1">
          <num>1</num>
          <content>
            <p>A memorandum of understanding is to:</p>
          </content>
          <paragraph eId="sec-9__subsec-1__para-a">
            <num>a</num>
            <content>
              <p>set out the basis on which a participant is included in the NWPP and details of the protection and assistance that is to be provided; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-9__subsec-1__para-b">
            <num>b</num>
            <content>
              <p>contain a provision to the effect that protection and assistance under the NWPP may be terminated if the participant breaches a term of the memorandum of understanding.</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-9__subsec-2">
          <num>2</num>
          <content>
            <p>A memorandum of understanding in relation to a participant may also contain:</p>
          </content>
          <paragraph eId="sec-9__subsec-2__para-a">
            <num>a</num>
            <content>
              <p>the terms and conditions on which protection and assistance is to be provided to the participant, which may include a condition that protection and assistance may be withdrawn if the participant:</p>
            </content>
          </paragraph>
          <paragraph eId="sec-9__subsec-2__para-i">
            <num>i</num>
            <content>
              <p>commits an offence against a law of the Commonwealth or of a State or Territory; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-9__subsec-2__para-ii">
            <num>ii</num>
            <content>
              <p>engages in activities of a kind specified in the memorandum of understanding; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-9__subsec-2__para-iii">
            <num>iii</num>
            <content>
              <p>compromises the integrity of the NWPP; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-9__subsec-2__para-b">

              <p>an agreement by or on behalf of the participant not to compromise, directly or indirectly, the security of, or any other aspect of, the protection or assistance being provided; and</p>

              <p>an agreement by or on behalf of the participant that the participant comply with all reasonable directions of <role refersTo="#commissioner">the Commissioner</role> in relation to the protection and assistance provided to the participant; and</p>

            <num>d</num>
            <content>
              <p>an agreement by or on behalf of the participant that the participant will, if required to do so by <role refersTo="#commissioner">the Commissioner</role>:</p>
            </content>
          </paragraph>
          <paragraph eId="sec-9__subsec-2__para-i">
            <num>i</num>
            <content>
              <p>undergo medical, psychological or psychiatric tests or examinations and make the results available to <role refersTo="#commissioner">the Commissioner</role>; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-9__subsec-2__para-ii">
            <num>ii</num>
            <content>
              <p>undergo drug or alcohol counselling or treatment; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-9__subsec-2__para-e">
            <num>e</num>
            <content>
              <p>a list of:</p>
            </content>
          </paragraph>
          <paragraph eId="sec-9__subsec-2__para-i">
            <num>i</num>
            <content>
              <p>the outstanding legal obligations (including family maintenance obligations and taxation obligations) of the participant; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-9__subsec-2__para-ii">
            <num>ii</num>
            <content>
              <p>any other obligations of the participant;</p>
            </content>
            <content>
              <p>and an agreement by or on behalf of the participant as to how those obligations are to be met; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-9__subsec-2__para-f">
            <num>f</num>
            <content>
              <p>a financial support arrangement; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-9__subsec-2__para-g">
            <num>g</num>
            <content>
              <p>an agreement by or on behalf of the participant that the participant will disclose to <role refersTo="#commissioner">the Commissioner</role> details of any criminal charges that are made against, and any civil or bankruptcy proceedings that are made in relation to, the participant after the participant is included in the NWPP; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-9__subsec-2__para-h">
            <num>h</num>
            <content>
              <p>details of how a suspension of protection and assistance under <ref href="#sec-17A">section 17A</ref> or 17B affects any of the other matters in the memorandum of understanding.</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-9__subsec-3">
          <num>3</num>
          <content>
            <p>A memorandum of understanding must be signed by or on behalf of the witness in the presence of a person who holds or occupies a designated position.</p>
          </content>
        </subsection>
        <subsection eId="sec-9__subsec-4">
          <num>4</num>
          <content>
            <p>A witness becomes included in the NWPP when <role refersTo="#commissioner">the Commissioner</role> signs the memorandum of understanding.</p>
          </content>
        </subsection>
        <subsection eId="sec-9__subsec-5">
          <num>5</num>
          <content>
            <p><role refersTo="#commissioner">The Commissioner</role> must, as soon as practicable after signing a memorandum of understanding, notify the relevant participant that it has been signed.</p>
          </content>
        </subsection>
        <subsection eId="sec-9__subsec-6">
          <num>6</num>
          <content>
            <p>Subject to subsection (7), <role refersTo="#commissioner">the Commissioner</role> may, by notice in writing given to a participant, vary the memorandum of understanding, and a variation takes effect on the day on which the notice is received by the participant.</p>
          </content>
        </subsection>
        <subsection eId="sec-9__subsec-7">
          <num>7</num>
          <content>
            <p>A variation must not have the effect of removing from the memorandum of understanding the provisions referred to in subsection (1).</p>
          </content>
        </subsection>
        <subsection eId="sec-9__subsec-8">
          <num>8</num>
          <content>
            <p>In this section:</p>
          </content>
          <content>
            <p><b><i>participant </i></b>does not include a former participant.</p>
          </content>
        </subsection>
        <subsection eId="sec-9__subsec-9">
          <num>9</num>
          <content>
            <p>To avoid doubt, subsection (8) does not affect any obligation of a former participant under a memorandum of understanding if the obligation continues (whether expressly or impliedly) to have effect after the former participant ceased to be included in the NWPP.</p>
          </content>
        </subsection>
      </section>
      <section eId="sec-10">
        <num>10</num>
        <heading>Inclusion of foreign nationals or residents in NWPP at the request of foreign law enforcement agencies</heading>
        <subsection eId="sec-10__subsec-1">
          <num>1</num>
          <content>
            <p>If:</p>
          </content>
          <paragraph eId="sec-10__subsec-1__para-a">
            <num>a</num>
            <content>
              <p>	(a)	the Minister receives a request from an appropriate authority of a foreign country (the <b><i>agency</i></b>) for the inclusion of a person (the <b><i>nominated person</i></b>) who is a citizen or a resident of that country in the NWPP; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-10__subsec-1__para-b">
            <num>b</num>
            <content>
              <p><role refersTo="#minister">the Minister</role> is satisfied that:</p>
            </content>
          </paragraph>
          <paragraph eId="sec-10__subsec-1__para-i">
            <num>i</num>
            <content>
              <p>the agency has provided all material that is necessary to support the request; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-10__subsec-1__para-ii">
            <num>ii</num>
            <content>
              <p>it is appropriate to do so in all the circumstances;</p>
            </content>
            <content>
              <p><role refersTo="#minister">the Minister</role> is to refer the request to <role refersTo="#commissioner">the Commissioner</role>.</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-10__subsec-2">
          <num>2</num>
          <content>
            <p><role refersTo="#commissioner">The Commissioner</role> is to consider including the nominated person in the NWPP in the same way as <role refersTo="#commissioner">the Commissioner</role> would consider including another person in the NWPP.</p>
          </content>
        </subsection>
        <subsection eId="sec-10__subsec-3">
          <num>3</num>
          <content>
            <p><role refersTo="#commissioner">The Commissioner</role> may, if he or she thinks it appropriate to do so, seek further information about the nominated person from the agency.</p>
          </content>
        </subsection>
        <subsection eId="sec-10__subsec-4">
          <num>4</num>
          <content>
            <p>If:</p>
          </content>
          <paragraph eId="sec-10__subsec-4__para-a">
            <num>a</num>
            <content>
              <p><role refersTo="#commissioner">the Commissioner</role> decides that the nominated person is suitable for inclusion in the NWPP; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-10__subsec-4__para-b">
            <num>b</num>
            <content>
              <p><role refersTo="#minister">the Minister</role>, after considering a report from <role refersTo="#commissioner">the Commissioner</role> recommending the inclusion of the person in the NWPP, has decided that it is appropriate in all the circumstances that the person be included in the NWPP; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-10__subsec-4__para-c">
            <num>c</num>
            <content>
              <p><role refersTo="#commissioner">the Commissioner</role> has entered into an arrangement with the agency for the purpose of making services under the NWPP available to the agency; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-10__subsec-4__para-d">
            <num>d</num>
            <content>
              <p>the nominated person has been granted a visa for entry to Australia;</p>
            </content>
            <content>
              <p><role refersTo="#commissioner">the Commissioner</role> is to include the nominated person in the NWPP.</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-10__subsec-5">
          <num>5</num>
          <content>
            <p>An arrangement referred to in paragraph (4)(c) must include procedures under which the agency pays the costs associated with providing protection for the nominated person and any associated persons, including:</p>
          </content>
          <paragraph eId="sec-10__subsec-5__para-a">
            <num>a</num>
            <content>
              <p>the costs of travel by those persons and the costs of associated travel by members; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-10__subsec-5__para-b">
            <num>b</num>
            <content>
              <p>any costs that will be incurred if protection and assistance under the NWPP to the nominated person is terminated; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-10__subsec-5__para-c">
            <num>c</num>
            <content>
              <p>such other costs as <role refersTo="#commissioner">the Commissioner</role> determines.</p>
            </content>
          </paragraph>
        </subsection>
      </section>
      <section eId="sec-10A">
        <num>10A</num>
        <heading>Inclusion of persons in NWPP at the request of International Criminal Court</heading>
        <subsection eId="sec-10A__subsec-1">
          <num>1</num>
          <content>
            <p>If:</p>
          </content>
          <paragraph eId="sec-10A__subsec-1__para-a">
            <num>a</num>
            <content>
              <p>	(a)	the Minister receives a request from the International Criminal Court for the inclusion of a person (the <b><i>nominated person</i></b>) in the NWPP; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-10A__subsec-1__para-b">
            <num>b</num>
            <content>
              <p><role refersTo="#minister">the Minister</role> is satisfied that:</p>
            </content>
          </paragraph>
          <paragraph eId="sec-10A__subsec-1__para-i">
            <num>i</num>
            <content>
              <p>the Court has provided all material that is necessary to support the request; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-10A__subsec-1__para-ii">
            <num>ii</num>
            <content>
              <p>it is appropriate to do so in all the circumstances;</p>
            </content>
            <content>
              <p><role refersTo="#minister">the Minister</role> is to refer the request to <role refersTo="#commissioner">the Commissioner</role>.</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-10A__subsec-2">
          <num>2</num>
          <content>
            <p><role refersTo="#commissioner">The Commissioner</role> is to consider including the nominated person in the NWPP in the same way as <role refersTo="#commissioner">the Commissioner</role> would consider including another person in the NWPP.</p>
          </content>
        </subsection>
        <subsection eId="sec-10A__subsec-3">
          <num>3</num>
          <content>
            <p><role refersTo="#commissioner">The Commissioner</role> may, if he or she thinks it appropriate to do so, seek further information about the nominated person from the Court.</p>
          </content>
        </subsection>
        <subsection eId="sec-10A__subsec-4">
          <num>4</num>
          <content>
            <p>If:</p>
          </content>
          <paragraph eId="sec-10A__subsec-4__para-a">
            <num>a</num>
            <content>
              <p><role refersTo="#commissioner">the Commissioner</role> decides that the nominated person is suitable for inclusion in the NWPP; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-10A__subsec-4__para-b">
            <num>b</num>
            <content>
              <p><role refersTo="#minister">the Minister</role>, after considering a report from <role refersTo="#commissioner">the Commissioner</role> recommending the inclusion of the person in the NWPP, has decided that it is appropriate in all the circumstances that the person be included in the NWPP; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-10A__subsec-4__para-c">
            <num>c</num>
            <content>
              <p><role refersTo="#commissioner">the Commissioner</role> has entered into an arrangement with the Court for the purpose of making services under the NWPP available to the Court; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-10A__subsec-4__para-d">
            <num>d</num>
            <content>
              <p>if the person is not an Australian citizen—the nominated person has been granted a visa for entry to Australia;</p>
            </content>
            <content>
              <p><role refersTo="#commissioner">the Commissioner</role> is to include the nominated person in the NWPP.</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-10A__subsec-5">
          <num>5</num>
          <content>
            <p>An arrangement referred to in paragraph (4)(c) must include procedures under which the Court pays the costs associated with providing protection for the nominated person and any associated persons, including:</p>
          </content>
          <paragraph eId="sec-10A__subsec-5__para-a">
            <num>a</num>
            <content>
              <p>the costs of travel by those persons and the costs of associated travel by members; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-10A__subsec-5__para-b">
            <num>b</num>
            <content>
              <p>any costs that will be incurred if protection and assistance under the NWPP to the nominated person is terminated; and</p>

            <num>c</num>
            <content>
              <p>such other costs as <role refersTo="#commissioner">the Commissioner</role> determines.</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-10A__subsec-6">
          <num>6</num>
          <content>
            <p>In this section:</p>
          </content>
          <content>
            <p><b><i>International Criminal Court</i></b> has the same meaning as in the <i>International Criminal Court Act 2002</i>.</p>
          </content>
        </subsection>
      </section>
      <section eId="sec-11">
        <num>11</num>
        <heading>Register of participants</heading>
        <subsection eId="sec-11__subsec-1">
          <num>1</num>
          <content>
            <p><role refersTo="#commissioner">The Commissioner</role> is to maintain a Register of participants.</p>
          </content>
        </subsection>
        <subsection eId="sec-11__subsec-2">
          <num>2</num>
          <content>
            <p>The Register may be maintained by electronic means.</p>
          </content>
        </subsection>
        <subsection eId="sec-11__subsec-3">
          <num>3</num>
          <content>
            <p><role refersTo="#commissioner">The Commissioner</role> is to include the following details in the Register in respect of each participant:</p>
          </content>
          <paragraph eId="sec-11__subsec-3__para-a">
            <num>a</num>
            <content>
              <p>the participant’s name;</p>
            </content>
          </paragraph>
          <paragraph eId="sec-11__subsec-3__para-b">
            <num>b</num>
            <content>
              <p>if the participant has been provided with a new identity under the NWPP—the participant’s new name for each new identity;</p>
            </content>
          </paragraph>
          <paragraph eId="sec-11__subsec-3__para-c">
            <num>c</num>
            <content>
              <p>the participant’s address;</p>
            </content>
          </paragraph>
          <paragraph eId="sec-11__subsec-3__para-d">
            <num>d</num>
            <content>
              <p>details of any offences of which the participant has been convicted;</p>
            </content>
          </paragraph>
          <paragraph eId="sec-11__subsec-3__para-e">
            <num>e</num>
            <content>
              <p>in the case of a former participant—the date on which the person became a former participant.</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-11__subsec-4">
          <num>4</num>
          <content>
            <p><role refersTo="#commissioner">The Commissioner</role> is also to include in the Register details of any permissions given by <role refersTo="#commissioner">the Commissioner</role> under section 16.</p>
          </content>
        </subsection>
        <subsection eId="sec-11__subsec-5">
          <num>5</num>
          <content>
            <p><role refersTo="#commissioner">The Commissioner</role> is to keep in conjunction with the Register:</p>
          </content>
          <paragraph eId="sec-11__subsec-5__para-a">
            <num>a</num>
            <content>
              <p>the original of each memorandum of understanding; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-11__subsec-5__para-b">
            <num>b</num>
            <content>
              <p>copies of each new birth certificate that is issued under the NWPP; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-11__subsec-5__para-c">
            <num>c</num>
            <content>
              <p>the original of each permission given by <role refersTo="#commissioner">the Commissioner</role> under section 16; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-11__subsec-5__para-d">
            <num>d</num>
            <content>
              <p>any documents returned to <role refersTo="#commissioner">the Commissioner</role> as a result of a notification under subsection 19(6).</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-11__subsec-6">
          <num>6</num>
          <content>
            <p>	(6)	In this section, <b><i>participant</i></b> and <b><i>former participant</i></b><b> </b>do not include a person who is a former participant only because of the operation of subsection 13(6).</p>
          </content>
        </subsection>
      </section>
      <section eId="sec-12">
        <num>12</num>
        <heading>Access to Register</heading>
        <subsection eId="sec-12__subsec-1">
          <num>1</num>
          <content>
            <p>Subject to this section, only <role refersTo="#commissioner">the Commissioner</role>, and persons who hold or occupy designated positions and who are authorised by <role refersTo="#commissioner">the Commissioner</role>, are to have access to the Register and to documents kept in conjunction with the Register.</p>
          </content>
        </subsection>
        <subsection eId="sec-12__subsec-2">
          <num>2</num>
          <content>
            <p><role refersTo="#commissioner">The Commissioner</role> must allow the Commonwealth Ombudsman, or a person authorised by the Commonwealth Ombudsman who has an eligible national security clearance, to have access to the Register or part of the Register or to some or all of the documents kept in conjunction with the Register for the purposes of:</p>
          </content>
          <paragraph eId="sec-12__subsec-2__para-a">
            <num>a</num>
            <content>
              <p>	(a)	an investigation by the Ombudsman under the <i>Ombudsman Act 1976</i>; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-12__subsec-2__para-b">
            <num>b</num>
            <content>
              <p>	(b)	an investigation under Part V of the <i>Australian Federal Police Act 1979</i>.</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-12__subsec-3">
          <num>3</num>
          <content>
            <p><role refersTo="#commissioner">The Commissioner</role> may, if he or she is of the opinion that it is in the interests of the due administration of justice to do so, allow another person to have access to the Register or part of the Register or to some or all of the documents kept in conjunction with the Register.</p>
          </content>
        </subsection>
        <subsection eId="sec-12__subsec-4">
          <num>4</num>
          <content>
            <p>If <role refersTo="#commissioner">the Commissioner</role> allows another person access under subsection (3), <role refersTo="#commissioner">the Commissioner</role> must notify the relevant approved authority of:</p>
          </content>
          <paragraph eId="sec-12__subsec-4__para-a">
            <num>a</num>
            <content>
              <p>the name of the person to whom the access was allowed; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-12__subsec-4__para-b">
            <num>b</num>
            <content>
              <p>the information the person was allowed access to; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-12__subsec-4__para-c">
            <num>c</num>
            <content>
              <p>the reasons for allowing access.</p>
            </content>
          </paragraph>
        </subsection>
      </section>
      <section eId="sec-13">
        <num>13</num>
        <heading>Action to protect witnesses, participants and former participants etc.</heading>
        <subsection eId="sec-13__subsec-1">
          <num>1</num>
          <content>
            <p>If a witness is included in the NWPP, or is being assessed for inclusion in the NWPP, <role refersTo="#commissioner">the Commissioner</role> is to take such action as <role refersTo="#commissioner">the Commissioner</role> considers necessary and reasonable to protect the witness’s safety and welfare while also protecting the safety of <role refersTo="#commissioner">the Commissioner</role>, a Deputy Commissioner, AFP employees and special members of the Australian Federal Police.</p>
          </content>
        </subsection>
        <subsection eId="sec-13__subsec-2">
          <num>2</num>
          <content>
            <p>That action may include:</p>
          </content>
          <paragraph eId="sec-13__subsec-2__para-a">
            <num>a</num>
            <content>
              <p>applying for any documents necessary:</p>
            </content>
          </paragraph>
          <paragraph eId="sec-13__subsec-2__para-i">
            <num>i</num>
            <content>
              <p>to allow the witness to establish a new identity; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-13__subsec-2__para-ii">
            <num>ii</num>
            <content>
              <p>otherwise to protect the witness; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-13__subsec-2__para-b">
            <num>b</num>
            <content>
              <p>	(b)	permitting persons who hold or occupy designated positions to acquire and use assumed identities in accordance with <i>Crimes Act 1914</i>; and<ref href="#part-IA">Part IA</ref>C of the </p>
            </content>
          </paragraph>
          <paragraph eId="sec-13__subsec-2__para-c">
            <num>c</num>
            <content>
              <p>relocating the witness; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-13__subsec-2__para-d">
            <num>d</num>
            <content>
              <p>providing accommodation for the witness; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-13__subsec-2__para-e">
            <num>e</num>
            <content>
              <p>providing transport for the witness’s property; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-13__subsec-2__para-f">
            <num>f</num>
            <content>
              <p>providing payments to the witness for the purpose of meeting the reasonable living expenses of the witness (including, where appropriate, living expenses of the witness’s family) and providing, whether directly or indirectly, other reasonable financial assistance; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-13__subsec-2__para-g">
            <num>g</num>
            <content>
              <p>providing payments to the witness for the purpose of meeting costs associated with relocation; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-13__subsec-2__para-h">
            <num>h</num>
            <content>
              <p>providing assistance to the witness in obtaining employment or access to education; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-13__subsec-2__para-i">
            <num>i</num>
            <content>
              <p>providing other assistance to the witness with a view to ensuring that the witness becomes self-sustaining; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-13__subsec-2__para-j">
            <num>j</num>
            <content>
              <p>doing other things that <role refersTo="#commissioner">the Commissioner</role> considers to be necessary to ensure the safety of the witness.</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-13__subsec-3">
          <num>3</num>
          <content>
            <p><role refersTo="#commissioner">The Commissioner</role> must not obtain documentation for a witness that represents the witness:</p>
          </content>
          <paragraph eId="sec-13__subsec-3__para-a">
            <num>a</num>
            <content>
              <p>to have qualifications that the witness does not have; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-13__subsec-3__para-b">
            <num>b</num>
            <content>
              <p>to be entitled to benefits to which the witness would not otherwise be entitled.</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-13__subsec-4">
          <num>4</num>
          <content>
            <p>A Commonwealth officer must not prepare documentation relating to the establishment of a new identity for a participant unless the officer has an eligible national security clearance.</p>
          </content>
        </subsection>
        <subsection eId="sec-13__subsec-5">
          <num>5</num>
          <content>
            <p><role refersTo="#commissioner">The Commissioner</role> may take the actions referred to in subsections (1) and (2) in respect of a former participant, or any other person whose relationship with the former participant is such that <role refersTo="#commissioner">the Commissioner</role> is satisfied that it is appropriate to take those actions, as if the former participant or other person were a witness included in the NWPP, if:</p>
          </content>
          <paragraph eId="sec-13__subsec-5__para-a">
            <num>a</num>
            <content>
              <p><role refersTo="#commissioner">the Commissioner</role> considers the actions necessary and reasonable for the protection of the former participant or the other person; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-13__subsec-5__para-b">
            <num>b</num>
            <content>
              <p><role refersTo="#commissioner">the Commissioner</role> has assessed the suitability of taking the actions in respect of the former participant or the other person.</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-13__subsec-6">
          <num>6</num>
          <content>
            <p>If <role refersTo="#commissioner">the Commissioner</role> takes action under subsection (5) in respect of a person other than a former participant, this Act applies to the person as if the person were a former participant.</p>
          </content>
        </subsection>

          <num>7</num>
          <content>
            <p>When <role refersTo="#commissioner">the Commissioner</role> first takes action under subsection (5) in respect of a former participant who was a participant under section 10 or 10A, <role refersTo="#commissioner">the Commissioner</role> must give the Immigration Secretary, or an officer nominated by that Secretary, written notice that he or she has taken that action.</p>
          </content>
        </subsection>
      </section>
      <section eId="sec-14">
        <num>14</num>
        <heading>Special provision in case of marriage of participant</heading>
        <content>
          <p>If:</p>
        </content>
        <paragraph eId="sec-14__para-a">
          <num>a</num>
          <content>
            <p>a participant who has been provided with a new identity under the NWPP wishes to marry; and</p>
          </content>
        </paragraph>
        <paragraph eId="sec-14__para-b">
          <num>b</num>
          <content>
            <p>the participant has given to <role refersTo="#commissioner">the Commissioner</role> or an approved authority evidence that satisfies <role refersTo="#commissioner">the Commissioner</role> or the approved authority:</p>
          </content>
        </paragraph>
        <paragraph eId="sec-14__para-i">
          <num>i</num>
          <content>
            <p>that the participant is of marriageable age; and</p>
          </content>
        </paragraph>
        <paragraph eId="sec-14__para-ii">
          <num>ii</num>
          <content>
            <p>of the original identity of the participant; and</p>
          </content>
        </paragraph>
        <paragraph eId="sec-14__para-c">
          <num>c</num>
          <content>
            <p>if the participant has been married previously—the participant has given to <role refersTo="#commissioner">the Commissioner</role> or an approved authority evidence that satisfies <role refersTo="#commissioner">the Commissioner</role> or the approved authority that the person’s previous spouse has died or that the participant is divorced; and</p>
          </content>
        </paragraph>
        <paragraph eId="sec-14__para-d">
          <num>d</num>
          <content>
            <p>the participant has given to <role refersTo="#commissioner">the Commissioner</role> or an approved authority a statutory declaration to the effect that there is no legal impediment to the marriage and <role refersTo="#commissioner">the Commissioner</role> or the approved authority is not aware of any legal impediment to the marriage;</p>
          </content>
          <content>
            <p><role refersTo="#commissioner">the Commissioner</role> or the approved authority may give a certificate to a Registrar stating that <role refersTo="#commissioner">the Commissioner</role> or <role refersTo="#authority">the authority</role> has received the evidence referred to in paragraphs (b) and (c) and the statutory declaration referred to in paragraph (d).</p>
          </content>
        </paragraph>
      </section>
      <section eId="sec-15">
        <num>15</num>
        <heading>Dealing with rights and obligations of participant</heading>
        <subsection eId="sec-15__subsec-1">
          <num>1</num>
          <content>
            <p>If a participant has any outstanding rights or obligations or is subject to any restrictions, <role refersTo="#commissioner">the Commissioner</role> is to take such steps as are reasonably practicable to ensure that:</p>
          </content>
          <paragraph eId="sec-15__subsec-1__para-a">
            <num>a</num>
            <content>
              <p>those rights or obligations are dealt with according to law; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-15__subsec-1__para-b">
            <num>b</num>
            <content>
              <p>the person complies with those restrictions.</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-15__subsec-2">
          <num>2</num>
          <content>
            <p>That action may include:</p>
          </content>
          <paragraph eId="sec-15__subsec-2__para-a">
            <num>a</num>
            <content>
              <p>providing protection for the participant while the participant is attending court; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-15__subsec-2__para-b">
            <num>b</num>
            <content>
              <p>notifying a party or possible party to legal proceedings that <role refersTo="#commissioner">the Commissioner</role> will accept process issued by a court or tribunal on behalf of the participant, and nominating a member for the purpose.</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-15__subsec-3">
          <num>3</num>
          <content>
            <p>If <role refersTo="#commissioner">the Commissioner</role> is satisfied that a participant who has been provided with a new identity under the NWPP is using the new identity to:</p>
          </content>
          <paragraph eId="sec-15__subsec-3__para-a">
            <num>a</num>
            <content>
              <p>avoid obligations that were incurred before the new identity was established; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-15__subsec-3__para-b">
            <num>b</num>
            <content>
              <p>avoid complying with restrictions that were imposed on the person before the new identity was established;</p>
            </content>
            <content>
              <p><role refersTo="#commissioner">the Commissioner</role> is to give notice in writing to the participant stating that he or she is so satisfied.</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-15__subsec-4">
          <num>4</num>
          <content>
            <p>The notice is also to state that, unless the participant satisfies <role refersTo="#commissioner">the Commissioner</role> that the obligations will be dealt with according to law or the restrictions will be complied with, <role refersTo="#commissioner">the Commissioner</role> will take such action as he or she considers reasonably necessary to ensure that they are dealt with according to law or complied with.</p>
          </content>
        </subsection>
        <subsection eId="sec-15__subsec-5">
          <num>5</num>
          <content>
            <p>That action may include informing a person who is seeking to enforce rights against the participant of the details of any property (whether real or personal) owned by the participant under his or her original identity or a former NWPP identity.</p>
          </content>
        </subsection>
      </section>
      <section eId="sec-16">
        <num>16</num>
        <heading>Non-disclosure of former identity of participant</heading>
        <subsection eId="sec-16__subsec-1">
          <num>1</num>
          <content>
            <p>If:</p>
          </content>
          <paragraph eId="sec-16__subsec-1__para-a">
            <num>a</num>
            <content>
              <p>a participant who has been provided with a new identity under the NWPP would, apart from this section, be required by or under a law of the Commonwealth to disclose his or her original identity or a former NWPP identity for a particular purpose; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-16__subsec-1__para-b">
            <num>b</num>
            <content>
              <p><role refersTo="#commissioner">the Commissioner</role> has given the participant permission, in the prescribed form, not to disclose the original identity or the former NWPP identity for that purpose;</p>
            </content>
            <content>
              <p>the participant is not required to disclose the original identity or the former NWPP identity to any person for that purpose.</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-16__subsec-2">
          <num>2</num>
          <content>
            <p>If a participant has been given permission under subsection (1) not to disclose his or her original identity or any former NWPP identity for a particular purpose, it is lawful for the participant, in any proceedings, or for any purpose, under or in relation to the relevant law of the Commonwealth, to claim that his or her current NWPP identity is his or her only identity.</p>
          </content>
        </subsection>
        <subsection eId="sec-16__subsec-3">
          <num>3</num>
          <content>
            <p>It is the duty of each Commonwealth officer and former Commonwealth officer who has obtained access to information or a document relevant to the NWPP not to disclose that information or publish that document except as authorised by <role refersTo="#commissioner">the Commissioner</role>.</p>
          </content>
        </subsection>
        <subsection eId="sec-16__subsec-4">
          <num>4</num>
          <content>
            <p>If, under a complementary witness protection law of a State or Territory, it is lawful for a participant not to disclose his or her original identity or any former NWPP identity for a purpose approved by <role refersTo="#commissioner">the Commissioner</role>, the participant is not required to disclose his or her original identity or any former NWPP identity to a Commonwealth officer for that purpose.</p>
          </content>
        </subsection>
        <subsection eId="sec-16__subsec-5">
          <num>5</num>
          <content>
            <p>In addition to prescribing a form for the purposes of a permission under subsection (1), the regulations may prescribe a form for the purposes of a similar permission of <role refersTo="#commissioner">the Commissioner</role> under a complementary witness protection law of a State or Territory.</p>
          </content>
        </subsection>
      </section>
      <section eId="sec-17">
        <num>17</num>
        <heading>Special commercial arrangements by Commissioner</heading>
        <content>
          <p>This Act does not prevent <role refersTo="#commissioner">the Commissioner</role> from making commercial arrangements with a person under which a participant is able to obtain benefits under a contract or arrangement without revealing his or her original identity or any former NWPP identity.</p>
        </content>
      </section>
      <section eId="sec-17A">
        <num>17A</num>
        <heading>Suspension of protection and assistance on request by participant</heading>
        <subsection eId="sec-17A__subsec-1">
          <num>1</num>
          <content>
            <p>Protection and assistance provided under the NWPP to a participant may be suspended by <role refersTo="#commissioner">the Commissioner</role> if the participant requests in writing that it be suspended.</p>
          </content>
        </subsection>
        <subsection eId="sec-17A__subsec-2">
          <num>2</num>
          <content>
            <p>A suspension under subsection (1) takes effect:</p>
          </content>
          <paragraph eId="sec-17A__subsec-2__para-a">
            <num>a</num>
            <content>
              <p>if the request specifies a time, and <role refersTo="#commissioner">the Commissioner</role> makes a decision on the request before that time—at the time specified in the request; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-17A__subsec-2__para-b">
            <num>b</num>
            <content>
              <p>otherwise—at a time determined by <role refersTo="#commissioner">the Commissioner</role>.</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-17A__subsec-3">
          <num>3</num>
          <content>
            <p>A suspension under subsection (1) ceases to have effect:</p>
          </content>
          <paragraph eId="sec-17A__subsec-3__para-a">
            <num>a</num>
            <content>
              <p>when the participant requests in writing that the suspension cease; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-17A__subsec-3__para-b">
            <num>b</num>
            <content>
              <p>if the request under subsection (1) specifies a time for the suspension to cease—at that time.</p>
            </content>
            <content>
              <p>Notice of decision</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-17A__subsec-4">
          <num>4</num>
          <content>
            <p>If a participant makes a request under subsection (1), <role refersTo="#commissioner">the Commissioner</role> must, as soon as practicable after the request is made:</p>
          </content>
          <paragraph eId="sec-17A__subsec-4__para-a">
            <num>a</num>
            <content>
              <p>give written notice to the participant of <role refersTo="#commissioner">the Commissioner</role>’s decision to suspend, or not to suspend, protection and assistance; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-17A__subsec-4__para-b">
            <num>b</num>
            <content>
              <p>notify the relevant approved authority of that decision.</p>
            </content>
            <content>
              <p>Effect of suspension</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-17A__subsec-5">
          <num>5</num>
          <content>
            <p>Subject to subsection (6), protection or assistance must not be provided under the NWPP to a participant while a suspension under this section is in effect for the participant.</p>
          </content>
        </subsection>
        <subsection eId="sec-17A__subsec-6">
          <num>6</num>
          <content>
            <p>However, subsection (5) does not prevent protection or assistance being provided under the NWPP to a participant while a suspension under this section is in effect for the participant if <role refersTo="#commissioner">the Commissioner</role> is satisfied that, in the circumstances, it is necessary and reasonable for the protection or assistance to be provided despite the suspension.</p>
          </content>
        </subsection>
        <subsection eId="sec-17A__subsec-7">
          <num>7</num>
          <content>
            <p>To avoid doubt, a suspension under this section does not result in a person ceasing to be a participant while the suspension is in effect.</p>
          </content>
          <content>
            <p>Former participants etc.</p>
          </content>
        </subsection>
        <subsection eId="sec-17A__subsec-8">
          <num>8</num>
          <content>
            <p>This section does not apply to:</p>
          </content>
          <paragraph eId="sec-17A__subsec-8__para-a">
            <num>a</num>
            <content>
              <p>former participants; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-17A__subsec-8__para-b">
            <num>b</num>
            <content>
              <p>other persons who are receiving protection or assistance under subsection 13(5) because of a relationship with a former participant.</p>
            </content>
          </paragraph>
        </subsection>
      </section>
      <section eId="sec-17B">
        <num>17B</num>
        <heading>Suspension of protection and assistance by Commissioner</heading>
        <subsection eId="sec-17B__subsec-1">
          <num>1</num>
          <content>
            <p>Protection and assistance provided under the NWPP to a participant may be suspended by <role refersTo="#commissioner">the Commissioner</role> if, in the opinion of <role refersTo="#commissioner">the Commissioner</role>:</p>
          </content>
          <paragraph eId="sec-17B__subsec-1__para-a">
            <num>a</num>
            <content>
              <p>the participant has done or intends to do something that limits, or would limit, <role refersTo="#commissioner">the Commissioner</role>’s ability to provide adequate protection and assistance under the NWPP; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-17B__subsec-1__para-b">
            <num>b</num>
            <content>
              <p>in the circumstances of the case, protection and assistance under the NWPP should be suspended.</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-17B__subsec-2">
          <num>2</num>
          <content>
            <p>A suspension under subsection (1) takes effect:</p>
          </content>
          <paragraph eId="sec-17B__subsec-2__para-a">
            <num>a</num>
            <content>
              <p>at the time determined by <role refersTo="#commissioner">the Commissioner</role>; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-17B__subsec-2__para-b">
            <num>b</num>
            <content>
              <p>if no such time is determined—at the time <role refersTo="#commissioner">the Commissioner</role> decides to suspend the protection and assistance.</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-17B__subsec-3">
          <num>3</num>
          <content>
            <p>A suspension under subsection (1):</p>
          </content>
          <paragraph eId="sec-17B__subsec-3__para-a">
            <num>a</num>
            <content>
              <p>has effect until the time determined by <role refersTo="#commissioner">the Commissioner</role>, which must be reasonable in all the circumstances; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-17B__subsec-3__para-b">
            <num>b</num>
            <content>
              <p>may be extended by the making of a new decision under subsection (1); and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-17B__subsec-3__para-c">
            <num>c</num>
            <content>
              <p>may be revoked by <role refersTo="#commissioner">the Commissioner</role> if <role refersTo="#commissioner">the Commissioner</role> is satisfied that paragraph (1)(a) or (b) no longer applies.</p>

              <p>Notice of decision</p>

          </paragraph>
        </subsection>
        <subsection eId="sec-17B__subsec-4">
          <num>4</num>
          <content>
            <p>If <role refersTo="#commissioner">the Commissioner</role> makes a decision under subsection (1) to suspend the protection and assistance provided to a participant under the NWPP, <role refersTo="#commissioner">the Commissioner</role> must:</p>
          </content>
          <paragraph eId="sec-17B__subsec-4__para-a">
            <num>a</num>
            <content>
              <p>take reasonable steps to notify the participant of the decision; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-17B__subsec-4__para-b">
            <num>b</num>
            <content>
              <p>notify the relevant approved authority of the decision.</p>
            </content>
            <content>
              <p>Effect of suspension</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-17B__subsec-5">
          <num>5</num>
          <content>
            <p>Subject to subsection (6), protection or assistance must not be provided under the NWPP to a participant while a suspension under this section is in effect for the participant.</p>
          </content>
        </subsection>
        <subsection eId="sec-17B__subsec-6">
          <num>6</num>
          <content>
            <p>However, subsection (5) does not prevent protection or assistance being provided under the NWPP to a participant while a suspension under this section is in effect for the participant if <role refersTo="#commissioner">the Commissioner</role> is satisfied that, in the circumstances, it is necessary and reasonable for the protection or assistance to be provided despite the suspension.</p>

            <num>a</num>
            <content>
              <p>former participants; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-17B__subsec-8__para-b">
            <num>b</num>
            <content>
              <p>other persons who are receiving protection or assistance under subsection 13(5) because of a relationship with a former participant.</p>
            </content>
            <content>
              <p>Suspension decision may only be made by delegate or sub-delegate</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-17B__subsec-9">
          <num>9</num>
          <content>
            <p>A decision under subsection 17B(1) to suspend the protection and assistance provided to a participant under the NWPP (other than such a decision made as a result of a review under <ref href="#sec-17C">section 17C</ref>) may only be made by a person to whom the power to make the decision has been delegated, or sub-delegated, under <ref href="#sec-25">section 25</ref>.</p>
          </content>
        </subsection>
      </section>
      <section eId="sec-17C">
        <num>17C</num>
        <heading>Review of decision to suspend protection and assistance</heading>
        <subsection eId="sec-17C__subsec-1">
          <num>1</num>
          <content>
            <p>	(1)	This section applies to a decision under subsection 17B(1) to suspend the protection and assistance provided to a participant under the NWPP (a <b><i>suspension decision</i></b>), other than such a decision made as a result of a review under this section.</p>
          </content>
        </subsection>
        <subsection eId="sec-17C__subsec-2">
          <num>2</num>
          <content>
            <p>A participant who receives notification of a suspension decision may, <quantity refersTo="#deadline">within 7 days</quantity> after receiving the notification, apply in writing to the Commissioner for a review of the decision.</p>
          </content>
        </subsection>
        <subsection eId="sec-17C__subsec-3">
          <num>3</num>
          <content>
            <p>If an application is made, <role refersTo="#commissioner">the Commissioner</role>:</p>
          </content>
          <paragraph eId="sec-17C__subsec-3__para-a">
            <num>a</num>
            <content>
              <p>must review the decision, and confirm, reverse or vary it; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-17C__subsec-3__para-b">
            <num>b</num>
            <content>
              <p>before making that decision, must give the participant a reasonable opportunity to state the participant’s case; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-17C__subsec-3__para-c">
            <num>c</num>
            <content>
              <p>after making that decision, must inform the participant in writing of the decision.</p>
            </content>
          </paragraph>
        </subsection>
      </section>
      <section eId="sec-18">
        <num>18</num>
        <heading>Termination of inclusion in NWPP and other protection and assistance</heading>
        <content>
          <p>Termination of inclusion in NWPP</p>
        </content>
        <subsection eId="sec-18__subsec-1">
          <num>1</num>
          <content>
            <p>A participant’s inclusion in the NWPP:</p>
          </content>
          <paragraph eId="sec-18__subsec-1__para-a">
            <num>a</num>
            <content>
              <p>must be terminated by <role refersTo="#commissioner">the Commissioner</role> if the participant requests in writing that it be terminated; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-18__subsec-1__para-b">
            <num>b</num>
            <content>
              <p>may be terminated by a Deputy Commissioner if:</p>
            </content>
          </paragraph>
          <paragraph eId="sec-18__subsec-1__para-i">
            <num>i</num>
            <content>
              <p>the participant deliberately breaches a term of the memorandum of understanding; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-18__subsec-1__para-ii">
            <num>ii</num>
            <content>
              <p>the Deputy Commissioner discovers that the participant had knowingly given information to <role refersTo="#commissioner">the Commissioner</role> that is false or misleading in a material particular; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-18__subsec-1__para-iii">
            <num>iii</num>
            <content>
              <p>the participant’s conduct or threatened conduct is, in the opinion of the Deputy Commissioner, likely to compromise the integrity of the NWPP; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-18__subsec-1__para-iv">
            <num>iv</num>
            <content>
              <p>the circumstances that gave rise to the need for the participant’s inclusion in the NWPP cease to exist; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-18__subsec-1__para-v">
            <num>v</num>
            <content>
              <p>the participant deliberately breaches an undertaking, including an undertaking to give evidence, given to the Commonwealth, a State or Territory in relation to a matter relevant to the NWPP; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-18__subsec-1__para-vi">
            <num>vi</num>
            <content>
              <p>the participant refuses or fails to sign a new memorandum of understanding when required to do so under subsection 8(5); or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-18__subsec-1__para-vii">
            <num>vii</num>
            <content>
              <p>there is, in the opinion of the Deputy Commissioner, no reasonable justification for the participant to remain included in the NWPP;</p>
            </content>
            <content>
              <p>and the Deputy Commissioner is of the opinion that, in the circumstances of the case, the participant’s inclusion in the NWPP should be terminated.</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-18__subsec-2">
          <num>2</num>
          <content>
            <p>	(2)	If a Deputy Commissioner makes a decision under paragraph (1)(b) that a participant’s inclusion in the NWPP be terminated (the <b><i>termination decision</i></b>), the Deputy Commissioner must:</p>
          </content>
          <paragraph eId="sec-18__subsec-2__para-a">
            <num>a</num>
            <content>
              <p>take reasonable steps to notify the participant of the decision; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-18__subsec-2__para-b">
            <num>b</num>
            <content>
              <p>notify the relevant approved authority of the decision.</p>
            </content>
            <content>
              <p>Termination of protection and assistance to former participants etc.</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-18__subsec-2A">
          <num>2A</num>
          <content>
            <p>Protection and assistance provided under subsection 13(5) to a person (including a former participant):</p>
          </content>
          <paragraph eId="sec-18__subsec-2A__para-a">
            <num>a</num>
            <content>
              <p>must be terminated by <role refersTo="#commissioner">the Commissioner</role> if the person requests in writing that it be terminated; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-18__subsec-2A__para-b">
            <num>b</num>
            <content>
              <p>may be terminated by a Deputy Commissioner if:</p>
            </content>
          </paragraph>
          <paragraph eId="sec-18__subsec-2A__para-i">
            <num>i</num>
            <content>
              <p>the Deputy Commissioner discovers that the person had knowingly given information to <role refersTo="#commissioner">the Commissioner</role> that is false or misleading in a material particular; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-18__subsec-2A__para-ii">
            <num>ii</num>
            <content>
              <p>the person’s conduct or threatened conduct is, in the opinion of the Deputy Commissioner, likely to compromise the integrity of the NWPP; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-18__subsec-2A__para-iii">
            <num>iii</num>
            <content>
              <p>the circumstances that gave rise to the need for protection and assistance for the person cease to exist; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-18__subsec-2A__para-iv">
            <num>iv</num>
            <content>
              <p>the person deliberately breaches an undertaking given to the Commonwealth, a State or a Territory that is relevant to the provision of that protection and assistance; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-18__subsec-2A__para-v">
            <num>v</num>
            <content>
              <p>there is, in the opinion of the Deputy Commissioner, no reasonable justification for protection and assistance to continue to be provided to the person;</p>
            </content>
            <content>
              <p>and the Deputy Commissioner is of the opinion that, in the circumstances of the case, the protection and assistance should be terminated.</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-18__subsec-2B">
          <num>2B</num>
          <content>
            <p>	(2B)	If a Deputy Commissioner makes a decision under paragraph (2A)(b) that protection and assistance provided to a person be terminated (the <b><i>termination decision</i></b>), the Deputy Commissioner must take reasonable steps to notify the person of the decision.</p>
          </content>
          <content>
            <p>Review</p>
          </content>
        </subsection>
        <subsection eId="sec-18__subsec-3">
          <num>3</num>
          <content>
            <p>A person who receives notification of a termination decision may, <quantity refersTo="#deadline">within 28 days</quantity> after receiving the notice, apply in writing to the Commissioner for a review of the decision of the Deputy Commissioner.</p>
          </content>
        </subsection>
        <subsection eId="sec-18__subsec-4">
          <num>4</num>
          <content>
            <p>If an application is made, <role refersTo="#commissioner">the Commissioner</role>:</p>
          </content>
          <paragraph eId="sec-18__subsec-4__para-a">
            <num>a</num>
            <content>
              <p>must review the decision of the Deputy Commissioner, and confirm, reverse or vary it; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-18__subsec-4__para-b">
            <num>b</num>
            <content>
              <p>before making that decision, must give the person a reasonable opportunity to state his or her case; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-18__subsec-4__para-c">
            <num>c</num>
            <content>
              <p>after making that decision, must inform the person in writing of the decision.</p>
            </content>
            <content>
              <p>When termination decisions take effect</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-18__subsec-5">
          <num>5</num>
          <content>
            <p>A termination decision that relates to a person:</p>
          </content>
          <paragraph eId="sec-18__subsec-5__para-a">
            <num>a</num>
            <content>
              <p>if:</p>
            </content>
          </paragraph>
          <paragraph eId="sec-18__subsec-5__para-i">
            <num>i</num>
            <content>
              <p>the person’s whereabouts are not known; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-18__subsec-5__para-ii">
            <num>ii</num>
            <content>
              <p>the Deputy Commissioner has taken reasonable steps to notify the person of the decision but has been unable to do so;</p>
            </content>
            <content>
              <p>takes effect at the end of the period of 28 days after those steps were commenced; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-18__subsec-5__para-b">
            <num>b</num>
            <content>
              <p>if the person does not apply for a review of the decision in accordance with subsection (3)—takes effect at the end of the period of 28 days after the person receives the notification; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-18__subsec-5__para-c">
            <num>c</num>
            <content>
              <p>if the person applies for a review of the decision in accordance with subsection (3) and <role refersTo="#commissioner">the Commissioner</role> notifies the person that he or she has reversed the decision—has no effect; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-18__subsec-5__para-d">
            <num>d</num>
            <content>
              <p>if the person applies for a review of the decision in accordance with subsection (3) and <role refersTo="#commissioner">the Commissioner</role> notifies the person that he or she has confirmed the decision—takes effect when <role refersTo="#commissioner">the Commissioner</role> notifies the person of the decision on the review; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-18__subsec-5__para-e">
            <num>e</num>
            <content>
              <p>if the person applies for a review of the decision in accordance with subsection (3) and <role refersTo="#commissioner">the Commissioner</role> notifies the person that he or she has varied the decision—takes effect on the day specified by <role refersTo="#commissioner">the Commissioner</role>.</p>
            </content>
            <content>
              <p>Notification of Immigration Secretary</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-18__subsec-6">
          <num>6</num>
          <content>
            <p>If:</p>
          </content>
          <paragraph eId="sec-18__subsec-6__para-a">
            <num>a</num>
            <content>
              <p>a Deputy Commissioner makes a termination decision in relation to a person; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-18__subsec-6__para-b">
            <num>b</num>
            <content>
              <p>the person was at any time a participant under <ref href="#sec-10">section 10</ref> or 10A;</p>
            </content>
            <content>
              <p><role refersTo="#commissioner">the Commissioner</role> must give the Immigration Secretary, or an officer nominated by that Secretary, written notice of that decision.</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-18__subsec-7">
          <num>7</num>
          <content>
            <p>In this section:</p>
          </content>
          <content>
            <p><b><i>participant</i></b> does not include a former participant.</p>
          </content>
        </subsection>
      </section>
      <section eId="sec-19">
        <num>19</num>
        <heading>Restoration of former identity</heading>
        <subsection eId="sec-19__subsec-1">
          <num>1</num>
          <content>
            <p>If a participant has been provided with a new identity under the NWPP, a Deputy Commissioner may, if he or she considers it appropriate to do so, take such action as is necessary to restore the original identity or any former NWPP identity of the participant.</p>
          </content>
        </subsection>
        <subsection eId="sec-19__subsec-2">
          <num>2</num>
          <content>
            <p>The Deputy Commissioner must take reasonable steps to notify the participant of a decision under subsection (1).</p>
          </content>
        </subsection>
        <subsection eId="sec-19__subsec-3">
          <num>3</num>
          <content>
            <p>If the Deputy Commissioner proposes to take action to restore the original identity or any former NWPP identity of the participant, the participant may apply in writing to <role refersTo="#commissioner">the Commissioner</role> for a review of the decision of the Deputy Commissioner.</p>
          </content>
        </subsection>
        <subsection eId="sec-19__subsec-4">
          <num>4</num>
          <content>
            <p>If an application is made, <role refersTo="#commissioner">the Commissioner</role>:</p>
          </content>
          <paragraph eId="sec-19__subsec-4__para-a">
            <num>a</num>
            <content>
              <p>must review the decision of the Deputy Commissioner and confirm, reverse or vary it; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-19__subsec-4__para-b">
            <num>b</num>
            <content>
              <p>before making that decision, must give the participant a reasonable opportunity to state his or her case; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-19__subsec-4__para-c">
            <num>c</num>
            <content>
              <p>after making that decision, must inform the participant in writing of the decision.</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-19__subsec-5">
          <num>5</num>
          <content>
            <p>If <role refersTo="#commissioner">the Commissioner</role> or a Deputy Commissioner takes action under this section to restore the original identity or any former NWPP identity of a Commonwealth participant, a State participant or a Territory participant, <role refersTo="#commissioner">the Commissioner</role> or a Deputy Commissioner may give a notice to the participant under subsection (6).</p>
          </content>
        </subsection>
        <subsection eId="sec-19__subsec-6">
          <num>6</num>
          <content>
            <p>The notice:</p>
          </content>
          <paragraph eId="sec-19__subsec-6__para-a">
            <num>a</num>
            <content>
              <p>must be in writing; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-19__subsec-6__para-b">
            <num>b</num>
            <content>
              <p>must require the participant to return to the Commissioner, <quantity refersTo="#deadline">within 10 days</quantity> of the giving of the notice, all documents provided to the participant that relate to:</p>
            </content>
          </paragraph>
          <paragraph eId="sec-19__subsec-6__para-i">
            <num>i</num>
            <content>
              <p>the participant’s current NWPP identity; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-19__subsec-6__para-ii">
            <num>ii</num>
            <content>
              <p>any former NWPP identity of the participant that is not being restored.</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-19__subsec-7">
          <num>7</num>
          <content>
            <p>A person commits an offence if:</p>
          </content>
          <paragraph eId="sec-19__subsec-7__para-a">
            <num>a</num>
            <content>
              <p>the person is given a notice under subsection (6); and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-19__subsec-7__para-b">
            <num>b</num>
            <content>
              <p>the person refuses or fails to comply with the notice.</p>
            </content>
            <hcontainer name="penalty">
              <content>
                <p>Penalty:	<quantity refersTo="#penaltyUnit">10 penalty units</quantity>.</p>
              </content>
            </hcontainer>
          </paragraph>
        </subsection>
      </section>
      <section eId="sec-20">
        <num>20</num>
        <heading>Provision of information to approved authorities</heading>
        <content>
          <p>If:</p>
        </content>
        <paragraph eId="sec-20__para-a">
          <num>a</num>
          <content>
            <p>a participant has been provided with a new identity or has been relocated under the NWPP; and</p>
          </content>
        </paragraph>
        <paragraph eId="sec-20__para-b">
          <num>b</num>
          <content>
            <p>an approved authority or a member notifies <role refersTo="#commissioner">the Commissioner</role> that the participant is under investigation for, or has been arrested for or charged with, an offence against a law of the Commonwealth or of a State or Territory the maximum penalty for which is or includes imprisonment for a period of more than one year;</p>
          </content>
          <content>
            <p><role refersTo="#commissioner">the Commissioner</role> may:</p>
          </content>
        </paragraph>
        <paragraph eId="sec-20__para-c">
          <num>c</num>
          <content>
            <p>release to the approved authority or the member the current NWPP identity or current location of the participant; and</p>
          </content>
        </paragraph>
        <paragraph eId="sec-20__para-d">
          <num>d</num>
          <content>
            <p>provide the approved authority or the member with the criminal record of the participant and the participant’s fingerprints; and</p>
          </content>
        </paragraph>
        <paragraph eId="sec-20__para-e">
          <num>e</num>
          <content>
            <p>release to the approved authority or the member such other information relating to the NWPP as <role refersTo="#commissioner">the Commissioner</role> considers appropriate in the circumstances; and</p>
          </content>
        </paragraph>
        <paragraph eId="sec-20__para-f">
          <num>f</num>
          <content>
            <p>if <role refersTo="#commissioner">the Commissioner</role> considers it appropriate to do so in the circumstances—allow officers of the approved authority or the member to interview <role refersTo="#commissioner">the Commissioner</role>, a Deputy Commissioner, AFP employees or special members of the Australian Federal Police in relation to the participant.</p>
          </content>
        </paragraph>
      </section>
      <section eId="sec-21">
        <num>21</num>
        <heading>Officers protected from suit in respect of decisions under Act</heading>
        <content>
          <p><role refersTo="#commissioner">The Commissioner</role>, delegates of <role refersTo="#commissioner">the Commissioner</role> and other persons performing functions in relation to the NWPP are not liable to any action, suit or proceedings (including criminal proceedings) in respect of an act done or omitted to be done in good faith in the exercise or purported exercise of a power conferred, or the performance or purported performance of a function conferred or a duty imposed, by this Act.</p>
        </content>
      </section>
      <section eId="sec-22">
        <num>22</num>
        <heading>Offences relating to Commonwealth or Territory participants</heading>
        <content>
          <p>Disclosure of information about Commonwealth or Territory participant</p>
        </content>
        <subsection eId="sec-22__subsec-1">
          <num>1</num>
          <content>
            <p>A person commits an offence if:</p>
          </content>
          <paragraph eId="sec-22__subsec-1__para-a">
            <num>a</num>
            <content>
              <p>the person discloses information about an individual; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-22__subsec-1__para-b">
            <num>b</num>
            <content>
              <p>the individual is a participant; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-22__subsec-1__para-c">
            <num>c</num>
            <content>
              <p>the individual is a Commonwealth participant or a Territory participant; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-22__subsec-1__para-d">
            <num>d</num>
            <content>
              <p>either or both of the following apply:</p>
            </content>
          </paragraph>
          <paragraph eId="sec-22__subsec-1__para-i">
            <num>i</num>
            <content>
              <p>the individual has a current NWPP identity at the time the information is disclosed and the information is about the original identity or a former NWPP identity of the individual;</p>
            </content>
          </paragraph>
          <paragraph eId="sec-22__subsec-1__para-ii">
            <num>ii</num>
            <content>
              <p>there is a risk that disclosure of the information will reveal that the individual is a participant.</p>
            </content>

            <p>A person commits an offence if:</p>
          </content>
          <paragraph eId="sec-22__subsec-2__para-a">
            <num>a</num>
            <content>
              <p>the person discloses information about an individual; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-22__subsec-2__para-b">
            <num>b</num>
            <content>
              <p>the individual is undergoing assessment for inclusion in the NWPP at the time the information is disclosed; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-22__subsec-2__para-c">
            <num>c</num>
            <content>
              <p>if the individual were included in the NWPP following that assessment, the individual would be a Commonwealth participant or a Territory participant; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-22__subsec-2__para-d">
            <num>d</num>
            <content>
              <p>there is a risk that disclosure of the information will reveal that the individual is undergoing such assessment.</p>
            </content>

              <p>the person discloses information about an individual; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-22__subsec-3__para-b">
            <num>b</num>
            <content>
              <p>the individual is a participant; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-22__subsec-3__para-c">
            <num>c</num>
            <content>
              <p>the individual is a Commonwealth participant or a Territory participant; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-22__subsec-3__para-d">
            <num>d</num>

              <p>either or both of the following apply:</p>
            </content>
          </paragraph>
          <paragraph eId="sec-22__subsec-3__para-i">
            <num>i</num>

              <p>the individual has a current NWPP identity at the time the information is disclosed and the information is about the original identity or a former NWPP identity of the individual;</p>

            <num>ii</num>

              <p>there is a risk that disclosure of the information will reveal that the individual is a participant; and</p>
            </content>
          </paragraph>

            <num>e</num>

              <p>there is a risk that disclosure of the information will compromise the security of the individual.</p>
            </content>

              <p>the person discloses information about an individual; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-22__subsec-4__para-b">
            <num>b</num>
            <content>
              <p>the individual is undergoing assessment for inclusion in the NWPP at the time the information is disclosed; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-22__subsec-4__para-c">
            <num>c</num>
            <content>
              <p>if the individual were included in the NWPP following that assessment, the individual would be a Commonwealth participant or a Territory participant; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-22__subsec-4__para-d">
            <num>d</num>
            <content>
              <p>there is a risk that disclosure of the information will reveal that the individual is undergoing such assessment; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-22__subsec-4__para-e">
            <num>e</num>
            <content>
              <p>there is a risk that disclosure of the information will compromise the security of the individual.</p>
            </content>
            <hcontainer name="penalty">

            <p>Subsections (1), (2), (3) and (4) do not apply to a disclosure by a person if:</p>
          </content>
          <paragraph eId="sec-22__subsec-5__para-a">
            <num>a</num>
            <content>
              <p>the person has been authorised by <role refersTo="#commissioner">the Commissioner</role> to make the disclosure; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-22__subsec-5__para-b">
            <num>b</num>
            <content>
              <p>	(b)	the disclosure is made for the purpose of making a complaint, or providing information, to the Ombudsman under the <i>Ombudsman Act 1976</i>; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-22__subsec-5__para-c">
            <num>c</num>
            <content>
              <p>	(c)	the disclosure is a NACC disclosure (within the meaning of the <i>National Anti</i><i>-</i><i>Corruption Commission Act 2022</i>); or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-22__subsec-5__para-d">
            <num>d</num>
            <content>
              <p>the disclosure is made for the purpose of:</p>
            </content>
          </paragraph>
          <paragraph eId="sec-22__subsec-5__para-i">
            <num>i</num>
            <content>
              <p>	(i)	giving information that raises an AFP conduct or practices issue (within the meaning of the <i>Australian Federal Police Act 1979</i>); or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-22__subsec-5__para-ii">
            <num>ii</num>
            <content>
              <p>investigating or resolving an AFP conduct or practices issue under <ref href="#part-V">Part V</ref> of that Act.</p>

              <p>there is a risk that disclosure of the information will reveal that the individual is undergoing such assessment; and</p>
            </content>
          </paragraph>

              <p>if the person disclosing the information is a person other than a person referred to in subparagraph (a)(i), (ii) or (iv)—there is a risk that disclosure of the information will adversely affect the integrity of the NWPP.</p>

              <p>the person is:</p>
            </content>
          </paragraph>
          <paragraph eId="sec-22A__subsec-3__para-i">
            <num>i</num>
            <content>
              <p>a Commonwealth officer; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-22A__subsec-3__para-ii">
            <num>ii</num>
            <content>
              <p>a Commonwealth participant; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-22A__subsec-3__para-iii">

              <p>the individual has a current NWPP identity at the time the information is disclosed and the information is about the original identity or a former NWPP identity of the individual;</p>

              <p>there is a risk that disclosure of the information will reveal that the individual is a participant; and</p>

              <p>there is a risk that disclosure of the information will compromise the security of the individual; and</p>
            </content>
          </paragraph>

              <p>if the person disclosing the information is a person other than a person referred to in subparagraph (a)(i), (ii) or (iv)—there is a risk that the disclosure of the information will adversely affect the integrity of the NWPP.</p>

            <p>A person commits an offence if:</p>
          </content>

              <p>the person is:</p>
            </content>
          </paragraph>
          <paragraph eId="sec-22A__subsec-4__para-i">
            <num>i</num>
            <content>
              <p>a Commonwealth officer; or</p>

              <p>if the individual were included in the NWPP following that assessment, the individual would be a State participant; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-22A__subsec-4__para-e">
            <num>e</num>

              <p>there is a risk that disclosure of the information will reveal that the individual is undergoing such assessment; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-22A__subsec-4__para-f">
            <num>f</num>
            <content>
              <p>there is a risk that disclosure of the information will compromise the security of the individual; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-22A__subsec-4__para-g">
            <num>g</num>

              <p>if the person disclosing the information is a person other than a person referred to in subparagraph (a)(i), (ii) or (iv)—there is a risk that disclosure of the information will adversely affect the integrity of the NWPP.</p>

              <p>the person has been authorised by <role refersTo="#commissioner">the Commissioner</role> to make the disclosure; or</p>
            </content>
          </paragraph>

              <p>	(b)	the disclosure is made for the purpose of making a complaint, or providing information, to the Ombudsman under the <i>Ombudsman Act 1976</i>; or</p>

            <content>
              <p>	(c)	the disclosure is a NACC disclosure (within the meaning of the <i>National Anti</i><i>-</i><i>Corruption Commission Act 2022</i>); or</p>

            <num>d</num>
            <content>
              <p>the disclosure is made for the purpose of:</p>
            </content>
          </paragraph>

              <p>	(i)	giving information that raises an AFP conduct or practices issue (within the meaning of the <i>Australian Federal Police Act 1979</i>); or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-22A__subsec-5__para-ii">
            <num>ii</num>
            <content>
              <p>investigating or resolving an AFP conduct or practices issue under <ref href="#part-V">Part V</ref> of that Act.</p>
            </content>

        <heading>Offences relating to disclosure of information about the NWPP</heading>
        <content>
          <p>Disclosures by participants and persons undergoing assessment</p>
        </content>
        <subsection eId="sec-22B__subsec-1">
          <num>1</num>
          <content>
            <p>A person commits an offence if:</p>
          </content>
          <paragraph eId="sec-22B__subsec-1__para-a">
            <num>a</num>
            <content>
              <p>the person is, or is undergoing or has undergone assessment for inclusion in the NWPP as, one of the following:</p>
            </content>
          </paragraph>
          <paragraph eId="sec-22B__subsec-1__para-i">
            <num>i</num>
            <content>
              <p>a Commonwealth participant;</p>
            </content>
          </paragraph>
          <paragraph eId="sec-22B__subsec-1__para-ii">
            <num>ii</num>
            <content>
              <p>a Territory participant;</p>
            </content>
          </paragraph>
          <paragraph eId="sec-22B__subsec-1__para-iii">
            <num>iii</num>
            <content>
              <p>a State participant; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-22B__subsec-1__para-b">
            <num>b</num>

              <p>the person discloses any of the following:</p>
            </content>
          </paragraph>

              <p>the fact that he or she is such a participant, or is undergoing or has undergone such assessment;</p>

              <p>information about the way in which the NWPP operates;</p>
            </content>
          </paragraph>

              <p>information about <role refersTo="#commissioner">the Commissioner</role>, a Deputy Commissioner, any AFP employee or any special member of the Australian Federal Police who is or has been involved in the NWPP;</p>
            </content>
          </paragraph>
          <paragraph eId="sec-22B__subsec-1__para-iv">
            <num>iv</num>
            <content>
              <p>the fact that he or she has signed a memorandum of understanding;</p>
            </content>
          </paragraph>
          <paragraph eId="sec-22B__subsec-1__para-v">
            <num>v</num>
            <content>
              <p>any details of a memorandum of understanding that he or she has signed.</p>
            </content>
            <hcontainer name="penalty">

              <p>Disclosures by other persons</p>

            <p>A person (other than a person referred to in paragraph (1)(a)) commits an offence if:</p>
          </content>
          <paragraph eId="sec-22B__subsec-2__para-a">
            <num>a</num>
            <content>
              <p>the person discloses information; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-22B__subsec-2__para-b">
            <num>b</num>
            <content>
              <p>the information is either or both of the following:</p>
            </content>
          </paragraph>
          <paragraph eId="sec-22B__subsec-2__para-i">
            <num>i</num>
            <content>
              <p>information about the way in which the NWPP operates;</p>
            </content>
          </paragraph>
          <paragraph eId="sec-22B__subsec-2__para-ii">
            <num>ii</num>
            <content>
              <p>information about <role refersTo="#commissioner">the Commissioner</role>, a Deputy Commissioner, any AFP employee or any special member of the Australian Federal Police who is or has been involved in the NWPP; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-22B__subsec-2__para-c">
            <num>c</num>
            <content>
              <p>there is a risk that disclosure of the information will do either or both of the following:</p>
            </content>
          </paragraph>
          <paragraph eId="sec-22B__subsec-2__para-i">
            <num>i</num>
            <content>
              <p>adversely affect the integrity of the NWPP;</p>
            </content>
          </paragraph>
          <paragraph eId="sec-22B__subsec-2__para-ii">
            <num>ii</num>
            <content>
              <p>compromise the security of <role refersTo="#commissioner">the Commissioner</role>, a Deputy Commissioner, or an AFP employee or special member of the Australian Federal Police who is or has been involved in the NWPP.</p>
            </content>
            <hcontainer name="penalty">
              <content>
                <p>Penalty:	<quantity refersTo="#custodialSentence">Imprisonment for 5 years</quantity>.</p>
              </content>
            </hcontainer>
          </paragraph>
        </subsection>
        <subsection eId="sec-22B__subsec-3">
          <num>3</num>
          <content>
            <p>Subsections (1) and (2) do not apply to a disclosure by a person if:</p>
          </content>
          <paragraph eId="sec-22B__subsec-3__para-a">
            <num>a</num>
            <content>
              <p>the person has been authorised by <role refersTo="#commissioner">the Commissioner</role> to make the disclosure; or</p>
            </content>
          </paragraph>

      </section>

        <num>22C</num>
        <heading>Disclosures to courts, etc.</heading>
        <subsection eId="sec-22C__subsec-1">
          <num>1</num>
          <content>
            <p>To avoid doubt, sections 22, 22A and 22B apply to a disclosure of information to:</p>
          </content>
          <paragraph eId="sec-22C__subsec-1__para-a">
            <num>a</num>
            <content>
              <p>a court or tribunal; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-22C__subsec-1__para-b">
            <num>b</num>
            <content>
              <p>a Royal Commission of the Commonwealth, a State or a Territory or any other commission of inquiry.</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-22C__subsec-2">
          <num>2</num>
          <content>
            <p>The application of subsection (1) to the disclosure of information as mentioned in that subsection does not affect the operation of subsection 26(3).</p>
          </content>
        </subsection>
      </section>
      <section eId="sec-23">
        <num>23</num>
        <heading>Payments under NWPP not able to be confiscated</heading>
        <subsection eId="sec-23__subsec-1">
          <num>1</num>
          <content>
            <p><role refersTo="#commissioner">The Commissioner</role> may certify in writing that an amount held by a participant represents payments made to the participant under the NWPP.</p>
          </content>
        </subsection>
        <subsection eId="sec-23__subsec-2">
          <num>2</num>
          <content>
            <p>	(2)	An amount so certified cannot be confiscated or restrained, and cannot be applied in payment of pecuniary penalties, under <i>Customs Act 1901</i>, the <i>Proceeds of Crime Act 1987</i>, the <i>Proceeds of Crime Act 2002</i>, the <i>Crimes (Superannuation Benefits) Act 1989</i> or the <i>Australian Federal Police Act 1979</i>.<ref href="#dvs-3">Division 3</ref> of <ref href="#part-XII">Part XII</ref>I of the </p>
          </content>
        </subsection>
      </section>
      <section eId="sec-24">
        <num>24</num>
        <heading>Restriction on issue of Commonwealth identity documents</heading>
        <subsection eId="sec-24__subsec-1">
          <num>1</num>
          <content>
            <p>Commonwealth identity documents must not, after the end of 12 months after the commencement of this Act, be issued for a person who is on a witness protection program being conducted by a State or Territory unless:</p>
          </content>
          <paragraph eId="sec-24__subsec-1__para-a">
            <num>a</num>
            <content>
              <p>an arrangement is in force between <role refersTo="#minister">the Minister</role> and the relevant State or Territory Minister relating to the issue of Commonwealth identity documents for the purposes of that program; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-24__subsec-1__para-b">
            <num>b</num>
            <content>
              <p>a complementary witness protection law is in force in the State or Territory.</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-24__subsec-2">
          <num>2</num>
          <content>
            <p>Without limiting the matters to which such an arrangement may relate, an arrangement may relate to:</p>
          </content>
          <paragraph eId="sec-24__subsec-2__para-a">
            <num>a</num>
            <content>
              <p>the procedures to be adopted for requesting the issue of Commonwealth identity documents for the purposes of such a program; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-24__subsec-2__para-b">
            <num>b</num>
            <content>
              <p>guidelines for the issue of those documents and other documents.</p>
            </content>
          </paragraph>
        </subsection>
      </section>
      <section eId="sec-25">
        <num>25</num>
        <heading>Delegation</heading>
        <subsection eId="sec-25__subsec-1">
          <num>1</num>
          <content>
            <p>Subject to subsections (3) and (4), <role refersTo="#commissioner">the Commissioner</role> may, by writing, delegate all or any of his or her powers under this Act to a person who holds or occupies a designated position.</p>
          </content>
        </subsection>
        <subsection eId="sec-25__subsec-2">
          <num>2</num>
          <content>
            <p>A person who holds or occupies a designated position may exercise powers delegated to the person by <role refersTo="#commissioner">the Commissioner</role> under a complementary witness protection law.</p>
          </content>
        </subsection>
        <subsection eId="sec-25__subsec-3">
          <num>3</num>
          <content>
            <p><role refersTo="#commissioner">The Commissioner</role>’s powers under sections 6, 8, 14, 16, 18, 20, 27 and 27A and subsections 12(2) and (3) may only be delegated to a Deputy Commissioner.</p>
          </content>
        </subsection>
        <subsection eId="sec-25__subsec-4">
          <num>4</num>
          <content>
            <p><role refersTo="#commissioner">The Commissioner</role>’s powers under sections 17A and 17B may only be delegated to an Assistant Commissioner.</p>
          </content>
        </subsection>
        <subsection eId="sec-25__subsec-5">
          <num>5</num>
          <content>
            <p>If <role refersTo="#commissioner">the Commissioner</role> delegates a power under section 17A or 17B to an Assistant Commissioner, the Assistant Commissioner may, by writing, sub-delegate the power to a Commander or Superintendent in the Australian Federal Police.</p>
          </content>
        </subsection>
        <subsection eId="sec-25__subsec-6">
          <num>6</num>
          <content>
            <p>A Commander or Superintendent may exercise a power delegated under subsection (5) only if the Commander or Superintendent is satisfied that the circumstances are serious and urgent.</p>
          </content>
        </subsection>
        <subsection eId="sec-25__subsec-7">
          <num>7</num>
          <content>
            <p><role refersTo="#commissioner">The Commissioner</role>’s powers under section 17C:</p>
          </content>
          <paragraph eId="sec-25__subsec-7__para-a">
            <num>a</num>
            <content>
              <p>may only be delegated to a member of the Australian Federal Police who holds or occupies a designated position; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-25__subsec-7__para-b">
            <num>b</num>
            <content>
              <p>may, in relation to a particular decision under subsection 17B(1), be exercised by a delegate only if that delegate holds a rank higher than the rank held by the delegate, or sub-delegate, who made the decision under subsection 17B(1).</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-25__subsec-8">
          <num>8</num>
          <content>
            <p>	(8)	Subject to subsection 17B(9) of this Act, sections 34AA, 34AB and 34A of the <i>Acts Interpretation Act 1901</i> apply in relation to a sub-delegation in a corresponding way to the way in which they apply in relation to a delegation.</p>
          </content>
        </subsection>
      </section>
      <section eId="sec-26">
        <num>26</num>
        <heading>Commissioner and members not to be required to disclose information</heading>
        <subsection eId="sec-26__subsec-1">
          <num>1</num>
          <content>
            <p>Subject to subsection (3), <role refersTo="#commissioner">the Commissioner</role>, a Deputy Commissioner, an AFP employee or a special member of the Australian Federal Police is not to be required:</p>
          </content>
          <paragraph eId="sec-26__subsec-1__para-a">
            <num>a</num>
            <content>
              <p>to produce in a court, or before a tribunal, a Royal Commission of the Commonwealth, a State or a Territory or any other commission of inquiry, any document that has come into the custody or control of the person in the course of, or because of, the performance of functions or duties, or the exercise of powers, under this Act; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-26__subsec-1__para-b">
            <num>b</num>

              <p>to divulge or communicate to or before such a body any matter or thing that has come to the notice of the person in the performance of functions or duties, or the exercise of powers, under this Act; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-26__subsec-1__para-c">
            <num>c</num>
            <content>
              <p>to divulge or communicate to or before such a body information, if:</p>
            </content>
          </paragraph>

              <p>the information is about the identity of, or disclosure of the information is such as to reveal the identity of, an AFP employee or special member of the Australian Federal Police who is involved in the operation of the NWPP; and</p>

          </paragraph>
          <paragraph eId="sec-26__subsec-1__para-ii">
            <num>ii</num>
            <content>
              <p>the person has the information as a result of the performance of functions or duties, or the exercise of powers, under this Act;</p>
            </content>
            <content>
              <p>except where it is necessary to do so for the purpose of carrying the provisions of this Act into effect.</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-26__subsec-2">
          <num>2</num>
          <content>
            <p>Subject to subsection (3), the Commonwealth Ombudsman or a member of the staff of the Commonwealth Ombudsman is not to be required:</p>
          </content>
          <paragraph eId="sec-26__subsec-2__para-a">
            <num>a</num>
            <content>
              <p>to produce in a court, or before a tribunal, a Royal Commission of the Commonwealth, a State or a Territory or any other commission of inquiry, any document that has come into the custody or control of the person in relation to this Act; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-26__subsec-2__para-b">
            <num>b</num>
            <content>
              <p>to divulge or communicate to or before such a body any matter or thing that has come to the notice of the person in relation to this Act; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-26__subsec-2__para-c">
            <num>c</num>
            <content>
              <p>to divulge or communicate to or before such a body information, if:</p>
            </content>
          </paragraph>
          <paragraph eId="sec-26__subsec-2__para-i">
            <num>i</num>
            <content>
              <p>the information is about the identity of, or disclosure of the information is such as to reveal the identity of, an AFP employee or special member of the Australian Federal Police who is involved in the operation of the NWPP; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-26__subsec-2__para-ii">
            <num>ii</num>
            <content>
              <p>the person has the information as a result of the performance of functions or duties, or the exercise of powers, in relation to this Act;</p>
            </content>
            <content>
              <p>except where it is necessary to do so for the purpose of carrying the provisions of this Act into effect.</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-26__subsec-3">
          <num>3</num>
          <content>
            <p>If it is essential to the determination of legal proceedings under or in relation to a law of the Commonwealth, a State or a Territory that the judge or magistrate presiding over the proceedings be advised of a participant’s location and circumstances, a person referred to in subsection (1) or (2) is to disclose the relevant information to the judge or magistrate in chambers, but the person must not disclose the information if any person other than the judge or magistrate and the person is present.</p>
          </content>
        </subsection>
        <subsection eId="sec-26__subsec-4">
          <num>4</num>
          <content>
            <p>The judge or magistrate must not disclose any information disclosed to the judge or magistrate under subsection (3) otherwise than in accordance with this Act.</p>
          </content>
        </subsection>
        <subsection eId="sec-26__subsec-5">
          <num>5</num>
          <content>
            <p>Subsection (1) does not apply to information about a financial support arrangement for a participant if the information is provided in a way that cannot identify the location, or prejudice the safety, of the participant.</p>
          </content>
        </subsection>
      </section>
      <section eId="sec-27">
        <num>27</num>
        <heading>Requirement where participant becomes a witness in criminal proceedings</heading>
        <subsection eId="sec-27__subsec-1">
          <num>1</num>
          <content>
            <p>If:</p>
          </content>
          <paragraph eId="sec-27__subsec-1__para-a">
            <num>a</num>
            <content>
              <p>a participant is to be a witness, under the participant’s current NWPP identity, in a criminal proceeding; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-27__subsec-1__para-b">
            <num>b</num>
            <content>
              <p>the participant has a criminal record under his or her original identity or any former NWPP identity;</p>
            </content>
            <content>
              <p>the participant must notify <role refersTo="#commissioner">the Commissioner</role> that the participant is to be a witness in the proceeding.</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-27__subsec-2">
          <num>2</num>
          <content>
            <p>After being notified under subsection (1), <role refersTo="#commissioner">the Commissioner</role> may take any action he or she considers appropriate in the circumstances, including disclosing to the court, the prosecutor and the accused person or the accused person’s legal representative the criminal record of the participant.</p>
          </content>
        </subsection>
      </section>
      <section eId="sec-27A">
        <num>27A</num>
        <heading>Requirement where participant involved in civil proceedings</heading>
        <subsection eId="sec-27A__subsec-1">
          <num>1</num>
          <content>
            <p>If a participant is to be involved, under the participant’s current NWPP identity, in a civil proceeding in which his or her identity is in issue, the participant must notify <role refersTo="#commissioner">the Commissioner</role> that the participant is involved in the proceeding.</p>
          </content>
        </subsection>
        <subsection eId="sec-27A__subsec-2">
          <num>2</num>
          <content>
            <p>After being notified under subsection (1), <role refersTo="#commissioner">the Commissioner</role> may take any action he or she considers appropriate in the circumstances.</p>
          </content>
        </subsection>
        <subsection eId="sec-27A__subsec-3">
          <num>3</num>
          <content>
            <p>In this section:</p>
          </content>
          <content>
            <p><b><i>civil proceeding</i></b> means any proceeding in a court, a tribunal or a Royal Commission of the Commonwealth, a State or a Territory or any other commission of inquiry, other than a criminal proceeding, and, to avoid doubt, each of the following is part of a civil proceeding:</p>
          </content>
          <paragraph eId="sec-27A__subsec-3__para-a">
            <num>a</num>
            <content>
              <p>any proceeding on an ex parte application (including an application made before pleadings are filed in a court);</p>
            </content>
          </paragraph>
          <paragraph eId="sec-27A__subsec-3__para-b">
            <num>b</num>
            <content>
              <p>the discovery, exchange, production, inspection or disclosure of intended evidence, documents and reports of persons intended to be called by a party to give evidence;</p>
            </content>
          </paragraph>
          <paragraph eId="sec-27A__subsec-3__para-c">
            <num>c</num>
            <content>
              <p>an appeal proceeding;</p>
            </content>
          </paragraph>
          <paragraph eId="sec-27A__subsec-3__para-d">
            <num>d</num>
            <content>
              <p>any interlocutory or other proceeding prescribed by regulations for the purposes of this paragraph.</p>
            </content>
          </paragraph>
        </subsection>
      </section>
      <section eId="sec-28">
        <num>28</num>
        <heading>Identity of participant not to be disclosed in court proceedings etc.</heading>
        <subsection eId="sec-28__subsec-1">
          <num>1</num>
          <content>
            <p>This section applies if one of more of the following matters is in issue, or may be disclosed, in any proceedings before a court, a tribunal, or a Royal Commission of the Commonwealth, a State or a Territory or any other commission of inquiry:</p>
          </content>
          <paragraph eId="sec-28__subsec-1__para-a">
            <num>a</num>
            <content>
              <p>the original identity or a former NWPP identity of:</p>
            </content>
          </paragraph>
          <paragraph eId="sec-28__subsec-1__para-i">
            <num>i</num>
            <content>
              <p>a Commonwealth participant; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-28__subsec-1__para-ii">
            <num>ii</num>
            <content>
              <p>a State participant; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-28__subsec-1__para-iii">
            <num>iii</num>
            <content>
              <p>a Territory participant;</p>
            </content>
          </paragraph>
          <paragraph eId="sec-28__subsec-1__para-b">
            <num>b</num>
            <content>
              <p>the fact that a person is such a participant;</p>
            </content>
          </paragraph>
          <paragraph eId="sec-28__subsec-1__para-c">
            <num>c</num>
            <content>
              <p>the fact that a person has undergone or is undergoing assessment for inclusion in the NWPP as such a participant.</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-28__subsec-2">
          <num>2</num>
          <content>
            <p>The court, tribunal or commission:</p>
          </content>
          <paragraph eId="sec-28__subsec-2__para-a">
            <num>a</num>
            <content>
              <p>must, unless it considers that it is not in the interests of justice to do so, hold in private that part of the proceedings that relates to the matter referred to in paragraph (1)(a), (b) or (c); and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-28__subsec-2__para-b">
            <num>b</num>
            <content>
              <p>must make such orders relating to the suppression of publication of evidence given before it as, in its opinion, will ensure that the matter referred to in paragraph (1)(a), (b) or (c) is not made public; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-28__subsec-2__para-c">
            <num>c</num>
            <content>
              <p>must, unless it considers that it is not in the interests of justice to do so, make such other orders as it considers appropriate to ensure that neither of the following is made public:</p>
            </content>
          </paragraph>
          <paragraph eId="sec-28__subsec-2__para-i">
            <num>i</num>
            <content>
              <p>the matter referred to in paragraph (1)(a), (b) or (c);</p>
            </content>
          </paragraph>
          <paragraph eId="sec-28__subsec-2__para-ii">
            <num>ii</num>
            <content>
              <p>information that may compromise the security of a person referred to in any of those paragraphs.</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-28__subsec-3">
          <num>3</num>
          <content>
            <p>To avoid doubt, paragraph (2)(b) does not prevent the taking of a transcript of court proceedings, but the court may make an order for how the transcript is to be dealt with, including an order suppressing its publication.</p>
          </content>
        </subsection>
      </section>
      <section eId="sec-28A">
        <num>28A</num>
        <heading>Offence of contravening an order under section 28</heading>
        <subsection eId="sec-28A__subsec-1">
          <num>1</num>
          <content>
            <p>A person commits an offence if:</p>
          </content>
          <paragraph eId="sec-28A__subsec-1__para-a">
            <num>a</num>
            <content>
              <p>an order is in force under <ref href="#sec-28">section 28</ref>; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-28A__subsec-1__para-b">
            <num>b</num>
            <content>
              <p>the person engages in conduct; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-28A__subsec-1__para-c">
            <num>c</num>
            <content>
              <p>the conduct contravenes the order.</p>
            </content>
            <hcontainer name="penalty">
              <content>
                <p>Penalty:	<quantity refersTo="#custodialSentence">Imprisonment for 2 years</quantity>.</p>
              </content>
            </hcontainer>
          </paragraph>
        </subsection>
        <subsection eId="sec-28A__subsec-2">
          <num>2</num>
          <content>
            <p>To avoid doubt, this section does not limit any other powers of the body that made the order under <ref href="#sec-28">section 28</ref>.</p>
          </content>
        </subsection>
      </section>
      <section eId="sec-29">
        <num>29</num>
        <heading>Transitional</heading>
        <subsection eId="sec-29__subsec-1">
          <num>1</num>
          <content>
            <p>	(1)	An authority that, immediately before the commencement of this Act, was a prescribed authority for the purposes of subsection 8(2A) of the <i>Australian Federal Police Act 1979 </i>is taken to be declared by the Minister to be an approved authority for the purposes of the definition of <b><i>approved authority</i></b> in section 3 of this Act.</p>
          </content>
        </subsection>
        <subsection eId="sec-29__subsec-2">
          <num>2</num>
          <content>
            <p>Persons who were, immediately before the commencement of this Act, included in the program operated by the Australian Federal Police and known as the witness protection program become participants on that commencement.</p>
          </content>
        </subsection>
        <subsection eId="sec-29__subsec-3">
          <num>3</num>
          <content>
            <p>To avoid doubt, an identity provided to a person under the program mentioned in subsection (2) is taken, for the purposes of this Act, to have been provided under the NWPP.</p>
          </content>
        </subsection>
      </section>
      <section eId="sec-29A">
        <num>29A</num>
        <heading>Past program participants</heading>
        <subsection eId="sec-29A__subsec-1">
          <num>1</num>
          <content>
            <p>	(1)	This section applies to a person (a <b><i>past program participant</i></b>) who:</p>
          </content>
          <paragraph eId="sec-29A__subsec-1__para-a">
            <num>a</num>
            <content>
              <p>	(a)	was, at some time before the commencement of this Act, included in a program (the <b><i>past program</i></b>) operated by the Australian Federal Police for the purpose of witness protection before the commencement of this Act; but</p>
            </content>
          </paragraph>
          <paragraph eId="sec-29A__subsec-1__para-b">
            <num>b</num>
            <content>
              <p>was not included in the past program immediately before the commencement of this Act.</p>
            </content>

            <p>For the purposes of this Act:</p>
          </content>
          <paragraph eId="sec-29A__subsec-2__para-a">
            <num>a</num>
            <content>
              <p>a past program participant is taken to be a former participant; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-29A__subsec-2__para-b">
            <num>b</num>
            <content>
              <p>an identity provided to a past program participant under the past program is taken to have been provided under the NWPP.</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-29A__subsec-3">
          <num>3</num>
          <content>
            <p>To avoid doubt, paragraph (2)(a) does not prevent a past program participant from becoming included in the NWPP under this Act.</p>
          </content>
        </subsection>
      </section>
      <section eId="sec-30">
        <num>30</num>
        <heading>Reports and information for the Minister</heading>
        <subsection eId="sec-30__subsec-1">
          <num>1</num>
          <content>
            <p><role refersTo="#commissioner">The Commissioner</role> must keep <role refersTo="#minister">the Minister</role> informed of the general operations, performance and effectiveness of the NWPP and, in particular, the exercise of <role refersTo="#commissioner">the Commissioner</role>’s powers under sections 27 and 27A.</p>
          </content>
        </subsection>
        <subsection eId="sec-30__subsec-2">
          <num>2</num>
          <content>
            <p>In consultation with <role refersTo="#commissioner">the Commissioner</role>, <role refersTo="#minister">the Minister</role> must prepare and cause to be laid before each House of the Parliament, an annual report on the matters referred to in subsection (1) in a manner which does not prejudice the effectiveness or security of the NWPP.</p>
          </content>
        </subsection>
      </section>
      <section eId="sec-32">
        <num>32</num>
        <heading>Regulations</heading>
        <content>
          <p>The Governor-General may make regulations prescribing matters:</p>
        </content>
        <paragraph eId="sec-32__para-a">
          <num>a</num>
          <content>
            <p>required or permitted to be prescribed by this Act; or</p>
          </content>
        </paragraph>
        <paragraph eId="sec-32__para-b">
          <num>b</num>
          <content>
            <p>necessary or convenient to be prescribed for carrying out or giving effect to this Act.</p>

            <p>A misdescribed amendment is an amendment that does not accurately describe how an amendment is to be made. If, despite the misdescription, the amendment can be given effect as intended, then the misdescribed amendment can be incorporated through an editorial change made under <i>Legislation Act 2003</i>.<ref href="#sec-15V">section 15V</ref> of the </p>
