        <num>1</num>
        <heading>Short title</heading>
        <content>
          <p>		This Act may be cited as the <i>Offshore Minerals (Retention Licence Fees) Act 1994</i>.</p>
        </content>
      </section>
      <section eId="sec-2">
        <num>2</num>
        <heading>Commencement</heading>
        <content>
          <p>		This Act commences immediately after the <i>Offshore Minerals Act 1994</i> commences.</p>
        </content>
      </section>
      <section eId="sec-3">
        <num>3</num>
        <heading>Interpretation</heading>
        <subsection eId="sec-3__subsec-1">
          <num>1</num>
          <content>
            <p>In this Act:</p>
          </content>
          <content>
            <p><b><i>year</i></b>, in relation to the term of a retention licence, means:</p>
            <p>(a)	the period of 12 months commencing on (and including) the day on which the provisional grant of the licence is properly accepted; or</p>
            <p>(b)	a period of 12 months commencing on (and including) an anniversary of that day; or</p>
            <p>(c)	a period of less than 12 months that:</p>
            <p>(i)	commences on (and includes):</p>
            <p>(A)	the day on which the provisional grant of the licence is properly accepted; or</p>
            <p>(B)	an anniversary of that day; and</p>
            <p>(ii)	ends at the end of the term of the licence.</p>

        </subsection>
        <subsection eId="sec-3__subsec-2">
          <num>2</num>
          <content>
            <p>	(2)	Expressions used in the <i>Offshore Minerals Act 1994</i> have the same meaning in this Act unless the contrary intention appears.</p>
          </content>
        </subsection>
      </section>
      <section eId="sec-4">
        <num>4</num>
        <heading>Retention licence fees</heading>
        <subsection eId="sec-4__subsec-1">
          <num>1</num>
          <content>
            <p>A retention licence holder must pay a fee to the Designated Authority for each year of the licence’s term.</p>
          </content>
        </subsection>
        <subsection eId="sec-4__subsec-2">
          <num>2</num>
          <content>
            <p>Subject to subsection (3), the amount of the fee is to be calculated in accordance with the regulations.</p>
          </content>
        </subsection>
        <subsection eId="sec-4__subsec-3">
          <num>3</num>
          <content>
            <p>The amount of the fee for a licence for a year is not to exceed the amount obtained by multiplying $1,000 by the number of blocks covered by the licence at the beginning of the year.</p>
          </content>
        </subsection>
      </section>
      <section eId="sec-5">
        <num>5</num>
        <heading>Holder liable to pay fee</heading>
        <subsection eId="sec-5__subsec-1">
          <num>1</num>
          <content>
            <p>The licence holder is liable to pay the fee.</p>
          </content>
        </subsection>
        <subsection eId="sec-5__subsec-2">
          <num>2</num>
          <content>
            <p>If the licence has 2 or more holders, the holders are jointly and severally liable to pay the fee.</p>
          </content>
        </subsection>
      </section>
      <section eId="sec-6">
        <num>6</num>
        <heading>Time for payment</heading>
        <content>
          <p>The fee for a year becomes payable one month after the day on which the year begins.</p>
        </content>
      </section>
      <section eId="sec-7">
        <num>7</num>
        <heading>Penalty if fee overdue</heading>
        <subsection eId="sec-7__subsec-1">
          <num>1</num>
          <content>
            <p>If the fee for a retention licence is not paid when it becomes payable, the licence holder must pay a penalty to the Designated Authority.</p>
          </content>
        </subsection>
        <subsection eId="sec-7__subsec-2">
          <num>2</num>
          <content>
            <p>If the licence has 2 or more holders, the holders are jointly and severally liable to pay the penalty.</p>
          </content>
        </subsection>
        <subsection eId="sec-7__subsec-3">
          <num>3</num>
          <content>
            <p>The penalty is to be calculated:</p>
          </content>
          <content>
            <p>(a)	on the amount of the fee that remains unpaid; and</p>
            <p>(b)	at the rate of 0.33% for each day during which the fee is unpaid.</p>
          </content>
        </subsection>
      </section>
      <section eId="sec-8">
        <num>8</num>
        <heading>Fees and penalties are debts due to Commonwealth</heading>
        <subsection eId="sec-8__subsec-1">
          <num>1</num>
          <content>
            <p>The Commonwealth may recover the following amounts in a court of competent jurisdiction as debts due to the Commonwealth:</p>
          </content>
          <content>
            <p>(a)	a fee under <ref href="#sec-4">section 4</ref>;</p>
            <p>(b)	an amount of unpaid <ref href="#sec-6">section 6</ref> penalty.</p>
          </content>
        </subsection>
        <subsection eId="sec-8__subsec-2">
          <num>2</num>
          <content>
            <p>The Designated Authority receives retention licence fees under <ref href="#sec-4">section 4</ref> and any <ref href="#sec-7">section 7</ref> penalty on behalf of the Commonwealth.</p>
          </content>
        </subsection>
      </section>
      <section eId="sec-9">
        <num>9</num>
        <heading>Regulations</heading>
        <content>
          <p>The Governor-General may make regulations prescribing matters:</p>
          <p>(a)	required or permitted by this Act to be prescribed; or</p>
          <p>(b)	necessary or convenient to be prescribed for carrying out or giving effect to this Act.</p>
