          <heading>Short title</heading>

            <p>		This Act may be cited as the <i>Health and Other Services (Compensation) Act 1995</i>.</p>
          </content>
        </section>

          <num>2</num>
          <heading>Commencement</heading>
          <subsection eId="part-1__sec-2__subsec-1">
            <num>1</num>
            <content>
              <p>Subject to subsection (2), this Act commences on a day to be fixed by Proclamation.</p>
            </content>
          </subsection>
          <subsection eId="part-1__sec-2__subsec-2">
            <num>2</num>
            <content>
              <p>If this Act does not commence under subsection (1) within the period of 3 months beginning on the day on which this Act receives the Royal Assent, it commences on the first day after the end of that period.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-1__sec-3">
          <num>3</num>
          <heading>Definitions</heading>
          <subsection eId="part-1__sec-3__subsec-1">
            <num>1</num>
            <content>
              <p>In this Act, unless the contrary intention appears:</p>
            </content>
            <content>
              <p><term refersTo="#term-advance-payment">advance payment</term> means <def>a payment made under <ref href="#sec-33B">section 33B</ref>.</def></p>
              <p><b><i>amount of compensation</i></b>, in relation to a judgment or settlement, is defined in subsection (2).</p>
              <p><term refersTo="#term-australian-law">Australian law</term> means <def>a law of the Commonwealth, a State or a Territory.</def></p>
              <p><term refersTo="#term-bulk-payment-agreement">bulk payment agreement</term> means <def>an agreement of a kind referred to in subsection 34(1).</def></p>
              <p><term refersTo="#term-charges-act">Charges Act</term> means <def>the Health and Other Services (Compensation) Care Charges Act 1995.</def></p>
              <p><term refersTo="#term-chief-executive-medicare">Chief Executive Medicare</term> has the same meaning as <def>in the Human Services (Medicare) Act 1973.</def></p>
              <p><term refersTo="#term-claim">claim</term> means <def>a claim in writing.</def></p>
              <p><term refersTo="#term-claimant">claimant</term> means <def>the person seeking compensation either on his or her own behalf or on behalf of another person.</def></p>
              <p><b><i>compensable person</i></b><i> </i>means:</p>
            </content>
            <paragraph eId="part-1__sec-3__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>an individual who is entitled to receive or has received a compensation payment in respect of an injury; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>if the individual has died—the individual’s estate.</p>
              </content>
              <content>
                <p><b><i>compensation</i></b> is defined in section 4.</p>
                <p><term refersTo="#term-compensation-authority">compensation authority</term> means <def>a person appointed, or a body established, by or under Australian law, being a person or body whose functions include determining amounts of compensation payable to persons.</def></p>
                <p><b><i>compensation payer</i></b> means:</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>a person who is liable to make a payment of compensation fixed under a judgment or settlement; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>a person who is liable to make a payment of compensation under a reimbursement arrangement; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>an authority of the Commonwealth, a State or a Territory that has decided that it will make a payment by way of compensation to another person, whether or not <role refersTo="#authority">the authority</role> is liable to make the payment.</p>
              </content>
              <content>
                <p><b><i>eligible benefit</i></b> means:</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>a medicare benefit; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>a residential care subsidy; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-1__para-d">
              <num>d</num>
              <content>
                <p>a home care subsidy.</p>
              </content>
              <content>
                <p><b><i>fixed</i></b>, in relation to an order or agreement relating to an amount of compensation, is defined in subsection (4).</p>
                <p><term refersTo="#term-home-care">home care</term> means <def>a funded aged care service (within the meaning of <ref href="">the Aged Care Act 2024</ref>) delivered in a home or community setting (within the meaning of that Act).</def></p>
                <p><term refersTo="#term-home-care-subsidy">home care subsidy</term> means <def>a person-centred subsidy or provider-based subsidy for the service group home support under <ref href="">the Aged Care Act 2024</ref>.</def></p>
                <p><term refersTo="#term-injury">injury</term> includes <def>a disease.</def></p>
                <p><term refersTo="#term-insurer">insurer</term> means <def>a person who is, under a contract of insurance, liable to indemnify a compensation payer, or a person against whom a claim for compensation is made, against liability arising from a claim for compensation, and includes: an authority of the Commonwealth, a State or a Territory that is liable to indemnify a compensation payer, or a person against whom a claim for compensation is made, against such liability, whether <role refersTo="#authority">the authority</role> is so liable under a contract, a law, or otherwise; or an authority of the Commonwealth, a State or a Territory that decides to make a payment to indemnify a compensation payer, or a person against whom a claim for compensation is made, against such liability, whether or not <role refersTo="#authority">the authority</role> is liable to do so; or a representative organisation, in relation to the claim for compensation, that decides to make a payment to indemnify a compensation payer, or a person against whom a claim for compensation is made, against such liability, whether or not the representative organisation is liable to do so.</def></p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>an authority of the Commonwealth, a State or a Territory that is liable to indemnify a compensation payer, or a person against whom a claim for compensation is made, against such liability, whether <role refersTo="#authority">the authority</role> is so liable under a contract, a law, or otherwise; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>an authority of the Commonwealth, a State or a Territory that decides to make a payment to indemnify a compensation payer, or a person against whom a claim for compensation is made, against such liability, whether or not <role refersTo="#authority">the authority</role> is liable to do so; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>a representative organisation, in relation to the claim for compensation, that decides to make a payment to indemnify a compensation payer, or a person against whom a claim for compensation is made, against such liability, whether or not the representative organisation is liable to do so.</p>
              </content>
              <content>
                <p><term refersTo="#term-judgment">judgment</term> means <def>an order (by whatever name called) by a court or a compensation authority under which an amount of compensation payable is fixed, but does not include a reimbursement arrangement, a consent judgment or an order in the nature of a consent judgment.</def></p>
                <p><b><i>law</i></b>, in relation to the Commonwealth, a State or a Territory, means a law (whether written or unwritten) of the Commonwealth, that State or that Territory, and includes a law (whether written or unwritten) in force in the Commonwealth, that State or that Territory or in any part of the Commonwealth, that State or that Territory.</p>
                <p><term refersTo="#term-medicare-benefit">medicare benefit</term> has the same meaning as <def>in <ref href="">the Health Insurance Act 1973</ref>.</def></p>
                <p><b><i>notifiable person</i></b>, in relation to a claim for compensation, means:</p>

            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>if the person against whom the claim is made has entered into a contract or arrangement with an insurer under which amounts of compensation that become payable as a result of the claim are to be paid by the insurer—the insurer; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>if paragraph (a) does not apply but the person against whom the claim is made is a member of a representative organisation that could, in performing its function of making payments in respect of amounts of compensation that its members are liable to pay, make a payment in respect of amounts of compensation that become payable as a result of the claim—the representative organisation; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>otherwise—the person against whom the claim is made.</p>
              </content>
              <content>
                <p><term refersTo="#term-professional-service">professional service</term> has the same meaning as <def>in <ref href="">the Health Insurance Act 1973</ref>.</def></p>
                <p><b><i>receive</i></b>, in relation to a compensation payment, is defined in subsection (3).</p>
                <p><term refersTo="#term-reimbursement-arrangement">reimbursement arrangement</term> means <def>an agreement in writing, an order of a court or compensation authority, or a decision of a person or body, to the effect that the person against whom a claim for compensation is made is liable to pay compensation to reimburse the claimant for expenses as they are incurred by the claimant that: are incurred in respect of any service or care rendered or provided in the course of treatment of, or as a result of, the claimant’s injury; and are expenses in respect of which an eligible benefit is or may become payable (whether or not the eligible benefit is payable to the claimant).</def></p>
              </content>
            </paragraph>

                <p>are incurred in respect of any service or care rendered or provided in the course of treatment of, or as a result of, the claimant’s injury; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>are expenses in respect of which an eligible benefit is or may become payable (whether or not the eligible benefit is payable to the claimant).</p>
              </content>
              <content>
                <p><term refersTo="#term-representative-organisation">representative organisation</term> means <def>a body that: has as one of its members the person against whom the claim for compensation was made (whether the compensation was claimed directly from that person or from the body); and has as its function, or one of its functions, making payments in respect of amounts of compensation that its members are liable to pay (whether those payments are made to compensable persons, to its members or to other persons); and had a discretion, at the time the claim for compensation was made, whether to perform the function in respect of that claim by making such a payment (whether or not it subsequently becomes liable, by agreement or otherwise, to make such a payment).</def></p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>has as one of its members the person against whom the claim for compensation was made (whether the compensation was claimed directly from that person or from the body); and</p>

                <p>had a discretion, at the time the claim for compensation was made, whether to perform the function in respect of that claim by making such a payment (whether or not it subsequently becomes liable, by agreement or otherwise, to make such a payment).</p>
              </content>
              <content>
                <p><term refersTo="#term-residential-care">residential care</term> means <def>a funded aged care service (within the meaning of <ref href="">the Aged Care Act 2024</ref>) delivered in a residential setting (within the meaning of that Act).</def></p>
                <p><term refersTo="#term-residential-care-subsidy">residential care subsidy</term> means <def>a person-centred subsidy or provider-based subsidy for the service group residential care under <ref href="">the Aged Care Act 2024</ref>.</def></p>
                <p><term refersTo="#term-secretary">Secretary</term> means <def>the Secretary of the Department.</def></p>
                <p><term refersTo="#term-settlement">settlement</term> means <def>an agreement under which an amount of compensation that a party to the agreement agrees to pay to another person is fixed, and includes: an agreement for redemption of an entitlement to compensation by way of periodic payments, being an agreement under which the amount of compensation payable under that redemption is fixed; and a consent judgment, or an order in the nature of a consent judgment, of a court or compensation authority under which an amount of compensation payable to a person is fixed; but does not include a reimbursement arrangement. <b><i>small amount</i></b> has the meaning given in section 38.</def></p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>an agreement for redemption of an entitlement to compensation by way of periodic payments, being an agreement under which the amount of compensation payable under that redemption is fixed; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-1__para-b">

                <p><b><i>Territory</i></b> means:</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>an internal Territory; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>Norfolk Island; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>the Territory of Christmas Island; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-1__para-d">
              <num>d</num>
              <content>
                <p>the Territory of Cocos (Keeling) Islands.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-1__sec-3__subsec-2">
            <num>2</num>
            <content>
              <p>A reference in this Act to an amount of compensation in relation to a judgment or settlement is a reference to the sum of all the amounts of compensation that are payable, under the judgment or settlement, to a particular compensable person.</p>
            </content>
          </subsection>
          <subsection eId="part-1__sec-3__subsec-3">
            <num>3</num>
            <content>
              <p>A reference in this Act to a person receiving a compensation payment includes a reference to another person receiving it on behalf of, or at the direction of, the first person.</p>
            </content>
          </subsection>
          <subsection eId="part-1__sec-3__subsec-4">
            <num>4</num>
            <content>
              <p>A reference in this Act to an amount of compensation being fixed under an order or agreement is a reference to the amount being:</p>
            </content>
            <paragraph eId="part-1__sec-3__subsec-4__para-a">
              <num>a</num>
              <content>
                <p>specified in the order or agreement, or in the law under which the order or agreement is made or to which the order or agreement relates; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-4__para-b">
              <num>b</num>
              <content>
                <p>ascertainable, at the time the order or agreement is made, in accordance with the terms of the order or agreement, or in accordance with a law under which the order or agreement is made or to which the order or agreement relates; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-4__para-c">
              <num>c</num>
              <content>
                <p>ascertainable, at some time after the order or agreement is made, in accordance with the terms of the order or agreement, or in accordance with a law under which the order or agreement is made or to which the order or agreement relates.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-1__sec-3__subsec-4A">
            <num>4A</num>
            <content>
              <p>An amount of compensation fixed under paragraph 3(4)(c) is fixed at the time at which the amount of compensation is ascertained.</p>
            </content>
          </subsection>
          <subsection eId="part-1__sec-3__subsec-5">
            <num>5</num>
            <content>
              <p>If a claimant is seeking compensation on behalf of another person:</p>
            </content>
            <paragraph eId="part-1__sec-3__subsec-5__para-a">
              <num>a</num>
              <content>
                <p>references in this Act to a claimant’s name, address and date of birth are taken to be references to the name, address or date of birth of the individual who is claimed to have suffered the injury in question; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-5__para-b">
              <num>b</num>
              <content>
                <p>references in this Act to the claimant’s injury are taken to be references to the injury in question.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-1__sec-3__subsec-6">
            <num>6</num>
            <content>
              <p>For the purposes of this Act (other than subsection 24(3)), an order is taken not to be a judgment until:</p>
            </content>
            <paragraph eId="part-1__sec-3__subsec-6__para-a">
              <num>a</num>
              <content>
                <p>any applicable time limits for lodging an appeal (by whatever name called) against the order have expired; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-6__para-b">
              <num>b</num>
              <content>
                <p>if there is such an appeal against the order—the appeal (and any subsequent appeals) have been finally disposed of.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-1__sec-3__subsec-7">
            <num>7</num>
            <content>
              <p>For the purposes of this Act, if a person pays an amount into a court prior to a judgment or settlement being made, the payment does not constitute a payment of compensation until the amount is released, by the court or in accordance with the rules of the court, to another person.</p>
            </content>
          </subsection>
          <subsection eId="part-1__sec-3__subsec-8">
            <num>8</num>
            <content>
              <p>For the avoidance of doubt, if:</p>
            </content>
            <paragraph eId="part-1__sec-3__subsec-8__para-a">
              <num>a</num>
              <content>
                <p>a court or compensation authority makes an order fixing an amount of compensation that is payable in respect of a claim for compensation; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-8__para-b">
              <num>b</num>
              <content>
                <p>the parties to the proceeding reached agreement on liability in respect of the injury to which the claim for compensation relates; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-8__para-c">
              <num>c</num>
              <content>
                <p>the court or compensation authority determined the quantum of damages payable, and the quantum of each head of damage specified in the order, without the agreement of the parties on any such quantum;</p>
              </content>
              <content>
                <p>the order is not a consent judgment, or an order in the nature of a consent judgment, for the purposes of this Act.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-1__sec-3__subsec-9">
            <num>9</num>
            <content>
              <p>If an injury is a disease, a reference in this Act to the day on which the injury occurs is a reference to the first day on which a professional service was rendered in respect of the disease.</p>
            </content>
          </subsection>
          <subsection eId="part-1__sec-3__subsec-10">
            <num>10</num>
            <content>
              <p>A reference in this Act to the period of a bulk payment agreement is a reference to the period to which the bulk payment agreement is expressed to apply.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-1__sec-4">
          <num>4</num>
          <heading>Definition of compensation</heading>
          <subsection eId="part-1__sec-4__subsec-1">
            <num>1</num>
            <content>
              <p>	(1)	Subject to subsection (2), for the purposes of this Act, <b><i>compensation</i></b> is:</p>
            </content>
            <paragraph eId="part-1__sec-4__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>a payment of damages; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>a payment under a scheme of insurance or compensation under a law, including a payment under a contract entered into under such a scheme, but not including a payment under such a scheme to which the recipient has contributed; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>a payment (with or without admission of liability) in settlement of a claim for damages or a claim under an insurance scheme of a kind to which paragraph (b) applies; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-1__para-d">
              <num>d</num>
              <content>
                <p>any other compensation or damages payment, other than a payment under a scheme to which the recipient has contributed;</p>
              </content>
              <content>
                <p>that is made in respect of an injury to a person (whether or not the payment is made to that person).</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-1__sec-4__subsec-2">
            <num>2</num>
            <content>
              <p>	(2)	For the purposes of this Act, <b><i>compensation</i></b> does not include:</p>
            </content>
            <paragraph eId="part-1__sec-4__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>a payment by an individual who is not insured or otherwise indemnified for liability in respect of the injury in question, and who is not required by law to be so insured or indemnified; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>a payment in the nature of criminal injuries compensation; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>an amount paid that is not required to be paid by or under an Australian law, other than such an amount the payment of which (whether on its own or in conjunction with other such payments) has the effect of extinguishing by agreement a claim for compensation; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-2__para-e">
              <num>e</num>
              <content>
                <p>a payment of a kind, or in circumstances, prescribed by the regulations made for the purposes of this paragraph.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-1__sec-4__subsec-3">
            <num>3</num>
            <content>
              <p>For the purposes of paragraph (2)(a), an individual is taken to be insured or otherwise indemnified for liability in respect of the injury in question if:</p>
            </content>
            <paragraph eId="part-1__sec-4__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>the individual is a member of a representative organisation; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>the representative organisation could, in performing its function of making payments in respect of amounts of compensation that its members are liable to pay, make a payment in respect of the liability of the individual.</p>
              </content>
            </paragraph>
          </subsection>
        </section>
        <section eId="part-1__sec-5">
          <num>5</num>
          <heading>Application of this Act to events occurring before the commencement of this Act</heading>
          <subsection eId="part-1__sec-5__subsec-1">
            <num>1</num>
            <content>
              <p>This Act only applies in relation to an amount of compensation fixed by a judgment or settlement if the judgment or settlement was made on or after the day on which this Act commences.</p>
            </content>
          </subsection>
          <subsection eId="part-1__sec-5__subsec-2">
            <num>2</num>
            <content>
              <p>This Act only applies in relation to an amount of compensation payable under a reimbursement arrangement if the reimbursement arrangement was made on or after the day on which this Act commences.</p>
            </content>
          </subsection>
          <subsection eId="part-1__sec-5__subsec-3">
            <num>3</num>
            <content>
              <p>This Act applies in relation to such a judgment, settlement or reimbursement arrangement even if it is made in respect of an injury that occurred before that day.</p>
            </content>
          </subsection>
          <subsection eId="part-1__sec-5__subsec-4">
            <num>4</num>
            <content>
              <p>In its application in respect of an injury that occurred before that day, this Act is capable of applying in relation to a particular payment of an eligible benefit whether the payment was made before, on or after that day.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-1__sec-6">
          <num>6</num>
          <heading>Crown to be bound</heading>
          <subsection eId="part-1__sec-6__subsec-1">
            <num>1</num>
            <content>
              <p>This Act binds the Crown in all its capacities.</p>
            </content>
          </subsection>
          <subsection eId="part-1__sec-6__subsec-2">
            <num>2</num>
            <content>
              <p>Nothing in this Act renders the Crown in any of its capacities liable to be prosecuted.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-1__sec-6AA">
          <num>6AA</num>
          <heading>Norfolk Island</heading>
          <content>
            <p>This Act extends to Norfolk Island.</p>
          </content>
        </section>
        <section eId="part-1__sec-6A">
          <num>6A</num>
          <heading>Application of the Criminal Code</heading>
          <content>
            <p>		Chapter 2 of the <i>Criminal Code</i> applies to all offences against this Act.</p>

            <heading>Reimbursement of amounts payable for professional services</heading>
            <subsection eId="part-2__dvs-1__sec-7__subsec-1">

                <p>This section applies if:</p>
              </content>
              <paragraph eId="part-2__dvs-1__sec-7__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>a reimbursement arrangement has been made in respect of an injury to a compensable person; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-1__sec-7__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>the person is entitled, under the reimbursement arrangement, to compensation by way of reimbursement of expenses as those expenses are incurred, being expenses relating to the professional services rendered to the person in the course of treatment of, or as a result of, the injury.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-1__sec-7__subsec-2">
              <num>2</num>
              <content>
                <p>	(2)	Despite <i>Health Insurance Act 1973</i>, medicare benefit is not payable in respect of a professional service if, under the reimbursement arrangement, the whole or any part of the amount payable for the service has already been reimbursed before a claim for medicare benefit in respect of the service is made.<ref href="#part-I">Part I</ref>I of the </p>
              </content>
            </subsection>
            <subsection eId="part-2__dvs-1__sec-7__subsec-3">
              <num>3</num>
              <content>
                <p>If:</p>
              </content>
              <paragraph eId="part-2__dvs-1__sec-7__subsec-3__para-a">
                <num>a</num>
                <content>
                  <p>medicare benefit has been paid in respect of a professional service rendered to the person; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-1__sec-7__subsec-3__para-b">
                <num>b</num>
                <content>
                  <p>under the reimbursement arrangement, the person is entitled to reimbursement of the whole or any part of the amount payable for the service;</p>
                </content>
                <content>
                  <p>the person entitled to the reimbursement is liable to pay to the Commonwealth an amount equal to the medicare benefit.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-1__sec-7__subsec-4">
              <num>4</num>
              <content>
                <p>Subsection (3) has effect only so far as it is not a law imposing taxation <ref href="#sec-55">within the meaning of section 55</ref> of the Constitution.</p>

            <heading>Recovering past payments of medicare benefit from judgments and settlements</heading>
            <subsection eId="part-2__dvs-1__sec-8__subsec-1">
              <num>1</num>
              <content>
                <p>Subject to subsections (2), (3), (6) and (9), if:</p>
              </content>
              <paragraph eId="part-2__dvs-1__sec-8__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>an amount of compensation is fixed under a judgment or settlement made in respect of an injury to a compensable person; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-1__sec-8__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>medicare benefit has already been paid in respect of a professional service rendered to that person in the course of treatment of, or as a result of, the injury; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-1__sec-8__subsec-1__para-c">
                <num>c</num>
                <content>
                  <p>a liability has not already arisen under <ref href="#sec-7">section 7</ref> in respect of that payment of medicare benefit;</p>
                </content>
                <content>
                  <p>there is payable to the Commonwealth an amount equal to the medicare benefit.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-1__sec-8__subsec-2">
              <num>2</num>
              <content>
                <p>Subject to subsection (3), if:</p>
              </content>
              <paragraph eId="part-2__dvs-1__sec-8__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>the judgment or settlement fixes the amount of compensation on the basis that liability for the injury should be apportioned between the compensable person and the compensation payer; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-1__sec-8__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>as a result, the amount of compensation is less than it would have been if liability had not been so apportioned;</p>
                </content>
                <content>
                  <p>the amount payable to the Commonwealth under subsection (1) is reduced by the proportion corresponding to the proportion of liability for the injury that is apportioned to the compensable person by the judgment or settlement.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-1__sec-8__subsec-3">
              <num>3</num>
              <content>
                <p>If:</p>
              </content>
              <paragraph eId="part-2__dvs-1__sec-8__subsec-3__para-a">
                <num>a</num>
                <content>
                  <p>	(a)	the amount of compensation is fixed by a judgment that specifies an amount (the <b><i>past medical care component</i></b>), being a portion of the amount of compensation, to be a component for the medical expenses already incurred relating to the injury; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-1__sec-8__subsec-3__para-b">
                <num>b</num>
                <content>
                  <p>the amount that, apart from this subsection, would be payable to the Commonwealth under this section exceeds the past medical care component;</p>
                </content>
                <content>
                  <p>the amount payable under subsection (1) is taken to be the past medical care component.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-1__sec-8__subsec-4">
              <num>4</num>
              <content>
                <p>The amount is payable by the compensable person.</p>
              </content>
            </subsection>
            <subsection eId="part-2__dvs-1__sec-8__subsec-5">
              <num>5</num>
              <content>
                <p>This section has effect only so far as it is not a law imposing taxation <ref href="#sec-55">within the meaning of section 55</ref> of the Constitution.</p>

                <p>Subject to subsections (7) and (8) and <ref href="#sec-37">section 37</ref>, this section does not apply if:</p>
              </content>
              <paragraph eId="part-2__dvs-1__sec-8__subsec-6__para-a">
                <num>a</num>
                <content>
                  <p>the notifiable person in relation to the claim for compensation concerned has entered into a bulk payment agreement with the Chief Executive Medicare; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-1__sec-8__subsec-6__para-b">
                <num>b</num>
                <content>
                  <p>the notifiable person has complied with all the conditions of the bulk payment agreement; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-1__sec-8__subsec-6__para-c">
                <num>c</num>
                <content>
                  <p>an amount of compensation is fixed under the judgment or settlement during the period of the bulk payment agreement; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-1__sec-8__subsec-6__para-d">
                <num>d</num>
                <content>
                  <p>the judgment or settlement determines all the outstanding liability of the compensation payer in relation to the claim.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-1__sec-8__subsec-7">
              <num>7</num>
              <content>
                <p>Subsection (6) does not apply in relation to a judgment or settlement of a kind referred to in that subsection if:</p>
              </content>
              <paragraph eId="part-2__dvs-1__sec-8__subsec-7__para-a">
                <num>a</num>
                <content>

                  <p>another judgment or settlement in respect of the claim is made after the end of the period of the bulk payment agreement.</p>

                <p>Subsection (6) does not affect the validity of a payment of money pursuant to a notice under <ref href="#sec-24">section 24</ref> if the payment occurred before the amount of compensation was fixed under the judgment or settlement referred to in that subsection.</p>

              <num>9</num>

                <p>This section does not apply if:</p>

                  <p>the amount of compensation fixed by the judgment or settlement is a small amount; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-1__sec-8__subsec-9__para-c">
                <num>c</num>

                  <p>the amount of compensation so fixed is the entire amount of compensation for the injury to which the claim relates.</p>

            <heading>Reimbursement of amounts payable for residential care or home care</heading>

                <p>This section applies if:</p>

              <paragraph eId="part-2__dvs-2__sec-9__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>a reimbursement arrangement has been made in respect of an injury to a compensable person; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-9__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>the person is entitled, under the reimbursement arrangement, to compensation by way of reimbursement of expenses as those expenses are incurred, being expenses incurred in respect of residential care or home care provided to the person in the course of treatment of, or as a result of, the injury.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-2__sec-9__subsec-2A">
              <num>2A</num>
              <content>
                <p>	(2A)	Despite <i>Aged Care Act 2024</i>, residential care subsidy is not payable in respect of residential care if, under the reimbursement arrangement, the whole or any part of the amount payable for residential care has already been reimbursed before a claim for residential care subsidy in respect of the residential care has been submitted.<ref href="#part-2">Part 2</ref> of Chapter 4 of the </p>
              </content>
            </subsection>
            <subsection eId="part-2__dvs-2__sec-9__subsec-2B">
              <num>2B</num>
              <content>
                <p>	(2B)	Despite <i>Aged Care Act 1997</i> and Part 3.2 of the <i>Aged Care (Transitional Provisions) Act 1997</i>, home care subsidy is not payable in respect of home care if, under the reimbursement arrangement, the whole or any part of the amount payable for home care has already been reimbursed before a claim for home care subsidy in respect of the home care has been submitted.<ref href="#part-3">Part 3</ref>.2 of the </p>

            </subsection>

                <p>If:</p>
              </content>
              <paragraph eId="part-2__dvs-2__sec-9__subsec-3__para-a">

                  <p>residential care or home care has been provided to the person; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-9__subsec-3__para-aa">
                <num>aa</num>
                <content>
                  <p>residential care subsidy or home care subsidy has been paid in respect of the residential care or home care; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-9__subsec-3__para-b">
                <num>b</num>
                <content>
                  <p>under the reimbursement arrangement, the person is entitled to reimbursement of the whole or any part of the amount payable for the residential care or home care;</p>
                </content>
                <content>
                  <p>the person entitled to the reimbursement is liable to pay to the Commonwealth an amount equal to the residential care subsidy or home care subsidy.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-2__sec-9__subsec-4">
              <num>4</num>
              <content>
                <p>Subsection (3) has effect only so far as it is not a law imposing taxation <ref href="#sec-55">within the meaning of section 55</ref> of the Constitution.</p>

            <heading>Recovering past payments of residential care subsidy or home care subsidy from judgments and settlements</heading>
            <subsection eId="part-2__dvs-2__sec-10__subsec-1">
              <num>1</num>
              <content>
                <p>Subject to subsections (2), (3), (6) and (9), if:</p>
              </content>
              <paragraph eId="part-2__dvs-2__sec-10__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>an amount of compensation is fixed under a judgment or settlement made in respect of an injury to a compensable person; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-10__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>residential care or home care has been provided to that person in the course of treatment of, or as a result of, the injury; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-10__subsec-1__para-ba">
                <num>ba</num>
                <content>
                  <p>residential care subsidy or home care subsidy has already been paid in respect of that residential care or home care; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-10__subsec-1__para-c">
                <num>c</num>
                <content>
                  <p>a liability has not already arisen under <ref href="#sec-9">section 9</ref> in respect of that payment of residential care subsidy or home care subsidy;</p>
                </content>
                <content>
                  <p>there is payable to the Commonwealth an amount equal to the residential care subsidy or home care subsidy.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-2__sec-10__subsec-2">
              <num>2</num>
              <content>
                <p>Subject to subsection (3), if:</p>
              </content>
              <paragraph eId="part-2__dvs-2__sec-10__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>the judgment or settlement fixes the amount of compensation on the basis that liability for the injury should be apportioned between the compensable person and the compensation payer; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-10__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>as a result, the amount of compensation is less than it would have been if liability had not been so apportioned;</p>
                </content>
                <content>
                  <p>the amount payable to the Commonwealth under subsection (1) is reduced by the proportion corresponding to the proportion of liability for the injury that is apportioned to the compensable person by the judgment or settlement.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-2__sec-10__subsec-3">
              <num>3</num>
              <content>
                <p>If:</p>
              </content>
              <paragraph eId="part-2__dvs-2__sec-10__subsec-3__para-a">
                <num>a</num>
                <content>
                  <p>	(a)	the amount of compensation is fixed by a judgment that specifies an amount (the <b><i>past care component</i></b>), being a portion of the amount of compensation, to be a component for the residential care expenses or home care expenses already incurred relating to the injury; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-10__subsec-3__para-b">
                <num>b</num>
                <content>
                  <p>the amount that, apart from this subsection, would be payable to the Commonwealth under this section exceeds the past care component;</p>
                </content>
                <content>
                  <p>the amount payable under subsection (1) is taken to be the past care component.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-2__sec-10__subsec-4">
              <num>4</num>
              <content>
                <p>The amount is payable by the compensable person.</p>
              </content>
            </subsection>
            <subsection eId="part-2__dvs-2__sec-10__subsec-5">
              <num>5</num>

                <p>Subject to subsections (7) and (8) and <ref href="#sec-37">section 37</ref>, this section does not apply if:</p>
              </content>
              <paragraph eId="part-2__dvs-2__sec-10__subsec-6__para-a">
                <num>a</num>
                <content>
                  <p>the notifiable person in relation to the claim for compensation concerned has entered into a bulk payment agreement with the Chief Executive Medicare; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-10__subsec-6__para-b">
                <num>b</num>
                <content>
                  <p>the notifiable person has complied with all the conditions of the bulk payment agreement; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-10__subsec-6__para-c">
                <num>c</num>
                <content>
                  <p>an amount of compensation is fixed under the judgment or settlement during the period of the bulk payment agreement; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-10__subsec-6__para-d">
                <num>d</num>
                <content>
                  <p>the judgment or settlement determines all the outstanding liability of the compensation payer in relation to the claim.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-2__sec-10__subsec-7">
              <num>7</num>
              <content>
                <p>Subsection (6) does not apply in relation to a judgment or settlement of a kind referred to in that subsection if:</p>
              </content>
              <paragraph eId="part-2__dvs-2__sec-10__subsec-7__para-a">
                <num>a</num>
                <content>
                  <p>an amount of compensation is fixed under the judgment or settlement during the period of the bulk payment agreement; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-10__subsec-7__para-b">
                <num>b</num>
                <content>
                  <p>at the time the judgment or settlement was made, it purported to determine all the outstanding liability of the compensation payer in relation to the claim; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-10__subsec-7__para-c">
                <num>c</num>
                <content>
                  <p>another judgment or settlement in respect of the claim is made after the end of the period of the bulk payment agreement.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-2__sec-10__subsec-8">
              <num>8</num>
              <content>
                <p>Subsection (6) does not affect the validity of a payment of money pursuant to a notice under <ref href="#sec-24">section 24</ref> if the payment occurred before the amount of compensation was fixed under the judgment or settlement referred to in that subsection.</p>

                <p>This section does not apply if:</p>

                  <p>the amount of compensation fixed by the judgment or settlement is a small amount; and</p>
                </content>
              </paragraph>

                  <p>the amount of compensation so fixed is the entire amount of compensation for the injury to which the claim relates.</p>

            <heading>Operation of Division</heading>
            <content>
              <p>This Division operates if a person makes a claim against another person for compensation in respect of an injury, by claiming compensation from the other person.</p>
            </content>
          </section>
          <section eId="part-3__dvs-1__sec-13">
            <num>13</num>
            <heading>Notice of reimbursement arrangements</heading>
            <content>
              <p>If:</p>
            </content>
            <paragraph eId="part-3__dvs-1__sec-13__para-a">
              <num>a</num>
              <content>
                <p>a period of 6 months has elapsed since the claim for compensation was made; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__dvs-1__sec-13__para-b">
              <num>b</num>
              <content>
                <p>a reimbursement arrangement in relation to the claim is or was made after the end of that period;</p>
              </content>
              <content>
                <p>the person who is liable to reimburse the claimant under the arrangement must, <quantity refersTo="#deadline">within 28 days</quantity> after the arrangement is made, give to the Chief Executive Medicare written notice of the arrangement.</p>
              </content>
            </paragraph>
          </section>
          <section eId="part-3__dvs-1__sec-14">
            <num>14</num>
            <heading>Notice of intention to recover amounts</heading>
            <subsection eId="part-3__dvs-1__sec-14__subsec-1">
              <num>1</num>
              <content>
                <p>The Chief Executive Medicare may give to the notifiable person written notice that the Chief Executive Medicare may seek:</p>
              </content>
              <paragraph eId="part-3__dvs-1__sec-14__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>in relation to the amount of compensation fixed in a judgment or settlement; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-14__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>in relation to an amount of compensation paid under a reimbursement arrangement;</p>
                </content>
                <content>
                  <p>payment to the Commonwealth, under this Act or the Charges Act, of amounts in respect of any eligible benefits paid by the Commonwealth in respect of any service or care rendered or provided in the course of treatment of, or as a result of, the claimant’s injury.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-14__subsec-2">
              <num>2</num>
              <content>
                <p>Without limiting the matters that the notice may include, it may include information about any requirements of this Division relating to the claim for compensation.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-14__subsec-3">
              <num>3</num>
              <content>
                <p>The Chief Executive Medicare must give a copy of any such notice to the claimant.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-3__dvs-1__sec-17">
            <num>17</num>
            <heading>Notice to claimant</heading>
            <subsection eId="part-3__dvs-1__sec-17__subsec-1">
              <num>1</num>
              <content>
                <p>The Chief Executive Medicare may, in respect of the claim for compensation, give to the claimant a written notice that requires the claimant to give to the Chief Executive Medicare a written statement specifying:</p>
              </content>
              <paragraph eId="part-3__dvs-1__sec-17__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>the professional services (if any), in respect of which medicare benefit has been paid, that have been rendered in the course of treatment of, or as a result of, the injury the claimant claims to have suffered; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-17__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>whether residential care or home care has been provided in the course of treatment of, or as a result of, the injury the claimant claims to have suffered.</p>
                </content>

                    <p>Note:	A notice under this section can be given before or after judgment or settlement in respect of the claim.</p>

              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-17__subsec-2">
              <num>2</num>
              <content>
                <p>The notice must specify the professional services (if any), in respect of which medicare benefit has been paid, that have been rendered to the claimant since the claimant claims to have suffered the injury.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-17__subsec-3">
              <num>3</num>
              <content>
                <p>The notice must:</p>
              </content>
              <paragraph eId="part-3__dvs-1__sec-17__subsec-3__para-a">
                <num>a</num>
                <content>
                  <p>state the period within which the claimant is required to give the statement to the Chief Executive Medicare; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-17__subsec-3__para-b">
                <num>b</num>
                <content>
                  <p>contain a statement of the claimant’s rights to seek an extension of that period and to apply for reconsideration of decisions about extensions of the period.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-17__subsec-4">
              <num>4</num>
              <content>
                <p>The Chief Executive Medicare may give more than one notice to the claimant in respect of the same claim for compensation.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-17__subsec-5">
              <num>5</num>
              <content>
                <p>The claimant or the notifiable person may request the Chief Executive Medicare to give the claimant a notice under this section.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-17__subsec-5A">
              <num>5A</num>
              <content>
                <p>A request under subsection (5) must be made in the form approved in writing by the Chief Executive Medicare.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-17__subsec-6">
              <num>6</num>
              <content>
                <p>The Chief Executive Medicare must comply with such a request:</p>
              </content>
              <paragraph eId="part-3__dvs-1__sec-17__subsec-6__para-a">
                <num>a</num>
                <content>
                  <p>if the date on which the claimant suffered the injury is more than 5 years before the request was made—<quantity refersTo="#deadline">within 60 days</quantity> after the request was made; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-17__subsec-6__para-b">
                <num>b</num>
                <content>
                  <p>otherwise—<quantity refersTo="#deadline">within 28 days</quantity> after the request was made.</p>
                </content>
              </paragraph>
            </subsection>
          </section>
          <section eId="part-3__dvs-1__sec-18">
            <num>18</num>
            <heading>Statement by claimant of past benefits</heading>
            <subsection eId="part-3__dvs-1__sec-18__subsec-1">
              <num>1</num>
              <content>
                <p>Subject to subsection (3), the claimant must give to the Chief Executive Medicare the statement required by the notice within the period of 28 days after being given the notice.</p>
              </content>

                  <p>Note:	Sections 137.1 and 137.2 of the <i>Criminal Code</i> create offences for providing false or misleading information or documents.</p>

            </subsection>

              <num>3</num>
              <content>
                <p>Subject to subsections (4) and (4A) and <ref href="#sec-20">section 20</ref>, the Chief Executive Medicare may, by notice in writing, grant the claimant one or more extensions of the period.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-18__subsec-4">
              <num>4</num>
              <content>
                <p>The period cannot be extended if:</p>
              </content>
              <paragraph eId="part-3__dvs-1__sec-18__subsec-4__para-a">
                <num>a</num>
                <content>
                  <p>the notice in question under subsection 17(1) was given in relation to a claim for compensation in respect of which an amount of compensation under a judgment or settlement had already been fixed; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-18__subsec-4__para-b">
                <num>b</num>
                <content>
                  <p>the Chief Executive Medicare had not given a notice under <ref href="#sec-21">section 21</ref>, in respect of the claim for compensation, during the 6 months preceding the day on which an amount of compensation was fixed under the judgment or settlement; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-18__subsec-4__para-c">
                <num>c</num>
                <content>
                  <p>an advance payment has not been made in respect of the compensation payable under the judgment or settlement.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-18__subsec-4A">
              <num>4A</num>
              <content>
                <p>If an advance payment has been made under <ref href="#sec-33B">section 33B</ref>, the period cannot be extended:</p>
              </content>
              <paragraph eId="part-3__dvs-1__sec-18__subsec-4A__para-a">
                <num>a</num>
                <content>
                  <p>if only one notice under <ref href="#sec-17">section 17</ref> has been given to the claimant in relation to the claim for compensation in question—beyond the period of 12 months after the claimant received that notice; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-18__subsec-4A__para-b">
                <num>b</num>
                <content>
                  <p>in any other case—beyond the period of 12 months after the claimant received the last notice given to the claimant in relation to the claim for compensation.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-18__subsec-5">
              <num>5</num>
              <content>
                <p>If the claimant does not give to the Chief Executive Medicare a statement as required by this section, all the professional services specified in the notice under subsection 17(2) are taken for the purposes of this Act and the Charges Act to have been rendered in the course of treatment of, or as a result of, the injury the claimant claims to have suffered.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-18__subsec-6">
              <num>6</num>
              <content>
                <p>Subsection (5) does not operate, and is taken for the purposes of this Act and the Charges Act never to have operated, in relation to professional services specified in a notice under subsection 17(2) if the Chief Executive Medicare gives the claimant a notice under subsection (7).</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-18__subsec-7">
              <num>7</num>
              <content>
                <p>The Chief Executive Medicare must give the claimant a notice for the purposes of subsection (6) if:</p>
              </content>
              <paragraph eId="part-3__dvs-1__sec-18__subsec-7__para-a">
                <num>a</num>
                <content>
                  <p>apart from subsection (6), subsection (5) would operate so that all the services specified in a notice under subsection 17(2) would be taken for the purposes of this Act and the Charges Act to have been rendered in the course of treatment of, or as a result of, the injury the claimant claims to have suffered; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-18__subsec-7__para-b">
                <num>b</num>
                <content>
                  <p>an amount of compensation has been fixed under a judgment or settlement; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-18__subsec-7__para-c">
                <num>c</num>
                <content>
                  <p>the claimant, within the period of 2 years beginning on the day on which the amount of compensation was fixed under the judgment or settlement, satisfies the Chief Executive Medicare that:</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-18__subsec-7__para-i">
                <num>i</num>
                <content>
                  <p>not all of those services have been rendered in the course of treatment of, or as a result of, the injury the claimant claims to have suffered; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-18__subsec-7__para-ii">
                <num>ii</num>
                <content>
                  <p>the claimant’s failure to give the Chief Executive Medicare a statement as required by this section was reasonable in the circumstances.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-18__subsec-8">
              <num>8</num>
              <content>
                <p>To avoid doubt, if:</p>
              </content>
              <paragraph eId="part-3__dvs-1__sec-18__subsec-8__para-a">
                <num>a</num>
                <content>
                  <p>apart from subsection (6), an amount was payable to the Commonwealth under this Act in relation to the claim; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-18__subsec-8__para-b">
                <num>b</num>
                <content>
                  <p>a person paid that amount to the Commonwealth in relation to the claim; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-18__subsec-8__para-c">
                <num>c</num>
                <content>
                  <p>the Chief Executive Medicare gave the claimant a notice under subsection (7); and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-18__subsec-8__para-d">
                <num>d</num>
                <content>
                  <p>because of subsection (6), the amount paid exceeds the amount properly payable under this Act;</p>
                </content>
                <content>
                  <p>the amount of the excess is payable by the Commonwealth to the person.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-18__subsec-9">
              <num>9</num>
              <content>
                <p>The Consolidated Revenue Fund is appropriated for the purposes of payments by the Commonwealth under subsection (8).</p>
              </content>
              <content>
                <p>Review of decision to refuse to give notice</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-18__subsec-9A">
              <num>9A</num>
              <content>
                <p>Application may be made to the Chief Executive Medicare for reconsideration of a decision by the Chief Executive Medicare to refuse to give a notice under subsection (7).</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-18__subsec-9B">
              <num>9B</num>
              <content>
                <p>The application must be made <quantity refersTo="#deadline">within 28 days</quantity> after the claimant is notified of the decision to refuse to give the notice.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-18__subsec-9C">
              <num>9C</num>
              <content>
                <p>If an application for reconsideration is made, the decision must be reconsidered by the Chief Executive Medicare or a delegate of the Chief Executive Medicare.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-18__subsec-9D">
              <num>9D</num>
              <content>
                <p>The decision must not be reconsidered by the person who made the decision to refuse to give the notice.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-18__subsec-9E">
              <num>9E</num>
              <content>
                <p>The person reconsidering the decision must affirm or vary the decision <quantity refersTo="#deadline">within 28 days</quantity> after the application for reconsideration is made.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-18__subsec-10">
              <num>10</num>
              <content>
                <p>If a decision has been reconsidered, application may be made to the Administrative Review Tribunal for review of the decision as affirmed or varied at the reconsideration.</p>
              </content>

                  <p>Note:	Section 266 of the <i>Administrative Review Tribunal Act 2024</i> requires the decision-maker to notify persons whose interests are affected by the decision of the making of the decision and their right to have the decision reviewed.           </section>
          <section eId="part-3__dvs-1__sec-19">
            <num>19</num>
            <heading>Reconsideration of decisions about extensions of the period for giving statements</heading>
            <subsection eId="part-3__dvs-1__sec-19__subsec-1">
              <num>1</num>
              <content>
                <p>If the claimant is dissatisfied with the Chief Executive Medicare’s decision about extension of the period, the claimant may apply in writing to the Chief Executive Medicare for the decision to be reconsidered.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-19__subsec-2">
              <num>2</num>
              <content>
                <p>The application must be made <quantity refersTo="#deadline">within 28 days</quantity> after the claimant is informed of the decision.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-19__subsec-3">
              <num>3</num>
              <content>
                <p>Subject to <quantity refersTo="#deadline">within 28 days</quantity> after receiving the application, the Chief Executive Medicare must:<ref href="#sec-20">section 20</ref>, </p>
              </content>
              <paragraph eId="part-3__dvs-1__sec-19__subsec-3__para-a">
                <num>a</num>
                <content>
                  <p>reconsider the decision; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-19__subsec-3__para-b">
                <num>b</num>
                <content>
                  <p>if the decision under reconsideration was a refusal to extend the period—affirm the decision or substitute a decision granting an extension; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-19__subsec-3__para-c">
                <num>c</num>
                <content>
                  <p>if the decision under reconsideration was a decision granting an extension—affirm the decision or vary the decision by granting a longer period; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-19__subsec-3__para-d">
                <num>d</num>
                <content>
                  <p>give to the claimant a notice stating the Chief Executive Medicare’s decision on the reconsideration together with a statement of his or her reasons for the decision on the reconsideration.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-19__subsec-4">
              <num>4</num>
              <content>
                <p>The Chief Executive Medicare’s decision on reconsideration of the decision has effect as if it had been made under subsection 18(3).</p>
              </content>
            </subsection>
          </section>
          <section eId="part-3__dvs-1__sec-20">
            <num>20</num>
            <heading>Effect of date of hearing on period for giving statement</heading>
            <content>
              <p>If a court or compensation authority sets a date for the hearing to determine the claim for compensation:</p>
            </content>
            <paragraph eId="part-3__dvs-1__sec-20__para-a">
              <num>a</num>
              <content>
                <p>an extension under <ref href="#sec-18">section 18</ref> or 19 must not be granted after the day on which the date for the hearing was set; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__dvs-1__sec-20__para-b">
              <num>b</num>
              <content>
                <p>any extension that:</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__dvs-1__sec-20__para-i">
              <num>i</num>
              <content>
                <p>was granted before the date for the hearing was set; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__dvs-1__sec-20__para-ii">
              <num>ii</num>
              <content>
                <p>would, apart from this section, have extended the period in question beyond 28 days after the day on which the date for the hearing was set, or beyond the date set for the hearing;</p>
              </content>
              <content>
                <p>is taken to be an extension of the period until 28 days after the day on which the date for the hearing was set, or until the date set for the hearing, whichever occurs earlier.</p>
              </content>
            </paragraph>
          </section>
          <section eId="part-3__dvs-1__sec-21">
            <num>21</num>
            <heading>Notice of past benefits</heading>
            <subsection eId="part-3__dvs-1__sec-21__subsec-1">
              <num>1</num>
              <content>
                <p>If, in relation to each notice given to the claimant under <ref href="#sec-17">section 17</ref> in respect of the claim for compensation, either:</p>
              </content>
              <paragraph eId="part-3__dvs-1__sec-21__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>the claimant has given to the Chief Executive Medicare a statement under <ref href="#sec-18">section 18</ref>; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-21__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>the period for giving the statement has expired;</p>
                </content>
                <content>
                  <p>the Chief Executive Medicare may give to the notifiable person a notice under this section.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-21__subsec-2">
              <num>2</num>
              <content>
                <p>The notice must set out:</p>
              </content>
              <paragraph eId="part-3__dvs-1__sec-21__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>the period covered by the notice; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-21__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>the total amount of eligible benefits paid by the Commonwealth, during that period, in respect of services and care rendered or provided in the course of treatment of, or as a result of, the injury the claimant claims to have suffered.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-21__subsec-3">
              <num>3</num>
              <content>
                <p>If the claimant had given to the Chief Executive Medicare a statement under <ref href="#sec-18">section 18</ref> prior to the Chief Executive Medicare giving the notice, the notice must not, in relation to the period covered by the statement, take account of any eligible benefits that were paid in respect of services or care not specified in the statement.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-21__subsec-4">
              <num>4</num>
              <content>
                <p>Without limiting the matters that the notice may include, it may include information about amounts that may become payable to the Commonwealth under this Act or the Charges Act in respect of the amount of compensation in question.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-21__subsec-5">
              <num>5</num>
              <content>
                <p>Without limiting the matters that the notice may include, it may include a statement to the effect that, if an amount of compensation is fixed under a judgment or settlement made in respect of the claim <quantity refersTo="#deadline">within 6 months</quantity> after the notice was given, the notice is taken to be a notice of charge under section 24, given by the Chief Executive Medicare on the day on which the compensation is fixed.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-21__subsec-6">
              <num>6</num>
              <content>
                <p>If a notice contains a statement of a kind referred to in subsection (5), it must also contain a statement to the effect that, subject to subsection (7), if:</p>
              </content>
              <paragraph eId="part-3__dvs-1__sec-21__subsec-6__para-a">
                <num>a</num>
                <content>
                  <p>the notice is taken to be a notice of charge under <ref href="#sec-24">section 24</ref>; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-21__subsec-6__para-b">
                <num>b</num>
                <content>
                  <p>the judgment or settlement fixes the amount of compensation on the basis that liability for the injury should be apportioned between the compensable person and the compensation payer; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-21__subsec-6__para-c">
                <num>c</num>
                <content>
                  <p>as a result, the amount of compensation is less than it would have been if liability had not been so apportioned;</p>
                </content>
                <content>
                  <p>the amount specified in the notice as payable to the Commonwealth is reduced by the proportion corresponding to the proportion of liability for the injury that is apportioned to the compensable person by the judgment or settlement.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-21__subsec-7">
              <num>7</num>
              <content>
                <p>If a notice contains a statement of a kind referred to in subsection (5), it must also contain a statement to the effect that, if:</p>
              </content>
              <paragraph eId="part-3__dvs-1__sec-21__subsec-7__para-a">
                <num>a</num>
                <content>
                  <p>the notice is taken to be a notice of charge under <ref href="#sec-24">section 24</ref>; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-21__subsec-7__para-b">
                <num>b</num>
                <content>
                  <p>	(b)	the amount of compensation is fixed by a judgment that specifies an amount (the <b><i>past expenses component</i></b>), being a portion of the amount of compensation, to be a component for either or both of the following:</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-21__subsec-7__para-i">
                <num>i</num>
                <content>
                  <p>the medical expenses already incurred relating to the injury;</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-21__subsec-7__para-ii">
                <num>ii</num>
                <content>
                  <p>the expenses in respect of residential care or home care already incurred relating to the injury;</p>
                </content>
                <content>
                  <p>the past expenses component is taken to be the amount specified in the notice as payable to the Commonwealth.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-21__subsec-8">
              <num>8</num>
              <content>
                <p>Without limiting the matters that the notice may include, it may include a statement to the effect that if a reimbursement arrangement is made in respect of the claim, the notice is taken to be a notice of charge under <ref href="#sec-25">section 25</ref>, given by the Chief Executive Medicare on:</p>
              </content>
              <paragraph eId="part-3__dvs-1__sec-21__subsec-8__para-a">
                <num>a</num>
                <content>
                  <p>if the reimbursement arrangement was made before the Chief Executive Medicare gives the notice to the notifiable person—the day on which the Chief Executive Medicare gives the notice to the notifiable person; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-21__subsec-8__para-b">
                <num>b</num>
                <content>
                  <p>in any other case—the day on which the reimbursement arrangement is made.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-21__subsec-9">
              <num>9</num>
              <content>
                <p>The Chief Executive Medicare must give a copy of any such notice to the claimant.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-21__subsec-10">
              <num>10</num>
              <content>
                <p>The Chief Executive Medicare may give more than one notice to the notifiable person in respect of the same claim for compensation.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-21__subsec-11">
              <num>11</num>
              <content>
                <p>Subject to subsection (13), the claimant or the notifiable person may request the Chief Executive Medicare to give the notifiable person a notice.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-21__subsec-12">
              <num>12</num>
              <content>
                <p>The Chief Executive Medicare must comply with such a request:</p>
              </content>
              <paragraph eId="part-3__dvs-1__sec-21__subsec-12__para-a">
                <num>a</num>
                <content>
                  <p>if, at the time the request was made, the claimant had been given a notice under <quantity refersTo="#deadline">within 28 days</quantity> after he or she complies or <quantity refersTo="#deadline">within 28 days</quantity> after the period for compliance expires, whichever happens first; or<ref href="#sec-17">section 17</ref> with which he or she had not yet complied but the period for compliance had not expired—</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-21__subsec-12__para-b">
                <num>b</num>
                <content>
                  <p>if the Chief Executive Medicare gives to the claimant a notice under <quantity refersTo="#deadline">within 28 days</quantity> after the request was made—<quantity refersTo="#deadline">within 28 days</quantity> after the claimant complies with the notice, or <quantity refersTo="#deadline">within 28 days</quantity> after the period for compliance expires, whichever happens first; or<ref href="#sec-17">section 17</ref> </p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-21__subsec-12__para-c">
                <num>c</num>
                <content>
                  <p>in any other case—<quantity refersTo="#deadline">within 28 days</quantity> after the request was made.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-21__subsec-13">
              <num>13</num>
              <content>
                <p>Subsection (11) does not apply if:</p>
              </content>
              <paragraph eId="part-3__dvs-1__sec-21__subsec-13__para-a">
                <num>a</num>
                <content>
                  <p>the Chief Executive Medicare had given the notifiable person a notice within the period of 6 months prior to the request; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-21__subsec-13__para-b">
                <num>b</num>
                <content>
                  <p>a judgment has been made in respect of the claim for compensation.</p>
                </content>
              </paragraph>
            </subsection>
          </section>
          <section eId="part-3__dvs-1__sec-22">
            <num>22</num>
            <heading>Restriction on making settlements</heading>
            <subsection eId="part-3__dvs-1__sec-22__subsec-1">
              <num>1</num>
              <content>
                <p>The notifiable person must not make a settlement in respect of the claim for compensation unless:</p>
              </content>
              <paragraph eId="part-3__dvs-1__sec-22__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>the notifiable person has informed the compensable person that the compensable person may be liable to pay amounts under this Act or the Charges Act as a result of the settlement being made; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-22__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>the Chief Executive Medicare has, within the 6 months prior to the day on which an amount of compensation was fixed under the settlement, given to the notifiable person a notice under <ref href="#sec-21">section 21</ref> in respect of the claim.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-22__subsec-2">
              <num>2</num>
              <content>
                <p>For the purposes of this section, payment of an amount into a court is taken to constitute the making of a settlement.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-22__subsec-3">
              <num>3</num>
              <content>
                <p>Subsection (1) is taken not to have been complied with in relation to the payment of an amount into a court unless, at the time of the payment, the notifiable person lodges with the court a copy of the notice under <ref href="#sec-21">section 21</ref> in respect of the claim.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-3__dvs-1__sec-23">
            <num>23</num>
            <heading>Notice of judgment or settlement</heading>
            <subsection eId="part-3__dvs-1__sec-23__subsec-1">
              <num>1</num>
              <content>
                <p>The notifiable person must notify the Chief Executive Medicare in writing if a judgment or settlement has been made in respect of the claim.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-23__subsec-2">
              <num>2</num>
              <content>
                <p>The notice must be given <quantity refersTo="#deadline">within 28 days</quantity> after the judgment or settlement is made.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-23__subsec-3">
              <num>3</num>
              <content>
                <p>The notice given to the Chief Executive Medicare under subsection (1) must contain the following information:</p>
              </content>
              <paragraph eId="part-3__dvs-1__sec-23__subsec-3__para-a">
                <num>a</num>
                <content>
                  <p>the compensable person’s name, address and date of birth; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-23__subsec-3__para-b">
                <num>b</num>
                <content>
                  <p>the date on which the compensable person suffered the injury; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-23__subsec-3__para-c">
                <num>c</num>
                <content>
                  <p>the nature of the injury that the compensable person suffered; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-23__subsec-3__para-d">
                <num>d</num>
                <content>
                  <p>the names of all the parties to the settlement, or the names of all the parties to which the judgment relates, as the case requires; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-23__subsec-3__para-e">
                <num>e</num>
                <content>
                  <p>the date (if any) by which the compensation payer is required to pay an amount of compensation under the judgment or settlement; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-23__subsec-3__para-f">
                <num>f</num>
                <content>
                  <p>the amount of compensation to be paid under the judgment or settlement to the compensable person (but see subsection (3A)); and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-23__subsec-3__para-fa">
                <num>fa</num>
                <content>
                  <p>whether the compensation payer or insurer intends to make an advance payment in respect of the compensation; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-23__subsec-3__para-fb">
                <num>fb</num>
                <content>
                  <p>if the compensation payer or insurer intends to make an advance payment—whether the compensable person has been notified under <ref href="#sec-33A">section 33A</ref>; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-23__subsec-3__para-g">
                <num>g</num>
                <content>
                  <p>if the amount of compensation represents, in whole or in part, a redemption of the entitlements to compensation by periodic payments—the fact that it represents such a redemption; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-23__subsec-3__para-h">
                <num>h</num>
                <content>
                  <p>such other information as is prescribed by the regulations made for the purposes of this subsection.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-23__subsec-3A">
              <num>3A</num>
              <content>
                <p>If the amount of compensation payable to a claimant is fixed as provided for in paragraph 3(4)(c) then, when that amount is ascertained, the notifiable person must give to the Chief Executive Medicare a further notice in writing that:</p>
              </content>
              <paragraph eId="part-3__dvs-1__sec-23__subsec-3A__para-a">
                <num>a</num>
                <content>
                  <p>states that the amount has been ascertained; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-23__subsec-3A__para-b">
                <num>b</num>
                <content>
                  <p>states the amount of the compensation.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-23__subsec-3B">
              <num>3B</num>
              <content>
                <p>The notice under subsection (3A) must be given <quantity refersTo="#deadline">within 28 days</quantity> after the day that the amount of compensation is fixed.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-23__subsec-4">
              <num>4</num>
              <content>
                <p>If:</p>
              </content>
              <paragraph eId="part-3__dvs-1__sec-23__subsec-4__para-a">
                <num>a</num>
                <content>
                  <p>the judgment or settlement fixes the amount of compensation on the basis that liability for the injury should be apportioned between the compensable person and the compensation payer; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-23__subsec-4__para-b">
                <num>b</num>
                <content>
                  <p>as a result, the amount of compensation is less than it would have been if liability had not been so apportioned;</p>
                </content>
                <content>
                  <p>a notice given to the Chief Executive Medicare under subsection (1) or (3A) must also state by how much, expressed as a percentage, the amount of compensation has been reduced as a result of the apportionment.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-23__subsec-5">
              <num>5</num>
              <content>
                <p>	(5)	If the amount of compensation is fixed by a judgment that specifies an amount (the <b><i>past expenses component</i></b>), being a portion of the amount of compensation, to be a component for either or both of the following:</p>
              </content>
              <paragraph eId="part-3__dvs-1__sec-23__subsec-5__para-a">
                <num>a</num>
                <content>
                  <p>the medical expenses already incurred relating to the injury;</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-23__subsec-5__para-b">
                <num>b</num>
                <content>
                  <p>the expenses in respect of residential care or home care already incurred relating to the injury;</p>
                </content>
                <content>
                  <p>the notice given to the Chief Executive Medicare under subsection (1) or (3A) as the case may be, must state the past expenses component and (if applicable) the proportion of the past expenses component applicable to expenses of a kind referred to in paragraphs (a) and (b) respectively.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-23__subsec-5A">
              <num>5A</num>
              <content>
                <p>If:</p>
              </content>
              <paragraph eId="part-3__dvs-1__sec-23__subsec-5A__para-a">
                <num>a</num>
                <content>
                  <p>the judgment or settlement was made before the commencement of <ref href="#dvs-2A">Division 2A</ref>; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-23__subsec-5A__para-b">
                <num>b</num>
                <content>
                  <p>notice of the judgment or settlement had already been given under subsection (1) before that commencement;</p>
                </content>
                <content>
                  <p>the notifiable person may, <quantity refersTo="#deadline">within 28 days</quantity> after that commencement, give to the Chief Executive Medicare a further notice in writing that contains all of the information and other matters that a notice under subsection (1) is required to contain under this section (as in force after that commencement).</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-23__subsec-6">
              <num>6</num>
              <content>
                <p>A notice under subsection (1) or (3A) must be signed by the notifiable person.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-23__subsec-7">
              <num>7</num>
              <content>
                <p>This section does not apply if:</p>
              </content>
              <paragraph eId="part-3__dvs-1__sec-23__subsec-7__para-a">
                <num>a</num>
                <content>
                  <p>the amount of compensation represents, in whole or in part, a redemption of an entitlement to compensation by periodic payments; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-23__subsec-7__para-b">
                <num>b</num>
                <content>
                  <p>redemption of the compensable person’s entitlement to compensation in respect of future medical care needs, residential care needs or home care needs relating to the injury is prohibited by law; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-23__subsec-7__para-c">
                <num>c</num>
                <content>
                  <p>inclusion of any amount fixed by a judgment or settlement in respect of expenses for past medical care needs, residential care needs or home care needs relating to the injury is prohibited by law.</p>
                </content>
              </paragraph>
            </subsection>
          </section>
          <section eId="part-3__dvs-1__sec-23A">
            <num>23A</num>
            <heading>Statement after judgment or settlement—no relevant past benefits</heading>
            <subsection eId="part-3__dvs-1__sec-23A__subsec-1">
              <num>1</num>
              <content>
                <p>This section has effect if:</p>
              </content>
              <paragraph eId="part-3__dvs-1__sec-23A__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>an amount of compensation has been fixed under a judgment or settlement made in respect of the claim; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-23A__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>the Chief Executive Medicare has received a notice under subsection 23(1) or (3A) in relation to the amount of compensation fixed under the judgment or settlement; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-23A__subsec-1__para-c">
                <num>c</num>
                <content>
                  <p>the Chief Executive Medicare has not given the notifiable person a notice under <ref href="#sec-21">section 21</ref> in respect of the claim during the 6 month period ending when the amount of compensation was fixed under the judgment or settlement; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-23A__subsec-1__para-d">
                <num>d</num>
                <content>
                  <p>either:</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-23A__subsec-1__para-i">
                <num>i</num>
                <content>
                  <p>	(i)	the Chief Executive Medicare has not given the notifiable person a notice under <i> </i>in respect of services and care rendered or provided in the course of treatment of, or as a result of, the injury the claimant claims to have suffered; or<ref href="#sec-21">section 21</ref> in respect of the claim before the start of the 6 month period and, as at the date that the amount of compensation was fixed under the judgment or settlement, the Commonwealth has paid no eligible benefits</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-23A__subsec-1__para-ii">
                <num>ii</num>
                <content>
                  <p>	(ii)	the Chief Executive Medicare has given the notifiable person one or more such notices before the start of the 6 month period and, as at the date that the amount of compensation was fixed under the judgment or settlement, the Commonwealth has paid no eligible benefits<i> </i>of the kind mentioned in subparagraph (i), other than those set out in the most recent of those notices.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-23A__subsec-2">
              <num>2</num>
              <content>
                <p>	(2)	The claimant<i> </i>may give a statement under this section to the Chief Executive Medicare specifying that:</p>
              </content>
              <paragraph eId="part-3__dvs-1__sec-23A__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>	(a)	if subparagraph (1)(d)(i) applies—as at the day that the amount of compensation was fixed under the judgment or settlement, the Commonwealth has paid no eligible benefits<i> </i>in respect of services and care rendered or provided in the course of treatment of, or as a result of, the injury the claimant claims to have suffered; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-23A__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>	(b)	if subparagraph (1)(d)(ii) applies—as at the day that the amount of compensation was fixed under the judgment or settlement, the Commonwealth has paid no eligible benefits<i> </i>in respect of services and care rendered or provided in the course of treatment of, or as a result of, the injury the claimant claims to have suffered, other than those set out in the most recent of the notices mentioned in that subparagraph.</p>
                </content>

            <subsection eId="part-3__dvs-1__sec-23A__subsec-3">
              <num>3</num>
              <content>
                <p>The statement must also contain any other information specified in a determination in writing made by the Chief Executive Medicare for the purposes of this subsection.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-3__dvs-1__sec-23B">
            <num>23B</num>
            <heading>Notice of statement that is not substantially correct</heading>
            <subsection eId="part-3__dvs-1__sec-23B__subsec-1">
              <num>1</num>
              <content>
                <p>If the Chief Executive Medicare is satisfied that a statement given to the Chief Executive Medicare under <ref href="#sec-18">section 18</ref> or 23A or this section is not substantially correct, the Chief Executive Medicare must give to the claimant a written notice:</p>
              </content>
              <paragraph eId="part-3__dvs-1__sec-23B__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>specifying that the statement is not substantially correct; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-23B__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>requiring the claimant to give an amended statement that is substantially correct; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-23B__subsec-1__para-c">
                <num>c</num>
                <content>
                  <p>stating the period within which the claimant is required to give the amended statement to the Chief Executive Medicare.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-23B__subsec-2">
              <num>2</num>
              <content>
                <p>The notice must be given:</p>
              </content>
              <paragraph eId="part-3__dvs-1__sec-23B__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>unless paragraph (b) applies—<quantity refersTo="#deadline">within 28 days</quantity> after the statement under section 18 or 23A or this section was given to the Chief Executive Medicare; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-23B__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>if an advance payment has been made to the Commonwealth under <ref href="#sec-33B">section 33B</ref> in relation to a judgment or settlement in respect of the claim—before the last day on which the Chief Executive Medicare could give the compensable person a notice under <ref href="#sec-33C">section 33C</ref> in relation to the payment.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-23B__subsec-3">
              <num>3</num>
              <content>
                <p>The claimant must give to the Chief Executive Medicare the statement required by the notice within the period of 28 days after being given the notice.</p>
              </content>

              <num>4</num>
              <content>
                <p>In deciding whether a statement is substantially correct, the Chief Executive Medicare may have regard to:</p>
              </content>
              <paragraph eId="part-3__dvs-1__sec-23B__subsec-4__para-a">
                <num>a</num>
                <content>
                  <p>the date on which the compensable person suffered the injury; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-23B__subsec-4__para-b">
                <num>b</num>
                <content>
                  <p>the nature of the injury that the compensable person suffered; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-23B__subsec-4__para-c">
                <num>c</num>
                <content>
                  <p>the treatment of the injury; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-23B__subsec-4__para-d">
                <num>d</num>
                <content>
                  <p>statistical information about claims for eligible benefits in relation to injuries of substantially the same kind as the injury in respect of which the claim was made; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-23B__subsec-4__para-e">
                <num>e</num>
                <content>
                  <p>expert medical opinion about the treatment that is usual or may reasonably be expected in relation to injuries of that kind; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-23B__subsec-4__para-f">
                <num>f</num>
                <content>
                  <p>any other matter that the Chief Executive Medicare considers relevant.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-23B__subsec-5">
              <num>5</num>
              <content>
                <p>A reference in subsection (4) to the treatment of the injury includes a reference to the provision of residential care or home care as a result of the injury.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-23B__subsec-6">
              <num>6</num>
              <content>
                <p>Sections 18 and 19 apply to an amended statement under this section as if it were a statement under <ref href="#sec-18">section 18</ref>. Section 23A applies to an amended statement under this section as if it were a statement under <ref href="#sec-23A">section 23A</ref>.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-3__dvs-1__sec-23C">
            <num>23C</num>
            <heading>Notice of acceptance of amended statement</heading>
            <subsection eId="part-3__dvs-1__sec-23C__subsec-1">
              <num>1</num>
              <content>
                <p>If the Chief Executive Medicare accepts an amended statement under <ref href="#sec-23B">section 23B</ref> as being substantially correct, the Chief Executive Medicare must, as soon as practicable after accepting the statement, notify the claimant, in writing, accordingly.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-23C__subsec-2">
              <num>2</num>
              <content>
                <p>An amended statement given to the Chief Executive Medicare under <quantity refersTo="#deadline">within 28 days</quantity> after the Chief Executive Medicare is given the statement, a notice under subsection 23B(1) in relation to the statement is not given to the claimant.<ref href="#sec-23B">section 23B</ref> is taken to have been accepted by the Chief Executive Medicare as being substantially correct if, </p>
              </content>
            </subsection>
          </section>
          <section eId="part-3__dvs-1__sec-23D">
            <num>23D</num>
            <heading>Review of decision under section 23B by the Administrative Review Tribunal</heading>
            <subsection eId="part-3__dvs-1__sec-23D__subsec-1">
              <num>1</num>
              <content>
                <p>Application may be made to the Administrative Review Tribunal for review of a decision by the Chief Executive Medicare that a statement under <ref href="#sec-18">section 18</ref> or 23A, or an amended statement under <ref href="#sec-23B">section 23B</ref>, is not substantially correct.</p>
              </content>

          </section>
          <section eId="part-3__dvs-1__sec-24">
            <num>24</num>
            <heading>Notice of charge—claims resulting in judgments or settlements</heading>
            <subsection eId="part-3__dvs-1__sec-24__subsec-1">
              <num>1</num>
              <content>
                <p>Subject to subsection (1A), if the Chief Executive Medicare receives a notice under subsection 23(1), the Chief Executive Medicare must give to:</p>
              </content>
              <paragraph eId="part-3__dvs-1__sec-24__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>if the notifiable person in relation to the claim for compensation from which the judgment or settlement resulted is an insurer—that insurer; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-24__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>otherwise—the compensation payer;</p>
                </content>
                <content>
                  <p>written notice specifying the sum of the amounts (if any) that are payable to the Commonwealth under this Act or the Charges Act in respect of the amount of compensation.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-24__subsec-1A">
              <num>1A</num>
              <content>
                <p>A notice under subsection (1) is not required if the compensation payer or insurer makes an advance payment in respect of the compensation.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-24__subsec-2">
              <num>2</num>
              <content>
                <p>The notice must also specify, in relation to each kind of eligible benefit that the Commonwealth has paid in respect of any service or care rendered or provided in the course of treatment of, or as a result of, the claimant’s injury, the sum of the amounts (if any) that will be payable to the Commonwealth under this Act or the Charges Act.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-24__subsec-3">
              <num>3</num>
              <content>
                <p>The notice must not, in relation to any period covered by a notice under <ref href="#sec-21">section 21</ref> in respect of the claim, take account of any eligible benefits that were paid in respect of services or care not specified in the notice under <ref href="#sec-21">section 21</ref>.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-24__subsec-4">
              <num>4</num>
              <content>
                <p>The Chief Executive Medicare must give the notice to the notifiable person:</p>
              </content>
              <paragraph eId="part-3__dvs-1__sec-24__subsec-4__para-a">
                <num>a</num>
                <content>
                  <p>if the Chief Executive Medicare had not given a notice under <quantity refersTo="#deadline">within 3 months</quantity> after the Chief Executive Medicare receives the notice under subsection 23(1); or<ref href="#sec-21">section 21</ref>, in respect of the claim for compensation, during the 6 months preceding the day on which the amount of compensation was fixed under the judgment or settlement—</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-24__subsec-4__para-b">
                <num>b</num>
                <content>
                  <p>otherwise—<quantity refersTo="#deadline">within 28 days</quantity> after the Chief Executive Medicare receives the notice under subsection 23(1).</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-24__subsec-5">
              <num>5</num>
              <content>
                <p>The Chief Executive Medicare must give a copy of the notice to the compensable person.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-24__subsec-6">
              <num>6</num>
              <content>
                <p>A notice under <ref href="#sec-21">section 21</ref> is taken also to be a notice under this section given by the Chief Executive Medicare to the insurer or compensation payer (as the case requires) on the day on which the amount of compensation is fixed under the judgment or settlement if:</p>
              </content>
              <paragraph eId="part-3__dvs-1__sec-24__subsec-6__para-a">
                <num>a</num>
                <content>
                  <p>the notice under <ref href="#sec-21">section 21</ref> includes statements of the kinds referred to in subsections 21(5), (6) and (7); and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-24__subsec-6__para-b">
                <num>b</num>
                <content>
                  <p>the amount of compensation is fixed under the judgment or settlement <quantity refersTo="#deadline">within 6 months</quantity> after the notice was given.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-24__subsec-7">
              <num>7</num>
              <content>
                <p>Subject to subsections (8) and (9), if subsection (6) applies to a notice, the amount specified in the notice pursuant to paragraph 21(2)(b) is taken to be the amount set out for the purpose of subsection (2) of this section.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-24__subsec-8">
              <num>8</num>
              <content>
                <p>Despite subsection (7), if:</p>
              </content>
              <paragraph eId="part-3__dvs-1__sec-24__subsec-8__para-a">
                <num>a</num>
                <content>
                  <p>subsection (6) applies to a notice; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-24__subsec-8__para-b">
                <num>b</num>
                <content>
                  <p>the judgment or settlement fixes the amount of compensation on the basis that liability for the injury should be apportioned between the compensable person and the compensation payer; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-24__subsec-8__para-c">
                <num>c</num>
                <content>
                  <p>as a result, the amount of compensation is less than it would have been if liability had not been so apportioned; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-24__subsec-8__para-d">
                <num>d</num>
                <content>
                  <p>subsection (9) does not apply;</p>
                </content>
                <content>
                  <p>the amount specified in the notice pursuant to paragraph 21(2)(b), reduced by the proportion corresponding to the proportion of liability for the injury that is apportioned to the compensable person by the judgment or settlement, is taken to be the amount set out for the purpose of subsection (2).</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-24__subsec-9">
              <num>9</num>
              <content>
                <p>Despite subsection (7), if:</p>
              </content>
              <paragraph eId="part-3__dvs-1__sec-24__subsec-9__para-a">
                <num>a</num>
                <content>
                  <p>subsection (6) applies to a notice; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-24__subsec-9__para-b">
                <num>b</num>
                <content>
                  <p>	(b)	the amount of compensation is fixed by a judgment that specifies an amount (the <b><i>past expenses component</i></b>), being a portion of the amount of compensation, to be a component for either or both of the following:</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-24__subsec-9__para-i">
                <num>i</num>
                <content>
                  <p>the medical expenses already incurred relating to the injury;</p>

          </section>
          <section eId="part-3__dvs-1__sec-25">
            <num>25</num>
            <heading>Notice of charge—claims resulting in reimbursement arrangements</heading>
            <subsection eId="part-3__dvs-1__sec-25__subsec-1">
              <num>1</num>
              <content>
                <p>If the Chief Executive Medicare receives a notice under <ref href="#sec-13">section 13</ref>, the Chief Executive Medicare may give to:</p>
              </content>
              <paragraph eId="part-3__dvs-1__sec-25__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>if the notifiable person in relation to the claim for compensation from which the reimbursement arrangement referred to in <ref href="#sec-13">section 13</ref> resulted is an insurer—that insurer; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-25__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>otherwise—the compensation payer;</p>
                </content>
                <content>
                  <p>written notice specifying the sum of the amounts (if any) that are payable to the Commonwealth under this Act or the Charges Act in respect of the amount of compensation.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-25__subsec-2">
              <num>2</num>
              <content>
                <p>The notice must also specify, in relation to each kind of eligible benefit that the Commonwealth has paid in respect of any service or care rendered or provided in the course of treatment of, or as a result of, the claimant’s injury, the sum of the amounts (if any) that will be payable to the Commonwealth under this Act or the Charges Act.</p>
              </content>
            </subsection>

                <p>The notice must not, in relation to any period covered by a notice under <ref href="#sec-21">section 21</ref> in respect of the claim, take account of any eligible benefits that were paid in respect of services or care not specified in the notice under <ref href="#sec-21">section 21</ref>.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-25__subsec-4">
              <num>4</num>
              <content>
                <p>Subject to subsection (5), the Chief Executive Medicare must give any such notice to the notifiable person <quantity refersTo="#deadline">within 3 months</quantity> after the Chief Executive Medicare receives the notice under section 13.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-25__subsec-5">
              <num>5</num>
              <content>
                <p>If, under subsection 18(3) or 19(3), the claimant has been granted an extension of the period for making a statement under <ref href="#sec-18">section 18</ref> in relation to the claim for compensation, the Chief Executive Medicare must give any such notice to the notifiable person:</p>
              </content>
              <paragraph eId="part-3__dvs-1__sec-25__subsec-5__para-a">
                <num>a</num>
                <content>
                  <p><quantity refersTo="#deadline">within 3 months</quantity> after the Chief Executive Medicare receives the notice under section 13; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-25__subsec-5__para-b">
                <num>b</num>
                <content>
                  <p><quantity refersTo="#deadline">within 60 days</quantity> after the claimant has given a statement to the Chief Executive Medicare under section 18;</p>
                </content>
                <content>
                  <p>whichever period ends later.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-25__subsec-6">
              <num>6</num>
              <content>
                <p>The Chief Executive Medicare must give a copy of the notice to the compensable person.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-25__subsec-7">
              <num>7</num>
              <content>
                <p>A notice under <ref href="#sec-21">section 21</ref> is taken also to be a notice under this section given by the Chief Executive Medicare to the insurer or compensation payer (as the case requires), on a day worked out in accordance with subsection (8), if:</p>
              </content>
              <paragraph eId="part-3__dvs-1__sec-25__subsec-7__para-a">
                <num>a</num>
                <content>
                  <p>the notice under <ref href="#sec-21">section 21</ref> includes a statement of a kind referred to in subsection 21(8); and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-25__subsec-7__para-b">
                <num>b</num>
                <content>
                  <p>a reimbursement arrangement has been made in relation to the claim.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-25__subsec-8">
              <num>8</num>
              <content>
                <p>If subsection (7) applies, the notice is taken to have been given by the Chief Executive Medicare on:</p>
              </content>
              <paragraph eId="part-3__dvs-1__sec-25__subsec-8__para-a">
                <num>a</num>
                <content>
                  <p>if the reimbursement arrangement was made before the Chief Executive Medicare gives the notice to the notifiable person—the day on which the Chief Executive Medicare gives the notice to the notifiable person; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-25__subsec-8__para-b">
                <num>b</num>
                <content>
                  <p>in any other case—the day on which the reimbursement arrangement is made.</p>
                </content>
              </paragraph>
            </subsection>
          </section>
          <section eId="part-3__dvs-1__sec-26">
            <num>26</num>
            <heading>Offences</heading>
            <subsection eId="part-3__dvs-1__sec-26__subsec-1">
              <num>1</num>
              <content>
                <p>A person must not refuse or fail to comply with a requirement of <ref href="#sec-13">section 13</ref> or 23 that the person give a notice to the Chief Executive Medicare under that section.</p>
              </content>

                  <p>Penalty:	<quantity refersTo="#custodialSentence">Imprisonment for 6 months</quantity>.</p>

              </hcontainer>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-26__subsec-1A">

                <p>Subsection (1) does not apply if the person has a reasonable excuse.</p>

                <p>An offence under subsection (1) is an offence of strict liability.</p>

                <p>For the purposes of subsection (1A), a person is not taken to have reasonable excuse for refusing or failing to comply with a requirement of <ref href="#sec-13">section 13</ref> or 23 to give a notice to the Chief Executive Medicare only because:</p>
              </content>
              <paragraph eId="part-3__dvs-1__sec-26__subsec-3__para-a">
                <num>a</num>
                <content>
                  <p>the information required to be contained in the notice is, or could be, subject to a claim of privilege that would prevent the information being given in evidence in proceedings before a court or tribunal; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-26__subsec-3__para-b">
                <num>b</num>
                <content>
                  <p>the person is under a contractual obligation that prevents the person giving the information required to be contained in the notice; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-26__subsec-3__para-c">
                <num>c</num>
                <content>
                  <p>an order of a court or tribunal prevents the person giving the information required to be contained in the notice; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-26__subsec-3__para-d">
                <num>d</num>
                <content>
                  <p>an Australian law prevents the person giving the information required to be contained in the notice.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-26__subsec-4">
              <num>4</num>
              <content>
                <p>Without limiting subsection (3), a person is not excused from giving a notice under <ref href="#sec-13">section 13</ref> or 23 on the ground that the information required to be contained in the notice may tend to incriminate the person.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-26__subsec-5">
              <num>5</num>
              <content>
                <p>In any criminal proceeding:</p>
              </content>
              <paragraph eId="part-3__dvs-1__sec-26__subsec-5__para-a">
                <num>a</num>
                <content>
                  <p>evidence of any information given under <ref href="#sec-13">section 13</ref> or 23; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-26__subsec-5__para-b">
                <num>b</num>
                <content>
                  <p>evidence of any information, document or thing obtained as a direct or indirect result of the person having given the information;</p>
                </content>
                <content>
                  <p>cannot be used against the person. However, this subsection does not apply to a proceeding for an offence against subsection (1) of this section, or an offence against <i>Criminal Code</i> that relates to whichever of the sections mentioned in paragraph (a) of this subsection is relevant.<ref href="#sec-137">section 137</ref>.1 of the </p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-26__subsec-6">
              <num>6</num>
              <content>
                <p>If:</p>
              </content>
              <paragraph eId="part-3__dvs-1__sec-26__subsec-6__para-a">
                <num>a</num>
                <content>
                  <p>a person gives a notice to the Chief Executive Medicare under <ref href="#sec-13">section 13</ref> or 23; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-26__subsec-6__para-b">
                <num>b</num>
                <content>
                  <p>in so doing, the person would, apart from this section, contravene an Australian law;</p>
                </content>
                <content>
                  <p>the person is taken not to have contravened that law by giving the notice.</p>
                </content>
              </paragraph>
            </subsection>
          </section>
        </division>
        <division eId="part-3__dvs-2">
          <num>2</num>
          <heading>Payments to the Commonwealth in respect of amounts of compensation</heading>

              <p>Note:	The obligations under this Division will not apply in circumstances covered by <ref href="#dvs-3">Division 3</ref>.</p>

          </authorialNote>

            <num>27</num>
            <heading>Limit on total amount payable in respect of amounts of compensation</heading>
            <subsection eId="part-3__dvs-2__sec-27__subsec-1">
              <num>1</num>
              <content>
                <p>Despite any other provision of this Act, and despite the Charges Act, if the sum of all the amounts that are payable under this Act or the Charges Act in respect of the amount of compensation fixed by a judgment or settlement would, apart from this section, exceed the difference between:</p>
              </content>
              <paragraph eId="part-3__dvs-2__sec-27__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>the amount of compensation fixed by the judgment or settlement; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-2__sec-27__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>	(b)	the sum of the amounts (if any) payable under <i>Social Security Act 1991 </i>in respect of the amount of compensation;<ref href="#part-3">Part 3</ref>.14 of the </p>
                </content>
                <content>
                  <p>the sum of all the amounts that are payable under this Act or the Charges Act in respect of the amount of compensation is taken, for all purposes, to be the amount of the difference.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-2__sec-27__subsec-2">
              <num>2</num>
              <content>
                <p>For the avoidance of doubt, if there are no amounts of a kind referred to in paragraph (1)(b) payable in respect of the amount of compensation, the amount of the difference referred to in subsection (1) is taken to be the amount of compensation.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-3__dvs-2__sec-28">
            <num>28</num>
            <heading>Payments to the Commonwealth</heading>
            <subsection eId="part-3__dvs-2__sec-28__subsec-1">
              <num>1</num>
              <content>
                <p>If the Chief Executive Medicare gives to a compensation payer a notice under <quantity refersTo="#deadline">within 28 days</quantity> after the day on which the notice was given.<ref href="#sec-24">section 24</ref> or 25, the compensation payer must pay to the Commonwealth the amount specified in the notice </p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-2__sec-28__subsec-2">
              <num>2</num>
              <content>
                <p>If the Chief Executive Medicare gives to an insurer a notice under <quantity refersTo="#deadline">within 28 days</quantity> after the day on which the notice was given.<ref href="#sec-24">section 24</ref> or 25, the insurer must pay to the Commonwealth the amount specified in the notice </p>
              </content>

                  <p>Note:	Under subsection 4D(1) of the <i>Crimes Act 1914</i>, these penalties are only maximum penalties for the offences. Subsection 4B(2) of that Act allows a court to impose an appropriate fine instead of, or in addition to, a term of imprisonment. If a body corporate is convicted of one of these offences, subsection 4B(3) of that Act allows a court to impose a fine of an amount not greater than 5 times the maximum fine that the court could impose on an individual convicted of the same offence.</p>

          </section>
          <section eId="part-3__dvs-2__sec-29">
            <num>29</num>
            <heading>Recovery of amounts payable to the Commonwealth</heading>
            <subsection eId="part-3__dvs-2__sec-29__subsec-1">
              <num>1</num>
              <content>
                <p>An amount that is payable to the Commonwealth under this Act or the Charges Act in respect of an amount of compensation is recoverable as a debt due to the Commonwealth.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-2__sec-29__subsec-2">
              <num>2</num>
              <content>
                <p>If:</p>
              </content>
              <paragraph eId="part-3__dvs-2__sec-29__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>the amount is included in the amount specified in a notice under <ref href="#sec-24">section 24</ref> or 25; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-2__sec-29__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>the compensation payer or insurer to whom the notice was given fails to comply with <ref href="#sec-28">section 28</ref> in relation to the notice;</p>
                </content>
                <content>
                  <p>the amount so included is recoverable from the compensation payer or insurer to whom the notice was given.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-2__sec-29__subsec-3">
              <num>3</num>
              <content>
                <p>If the amount is payable in respect of an amount of compensation fixed by a judgment or settlement in relation to which there has been a failure to comply with <ref href="#sec-23">section 23</ref>, the amount is recoverable from the compensation payer or insurer who failed so to comply.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-2__sec-29__subsec-4">
              <num>4</num>
              <content>
                <p>If the amount is payable in respect of an amount of compensation payable under a reimbursement arrangement in relation to which there has been a failure to comply with <ref href="#sec-13">section 13</ref>, the amount is recoverable from the person who failed to comply with that section.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-2__sec-29__subsec-5">
              <num>5</num>
              <content>
                <p>A person’s liability to pay to the Commonwealth under subsection (3) or (4) amounts owing to the Commonwealth in respect of an amount of compensation is not affected by any payment of compensation by the person in relation to the claim for compensation.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-2__sec-29__subsec-6">
              <num>6</num>
              <content>
                <p>If the amount is payable in respect of an amount of compensation fixed by a settlement in relation to which there has been a failure to comply with <ref href="#sec-22">section 22</ref>, the amount is recoverable from the notifiable person in relation to the claim for compensation.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-2__sec-29__subsec-7">
              <num>7</num>
              <content>
                <p>A person’s liability to pay to the Commonwealth under subsection (6) amounts owing to the Commonwealth in respect of an amount of compensation:</p>
              </content>
              <paragraph eId="part-3__dvs-2__sec-29__subsec-7__para-a">
                <num>a</num>
                <content>
                  <p>is not affected by any payment of compensation by the person in relation to the claim for compensation; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-2__sec-29__subsec-7__para-b">
                <num>b</num>
                <content>
                  <p>does not affect the amount of compensation that the person is liable to pay; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-2__sec-29__subsec-7__para-c">
                <num>c</num>
                <content>
                  <p>does not give rise to any right of recovery in respect of any payments of the compensation that the person has made.</p>
                </content>
              </paragraph>
            </subsection>
          </section>
          <section eId="part-3__dvs-2__sec-30">
            <num>30</num>
            <heading>Notice of charge suspends liability to pay compensation etc.</heading>
            <subsection eId="part-3__dvs-2__sec-30__subsec-1">
              <num>1</num>
              <content>
                <p>If an amount is recoverable under <ref href="#sec-28">section 28</ref> from a compensation payer in respect of an amount of compensation, the compensation payer is not liable to pay to the compensable person any amount of the compensation until the amount is paid to the Commonwealth, or until the end of the 28 day period for complying with <ref href="#sec-28">section 28</ref>, whichever happens first.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-2__sec-30__subsec-2">
              <num>2</num>
              <content>
                <p>If an amount is recoverable under <ref href="#sec-28">section 28</ref> from an insurer in respect of an amount of compensation:</p>
              </content>
              <paragraph eId="part-3__dvs-2__sec-30__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>the insurer is not liable to indemnify the compensation payer in respect of the compensation payer’s liability to pay to the compensable person any amount of the compensation; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-2__sec-30__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>the compensation payer is not liable to pay to the compensable person any amount of the compensation;</p>
                </content>
                <content>
                  <p>until the amount is paid to the Commonwealth, or until the end of the 28 day period for complying with <ref href="#sec-28">section 28</ref>, whichever happens first.</p>
                </content>
              </paragraph>
            </subsection>
          </section>
          <section eId="part-3__dvs-2__sec-31">
            <num>31</num>
            <heading>Payment to the Commonwealth discharges liability</heading>
            <subsection eId="part-3__dvs-2__sec-31__subsec-1">
              <num>1</num>
              <content>
                <p>Payment of an amount that a compensation payer is liable to pay to the Commonwealth under <ref href="#sec-28">section 28</ref> or subsection 29(3) or (4) operates, to the extent of the payment, as a discharge of:</p>
              </content>
              <paragraph eId="part-3__dvs-2__sec-31__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>the compensation payer’s liability to the compensable person in respect of the amount of compensation; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-2__sec-31__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>the compensable person’s liability to pay to the Commonwealth amounts payable under this Act or the Charges Act in respect of the amount of compensation.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-2__sec-31__subsec-2">
              <num>2</num>
              <content>
                <p>Payment of the amount that an insurer is liable to pay to the Commonwealth under <ref href="#sec-28">section 28</ref> or subsection 29(3) or (4) operates, to the extent of the payment, as a discharge of:</p>
              </content>
              <paragraph eId="part-3__dvs-2__sec-31__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>the insurer’s liability to indemnify the compensation payer in respect of the compensation payer’s liability to the compensable person in respect of the amount of compensation; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-2__sec-31__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>the compensation payer’s liability to the compensable person in respect of the amount of compensation; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-2__sec-31__subsec-2__para-c">
                <num>c</num>
                <content>
                  <p>the compensable person’s liability under this Act or the Charges Act to pay to the Commonwealth amounts payable under this Act in respect of the amount of compensation.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-2__sec-31__subsec-3">
              <num>3</num>
              <content>
                <p>A reference in this section to payment of an amount is a reference to payment by any person, other than the compensable person or a person acting on the compensable person’s behalf.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-3__dvs-2__sec-32">
            <num>32</num>
            <heading>Offence to make payment before discharging liability to the Commonwealth</heading>
            <subsection eId="part-3__dvs-2__sec-32__subsec-1">
              <num>1</num>
              <content>
                <p>If a judgment or settlement has been made in respect of an amount of compensation, a compensation payer or insurer must not pay to the compensable person any part of the compensation before the Chief Executive Medicare has issued a notice under <ref href="#sec-24">section 24</ref> unless:</p>
              </content>
              <paragraph eId="part-3__dvs-2__sec-32__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>the time within which the Chief Executive Medicare must issue such a notice has expired; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-2__sec-32__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>if the Chief Executive Medicare had given a notice under <ref href="#sec-21">section 21</ref>, in respect of the claim for compensation, during the 6 months preceding the day on which an amount of compensation was fixed under the judgment or settlement—the insurer or compensation payer withholds from the compensable person an amount of compensation equal to the amount set out in the notice under paragraph 21(2)(b).</p>

            </subsection>

              <content>
                <p>Subsection (1) does not apply if the compensation payer or insurer makes an advance payment in respect of the compensation.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-2__sec-32__subsec-2">
              <num>2</num>
              <content>
                <p>If a compensation payer is liable under <ref href="#sec-28">section 28</ref> to pay an amount to the Commonwealth in respect of an amount of compensation, the compensation payer must not pay to the compensable person any part of the compensation unless:</p>
              </content>
              <paragraph eId="part-3__dvs-2__sec-32__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>the Commonwealth has been paid the amount specified in the notice referred to in that section (whether or not it is paid by the compensation payer); or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-2__sec-32__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>the 28 day period for complying with that section has expired, and a part of the amount of compensation equal to the amount specified in the notice has been withheld from the compensable person.</p>
                </content>

                    <p>Penalty:	<quantity refersTo="#custodialSentence">Imprisonment for 12 months</quantity>.</p>

                </hcontainer>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-2__sec-32__subsec-3">
              <num>3</num>
              <content>
                <p>If the compensation payer is a member of a body that is a representative organisation in relation to the claim for compensation that gave rise to the amount of compensation becoming payable:</p>
              </content>
              <paragraph eId="part-3__dvs-2__sec-32__subsec-3__para-a">
                <num>a</num>
                <content>
                  <p>the representative organisation; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-2__sec-32__subsec-3__para-b">
                <num>b</num>
                <content>
                  <p>any insurers of the representative organisation;</p>
                </content>
                <content>
                  <p>are subject to the same obligations under subsections (1) and (2) as the compensation payer.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-2__sec-32__subsec-4">
              <num>4</num>
              <content>
                <p>If an insurer is liable under <ref href="#sec-28">section 28</ref> to pay an amount to the Commonwealth in respect of an amount of compensation, the insurer must not pay to the compensable person any part of the compensation unless:</p>
              </content>
              <paragraph eId="part-3__dvs-2__sec-32__subsec-4__para-a">
                <num>a</num>
                <content>
                  <p>the Commonwealth has been paid the amount specified in the notice referred to in that section (whether or not it is paid by the insurer); or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-2__sec-32__subsec-4__para-b">
                <num>b</num>
                <content>
                  <p>the 28 day period for complying with that section has expired, and a part of the amount of compensation equal to the amount specified in the notice has been withheld from the compensable person.</p>
                </content>

                <p>A compensation payer’s or insurer’s liability to pay to the Commonwealth amounts owing to the Commonwealth in respect of the amount of compensation is not affected by:</p>
              </content>
              <paragraph eId="part-3__dvs-2__sec-32__subsec-5__para-a">
                <num>a</num>
                <content>
                  <p>payment of an amount of compensation prior to the making of a judgment, settlement or reimbursement arrangement in respect of the claim for compensation; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-2__sec-32__subsec-5__para-b">
                <num>b</num>
                <content>
                  <p>payment of an amount of compensation in contravention of this section.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-2__sec-32__subsec-6">
              <num>6</num>
              <content>
                <p>If a compensable person receives from a compensation payer or insurer a payment of an amount of compensation in contravention of this section, the compensation payer or insurer is not entitled to recover the amount from the compensable person.</p>

            </subsection>
          </section>
          <section eId="part-3__dvs-2__sec-33">
            <num>33</num>
            <heading>Interest not payable on amount withheld</heading>
            <content>
              <p>If:</p>
            </content>
            <paragraph eId="part-3__dvs-2__sec-33__para-a">
              <num>a</num>
              <content>
                <p>a judgment or settlement has been made in respect of an amount of compensation; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__dvs-2__sec-33__para-b">
              <num>b</num>
              <content>
                <p>a compensation payer or insurer has paid to the compensable person a part of the compensation, but withheld an amount referred to in paragraph 32(1)(b); and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__dvs-2__sec-33__para-c">
              <num>c</num>
              <content>
                <p>an Australian law would, apart from this section, make the compensation payer or insurer liable to pay interest on the sum withheld, because the sum is withheld after the judgment or settlement has been made;</p>
              </content>
              <content>
                <p>despite that law, the compensation payer or insurer is not liable to pay that interest.</p>
              </content>
            </paragraph>
          </section>
        </division>
        <division eId="part-3__dvs-2A">
          <num>2A</num>
          <heading>Advance payments to the Commonwealth</heading>
          <section eId="part-3__dvs-2A__sec-33A">
            <num>33A</num>
            <heading>Notice of advance payment</heading>
            <subsection eId="part-3__dvs-2A__sec-33A__subsec-1">
              <num>1</num>
              <content>
                <p>If a compensation payer or insurer intends to make an advance payment in respect of the compensation payable under a judgment or settlement, the compensation payer or insurer must notify the compensable person in writing.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-2A__sec-33A__subsec-2">
              <num>2</num>
              <content>
                <p>The notice must state:</p>
              </content>
              <paragraph eId="part-3__dvs-2A__sec-33A__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>that the compensation payer or insurer intends to make the advance payment; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-2A__sec-33A__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>the amount of the advance payment; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-2A__sec-33A__subsec-2__para-c">
                <num>c</num>
                <content>
                  <p>the circumstances in which the Commonwealth can retain some or all of the advance payment; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-2A__sec-33A__subsec-2__para-d">
                <num>d</num>
                <content>
                  <p>the circumstances in which the compensable person will be required to make an additional payment to the Commonwealth in respect of eligible benefits.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-2A__sec-33A__subsec-3">
              <num>3</num>
              <content>
                <p>The notice must be given to the compensable person:</p>
              </content>
              <paragraph eId="part-3__dvs-2A__sec-33A__subsec-3__para-a">
                <num>a</num>
                <content>
                  <p>if the judgment or settlement was made after the commencement of this Division—before the judgment or settlement was made; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-2A__sec-33A__subsec-3__para-b">
                <num>b</num>
                <content>
                  <p>if the judgment or settlement was made before that commencement—before the advance payment in question is made and, in any case, <quantity refersTo="#deadline">within 28 days</quantity> after that commencement.</p>
                </content>
              </paragraph>
            </subsection>
          </section>
          <section eId="part-3__dvs-2A__sec-33B">
            <num>33B</num>
            <heading>Advance payments</heading>
            <subsection eId="part-3__dvs-2A__sec-33B__subsec-1">
              <num>1</num>
              <content>
                <p>A compensation payer or insurer may make an advance payment to the Commonwealth in respect of the compensation payable under a judgment or settlement if:</p>
              </content>
              <paragraph eId="part-3__dvs-2A__sec-33B__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>during the 6 months preceding the day on which an amount of compensation was fixed under the judgment or settlement, a notice under <ref href="#sec-21">section 21</ref> had not been given; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-2A__sec-33B__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>a notice under <ref href="#sec-23">section 23</ref> has been given indicating that the compensation payer or insurer intends to make an advance payment; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-2A__sec-33B__subsec-1__para-c">
                <num>c</num>
                <content>
                  <p>a notice under <ref href="#sec-33A">section 33A</ref> has been given; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-2A__sec-33B__subsec-1__para-d">
                <num>d</num>
                <content>
                  <p>the amount of the compensation payable under the judgment or settlement is not a small amount.</p>
                </content>

            </subsection>

                <p>The advance payment must be an amount equal to 10%, or such other percentage as <role refersTo="#minister">the Minister</role> determines under subsection (4), of the amount of compensation payable under the judgment or settlement.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-2A__sec-33B__subsec-2A">
              <num>2A</num>
              <content>
                <p>A determination under subsection (4) may:</p>
              </content>
              <paragraph eId="part-3__dvs-2A__sec-33B__subsec-2A__para-a">
                <num>a</num>
                <content>
                  <p>identify different amounts, or ranges of amounts, of compensation payable; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-2A__sec-33B__subsec-2A__para-b">
                <num>b</num>
                <content>
                  <p>set different percentages for any one or more of those amounts, or ranges of amounts.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-2A__sec-33B__subsec-3">
              <num>3</num>
              <content>
                <p>The advance payment must be made:</p>
              </content>
              <paragraph eId="part-3__dvs-2A__sec-33B__subsec-3__para-a">
                <num>a</num>
                <content>
                  <p>if the judgment or settlement was made after the commencement of this Division—<quantity refersTo="#deadline">within 28 days</quantity> after the judgment or settlement was made; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-2A__sec-33B__subsec-3__para-b">
                <num>b</num>
                <content>
                  <p>if the judgment or settlement was made before that commencement—<quantity refersTo="#deadline">within 28 days</quantity> after that commencement.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-2A__sec-33B__subsec-4">
              <num>4</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> may, by legislative instrument, make a determination for the purposes of subsection (2).</p>
              </content>
            </subsection>
          </section>
          <section eId="part-3__dvs-2A__sec-33C">
            <num>33C</num>
            <heading>Notice of past benefits</heading>
            <subsection eId="part-3__dvs-2A__sec-33C__subsec-1">
              <num>1</num>
              <content>
                <p>If a compensation payer or insurer makes an advance payment, the Chief Executive Medicare must give to the compensable person a written notice setting out the total amount of eligible benefits paid by the Commonwealth in respect of services and care rendered or provided in the course of treatment of, or as a result of, the compensable person’s injury.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-2A__sec-33C__subsec-2">
              <num>2</num>
              <content>
                <p>The notice must not, in relation to the period covered by a statement given under <ref href="#sec-18">section 18</ref>, take account of any eligible benefits that were paid in respect of services or care not specified in:</p>
              </content>
              <paragraph eId="part-3__dvs-2A__sec-33C__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>that statement; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-2A__sec-33C__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>that statement as amended under <ref href="#sec-23B">section 23B</ref>.</p>
                </content>
              </paragraph>
            </subsection>
          </section>
          <section eId="part-3__dvs-2A__sec-33D">
            <num>33D</num>
            <heading>Time within which notice of past benefits must be given</heading>
            <subsection eId="part-3__dvs-2A__sec-33D__subsec-1">
              <num>1</num>
              <content>
                <p>Subject to subsections (2) and (3), the notice under <quantity refersTo="#deadline">within 3 months</quantity> after:<ref href="#sec-33C">section 33C</ref> must be given </p>
              </content>
              <paragraph eId="part-3__dvs-2A__sec-33D__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>the Chief Executive Medicare receives notice under <ref href="#sec-23">section 23</ref> indicating that the compensation payer or insurer intends to make an advance payment; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-2A__sec-33D__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>the advance payment is made;</p>
                </content>
                <content>
                  <p>whichever is the later.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-2A__sec-33D__subsec-2">
              <num>2</num>
              <content>
                <p>If the Chief Executive Medicare gives a notice under subsection 23B(1) to the compensable person, the notice under <ref href="#sec-33C">section 33C</ref> need not be given until:</p>
              </content>
              <paragraph eId="part-3__dvs-2A__sec-33D__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>the end of the 3 month period referred to in subsection (1); or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-2A__sec-33D__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>the end of the period of 28 days after the Chief Executive Medicare accepts an amended statement under <ref href="#sec-23B">section 23B</ref> as being substantially correct;</p>
                </content>
                <content>
                  <p>whichever is the later.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-2A__sec-33D__subsec-3">
              <num>3</num>
              <content>
                <p>If:</p>
              </content>
              <paragraph eId="part-3__dvs-2A__sec-33D__subsec-3__para-a">
                <num>a</num>
                <content>
                  <p>the Chief Executive Medicare has not given a notice under subsection 23B(1) to the compensable person; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-2A__sec-33D__subsec-3__para-b">
                <num>b</num>
                <content>
                  <p>the period for giving a statement under <ref href="#sec-18">section 18</ref> has been extended under subsection 18(3); and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-2A__sec-33D__subsec-3__para-c">
                <num>c</num>
                <content>
                  <p>the date of expiry of the period of the extension is after the end of the 3 month period referred to in subsection (1);</p>
                </content>
                <content>
                  <p>the notice under <quantity refersTo="#deadline">within 28 days</quantity> after that date of expiry.<ref href="#sec-33C">section 33C</ref> must be given </p>
                </content>
              </paragraph>
            </subsection>
          </section>
          <section eId="part-3__dvs-2A__sec-33H">
            <num>33H</num>
            <heading>Refunds from advance payments</heading>
            <subsection eId="part-3__dvs-2A__sec-33H__subsec-1">
              <num>1</num>
              <content>
                <p>If the amount specified in the notice under <ref href="#sec-33C">section 33C</ref> is less than the amount of the advance payment, the difference is payable by the Commonwealth to the compensable person.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-2A__sec-33H__subsec-2">
              <num>2</num>
              <content>
                <p>The difference is payable on the last day on which the Chief Executive Medicare is required under <ref href="#sec-33D">section 33D</ref> to give the notice to the compensable person.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-2A__sec-33H__subsec-3">
              <num>3</num>
              <content>
                <p>An amount payable under this section is recoverable as a debt due to the compensable person.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-3__dvs-2A__sec-33J">
            <num>33J</num>
            <heading>Additional payments to the Commonwealth</heading>
            <subsection eId="part-3__dvs-2A__sec-33J__subsec-1">
              <num>1</num>
              <content>
                <p>If the amount specified in the notice under <ref href="#sec-33C">section 33C</ref> is greater than the amount of the advance payment, the difference is payable by the compensable person to the Commonwealth.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-2A__sec-33J__subsec-2">
              <num>2</num>
              <content>
                <p>The difference is payable 28 days after the day on which the notice was given to the compensable person.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-2A__sec-33J__subsec-3">
              <num>3</num>
              <content>
                <p>The notice must specify:</p>
              </content>
              <paragraph eId="part-3__dvs-2A__sec-33J__subsec-3__para-a">
                <num>a</num>
                <content>
                  <p>the amount that is payable to the Commonwealth; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-2A__sec-33J__subsec-3__para-b">
                <num>b</num>
                <content>
                  <p>the day by which it must be paid.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-2A__sec-33J__subsec-4">
              <num>4</num>
              <content>
                <p>An amount payable under this section is recoverable as a debt due to the Commonwealth.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-3__dvs-2A__sec-33K">
            <num>33K</num>
            <heading>Payment of the whole of the advance payment</heading>
            <subsection eId="part-3__dvs-2A__sec-33K__subsec-1">
              <num>1</num>
              <content>
                <p>If the Chief Executive Medicare does not give a notice under <ref href="#sec-33C">section 33C</ref> to the compensable person on or before the day on which the Chief Executive Medicare is required to do so, the whole of the advance payment is payable by the Commonwealth to the compensable person on that day.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-2A__sec-33K__subsec-2">
              <num>2</num>
              <content>
                <p>The payment of the whole of the advance payment operates as a discharge of the compensable person’s liability to pay to the Commonwealth amounts payable under this Act or the Charges Act in respect of the compensation payable under the judgment or settlement in question.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-3__dvs-2A__sec-33L">
            <num>33L</num>
            <heading>Advance payments to the Commonwealth discharge liability</heading>
            <content>
              <p>The making of an advance payment by a compensation payer or insurer to the Commonwealth of the amount of compensation payable under a judgment or settlement operates, to the extent of the payment, as a discharge of:</p>
            </content>
            <paragraph eId="part-3__dvs-2A__sec-33L__para-a">
              <num>a</num>
              <content>
                <p>the compensation payer’s or insurer’s liability to the compensable person in respect of the amount of compensation; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__dvs-2A__sec-33L__para-b">
              <num>b</num>
              <content>
                <p>the compensable person’s liability to pay to the Commonwealth amounts payable under this Act or the Charges Act in respect of the amount of compensation.</p>
              </content>
            </paragraph>
          </section>
          <section eId="part-3__dvs-2A__sec-33M">
            <num>33M</num>
            <heading>Interest not payable on advance payments</heading>
            <subsection eId="part-3__dvs-2A__sec-33M__subsec-1">
              <num>1</num>
              <content>
                <p>If:</p>
              </content>
              <paragraph eId="part-3__dvs-2A__sec-33M__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>a compensation payer or insurer makes an advance payment to the Commonwealth of the amount of compensation payable under a judgment or settlement; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-2A__sec-33M__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>an Australian law would, apart from this section, make the Commonwealth liable to pay interest on the advance payment, because the advance payment has been retained by the Commonwealth after the judgment or settlement has been made;</p>
                </content>
                <content>
                  <p>despite that law, the Commonwealth is not liable to pay that interest.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-2A__sec-33M__subsec-2">
              <num>2</num>
              <content>
                <p>If the Commonwealth is required to make a payment under <ref href="#sec-33H">section 33H</ref> or 33K, subsection (1) does not apply after the expiry of the period within which the payment must be made.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-2A__sec-33M__subsec-3">
              <num>3</num>
              <content>
                <p>If:</p>
              </content>
              <paragraph eId="part-3__dvs-2A__sec-33M__subsec-3__para-a">
                <num>a</num>
                <content>
                  <p>a compensation payer or insurer makes an advance payment to the Commonwealth of the amount of compensation payable under a judgment or settlement; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-2A__sec-33M__subsec-3__para-b">
                <num>b</num>
                <content>
                  <p>an Australian law would, apart from this section, make the compensation payer or insurer liable to pay interest on the advance payment, because the advance payment has not been paid to the compensable person after the judgment or settlement has been made;</p>
                </content>
                <content>
                  <p>despite that law, the compensation payer or insurer is not liable to pay that interest.</p>
                </content>
              </paragraph>
            </subsection>
          </section>
        </division>
        <division eId="part-3__dvs-3">
          <num>3</num>
          <heading>Waiver of the requirements of this Part</heading>
          <section eId="part-3__dvs-3__sec-34">
            <num>34</num>
            <heading>Bulk payment agreements</heading>
            <subsection eId="part-3__dvs-3__sec-34__subsec-1">
              <num>1</num>
              <content>
                <p>The Chief Executive Medicare may, on behalf of the Commonwealth, at any time after 18 months following the commencement of this Act, enter into an agreement with a person that contains provisions to the effect that:</p>
              </content>
              <paragraph eId="part-3__dvs-3__sec-34__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>the person will pay the Commonwealth a specified amount; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-34__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>the person will:</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-34__subsec-1__para-i">
                <num>i</num>
                <content>
                  <p>give the Chief Executive Medicare information of a kind specified in a determination made by the Chief Executive Medicare under subsection (2); and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-34__subsec-1__para-ii">
                <num>ii</num>
                <content>
                  <p>give the information in a way specified in the determination; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-34__subsec-1__para-c">
                <num>c</num>
                <content>
                  <p>if the person is or becomes a notifiable person in relation to a claim for compensation:</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-34__subsec-1__para-i">
                <num>i</num>
                <content>
                  <p>the person will be, to the extent provided for in sections 35, 36 and 37, exempt from Divisions 1 and 2 in relation to the claim; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-34__subsec-1__para-ii">
                <num>ii</num>
                <content>
                  <p>the compensable person concerned will be, to the extent provided for in subsections 8(6), (7) and (8), exempt from <ref href="#sec-8">section 8</ref> in respect of the injury to which the claim relates; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-34__subsec-1__para-iii">
                <num>iii</num>
                <content>
                  <p>the compensable person concerned will be, to the extent provided for in subsections 10(6), (7) and (8), exempt from <ref href="#sec-10">section 10</ref> in respect of the injury to which the claim relates; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-34__subsec-1__para-iv">
                <num>iv</num>
                <content>
                  <p>the compensable person concerned will be, to the extent provided for in subsections 6(6), (7) and (8) of the Charges Act, exempt from <ref href="#sec-6">section 6</ref> of that Act in respect of the injury to which the claim relates; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-34__subsec-1__para-v">
                <num>v</num>
                <content>
                  <p>the compensable person concerned will be, to the extent provided for in subsections 8(6), (7) and (8) of the Charges Act, exempt from <ref href="#sec-8">section 8</ref> of that Act in respect of the injury to which the claim relates.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-3__sec-34__subsec-2">
              <num>2</num>
              <content>
                <p>The Chief Executive Medicare may determine in writing:</p>
              </content>
              <paragraph eId="part-3__dvs-3__sec-34__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>the kinds of information that must be given; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-34__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>the way in which such information must be given;</p>
                </content>
                <content>
                  <p>for the purposes of provisions of a kind referred to in paragraph (1)(b).</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-3__sec-34__subsec-3">
              <num>3</num>
              <content>
                <p>Without limiting subsection (2), the determination may require the giving of information about settlements, judgments and reimbursement arrangements in relation to injuries that occur within the period to which the contract is expressed to apply, including:</p>
              </content>
              <paragraph eId="part-3__dvs-3__sec-34__subsec-3__para-a">
                <num>a</num>
                <content>

            <num>35</num>
            <heading>Waiver—bulk payment agreements</heading>
            <subsection eId="part-3__dvs-3__sec-35__subsec-1">
              <num>1</num>
              <content>
                <p>Subject to this section and <ref href="#sec-37">section 37</ref>, during the period of a bulk payment agreement, Divisions 1 and 2 do not apply in relation to a claim if:</p>
              </content>
              <paragraph eId="part-3__dvs-3__sec-35__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>the notifiable person in relation to the claim has entered into the bulk payment agreement with the Chief Executive Medicare; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-35__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>the notifiable person has complied with all the conditions of the bulk payment agreement.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-3__sec-35__subsec-2">
              <num>2</num>
              <content>
                <p>This section does not affect the operation of Divisions 1 and 2 in relation to an amount of compensation fixed under a judgment or settlement, in respect of the claim, if the amount was fixed prior to the start of the period of the bulk payment agreement.</p>

            </subsection>
            <subsection eId="part-3__dvs-3__sec-35__subsec-3">
              <num>3</num>
              <content>
                <p>This section does not affect the operation of Divisions 1 and 2 in relation to a reimbursement arrangement that has been made in respect of the claim.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-3__dvs-3__sec-36">
            <num>36</num>
            <heading>Extended waiver—settlements during periods of bulk payment agreements</heading>
            <subsection eId="part-3__dvs-3__sec-36__subsec-1">
              <num>1</num>
              <content>
                <p>Subject to this section and <ref href="#sec-37">section 37</ref>, Divisions 1 and 2 do not apply in relation to a claim for compensation if:</p>
              </content>
              <paragraph eId="part-3__dvs-3__sec-36__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>the notifiable person in relation to the claim has entered into a bulk payment agreement with the Chief Executive Medicare; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-36__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>the notifiable person has complied with all the conditions of the bulk payment agreement; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-36__subsec-1__para-c">
                <num>c</num>
                <content>
                  <p>an amount of compensation is fixed under a judgment or settlement in respect of the claim during the period of the bulk payment agreement; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-36__subsec-1__para-d">
                <num>d</num>
                <content>
                  <p>the judgment or settlement determines all the outstanding liability of the compensation payer in relation to the claim.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-3__sec-36__subsec-2">
              <num>2</num>
              <content>
                <p>For the avoidance of doubt, subsection (1) applies in relation to a claim even if a reimbursement arrangement in respect of the claim has been made before, during or after the period of the bulk payment agreement.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-3__sec-36__subsec-3">
              <num>3</num>
              <content>
                <p>For the avoidance of doubt, subsection (1) applies in relation to a judgment or settlement even if:</p>
              </content>
              <paragraph eId="part-3__dvs-3__sec-36__subsec-3__para-a">
                <num>a</num>
                <content>
                  <p>an amount of compensation was fixed under the judgment or settlement before the start of the period of the bulk payment agreement; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-36__subsec-3__para-b">
                <num>b</num>
                <content>
                  <p>the judgment or settlement did not determine all the outstanding liability of the compensation payer in relation to the claim; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-36__subsec-3__para-c">
                <num>c</num>
                <content>
                  <p>during the period of the bulk payment agreement, an amount of compensation is fixed under a further judgment or settlement of a kind referred to in subsection (1).</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-3__sec-36__subsec-4">
              <num>4</num>
              <content>
                <p>This section does not affect the operation of Divisions 1 and 2 in relation to a judgment or settlement of a kind referred to in subsection (1) if:</p>
              </content>
              <paragraph eId="part-3__dvs-3__sec-36__subsec-4__para-a">
                <num>a</num>
                <content>
                  <p>an amount of compensation was fixed under the judgment or settlement during the period of the bulk payment agreement; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-36__subsec-4__para-b">
                <num>b</num>
                <content>
                  <p>at the time the judgment or settlement was made, it purported to determine all the outstanding liability of the compensation payer in relation to the claim; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-36__subsec-4__para-c">
                <num>c</num>
                <content>
                  <p>another judgment or settlement in respect of the claim is made after the end of the period of the bulk payment agreement.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-3__sec-36__subsec-5">
              <num>5</num>
              <content>
                <p>This section does not affect the validity of a payment of money pursuant to a notice under <ref href="#sec-24">section 24</ref> or 25 if the payment occurred before the amount of compensation was fixed under the judgment or settlement referred to in subsection (1).</p>
              </content>
            </subsection>
          </section>
          <section eId="part-3__dvs-3__sec-37">
            <num>37</num>
            <heading>Limits of waiver—bulk payment agreements</heading>
            <subsection eId="part-3__dvs-3__sec-37__subsec-1">
              <num>1</num>
              <content>
                <p>This section has effect despite:</p>
              </content>
              <paragraph eId="part-3__dvs-3__sec-37__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>subsections 8(6), 8(7), 8(8), 10(6), 10(7) and 10(8); and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-37__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>sections 35 and 36; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-37__subsec-1__para-c">
                <num>c</num>
                <content>
                  <p>subsections 6(6), 6(7), 6(8), 8(6), 8(7) and 8(8) of the Charges Act;</p>
                </content>
                <content>
                  <p>(the <b><i>exempting provisions</i></b>).</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-3__sec-37__subsec-2">
              <num>2</num>
              <content>
                <p>The exempting provisions do not affect the operation of a provision of <ref href="#dvs-1">Division 1</ref> or 2 that creates an offence, if that provision was breached before the start of the period of the bulk payment agreement concerned.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-3__sec-37__subsec-3">
              <num>3</num>
              <content>
                <p>The exempting provisions do not affect the operation of a provision of <ref href="#dvs-1">Division 1</ref> or 2 imposing an obligation to do something within a certain time limit, if:</p>
              </content>
              <paragraph eId="part-3__dvs-3__sec-37__subsec-3__para-a">
                <num>a</num>
                <content>
                  <p>the time limit expired before the start of the period of the bulk payment agreement concerned; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-37__subsec-3__para-b">
                <num>b</num>
                <content>
                  <p>the thing was not done within that time limit.</p>
                </content>
              </paragraph>
            </subsection>
          </section>
          <section eId="part-3__dvs-3__sec-38">
            <num>38</num>
            <heading>Waiver—small amounts of compensation</heading>
            <subsection eId="part-3__dvs-3__sec-38__subsec-1">
              <num>1</num>
              <content>
                <p>Despite Divisions 1 and 2, those Divisions do not apply in relation to a claim for compensation in respect of an injury if:</p>
              </content>
              <paragraph eId="part-3__dvs-3__sec-38__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>a judgment or settlement has been made in respect of the claim; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-38__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>the amount of compensation fixed by the judgment or settlement is a small amount; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-38__subsec-1__para-c">
                <num>c</num>
                <content>
                  <p>the amount of compensation so fixed is the entire amount of compensation in respect of the injury.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-3__sec-38__subsec-2">
              <num>2</num>
              <content>
                <p>	(2)	An amount of compensation is a <b><i>small amount</i></b> if it is equal to or less than:</p>
              </content>
              <paragraph eId="part-3__dvs-3__sec-38__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>$5,000; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-38__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>if a higher amount is prescribed for the purposes of this subsection by the regulations—that amount.</p>
                </content>
              </paragraph>
            </subsection>

              <p>The Chief Executive Medicare has the general administration of this Act, other than <ref href="#dvs-2">Division 2</ref> of <ref href="#part-2">Part 2</ref>.</p>
            </content>

          <section eId="part-4__dvs-1__sec-40">
            <num>40</num>
            <heading>Additional functions of the Chief Executive Medicare</heading>
            <subsection eId="part-4__dvs-1__sec-40__subsec-1">
              <num>1</num>
              <content>
                <p>	(1)	In addition to the functions of the Chief Executive Medicare under the <i>Human Services (Medicare) Act 1973</i>, the Chief Executive Medicare has such additional functions as are conferred on the Chief Executive Medicare under this Act.</p>
              </content>
            </subsection>
            <subsection eId="part-4__dvs-1__sec-40__subsec-2">
              <num>2</num>
              <content>
                <p>	(2)	Anything done by or on behalf of the Chief Executive Medicare in the performance of such additional functions is taken, for all purposes, to have been done in the performance of his or her functions under the<i> Human Services (Medicare) Act 1973</i>.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-4__dvs-1__sec-41">
            <num>41</num>
            <heading>Delegation</heading>
            <subsection eId="part-4__dvs-1__sec-41__subsec-1">
              <num>1</num>
              <content>
                <p>The Chief Executive Medicare may delegate any of his or her powers under this Act to:</p>
              </content>
              <paragraph eId="part-4__dvs-1__sec-41__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>	(a)	a Departmental employee (within the meaning of the <i>Human Services (Medicare) Act 1973</i>); or</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-1__sec-41__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>a person occupying, or performing the duties of, an office in the Department.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-4__dvs-1__sec-41__subsec-2">
              <num>2</num>
              <content>
                <p>	(2)	The power of delegation under subsection (1) does not affect any power of delegation that the Chief Executive Medicare has under the <i>Human Services (Medicare) Act 1973</i>.</p>
              </content>
            </subsection>

              <num>3</num>
              <content>
                <p><role refersTo="#secretary">The Secretary</role> may delegate any of <role refersTo="#secretary">the Secretary</role>’s powers under this Act to:</p>

                  <p>a person occupying, or performing the duties of, an office in the Department; or</p>

          <heading>Power to obtain information</heading>

            <heading>Chief Executive Medicare etc. may obtain information etc.</heading>
            <subsection eId="part-4__dvs-2__sec-42__subsec-1">
              <num>1</num>
              <content>
                <p>The Chief Executive Medicare or an authorised officer may require a person to give information or produce a document that is in the person’s custody, or under the person’s control, if the Chief Executive Medicare or authorised officer believes on reasonable grounds that the information or document may be relevant to the question of:</p>
              </content>
              <paragraph eId="part-4__dvs-2__sec-42__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>whether a claim for compensation has been made; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-42__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>whether a judgment, settlement, reimbursement arrangement has been made or entered into; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-42__subsec-1__para-c">
                <num>c</num>
                <content>
                  <p>the amount of compensation fixed by the judgment or settlement; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-42__subsec-1__para-d">
                <num>d</num>
                <content>
                  <p>what amounts (if any) are or may be payable under this Act or the Charges Act in respect of the amount of compensation; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-42__subsec-1__para-f">
                <num>f</num>
                <content>
                  <p>	(f)	whether the Secretary of the Department administered by the Minister administering the <i>Aged Care Act 2024</i> should make a determination under subsection 199(3), 207(3), 216(3), 225(3), 233(3) or 241(3) of that Act.</p>

            </subsection>

                <p>The requirement must be by notice in writing given to the person.</p>
              </content>

                  <p>	(a)	a person who is appointed under <i>Human Services (Medicare) Act 1973 </i>and whose powers under that appointment include the powers under Division 2 of Part IID of that Act; or<ref href="#sec-8M">section 8M</ref> of the </p>

                  <p>	(b)	a Departmental employee (within the meaning of the <i>Human Services (Medicare) Act 1973</i>), or a person holding or performing the duties of an office in the Department, who is appointed by the Chief Executive Medicare, by signed instrument, to be an authorised officer for the purposes of this section.</p>

            </subsection>

            <num>43</num>
            <heading>Content of notices</heading>
            <subsection eId="part-4__dvs-2__sec-43__subsec-1">
              <num>1</num>
              <content>
                <p>The notice must specify:</p>
              </content>
              <paragraph eId="part-4__dvs-2__sec-43__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>how the person is to give the information or how the document is to be produced; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-43__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>the period within which the person is to give the information, or to produce the document; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-43__subsec-1__para-c">
                <num>c</num>
                <content>
                  <p>	(c)	the Departmental employee (within the meaning of the <i>Human Services (Medicare) Act 1973</i>) (if any) to whom the information is to be given or the document is to be produced; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-43__subsec-1__para-d">
                <num>d</num>
                <content>
                  <p>that the notice is given under <ref href="#sec-42">section 42</ref>.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-4__dvs-2__sec-43__subsec-2">

              <content>
                <p>The period specified under paragraph (1)(b) must end at least 28 days after the notice is given.</p>
              </content>
            </subsection>
            <subsection eId="part-4__dvs-2__sec-43__subsec-3">
              <num>3</num>
              <content>
                <p>	(3)	The notice may require the person to give the information by appearing before a specified Departmental employee (within the meaning of the <i>Human Services (Medicare) Act 1973</i>) to answer questions.</p>
              </content>
            </subsection>
            <subsection eId="part-4__dvs-2__sec-43__subsec-4">
              <num>4</num>
              <content>
                <p>If the notice requires the person to appear before an officer, the notice must specify a time and a place for the person to appear. The time must be at least 28 days after the notice is given.</p>
              </content>
            </subsection>
            <subsection eId="part-4__dvs-2__sec-43__subsec-5">
              <num>5</num>
              <content>
                <p>	(5)	A reference in this section to a Departmental employee (within the meaning of the <i>Human Services (Medicare) Act 1973</i>) includes a reference to a person to whom the Chief Executive Medicare or the Secretary has delegated powers under section 41.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-4__dvs-2__sec-44">
            <num>44</num>
            <heading>Offences</heading>
            <subsection eId="part-4__dvs-2__sec-44__subsec-1">
              <num>1</num>
              <content>
                <p>A person must not refuse or fail to comply with a notice under <ref href="#sec-42">section 42</ref>.</p>
              </content>

                  <p>Penalty:	<quantity refersTo="#custodialSentence">Imprisonment for 6 months</quantity>.</p>

            </subsection>

                <p>However, the person is only required to comply with the notice to the extent that the person is capable of doing so.</p>

              <num>4</num>
              <content>
                <p>In any criminal proceeding:</p>
              </content>
              <paragraph eId="part-4__dvs-2__sec-44__subsec-4__para-a">
                <num>a</num>
                <content>
                  <p>evidence of any information given or document produced pursuant to a notice under <ref href="#sec-42">section 42</ref>; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-44__subsec-4__para-b">
                <num>b</num>
                <content>
                  <p>evidence of any information, document or thing obtained as a direct or indirect result of the person having given the information or produced the document;</p>
                </content>
                <content>
                  <p>cannot be used against the person. However, this subsection does not apply to a proceeding for an offence against subsection (1) of this section, or an offence against <i>Criminal Code</i> that relates to a notice under section 42 of this Act.<ref href="#sec-137">section 137</ref>.1 or 137.2 of the </p>
                </content>
              </paragraph>
            </subsection>
          </section>
          <section eId="part-4__dvs-2__sec-45">

            <heading>Exemption</heading>
            <content>
              <p>This Division does not require a person to give information or produce a document to the extent that, in doing so, the person would contravene a law of the Commonwealth (other than a law of a Territory).</p>

          <heading>Form of notices etc.</heading>

            <p>A notice or statement given to the Chief Executive Medicare under this Act must be given:</p>
          </content>

                <b>Editorial changes</b>
              </p>
              <p>The <i>Legislation Act 2003</i> authorises First Parliamentary Counsel to make editorial and presentational changes to a compiled law in preparing a compilation of the law for registration. The changes must not change the effect of the law. Editorial changes take effect from the compilation registration date.</p>
              <p>If the compilation includes editorial changes, the endnotes include a brief outline of the changes in general terms. Full details of any changes can be obtained from the Office of Parliamentary Counsel.</p>

                <b>Misdescribed amendments</b>
              </p>
              <p>A misdescribed amendment is an amendment that does not accurately describe how an amendment is to be made. If, despite the misdescription, the amendment can be given effect as intended, then the misdescribed amendment can be incorporated through an editorial change made under <i>Legislation Act 2003</i>.<ref href="#sec-15V">section 15V</ref> of the </p>
              <p>If a misdescribed amendment cannot be given effect as intended, the amendment is not incorporated and “(md not incorp)” is added to the amendment history.</p>
