            <p>		These Regulations are the <i>Agricultural and Veterinary Chemicals (Administration) </i><i>Regulations 1</i><i>995</i>.</p>

          <heading>Interpretation</heading>
          <subsection eId="part-1__sec-1.3__subsec-1">
            <num>1</num>
            <content>
              <p>In these Regulations:</p>
            </content>
            <content>
              <p><term refersTo="#term-act">Act</term> means <def>the Agricultural and Veterinary Chemicals (Administration) Act 1992.</def></p>
              <p><term refersTo="#term-active-constituent">active constituent</term> has the same meaning as <def>in the Agvet Code of the participating Territories.</def></p>
              <p><term refersTo="#term-agricultural-chemical-product">agricultural chemical product</term> has the same meaning as <def>in the Agvet Code of the participating Territories.</def></p>
              <p><term refersTo="#term-agvet-code-of-the-participating-territories">Agvet Code of the participating Territories</term> has the same meaning as <def>in subsection 5(1) of <ref href="">the Agricultural and Veterinary Chemicals Code Act 1994</ref>.</def></p>
              <p><term refersTo="#term-authorised-officer">authorised officer</term> has the meaning given by <def>regulation 1.4.</def></p>
              <p><term refersTo="#term-cas-number-or-chemical-abstracts-service-number">CAS number or Chemical Abstracts Service number</term> means <def>the registry number: assigned to the chemical by the Chemical Abstracts Service, Columbus, Ohio, United States of America; and 	(b)	published by the Service in the journal <i>Chemical Abstracts</i>.</def></p>

              <content>
                <p>assigned to the chemical by the Chemical Abstracts Service, Columbus, Ohio, United States of America; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-1.3__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>	(b)	published by the Service in the journal <i>Chemical Abstracts</i>.</p>
              </content>
              <content>
                <p><term refersTo="#term-chemical-product">chemical product</term> has the same meaning as <def>in the Agvet Code of the participating Territories.</def></p>
                <p><term refersTo="#term-collector">Collector</term> has the meaning given by <def>subsection 8(1) of <ref href="">the Customs Act 1901</ref>.</def></p>
                <p><term refersTo="#term-controlled-chemical">controlled chemical</term> has the meaning given by <def>regulation 1.3A.</def></p>
                <p><term refersTo="#term-generic-information">generic information</term> has the meaning given by <def>regulation 1.5.</def></p>
                <p><term refersTo="#term-import-decision">import decision</term> means <def>a response, made under paragraph 2 of Article 10 of the Rotterdam Convention, providing a response in accordance with the requirements of paragraph 4 of that Article that consists of a final decision or an interim decision (within the respective meanings given by that paragraph): consenting to import with or without specified conditions; or not consenting to import.</def></p>

              <num>a</num>
              <content>
                <p>consenting to import with or without specified conditions; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-1.3__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>not consenting to import.</p>
              </content>
              <content>
                <p><term refersTo="#term-iupac-name">IUPAC name</term> means <def>a name assigned to a chemical by the International Union of Pure and Applied Chemistry, set out in International Standard ISO 1750—1981: Pesticides and Agrochemicals—Common Names, published in Geneva by the International Standards Organisation in 1981.</def></p>
                <p><term refersTo="#term-mercury">mercury</term> means <def>elemental mercury (Hg(0), CAS Number 7439-97-6), and includes mixtures of mercury (including alloys of mercury) with a mercury concentration of at least 95% by weight, but does not include non-Minamata mercury.</def></p>
                <p><term refersTo="#term-mercury-added-products">mercury-added products</term> means <def>the products listed in <ref href="#part-1">Part 1</ref> of Annex A to the Minamata Convention that contain mercury, but does not include the following: products essential for civil protection and military uses; products for research, calibration of instrumentation, or for use as a reference standard; if no feasible mercury-free alternative for a replacement is available—the following: switches and relays; cold cathode fluorescent lamps and external electrode fluorescent lamps for electronic displays; measuring devices; products used in traditional or religious practices; vaccines containing thiomersal as preservatives.</def></p>

            </paragraph>
            <paragraph eId="part-1__sec-1.3__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>products essential for civil protection and military uses;</p>
              </content>
            </paragraph>

                <p>products for research, calibration of instrumentation, or for use as a reference standard;</p>

                <p><term refersTo="#term-multiple-entry-import-permit">multiple entry import permit</term> has the meaning given by <def>regulation 3.310.</def></p>
                <p><term refersTo="#term-multiple-exit-export-permit">multiple exit export permit</term> has the meaning given by <def>regulation 3.310.</def></p>
                <p><term refersTo="#term-multiple-permit">multiple permit</term> means <def>a multiple entry import permit or multiple exit export permit.</def></p>
                <p><term refersTo="#term-non-minamata-mercury">non-Minamata mercury</term> means <def>any of the following: research mercury; naturally occurring trace quantities of mercury present in: products such as non-mercury metals, ores or mineral products (including coal); or products derived from the products mentioned in subparagraph (i); unintentional trace quantities of mercury in chemical products.</def></p>

                <p>an active constituent or chemical product that has been prescribed by these Regulations for the purposes of <ref href="#sec-69C">section 69C</ref>A or 69CB of the Act; or</p>

            </paragraph>

              <num>b</num>
              <content>
                <p>a chemical product containing an active constituent referred to in paragraph (a).</p>
              </content>
              <content>
                <p><term refersTo="#term-research-mercury">research mercury</term> means <def>mercury to be used for laboratory-scale research or as a reference standard.</def></p>
                <p><term refersTo="#term-rotterdam-convention">Rotterdam Convention</term> means <def>the Rotterdam Convention on the Prior Informed Consent Procedure for Certain Hazardous Chemicals and Pesticides in International Trade.</def></p>
                <p><b><i>Secretariat </i></b>means:</p>

              <p>Unless the contrary intention appears, a term that is defined in an international agreement or arrangement and that is used in these Regulations has the same meaning in these Regulations when used in relation to that agreement or arrangement.</p>

          </subsection>

            <content>
              <p>	(3)	A reference in these Regulations to an <b><i>active constituent</i></b> is a reference to an active constituent for a proposed or existing chemical product.</p>

          </subsection>
        </section>
        <section eId="part-1__sec-1.3A">
          <num>1.3A</num>
          <heading>Meaning of controlled chemical</heading>
          <subsection eId="part-1__sec-1.3A__subsec-1">
            <num>1</num>
            <content>
              <p>Subject to subregulation (2), in these Regulations:</p>
            </content>
            <intro>
              <p><term refersTo="#term-controlled-chemical">controlled chemical</term> means:</p>
            </intro>

              <num>a</num>

                <p>an active constituent or chemical product listed in <ref href="#part-2">Part 2</ref> of Schedule 1; or</p>
              </content>
            </paragraph>

                <p>a chemical product containing an active constituent referred to in paragraph (a); or</p>
              </content>
            </paragraph>

                <p>the chemical product listed as an item in <ref href="#part-3">Part 3</ref> of Schedule 1;</p>

                <p>mercury that is to be used as an active constituent in a proposed or existing chemical product; or</p>
              </content>
            </paragraph>

              </content>
            </paragraph>
            <paragraph eId="part-1__sec-1.3A__subsec-1__para-f">

                <p>a chemical product that is a mercury-added product.</p>

            </paragraph>
          </subsection>
          <subsection eId="part-1__sec-1.3A__subsec-2">
            <num>2</num>
            <content>
              <p>To avoid doubt, if the heading of an item in <ref href="#part-2">Part 2</ref> of Schedule 1 includes the words ‘and its compounds’ or other words describing all compounds, or all compounds of a particular kind (such as, for example, ‘and its salts and esters’) of the relevant chemical, all compounds, or all such compounds, of the chemical are also controlled chemicals.</p>

          </subsection>
        </section>
        <section eId="part-1__sec-1.4">
          <num>1.4</num>
          <heading>Meaning of authorised officer</heading>
          <content>
            <p>		An officer of the Department is an <b><i>authorised officer</i></b> for a provision of these Regulations if the person is authorised in writing by the Secretary under the provision in which the expression occurs.</p>
          </content>
        </section>
        <section eId="part-1__sec-1.5">
          <num>1.5</num>
          <heading>Meaning of generic information about a person</heading>
          <subsection eId="part-1__sec-1.5__subsec-1">
            <num>1</num>
            <content>
              <p>In these Regulations:</p>
            </content>
            <content>
              <p><term refersTo="#term-generic-information-about-a-person">generic information about a person</term> means <def>the following information: the person’s name; the person’s ABN; the address of the person’s principal place of business; the address of the person’s registered office, if different from the address of the person’s principal place of business; if the person is not an individual, the name of an individual who is to be the contact person; the telephone and facsimile numbers for, and e-mail address of, the person and contact person.</def></p>

              <num>a</num>
              <content>
                <p>the person’s name;</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-1.5__subsec-1__para-b">

                <p>the person’s ABN;</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-1.5__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>the address of the person’s principal place of business;</p>

            <paragraph eId="part-1__sec-1.5__subsec-1__para-d">

                <p>the address of the person’s registered office, if different from the address of the person’s principal place of business;</p>

            </paragraph>

                <p>if the person is not an individual, the name of an individual who is to be the contact person;</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-1.5__subsec-1__para-f">

                <p>the telephone and facsimile numbers for, and e-mail address of, the person and contact person.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-1__sec-1.5__subsec-2">
            <num>2</num>
            <content>
              <p>If a person has given generic information about himself, herself or itself to the Department, and the information changes, the person must give the new information to the Department <quantity refersTo="#deadline">within 30 days</quantity>.</p>
            </content>
          </subsection>
        </section>
      </part>
      <part eId="part-1A">
        <num>1A</num>
        <heading>Annual operational plan and annual report</heading>
        <section eId="part-1A__sec-1A.1">
          <num>1A.1</num>
          <heading>Information for inclusion in annual report</heading>
          <content>
            <p>The APVMA must include in its annual report a list of:</p>
          </content>
          <paragraph eId="part-1A__sec-1A.1__para-a">
            <num>a</num>
            <content>
              <p>	(a)	the standards made under <i>Agricultural and Veterinary Chemicals Code Act 1994</i> during the period to which the annual report relates; and<ref href="#sec-6E">section 6E</ref> of the Schedule to the </p>
            </content>
          </paragraph>
          <paragraph eId="part-1A__sec-1A.1__para-b">
            <num>b</num>
            <content>
              <p>the standards made under <ref href="#sec-6E">section 6E</ref> that were varied by the APVMA during the period to which the annual report relates.</p>
            </content>
          </paragraph>
        </section>
        <section eId="part-1A__sec-1A.3">
          <num>1A.3</num>
          <heading>Performance indicators for inclusion in annual report</heading>
          <content>
            <p>For the purposes of paragraph 61(b) of the Act, the following performance indicators are prescribed:</p>
          </content>
          <paragraph eId="part-1A__sec-1A.3__para-a">
            <num>a</num>
            <content>
              <p>	(a)	the number of reconsiderations commenced by the APVMA under <i>Agricultural and Veterinary Chemicals Code Act 1994 </i>(the <b><i>Agvet Code Act</i></b>) during the period to which the annual report relates;<ref href="#sec-31">section 31</ref> of the Schedule to the </p>
            </content>
          </paragraph>
          <paragraph eId="part-1A__sec-1A.3__para-b">
            <num>b</num>
            <content>
              <p>the number of reconsiderations concluded by the APVMA under <ref href="#dvs-4">Division 4</ref> of Part 2 of the Schedule to the Agvet Code Act during that period;</p>
            </content>
          </paragraph>
          <paragraph eId="part-1A__sec-1A.3__para-c">
            <num>c</num>
            <content>
              <p>brief details of the progress of reconsiderations that were scheduled to progress in that period;</p>
            </content>
          </paragraph>
          <paragraph eId="part-1A__sec-1A.3__para-ca">
            <num>ca</num>
            <content>
              <p>a summary of any action taken by the APVMA under <ref href="#sec-99">section 99</ref> of the Schedule to the Agvet Code Act during that period;</p>
            </content>
          </paragraph>
          <paragraph eId="part-1A__sec-1A.3__para-d">
            <num>d</num>
            <content>
              <p>	(d)	the number of applications mentioned in each item of <i>Agricultural and Veterinary Chemicals Code </i><i>Regulations 1</i><i>995</i> that were:<ref href="#part-2">Part 2</ref> of Schedule 6 of the </p>
            </content>
          </paragraph>
          <paragraph eId="part-1A__sec-1A.3__para-i">
            <num>i</num>
            <content>
              <p>made under the Schedule to the Agvet Code Act during that period; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-1A__sec-1A.3__para-ii">
            <num>ii</num>
            <content>
              <p>not determined within the period required for the application by regulations made under <ref href="#sec-165">section 165</ref> of that Schedule;</p>
            </content>
          </paragraph>
          <paragraph eId="part-1A__sec-1A.3__para-e">
            <num>e</num>
            <content>
              <p>the number of reports (known as adverse experience reports) received by the APVMA during that period;</p>
            </content>
          </paragraph>
          <paragraph eId="part-1A__sec-1A.3__para-f">
            <num>f</num>
            <content>
              <p>the number of adverse experience reports mentioned in paragraph (e) that the APVMA determined were related to each of the following:</p>
            </content>
          </paragraph>
          <paragraph eId="part-1A__sec-1A.3__para-i">
            <num>i</num>
            <content>
              <p>human health;</p>
            </content>
          </paragraph>
          <paragraph eId="part-1A__sec-1A.3__para-ii">
            <num>ii</num>
            <content>
              <p>environment;</p>
            </content>
          </paragraph>
          <paragraph eId="part-1A__sec-1A.3__para-iii">
            <num>iii</num>
            <content>
              <p>animal health;</p>
            </content>
          </paragraph>

              <p>a summary of any action taken by the APVMA during that period in relation to adverse experience reports.</p>
            </content>

        <heading>Providing information about certain active constituents and chemical products</heading>

          <num>2.05</num>
          <heading>Prescribed international agreements (Act s 69CA(1))</heading>
          <content>
            <p>Each of the following is a prescribed international agreement for the purposes of subsection 69CA(1) of the Act:</p>
          </content>
          <paragraph eId="part-2__sec-2.05__para-a">
            <num>a</num>
            <content>
              <p>the Rotterdam Convention;</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-2.05__para-b">
            <num>b</num>
            <content>
              <p>the Stockholm Convention.</p>
            </content>
          </paragraph>
        </section>
        <section eId="part-2__sec-2.10">
          <num>2.10</num>
          <heading>Prescribed chemicals (Act s 69CA(2))</heading>
          <content>
            <p>A chemical is a prescribed active constituent or prescribed chemical product for the purposes of subsection 69CA(2) of the Act if:</p>
          </content>
          <paragraph eId="part-2__sec-2.10__para-a">
            <num>a</num>
            <content>
              <p>there is an item in Schedule 1 for the chemical; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-2.10__para-b">
            <num>b</num>
            <content>
              <p>the item describes the chemical as a prescribed active constituent or a prescribed chemical product for the purposes of that subsection.</p>
            </content>

          <heading>Prescribed chemicals (Act s 69CB(1))</heading>
          <content>
            <p>A chemical is a prescribed active constituent or prescribed chemical product for the purposes of subsection 69CB(1) of the Act if:</p>
          </content>
          <paragraph eId="part-2__sec-2.15__para-a">
            <num>a</num>
            <content>
              <p>there is an item in Schedule 1 for the chemical; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-2.15__para-b">
            <num>b</num>
            <content>
              <p>the item describes the chemical as a prescribed active constituent or prescribed chemical product for the purposes of that subsection.</p>
            </content>
          </paragraph>
        </section>
        <section eId="part-2__sec-2.20">
          <num>2.20</num>
          <heading>Prescribed information—import (Act ss 69CA(2)(a) and 69CB(2)(a))</heading>
          <content>
            <p>The following information about the import into Australia of a prescribed chemical is prescribed for the purposes of paragraphs 69CA(2)(a) and 69CB(2)(a) of the Act:</p>
          </content>
          <paragraph eId="part-2__sec-2.20__para-a">
            <num>a</num>
            <content>
              <p>generic information about the importer;</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-2.20__para-b">
            <num>b</num>
            <content>
              <p>the technical name and common name of the chemical;</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-2.20__para-c">
            <num>c</num>
            <content>
              <p>the name of any chemical product that contains the chemical;</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-2.20__para-d">
            <num>d</num>
            <content>
              <p>the name of the exporting country or countries;</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-2.20__para-e">
            <num>e</num>
            <content>
              <p>the chemical’s intended use;</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-2.20__para-f">
            <num>f</num>
            <content>
              <p>the total quantity of the chemical imported in any calendar year or part of any calendar year, specifying the quantity imported from each named exporting country;</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-2.20__para-g">
            <num>g</num>
            <content>
              <p>any additional information specified in the relevant item in Schedule 1.</p>
            </content>
          </paragraph>
        </section>
        <section eId="part-2__sec-2.25">
          <num>2.25</num>
          <heading>Prescribed information—manufacture (Act ss 69CA(2)(b) and 69CB(2)(b))</heading>
          <content>
            <p>The following information about the manufacture in Australia of a prescribed chemical is prescribed for the purposes of paragraphs 69CA(2)(b) and 69CB(2)(b) of the Act:</p>
          </content>

            <num>a</num>
            <content>
              <p>generic information about the manufacturer;</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-2.25__para-b">
            <num>b</num>

              <p>the technical name and common name of the chemical;</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-2.25__para-c">
            <num>c</num>
            <content>
              <p>the address of the place of manufacture;</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-2.25__para-d">
            <num>d</num>
            <content>
              <p>the quantity manufactured in any calendar year or part of any calendar year;</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-2.25__para-e">
            <num>e</num>
            <content>
              <p>the chemical’s intended use;</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-2.25__para-f">
            <num>f</num>

              <p>any additional information specified in the relevant item in Schedule 1.</p>

            <p>The following information about the export from Australia of a prescribed chemical is prescribed for the purposes of paragraphs 69CA(2)(d) and 69CB(2)(d) of the Act:</p>

              <p>generic information about the exporter;</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-2.40__para-b">
            <num>b</num>

              <p>the technical name and common name of the chemical;</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-2.40__para-c">
            <num>c</num>
            <content>
              <p>the name of importing country or countries;</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-2.40__para-d">
            <num>d</num>
            <content>
              <p>the total quantity of the prescribed chemical exported in any calendar year or part of any calendar year, specifying the quantity exported to each named importing country;</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-2.40__para-e">
            <num>e</num>
            <content>
              <p>any additional information specified in the relevant item in Schedule 1.</p>
            </content>
          </paragraph>
        </section>
        <section eId="part-2__sec-2.45">
          <num>2.45</num>
          <heading>Prescribed period for giving prescribed information (Act ss 69CA(5) and 69CB(5))</heading>
          <subsection eId="part-2__sec-2.45__subsec-1">
            <num>1</num>
            <content>
              <p>Subject to subregulation (2), for the purposes of subsections 69CA(5) and 69CB(5) of the Act, the period within which relevant prescribed information in respect of a prescribed chemical must be provided:</p>
            </content>

                <p>starts on the date when a notice setting out:</p>

            </paragraph>

                <p>		is published in the <i>Gazette</i>; and</p>

            </paragraph>

        <heading>Prohibition on import, manufacture etc of certain active constituents and chemical products</heading>

          <num>3.1</num>
          <heading>General</heading>
          <section eId="part-3__dvs-3.1__sec-3.05">
            <num>3.05</num>
            <heading>Prescribed international agreements (Act, s 69C)</heading>
            <content>
              <p>Each of the following is a prescribed international agreement for the purposes of <ref href="#sec-69C">section 69C</ref> of the Act:</p>

                <p>the Minamata Convention;</p>

          <section eId="part-3__dvs-3.1__sec-3.10">
            <num>3.10</num>
            <heading>Effect of grant of permissions or multiple permits</heading>
            <content>
              <p>The grant of a permission or multiple permit under this Part does not excuse the holder from compliance with other requirements in the Act, in these Regulations and in other Commonwealth, State or Territory legislation relating to the controlled chemical to which the permission or permit relates.</p>
            </content>
          </section>
          <section eId="part-3__dvs-3.1__sec-3.15">
            <num>3.15</num>
            <heading>Notice to be given if additional information required</heading>
            <subsection eId="part-3__dvs-3.1__sec-3.15__subsec-1">
              <num>1</num>
              <content>
                <p>An authorised officer or <role refersTo="#minister">the Minister</role> may, by written notice, require an applicant to give additional information in relation to the applicant’s application.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-3.1__sec-3.15__subsec-2">
              <num>2</num>
              <content>
                <p>The notice must include a statement to the effect that:</p>
              </content>
              <paragraph eId="part-3__dvs-3.1__sec-3.15__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>the application will not be considered further until the applicant gives to the authorised officer or Minister the information; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3.1__sec-3.15__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>the application will be taken to have been withdrawn if the applicant does not give the information <quantity refersTo="#deadline">within 28 days</quantity> after the day on which the notice is received by the applicant or within such further period as the authorised officer or Minister allows in writing.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-3.1__sec-3.15__subsec-3">
              <num>3</num>
              <content>
                <p>If an applicant does not give the additional information within the required period, the application is taken to have been withdrawn.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-3.1__sec-3.15__subsec-4">
              <num>4</num>
              <content>
                <p>In this regulation:</p>
              </content>
              <content>
                <p><b><i>applicant </i></b>means:</p>
              </content>
              <paragraph eId="part-3__dvs-3.1__sec-3.15__subsec-4__para-a">
                <num>a</num>
                <content>
                  <p>an applicant for a permission or multiple permit under this Part; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3.1__sec-3.15__subsec-4__para-b">
                <num>b</num>
                <content>
                  <p>an applicant for reconsideration under regulation 3.510.</p>
                </content>
              </paragraph>
            </subsection>
          </section>
          <section eId="part-3__dvs-3.1__sec-3.20">
            <num>3.20</num>
            <heading>Matters that may be considered when making decision</heading>
            <content>
              <p>In making a decision whether to grant an application for a permission or multiple permit under this Part, the authorised officer may take into consideration:</p>
            </content>
            <paragraph eId="part-3__dvs-3.1__sec-3.20__para-a">
              <num>a</num>
              <content>
                <p>whether the applicant has previously been granted a permission or permit of that kind; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__dvs-3.1__sec-3.20__para-b">
              <num>b</num>
              <content>
                <p>whether the applicant complied with any conditions or restrictions specified in the permission or permit; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__dvs-3.1__sec-3.20__para-c">
              <num>c</num>
              <content>
                <p>whether the applicant has failed to comply with any of the following:</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__dvs-3.1__sec-3.20__para-i">
              <num>i</num>

                <p>the Act;</p>
              </content>
            </paragraph>

                  <p>	(2)	In this Subdivision, a controlled chemical to which this Subdivision applies is called an <b><i>import</i></b><b><i>-</i></b><b><i>prohibited chemical</i></b>.</p>

              <heading>Prohibition</heading>
              <subsection eId="part-3__dvs-3.2__subdvs-3.2.2__sec-3.55__subsec-1">

                  <p>The importation into Australia of an import-prohibited chemical is prohibited unless:</p>
                </content>
                <paragraph eId="part-3__dvs-3.2__subdvs-3.2.2__sec-3.55__subsec-1__para-a">
                  <num>a</num>
                  <content>
                    <p>an authorised officer or <role refersTo="#minister">the Minister</role> has given permission in writing to import the chemical; and</p>
                  </content>
                </paragraph>
                <paragraph eId="part-3__dvs-3.2__subdvs-3.2.2__sec-3.55__subsec-1__para-b">
                  <num>b</num>
                  <content>
                    <p>the permission is produced to a Collector; and</p>
                  </content>
                </paragraph>
                <paragraph eId="part-3__dvs-3.2__subdvs-3.2.2__sec-3.55__subsec-1__para-c">
                  <num>c</num>
                  <content>
                    <p>for a chemical listed in Schedule 1—any condition or restriction specified for the chemical in the relevant item in Schedule 1 is satisfied.</p>
                  </content>

                      <p>Note 1:	The permission to import required under this regulation must be produced to a Collector for the purposes of complying with regulation 5I of the<i> Customs (Prohibited Imports) </i><i>Regulations 1</i><i>956</i> in relation to the importation of chemicals under those Regulations that are active constituents or chemical products.</p>

                  <p>For the purposes of subsection 69C(1) of the Act, the following conditions or restrictions are prescribed for each such chemical:</p>
                </content>
                <paragraph eId="part-3__dvs-3.2__subdvs-3.2.2__sec-3.55__subsec-2__para-a">
                  <num>a</num>
                  <content>
                    <p>a person must not import the chemical:</p>
                  </content>
                </paragraph>
                <paragraph eId="part-3__dvs-3.2__subdvs-3.2.2__sec-3.55__subsec-2__para-i">
                  <num>i</num>
                  <content>
                    <p>without the written permission of an authorised officer or <role refersTo="#minister">the Minister</role>; or</p>
                  </content>
                </paragraph>
                <paragraph eId="part-3__dvs-3.2__subdvs-3.2.2__sec-3.55__subsec-2__para-ii">
                  <num>ii</num>
                  <content>
                    <p>contrary to a condition or restriction specified in the permission;</p>
                  </content>
                </paragraph>
                <paragraph eId="part-3__dvs-3.2__subdvs-3.2.2__sec-3.55__subsec-2__para-b">
                  <num>b</num>
                  <content>
                    <p>a person who imports the chemical must not fail to produce the permission if asked to do so by a Collector;</p>
                  </content>
                </paragraph>
                <paragraph eId="part-3__dvs-3.2__subdvs-3.2.2__sec-3.55__subsec-2__para-c">
                  <num>c</num>
                  <content>
                    <p>for a chemical other than mercury—any condition or restriction specified for the chemical in the relevant item in Schedule 1.</p>
                  </content>

                      <p>Note:	A person who imports such a chemical in contravention of a prescribed condition or restriction may be punished by a fine of up to <quantity refersTo="#penaltyUnit">300 penalty units</quantity> (see subsection 69C(5) of the Act).</p>

                    <p>the APVMA’s written consent to import referred to in subsection 69B(1B) of the Act; and</p>
                  </content>
                </paragraph>
                <paragraph eId="part-3__dvs-3.2__subdvs-3.2.2__sec-3.55__subsec-3__para-b">
                  <num>b</num>
                  <content>
                    <p>any approval to import under any other legislation.</p>
                  </content>
                </paragraph>
              </subsection>
            </section>
            <section eId="part-3__dvs-3.2__subdvs-3.2.2__sec-3.60">
              <num>3.60</num>
              <heading>Applications for permission to import import-prohibited chemicals</heading>
              <subsection eId="part-3__dvs-3.2__subdvs-3.2.2__sec-3.60__subsec-1">
                <num>1</num>
                <content>
                  <p>A person may apply to the Department for permission to import an import-prohibited chemical.</p>
                </content>
              </subsection>
              <subsection eId="part-3__dvs-3.2__subdvs-3.2.2__sec-3.60__subsec-2">
                <num>2</num>
                <content>
                  <p>An application must be in the approved form and must include the following information:</p>
                </content>
                <paragraph eId="part-3__dvs-3.2__subdvs-3.2.2__sec-3.60__subsec-2__para-a">
                  <num>a</num>
                  <content>
                    <p>generic information about the applicant;</p>
                  </content>
                </paragraph>
                <paragraph eId="part-3__dvs-3.2__subdvs-3.2.2__sec-3.60__subsec-2__para-b">
                  <num>b</num>
                  <content>
                    <p>the technical name, common name and CAS number (if known) of the chemical;</p>
                  </content>
                </paragraph>
                <paragraph eId="part-3__dvs-3.2__subdvs-3.2.2__sec-3.60__subsec-2__para-c">
                  <num>c</num>
                  <content>
                    <p>the quantity to be imported;</p>
                  </content>
                </paragraph>
                <paragraph eId="part-3__dvs-3.2__subdvs-3.2.2__sec-3.60__subsec-2__para-d">
                  <num>d</num>
                  <content>
                    <p>the name of the exporting country;</p>
                  </content>
                </paragraph>
                <paragraph eId="part-3__dvs-3.2__subdvs-3.2.2__sec-3.60__subsec-2__para-e">
                  <num>e</num>

                    <p>the intended use in Australia.</p>
                  </content>

              <heading>When permission may be granted</heading>
              <content>
                <p>Permission to import an import-prohibited chemical other than mercury</p>
              </content>
              <subsection eId="part-3__dvs-3.2__subdvs-3.2.2__sec-3.65__subsec-1">
                <num>1</num>
                <content>
                  <p>An authorised officer may grant an application for permission to import an import-prohibited chemical specified in an item in Schedule 1 if the officer is satisfied that:</p>
                </content>
                <paragraph eId="part-3__dvs-3.2__subdvs-3.2.2__sec-3.65__subsec-1__para-a">
                  <num>a</num>
                  <content>
                    <p>in the case of a chemical whose importation is stated in an item in Schedule 1 to be prohibited except with written permission under paragraph 3.65(1)(a)—the chemical is being imported for the purpose of environmentally sound disposal in accordance with paragraph (1)(d) of Article 6 of the Stockholm Convention; or</p>
                  </content>
                </paragraph>
                <paragraph eId="part-3__dvs-3.2__subdvs-3.2.2__sec-3.65__subsec-1__para-b">
                  <num>b</num>
                  <content>
                    <p>in any other case—the chemical is being imported for a use or purpose that is permitted under the relevant Convention.</p>
                  </content>

                    <content>
                      <p>Note:	In deciding whether to grant the application, the officer may take into consideration the matters mentioned in regulation 3.20.</p>
                    </content>
                  </authorialNote>
                  <content>
                    <p>Permission to import an import-prohibited chemical that is mercury</p>
                  </content>
                </paragraph>
              </subsection>
              <subsection eId="part-3__dvs-3.2__subdvs-3.2.2__sec-3.65__subsec-1A">
                <num>1A</num>
                <content>
                  <p>	(1A)	An authorised officer may grant an application for permission to import an import-prohibited chemical that is mercury from a non-party (the <b><i>exporting party</i></b>) to the Minamata Convention only if the officer is satisfied that:</p>
                </content>
                <paragraph eId="part-3__dvs-3.2__subdvs-3.2.2__sec-3.65__subsec-1A__para-a">
                  <num>a</num>
                  <content>
                    <p>either:</p>
                  </content>
                </paragraph>
                <paragraph eId="part-3__dvs-3.2__subdvs-3.2.2__sec-3.65__subsec-1A__para-i">
                  <num>i</num>
                  <content>
                    <p>Australia has provided the exporting party with written consent to the import; or</p>
                  </content>
                </paragraph>
                <paragraph eId="part-3__dvs-3.2__subdvs-3.2.2__sec-3.65__subsec-1A__para-ii">
                  <num>ii</num>
                  <content>
                    <p>a general notification of consent is in force for Australia in accordance with paragraph 7 of Article 3 of the Minamata Convention; and</p>
                  </content>
                </paragraph>
                <paragraph eId="part-3__dvs-3.2__subdvs-3.2.2__sec-3.65__subsec-1A__para-b">
                  <num>b</num>
                  <content>
                    <p>the exporting party has provided written certification that the mercury is neither sourced from primary mercury mining nor excess mercury from the decommissioning of chlor-alkali facilities.</p>
                  </content>
                  <content>
                    <p>Refusal to grant application</p>
                  </content>
                </paragraph>
              </subsection>
              <subsection eId="part-3__dvs-3.2__subdvs-3.2.2__sec-3.65__subsec-2">
                <num>2</num>
                <content>
                  <p>If the officer is not satisfied as to the matters mentioned in subregulation (1) or (1A), the officer must refuse to grant the application.</p>
                </content>
              </subsection>
              <subsection eId="part-3__dvs-3.2__subdvs-3.2.2__sec-3.65__subsec-3">
                <num>3</num>
                <content>
                  <p>To avoid doubt, an authorised officer may refuse to grant an application despite the fact that the applicant has the APVMA’s written consent, referred to in subsection 69B(1B) of the Act, to import the import-prohibited chemical.</p>

                  <p>The manufacture in Australia of a manufacture-prohibited chemical is prohibited unless:</p>
                </content>
                <paragraph eId="part-3__dvs-3.3__subdvs-3.3.2__sec-3.110__subsec-1__para-a">
                  <num>a</num>
                  <content>
                    <p>an authorised officer or <role refersTo="#minister">the Minister</role> has given permission in writing to manufacture the chemical (if such permission is required); and</p>
                  </content>
                </paragraph>
                <paragraph eId="part-3__dvs-3.3__subdvs-3.3.2__sec-3.110__subsec-1__para-b">
                  <num>b</num>
                  <content>
                    <p>any condition or restriction specified in the relevant item in Schedule 1 is satisfied.</p>
                  </content>
                </paragraph>

              <subsection eId="part-3__dvs-3.3__subdvs-3.3.2__sec-3.110__subsec-2">
                <num>2</num>
                <content>
                  <p>For the purposes of subsection 69C(1) of the Act, the following conditions or restrictions are prescribed for each such chemical:</p>

                <paragraph eId="part-3__dvs-3.3__subdvs-3.3.2__sec-3.110__subsec-2__para-a">
                  <num>a</num>
                  <content>
                    <p>a person must not manufacture the chemical:</p>
                  </content>
                </paragraph>
                <paragraph eId="part-3__dvs-3.3__subdvs-3.3.2__sec-3.110__subsec-2__para-i">
                  <num>i</num>
                  <content>
                    <p>without the written permission of an authorised officer or <role refersTo="#minister">the Minister</role> (if such permission is required); or</p>
                  </content>
                </paragraph>
                <paragraph eId="part-3__dvs-3.3__subdvs-3.3.2__sec-3.110__subsec-2__para-ii">
                  <num>ii</num>
                  <content>
                    <p>contrary to a condition or restriction specified in the permission;</p>
                  </content>

                    <p>a person who manufactures the chemical must not fail to produce any required permission if asked to do so by:</p>

                  <content>
                    <p>an authorised officer; or</p>
                  </content>
                </paragraph>

                    <p>an officer of another Agency, or an officer or employee of a State or Territory government, authorised in writing by <role refersTo="#secretary">the Secretary</role> for the purposes of this paragraph;</p>

              <heading>Applications for permission to manufacture manufacture-prohibited chemicals</heading>
              <subsection eId="part-3__dvs-3.3__subdvs-3.3.2__sec-3.115__subsec-1">
                <num>1</num>

                  <p>A person may apply to the Department for permission to manufacture a manufacture-prohibited chemical.</p>
                </content>
              </subsection>
              <subsection eId="part-3__dvs-3.3__subdvs-3.3.2__sec-3.115__subsec-2">
                <num>2</num>
                <content>
                  <p>An application must be in the approved form and must include the following information:</p>
                </content>
                <paragraph eId="part-3__dvs-3.3__subdvs-3.3.2__sec-3.115__subsec-2__para-a">
                  <num>a</num>
                  <content>
                    <p>generic information about the applicant;</p>
                  </content>
                </paragraph>
                <paragraph eId="part-3__dvs-3.3__subdvs-3.3.2__sec-3.115__subsec-2__para-b">
                  <num>b</num>
                  <content>
                    <p>the technical name, common name and CAS number (if known) of the chemical;</p>
                  </content>
                </paragraph>
                <paragraph eId="part-3__dvs-3.3__subdvs-3.3.2__sec-3.115__subsec-2__para-c">
                  <num>c</num>
                  <content>
                    <p>the quantity to be manufactured.</p>
                  </content>

                  <p>An authorised officer may grant an application for permission to manufacture a manufacture-prohibited chemical if:</p>
                </content>
                <paragraph eId="part-3__dvs-3.3__subdvs-3.3.2__sec-3.120__subsec-1__para-a">

                  <content>
                    <p>the manufacture of the chemical is stated in an item in Schedule 1 to be prohibited except with written permission under subregulation 3.120(1); and</p>

                </paragraph>
                <paragraph eId="part-3__dvs-3.3__subdvs-3.3.2__sec-3.120__subsec-1__para-b">
                  <num>b</num>
                  <content>
                    <p>the officer is satisfied that there is in effect for Australia a production-specific exemption for the chemical under Article 4 of the Stockholm Convention.</p>
                  </content>
                </paragraph>
              </subsection>
              <subsection eId="part-3__dvs-3.3__subdvs-3.3.2__sec-3.120__subsec-2">
                <num>2</num>
                <content>
                  <p>An authorised officer may grant an application for permission to manufacture a manufacture-prohibited chemical if:</p>
                </content>
                <paragraph eId="part-3__dvs-3.3__subdvs-3.3.2__sec-3.120__subsec-2__para-a">
                  <num>a</num>
                  <content>
                    <p>the manufacture of the chemical is stated in an item in Schedule 1 to be prohibited except with written permission under subregulation 3.120(2); and</p>
                  </content>
                </paragraph>
                <paragraph eId="part-3__dvs-3.3__subdvs-3.3.2__sec-3.120__subsec-2__para-b">
                  <num>b</num>
                  <content>
                    <p>the officer is satisfied that, in accordance with paragraph 9 of Article 10 of the Rotterdam Convention, the chemical to be manufactured is to be exported and not used in Australia.</p>
                  </content>
                </paragraph>
              </subsection>
              <subsection eId="part-3__dvs-3.3__subdvs-3.3.2__sec-3.120__subsec-3">
                <num>3</num>
                <content>
                  <p>An authorised officer may grant an application for permission to manufacture a manufacture-prohibited chemical if:</p>
                </content>
                <paragraph eId="part-3__dvs-3.3__subdvs-3.3.2__sec-3.120__subsec-3__para-a">
                  <num>a</num>
                  <content>
                    <p>neither subregulation (1) nor (2) applies; and</p>
                  </content>
                </paragraph>
                <paragraph eId="part-3__dvs-3.3__subdvs-3.3.2__sec-3.120__subsec-3__para-b">
                  <num>b</num>
                  <content>
                    <p>the chemical is to be manufactured for a use or purpose that is permitted under the relevant Convention.</p>
                  </content>

            <heading>Prohibition subject to conditions</heading>

                <p>This regulation applies to a controlled chemical if:</p>

              <paragraph eId="part-3__dvs-3.4__sec-3.150__subsec-1__para-a">

                  <p>the relevant item in Schedule 1 identifies the relevant international agreement or arrangement as the Stockholm Convention; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3.4__sec-3.150__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>that item states that use is prohibited unless paragraphs 3.150(2)(a) to (d) are complied with.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-3.4__sec-3.150__subsec-2">
              <num>2</num>
              <content>
                <p>The use in Australia of a controlled chemical to which this regulation applies is prohibited unless:</p>
              </content>
              <paragraph eId="part-3__dvs-3.4__sec-3.150__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>the chemical is an approved active constituent or a registered chemical product; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3.4__sec-3.150__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>the use is in accordance with the instructions for its use that the APVMA has approved; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3.4__sec-3.150__subsec-2__para-c">
                <num>c</num>
                <content>
                  <p>the use is in accordance with a use-specific exemption that is in effect for Australia under Article 4 of the Stockholm Convention; and</p>
                </content>
              </paragraph>

                <num>d</num>
                <content>
                  <p>the use is permitted under the law of the State or Territory in which the chemical is to be used.</p>

          <heading>Dealing with chemicals</heading>

            </section>
            <section eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.210">
              <num>3.210</num>
              <heading>Prohibition</heading>
              <subsection eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.210__subsec-1">
                <num>1</num>
                <content>
                  <p>The export from Australia of an export-prohibited chemical is prohibited unless:</p>
                </content>
                <paragraph eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.210__subsec-1__para-a">
                  <num>a</num>
                  <content>
                    <p>an authorised officer or <role refersTo="#minister">the Minister</role> has given permission in writing to export the chemical; and</p>
                  </content>
                </paragraph>
                <paragraph eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.210__subsec-1__para-b">
                  <num>b</num>
                  <content>
                    <p>the permission is produced to a Collector; and</p>
                  </content>
                </paragraph>
                <paragraph eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.210__subsec-1__para-c">
                  <num>c</num>
                  <content>
                    <p>for a chemical that is listed in Schedule 1—any condition or restriction specified for the chemical in the relevant item in Schedule 1 is satisfied.</p>
                  </content>

                      <p>Note 1:	The permission to export required under this regulation must be produced to a Collector for the purposes of complying with regulation 4A of the<i> Customs (Prohibited Exports) </i><i>Regulations 1</i><i>958</i> in relation to the exportation of chemicals under those Regulations that are active constituents or chemical products.</p>

              </subsection>
              <subsection eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.210__subsec-2">
                <num>2</num>
                <content>
                  <p>For the purposes of subsection 69C(1) of the Act, the following conditions or restrictions are prescribed for each such chemical:</p>
                </content>
                <paragraph eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.210__subsec-2__para-a">
                  <num>a</num>
                  <content>
                    <p>a person must not export the chemical:</p>
                  </content>
                </paragraph>
                <paragraph eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.210__subsec-2__para-i">
                  <num>i</num>
                  <content>
                    <p>without the written permission of an authorised officer or <role refersTo="#minister">the Minister</role>; or</p>
                  </content>
                </paragraph>
                <paragraph eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.210__subsec-2__para-ii">
                  <num>ii</num>
                  <content>
                    <p>contrary to a condition or restriction specified in the permission;</p>
                  </content>
                </paragraph>
                <paragraph eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.210__subsec-2__para-b">
                  <num>b</num>
                  <content>
                    <p>a person who exports the chemical must not fail to produce the permission if asked to do so by a Collector;</p>
                  </content>
                </paragraph>
                <paragraph eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.210__subsec-2__para-c">
                  <num>c</num>
                  <content>
                    <p>for a chemical other than mercury—any condition or restriction specified for the chemical in the relevant item in Schedule 1.</p>
                  </content>

                    <content>
                      <p>Note:	A person who exports such a chemical in contravention of a prescribed condition or restriction may be punished by a fine of up to <quantity refersTo="#penaltyUnit">300 penalty units</quantity> (see subsection 69C(5) of the Act).</p>

                </paragraph>
              </subsection>
              <subsection eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.210__subsec-3">
                <num>3</num>
                <content>
                  <p>This regulation applies despite:</p>
                </content>
                <paragraph eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.210__subsec-3__para-a">
                  <num>a</num>
                  <content>
                    <p>the APVMA’s certificate setting out its findings (if any) in relation to the export of a chemical product under <ref href="#sec-69D">section 69D</ref> of the Act; and</p>
                  </content>
                </paragraph>
                <paragraph eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.210__subsec-3__para-b">
                  <num>b</num>
                  <content>
                    <p>any approval to export under any other legislation.</p>
                  </content>
                </paragraph>
              </subsection>
            </section>
            <section eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.215">
              <num>3.215</num>
              <heading>Applications for permission to export export-prohibited chemicals</heading>
              <subsection eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.215__subsec-1">
                <num>1</num>
                <content>
                  <p>A person may apply to the Department for permission to export an export-prohibited chemical.</p>
                </content>
              </subsection>
              <subsection eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.215__subsec-2">
                <num>2</num>
                <content>
                  <p>An application must be in the approved form and must include the following information:</p>
                </content>
                <paragraph eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.215__subsec-2__para-a">
                  <num>a</num>
                  <content>
                    <p>generic information about the applicant;</p>
                  </content>
                </paragraph>
                <paragraph eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.215__subsec-2__para-b">
                  <num>b</num>
                  <content>
                    <p>the technical name, common name and CAS number (if known) of the chemical;</p>
                  </content>
                </paragraph>
                <paragraph eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.215__subsec-2__para-c">
                  <num>c</num>
                  <content>
                    <p>the quantity to be exported;</p>
                  </content>
                </paragraph>
                <paragraph eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.215__subsec-2__para-d">
                  <num>d</num>
                  <content>
                    <p>the name of the importing country;</p>
                  </content>
                </paragraph>
                <paragraph eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.215__subsec-2__para-e">
                  <num>e</num>
                  <content>
                    <p>the name of any transit country (if known);</p>
                  </content>
                </paragraph>
                <paragraph eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.215__subsec-2__para-f">
                  <num>f</num>
                  <content>
                    <p>the intended use in the importing country.</p>
                  </content>

              </subsection>
            </section>
            <section eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.220">
              <num>3.220</num>
              <heading>Additional information required for certain exports</heading>
              <subsection eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.220__subsec-1">
                <num>1</num>
                <content>
                  <p>This regulation applies to an export-prohibited chemical if the relevant item in Schedule 1 states that the chemical is subject to a notification of final regulatory action by Australia under Article 5 of the Rotterdam Convention.</p>
                </content>
              </subsection>
              <subsection eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.220__subsec-2">
                <num>2</num>
                <content>
                  <p>An application for permission to export a chemical to which this regulation applies must, in addition to the information required under regulation 3.215, include the following information:</p>
                </content>
                <paragraph eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.220__subsec-2__para-a">
                  <num>a</num>
                  <content>
                    <p>expected date of export;</p>
                  </content>
                </paragraph>
                <paragraph eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.220__subsec-2__para-b">
                  <num>b</num>
                  <content>
                    <p>category (pesticide or industrial use) under which the chemical is being exported;</p>
                  </content>
                </paragraph>
                <paragraph eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.220__subsec-2__para-c">
                  <num>c</num>
                  <content>
                    <p>the name and address of the importer;</p>
                  </content>
                </paragraph>
                <paragraph eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.220__subsec-2__para-d">
                  <num>d</num>
                  <content>
                    <p>precautionary measures to reduce exposure to, and emission of, the chemical;</p>
                  </content>
                </paragraph>
                <paragraph eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.220__subsec-2__para-e">
                  <num>e</num>
                  <content>
                    <p>in the case of a mixture or preparation, the concentration of the prescribed active constituent or constituents.</p>
                  </content>

                      <p><i>Note  </i>The above information forms part of the export notification required under Article 12 of the Rotterdam Convention.</p>

                  </authorialNote>
                </paragraph>
              </subsection>
            </section>
            <section eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.225">
              <num>3.225</num>
              <heading>When permission must be granted</heading>
              <subsection eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.225__subsec-1">
                <num>1</num>
                <content>
                  <p>An authorised officer must grant an application for permission to export an export-prohibited chemical if:</p>
                </content>
                <paragraph eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.225__subsec-1__para-a">
                  <num>a</num>
                  <content>
                    <p>the relevant item in Schedule 1 identifies the relevant international agreement or arrangement as the Rotterdam Convention; and</p>
                  </content>
                </paragraph>
                <paragraph eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.225__subsec-1__para-b">
                  <num>b</num>
                  <content>
                    <p>the export is to a non-party to that Convention.</p>
                  </content>
                </paragraph>
              </subsection>
              <subsection eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.225__subsec-2">
                <num>2</num>
                <content>
                  <p>An authorised officer must grant an application for permission to export research mercury if the export is to a non-party to the Rotterdam Convention.</p>
                </content>
              </subsection>
            </section>
            <section eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.230">
              <num>3.230</num>
              <heading>When permission may be granted</heading>
              <content>
                <p>Export-prohibited chemicals specified in Schedule 1—Stockholm Convention</p>
              </content>
              <subsection eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.230__subsec-1">
                <num>1</num>
                <content>
                  <p>An authorised officer may grant an application for permission to export an export-prohibited chemical whose export is stated in an item in Schedule 1 to be prohibited except with written permission under paragraph 3.230(1)(a), (b) or (c) if the officer is satisfied that the export is:</p>
                </content>
                <paragraph eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.230__subsec-1__para-a">
                  <num>a</num>
                  <content>
                    <p>for the purpose of environmentally sound disposal in accordance with paragraph (1)(d) of Article 6 of the Stockholm Convention; or</p>
                  </content>
                </paragraph>
                <paragraph eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.230__subsec-1__para-b">
                  <num>b</num>
                  <content>
                    <p>to a party that is permitted to use the chemical under Annex A or B of the Stockholm Convention; or</p>
                  </content>
                </paragraph>
                <paragraph eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.230__subsec-1__para-c">
                  <num>c</num>
                  <content>
                    <p>to a State not Party to the Stockholm Convention (within the meaning of paragraph 2 of Article 3 of that Convention) that has provided an annual certification to Australia in accordance with that paragraph.</p>
                  </content>
                  <authorialNote placement="end" eId="note-28" marker="28">
                    <content>
                      <p>Note 1:	The export of an active constituent or chemical product for the purpose of environmentally sound disposal must also comply with the <i>Hazardous Waste (Regulation of Exports and Imports) Act 1989</i> and any regulations made under that Act.</p>
                    </content>
                  </authorialNote>
                  <authorialNote placement="end" eId="note-29" marker="29">
                    <content>
                      <p>Note 2:	Under paragraph 2(b)(iii) of Article 3 of the Stockholm Convention, the annual certification of a non-party must:</p>
                    </content>
                  </authorialNote>
                </paragraph>
                <paragraph eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.230__subsec-1__para-a">
                  <num>a</num>
                  <content>
                    <p>specify the intended use of the chemical; and</p>
                  </content>
                </paragraph>
                <paragraph eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.230__subsec-1__para-b">
                  <num>b</num>
                  <content>
                    <p>include a statement that, with respect to that chemical, the importing State is committed to:</p>
                  </content>
                </paragraph>
                <paragraph eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.230__subsec-1__para-i">
                  <num>i</num>
                  <content>
                    <p>protect human health and the environment by taking the necessary measures to minimize or prevent releases;</p>
                  </content>
                </paragraph>
                <paragraph eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.230__subsec-1__para-ii">
                  <num>ii</num>
                  <content>
                    <p>comply with the provisions of paragraph 1 of Article 6; and</p>
                  </content>
                </paragraph>
                <paragraph eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.230__subsec-1__para-iii">
                  <num>iii</num>
                  <content>
                    <p>comply, where appropriate, with the provisions of paragraph 2 of <ref href="#part-II">Part II</ref> of Annex B; and</p>
                  </content>
                </paragraph>
                <paragraph eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.230__subsec-1__para-c">
                  <num>c</num>
                  <content>
                    <p>include any appropriate supporting documentation, such as legislation, regulatory instruments, or administrative or policy guidelines.</p>
                  </content>
                  <authorialNote placement="end" eId="note-30" marker="30">
                    <content>
                      <p>Note 3:	Paragraph 2(d) of Article 3 of the Stockholm Convention states:</p>
                    </content>
                  </authorialNote>
                  <content>
                    <p>‘For the purposes of this paragraph, the term “State not Party to this Convention” shall include with respect to a particular chemical, a State or regional economic integration organization that has not agreed to be bound by the Convention with respect to that chemical.’.</p>
                    <p>Export-prohibited chemicals specified in Schedule 1—Rotterdam Convention</p>
                  </content>
                </paragraph>
              </subsection>
              <subsection eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.230__subsec-2">
                <num>2</num>
                <content>
                  <p>An authorised officer may grant an application for permission to export an export-prohibited chemical if:</p>
                </content>
                <paragraph eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.230__subsec-2__para-a">
                  <num>a</num>
                  <content>
                    <p>the relevant item in Schedule 1 identifies the relevant international agreement or arrangement as the Rotterdam Convention; and</p>
                  </content>
                </paragraph>
                <paragraph eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.230__subsec-2__para-b">
                  <num>b</num>
                  <content>
                    <p>the export is to a party to that Convention; and</p>
                  </content>
                </paragraph>
                <paragraph eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.230__subsec-2__para-c">
                  <num>c</num>
                  <content>
                    <p>the officer is satisfied that the export complies with the requirements of that Convention.</p>
                  </content>
                  <content>
                    <p>Export of export-prohibited chemical that is mercury to a Party to the Minamata Convention</p>
                  </content>
                </paragraph>
              </subsection>
              <subsection eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.230__subsec-2A">
                <num>2A</num>
                <content>
                  <p>	(2A)	An authorised officer may grant an application for permission to export an export-prohibited chemical that is mercury to a Party (the <b><i>importing Party</i></b>) to the Minamata Convention if the authorised officer is satisfied that:</p>
                </content>
                <paragraph eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.230__subsec-2A__para-a">
                  <num>a</num>
                  <content>
                    <p>the importing Party has provided its written consent to the export; and</p>
                  </content>
                </paragraph>
                <paragraph eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.230__subsec-2A__para-b">
                  <num>b</num>
                  <content>
                    <p>the mercury is to be exported:</p>
                  </content>
                </paragraph>
                <paragraph eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.230__subsec-2A__para-i">
                  <num>i</num>
                  <content>
                    <p>for a use allowed to the importing Party under the Minamata Convention; or</p>
                  </content>
                </paragraph>
                <paragraph eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.230__subsec-2A__para-ii">
                  <num>ii</num>
                  <content>
                    <p>for environmentally sound interim storage as set out in Article 10 of the Minamata Convention.</p>
                  </content>
                  <content>
                    <p>Export of export-prohibited chemical that is mercury to a non-party to the Minamata Convention</p>
                  </content>
                </paragraph>
              </subsection>
              <subsection eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.230__subsec-2B">
                <num>2B</num>
                <content>
                  <p>	(2B)	An authorised officer may grant an application for permission to export an export-prohibited chemical that is mercury to a non-party (the <b><i>importing party</i></b>) to the Minamata Convention if the authorised officer is satisfied that the importing party has provided:</p>
                </content>
                <paragraph eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.230__subsec-2B__para-a">
                  <num>a</num>
                  <content>
                    <p>its written consent to the export; and</p>
                  </content>
                </paragraph>
                <paragraph eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.230__subsec-2B__para-b">
                  <num>b</num>
                  <content>
                    <p>its written certification demonstrating that:</p>
                  </content>
                </paragraph>
                <paragraph eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.230__subsec-2B__para-i">
                  <num>i</num>
                  <content>
                    <p>it has measures in place to ensure the protection of human health and the environment; and</p>
                  </content>
                </paragraph>
                <paragraph eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.230__subsec-2B__para-ii">
                  <num>ii</num>
                  <content>
                    <p>it has measures in place to ensure compliance with Articles 10 and 11 of the Minamata Convention; and</p>
                  </content>
                </paragraph>
                <paragraph eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.230__subsec-2B__para-iii">
                  <num>iii</num>
                  <content>
                    <p>the mercury will be used only for a use allowed under the Minamata Convention to a Party to the Minamata Convention or for environmentally sound interim storage as set out in Article 10 of the Minamata Convention.</p>
                  </content>
                  <content>
                    <p>Export of export-prohibited chemical that is research mercury</p>
                  </content>
                </paragraph>
              </subsection>
              <subsection eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.230__subsec-2C">
                <num>2C</num>
                <content>
                  <p>An authorised officer may grant an application for permission to export an export-prohibited chemical that is research mercury if:</p>
                </content>
                <paragraph eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.230__subsec-2C__para-a">
                  <num>a</num>
                  <content>
                    <p>the export is to a Party to the Rotterdam Convention; and</p>
                  </content>
                </paragraph>
                <paragraph eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.230__subsec-2C__para-b">
                  <num>b</num>
                  <content>
                    <p>the authorised officer is satisfied that the export complies with the requirements of that Convention.</p>
                  </content>
                  <content>
                    <p>Export of other export-prohibited chemicals</p>
                  </content>
                </paragraph>
              </subsection>
              <subsection eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.230__subsec-3">
                <num>3</num>
                <content>
                  <p>An authorised officer may grant an application for permission to export an export-prohibited chemical if:</p>
                </content>
                <paragraph eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.230__subsec-3__para-a">
                  <num>a</num>
                  <content>
                    <p>none of subregulations (1) to (2C) apply; and</p>
                  </content>
                </paragraph>
                <paragraph eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.230__subsec-3__para-b">
                  <num>b</num>
                  <content>
                    <p>the chemical is being exported for a use or purpose in the importing country that is permitted under the relevant Convention.</p>
                  </content>
                  <authorialNote placement="end" eId="note-31" marker="31">
                    <content>
                      <p>Note:	In deciding whether to grant the application, the officer may take into consideration the matters mentioned in regulation 3.20.</p>
                    </content>
                  </authorialNote>
                  <content>
                    <p>Refusal to grant application</p>
                  </content>
                </paragraph>
              </subsection>
              <subsection eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.230__subsec-4">
                <num>4</num>
                <content>
                  <p>To avoid doubt, an authorised officer may refuse to grant an application despite the fact that the APVMA has given a certificate setting out its findings (if any) in relation to the export of the chemical product under <ref href="#sec-69D">section 69D</ref> of the Act.</p>
                </content>
              </subsection>
            </section>
            <section eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.235">
              <num>3.235</num>
              <heading>Required conditions</heading>
              <subsection eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.235__subsec-1">
                <num>1</num>
                <content>
                  <p>This regulation applies to the export of an export-prohibited chemical if:</p>
                </content>
                <paragraph eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.235__subsec-1__para-a">
                  <num>a</num>
                  <content>
                    <p>either:</p>
                  </content>
                </paragraph>
                <paragraph eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.235__subsec-1__para-i">
                  <num>i</num>
                  <content>
                    <p>the relevant item in Schedule 1 identifies the relevant international agreement or arrangement as the Rotterdam Convention; or</p>
                  </content>
                </paragraph>
                <paragraph eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.235__subsec-1__para-ii">
                  <num>ii</num>
                  <content>
                    <p>the chemical is research mercury; and</p>

                    <p>include the Harmonized System customs code for the chemical (if assigned) on shipping documentation; and</p>
                  </content>
                </paragraph>
                <paragraph eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.235__subsec-2__para-b">
                  <num>b</num>
                  <content>
                    <p>ensure that the labelling of the chemical complies with relevant international standards (including standards requiring information regarding risks and hazards to human health and the environment); and</p>
                  </content>
                </paragraph>
                <paragraph eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.235__subsec-2__para-c">
                  <num>c</num>
                  <content>
                    <p>if the chemical is to be used for occupational purposes, give to the importer a safety data sheet that:</p>
                  </content>
                </paragraph>
                <paragraph eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.235__subsec-2__para-i">
                  <num>i</num>
                  <content>
                    <p>is in accordance with an internationally recognised format; and</p>
                  </content>
                </paragraph>
                <paragraph eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.235__subsec-2__para-ii">
                  <num>ii</num>
                  <content>
                    <p>sets out up-to-date information; and</p>
                  </content>
                </paragraph>
                <paragraph eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.235__subsec-2__para-iii">
                  <num>iii</num>
                  <content>
                    <p>if practicable, is in one of the official languages of the country to which the chemical is to be exported; and</p>
                  </content>
                </paragraph>
                <paragraph eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.235__subsec-2__para-d">
                  <num>d</num>
                  <content>
                    <p>give to the Department, on or before 28 February following each calendar year, a statement of the total quantity of the chemical exported in the calendar year, naming each importing country and specifying how much of the chemical was exported to each importing country.</p>
                  </content>
                </paragraph>
              </subsection>
            </section>
            <section eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.240">
              <num>3.240</num>
              <heading>Deciding application for permission to export when import decision available</heading>
              <subsection eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.240__subsec-1">
                <num>1</num>
                <content>
                  <p>This regulation applies to the export of an export-prohibited chemical if:</p>
                </content>
                <paragraph eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.240__subsec-1__para-a">
                  <num>a</num>
                  <content>
                    <p>the relevant item in Schedule 1 identifies the relevant international agreement or arrangement as the Rotterdam Convention; or</p>
                  </content>
                </paragraph>
                <paragraph eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.240__subsec-1__para-b">
                  <num>b</num>
                  <content>
                    <p>the chemical is research mercury.</p>
                  </content>
                </paragraph>
              </subsection>
              <subsection eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.240__subsec-2">
                <num>2</num>
                <content>
                  <p>In making a decision whether to grant an application for permission to export the chemical to a party to the Convention, an authorised officer must take into consideration:</p>
                </content>
                <paragraph eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.240__subsec-2__para-a">
                  <num>a</num>
                  <content>
                    <p>any import decision notified to the Secretariat by the party; and</p>
                  </content>
                </paragraph>
                <paragraph eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.240__subsec-2__para-b">
                  <num>b</num>
                  <content>
                    <p>if the chemical is described in the relevant item in Schedule 1 as a severely hazardous pesticide formulation, any applicable condition or restriction specified in that item; and</p>
                  </content>
                </paragraph>
                <paragraph eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.240__subsec-2__para-c">
                  <num>c</num>
                  <content>
                    <p>whether the applicant has provided any additional information required under regulation 3.220.</p>

              <num>3.245</num>
              <heading>Deciding application for permission to export when import decision not known</heading>
              <subsection eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.245__subsec-1">
                <num>1</num>
                <content>
                  <p>This regulation applies to the export of an export-prohibited chemical if:</p>
                </content>
                <paragraph eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.245__subsec-1__para-a">
                  <num>a</num>
                  <content>
                    <p>either:</p>
                  </content>
                </paragraph>
                <paragraph eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.245__subsec-1__para-i">
                  <num>i</num>
                  <content>
                    <p>the relevant item in Schedule 1 identifies the relevant international agreement or arrangement as the Rotterdam Convention; or</p>
                  </content>
                </paragraph>
                <paragraph eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.245__subsec-1__para-ii">
                  <num>ii</num>
                  <content>
                    <p>the chemical is research mercury; and</p>
                  </content>
                </paragraph>
                <paragraph eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.245__subsec-1__para-b">

                  <content>
                    <p>the export is to a party to that Convention; and</p>
                  </content>
                </paragraph>

                    <p>the party’s import decision is not known.</p>
                  </content>
                </paragraph>
              </subsection>
              <subsection eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.245__subsec-2">
                <num>2</num>
                <content>
                  <p>An authorised officer must not grant an application for permission to export the chemical, unless he or she is satisfied that the export will not be in breach of Australia’s obligations under Article 11 of the Rotterdam Convention.</p>
                </content>

                    <p>the party transmitted an import response stating that a final import decision is under consideration or requesting more information or assistance in making its decision (see paragraph 4 (b) of Article 10 of the Rotterdam Convention).</p>

                </paragraph>
              </subsection>
            </section>
            <section eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.250">
              <num>3.250</num>
              <heading>When permission must be refused</heading>
              <subsection eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.250__subsec-1">
                <num>1</num>
                <content>
                  <p>An authorised officer must refuse to grant an application mentioned in any of subregulations 3.230(1) to (3) for permission to export an export-prohibited chemical if the officer is not satisfied as to the matters mentioned in the relevant subregulation in relation to the application.</p>
                </content>
              </subsection>
              <subsection eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.250__subsec-2">
                <num>2</num>
                <content>
                  <p><b><i>	</i></b>(2)	An authorised officer must refuse an application for permission to export an export-prohibited chemical if:</p>
                </content>
                <paragraph eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.250__subsec-2__para-a">
                  <num>a</num>
                  <content>
                    <p>either:</p>
                  </content>
                </paragraph>
                <paragraph eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.250__subsec-2__para-i">
                  <num>i</num>
                  <content>
                    <p>the relevant item in Schedule 1 identifies the relevant international agreement or arrangement as the Rotterdam Convention; or</p>
                  </content>
                </paragraph>
                <paragraph eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.250__subsec-2__para-ii">
                  <num>ii</num>
                  <content>
                    <p>the chemical is research mercury; and</p>
                  </content>
                </paragraph>

                  <num>b</num>
                  <content>
                    <p>the export is to a party to that Convention; and</p>
                  </content>
                </paragraph>
                <paragraph eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.250__subsec-2__para-c">
                  <num>c</num>
                  <content>
                    <p>any of the following applies:</p>
                  </content>
                </paragraph>
                <paragraph eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.250__subsec-2__para-i">
                  <num>i</num>
                  <content>
                    <p>the officer is not satisfied that the export complies with the Rotterdam Convention;</p>
                  </content>
                </paragraph>
                <paragraph eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.250__subsec-2__para-ii">
                  <num>ii</num>
                  <content>
                    <p>the party has notified to the Secretariat an import decision not to consent to the import;</p>
                  </content>
                </paragraph>
                <paragraph eId="part-3__dvs-3.6__subdvs-3.6.2__sec-3.250__subsec-2__para-iii">
                  <num>iii</num>
                  <content>
                    <p>the party has notified to the Secretariat an import decision to consent to the import only subject to specified conditions and the authorised officer is not satisfied that those conditions have been met or will be met.</p>

                    <p>neither subregulation (1) nor (2) applies; and</p>
                  </content>
                </paragraph>

                    <p>the chemical is being exported for a use or purpose in the importing country that is not permitted under the relevant Convention.</p>

        </division>

          <num>3.7</num>
          <heading>Multiple entry import and multiple exit export permits</heading>
          <section eId="part-3__dvs-3.7__sec-3.305">
            <num>3.305</num>
            <heading>Definitions</heading>
            <content>
              <p>In this Division:</p>
              <p><term refersTo="#term-export-prohibited-chemical">export-prohibited chemical</term> means <def>a controlled chemical (other than mercury), and includes research mercury.</def></p>
              <p><term refersTo="#term-import-prohibited-chemical">import-prohibited chemical</term> means <def>a controlled chemical (other than mercury) to which Subdivision 3.2.2 applies.</def></p>
            </content>
          </section>
          <section eId="part-3__dvs-3.7__sec-3.310">
            <num>3.310</num>
            <heading>Purpose</heading>
            <subsection eId="part-3__dvs-3.7__sec-3.310__subsec-1">
              <num>1</num>
              <content>
                <p>	(1)	The purpose of this Division is to allow persons who from time to time import import-prohibited chemicals, or export export-prohibited chemicals, to apply for a permission to import (<b><i>multiple entry import permit</i></b>) or export (<b><i>multiple exit export permit</i></b>) those chemicals over a period of time, instead of having to apply for a permission for each import or export.</p>

            </subsection>
            <subsection eId="part-3__dvs-3.7__sec-3.310__subsec-2">
              <num>2</num>
              <content>
                <p>A multiple entry import permit is a permission for the purposes of regulation 3.55.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-3.7__sec-3.310__subsec-3">

              <content>
                <p>A multiple exit export permit is a permission for the purposes of regulation 3.210.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-3__dvs-3.7__sec-3.315">
            <num>3.315</num>
            <heading>Fit and proper person</heading>
            <subsection eId="part-3__dvs-3.7__sec-3.315__subsec-1">
              <num>1</num>
              <content>
                <p>For the purposes of regulation 3.340, an authorised officer must have regard to the following matters in determining whether a person is a fit and proper person:</p>
              </content>
              <paragraph eId="part-3__dvs-3.7__sec-3.315__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>any conviction of the applicant for an offence against the Act or these Regulations;</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3.7__sec-3.315__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>if the applicant is an individual:</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3.7__sec-3.315__subsec-1__para-i">
                <num>i</num>
                <content>
                  <p>any conviction of the applicant for an offence under a law of the Commonwealth, of a State or of a Territory that is punishable by imprisonment for a period of one year or longer; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3.7__sec-3.315__subsec-1__para-ii">
                <num>ii</num>
                <content>
                  <p>whether the applicant is bankrupt;</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3.7__sec-3.315__subsec-1__para-c">
                <num>c</num>
                <content>
                  <p>if the applicant is a corporation:</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3.7__sec-3.315__subsec-1__para-i">
                <num>i</num>
                <content>
                  <p>any conviction of the applicant for an offence under a law of the Commonwealth, of a State or of a Territory that is punishable by a fine of <quantity refersTo="#penaltyUnit">50 penalty units</quantity> or more, being an offence committed at a time when a person who is a director, officer or shareholder of the company was a director, officer or shareholder of the company; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3.7__sec-3.315__subsec-1__para-ii">
                <num>ii</num>

                  <p>	(ii)	whether the applicant is a Chapter 5 body corporate (within the meaning of the <i>Corporations Act 2001</i>);</p>

                <content>
                  <p>whether the applicant has previously held a multiple permit or a permission under this Part;</p>
                </content>
              </paragraph>

                <num>e</num>
                <content>
                  <p>whether the applicant complied with any conditions or restrictions specified in the permit or permission.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-3.7__sec-3.315__subsec-2">

              <content>
                <p>To avoid doubt, the matters mentioned in subregulation (1) are in addition to:</p>
              </content>
              <paragraph eId="part-3__dvs-3.7__sec-3.315__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>any matters that an authorised officer is required to take into consideration under a provision of this Division; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3.7__sec-3.315__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>any other matters that are relevant.</p>
                </content>
              </paragraph>
            </subsection>

                  <p>the relevant item in Schedule 1 identifies the relevant international agreement or arrangement as the Rotterdam Convention; and</p>

              <paragraph eId="part-3__dvs-3.7__sec-3.330__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>either:</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3.7__sec-3.330__subsec-1__para-i">

                  <p>the export is to a non-party to that Convention; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3.7__sec-3.330__subsec-1__para-ii">

                  <p>the chemical to be exported is a severely hazardous pesticide formulation that is of a form different from, or is of a concentration lower than, the relevant formulation given in Schedule 1.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-3.7__sec-3.330__subsec-2">
              <num>2</num>
              <content>
                <p>A person may apply to the Department for a multiple exit export permit.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-3.7__sec-3.330__subsec-3">
              <num>3</num>
              <content>
                <p>An application must be in the approved form and must include generic information about the applicant and the following information in respect of each export-prohibited chemical to be exported under the permit:</p>
              </content>
              <paragraph eId="part-3__dvs-3.7__sec-3.330__subsec-3__para-a">
                <num>a</num>
                <content>
                  <p>the technical name, common name and CAS number (if known) of each chemical;</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3.7__sec-3.330__subsec-3__para-b">
                <num>b</num>
                <content>
                  <p>the non-parties to which exports are to be made (if applicable);</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3.7__sec-3.330__subsec-3__para-c">
                <num>c</num>
                <content>
                  <p>the formulation to be exported (if applicable);</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3.7__sec-3.330__subsec-3__para-d">
                <num>d</num>
                <content>
                  <p>the quantity of chemical to be exported under the permit or, if that quantity is not known, an estimate of the quantity to be exported.</p>
                </content>
              </paragraph>
            </subsection>
          </section>
          <section eId="part-3__dvs-3.7__sec-3.335">
            <num>3.335</num>
            <heading>When multiple exit export permits may be granted—general</heading>
            <subsection eId="part-3__dvs-3.7__sec-3.335__subsec-1">
              <num>1</num>
              <content>
                <p>An authorised officer may grant an application for a multiple exit export permit if the officer is satisfied that the exports to be made under the permit comply with the requirements of the Rotterdam Convention.</p>

            </subsection>

              <content>
                <p>An authorised officer must refuse to grant an application if:</p>
              </content>
              <paragraph eId="part-3__dvs-3.7__sec-3.335__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>the officer is not satisfied as to the matter mentioned in subregulation (1); or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3.7__sec-3.335__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>the applicant has at any time failed to comply with any condition or restriction specified in a permission or permit.</p>
                </content>
              </paragraph>
            </subsection>
          </section>
          <section eId="part-3__dvs-3.7__sec-3.340">
            <num>3.340</num>
            <heading>Grant of multiple exit export permits in special circumstances</heading>
            <content>
              <p>Despite any thing else in this Division, an authorised officer may grant a multiple exit export permit to a person if the authorised officer is satisfied that:</p>
            </content>
            <paragraph eId="part-3__dvs-3.7__sec-3.340__para-a">
              <num>a</num>
              <content>
                <p>the relevant items in Schedule 1 for the export-prohibited chemicals to be exported under the permit identify the relevant international agreement or arrangement as the Rotterdam Convention; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__dvs-3.7__sec-3.340__para-b">
              <num>b</num>
              <content>
                <p>the person has, over an aggregate period of at least 1 year, exported export-prohibited chemicals; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__dvs-3.7__sec-3.340__para-c">
              <num>c</num>
              <content>
                <p>the person has complied with the requirements of the Act and these Regulations in relation to those exports; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__dvs-3.7__sec-3.340__para-d">
              <num>d</num>
              <content>
                <p>the person is a fit and proper person.</p>
              </content>

            <num>3.345</num>
            <heading>Annual reports</heading>
            <subsection eId="part-3__dvs-3.7__sec-3.345__subsec-1">
              <num>1</num>
              <content>
                <p>The holder of a multiple permit must give to the Department an annual report about imports or exports made under the permit.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-3.7__sec-3.345__subsec-2">
              <num>2</num>
              <content>
                <p>The report:</p>
              </content>
              <paragraph eId="part-3__dvs-3.7__sec-3.345__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>must state the name of the holder, the identification number and date of issue, of the permit; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3.7__sec-3.345__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>must include the following information in respect of the chemicals imported or exported under the permit:</p>
                </content>

                <p>A multiple permit is valid until the end of 31 March next occurring after the permit is granted.</p>

                <p>An application for renewal of a permit may be made in writing by the holder of the permit not more than 60 days before the day on which the permit ceases to be valid under subregulation (1).</p>

              <p>A permission or multiple permit granted under this Part may specify conditions or restrictions to be complied with by the holder and may, in respect of any such condition or restriction, specify a time (being a time before or after the act permitted) at or before which the holder must comply with the condition or restriction.</p>

            <heading>Revocation etc of permission or multiple permits</heading>

                <p>An authorised officer may revoke, vary or suspend a permission or multiple permit granted under this Part.</p>

            </subsection>

                <p>The authorised officer must give to the holder of a permission or permit written notice of the revocation, variation or suspension of the permission or permit <quantity refersTo="#deadline">within 10 days</quantity> after doing so.</p>

                  <p>an authorised officer’s decision to refuse to grant a permission or permit;</p>
                </content>

                  <p>an authorised officer’s decision to revoke, vary or suspend a permission or permit.</p>

            <heading>Export of chemical products—fees for certificates</heading>

                <p>Subject to subregulation (2), the following fees are prescribed for subsection 69D(1) of the Act:</p>

                  <p>$125 as the standard fee for a certificate;</p>
                </content>
              </paragraph>

                  <p>if the certificate requires technical or scientific assessment to be undertaken by the APVMA, a further $105 for the assessment.</p>

                <p>	(2)	No fee is payable for a certificate (the <b><i>subsequent certificate</i></b>) if an applicant applies for the subsequent certificate on the same day when the applicant applied for another certificate (the<b><i> original certificate</i></b>), and the original and subsequent certificates are:</p>

                <p>	(3)	For the purposes of subsection 69D(1) of the Act, a fee is prescribed if the applicant requires the APVMA to request the performance, in relation to a certificate (whether original or subsequent), of a consular act for which a fee (the <b><i>consular fee</i></b>):</p>

            <p>The amendment history in endnote 4 provides information about amendments at the provision (generally section or equivalent) level. It also includes information about any provision of the compiled law that has been repealed in accordance with a provision of the law.</p>

              <b>Editorial changes</b>
            </p>
            <p>The <i>Legislation Act 2003</i> authorises First Parliamentary Counsel to make editorial and presentational changes to a compiled law in preparing a compilation of the law for registration. The changes must not change the effect of the law. Editorial changes take effect from the compilation registration date.</p>
            <p>If the compilation includes editorial changes, the endnotes include a brief outline of the changes in general terms. Full details of any changes can be obtained from the Office of Parliamentary Counsel.</p>

              <b>Misdescribed amendments</b>
            </p>
            <p>A misdescribed amendment is an amendment that does not accurately describe how an amendment is to be made. If, despite the misdescription, the amendment can be given effect as intended, then the misdescribed amendment can be incorporated through an editorial change made under <i>Legislation Act 2003</i>.<ref href="#sec-15V">section 15V</ref> of the </p>
            <p>If a misdescribed amendment cannot be given effect as intended, the amendment is not incorporated and “(md not incorp)” is added to the amendment history.</p>
