        <heading>Short title</heading>
        <content>
          <p>		This Act may be cited as the <i>Weapons of Mass Destruction (Prevention of Proliferation) Act 1995</i>.</p>
        </content>
      </section>
      <section eId="sec-2">
        <num>2</num>
        <heading>Commencement</heading>
        <subsection eId="sec-2__subsec-1">
          <num>1</num>
          <content>
            <p>Subject to subsection (2), this Act commences on a day to be fixed by Proclamation.</p>
          </content>
        </subsection>
        <subsection eId="sec-2__subsec-2">
          <num>2</num>
          <content>
            <p>If this Act does not commence under subsection (1) <quantity refersTo="#deadline">within 6 months</quantity> beginning on the day on which it receives the Royal Assent, it commences on the first day after the end of that period.</p>
          </content>
        </subsection>
      </section>
      <section eId="sec-3">
        <num>3</num>
        <heading>Interpretation</heading>
        <content>
          <p>In this Act, unless the contrary intention appears:</p>
          <p><b><i>authorised person</i></b> means:</p>
        </content>
        <paragraph eId="sec-3__para-a">
          <num>a</num>
          <content>
            <p>a member of the Defence Force; or</p>
          </content>
        </paragraph>
        <paragraph eId="sec-3__para-b">
          <num>b</num>
          <content>
            <p>a member or special member of the Australian Federal Police or a member of the police force of a State or Territory; or</p>
          </content>
        </paragraph>
        <paragraph eId="sec-3__para-c">
          <num>c</num>
          <content>
            <p>an officer of Customs.</p>
          </content>
          <content>
            <p><term refersTo="#term-biological-weapons-convention">Biological Weapons Convention</term> means <def>the Convention on the Prohibition of the Development, Production and Stockpiling of Bacteriological (Biological) and Toxin Weapons and on their Destruction, which was signed on behalf of Australia on 10 April 1972 and a copy of the English text of which is set out in the Schedule to the Crimes (Biological Weapons) Act 1976.</def></p>
            <p><term refersTo="#term-chemical-weapons-convention">Chemical Weapons Convention</term> means <def>the Convention on the Prohibition of the Development, Production, Stockpiling and use of Chemical Weapons and on their Destruction (including the annexes to that Convention), a copy of the English text of which is set out in the Schedule to the Chemical Weapons (Prohibition) Act 1994, as amended by any amendment to that Convention that is accepted by Australia and a copy of the English text of which is set out in regulations in force under that Act.</def></p>
            <p><b><i>director</i></b>, in relation to a body that:</p>
          </content>
        </paragraph>
        <paragraph eId="sec-3__para-a">
          <num>a</num>
          <content>
            <p>is incorporated for a public purpose by a law of the Commonwealth, of a State or of a Territory; and</p>
          </content>
        </paragraph>
        <paragraph eId="sec-3__para-b">
          <num>b</num>
          <content>
            <p>is constituted by one or more members;</p>
          </content>
          <content>
            <p>means the member, or any of the members, constituting the body.</p>
            <p><term refersTo="#term-engage-in-conduct">engage in conduct</term> includes <def>fail or refuse to engage in conduct.</def></p>
            <p><term refersTo="#term-export">export</term> means <def>export from , the  (Keeling)  or the .</def></p>
            <p><term refersTo="#term-financial-corporation">financial corporation</term> means <def>a financial corporation, within the meaning of paragraph 51(xx) of the Constitution, formed within the limits of the Commonwealth.</def></p>
            <p><term refersTo="#term-foreign-corporation">foreign corporation</term> has the same meaning as <def>in paragraph 51(xx) of the Constitution.</def></p>
            <p><term refersTo="#term-goods">goods</term> includes <def>documents.</def></p>
            <p><term refersTo="#term-non-proliferation-treaty">Non-Proliferation Treaty</term> means <def>the Treaty on the Non-Proliferation of Nuclear Weapons that was signed on behalf of Australia on 27 February 1970, a copy of the English text of which is set out in Schedule 2 to the Nuclear Non-Proliferation (Safeguards) Act 1987, and, subject to subsection 4(3) of that Act, includes that Treaty as amended from time to time.</def></p>
            <p><term refersTo="#term-non-regulated-goods">non-regulated goods</term> means <def>goods that are not prohibited exports under <ref href="">the Customs Act 1901</ref>.</def></p>
            <p><term refersTo="#term-offence-against-this-act">offence against this Act</term> includes <def>an offence against: 	(a)	<i>Crimes Act 1914</i>; or<ref href="#sec-6">section 6</ref> of the  	(b)	<i>Criminal Code</i>;<ref href="#sec-11">section 11</ref>.1, 11.4 or 11.5 of the  that relates to an offence against this Act.</def></p>
          </content>
        </paragraph>
        <paragraph eId="sec-3__para-a">
          <num>a</num>
          <content>
            <p>	(a)	<i>Crimes Act 1914</i>; or<ref href="#sec-6">section 6</ref> of the </p>
          </content>
        </paragraph>
        <paragraph eId="sec-3__para-b">
          <num>b</num>
          <content>
            <p>	(b)	<i>Criminal Code</i>;<ref href="#sec-11">section 11</ref>.1, 11.4 or 11.5 of the </p>
          </content>
          <content>
            <p>that relates to an offence against this Act.</p>
            <p><term refersTo="#term-officer-of-customs">officer of Customs</term> has the same meaning as <def>in <ref href="">the Customs Act 1901</ref>.</def></p>
            <p><term refersTo="#term-permit">permit</term> means <def>a permit in force under <ref href="#sec-13">section 13</ref>.</def></p>
            <p><b><i>provide services</i></b> has a meaning affected by section 4.</p>
            <p><term refersTo="#term-regulatory-powers-act">Regulatory Powers Act</term> means <def>the Regulatory Powers (Standard Provisions) Act 2014.</def></p>
            <p><b><i>state of mind</i></b>, in relation to a person, includes:</p>
          </content>
        </paragraph>
        <paragraph eId="sec-3__para-a">
          <num>a</num>
          <content>
            <p>the person’s knowledge, intention, opinion, belief or purpose; and</p>
          </content>
        </paragraph>
        <paragraph eId="sec-3__para-b">
          <num>b</num>
          <content>
            <p>the person’s reasons for the intention, opinion, belief or purpose.</p>
          </content>
          <content>
            <p><term refersTo="#term-supply">supply</term> means <def>supply whether or not for any consideration, and includes supply by way of sale, lease, hire or hire-purchase.</def></p>
            <p><term refersTo="#term-trading-corporation">trading corporation</term> means <def>a trading corporation, within the meaning of paragraph 51(xx) of the Constitution, formed within the limits of the Commonwealth.</def></p>
            <p><term refersTo="#term-weapons-of-mass-destruction-program-or-wmd-program">Weapons of Mass Destruction program or WMD program</term> means <def>a plan or program for the development, production, acquisition or stockpiling of nuclear, biological or chemical weapons or missiles capable of delivering such weapons.</def></p>
          </content>
        </paragraph>
      </section>
      <section eId="sec-4">
        <num>4</num>
        <heading>Provision of services</heading>
        <subsection eId="sec-4__subsec-1">
          <num>1</num>
          <content>
            <p>A reference in this Act to the provision of services includes, without limiting the generality of that expression, a reference to doing anything (other than supplying or exporting goods) that confers a benefit on, grants a right or privilege to, provides a facility for, or otherwise assists, someone, including anything done under:</p>
          </content>
          <paragraph eId="sec-4__subsec-1__para-a">
            <num>a</num>
            <content>
              <p>a contract for or in relation to the performance of work (including work of a professional nature) with or without the supply or export of goods; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-4__subsec-1__para-b">
            <num>b</num>
            <content>
              <p>a contract for or in relation to the lending of money or other provision of financial assistance.</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-4__subsec-2">
          <num>2</num>
          <content>
            <p>Examples of the provision of services are:</p>
          </content>
          <paragraph eId="sec-4__subsec-2__para-a">
            <num>a</num>
            <content>
              <p>working as an employee, consultant or adviser; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-4__subsec-2__para-b">
            <num>b</num>
            <content>
              <p>providing training; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-4__subsec-2__para-c">
            <num>c</num>
            <content>
              <p>providing technological information or know-how; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-4__subsec-2__para-d">
            <num>d</num>
            <content>
              <p>procuring another to supply or export goods or provide services.</p>
            </content>
          </paragraph>
        </subsection>
      </section>
      <section eId="sec-5">
        <num>5</num>
        <heading>Extension to external Territories</heading>
        <content>
          <p>This Act extends to the external Territories.</p>
        </content>
      </section>
      <section eId="sec-6">
        <num>6</num>
        <heading>Object and operation of the Act</heading>
        <subsection eId="sec-6__subsec-1">
          <num>1</num>
          <content>
            <p>The object of this Act is to ensure, so far as the Constitution permits, that goods are not supplied or exported, and services are not provided, in circumstances where the goods will or may be used in, or the services will or may assist, the development, production, acquisition or stockpiling of weapons that are capable of causing mass destruction or missiles that are capable of delivering such weapons.</p>
          </content>
        </subsection>
        <subsection eId="sec-6__subsec-2">
          <num>2</num>
          <content>
            <p>This Act has effect, and is to be interpreted, accordingly.</p>
          </content>
        </subsection>
        <subsection eId="sec-6__subsec-3">
          <num>3</num>
          <content>
            <p>This Act applies to:</p>
          </content>
          <paragraph eId="sec-6__subsec-3__para-a">
            <num>a</num>
            <content>
              <p>acts and omissions done in  or an external Territory; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-6__subsec-3__para-b">
            <num>b</num>
            <content>
              <p>acts and omissions done outside  and the external Territories by:</p>
            </content>
          </paragraph>
          <paragraph eId="sec-6__subsec-3__para-i">
            <num>i</num>
            <content>
              <p>Australian citizens; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-6__subsec-3__para-ii">
            <num>ii</num>
            <content>
              <p>people ordinarily resident in  or an external Territory; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-6__subsec-3__para-iii">
            <num>iii</num>
            <content>
              <p>bodies incorporated in  or an external Territory.</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-6__subsec-4">
          <num>4</num>
          <content>
            <p>This Act is additional to, and does not prejudice, the operation of any other Act that deals with a matter dealt with by this Act.</p>
          </content>
        </subsection>
      </section>
      <section eId="sec-7">
        <num>7</num>
        <heading>Additional operation of the Act</heading>
        <subsection eId="sec-7__subsec-1">
          <num>1</num>
          <content>
            <p>Without prejudice to the effect that this Act has apart from this subsection, it also has the effect that it would have if its application were limited to:</p>
          </content>
          <paragraph eId="sec-7__subsec-1__para-a">
            <num>a</num>
            <content>
              <p>giving effect to:</p>
            </content>
          </paragraph>
          <paragraph eId="sec-7__subsec-1__para-i">
            <num>i</num>
            <content>
              <p>the Biological Weapons Convention; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-7__subsec-1__para-ii">
            <num>ii</num>
            <content>
              <p>the Non-Proliferation Treaty; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-7__subsec-1__para-iii">
            <num>iii</num>
            <content>
              <p>after the Chemical Weapons Convention comes into force for Australia-that Convention; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-7__subsec-1__para-iv">
            <num>iv</num>
            <content>
              <p>any international obligation of  arising otherwise than under a Convention or Treaty referred to in a preceding subparagraph; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-7__subsec-1__para-b">
            <num>b</num>
            <content>
              <p>matters external to ; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-7__subsec-1__para-c">
            <num>c</num>
            <content>
              <p>matters of international concern; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-7__subsec-1__para-d">
            <num>d</num>
            <content>
              <p>the defence of ; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-7__subsec-1__para-e">
            <num>e</num>
            <content>
              <p>goods that are owned by, or are in the possession or control of, a trading corporation or a foreign corporation or services that are provided by a trading corporation, a financial corporation or a foreign corporation; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-7__subsec-1__para-f">
            <num>f</num>
            <content>
              <p>goods that are, or services that are provided, in the course of trade or commerce:</p>
            </content>
          </paragraph>
          <paragraph eId="sec-7__subsec-1__para-i">
            <num>i</num>
            <content>
              <p>between  and places outside ; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-7__subsec-1__para-ii">
            <num>ii</num>
            <content>
              <p>among the States; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-7__subsec-1__para-iii">
            <num>iii</num>
            <content>
              <p>within a Territory, between a State and a Territory or between 2 Territories.</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-7__subsec-2">
          <num>2</num>
          <content>
            <p>Without prejudice to the effect that this Act has apart from this subsection, it also has the effect that it would have if its application were limited to goods that are owned by, or are in the possession or control of, a trading corporation in the course of its trading activities or services that are provided by a trading corporation in the course of its trading activities or by a financial corporation in the course of its financial activities.</p>

        </subsection>
      </section>
      <section eId="sec-8">
        <num>8</num>
        <heading>Act to bind the Crown</heading>
        <subsection eId="sec-8__subsec-1">
          <num>1</num>
          <content>
            <p>This Act binds the Crown in right of the Commonwealth, of each of the States, of the Australian Capital Territory and of the Northern Territory.</p>
          </content>
        </subsection>
        <subsection eId="sec-8__subsec-2">
          <num>2</num>
          <content>
            <p>Nothing in this Act renders the Crown in any right liable to be prosecuted for an offence.</p>
          </content>
        </subsection>
        <subsection eId="sec-8__subsec-3">
          <num>3</num>
          <content>
            <p>To avoid doubt, a reference in this section to the Crown in a particular right includes a reference to an instrumentality or agency (whether a body corporate or not) of the Crown in that right.</p>
          </content>
        </subsection>
      </section>
      <section eId="sec-8A">

        <heading>Prohibition on supplying goods for WMD program</heading>
        <subsection eId="sec-9__subsec-1">
          <num>1</num>
          <content>
            <p>If:</p>
          </content>
          <paragraph eId="sec-9__subsec-1__para-a">
            <num>a</num>
            <content>
              <p>a person supplies any goods to another person; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-9__subsec-1__para-b">
            <num>b</num>
            <content>
              <p>the first-mentioned person believes or suspects, on reasonable grounds, that the goods will or may be used in a WMD program; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-9__subsec-1__para-c">
            <num>c</num>
            <content>
              <p>the supply of the goods is not authorised by a permit or is in contravention of a condition stated in a permit; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-9__subsec-1__para-d">
            <num>d</num>
            <content>
              <p><role refersTo="#minister">the Minister</role> has not given a written notice to the first-mentioned person under section 12 stating that <role refersTo="#minister">the Minister</role> has no reason to believe or suspect that the goods will or may be used in a WMD program;</p>
            </content>
            <content>
              <p>the first-mentioned person commits an offence punishable on conviction by imprisonment for not more than 8 years.</p>

            <p>It is not an offence against subsection (1) for a person to supply goods to another person if the goods are supplied in compliance with conditions stated in a notice given to the first-mentioned person by <role refersTo="#minister">the Minister</role> under subsection 14(2).</p>

        </subsection>
      </section>
      <section eId="sec-10">
        <num>10</num>
        <heading>Prohibition on exporting goods for WMD program</heading>
        <subsection eId="sec-10__subsec-1">
          <num>1</num>
          <content>
            <p>If:</p>
          </content>
          <paragraph eId="sec-10__subsec-1__para-a">
            <num>a</num>
            <content>
              <p>a person exports any non-regulated goods; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-10__subsec-1__para-b">
            <num>b</num>
            <content>
              <p>the person believes or suspects, on reasonable grounds, that the goods will or may be used in a WMD program; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-10__subsec-1__para-c">
            <num>c</num>
            <content>
              <p>the export of the goods is not authorised by a permit or is in contravention of a condition stated in a permit; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-10__subsec-1__para-d">
            <num>d</num>
            <content>
              <p><role refersTo="#minister">the Minister</role> has not given a written notice to the person under section 12 stating that <role refersTo="#minister">the Minister</role> has no reason to believe or suspect that the goods will or may be used in a WMD program;</p>
            </content>
            <content>
              <p>the person commits an offence punishable on conviction by imprisonment for not more than 8 years.</p>

            <p>It is not an offence against subsection (1) for a person to export non-regulated goods if the goods are exported in compliance with conditions stated in a notice given to the person by <role refersTo="#minister">the Minister</role> under subsection 14(2).</p>

        </subsection>
      </section>
      <section eId="sec-11">
        <num>11</num>
        <heading>Prohibition on providing services for WMD program</heading>
        <subsection eId="sec-11__subsec-1">
          <num>1</num>
          <content>
            <p>If:</p>
          </content>
          <paragraph eId="sec-11__subsec-1__para-a">
            <num>a</num>
            <content>
              <p>a person provides any services to another person; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-11__subsec-1__para-b">
            <num>b</num>
            <content>
              <p>the first-mentioned person believes or suspects, on reasonable grounds, that the services will or may assist a WMD program; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-11__subsec-1__para-c">
            <num>c</num>
            <content>
              <p>the provision of the services is not authorised by a permit or is in contravention of a condition stated in a permit; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-11__subsec-1__para-d">
            <num>d</num>
            <content>
              <p><role refersTo="#minister">the Minister</role> has not given a written notice to the first-mentioned person under section 12 stating that <role refersTo="#minister">the Minister</role> has no reason to believe or suspect that the provision of the services will or may assist a WMD program;</p>
            </content>
            <content>
              <p>the first-mentioned person commits an offence punishable on conviction by imprisonment for not more than 8 years.</p>

            <p>It is not an offence against subsection (1) for a person to provide services to another person if the services are provided in compliance with conditions stated in a notice given to the first-mentioned person by <role refersTo="#minister">the Minister</role> under subsection 14(2).</p>

        </subsection>
      </section>
      <section eId="sec-12">
        <num>12</num>
        <heading>Request to the Minister for information</heading>
        <subsection eId="sec-12__subsec-1">
          <num>1</num>
          <content>
            <p>If a person who wishes to supply goods, to export non-regulated goods or to provide services believes or suspects that the goods will or may be used in, or the provision of the services will or may assist, a WMD program, the person may request <role refersTo="#minister">the Minister</role> in writing for information as to whether <role refersTo="#minister">the Minister</role> has reason to believe or suspect that the goods will or may be used in, or the provision of the services will or may assist, a WMD program.</p>
          </content>
        </subsection>
        <subsection eId="sec-12__subsec-2">
          <num>2</num>
          <content>
            <p>If such a request is made, <role refersTo="#minister">the Minister</role> must, as soon as possible, give the person who made the request a written notice containing the information sought in the request.</p>
          </content>
        </subsection>
      </section>
      <section eId="sec-13">
        <num>13</num>
        <heading>Permits</heading>
        <subsection eId="sec-13__subsec-1">
          <num>1</num>
          <content>
            <p>If:</p>
          </content>
          <paragraph eId="sec-13__subsec-1__para-a">
            <num>a</num>
            <content>
              <p>a person wishes to supply goods to a particular person, to export non-regulated goods to a particular place or to provide services to a particular person; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-13__subsec-1__para-b">
            <num>b</num>
            <content>
              <p><role refersTo="#minister">the Minister</role> has reason to believe or suspect that the goods will or may be used in, or the provision of the services will or may assist, a WMD program; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-13__subsec-1__para-c">
            <num>c</num>
            <content>
              <p>the first-mentioned person applies in accordance with the regulations for a permit under this section to supply or export the goods or provide the services; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-13__subsec-1__para-d">
            <num>d</num>
            <content>
              <p><role refersTo="#minister">the Minister</role> is satisfied that the supply or export of the goods or the provision of the services in accordance with the application would not be contrary to Australia’s international or treaty obligations or the national interest;</p>
            </content>
            <content>
              <p><role refersTo="#minister">the Minister</role> may give the first-mentioned person a written permit to supply or export the goods or provide the services, as the case may be, as mentioned in the permit.</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-13__subsec-2">
          <num>2</num>
          <content>
            <p>A permit may be unconditional or subject to conditions stated in the permit.</p>
          </content>
        </subsection>
        <subsection eId="sec-13__subsec-3">
          <num>3</num>
          <content>
            <p>If a permit to supply or export goods or provide services was given to a person, <role refersTo="#minister">the Minister</role> may, by written notice given to the person, revoke the permit if <role refersTo="#minister">the Minister</role> is satisfied, having regard to any events that have occurred, or any information of which he or she has become aware, since the permit was given, that the supply or export of the goods or the provision of the services, as the case may be, would be contrary to Australia’s international or treaty obligations or the national interest.</p>
          </content>
        </subsection>
      </section>
      <section eId="sec-14">
        <num>14</num>
        <heading>Notice prohibiting supply or export of goods or provision of services</heading>
        <subsection eId="sec-14__subsec-1">
          <num>1</num>
          <content>
            <p>If <role refersTo="#minister">the Minister</role>:</p>
          </content>
          <paragraph eId="sec-14__subsec-1__para-a">
            <num>a</num>
            <content>
              <p>has reason to believe or suspect that:</p>
            </content>
          </paragraph>
          <paragraph eId="sec-14__subsec-1__para-i">
            <num>i</num>
            <content>
              <p>if a person were to supply particular goods to another person or to export particular non-regulated goods to a particular place, the goods would or might be used in a WMD program; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-14__subsec-1__para-ii">
            <num>ii</num>
            <content>
              <p>if a person were to provide particular services to another person, the provision of the services would or might assist a WMD program; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-14__subsec-1__para-b">
            <num>b</num>
            <content>
              <p><role refersTo="#minister">the Minister</role> considers that a permit could not be given under section 13 in respect of such a supply or export of goods or the provision of such services, as the case may be;</p>
            </content>
            <content>
              <p><role refersTo="#minister">the Minister</role> may give the person in accordance with the regulations a notice under subsection (2).</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-14__subsec-2">
          <num>2</num>
          <content>
            <p>The notice may:</p>
          </content>
          <paragraph eId="sec-14__subsec-2__para-a">
            <num>a</num>
            <content>
              <p>prohibit the person from supplying the goods to the other person or exporting the goods to the place concerned, or from providing the services to the other person, as the case requires; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-14__subsec-2__para-b">
            <num>b</num>
            <content>
              <p>prohibit the person from so supplying or exporting the goods, or so providing the services, unless conditions stated in the notice are complied with.</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-14__subsec-3">
          <num>3</num>
          <content>
            <p><role refersTo="#minister">The Minister</role> may revoke, in accordance with the regulations, a notice given under subsection (1).</p>
          </content>
        </subsection>
        <subsection eId="sec-14__subsec-4">
          <num>4</num>
          <content>
            <p>A notice given to a person under subsection (1) remains in force for a period of 12 months beginning on the day when the notice is given to the person, unless the notice is revoked before the end of that period.</p>
          </content>
        </subsection>
        <subsection eId="sec-14__subsec-5">
          <num>5</num>
          <content>
            <p><role refersTo="#minister">The Minister</role> may, in relation to the supply or export of goods, or the provision of services, give a notice to a person under subsection (1) that is to take effect at the time when a previous notice given to the person under that subsection in relation to the supply or export of those goods, or the provision of those services, as the case may be, ceases to be in force.</p>
          </content>
        </subsection>
        <subsection eId="sec-14__subsec-6">
          <num>6</num>
          <content>
            <p>A person commits an offence if:</p>
          </content>
          <paragraph eId="sec-14__subsec-6__para-a">
            <num>a</num>
            <content>
              <p>the person supplies or exports goods or provides services; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-14__subsec-6__para-b">
            <num>b</num>
            <content>
              <p>that conduct is in contravention of a notice, or of a condition stated in a notice, in force under this section; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-14__subsec-6__para-c">
            <num>c</num>
            <content>
              <p>the person knows of the contravention.</p>
            </content>
            <hcontainer name="penalty">

                <p>Penalty:	<quantity refersTo="#custodialSentence">Imprisonment for 8 years</quantity>.</p>

          </paragraph>
        </subsection>
      </section>
      <section eId="sec-15">
        <num>15</num>
        <heading>Conduct by directors, employees and agents</heading>
        <subsection eId="sec-15__subsec-1">
          <num>1</num>
          <content>
            <p>If, in proceedings for an offence against this Act, it is necessary to prove the state of mind of a body corporate in relation to particular conduct, it is enough to show:</p>
          </content>
          <paragraph eId="sec-15__subsec-1__para-a">
            <num>a</num>
            <content>
              <p>that the conduct was engaged in by a director, employee or agent of the body corporate within the scope of his or her actual or apparent authority; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-15__subsec-1__para-b">
            <num>b</num>
            <content>
              <p>that the director, employee or agent had the state of mind.</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-15__subsec-2">
          <num>2</num>
          <content>
            <p>Any conduct engaged in on behalf of a body corporate by a director, employee or agent of the body corporate within the scope of his or her actual or apparent authority is taken, for the purposes of a prosecution for an offence against this Act, to have been engaged in also by the body corporate unless it proves that it took reasonable precautions and exercised due diligence to avoid the conduct.</p>
          </content>
        </subsection>
        <subsection eId="sec-15__subsec-3">
          <num>3</num>
          <content>
            <p>If, in proceedings for an offence against this Act, it is necessary to prove the state of mind of an individual in relation to particular conduct, it is enough to show:</p>
          </content>
          <paragraph eId="sec-15__subsec-3__para-a">
            <num>a</num>
            <content>
              <p>that the conduct was engaged in by an employee or agent of the individual within the scope of his or her actual or apparent authority; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-15__subsec-3__para-b">
            <num>b</num>
            <content>
              <p>that the employee or agent had the state of mind.</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-15__subsec-4">
          <num>4</num>
          <content>
            <p>Any conduct engaged in on behalf of an individual by an employee or agent of the individual within the scope of his or her actual or apparent authority is taken, for the purposes of a prosecution for an offence against this Act, to have been engaged in also by the individual unless he or she proves that he or she took reasonable precautions and exercised due diligence to avoid the conduct.</p>
          </content>
        </subsection>
        <subsection eId="sec-15__subsec-5">
          <num>5</num>
          <content>
            <p>If:</p>
          </content>
          <paragraph eId="sec-15__subsec-5__para-a">
            <num>a</num>
            <content>
              <p>an individual is convicted of an offence; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-15__subsec-5__para-b">
            <num>b</num>
            <content>
              <p>he or she would not have been convicted of the offence if subsections (3) and (4) had not been enacted;</p>
            </content>
            <content>
              <p>he or she is not liable to be punished by imprisonment for that offence.</p>
            </content>
          </paragraph>
        </subsection>
      </section>
      <section eId="sec-16">
        <num>16</num>
        <heading>Injunctions</heading>

          <p>Enforceable provisions</p>
        </content>
        <subsection eId="sec-16__subsec-1">
          <num>1</num>
          <content>
            <p>A provision is enforceable under Part 7 of the Regulatory Powers Act if it is an offence against this Act.</p>
          </content>

            <p>For the purposes of Part 7 of the Regulatory Powers Act, <role refersTo="#minister">the Minister</role> is an authorised person in relation to the provisions mentioned in subsection (1).</p>

        </subsection>

          <content>
            <p><role refersTo="#minister">The Minister</role> may, in writing, delegate <role refersTo="#minister">the Minister</role>’s powers and functions as an authorised person to an officer of the Department in relation to the provisions mentioned in subsection (1).</p>

            <p>Relevant court</p>
          </content>
        </subsection>
        <subsection eId="sec-16__subsec-4">
          <num>4</num>
          <content>
            <p>For the purposes of Part 7 of the Regulatory Powers Act, the Federal Court of Australia is a relevant court in relation to the provisions mentioned in subsection (1).</p>
          </content>
          <content>
            <p>Extension to external Territories</p>
          </content>
        </subsection>
        <subsection eId="sec-16__subsec-5">
          <num>5</num>
          <content>
            <p>	(5)	Part 7 of the Regulatory Powers Act, as it applies in relation to<i> </i>the provisions mentioned in subsection (1), extends to every external Territory.</p>
          </content>
        </subsection>
      </section>
      <section eId="sec-17">
        <num>17</num>
        <heading>Forfeiture of goods</heading>
        <subsection eId="sec-17__subsec-1">
          <num>1</num>
          <content>
            <p>If a person exports or supplies, or attempts to export or supply, goods in contravention of this Act, the goods, and any packages in which they are contained, are forfeited to the Commonwealth.</p>
          </content>
        </subsection>
        <subsection eId="sec-17__subsec-2">
          <num>2</num>
          <content>
            <p>An authorised person may, without warrant, seize any goods that are forfeited, or that the authorised person has reasonable grounds to believe are forfeited, to the Commonwealth under subsection (1) and take them before a court of summary jurisdiction.</p>
          </content>
        </subsection>
        <subsection eId="sec-17__subsec-3">
          <num>3</num>
          <content>
            <p>If goods are taken before a court of summary jurisdiction under subsection (2), the court must inquire into the matter and:</p>
          </content>
          <paragraph eId="sec-17__subsec-3__para-a">
            <num>a</num>
            <content>
              <p>if the court is satisfied that the goods are forfeited—must order that the goods be condemned; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-17__subsec-3__para-b">
            <num>b</num>
            <content>
              <p>if the court is not so satisfied—must order that the goods be delivered to whoever the court is satisfied is entitled to the goods.</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-17__subsec-4">
          <num>4</num>
          <content>
            <p>Before inquiring into a matter in accordance with subsection (3), a court of summary jurisdiction may require notice of the inquiry to be given to anyone that the court thinks appropriate.</p>
          </content>
        </subsection>
        <subsection eId="sec-17__subsec-5">
          <num>5</num>
          <content>
            <p>If a prosecution is pending, an order for the condemnation, or for the delivery to a person, of goods relating to the prosecution must not be made until the prosecution is determined.</p>
          </content>
        </subsection>
        <subsection eId="sec-17__subsec-6">
          <num>6</num>
          <content>
            <p>Goods seized under subsection (2) must be stored in accordance with prescribed procedures until an order is made under subsection (3).</p>
          </content>
        </subsection>
        <subsection eId="sec-17__subsec-7">
          <num>7</num>
          <content>
            <p>Condemned goods must be destroyed or otherwise dealt with in accordance with prescribed procedures as soon as practicable after it is determined that the goods are condemned.</p>
          </content>
        </subsection>
        <subsection eId="sec-17__subsec-8">
          <num>8</num>
          <content>
            <p>Until they are so destroyed or otherwise dealt with, condemned goods must be stored in accordance with prescribed procedures.</p>
          </content>
        </subsection>
      </section>
      <section eId="sec-18">
        <num>18</num>
        <heading>Evidential certificates by Minister</heading>
        <content>
          <p>In any proceeding, a certificate given by <role refersTo="#minister">the Minister</role> stating that notice of a kind mentioned in subsection 14(1) was given to a particular person on a particular date is admissible as prima facie evidence of the matters stated in the certificate.</p>
        </content>
      </section>
      <section eId="sec-19">
        <num>19</num>
        <heading>Delegation by Minister</heading>
        <content>
          <p><role refersTo="#minister">The Minister</role> may delegate to an officer of the Department all or any of the powers conferred on <role refersTo="#minister">the Minister</role> by this Act other than the power to give or revoke a notice under section 14.</p>
        </content>
      </section>
      <section eId="sec-20">
        <num>20</num>
        <heading>Attorney-General’s consent required for prosecutions</heading>
        <subsection eId="sec-20__subsec-1">
          <num>1</num>
          <content>
            <p>A prosecution for an offence against this Act requires the consent of the Attorney-General.</p>
          </content>
        </subsection>
        <subsection eId="sec-20__subsec-2">
          <num>2</num>
          <content>
            <p>Despite subsection (1):</p>
          </content>
          <paragraph eId="sec-20__subsec-2__para-a">
            <num>a</num>
            <content>
              <p>anyone may be arrested for an offence against this Act, and a warrant for such an arrest may be issued and executed; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-20__subsec-2__para-b">
            <num>b</num>
            <content>
              <p>anyone may be charged with such an offence; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-20__subsec-2__para-c">
            <num>c</num>
            <content>
              <p>anyone so charged may be remanded in custody or on bail;</p>
            </content>
            <content>
              <p>but no further step in the proceedings referred to in subsection (1) is to be taken until the Attorney-General’s consent has been given.</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-20__subsec-3">
          <num>3</num>
          <content>
            <p>Subsection (2) does not prevent the discharge of the accused if proceedings are not continued within a reasonable time.</p>
          </content>
        </subsection>
      </section>
      <section eId="sec-21">
        <num>21</num>
        <heading>Regulations</heading>
        <content>
          <p>The Governor-General may make regulations prescribing matters:</p>
        </content>
        <paragraph eId="sec-21__para-a">
          <num>a</num>
          <content>
            <p>required or permitted by this Act to be prescribed; or</p>
          </content>
        </paragraph>
        <paragraph eId="sec-21__para-b">
          <num>b</num>
          <content>
            <p>necessary or convenient to be prescribed for carrying out or giving effect to this Act.</p>

              <b>Legislation history and amendment history—Endnotes 3 and 4</b>
            </p>
            <p>Amending laws are annotated in the legislation history and amendment history.</p>
            <p>The legislation history in endnote 3 provides information about each law that has amended (or will amend) the compiled law. The information includes commencement details for amending laws and details of any application, saving or transitional provisions that are not included in this compilation.</p>
            <p>The amendment history in endnote 4 provides information about amendments at the provision (generally section or equivalent) level. It also includes information about any provision of the compiled law that has been repealed in accordance with a provision of the law.</p>
            <p>
              <b>Editorial changes</b>
            </p>
            <p>The <i>Legislation Act 2003</i> authorises First Parliamentary Counsel to make editorial and presentational changes to a compiled law in preparing a compilation of the law for registration. The changes must not change the effect of the law. Editorial changes take effect from the compilation registration date.</p>
            <p>If the compilation includes editorial changes, the endnotes include a brief outline of the changes in general terms. Full details of any changes can be obtained from the Office of Parliamentary Counsel.</p>
            <p>
              <b>Misdescribed amendments</b>
            </p>
            <p>A misdescribed amendment is an amendment that does not accurately describe the amendment to be made. If, despite the misdescription, the amendment can be given effect as intended, the amendment is incorporated into the compiled law and the abbreviation “(md)” added to the details of the amendment included in the amendment history.</p>
            <p>If a misdescribed amendment cannot be given effect as intended, the abbreviation “(md not incorp)” is added to the details of the amendment included in the amendment history.</p>
