        <heading>Short title [see Note 1]</heading>
        <content>
          <p>		This Act may be cited as the <i>Commonwealth Vehicles (Registration and Exemption from Taxation) Act 1997</i>.</p>
        </content>
      </section>
      <section eId="sec-2">
        <num>2</num>
        <heading>Commencement [see Note 1]</heading>
        <content>
          <p>This Act commences on the day on which it receives the Royal Assent.</p>
        </content>
      </section>
      <section eId="sec-3">
        <num>3</num>
        <heading>Definitions</heading>
        <content>
          <p>In this Act, unless the contrary intention appears:</p>
          <p><term refersTo="#term-commonwealth-authority">Commonwealth authority</term> means <def>a body corporate that is incorporated for a public purpose by a law of: the Commonwealth; or the Jervis Bay Territory; or an external Territory other than Norfolk Island; but does not include any body corporate that is excluded by the regulations from this definition.</def></p>

          <num>a</num>
          <content>
            <p>the Commonwealth; or</p>
          </content>
        </paragraph>
        <paragraph eId="sec-3__para-b">
          <num>b</num>
          <content>
            <p>the Jervis Bay Territory; or</p>
          </content>
        </paragraph>
        <paragraph eId="sec-3__para-c">
          <num>c</num>
          <content>
            <p>an external Territory other than Norfolk Island;</p>
          </content>
          <content>
            <p>but does not include any body corporate that is excluded by the regulations from this definition.</p>
            <p><term refersTo="#term-dasfleet">DASFLEET</term> means <def>the integrated leasing, rentals and fleet management business conducted by the Commonwealth under that name.</def></p>
            <p><term refersTo="#term-dasfleet-asset">DASFLEET asset</term> means <def>an asset of the Commonwealth used for the purposes of DASFLEET.</def></p>
            <p><term refersTo="#term-lease">lease</term> means <def>any agreement or arrangement under which the vehicle (whether for any or no consideration) is made available exclusively to a person for the person’s use.</def></p>
            <p><term refersTo="#term-motor-vehicle">motor vehicle</term> means <def>any means of conveyance that: runs on wheels; and uses or is designed to use volatile spirit, gas, oil, electricity or any other power (not being human or animal power) as the principal means of propulsion; but does not include a motor vehicle designed to be used on a railway or tramway.</def></p>

        <paragraph eId="sec-3__para-a">
          <num>a</num>
          <content>
            <p>runs on wheels; and</p>
          </content>
        </paragraph>
        <paragraph eId="sec-3__para-b">
          <num>b</num>
          <content>
            <p>uses or is designed to use volatile spirit, gas, oil, electricity or any other power (not being human or animal power) as the principal means of propulsion;</p>
          </content>
          <content>
            <p>but does not include a motor vehicle designed to be used on a railway or tramway.</p>
            <p><term refersTo="#term-register">register</term> means <def>the register of Commonwealth vehicles kept under <ref href="#sec-6">section 6</ref>.</def></p>
            <p><term refersTo="#term-registered-vehicle">registered vehicle</term> means <def>a vehicle registered under <ref href="#part-2">Part 2</ref>.</def></p>
            <p><term refersTo="#term-registrar">registrar</term> has the meaning given by <def>subsection 7(2).</def></p>
            <p><term refersTo="#term-registration">registration</term> includes <def>the issue of a vehicle licence in respect of that vehicle under a law of a State or Territory.</def></p>
            <p><term refersTo="#term-third-party-policy">third-party policy</term> means <def>a policy of insurance that, in accordance with the law of a State or Territory, insures: the owner of the vehicle; and any other person who at any time (whether with or without <role refersTo="#authority">the authority</role> of the owner) drives the vehicle; against any liability incurred by them jointly, or by either of them separately, in respect of the death of, or any injury to, a person caused by, or arising out of, the use of the vehicle.</def></p>
          </content>
        </paragraph>
        <paragraph eId="sec-3__para-a">
          <num>a</num>
          <content>
            <p>the owner of the vehicle; and</p>
          </content>
        </paragraph>
        <paragraph eId="sec-3__para-b">
          <num>b</num>
          <content>
            <p>any other person who at any time (whether with or without <role refersTo="#authority">the authority</role> of the owner) drives the vehicle;</p>
          </content>
          <content>
            <p>against any liability incurred by them jointly, or by either of them separately, in respect of the death of, or any injury to, a person caused by, or arising out of, the use of the vehicle.</p>
            <p><term refersTo="#term-trailer">trailer</term> means <def>any means of conveyance, or any piece of machinery or equipment, that: runs on wheels; and is not self-propelled; and is designed to be towed by a motor vehicle.</def></p>
          </content>
        </paragraph>
        <paragraph eId="sec-3__para-a">
          <num>a</num>
          <content>
            <p>runs on wheels; and</p>
          </content>
        </paragraph>
        <paragraph eId="sec-3__para-b">
          <num>b</num>
          <content>
            <p>is not self-propelled; and</p>
          </content>
        </paragraph>
        <paragraph eId="sec-3__para-c">
          <num>c</num>
          <content>
            <p>is designed to be towed by a motor vehicle.</p>
          </content>
          <content>
            <p><term refersTo="#term-vehicle">vehicle</term> means <def>a motor vehicle or trailer.</def></p>
          </content>
        </paragraph>
      </section>
      <section eId="sec-4">
        <num>4</num>
        <heading>Objects of Act</heading>
        <content>
          <p>The objects of this Act are:</p>
        </content>
        <paragraph eId="sec-4__para-a">
          <num>a</num>
          <content>
            <p>to provide for the registration of vehicles used by the Commonwealth and Commonwealth authorities; and</p>
          </content>
        </paragraph>
        <paragraph eId="sec-4__para-b">
          <num>b</num>
          <content>
            <p>to exempt from taxation by a State or Territory:</p>
          </content>
        </paragraph>
        <paragraph eId="sec-4__para-i">
          <num>i</num>
          <content>
            <p>the sale of certain DASFLEET assets; and</p>
          </content>
        </paragraph>
        <paragraph eId="sec-4__para-ii">
          <num>ii</num>
          <content>
            <p>certain leases of vehicles to the Commonwealth or Commonwealth authorities; and</p>
          </content>
        </paragraph>
        <paragraph eId="sec-4__para-iii">
          <num>iii</num>
          <content>
            <p>the registration (under a law of that State or Territory) of certain vehicles leased to the Commonwealth or Commonwealth authorities.</p>
          </content>
        </paragraph>
      </section>
      <section eId="sec-5">
        <num>5</num>
        <heading>Extension of Act to external Territories</heading>
        <content>
          <p>This Act extends to:</p>
        </content>
        <paragraph eId="sec-5__para-a">
          <num>a</num>
          <content>
            <p>the Australian Antarctic Territory; and</p>
          </content>
        </paragraph>
        <paragraph eId="sec-5__para-b">
          <num>b</num>
          <content>
            <p>the Coral Sea Islands Territory; and</p>
          </content>
        </paragraph>
        <paragraph eId="sec-5__para-c">
          <num>c</num>
          <content>
            <p>the Territory of Heard Island and McDonald Islands.</p>
          </content>
          <content>
            <p><ref href="#part-2">Part 2</ref>—Registration of Commonwealth vehicles</p>
          </content>
        </paragraph>
      </section>
      <section eId="sec-6">
        <num>6</num>
        <heading>Register of Commonwealth vehicles</heading>
        <content>
          <p>There is to be kept in the Department, under the control of <role refersTo="#registrar">the Registrar</role>, a register of Commonwealth vehicles.</p>
        </content>
      </section>
      <section eId="sec-7">
        <num>7</num>
        <heading>Registrar</heading>
        <subsection eId="sec-7__subsec-1">
          <num>1</num>
          <content>
            <p>There is to be a position in the Department whose duties include the general control of the register.</p>
          </content>
        </subsection>
        <subsection eId="sec-7__subsec-2">
          <num>2</num>
          <content>
            <p><role refersTo="#registrar">The Registrar</role> is the APS employee who is performing the duties of the position referred to in subsection (1).</p>
          </content>
        </subsection>
      </section>
      <section eId="sec-8">
        <num>8</num>
        <heading>Vehicles that may be registered</heading>
        <content>
          <p>The only vehicles that may be registered under this Part are vehicles owned by, or leased for a continuous period of at least 3 months to, the Commonwealth or a Commonwealth authority.</p>
        </content>
      </section>
      <section eId="sec-9">
        <num>9</num>
        <heading>Registration of motor vehicles</heading>
        <subsection eId="sec-9__subsec-1">
          <num>1</num>
          <content>
            <p>Upon application made in accordance with an approved form by the owner of a vehicle referred to in <role refersTo="#registrar">the Registrar</role> must register the vehicle if:<ref href="#sec-8">section 8</ref>, </p>
          </content>
          <paragraph eId="sec-9__subsec-1__para-a">
            <num>a</num>
            <content>
              <p><role refersTo="#registrar">the Registrar</role> is satisfied that the vehicle may be registered under this Part; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-9__subsec-1__para-b">
            <num>b</num>
            <content>
              <p>the applicant has paid the prescribed fee.</p>
            </content>

          </paragraph>
        </subsection>
        <subsection eId="sec-9__subsec-2">
          <num>2</num>
          <content>
            <p>The registration of a vehicle:</p>
          </content>
          <paragraph eId="sec-9__subsec-2__para-a">
            <num>a</num>
            <content>
              <p>subject to subsection (3), comes into force on the day on which it is granted; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-9__subsec-2__para-b">
            <num>b</num>
            <content>
              <p>unless sooner cancelled or surrendered, remains in force for the prescribed period.</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-9__subsec-3">
          <num>3</num>
          <content>
            <p>If application is made for the registration, for a further period, of a vehicle that is already registered, the registration may be expressed to come into force immediately after the existing registration ceases to be in force.</p>
          </content>
        </subsection>
        <subsection eId="sec-9__subsec-4">
          <num>4</num>
          <content>
            <p>In this section:</p>
          </content>
          <content>
            <p><b><i>approved form</i></b> means a form approved by the Registrar for the purposes of subsection (1).</p>
          </content>
        </subsection>
      </section>
      <section eId="sec-10">
        <num>10</num>
        <heading>Cancellation of registration by Registrar</heading>
        <content>
          <p><role refersTo="#registrar">The Registrar</role> may, by notice in writing given to its owner, cancel the registration of a vehicle if:</p>
        </content>
        <paragraph eId="sec-10__para-a">
          <num>a</num>
          <content>
            <p>the vehicle has been stolen or destroyed; or</p>
          </content>
        </paragraph>
        <paragraph eId="sec-10__para-b">
          <num>b</num>
          <content>
            <p>if the fee payable under paragraph 9(1)(b) has been paid by cheque—the cheque is dishonoured when presented for payment.</p>
          </content>
        </paragraph>
      </section>
      <section eId="sec-11">
        <num>11</num>
        <heading>Automatic cancellation of registration</heading>
        <content>
          <p>If:</p>
        </content>
        <paragraph eId="sec-11__para-a">
          <num>a</num>
          <content>
            <p>in the case of a registered vehicle that is owned by the Commonwealth or a Commonwealth authority—the Commonwealth or Commonwealth authority ceases to be the owner of the vehicle; or</p>
          </content>
        </paragraph>
        <paragraph eId="sec-11__para-b">
          <num>b</num>
          <content>
            <p>in the case of a registered vehicle that is leased to the Commonwealth or a Commonwealth authority—the lease expires or is terminated;</p>
          </content>
          <content>
            <p>the registration of the vehicle ceases immediately to be in force.</p>
          </content>
        </paragraph>
      </section>
      <section eId="sec-12">
        <num>12</num>
        <heading>Suspension of registration</heading>
        <subsection eId="sec-12__subsec-1">
          <num>1</num>
          <content>
            <p><role refersTo="#registrar">The Registrar</role> may, by notice in writing given to its owner, suspend the registration of a vehicle if:</p>
          </content>
          <paragraph eId="sec-12__subsec-1__para-a">
            <num>a</num>
            <content>
              <p>the vehicle has been stolen; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-12__subsec-1__para-b">
            <num>b</num>
            <content>
              <p>if the fee payable under paragraph 9(1)(b) has been paid by cheque—the cheque is dishonoured when presented for payment.</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-12__subsec-2">
          <num>2</num>
          <content>
            <p>The vehicle is taken not to be registered while the registration is suspended.</p>
          </content>
        </subsection>
        <subsection eId="sec-12__subsec-3">
          <num>3</num>
          <content>
            <p>If the registration of a vehicle has been suspended because the vehicle was stolen, <role refersTo="#registrar">the Registrar</role> may, by notice in writing given to its owner, terminate the suspension if <role refersTo="#registrar">the Registrar</role> is satisfied:</p>
          </content>
          <paragraph eId="sec-12__subsec-3__para-a">
            <num>a</num>
            <content>
              <p>in the case of a vehicle owned by the Commonwealth or a Commonwealth authority—that the vehicle has been found; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-12__subsec-3__para-b">
            <num>b</num>
            <content>
              <p>in the case of a vehicle that is leased to the Commonwealth or a Commonwealth authority—that the vehicle has been found and returned to the Commonwealth or <role refersTo="#authority">the authority</role> for use in accordance with the lease.</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-12__subsec-4">
          <num>4</num>
          <content>
            <p>If the registration of a vehicle has been suspended for the reason specified in paragraph (1)(b), <role refersTo="#registrar">the Registrar</role> may, by notice in writing given to its owner, terminate the suspension if <role refersTo="#registrar">the Registrar</role> is satisfied that the amount of the fee payable by the owner of the vehicle under subsection 9(1) has actually been paid.</p>
          </content>
        </subsection>
      </section>
      <section eId="sec-13">
        <num>13</num>
        <heading>Surrender of registration</heading>
        <content>
          <p>The owner of a registered vehicle may, by notice in writing to <role refersTo="#registrar">the Registrar</role>, surrender the registration of the vehicle.</p>
        </content>
      </section>
      <section eId="sec-14">
        <num>14</num>
        <heading>Exemption from registration etc. under State or Territory laws</heading>
        <content>
          <p>If a vehicle is registered under this Part, no person:</p>
        </content>
        <paragraph eId="sec-14__para-a">
          <num>a</num>
          <content>
            <p>is under an obligation under a law of a State or Territory:</p>
          </content>
        </paragraph>
        <paragraph eId="sec-14__para-i">
          <num>i</num>
          <content>
            <p>to have the vehicle registered; or</p>
          </content>
        </paragraph>
        <paragraph eId="sec-14__para-ii">
          <num>ii</num>
          <content>
            <p>to apply for the issue of a vehicle licence in respect of the vehicle; or</p>
          </content>
        </paragraph>
        <paragraph eId="sec-14__para-iii">
          <num>iii</num>
          <content>
            <p>to display on the vehicle any registration plates issued under the law of that State or Territory; or</p>
          </content>
        </paragraph>
        <paragraph eId="sec-14__para-iv">
          <num>iv</num>
          <content>
            <p>to ensure that there is in force a third party policy in relation to the use of the vehicle; or</p>
          </content>
        </paragraph>
        <paragraph eId="sec-14__para-b">
          <num>b</num>
          <content>
            <p>may be found guilty of an offence, or be in any way penalised, under a law of a State or Territory for having used the vehicle, or caused or permitted the vehicle to be used, while:</p>
          </content>
        </paragraph>
        <paragraph eId="sec-14__para-i">
          <num>i</num>
          <content>
            <p>the vehicle was not registered; or</p>
          </content>
        </paragraph>
        <paragraph eId="sec-14__para-ii">
          <num>ii</num>
          <content>
            <p>a vehicle licence was not in force in respect of the vehicle; or</p>
          </content>
        </paragraph>
        <paragraph eId="sec-14__para-iii">
          <num>iii</num>
          <content>
            <p>registration plates were not displayed on the vehicle; or</p>
          </content>
        </paragraph>
        <paragraph eId="sec-14__para-iv">
          <num>iv</num>
          <content>
            <p>there was not in force a third party policy in relation to the use of the vehicle;</p>
          </content>
          <content>
            <p>as required under the law of that State or Territory.</p>
          </content>
        </paragraph>
      </section>
      <section eId="sec-15">
        <num>15</num>
        <heading>Regulations may make further provision with respect to registered vehicles</heading>
        <content>
          <p>The regulations may make provision for and in relation to:</p>
        </content>
        <paragraph eId="sec-15__para-a">
          <num>a</num>
          <content>
            <p>the keeping of the register; and</p>
          </content>
        </paragraph>
        <paragraph eId="sec-15__para-b">
          <num>b</num>
          <content>
            <p>the issue, replacement and return of certificates of registration, registration plates and registration labels in respect of registered vehicles; and</p>
          </content>
        </paragraph>
        <paragraph eId="sec-15__para-c">
          <num>c</num>
          <content>
            <p>regulating the display of registration plates and labels on registered vehicles; and</p>
          </content>
        </paragraph>
        <paragraph eId="sec-15__para-d">
          <num>d</num>
          <content>
            <p>prohibiting the defacement, or the alteration (without <role refersTo="#authority">the authority</role> of <role refersTo="#registrar">the Registrar</role>), of certificates of registration, registration plates and registration labels issued in respect of registered vehicles; and</p>
          </content>
        </paragraph>
        <paragraph eId="sec-15__para-e">
          <num>e</num>
          <content>
            <p>prohibiting the display on vehicles of words, letters or digits that are, or other matter that is, capable of being mistaken for a registration plate or label issued in respect of a registered vehicle; and</p>
          </content>
        </paragraph>
        <paragraph eId="sec-15__para-f">
          <num>f</num>
          <content>
            <p>requiring notification to be given to <role refersTo="#registrar">the Registrar</role> of such matters as are prescribed.</p>
          </content>
          <content>
            <p><ref href="#part-3">Part 3</ref>—Exemption from taxation</p>
          </content>
        </paragraph>
      </section>
      <section eId="sec-16">
        <num>16</num>
        <heading>Exemption from State and Territory taxation</heading>
        <subsection eId="sec-16__subsec-1">
          <num>1</num>
          <content>
            <p>Tax is not payable under a law of a State or Territory in respect of:</p>
          </content>
          <paragraph eId="sec-16__subsec-1__para-a">
            <num>a</num>
            <content>
              <p>an exempt matter; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-16__subsec-1__para-b">
            <num>b</num>
            <content>
              <p>anything done (including a transaction entered into or an instrument or document made, executed, lodged or given) because of, or for a purpose connected with, or arising out of, an exempt matter.</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-16__subsec-2">
          <num>2</num>
          <content>
            <p>In subsection (1):</p>
          </content>
          <content>
            <p><b><i>exempt matter</i></b> means any of the following:</p>
          </content>
          <paragraph eId="sec-16__subsec-2__para-a">
            <num>a</num>
            <content>
              <p>the sale by the Commonwealth of a package of DASFLEET assets that includes the fleet, or the major part of the fleet, of vehicles used by it for the purposes of DASFLEET;</p>
            </content>
          </paragraph>
          <paragraph eId="sec-16__subsec-2__para-b">
            <num>b</num>
            <content>
              <p>the sale by the Commonwealth of the fleet, or the major part of the fleet, of vehicles used by it for the purposes of DASFLEET;</p>
            </content>
          </paragraph>
          <paragraph eId="sec-16__subsec-2__para-c">
            <num>c</num>
            <content>
              <p>the lease of a vehicle for a continuous period of at least 3 months to the Commonwealth or a Commonwealth authority;</p>
            </content>
          </paragraph>

        <heading>Regulations</heading>
        <subsection eId="sec-17__subsec-1">
          <num>1</num>
          <content>
            <p>The Governor-General may make regulations prescribing matters:</p>
          </content>
          <paragraph eId="sec-17__subsec-1__para-a">
            <num>a</num>
            <content>
              <p>required or permitted by this Act to be prescribed; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-17__subsec-1__para-b">
            <num>b</num>
            <content>
              <p>necessary or convenient to be prescribed for carrying out or giving effect to this Act.</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-17__subsec-2">
          <num>2</num>
          <content>
            <p>Without limiting subsection (1), the regulations may prescribe penalties not exceeding <quantity refersTo="#penaltyUnit">10 penalty units</quantity> for the contravention of any regulation made under this Act.</p>
