              <p>This Act, other than Parts 2 and 3, commence on the day on which this Act receives the Royal Assent.</p>

              <p>Subject to subsection (3), Parts 2 and 3 commence on a day to be fixed by Proclamation.</p>

              <p>This Act sets the *maximum movement limit for *aircraft movements at  (otherwise than during *curfew periods). It also provides for the *Slot Management Scheme, under which slots for *gate movements at  are allocated. The Scheme is required to be consistent with the maximum movement limit.</p>

              <p><ref href="#part-2">Part 2</ref> sets the *maximum movement limit for *aircraft movements at , and provides for monitoring of compliance with that limit. It also provides for *recovery periods to assist in managing certain disruptions to operations at Sydney Airport.</p>

                  <p>during a *regulated hour—80 aircraft movements in the hour; or</p>
                </content>
              </paragraph>

                  <p>during a *recovery hour—85 aircraft movements in the hour.</p>

                <p>	(1A)	The maximum number of *aircraft movements mentioned in subsection (1) is the <b><i>maximum movement limit</i></b>.</p>

                <p>The total number of *aircraft movements at Sydney Airport in a day must not exceed 1,360 movements outside the *curfew period for the day.</p>

                <p>	(2)	A <b><i>regulated hour</i></b> is a period of 60 minutes starting:</p>

                  <p>on the hour (being one of the 24 hours of a day); or</p>
                </content>
              </paragraph>

                </content>
              </paragraph>

                <p>The purpose of this section is to set the maximum movement limit for the purposes of the *Slot Management Scheme and other provisions of this Act. It does not operate to create rights or obligations except as provided in other provisions of this Act.</p>

            <heading>Minister’s power to determine a lower maximum movement limit</heading>

                <p><role refersTo="#minister">The Minister</role> may, by legislative instrument, determine that paragraph 6(1)(a) is to have effect as if a lower number of *aircraft movements were specified in it.</p>

                <p>While a determination under subsection (1) is in force, paragraph 6(1)(a) has effect as if the lower number of *aircraft movements were specified in it.</p>

                <p>A determination under subsection (1):</p>
              </content>

                  <p>comes into force on the first day after the end of the period during which it can be disallowed by a House of the Parliament, or on a later day specified in the determination; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-1__sec-7__subsec-4__para-b">
                <num>b</num>
                <content>
                  <p>remains in force until the end of the period (if any) specified in the determination, or until <role refersTo="#minister">the Minister</role> revokes the determination.</p>
                </content>

                  <p>If the determination is disallowed, it does not come into force.</p>
                </content>
              </paragraph>
            </subsection>
          </section>
          <section eId="part-2__dvs-1__sec-8">
            <num>8</num>
            <heading>Consultation about determination of lower maximum movement limit</heading>
            <subsection eId="part-2__dvs-1__sec-8__subsec-1">
              <num>1</num>
              <content>
                <p>Before making a determination under subsection 7(1), <role refersTo="#minister">the Minister</role> must, by notifiable instrument, publish a notice:</p>
              </content>
              <paragraph eId="part-2__dvs-1__sec-8__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>stating that <role refersTo="#minister">the Minister</role> is considering making the determination specified in the notice; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-1__sec-8__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>inviting persons covered by any of the following subparagraphs to give the Minister a written submission about the proposed determination <quantity refersTo="#deadline">within 30 days</quantity> after the publication of the notice:</p>

              </paragraph>
              <paragraph eId="part-2__dvs-1__sec-8__subsec-1__para-i">
                <num>i</num>
                <content>
                  <p>	(i)	the airport-operator company (within the meaning of the <i>Airports Act 1996</i>) for Sydney Airport or, if there is more than one such company, the airport-management company (within the meaning of that Act) for Sydney Airport;</p>
                </content>
              </paragraph>

                <num>ii</num>

                  <p>a person specified in the regulations for the purposes of this subparagraph, being a person who represents the interests of all of the aircraft operators who use Sydney Airport to operate scheduled air services;</p>

                </content>

                <p>If a person gives <role refersTo="#minister">the Minister</role> a written submission in accordance with the notice, <role refersTo="#minister">the Minister</role> must have due regard to the submission in making the determination.</p>

                <p>*Airservices  is to monitor compliance with the *maximum movement limit.</p>
              </content>
            </subsection>
            <subsection eId="part-2__dvs-1__sec-9__subsec-2">
              <num>2</num>
              <content>
                <p>*Airservices Australia is not authorised or required to take any action to enforce compliance with the *maximum movement limit.</p>
              </content>
            </subsection>
            <subsection eId="part-2__dvs-1__sec-9__subsec-3">
              <num>3</num>
              <content>
                <p>If *Airservices Australia ceases to provide air traffic services at , <role refersTo="#minister">the Minister</role> may enter into an arrangement with another person who provides, or who is to provide, such air traffic services under which the person agrees to monitor compliance with the *maximum movement limit.</p>

                <p>The regulations may require *Airservices Australia, or a person mentioned in subsection (3) who provides air traffic services, to publish information about compliance with the *maximum movement limit.</p>

            <heading>Minister may make recovery period declaration</heading>

                <p><role refersTo="#minister">The Minister</role> may, by written notice, make a declaration in respect of a period if <role refersTo="#minister">the Minister</role> is satisfied that:</p>

                <content>
                  <p>on the day that includes the period, *aircraft movements at Sydney Airport are significantly disrupted; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-9A__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>the cause or circumstances of the disruption are such that criteria specified by the regulations for the purposes of this paragraph are met; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-9A__subsec-1__para-c">
                <num>c</num>
                <content>
                  <p>*Airservices Australia has recommended to <role refersTo="#minister">the Minister</role> that <role refersTo="#minister">the Minister</role> make the declaration in respect of the period.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-2__sec-9A__subsec-2">
              <num>2</num>
              <content>
                <p>	(2)	A declaration under subsection (1) is a <b><i>recovery period declaration</i></b>.</p>
              </content>
            </subsection>
            <subsection eId="part-2__dvs-2__sec-9A__subsec-3">
              <num>3</num>
              <content>
                <p>A *recovery period declaration must be made on the same day as the period to which it relates.</p>
              </content>
            </subsection>
            <subsection eId="part-2__dvs-2__sec-9A__subsec-4">

                <p>For the purposes of this section, it is immaterial whether the cause of the disruption:</p>
              </content>
              <paragraph eId="part-2__dvs-2__sec-9A__subsec-4__para-a">

                  <p>directly disrupts *aircraft movements at Sydney Airport; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-9A__subsec-4__para-b">
                <num>b</num>
                <content>
                  <p>occurs elsewhere and, as a consequence, indirectly disrupts aircraft movements at Sydney Airport.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-2__sec-9A__subsec-5">
              <num>5</num>
              <content>
                <p>A *recovery period declaration may be made regardless of whether the disruption has ended or not.</p>
              </content>
            </subsection>
            <subsection eId="part-2__dvs-2__sec-9A__subsec-6">

                <p><role refersTo="#minister">The Minister</role> may make more than 1 *recovery period declaration for a day.</p>

                <p>	(1)	A *gate movement on a day is an <b><i>off</i></b><b><i>-</i></b><b><i>slot movement</i></b> for that day if:</p>

                  <p>a slot permitting the movement on the day on which it occurs has been allocated under the *Slot Management Scheme; but</p>

                  <p>a slot has been allocated under the *Slot Management Scheme that permits a *gate movement for the aircraft on a day; and</p>

                  <p>the aircraft engages in a gate movement on that day; and</p>
                </content>
              </paragraph>

                  <p>the movement does not comply with one or more requirements of the slot for the movement that are specified by the Slot Management Scheme for the purposes of this paragraph.</p>

                  <p>the airline customarily operates aircraft providing air services; and</p>
                </content>
              </paragraph>

                  <p>the airline applies for the allocation of one or more slots under the *Slot Management Scheme; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-4__sec-19__subsec-1__para-c">
                <num>c</num>

                  <p>at the time of the application, the airline has no reasonably practicable plans to conduct one or more of the *gate movements permitted by the slots.</p>

                <p>	(1)	A person (the <b><i>airline</i></b>) contravenes this subsection if:</p>

              <paragraph eId="part-3__dvs-4__sec-20__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>the airline customarily operates aircraft providing air services; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-4__sec-20__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>the airline has been allocated one or more slots under the *Slot Management Scheme; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-4__sec-20__subsec-1__para-c">
                <num>c</num>
                <content>
                  <p>the airline:</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-4__sec-20__subsec-1__para-i">
                <num>i</num>
                <content>
                  <p>decides not to offer, or to no longer offer, an air service for which allocation of the slots was sought; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-4__sec-20__subsec-1__para-ii">
                <num>ii</num>
                <content>
                  <p>becomes aware of other circumstances that make it unlikely that the airline will use the *gate movements permitted by the slots for an air service for which allocation of the slots was sought; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-4__sec-20__subsec-1__para-d">
                <num>d</num>
                <content>
                  <p>the airline does not return the slots to the *Slot Manager, or transfer the slots to another person who holds slots under the Slot Management Scheme:</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-4__sec-20__subsec-1__para-i">
                <num>i</num>
                <content>
                  <p>in the case of subparagraph (c)(i)—<quantity refersTo="#deadline">within 14 days</quantity> after making the decision; or</p>

                <p>For the purposes of subsection (1), it is immaterial whether the conduct, or part of the conduct, of the airline alleged to constitute the contravention occurs before, on or after any deadline specified by the *Slot Management Scheme for the return of unused slots by holders of the slots.</p>

            <heading>Aircraft may make gate movements in emergencies or if Slot Manager makes declared exemption under section 48</heading>

              <p>An aircraft may make a *gate movement at  in circumstances that would otherwise result in the *operator contravening a *civil penalty provision if:</p>

                <p>the aircraft is involved in an emergency as described in <ref href="#sec-30">section 30</ref>; or</p>

                <p>a *declared exemption made under <ref href="#sec-48">section 48</ref> covers the *gate movement; or</p>
              </content>
            </paragraph>

              <num>c</num>
              <content>
                <p>the aircraft is a state aircraft as described in <ref href="#sec-32">section 32</ref>.</p>

            <heading>Emergencies</heading>

              <p>		An aircraft is<b><i> involved in an emergency</i></b> if:</p>

                <p>the aircraft is being used, or is returning after use, for or in connection with:</p>
              </content>
            </paragraph>

                <p>a search and rescue operation; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__dvs-5__sec-30__para-ii">

                <p>The use of a slot may be subject to conditions imposed on the slot.</p>

                  <p>to vary, suspend or cancel slots that have been allocated under the *Slot Management Scheme as specified in the direction; or</p>

                  <p>to exercise the power to issue slots under the Scheme subject to limitations specified in the direction.</p>

                <p>The *Slot Manager may, by instrument in writing, authorise the *operator of an aircraft to conduct a *gate movement in circumstances where the conduct of the gate movement would otherwise contravene a civil penalty provision of this Act.</p>

              <p>For the purposes of Part 7 of the Regulatory Powers Act, each of the following courts is a relevant court in relation to the provisions of this Act:</p>

                <p>the Federal Court of Australia;</p>
              </content>

              </content>
            </paragraph>

                <p>a court of a State or Territory that has jurisdiction in relation to matters arising under this Act.</p>

                <p>Extension to external Territories</p>

        <heading>The Slot Manager</heading>
        <section eId="part-6__sec-60A">
          <num>60A</num>
          <heading>Simplified outline of this Part</heading>
          <content>
            <p>There is a Slot Manager for Sydney Airport. A key function of the Slot Manager is administering the Slot Management Scheme.</p>
            <p><role refersTo="#minister">The Minister</role> appoints the Slot Manager.</p>
            <p>The Slot Manager may charge fees for certain functions it performs.</p>
          </content>
        </section>
        <section eId="part-6__sec-60">
          <num>60</num>
          <heading>The Slot Manager</heading>
          <subsection eId="part-6__sec-60__subsec-1">
            <num>1</num>
            <content>
              <p>There is to be a Slot Manager for .</p>
            </content>
          </subsection>
          <subsection eId="part-6__sec-60__subsec-2">
            <num>2</num>
            <content>
              <p>The functions of the *Slot Manager are:</p>
            </content>
            <paragraph eId="part-6__sec-60__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>administer the *Slot Management Scheme; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-60__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>such other functions as are conferred on the Slot Manager by this Act.</p>
              </content>
            </paragraph>
          </subsection>
        </section>
        <section eId="part-6__sec-61">
          <num>61</num>
          <heading>Appointment of Slot Manager</heading>
          <subsection eId="part-6__sec-61__subsec-1">
            <num>1</num>
            <content>
              <p>	(1)	The Minister may, in writing, appoint a body corporate (including a company incorporated under the <i>Corporations Act 2001</i>) to be the *Slot Manager.</p>
            </content>
          </subsection>
          <subsection eId="part-6__sec-61__subsec-2">
            <num>2</num>
            <content>
              <p>The appointment is to be for a specified period not exceeding 3 years.</p>
            </content>
          </subsection>
          <subsection eId="part-6__sec-61__subsec-3">
            <num>3</num>
            <content>
              <p>The body corporate must be one that <role refersTo="#minister">the Minister</role> considers has, through its members or employees, a good understanding of aviation generally and of the issues involved in slot allocation processes.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-6__sec-62">
          <num>62</num>
          <heading>The legal position of the Slot Manager</heading>
          <content>
            <p>Appointment as Slot Manager does not confer separate legal personality</p>
          </content>
          <subsection eId="part-6__sec-62__subsec-1">
            <num>1</num>
            <content>
              <p>The appointment of a body corporate to be the *Slot Manager does not confer on the body corporate a legal personality that is separate from the legal personality it already has as a body corporate.</p>
            </content>
            <content>
              <p>How legal proceedings taken by or against Slot Manager</p>
            </content>
          </subsection>
          <subsection eId="part-6__sec-62__subsec-2">
            <num>2</num>
            <content>
              <p>Legal proceedings by or against the *Slot Manager are to be taken by or against the body corporate that is the Slot Manager in that body corporate’s own name.</p>
            </content>
            <content>
              <p>Application of the finance law</p>
            </content>
          </subsection>
          <subsection eId="part-6__sec-62__subsec-2A">
            <num>2A</num>
            <content>
              <p>	(2A)	An officer, employee or agent of the *Slot Manager is not an official for the purposes of the finance law (within the meaning of the <i>Public Governance, Performance and Accountability Act 2013</i>).</p>
            </content>
            <content>
              <p>Slot Manager not a Commonwealth authority etc.</p>
            </content>
          </subsection>
          <subsection eId="part-6__sec-62__subsec-3">
            <num>3</num>
            <content>
              <p>Subject to subsections (4) and (5), the body corporate that is the *Slot Manager is not to be taken, merely because it holds that office:</p>
            </content>
            <paragraph eId="part-6__sec-62__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>to be the Commonwealth or a Commonwealth authority; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-62__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>to be established for a public purpose or for a purpose of the Commonwealth; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-62__subsec-3__para-c">
              <num>c</num>
              <content>
                <p>to hold a Commonwealth office or to be a Commonwealth officer; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-62__subsec-3__para-d">
              <num>d</num>
              <content>
                <p>to be a public authority or an agency or instrumentality of the Crown;</p>
              </content>
              <content>
                <p>(within the ordinary meaning of the expression concerned) for the purposes of a law unless a law, or regulations for the purposes of this section, expressly provide otherwise.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-6__sec-62__subsec-4">
            <num>4</num>
            <content>
              <p>	(4)	For the purposes of sections 134.1, 134.2, 135.1 and 135.2 of the <i>Criminal Code</i>, the *Slot Manager is to be taken to be a Commonwealth entity.</p>
            </content>
          </subsection>
          <subsection eId="part-6__sec-62__subsec-5">
            <num>5</num>
            <content>
              <p>	(5)	For the purposes of sections 141.1, 142.1, 142.2, 148.1 and 148.2 of the <i>Criminal Code</i>, the following persons are to be taken to be Commonwealth public officials:</p>
            </content>
            <paragraph eId="part-6__sec-62__subsec-5__para-a">
              <num>a</num>
              <content>
                <p>the *Slot Manager; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-62__subsec-5__para-b">
              <num>b</num>
              <content>
                <p>the employees and agents of the Slot Manager; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-62__subsec-5__para-c">
              <num>c</num>
              <content>
                <p>any person authorised by the Slot Manager, under the *Slot Management Scheme, to exercise powers or perform functions of the Slot Manager in relation to the allocation or management of slots.</p>
              </content>
              <content>
                <p>Interpretation</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-6__sec-62__subsec-6">
            <num>6</num>
            <content>
              <p>In this section:</p>
            </content>
            <content>
              <p><b><i>law </i></b>means:</p>
            </content>
            <paragraph eId="part-6__sec-62__subsec-6__para-a">
              <num>a</num>
              <content>
                <p>an Act of the Commonwealth or of a State or Territory; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-62__subsec-6__para-b">
              <num>b</num>
              <content>
                <p>regulations or any other instrument made under such an Act.</p>
              </content>
            </paragraph>
          </subsection>
        </section>
        <section eId="part-6__sec-63">
          <num>63</num>
          <heading>Termination of appointment</heading>
          <content>
            <p><role refersTo="#minister">The Minister</role> may, in writing, terminate the appointment of a body corporate as the *Slot Manager at any time for any reason.</p>
          </content>
        </section>
        <section eId="part-6__sec-64">
          <num>64</num>
          <heading>Protection of Slot Manager etc. from legal actions</heading>
          <subsection eId="part-6__sec-64__subsec-1">
            <num>1</num>
            <content>
              <p>No action lies against the *Slot Manager, or against an employee or agent of the Slot Manager acting in the course of that person’s employment or agency, for or in respect of any loss or damage caused by the Slot Manager, or the employee or agent, doing something that is within the Slot Manager’s functions.</p>
            </content>
          </subsection>
          <subsection eId="part-6__sec-64__subsec-2">
            <num>2</num>
            <content>
              <p>Subsection (1) does not cover loss or damage that is wilfully or negligently caused by the *Slot Manager or by the employee or agent.</p>
            </content>
          </subsection>
          <subsection eId="part-6__sec-64__subsec-3">
            <num>3</num>
            <content>
              <p>In this section:</p>
            </content>
            <paragraph eId="part-6__sec-64__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>a reference to the *Slot Manager includes a reference to a person who is a member of the body corporate that is the Slot Manager; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-64__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>a reference to an agent of the Slot Manager acting in the course of that agency includes a reference to a person authorised by the Slot Manager, under the *Slot Management Scheme, to exercise powers or perform functions of the Slot Manager in relation to the allocation or management of slots who is acting in the course of that authority.</p>
              </content>
            </paragraph>
          </subsection>
        </section>
        <section eId="part-6__sec-65">
          <num>65</num>
          <heading>Change of Slot Manager</heading>
          <content>
            <p>The regulations may make provision for matters relating to one body corporate ceasing to be the *Slot Manager and another body corporate becoming the Slot Manager, including:</p>
          </content>
          <paragraph eId="part-6__sec-65__para-a">
            <num>a</num>
            <content>
              <p>the continued effect of things done by the previous Slot Manager; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-6__sec-65__para-b">
            <num>b</num>
            <content>
              <p>the substitution of parties to legal proceedings by or against the previous Slot Manager; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-6__sec-65__para-c">
            <num>c</num>
            <content>
              <p>the transfer of rights and liabilities to the new Slot Manager.</p>
            </content>
          </paragraph>
        </section>
        <section eId="part-6__sec-65A">
          <num>65A</num>
          <heading>Slot Manager may charge fees</heading>
          <subsection eId="part-6__sec-65A__subsec-1">
            <num>1</num>
            <content>
              <p>The *Slot Manager may charge a fee in relation to anything done in performing its function of allocating and managing slots under the *Slot Management Scheme.</p>
            </content>
          </subsection>
          <subsection eId="part-6__sec-65A__subsec-2">
            <num>2</num>
            <content>
              <p>A fee must not be such as to amount to taxation.</p>
            </content>
          </subsection>
        </section>

        <num>7</num>
        <heading>The Compliance Committee</heading>

            <p>This Part establishes the Compliance Committee and sets out its membership and functions.</p>
            <p>The regulations may make provision for matters relating to the Compliance Committee.</p>

              <p>The Compliance Committee is established by this section.</p>

          <subsection eId="part-7__sec-66__subsec-2">
            <num>2</num>
            <content>
              <p>The *Compliance Committee consists of the following members:</p>
            </content>
            <paragraph eId="part-7__sec-66__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>the Chair;</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-66__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>	(b)	a representative of the airport-operator company (within the meaning of the <i>Airports Act 1996</i>) for Sydney Airport or, if there is more than one such company, a representative of the airport-management company (within the meaning of that Act) for Sydney Airport;</p>
              </content>
            </paragraph>

              <num>c</num>
              <content>
                <p>a representative of the *Slot Manager;</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-66__subsec-2__para-d">

              </content>
            </paragraph>
            <paragraph eId="part-7__sec-66__subsec-2__para-e">
              <num>e</num>

                <p>3 other members.</p>
              </content>

                <p>Appointment of members</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-7__sec-66__subsec-3">
            <num>3</num>
            <content>
              <p>The Chair and the members mentioned in paragraph (2)(e) are to be appointed, in writing, by <role refersTo="#minister">the Minister</role>.</p>

              <p>The Chair must be a person who is independent from:</p>

                <p>	(a)	an airport-operator company (within the meaning of the <i>Airports Act 1996</i>) for Sydney Airport; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-66__subsec-4__para-b">
              <num>b</num>
              <content>
                <p>the *Slot Manager; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-66__subsec-4__para-c">
              <num>c</num>
              <content>
                <p>*Airservices Australia; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-66__subsec-4__para-d">
              <num>d</num>
              <content>
                <p>an airline that customarily provides air services (whether or not from Sydney Airport); and</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-66__subsec-4__para-e">
              <num>e</num>
              <content>
                <p>any other person prescribed by the regulations for the purposes of this paragraph.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-7__sec-66__subsec-5">
            <num>5</num>
            <content>
              <p>A person is not eligible to be a member unless <role refersTo="#minister">the Minister</role> is satisfied that the person has appropriate qualifications, knowledge, skills or experience.</p>
            </content>
            <content>
              <p>Functions</p>
            </content>
          </subsection>
          <subsection eId="part-7__sec-66__subsec-6">
            <num>6</num>
            <content>
              <p>The *Compliance Committee has the following functions:</p>
            </content>
            <paragraph eId="part-7__sec-66__subsec-6__para-a">
              <num>a</num>
              <content>
                <p>on its own initiative or at the request of <role refersTo="#minister">the Minister</role>, to inquire into and report to <role refersTo="#minister">the Minister</role> about any of the following matters:</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-66__subsec-6__para-i">
              <num>i</num>
              <content>
                <p>the allocation or use of slots at Sydney Airport;</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-66__subsec-6__para-ii">
              <num>ii</num>
              <content>
                <p>*gate movements at Sydney Airport;</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-66__subsec-6__para-iii">
              <num>iii</num>
              <content>
                <p>compliance with this Act;</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-66__subsec-6__para-b">
              <num>b</num>
              <content>
                <p>to publish information held by the Committee in accordance with the regulations;</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-66__subsec-6__para-c">
              <num>c</num>
              <content>
                <p>such other functions as are conferred on the Committee by this Act;</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-66__subsec-6__para-d">
              <num>d</num>
              <content>
                <p>to do anything incidental to, or conducive to, the performance of the above functions.</p>
              </content>
              <content>
                <p>Minister’s requests</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-7__sec-66__subsec-7">
            <num>7</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> may, in writing, request the *Compliance Committee to inquire into and report to <role refersTo="#minister">the Minister</role> about any matter.</p>
            </content>
          </subsection>
          <subsection eId="part-7__sec-66__subsec-8">
            <num>8</num>
            <content>
              <p>If <role refersTo="#minister">the Minister</role> makes such a request, <role refersTo="#minister">the Minister</role> may determine the *Compliance Committee’s terms of reference for conducting the inquiry and reporting to <role refersTo="#minister">the Minister</role>.</p>
            </content>
          </subsection>
          <subsection eId="part-7__sec-66__subsec-9">
            <num>9</num>
            <content>
              <p>The request must comply with the requirements (if any) prescribed by the regulations.</p>
            </content>
          </subsection>
          <subsection eId="part-7__sec-66__subsec-10">
            <num>10</num>
            <content>
              <p>A request under subsection (7) is not a legislative instrument.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-7__sec-67A">
          <num>67A</num>
          <heading>Minister may give directions to the Compliance Committee</heading>
          <subsection eId="part-7__sec-67A__subsec-1">
            <num>1</num>
            <content>
              <p>	(1)	The Minister may, by notifiable instrument,<i> </i>give written directions to the *Compliance Committee about the performance of its functions.</p>
            </content>
          </subsection>
          <subsection eId="part-7__sec-67A__subsec-2">
            <num>2</num>
            <content>
              <p>A direction under subsection (1) must be of a general nature only.</p>
            </content>
          </subsection>
          <subsection eId="part-7__sec-67A__subsec-3">
            <num>3</num>
            <content>
              <p>The *Compliance Committee must comply with a direction under subsection (1).</p>
            </content>
          </subsection>
        </section>
        <section eId="part-7__sec-67">
          <num>67</num>
          <heading>Regulations may provide for matters relating to the Compliance Committee</heading>
          <content>
            <p>The regulations may make provision for or in relation to the *Compliance Committee, including for or in relation to the following matters:</p>
          </content>
          <paragraph eId="part-7__sec-67__para-a">
            <num>a</num>
            <content>
              <p>the operation and procedures of the Committee;</p>
            </content>
          </paragraph>
          <paragraph eId="part-7__sec-67__para-b">
            <num>b</num>
            <content>
              <p>the appointment of members, including, but not limited to:</p>
            </content>
          </paragraph>
          <paragraph eId="part-7__sec-67__para-i">
            <num>i</num>
            <content>
              <p>how many members may be appointed; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-7__sec-67__para-ii">
            <num>ii</num>
            <content>
              <p>selection criteria or other requirements for appointment; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-7__sec-67__para-iii">
            <num>iii</num>
            <content>
              <p>the duration of appointments; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-7__sec-67__para-iv">
            <num>iv</num>
            <content>
              <p>the terms and conditions of appointments; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-7__sec-67__para-v">
            <num>v</num>
            <content>
              <p>the appointment of acting members; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-7__sec-67__para-vi">
            <num>vi</num>

              <p>the termination of appointments;</p>
            </content>
          </paragraph>

              <p>the resignation of members;</p>

              <p>disclosures of interests by members;</p>

              <p>deputies of members;</p>

              <p>meetings of the Committee, including, but not limited to:</p>
            </content>
          </paragraph>
          <paragraph eId="part-7__sec-67__para-i">
            <num>i</num>
            <content>
              <p>convening of meetings of the Committee; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-7__sec-67__para-ii">
            <num>ii</num>
            <content>
              <p>the number of members who are to constitute a quorum; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-7__sec-67__para-iii">
            <num>iii</num>
            <content>
              <p>the selection of a member to preside at meetings of the Committee in the absence of the Chair; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-7__sec-67__para-iv">
            <num>iv</num>
            <content>
              <p>the manner in which questions arising at a meeting of the Committee are to be decided;</p>
            </content>
          </paragraph>
          <paragraph eId="part-7__sec-67__para-h">
            <num>h</num>
            <content>
              <p>requests made by <role refersTo="#minister">the Minister</role> under subsection 66(7);</p>
            </content>
          </paragraph>
          <paragraph eId="part-7__sec-67__para-i">
            <num>i</num>
            <content>
              <p>administrative and other support for the Committee.</p>
            </content>
          </paragraph>
        </section>
        <section eId="part-7__sec-68">
          <num>68</num>
          <heading>Remuneration</heading>
          <subsection eId="part-7__sec-68__subsec-1">
            <num>1</num>
            <content>
              <p>A member is to be paid the remuneration that is determined by the Remuneration Tribunal. If no determination of that remuneration by the Tribunal is in operation, the member is to be paid the remuneration that is prescribed by the regulations.</p>
            </content>
          </subsection>

              <p>A member entitled to be paid remuneration is to be paid the allowances that are prescribed by the regulations.</p>

              <p>	(4)	This section has effect subject to the <i>Remuneration Tribunal Act 1973</i>.</p>

          </subsection>
        </section>

          <heading>Application of the finance law</heading>
          <content>
            <p>		A member is not an official of the Department for the purposes of the finance law (within the meaning of the <i>Public Governance, Performance and Accountability Act 2013</i>).</p>

          <num>69A</num>
          <heading>Protection from civil actions</heading>
          <content>
            <p>A member is not liable to an action or other proceeding for damages for, or in relation to, an act done or omitted to be done in good faith by the member in the performance or purported performance of any function of the *Compliance Committee.</p>

          <heading>Legal position of the Compliance Committee</heading>
          <content>
            <p>The *Compliance Committee, or a member acting as such a member, is not to be taken:</p>
          </content>

            <num>a</num>
            <content>
              <p>to be the Commonwealth or a Commonwealth authority; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-7__sec-69B__para-b">
            <num>b</num>
            <content>
              <p>to be established for a public purpose or for a purpose of the Commonwealth; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-7__sec-69B__para-c">
            <num>c</num>
            <content>
              <p>to hold a Commonwealth office or to be a Commonwealth officer; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-7__sec-69B__para-d">
            <num>d</num>
            <content>
              <p>to be a public authority or an agency or instrumentality of the Crown;</p>

          <heading>Minister may require information or documents</heading>

              <p>This section applies if <role refersTo="#minister">the Minister</role> believes, on reasonable grounds, that a person is capable of giving any information, or producing any document, that is relevant to:</p>

              <content>
                <p>the allocation or use of slots at Sydney Airport; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-7A__sec-70C__subsec-1__para-b">

                <p>*gate movements at Sydney Airport; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-7A__sec-70C__subsec-1__para-c">

                <p>compliance with this Act; or</p>

                <p>the period (which must be at least 14 days after the day the notice is given) within which the person is to give the information or produce the document;</p>

              <p>A person is liable to a civil penalty if:</p>
            </content>
            <paragraph eId="part-7A__sec-70E__subsec-5__para-a">

                <p>the person is an information holder mentioned in paragraph (1)(d), (g) or (h); and</p>
              </content>
            </paragraph>
            <paragraph eId="part-7A__sec-70E__subsec-5__para-b">

                <p>regulations made for the purposes of subsection (2) impose an obligation on the information holder in relation to publishing information; and</p>

              <p>The section applies in relation to information obtained, or documents received, by <role refersTo="#minister">the Minister</role> in the course of exercising powers, or performing functions or duties, under or for the purposes of this Act.</p>

              <p>To avoid doubt, information or documents covered by subsection (1) may include *commercially sensitive information.</p>
            </content>
            <content>
              <p>Minister may share information or documents</p>
            </content>
          </subsection>
          <subsection eId="part-7A__sec-70F__subsec-3">
            <num>3</num>
            <content>
              <p>	(3)	The Minister may share the information or documents with a person or body (each a <b><i>receiving entity</i></b>) covered by subsection (5) if:</p>

                <p>sharing the information or documents is for the purposes of:</p>

                <p><role refersTo="#minister">the Minister</role> exercising powers, or performing functions or duties, under or for the purposes of this Act; or</p>

                <p>the receiving entity exercising the entity’s powers, or performing the entity’s functions or duties; and</p>

                <p>the information is relevant to the receiving entity’s functions or duties; and</p>
              </content>
            </paragraph>

                <p><role refersTo="#minister">the Minister</role> is satisfied, on reasonable grounds, that the receiving entity has satisfactory arrangements in place for protecting the information or documents; and</p>

                <p>in a case where the regulations provide that information or documents may be shared with the receiving entity only if specified conditions are met—those conditions are met.</p>

              <p>Subsection (3) is subject to sections 70G and 70H (which are about the use and disclosure of protected information).</p>

              <p>Receiving entities</p>
            </content>
          </subsection>

            <content>
              <p>For the purposes of subsection (3), the following persons and bodies are covered by this subsection:</p>
            </content>
            <paragraph eId="part-7A__sec-70F__subsec-5__para-a">
              <num>a</num>
              <content>
                <p>the *Slot Manager;</p>
              </content>
            </paragraph>
            <paragraph eId="part-7A__sec-70F__subsec-5__para-b">
              <num>b</num>
              <content>
                <p>the *Compliance Committee;</p>
              </content>
            </paragraph>
            <paragraph eId="part-7A__sec-70F__subsec-5__para-c">
              <num>c</num>
              <content>
                <p>*Airservices Australia;</p>
              </content>
            </paragraph>
            <paragraph eId="part-7A__sec-70F__subsec-5__para-d">
              <num>d</num>
              <content>
                <p>a person or body engaged to perform a compliance audit under the *Slot Management Scheme or in relation to any other obligation under this Act;</p>
              </content>
            </paragraph>
            <paragraph eId="part-7A__sec-70F__subsec-5__para-e">
              <num>e</num>
              <content>
                <p>	(e)	a Commonwealth entity (within the meaning of the <i>Public Governance, Performance and Accountability Act 2013</i>) that:</p>
              </content>
            </paragraph>
            <paragraph eId="part-7A__sec-70F__subsec-5__para-i">
              <num>i</num>
              <content>
                <p>has functions involving matters relevant to operations at Sydney Airport; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-7A__sec-70F__subsec-5__para-ii">
              <num>ii</num>
              <content>
                <p>is prescribed by the regulations for the purposes of this paragraph;</p>
              </content>
            </paragraph>
            <paragraph eId="part-7A__sec-70F__subsec-5__para-f">
              <num>f</num>
              <content>
                <p>any other person or body prescribed by the regulations for the purposes of this paragraph.</p>
              </content>
              <content>
                <p>Minister may impose limits on use or further sharing</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-7A__sec-70F__subsec-6">
            <num>6</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> may, by notice in writing given to the receiving entity, impose conditions that:</p>
            </content>
            <paragraph eId="part-7A__sec-70F__subsec-6__para-a">
              <num>a</num>
              <content>
                <p>limit the use of the information or documents given to the receiving entity; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-7A__sec-70F__subsec-6__para-b">
              <num>b</num>
              <content>
                <p>prohibit the further sharing of the information or documents by the receiving entity.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-7A__sec-70F__subsec-7">
            <num>7</num>
            <content>
              <p>The receiving entity must comply with any such conditions.</p>
            </content>
            <content>
              <p>Minister under no obligation to advise sharing</p>
            </content>
          </subsection>
          <subsection eId="part-7A__sec-70F__subsec-8">

            <content>
              <p><role refersTo="#minister">The Minister</role> need not notify any other person of <role refersTo="#minister">the Minister</role>’s plans to share the information or the documents with a receiving entity, or that <role refersTo="#minister">the Minister</role> has done so.</p>

              <p>A receiving entity must not use or further disclose the information or documents for a commercial purpose.</p>

              <p>A person contravenes this subsection if:</p>

                <p>the person is, or has been, an *entrusted person; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-7A__sec-70G__subsec-1__para-b">

                <p>the person obtained or generated *protected information in the course of, or for the purposes of:</p>
              </content>
            </paragraph>
            <paragraph eId="part-7A__sec-70G__subsec-1__para-i">

                <p>performing functions or duties, or exercising powers, under or for the purposes of this Act; or</p>
              </content>
            </paragraph>

                <p>assisting another person to perform functions or duties, or exercise powers, under or for the purposes of this Act; and</p>

                <p>information about an identified individual, or an individual who is reasonably identifiable, that if communicated (whether alone or in conjunction with other information) would, or could reasonably be expected to:</p>

              <num>i</num>
              <content>
                <p>endanger the safety of the individual; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-7A__sec-70G__subsec-6__para-ii">

                <p>cause harm to the individual’s physical or mental health; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-7A__sec-70G__subsec-6__para-iii">

                <p>have a substantial adverse effect on the individual’s lawful business, professional, commercial or financial affairs; or</p>

                <p>expose the individual to a substantial risk of being a victim of identity fraud; or</p>

          <heading>Authorisations to use or disclose protected information</heading>

            <p>Use or disclosure in performing functions or exercising powers under this Act</p>

              <p>An *entrusted person may use or disclose *protected information in performing functions or duties, or exercising powers, under or for the purposes of this Act.</p>

              <p>	(3)	An *entrusted person may use *protected information, or disclose protected information to an enforcement body (within the meaning of the <i>Privacy Act 1988</i>), if the person reasonably believes that the use or disclosure is reasonably necessary for, or directly related to, one or more enforcement-related activities being conducted by, or on behalf of, that enforcement body.</p>

              <p>An enforcement body to which *protected information is disclosed under subsection (3) may use or disclose the information for the purposes of one or more enforcement-related activities being conducted by, or on behalf of, that enforcement body.</p>

            </paragraph>

                <p>under the seal of the body corporate; or</p>

            <heading>Definitions</heading>

              <p>In this Act, unless the contrary intention appears:</p>
              <p><b><i>aircraft</i></b> means any machine or craft that can derive support in the atmosphere from the reactions of the air.</p>
              <p><b><i>aircraft movement</i></b> means:</p>
              <p><b><i>Airservices Australia</i></b> means the body called Airservices  that is established by the <i>Air Services Act 1995</i>.</p>
              <p><b><i>associated</i></b>: an *aircraft movement and a *gate movement are <b><i>associated</i></b> if:</p>
              <p><b><i>block time</i></b>: see section 14.</p>
              <p><b><i>Chair</i></b> means the Chair of the *Compliance Committee.</p>
              <p><b><i>civil penalty provision</i></b> has the same meaning as in the Regulatory Powers Act.</p>
              <p><b><i>commercially sensitive information</i></b>: see subsection 70G(5).</p>
              <p><b><i>Compliance Committee</i></b> means the committee established by subsection 66(1).</p>
              <p><b><i>curfew period</i></b> has the same meaning as in the <i> Curfew Act 1995</i>.</p>
              <p><b><i>declared exemption</i></b> means an instrument made by the *Slot Manager under section 47 or 48.</p>
              <p><b><i>entrusted person</i></b>: see subsection 70G(3).</p>
              <p><b><i>gate movement</i></b>: see section 11.</p>
              <p><b><i>maximum movement limit</i></b>: see subsection 6(1A).</p>
              <p><b><i>member</i></b> means a member of the *Compliance Committee and includes the Chair.</p>
              <p><b><i>no</i></b><b><i>-</i></b><b><i>slot movement</i></b>: see section 12.</p>
              <p><b><i>off</i></b><b><i>-</i></b><b><i>slot movement</i></b>: see section 13.</p>
              <p><b><i>operator</i></b> of an aircraft means the person who, when a *gate movement using the aircraft occurs, is:</p>
              <p><b><i>protected information</i></b>: see subsection 70G(4).</p>
              <p><b><i>recovery hour</i></b>: see subsection 9B(3).</p>
              <p><b><i>recovery period</i></b>: see subsection 9B(1).</p>
              <p><b><i>recovery period declaration</i></b>: see subsection 9A(2).</p>
              <p><b><i>regulated hour</i></b>: see subsections 6(2) and (3).</p>
              <p><b><i>Regulatory Powers Act</i></b> means the <i>Regulatory Powers (Standard Provisions) Act 2014</i>.</p>
              <p><b><i>Secretary</i></b> means the Secretary of the Department.</p>
              <p><b><i>sensitive personal information</i></b>: see subsection 70G(6).</p>
              <p><b><i>slot</i></b>: see subsection 34(2).</p>
              <p><b><i>Slot Management Scheme</i></b>: see subsection 34(1).</p>
              <p><b><i>Slot Manager </i></b>means the body corporate appointed under section 61 to hold the office of Slot Manager.</p>
              <p>means the airport known as Sydney (Kingsford-Smith) Airport.</p>

                <b>Editorial changes</b>
              </p>
              <p>The <i>Legislation Act 2003</i> authorises First Parliamentary Counsel to make editorial and presentational changes to a compiled law in preparing a compilation of the law for registration. The changes must not change the effect of the law. Editorial changes take effect from the compilation registration date.</p>
              <p>If the compilation includes editorial changes, the endnotes include a brief outline of the changes in general terms. Full details of any changes can be obtained from the Office of Parliamentary Counsel.</p>

                <b>Misdescribed amendments</b>
              </p>
              <p>A misdescribed amendment is an amendment that does not accurately describe how an amendment is to be made. If, despite the misdescription, the amendment can be given effect as intended, then the misdescribed amendment can be incorporated through an editorial change made under <i>Legislation Act 2003</i>.<ref href="#sec-15V">section 15V</ref> of the </p>
              <p>If a misdescribed amendment cannot be given effect as intended, the amendment is not incorporated and “(md not incorp)” is added to the amendment history.</p>
