            <p>		This Act may be cited as the <i>Telecommunications (Numbering Charges) Act 1997</i>.</p>
          </content>
        </section>
        <section eId="part-1__sec-2">

          <heading>Commencement</heading>
          <subsection eId="part-1__sec-2__subsec-1">
            <num>1</num>
            <content>
              <p>Parts 1 and 4 commence on the day on which this Act receives the Royal Assent.</p>
            </content>
          </subsection>
          <subsection eId="part-1__sec-2__subsec-2">
            <num>2</num>
            <content>
              <p>Parts 2 and 3 commence on <date date="1997-07-01">1 July 1997</date>.</p>

          <heading>Act to bind Crown</heading>
          <content>
            <p>This Act binds the Crown in right of each of the States, of the Australian Capital Territory and of the Northern Territory.</p>
          </content>
        </section>

          <heading>Extension to eligible Territories</heading>
          <subsection eId="part-1__sec-4__subsec-1">
            <num>1</num>
            <content>
              <p>This Act extends to each eligible Territory.</p>

              <p>	(2)	The operation of this Act in relation to Norfolk Island is not affected by the amendments made by <i>Territories Legislation Amendment Act 2016</i>.<ref href="#dvs-1">Division 1</ref> of <ref href="#part-1">Part 1</ref> of Schedule 5 to the </p>

        </section>
        <section eId="part-1__sec-5">
          <num>5</num>
          <heading>Interpretation</heading>
          <content>
            <p>In this Act:</p>
            <p><term refersTo="#term-acma">ACMA</term> means <def>the Australian Communications and Media Authority.</def></p>
            <p><term refersTo="#term-allocation">allocation</term> means <def>the allocation of the number in accordance with: an allocation system; or the rules and processes published by the numbering scheme manager; or if there is no numbering scheme manager—the numbering plan made by the ACMA.</def></p>

            <num>a</num>
            <content>
              <p>an allocation system; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-b">
            <num>b</num>
            <content>
              <p>the rules and processes published by the numbering scheme manager; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-c">
            <num>c</num>
            <content>
              <p>if there is no numbering scheme manager—the numbering plan made by the ACMA.</p>

            <content>
              <p><term refersTo="#term-allocation-system">allocation system</term> means <def>a system determined under <ref href="#sec-463">section 463</ref> of <ref href="">the Telecommunications Act 1997</ref>.</def></p>
              <p><term refersTo="#term-carriage-service-provider">carriage service provider</term> has the same meaning as <def>in <ref href="">the Telecommunications Act 1997</ref>.</def></p>
              <p><term refersTo="#term-eligible-territory">eligible Territory</term> has the same meaning as <def>in <ref href="">the Telecommunications Act 1997</ref>.</def></p>
              <p><term refersTo="#term-number">number</term> has the same meaning as <def>in <ref href="#dvs-2">Division 2</ref> of <ref href="#part-2">Part 2</ref>2 of <ref href="">the Telecommunications Act 1997</ref>.</def></p>
              <p><term refersTo="#term-numbering-plan">numbering plan</term> has the same meaning as <def>in <ref href="">the Telecommunications Act 1997</ref>.</def></p>
              <p><term refersTo="#term-numbering-scheme-manager">numbering scheme manager</term> has the same meaning as <def>in <ref href="">the Telecommunications Act 1997</ref>.</def></p>
              <p><term refersTo="#term-ported">ported</term> means <def>that the carriage service provider or the carrier network involved in providing the service, or both, is changed while the customer continues to receive the carriage service using the number.</def></p>
              <p><term refersTo="#term-standard-telephone-service">standard telephone service</term> has the same meaning as <def>in <ref href="">the Telecommunications Act 1997</ref>.</def></p>
              <p><term refersTo="#term-surrendered">surrendered</term> means <def>surrendered in accordance with: the rules and processes published by the numbering scheme manager; or if there is no numbering scheme manager—the numbering plan made by the ACMA. <b><i>transferred</i></b> has the meanings given by section 5A.</def></p>

            <content>
              <p>the rules and processes published by the numbering scheme manager; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-b">

            <content>
              <p>if there is no numbering scheme manager—the numbering plan made by the ACMA.</p>
            </content>
            <content>
              <p><b><i>transferred</i></b> has the meanings given by section 5A.</p>
              <p><term refersTo="#term-withdrawn">withdrawn</term> means <def>withdrawn in accordance with: the rules and processes published by the numbering scheme manager; or if there is no numbering scheme manager—the numbering plan made by the ACMA.</def></p>

        </section>

          <num>5A</num>
          <heading>Meaning of transferred</heading>
          <subsection eId="part-1__sec-5A__subsec-1A">
            <num>1A</num>
            <content>
              <p>	(1A)	A number is <b><i>transferred</i></b> if it is transferred in accordance with:</p>
            </content>
            <paragraph eId="part-1__sec-5A__subsec-1A__para-a">
              <num>a</num>
              <content>
                <p>the rules and processes published by the numbering scheme manager; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-5A__subsec-1A__para-b">
              <num>b</num>
              <content>
                <p>if there is no numbering scheme manager—the numbering plan made by the ACMA.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-1__sec-5A__subsec-1">
            <num>1</num>
            <content>
              <p>	(1)	A number is <b><i>transferred</i></b> between 2 carriage service providers when the number is ported from one of the providers to the other provider.</p>
            </content>
          </subsection>
          <subsection eId="part-1__sec-5A__subsec-2">
            <num>2</num>
            <content>
              <p>	(2)	Two carriage service providers may enter into a binding written agreement that provides that a number is <b><i>transferred</i></b> from one of them to the other. The carriage service providers must jointly give the ACMA written notice of the transfer, and also give the notice to the numbering scheme manager if there is one. The transfer takes effect on the later of the following:</p>

              <num>a</num>
              <content>
                <p>the day on which the notice is given to the ACMA;</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-5A__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>another day specified in the notice.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-1__sec-5A__subsec-3">
            <num>3</num>
            <content>
              <p>A number is transferred at the time worked out under subsection (1), and not at the time worked out under subsection (2), if the number is ported from one carriage service provider to another when:</p>
            </content>
            <paragraph eId="part-1__sec-5A__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>an agreement described in subsection (2) and relating to the number is in force; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-5A__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>a notice relating to the number has been given as described in that subsection.</p>
              </content>
            </paragraph>
          </subsection>
        </section>

        <heading>Allocation charges</heading>
        <division eId="part-2__dvs-1">
          <num>1</num>
          <heading>Allocation in accordance with an allocation system</heading>

            <heading>Definition of charge</heading>
            <content>
              <p>In this Division:</p>
              <p><term refersTo="#term-charge">charge</term> means <def>charge imposed by this Division.</def></p>
            </content>
          </section>
          <section eId="part-2__dvs-1__sec-7">
            <num>7</num>
            <heading>Imposition of charge</heading>
            <content>
              <p>If a number is allocated to a carriage service provider in accordance with an allocation system, charge is imposed on the allocation of the number to the provider.</p>
            </content>
          </section>
          <section eId="part-2__dvs-1__sec-8">
            <num>8</num>
            <heading>By whom charge payable</heading>
            <content>
              <p>Charge imposed on the allocation of a number to a carriage service provider is payable by the provider.</p>
            </content>
          </section>
          <section eId="part-2__dvs-1__sec-9">
            <num>9</num>
            <heading>Amount of charge</heading>
            <content>
              <p>		The amount of charge imposed on the allocation of a number is equal to the amount that is the eligible amount in relation to the allocation of the number for the purposes of <i>Telecommunications Act 1997</i>.<ref href="#sec-463">section 463</ref> of the </p>
            </content>
          </section>
        </division>
        <division eId="part-2__dvs-2">
          <num>2</num>
          <heading>Allocation otherwise than in accordance with an allocation system</heading>
          <section eId="part-2__dvs-2__sec-10">
            <num>10</num>
            <heading>Definition of charge</heading>
            <content>
              <p>In this Division:</p>
              <p><term refersTo="#term-charge">charge</term> means <def>charge imposed by this Division.</def></p>
            </content>
          </section>
          <section eId="part-2__dvs-2__sec-11">
            <num>11</num>
            <heading>Imposition of charge</heading>
            <content>
              <p>If a number is allocated to a carriage service provider otherwise than in accordance with an allocation system, charge is imposed on the allocation of the number to the provider.</p>
            </content>
          </section>
          <section eId="part-2__dvs-2__sec-12">
            <num>12</num>
            <heading>By whom charge payable</heading>
            <content>
              <p>Charge imposed on the allocation of a number to a carriage service provider is payable by the provider.</p>
            </content>
          </section>
          <section eId="part-2__dvs-2__sec-13">
            <num>13</num>
            <heading>Amount of charge</heading>
            <subsection eId="part-2__dvs-2__sec-13__subsec-1">
              <num>1</num>
              <content>
                <p>The amount of charge imposed on the allocation of a number is the amount ascertained in accordance with a written determination made by the ACMA.</p>
              </content>
            </subsection>
            <subsection eId="part-2__dvs-2__sec-13__subsec-2">
              <num>2</num>
              <content>
                <p>A determination under subsection (1) is a legislative instrument.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-2__dvs-2__sec-14">
            <num>14</num>
            <heading>Maximum charge</heading>
            <content>
              <p>The amount of charge imposed on the allocation of a number must not exceed $100,000.</p>
            </content>
          </section>
          <section eId="part-2__dvs-2__sec-15">
            <num>15</num>
            <heading>Exemption from charge</heading>
            <subsection eId="part-2__dvs-2__sec-15__subsec-1">
              <num>1</num>
              <content>
                <p>A number is exempt from charge if the number is a geographic number allocated to a carriage service provider for the purposes of providing a standard telephone service to a customer.</p>
              </content>
            </subsection>
            <subsection eId="part-2__dvs-2__sec-15__subsec-2">
              <num>2</num>
              <content>
                <p>The ACMA may, by written determination, exempt a specified number from charge.</p>
              </content>

        <heading>Annual charge</heading>

          <heading>Definition of charge</heading>
          <content>
            <p>In this Part:</p>
            <p><term refersTo="#term-charge">charge</term> means <def>charge imposed by this Part.</def></p>
          </content>
        </section>
        <section eId="part-3__sec-17">
          <num>17</num>
          <heading>Holder of a number</heading>
          <subsection eId="part-3__sec-17__subsec-1">
            <num>1</num>
            <content>
              <p>For the purposes of this Part, if a number is allocated or transferred to a carriage service provider at a particular time, the provider holds the number throughout the period:</p>
            </content>
            <paragraph eId="part-3__sec-17__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>beginning at that time; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-17__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>ending when:</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-17__subsec-1__para-i">
              <num>i</num>
              <content>
                <p>the number is subsequently withdrawn; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-17__subsec-1__para-ii">
              <num>ii</num>
              <content>
                <p>the number is subsequently surrendered; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-17__subsec-1__para-iii">
              <num>iii</num>
              <content>
                <p>the number is subsequently transferred from the provider to another carriage service provider;</p>
              </content>
              <content>
                <p>whichever first happens.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-3__sec-17__subsec-2">
            <num>2</num>
            <content>
              <p>For the purposes of this section, the renumbering of a number does not affect the continuity of the holding of the number.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-3__sec-18">
          <num>18</num>
          <heading>Imposition of charge</heading>
          <subsection eId="part-3__sec-18__subsec-1">
            <num>1</num>
            <content>
              <p>If a carriage service provider holds an allocated number at the beginning of a day determined under subsection (2), charge is imposed on the number.</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-18__subsec-2">
            <num>2</num>
            <content>
              <p>Before 16 February in each year, the ACMA must determine in writing a day in April in that year.</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-18__subsec-3">
            <num>3</num>
            <content>
              <p>	(3)	The ACMA must publish the determination in the <i>Gazette</i> before the day determined.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-3__sec-19">
          <num>19</num>
          <heading>By whom charge payable</heading>
          <content>
            <p>Charge imposed on a number is payable by the carriage service provider who holds the number.</p>
          </content>
        </section>

          <heading>Amount of charge</heading>
          <subsection eId="part-3__sec-20__subsec-1">
            <num>1</num>
            <content>
              <p>The amount of charge imposed on a number held at a particular time is the amount ascertained in accordance with a written determination made by the ACMA.</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-20__subsec-2">
            <num>2</num>

          <heading>Maximum charge</heading>

            <p>The amount of charge imposed on a number held at a particular time must not exceed $100,000.</p>

          <heading>Exemption from charge</heading>

              <p>A number is exempt from charge if the number is a geographic number allocated to a carriage service provider for the purposes of providing a standard telephone service to a customer.</p>

              <p>The ACMA may, by written determination, exempt a specified number from charge.</p>

              <p>The legislation history in endnote 3 provides information about each law that has amended (or will amend) the compiled law. The information includes commencement details for amending laws and details of any application, saving or transitional provisions that are not included in this compilation.</p>
              <p>The amendment history in endnote 4 provides information about amendments at the provision (generally section or equivalent) level. It also includes information about any provision of the compiled law that has been repealed in accordance with a provision of the law.</p>

                <b>Editorial changes</b>
              </p>
              <p>The <i>Legislation Act 2003</i> authorises First Parliamentary Counsel to make editorial and presentational changes to a compiled law in preparing a compilation of the law for registration. The changes must not change the effect of the law. Editorial changes take effect from the compilation registration date.</p>
              <p>If the compilation includes editorial changes, the endnotes include a brief outline of the changes in general terms. Full details of any changes can be obtained from the Office of Parliamentary Counsel.</p>

                <b>Misdescribed amendments</b>
              </p>
              <p>A misdescribed amendment is an amendment that does not accurately describe the amendment to be made. If, despite the misdescription, the amendment can be given effect as intended, the amendment is incorporated into the compiled law and the abbreviation “(md)” added to the details of the amendment included in the amendment history.</p>
              <p>If a misdescribed amendment cannot be given effect as intended, the abbreviation “(md not incorp)” is added to the details of the amendment included in the amendment history.</p>
