          <heading>Short title</heading>
          <content>
            <p>		This Act may be cited as the <i>International Transfer of Prisoners Act 1997</i>.</p>
          </content>
        </section>
        <section eId="part-1__sec-2">
          <num>2</num>
          <heading>Commencement</heading>
          <subsection eId="part-1__sec-2__subsec-1">
            <num>1</num>
            <content>
              <p>Sections 1 and 2 commence on the day on which this Act receives the Royal Assent.</p>
            </content>
          </subsection>
          <subsection eId="part-1__sec-2__subsec-2">
            <num>2</num>
            <content>
              <p>The remaining provisions of this Act commence on a day or days to be fixed by Proclamation.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-1__sec-3">
          <num>3</num>
          <heading>Objects of Act</heading>
          <content>
            <p>The objects of this Act are:</p>
          </content>
          <paragraph eId="part-1__sec-3__para-a">
            <num>a</num>
            <content>
              <p>to facilitate the transfer of prisoners between Australia and certain countries with which Australia has entered agreements for the transfer of prisoners so that the prisoners may serve their sentences of imprisonment in their countries of nationality or in countries with which they have community ties; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-b">
            <num>b</num>
            <content>
              <p>to facilitate the transfer of prisoners to  from countries in which prisoners are serving sentences of imprisonment imposed by certain war crimes tribunals.</p>
            </content>
          </paragraph>
        </section>
        <section eId="part-1__sec-4">
          <num>4</num>
          <heading>Definitions</heading>
          <subsection eId="part-1__sec-4__subsec-1">
            <num>1</num>
            <content>
              <p>In this Act, unless the contrary intention appears:</p>
            </content>
            <content>
              <p><term refersTo="#term-act">ACT</term> means <def>the .</def></p>
              <p><term refersTo="#term-act-minister">ACT Minister</term> means <def>the Minister for the ACT administering the law of the ACT relating to the transfer of prisoners and includes any Minister acting for the time being for or on behalf of that Minister.</def></p>
              <p><term refersTo="#term-appropriate-ministerial-consent">appropriate Ministerial consent</term> means <def>Ministerial consent given as required by <ref href="#sec-5">section 5</ref>.</def></p>
              <p><term refersTo="#term-attorney-general">Attorney-General</term> means <def>the Attorney-General of the Commonwealth.</def></p>
              <p><term refersTo="#term-australian-court">Australian court</term> means <def>a court or tribunal of the Commonwealth, a State or a Territory.</def></p>
              <p><term refersTo="#term-australian-law">Australian law</term> means <def>a law of the Commonwealth, a State or a Territory.</def></p>
              <p><b><i>child</i></b>: without limiting who is a child of a person for the purposes of this Act, someone is the <b><i>child</i></b> of a person if he or she is a child of the person within the meaning of the <i>Family Law Act 1975</i>.</p>
              <p><b><i>close family member</i></b>: see section 4AA.</p>
              <p><term refersTo="#term-community-ties">community ties</term> has the meaning given by <def>subsections (4) and (5).</def></p>
              <p><b><i>continued enforcement method</i></b>, in relation to enforcement of a sentence of imprisonment, has the meaning given by section 42.</p>
              <p><b><i>converted enforcement method</i></b>, in relation to enforcement of a sentence of imprisonment, has the meaning given by section 42.</p>
              <p><term refersTo="#term-de-facto-partner">de facto partner</term> has the meaning given by <def><ref href="">the Acts Interpretation Act 1901</ref>.</def></p>
              <p><term refersTo="#term-escort-officer">escort officer</term> means <def>the police officer, prison officer or other person specified in the warrant authorising the transfer of the prisoner under this Act as the escort officer for the prisoner.</def></p>
              <p><term refersTo="#term-extradition-country">extradition country</term> has the same meaning as <def>in <ref href="">the Extradition Act 1988</ref>.</def></p>
              <p><b><i>federal prisoner</i></b>:</p>
            </content>
            <paragraph eId="part-1__sec-4__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>means a prisoner who is serving a sentence of imprisonment imposed under a law of the Commonwealth; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>	(b)	includes a prisoner who is serving a sentence of imprisonment imposed under a law of the  and who was, before 12 June 1985, removed to the State of  under <i>Removal of Prisoners (Territories) Act 1923</i>.<ref href="#sec-3">section 3</ref> of the </p>
              </content>
              <content>
                <p><term refersTo="#term-foreign-law">foreign law</term> means <def>a law of a foreign country or of a part of, or in force in a part of, a foreign country.</def></p>
                <p><b><i>Former Yugoslavia Tribunal</i></b>:</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>means the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991, established by United Nations Security Council Resolution 827 S/RES/827 (1993); and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>includes the organs referred to in Article 11 of the Statute of the Tribunal.</p>
              </content>

                <p><b><i>International Residual Mechanism for Criminal Tribunals</i></b>:</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>means the International Residual Mechanism for Criminal Tribunals, established by United Nations Security Council Resolution 1966 S/RES/1966 (2010); and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>includes the organs referred to in Article 4 of the Statute of the Tribunal.</p>
              </content>

              <content>
                <p><b><i>joint prisoner</i></b> means:</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>a prisoner who is serving sentences of imprisonment imposed under the laws of 2 or more of the States and Territories; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>a federal prisoner who is also serving one or more sentences of imprisonment imposed under the laws of one or more of the States and Territories.</p>
              </content>
              <content>
                <p><b><i>law</i></b> of the Commonwealth, a State or a Territory, means a law (whether written or unwritten) of the Commonwealth, that State or that Territory, and includes a law (whether written or unwritten) in force in the Commonwealth, that State or that Territory or in any part of the Commonwealth, that State or that Territory.</p>
                <p><term refersTo="#term-mental-illness">mental illness</term> means <def>an underlying pathological infirmity of the mind, whether of long or short duration and whether permanent or temporary, but does not include a condition that results from the reaction of a healthy mind to extraordinary stimuli.</def></p>
                <p><term refersTo="#term-mental-impairment">mental impairment</term> includes <def>senility, intellectual disability, mental illness, brain damage and severe personality disorder.</def></p>
                <p><b><i>mentally impaired prisoner</i></b> means:</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>a person serving a sentence of imprisonment on the acquittal of the person for an offence on the ground of mental impairment; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>a person serving a sentence of imprisonment because the person has been found mentally unfit to stand trial.</p>
              </content>
              <content>
                <p><term refersTo="#term-national-of-a-country">national of a country</term> means <def>a person who is a citizen of the country under the law of the country.</def></p>
                <p><term refersTo="#term-non-parole-period">non-parole period</term> means <def>that part of the period of imprisonment for that sentence during which the person is not to be released on parole, whether that part of the period is fixed or recommended by a court or tribunal or fixed by operation of law.</def></p>
                <p><term refersTo="#term-non-tribunal-offence">non-Tribunal offence</term> means <def>an offence other than a Tribunal offence.</def></p>
                <p><b><i>parent</i></b>: without limiting who is a parent of a person for the purposes of this Act, someone is the <b><i>parent</i></b> of a person if the person is his or her child because of the definition of <b><i>child</i></b> in this subsection.</p>
                <p><b><i>police officer</i></b> means:</p>

                <p>a mentally impaired prisoner; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-1__para-b">

                <p>a person who has been released on parole.</p>
              </content>
              <content>
                <p><term refersTo="#term-prisoner-s-representative">prisoner’s representative</term> means <def>a person who may consent to the transfer of a prisoner as referred to in <ref href="#sec-6">section 6</ref>.</def></p>
                <p><term refersTo="#term-prison-officer">prison officer</term> means <def>a person appointed or employed to assist in the management of a prison.</def></p>
                <p><term refersTo="#term-release-on-parole">release on parole</term> means <def>any form of conditional release in the nature of parole and includes: release on probation; and release on licence to be at large. <b><i>Rwanda Tribunal</i></b>: means the International Criminal Tribunal for the Prosecution of Persons Responsible for Genocide and Other Serious Violations of International Humanitarian Law Committed in the Territory of Rwanda and Rwandan citizens responsible for genocide and other such violations committed in the territory of neighbouring States, between <date date="1994-01-01">1 January 1994</date> and <date date="1994-12-31">31 December 1994</date>, established by United Nations Security Council Resolution 955 S/RES/955 (1994); and includes the organs referred to in Article 10 of the Statute of the Tribunal.</def></p>

                <p><term refersTo="#term-state-prisoner">State prisoner</term> means <def>a prisoner who is serving a sentence of imprisonment imposed under a law of a State.</def></p>
                <p><b><i>Statute of the Tribunal</i></b> means:</p>

            </paragraph>

                <p><term refersTo="#term-territory-prisoner">Territory prisoner</term> means <def>a prisoner who is serving a sentence of imprisonment imposed under a law of a Territory.</def></p>
                <p><term refersTo="#term-transfer-country">transfer country</term> means <def>a foreign country or a region that is declared by the regulations under <ref href="#sec-8">section 8</ref> to be a transfer country.</def></p>
                <p><term refersTo="#term-treaty">treaty</term> includes <def>a convention, protocol, agreement or arrangement.</def></p>
                <p><b><i>Tribunal</i></b> means:</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>the Former  Tribunal; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>the  Tribunal; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>the International Residual Mechanism for Criminal Tribunals.</p>
              </content>
              <content>
                <p><term refersTo="#term-tribunal-country">Tribunal country</term> means <def>a foreign country in which a Tribunal prisoner is serving, or is to serve, a sentence of imprisonment imposed by the Tribunal.</def></p>
                <p><b><i>Tribunal offence</i></b> means:</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>an offence in relation to which the Former Yugoslavia Tribunal has the power to prosecute persons under Article 2, 3, 4 or 5 of the Statute of the Tribunal; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>an offence in relation to which the Rwanda Tribunal has the power to prosecute persons under Article 2, 3 or 4 of the Statute of the Tribunal; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>an offence in relation to which the International Residual Mechanism for Criminal Tribunals has the power to prosecute persons under Article 1 of the Statute of the Tribunal.</p>
              </content>
              <content>
                <p><term refersTo="#term-tribunal-prisoner">Tribunal prisoner</term> means <def>a prisoner who is serving a sentence of imprisonment imposed by a Tribunal for a Tribunal offence.</def></p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-1__sec-4__subsec-2">
            <num>2</num>
            <content>
              <p>For the purposes of this Act, the following persons are taken not to be serving a sentence of imprisonment:</p>
            </content>
            <paragraph eId="part-1__sec-4__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>a person who has been released by a court from serving the whole or a part of a sentence of imprisonment on the person giving a security (with or without sureties) by recognisance or otherwise, that the person will comply with conditions relating to the person’s behaviour and in relation to whom action can no longer be taken because of a breach of a condition of the security or because of the expiration of the security;</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>a person who, through exercise of the Royal prerogative of mercy or other executive prerogative or discretion given by law, is no longer required to serve the whole or part of a sentence of imprisonment;</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>a person on whom a sentence of imprisonment has been imposed that has not yet commenced.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-1__sec-4__subsec-3">
            <num>3</num>
            <content>
              <p>If a sentence of death imposed on a person has been commuted to a term of imprisonment or to imprisonment for life, this Act applies to and in relation to the person as if the sentence of death had been a sentence of imprisonment for that term or for life.</p>
            </content>
          </subsection>
          <subsection eId="part-1__sec-4__subsec-4">
            <num>4</num>
            <content>
              <p>	(4)	For the purposes of this Act, a prisoner has <b><i>community ties</i></b> with a transfer country if:</p>
            </content>
            <paragraph eId="part-1__sec-4__subsec-4__para-a">
              <num>a</num>
              <content>
                <p>the prisoner’s principal place of residence immediately before being sentenced to imprisonment in  was in the transfer country; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-4__para-b">
              <num>b</num>
              <content>
                <p>the principal place of residence of a close family member of the prisoner is in the transfer country; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-4__para-d">
              <num>d</num>
              <content>
                <p>the prisoner has a close continuing relationship (involving frequent personal contact and a personal interest in the other person’s welfare) with anyone whose principal place of residence is in the transfer country.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-1__sec-4__subsec-5">
            <num>5</num>
            <content>
              <p>	(5)	For the purposes of this Act, a prisoner has <b><i>community ties</i></b> with a State or a Territory if:</p>
            </content>
            <paragraph eId="part-1__sec-4__subsec-5__para-a">
              <num>a</num>
              <content>
                <p>the prisoner’s principal place of residence immediately before being sentenced to imprisonment in the transfer country was in that State or Territory; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-5__para-b">
              <num>b</num>
              <content>
                <p>the principal place of residence of a close family member of the prisoner is in that State or Territory; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-5__para-d">
              <num>d</num>
              <content>
                <p>the prisoner has a close continuing relationship (involving frequent personal contact and a personal interest in the other person’s welfare) with anyone whose principal place of residence is in that State or Territory.</p>
              </content>
            </paragraph>
          </subsection>
        </section>
        <section eId="part-1__sec-4AA">
          <num>4AA</num>
          <heading>Close family member</heading>
          <subsection eId="part-1__sec-4AA__subsec-1">
            <num>1</num>
            <content>
              <p>	(1)	A <b><i>close family member</i></b> of a person is:</p>
            </content>
            <paragraph eId="part-1__sec-4AA__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>the person’s spouse or de facto partner; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4AA__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>a parent, step-parent or grandparent of the person; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4AA__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>a child, stepchild or grandchild of the person; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4AA__subsec-1__para-d">
              <num>d</num>
              <content>
                <p>a brother, sister, stepbrother or stepsister of the person; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4AA__subsec-1__para-e">
              <num>e</num>
              <content>
                <p>a guardian or carer of the person.</p>
              </content>

            <content>
              <p>For the purposes of, and without limiting, subsection (1):</p>
            </content>
            <paragraph eId="part-1__sec-4AA__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>	(a)	if one person is the child of another person because of the definition of <b><i>child</i></b>, relationships traced to or through the person are to be determined on the basis that the person is the child of the other person; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4AA__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>	(b)	someone is the <b><i>stepchild</i></b>, <b><i>stepbrother</i></b>, <b><i>stepsister</i></b> or <b><i>step</i></b><b><i>-</i></b><b><i>parent</i></b> of another person if this would be the case except that 2 persons who are each other’s de facto partner are not legally married.</p>
              </content>
            </paragraph>
          </subsection>
        </section>
        <section eId="part-1__sec-4A">
          <num>4A</num>
          <heading>Sentences of imprisonment imposed by military commissions of the</heading>
          <content>
            <p>For the purposes of this Act:</p>
          </content>
          <paragraph eId="part-1__sec-4A__para-a">
            <num>a</num>
            <content>
              <p>a military commission of the United States of America is taken to be a court or tribunal of the United States of America; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4A__para-b">
            <num>b</num>
            <content>
              <p>any punishment or measure involving deprivation of liberty ordered by a military commission of the United States of America is taken to have been ordered by a court or tribunal of the United States of America in the exercise of its criminal jurisdiction; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4A__para-c">
            <num>c</num>
            <content>
              <p>any direction or order given or made by a military commission of the  with respect to the commencement of such punishment or measure is taken to have been given or made by a court or tribunal of the .</p>
            </content>
          </paragraph>
        </section>
        <section eId="part-1__sec-4B">
          <num>4B</num>
          <heading>Suspended sentences of imprisonment</heading>
          <subsection eId="part-1__sec-4B__subsec-1">
            <num>1</num>
            <content>
              <p>	(1)	<b><i>Serving</i></b> a sentence of imprisonment includes being subject to so much of the period of the sentence of imprisonment as involves a potential deprivation of liberty.</p>
            </content>

                <p>Note:	While a person is subject to a suspended sentence of imprisonment, he or she is treated under this Act as a prisoner serving that sentence of imprisonment.</p>

            <num>2</num>
            <content>
              <p>	(2)	The <b><i>suspended part</i></b> of a sentence of imprisonment is so much of the period of the sentence of imprisonment as:</p>
            </content>
            <paragraph eId="part-1__sec-4B__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>involves a potential deprivation of liberty; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4B__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>is not a period of release on parole.</p>
              </content>
            </paragraph>
          </subsection>
        </section>
        <section eId="part-1__sec-5">
          <num>5</num>
          <heading>Appropriate Ministerial consent to transfer</heading>
          <subsection eId="part-1__sec-5__subsec-1">
            <num>1</num>
            <content>
              <p>Ministerial consent to the transfer of a prisoner from  to a transfer country is required to be given:</p>
            </content>
            <paragraph eId="part-1__sec-5__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>if the prisoner is a federal prisoner—by the Attorney-General; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-5__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>if the prisoner is a State prisoner—by both the Attorney-General and the State Minister concerned; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-5__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>if the prisoner is a Territory prisoner—by both the Attorney-General and the Territory Minister concerned; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-5__subsec-1__para-d">
              <num>d</num>
              <content>
                <p>if the prisoner is a joint prisoner—by the Attorney-General and all State Ministers or Territory Ministers concerned.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-1__sec-5__subsec-2">
            <num>2</num>
            <content>
              <p>Ministerial consent to the transfer of a prisoner from a transfer country to  is required to be given:</p>
            </content>
            <paragraph eId="part-1__sec-5__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>by both the Attorney-General and the State or Territory Minister of the State or Territory in which the prisoner is to begin to complete serving a sentence of imprisonment imposed by the transfer country in accordance with this Act; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-5__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>if applicable:</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-5__subsec-2__para-i">
              <num>i</num>
              <content>
                <p>if the prisoner is to begin to complete serving a sentence of imprisonment imposed by the transfer country in accordance with this Act in New South Wales but has community ties with the ACT, the Jervis Bay Territory or Norfolk Island—by the ACT Minister or Territory Minister concerned; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-5__subsec-2__para-ii">
              <num>ii</num>
              <content>
                <p>if the prisoner is to begin to complete serving a sentence of imprisonment imposed by the transfer country in accordance with this Act in  but has community ties with a Territory other than the  or —by the Territory Minister.</p>
              </content>

              <p>Ministerial consent to the transfer of a Tribunal prisoner from a Tribunal country to  is required to be given by the Attorney-General and the State Minister or Territory Minister of the State or Territory in which the Tribunal prisoner is to begin to complete serving the sentence of imprisonment imposed by the Tribunal in accordance with this Act.</p>

          <num>6</num>
          <heading>Prisoner’s and prisoner’s representative’s consent to transfer</heading>
          <subsection eId="part-1__sec-6__subsec-1">
            <num>1</num>
            <content>
              <p>A prisoner may consent to his or her transfer under this Act only if:</p>
            </content>
            <paragraph eId="part-1__sec-6__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>the prisoner is an adult; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-6__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>the prisoner is capable of consenting to the transfer.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-1__sec-6__subsec-2">

              <p>	(2)	A prisoner’s close family member, or legal representative, (the <b><i>prisoner’s representative</i></b>) may consent to the prisoner’s transfer under this Act if:</p>
            </content>
            <paragraph eId="part-1__sec-6__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>the prisoner is not an adult; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-6__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>the prisoner is incapable of consenting to the transfer.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-1__sec-6__subsec-3">
            <num>3</num>
            <content>
              <p>A prisoner or prisoner’s representative must be informed, through an interpreter if necessary, in language (including sign language or braille) in which the prisoner or prisoner’s representative is able to communicate with reasonable fluency, of the legal consequences of transfer of the prisoner under this Act before consenting to the transfer.</p>
            </content>
          </subsection>
          <subsection eId="part-1__sec-6__subsec-4">
            <num>4</num>
            <content>
              <p>The prisoner’s or prisoner’s representative’s consent to transfer must be accompanied by certification by the prisoner or prisoner’s representative that he or she has been so informed.</p>
            </content>
          </subsection>
          <subsection eId="part-1__sec-6__subsec-5">
            <num>5</num>
            <content>
              <p>For the purposes of this section, a prisoner is incapable of consenting to his or her transfer if the prisoner is an adult who:</p>
            </content>
            <paragraph eId="part-1__sec-6__subsec-5__para-a">
              <num>a</num>
              <content>
                <p>is incapable of understanding the general nature and effect of the transfer; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-6__subsec-5__para-b">
              <num>b</num>
              <content>
                <p>is incapable of indicating whether he or she consents or does not consent to a transfer.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-1__sec-6__subsec-6">
            <num>6</num>
            <content>
              <p>A prisoner’s or prisoner’s representative’s consent to transfer cannot be withdrawn after the prisoner leaves the country from which the prisoner is being transferred.</p>
            </content>
          </subsection>
          <subsection eId="part-1__sec-6__subsec-7">
            <num>7</num>
            <content>
              <p>In this section:</p>
            </content>
            <content>
              <p><b><i>adult</i></b> means:</p>
            </content>
            <paragraph eId="part-1__sec-6__subsec-7__para-a">
              <num>a</num>
              <content>
                <p>in the case of a prisoner in —a person of or above 18 years of age; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-6__subsec-7__para-b">
              <num>b</num>
              <content>
                <p>in the case of a prisoner in a transfer country or a Tribunal country—a person of or above the age that under the law of that country is the age at which a person is considered for legal purposes to be an adult.</p>
              </content>
            </paragraph>
          </subsection>
        </section>
        <section eId="part-1__sec-7">
          <num>7</num>
          <heading>Extension to external Territories</heading>
          <content>
            <p>This Act extends to the external Territories.</p>
          </content>
        </section>
        <section eId="part-1__sec-8">
          <num>8</num>
          <heading>Application of Act to transfer countries</heading>
          <subsection eId="part-1__sec-8__subsec-1">
            <num>1</num>
            <content>
              <p>The regulations may provide that this Act applies to a foreign country declared by the regulations to be a transfer country for the purposes of this Act.</p>
            </content>
          </subsection>
          <subsection eId="part-1__sec-8__subsec-2">
            <num>2</num>
            <content>
              <p>The regulations may declare that this Act applies in relation to such a foreign country subject to limitations, conditions, exceptions or qualifications referred to in the regulations.</p>
            </content>
          </subsection>
          <subsection eId="part-1__sec-8__subsec-3">
            <num>3</num>
            <content>
              <p>The limitations, conditions, exceptions or qualifications in relation to a transfer country that may be referred to in the regulations are any one or more of the following:</p>
            </content>
            <paragraph eId="part-1__sec-8__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>limitations, conditions, exceptions or qualifications that are necessary to give effect to a bilateral treaty in relation to transfer of prisoners to or from that country, a copy of which is set out in the regulations;</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-8__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>limitations, conditions, exceptions or qualifications that are necessary to give effect to a multilateral treaty in relation to transfer of prisoners to or from that country, a copy of which is set out in the regulations;</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-8__subsec-3__para-c">
              <num>c</num>
              <content>
                <p>limitations, conditions, exceptions or qualifications (other than limitations, conditions, exceptions or qualifications that are necessary to give effect to a treaty) for the transfer of prisoners to or from that country that are set out, or identified in any other way, in the regulations.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-1__sec-8__subsec-4">
            <num>4</num>
            <content>
              <p>The limitations, conditions, exceptions or qualifications that are necessary to give effect to a treaty in relation to a transfer country may be expressed in the form that this Act applies to that country subject to the treaty.</p>
            </content>
          </subsection>
          <subsection eId="part-1__sec-8__subsec-5">
            <num>5</num>
            <content>
              <p>For the purposes of the application of this Act in relation to a transfer country:</p>
            </content>
            <paragraph eId="part-1__sec-8__subsec-5__para-a">
              <num>a</num>
              <content>
                <p>a colony, territory or protectorate of that country; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-8__subsec-5__para-b">
              <num>b</num>
              <content>
                <p>a region that is part of that country; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-8__subsec-5__para-c">
              <num>c</num>
              <content>
                <p>a region that is under the protection of that country; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-8__subsec-5__para-d">
              <num>d</num>
              <content>
                <p>a region over which that country exercises jurisdiction or control; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-8__subsec-5__para-e">
              <num>e</num>
              <content>
                <p>a region for whose international relations that country is responsible;</p>
              </content>
              <content>
                <p>are taken to be part of the country.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-1__sec-8__subsec-6">
            <num>6</num>
            <content>
              <p>	(6)	For the purposes of this section, a region is taken to be a <b><i>foreign country</i></b> if:</p>
            </content>
            <paragraph eId="part-1__sec-8__subsec-6__para-a">
              <num>a</num>
              <content>
                <p>the region is a colony, territory or protectorate of a foreign country; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-8__subsec-6__para-b">
              <num>b</num>
              <content>
                <p>the region is part of a foreign country; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-8__subsec-6__para-c">
              <num>c</num>
              <content>
                <p>the region is under the protection of a foreign country; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-8__subsec-6__para-d">
              <num>d</num>
              <content>
                <p>a foreign country exercises jurisdiction or control over the region; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-8__subsec-6__para-e">
              <num>e</num>
              <content>
                <p>a foreign country is responsible for the region’s international relations.</p>
              </content>
            </paragraph>
          </subsection>
        </section>
        <section eId="part-1__sec-9">
          <num>9</num>
          <heading>Act to bind Crown</heading>
          <content>
            <p>This Act binds the Crown in each of its capacities.</p>
          </content>
        </section>
      </part>
      <part eId="part-2">
        <num>2</num>
        <heading>Transfers generally</heading>
        <section eId="part-2__sec-10">
          <num>10</num>
          <heading>When may a prisoner (other than a Tribunal prisoner) be transferred?</heading>
          <content>
            <p>A prisoner (other than a Tribunal prisoner) may be transferred between  and a transfer country under this Act if:</p>
          </content>
          <paragraph eId="part-2__sec-10__para-a">
            <num>a</num>
            <content>
              <p>the prisoner is eligible for transfer from or to  (as the case requires); and</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-10__para-b">
            <num>b</num>
            <content>
              <p>and the transfer country have agreed to the transfer of the prisoner on terms agreed under this Act; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-10__para-c">
            <num>c</num>
            <content>
              <p>the prisoner or the prisoner’s representative has consented in writing to transfer on those terms; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-10__para-d">
            <num>d</num>
            <content>
              <p>appropriate Ministerial consent in writing has been given to transfer on those terms; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-10__para-e">
            <num>e</num>
            <content>
              <p>the relevant conditions for transfer of the prisoner are satisfied; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-10__para-f">
            <num>f</num>
            <content>
              <p>the transfer of the prisoner is not likely to prevent the surrender of the prisoner to any extradition country known by the Attorney-General to have requested the extradition of the prisoner or to have expressed interest in extraditing the prisoner or that, in the opinion of the Attorney-General, is reasonably likely to request extradition.</p>
            </content>
          </paragraph>
        </section>
        <section eId="part-2__sec-10A">
          <num>10A</num>
          <heading>Decisions by the Attorney-General about transfers</heading>
          <subsection eId="part-2__sec-10A__subsec-1">
            <num>1</num>
            <content>
              <p>The Attorney-General need not take any steps for making:</p>
            </content>
            <paragraph eId="part-2__sec-10A__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>a decision on an application under <ref href="#sec-16">section 16</ref> (about transfers from Australia) for the transfer of a prisoner; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-10A__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>a decision under <ref href="#sec-24">section 24</ref> (about transfers to Australia) about a request for the transfer of a prisoner;</p>
              </content>
              <content>
                <p>if any of the following requirements for the transfer are not met:</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-10A__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>paragraph 10(a), (c), (e) or (f);</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-10A__subsec-1__para-d">
              <num>d</num>
              <content>
                <p>paragraph 10(b), to the extent that it requires the agreement of the transfer country to the transfer;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-10A__subsec-1__para-e">
              <num>e</num>
              <content>
                <p>paragraph 10(d), to the extent that it requires the consent of State Ministers or Territory Ministers to the transfer.</p>
              </content>

            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-10A__subsec-2">
            <num>2</num>
            <content>
              <p>The Attorney-General need not take any steps for making a decision referred to in paragraph (1)(a) or (b) for the transfer of a prisoner if:</p>
            </content>
            <paragraph eId="part-2__sec-10A__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>the prisoner had made an earlier application or request; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-10A__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>the Attorney-General received the current application or request less than 12 months after the later of either:</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-10A__subsec-2__para-i">
              <num>i</num>
              <content>
                <p>the day the prisoner was informed under <ref href="#sec-52">section 52</ref> that the earlier application or request did not meet one or more of the requirements in <ref href="#sec-10">section 10</ref>;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-10A__subsec-2__para-ii">
              <num>ii</num>
              <content>
                <p>the day the prisoner informed the Attorney-General that the prisoner was withdrawing the earlier application or request.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-10A__subsec-3">
            <num>3</num>
            <content>
              <p>Parts 3 and 4 have effect subject to this section.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-2__sec-11">
          <num>11</num>
          <heading>When may a Tribunal prisoner be transferred?</heading>
          <content>
            <p>A Tribunal prisoner may be transferred to  under this Act if:</p>
          </content>
          <paragraph eId="part-2__sec-11__para-a">
            <num>a</num>
            <content>
              <p>and the Tribunal have agreed to the transfer of the prisoner on terms agreed under this Act; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-11__para-b">
            <num>b</num>
            <content>
              <p>unless the Attorney-General determines that it is not necessary in the prisoner’s case—the prisoner or prisoner’s representative has consented to transfer on those terms; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-11__para-c">
            <num>c</num>
            <content>
              <p>appropriate Ministerial consent in writing has been given to transfer on those terms; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-11__para-d">
            <num>d</num>
            <content>
              <p>the relevant conditions for transfer to Australia of Tribunal prisoners are satisfied.</p>
            </content>
          </paragraph>
        </section>
        <section eId="part-2__sec-12">
          <num>12</num>
          <heading>Eligibility for transfer from  of prisoners (other than Tribunal prisoners)</heading>
          <content>
            <p>A prisoner (other than a Tribunal prisoner) is eligible for transfer from  to a transfer country under this Act if the prisoner:</p>
          </content>
          <paragraph eId="part-2__sec-12__para-a">
            <num>a</num>
            <content>
              <p>is a national of the transfer country; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-12__para-b">
            <num>b</num>
            <content>
              <p>has community ties with the transfer country.</p>
            </content>

        <section eId="part-2__sec-13">
          <num>13</num>
          <heading>Eligibility for transfer to  of prisoners (other than Tribunal prisoners)</heading>
          <subsection eId="part-2__sec-13__subsec-1">
            <num>1</num>
            <content>
              <p>A prisoner (other than a Tribunal prisoner) is eligible for transfer to  from a transfer country under this Act if the prisoner:</p>
            </content>
            <paragraph eId="part-2__sec-13__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>is an Australian citizen; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-13__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>	(b)	is permitted to travel to, enter and remain in  indefinitely pursuant to the <i>Migration Act 1958</i> and has community ties with a State or a Territory.</p>
              </content>

              <p>If a request is made for the transfer of a prisoner (other than a Tribunal prisoner) to , the Attorney-General must consult with the Immigration Minister about whether the prisoner:</p>
            </content>
            <paragraph eId="part-2__sec-13__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>is eligible under subsection (1) for a transfer to ; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-13__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>is likely to be eligible under subsection (1) for a transfer to  at a future time specified by the Attorney-General for the purposes of the consultation.</p>
              </content>
            </paragraph>
          </subsection>
        </section>
        <section eId="part-2__sec-14">
          <num>14</num>
          <heading>Transfer conditions—transfer from</heading>
          <subsection eId="part-2__sec-14__subsec-1">
            <num>1</num>
            <content>
              <p>The conditions for transfer from  of a prisoner (other than a mentally impaired prisoner) are satisfied if:</p>
            </content>
            <paragraph eId="part-2__sec-14__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>neither the sentence of imprisonment imposed by the Australian court nor the conviction on which it is based is subject to appeal; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-14__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>subject to subsection (3), the acts or omissions constituting the offence on account of which the prisoner is serving the sentence in Australia would, if the acts or omissions had occurred in the transfer country at the time the Attorney-General received the application under <ref href="#sec-16">section 16</ref> for the prisoner, have constituted an offence in the transfer country; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-14__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>if the sentence of imprisonment is determinate—on the day of receipt of the application at least 6 months of the prisoner’s sentence remains to be served (whether or not the prisoner has been released on parole or is serving the suspended part of the sentence), or a shorter period remains to be served and the Attorney-General has determined that, in the circumstances, transfer for a shorter period is acceptable.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-14__subsec-2">
            <num>2</num>
            <content>
              <p>The conditions for transfer from  of a mentally impaired prisoner are satisfied if:</p>
            </content>
            <paragraph eId="part-2__sec-14__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>neither the sentence of imprisonment imposed by the Australian court nor the acquittal or finding of unfitness to stand trial on which it is based is subject to appeal; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-14__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>subject to subsection (3), the acts or omissions constituting the offence:</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-14__subsec-2__para-i">
              <num>i</num>
              <content>
                <p>in respect of which the prisoner was charged but acquitted on the ground of mental impairment or found unfit to stand trial; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-14__subsec-2__para-ii">
              <num>ii</num>
              <content>
                <p>on account of which the prisoner is serving the sentence in ;</p>
              </content>
              <content>
                <p>would, if the acts or omissions had occurred in the transfer country at the time the Attorney-General received the application under <ref href="#sec-16">section 16</ref> for the prisoner, have constituted an offence in the transfer country; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-14__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>if the sentence of imprisonment is determinate—on the day of receipt of the application at least 6 months of the prisoner’s sentence remains to be served (whether or not any review affecting the duration of the sentence is pending), or a shorter period remains to be served and the Attorney-General has determined that, in the circumstances of the case, transfer for a shorter period is acceptable.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-14__subsec-3">
            <num>3</num>
            <content>
              <p>The Attorney-General may determine that the requirements of subsection (1)(b) or (2)(b) need not be satisfied in a particular prisoner’s case.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-2__sec-15">
          <num>15</num>
          <heading>Transfer conditions—transfer to</heading>
          <subsection eId="part-2__sec-15__subsec-1">
            <num>1</num>
            <content>
              <p>The conditions for transfer to  of a prisoner (other than a mentally impaired prisoner or Tribunal prisoner) are satisfied if:</p>
            </content>
            <paragraph eId="part-2__sec-15__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>neither the sentence of imprisonment imposed by the transfer country’s court or tribunal nor the conviction on which it is based is subject to appeal under the law of the transfer country; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-15__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>subject to subsection (3), the acts or omissions constituting the offence on account of which the prisoner is serving the sentence in the transfer country would, if the acts or omissions had occurred in Australia at the time the Attorney-General received the request under <ref href="#sec-24">section 24</ref> for the prisoner, have constituted an offence in Australia; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-15__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>if the sentence of imprisonment is determinate—on the day of receipt of the request at least 6 months of the prisoner’s sentence remains to be served (whether or not the prisoner has been released on parole or is serving the suspended part of the sentence), or a shorter period remains to be served and the Attorney-General has determined that, in the circumstances, transfer for a shorter period is acceptable.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-15__subsec-2">
            <num>2</num>
            <content>
              <p>The conditions for transfer to  of a mentally impaired prisoner are satisfied if:</p>
            </content>
            <paragraph eId="part-2__sec-15__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>neither the sentence of imprisonment imposed by the transfer country’s court or tribunal nor the acquittal or finding of unfitness to stand trial on which it is based is subject to appeal under the law of the transfer country; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-15__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>subject to subsection (3), the acts or omissions constituting the offence:</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-15__subsec-2__para-i">
              <num>i</num>
              <content>
                <p>in respect of which the prisoner was charged but acquitted on the ground of mental impairment or found unfit to stand trial; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-15__subsec-2__para-ii">
              <num>ii</num>
              <content>
                <p>on account of which the prisoner is serving the sentence in the transfer country;</p>

            </paragraph>
            <paragraph eId="part-2__sec-15__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>if the sentence of imprisonment is determinate—on the day of receipt of the request at least 6 months of the prisoner’s sentence remains to be served (whether or not any review affecting the duration of the sentence is pending), or a shorter period remains to be served and the Attorney-General has determined that, in the circumstances, transfer for a shorter period is acceptable.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-15__subsec-3">
            <num>3</num>
            <content>
              <p>The Attorney-General may determine that the requirements of subsection (1)(b) or (2)(b) need not be satisfied in a particular prisoner’s case.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-15__subsec-4">
            <num>4</num>
            <content>
              <p>The conditions for transfer to  of a Tribunal prisoner are satisfied if:</p>
            </content>
            <paragraph eId="part-2__sec-15__subsec-4__para-a">
              <num>a</num>
              <content>
                <p>neither the sentence of imprisonment imposed by the Tribunal nor the conviction on which it is based is subject to appeal under the Statute of the Tribunal; and</p>
              </content>
            </paragraph>

        <heading>Transfers from</heading>

          <num>16</num>
          <heading>Applications for transfer from</heading>
          <content>
            <p>A prisoner serving a sentence of imprisonment in Australia, or the prisoner’s representative, may apply to the Attorney-General, using a form approved in writing by the Attorney-General, for transfer of the prisoner to a transfer country to complete serving the sentence on terms agreed in accordance with this Act.</p>

          <heading>Asking the transfer country to consent to the transfer</heading>
          <subsection eId="part-3__sec-18__subsec-1">
            <num>1</num>
            <content>
              <p>The Attorney-General must ask the transfer country:</p>
            </content>
            <paragraph eId="part-3__sec-18__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>whether it consents to the transfer of a prisoner for whom an application has been given under <ref href="#sec-16">section 16</ref>; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-18__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>to propose any terms on which any consent is to be subject.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-3__sec-18__subsec-2">
            <num>2</num>
            <content>
              <p>When asking the transfer country, the Attorney-General must give the transfer country the following:</p>
            </content>
            <paragraph eId="part-3__sec-18__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>a copy of the application given under <ref href="#sec-16">section 16</ref> for the prisoner;</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-18__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>any information required to be provided in accordance with arrangements made with the transfer country; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-18__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>any other information the Attorney-General considers relevant, including details of:</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-18__subsec-2__para-i">
              <num>i</num>
              <content>
                <p>	(i)	any request for extradition of the prisoner that has been made under the <i>Extradition Act 1988</i>; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-18__subsec-2__para-ii">
              <num>ii</num>
              <content>
                <p>any expression of interest made to the Attorney-General by another country to extradite the prisoner.</p>
              </content>

          </subsection>
        </section>

          <num>19</num>
          <heading>Decision by the Attorney-General to refuse consent to transfer from Australia</heading>
          <subsection eId="part-3__sec-19__subsec-1">
            <num>1</num>
            <content>
              <p>If the transfer country consents to the transfer of the prisoner on terms that it proposes, the Attorney-General may decide to refuse consent to the transfer on those terms.</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-19__subsec-2">
            <num>2</num>
            <content>
              <p>Before deciding under subsection (1) to refuse consent, the Attorney-General must notify the prisoner (or the prisoner’s representative) of the proposed terms on which the transfer country has consented to the transfer, including the proposed method by which the sentence of imprisonment will be enforced by the transfer country.</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-19__subsec-3">
            <num>3</num>
            <content>
              <p>If the Attorney-General decides under subsection (1) to refuse consent to the transfer on terms proposed by the transfer country, the Attorney-General:</p>
            </content>
            <paragraph eId="part-3__sec-19__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>must notify the transfer country of the decision; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-19__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>may advise the transfer country in writing that consent may be given if the transfer country proposes a variation of those terms, including any variation suggested by the Attorney-General.</p>
              </content>

                  <p>Note:	This section applies separately for each occasion where the transfer country proposes varied terms. This means the Attorney-General can consider whether to refuse consent under subsection (1) in relation to each variation of terms proposed by the transfer country.</p>

            <num>4</num>

              <p>If the Attorney-General decides under subsection (1) to refuse consent to the transfer on terms proposed by the transfer country, sections 20 to 23 do not apply for the transfer on those particular terms.</p>

          <num>20</num>
          <heading>Governmental consent to transfer from</heading>
          <subsection eId="part-3__sec-20__subsec-1">
            <num>1</num>
            <content>
              <p>If the transfer country consents to the transfer of the prisoner on terms that it proposes, the Attorney-General must:</p>
            </content>
            <paragraph eId="part-3__sec-20__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>give any State Ministers and Territory Ministers whose consent is required for the transfer to have appropriate Ministerial consent:</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-20__subsec-1__para-i">
              <num>i</num>
              <content>
                <p>a copy of the application given under <ref href="#sec-16">section 16</ref>; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-20__subsec-1__para-ii">
              <num>ii</num>
              <content>
                <p>any other information the Attorney-General considers relevant; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-20__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>notify the following of the proposed terms on which the transfer country has given consent to the transfer, including the proposed method by which the sentence of imprisonment will be enforced by the transfer country:</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-20__subsec-1__para-i">
              <num>i</num>
              <content>
                <p>each Minister concerned;</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-20__subsec-1__para-ii">
              <num>ii</num>
              <content>
                <p>unless earlier notified under subsection 19(2) of those proposed terms—the prisoner (or the prisoner’s representative).</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-3__sec-20__subsec-1A">
            <num>1A</num>
            <content>
              <p>Each Minister concerned may:</p>
            </content>
            <paragraph eId="part-3__sec-20__subsec-1A__para-a">
              <num>a</num>
              <content>
                <p>advise the Attorney-General of any matters that Minister considers relevant to the processing of the application; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-20__subsec-1A__para-b">
              <num>b</num>
              <content>
                <p>request the Attorney-General to obtain information from the transfer country that is relevant to that Minister’s assessment of the application.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-3__sec-20__subsec-2">
            <num>2</num>
            <content>
              <p>The prisoner or prisoner’s representative and each Minister concerned are to advise the Attorney-General as to whether they consent to the transfer on the terms proposed by the transfer country.</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-20__subsec-3">
            <num>3</num>
            <content>
              <p>The Attorney-General must decide whether to consent to the transfer of the prisoner on the terms proposed by the transfer country.</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-20__subsec-4">
            <num>4</num>
            <content>
              <p>The Attorney-General must notify the transfer country of his or her decision under subsection (3).</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-20__subsec-5">
            <num>5</num>
            <content>
              <p>If the Attorney-General decides not to consent to the transfer on those terms, the Attorney-General may advise the transfer country in writing that consent may be given if the transfer country proposes a variation of those terms, including any variation suggested by the Attorney-General.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-3__sec-21">
          <num>21</num>
          <heading>Issue of warrant for transfer from</heading>
          <content>
            <p>The Attorney-General may, subject to <ref href="#part-2">Part 2</ref>, issue a warrant, in the form prescribed by the regulations, for the transfer of the prisoner from Australia to a transfer country if the prisoner’s or the prisoner’s representative’s consent and appropriate Ministerial consent in writing to the transfer on the terms proposed by the transfer country (including proposed terms that are an agreed variation of earlier terms) have been given.</p>
          </content>
        </section>
        <section eId="part-3__sec-22">
          <num>22</num>
          <heading>Warrants for transfer from</heading>
          <subsection eId="part-3__sec-22__subsec-1">
            <num>1</num>
            <content>
              <p>A warrant for the transfer of a prisoner from  authorises the transfer of the prisoner from  to the transfer country to complete serving the sentence of imprisonment in accordance with the terms agreed under this Act.</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-22__subsec-2">
            <num>2</num>
            <content>
              <p>A warrant for transfer from  must:</p>
            </content>
            <paragraph eId="part-3__sec-22__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>specify the name and date of birth of the prisoner to be transferred; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-22__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>specify the transfer country to which the prisoner is to be transferred; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-22__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>state that the following written consents to the transfer have been given:</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-22__subsec-2__para-i">
              <num>i</num>
              <content>
                <p>the prisoner’s or prisoner’s representative’s consent;</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-22__subsec-2__para-ii">
              <num>ii</num>
              <content>
                <p>the transfer country’s consent;</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-22__subsec-2__para-iii">
              <num>iii</num>
              <content>
                <p>appropriate Ministerial consent.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-3__sec-22__subsec-3">
            <num>3</num>
            <content>
              <p>If the prisoner has not been released on parole and is not serving the suspended part of the sentence of imprisonment, the warrant is:</p>
            </content>
            <paragraph eId="part-3__sec-22__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>to require the superintendent of the prison, or the person in charge of the hospital or other place, in which the prisoner is serving the sentence of imprisonment to release the prisoner into the custody of a person specified in the warrant; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-22__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>to authorise the person to take the prisoner to a place in  and, if necessary, to detain the prisoner in custody for the purpose of placing the prisoner in the custody of an escort officer for transport out of ; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-22__subsec-3__para-c">
              <num>c</num>
              <content>
                <p>to authorise the escort officer to transport the prisoner in custody out of  to the transfer country for surrender to a person appointed by the transfer country to receive the prisoner.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-3__sec-22__subsec-4">
            <num>4</num>
            <content>
              <p>If the prisoner has been released on parole, the warrant is:</p>
            </content>
            <paragraph eId="part-3__sec-22__subsec-4__para-a">
              <num>a</num>
              <content>
                <p>to specify any approvals, authorities, permissions or variations to the parole or other order or licence to be at large that have been made under an Australian law; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-22__subsec-4__para-b">
              <num>b</num>
              <content>
                <p>to specify any procedures for the transfer of the prisoner to the transfer country that have been agreed upon with the transfer country and to give any necessary authorisations and directions.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-3__sec-22__subsec-4A">
            <num>4A</num>
            <content>
              <p>If the prisoner is serving the suspended part of the sentence of imprisonment, the warrant is:</p>
            </content>
            <paragraph eId="part-3__sec-22__subsec-4A__para-a">
              <num>a</num>
              <content>
                <p>to specify any conditions relating to that part of the sentence that have been imposed under an Australian law; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-22__subsec-4A__para-b">
              <num>b</num>
              <content>
                <p>to specify any procedures for the transfer of the prisoner to the transfer country that have been agreed upon with the transfer country, and to give any necessary authorisations and directions.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-3__sec-22__subsec-5">
            <num>5</num>
            <content>
              <p>The Attorney-General may give any direction or approval that is necessary to ensure that the warrant is executed in accordance with its tenor.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-3__sec-23">
          <num>23</num>
          <heading>Cancellation of warrant for transfer from</heading>
          <subsection eId="part-3__sec-23__subsec-1">
            <num>1</num>
            <content>
              <p>The Attorney-General may cancel a warrant for transfer from  at any time before the prisoner it concerns leaves .</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-23__subsec-2">
            <num>2</num>
            <content>
              <p>Without limiting the grounds on which the Attorney-General may cancel a warrant for transfer, it must be cancelled if the Attorney-General, a State or Territory Minister, the prisoner or prisoner’s representative or the transfer country concerned, withdraws consent to the transfer.</p>
            </content>
          </subsection>
        </section>
      </part>

        <heading>Transfers to  of prisoners from transfer countries</heading>
        <section eId="part-4__sec-24">
          <num>24</num>
          <heading>Transfer request from outside</heading>
          <subsection eId="part-4__sec-24__subsec-1">
            <num>1</num>
            <content>
              <p>The Attorney-General may consent to a request for the transfer of a prisoner (other than a Tribunal prisoner) serving a sentence of imprisonment in a transfer country to Australia to complete serving the sentence on terms agreed under this Act if the Attorney-General is satisfied that, were the Attorney-General to give that consent, the transfer could be made in compliance with <ref href="#sec-10">section 10</ref>.</p>

          </subsection>
        </section>

          <num>24A</num>
          <heading>Decision by the Attorney-General to refuse consent to transfer to Australia</heading>
          <subsection eId="part-4__sec-24A__subsec-1">
            <num>1</num>
            <content>
              <p>The Attorney-General may decide to refuse consent to the transfer of a prisoner to Australia under this Part:</p>
            </content>
            <paragraph eId="part-4__sec-24A__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>after the Attorney-General receives a request under <ref href="#sec-24">section 24</ref> for the transfer; but</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-24A__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>before the Attorney-General has started to act under any of sections 26 to 32 in relation to the transfer.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-4__sec-24A__subsec-2">
            <num>2</num>
            <content>
              <p>Sections 26 to 32 do not apply for the transfer of the prisoner if the Attorney-General decides under subsection (1) of this section to refuse consent to the transfer.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-4__sec-25">
          <num>25</num>
          <heading>Information to accompany request</heading>
          <content>
            <p>Before consenting to the transfer of a prisoner to  under this Part, the Attorney-General may request the transfer country to provide:</p>
          </content>
          <paragraph eId="part-4__sec-25__para-a">
            <num>a</num>
            <content>
              <p>details of any request for extradition of the prisoner that has been made to the transfer country or of any country that has expressed interest in extraditing the prisoner or that is likely, in the opinion of the transfer country, to request extradition; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-4__sec-25__para-b">
            <num>b</num>
            <content>
              <p>any other information the Attorney-General considers relevant to the assessment of whether consent should be given for the transfer of the prisoner to .</p>
            </content>
          </paragraph>
        </section>
        <section eId="part-4__sec-26">
          <num>26</num>
          <heading>Enforcement of foreign sentence</heading>
          <content>
            <p>Before consenting to the transfer of a prisoner to Australia under this Part, the Attorney-General is to determine, in accordance with <ref href="#part-6">Part 6</ref>, the method by which the sentence of imprisonment imposed by the transfer country will be enforced in Australia if the prisoner is transferred and is to advise the transfer country of this and of any other proposed terms on which consent will be given to the transfer.</p>
          </content>
        </section>
        <section eId="part-4__sec-27">
          <num>27</num>
          <heading>Governmental consent to transfer to</heading>
          <subsection eId="part-4__sec-27__subsec-1">
            <num>1</num>
            <content>
              <p>Before consenting to the transfer of a prisoner to Australia under this Part, the Attorney-General is to notify the State or Territory Minister of the place in which the prisoner wishes to begin to complete serving the sentence of imprisonment imposed by the transfer country in Australia, in writing, in the form prescribed by the regulations, of receipt of the request.</p>
            </content>
          </subsection>
          <subsection eId="part-4__sec-27__subsec-2">
            <num>2</num>
            <content>
              <p>If the prisoner wishes to begin to complete serving the sentence of imprisonment in  or  but has community ties with the ACT or a Territory, the Attorney-General is also to notify the ACT Minister or Territory Minister concerned of the matters referred to in subsection (1).</p>

          </subsection>

              <p>The Attorney-General is to provide each Minister concerned with any information that the transfer country has given the Attorney-General and particulars of the method by which the Attorney-General considers the sentence of imprisonment imposed by the transfer country could be enforced by Australia and any other proposed terms of the transfer.</p>
            </content>
          </subsection>
          <subsection eId="part-4__sec-27__subsec-4">
            <num>4</num>
            <content>
              <p>Each Minister concerned is to advise the Attorney-General in writing as to whether <role refersTo="#minister">the Minister</role> consents to the transfer on the terms proposed as soon as possible after receiving the notification.</p>
            </content>
          </subsection>
          <subsection eId="part-4__sec-27__subsec-5">
            <num>5</num>
            <content>
              <p>If <role refersTo="#minister">the Minister</role> of the State or Territory in which the prisoner is to begin to complete serving the sentence of imprisonment imposed by the transfer country consents to the transfer, <role refersTo="#minister">the Minister</role> is to advise the Attorney-General of:</p>
            </content>
            <paragraph eId="part-4__sec-27__subsec-5__para-a">
              <num>a</num>
              <content>
                <p>the prison, or hospital or other place, in which the prisoner will begin to complete serving the sentence in the State or Territory; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-27__subsec-5__para-b">
              <num>b</num>
              <content>
                <p>in the case of a prisoner who has been released on parole—any recommended terms or conditions on which the prisoner is to complete serving the sentence; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-27__subsec-5__para-ba">
              <num>ba</num>
              <content>
                <p>in the case of a prisoner serving the suspended part of the sentence—any recommended terms or conditions on which the prisoner is to complete serving the sentence; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-27__subsec-5__para-c">
              <num>c</num>
              <content>
                <p>any other matters <role refersTo="#minister">the Minister</role> considers relevant to sentence enforcement in the State or Territory.</p>
              </content>

                  <p>Note:	A prisoner may be transferred from the prison, hospital or other place in the State or Territory in which the prisoner begins to complete serving a sentence of imprisonment to another prison, hospital or other place in the State or Territory or to a prison, hospital or other place in another State or Territory.           <heading>Transfer country’s consent to transfer</heading>
          <subsection eId="part-4__sec-28__subsec-1">
            <num>1</num>
            <content>
              <p>The Attorney-General must, as soon as possible after the matters mentioned in subsection (2) are satisfied for a transfer, notify the transfer country of this and ask it:</p>
            </content>
            <paragraph eId="part-4__sec-28__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>whether it consents to the transfer on the terms proposed in writing by the Attorney-General; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-28__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>to advise whether the prisoner, or the prisoner’s representative, consents to the transfer on those terms.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-4__sec-28__subsec-2">
            <num>2</num>
            <content>
              <p>The matters are as follows:</p>
            </content>
            <paragraph eId="part-4__sec-28__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>paragraphs 10(a), (e) and (f);</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-28__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>consent in writing, by any applicable State Ministers and Territory Ministers, has been given to transfer on those terms.</p>
              </content>
            </paragraph>
          </subsection>
        </section>
        <section eId="part-4__sec-29">
          <num>29</num>
          <heading>Issue of warrant for transfer to</heading>
          <content>
            <p>The Attorney-General may issue a warrant, in the form prescribed by the regulations, for the transfer of the prisoner from a transfer country to Australia if the written consent of the prisoner or prisoner’s representative and the transfer country and appropriate Ministerial consent in writing to transfer on the terms proposed by Australia have been given.</p>
          </content>
        </section>
        <section eId="part-4__sec-30">

          <heading>Warrants for transfer to</heading>
          <subsection eId="part-4__sec-30__subsec-1">
            <num>1</num>
            <content>
              <p>A warrant for the transfer of a prisoner to  authorises the transfer of the prisoner from the transfer country to  to complete serving the sentence of imprisonment imposed by the transfer country in accordance with the terms agreed under this Act.</p>
            </content>
          </subsection>
          <subsection eId="part-4__sec-30__subsec-2">
            <num>2</num>
            <content>
              <p>A warrant for transfer to  must:</p>
            </content>
            <paragraph eId="part-4__sec-30__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>specify the name and date of birth of the prisoner to be transferred; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-30__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>specify the transfer country from which the prisoner is to be transferred; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-30__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>state that the following written consents to the transfer have been given:</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-30__subsec-2__para-i">
              <num>i</num>
              <content>
                <p>the prisoner’s or prisoner’s representative’s consent;</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-30__subsec-2__para-ii">
              <num>ii</num>
              <content>
                <p>the transfer country’s consent;</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-30__subsec-2__para-iii">
              <num>iii</num>
              <content>
                <p>appropriate Ministerial consent.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-4__sec-30__subsec-3">
            <num>3</num>
            <content>
              <p>If the prisoner has not been released on parole and is not serving the suspended part of the sentence of imprisonment, the warrant is:</p>
            </content>
            <paragraph eId="part-4__sec-30__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>to authorise an escort officer to collect the prisoner from a place (whether in  or the transfer country) specified in the warrant; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-30__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>if the place is in the transfer country, to authorise the escort officer to transport the prisoner in custody to Australia for surrender to a person appointed by the Attorney-General to receive the prisoner and, if appropriate, to authorise the appointed person to escort the prisoner to the prison, or hospital or other place, in Australia where the prisoner is to begin to complete serving the sentence of imprisonment in accordance with this Act; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-30__subsec-3__para-c">
              <num>c</num>
              <content>
                <p>if the place is in Australia, to authorise the escort officer to escort the prisoner to the prison, or hospital or other place, in Australia where the prisoner is to begin to complete serving the sentence of imprisonment in accordance with this Act; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-30__subsec-3__para-d">
              <num>d</num>
              <content>
                <p>if the prisoner is to be escorted to a prison, to require the superintendent of the prison to take the prisoner into custody to be dealt with in accordance with the terms agreed under this Act; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-30__subsec-3__para-e">
              <num>e</num>
              <content>
                <p>if the prisoner is to be escorted to a hospital or other place, to authorise the detention of the prisoner in that hospital or place to be dealt with in accordance with the terms agreed under this Act.</p>

                  <p>Note:	A prisoner may be transferred from the prison, hospital or other place in the State or Territory in which the prisoner begins to complete serving a sentence of imprisonment to another prison, hospital or other place in the State or Territory or to a prison, hospital or other place in another State or Territory.           </subsection>
          <subsection eId="part-4__sec-30__subsec-4">
            <num>4</num>
            <content>
              <p>However, if the prisoner:</p>
            </content>
            <paragraph eId="part-4__sec-30__subsec-4__para-a">
              <num>a</num>
              <content>
                <p>has been released on parole; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-30__subsec-4__para-b">
              <num>b</num>
              <content>
                <p>is serving the suspended part of the sentence of imprisonment;</p>
              </content>
              <content>
                <p>the warrant is to specify any procedures for the transfer of the prisoner to Australia that have been agreed upon with the transfer country and to give any necessary authorisations and directions.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-4__sec-30__subsec-5">
            <num>5</num>
            <content>
              <p>The Attorney-General may give any direction or approval that is necessary to ensure the warrant is executed in accordance with its tenor.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-4__sec-31">
          <num>31</num>
          <heading>Cancellation of warrant</heading>
          <subsection eId="part-4__sec-31__subsec-1">
            <num>1</num>
            <content>
              <p>The Attorney-General may cancel a warrant for transfer to  at any time before the prisoner it concerns leaves the transfer country.</p>
            </content>
          </subsection>
          <subsection eId="part-4__sec-31__subsec-2">
            <num>2</num>
            <content>
              <p>Without limiting the grounds on which the Attorney-General may cancel a transfer warrant, it must be cancelled if the Attorney-General, a State or Territory Minister, a prisoner or prisoner’s representative, or the transfer country concerned, withdraws consent to the transfer.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-4__sec-32">
          <num>32</num>
          <heading>Effect of warrant on prisoner’s sentence</heading>
          <content>
            <p>The prisoner to whom a warrant relates is to be released when the prisoner has completed serving the sentence of imprisonment in accordance with this Act unless any other law authorises the prisoner’s detention in respect of an offence other than that on account of which the sentence of imprisonment was imposed.</p>
          </content>
        </section>
      </part>
      <part eId="part-5">
        <num>5</num>
        <heading>Transfer to  of Tribunal prisoners</heading>
        <section eId="part-5__sec-33">
          <num>33</num>
          <heading>Transfer request from a Tribunal</heading>
          <content>
            <p>The Attorney-General may consent to a request from a Tribunal for the transfer of a Tribunal prisoner serving a sentence of imprisonment imposed by the Tribunal in a Tribunal country to Australia to complete serving the sentence of imprisonment on terms agreed under this Act if the Attorney-General is satisfied that the transfer can be made in compliance with <ref href="#sec-11">section 11</ref>.</p>
          </content>
        </section>
        <section eId="part-5__sec-33A">
          <num>33A</num>
          <heading>Decision by the Attorney-General to refuse consent to transfer of Tribunal prisoner to Australia</heading>
          <subsection eId="part-5__sec-33A__subsec-1">
            <num>1</num>
            <content>
              <p>The Attorney-General may decide to refuse consent to the transfer of a Tribunal prisoner to Australia under this Part:</p>
            </content>
            <paragraph eId="part-5__sec-33A__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>after the Attorney-General receives a request under <ref href="#sec-33">section 33</ref> for the transfer; but</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-33A__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>before the Attorney-General has started to act under any of sections 35 to 41 in relation to the transfer.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-5__sec-33A__subsec-2">
            <num>2</num>
            <content>
              <p>Sections 35 to 41 do not apply for the transfer of the Tribunal prisoner if the Attorney-General decides under subsection (1) of this section to refuse consent to the transfer.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-5__sec-34">
          <num>34</num>
          <heading>Information to accompany request</heading>
          <content>
            <p>Before consenting to the transfer of a Tribunal prisoner to , the Attorney-General may request the Tribunal requesting the transfer to provide the Attorney-General with any relevant information that will enable the Attorney-General to assess whether consent should be given for the transfer of the prisoner to .</p>
          </content>
        </section>
        <section eId="part-5__sec-35">
          <num>35</num>
          <heading>Enforcement of Tribunal sentence of imprisonment</heading>
          <content>
            <p>Before consenting to the transfer of a Tribunal prisoner to Australia under this Part, the Attorney-General is to determine, in accordance with <ref href="#part-6">Part 6</ref>, the method by which the sentence of imprisonment imposed by the Tribunal will be enforced in Australia if the prisoner is transferred and is to advise the Tribunal of this and of any other proposed terms on which consent will be given to the transfer.</p>
          </content>
        </section>
        <section eId="part-5__sec-36">
          <num>36</num>
          <heading>Governmental consent to transfer to</heading>
          <subsection eId="part-5__sec-36__subsec-1">
            <num>1</num>
            <content>
              <p>Before consenting to the transfer of a Tribunal prisoner to Australia, the Attorney-General is to determine the State or Territory in which it would be most appropriate for the prisoner to begin to complete serving the sentence of imprisonment imposed on the prisoner by the Tribunal in Australia and to seek the consent of the State or Territory Minister concerned.</p>
            </content>
          </subsection>
          <subsection eId="part-5__sec-36__subsec-2">
            <num>2</num>
            <content>
              <p>The Attorney-General is to provide <role refersTo="#minister">the Minister</role> with details of any information that the Tribunal has given the Attorney-General and particulars of the method by which the Attorney-General considers the sentence of imprisonment could be enforced by  and any other proposed terms of the transfer.</p>
            </content>
          </subsection>
          <subsection eId="part-5__sec-36__subsec-3">
            <num>3</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> is to advise the Attorney-General in writing as to whether <role refersTo="#minister">the Minister</role> consents to the transfer on the terms proposed as soon as possible after receiving the notification.</p>
            </content>
          </subsection>
          <subsection eId="part-5__sec-36__subsec-4">
            <num>4</num>
            <content>
              <p>If <role refersTo="#minister">the Minister</role> refuses to consent to the transfer, the Attorney-General may request consent to transfer of the prisoner to another State or Territory from the appropriate State or Territory Minister.</p>
            </content>
          </subsection>
          <subsection eId="part-5__sec-36__subsec-5">
            <num>5</num>
            <content>
              <p>If a State Minister or Territory Minister consents to the transfer, <role refersTo="#minister">the Minister</role> is to advise the Attorney-General of:</p>
            </content>
            <paragraph eId="part-5__sec-36__subsec-5__para-a">
              <num>a</num>
              <content>
                <p>the prison, or hospital or other place, in which the prisoner is to begin to complete serving the sentence of imprisonment in accordance with this Act in the State or Territory; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-36__subsec-5__para-b">
              <num>b</num>
              <content>
                <p>in the case of a prisoner who has been released on parole—any recommended terms or conditions on which the prisoner is to complete serving the sentence of imprisonment in accordance with this Act; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-36__subsec-5__para-c">
              <num>c</num>
              <content>
                <p>any other matters <role refersTo="#minister">the Minister</role> considers relevant to enforcement of the sentence of imprisonment in the State or Territory.</p>
              </content>

        </section>
        <section eId="part-5__sec-37">
          <num>37</num>
          <heading>Formal consent to transfer</heading>
          <content>
            <p>The Attorney-General is to notify the Tribunal as soon as possible after appropriate Ministerial consent to the transfer has been given and is to ask the Tribunal:</p>
          </content>
          <paragraph eId="part-5__sec-37__para-a">
            <num>a</num>
            <content>
              <p>to formally consent to the transfer on the terms proposed by ; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-5__sec-37__para-b">
            <num>b</num>
            <content>
              <p>to advise of the prisoner’s formal consent to transfer on those terms (if the Tribunal has determined that it is appropriate to obtain the prisoner’s consent).</p>
            </content>
          </paragraph>
        </section>
        <section eId="part-5__sec-38">
          <num>38</num>
          <heading>Issue of warrant for transfer to</heading>
          <content>
            <p>The Attorney-General may issue a warrant, in the form prescribed by the regulations, for the transfer of a Tribunal prisoner from a Tribunal country to Australia if the written consent of the prisoner or prisoner’s representative (if the Attorney-General considers such consent is necessary), and the Tribunal and appropriate Ministerial consent in writing to transfer on the terms proposed by Australia, have been given.</p>
          </content>
        </section>

          <num>39</num>
          <heading>Warrants for transfer to</heading>
          <subsection eId="part-5__sec-39__subsec-1">
            <num>1</num>
            <content>
              <p>A warrant for the transfer of a Tribunal prisoner to  authorises the transfer of the prisoner from the Tribunal country to  to complete serving the sentence of imprisonment imposed by the Tribunal in accordance with the terms agreed under this Act.</p>
            </content>
          </subsection>
          <subsection eId="part-5__sec-39__subsec-2">
            <num>2</num>
            <content>
              <p>A warrant for transfer to  must:</p>
            </content>
            <paragraph eId="part-5__sec-39__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>specify the name and date of birth of the Tribunal prisoner to be transferred; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-39__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>specify the Tribunal country from which the prisoner is to be transferred; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-39__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>state that the following written consents to the transfer have been given:</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-39__subsec-2__para-i">
              <num>i</num>
              <content>
                <p>the prisoner’s or prisoner’s representative’s consent (if the Attorney-General considers such consent is necessary);</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-39__subsec-2__para-ii">
              <num>ii</num>
              <content>
                <p>the Tribunal’s consent;</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-39__subsec-2__para-iii">
              <num>iii</num>
              <content>
                <p>appropriate Ministerial consent.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-5__sec-39__subsec-3">
            <num>3</num>
            <content>
              <p>If the prisoner is a Tribunal prisoner other than a Tribunal prisoner who has been released on parole, the warrant is:</p>
            </content>
            <paragraph eId="part-5__sec-39__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>to authorise an escort officer to collect the Tribunal prisoner from a place (whether in  or the Tribunal country) specified in the warrant; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-39__subsec-3__para-b">
              <num>b</num>
              <content>

              <num>d</num>
              <content>
                <p>if the Tribunal prisoner is to be escorted to a prison, to require the superintendent of the prison to take the prisoner into custody to be dealt with in accordance with the terms agreed under this Act; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-39__subsec-3__para-e">
              <num>e</num>
              <content>
                <p>if the Tribunal prisoner is to be escorted to a hospital or other place, to authorise the detention of the prisoner in that hospital or place to be dealt with in accordance with the terms agreed under this Act.</p>

              <p>The Attorney-General may cancel a warrant for transfer to  at any time before the Tribunal prisoner it concerns leaves the Tribunal country.</p>

          <subsection eId="part-5__sec-40__subsec-2">
            <num>2</num>
            <content>
              <p>Without limiting the grounds on which the Attorney-General may cancel a transfer warrant, it must be cancelled if the Attorney-General, a State or Territory Minister or the Tribunal concerned (or, in those cases where a Tribunal prisoner or prisoner’s representative’s consent to transfer was required by the Attorney-General, the Tribunal prisoner or prisoner’s representative) withdraws consent to the transfer.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-5__sec-41">
          <num>41</num>
          <heading>Effect of warrant on Tribunal prisoner’s sentence</heading>
          <content>
            <p>The Tribunal prisoner to whom a warrant relates is to be released when the prisoner has completed serving the sentence of imprisonment in accordance with this Act unless any other law authorises the prisoner’s detention in respect of an offence other than that on account of which the sentence of imprisonment was imposed.</p>
          </content>
        </section>
      </part>
      <part eId="part-6">
        <num>6</num>
        <heading>Enforcement of sentences</heading>
        <section eId="part-6__sec-42">
          <num>42</num>
          <heading>Sentence enforcement in</heading>
          <content>
            <p>The Attorney-General may direct that a sentence of imprisonment imposed on a prisoner by a court or tribunal of a transfer country, or on a Tribunal prisoner by a Tribunal, be enforced on transfer of the prisoner to  under this Act:</p>
          </content>
          <paragraph eId="part-6__sec-42__para-a">
            <num>a</num>
            <content>
              <p>	(a)	without any adaptation of the duration of the sentence of imprisonment or its legal nature, or with only such adaptations to the duration of the sentence or its legal nature as the Attorney-General considers are necessary to ensure that enforcement of the sentence is consistent with Australian law (in this Act called the <b><i>continued enforcement method</i></b>); or</p>
            </content>
          </paragraph>
          <paragraph eId="part-6__sec-42__para-b">
            <num>b</num>
            <content>
              <p>	(b)	by substituting a different sentence of imprisonment for that imposed by the transfer country or Tribunal (in this Act called the <b><i>converted enforcement method</i></b>).</p>
            </content>
          </paragraph>
        </section>
        <section eId="part-6__sec-43">
          <num>43</num>
          <heading>Duration and nature of enforced sentence</heading>
          <subsection eId="part-6__sec-43__subsec-1">
            <num>1</num>
            <content>
              <p>The sentence of imprisonment to be enforced under the continued enforcement method or converted enforcement method must not be harsher, in legal nature or duration, than the sentence of imprisonment imposed by the transfer country or Tribunal.</p>
            </content>
          </subsection>
          <subsection eId="part-6__sec-43__subsec-2">
            <num>2</num>
            <content>
              <p>Without limiting subsection (1):</p>
            </content>
            <paragraph eId="part-6__sec-43__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>if the sentence of imprisonment imposed by the transfer country or Tribunal is for a determinate period, the sentence of imprisonment to be enforced under this Act must not be for a longer duration than that sentence; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-43__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>if the sentence of imprisonment imposed by the transfer country or Tribunal is for an indeterminate period, the sentence of imprisonment to be enforced under this Act is, as far as practicable, to be subject to similar terms affecting the duration of the sentence as those imposed in the transfer country or by the Tribunal; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-43__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>the sentence of imprisonment to be enforced under this Act must not be of a kind that involves a more severe form of deprivation of liberty than the sentence of imprisonment imposed by the transfer country or Tribunal.</p>
              </content>
            </paragraph>
          </subsection>
        </section>
        <section eId="part-6__sec-44">
          <num>44</num>
          <heading>Directions concerning enforcement of sentence</heading>
          <subsection eId="part-6__sec-44__subsec-1">
            <num>1</num>
            <content>
              <p>In ordering that a sentence of imprisonment be enforced by the continued enforcement method or the converted enforcement method, the Attorney-General may, subject to <ref href="#sec-43">section 43</ref>, give such directions as the Attorney-General considers appropriate as to the duration and legal nature of the sentence of imprisonment as it is to be enforced under this Act.</p>
            </content>
          </subsection>
          <subsection eId="part-6__sec-44__subsec-2">
            <num>2</num>
            <content>
              <p>Without limiting subsection (1), directions may be made:</p>
            </content>
            <paragraph eId="part-6__sec-44__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>as to entitlements to release on parole (including any non-parole period) of the prisoner or Tribunal prisoner following transfer; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-44__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>if the prisoner is a mentally impaired prisoner—as to any review to be undertaken of the mental condition of the prisoner and treatment to be provided to the prisoner following transfer.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-6__sec-44__subsec-3">
            <num>3</num>
            <content>
              <p>For the purpose of forming an opinion or exercising a discretion under this section, the Attorney-General may inform himself or herself as the Attorney-General thinks fit and, in particular, may have regard to the following:</p>
            </content>
            <paragraph eId="part-6__sec-44__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>any submissions made by the transfer country or Tribunal;</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-44__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>any views expressed by any State Minister or Territory Minister concerned with the proposed transfer;</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-44__subsec-3__para-c">
              <num>c</num>
              <content>
                <p>any views expressed by parole or prison authorities of any State or Territory;</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-44__subsec-3__para-d">
              <num>d</num>
              <content>

        </section>

          <num>45</num>
          <heading>Appeal and review of sentences of imprisonment imposed by transfer country or Tribunal and sentence enforcement decisions of Attorney-General</heading>
          <subsection eId="part-6__sec-45__subsec-1">
            <num>1</num>
            <content>
              <p>On transfer of a prisoner to  under this Act, no appeal or review lies in  against the sentence of imprisonment imposed by the court or tribunal of the transfer country or by the Tribunal.</p>
            </content>
          </subsection>
          <subsection eId="part-6__sec-45__subsec-2">
            <num>2</num>
            <content>
              <p>No appeal lies against a decision of the Attorney-General concerning the enforcement in  under this Act of a sentence of imprisonment imposed by a court or tribunal of a transfer country or the Tribunal.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-6__sec-46">
          <num>46</num>
          <heading>Prisoner transferred to  taken to be federal prisoner</heading>
          <subsection eId="part-6__sec-46__subsec-1">
            <num>1</num>
            <content>
              <p>A sentence of imprisonment imposed by the transfer country or Tribunal that is to be enforced in Australia under the continued enforcement method or the converted enforcement method is taken, for the purpose of enforcement of the sentence of imprisonment in Australia on transfer of the prisoner or Tribunal prisoner to Australia under this Act, to be a federal sentence of imprisonment and the prisoner to be a federal prisoner.</p>
            </content>
          </subsection>
          <subsection eId="part-6__sec-46__subsec-2">
            <num>2</num>
            <content>
              <p>Any period of the sentence of imprisonment as originally imposed by the transfer country or Tribunal served by the prisoner or Tribunal prisoner before the transfer is taken to have been served under the sentence of imprisonment as it is enforced under this Act.</p>
            </content>
          </subsection>
          <subsection eId="part-6__sec-46__subsec-3">
            <num>3</num>
            <content>
              <p>A prisoner who is transferred to Australia under this Act while serving a sentence of imprisonment (other than the suspended part of the sentence) that is:</p>
            </content>
            <paragraph eId="part-6__sec-46__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>imposed by a transfer country; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-46__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>enforced under this Act;</p>
              </content>
              <content>
                <p>may be detained in a prison or hospital or other place in a State or Territory.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-6__sec-46__subsec-3A">
            <num>3A</num>
            <content>
              <p>A prisoner who is transferred to Australia under this Act while serving the suspended part of a sentence of imprisonment that is:</p>
            </content>
            <paragraph eId="part-6__sec-46__subsec-3A__para-a">
              <num>a</num>
              <content>
                <p>imposed by a transfer country; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-46__subsec-3A__para-b">
              <num>b</num>
              <content>
                <p>enforced under this Act;</p>
              </content>
              <content>
                <p>may be supervised in a State or Territory in accordance with terms agreed under this Act.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-6__sec-46__subsec-3B">
            <num>3B</num>
            <content>
              <p>A Tribunal prisoner who is transferred to Australia under this Act while serving a sentence of imprisonment that is:</p>
            </content>
            <paragraph eId="part-6__sec-46__subsec-3B__para-a">
              <num>a</num>
              <content>
                <p>imposed by a Tribunal; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-46__subsec-3B__para-b">
              <num>b</num>
              <content>
                <p>enforced under this Act;</p>
              </content>
              <content>
                <p>may be detained in a prison or hospital or other place in a State or Territory.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-6__sec-46__subsec-4">
            <num>4</num>
            <content>
              <p>Any relevant Australian law, or practice or procedure lawfully observed, concerning the detention of prisoners applies in relation to the prisoner or Tribunal prisoner on and after that transfer to the extent that it is capable of applying concurrently with this Act.</p>
            </content>
          </subsection>
          <subsection eId="part-6__sec-46__subsec-5">
            <num>5</num>
            <content>
              <p>Without limiting subsection (4), Australian law and practice and procedure relating to the following matters are applicable to a prisoner or Tribunal prisoner who is transferred to  under this Act:</p>
            </content>
            <paragraph eId="part-6__sec-46__subsec-5__para-a">
              <num>a</num>
              <content>
                <p>conditions of imprisonment and treatment of prisoners;</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-46__subsec-5__para-b">
              <num>b</num>
              <content>
                <p>release on parole of prisoners;</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-46__subsec-5__para-ba">
              <num>ba</num>
              <content>
                <p>serving the suspended part of a sentence of imprisonment;</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-46__subsec-5__para-c">
              <num>c</num>
              <content>
                <p>classification and separation of prisoners;</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-46__subsec-5__para-d">
              <num>d</num>
              <content>
                <p>removal of prisoners from one prison to another;</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-46__subsec-5__para-e">
              <num>e</num>
              <content>
                <p>removal of prisoners between prisons and hospitals or other places or between one hospital or other place and another;</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-46__subsec-5__para-f">
              <num>f</num>
              <content>
                <p>treatment of mentally impaired prisoners;</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-46__subsec-5__para-g">
              <num>g</num>
              <content>
                <p>eligibility for participation in prison programs, including release under a pre-release permit scheme (however called);</p>
              </content>

              <num>i</num>
              <content>
                <p>transfer of prisoners between States and Territories.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-6__sec-46__subsec-6">
            <num>6</num>
            <content>
              <p>The prisoner or Tribunal prisoner is entitled to any remission or reduction of the sentence of imprisonment imposed by the transfer country or Tribunal that is to be enforced under this Act for which the prisoner would be eligible in accordance with any applicable Australian law if the sentence were a sentence of imprisonment for an offence against a law of the Commonwealth.</p>
            </content>
          </subsection>
          <subsection eId="part-6__sec-46__subsec-7">
            <num>7</num>
            <content>
              <p>Nothing in this section prevents the transfer country or Tribunal from pardoning or granting amnesty to or quashing or otherwise nullifying the conviction of a prisoner serving a sentence of imprisonment imposed by the transfer country or Tribunal in  in accordance with this Act, or from commuting the sentence.</p>
            </content>
          </subsection>
          <subsection eId="part-6__sec-46__subsec-8">
            <num>8</num>
            <content>
              <p>Nothing in this Act imposes any financial responsibility on the Commonwealth to maintain a prisoner transferred under <ref href="#part-4">Part 4</ref> of this Act in a prison, or hospital or other place, in a State or Territory unless the prisoner has community ties with the Jervis Bay Territory, the Territory of Christmas Island or the Territory of Cocos (Keeling) Islands.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-6__sec-47">
          <num>47</num>
          <heading>Prisoner transferred from  taken to be prisoner of transfer country</heading>
          <content>
            <p>On transfer of a prisoner from Australia under this Act, the sentence of imprisonment imposed by the Australian court ceases to have effect in Australia and, except as provided by <ref href="#sec-48">section 48</ref>, the sentence of imprisonment is taken for all purposes in Australia to be a sentence of imprisonment imposed by a court or tribunal of the transfer country and the prisoner is to be a prisoner of the transfer country.</p>
          </content>
        </section>
        <section eId="part-6__sec-48">
          <num>48</num>
          <heading>Pardon, amnesty or commutation of sentences of imprisonment—prisoners transferred from</heading>
          <subsection eId="part-6__sec-48__subsec-1">
            <num>1</num>
            <content>
              <p>During the period in which a sentence of imprisonment is served in a transfer country by a prisoner transferred from Australia under this Act, the prisoner’s conviction may be quashed or otherwise nullified and the prisoner may be pardoned or granted any amnesty or commutation of sentence of imprisonment that could be granted under Australian law if the prisoner were serving the sentence of imprisonment in Australia.</p>
            </content>
          </subsection>
          <subsection eId="part-6__sec-48__subsec-2">
            <num>2</num>
            <content>
              <p>If, during the period in which the sentence of imprisonment is served by a prisoner transferred from Australia under this Act in a transfer country, the prisoner’s conviction is quashed or otherwise nullified or the prisoner is pardoned or granted amnesty or commutation of sentence of imprisonment under Australian law, the Attorney-General is to immediately notify the transfer country that the prisoner should no longer be detained in custody or otherwise subjected to detention or supervision only because of the sentence of imprisonment.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-6__sec-49">
          <num>49</num>
          <heading>Pardon, amnesty or commutation of sentences of imprisonment—prisoners transferred to</heading>
          <subsection eId="part-6__sec-49__subsec-1">
            <num>1</num>
            <content>
              <p>During the period in which a sentence of imprisonment is served in  by a prisoner transferred to  under this Act, the prisoner may be pardoned or granted any amnesty or commutation of sentence of imprisonment that could be granted under Australian law if the sentence of imprisonment had been imposed for an offence against an Australian law.</p>
            </content>
          </subsection>
          <subsection eId="part-6__sec-49__subsec-2">
            <num>2</num>
            <content>
              <p>The Attorney-General is to direct, in a form prescribed by the regulations, that a prisoner must not be detained in custody or otherwise be subjected to detention or supervision in Australia under a sentence of imprisonment imposed by a transfer country enforced under this Act only because of that sentence of imprisonment if, during the period in which the sentence of imprisonment is served in Australia:</p>
            </content>
            <paragraph eId="part-6__sec-49__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>the prisoner is pardoned or granted amnesty or commutation of sentence of imprisonment under an Australian law; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-49__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>the transfer country notifies the Attorney-General that the prisoner’s conviction has been quashed or otherwise nullified or that the prisoner has been pardoned or granted amnesty or commutation of sentence of imprisonment under the law of the transfer country.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-6__sec-49__subsec-3">
            <num>3</num>
            <content>
              <p>The Attorney-General is to direct, in a form prescribed by the regulations, that a prisoner must not be detained in custody or otherwise be subjected to detention or supervision in Australia under a sentence of imprisonment imposed by a Tribunal enforced under this Act only because of that sentence of imprisonment if, during the period in which the sentence is served in Australia:</p>
            </content>
            <paragraph eId="part-6__sec-49__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>the Tribunal notifies the Attorney-General that the prisoner may be pardoned or granted amnesty or commutation of sentence of imprisonment under an Australian law and the prisoner is granted such amnesty or commutation of sentence of imprisonment; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-49__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>the Tribunal notifies the Attorney-General that the prisoner’s conviction has been quashed or otherwise nullified or that the prisoner has been pardoned or granted amnesty or commutation of sentence of imprisonment by the Tribunal.</p>
              </content>
            </paragraph>
          </subsection>
        </section>
      </part>

        <num>7</num>
        <heading>Miscellaneous</heading>
        <section eId="part-7__sec-50">
          <num>50</num>
          <heading>Arrangements with States and Territories</heading>
          <subsection eId="part-7__sec-50__subsec-1">
            <num>1</num>
            <content>
              <p>The Governor-General may make arrangements with the Governor of a State, the Chief Minister of the ACT or the Administrator of a Territory with respect to the administration of this Act, including arrangements relating to the exercise by officers of the State or Territory of functions under this Act.</p>
            </content>
          </subsection>
          <subsection eId="part-7__sec-50__subsec-2">
            <num>2</num>
            <content>
              <p>An arrangement may be varied or terminated at any time.</p>
            </content>
          </subsection>
          <subsection eId="part-7__sec-50__subsec-3">
            <num>3</num>
            <content>
              <p>	(3)	The Attorney-General is to cause notice of the making, variation or termination of an arrangement to be published in the <i>Gazette</i>.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-7__sec-51">
          <num>51</num>
          <heading>Recovery of costs and expenses of transfer</heading>
          <subsection eId="part-7__sec-51__subsec-1">
            <num>1</num>
            <content>
              <p>The terms agreed under this Act for transfer of a prisoner or Tribunal prisoner may, if the Attorney-General considers it appropriate, include terms relating to the recovery of the costs and expenses reasonably incurred in transferring the prisoner or Tribunal prisoner.</p>
            </content>
          </subsection>
          <subsection eId="part-7__sec-51__subsec-2">
            <num>2</num>
            <content>
              <p>If any costs or expenses in respect of money recovered in accordance with such terms were incurred by a State or Territory, the Commonwealth is to reimburse the State or Territory concerned.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-7__sec-52">
          <num>52</num>
          <heading>Prisoner and prisoner’s representative to be kept informed</heading>
          <content>
            <p>The Attorney-General must arrange for a prisoner or prisoner’s representative to be kept informed of the progress of:</p>
          </content>
          <paragraph eId="part-7__sec-52__para-a">
            <num>a</num>
            <content>
              <p>any application made under <ref href="#sec-16">section 16</ref>; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-7__sec-52__para-b">
            <num>b</num>
            <content>
              <p>any request made under <ref href="#sec-24">section 24</ref> or 33;</p>
            </content>
            <content>
              <p>for the transfer of the prisoner.</p>
            </content>
          </paragraph>
        </section>
        <section eId="part-7__sec-53">
          <num>53</num>
          <heading>Delegation</heading>
          <content>
            <p>The Attorney-General may delegate in writing all or any of the Attorney-General’s powers under this Act or the regulations to:</p>
          </content>
          <paragraph eId="part-7__sec-53__para-a">
            <num>a</num>
            <content>
              <p><role refersTo="#secretary">the Secretary</role> of the Department; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-7__sec-53__para-b">
            <num>b</num>
            <content>
              <p>an SES employee, or acting SES employee, in the Department; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-7__sec-53__para-c">
            <num>c</num>
            <content>
              <p>an APS employee who holds or performs the duties of an Executive Level 2, or equivalent, position in the Department.</p>
            </content>
          </paragraph>
        </section>
        <section eId="part-7__sec-54">
          <num>54</num>
          <heading>Notification of countries as transfer countries</heading>
          <content>
            <p>The Attorney-General is to inform each State and Territory Minister whenever a country is declared by the regulations to be a transfer country and request the State and Territory Ministers to use their best endeavours to notify any prisoner who may be eligible for transfer under this Act of the application of this Act to a country of which the prisoner is a national and of the operation of this Act.</p>
          </content>
        </section>
        <section eId="part-7__sec-55">
          <num>55</num>
          <heading>Transit of prisoners</heading>
          <subsection eId="part-7__sec-55__subsec-1">
            <num>1</num>
            <content>
              <p>The following provisions apply to the transport in custody through  of a prisoner or Tribunal prisoner who is being transferred from a transfer country or Tribunal country to another transfer country or Tribunal country:</p>
            </content>
            <paragraph eId="part-7__sec-55__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>the prisoner may be transported in custody through  for the purposes of the transfer;</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-55__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>if the aircraft or ship that transports the prisoner makes a landing or calls at a place in :</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-55__subsec-1__para-i">
              <num>i</num>
              <content>
                <p>the person holding the prisoner in custody before the landing or call is made may hold the prisoner in custody at the place for a period not exceeding 24 hours;</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-55__subsec-1__para-ii">
              <num>ii</num>
              <content>
                <p>any police officer may provide such assistance at the place as is reasonable and necessary to facilitate transporting of the prisoner in custody;</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-55__subsec-1__para-iii">
              <num>iii</num>
              <content>
                <p>any magistrate to whom application is made, in the form prescribed by the regulations, by or on behalf of the transfer country or Tribunal concerned must issue a warrant ordering a person specified in the warrant to hold the prisoner in custody for such period or periods as the magistrate considers necessary to facilitate the transporting of the prisoner;</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-55__subsec-1__para-iv">
              <num>iv</num>
              <content>
                <p>the Attorney-General may, on application by the transfer country or Tribunal concerned, authorise in writing a magistrate to issue a warrant ordering a person specified in the warrant to hold the prisoner in custody for a further specified period in order to facilitate the transporting of the prisoner;</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-55__subsec-1__para-v">
              <num>v</num>
              <content>
                <p>the Attorney-General may at any time direct a person having custody of the prisoner under this paragraph to release the prisoner from custody.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-7__sec-55__subsec-2">
            <num>2</num>
            <content>
              <p>The total period or periods of any custody in accordance with subparagraphs (1)(b)(i) and (ii) must not exceed 96 hours.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-7__sec-56">
          <num>56</num>
          <heading>Arrest of persons escaping from custody</heading>
          <subsection eId="part-7__sec-56__subsec-1">
            <num>1</num>
            <content>
              <p>A police officer may, without warrant, arrest a person if the officer has reasonable grounds to believe that the person has escaped from custody authorised by this Act.</p>
            </content>
          </subsection>
          <subsection eId="part-7__sec-56__subsec-2">
            <num>2</num>
            <content>
              <p>The police officer must, as soon as practicable, take the person before a magistrate.</p>
            </content>
          </subsection>
          <subsection eId="part-7__sec-56__subsec-3">
            <num>3</num>
            <content>
              <p>If the magistrate is satisfied that the person has escaped from custody authorised by this Act, the magistrate may issue a warrant authorising any police officer to return the person to the custody from which the person escaped.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-7__sec-56A">

          <heading>Aiding persons to escape etc.</heading>
          <content>
            <p>		<i>Crimes Act 1914</i> has effect as if:<ref href="#dvs-5">Division 5</ref> of <ref href="#part-II">Part II</ref>I of the </p>

          <paragraph eId="part-7__sec-56A__para-a">
            <num>a</num>
            <content>
              <p>custody or detention in Australia under this Act were custody in respect of an offence against a law of the Commonwealth; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-7__sec-56A__para-b">
            <num>b</num>
            <content>
              <p>arrest under <ref href="#sec-56">section 56</ref> of this Act were arrest in respect of an offence against a law of the Commonwealth.</p>
            </content>
          </paragraph>
        </section>
        <section eId="part-7__sec-57">
          <num>57</num>
          <heading>Consent of the Immigration Minister</heading>
          <content>
            <p>If the Attorney-General proposes to consent to the transfer to  of a Tribunal prisoner, the Attorney-General must first obtain the consent of the Immigration Minister.</p>
          </content>

          <heading>Regulations</heading>
          <subsection eId="part-7__sec-58__subsec-1">
            <num>1</num>

              <p>The Governor-General may make regulations prescribing matters:</p>
            </content>

              <num>a</num>
              <content>
                <p>required or permitted by this Act to be prescribed; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-58__subsec-1__para-b">
              <num>b</num>

                <p>necessary or convenient to be prescribed for carrying out or giving effect to this Act.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-7__sec-58__subsec-2">

              <p>In particular, regulations may make provision for or with respect to information to be provided to prisoners and other persons for the purposes of this Act and any State or Territory Act relating to the international transfer of prisoners.</p>

              <p>The regulations may prescribe penalties not exceeding a fine of <quantity refersTo="#penaltyUnit">10 penalty units</quantity> for offences against the regulations.</p>
