          <heading>Short title</heading>
          <content>
            <p>		This Act may be cited as the <i>National Transmission Network Sale Act 1998</i>.</p>
          </content>
        </section>
        <section eId="part-1__sec-2">
          <num>2</num>
          <heading>Commencement</heading>
          <content>
            <p>This Act commences on the day on which it receives the Royal Assent.</p>
          </content>
        </section>
        <section eId="part-1__sec-3">
          <num>3</num>
          <heading>Definitions</heading>
          <subsection eId="part-1__sec-3__subsec-1">
            <num>1</num>
            <content>
              <p>In this Act:</p>
            </content>
            <content>
              <p><term refersTo="#term-abc">ABC</term> means <def>the Australian Broadcasting Corporation.</def></p>
              <p><term refersTo="#term-accc">ACCC</term> means <def>the Australian Competition and Consumer Commission.</def></p>
              <p><term refersTo="#term-access-seeker">access seeker</term> has the same meaning as <def>in <ref href="#part-XI">Part XI</ref>C of the Competition and Consumer Act.</def></p>
              <p><term refersTo="#term-ancillary-service">ancillary service</term> means <def>a service that is ancillary to a national broadcasting service and is carried by means of an analog main carrier signal that is used for the transmission of the national broadcasting service.</def></p>
              <p><term refersTo="#term-archives-act">Archives Act</term> means <def><ref href="">the Archives Act 1983</ref>.</def></p>
              <p><b><i>asset</i></b> means:</p>

              <num>a</num>
              <content>
                <p>any legal or equitable estate or interest in real or personal property, including a contingent or prospective one; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>any right, privilege or immunity, including a contingent or prospective one.</p>
              </content>
              <content>
                <p><term refersTo="#term-broadcasting-service">broadcasting service</term> has the same meaning as <def>in the Broadcasting Services Act.</def></p>
                <p><term refersTo="#term-broadcasting-services-act">Broadcasting Services Act</term> means <def><ref href="">the Broadcasting Services Act 1992</ref>.</def></p>
                <p><term refersTo="#term-carrier-licence">carrier licence</term> has the same meaning as <def>in the Telecommunications Act.</def></p>
                <p><b><i>commercial broadcasting licensee</i></b> means:</p>

              <num>a</num>
              <content>
                <p>the holder of a commercial television broadcasting licence (within the meaning of the Broadcasting Services Act); or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>the holder of a commercial radio broadcasting licence (within the meaning of the Broadcasting Services Act).</p>
              </content>
              <content>
                <p><term refersTo="#term-commonwealth-asset">Commonwealth asset</term> means <def>an asset of the Commonwealth.</def></p>
                <p><term refersTo="#term-commonwealth-liability">Commonwealth liability</term> means <def>a liability of the Commonwealth.</def></p>
                <p><term refersTo="#term-community-broadcasting-licensee">community broadcasting licensee</term> means <def>the holder of a community broadcasting licence (within the meaning of the Broadcasting Services Act).</def></p>
                <p><term refersTo="#term-community-broadcasting-service">community broadcasting service</term> has the same meaning as <def>in the Broadcasting Services Act.</def></p>
                <p><term refersTo="#term-company">company</term> means <def>a body corporate.</def></p>
                <p><term refersTo="#term-competition-and-consumer-act">Competition and Consumer Act</term> means <def><ref href="">the Competition and Consumer Act 2010</ref>.</def></p>
                <p><term refersTo="#term-declared-remote-area">declared remote area</term> means <def>an area specified by the Minister under subsection (2) for the purposes of this definition.</def></p>
                <p><term refersTo="#term-declared-successor">declared successor</term> means <def>a person declared under <ref href="#sec-22">section 22</ref> to be a declared successor.</def></p>
                <p><b><i>emergency service organisation</i></b> means:</p>

            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>any of the following organisations (including those consisting wholly or partly of volunteers):</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-1__para-i">
              <num>i</num>
              <content>
                <p>a police force or service;</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-1__para-ii">
              <num>ii</num>
              <content>
                <p>a fire service;</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-1__para-iii">
              <num>iii</num>
              <content>
                <p>an ambulance service;</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-1__para-iv">
              <num>iv</num>
              <content>
                <p>a coast guard service, rescue service or emergency service; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>any other organisation specified by <role refersTo="#minister">the Minister</role> under subsection (2) for the purposes of this paragraph.</p>
              </content>
              <content>
                <p><term refersTo="#term-exempt-re-transmission">exempt re-transmission</term> means <def>a re-transmission covered by <ref href="#sec-212">section 212</ref> of the Broadcasting Services Act.</def></p>
                <p><b><i>government body</i></b> means:</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>a State or Territory; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>an authority of a State or Territory; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>a local government body of a State or Territory.</p>
              </content>
              <content>
                <p><term refersTo="#term-instrument">instrument</term> includes <def>a document.</def></p>
                <p><term refersTo="#term-land-registration-official">land registration official</term> means <def>the Registrar of Titles or other proper officer of the State or Territory in which the land is situated.</def></p>
                <p><term refersTo="#term-liability">liability</term> means <def>a liability, duty or obligation, including a contingent or prospective one.</def></p>
                <p><term refersTo="#term-national-broadcasting-service">national broadcasting service</term> has the same meaning as <def>in the Broadcasting Services Act.</def></p>
                <p><term refersTo="#term-nbs-transmitter-licence">NBS transmitter licence</term> means <def>a transmitter licence (within the meaning of the Radiocommunications Act) for a transmitter that is for use for transmitting a national broadcasting service to the public.</def></p>
                <p><term refersTo="#term-nominated-customer">nominated customer</term> has the meaning given by <def><ref href="#sec-15">section 15</ref>.</def></p>
                <p><term refersTo="#term-nominated-purpose">nominated purpose</term> means <def>a purpose specified in <ref href="#sec-15">section 15</ref> as a purpose for which the person is a nominated customer.</def></p>
                <p><term refersTo="#term-nominated-service">nominated service</term> has the meaning given by <def><ref href="#sec-14">section 14</ref>.</def></p>
                <p><term refersTo="#term-non-profit-body">non-profit body</term> means <def>an incorporated body that: is not carried on for the purposes of profit or gain to its individual members; and is prohibited by its constituent document from making any distribution of money or property to its individual members.</def></p>

              <num>a</num>
              <content>
                <p>is not carried on for the purposes of profit or gain to its individual members; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>is prohibited by its constituent document from making any distribution of money or property to its individual members.</p>
              </content>
              <content>
                <p><term refersTo="#term-ntc-or-national-transmission-company">NTC or National Transmission Company</term> means <def>a company to which assets or liabilities are transferred under <ref href="#sec-9">section 9</ref>.</def></p>
                <p><term refersTo="#term-open-narrowcasting-television-service">open narrowcasting television service</term> has the same meaning as <def>in the Broadcasting Services Act.</def></p>
                <p><term refersTo="#term-original-asset">original asset</term> means <def>an asset transferred from the Commonwealth under <ref href="#sec-9">section 9</ref>.</def></p>
                <p><term refersTo="#term-radiocommunication">radiocommunication</term> has the same meaning as <def>in the Radiocommunications Act.</def></p>
                <p><term refersTo="#term-radiocommunications-act">Radiocommunications Act</term> means <def><ref href="">the Radiocommunications Act 1992</ref>.</def></p>
                <p><term refersTo="#term-replacement-asset">replacement asset</term> means <def>an asset that is a replacement for: an original asset; or an asset that is a replacement asset because of a previous application of this definition.</def></p>

            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>an original asset; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>an asset that is a replacement asset because of a previous application of this definition.</p>
              </content>
              <content>
                <p><term refersTo="#term-sbs">SBS</term> means <def>the Special Broadcasting Service Corporation.</def></p>
                <p><term refersTo="#term-share">share</term> means <def>a share in the company’s share capital.</def></p>
                <p><term refersTo="#term-site">site</term> has the same meaning as <def>in <ref href="#part-5">Part 5</ref> of Schedule 1 to the Telecommunications Act.</def></p>
                <p><b><i>specified</i></b>, in relation to an asset, liability or instrument, means specified or identified (whether by reference to a class or by any other means).</p>
                <p><b><i>telecommunications access regime</i></b> means:</p>

            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>	(a)	<i>Telecommunications Legislation Amendment (Competition and Consumer Safeguards) Act 2010</i>); and<ref href="#part-XI">Part XI</ref>C of the Competition and Consumer Act (as in force immediately before the commencement of <ref href="#dvs-1">Division 1</ref> of <ref href="#part-2">Part 2</ref> of Schedule 1 to the </p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>	(b)	any other provisions of the Competition and Consumer Act (as in force immediately before the commencement of <i>Telecommunications Legislation Amendment (Competition and Consumer Safeguards) Act 2010</i>) that relate to the operation of that Part; and<ref href="#dvs-1">Division 1</ref> of <ref href="#part-2">Part 2</ref> of Schedule 1 to the </p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>sections 62 and 68, subsection 70(5) and Parts 30, 31 and 32 of the Telecommunications Act; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-1__para-d">
              <num>d</num>
              <content>
                <p>any other provisions of the Telecommunications Act that relate to the operation of the provisions specified in paragraph (c).</p>
              </content>
              <content>
                <p><term refersTo="#term-telecommunications-act">Telecommunications Act</term> means <def><ref href="">the Telecommunications Act 1997</ref>.</def></p>
                <p><b><i>telecommunications carrier rules</i></b> means:</p>
              </content>
            </paragraph>

              <num>a</num>
              <content>

              <p><role refersTo="#minister">The Minister</role> may, by legislative instrument, specify:</p>

                <p>	(a)	an area for the purposes of the definition of <b><i>declared remote area</i></b> in subsection (1); or</p>
              </content>
            </paragraph>

                <p>	(b)	an organisation for the purposes of paragraph (b) of the definition of <b><i>emergency service organisation</i></b> in subsection (1).</p>

        </section>

          <heading>Crown to be bound</heading>
          <subsection eId="part-1__sec-4__subsec-1">
            <num>1</num>
            <content>
              <p>This Act binds the Crown in the right of the Commonwealth, of each of the States, of the Australian Capital Territory and of the Northern Territory.</p>
            </content>
          </subsection>
          <subsection eId="part-1__sec-4__subsec-2">
            <num>2</num>
            <content>
              <p><b>	</b>(2)<b>	</b>This Act does not make the Crown liable to be prosecuted for an offence.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-1__sec-5">
          <num>5</num>
          <heading>External Territories</heading>
          <content>
            <p>This Act extends to all the external Territories.</p>
          </content>
        </section>
        <section eId="part-1__sec-6">
          <num>6</num>
          <heading>Extra-territorial operation</heading>
          <content>
            <p>This Act extends to acts, omissions, matters and things outside Australia, whether or not in a foreign country.</p>
          </content>
        </section>
      </part>
      <part eId="part-2">
        <num>2</num>
        <heading>Sale of the National Transmission Network</heading>
        <section eId="part-2__sec-7">
          <num>7</num>
          <heading>Fixtures on non-Commonwealth land</heading>
          <subsection eId="part-2__sec-7__subsec-1">
            <num>1</num>
            <content>
              <p>	(1)	The Minister for Finance and Administration may, by notice in the <i>Gazette</i>, declare that this section applies to network facilities specified in the notice.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-7__subsec-2">
            <num>2</num>
            <content>
              <p>At the end of the day on which the notice is published, any specified network facility that is a fixture on non-Commonwealth land:</p>
            </content>
            <paragraph eId="part-2__sec-7__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>is severed from the land and remains severed; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-7__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>vests in the Commonwealth;</p>
              </content>
              <content>
                <p>by force of this section.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-7__subsec-3">
            <num>3</num>
            <content>
              <p>In this section:</p>
            </content>
            <content>
              <p><b><i>network facility</i></b> means any asset used, or formerly used, by the Commonwealth in connection with the transmission of a broadcasting service.</p>
              <p><b><i>non</i></b><b><i>-</i></b><b><i>Commonwealth land</i></b> means land not owned by the Commonwealth.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-2__sec-8">
          <num>8</num>
          <heading>Effect of Lands Acquisition Act on past grants etc. of interests in land</heading>
          <subsection eId="part-2__sec-8__subsec-1">
            <num>1</num>
            <content>
              <p>If an instrument made or executed before the commencement of this Act was expressed to grant or transfer an interest in land to or from the Commonwealth, then <ref href="#sec-9">section 9</ref> is to be applied on the basis that the grant or transfer is not invalid, and is taken never to have been invalid, solely because the grant or transfer was not made in accordance with the requirements of the Lands Acquisition Act.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-8__subsec-2">
            <num>2</num>
            <content>
              <p>In this section:</p>
            </content>
            <content>
              <p><b><i>interest in land</i></b> has the same meaning as in the Lands Acquisition Act.</p>
              <p><b><i>Lands Acquisition Act</i></b> means the Act for the time being in force relating to the acquisition of land by the Commonwealth and associated matters.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-2__sec-9">
          <num>9</num>
          <heading>Transfer of assets and liabilities</heading>
          <subsection eId="part-2__sec-9__subsec-1">
            <num>1</num>
            <content>
              <p>	(1)	The Minister for Finance and Administration may, by notice in the <i>Gazette</i>, declare all or any of the following, in relation to a company specified in the notice:</p>
            </content>
            <paragraph eId="part-2__sec-9__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>	(a)	a specified Commonwealth asset vests in the company at a time specified in the notice (the <b><i>transfer time</i></b>), without any conveyance, transfer or assignment;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-9__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>	(b)	at the<b> </b>transfer time, the company becomes the Commonwealth’s successor in law in relation to the transferred asset;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-9__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>a specified instrument relating to the transferred asset continues to have effect after the transfer time as if a reference in the instrument to the Commonwealth or to the National Transmission Agency were a reference to the company.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-9__subsec-2">
            <num>2</num>
            <content>
              <p>	(2)	The Minister for Finance and Administration may, by notice in the <i>Gazette</i>, declare all or any of the following, in relation to a company specified in the notice:</p>
            </content>
            <paragraph eId="part-2__sec-9__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>	(a)	a Commonwealth liability specified in the notice ceases to be a Commonwealth liability at a time specified in the notice (the <b><i>transfer time</i></b>) and becomes a liability of the company;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-9__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>	(b)	at the<b> </b>transfer time, the company becomes the Commonwealth’s successor in law in relation to the transferred liability;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-9__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>a specified instrument relating to the transferred liability continues to have effect after the transfer time as if a reference in the instrument to the Commonwealth or to the National Transmission Agency were a reference to the company.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-9__subsec-3">
            <num>3</num>
            <content>
              <p>Declarations in relation to both assets and liabilities may be included in the same notice. The same notice may include declarations in relation to more than one asset or liability.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-9__subsec-4">
            <num>4</num>
            <content>
              <p>A declaration under this section has effect according to its terms.</p>
            </content>

                <p>Note:	The assets and liabilities that can be transferred under this section include assets and liabilities that consist of rights and obligations under contracts.</p>

          </subsection>
        </section>
        <section eId="part-2__sec-10">
          <num>10</num>
          <heading>Exemption from stamp duty and other taxes</heading>
          <subsection eId="part-2__sec-10__subsec-1">
            <num>1</num>
            <content>
              <p>In this section:</p>
            </content>
            <content>
              <p><b><i>exempt matter</i></b> means the transfer of an asset or a liability under section 9 to a company at a time when all the shares in the company are owned by the Commonwealth.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-10__subsec-2">
            <num>2</num>
            <content>
              <p>Stamp duty or other tax is not payable under a law of a State or Territory in respect of:</p>
            </content>
            <paragraph eId="part-2__sec-10__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>an exempt matter; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-10__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>anything done (including a transaction entered into or an instrument made, executed, lodged or given) because of, or for a purpose connected with or arising out of, an exempt matter.</p>
              </content>
            </paragraph>
          </subsection>
        </section>
        <section eId="part-2__sec-11">
          <num>11</num>
          <heading>Registration of transfers of land</heading>
          <subsection eId="part-2__sec-11__subsec-1">
            <num>1</num>
            <content>
              <p>This section applies if:</p>
            </content>
            <paragraph eId="part-2__sec-11__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>any right, title and interest in particular land vests in a company under this Act; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-11__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>there is lodged with a land registration official a certificate that:</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-11__subsec-1__para-i">
              <num>i</num>
              <content>
                <p>is signed by an authorised person; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-11__subsec-1__para-ii">
              <num>ii</num>
              <content>
                <p>identifies the land, whether by reference to a map or otherwise; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-11__subsec-1__para-iii">
              <num>iii</num>
              <content>
                <p>states that the right, title and interest has become vested in the company under this Act.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-11__subsec-2">
            <num>2</num>
            <content>
              <p>The land registration official may:</p>
            </content>
            <paragraph eId="part-2__sec-11__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>register the matter in a way that is the same as, or similar to, the way in which dealings in land of that kind are registered; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-11__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>deal with, and give effect to, the certificate.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-11__subsec-3">
            <num>3</num>
            <content>
              <p><b>	</b>(3)	A document that appears to be a certificate under subsection (1) is taken to be such a certificate, and to have been properly given, unless the contrary is established.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-11__subsec-4">
            <num>4</num>
            <content>
              <p>In this section:</p>
            </content>
            <content>
              <p><b><i>authorised person</i></b> means:</p>
            </content>
            <paragraph eId="part-2__sec-11__subsec-4__para-a">
              <num>a</num>
              <content>
                <p><role refersTo="#minister">the Minister</role> for Finance and Administration; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-11__subsec-4__para-b">
              <num>b</num>
              <content>
                <p>a person authorised by <role refersTo="#minister">the Minister</role> for Finance and Administration, in writing, for the purposes of this section.</p>
              </content>
            </paragraph>
          </subsection>
        </section>
        <section eId="part-2__sec-12">
          <num>12</num>
          <heading>Part does not place person in breach of contract etc.</heading>
          <content>
            <p>The operation of this Part is not to be regarded as:</p>
          </content>
          <paragraph eId="part-2__sec-12__para-a">
            <num>a</num>
            <content>
              <p>placing a person in breach of contract or confidence; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-12__para-b">
            <num>b</num>
            <content>
              <p>otherwise making a person guilty of a civil wrong; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-12__para-c">
            <num>c</num>
            <content>
              <p>placing a person in breach of any contractual provision prohibiting, restricting or regulating:</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-12__para-i">
            <num>i</num>
            <content>
              <p>the assignment or transfer of any asset or liability; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-12__para-ii">
            <num>ii</num>
            <content>
              <p>the disclosure of any information; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-12__para-d">
            <num>d</num>
            <content>
              <p>releasing any surety from any of the surety’s obligations in relation to a liability that is transferred to a company under this Part.</p>
            </content>
          </paragraph>
        </section>
      </part>
      <part eId="part-3">
        <num>3</num>
        <heading>Access to services etc.</heading>
        <section eId="part-3__sec-13">
          <num>13</num>
          <heading>Deemed application of telecommunications access regime</heading>
          <subsection eId="part-3__sec-13__subsec-1">
            <num>1</num>
            <content>
              <p>The telecommunications access regime has effect in relation to a nominated service in accordance with this Part.</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-13__subsec-2">
            <num>2</num>
            <content>
              <p>The telecommunications access regime has effect as if:</p>
            </content>
            <paragraph eId="part-3__sec-13__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>each nominated service were a declared service within the meaning of <ref href="#part-XI">Part XI</ref>C of the Competition and Consumer Act; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-13__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>each provider of a nominated service were:</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-13__subsec-2__para-i">
              <num>i</num>
              <content>
                <p>a carrier (within the meaning of the Telecommunications Act); and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-13__subsec-2__para-ii">
              <num>ii</num>
              <content>
                <p>the holder of a carrier licence; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-13__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>each nominated customer were a service provider within the meaning of <ref href="#part-XI">Part XI</ref>C of the Competition and Consumer Act.</p>
              </content>
            </paragraph>
          </subsection>
        </section>
        <section eId="part-3__sec-14">
          <num>14</num>
          <heading>Nominated services</heading>
          <subsection eId="part-3__sec-14__subsec-1">
            <num>1</num>
            <content>
              <p>	(1)	Each of the following is a <b><i>nominated service</i></b>:</p>
            </content>
            <paragraph eId="part-3__sec-14__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>the carriage of broadcasting services, where:</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-14__subsec-1__para-i">
              <num>i</num>
              <content>
                <p>the provider of the carriage service is an NTC or a declared successor; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-14__subsec-1__para-ii">
              <num>ii</num>
              <content>
                <p>the carriage service is to be provided, to any extent, using assets that are original assets or replacement assets; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-14__subsec-1__para-iii">
              <num>iii</num>
              <content>
                <p>the carriage service is to be provided for the purpose of analog transmission, or for purposes that include analog transmission;</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-14__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>the carriage of ancillary services, where:</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-14__subsec-1__para-i">
              <num>i</num>
              <content>
                <p>the provider of the carriage service is an NTC or a declared successor; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-14__subsec-1__para-ii">
              <num>ii</num>
              <content>
                <p>the carriage service is to be provided, to any extent, using assets that are original assets or replacement assets;</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-14__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>the provision of access to sites or telecommunications transmission towers, where:</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-14__subsec-1__para-i">
              <num>i</num>
              <content>
                <p>the provider of the access is an NTC or a declared successor; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-14__subsec-1__para-ii">
              <num>ii</num>
              <content>
                <p>the sites or towers are original assets or replacement assets.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-3__sec-14__subsec-2">
            <num>2</num>
            <content>
              <p>	(2)	If a carriage service referred to in paragraph (1)(a) is to be provided for the purpose of analog transmission and also for other purposes, then the carriage service is a <b><i>nominated service</i></b> only to the extent to which it is to be provided for the purpose of analog transmission.</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-14__subsec-3">
            <num>3</num>
            <content>
              <p>In this section:</p>
            </content>
            <content>
              <p><b><i>analog transmission</i></b> means transmission of a broadcasting service to the public using an analog modulation technique.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-3__sec-15">
          <num>15</num>
          <heading>Nominated customers</heading>
          <subsection eId="part-3__sec-15__subsec-1">
            <num>1</num>
            <content>
              <p>The telecommunications access regime applies only in cases where the access seeker is a nominated customer and is seeking access for a nominated purpose.</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-15__subsec-2">
            <num>2</num>
            <content>
              <p>The ABC and SBS are nominated customers for the purposes of:</p>
            </content>
            <paragraph eId="part-3__sec-15__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>the carriage of national broadcasting services or ancillary services; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-15__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>access to sites or telecommunications transmission towers for purposes connected with national broadcasting services or ancillary services.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-3__sec-15__subsec-3">
            <num>3</num>
            <content>
              <p>A non-profit body is a nominated customer for the purposes of access to sites or telecommunications transmission towers, where that access is for community or educational purposes connected with an open narrowcasting television service.</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-15__subsec-4">
            <num>4</num>
            <content>
              <p>A community broadcasting licensee is a nominated customer for the purposes of:</p>
            </content>
            <paragraph eId="part-3__sec-15__subsec-4__para-a">
              <num>a</num>
              <content>
                <p>the carriage of broadcasting services solely or principally for the purpose of supplying the service known as Radio for the Print Handicapped; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-15__subsec-4__para-b">
              <num>b</num>
              <content>
                <p>access to sites or telecommunications transmission towers for purposes connected with a community broadcasting service.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-3__sec-15__subsec-5">
            <num>5</num>
            <content>
              <p>An emergency service organisation is a nominated customer for the purposes of access to sites or telecommunications transmission towers for purposes connected with radiocommunication transmissions by the organisation.</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-15__subsec-6">
            <num>6</num>
            <content>
              <p>A commercial broadcasting licensee is a nominated customer for the purposes of access to sites or telecommunications transmission towers for purposes connected with providing a commercial broadcasting service in a declared remote area.</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-15__subsec-7">
            <num>7</num>
            <content>
              <p>A non-profit body is a nominated customer for the purposes of:</p>
            </content>
            <paragraph eId="part-3__sec-15__subsec-7__para-a">
              <num>a</num>
              <content>
                <p>the carriage of broadcasting services for the purpose of an exempt re-transmission; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-15__subsec-7__para-b">
              <num>b</num>
              <content>
                <p>access to sites or telecommunications transmission towers for purposes connected with an exempt re-transmission.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-3__sec-15__subsec-8">
            <num>8</num>
            <content>
              <p>A government body is a nominated customer for the purposes of:</p>
            </content>
            <paragraph eId="part-3__sec-15__subsec-8__para-a">
              <num>a</num>
              <content>
                <p>the carriage of broadcasting services for the purpose of an exempt re-transmission; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-15__subsec-8__para-b">
              <num>b</num>
              <content>
                <p>access to sites or telecommunications transmission towers for purposes connected with an exempt re-transmission.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-3__sec-15__subsec-9">
            <num>9</num>
            <content>
              <p>The same person or body can be a nominated customer under more than one of the preceding subsections.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-3__sec-16">
          <num>16</num>
          <heading>Miscellaneous modifications of telecommunications access regime</heading>
          <subsection eId="part-3__sec-16__subsec-1">
            <num>1</num>
            <content>
              <p>The following provisions of the Competition and Consumer Act do not apply:</p>
            </content>

              <num>a</num>

                <p>subsections 152AB(2), (3), (4), (5), (6), (7) and (8);</p>
              </content>
            </paragraph>

          <heading>Relationship with other access regimes</heading>
          <subsection eId="part-3__sec-17__subsec-1">
            <num>1</num>
            <content>
              <p>If a nominated service becomes a declared service for the purposes of the telecommunications access regime in accordance with <ref href="#sec-152A">section 152A</ref>L of the Competition and Consumer Act, then this Act does not prevent the application of the telecommunications access regime in relation to:</p>

              <num>a</num>
              <content>
                <p>access to the declared service by persons who are not nominated customers; or</p>
              </content>
            </paragraph>

                <p>access to the declared service by nominated customers for purposes other than nominated purposes.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-3__sec-17__subsec-2">
            <num>2</num>
            <content>
              <p>A notification must not be given under <ref href="#sec-44S">section 44S</ref> of the Competition and Consumer Act in relation to an access dispute if:</p>
            </content>
            <paragraph eId="part-3__sec-17__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>the dispute relates to a nominated service; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-17__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>the third party is a nominated customer who is seeking access for a nominated purpose.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-3__sec-17__subsec-3">
            <num>3</num>
            <content>
              <p>The ACCC must not accept an undertaking under <ref href="#sec-44Z">section 44Z</ref>ZA of the Competition and Consumer Act if any of the terms and conditions set out in the undertaking relate to access to a nominated service by a nominated customer for a nominated purpose.</p>
            </content>
          </subsection>
        </section>
      </part>
      <part eId="part-4">
        <num>4</num>
        <heading>Restrictions on transfer of assets</heading>
        <section eId="part-4__sec-18">
          <num>18</num>
          <heading>Minister’s approval required for transfers of original assets or replacement assets</heading>
          <subsection eId="part-4__sec-18__subsec-1">
            <num>1</num>
            <content>
              <p>A transfer of an original asset or a replacement asset by any person is of no effect unless approved in writing by <role refersTo="#minister">the Minister</role> before the time of transfer.</p>
            </content>
          </subsection>
          <subsection eId="part-4__sec-18__subsec-2">
            <num>2</num>
            <content>
              <p>If a person makes a written application to <role refersTo="#minister">the Minister</role> for approval of a proposed transfer, <role refersTo="#minister">the Minister</role> must approve the transfer, unless <role refersTo="#minister">the Minister</role> refuses under subsection (3).</p>
            </content>
          </subsection>
          <subsection eId="part-4__sec-18__subsec-3">
            <num>3</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> may refuse to approve a transfer on any of the following grounds:</p>
            </content>

              <num>a</num>
              <content>
                <p><role refersTo="#minister">the Minister</role> has reason to believe that the transfer might jeopardise continued access by a nominated customer to a nominated service for a nominated purpose;</p>

              <num>b</num>
              <content>
                <p>any other prescribed ground that relates to matters covered by paragraph 51(v) of the Constitution.</p>
              </content>

              <p>Application may be made to the Administrative Review Tribunal for review of a decision by <role refersTo="#minister">the Minister</role> under subsection (3) refusing to grant an approval.</p>

            <num>5</num>
            <content>
              <p>This section does not apply to assets that are exempted from the operation of this section by notice by <role refersTo="#minister">the Minister</role> under subsection (6).</p>

              <p><role refersTo="#minister">The Minister</role> may, by legislative instrument, give a notice for the purposes of subsection (5) in relation to assets.</p>

        <heading>Powers and immunities of NTC or declared successor</heading>

          <heading>Deemed application of telecommunications carrier rules</heading>

            <num>1</num>
            <content>
              <p>The telecommunications carrier rules have effect in accordance with this Part, in relation to an NTC or declared successor, in relation to any telecommunications facility that satisfies the following conditions:</p>
            </content>
            <paragraph eId="part-6__sec-20__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>the facility is owned by the NTC or the declared successor;</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-20__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>the facility:</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-20__subsec-1__para-i">
              <num>i</num>
              <content>
                <p>is an original asset consisting of land; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-20__subsec-1__para-ii">
              <num>ii</num>
              <content>
                <p>is an original asset and is located at land on which there is located a telecommunications transmission tower that is either an original asset or a replacement asset; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-20__subsec-1__para-iii">
              <num>iii</num>
              <content>
                <p>is a replacement asset and is located at land on which there is located a telecommunications transmission tower that is either an original asset or a replacement asset.</p>
              </content>
            </paragraph>
          </subsection>

              <p>The telecommunications carrier rules have effect as if the NTC or declared successor were:</p>
            </content>
            <paragraph eId="part-6__sec-20__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>a carrier (within the meaning of the Telecommunications Act); and</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-20__subsec-2__para-b">
              <num>b</num>

                <p>the holder of a carrier licence.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-6__sec-20__subsec-3">
            <num>3</num>
            <content>
              <p>This Part does not apply to an NTC or declared successor at any time when the NTC or declared successor is actually the holder of a carrier licence.</p>

          </subsection>
        </section>

          <heading>Miscellaneous modifications of telecommunications carrier rules</heading>
          <content>
            <p>The following provisions of Schedule 3 to the Telecommunications Act do not apply:</p>

              <p>	(1)	The Minister may, by notice in the <i>Gazette</i>, declare a person to be a declared successor for the purposes of this Act.</p>

              <p>A notice under subsection (1) has no effect unless the person is the owner of an original asset, or a replacement asset, on the date on which the notice is published.</p>

              <p>Application may be made to the Administrative Review Tribunal for review of the following decisions of <role refersTo="#minister">the Minister</role>:</p>

          </subsection>
        </section>

          <heading>Delegation</heading>
          <subsection eId="part-7__sec-23__subsec-1">
            <num>1</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> may, by writing, delegate any of <role refersTo="#minister">the Minister</role>’s powers under this Act to:</p>
            </content>
            <paragraph eId="part-7__sec-23__subsec-1__para-a">
              <num>a</num>
              <content>
                <p><role refersTo="#secretary">the Secretary</role> of the Department; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-23__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>an SES employee or acting SES employee in the Department.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-7__sec-23__subsec-2">
            <num>2</num>

              <p>In exercising a delegation, the delegate must comply with any directions of <role refersTo="#minister">the Minister</role>.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-7__sec-24">

          <heading>Immunity from State and Territory regulatory laws</heading>
          <subsection eId="part-7__sec-24__subsec-1">
            <num>1</num>
            <content>
              <p>A State regulatory law does not apply, and is taken never to have applied, in relation to any protected activity that occurred before the commencement of this Act.</p>
            </content>
          </subsection>
          <subsection eId="part-7__sec-24__subsec-2">
            <num>2</num>
            <content>
              <p>Subsection (1) is not intended to imply anything about:</p>
            </content>
            <paragraph eId="part-7__sec-24__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>the application, in relation to a protected activity, of any law of a State or Territory (other than a State regulatory law); or</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-24__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>the application of any law of a State or Territory in relation to an activity other than a protected activity.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-7__sec-24__subsec-3">
            <num>3</num>
            <content>
              <p>A State regulatory law does not apply to a site or telecommunications facility that:</p>
            </content>
            <paragraph eId="part-7__sec-24__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>is owned by the Commonwealth, an NTC or a declared successor; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-24__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>was used at any time before the commencement of this Act in connection with a protected activity.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-7__sec-24__subsec-4">

              <p>A rule of the common law relating to trespass does not apply to a site or telecommunications facility that:</p>
            </content>
            <paragraph eId="part-7__sec-24__subsec-4__para-a">
              <num>a</num>
              <content>
                <p>is owned by the Commonwealth, an NTC or a declared successor; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-24__subsec-4__para-b">
              <num>b</num>
              <content>
                <p>was used at any time before the commencement of this Act in connection with a protected activity.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-7__sec-24__subsec-5">
            <num>5</num>
            <content>
              <p>Subsections (3) and (4) do not apply to a building, structure or other telecommunications facility that commenced to be constructed after the commencement of this Act.</p>
            </content>
          </subsection>
          <subsection eId="part-7__sec-24__subsec-6">
            <num>6</num>
            <content>
              <p>In this section:</p>
            </content>
            <content>
              <p><b><i>activity</i></b> includes an act.</p>
              <p><b><i>law</i></b> includes:</p>
            </content>
            <paragraph eId="part-7__sec-24__subsec-6__para-a">
              <num>a</num>
              <content>
                <p>a provision of a law;</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-24__subsec-6__para-b">
              <num>b</num>

                <p>subordinate legislation or a provision of subordinate legislation.</p>
              </content>
              <content>
                <p><b><i>protected activity </i></b>means an activity carried out:</p>
              </content>
            </paragraph>

              <content>
                <p>by the Commonwealth; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-24__subsec-6__para-b">

                <p><b><i>State regulatory law</i></b> means a law of a State or Territory that relates to any of the following matters:</p>

            </paragraph>

                <p>conducting a particular kind of operation.</p>

            </paragraph>
          </subsection>
        </section>

          <heading>Lands Acquisition Act does not apply</heading>

            <p>		The <i>Lands Acquisition Act 1989</i> does not apply in relation to anything done under this Act.</p>

          <heading>Compensation for acquisition of property</heading>
          <subsection eId="part-7__sec-28__subsec-1">
            <num>1</num>
            <content>
              <p>If:</p>
            </content>

              <content>
                <p>apart from this section, the operation of this Act would result in the acquisition of property from a person otherwise than on just terms; and</p>

            </paragraph>

                <p>the acquisition would be invalid because of paragraph 51(xxxi) of the Constitution;</p>
