          <heading>Short title</heading>
          <content>
            <p>		This Act may be cited as the <i>Australian Radiation Protection and Nuclear Safety Act 1998</i>.</p>
          </content>
        </section>
        <section eId="part-1__sec-2">
          <num>2</num>
          <heading>Commencement</heading>
          <subsection eId="part-1__sec-2__subsec-1">
            <num>1</num>
            <content>
              <p>Subject to subsection (2), this Act commences on a day to be fixed by Proclamation.</p>
            </content>
          </subsection>
          <subsection eId="part-1__sec-2__subsec-2">
            <num>2</num>
            <content>
              <p>If this Act does not commence under subsection (1) <quantity refersTo="#deadline">within 6 months</quantity> after the day on which this Act receives the Royal Assent, it commences on the first day after the end of that period.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-1__sec-3">
          <num>3</num>
          <heading>Object of Act</heading>
          <content>
            <p>The object of this Act is to protect the health and safety of people, and to protect the environment, from the harmful effects of radiation.</p>
          </content>
        </section>
        <section eId="part-1__sec-4">
          <num>4</num>
          <heading>Act binds the Crown</heading>
          <subsection eId="part-1__sec-4__subsec-1">
            <num>1</num>
            <content>
              <p>This Act binds the Crown in each of its capacities.</p>
            </content>
          </subsection>
          <subsection eId="part-1__sec-4__subsec-2">
            <num>2</num>
            <content>
              <p>Nothing in this Act renders the Crown liable to be prosecuted for an offence.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-1__sec-5">
          <num>5</num>
          <heading>External Territories</heading>
          <content>
            <p>This Act extends to every external Territory.</p>
          </content>
        </section>
        <section eId="part-1__sec-6">
          <num>6</num>
          <heading>Extraterritorial operation</heading>
          <content>
            <p>This Act applies within and outside Australia.</p>
          </content>
        </section>
        <section eId="part-1__sec-7">
          <num>7</num>
          <heading>Act not to prejudice Australia’s defence</heading>
          <subsection eId="part-1__sec-7__subsec-1">
            <num>1</num>
            <content>
              <p>Nothing in this Act requires or permits a person to take any action, or to refrain from taking any action, if taking the action or refraining from taking the action would be, or could reasonably be expected to be, prejudicial to Australia’s defence.</p>
            </content>
          </subsection>
          <subsection eId="part-1__sec-7__subsec-2">
            <num>2</num>
            <content>
              <p>Without limiting subsection (1), the Chief of the Defence Force may, after consulting with <role refersTo="#minister">the Minister</role>, by legislative instrument, declare that:</p>
            </content>
            <paragraph eId="part-1__sec-7__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>specified provisions of this Act or the regulations do not apply in relation to specified members of the Defence Force; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-7__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>specified provisions of this Act or the regulations apply subject to such modifications as are set out in the declaration in relation to specified members of the Defence Force.</p>
              </content>
              <content>
                <p>The declaration has effect accordingly.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-1__sec-7__subsec-3">
            <num>3</num>
            <content>
              <p>In making a declaration under subsection (2), the Chief of the Defence Force must take into account the need to promote the object of this Act to the greatest extent consistent with the maintenance of Australia’s defence.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-1__sec-8">
          <num>8</num>
          <heading>Act not to prejudice national security</heading>
          <subsection eId="part-1__sec-8__subsec-1">
            <num>1</num>
            <content>
              <p>Nothing in this Act requires or permits a person to take any action, or to refrain from taking any action, if taking the action or refraining from taking the action would be, or could reasonably be expected to be, prejudicial to Australia’s national security.</p>
            </content>
          </subsection>
          <subsection eId="part-1__sec-8__subsec-2">
            <num>2</num>
            <content>
              <p>Without limiting subsection (1), the Director-General of Security may, after consulting with <role refersTo="#minister">the Minister</role>, by legislative instrument, declare that specified provisions of this Act or the regulations do not apply, or apply subject to such modifications as are set out in the declaration, in relation to:</p>
            </content>
            <paragraph eId="part-1__sec-8__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>premises or a workplace under the control of the Director-General; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-8__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>	(b)	a person who is employed under <i>Australian Security Intelligence Organisation Act 1979</i>; or<ref href="#sec-84">section 84</ref> of the </p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-8__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>the performance of work by such a person for the purpose of carrying out a function set out in <ref href="#sec-17">section 17</ref> of that Act.</p>
              </content>
              <content>
                <p>The declaration has effect accordingly.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-1__sec-8__subsec-3">
            <num>3</num>
            <content>
              <p>In making a declaration under subsection (2), the Director-General must take into account the need to promote the object of this Act to the greatest extent consistent with the maintenance of Australia’s national security.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-1__sec-9">
          <num>9</num>
          <heading>Operation of Act</heading>
          <subsection eId="part-1__sec-9__subsec-1">
            <num>1</num>
            <content>
              <p>	(1)	It is the intention of the Parliament that this Act is not to exclude the operation of the <i>Nuclear Non</i><i>-</i><i>Proliferation (Safeguards) Act 1987</i>, to the extent that the <i>Nuclear Non</i><i>-</i><i>Proliferation (Safeguards) Act 1987</i> is capable of operating concurrently with this Act.</p>

                <p>Example:	A controlled person may be required by this Act to hold a licence, and by the <i>Nuclear Non</i><i>-</i><i>Proliferation (Safeguards) Act 1987</i> to hold a permit, in respect of the same thing. The controlled person must satisfy the requirements of both Acts in so far as they are capable of being satisfied concurrently.</p>

            <num>2</num>
            <content>
              <p>	(2)	The application of this Act in relation to nuclear material and associated items within the meaning of the <i>Nuclear Non</i><i>-</i><i>Proliferation (Safeguards) Act 1987</i> is subject to any modifications that are prescribed by the regulations.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-1__sec-10">
          <num>10</num>
          <heading>Prohibition on certain nuclear installations</heading>
          <subsection eId="part-1__sec-10__subsec-1">
            <num>1</num>
            <content>
              <p>Nothing in this Act is to be taken to authorise the construction or operation of any of the following nuclear installations:</p>

                <p>a reprocessing facility.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-1__sec-10__subsec-1A">
            <num>1A</num>
            <content>
              <p>Paragraph (1)(b) does not apply to a naval nuclear propulsion plant related to use in a conventionally-armed, nuclear-powered submarine.</p>
            </content>
          </subsection>
          <subsection eId="part-1__sec-10__subsec-2">
            <num>2</num>
            <content>
              <p><role refersTo="#ceo">The CEO</role> must not issue a licence under section 32 in respect of any of the facilities to which subsection (1) applies.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-1__sec-11">
          <num>11</num>
          <heading>Application of Act to Commonwealth contractors</heading>
          <subsection eId="part-1__sec-11__subsec-1">
            <num>1</num>
            <content>
              <p>This Act applies to a Commonwealth contractor, in respect of conduct referred to in subsection 30(1) that is engaged in by the Commonwealth contractor, only if, and in so far as, the conduct is engaged in:</p>
            </content>
            <paragraph eId="part-1__sec-11__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>for or on behalf of a Commonwealth entity; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-11__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>under or for the purposes of a contract with the Commonwealth entity.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-1__sec-11__subsec-2">
            <num>2</num>
            <content>
              <p>This Act applies to a Commonwealth contractor, in respect of a dealing by the Commonwealth contractor with controlled material or controlled apparatus, only if, and in so far as:</p>
            </content>
            <paragraph eId="part-1__sec-11__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>the dealing is for or on behalf of a Commonwealth entity; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-11__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>the dealing is under or for the purposes of a contract with the Commonwealth entity; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-11__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>the controlled material or controlled apparatus is owned or controlled by the Commonwealth entity.</p>
              </content>

                  <p>Example:	A private airline company leases premises on land owned by the Commonwealth, and deals with controlled material on behalf of a client that is not a Commonwealth entity. The airline company is not covered by the Act in respect of that dealing.</p>

          </subsection>
          <subsection eId="part-1__sec-11__subsec-3">
            <num>3</num>
            <content>
              <p>If conduct of, or a dealing by, a person in the person’s capacity as a Commonwealth contractor is not covered by subsection (1) or (2), then:</p>
            </content>
            <paragraph eId="part-1__sec-11__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>that does not prevent this Act from applying in respect of the conduct or dealing in the person’s capacity as a permitted person under <ref href="#sec-11A">section 11A</ref>; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-11__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>in applying that section to the conduct or dealing, the person is not to be taken to be a controlled person (and therefore excluded from the scope of that section) merely because the person is a Commonwealth contractor.</p>
              </content>
            </paragraph>
          </subsection>
        </section>
        <section eId="part-1__sec-11A">
          <num>11A</num>
          <heading>Application of Act to permitted persons</heading>
          <subsection eId="part-1__sec-11A__subsec-1">
            <num>1</num>
            <content>
              <p>	(1)	A <b><i>permitted person</i></b>, in relation to a licence, is a person (other than a controlled person) who is permitted, under an arrangement with the licence holder, to do any of the following things that the licence authorises the licence holder to do:</p>
            </content>
            <paragraph eId="part-1__sec-11A__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>undertake an activity referred to in subsection 30(1) in relation to a controlled facility that is owned or controlled by the licence holder;</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-11A__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>deal with a controlled material or controlled apparatus that is owned or controlled by the licence holder.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-1__sec-11A__subsec-2">
            <num>2</num>
            <content>
              <p>This Act applies to the permitted person only in respect of the activity or dealing to which the arrangement applies.</p>
            </content>
            <content>
              <p>Severability</p>
            </content>
          </subsection>
          <subsection eId="part-1__sec-11A__subsec-3">
            <num>3</num>
            <content>
              <p>Without limiting its effect apart from this section, this Act also has the effect it would have if paragraphs (1)(a) and (b) of this section were expressly limited to an activity or a dealing:</p>
            </content>
            <paragraph eId="part-1__sec-11A__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>that is for the purposes of the licence holder; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-11A__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>that is undertaken or done:</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-11A__subsec-3__para-i">
              <num>i</num>
              <content>
                <p>in a Territory; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-11A__subsec-3__para-ii">
              <num>ii</num>
              <content>
                <p>	(ii)	in a Commonwealth place (within the meaning of the <i>Commonwealth Places (Application of Laws) Act 1970)</i>.</p>
              </content>
            </paragraph>
          </subsection>

          <heading>Offences</heading>
          <content>
            <p>		Chapter 2 of the <i>Criminal Code</i> applies to all offences against this Act. </p>

            <p>In this Act, unless the contrary intention appears:</p>
            <p><term refersTo="#term-annual-charge">annual charge</term> means <def>charge imposed by the Licence Charges Act.</def></p>
            <p><term refersTo="#term-ceo-or-chief-executive-officer">CEO or Chief Executive Officer</term> means <def>the CEO referred to in <ref href="#sec-14">section 14</ref>.</def></p>
            <p><term refersTo="#term-commonwealth-contractor">Commonwealth contractor</term> means <def>a person (other than a Commonwealth entity) who is a party to a contract with a Commonwealth entity.</def></p>
            <p><term refersTo="#term-commonwealth-entity">Commonwealth entity</term> means <def>any of the following:</def></p>

          <paragraph eId="part-2__sec-13__para-c">
            <num>c</num>
            <content>
              <p>a company in which a controlling interest is held by any one of the following persons, or by 2 or more of the following persons together:</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-13__para-i">
            <num>i</num>
            <content>
              <p>the Commonwealth;</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-13__para-ii">
            <num>ii</num>
            <content>
              <p>a body covered by paragraph (b);</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-13__para-d">
            <num>d</num>
            <content>
              <p>an employee of a person or body covered by any of the above paragraphs.</p>
            </content>
            <content>
              <p><term refersTo="#term-controlled-apparatus">controlled apparatus</term> means <def>any of the following: an apparatus that produces ionizing radiation when energised or that would, if assembled or repaired, be capable of producing ionizing radiation when energised; an apparatus that produces ionizing radiation because it contains radioactive material; an apparatus prescribed by the regulations that produces harmful non-ionizing radiation when energised.</def></p>

          </paragraph>
          <paragraph eId="part-2__sec-13__para-a">
            <num>a</num>
            <content>
              <p>an apparatus that produces ionizing radiation when energised or that would, if assembled or repaired, be capable of producing ionizing radiation when energised;</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-13__para-b">
            <num>b</num>
            <content>
              <p>an apparatus that produces ionizing radiation because it contains radioactive material;</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-13__para-c">
            <num>c</num>
            <content>
              <p>an apparatus prescribed by the regulations that produces harmful non-ionizing radiation when energised.</p>
            </content>
            <content>
              <p><b><i>controlled facility</i></b> means:</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-13__para-a">
            <num>a</num>
            <content>
              <p>a nuclear installation; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-13__para-b">
            <num>b</num>
            <content>
              <p>a prescribed radiation facility; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-13__para-c">
            <num>c</num>
            <content>
              <p>a prescribed legacy site.</p>
            </content>
            <content>
              <p><term refersTo="#term-controlled-material">controlled material</term> means <def>any natural or artificial material, whether in solid or liquid form, or in the form of a gas or vapour, which emits ionizing radiation spontaneously.</def></p>
              <p><term refersTo="#term-controlled-person">controlled person</term> means <def>any of the following: a Commonwealth entity; a Commonwealth contractor; a person in the capacity of an employee of a Commonwealth contractor; a person in a prescribed Commonwealth place.</def></p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-13__para-a">
            <num>a</num>
            <content>
              <p>a Commonwealth entity;</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-13__para-b">
            <num>b</num>
            <content>
              <p>a Commonwealth contractor;</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-13__para-c">
            <num>c</num>
            <content>
              <p>a person in the capacity of an employee of a Commonwealth contractor;</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-13__para-d">
            <num>d</num>
            <content>
              <p>a person in a prescribed Commonwealth place.</p>
            </content>
            <content>
              <p><term refersTo="#term-council">Council</term> means <def>the Radiation Health and Safety Advisory Council established by <ref href="#sec-19">section 19</ref>.</def></p>
              <p><term refersTo="#term-csc-short-for-commonwealth-superannuation-corporation">CSC (short for Commonwealth Superannuation Corporation)</term> has the same meaning as <def>in <ref href="">the Governance of Australian Government Superannuation Schemes Act 2011</ref>.</def></p>
              <p><b><i>deal with</i></b>, in relation to a controlled apparatus or controlled material, means any of the following:</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-13__para-a">
            <num>a</num>
            <content>
              <p>possess, or have control of, the apparatus or material;</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-13__para-b">
            <num>b</num>
            <content>
              <p>use or operate the apparatus, or use the material;</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-13__para-c">
            <num>c</num>
            <content>
              <p>dispose of the apparatus or material.</p>
            </content>
            <content>
              <p><term refersTo="#term-evidential-material">evidential material</term> means <def>any of the following: any thing with respect to which an offence against this Act or the regulations has been committed or is suspected, on reasonable grounds, to have been committed; any thing as to which there are reasonable grounds for suspecting that it will afford evidence as to the commission of any such offence; any thing as to which there are reasonable grounds for suspecting that it is intended to be used for the purpose of committing any such offence.</def></p>

          </paragraph>
          <paragraph eId="part-2__sec-13__para-a">
            <num>a</num>
            <content>
              <p>any thing with respect to which an offence against this Act or the regulations has been committed or is suspected, on reasonable grounds, to have been committed;</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-13__para-b">
            <num>b</num>
            <content>
              <p>any thing as to which there are reasonable grounds for suspecting that it will afford evidence as to the commission of any such offence;</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-13__para-c">
            <num>c</num>
            <content>
              <p>any thing as to which there are reasonable grounds for suspecting that it is intended to be used for the purpose of committing any such offence.</p>
            </content>
            <content>
              <p><term refersTo="#term-facility-licence">facility licence</term> means <def>a licence issued under <ref href="#sec-32">section 32</ref>.</def></p>
              <p><term refersTo="#term-finance-minister">Finance Minister</term> means <def>the Minister administering the Public Governance, Performance and Accountability Act 2013.</def></p>
              <p><b><i>improvement notice</i></b>: see subsection 80A(2).</p>
              <p><term refersTo="#term-inspector">inspector</term> means <def>a person appointed as an inspector under <ref href="#sec-62">section 62</ref>.</def></p>
              <p><term refersTo="#term-ionizing-radiation">ionizing radiation</term> means <def>electromagnetic or particulate radiation capable of producing ions directly or indirectly, but does not include electromagnetic radiation of a wavelength greater than 100 nanometres.</def></p>
              <p><term refersTo="#term-licence">licence</term> means <def>a source licence or a facility licence.</def></p>
              <p><term refersTo="#term-licence-charges-act">Licence Charges Act</term> means <def>the Australian Radiation Protection and Nuclear Safety (Licence Charges) Act 1998.</def></p>
              <p><term refersTo="#term-modifications">modifications</term> includes <def>omissions, additions and substitutions.</def></p>
              <p><term refersTo="#term-non-ionizing-radiation">non-ionizing radiation</term> means <def>electromagnetic radiation of a wavelength greater than 100 nanometres.</def></p>
              <p><term refersTo="#term-nuclear-installation">nuclear installation</term> means <def>any of the following: a nuclear reactor for research or production of radioactive materials for industrial or medical use (including critical and sub-critical assemblies); a plant for preparing or storing fuel for use in a nuclear reactor as described in paragraph (a); a radioactive waste storage or disposal facility with an activity that is greater than the activity level prescribed by regulations made for the purposes of this section; a facility for production of radioisotopes with an activity that is greater than the activity level prescribed by regulations made for the purposes of this section; a plant for storing spent fuel that has been used in a nuclear reactor as described in paragraph (a).</def></p>

              <p>a nuclear reactor for research or production of radioactive materials for industrial or medical use (including critical and sub-critical assemblies);</p>

            <num>b</num>
            <content>
              <p>a plant for preparing or storing fuel for use in a nuclear reactor as described in paragraph (a);</p>

          </paragraph>

              <p>a radioactive waste storage or disposal facility with an activity that is greater than the activity level prescribed by regulations made for the purposes of this section;</p>

              <p>a facility for production of radioisotopes with an activity that is greater than the activity level prescribed by regulations made for the purposes of this section;</p>
            </content>
          </paragraph>

            <content>
              <p>a plant for storing spent fuel that has been used in a nuclear reactor as described in paragraph (a).</p>
            </content>
            <content>
              <p><term refersTo="#term-occupier">occupier</term> includes <def>a person present at the premises who is in apparent control of the premises.</def></p>
              <p><b><i>permitted person</i></b>: see section 11A.</p>
              <p><b><i>person covered by a licence</i></b> means:</p>
            </content>

              <p>a permitted person in relation to the licence.</p>
            </content>
            <content>
              <p><term refersTo="#term-premises">premises</term> includes <def>the following: a structure, building, aircraft, vehicle or vessel; a place (whether enclosed or built on or not); a part of a thing referred to in paragraph (a) or (b).</def></p>

          </paragraph>

            <num>a</num>
            <content>
              <p>a structure, building, aircraft, vehicle or vessel;</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-13__para-b">

            <content>
              <p>a place (whether enclosed or built on or not);</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-13__para-c">

              <p>a part of a thing referred to in paragraph (a) or (b).</p>

              <p><term refersTo="#term-prescribed-commonwealth-place">prescribed Commonwealth place</term> means <def>a place that is referred to in paragraph 52(i) of the Constitution and is prescribed by the regulations for the purposes of this definition.</def></p>
              <p><term refersTo="#term-prescribed-legacy-site">prescribed legacy site</term> means <def>a place (whether enclosed or built on or not) that is prescribed by the regulations for the purposes of this definition.</def></p>
              <p><term refersTo="#term-prescribed-radiation-facility">prescribed radiation facility</term> means <def>a facility or installation that is prescribed by the regulations for the purposes of this definition.</def></p>
              <p><term refersTo="#term-radiation">radiation</term> means <def>ionizing radiation or non-ionizing radiation.</def></p>
              <p><term refersTo="#term-radiation-control-officer">radiation control officer</term> means <def>a person who: holds a senior position in a regulatory body of a State or Territory; and is responsible for matters relating to radiation protection or nuclear safety.</def></p>

          </paragraph>
          <paragraph eId="part-2__sec-13__para-a">
            <num>a</num>
            <content>
              <p>holds a senior position in a regulatory body of a State or Territory; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-13__para-b">
            <num>b</num>
            <content>
              <p>is responsible for matters relating to radiation protection or nuclear safety.</p>
            </content>
            <content>
              <p><term refersTo="#term-remediate">remediate</term> means <def>to apply measures to the site to reduce the exposure of people or the environment to radiation from contamination of the site with radioactive material.</def></p>
              <p><term refersTo="#term-seize">seize</term> includes <def>secure against interference.</def></p>
              <p><term refersTo="#term-source-licence">source licence</term> means <def>a licence issued under <ref href="#sec-33">section 33</ref>.</def></p>
              <p><term refersTo="#term-thing">thing</term> includes <def>a substance, and a thing in electronic or magnetic form.</def></p>

          <heading>Application of the finance law</heading>

            <p>		For the purposes of the finance law (within the meaning of the <i>Public Governance, Performance and Accountability Act 2013</i>):</p>

              <p>ARPANSA is a listed entity; and</p>
            </content>

                <p>to promote uniformity of radiation protection and nuclear safety policy and practices across jurisdictions of the Commonwealth, the States and the Territories;</p>

                <p>to provide advice on radiation protection, nuclear safety and related issues;</p>

                <p>such other functions as are conferred by this Act, the regulations or any other law.</p>

              <p><role refersTo="#ceo">The CEO</role> must take all reasonable steps to avoid any conflict of interest between <role refersTo="#ceo">the CEO</role>’s regulatory functions and <role refersTo="#ceo">the CEO</role>’s other functions.</p>

        </section>

          <heading>Minister’s directions to CEO</heading>
          <subsection eId="part-3__sec-16__subsec-1">
            <num>1</num>
            <content>
              <p>If <role refersTo="#minister">the Minister</role> is satisfied that it is in the public interest to do so, <role refersTo="#minister">the Minister</role> must, by notice in writing, give directions to <role refersTo="#ceo">the CEO</role> with respect to the performance of <role refersTo="#ceo">the CEO</role>’s functions or the exercise of <role refersTo="#ceo">the CEO</role>’s powers.</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-16__subsec-2">
            <num>2</num>
            <content>
              <p><role refersTo="#ceo">The CEO</role> must comply with the directions.</p>
            </content>
          </subsection>

              <p>Within 15 sitting days of issuing a notice to <role refersTo="#ceo">the CEO</role> under this section, <role refersTo="#minister">the Minister</role> must cause a copy of the notice to be tabled in each House of the Parliament.</p>

          <heading>Delegation by Minister</heading>
          <subsection eId="part-3__sec-17__subsec-1">

              <p><role refersTo="#minister">The Minister</role> may, by instrument in writing, delegate <role refersTo="#minister">the Minister</role>’s powers under section 7, 8 or 44 to <role refersTo="#ceo">the CEO</role>.</p>

              <p><role refersTo="#minister">The Minister</role> may, by instrument in writing, delegate <role refersTo="#minister">the Minister</role>’s powers under section 40 to any of the following:</p>

            <p>The Council has the following functions:</p>

              <p>to identify emerging issues relating to radiation protection and nuclear safety and to advise <role refersTo="#ceo">the CEO</role> on them;</p>

            <content>
              <p>to examine matters of major concern to the community in relation to radiation protection and nuclear safety and to advise <role refersTo="#ceo">the CEO</role> on them;</p>

            <num>c</num>
            <content>
              <p>to advise <role refersTo="#ceo">the CEO</role> on the adoption of recommendations, policies, codes and standards in relation to radiation protection and nuclear safety;</p>

            <num>d</num>
            <content>

                <p>from time to time, to review national policies, codes and standards in relation to radiation protection to ensure that they continue to substantially reflect world best practice;</p>

                <p>to consult publicly in the development and review of policies, codes and standards in relation to radiation protection.</p>

          <heading>Remuneration</heading>
          <subsection eId="part-4__sec-28__subsec-1">

              <p>A member of the Council, the Radiation Health Committee or the Nuclear Safety Committee is to be paid the remuneration that is determined by the Remuneration Tribunal. If no determination of that remuneration by the Tribunal is in operation, the member is to be paid the remuneration that is prescribed.</p>

          </subsection>

            <num>2</num>
            <content>
              <p>A member referred to in subsection (1) is to be paid the allowances that are prescribed.</p>
            </content>
          </subsection>

              <p>	(3)	This section has effect subject to the <i>Remuneration Tribunal Act 1973</i>.</p>

                <p>A controlled person must not deal with a controlled material or controlled apparatus unless:</p>

                  <p>the dealing is authorised by a source licence; or</p>
                </content>
              </paragraph>

                  <p>the dealing is authorised by a facility licence; or</p>
                </content>
              </paragraph>

                  <p>the dealing is prescribed by the regulations as an exempt dealing for the purposes of this section.</p>

                <p><role refersTo="#ceo">The CEO</role> may issue a licence to a controlled person that authorises persons to do some or all of the things referred to in subsection 30(1).</p>

                <p>A licence under subsection (1):</p>
              </content>

              <paragraph eId="part-5__dvs-2__sec-32__subsec-1A__para-b">

                  <p>may also authorise persons to deal with a controlled apparatus or a controlled material.</p>
                </content>
              </paragraph>
            </subsection>

                <p>A licence issued to the Commonwealth may be issued in the name of a Department of State.</p>
              </content>
            </subsection>
            <subsection eId="part-5__dvs-2__sec-32__subsec-3">

                <p>In deciding whether to issue a licence under subsection (1), <role refersTo="#ceo">the CEO</role> must take into account the matters (if any) specified in the regulations, and must also take into account international best practice in relation to radiation protection and nuclear safety.</p>

            </subsection>
          </section>

            <num>33</num>
            <heading>Issue of source licence</heading>

            <heading>Application fees</heading>
            <content>
              <p>An application for a licence must:</p>
            </content>
            <paragraph eId="part-5__dvs-2__sec-34__para-a">
              <num>a</num>
              <content>
                <p>be in a form approved by <role refersTo="#ceo">the CEO</role>; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__dvs-2__sec-34__para-b">
              <num>b</num>
              <content>
                <p>be accompanied by such fee as is prescribed by the regulations.</p>
              </content>
            </paragraph>
          </section>
          <section eId="part-5__dvs-2__sec-35">
            <num>35</num>
            <heading>Licence conditions</heading>
            <subsection eId="part-5__dvs-2__sec-35__subsec-1">
              <num>1</num>
              <content>
                <p>A licence is subject to the following conditions:</p>
              </content>
              <paragraph eId="part-5__dvs-2__sec-35__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>the conditions set out in this section;</p>
                </content>
              </paragraph>
              <paragraph eId="part-5__dvs-2__sec-35__subsec-1__para-aa">
                <num>aa</num>
                <content>
                  <p>the condition set out in subsection 80B(1);</p>
                </content>
              </paragraph>
              <paragraph eId="part-5__dvs-2__sec-35__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>the conditions prescribed by the regulations;</p>
                </content>
              </paragraph>
              <paragraph eId="part-5__dvs-2__sec-35__subsec-1__para-c">
                <num>c</num>
                <content>
                  <p>conditions imposed by <role refersTo="#ceo">the CEO</role> at the time of issuing the licence;</p>
                </content>
              </paragraph>
              <paragraph eId="part-5__dvs-2__sec-35__subsec-1__para-d">
                <num>d</num>
                <content>
                  <p>any conditions imposed by <role refersTo="#ceo">the CEO</role> under subsection 36(2) after the licence is issued.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-5__dvs-2__sec-35__subsec-2">
              <num>2</num>
              <content>
                <p>Licence conditions may include conditions that are specific to particular apparatus or material, including apparatus or material that may, at a time after the licence is issued, come into the possession or control of persons covered by the licence.</p>
              </content>
            </subsection>
            <subsection eId="part-5__dvs-2__sec-35__subsec-3">
              <num>3</num>
              <content>
                <p>A facility licence is subject to the condition that any person authorised by the licence to prepare a site for a controlled facility or to construct, have possession or control of, operate, de-commission, dispose of, abandon or remediate a controlled facility must:</p>
              </content>
              <paragraph eId="part-5__dvs-2__sec-35__subsec-3__para-a">
                <num>a</num>
                <content>
                  <p>at any time when the person has possession or control of such a site or facility—allow <role refersTo="#ceo">the CEO</role>, or a person authorised by <role refersTo="#ceo">the CEO</role>, to enter and inspect the site or facility at reasonable times; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-5__dvs-2__sec-35__subsec-3__para-b">
                <num>b</num>
                <content>
                  <p>comply with any requirements specified in the regulations in relation to such an inspection.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-5__dvs-2__sec-35__subsec-4">
              <num>4</num>
              <content>
                <p>A licence is subject to the condition that any person authorised by the licence to deal with a controlled apparatus or controlled material must:</p>
              </content>
              <paragraph eId="part-5__dvs-2__sec-35__subsec-4__para-a">
                <num>a</num>
                <content>
                  <p>at any time when the person has possession or control of such apparatus or material—allow <role refersTo="#ceo">the CEO</role>, or a person authorised by <role refersTo="#ceo">the CEO</role>, to inspect the apparatus or material at reasonable times; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-5__dvs-2__sec-35__subsec-4__para-b">
                <num>b</num>
                <content>
                  <p>comply with any requirements specified in the regulations in relation to such an inspection.</p>
                </content>
              </paragraph>
            </subsection>
          </section>
          <section eId="part-5__dvs-2__sec-36">
            <num>36</num>
            <heading>Amendment of licence</heading>
            <subsection eId="part-5__dvs-2__sec-36__subsec-1">
              <num>1</num>
              <content>
                <p><role refersTo="#ceo">The CEO</role> may, at any time, by notice in writing given to the licence holder, amend a licence.</p>
              </content>
            </subsection>
            <subsection eId="part-5__dvs-2__sec-36__subsec-2">
              <num>2</num>
              <content>
                <p>Without limiting subsection (1), <role refersTo="#ceo">the CEO</role> may:</p>
              </content>
              <paragraph eId="part-5__dvs-2__sec-36__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>impose additional licence conditions; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-5__dvs-2__sec-36__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>remove or vary licence conditions that were imposed by <role refersTo="#ceo">the CEO</role>; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-5__dvs-2__sec-36__subsec-2__para-c">
                <num>c</num>
                <content>
                  <p>extend or reduce <role refersTo="#authority">the authority</role> granted by the licence; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-5__dvs-2__sec-36__subsec-2__para-d">
                <num>d</num>
                <content>
                  <p>if the licence was issued for a specified period—extend that period.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-5__dvs-2__sec-36__subsec-3">
              <num>3</num>
              <content>
                <p>If the conditions are specific to particular material, or to particular apparatus, the notice under subsection (1) must be given to the licence holder who, according to <role refersTo="#ceo">the CEO</role>’s records, has possession or control of the material or apparatus at the time the condition is imposed, removed or varied.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-5__dvs-2__sec-37">
            <num>37</num>
            <heading>Period of licence</heading>
            <subsection eId="part-5__dvs-2__sec-37__subsec-1">
              <num>1</num>
              <content>
                <p>A licence may be issued:</p>
              </content>
              <paragraph eId="part-5__dvs-2__sec-37__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>for an indefinite period; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-5__dvs-2__sec-37__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>for a period specified in the licence.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-5__dvs-2__sec-37__subsec-2">
              <num>2</num>
              <content>
                <p>A licence continues in force until:</p>
              </content>
              <paragraph eId="part-5__dvs-2__sec-37__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>it is cancelled or surrendered; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-5__dvs-2__sec-37__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>if the licence was issued for a specified period—the end of that period (or that period as extended under paragraph 36(2)(d)), unless earlier cancelled or surrendered.</p>
                </content>
              </paragraph>
            </subsection>
          </section>
          <section eId="part-5__dvs-2__sec-38">
            <num>38</num>
            <heading>Cancellation and suspension of licence</heading>
            <subsection eId="part-5__dvs-2__sec-38__subsec-1">
              <num>1</num>
              <content>
                <p><role refersTo="#ceo">The CEO</role> may, by notice in writing given to the licence holder, suspend or cancel a licence if:</p>
              </content>
              <paragraph eId="part-5__dvs-2__sec-38__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>a condition of the licence has been breached, whether by the licence holder or by a person covered by the licence; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-5__dvs-2__sec-38__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p><role refersTo="#ceo">the CEO</role> believes on reasonable grounds that the licence holder, or a person covered by the licence, has committed an offence against this Act or the regulations; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-5__dvs-2__sec-38__subsec-1__para-c">
                <num>c</num>
                <content>
                  <p>any annual charge payable in respect of the licence remains unpaid after the due date; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-5__dvs-2__sec-38__subsec-1__para-d">
                <num>d</num>
                <content>
                  <p>the licence was obtained improperly.</p>
                </content>
              </paragraph>
            </subsection>
          </section>
          <section eId="part-5__dvs-2__sec-39">
            <num>39</num>
            <heading>Surrender of licence</heading>
            <content>
              <p>The holder of a licence may, with the consent of <role refersTo="#ceo">the CEO</role>, surrender the licence.</p>
            </content>
          </section>
          <section eId="part-5__dvs-2__sec-40">
            <num>40</num>
            <heading>Review of licence decisions</heading>
            <subsection eId="part-5__dvs-2__sec-40__subsec-1">
              <num>1</num>
              <content>
                <p>An eligible person in relation to a licence decision may request that <role refersTo="#minister">the Minister</role> reconsider the licence decision.</p>
              </content>
            </subsection>
            <subsection eId="part-5__dvs-2__sec-40__subsec-2">
              <num>2</num>
              <content>
                <p>The request must be:</p>
              </content>
              <paragraph eId="part-5__dvs-2__sec-40__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>in writing; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-5__dvs-2__sec-40__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>given to the Minister <quantity refersTo="#deadline">within 28 days</quantity> of the making of the licence decision.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-5__dvs-2__sec-40__subsec-3">
              <num>3</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> must reconsider the licence decision and confirm, vary or set aside the licence decision.</p>
              </content>

                  <p>Note:	Section 266 of the <i>Administrative Review Tribunal Act 2024</i> requires the person to be notified of the person’s review rights.</p>

            </subsection>

              <num>4</num>
              <content>
                <p>The Minister is taken to have confirmed the licence decision under subsection (3) if the Minister does not give written notice of the Minister’s decision under that subsection <quantity refersTo="#deadline">within 60 days</quantity> of the request.</p>
              </content>
            </subsection>
            <subsection eId="part-5__dvs-2__sec-40__subsec-5">
              <num>5</num>
              <content>
                <p>Applications may be made to the Administrative Review Tribunal for review of a decision of <role refersTo="#minister">the Minister</role> under subsection (3) to confirm, vary or set aside the licence decision.</p>
              </content>
            </subsection>
            <subsection eId="part-5__dvs-2__sec-40__subsec-6">
              <num>6</num>
              <content>
                <p>For the purposes of this section:</p>
              </content>
              <content>
                <p><b><i>licence decision </i></b>means any of the following decisions of the CEO:</p>
              </content>
              <paragraph eId="part-5__dvs-2__sec-40__subsec-6__para-a">
                <num>a</num>
                <content>
                  <p>to refuse to grant a licence;</p>
                </content>
              </paragraph>
              <paragraph eId="part-5__dvs-2__sec-40__subsec-6__para-b">
                <num>b</num>
                <content>
                  <p>to impose conditions on a licence;</p>
                </content>
              </paragraph>
              <paragraph eId="part-5__dvs-2__sec-40__subsec-6__para-c">
                <num>c</num>
                <content>
                  <p>to suspend a licence;</p>
                </content>
              </paragraph>
              <paragraph eId="part-5__dvs-2__sec-40__subsec-6__para-d">
                <num>d</num>
                <content>
                  <p>to cancel a licence;</p>
                </content>
              </paragraph>
              <paragraph eId="part-5__dvs-2__sec-40__subsec-6__para-e">
                <num>e</num>
                <content>
                  <p>to amend a licence;</p>
                </content>
              </paragraph>
              <paragraph eId="part-5__dvs-2__sec-40__subsec-6__para-f">
                <num>f</num>
                <content>
                  <p>not to approve the surrender of a licence;</p>
                </content>
              </paragraph>
              <paragraph eId="part-5__dvs-2__sec-40__subsec-6__para-g">
                <num>g</num>
                <content>
                  <p>to issue a licence for a particular period, rather than for a longer period or indefinitely;</p>
                </content>
              </paragraph>
              <paragraph eId="part-5__dvs-2__sec-40__subsec-6__para-h">
                <num>h</num>
                <content>
                  <p>not to extend the period for which a licence was issued.</p>
                </content>
                <content>
                  <p><b><i>eligible person</i></b>, in relation to a licence decision, means:</p>
                </content>
              </paragraph>
              <paragraph eId="part-5__dvs-2__sec-40__subsec-6__para-a">
                <num>a</num>
                <content>
                  <p>in relation to a decision to refuse to grant a licence—the person who applied for the licence; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-5__dvs-2__sec-40__subsec-6__para-b">
                <num>b</num>
                <content>
                  <p>in relation to any other licence decision—the licence holder.</p>
                </content>
              </paragraph>
            </subsection>
          </section>
        </division>

          <heading>Enforcement</heading>
          <section eId="part-5__dvs-3__sec-41">
            <num>41</num>
            <heading>CEO may give directions to controlled persons</heading>
            <content>
              <p>When this section applies</p>
            </content>
            <subsection eId="part-5__dvs-3__sec-41__subsec-1">
              <num>1</num>
              <content>
                <p>This section applies if:</p>
              </content>
              <paragraph eId="part-5__dvs-3__sec-41__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p><role refersTo="#ceo">the CEO</role> believes, on reasonable grounds, that a controlled person is not complying with the Act or regulations in respect of a thing; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-5__dvs-3__sec-41__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p><role refersTo="#ceo">the CEO</role> believes that it is necessary to exercise powers under this section in order to protect the health and safety of people or to avoid damage to the environment.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-5__dvs-3__sec-41__subsec-1A">
              <num>1A</num>
              <content>
                <p>This section also applies if:</p>
              </content>
              <paragraph eId="part-5__dvs-3__sec-41__subsec-1A__para-a">
                <num>a</num>
                <content>
                  <p><role refersTo="#ceo">the CEO</role> believes, on reasonable grounds, that there is a risk of death, serious illness, serious injury or serious damage to the environment, arising from radiation, in connection with a controlled facility, controlled material or controlled apparatus; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-5__dvs-3__sec-41__subsec-1A__para-b">
                <num>b</num>
                <content>
                  <p><role refersTo="#ceo">the CEO</role> believes that there is an urgent need to exercise powers under this section in order to minimise the risk.</p>
                </content>
                <content>
                  <p>Power to give directions, and consequences of a direction</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-5__dvs-3__sec-41__subsec-2">
              <num>2</num>
              <content>
                <p><role refersTo="#ceo">The CEO</role> may give written directions to a controlled person requiring the controlled person to take such steps as <role refersTo="#ceo">the CEO</role> considers appropriate:</p>
              </content>
              <paragraph eId="part-5__dvs-3__sec-41__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>if subsection (1) applies—in relation to the thing; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-5__dvs-3__sec-41__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>if subsection (1A) applies—in relation to the controlled facility, controlled material or controlled apparatus.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-5__dvs-3__sec-41__subsec-3">
              <num>3</num>
              <content>
                <p>The controlled person must take the steps specified in the notice within the time specified in the notice.</p>
              </content>
              <hcontainer name="penalty">
                <content>
                  <p>Penalty:	<quantity refersTo="#penaltyUnit">30 penalty units</quantity>.</p>
                </content>
              </hcontainer>
            </subsection>
            <subsection eId="part-5__dvs-3__sec-41__subsec-4">
              <num>4</num>
              <content>
                <p>As soon as possible after giving directions under subsection (2), <role refersTo="#ceo">the CEO</role> must provide a copy of the directions to <role refersTo="#minister">the Minister</role>.</p>
              </content>
            </subsection>
            <subsection eId="part-5__dvs-3__sec-41__subsec-5">
              <num>5</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> must cause a copy of the directions to be tabled in each House of the Parliament within 15 sitting days of that House after the directions have been given.</p>
              </content>
            </subsection>
            <subsection eId="part-5__dvs-3__sec-41__subsec-6">
              <num>6</num>
              <content>
                <p>If the person does not take the steps specified in the notice within the time specified in the notice, <role refersTo="#ceo">the CEO</role> may arrange for those steps to be taken.</p>
              </content>
            </subsection>
            <subsection eId="part-5__dvs-3__sec-41__subsec-7">
              <num>7</num>
              <content>
                <p>If the Commonwealth incurs costs because of arrangements made by <role refersTo="#ceo">the CEO</role> under subsection (6), the person is liable to pay to the Commonwealth an amount equal to the costs and the amount may be recovered by the Commonwealth as a debt due to the Commonwealth in a court of competent jurisdiction.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-5__dvs-3__sec-42">
            <num>42</num>
            <heading>Review of decisions to give directions</heading>
            <subsection eId="part-5__dvs-3__sec-42__subsec-1">
              <num>1</num>
              <content>
                <p>A controlled person to whom a direction is given under <role refersTo="#minister">the Minister</role> reconsider the decision to give the direction.<ref href="#sec-41">section 41</ref> may request that </p>
              </content>
            </subsection>

          </section>
          <section eId="part-5__dvs-3__sec-43">
            <num>43</num>
            <heading>Injunctions</heading>
            <subsection eId="part-5__dvs-3__sec-43__subsec-1">
              <num>1</num>
              <content>
                <p>	(1)	If a person has engaged, is engaging, or is proposing to engage in any conduct that is or would be an offence against this Act or the regulations, the Federal Court of Australia (the<b> </b><b><i>Court</i></b>) may, on the application of the CEO, grant an injunction restraining the person from engaging in the conduct.</p>
              </content>
            </subsection>
            <subsection eId="part-5__dvs-3__sec-43__subsec-2">
              <num>2</num>
              <content>
                <p>If:</p>
              </content>
              <paragraph eId="part-5__dvs-3__sec-43__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>a person has refused or failed, is refusing or failing, or is proposing to refuse or fail, to do a thing; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-5__dvs-3__sec-43__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>the refusal or failure is, or would be, an offence against this Act;</p>
                </content>
                <content>
                  <p>the Court may, on the application of <role refersTo="#ceo">the CEO</role>, grant an injunction requiring the person to do the thing.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-5__dvs-3__sec-43__subsec-3">
              <num>3</num>
              <content>
                <p>The power of the Court to grant an injunction may be exercised:</p>
              </content>
              <paragraph eId="part-5__dvs-3__sec-43__subsec-3__para-a">
                <num>a</num>
                <content>
                  <p>whether or not it appears to the Court that the person intends to engage, or to continue to engage, in conduct of that kind; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-5__dvs-3__sec-43__subsec-3__para-b">
                <num>b</num>
                <content>
                  <p>whether or not the person has previously engaged in conduct of that kind.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-5__dvs-3__sec-43__subsec-4">
              <num>4</num>
              <content>
                <p>The Court may discharge or vary an injunction granted under this section.</p>
              </content>
            </subsection>
            <subsection eId="part-5__dvs-3__sec-43__subsec-5">
              <num>5</num>
              <content>
                <p>The Court may grant an interim injunction pending the determination of an application under subsection (1).</p>
              </content>
            </subsection>
            <subsection eId="part-5__dvs-3__sec-43__subsec-6">
              <num>6</num>
              <content>
                <p>The powers granted by this section are in addition to, and not in derogation of, any other powers of the Court.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-5__dvs-3__sec-44">
            <num>44</num>
            <heading>Forfeiture</heading>
            <subsection eId="part-5__dvs-3__sec-44__subsec-1">
              <num>1</num>
              <content>
                <p>If a court:</p>
              </content>
              <paragraph eId="part-5__dvs-3__sec-44__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>convicts a person of an offence against this Act or the regulations; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-5__dvs-3__sec-44__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>	(b)	makes an order under <i>Crimes Act 1914</i> in respect of a person charged with an offence against this Act;<ref href="#sec-19B">section 19B</ref> of the </p>
                </content>
                <content>
                  <p>the court may order forfeiture to the Commonwealth of any substance or thing used or otherwise involved in the commission of the offence.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-5__dvs-3__sec-44__subsec-2">
              <num>2</num>
              <content>
                <p>A substance or thing ordered by a court to be forfeited under this section becomes the property of the Commonwealth and may be sold or otherwise dealt with in accordance with the directions of <role refersTo="#minister">the Minister</role>.</p>
              </content>
            </subsection>
            <subsection eId="part-5__dvs-3__sec-44__subsec-3">
              <num>3</num>
              <content>
                <p>Until <role refersTo="#minister">the Minister</role> gives a direction, the substance or thing must be kept in such custody as <role refersTo="#minister">the Minister</role> directs.</p>
              </content>
            </subsection>
          </section>
        </division>

          <num>4</num>
          <heading>Information-gathering</heading>
          <section eId="part-5__dvs-4__sec-44A">
            <num>44A</num>
            <heading>CEO may require controlled person to provide information, produce documents or appear before the CEO</heading>
            <subsection eId="part-5__dvs-4__sec-44A__subsec-1">
              <num>1</num>
              <content>
                <p>This section applies to a controlled person if <role refersTo="#ceo">the CEO</role> believes, on reasonable grounds, that the person has information or a document that is relevant for the purpose of finding out whether this Act, the regulations or the conditions of a licence have been complied with.</p>
              </content>
            </subsection>
            <subsection eId="part-5__dvs-4__sec-44A__subsec-2">
              <num>2</num>
              <content>
                <p><role refersTo="#ceo">The CEO</role> may, for that purpose, require the controlled person, by written notice given to the person, to:</p>
              </content>
              <paragraph eId="part-5__dvs-4__sec-44A__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>give information to <role refersTo="#ceo">the CEO</role>; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-5__dvs-4__sec-44A__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>produce to <role refersTo="#ceo">the CEO</role> documents in the person’s custody or control, or copies of such documents; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-5__dvs-4__sec-44A__subsec-2__para-c">
                <num>c</num>
                <content>
                  <p>answer questions specified in the notice; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-5__dvs-4__sec-44A__subsec-2__para-d">
                <num>d</num>
                <content>
                  <p>if the person is an individual—appear before <role refersTo="#ceo">the CEO</role> at a time and place specified in the notice to give information or answer questions, either orally or in writing, or produce to <role refersTo="#ceo">the CEO</role> documents in the person’s custody or control, or copies of such documents; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-5__dvs-4__sec-44A__subsec-2__para-e">
                <num>e</num>
                <content>
                  <p>if the person is a body corporate—cause a competent officer of the body to appear before <role refersTo="#ceo">the CEO</role> at a time and place specified in the notice to give information or answer questions, either orally or in writing, or produce to <role refersTo="#ceo">the CEO</role> documents in the person’s custody or control, or copies of such documents.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-5__dvs-4__sec-44A__subsec-3">
              <num>3</num>
              <content>
                <p>If the notice makes a requirement under paragraph (2)(a), (b) or (c), the controlled person must comply with the requirement:</p>
              </content>
              <paragraph eId="part-5__dvs-4__sec-44A__subsec-3__para-a">
                <num>a</num>
                <content>
                  <p><quantity refersTo="#deadline">within 28 days</quantity> after the notice is given (unless paragraph (b) applies); or</p>
                </content>
              </paragraph>
              <paragraph eId="part-5__dvs-4__sec-44A__subsec-3__para-b">
                <num>b</num>
                <content>
                  <p>if a shorter period is specified in the notice—within that shorter period.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-5__dvs-4__sec-44A__subsec-4">
              <num>4</num>
              <content>
                <p>If the notice makes a requirement under paragraph (2)(d) or (e), the time specified in the notice as mentioned in that paragraph may be any reasonable time after the notice is given.</p>
              </content>
            </subsection>
            <subsection eId="part-5__dvs-4__sec-44A__subsec-5">
              <num>5</num>
              <content>
                <p>If the controlled person is an individual, the individual is excused from giving information, answering a question or producing a document in accordance with the notice if the information, the answer or the production of the document might tend to incriminate the individual or to expose the individual to a penalty.</p>
              </content>
            </subsection>
            <subsection eId="part-5__dvs-4__sec-44A__subsec-6">
              <num>6</num>
              <content>
                <p>	(6)	The controlled person (the <b><i>recipient</i></b>) is excused from giving information, answering a question or producing a document in accordance with the notice if doing so would involve a contravention of an obligation under an international agreement:</p>
              </content>
              <paragraph eId="part-5__dvs-4__sec-44A__subsec-6__para-a">
                <num>a</num>
                <content>
                  <p>to which Australia, the recipient or another controlled person is a party; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-5__dvs-4__sec-44A__subsec-6__para-b">
                <num>b</num>
                <content>
                  <p>that relates specifically to:</p>
                </content>
              </paragraph>
              <paragraph eId="part-5__dvs-4__sec-44A__subsec-6__para-i">
                <num>i</num>
                <content>
                  <p>the recipient; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-5__dvs-4__sec-44A__subsec-6__para-ii">
                <num>ii</num>
                <content>
                  <p>if the recipient is an officer or an employee of a controlled person—that controlled person.</p>

                <p>the controlled person is given a notice under <ref href="#sec-44A">section 44A</ref>; and</p>

            </paragraph>

                <p>the controlled person fails to comply with the notice.</p>
              </content>

                <p><role refersTo="#ceo">The CEO</role> is to be appointed by the Governor-General for a term of up to 5 years.</p>

            </subsection>

                <p><role refersTo="#ceo">The CEO</role> holds office on a full-time basis.</p>
              </content>
            </subsection>
          </section>

            <heading>Remuneration and allowances</heading>
            <subsection eId="part-6__dvs-1__sec-46__subsec-1">
              <num>1</num>
              <content>
                <p><role refersTo="#ceo">The CEO</role> is to be paid the remuneration that is determined by the Remuneration Tribunal. However, if no determination of that remuneration by the Tribunal is in operation, <role refersTo="#ceo">the CEO</role> is to be paid the remuneration that is prescribed by the regulations.</p>
              </content>
            </subsection>
            <subsection eId="part-6__dvs-1__sec-46__subsec-2">
              <num>2</num>
              <content>
                <p><role refersTo="#ceo">The CEO</role> is to be paid such allowances as are prescribed by the regulations.</p>
              </content>
            </subsection>
            <subsection eId="part-6__dvs-1__sec-46__subsec-3">

              <content>
                <p>	(3)	This section has effect subject to the <i>Remuneration Tribunal Act 1973</i>.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-6__dvs-1__sec-47">

            <heading>Outside employment</heading>
            <content>
              <p><role refersTo="#ceo">The CEO</role> must not engage in any paid employment outside the duties of the office without <role refersTo="#minister">the Minister</role>’s written approval.</p>
            </content>
          </section>
          <section eId="part-6__dvs-1__sec-48">
            <num>48</num>
            <heading>Recreation leave etc.</heading>
            <subsection eId="part-6__dvs-1__sec-48__subsec-1">
              <num>1</num>
              <content>
                <p><role refersTo="#ceo">The CEO</role> has such recreation leave entitlements as are determined by the Remuneration Tribunal.</p>
              </content>
            </subsection>
            <subsection eId="part-6__dvs-1__sec-48__subsec-2">
              <num>2</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> may grant <role refersTo="#ceo">the CEO</role> other leave of absence on such terms and conditions as <role refersTo="#minister">the Minister</role> determines. The terms and conditions may include terms and conditions relating to remuneration.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-6__dvs-1__sec-49">
            <num>49</num>
            <heading>Resignation</heading>
            <content>
              <p><role refersTo="#ceo">The CEO</role> may resign by giving the Governor-General a signed resignation notice.</p>
            </content>
          </section>
          <section eId="part-6__dvs-1__sec-51">
            <num>51</num>
            <heading>Termination of appointment</heading>
            <subsection eId="part-6__dvs-1__sec-51__subsec-1">
              <num>1</num>
              <content>
                <p>The Governor-General may terminate the appointment of <role refersTo="#ceo">the CEO</role> for physical or mental incapacity, misbehaviour, incompetence or inefficiency.</p>
              </content>
            </subsection>
            <subsection eId="part-6__dvs-1__sec-51__subsec-2">
              <num>2</num>
              <content>
                <p>The Governor-General must terminate the appointment of <role refersTo="#ceo">the CEO</role> if <role refersTo="#ceo">the CEO</role> does any of the following:</p>
              </content>
              <paragraph eId="part-6__dvs-1__sec-51__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>is absent from duty (except on leave of absence) for 14 consecutive days, or for 28 days in any period of 12 months;</p>
                </content>
              </paragraph>
              <paragraph eId="part-6__dvs-1__sec-51__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>becomes bankrupt;</p>
                </content>
              </paragraph>
              <paragraph eId="part-6__dvs-1__sec-51__subsec-2__para-c">
                <num>c</num>
                <content>
                  <p>applies to take the benefit of any law for the relief of bankrupt or insolvent debtors;</p>
                </content>
              </paragraph>
              <paragraph eId="part-6__dvs-1__sec-51__subsec-2__para-d">
                <num>d</num>
                <content>
                  <p>compounds with his or her creditors;</p>
                </content>
              </paragraph>
              <paragraph eId="part-6__dvs-1__sec-51__subsec-2__para-e">

                  <p>assigns his or her remuneration for the benefit of his or her creditors;</p>
                </content>
              </paragraph>

            </subsection>
            <subsection eId="part-6__dvs-1__sec-51__subsec-3">
              <num>3</num>
              <content>
                <p>If <role refersTo="#ceo">the CEO</role> is:</p>
              </content>
              <paragraph eId="part-6__dvs-1__sec-51__subsec-3__para-a">
                <num>a</num>
                <content>
                  <p>	(a)	an eligible employee for the purposes of the <i>Superannuation Act 1976</i>; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-6__dvs-1__sec-51__subsec-3__para-b">
                <num>b</num>
                <content>
                  <p>	(b)	a member of the superannuation scheme established by deed under the <i>Superannuation Act 1990</i>; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-6__dvs-1__sec-51__subsec-3__para-c">

                <content>
                  <p>	(c)	an ordinary employer-sponsored member of PSSAP, within the meaning of the <i>Superannuation Act 2005</i>;</p>

                  <p>the Governor-General may, with the consent of <role refersTo="#ceo">the CEO</role>, retire <role refersTo="#ceo">the CEO</role> from office on the ground of physical or mental incapacity.</p>

              </paragraph>
            </subsection>
            <subsection eId="part-6__dvs-1__sec-51__subsec-4">
              <num>4</num>
              <content>
                <p>	(4)	For the purposes of the <i>Superannuation Act 1976</i>, the CEO is taken to have been retired from office on the ground of invalidity if:</p>
              </content>
              <paragraph eId="part-6__dvs-1__sec-51__subsec-4__para-a">
                <num>a</num>
                <content>
                  <p><role refersTo="#ceo">the CEO</role> is removed or retired from office on the ground of physical or mental incapacity; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-6__dvs-1__sec-51__subsec-4__para-b">
                <num>b</num>
                <content>
                  <p>CSC gives a certificate under <ref href="#sec-54C">section 54C</ref> of that Act.</p>
                </content>
              </paragraph>
            </subsection>

                <p>	(5)	For the purposes of the <i>Superannuation Act 1990</i>, the CEO is taken to have been retired from office on the ground of invalidity if:</p>

                  <p><role refersTo="#ceo">the CEO</role> is removed or retired from office on the ground of physical or mental incapacity; and</p>

                  <p>CSC gives a certificate under <ref href="#sec-13">section 13</ref> of that Act.</p>

                <p>	(6)	For the purposes of the <i>Superannuation Act 2005</i>, the CEO is taken to have been retired from office on the ground of invalidity if:</p>

                <content>
                  <p><role refersTo="#ceo">the CEO</role> is removed or retired from office on the ground of physical or mental incapacity; and</p>

                  <p>CSC gives an approval and certificate under <ref href="#sec-43">section 43</ref> of that Act.</p>

            <heading>Other terms and conditions of appointment</heading>

              <p><role refersTo="#ceo">The CEO</role> holds office on such terms and conditions (if any) in respect of matters not provided for by this Act as are determined by the Governor-General in writing.</p>

            <num>53</num>
            <heading>Acting appointment</heading>
            <content>
              <p><role refersTo="#minister">The Minister</role> may appoint a person to act as CEO:</p>
            </content>
            <paragraph eId="part-6__dvs-1__sec-53__para-a">
              <num>a</num>
              <content>
                <p>if there is a vacancy in the office of CEO, whether or not an appointment has previously been made to the office; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__dvs-1__sec-53__para-b">
              <num>b</num>
              <content>
                <p>during any period, or during all periods, when <role refersTo="#ceo">the CEO</role> is absent from duty or from Australia or is, for any reason, unable to perform the duties of the office.</p>

            <heading>Notional payments by the Commonwealth</heading>

                <p>The purpose of this section is to ensure that fees and charges under this Act and the regulations, and charges under the Licence Charges Act, are notionally payable by the Commonwealth (or parts of the Commonwealth).</p>

            <heading>Annual report</heading>

            <heading>Reports to Parliament</heading>

                <p><role refersTo="#ceo">The CEO</role> may at any time cause a report about matters relating to <role refersTo="#ceo">the CEO</role>’s functions to be tabled in either House of the Parliament.</p>
              </content>
            </subsection>
            <subsection eId="part-6__dvs-3__sec-61__subsec-2">
              <num>2</num>
              <content>
                <p>If a serious accident or malfunction occurs at a nuclear installation, <role refersTo="#ceo">the CEO</role> must cause a report about the incident to be tabled in each House of the Parliament no later than 3 sitting days after the incident occurs.</p>
              </content>
            </subsection>

                <p><role refersTo="#ceo">The CEO</role> must give a copy of the report to <role refersTo="#minister">the Minister</role>.</p>

                <p><role refersTo="#ceo">The CEO</role> may, by instrument in writing, appoint any of the following persons as an inspector:</p>
              </content>

                  <p>a person who is appointed or employed by the Commonwealth;</p>
                </content>
              </paragraph>
              <paragraph eId="part-7__dvs-1__sec-62__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>a person who is appointed or employed by a State or Territory.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-7__dvs-1__sec-62__subsec-2">
              <num>2</num>
              <content>
                <p>In exercising powers or performing functions as an inspector, an inspector must comply with any directions of <role refersTo="#ceo">the CEO</role>.</p>
              </content>
            </subsection>
            <subsection eId="part-7__dvs-1__sec-62__subsec-3">
              <num>3</num>
              <content>
                <p><role refersTo="#ceo">The CEO</role> must issue an identity card to an inspector, in the form approved in an instrument under subsection (3A). The identity card must contain a recent photograph of the inspector.</p>
              </content>
            </subsection>
            <subsection eId="part-7__dvs-1__sec-62__subsec-3A">
              <num>3A</num>
              <content>
                <p><role refersTo="#ceo">The CEO</role> may, by notifiable instrument, approve a form for the purposes of subsection (3).</p>
              </content>
            </subsection>
            <subsection eId="part-7__dvs-1__sec-62__subsec-4">
              <num>4</num>
              <content>
                <p>If a person to whom an identity card has been issued ceases to be an inspector, the person must immediately return the identity card to <role refersTo="#ceo">the CEO</role>.</p>

            <heading>Powers available to inspectors for monitoring compliance</heading>

                <p>For the purpose of finding out whether this Act or the regulations have been complied with, an inspector may:</p>
              </content>
              <paragraph eId="part-7__dvs-1__sec-63__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>enter any premises; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-7__dvs-1__sec-63__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>exercise the powers set out in subsection 67(1).</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-7__dvs-1__sec-63__subsec-2">
              <num>2</num>
              <content>
                <p>An inspector is not authorised to enter premises under subsection (1) unless:</p>
              </content>
              <paragraph eId="part-7__dvs-1__sec-63__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>the occupier of the premises has consented to the entry; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-7__dvs-1__sec-63__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>the entry is made under a warrant issued under <ref href="#sec-77">section 77</ref>.</p>
                </content>
              </paragraph>
            </subsection>
          </section>

            <heading>Inspector must produce identity card on request</heading>
            <content>
              <p>An inspector is not entitled to exercise any powers under this Part in relation to premises if:</p>
            </content>
            <paragraph eId="part-7__dvs-1__sec-64__para-a">
              <num>a</num>
              <content>
                <p>the occupier of the premises has required the inspector to produce his or her identity card for inspection by the occupier; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__dvs-1__sec-64__para-b">
              <num>b</num>
              <content>
                <p>the inspector fails to comply with the requirement.</p>
              </content>
            </paragraph>
          </section>
          <section eId="part-7__dvs-1__sec-65">
            <num>65</num>
            <heading>Powers available to inspectors for dealing with hazardous situations</heading>
            <subsection eId="part-7__dvs-1__sec-65__subsec-1">
              <num>1</num>
              <content>
                <p>This section applies if an inspector has reasonable grounds for suspecting that:</p>
              </content>
              <paragraph eId="part-7__dvs-1__sec-65__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>	(a)	there may be on any premises a particular thing (the <b><i>hazardous thing</i></b>) in respect of which this Act or the regulations have not been complied with; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-7__dvs-1__sec-65__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>it is necessary to exercise powers under this section in order to protect the health and safety of people or to avoid damage to the environment.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-7__dvs-1__sec-65__subsec-2">
              <num>2</num>
              <content>
                <p>The inspector may do any of the following:</p>
              </content>
              <paragraph eId="part-7__dvs-1__sec-65__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>enter the premises;</p>
                </content>
              </paragraph>
              <paragraph eId="part-7__dvs-1__sec-65__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>search the premises for the hazardous thing;</p>
                </content>
              </paragraph>
              <paragraph eId="part-7__dvs-1__sec-65__subsec-2__para-c">
                <num>c</num>
                <content>
                  <p>seize the hazardous thing, if the inspector finds it on the premises;</p>
                </content>
              </paragraph>
              <paragraph eId="part-7__dvs-1__sec-65__subsec-2__para-d">
                <num>d</num>
                <content>
                  <p>if the inspector has reasonable grounds for suspecting that a controlled person has not complied with this Act or the regulations in respect of the hazardous thing—require the controlled person to take such steps that the inspector considers necessary.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-7__dvs-1__sec-65__subsec-3">
              <num>3</num>
              <content>
                <p>The inspector may exercise the powers in subsection (2) only to the extent that it is necessary for the purpose of protecting the health and safety of people or avoiding damage to the environment.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-7__dvs-1__sec-66">
            <num>66</num>
            <heading>Searches and seizures related to offences</heading>
            <subsection eId="part-7__dvs-1__sec-66__subsec-1">
              <num>1</num>
              <content>
                <p>	(1)	This section applies if an inspector has reasonable grounds for suspecting that there may be evidential material (the <b><i>suspected material</i></b>) on any premises.</p>
              </content>
            </subsection>
            <subsection eId="part-7__dvs-1__sec-66__subsec-2">
              <num>2</num>
              <content>
                <p>The inspector may:</p>
              </content>
              <paragraph eId="part-7__dvs-1__sec-66__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>enter the premises, with the consent of the occupier or under a warrant issued under <ref href="#sec-78">section 78</ref>; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-7__dvs-1__sec-66__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>exercise the powers set out in subsection (3) and subsection 67(1); and</p>
                </content>
              </paragraph>
              <paragraph eId="part-7__dvs-1__sec-66__subsec-2__para-c">
                <num>c</num>
                <content>
                  <p>seize the suspected material, if the inspector finds it on the premises.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-7__dvs-1__sec-66__subsec-3">
              <num>3</num>
              <content>
                <p>If:</p>
              </content>
              <paragraph eId="part-7__dvs-1__sec-66__subsec-3__para-a">
                <num>a</num>
                <content>
                  <p>in the course of searching, in accordance with a warrant, for a particular thing, an inspector finds another thing that the inspector believes on reasonable grounds to be evidential material; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-7__dvs-1__sec-66__subsec-3__para-b">
                <num>b</num>
                <content>
                  <p>the inspector believes, on reasonable grounds, that it is necessary to seize that other thing in order to prevent its concealment, loss or destruction, or its use in committing, continuing or repeating an offence against this Act or the regulations;</p>
                </content>
                <content>
                  <p>the warrant is taken to authorise the inspector to seize that other thing.</p>
                </content>
              </paragraph>
            </subsection>
          </section>
          <section eId="part-7__dvs-1__sec-67">
            <num>67</num>
            <heading>General powers of inspectors in relation to premises</heading>
            <subsection eId="part-7__dvs-1__sec-67__subsec-1">
              <num>1</num>
              <content>
                <p>The powers an inspector may exercise under paragraphs 63(1)(b) and 66(2)(b) are as follows:</p>
              </content>
              <paragraph eId="part-7__dvs-1__sec-67__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>to search the premises and any thing on the premises;</p>
                </content>
              </paragraph>
              <paragraph eId="part-7__dvs-1__sec-67__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>to inspect, examine, take measurements of, or conduct tests (including by the taking of samples) concerning, any thing on the premises that relates to controlled material, controlled apparatus or a controlled facility;</p>
                </content>
              </paragraph>
              <paragraph eId="part-7__dvs-1__sec-67__subsec-1__para-c">
                <num>c</num>
                <content>
                  <p>to take photographs (including video recordings), take audio recordings or make sketches of the premises or any thing on the premises;</p>
                </content>
              </paragraph>
              <paragraph eId="part-7__dvs-1__sec-67__subsec-1__para-d">
                <num>d</num>
                <content>
                  <p>if the inspector was only authorised to enter the premises because the occupier of the premises consented to the entry—to require the occupier to:</p>
                </content>
              </paragraph>
              <paragraph eId="part-7__dvs-1__sec-67__subsec-1__para-i">
                <num>i</num>
                <content>
                  <p>answer any questions put by the inspector; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-7__dvs-1__sec-67__subsec-1__para-ii">
                <num>ii</num>
                <content>
                  <p>produce any book, record or document requested by the inspector;</p>
                </content>
              </paragraph>
              <paragraph eId="part-7__dvs-1__sec-67__subsec-1__para-e">

              </paragraph>
              <paragraph eId="part-7__dvs-1__sec-67__subsec-1__para-g">

                  <p>to take extracts from or make copies of any such book, record or document;</p>
                </content>
              </paragraph>
              <paragraph eId="part-7__dvs-1__sec-67__subsec-1__para-h">
                <num>h</num>
                <content>
                  <p>to take onto the premises such equipment and materials as the inspector requires for the purpose of exercising powers in relation to the premises.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-7__dvs-1__sec-67__subsec-2">
              <num>2</num>
              <content>
                <p>A person must not refuse or fail to comply with a requirement under paragraph (1)(e).</p>
              </content>

          </section>

            <heading>Details of warrant to be given to occupier etc.</heading>
            <subsection eId="part-7__dvs-1__sec-68__subsec-1">
              <num>1</num>
              <content>
                <p>If a warrant in relation to premises is being executed and the occupier of the premises or another person who apparently represents the occupier is present at the premises, the inspector must make available to that person a copy of the warrant.</p>
              </content>
            </subsection>
            <subsection eId="part-7__dvs-1__sec-68__subsec-2">
              <num>2</num>
              <content>
                <p>The inspector must identify himself or herself to that person.</p>
              </content>
            </subsection>
            <subsection eId="part-7__dvs-1__sec-68__subsec-3">
              <num>3</num>
              <content>
                <p>The copy of the warrant referred to in subsection (1) need not include the signature of the magistrate who issued the warrant.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-7__dvs-1__sec-69">
            <num>69</num>
            <heading>Announcement before entry</heading>
            <subsection eId="part-7__dvs-1__sec-69__subsec-1">
              <num>1</num>
              <content>
                <p>An inspector must, before entering the premises under a warrant:</p>
              </content>
              <paragraph eId="part-7__dvs-1__sec-69__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>announce that he or she is authorised to enter the premises; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-7__dvs-1__sec-69__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>give any person at the premises an opportunity to allow entry to the premises.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-7__dvs-1__sec-69__subsec-2">
              <num>2</num>
              <content>
                <p>An inspector is not required to comply with subsection (1) if he or she believes on reasonable grounds that immediate entry to the premises is required:</p>
              </content>
              <paragraph eId="part-7__dvs-1__sec-69__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>to ensure the safety of a person; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-7__dvs-1__sec-69__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>to prevent serious damage to the environment; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-7__dvs-1__sec-69__subsec-2__para-c">
                <num>c</num>
                <content>
                  <p>to ensure that the effective execution of the warrant is not frustrated.</p>
                </content>
              </paragraph>
            </subsection>
          </section>
          <section eId="part-7__dvs-1__sec-70">
            <num>70</num>
            <heading>Use of electronic equipment at premises</heading>
            <subsection eId="part-7__dvs-1__sec-70__subsec-1">
              <num>1</num>
              <content>
                <p>The inspector may operate electronic equipment at the premises to see whether evidential material is accessible by doing so if he or she believes on reasonable grounds that the operation of the equipment can be carried out without damage to the equipment.</p>
              </content>
            </subsection>
            <subsection eId="part-7__dvs-1__sec-70__subsec-2">
              <num>2</num>
              <content>
                <p>If the inspector, after operating the equipment, finds that evidential material is accessible by doing so, he or she may:</p>
              </content>
              <paragraph eId="part-7__dvs-1__sec-70__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>seize the equipment and any disk, tape or other associated device; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-7__dvs-1__sec-70__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>if the material can, by using facilities at the premises, be put in documentary form—operate the facilities to put the material in that form and seize the documents so produced; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-7__dvs-1__sec-70__subsec-2__para-c">
                <num>c</num>
                <content>
                  <p>if the material can be transferred to a disk, tape or other storage device that:</p>
                </content>
              </paragraph>
              <paragraph eId="part-7__dvs-1__sec-70__subsec-2__para-i">
                <num>i</num>
                <content>
                  <p>is brought to the premises; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-7__dvs-1__sec-70__subsec-2__para-ii">
                <num>ii</num>
                <content>
                  <p>is at the premises and the use of which for the purpose has been agreed to in writing by the occupier of the premises;</p>
                </content>
                <content>
                  <p>operate the equipment or other facilities to copy the material to the storage device and take the storage device from the premises.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-7__dvs-1__sec-70__subsec-3">
              <num>3</num>
              <content>
                <p>An inspector may seize equipment under paragraph (2)(a) only if:</p>
              </content>
              <paragraph eId="part-7__dvs-1__sec-70__subsec-3__para-a">
                <num>a</num>
                <content>
                  <p>it is not practicable to put the material in documentary form as mentioned in paragraph (2)(b) or to copy the material as mentioned in paragraph (2)(c); or</p>
                </content>
              </paragraph>
              <paragraph eId="part-7__dvs-1__sec-70__subsec-3__para-b">
                <num>b</num>
                <content>
                  <p>possession by the occupier of the equipment could constitute an offence.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-7__dvs-1__sec-70__subsec-4">
              <num>4</num>
              <content>
                <p>If the inspector believes on reasonable grounds that:</p>
              </content>
              <paragraph eId="part-7__dvs-1__sec-70__subsec-4__para-a">
                <num>a</num>
                <content>
                  <p>evidential material may be accessible by operating electronic equipment at the premises; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-7__dvs-1__sec-70__subsec-4__para-b">
                <num>b</num>
                <content>
                  <p>expert assistance is required to operate the equipment; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-7__dvs-1__sec-70__subsec-4__para-c">
                <num>c</num>
                <content>
                  <p>if he or she does not take action under this subsection, the material may be destroyed, altered or otherwise interfered with;</p>
                </content>
                <content>
                  <p>he or she may do whatever is necessary to secure the equipment, whether by locking it up, placing a guard or otherwise.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-7__dvs-1__sec-70__subsec-5">
              <num>5</num>
              <content>
                <p>The inspector must give notice to the occupier of the premises of his or her intention to secure equipment and of the fact that the equipment may be secured for up to 24 hours.</p>
              </content>
            </subsection>
            <subsection eId="part-7__dvs-1__sec-70__subsec-6">
              <num>6</num>
              <content>
                <p>The equipment may be secured:</p>
              </content>
              <paragraph eId="part-7__dvs-1__sec-70__subsec-6__para-a">
                <num>a</num>
                <content>
                  <p>for a period not exceeding 24 hours; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-7__dvs-1__sec-70__subsec-6__para-b">
                <num>b</num>
                <content>
                  <p>until the equipment has been operated by the expert;</p>
                </content>
                <content>
                  <p>whichever happens first.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-7__dvs-1__sec-70__subsec-7">
              <num>7</num>
              <content>
                <p>If the inspector believes on reasonable grounds that the expert assistance will not be available within 24 hours, he or she may apply to the magistrate for an extension of that period.</p>
              </content>
            </subsection>
            <subsection eId="part-7__dvs-1__sec-70__subsec-8">
              <num>8</num>
              <content>
                <p>The inspector must give notice to the occupier of the premises of his or her intention to apply for an extension, and the occupier is entitled to be heard in relation to the application.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-7__dvs-1__sec-71">
            <num>71</num>
            <heading>Compensation for damage to electronic equipment</heading>
            <subsection eId="part-7__dvs-1__sec-71__subsec-1">
              <num>1</num>
              <content>
                <p>The owner of equipment is entitled to compensation for damage to the equipment if:</p>
              </content>
              <paragraph eId="part-7__dvs-1__sec-71__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>the damage was caused to equipment as a result of it being operated as mentioned in <ref href="#sec-70">section 70</ref>; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-7__dvs-1__sec-71__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>the damage was caused as a result of:</p>
                </content>
              </paragraph>
              <paragraph eId="part-7__dvs-1__sec-71__subsec-1__para-i">
                <num>i</num>
                <content>
                  <p>insufficient care being exercised in selecting the person who was to operate the equipment; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-7__dvs-1__sec-71__subsec-1__para-ii">
                <num>ii</num>
                <content>
                  <p>insufficient care being exercised by the person operating the equipment.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-7__dvs-1__sec-71__subsec-2">
              <num>2</num>
              <content>
                <p>Compensation is payable out of money appropriated by the Parliament for the purpose.</p>
              </content>
            </subsection>
            <subsection eId="part-7__dvs-1__sec-71__subsec-3">
              <num>3</num>
              <content>
                <p>In determining the amount of compensation payable, regard is to be had to whether the occupier of the premises and his or her employees and agents, if they were available at the time, had provided any warning or guidance as to the operation of the equipment that was appropriate in the circumstances.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-7__dvs-1__sec-72">
            <num>72</num>
            <heading>Copies of seized things to be provided</heading>
            <subsection eId="part-7__dvs-1__sec-72__subsec-1">
              <num>1</num>
              <content>
                <p>Subject to subsection (2), if an inspector seizes, under a warrant relating to premises:</p>
              </content>
              <paragraph eId="part-7__dvs-1__sec-72__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>a document, film, computer file or other thing that can be readily copied; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-7__dvs-1__sec-72__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>a storage device the information in which can be readily copied;</p>
                </content>
                <content>
                  <p>the inspector must, if requested to do so by the occupier of the premises or another person who apparently represents the occupier and who is present when the warrant is executed, give a copy of the thing or the information to that person as soon as practicable after the seizure.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-7__dvs-1__sec-72__subsec-2">
              <num>2</num>
              <content>
                <p>Subsection (1) does not apply if:</p>
              </content>
              <paragraph eId="part-7__dvs-1__sec-72__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>the thing that has been seized was seized under paragraph 70(2)(b) or (c); or</p>
                </content>
              </paragraph>
              <paragraph eId="part-7__dvs-1__sec-72__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>possession by the occupier of the document, film, computer file, thing or information could constitute an offence.</p>
                </content>
              </paragraph>
            </subsection>
          </section>
          <section eId="part-7__dvs-1__sec-73">
            <num>73</num>
            <heading>Occupier entitled to be present during search</heading>
            <subsection eId="part-7__dvs-1__sec-73__subsec-1">
              <num>1</num>
              <content>
                <p>If a warrant in relation to premises is being executed and the occupier of the premises or another person who apparently represents the occupier is present at the premises, the person is entitled to observe the search being conducted.</p>
              </content>
            </subsection>
            <subsection eId="part-7__dvs-1__sec-73__subsec-2">
              <num>2</num>
              <content>
                <p>The right to observe the search being conducted ceases if the person impedes the search.</p>
              </content>
            </subsection>
            <subsection eId="part-7__dvs-1__sec-73__subsec-3">
              <num>3</num>
              <content>
                <p>This section does not prevent 2 or more areas of the premises being searched at the same time.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-7__dvs-1__sec-74">
            <num>74</num>
            <heading>Receipts for things seized</heading>
            <subsection eId="part-7__dvs-1__sec-74__subsec-1">
              <num>1</num>
              <content>
                <p>If a thing is seized under this Part, the inspector must provide a receipt for the thing.</p>
              </content>
            </subsection>
            <subsection eId="part-7__dvs-1__sec-74__subsec-2">
              <num>2</num>
              <content>
                <p>If 2 or more things are seized or moved, they may be covered in the one receipt.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-7__dvs-1__sec-75">
            <num>75</num>
            <heading>Retention of seized things</heading>
            <subsection eId="part-7__dvs-1__sec-75__subsec-1">
              <num>1</num>
              <content>
                <p>Subject to any contrary order of a court, if an inspector seizes a thing under this Part, an inspector must return it if:</p>
              </content>
              <paragraph eId="part-7__dvs-1__sec-75__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>the reason for its seizure no longer exists or it is decided that it is not to be used in evidence; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-7__dvs-1__sec-75__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>the period of 60 days after its seizure ends;</p>
                </content>
                <content>
                  <p>whichever first occurs, unless the thing is forfeited or forfeitable to the Commonwealth.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-7__dvs-1__sec-75__subsec-2">
              <num>2</num>
              <content>
                <p>At the end of the 60 days specified in subsection (1), an inspector must take reasonable steps to return the thing to the person from whom it was seized, unless:</p>
              </content>
              <paragraph eId="part-7__dvs-1__sec-75__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>proceedings in respect of which the thing may afford evidence were instituted before the end of the 60 days and have not been completed (including an appeal to a court in relation to those proceedings); or</p>
                </content>
              </paragraph>
              <paragraph eId="part-7__dvs-1__sec-75__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>an inspector may retain the thing because of an order under <ref href="#sec-76">section 76</ref>; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-7__dvs-1__sec-75__subsec-2__para-c">
                <num>c</num>
                <content>
                  <p>to return the thing could cause an imminent risk of death, serious illness, serious injury or serious damage to the environment; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-7__dvs-1__sec-75__subsec-2__para-d">
                <num>d</num>
                <content>
                  <p>an inspector is otherwise authorised (by a law, or an order of a court, of the Commonwealth or of a State or Territory) to retain, destroy or dispose of the thing.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-7__dvs-1__sec-75__subsec-3">
              <num>3</num>
              <content>
                <p>The thing may be returned under subsection (2) either unconditionally or on such terms and conditions as <role refersTo="#ceo">the CEO</role> sees fit.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-7__dvs-1__sec-76">
            <num>76</num>
            <heading>Magistrate may permit a thing to be retained</heading>
            <subsection eId="part-7__dvs-1__sec-76__subsec-1">
              <num>1</num>
              <content>
                <p>An inspector may apply to a magistrate for an order that he or she may retain the thing for a further period if:</p>
              </content>
              <paragraph eId="part-7__dvs-1__sec-76__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>before the end of 60 days after the seizure; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-7__dvs-1__sec-76__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>before the end of a period previously specified in an order of a magistrate under this section;</p>
                </content>
                <content>
                  <p>proceedings in respect of which the thing may afford evidence have not commenced.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-7__dvs-1__sec-76__subsec-2">
              <num>2</num>
              <content>
                <p>If the magistrate is satisfied that it is necessary for an inspector to continue to retain the thing:</p>
              </content>
              <paragraph eId="part-7__dvs-1__sec-76__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>for the purposes of an investigation as to whether an offence against this Act has been committed; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-7__dvs-1__sec-76__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>to enable evidence of an offence against this Act to be secured for the purposes of a prosecution;</p>
                </content>
                <content>
                  <p>the magistrate may order that an inspector may retain the thing for a period (not being a period exceeding 3 years) specified in the order.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-7__dvs-1__sec-76__subsec-3">
              <num>3</num>
              <content>
                <p>Before making the application, the inspector must:</p>
              </content>
              <paragraph eId="part-7__dvs-1__sec-76__subsec-3__para-a">
                <num>a</num>
                <content>
                  <p>take reasonable steps to discover who has an interest in the retention of the thing; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-7__dvs-1__sec-76__subsec-3__para-b">
                <num>b</num>
                <content>
                  <p>if it is practicable to do so, notify each person whom the inspector believes to have such an interest of the proposed application.</p>
                </content>
              </paragraph>
            </subsection>
          </section>
          <section eId="part-7__dvs-1__sec-77">
            <num>77</num>
            <heading>Monitoring warrants</heading>
            <subsection eId="part-7__dvs-1__sec-77__subsec-1">
              <num>1</num>
              <content>
                <p>An inspector may apply to a magistrate for a warrant under this section in relation to premises.</p>
              </content>
            </subsection>
            <subsection eId="part-7__dvs-1__sec-77__subsec-2">
              <num>2</num>
              <content>
                <p>Subject to subsection (3), the magistrate may issue the warrant if the magistrate is satisfied, by information on oath, that it is reasonably necessary that one or more inspectors should have access to the premises for the purposes of finding out whether this Act or the regulations have been complied with.</p>
              </content>
            </subsection>
            <subsection eId="part-7__dvs-1__sec-77__subsec-3">
              <num>3</num>
              <content>
                <p>The magistrate must not issue the warrant unless the inspector or some other person has given to the magistrate, either orally or by affidavit, such further information (if any) as the magistrate requires concerning the grounds on which the issue of the warrant is being sought.</p>
              </content>
            </subsection>
            <subsection eId="part-7__dvs-1__sec-77__subsec-4">
              <num>4</num>
              <content>
                <p>The warrant must:</p>
              </content>
              <paragraph eId="part-7__dvs-1__sec-77__subsec-4__para-a">
                <num>a</num>
                <content>
                  <p>authorise one or more inspectors (whether or not named in the warrant), with such assistance and by such force as is necessary and reasonable:</p>
                </content>
              </paragraph>
              <paragraph eId="part-7__dvs-1__sec-77__subsec-4__para-i">
                <num>i</num>
                <content>
                  <p>to enter the premises; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-7__dvs-1__sec-77__subsec-4__para-ii">
                <num>ii</num>
                <content>
                  <p>to exercise the powers set out in subsection 67(1) in relation to the premises; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-7__dvs-1__sec-77__subsec-4__para-b">
                <num>b</num>
                <content>
                  <p>state whether the entry is authorised to be made at any time of the day or night or during specified hours of the day or night; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-7__dvs-1__sec-77__subsec-4__para-c">
                <num>c</num>
                <content>
                  <p>specify the day (not more than 6 months after the issue of the warrant) on which the warrant ceases to have effect; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-7__dvs-1__sec-77__subsec-4__para-d">
                <num>d</num>
                <content>
                  <p>state the purpose for which the warrant is issued.</p>
                </content>
              </paragraph>
            </subsection>
          </section>
          <section eId="part-7__dvs-1__sec-78">
            <num>78</num>
            <heading>Offence related warrants</heading>
            <subsection eId="part-7__dvs-1__sec-78__subsec-1">
              <num>1</num>
              <content>
                <p>An inspector may apply to a magistrate for a warrant under this section in relation to premises.</p>
              </content>
            </subsection>
            <subsection eId="part-7__dvs-1__sec-78__subsec-2">
              <num>2</num>
              <content>
                <p>Subject to subsection (3), the magistrate may issue the warrant if the magistrate is satisfied, by information on oath, that there are reasonable grounds for suspecting that there is, or there may be within the next 72 hours, in or on the premises evidential material.</p>
              </content>
            </subsection>
            <subsection eId="part-7__dvs-1__sec-78__subsec-3">
              <num>3</num>
              <content>
                <p>The magistrate must not issue the warrant unless the inspector or some other person has given to the magistrate, either orally or by affidavit, such further information (if any) as the magistrate requires concerning the grounds on which the issue of the warrant is being sought.</p>
              </content>
            </subsection>
            <subsection eId="part-7__dvs-1__sec-78__subsec-4">
              <num>4</num>
              <content>
                <p>The warrant must:</p>
              </content>
              <paragraph eId="part-7__dvs-1__sec-78__subsec-4__para-a">
                <num>a</num>
                <content>
                  <p>name one or more inspectors; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-7__dvs-1__sec-78__subsec-4__para-b">
                <num>b</num>
                <content>
                  <p>authorise the persons so named, with such assistance and by such force as is necessary and reasonable:</p>
                </content>
              </paragraph>
              <paragraph eId="part-7__dvs-1__sec-78__subsec-4__para-i">
                <num>i</num>
                <content>
                  <p>to enter the premises; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-7__dvs-1__sec-78__subsec-4__para-ii">
                <num>ii</num>
                <content>
                  <p>to exercise the powers set out in subsections 66(3) and 67(1); and</p>
                </content>
              </paragraph>
              <paragraph eId="part-7__dvs-1__sec-78__subsec-4__para-iii">
                <num>iii</num>
                <content>
                  <p>to seize the evidential material; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-7__dvs-1__sec-78__subsec-4__para-c">
                <num>c</num>
                <content>

            <heading>Offence related warrants by telephone</heading>
            <subsection eId="part-7__dvs-1__sec-79__subsec-1">
              <num>1</num>
              <content>
                <p>If, in an urgent case, an inspector considers it necessary to do so, the person may apply to a magistrate by telephone for a warrant under <ref href="#sec-78">section 78</ref> in relation to premises.</p>
              </content>
            </subsection>
            <subsection eId="part-7__dvs-1__sec-79__subsec-2">
              <num>2</num>
              <content>
                <p>Before applying for the warrant, the person must prepare an information of the kind mentioned in subsection 78(2) in relation to the premises that sets out the grounds on which the warrant is sought.</p>

            </subsection>

              <num>3</num>
              <content>
                <p>If it is necessary to do so, the person may apply for the warrant before the information is sworn.</p>
              </content>
            </subsection>
            <subsection eId="part-7__dvs-1__sec-79__subsec-4">

                <p>If the magistrate is satisfied:</p>
              </content>
              <paragraph eId="part-7__dvs-1__sec-79__subsec-4__para-a">
                <num>a</num>
                <content>
                  <p>after having considered the terms of the information; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-7__dvs-1__sec-79__subsec-4__para-b">
                <num>b</num>
                <content>
                  <p>after having received such further information (if any) as the magistrate requires concerning the grounds on which the issue of the warrant is being sought;</p>
                </content>
                <content>
                  <p>that there are reasonable grounds for issuing the warrant, the magistrate may complete and sign the same warrant that the magistrate would issue under <ref href="#sec-78">section 78</ref> if the application had been made under that section.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-7__dvs-1__sec-79__subsec-5">
              <num>5</num>
              <content>
                <p>If the magistrate completes and signs the warrant:</p>
              </content>
              <paragraph eId="part-7__dvs-1__sec-79__subsec-5__para-a">
                <num>a</num>
                <content>
                  <p>the magistrate must:</p>
                </content>
              </paragraph>
              <paragraph eId="part-7__dvs-1__sec-79__subsec-5__para-i">
                <num>i</num>
                <content>
                  <p>tell the inspector what the terms of the warrant are; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-7__dvs-1__sec-79__subsec-5__para-ii">
                <num>ii</num>
                <content>
                  <p>tell the inspector the day on which and the time at which the warrant was signed; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-7__dvs-1__sec-79__subsec-5__para-iii">
                <num>iii</num>
                <content>
                  <p>tell the inspector the day (not more than one week after the magistrate completes and signs the warrant) on which the warrant ceases to have effect; and</p>

                <content>
                  <p>record on the warrant the reasons for granting the warrant; and</p>
                </content>
              </paragraph>

                  <p>the inspector must:</p>
                </content>
              </paragraph>
              <paragraph eId="part-7__dvs-1__sec-79__subsec-5__para-i">

                  <p>complete a form of warrant in the same terms as the warrant completed and signed by the magistrate; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-7__dvs-1__sec-79__subsec-5__para-ii">
                <num>ii</num>
                <content>
                  <p>write on the form the name of the magistrate and the day on which and the time at which the warrant was signed.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-7__dvs-1__sec-79__subsec-6">
              <num>6</num>
              <content>
                <p>The inspector must also, not later than the day after the day of expiry or execution of the warrant, whichever is the earlier, send to the magistrate:</p>
              </content>
              <paragraph eId="part-7__dvs-1__sec-79__subsec-6__para-a">
                <num>a</num>
                <content>
                  <p>the form of warrant completed by the person; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-7__dvs-1__sec-79__subsec-6__para-b">
                <num>b</num>
                <content>
                  <p>the information referred to in subsection (2), which must have been duly sworn.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-7__dvs-1__sec-79__subsec-7">
              <num>7</num>
              <content>
                <p>When the magistrate receives those documents, the magistrate must:</p>
              </content>
              <paragraph eId="part-7__dvs-1__sec-79__subsec-7__para-a">
                <num>a</num>
                <content>
                  <p>attach them to the warrant that the magistrate completed and signed; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-7__dvs-1__sec-79__subsec-7__para-b">
                <num>b</num>
                <content>
                  <p>deal with them in the way in which the magistrate would have dealt with the information if the application had been made under <ref href="#sec-78">section 78</ref>.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-7__dvs-1__sec-79__subsec-8">
              <num>8</num>
              <content>
                <p>A form of warrant duly completed under subsection (5) is authority for any entry, search, seizure or other exercise of a power that the warrant signed by the magistrate authorises.</p>
              </content>
            </subsection>
            <subsection eId="part-7__dvs-1__sec-79__subsec-9">
              <num>9</num>
              <content>
                <p>If:</p>
              </content>
              <paragraph eId="part-7__dvs-1__sec-79__subsec-9__para-a">
                <num>a</num>
                <content>
                  <p>it is material, in any proceedings, for a court to be satisfied that an exercise of a power was authorised by this section; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-7__dvs-1__sec-79__subsec-9__para-b">
                <num>b</num>
                <content>
                  <p>the warrant signed by the magistrate authorising the exercise of the power is not produced in evidence;</p>
                </content>
                <content>
                  <p>the court must assume, unless the contrary is proved, that the exercise of the power was not authorised by such a warrant.</p>
                </content>
              </paragraph>

                <p>A reference in this Part to a warrant under <ref href="#sec-78">section 78</ref> includes a reference to a warrant signed by a magistrate under this section.</p>

            <heading>Offences relating to warrants</heading>
            <subsection eId="part-7__dvs-1__sec-80__subsec-1">

                <p>A person must not make, in an application for a warrant, a statement that the person knows to be false or misleading in a material particular.</p>

                  <p>state in a document that purports to be a form of warrant under <ref href="#sec-79">section 79</ref> the name of a magistrate unless that magistrate issued the warrant; or</p>

                  <p>state on a form of warrant under that section a matter that, to the person’s knowledge, departs in a material particular from the form authorised by the magistrate; or</p>

              <paragraph eId="part-7__dvs-1__sec-80__subsec-2__para-c">
                <num>c</num>
                <content>
                  <p>purport to execute, or present to another person, a document that purports to be a form of warrant under that section that the first-mentioned person knows:</p>
                </content>
              </paragraph>
              <paragraph eId="part-7__dvs-1__sec-80__subsec-2__para-i">
                <num>i</num>
                <content>
                  <p>has not been approved by a magistrate under that section; or</p>
                </content>
              </paragraph>

                  <p>to depart in a material particular from the terms authorised by a magistrate under that section; or</p>
                </content>
              </paragraph>

                  <p>give to a magistrate a form of warrant under that section that is not the form of warrant that the person purported to execute.</p>

                <p>This section applies if an inspector reasonably believes that:</p>

                  <p>the holder of a licence or a person covered by a licence is contravening, or is likely to contravene, a provision of this Act or the regulations; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-7__dvs-2__sec-80A__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>a condition of a licence is being contravened, or is likely to be contravened.</p>
                </content>
              </paragraph>

                <p>	(2)	The inspector may give the holder of the licence a notice in writing (an <b><i>improvement notice</i></b>) requiring the holder of the licence to:</p>

                  <p>remedy the contravention; or</p>
                </content>
              </paragraph>

                  <p>prevent a likely contravention from occurring; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-7__dvs-2__sec-80A__subsec-2__para-c">

                <p>A licence is subject to the condition that an improvement notice relating to the licence and issued to the holder of the licence must be complied with by the time specified in the notice.</p>

            <heading>Review of improvement notice decisions</heading>

                <p>	(1)	A licence holder to whom an improvement notice has been given may request that the CEO reconsider a decision made by an inspector under <b><i>improvement notice decision</i></b>).<ref href="#sec-80A">section 80A</ref> in relation to the improvement notice (the </p>

              <p>Where this Act confers a power or discretion on a person, the person must have regard to Australia’s obligations under the relevant international agreements in exercising that power or discretion.</p>

              <p>	(3)	For the purposes of this section, an agreement is a <b><i>relevant international agreement</i></b> if it is an international agreement prescribed by the regulations.</p>

              <p>The Governor-General may make regulations prescribing matters:</p>

                <p>required or permitted by this Act to be prescribed; or</p>

            </paragraph>

                <p>necessary or convenient to be prescribed for carrying out or giving effect to this Act.</p>

            </paragraph>

                <p>regulate, restrict or prohibit any act of a controlled person in relation to such activities or dealings; and</p>

                <p>The amendment history in endnote 4 provides information about amendments at the provision (generally section or equivalent) level. It also includes information about any provision of the compiled law that has been repealed in accordance with a provision of the law.</p>

                  <b>Editorial changes</b>
                </p>
                <p>The <i>Legislation Act 2003</i> authorises First Parliamentary Counsel to make editorial and presentational changes to a compiled law in preparing a compilation of the law for registration. The changes must not change the effect of the law. Editorial changes take effect from the compilation registration date.</p>
                <p>If the compilation includes editorial changes, the endnotes include a brief outline of the changes in general terms. Full details of any changes can be obtained from the Office of Parliamentary Counsel.</p>

                  <b>Misdescribed amendments</b>
                </p>
                <p>A misdescribed amendment is an amendment that does not accurately describe how an amendment is to be made. If, despite the misdescription, the amendment can be given effect as intended, then the misdescribed amendment can be incorporated through an editorial change made under <i>Legislation Act 2003</i>.<ref href="#sec-15V">section 15V</ref> of the </p>
                <p>If a misdescribed amendment cannot be given effect as intended, the amendment is not incorporated and “(md not incorp)” is added to the amendment history.</p>
