          <heading>Short title</heading>
          <content>
            <p>		This Act may be cited as the <i>Productivity Commission Act 1998</i>.</p>
          </content>
        </section>
        <section eId="part-1__sec-2">
          <num>2</num>
          <heading>Commencement</heading>
          <content>
            <p>		This Act commences immediately after the commencement of the <i>Productivity Commission (Repeals, Transitional and Consequential Amendments) Act 1998</i>.</p>
          </content>
        </section>
        <section eId="part-1__sec-3">
          <num>3</num>
          <heading>Definitions</heading>
          <content>
            <p>In this Act, unless the contrary intention appears:</p>
            <p><term refersTo="#term-associate-commissioner">Associate Commissioner</term> means <def>an Associate Commissioner appointed under <ref href="#sec-25">section 25</ref>.</def></p>
            <p><term refersTo="#term-chair">Chair</term> means <def>the Chair of the Commission.</def></p>
            <p><term refersTo="#term-commission">Commission</term> means <def>the Productivity Commission established by this Act, and includes a Division of the Commission performing functions of the Commission.</def></p>
            <p><b><i>Commissioner</i></b> means:</p>
          </content>

            <num>a</num>
            <content>
              <p>the Chair; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-b">
            <num>b</num>
            <content>
              <p><i>	</i>(b)<i>	</i>a Commissioner appointed under section 24.</p>
            </content>
            <content>
              <p><b><i>Commonwealth authority</i></b> means:</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-a">
            <num>a</num>
            <content>
              <p>a body (whether incorporated or not) established for a public purpose by or under a law of the Commonwealth or of a Territory; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-b">
            <num>b</num>
            <content>
              <p>a company or other body corporate in which the Commonwealth, a Territory or a body referred to in paragraph (a) has a controlling interest.</p>
            </content>
            <content>
              <p><term refersTo="#term-csc-short-for-commonwealth-superannuation-corporation">CSC (short for Commonwealth Superannuation Corporation)</term> has the same meaning as <def>in <ref href="">the Governance of Australian Government Superannuation Schemes Act 2011</ref>.</def></p>
              <p><term refersTo="#term-division">Division</term> means <def>a Division of the Commission established under <ref href="#sec-40">section 40</ref>.</def></p>
              <p><b><i>government body</i></b> includes:</p>

          </paragraph>

            <num>a</num>
            <content>
              <p>a body consisting of representatives of 2 or more government bodies; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-b">
            <num>b</num>
            <content>
              <p>an international government body.</p>
            </content>
            <content>
              <p><term refersTo="#term-hearing">hearing</term> means <def>a hearing held for the purposes of an inquiry.</def></p>
              <p><term refersTo="#term-industry">industry</term> means <def>industry of any kind (including any business or activity relating to goods or services), and a reference to industry is a reference to industry in general, a particular industry, a part of an industry, or a group or groups of particular industries.</def></p>
              <p><term refersTo="#term-inquiry">inquiry</term> means <def>an inquiry held under this Act.</def></p>
              <p><b><i>member</i></b> means:</p>
            </content>
          </paragraph>

            <num>a</num>
            <content>
              <p>a Commissioner (including the Chair); or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-b">
            <num>b</num>
            <content>
              <p>an Associate Commissioner.</p>
            </content>
            <content>
              <p><term refersTo="#term-subject-of-commonwealth-power">subject of Commonwealth power</term> means <def>any matter with respect to which the Parliament has power to make laws.</def></p>
            </content>
          </paragraph>
        </section>
        <section eId="part-1__sec-4">
          <num>4</num>
          <heading>Act binds Crown</heading>
          <subsection eId="part-1__sec-4__subsec-1">
            <num>1</num>
            <content>
              <p>Subject to this section, this Act binds the Crown in right of the Commonwealth, of each of the States, of the Australian Capital Territory and of the Northern Territory.</p>
            </content>
          </subsection>
          <subsection eId="part-1__sec-4__subsec-2">
            <num>2</num>
            <content>
              <p>Nothing in this Act makes the Crown liable to prosecution for an offence against this Act.</p>
            </content>
          </subsection>
          <subsection eId="part-1__sec-4__subsec-3">
            <num>3</num>
            <content>
              <p>The protection in subsection (2) does not apply to a Commonwealth authority.</p>
            </content>
          </subsection>
        </section>
      </part>
      <part eId="part-2">
        <num>2</num>
        <heading>Establishment and functions of Productivity Commission</heading>
        <section eId="part-2__sec-5">
          <num>5</num>
          <heading>Establishment of Commission</heading>
          <subsection eId="part-2__sec-5__subsec-1">
            <num>1</num>
            <content>
              <p>The Productivity Commission is established.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-5__subsec-2">
            <num>2</num>
            <content>
              <p>	(2)	For the purposes of the finance law (within the meaning of the <i>Public Governance, Performance and Accountability Act 2013</i>):</p>
            </content>
            <paragraph eId="part-2__sec-5__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>the Commission is a listed entity; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>the Chair is the accountable authority of the Commission; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>the following persons are officials of the Commission:</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5__subsec-2__para-i">
              <num>i</num>
              <content>
                <p>the Chair;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5__subsec-2__para-ii">
              <num>ii</num>
              <content>
                <p>the other members;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5__subsec-2__para-iii">
              <num>iii</num>
              <content>
                <p>the staff of the Commission referred to in <ref href="#sec-44">section 44</ref>;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5__subsec-2__para-iv">
              <num>iv</num>
              <content>
                <p>consultants engaged under <ref href="#sec-45">section 45</ref>; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5__subsec-2__para-d">
              <num>d</num>
              <content>
                <p>the purposes of the Commission include the functions of the Commission referred to in <ref href="#sec-6">section 6</ref> and <ref href="#part-4">Part 4</ref>.</p>
              </content>
            </paragraph>
          </subsection>
        </section>
        <section eId="part-2__sec-6">
          <num>6</num>
          <heading>Functions of Commission</heading>
          <subsection eId="part-2__sec-6__subsec-1">
            <num>1</num>
            <content>
              <p>The functions of the Commission are:</p>
            </content>
            <paragraph eId="part-2__sec-6__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>to hold inquiries and report to <role refersTo="#minister">the Minister</role> about matters relating to industry, industry development and productivity that are referred to it by <role refersTo="#minister">the Minister</role>; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-6__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>to provide secretariat services and research services to government bodies as directed by <role refersTo="#minister">the Minister</role>; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-6__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>on and after <date date="1997-07-01">1 July 1997</date>, to receive and investigate complaints about the implementation of competitive neutrality arrangements in relation to Commonwealth government businesses and business activities and to report to the Minister on its investigations; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-6__subsec-1__para-d">
              <num>d</num>
              <content>
                <p>to provide advice to <role refersTo="#minister">the Minister</role> about matters relating to industry, industry development and productivity, as requested by <role refersTo="#minister">the Minister</role>; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-6__subsec-1__para-e">
              <num>e</num>
              <content>
                <p>to undertake, on its own initiative, research about matters relating to industry, industry development and productivity; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-6__subsec-1__para-f">
              <num>f</num>
              <content>
                <p>to promote public understanding of matters relating to industry, industry development and productivity; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-6__subsec-1__para-g">
              <num>g</num>
              <content>
                <p>to perform any other function conferred on it by this Act; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-6__subsec-1__para-h">
              <num>h</num>
              <content>
                <p>to do anything incidental to any of the preceding functions.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-6__subsec-2">
            <num>2</num>
            <content>
              <p>In this section:</p>
            </content>
            <content>
              <p><b><i>matters relating to industry, industry development and productivity</i></b> includes legislative or administrative action taken, or to be taken, by the Commonwealth, a State or a Territory that affects or might affect the productivity performance of industry, industry development, or the productivity performance of the economy as a whole.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-2__sec-7">
          <num>7</num>
          <heading>General power of Commission</heading>
          <content>
            <p>The Commission has power to do everything necessary or convenient to be done for, or in connection with, the performance of its functions.</p>
          </content>
        </section>
        <section eId="part-2__sec-8">
          <num>8</num>
          <heading>General policy guidelines for Commission</heading>
          <subsection eId="part-2__sec-8__subsec-1">
            <num>1</num>
            <content>
              <p>In the performance of its functions, the Commission must have regard to the need:</p>
            </content>
            <paragraph eId="part-2__sec-8__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>to improve the overall economic performance of the economy through higher productivity in the public and private sectors in order to achieve higher living standards for all members of the Australian community; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>to reduce regulation of industry (including regulation by the States, Territories and local government) where this is consistent with the social and economic goals of the Commonwealth Government; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>to encourage the development and growth of Australian industries that are efficient in their use of resources, enterprising, innovative and internationally competitive; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-1__para-d">
              <num>d</num>
              <content>
                <p>to facilitate adjustment to structural changes in the economy and the avoidance of social and economic hardships arising from those changes; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-1__para-e">
              <num>e</num>
              <content>
                <p>to recognise the interests of industries, employees, consumers and the community, likely to be affected by measures proposed by the Commission; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-1__para-f">
              <num>f</num>
              <content>
                <p>to increase employment, including in regional areas; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-1__para-g">
              <num>g</num>
              <content>
                <p>to promote regional development; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-1__para-h">
              <num>h</num>
              <content>
                <p>to recognise the progress made by ’s trading partners in reducing both tariff and non-tariff barriers; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-1__para-i">
              <num>i</num>
              <content>
                <p>to ensure that industry develops in a way that is ecologically sustainable; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-1__para-j">
              <num>j</num>
              <content>
                <p>for  to meet its international obligations and commitments.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-8__subsec-2">
            <num>2</num>
            <content>
              <p>In the performance of its functions, the Commission must also have regard to any other matters notified to it in writing by <role refersTo="#minister">the Minister</role>.</p>

              <p>The Commission, in all reports on matters referred to it, must provide a variety of viewpoints and options representing alternative means of addressing the issues in the report. If the report relies on formal mathematical economic modelling, the Commission must either:</p>

                <p>if practicable—utilise at least 2 different economic models, with the assumptions and results of those models made explicit in the report; or</p>

                <p>if it is not practicable to utilise at least 2 different economic models, appoint, and report on the views of, an independent reference panel on the modelling.</p>

          <heading>Flexibility and range of working methods in performance of Commission’s functions</heading>
          <content>
            <p>In the performance of its functions, the Commission:</p>
          </content>
          <paragraph eId="part-2__sec-9__para-a">
            <num>a</num>
            <content>
              <p>is not required to act in a formal manner; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-9__para-b">
            <num>b</num>
            <content>
              <p>may inform itself on any matter in any way it thinks fit; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-9__para-c">
            <num>c</num>
            <content>
              <p>may consult with anyone it thinks fit; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-9__para-d">
            <num>d</num>
            <content>
              <p>may receive written or oral information or submissions; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-9__para-e">
            <num>e</num>
            <content>
              <p>may hold public seminars, conduct workshops and establish working groups and task forces.</p>
            </content>
          </paragraph>
        </section>

          <heading>Annual report</heading>
          <subsection eId="part-2__sec-10__subsec-1">
            <num>1</num>
            <content>
              <p>	(1)	The annual report prepared by the Chair and given to the Minister under <i>Public Governance, Performance and Accountability Act 2013</i> for a period must:<ref href="#sec-46">section 46</ref> of the </p>
            </content>
            <paragraph eId="part-2__sec-10__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>report on matters relating to industry, industry development and productivity that have been referred to it during the period; and</p>
              </content>
            </paragraph>

              <p><b><i>assistance</i></b> includes any act that, directly or indirectly:</p>

                <p>assists a person to carry on a business or activity; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-10__subsec-3__para-b">

                <p>confers a pecuniary benefit on, or results in a pecuniary benefit accruing to, a person in respect of carrying on a business or activity.</p>

                <p>In referring a matter to the Commission for inquiry, <role refersTo="#minister">the Minister</role> may, for the purpose of ensuring that the inquiry is conducted in the manner appropriate to that inquiry, do any or all of the following:</p>

                  <p>require the Commission to hold hearings for the purposes of the inquiry;</p>

                  <p>specify a period within which the Commission must submit its report on the inquiry to <role refersTo="#minister">the Minister</role>;</p>

                <content>
                  <p>require the Commission to make a draft report available to the public during an inquiry;</p>
                </content>

                  <p>require the Commission to make recommendations in relation to the matter;</p>
                </content>

                <p>The Commission must make a written report to <role refersTo="#minister">the Minister</role> on the inquiry unless <role refersTo="#minister">the Minister</role> withdraws the reference to the Commission.</p>

              <num>3</num>

                <p><role refersTo="#minister">The Minister</role> may withdraw or amend the reference at any time before <role refersTo="#minister">the Minister</role> has received the report on the inquiry from the Commission.</p>

              <num>4</num>
              <content>
                <p>If <role refersTo="#minister">the Minister</role> refers a matter to the Commission for inquiry, the Commission may also make recommendations in the report on any matters relevant to the matter referred.</p>

            <num>12</num>
            <heading>Report of inquiry to be tabled</heading>
            <content>
              <p><role refersTo="#minister">The Minister</role> must cause a copy of the Commission’s report on an inquiry to be tabled in each House of the Parliament:</p>

              <num>a</num>
              <content>
                <p>within 25 sitting days of that House after the day on which <role refersTo="#minister">the Minister</role> receives it; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__dvs-1__sec-12__para-b">
              <num>b</num>
              <content>
                <p>if the Commission recommends that the tabling of the report, or part of the report, be delayed for a specified period—within 25 sitting days of that House after the end of that period.</p>

            </paragraph>

          <heading>Conduct of inquiries</heading>

              <p>As soon as practicable after the Commission receives a reference to hold an inquiry, it must give reasonable notice, by publishing a notice in a manner that results in the notice being accessible to the public and reasonably prominent, of its intention to hold the inquiry.</p>
            </content>

            <num>14</num>
            <heading>Notice of hearings</heading>
            <content>
              <p>Before the Commission begins to hold hearings for the purposes of an inquiry, it must give reasonable notice, by publishing a notice in a manner that results in the notice being accessible to the public and reasonably prominent, of its intention to hold the hearings, the subject of the hearings and the time and place at which the first of the hearings is to be begun.</p>

            <heading>Procedure at hearings</heading>
            <subsection eId="part-3__dvs-2__sec-15__subsec-1">
              <num>1</num>
              <content>
                <p>A hearing must be held in public except in the circumstances set out in subsection (2).</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-2__sec-15__subsec-2">
              <num>2</num>
              <content>
                <p>If the Commission is satisfied that it is in the public interest not to hold the hearing, or a part of it, in public because of the confidential nature of any evidence or matter, or for any other reason, it may:</p>

                <num>a</num>
                <content>
                  <p>direct that the hearing, or that part of it, take place in private; and</p>
                </content>

            <heading>Written statements etc. to be made public</heading>

                <p>the Commission is required to hold hearings for the purposes of an inquiry; and</p>
              </content>
            </paragraph>

                <p>a person gives written evidence to the inquiry or gives or produces a document to the Commission in connection with the inquiry;</p>
              </content>
              <content>
                <p>the Commission must make available to the public in any way it thinks fit the contents of the statement or document, other than any matter:</p>
              </content>

                <p>that the person objects to being made public; and</p>
              </content>

                <p>If <role refersTo="#minister">the Minister</role> requests the Commission’s advice on a matter, <role refersTo="#minister">the Minister</role> may specify any or all of the following:</p>

                  <p>that the advice is to be in writing;</p>
                </content>
              </paragraph>

                </content>
              </paragraph>

                <p>If <role refersTo="#minister">the Minister</role> requests the Commission’s advice on a matter, the Commission may also advise <role refersTo="#minister">the Minister</role> on any matters it considers relevant to the matter.</p>

            <heading>Minister may publish Commission’s advice</heading>

                <p><role refersTo="#minister">The Minister</role> may publish advice given by the Commission under section 17 in any way he or she thinks fit.</p>

                  <p>the advice contains information whose publication would, in <role refersTo="#minister">the Minister</role>’s opinion, be contrary to the public interest;</p>

            </subsection>

                <p>If the advice is published with deletions, <role refersTo="#minister">the Minister</role> must also publish the fact that the advice is published with deletions.</p>

            <heading>Secretariat services and research services to government bodies</heading>

                <p><role refersTo="#minister">The Minister</role> may, in writing, specify conditions on which the Commission is to provide the services.</p>

            <heading>Research services on request of other bodies</heading>
            <subsection eId="part-4__dvs-1__sec-20__subsec-1">

                  <p>a person or body (other than a government body) requests the Commission to undertake a specified research project for the person or body; and</p>

                  <p>the project relates to a matter or matters relating to industry, industry development and productivity, <ref href="#sec-6">as defined in section 6</ref>; and</p>

          <heading>Competitive neutrality complaints</heading>

            <heading>Complaints to the Commission</heading>

                <p>A person may complain to the Commission that:</p>
              </content>
              <paragraph eId="part-4__dvs-2__sec-21__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>a particular Commonwealth Government business or business activity, or a business or business activity competing with a Commonwealth Government business or business activity, is not conducted in accordance with competitive neutrality arrangements that apply to it; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-21__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>a particular Commonwealth government or business activity, or a business or business activity competing with a Commonwealth government business or business activity, should be required to be conducted in accordance with competitive neutrality arrangements.</p>

                <p>The complaint must be in writing.</p>

                <p>The Commission is to give particular regard to ensuring the interests of users of the service are considered in relation to the complaint and may invite submissions from interested parties.</p>
              </content>
            </subsection>
            <subsection eId="part-4__dvs-2__sec-21__subsec-4">

              <content>
                <p>In addition to the obligations imposed on the functions of the Commission in <date date="1995-04-11">11 April 1995</date>.<ref href="#sec-8">section 8</ref>, the Commission must give particular consideration to the public interest requirements in clause 1 of the Competition Principles Agreement signed by the Commonwealth Government on </p>

                <p>	(5)	Competitive neutrality arrangements are the arrangements referred to by that name in the <i>Commonwealth Government Competitive Neutrality Statement</i> of June 1996 (the aim of which is to ensure that significant business activities do not enjoy net competitive advantages or disadvantages in comparison with their competitors by virtue of their public sector ownership). </p>

            <heading>Discretion not to investigate complaints</heading>
            <subsection eId="part-4__dvs-2__sec-22__subsec-1">

                <p>The Commission may decide not to investigate a complaint, if in the opinion of the Commission:</p>
              </content>
              <paragraph eId="part-4__dvs-2__sec-22__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>the complaint is frivolous or vexatious or was not made in good faith; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-22__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>the complainant does not have sufficient interest in the subject matter of the complaint; or</p>
                </content>
              </paragraph>

                  <p>an investigation is not warranted having regard to all the relevant circumstances.</p>

            <heading>Terms and conditions of appointment of members</heading>
            <subsection eId="part-5__dvs-1__sec-26__subsec-1">
              <num>1</num>
              <content>
                <p>The Chair must be appointed on a full-time basis.</p>
              </content>
            </subsection>
            <subsection eId="part-5__dvs-1__sec-26__subsec-2">
              <num>2</num>
              <content>
                <p>The other members of the Commission may be appointed either on a full-time or part-time basis.</p>
              </content>
            </subsection>
            <subsection eId="part-5__dvs-1__sec-26__subsec-6">
              <num>6</num>
              <content>
                <p>A member is appointed for the term, not longer than 5 years, that is specified in the instrument of appointment, and is eligible for re-appointment.</p>
              </content>
            </subsection>
            <subsection eId="part-5__dvs-1__sec-26__subsec-7">
              <num>7</num>
              <content>
                <p>A member’s appointment is subject to any terms and conditions set out in the instrument of appointment.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-5__dvs-1__sec-27">
            <num>27</num>
            <heading>Outside employment</heading>
            <subsection eId="part-5__dvs-1__sec-27__subsec-1">
              <num>1</num>
              <content>
                <p>A full-time member must not engage in paid employment outside the duties of his or her office, except with <role refersTo="#minister">the Minister</role>’s consent.</p>
              </content>
            </subsection>
            <subsection eId="part-5__dvs-1__sec-27__subsec-2">
              <num>2</num>
              <content>
                <p>A part-time member must not engage in paid employment that, in <role refersTo="#minister">the Minister</role>’s opinion, conflicts with the proper performance of the member’s duties.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-5__dvs-1__sec-28">
            <num>28</num>
            <heading>Remuneration and allowances</heading>
            <subsection eId="part-5__dvs-1__sec-28__subsec-1">
              <num>1</num>
              <content>
                <p>A member is to be paid the remuneration that is determined by the Remuneration Tribunal. If no determination of that remuneration by the Tribunal is in operation, the member is to be paid the remuneration that is prescribed.</p>
              </content>
            </subsection>
            <subsection eId="part-5__dvs-1__sec-28__subsec-2">
              <num>2</num>
              <content>
                <p>A member is to be paid the prescribed allowances.</p>
              </content>
            </subsection>
            <subsection eId="part-5__dvs-1__sec-28__subsec-3">

                <p>	(3)	This section has effect subject to the <i>Remuneration Tribunal Act 1973</i>.</p>
              </content>
            </subsection>
          </section>

            <heading>Leave of absence for full-time members</heading>
            <subsection eId="part-5__dvs-1__sec-29__subsec-1">
              <num>1</num>
              <content>
                <p>A full-time member has the recreation leave entitlements that are determined by the Remuneration Tribunal.</p>
              </content>
            </subsection>
            <subsection eId="part-5__dvs-1__sec-29__subsec-2">
              <num>2</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> may grant a full-time member leave of absence (other than recreation leave) on the terms and conditions as to remuneration or otherwise that <role refersTo="#minister">the Minister</role> determines.</p>
              </content>
            </subsection>
            <subsection eId="part-5__dvs-1__sec-29__subsec-3">
              <num>3</num>
              <content>
                <p><i>	</i>(3)	The Minister may, by written instrument, delegate to the Chair the Minister’s powers under subsection (2) (other than powers in relation to the Chair).</p>

            </subsection>
          </section>
          <section eId="part-5__dvs-1__sec-30">
            <num>30</num>
            <heading>Leave of absence for part-time members</heading>
            <content>
              <p>The Chair may grant leave to a part-time member to be absent from a meeting or meetings of the Commission.</p>
            </content>
          </section>
          <section eId="part-5__dvs-1__sec-31">
            <num>31</num>
            <heading>Deputy Chair</heading>
            <subsection eId="part-5__dvs-1__sec-31__subsec-1">
              <num>1</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> may, in writing, appoint one of the full-time Commissioners to be the Deputy Chair for such period as is specified in the instrument of appointment.</p>
              </content>
            </subsection>
            <subsection eId="part-5__dvs-1__sec-31__subsec-2">
              <num>2</num>
              <content>
                <p>The Deputy Chair must assist the Chair in the exercise of the powers and the performance of the duties of the Chair.</p>
              </content>
            </subsection>
            <subsection eId="part-5__dvs-1__sec-31__subsec-3">
              <num>3</num>
              <content>
                <p>The Deputy Chair holds office until:</p>
              </content>
              <paragraph eId="part-5__dvs-1__sec-31__subsec-3__para-a">
                <num>a</num>
                <content>
                  <p>his or her term of office as Deputy Chair expires; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-5__dvs-1__sec-31__subsec-3__para-b">
                <num>b</num>
                <content>
                  <p>he or she ceases to be a Commissioner; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-5__dvs-1__sec-31__subsec-3__para-c">
                <num>c</num>
                <content>
                  <p>the Chair ends the appointment;</p>
                </content>
                <content>
                  <p>whichever first happens.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-5__dvs-1__sec-31__subsec-4">
              <num>4</num>
              <content>
                <p>A Commissioner may resign an appointment as Deputy Chair by giving the Chair a signed notice of resignation, but the resignation is not effective until it is accepted by the Chair.</p>
              </content>
            </subsection>
          </section>

            <num>32</num>
            <heading>Acting appointments</heading>
            <subsection eId="part-5__dvs-1__sec-32__subsec-1">
              <num>1</num>
              <content>
                <p>The Deputy Chair is to act as Chair:</p>
              </content>
              <paragraph eId="part-5__dvs-1__sec-32__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>during a vacancy in the office of Chair, whether or not an appointment has previously been made to the office; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-5__dvs-1__sec-32__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>during any period, or during all periods, when the Chair is absent from duty or from  or is, for any other reason, unable to perform the duties of office.</p>
                </content>

                  <p>the Chair and Deputy Chair are absent from duty or from  or are, for any other reason, unable to perform the duties of office.</p>

                <p>An Associate Commissioner may resign by giving <role refersTo="#minister">the Minister</role> a signed notice of resignation.</p>

            </subsection>
          </section>

            <heading>Retirement of member</heading>
            <subsection eId="part-5__dvs-1__sec-34__subsec-1">
              <num>1</num>
              <content>
                <p>The Governor-General may retire a Commissioner on the ground of invalidity if <role refersTo="#commissioner">the Commissioner</role> consents.</p>
              </content>
            </subsection>
            <subsection eId="part-5__dvs-1__sec-34__subsec-2">
              <num>2</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> may retire an Associate Commissioner on the ground of invalidity if the Associate Commissioner consents.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-5__dvs-1__sec-35">
            <num>35</num>
            <heading>Termination of member</heading>
            <subsection eId="part-5__dvs-1__sec-35__subsec-1">
              <num>1</num>
              <content>
                <p>The Governor-General may terminate a Commissioner’s appointment for misbehaviour or physical or mental incapacity.</p>
              </content>
            </subsection>
            <subsection eId="part-5__dvs-1__sec-35__subsec-2">
              <num>2</num>
              <content>
                <p>The Governor-General must terminate a Commissioner’s appointment:</p>
              </content>
              <paragraph eId="part-5__dvs-1__sec-35__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>if <role refersTo="#commissioner">the Commissioner</role>:</p>
                </content>
              </paragraph>
              <paragraph eId="part-5__dvs-1__sec-35__subsec-2__para-i">
                <num>i</num>
                <content>
                  <p>becomes bankrupt; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-5__dvs-1__sec-35__subsec-2__para-ii">
                <num>ii</num>
                <content>
                  <p>applies to take the benefit of any law for the relief of bankrupt or insolvent debtors; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-5__dvs-1__sec-35__subsec-2__para-iii">
                <num>iii</num>
                <content>
                  <p>compounds with his or her creditors or makes an assignment of remuneration to them; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-5__dvs-1__sec-35__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>if <role refersTo="#commissioner">the Commissioner</role> is a full-time Commissioner and is absent from duty, without reasonable excuse, for 14 consecutive days or for 28 days in any 12 month period; or</p>
                </content>
              </paragraph>

                <num>c</num>
                <content>
                  <p>if <role refersTo="#commissioner">the Commissioner</role> is absent, without reasonable excuse, from 3 consecutive meetings of the Commission; or</p>

                <num>d</num>

                  <p>if <role refersTo="#commissioner">the Commissioner</role> fails, without reasonable excuse, to comply with his or her disclosure obligations under section 43; or</p>

                <num>da</num>
                <content>
                  <p>	(da)	if the Commissioner fails, without reasonable excuse, to comply with <i>Public Governance, Performance and Accountability Act 2013</i> (which deals with the duty to disclose interests) or rules made for the purposes of that section; or<ref href="#sec-29">section 29</ref> of the </p>

              </paragraph>

                  <p>if <role refersTo="#commissioner">the Commissioner</role> is a part-time Commissioner who engages in paid employment that, in <role refersTo="#minister">the Minister</role>’s opinion, conflicts with the proper performance of <role refersTo="#commissioner">the Commissioner</role>’s duties.</p>

            </subsection>

                  <p>if the Associate Commissioner fails, without reasonable excuse, to comply with his or her disclosure obligations under <ref href="#sec-43">section 43</ref>; or</p>

              </paragraph>
              <paragraph eId="part-5__dvs-1__sec-35__subsec-4__para-da">
                <num>da</num>
                <content>
                  <p>	(da)	if the Commissioner fails, without reasonable excuse, to comply with <i>Public Governance, Performance and Accountability Act 2013</i> (which deals with the duty to disclose interests) or rules made for the purposes of that section; or<ref href="#sec-29">section 29</ref> of the </p>
                </content>
              </paragraph>

                <num>e</num>

                  <p>if the Associate Commissioner is a full-time Associate Commissioner who engages in paid employment outside the duties of his or her office without <role refersTo="#minister">the Minister</role>’s consent; or</p>

                <num>f</num>

                  <p>if the Associate Commissioner is a part-time Associate Commissioner who engages in paid employment that, in <role refersTo="#minister">the Minister</role>’s opinion, conflicts with the proper performance of the Associate Commissioner’s duties.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-5__dvs-1__sec-35__subsec-5">
              <num>5</num>
              <content>
                <p>A member is not to be removed from office except as provided in this section.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-5__dvs-1__sec-36">
            <num>36</num>
            <heading>Removal taken to be retirement on ground of invalidity</heading>
            <subsection eId="part-5__dvs-1__sec-36__subsec-1">
              <num>1</num>
              <content>
                <p>If a member:</p>
              </content>
              <paragraph eId="part-5__dvs-1__sec-36__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>	(a)	is an eligible employee for the purposes of the <i>Superannuation Act 1976</i>; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-5__dvs-1__sec-36__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>is removed from office under <ref href="#sec-35">section 35</ref> on the ground of physical or mental incapacity;</p>
                </content>
                <content>
                  <p>for the purposes of that Act, he or she is taken to have been retired on the ground of invalidity within the meaning of <ref href="#part-IVA">Part IVA</ref> of that Act on the day on which he or she was removed from office.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-5__dvs-1__sec-36__subsec-2">
              <num>2</num>
              <content>
                <p>	(2)	In spite of subsection (1), <i>Superannuation Act 1976</i> applies in relation to the member.<ref href="#sec-54C">section 54C</ref> of the </p>
              </content>
            </subsection>
            <subsection eId="part-5__dvs-1__sec-36__subsec-3">
              <num>3</num>
              <content>
                <p>If a member:</p>
              </content>
              <paragraph eId="part-5__dvs-1__sec-36__subsec-3__para-a">
                <num>a</num>
                <content>
                  <p>	(a)	is a member of the superannuation scheme established by deed under the <i>Superannuation Act 1990</i>; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-5__dvs-1__sec-36__subsec-3__para-b">
                <num>b</num>
                <content>
                  <p>is removed from office under <ref href="#sec-35">section 35</ref> on the ground of physical or mental incapacity;</p>
                </content>
                <content>
                  <p>for the purposes of that Act, he or she is taken to have been retired on the ground of invalidity within the meaning of that Act on the day on which he or she was removed from office.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-5__dvs-1__sec-36__subsec-4">
              <num>4</num>
              <content>
                <p>	(4)	In spite of subsection (3), <i>Superannuation Act 1990</i> applies in relation to the member.<ref href="#sec-13">section 13</ref> of the </p>
              </content>
            </subsection>
            <subsection eId="part-5__dvs-1__sec-36__subsec-5">
              <num>5</num>
              <content>
                <p>If a member:</p>
              </content>
              <paragraph eId="part-5__dvs-1__sec-36__subsec-5__para-a">
                <num>a</num>
                <content>
                  <p>	(a)	is an ordinary employer-sponsored member of PSSAP, within the meaning of the <i>Superannuation Act 2005</i>; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-5__dvs-1__sec-36__subsec-5__para-b">
                <num>b</num>
                <content>
                  <p>is removed from office under <ref href="#sec-35">section 35</ref> on the ground of physical or mental incapacity;</p>
                </content>
                <content>
                  <p>for the purposes of that Act, he or she is taken to have been retired on the ground of invalidity within the meaning of that Act on the day on which he or she was removed from office.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-5__dvs-1__sec-36__subsec-6">
              <num>6</num>
              <content>
                <p>	(6)	In spite of subsection (5), <i>Superannuation Act 2005 </i>applies in relation to the member.<ref href="#sec-43">section 43</ref> of the </p>
              </content>
            </subsection>
          </section>
          <section eId="part-5__dvs-1__sec-37">
            <num>37</num>
            <heading>Retirement on ground of invalidity under the Superannuation Acts</heading>
            <subsection eId="part-5__dvs-1__sec-37__subsec-1">
              <num>1</num>
              <content>
                <p>In spite of anything contained in sections 34 and 35, a member who:</p>
              </content>
              <paragraph eId="part-5__dvs-1__sec-37__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>	(a)	is an eligible employee for the purposes of the <i>Superannuation Act 1976</i>; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-5__dvs-1__sec-37__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>has not reached his or her maximum retiring age (within the meaning of that Act);</p>
                </content>
                <content>
                  <p>is not capable of being retired from office on the ground of invalidity (within the meaning of <ref href="#part-IVA">Part IVA</ref> of that Act) unless CSC has given a certificate under <ref href="#sec-54C">section 54C</ref> of that Act.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-5__dvs-1__sec-37__subsec-2">
              <num>2</num>
              <content>
                <p>In spite of anything contained in sections 34 and 35, a member who:</p>
              </content>
              <paragraph eId="part-5__dvs-1__sec-37__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>	(a)	is a member of the superannuation scheme established by deed under the <i>Superannuation Act 1990</i>; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-5__dvs-1__sec-37__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>is under 60 years of age;</p>
                </content>
                <content>
                  <p>is not capable of being retired from office on the ground of invalidity (within the meaning of that Act) unless CSC has given a certificate under <ref href="#sec-13">section 13</ref> of that Act.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-5__dvs-1__sec-37__subsec-3">
              <num>3</num>
              <content>
                <p>In spite of anything contained in sections 34 and 35, a member who:</p>
              </content>
              <paragraph eId="part-5__dvs-1__sec-37__subsec-3__para-a">
                <num>a</num>
                <content>
                  <p>	(a)	is an ordinary employer-sponsored member of PSSAP, within the meaning of the <i>Superannuation Act 2005</i>; and</p>
                </content>
              </paragraph>

            <heading>Meetings of Commission</heading>

              <num>1</num>
              <content>
                <p>The Chair is to convene such meetings of the Commission he or she thinks necessary for the efficient performance of the functions of the Commission.</p>
              </content>
            </subsection>
            <subsection eId="part-5__dvs-2__sec-39__subsec-2">
              <num>2</num>
              <content>
                <p>Meetings are to be held at such places as the Chair determines.</p>
              </content>
            </subsection>
            <subsection eId="part-5__dvs-2__sec-39__subsec-3">
              <num>3</num>
              <content>
                <p>The Chair must preside at all meetings.</p>
              </content>
            </subsection>
            <subsection eId="part-5__dvs-2__sec-39__subsec-4">
              <num>4</num>
              <content>
                <p>The Chair may give directions regarding the procedure to be followed at or in connection with a meeting.</p>
              </content>
            </subsection>
            <subsection eId="part-5__dvs-2__sec-39__subsec-5">
              <num>5</num>
              <content>
                <p>At a meeting:</p>
              </content>
              <paragraph eId="part-5__dvs-2__sec-39__subsec-5__para-a">
                <num>a</num>
                <content>
                  <p>the Chair and 3 other Commissioners form a quorum; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-5__dvs-2__sec-39__subsec-5__para-b">
                <num>b</num>
                <content>
                  <p>questions must be decided by a majority of votes of the Commissioners present and voting; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-5__dvs-2__sec-39__subsec-5__para-c">
                <num>c</num>
                <content>
                  <p>the Chair has a deliberative vote and, if necessary, also has a casting vote.</p>
                </content>
              </paragraph>
            </subsection>

                <p>The Chair may permit a person to participate in, or a Commissioner to form a part of a quorum at, a meeting by means of telephone, closed circuit television or any other method of communication.</p>

                <p>A power of the Chair under subsection (1), (2), (4) or (6) must be exercised, so far as practicable, only after consultation with the Commissioners.</p>

                <p>This section has effect subject to sections 40 and 41.</p>

            </subsection>
          </section>
          <section eId="part-5__dvs-2__sec-40">

            <heading>Commission may sit in Divisions</heading>
            <subsection eId="part-5__dvs-2__sec-40__subsec-1">
              <num>1</num>
              <content>
                <p>For the purposes of performing a function of the Commission, the Chair may, by written instrument, establish a Division of the Commission.</p>
              </content>
            </subsection>
            <subsection eId="part-5__dvs-2__sec-40__subsec-2">
              <num>2</num>
              <content>
                <p>The Division is to be constituted by the Chair and any other member or members specified in the instrument.</p>
              </content>
            </subsection>
            <subsection eId="part-5__dvs-2__sec-40__subsec-3">
              <num>3</num>
              <content>
                <p>A Division is taken to be the Commission for the purposes of performing the function specified in the instrument and exercising the powers of the Commission in relation to that function.</p>
              </content>
            </subsection>
            <subsection eId="part-5__dvs-2__sec-40__subsec-4">
              <num>4</num>
              <content>
                <p>Despite subsection 39(3), the Chair is not required to attend a meeting of a Division. If the Chair does not attend, he or she must nominate another member to preside.</p>
              </content>
            </subsection>
            <subsection eId="part-5__dvs-2__sec-40__subsec-5">
              <num>5</num>
              <content>
                <p>The Chair may at any time before the Commission has completed performing the function specified in the instrument, amend the instrument in any respect, and if the constitution of the Division is changed, the Division as constituted after the change may complete the function specified in the instrument.</p>
              </content>
            </subsection>
            <subsection eId="part-5__dvs-2__sec-40__subsec-6">
              <num>6</num>
              <content>
                <p>At a meeting of a Division constituted by 3 or more members, 2 members form a quorum.</p>
              </content>
            </subsection>
            <subsection eId="part-5__dvs-2__sec-40__subsec-7">
              <num>7</num>
              <content>
                <p>A Division of the Commission may exercise powers of the Commission under this Act even if another Division of the Commission is exercising powers of the Commission at the same time.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-5__dvs-2__sec-41">
            <num>41</num>
            <heading>Constitution of Division by one member in exceptional circumstances</heading>
            <subsection eId="part-5__dvs-2__sec-41__subsec-1">
              <num>1</num>
              <content>
                <p>Despite <ref href="#sec-40">section 40</ref>, a Division may be constituted by one member if:</p>
              </content>
              <paragraph eId="part-5__dvs-2__sec-41__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>only one member of a Division is available to attend a hearing; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-5__dvs-2__sec-41__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>the other members of the Division are unavailable to attend the hearing because of accident, illness, injury or other reason beyond their control.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-5__dvs-2__sec-41__subsec-2">
              <num>2</num>
              <content>
                <p>If subsection (1) applies:</p>
              </content>
              <paragraph eId="part-5__dvs-2__sec-41__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>the Division is taken, for the purposes of the hearing, to be constituted by the sole available member until one of the other members becomes available to attend the hearing; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-5__dvs-2__sec-41__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>while the sole available member is taken to constitute the Division, he or she is taken to have been nominated to preside at the meeting of the Division at which the hearing takes place.</p>

          </section>

            <heading>Delegation by Chair</heading>
            <content>
              <p>The Chair may, in writing, delegate all or any of the Chair’s powers and functions under this Act to a member.</p>
            </content>

            <heading>Disclosure of interests</heading>
            <subsection eId="part-5__dvs-2__sec-43__subsec-1">

                <p>The Chair must give written notice to <role refersTo="#minister">the Minister</role> of all direct and indirect pecuniary interests that he or she has or acquires in a business or in a body corporate carrying on a business.</p>
              </content>
            </subsection>
            <subsection eId="part-5__dvs-2__sec-43__subsec-2">
              <num>2</num>
              <content>
                <p>	(2)	Subsection (1) applies in addition to <i>Public Governance, Performance and Accountability Act 2013</i> (which deals with the duty to disclose interests).<ref href="#sec-29">section 29</ref> of the </p>

                <p>If:</p>

                  <p>	(a)	the Chair has or acquires an interest of the kind mentioned in <i>Public Governance, Performance and Accountability Act 2013</i>; and<ref href="#sec-29">section 29</ref> of the </p>

                <num>b</num>
                <content>
                  <p>the interest relates to affairs of the Commission the conducting of which results in a report or similar document;</p>

                  <p>the Chair must ensure that the interest is disclosed in the report or document.</p>

            </subsection>

              <num>4</num>

                <p>	(4)	If the Chair becomes aware that a member has an interest of the kind mentioned in <i>Public Governance, Performance and Accountability Act 2013</i>, the Chair must do one of the following:<ref href="#sec-29">section 29</ref> of the </p>

                  <p>if paragraph (a) does not apply, the Chair must ensure that:</p>

        <heading>Staff and consultants</heading>

          <heading>Staff</heading>
          <subsection eId="part-6__sec-44__subsec-1">
            <num>1</num>
            <content>
              <p>	(1)	Subject to <i>Public Service Act 1999</i>.<ref href="#sec-45">section 45</ref>, the staff of the Commission are to be engaged under the </p>
            </content>
          </subsection>
          <subsection eId="part-6__sec-44__subsec-2">
            <num>2</num>
            <content>
              <p>	(2)	For the purposes of the <i>Public Service Act 1999</i>:</p>
            </content>
            <paragraph eId="part-6__sec-44__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>the Chair and the APS employees assisting the Chair together constitute a Statutory Agency; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-44__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>the Chair is the Head of that Statutory Agency.</p>
              </content>
            </paragraph>
          </subsection>
        </section>
        <section eId="part-6__sec-45">
          <num>45</num>
          <heading>Consultants</heading>
          <subsection eId="part-6__sec-45__subsec-1">
            <num>1</num>
            <content>
              <p>The Chair may, on behalf of the Commonwealth, engage as consultants to the Commission persons who have suitable qualifications and experience.</p>
            </content>
          </subsection>
          <subsection eId="part-6__sec-45__subsec-2">
            <num>2</num>
            <content>
              <p>In selecting consultants and in its annual reporting on the engagement of consultants, the Commission must follow the Commonwealth’s best practice standards.</p>
            </content>
          </subsection>
          <subsection eId="part-6__sec-45__subsec-3">
            <num>3</num>
            <content>
              <p>The Chair must ensure that the Commonwealth’s best practice standards are used in selecting consultants and in public reporting on their engagement.</p>
            </content>
          </subsection>
          <subsection eId="part-6__sec-45__subsec-4">
            <num>4</num>
            <content>
              <p>If the estimated value of a consultancy exceeds the amount prescribed by the regulations, the Chair must ensure that an open, competitive tendering process is used in selecting the consultant or consultants.</p>
            </content>
          </subsection>
          <subsection eId="part-6__sec-45__subsec-5">
            <num>5</num>
            <content>
              <p>A consultant may be engaged either under a contract for services or a contract of service.</p>
            </content>
          </subsection>
          <subsection eId="part-6__sec-45__subsec-6">
            <num>6</num>
            <content>
              <p>Subject to any commitments under any award or employment agreement, the Chair may determine the terms and conditions on which a consultant is engaged.</p>
            </content>
          </subsection>
        </section>
      </part>

        <heading>Offences etc.</heading>

          <heading>Hindering or disrupting Commission</heading>
          <content>
            <p>A person must not:</p>
          </content>

            <num>a</num>
            <content>
              <p>	(a)	obstruct or hinder a member of the Commission<i> </i>in the performance of the Commission’s functions; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-7__sec-46__para-b">
            <num>b</num>
            <content>
              <p>disrupt a hearing before the Commission.</p>
            </content>

              <p>cause or procure damage, loss or disadvantage to another person;</p>

              <p>because that other person:</p>
            </content>
          </paragraph>

              <p>proposes to give, or has given, information or documents to the Commission; or</p>
            </content>
          </paragraph>

              <p>proposes to give evidence, or has given evidence, at a hearing held for the purposes of an inquiry; or</p>
            </content>
          </paragraph>

              <p>A person served with a summons to appear at a hearing must not intentionally:</p>
            </content>

                <p>fail to attend as required by the summons; or</p>

              <p>Subject to subsection (2), a person who would, apart from this subsection, be required to:</p>

                <p>send a statement or document to the Commission under <ref href="#sec-48">section 48</ref>; or</p>
              </content>
            </paragraph>

                <p>answer a question or produce a document under <ref href="#sec-50">section 50</ref>;</p>

                <p>need not comply with that requirement if so complying would:</p>

                <p>tend to incriminate the person; or</p>

              <p>Subsection (1) does not apply, and the person must comply with the requirement, if the person has waived his or her rights under that subsection.</p>

          </subsection>
        </section>
        <section eId="part-7__sec-52">
          <num>52</num>
          <heading>False or misleading evidence or information</heading>
          <content>
            <p>If the Commission is:</p>
          </content>
          <paragraph eId="part-7__sec-52__para-a">
            <num>a</num>
            <content>
              <p>required to hold hearings for the purposes of an inquiry; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-7__sec-52__para-b">
            <num>b</num>
            <content>
              <p>holding an inquiry under <ref href="#sec-11">section 11</ref> in relation to a competitive neutrality complaint made under <ref href="#dvs-2">Division 2</ref> of <ref href="#part-4">Part 4</ref>;</p>
            </content>
            <content>
              <p>a person must not, in relation to the inquiry:</p>
            </content>
          </paragraph>

              <p>give information to the Commission, whether orally or in writing, that the person knows to be false or misleading in a material particular; or</p>

              <p>give evidence at a hearing before the Commission that the person knows to be false or misleading in a material particular; or</p>

              <p>send to the Commission, under <ref href="#sec-48">section 48</ref>, a statement or document containing material that the person knows to be false or misleading in a material particular.</p>

              <p>If the Commission directs that a hearing, or part of it, take place in private, the Commission may give directions prohibiting or restricting the publication of:</p>

                <p>evidence given before the hearing (including evidence given prior to a direction that part of the hearing take place in private); or</p>

                <p>matters contained in documents given to the Commission in connection with the hearing.</p>

          <heading>Documents produced in relation to inquiry</heading>

            <p>If documents are produced or given to the Commission under this Part, the Commission:</p>
          </content>
          <paragraph eId="part-7__sec-54__para-a">
            <num>a</num>
            <content>
              <p>may take possession of, and make copies of, or take extracts from, the documents; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-7__sec-54__para-b">
            <num>b</num>
            <content>
              <p>may keep possession of the documents for so long as is necessary for the purposes of the inquiry to which they relate; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-7__sec-54__para-c">
            <num>c</num>
            <content>
              <p>while it has possession of the documents, must permit them to be inspected at all reasonable times by people who would be entitled to inspect them if they were not in the possession of the Commission.</p>
            </content>
          </paragraph>
        </section>
        <section eId="part-7__sec-55">
          <num>55</num>
          <heading>Allowances to witnesses</heading>
          <content>
            <p>A person who attends a hearing of the Commission under a summons served under <ref href="#sec-49">section 49</ref> is entitled to be paid by the Commonwealth such allowances and expenses as are prescribed.</p>
          </content>
        </section>
        <section eId="part-7__sec-56">
          <num>56</num>
          <heading>Limitation of powers under this Part</heading>
          <subsection eId="part-7__sec-56__subsec-1">
            <num>1</num>
            <content>
              <p>The powers under sections 48 and 49, paragraph 50(a) and sections 53 and 54 may be exercised only as provided in this section.</p>
            </content>
          </subsection>
          <subsection eId="part-7__sec-56__subsec-2">
            <num>2</num>
            <content>
              <p>The powers may be exercised in relation to:</p>
            </content>
            <paragraph eId="part-7__sec-56__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>a person holding, or performing the duties of, an office or appointment under a law of the Commonwealth or of a Territory; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-56__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>a Commonwealth authority.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-7__sec-56__subsec-3">
            <num>3</num>
            <content>
              <p>The powers may also be exercised in relation to any person for the purposes of an inquiry to the extent that the subject matter of the inquiry relates to a subject of Commonwealth power.</p>
            </content>
          </subsection>
          <subsection eId="part-7__sec-56__subsec-4">
            <num>4</num>
            <content>
              <p>Subsection (3) does not enable a power to be exercised to the extent that it would impair the capacity of a State to exercise its constitutional powers.</p>

        <heading>Miscellaneous</heading>
        <section eId="part-8__sec-57">
          <num>57</num>
          <heading>Protection from civil actions</heading>
          <subsection eId="part-8__sec-57__subsec-1">
            <num>1</num>
            <content>
              <p>Civil proceedings may not be brought against a member, or a person acting under the direction or authority of a member, in relation to loss, damage or injury of any kind suffered by a person in the course of the proper performance or exercise of the Commission’s functions or powers.</p>
            </content>
          </subsection>
          <subsection eId="part-8__sec-57__subsec-2">
            <num>2</num>
            <content>
              <p>Civil proceedings may not be brought against a person in relation to loss, damage or injury of any kind suffered by another person because the first-mentioned person:</p>

              <content>
                <p>made a statement or submission; or</p>
              </content>
            </paragraph>

                <p>in good faith to the Commission in the course of the proper performance or exercise of the Commission’s functions or powers.</p>

          <heading>Charges for services</heading>
          <content>
            <p><i>	</i><i>	</i>The Commission may, on behalf of the Commonwealth, charge fees in relation to services provided by it in the course of performing functions referred to in paragraphs 6(1)(f), (g) and (h).</p>
          </content>
        </section>
        <section eId="part-8__sec-59">
          <num>59</num>
          <heading>Conduct by directors, employees or agents</heading>
          <subsection eId="part-8__sec-59__subsec-1">
            <num>1</num>
            <content>
              <p>If, in proceedings for an offence against this Act in respect of conduct engaged in by a body corporate, it is necessary to establish a state of mind of the body corporate, it is sufficient to show:</p>
            </content>
            <paragraph eId="part-8__sec-59__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>that the conduct was engaged in by a director, employee or agent of the body corporate within the scope of his or her actual or apparent authority; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-8__sec-59__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>that the director, employee or agent had that state of mind.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-8__sec-59__subsec-2">
            <num>2</num>
            <content>
              <p>If:</p>
            </content>
            <paragraph eId="part-8__sec-59__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>conduct is engaged in on behalf of a body corporate by a director, employee or agent of the body corporate; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-8__sec-59__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>the conduct is within the scope of his or her actual or apparent authority;</p>
              </content>
              <content>
                <p>the conduct is taken, for the purposes of this Act, to have been engaged in also by the body corporate unless the body corporate establishes that it took reasonable precautions and exercised due diligence to avoid the conduct.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-8__sec-59__subsec-3">
            <num>3</num>
            <content>
              <p>If, in proceedings for an offence against this Act in respect of conduct engaged in by a person other than a body corporate, it is necessary to establish a state of mind of the person, it is sufficient to show:</p>
            </content>
            <paragraph eId="part-8__sec-59__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>that the conduct was engaged in by an employee or agent of the person within the scope of the employee’s or agent’s actual or apparent authority; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-8__sec-59__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>that the employee or agent had that state of mind.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-8__sec-59__subsec-4">
            <num>4</num>
            <content>
              <p>If:</p>
            </content>
            <paragraph eId="part-8__sec-59__subsec-4__para-a">
              <num>a</num>
              <content>
                <p>conduct is engaged in on behalf of a person other than a body corporate by an employee or an agent of the person; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-8__sec-59__subsec-4__para-b">
              <num>b</num>
              <content>
                <p>the conduct is within the employee’s or agent’s actual or apparent authority;</p>
              </content>
              <content>
                <p>the conduct is taken, for the purposes of this Act, to have been engaged in also by the person unless the person establishes that he or she took reasonable precautions and exercised due diligence to avoid the conduct.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-8__sec-59__subsec-5">
            <num>5</num>
            <content>
              <p>A reference in subsection (1) to a state of mind of a person includes a reference to the knowledge, intention, opinion, belief or purpose of the person and the person’s reasons for the intention, opinion, belief or purpose.</p>

            <num>6</num>
            <content>
              <p>A reference in this section to a director of a body corporate includes a reference to a constituent member of a body corporate incorporated for a public purpose by a law of the Commonwealth or of a State or Territory.</p>
