            <p>		These Regulations are the <i>Family Law (Hague Convention on Intercountry Adoption) </i><i>Regulations 1</i><i>998</i>.</p>
          </content>
        </section>

          <heading>Authority</heading>
          <content>
            <p>		These Regulations are made under the <i>Family Law Act 1975</i>.</p>
          </content>
        </section>

          <num>3</num>
          <heading>Definitions</heading>

              <p>Note:	A number of expressions used in these Regulations are defined in the Act, including the following:</p>

          <subsection eId="part-1__sec-3__subsec-1">
            <num>1</num>
            <content>
              <p>In these Regulations:</p>
            </content>
            <content>
              <p><term refersTo="#term-accredited-body">accredited body</term> means <def>a body accredited, under the laws of a State and in accordance with the Commonwealth-State agreement, as an accredited body for the Convention.</def></p>
              <p><term refersTo="#term-act">Act</term> means <def><ref href="">the Family Law Act 1975</ref>.</def></p>
              <p><term refersTo="#term-adoption-compliance-certificate">adoption compliance certificate</term> means <def>a certificate issued in accordance with article 23 of the Convention.</def></p>
              <p><term refersTo="#term-bureau">Bureau</term> means <def>the Permanent Bureau of the Hague Conference on Private International Law.</def></p>
              <p><term refersTo="#term-central-authority">Central Authority</term> means <def>a person or office designated for a Convention country under article 6 of the Convention.</def></p>
              <p><term refersTo="#term-child">child</term> means <def>an individual who is under 18 years.</def></p>
              <p><term refersTo="#term-commonwealth-central-authority">Commonwealth Central Authority</term> has the meaning given by <def>regulation 5.</def></p>
              <p><term refersTo="#term-commonwealth-state-agreement">Commonwealth-State agreement</term> means <def>the “Commonwealth-State agreement for the implementation of the Hague Convention on Protection of Children and Cooperation in Respect of Intercountry Adoption”: made between the Commonwealth and the States and Territories; and that commenced operation on <date date="1998-04-09">9 April 1998</date>.</def></p>

              <num>a</num>
              <content>
                <p>made between the Commonwealth and the States and Territories; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>that commenced operation on <date date="1998-04-09">9 April 1998</date>.</p>
              </content>
              <content>
                <p><term refersTo="#term-convention">Convention</term> means <def>the Convention on Protection of Children and Cooperation in Respect of Intercountry Adoption: mentioned in subsection 111C(1) of the Act; and a copy of the English text of which is set out in Schedule 1.</def></p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>mentioned in subsection 111C(1) of the Act; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>a copy of the English text of which is set out in Schedule 1.</p>
              </content>
              <content>
                <p><term refersTo="#term-convention-country">Convention country</term> has the meaning given by <def>regulation 4.</def></p>
                <p><b><i>parental responsibility</i></b>, in relation to a child, has the same meaning as in section 61B of the Act.</p>
                <p><term refersTo="#term-receiving-state">receiving State</term> has the same meaning as <def>in article 2 of the Convention.</def></p>
                <p><term refersTo="#term-state">State</term> includes <def>Territory.</def></p>
                <p><term refersTo="#term-state-central-authority">State Central Authority</term> has the meaning given by <def>regulation 8.</def></p>
                <p><term refersTo="#term-state-of-origin">State of origin</term> has the same meaning as <def>in article 2 of the Convention.</def></p>
                <p><term refersTo="#term-working-day">working day</term> means <def>a day that is not a Saturday, Sunday or public holiday.</def></p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-1__sec-3__subsec-2">
            <num>2</num>
            <content>
              <p>A reference in these Regulations to a form by number is a reference to the form so numbered in Schedule 3.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-1__sec-3A">
          <num>3A</num>
          <heading>Headings of certain documents</heading>
          <content>
            <p>A document to be filed in, or issued out of, a court in proceedings that is in a form set out in Schedule 3:</p>
          </content>
          <paragraph eId="part-1__sec-3A__para-a">
            <num>a</num>
            <content>
              <p>must be headed in accordance with Form 1; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3A__para-b">
            <num>b</num>
            <content>
              <p>may identify the proceedings in accordance with the rules of the court.</p>
            </content>
          </paragraph>
        </section>
        <section eId="part-1__sec-4">
          <num>4</num>
          <heading>Convention countries</heading>
          <content>
            <p>	<b>	</b>Subject to article 45 of the Convention, each of the following countries is a Convention country:</p>
          </content>
          <paragraph eId="part-1__sec-4__para-a">
            <num>a</num>
            <content>
              <p>a country mentioned in Schedule 2, on and from the date mentioned in relation to the country;</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-b">
            <num>b</num>
            <content>
              <p>any other country for which the Convention has entered into force, other than:</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-i">
            <num>i</num>
            <content>
              <p>Australia; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-ii">
            <num>ii</num>
            <content>
              <p>a country against whose accession Australia has raised an objection under article 44 of the Convention.</p>
            </content>
          </paragraph>
        </section>
      </part>
      <part eId="part-2">
        <num>2</num>
        <heading>Commonwealth and State Central Authorities</heading>
        <section eId="part-2__sec-5">
          <num>5</num>
          <heading>Commonwealth Central Authority</heading>
          <content>
            <p>For article 6 of the Convention, <role refersTo="#secretary">the Secretary</role> to the Department is designated:</p>
          </content>
          <paragraph eId="part-2__sec-5__para-a">
            <num>a</num>
            <content>
              <p>the Commonwealth Central Authority; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-5__para-b">
            <num>b</num>
            <content>
              <p>the Central Authority to which communication from a country other than Australia may be addressed.</p>
            </content>
          </paragraph>
        </section>
        <section eId="part-2__sec-6">
          <num>6</num>
          <heading>Functions etc of Commonwealth Central Authority</heading>
          <subsection eId="part-2__sec-6__subsec-1">
            <num>1</num>
            <content>
              <p>The functions of the Commonwealth Central Authority are to do, or to coordinate the doing of, anything that is necessary:</p>
            </content>
            <paragraph eId="part-2__sec-6__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>to enable the performance of Australia’s obligations under the Convention; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-6__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>to obtain for Australia any advantage or benefit under the Convention.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-6__subsec-2">
            <num>2</num>
            <content>
              <p>	(2)<b>	</b>For subregulation (1), the functions of the Commonwealth Central Authority include the following:</p>
            </content>
            <paragraph eId="part-2__sec-6__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>cooperating with Central Authorities outside Australia on matters relating to the administration and implementation of the Convention;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-6__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>consulting State Central Authorities to get information for determining whether Australia is meeting its obligations under the Convention;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-6__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>to the extent that the legislation and administrative practices of States do not ensure that Australia meets its obligations under the Convention—preparing legislation to ensure that Australia meets those obligations;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-6__subsec-2__para-d">
              <num>d</num>
              <content>
                <p>receiving advice from a State Central Authority that a provision of the Convention has not been respected in the State, and ensuring with the State Central Authority that appropriate measures are taken to ensure compliance with the provision;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-6__subsec-2__para-e">
              <num>e</num>
              <content>
                <p>receiving advice from a State Central Authority that there is a serious risk that a provision of the Convention may not be respected in the State, and ensuring with the State Central Authority that appropriate measures are taken to ensure compliance with the provision;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-6__subsec-2__para-f">
              <num>f</num>
              <content>
                <p>consulting State Central Authorities on matters relating to intercountry adoption.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-6__subsec-3">
            <num>3</num>
            <content>
              <p>However, the functions of the Commonwealth Central Authority do not include the following:</p>
            </content>
            <paragraph eId="part-2__sec-6__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>processing the day-to-day casework involved in a particular adoption;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-6__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>approving an application for the adoption of a child;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-6__subsec-3__para-c">
              <num>c</num>
              <content>
                <p>giving consent to the adoption of a child;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-6__subsec-3__para-d">
              <num>d</num>
              <content>
                <p>a function reserved, under the Commonwealth-State agreement, for a State or State Central Authority;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-6__subsec-3__para-e">
              <num>e</num>
              <content>
                <p>accrediting a body for the Convention.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-6__subsec-4">
            <num>4</num>
            <content>
              <p>The functions of the Commonwealth Central Authority under this regulation are additional to its other functions under these Regulations.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-6__subsec-5">
            <num>5</num>
            <content>
              <p>Subject to subregulation (3), the Commonwealth Central Authority:</p>
            </content>
            <paragraph eId="part-2__sec-6__subsec-5__para-a">
              <num>a</num>
              <content>
                <p>has all of the duties of a Central Authority under the Convention; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-6__subsec-5__para-b">
              <num>b</num>
              <content>
                <p>may exercise all of the powers of a Central Authority under the Convention.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-6__subsec-6">
            <num>6</num>
            <content>
              <p>	(6)	If the exercise by the Commonwealth Central Authority of one of its functions (the <b><i>Commonwealth function</i></b>) would affect the exercise of a function of a State Central Authority, the Commonwealth Central Authority must consult the State Central Authority about the exercise of the Commonwealth function before it is exercised.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-2__sec-7">
          <num>7</num>
          <heading>Notice of designation of Commonwealth Central Authority</heading>
          <subsection eId="part-2__sec-7__subsec-1">
            <num>1</num>
            <content>
              <p>As soon as practicable after the commencement of these Regulations, the Commonwealth Central Authority must tell the Bureau, in writing, the Commonwealth Central Authority’s name, address and functions.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-7__subsec-2">
            <num>2</num>
            <content>
              <p>As soon as practicable after a change to the name, address or functions of the Commonwealth Central Authority, the Commonwealth Central Authority must tell the Bureau, in writing, about the change.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-2__sec-8">
          <num>8</num>
          <heading>State Central Authorities</heading>
          <subsection eId="part-2__sec-8__subsec-1">
            <num>1</num>
            <content>
              <p>	(1)<b>	</b>The State Central Authority for a State is the person:</p>
            </content>
            <paragraph eId="part-2__sec-8__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>so designated by the State (if it has the capacity to do so) and notified to the Commonwealth Central Authority under subregulation 10(1); or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>if a person is not designated under paragraph (a)—so designated by the Commonwealth, under regulation 9.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-8__subsec-2">
            <num>2</num>
            <content>
              <p>A State Central Authority designated under regulation 9 ceases to be a State Central Authority under that regulation if the State concerned:</p>
            </content>
            <paragraph eId="part-2__sec-8__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>designates a State Central Authority for the State; and</p>
              </content>
            </paragraph>

              <p>The Attorney-General of the Commonwealth may designate a person, in writing, as State Central Authority of a State for these Regulations.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-9__subsec-2">
            <num>2</num>
            <content>
              <p>A person designated must be:</p>
            </content>
            <paragraph eId="part-2__sec-9__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>the State Minister administering the laws of that State relating to adoptions; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-9__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>a person holding, or for the time being performing the duties of, the office, in the department or service responsible for the administration of adoptions in the State, that supervises the conduct of those adoptions.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-9__subsec-3">
            <num>3</num>
            <content>
              <p>A designation may be expressed to have effect only in the circumstances mentioned in the instrument of designation.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-9__subsec-4">

              <p>	(4)	As soon as practicable after the Attorney-General designates a State Central Authority, the Attorney-General must publish a notice of the designation in the <i>Gazette</i>.</p>

              <p>	(5)	In this regulation, <b><i>State Minister</i></b> means:</p>

          <heading>Notice of designation of State Central Authority</heading>

              <p>As soon as practicable after a State designates a State Central Authority, the State must tell the Commonwealth Central Authority, in writing, the name, address and functions of the State Central Authority.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-10__subsec-2">
            <num>2</num>
            <content>
              <p>As soon as practicable after a change to the name, address or functions of a State Central Authority, the State concerned must tell the Commonwealth Central Authority, in writing, about the change.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-10__subsec-3">
            <num>3</num>
            <content>
              <p>As soon as practicable after the Commonwealth Central Authority is given information under subregulation (1) or (2), it must give the Bureau the information, in writing.</p>
            </content>
          </subsection>

              <p>	(4)	As soon as practicable after the Commonwealth Central Authority is told about a designation under subregulation (1), it must also publish a notice of the designation in the <i>Gazette</i>.</p>

        <heading>Accredited bodies</heading>

          <num>12</num>
          <heading>Notice of accreditation</heading>
          <subsection eId="part-3__sec-12__subsec-1">
            <num>1</num>
            <content>
              <p>As soon as practicable after a State Central Authority accredits a body, the State Central Authority must tell the Commonwealth Central Authority, in writing:</p>
            </content>
            <paragraph eId="part-3__sec-12__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>the name, address, duties and powers of the accredited body; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-12__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>the conditions of the accreditation.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-3__sec-12__subsec-2">
            <num>2</num>
            <content>
              <p>As soon as practicable after a change to the name, address, duties or powers of an accredited body, the State Central Authority that accredited the body must tell the Commonwealth Central Authority, in writing, about the change.</p>
            </content>
          </subsection>

              <p>As soon as practicable after a change to the conditions of an accreditation, the State Central Authority that accredited the body must tell the Commonwealth Central Authority, in writing, about the change.</p>

            <content>
              <p>As soon as practicable after the Commonwealth Central Authority is given information under subregulation (1), (2) or (3), it must give the Bureau the information, in writing.</p>

            <content>
              <p>	(5)	As soon as practicable after the Commonwealth Central Authority is told about an accreditation, it must also publish a notice of the accreditation in the <i>Gazette</i>.</p>

              <p>As soon as practicable after a State Central Authority revokes the accreditation of a body, the State Central Authority must tell the Commonwealth Central Authority, in writing, about the revocation.</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-13__subsec-2">
            <num>2</num>
            <content>
              <p>As soon as practicable after the Commonwealth Central Authority is given information under subregulation (1):</p>
            </content>
            <paragraph eId="part-3__sec-13__subsec-2__para-a">

                <p>it must give the Bureau the information, in writing; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-13__subsec-2__para-b">

        <heading>Court orders and recognition of adoption</heading>

          <num>14</num>
          <heading>Adoption of Australian child into a Convention country</heading>
          <subsection eId="part-4__sec-14__subsec-1">
            <num>1</num>
            <content>
              <p>This regulation applies if arrangements for the adoption of a child, who is habitually resident in Australia, by a person who is, or persons who are, habitually resident in a Convention country, are made in accordance with:</p>
            </content>
            <paragraph eId="part-4__sec-14__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>the Convention; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-14__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>the laws of the Commonwealth and the State in which the child is habitually resident; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-14__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>the laws of the Convention country.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-4__sec-14__subsec-2">
            <num>2</num>
            <content>
              <p>The person or persons proposing to adopt the child must apply to a court for an order that the child be adopted by the person or persons.</p>
            </content>
          </subsection>
          <subsection eId="part-4__sec-14__subsec-2A">
            <num>2A</num>
            <content>
              <p>The application must:</p>
            </content>
            <paragraph eId="part-4__sec-14__subsec-2A__para-a">
              <num>a</num>
              <content>
                <p>be in accordance with Form 3; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-14__subsec-2A__para-b">
              <num>b</num>
              <content>
                <p>include an affidavit in accordance with Form 2.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-4__sec-14__subsec-2B">
            <num>2B</num>
            <content>
              <p>At the same time as the application is made, the applicant, or applicants, must give a copy of the application to the State Central Authority for the State where the child who is the subject of the application habitually resides.</p>
            </content>
          </subsection>
          <subsection eId="part-4__sec-14__subsec-2C">
            <num>2C</num>
            <content>
              <p>As soon as practicable, the State Central Authority must give notice, in accordance with Form 4, of the application to any person of whom <role refersTo="#authority">the Authority</role> is aware as having an interest in whether the application is granted.</p>
            </content>
          </subsection>
          <subsection eId="part-4__sec-14__subsec-2D">
            <num>2D</num>
            <content>
              <p>A person to whom the notice is given:</p>
            </content>
            <paragraph eId="part-4__sec-14__subsec-2D__para-a">
              <num>a</num>
              <content>
                <p>no later than 5 working days before the court hearing, may file with the court a statement in accordance with Form 5 that sets out briefly the matters on which the person wishes to rely in support of the court making an order other than the order sought in the application; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-14__subsec-2D__para-b">
              <num>b</num>
              <content>
                <p>must include with that statement an affidavit in accordance with Form 2.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-4__sec-14__subsec-2E">
            <num>2E</num>
            <content>
              <p>As soon as practicable before the court hearing, the applicant, or applicants, may file with the court a reply to a statement filed under subregulation (2D), being a reply that:</p>
            </content>
            <paragraph eId="part-4__sec-14__subsec-2E__para-a">
              <num>a</num>
              <content>
                <p>is in accordance with Form 6; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-14__subsec-2E__para-b">
              <num>b</num>
              <content>
                <p>includes an affidavit in accordance with Form 2.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-4__sec-14__subsec-2F">
            <num>2F</num>
            <content>
              <p>An order made by the court must be in accordance with Form 7.</p>
            </content>
          </subsection>
          <subsection eId="part-4__sec-14__subsec-3">
            <num>3</num>
            <content>
              <p>The court may make the order only if it is satisfied that:</p>
            </content>
            <paragraph eId="part-4__sec-14__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>the Central Authority of the Convention country has agreed to the adoption of the child; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-14__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>the State Central Authority of the State in which the child habitually resides has agreed to the adoption of the child; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-14__subsec-3__para-c">
              <num>c</num>
              <content>
                <p>the adoption is in the best interests of the child.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-4__sec-14__subsec-4">
            <num>4</num>
            <content>
              <p>However, the court must not make the order if:</p>
            </content>
            <paragraph eId="part-4__sec-14__subsec-4__para-a">
              <num>a</num>
              <content>
                <p>the child is not in Australia; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-14__subsec-4__para-b">
              <num>b</num>
              <content>
                <p>the child is not allowed to leave Australia:</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-14__subsec-4__para-i">
              <num>i</num>
              <content>
                <p>under a law of the Commonwealth or a State; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-14__subsec-4__para-ii">
              <num>ii</num>
              <content>
                <p>because of an order of a court of the Commonwealth or a State.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-4__sec-14__subsec-5">
            <num>5</num>
            <content>
              <p>The best interests of a child must be determined in accordance with <ref href="#sec-68F">section 68F</ref> of the Act.</p>
            </content>

          <num>15</num>
          <heading>Adoption in Australia of a child from a Convention country</heading>
          <subsection eId="part-4__sec-15__subsec-1">
            <num>1</num>
            <content>
              <p>This regulation applies in relation to an adoption that is to be granted in Australia, of a child who is habitually resident in a Convention country, by a person who is, or persons who are, habitually resident in Australia, if arrangements for the adoption are made in accordance with:</p>
            </content>
            <paragraph eId="part-4__sec-15__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>the Convention; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-15__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>the laws of the Commonwealth and the State of habitual residence of the person or persons proposing to adopt the child; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-15__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>the laws of the Convention country.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-4__sec-15__subsec-2">
            <num>2</num>
            <content>
              <p>The person or persons proposing to adopt the child must apply to a court for an order that the child be adopted by the person or persons.</p>
            </content>
          </subsection>
          <subsection eId="part-4__sec-15__subsec-2A">
            <num>2A</num>
            <content>
              <p>The application must:</p>
            </content>
            <paragraph eId="part-4__sec-15__subsec-2A__para-a">
              <num>a</num>
              <content>
                <p>be in accordance with Form 3; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-15__subsec-2A__para-b">
              <num>b</num>
              <content>
                <p>include an affidavit in accordance with Form 2.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-4__sec-15__subsec-2B">
            <num>2B</num>
            <content>
              <p>At the same time as the application is made, the applicant, or applicants, must give a copy of the application to the State Central Authority for the State:</p>
            </content>
            <paragraph eId="part-4__sec-15__subsec-2B__para-a">
              <num>a</num>
              <content>
                <p>if the application is made by 1 applicant—where the applicant habitually resides; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-15__subsec-2B__para-b">
              <num>b</num>
              <content>
                <p>if the application is made by more than 1 applicant—where the applicants habitually reside.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-4__sec-15__subsec-2C">
            <num>2C</num>
            <content>
              <p>The State Central Authority:</p>
            </content>
            <paragraph eId="part-4__sec-15__subsec-2C__para-a">
              <num>a</num>
              <content>
                <p>no later than 5 working days before the court hearing, may file with the court a statement in accordance with Form 5 that sets out briefly the matters on which <role refersTo="#authority">the Authority</role> wishes to rely in support of the court making an order other than the order sought in the application; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-15__subsec-2C__para-b">
              <num>b</num>
              <content>
                <p>must include with that statement an affidavit in accordance with Form 2.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-4__sec-15__subsec-2D">

            <content>
              <p>As soon as practicable before the court hearing, the applicant, or applicants, may file with the court a reply to a statement filed under subregulation (2C), being a reply that:</p>
            </content>
            <paragraph eId="part-4__sec-15__subsec-2D__para-a">
              <num>a</num>
              <content>
                <p>is in accordance with Form 6; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-15__subsec-2D__para-b">
              <num>b</num>
              <content>
                <p>includes an affidavit in accordance with Form 2.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-4__sec-15__subsec-2E">
            <num>2E</num>
            <content>
              <p>An order made by the court must be in accordance with Form 8.</p>
            </content>
          </subsection>
          <subsection eId="part-4__sec-15__subsec-3">
            <num>3</num>
            <content>
              <p>The court may make the order only if it is satisfied that:</p>
            </content>
            <paragraph eId="part-4__sec-15__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>the Central Authority of the Convention country has agreed to the adoption of the child; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-15__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>the State Central Authority of the State in which the applicant or applicants habitually reside has agreed to the adoption of the child; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-15__subsec-3__para-c">
              <num>c</num>
              <content>
                <p>the child is allowed to reside permanently in Australia.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-4__sec-15__subsec-4">
            <num>4</num>
            <content>
              <p>However, the court must not make the order if the child is not in Australia.</p>
            </content>
          </subsection>
          <subsection eId="part-4__sec-15__subsec-5">
            <num>5</num>
            <content>
              <p>For paragraph (3)(c), a child is not allowed to reside permanently in Australia if the child is affected by a law of the Commonwealth, or of a State, or by an order of a Commonwealth or State court, the effect of which is to prevent the child from so residing.</p>

          <num>16</num>
          <heading>Adoption of a child from a Convention country to Australia</heading>
          <subsection eId="part-4__sec-16__subsec-1">
            <num>1</num>
            <content>
              <p>	(1)<b>	</b>This regulation applies if:</p>
            </content>
            <paragraph eId="part-4__sec-16__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>an adoption, by a person who is habitually resident in Australia, of a child who is habitually resident in a Convention country is granted in that country; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-16__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>an adoption compliance certificate issued in that country is in force for the adoption.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-4__sec-16__subsec-2">
            <num>2</num>
            <content>
              <p>Subject to regulation 22, the adoption is recognised and effective, for the laws of the Commonwealth and each State, on and from the day the certificate becomes effective.</p>
            </content>

        </section>
        <section eId="part-4__sec-17">
          <num>17</num>
          <heading>Adoption of a child from a Convention country to another Convention country</heading>
          <subsection eId="part-4__sec-17__subsec-1">
            <num>1</num>
            <content>
              <p>	(1)<b>	</b>This regulation applies if:</p>
            </content>
            <paragraph eId="part-4__sec-17__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>a child, who is habitually resident in a Convention country, is adopted by a person who is habitually resident in another Convention country; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-17__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>an adoption compliance certificate issued in the Convention country in which the adoption is granted is in force for the adoption.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-4__sec-17__subsec-2">
            <num>2</num>
            <content>
              <p>Subject to regulation 22, the adoption is recognised and effective, for the laws of the Commonwealth and each State, on and from the day the certificate becomes effective.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-4__sec-18">
          <num>18</num>
          <heading>Effect of recognition of an adoption</heading>
          <content>
            <p>Recognition of the adoption of a child includes, for the laws of the Commonwealth and each State, recognition that under those laws:</p>
          </content>
          <paragraph eId="part-4__sec-18__para-a">
            <num>a</num>
            <content>
              <p>the relationship between the child and each of the child’s adoptive parents is the relationship of child and parent; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-4__sec-18__para-b">
            <num>b</num>
            <content>
              <p>each adoptive parent of the child has parental responsibility for the child; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-4__sec-18__para-c">
            <num>c</num>
            <content>
              <p><b>	</b>(c)<b>	</b>if the laws of the Convention country where the adoption was granted provide that the adoption of the child terminates the legal relationship between the child and the individuals who were, immediately before the adoption, the child’s parents—the relationship is terminated; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-4__sec-18__para-d">
            <num>d</num>
            <content>
              <p>the child has the same rights as a child who is adopted under the laws of a State.</p>
            </content>
          </paragraph>
        </section>
        <section eId="part-4__sec-19">

          <heading>Evidential value of adoption compliance certificate</heading>
          <content>
            <p>Subject to regulation 22, an adoption compliance certificate is evidence, for the laws of the Commonwealth and each State, that the adoption to which the certificate relates:</p>
          </content>
          <paragraph eId="part-4__sec-19__para-a">
            <num>a</num>
            <content>
              <p>was agreed to by the Central Authorities of the countries mentioned in the certificate; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-4__sec-19__para-b">
            <num>b</num>
            <content>
              <p>was carried out in accordance with the Convention and the laws of the countries mentioned in the certificate.</p>
            </content>
          </paragraph>
        </section>
        <section eId="part-4__sec-20">
          <num>20</num>
          <heading>Order terminating legal relationship between child and parents</heading>
          <subsection eId="part-4__sec-20__subsec-1">
            <num>1</num>
            <content>
              <p>This regulation applies if:</p>
            </content>
            <paragraph eId="part-4__sec-20__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>an adoption, by a person who is habitually resident in Australia, of a child who is habitually resident in a Convention country is granted in that country; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-20__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>	(b)	the laws of the Convention country do not provide that the adoption of the child terminates the legal relationship between the child and the individuals who were, immediately before the adoption, the child’s parents (the <b><i>pre</i></b><b><i>-</i></b><b><i>adoption parents</i></b>).</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-4__sec-20__subsec-2">
            <num>2</num>
            <content>
              <p>The person may apply to a court for an order that the adoption of the child terminates the legal relationship between the child and the pre-adoption parents.</p>
            </content>
          </subsection>
          <subsection eId="part-4__sec-20__subsec-2A">
            <num>2A</num>
            <content>
              <p>The application must:</p>
            </content>
            <paragraph eId="part-4__sec-20__subsec-2A__para-a">
              <num>a</num>
              <content>
                <p>be in accordance with Form 3; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-20__subsec-2A__para-b">
              <num>b</num>
              <content>
                <p>include an affidavit in accordance with Form 2.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-4__sec-20__subsec-2B">
            <num>2B</num>
            <content>
              <p>At the same time as the application is made, the applicant, or applicants, must give a copy of the application to the State Central Authority for the State:</p>
            </content>
            <paragraph eId="part-4__sec-20__subsec-2B__para-a">
              <num>a</num>
              <content>
                <p>if the application is made by 1 applicant—where the applicant habitually resides; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-20__subsec-2B__para-b">
              <num>b</num>
              <content>
                <p>if the application is made by more than 1 applicant—where the applicants habitually reside.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-4__sec-20__subsec-2C">
            <num>2C</num>
            <content>
              <p>As soon as practicable, the State Central Authority must give notice, in accordance with Form 4, of the application to <role refersTo="#minister">the Minister</role> for Immigration and Multicultural Affairs at the principal office of the Department of Immigration and Multicultural Affairs in Canberra.</p>
            </content>
          </subsection>
          <subsection eId="part-4__sec-20__subsec-2D">
            <num>2D</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> for Immigration and Multicultural Affairs:</p>
            </content>
            <paragraph eId="part-4__sec-20__subsec-2D__para-a">
              <num>a</num>
              <content>
                <p>no later than 5 working days before the court hearing, may file with the court a statement in accordance with Form 5 that sets out briefly the matters on which <role refersTo="#minister">the Minister</role> wishes to rely in support of the court making an order other than the order sought in the application; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-20__subsec-2D__para-b">
              <num>b</num>
              <content>
                <p>must include with that statement an affidavit in accordance with Form 2.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-4__sec-20__subsec-2E">
            <num>2E</num>
            <content>
              <p>As soon as practicable before the court hearing, the applicant, or applicants may file with the court a reply to a statement filed under subregulation (2D), being a reply that:</p>
            </content>
            <paragraph eId="part-4__sec-20__subsec-2E__para-a">
              <num>a</num>
              <content>
                <p>is in accordance with Form 6; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-20__subsec-2E__para-b">
              <num>b</num>
              <content>
                <p>includes an affidavit in accordance with Form 2.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-4__sec-20__subsec-2F">
            <num>2F</num>
            <content>
              <p>An order made by the court must be in accordance with Form 9.</p>
            </content>
          </subsection>
          <subsection eId="part-4__sec-20__subsec-3">
            <num>3</num>
            <content>
              <p><b>	</b>(3)	The court may make the order only if it is satisfied that:</p>
            </content>
            <paragraph eId="part-4__sec-20__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>an adoption compliance certificate issued in the Convention country is in force for the adoption; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-20__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>the laws of the Convention country do not provide that the adoption of a child terminates the legal relationship between the child and the pre-adoption parents; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-20__subsec-3__para-c">
              <num>c</num>
              <content>
                <p>the child is allowed:</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-20__subsec-3__para-i">
              <num>i</num>
              <content>
                <p>to enter Australia; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-20__subsec-3__para-ii">
              <num>ii</num>
              <content>
                <p>to reside permanently in Australia.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-4__sec-20__subsec-4">
            <num>4</num>
            <content>
              <p>For paragraph (3)(c), a child is not allowed to enter, or reside permanently in, Australia if the child is affected by a law of the Commonwealth, or of a State, or by an order of a Commonwealth or State court, the effect of which is to prevent the child from so entering or residing.</p>
            </content>

        </section>
        <section eId="part-4__sec-21">
          <num>21</num>
          <heading>Decision in a Convention country to convert an adoption</heading>
          <subsection eId="part-4__sec-21__subsec-1">
            <num>1</num>
            <content>
              <p>Subject to regulation 22, if a decision is made in a Convention country to convert the adoption of a child, in accordance with article 27 of the Convention, the decision is recognised and effective, for the laws of the Commonwealth and each State, on and from the day the decision becomes effective.</p>
            </content>
          </subsection>
          <subsection eId="part-4__sec-21__subsec-2">
            <num>2</num>
            <content>
              <p>Recognition of the decision includes, for the laws of the Commonwealth and each State, recognition that under those laws, the decision terminates the legal relationship between the child and the individuals who were, immediately before the adoption, the child’s parents.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-4__sec-22">
          <num>22</num>
          <heading>Refusal to recognise an adoption or an article 27 decision</heading>
          <subsection eId="part-4__sec-22__subsec-1">
            <num>1</num>
            <content>
              <p>This regulation applies if a State Central Authority considers that an adoption, or a decision made in accordance with article 27 of the Convention, is manifestly contrary to public policy, taking into account the best interests of the child to whom the adoption or decision relates.</p>
            </content>
          </subsection>
          <subsection eId="part-4__sec-22__subsec-2">
            <num>2</num>
            <content>
              <p>The State Central Authority may apply to a court for a declaration that the adoption or decision is not recognised.</p>
            </content>
          </subsection>
          <subsection eId="part-4__sec-22__subsec-2A">
            <num>2A</num>
            <content>
              <p>The application must:</p>
            </content>
            <paragraph eId="part-4__sec-22__subsec-2A__para-a">
              <num>a</num>
              <content>
                <p>be in accordance with Form 3; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-22__subsec-2A__para-b">
              <num>b</num>
              <content>
                <p>include an affidavit in accordance with Form 2.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-4__sec-22__subsec-2B">
            <num>2B</num>
            <content>
              <p>At the same time as the application is made, the State Central Authority must give notice, in accordance with Form 4, of the application to:</p>
            </content>
            <paragraph eId="part-4__sec-22__subsec-2B__para-a">
              <num>a</num>
              <content>
                <p>the adoptive parents, or adoptive parent, of the child to whom the adoption or decision relates; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-22__subsec-2B__para-b">
              <num>b</num>
              <content>
                <p><role refersTo="#minister">the Minister</role> for Immigration and Multicultural Affairs at the principal office of the Department of Immigration and Multicultural Affairs in Canberra.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-4__sec-22__subsec-2C">
            <num>2C</num>
            <content>
              <p>A person to whom notice of the application is given:</p>
            </content>
            <paragraph eId="part-4__sec-22__subsec-2C__para-a">
              <num>a</num>
              <content>
                <p>no later than 5 working days before the court hearing, may file with the court a statement in accordance with Form 5 that sets out briefly the matters on which the person wishes to rely in support of the court making an order other than the order sought in the application; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-22__subsec-2C__para-b">
              <num>b</num>
              <content>
                <p>must include with that statement an affidavit in accordance with Form 2.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-4__sec-22__subsec-2D">
            <num>2D</num>
            <content>
              <p>As soon as practicable before the court hearing, the State Central Authority may file with the court a reply to a statement filed under subregulation (2C), being a reply that:</p>
            </content>
            <paragraph eId="part-4__sec-22__subsec-2D__para-a">
              <num>a</num>
              <content>
                <p>is in accordance with Form 6; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-22__subsec-2D__para-b">
              <num>b</num>
              <content>
                <p>includes an affidavit in accordance with Form 2.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-4__sec-22__subsec-2E">
            <num>2E</num>
            <content>
              <p>An order made by the court must be in accordance with Form 10.</p>
            </content>
          </subsection>
          <subsection eId="part-4__sec-22__subsec-3">
            <num>3</num>
            <content>
              <p>If a court declares that it does not recognise the adoption or decision, the adoption or decision (as the case requires) has no effect for the laws of the Commonwealth and each State.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-4__sec-23">
          <num>23</num>
          <heading>Notice of application under regulation 22</heading>
          <subsection eId="part-4__sec-23__subsec-1">
            <num>1</num>
            <content>
              <p>If a State Central Authority applies to a court for a declaration under regulation 22, the State Central Authority must, as soon as practicable, tell the Commonwealth Central Authority, in writing, about the application and its reasons for making the application.</p>
            </content>
          </subsection>
          <subsection eId="part-4__sec-23__subsec-2">
            <num>2</num>
            <content>
              <p>When the Commonwealth Central Authority is given information under subregulation (1), it must, as soon as practicable:</p>
            </content>
            <paragraph eId="part-4__sec-23__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>give the Bureau and the Central Authorities of the State of origin and the receiving State the information, in writing; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-23__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>invite those Central Authorities to make submissions to the court about the application.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-4__sec-23__subsec-3">
            <num>3</num>
            <content>
              <p>As soon as practicable after the court has decided the application, the Commonwealth Central Authority must tell the Bureau, in writing, about the decision.</p>
            </content>
          </subsection>
          <subsection eId="part-4__sec-23__subsec-4">
            <num>4</num>
            <content>
              <p>If a State to which subregulation (1) does not apply gives the Commonwealth Central Authority information of a kind mentioned in the subregulation, the Commonwealth Central Authority must comply with subregulations (2) and (3) as if the information were given under subregulation (1).</p>

            <p>For this Part, a matter to which a provision of <ref href="#part-4">Part 4</ref> applies arises in a State if the adoptive parents, or prospective adoptive parents, concerned are habitually resident in that State.</p>
          </content>
        </section>
        <section eId="part-5__sec-24A">
          <num>24A</num>
          <heading>Jurisdiction of Federal Circuit and Family Court of Australia (Division 2)</heading>
          <subsection eId="part-5__sec-24A__subsec-1">
            <num>1</num>
            <content>
              <p>Jurisdiction is conferred on the Federal Circuit and Family Court of Australia (<ref href="#dvs-2">Division 2</ref>) in a matter to which a provision of <ref href="#part-4">Part 4</ref> applies.</p>
            </content>
          </subsection>
          <subsection eId="part-5__sec-24A__subsec-2">
            <num>2</num>
            <content>
              <p>If jurisdiction is invested, in the matter, in a court of a State under a law of the State, the Federal Circuit and Family Court of Australia (<ref href="#dvs-2">Division 2</ref>) is divested of jurisdiction in the matter.</p>
            </content>
          </subsection>

            <p>CONVENTION ON PROTECTION OF CHILDREN AND COOPERATION IN RESPECT OF INTERCOUNTRY ADOPTION</p>
            <p>The States signatory to the present Convention,</p>
            <p>Recognising that the child, for the full and harmonious development of his or her personality, should grow up in a family environment, in an atmosphere of happiness, love and understanding,</p>
            <p>Recalling that each State should take, as a matter of priority, appropriate measures to enable the child to remain in the care of his or her family of origin,</p>
            <p>Recognising that intercountry adoption may offer the advantage of a permanent family to a child for whom a suitable family cannot be found in his or her State of origin,</p>
            <p>Convinced of the necessity to take measures to ensure that intercountry adoptions are made in the best interests of the child and with respect for his or her fundamental rights, and to prevent the abduction, the sale of, or traffic in children,</p>
            <p>Desiring to establish common provisions to this effect, taking into account the principles set forth in international instruments, in particular the <i>United Nations Convention on the Rights of the Child</i>, of 20 November 1989, and the United Nations Declaration on Social and Legal Principles relating to the Protection and Welfare of Children, with Special Reference to Foster Placement and Adoption Nationally and Internationally (General Assembly Resolution 41/85, of 3 December 1986),</p>
            <p>Have agreed upon the following provisions—</p>
            <p>CHAPTER 1—SCOPE OF THE CONVENTION</p>
            <p>
              <i>Article 1</i>
            </p>
            <p>The objects of the present Convention are—</p>
            <p><i>a</i>	to establish safeguards to ensure that intercountry adoptions take place in the best interests of the child and with respect for his or her fundamental rights as recognised in international law;</p>
            <p><i>b</i>	to establish a system of cooperation amongst Contracting States to ensure that those safeguards are respected and thereby prevent the abduction, the sale of, or traffic in children;</p>
            <p><i>c</i>	to secure the recognition in Contracting States of adoptions made in accordance with the Convention.</p>
            <p>
              <i>Article 2</i>
            </p>
          </content>
          <hcontainer name="clause" eId="schedule-1__clause-1">
            <num>1</num>
            <heading>The Convention shall apply where a child habitually resident in one Contracting State (‘the State of origin’) has been, is being, or is to be moved to another Contracting State (‘the receiving State’) either after his or her adoption in the State of origin by spouses or a person habitually resident in the receiving State, or for the purposes of such an adoption in the receiving State or in the State of origin.</heading>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-2">
            <num>2</num>
            <heading>The Convention covers only adoptions which create a permanent parent-child relationship.</heading>

              </p>
              <p>The Convention ceases to apply if the agreements mentioned in Article 17, sub-paragraph <i>c</i>, have not been given before the child attains the age of eighteen years.</p>
              <p>CHAPTER II—REQUIREMENTS FOR INTERCOUNTRY ADOPTIONS</p>
              <p>
                <i>Article 4</i>
              </p>
              <p>An adoption within the scope of the Convention shall take place only if the competent authorities of the State of origin—</p>
              <p><i>a</i>	have established that the child is adoptable;</p>
              <p><i>b</i>	have determined, after possibilities for placement of the child within the State of origin have been given due consideration, that an intercountry adoption is in the child’s best interests;</p>
              <p><i>c</i><i>	</i>have ensured that</p>
              <p><i>d</i>	have ensured, having regard to the age and degree of maturity of the child, that</p>
              <p>
                <i>Article 5</i>
              </p>
              <p>An adoption within the scope of the convention shall take place only if the competent authorities of the receiving State—</p>
              <p><i>a</i><i>	</i>have determined that the prospective adoptive parents are eligible and suited to adopt;</p>
              <p><i>b</i>	have ensured that the prospective adoptive parents have been counselled as may be necessary; and</p>
              <p><i>c</i>	have determined that the child is or will be authorised to enter and reside permanently in that State.</p>
              <p>CHAPTER III—CENTRAL AUTHORITIES AND ACCREDITED BODIES</p>
              <p>
                <i>Article 6</i>
              </p>
            </content>

                <p>the persons, institutions and authorities whose consent is necessary for adoption, have been counselled as may be necessary and duly informed of the effects of their consent, in particular whether or not an adoption will result in the termination of the legal relationship between the child and his or her family of origin,</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-2__subclause-2">
              <num>2</num>
              <content>
                <p>such persons, institutions and authorities have given their consent freely, in the required legal form, and expressed or evidenced in writing,</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-2__subclause-3">
              <num>3</num>
              <content>
                <p>the consents have not been induced by payment or compensation of any kind and have not been withdrawn, and</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-2__subclause-4">
              <num>4</num>
              <content>
                <p>the consent of the mother, where required, has been given only after the birth of the child; and</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-2__subclause-1">
              <num>1</num>
              <content>
                <p>he or she has been counselled and duly informed of the effects of the adoption and of his or her consent to the adoption, where such consent is required,</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-2__subclause-2">
              <num>2</num>
              <content>
                <p>consideration has been given to the child’s wishes and opinions,</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-2__subclause-3">
              <num>3</num>
              <content>
                <p>the child’s consent to the adoption, where such consent is required, has been given freely, in the required legal form, and expressed or evidenced in writing, and</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-2__subclause-4">
              <num>4</num>
              <content>
                <p>such consent has not been induced by payment or compensation of any kind.</p>
              </content>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-1">
            <num>1</num>
            <heading>A Contracting State shall designate a Central Authority to discharge the duties which are imposed by the Convention upon such authorities.</heading>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-2">
            <num>2</num>
            <heading>Federal States, States with more than one system of law or States having autonomous territorial units shall be free to appoint more than one Central Authority and to specify the territorial or personal extent of their functions. Where a State has appointed more than one Central Authority, it shall designate the Central Authority to which any communication may be addressed for transmission to the appropriate Central Authority within that State.</heading>
            <content>
              <p>
                <i>Article 7</i>
              </p>
            </content>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-1">
            <num>1</num>
            <heading>Central Authorities shall cooperate with each other and promote cooperation amongst the competent authorities in their States to protect children and to achieve the other objects of the Convention.</heading>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-2">
            <num>2</num>
            <heading>They shall take directly all appropriate measures to—</heading>
            <content>
              <p><i>a</i><i>	</i>provide information as to the laws of their States concerning adoption and other general information, such as statistics and standard forms;</p>
              <p><i>b</i><i>	</i>keep one another informed about the operation of the Convention and, as far as possible, eliminate any obstacles to it application.</p>
              <p>
                <i>Article 8</i>
              </p>
              <p>Central Authorities shall take, directly or through public authorities, all appropriate measures to prevent improper financial or other gain in connection with an adoption and to deter all practices contrary to the objects of the Convention.</p>
              <p>
                <i>Article 9</i>
              </p>
              <p>Central Authorities shall take, directly or through public authorities or other bodies duly accredited in their State, all appropriate measures, in particular to—</p>
              <p><i>a</i>	collect, preserve and exchange information about the situation of the child and the prospective adoptive parents, so far as is necessary to complete the adoption;</p>
              <p><i>b</i><i>	</i>facilitate, follow and expedite proceedings with a view to obtaining the adoption;</p>
              <p><i>c</i><i>	</i>promote the development of adoption counselling and post-adoption services in their States;</p>
              <p><i>d</i><i>	</i>provide each other with general evaluation reports about experience with intercountry adoption;</p>
              <p><i>e</i><i>	</i>reply, in so far as is permitted by the law of their State, to justified requests from other Central Authorities or public authorities for information about a particular adoption situation.</p>
              <p>
                <i>Article 10</i>
              </p>
              <p>Accreditation shall only be granted to and maintained by bodies demonstrating their competence to carry out properly the tasks with which they may be entrusted.</p>
              <p>
                <i>Article 11</i>
              </p>
              <p>An accredited body shall—</p>
              <p><i>a</i><i>	</i>pursue only non-profit objectives according to such conditions and within such limits as may be established by the competent authorities of the State of accreditation;</p>
              <p><i>b</i><i>	</i>be directed and staffed by persons qualified by their ethical standards and by training or experience to work in the field of intercountry adoption; and</p>
              <p><i>c</i><i>	</i>be subject to supervision by competent authorities of that State as to its composition, operation and financial situation.</p>
              <p>
                <i>Article 12</i>
              </p>
              <p>A body accredited in one Contracting State may act in another Contracting State only if the competent authorities of both States have authorised it to do so.</p>
              <p>
                <i>Article 13</i>
              </p>
              <p>The designation of the Central Authorities and where appropriate, the extent of their functions, as well as the names and addresses of the accredited bodies shall be communicated by each Contracting State to the Permanent Bureau of the Hague Conference on Private International Law.</p>
              <p>CHAPTER IV—PROCEDURAL REQUIREMENTS IN INTERCOUNTRY ADOPTION</p>
              <p>
                <i>Article 14</i>
              </p>
              <p>Persons habitually resident in a Contracting State, who wish to adopt a child habitually resident in another Contracting State, shall apply to the Central Authority in the State of their habitual residence.</p>
              <p>
                <i>Article 15</i>
              </p>
            </content>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-1">
            <num>1</num>
            <heading>If the Central Authority of the receiving State is satisfied that the applicants are eligible and suited to adopt, it shall prepare a report including information about their identity, eligibility and suitability to adopt, background, family and medical history, social environment, reasons for adoption, ability to undertake an intercountry adoption, as well as the characteristics of the children for whom they would be qualified to care.</heading>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-2">
            <num>2</num>
            <heading>It shall transmit the report to the Central Authority of the State of origin.</heading>
            <content>
              <p>
                <i>Article 16</i>
              </p>
            </content>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-1">
            <num>1</num>
            <heading>If the Central Authority of the State of origin is satisfied that the child is adoptable, it shall—</heading>
            <content>
              <p><i>a</i><i>	</i>prepare a report including information about his or her identity, adoptability, background, social environment, family history, medical history including that of the child’s family, and any special needs of the child;</p>
              <p><i>b</i><i>	</i>give due consideration to the child’s upbringing and to his or her ethnic, religious and cultural background;</p>
              <p><i>c</i><i>	</i>ensure that consents have been obtained in accordance with Article 4; and</p>
              <p><i>d</i>	determine, on the basis in particular of the reports relating to the child and the prospective adoptive parents, whether the envisaged placement is in the best interests of the child.</p>
            </content>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-2">
            <num>2</num>
            <heading>It shall transmit to the Central Authority of the receiving State its report on the child, proof that the necessary consents have been obtained and the reasons for its determination on the placement, taking care not to reveal the identity of the mother and the father if, in the State of origin, these identities may not be disclosed.</heading>
            <content>
              <p>
                <i>Article 17</i>
              </p>
              <p>Any decision in the State of origin that a child should be entrusted to prospective adoptive parents may only be made if—</p>
              <p><i>a</i><i>	</i>the Central Authority of that State has ensured that the prospective adoptive parents agree;</p>
              <p><i>b</i><i>	</i>the Central Authority of the receiving State has approved such decision, where such approval is required by the law of that State or by the Central Authority of the State of origin;</p>
              <p><i>c</i>	the Central Authorities of both States have agreed that the adoption may proceed; and</p>
              <p><i>d</i><i>	</i>it has been determined, in accordance with Article 5, that the prospective adoptive parents are eligible and suited to adopt and that the child is or will be authorised to enter and reside permanently in the receiving State.</p>
              <p>
                <i>Article 18</i>
              </p>
              <p>The Central Authorities of both States shall take all necessary steps to obtain permission for the child to leave the State of origin and to enter and reside permanently in the receiving State.</p>
              <p>
                <i>Article 19</i>
              </p>
            </content>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-1">
            <num>1</num>
            <heading>The transfer of the child to the receiving State may only be carried out if the requirements of Article 17 have been satisfied.</heading>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-2">
            <num>2</num>
            <heading>The Central Authorities of both States shall ensure that this transfer takes place in secure and appropriate circumstances and, if possible, in the company of the adoptive or prospective adoptive parents.</heading>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-3">
            <num>3</num>
            <heading>If the transfer of the child does not take place, the reports referred to in Articles 15 and 16 are to be sent back to the authorities who forwarded them.</heading>
            <content>
              <p>
                <i>Article 20</i>
              </p>
              <p>The Central Authorities shall keep each other informed about the adoption process and the measures taken to complete it, as well as about the progress of the placement if a probationary period is required.</p>
              <p>
                <i>Article 21</i>
              </p>
            </content>
          </hcontainer>

            <heading>Where the adoption is to take place after the transfer of the child to the receiving State and it appears to the Central Authority of that State that the continued placement of the child with the prospective adoptive parents is not in the child’s best interests, such Central Authority shall take the measures necessary to protect the child, in particular—</heading>
            <content>
              <p><i>a</i><i>	</i>to cause the child to be withdrawn from the prospective adoptive parents and to arrange temporary care;</p>
              <p><i>b</i><i>	</i>in consultation with the Central Authority of the State of origin, to arrange without delay a new placement of the child with a view to adoption or, if this is not appropriate, to arrange alternative long-term care; an adoption shall not take place until the Central Authority of the State of origin has been duly informed concerning the new prospective adoptive parents;</p>
              <p><i>c</i><i>	</i>as a last resort, to arrange the return of the child, if his or her interests so require.</p>

          <hcontainer name="clause" eId="schedule-1__clause-2">
            <num>2</num>
            <heading>Having regard in particular to the age and degree of maturity of the child, he or she shall be consulted and, where appropriate, his or her consent obtained in relation to measures to be taken under this Article.</heading>

            <num>1</num>
            <heading>The functions of a Central Authority under this Chapter may be performed by public authorities or by bodies accredited under Chapter III, to the extent permitted by the law of its State.</heading>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-2">
            <num>2</num>
            <heading>Any Contracting State may declare to the depositary of the Convention that the functions of the Central Authority under Articles 15 to 21 may be performed in that State, to the extent permitted by the law and subject to the supervision of the competent authorities of that State, also by bodies or person who—</heading>

              <p><i>a</i><i>	</i>meet the requirements of integrity, professional competence, experience and accountability of that State; and</p>
              <p><i>b</i>	are qualified by their ethical standards and by training or experience to work in the field of intercountry adoption.</p>
            </content>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-3">
            <num>3</num>
            <heading>A Contracting State which makes the declaration provided for in paragraph 2 shall keep the Permanent Bureau of the Hague Conference on Private International Law informed of the names and addresses of these bodies and persons.</heading>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-4">
            <num>4</num>
            <heading>Any Contracting State may declare to the depositary of the Convention that adoptions of children habitually resident in its territory may only take place if the functions of the Central Authorities are performed in accordance with paragraph 1.</heading>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-5">
            <num>5</num>
            <heading>Notwithstanding any declaration made under paragraph 2, the reports provide for in Articles 15 and 16 shall, in every case, be prepared under the responsibility of the Central Authority or other authorities or bodies in accordance with paragraph 1.</heading>

              <p>CHAPTER V—RECOGNITION AND EFFECTS OF THE ADOPTION</p>
              <p>
                <i>Article 23</i>
              </p>

            <num>1</num>
            <heading>An adoption certified by the competent authority of the State of the adoption as having been made in accordance with the Convention shall be recognised by operation of law in the other Contracting States. The certificate shall specify when and by whom the agreements under Article 17, sub-paragraph c, were given.</heading>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-2">
            <num>2</num>
            <heading>Each Contracting State shall, at the time of signature, ratification, acceptance, approval or accession, notify the depositary of the Convention of the identity and the functions of the authority or the authorities which, in that State, are competent to make the certification. It shall also notify the depositary of any modification in the designation of these authorities.</heading>

              <p>
                <i>Article 24</i>
              </p>
              <p>The recognition of an adoption may be refused in a Contracting State only if the adoption is manifestly contrary to its public policy, taking into account the best interests of the child.</p>
              <p>
                <i>Article 25</i>
              </p>
              <p>Any Contracting State may declare to the depositary of the Convention that it will not be bound under this Convention to recognise adoptions made in accordance with an agreement concluded by application of Article 39, paragraph 2.</p>
              <p>
                <i>Article 26</i>
              </p>

            <num>1</num>
            <heading>The recognition of an adoption includes recognition of—</heading>
            <content>
              <p><i>a</i><i>	</i>the legal parent-child relationship between the child and his or her adoptive parents;</p>
              <p><i>b</i><i>	</i>parental responsibility of the adoptive parents for the child;</p>
              <p><i>c</i><i>	</i>the termination of a pre-existing legal relationship between the child and his or her mother and father, if the adoption has this effect in the Contracting State where it was made.</p>

          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-2">
            <num>2</num>
            <heading>In the case of an adoption having the effect of terminating a pre-existing legal parent-child relationship, the child shall enjoy in the receiving State, and in any other Contracting State where the adoption is recognised, rights equivalent to those resulting from adoptions having this effect in each such State.</heading>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-3">
            <num>3</num>
            <heading>The preceding paragraphs shall not prejudice the application of any provision more favourable for the child, in force in the Contracting State which recognises the adoption.</heading>

                <i>Article 27</i>
              </p>

          <hcontainer name="clause" eId="schedule-1__clause-1">
            <num>1</num>
            <heading>Where an adoption granted in the State of origin does not have the effect of terminating a pre-existing legal parent-child relationship, it may, in the receiving State which recognises the adoption under the Convention, be converted into an adoption having such an effect—</heading>

              <p><i>a</i><i>	</i>if the law of the receiving State so permits; and</p>
              <p><i>b</i><i>	</i>if the consent referred to in Article 4, sub-paragraphs <i>c </i>and <i>d</i>, have been or are given for the purpose of such an adoption.</p>

            <num>2</num>
            <heading>Article 23 applies to the decision converting the adoption.</heading>
            <content>
              <p>CHAPTER VI—GENERAL PROVISIONS</p>
              <p>
                <i>Article 28</i>
              </p>
              <p>The Convention does not affect any law of a State of origin which requires that the adoption of a child habitually resident within that State take place in that State or which prohibits the child’s placement in, or transfer to, the receiving State prior to adoption.</p>
              <p>
                <i>Article 29</i>
              </p>
              <p>There shall be no contact between the prospective adoptive parents and the child’s parents or any other person who has care of the child until the requirements of Article 4, sub-paragraphs <i>a</i> to<i> c</i>, and Article 5, sub-paragraph <i>a</i>, have been met, unless the adoption takes place within a family or unless the contact is in compliance with the conditions established by the competent authority of the State of origin.</p>
              <p>
                <i>Article 30</i>
              </p>

          <hcontainer name="clause" eId="schedule-1__clause-1">
            <num>1</num>
            <heading>The competent Authorities of a Contracting State shall ensure that information held by them concerning the child’s origin, in particular information concerning the identity of his or her parents, as well as the medical history, is preserved.</heading>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-2">
            <num>2</num>
            <heading>They shall ensure that the child or his or her representative has access to such information, under appropriate guidance, in so far as is permitted by the law of that State.</heading>
            <content>
              <p>
                <i>Article 31</i>
              </p>
              <p>Without prejudice to Article 30, personal data gathered or transmitted under the Convention, especially data referred to in Articles 15 and 16, shall be used only for the purposes for which they were gathered or transmitted.</p>
              <p>
                <i>Article 32</i>

            <num>1</num>
            <heading>No one shall derive improper financial or other gain from an activity related to an intercountry adoption.</heading>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-2">
            <num>2</num>
            <heading>Only costs and expenses, including reasonable professional fees of person involved in the adoption, may be charged or paid.</heading>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-3">
            <num>3</num>
            <heading>The directors, administrators and employees of bodies involved in an adoption shall not receive remuneration which is unreasonably high in relation to services rendered.</heading>
            <content>
              <p>
                <i>Article 33</i>
              </p>
              <p>A competent authority which finds that any provision of the Convention has not been respected or that there is a serious risk that it may not be respected, shall immediately inform the Central Authority of its State. This Central Authority shall be responsible for ensuring that appropriate measures are taken.</p>
              <p>
                <i>Article 34</i>
              </p>
              <p>If the competent authority of the State of destination of a document so requests, a translation certified as being in conformity with the original must be furnished. Unless otherwise provided, the costs of such translation are to be borne by the prospective adoptive parents.</p>
              <p>
                <i>Article 35</i>
              </p>
              <p>The competent authorities of the Contracting States shall act expeditiously in the process of adoption.</p>
              <p>
                <i>Article 36</i>
              </p>
              <p>In relation to a State which has two or more systems of law with regard to adoption applicable in different territorial units—</p>
              <p><i>a</i>	any reference to habitual residence in that State shall be construed as referring to habitual residence in a territorial unit of that State;</p>
              <p><i>b</i>	any reference to the law of that State shall be construed as referring to the law in force in the relevant territorial unit;</p>
              <p><i>c</i>	any reference to the competent authorities or to be public authorities of that State shall be construed as referring to those authorised to act in the relevant territorial unit;</p>
              <p><i>d</i>	any reference to the accredited bodies of that State shall be construed as referring to bodies accredited in the relevant territorial unit.</p>
              <p>
                <i>Article 37</i>
              </p>
              <p>In relation to a State which with regard to adoption has two or more systems of law applicable to different categories of person, any reference to the law of that State shall be construed as referring to the legal system specified by the law of that State.</p>
              <p>
                <i>Article 38</i>
              </p>
              <p>A State within which different territorial units have their own rules of law in respect of adoption shall not be bound to apply the Convention where a State with a unified system of law would not be bound to do so.</p>
              <p>
                <i>Article 39</i>
              </p>

          <hcontainer name="clause" eId="schedule-1__clause-1">
            <num>1</num>
            <heading>The Convention does not affect any international instrument to which Contracting States are Parties and which contains provisions on matters governed by the Convention, unless a contrary declaration is made by the States Parties to such instrument.</heading>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-2">
            <num>2</num>
            <heading>Any Contracting State may enter into agreements with one or more other Contracting States, with a view to improving the application of the Convention in their mutual relations. These agreements may derogate only from the provisions of Articles 14 to 16 and 18 to 21. The States which have concluded such an agreement shall transmit a copy to the depositary of the Convention.</heading>

                <i>Article 40</i>
              </p>
              <p>No reservation to the Convention shall be permitted.</p>
              <p>
                <i>Article 41</i>
              </p>
              <p>The Convention shall apply in every case where an application pursuant to Article 14 has been received after the Convention has entered into force in the receiving State and the State of origin.</p>
              <p>
                <i>Article 42</i>
              </p>
              <p><role refersTo="#secretary">The Secretary</role> General of the Hague Conference on Private International Law shall at regular intervals convene a Special Commission in order to review the practical operation of the Convention.</p>
              <p>CHAPTER VII—FINAL CLAUSES</p>
              <p>
                <i>Article 43</i>
              </p>

            <num>1</num>
            <heading>The Convention shall be open for signature by the States which were Members of the Hague Conference on Private International Law at the time of its Seventeenth Session and by the other States which participated in that Session.</heading>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-2">
            <num>2</num>
            <heading>It shall be ratified, accepted or approved and the instruments of ratification, acceptance or approval shall be deposited with the Ministry of Foreign Affairs of the Kingdom of the Netherlands, depositary of the Convention.</heading>

                <i>Article 44</i>

            <num>1</num>
            <heading>Any other State may accede to the Convention after it has entered into force in accordance with Article 46, paragraph 1.</heading>

            <heading>The instrument of accession shall be deposited with the depositary.</heading>
          </hcontainer>

            <heading>Such accession shall have effect only as regards the relations between the acceding State and those Contracting States which have not raised an objection to its accession in the six months after the receipt of the notification referred to in sub-paragraph b of Article 48. Such an objection may also be raised by States at the time when they ratify, accept or approve the Convention after an accession. Any such objection shall be notified to the depositary.</heading>

                <i>Article 45</i>
              </p>

          <hcontainer name="clause" eId="schedule-1__clause-1">
            <num>1</num>
            <heading>If a State has two or more territorial units in which different systems of law are applicable in relation to matter dealt with in the Convention, it may at the time of signature, ratification, acceptance, approval or accession declare that this Convention shall extend to all its territorial units or only to one or more of them and may modify this declaration by submitting another declaration at any time.</heading>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-2">
            <num>2</num>
            <heading>Any such declaration shall be notified to the depositary and shall state expressly the territorial units to which the Convention applies.</heading>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-3">
            <num>3</num>
            <heading>If a State makes no declaration under this Article, the Convention is to extend to all territorial units of that State.</heading>

                <i>Article 46</i>

            <heading>The Convention shall enter into force on the first day of the month following the expiration of three months after the deposit of the third instrument of ratification, acceptance or approval referred to in Article 43.</heading>

            <heading>Thereafter the Convention shall enter into force—</heading>

              <p><i>a</i>	for each State ratifying, accepting or approving it subsequently, or acceding to it, on the first day of the month following the expiration of three months after the deposit of its instrument of ratification, acceptance, approval or accession;</p>
              <p><i>b</i>	for a territorial unit to which the Convention has been extended in conformity with Article 45, on the first day of the month following the expiration of three months after the notification referred to in that Article.</p>

                <i>Article 47</i>

            <heading>A State Party to the Convention may denounce it by a notification in writing addressed to the depositary.</heading>

            <heading>The denunciation takes effect on the first day of the month following the expirations of twelve months after the notification is received by the depositary. Where a longer period for the denunciation to take effect is specified in the notification, the denunciation takes effect upon the expiration of such longer period after the notification is received by the depositary.</heading>

                <i>Article 48</i>
              </p>
              <p>The depositary shall notify the States Members of the Hague Conference on Private International Law, the other States which participated in the Seventeenth Session and the States which have acceded in accordance with Article 44, of the following—</p>
