            <p>		This Act may be cited as the <i>Payment Systems (Regulation) Act 1998</i>.</p>

            <p>		This Act commences on the commencement of the <i>Australian Prudential Regulation Authority Act 1998</i>.</p>

          <heading>Crown is bound by this Act</heading>
          <content>
            <p>This Act binds the Crown in all its capacities, but does not make the Crown liable to be prosecuted for an offence.</p>

              <p>This Act provides for the regulation of payment systems and purchased payment facilities.</p>

              <p><ref href="#part-3">Part 3</ref> deals with the regulation of payment systems. It provides for:</p>

                <p>the designation of payment systems (see <ref href="#dvs-2">Division 2</ref> for designated payment systems and <ref href="#dvs-2A">Division 2A</ref> for special designated payment systems); and</p>

        </section>

        <heading>Interpretation</heading>
        <section eId="part-2__sec-7">
          <num>7</num>
          <heading>Definitions</heading>
          <subsection eId="part-2__sec-7__subsec-1">
            <num>1</num>
            <content>
              <p>In this Act:</p>
            </content>
            <content>
              <p><term refersTo="#term-access">access</term> means <def>the entitlement or eligibility of a person to become a participant in the payment system, as a user of the payment system, on a commercial basis on terms that are fair and reasonable.</def></p>
              <p><b><i>access regime</i></b>, in relation to a payment system that is a designated payment system or a special designated payment system (or both), means an access regime:</p>
            </content>
            <paragraph eId="part-2__sec-7__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>that has been imposed by the Reserve Bank or a nominated special regulator under <ref href="#sec-12">section 12</ref>; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-7__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>that is in force.</p>
              </content>
              <content>
                <p><term refersTo="#term-civil-penalty-provision">civil penalty provision</term> has the same meaning as <def>in the Regulatory Powers Act.</def></p>
                <p><term refersTo="#term-constitutional-corporation">constitutional corporation</term> means <def>a corporation to which paragraph 51(xx) of the Constitution applies.</def></p>
                <p><b><i>contravene</i></b> an offence or civil penalty provision has a meaning affected by section 9B.</p>
                <p><term refersTo="#term-designated-payment-system">designated payment system</term> means <def>a payment system that is designated under <ref href="#sec-11">section 11</ref>.</def></p>
                <p><term refersTo="#term-federal-court">Federal Court</term> means <def>the Federal Court of Australia.</def></p>
                <p><b><i>funds</i></b> includes, but is not limited to, the following:</p>

              <num>a</num>
              <content>
                <p>money;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-7__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>	(b)	digital units of value, including digital currency (within the meaning of the <i>A New Tax System (Goods and Services Tax) Act 1999</i>).</p>
              </content>
              <content>
                <p><b><i>head</i></b>, of a nominated special regulator, has the meaning given by subsection (2).</p>
                <p><b><i>holder of the stored value</i></b>, in relation to a purchased payment facility, has the meaning given by subsection 9(2).</p>
                <p><term refersTo="#term-matters-direction">matters direction</term> has the meaning given by <def>paragraph 11F(1)(a).</def></p>
                <p><b><i>national interest</i></b> has a meaning affected by section 8A.</p>
                <p><b><i>nominated special regulator</i></b>, in relation to a special designated payment system, has the meaning given by subsection 11D(2).</p>
                <p><b><i>participant</i></b>, in a payment system, has the meaning given by subsection 7A(2).</p>
                <p><term refersTo="#term-payment-system">payment system</term> has the meaning given by <def>subsection 7A(1).</def></p>
                <p><b><i>public interest </i></b>has a meaning affected by section 8.</p>
                <p><term refersTo="#term-purchased-payment-facility">purchased payment facility</term> means <def>a facility described in subsection 9(1), other than a facility covered by a declaration under subsection 9(3).</def></p>
                <p><term refersTo="#term-purposes-direction">purposes direction</term> has the meaning given by <def>paragraph 11F(1)(b).</def></p>
                <p><term refersTo="#term-regulatory-powers-act">Regulatory Powers Act</term> means <def>the Regulatory Powers (Standard Provisions) Act 2014.</def></p>
                <p><term refersTo="#term-reserve-bank">Reserve Bank</term> means <def>the Reserve Bank of .</def></p>
                <p><term refersTo="#term-responsible-minister">responsible Minister</term> has the same meaning as <def>in the Public Governance, Performance and Accountability Act 2013.</def></p>
                <p><term refersTo="#term-special-designated-payment-system">special designated payment system</term> means <def>a payment system that is designated under <ref href="#sec-11B">section 11B</ref>.</def></p>
                <p><term refersTo="#term-special-regulator">special regulator</term> has the meaning given by <def><ref href="#sec-11C">section 11C</ref>.</def></p>
                <p><term refersTo="#term-standard">standard</term> means <def>a standard in force under <ref href="#sec-18">section 18</ref>.</def></p>

            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-7__subsec-2">
            <num>2</num>
            <content>
              <p>	(2)	In this Act, a person is the <b><i>head</i></b> of a special regulator (including a special regulator that is a nominated special regulator) if:</p>
            </content>
            <paragraph eId="part-2__sec-7__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>in the case of the Reserve Bank—the person is the Governor of the Reserve Bank; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-7__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>in the case of an entity prescribed by the regulations as a special regulator—the person is prescribed by the regulations as the head of that special regulator.</p>
              </content>
            </paragraph>
          </subsection>
        </section>
        <section eId="part-2__sec-7A">
          <num>7A</num>
          <heading>Meaning of payment system and participant</heading>
          <subsection eId="part-2__sec-7A__subsec-1">
            <num>1</num>
            <content>
              <p>	(1)	A <b><i>payment system</i></b>:</p>
            </content>
            <paragraph eId="part-2__sec-7A__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>	(a)	is a system under which, or pursuant to<b> </b>which, one or both of the following occur:</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-7A__subsec-1__para-i">
              <num>i</num>
              <content>
                <p>the making of payments or the transfer of funds;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-7A__subsec-1__para-ii">
              <num>ii</num>
              <content>
                <p>the transmission or receipt of messages that effect, enable, facilitate or sequence the making of payments or the transfer of funds (whether or not those payments are made, or those funds are transferred, under or pursuant to the system); and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-7A__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>includes any instruments or procedures that relate to that system.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-7A__subsec-2">
            <num>2</num>
            <content>
              <p>	(2)	A <b><i>participant</i></b><i> </i>in a payment system is a constitutional corporation that:</p>
            </content>
            <paragraph eId="part-2__sec-7A__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>operates, administers or participates in the payment system; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-7A__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>provides services that enable or facilitate one or more of the following:</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-7A__subsec-2__para-i">
              <num>i</num>
              <content>
                <p>the operation or administration of, or participation in, the payment system;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-7A__subsec-2__para-ii">
              <num>ii</num>
              <content>
                <p>the making of payments, or the transfer of funds, under or pursuant to the payment system;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-7A__subsec-2__para-iii">
              <num>iii</num>
              <content>
                <p>	(iii)	the transmission or receipt of messages under or pursuant to the payment system, being messages that effect,<i> </i>enable, facilitate or sequence the making of payments or the transfer of funds (whether or not those payments are made, or those funds are transferred, under or pursuant to the payment system).</p>
              </content>
            </paragraph>
          </subsection>

              <p>	(3)	For the purposes of subsections (1) and (2), a payment may be made, or funds may be transferred, under or pursuant to a system (the <b><i>target system</i></b>) even if the making of the payment, or the transfer of the funds, is effected by a system other than the target system.</p>

          <heading>Meaning of public interest</heading>

            <p>		In determining, for the purposes of this Act, if particular action is or would be in, or contrary to, the <b><i>public interest</i></b>, the Reserve Bank is to have regard to the desirability of payment systems:</p>
          </content>
          <paragraph eId="part-2__sec-8__para-a">
            <num>a</num>
            <content>
              <p>being (in its opinion):</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-8__para-i">
            <num>i</num>
            <content>
              <p>financially safe for use by participants; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-8__para-ii">
            <num>ii</num>
            <content>
              <p>efficient; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-8__para-iii">
            <num>iii</num>
            <content>
              <p>competitive; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-8__para-b">
            <num>b</num>
            <content>
              <p>not (in its opinion) materially causing or contributing to increased risk to the financial system.</p>
            </content>
            <content>
              <p>The Reserve Bank may have regard to other matters that it considers are relevant, but is not required to do so.</p>
            </content>
          </paragraph>
        </section>
        <section eId="part-2__sec-8A">
          <num>8A</num>
          <heading>Meaning of national interest</heading>
          <content>
            <p>		In determining, for the purposes of this Act, whether a particular action is in the <b><i>national interest</i></b>:</p>
          </content>
          <paragraph eId="part-2__sec-8A__para-a">
            <num>a</num>
            <content>
              <p>	(a)	the Minister may have regard to a matter (a <b><i>core public interest matter</i></b>)<b><i> </i></b>that the Reserve Bank would be required to have regard to if it were determining, for the purposes of this Act, whether the action is in the public interest (see section 8); and</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-8A__para-b">
            <num>b</num>
            <content>
              <p>whether or not <role refersTo="#minister">the Minister</role> has regard to a core public interest matter—<role refersTo="#minister">the Minister</role> must identify, and have regard to, one or more matters each of which:</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-8A__para-i">
            <num>i</num>
            <content>
              <p>is not a core public interest matter; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-8A__para-ii">
            <num>ii</num>
            <content>
              <p>is a matter that <role refersTo="#minister">the Minister</role> considers materially relevant to determining whether the action is in the national interest.</p>
            </content>
          </paragraph>
        </section>
        <section eId="part-2__sec-9">
          <num>9</num>
          <heading>Meaning of purchased payment facility and holder of the stored value</heading>
          <subsection eId="part-2__sec-9__subsec-1">
            <num>1</num>
            <content>
              <p>	(1)	A <b><i>purchased payment facility</i></b> is a facility (other than cash) in relation to which the following conditions are satisfied: </p>
            </content>
            <paragraph eId="part-2__sec-9__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>the facility is purchased by a person from another person; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-9__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>the facility is able to be used as a means of making payments up to the amount that, from time to time, is available for use under the conditions applying to the facility; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-9__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>those payments are to be made by the provider of the facility or by a person acting under an arrangement with the provider (rather than by the user of the facility).</p>
              </content>
              <content>
                <p>However, a facility covered by a declaration under subsection (3) is not a purchased payment facility for the purposes of this Act.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-9__subsec-2">
            <num>2</num>
            <content>
              <p>	(2)	The <b><i>holder of the stored value</i></b>, in relation to a purchased payment facility, is the person who is to make payments as mentioned in paragraph (1)(c).</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-9__subsec-3">
            <num>3</num>
            <content>
              <p>The Reserve Bank may, by legislative instrument, declare that this Act does not apply to a specified facility, or to facilities included in a specified class of facilities, if the Reserve Bank considers that it is not appropriate for this Act to apply to the facility, or to each facility of that class, having regard to:</p>
            </content>
            <paragraph eId="part-2__sec-9__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>any restrictions that limit the number or types of people who may purchase the facility; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-9__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>any restrictions that limit the number or types of people to whom payments may be made using the facility.</p>
              </content>
              <content>
                <p>The Reserve Bank may have regard to other matters that it considers are relevant, but is not required to do so.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-9__subsec-4">
            <num>4</num>
            <content>
              <p>In this section:</p>
            </content>
            <paragraph eId="part-2__sec-9__subsec-4__para-a">
              <num>a</num>
              <content>
                <p>a reference to a facility includes a reference to a right to use a facility; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-9__subsec-4__para-b">
              <num>b</num>
              <content>
                <p>a reference to the purchase of a facility includes a reference to the payment of an amount for a right to use a facility.</p>
              </content>
            </paragraph>
          </subsection>

          <heading>Functions and powers under the Regulatory Powers Act</heading>
          <content>
            <p>Unless this Act expressly provides otherwise, a reference in this Act to a function or power under this Act includes a reference to a function or power under the Regulatory Powers Act as it applies in relation to this Act.</p>
          </content>
        </section>

          <num>9B</num>
          <heading>Contravening an offence provision or a civil penalty provision</heading>
          <subsection eId="part-2__sec-9B__subsec-1">
            <num>1</num>
            <content>
              <p>	(1)	This section applies if a provision of this Act provides that a person contravening another provision of this Act (the <b><i>conduct provision</i></b>) commits an offence or is liable to a civil penalty.</p>

          </subsection>

              <p>For the purposes of this Act, and the Regulatory Powers Act to the extent that it relates to this Act, a reference to a contravention of an offence provision or a civil penalty provision includes a reference to a contravention of the conduct provision.</p>

            <heading>Meaning of special regulator</heading>

                <p>	(1)	The following are <b><i>special regulators</i></b>:</p>

              <paragraph eId="part-3__dvs-2A__sec-11C__subsec-1__para-a">
                <num>a</num>

                  <p>the Reserve Bank;</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-2A__sec-11C__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>any entity prescribed by the regulations as a special regulator.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-2A__sec-11C__subsec-2">
              <num>2</num>
              <content>
                <p>	(2)	An entity may be prescribed as a special regulator only if the entity is a Commonwealth entity (within the meaning of the <i>Public Governance, Performance and Accountability Act 2013</i>) or a Commonwealth company (within the meaning of that Act).</p>

            <num>11D</num>
            <heading>Nomination of special regulators</heading>
            <subsection eId="part-3__dvs-2A__sec-11D__subsec-1">
              <num>1</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> may, by legislative instrument, nominate one or more special regulators in relation to a special designated payment system if <role refersTo="#minister">the Minister</role> considers that doing so is in the national interest.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-2A__sec-11D__subsec-2">
              <num>2</num>
              <content>
                <p>	(2)	If a special regulator is nominated in relation to a special designated payment system under subsection (1), then the special regulator is a <b><i>nominated special regulator</i></b> in relation to that special designated payment system.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-2A__sec-11D__subsec-3">
              <num>3</num>
              <content>
                <p>The special regulator is a nominated special regulator either:</p>
              </content>
              <paragraph eId="part-3__dvs-2A__sec-11D__subsec-3__para-a">
                <num>a</num>
                <content>
                  <p>for the period specified in the nomination; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-2A__sec-11D__subsec-3__para-b">
                <num>b</num>
                <content>
                  <p>if no period is specified—until the nomination is revoked.</p>
                </content>
                <content>
                  <p>Conditions on nomination</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-2A__sec-11D__subsec-4">
              <num>4</num>
              <content>
                <p>Before nominating a special regulator under subsection (1), <role refersTo="#minister">the Minister</role> must:</p>
              </content>
              <paragraph eId="part-3__dvs-2A__sec-11D__subsec-4__para-a">
                <num>a</num>
                <content>
                  <p>consult the special regulator; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-2A__sec-11D__subsec-4__para-b">
                <num>b</num>
                <content>
                  <p>if <role refersTo="#minister">the Minister</role> is not the responsible Minister for the special regulator—obtain written consent to the nomination from the responsible Minister; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-2A__sec-11D__subsec-4__para-c">
                <num>c</num>
                <content>
                  <p>be satisfied that the nomination is consistent with any functions of the special regulator under this Act or any other Act (and with any requirements that apply to the performance of those functions); and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-2A__sec-11D__subsec-4__para-d">
                <num>d</num>
                <content>
                  <p>consider the following:</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-2A__sec-11D__subsec-4__para-i">

                  <p>the outcome of the consultation undertaken by <role refersTo="#minister">the Minister</role> under paragraph (a);</p>

              </paragraph>

                  <p>any other matter <role refersTo="#minister">the Minister</role> considers relevant.</p>

                  <p>Revocation</p>

                <p><role refersTo="#minister">The Minister</role> may revoke a nomination made under subsection (1) if, at the time of the revocation, <role refersTo="#minister">the Minister</role> considers that the nomination is no longer necessary or appropriate.</p>

            <heading>Functions and powers of nominated special regulators</heading>

                <p>Subject to this section, a nominated special regulator in relation to a special designated payment system may perform the functions, and exercise the powers, of a nominated special regulator under this Act in relation to that special designated payment system.</p>

                <p>Restrictions relating to Ministerial directions</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-2A__sec-11E__subsec-2">
              <num>2</num>
              <content>
                <p>A nominated special regulator must not perform a function, or exercise a power, of the kind mentioned in subsection (1) unless:</p>
              </content>
              <paragraph eId="part-3__dvs-2A__sec-11E__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p><role refersTo="#minister">the Minister</role> has given the nominated special regulator a matters direction under subsection 11F(1), the effect of which is that specified matters must be considered by the nominated special regulator before performing the function or exercising the power; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-2A__sec-11E__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p><i>	</i>(b)	the nominated special regulator has considered those matters.</p>
                </content>

                <p>In performing a function, or exercising a power, of a kind mentioned in subsection (1), a nominated special regulator must comply with any directions given to the nominated special regulator by <role refersTo="#minister">the Minister</role> under subsection 11F(1).</p>

              <content>
                <p>Consultation</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-2A__sec-11E__subsec-5">
              <num>5</num>
              <content>
                <p>Before a nominated special regulator in relation to a special designated payment system performs a function, or exercises a power, under this Act in relation to the special designated payment system, the nominated special regulator must consult:</p>
              </content>
              <paragraph eId="part-3__dvs-2A__sec-11E__subsec-5__para-a">
                <num>a</num>
                <content>
                  <p>the Reserve Bank (if the nominated special regulator is not the Reserve Bank); and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-2A__sec-11E__subsec-5__para-b">
                <num>b</num>
                <content>
                  <p>if there are one or more other nominated special regulators in relation to the special designated payment system—each of those other nominated special regulators.</p>
                </content>
              </paragraph>
            </subsection>
          </section>
          <section eId="part-3__dvs-2A__sec-11F">
            <num>11F</num>
            <heading>Ministerial directions to nominated special regulators</heading>
            <subsection eId="part-3__dvs-2A__sec-11F__subsec-1">
              <num>1</num>
              <content>
                <p>Subject to this section, <role refersTo="#minister">the Minister</role> may, by legislative instrument, give directions of the following kinds to a nominated special regulator in relation to the performance of its functions, or the exercise of its powers, under this Act in relation to a special designated payment system:</p>
              </content>
              <paragraph eId="part-3__dvs-2A__sec-11F__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>	(a)	a direction (a <b><i>matters direction</i></b>)<b><i> </i></b>specifying matters that must be considered before performing or exercising such a function or power;</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-2A__sec-11F__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>	(b)	a direction (a <b><i>purposes direction</i></b>)<b><i> </i></b>specifying purposes for which such a function or power must, or must not, be performed or exercised.</p>

              <num>2</num>
              <content>
                <p>However, <role refersTo="#minister">the Minister</role> must not give a nominated special regulator a purposes direction in relation to a function or power unless, before or at the same time as giving the purposes direction, <role refersTo="#minister">the Minister</role> gives the nominated special regulator a matters direction in relation to that function or power.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-2A__sec-11F__subsec-3">
              <num>3</num>
              <content>
                <p>To avoid doubt, a direction given under subsection (1) may relate to all functions and powers of the kind mentioned in that subsection, or only to one or more specified functions or powers of that kind.</p>
              </content>
              <content>
                <p>Conditions on giving directions</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-2A__sec-11F__subsec-4">
              <num>4</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> must not give a direction under subsection (1) unless <role refersTo="#minister">the Minister</role> considers that doing so is in the national interest.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-2A__sec-11F__subsec-5">
              <num>5</num>
              <content>
                <p>Before giving a direction to a nominated special regulator under subsection (1), <role refersTo="#minister">the Minister</role> must:</p>
              </content>
              <paragraph eId="part-3__dvs-2A__sec-11F__subsec-5__para-a">
                <num>a</num>
                <content>
                  <p>consult the nominated special regulator; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-2A__sec-11F__subsec-5__para-b">
                <num>b</num>
                <content>
                  <p>if the nominated special regulator is not the Reserve Bank—consult the Reserve Bank; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-2A__sec-11F__subsec-5__para-c">
                <num>c</num>
                <content>
                  <p>if <role refersTo="#minister">the Minister</role> is not the responsible Minister for the nominated special regulator—obtain written consent to the direction from the responsible Minister; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-2A__sec-11F__subsec-5__para-d">
                <num>d</num>
                <content>
                  <p>be satisfied that giving the direction is consistent with any functions of the nominated special regulator under this Act or any other Act (and with any requirements that apply to the performance of those functions); and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-2A__sec-11F__subsec-5__para-e">
                <num>e</num>
                <content>
                  <p>consider the following:</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-2A__sec-11F__subsec-5__para-i">
                <num>i</num>
                <content>
                  <p>the outcome of the consultation undertaken by <role refersTo="#minister">the Minister</role> under paragraph (a) and (if applicable) paragraph (b);</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-2A__sec-11F__subsec-5__para-ii">
                <num>ii</num>
                <content>
                  <p>any other matter <role refersTo="#minister">the Minister</role> considers relevant.</p>
                </content>
                <content>
                  <p>Restrictions on content of directions</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-2A__sec-11F__subsec-6">
              <num>6</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> must not give a direction under subsection (1) in relation to functions and powers under any of the following:</p>
              </content>
              <paragraph eId="part-3__dvs-2A__sec-11F__subsec-6__para-a">
                <num>a</num>
                <content>
                  <p><ref href="#sec-26">section 26</ref> (which deals with requests for information);</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-2A__sec-11F__subsec-6__para-b">
                <num>b</num>
                <content>
                  <p><ref href="#sec-30A">section 30A</ref> (which deals with enforceable undertakings);</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-2A__sec-11F__subsec-6__para-c">
                <num>c</num>
                <content>
                  <p><ref href="#sec-31">section 31</ref> or 31A (which deal with delegations);</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-2A__sec-11F__subsec-6__para-d">

                  <p>the Regulatory Powers Act as it applies in relation to this Act.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-2A__sec-11F__subsec-7">
              <num>7</num>
              <content>
                <p>A direction given under subsection (1) may specify matters or purposes that relate to a particular special designated payment system, but must not specify matters or purposes that relate to a particular participant in a special designated payment system.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-2A__sec-11F__subsec-8">
              <num>8</num>
              <content>
                <p>To avoid doubt, a direction given under subsection (1) must not require a nominated special regulator to do any of the following:</p>
              </content>
              <paragraph eId="part-3__dvs-2A__sec-11F__subsec-8__para-a">
                <num>a</num>
                <content>
                  <p>impose, vary or repeal a particular provision of an access regime;</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-2A__sec-11F__subsec-8__para-b">
                <num>b</num>
                <content>
                  <p>determine, vary or revoke a particular standard;</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-2A__sec-11F__subsec-8__para-c">
                <num>c</num>
                <content>
                  <p>give, vary or revoke a particular direction.</p>
                </content>
                <content>
                  <p>When direction is in force</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-2A__sec-11F__subsec-9">
              <num>9</num>
              <content>
                <p>A direction given under subsection (1):</p>
              </content>
              <paragraph eId="part-3__dvs-2A__sec-11F__subsec-9__para-a">
                <num>a</num>
                <content>
                  <p>comes into force:</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-2A__sec-11F__subsec-9__para-i">
                <num>i</num>
                <content>
                  <p>unless subparagraph (ii) of this paragraph applies—on the day on which it is given; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-2A__sec-11F__subsec-9__para-ii">
                <num>ii</num>
                <content>
                  <p>if the direction specifies a later day as the day on which it comes into force—on the day so specified; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-2A__sec-11F__subsec-9__para-b">
                <num>b</num>
                <content>
                  <p>continues in force until it is revoked.</p>
                </content>
                <content>
                  <p>Revocation</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-2A__sec-11F__subsec-10">
              <num>10</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> may revoke a direction given under subsection (1) if, at the time of the revocation, <role refersTo="#minister">the Minister</role> considers that the direction is no longer necessary or appropriate.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-3__dvs-2A__sec-11G">
            <num>11G</num>
            <heading>Reports by nominated special regulators</heading>
            <subsection eId="part-3__dvs-2A__sec-11G__subsec-1">
              <num>1</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> may, by notice in writing, request a nominated special regulator in relation to a special designated payment system to report in writing to <role refersTo="#minister">the Minister</role> on:</p>
              </content>
              <paragraph eId="part-3__dvs-2A__sec-11G__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>the performance of functions and exercise of powers under this Act by the nominated special regulator; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-2A__sec-11G__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>without limiting paragraph (a), the nominated special regulator’s compliance with a direction given to the nominated special regulator under subsection 11F(1).</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-2A__sec-11G__subsec-2">
              <num>2</num>
              <content>
                <p>The nominated special regulator must comply with a request made by <role refersTo="#minister">the Minister</role> under subsection (1).</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-2A__sec-11G__subsec-3">
              <num>3</num>
              <content>
                <p>If <role refersTo="#minister">the Minister</role> is not the responsible Minister for the nominated special regulator, the nominated special regulator must also provide a copy of a report prepared under subsection (1) to the responsible Minister.</p>

          <heading>Access regimes</heading>

            <p>Subdivision A—Operation of access regimes</p>
          </content>

            <num>12</num>
            <heading>Imposition of access regime</heading>
            <subsection eId="part-3__dvs-3__sec-12__subsec-1">
              <num>1</num>
              <content>
                <p>The Reserve Bank may, by legislative instrument, impose an access regime on participants in a designated payment system.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-3__sec-12__subsec-1A">
              <num>1A</num>
              <content>
                <p>A nominated special regulator in relation to a special designated payment system may, by legislative instrument, impose an access regime on participants in that special designated payment system.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-3__sec-12__subsec-2">
              <num>2</num>
              <content>
                <p>The access regime imposed must be one that the Reserve Bank or the nominated special regulator (as the case may be) considers appropriate, having regard to:</p>
              </content>
              <paragraph eId="part-3__dvs-3__sec-12__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>in the case of an access regime imposed by the Reserve Bank under subsection (1)—whether imposing the access regime would be in the public interest; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-12__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>the interests of the current participants in the system; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-12__subsec-2__para-c">
                <num>c</num>
                <content>
                  <p>the interests of people who, in the future, may want access to the system; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-12__subsec-2__para-d">
                <num>d</num>
                <content>
                  <p>any other matters the Reserve Bank or the nominated special regulator (as the case may be) considers relevant.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-3__sec-12__subsec-3">
              <num>3</num>
              <content>
                <p>Without limiting subsection (1) or (1A), the Reserve Bank or the nominated special regulator (as the case may be) may, in an instrument made under either of those subsections:</p>
              </content>
              <paragraph eId="part-3__dvs-3__sec-12__subsec-3__para-a">
                <num>a</num>
                <content>
                  <p>specify participants or classes of participants to whom the access regime does or does not apply; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-12__subsec-3__para-b">
                <num>b</num>
                <content>
                  <p>provide that the access regime applies differently in relation to different participants or classes of participants.</p>
                </content>

                <p>As soon as practicable after imposing the access regime, the Reserve Bank or the nominated special regulator must provide notification under <ref href="#sec-29">section 29</ref>.</p>

              <content>
                <p>A failure to comply with subsection (5) does not affect the validity of the access regime.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-3__dvs-3__sec-13">
            <num>13</num>
            <heading>When access regimes are in force</heading>
            <content>
              <p>An access regime:</p>
            </content>
            <paragraph eId="part-3__dvs-3__sec-13__para-a">
              <num>a</num>
              <content>
                <p>	(a)	comes into force on the day specified in the instrument imposing the regime under <i>Legislation Act 2003</i>; and<ref href="#sec-12">section 12</ref>, which must not be earlier than the day after the instrument is registered on the Federal Register of Legislation under the </p>
              </content>
            </paragraph>
            <paragraph eId="part-3__dvs-3__sec-13__para-b">
              <num>b</num>
              <content>
                <p>may be varied as provided in <ref href="#sec-14">section 14</ref>; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__dvs-3__sec-13__para-c">
              <num>c</num>
              <content>
                <p>remains in force until it ceases to be in force as provided in <ref href="#sec-15">section 15</ref>.</p>
              </content>
            </paragraph>
          </section>
          <section eId="part-3__dvs-3__sec-14">
            <num>14</num>
            <heading>Variation of access regime</heading>
            <subsection eId="part-3__dvs-3__sec-14__subsec-1">
              <num>1</num>
              <content>
                <p>The Reserve Bank or a nominated special regulator in relation to a special designated payment system may, by legislative instrument, vary an access regime that it has imposed if the Reserve Bank or the nominated special regulator (as the case may be) considers it is appropriate to do so, having regard to:</p>
              </content>
              <paragraph eId="part-3__dvs-3__sec-14__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>in the case of an access regime imposed by the Reserve Bank under subsection 12(1)—whether the variation would be in the public interest; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-14__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>the interests of the current participants in the system; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-14__subsec-1__para-c">
                <num>c</num>
                <content>
                  <p>the interests of people who, in the future, may want access to the system; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-14__subsec-1__para-d">
                <num>d</num>
                <content>
                  <p>any other matters the Reserve Bank or the nominated special regulator (as the case may be) considers relevant.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-3__sec-14__subsec-5">
              <num>5</num>
              <content>
                <p>If the Reserve Bank or the nominated special regulator varies the access regime it must, as soon as practicable, provide notification under <ref href="#sec-29">section 29</ref>.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-3__sec-14__subsec-6">
              <num>6</num>
              <content>
                <p>A failure to comply with subsection (5) does not affect the validity of a variation of the access regime.</p>
              </content>
            </subsection>

                <p>	(7)	A variation of the access regime takes effect on the day specified in the instrument, which must not be earlier than the day after the instrument is registered on the Federal Register of Legislation under the <i>Legislation Act 2003</i>.</p>

          </section>
          <section eId="part-3__dvs-3__sec-15">
            <num>15</num>
            <heading>When access regimes cease to be in force</heading>
            <subsection eId="part-3__dvs-3__sec-15__subsec-1">
              <num>1</num>
              <content>
                <p>An access regime that the Reserve Bank or a nominated special regulator has imposed ceases to be in force if:</p>
              </content>
              <paragraph eId="part-3__dvs-3__sec-15__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>the access regime contains an expiry date and that date is reached; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-15__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>the entity that imposed the access regime, on the application of the participants in the payment system concerned, revokes the access regime; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-15__subsec-1__para-c">
                <num>c</num>
                <content>
                  <p>the entity that imposed the access regime revokes the access regime on its own initiative; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-15__subsec-1__para-d">
                <num>d</num>
                <content>
                  <p>the payment system concerned ceases to exist; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-15__subsec-1__para-e">
                <num>e</num>
                <content>
                  <p>either:</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-15__subsec-1__para-i">
                <num>i</num>
                <content>
                  <p>in the case of an access regime imposed by the Reserve Bank under subsection 12(1)—the payment system concerned ceases to be a designated payment system; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-15__subsec-1__para-ii">
                <num>ii</num>
                <content>
                  <p>in the case of an access regime imposed by a nominated special regulator under subsection 12(1A)—the payment system concerned ceases to be a special designated payment system.</p>
                </content>

                <p>An application for the revocation of the regime must comply with the applicable requirements determined under <ref href="#sec-27">section 27</ref>.</p>

            </subsection>
            <subsection eId="part-3__dvs-3__sec-15__subsec-3">
              <num>3</num>
              <content>
                <p>The entity that imposed the access regime (whether the Reserve Bank or a nominated special regulator) may, by legislative instrument, revoke the access regime (pursuant to an application or on its own initiative) if the entity considers it appropriate to do so, having regard to:</p>
              </content>
              <paragraph eId="part-3__dvs-3__sec-15__subsec-3__para-a">
                <num>a</num>
                <content>
                  <p>in the case of an access regime imposed by the Reserve Bank under subsection 12(1)—whether revoking the access regime would be in the public interest; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-15__subsec-3__para-b">
                <num>b</num>
                <content>
                  <p>the interests of the current participants in the system; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-15__subsec-3__para-c">
                <num>c</num>
                <content>
                  <p>the interests of people who, in the future, may want access to the system; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-15__subsec-3__para-d">
                <num>d</num>
                <content>
                  <p>any other matters the entity considers relevant.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-3__sec-15__subsec-5">
              <num>5</num>
              <content>
                <p>If the entity that imposed the access regime revokes the access regime it must, as soon as practicable, provide notification under <ref href="#sec-29">section 29</ref>.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-3__sec-15__subsec-6">
              <num>6</num>
              <content>
                <p>A failure to comply with subsection (5) does not invalidate the revocation of the access regime.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-3__sec-15__subsec-7">
              <num>7</num>
              <content>
                <p>	(7)	The revocation of the access regime takes effect on the day specified in the instrument, which must not be earlier than the day after the instrument is registered on the Federal Register of Legislation under the <i>Legislation Act 2003</i>.</p>

            </subsection>
          </section>
          <section eId="part-3__dvs-3__sec-15AA">
            <num>15AA</num>
            <heading>Conflicts between access regimes</heading>
            <subsection eId="part-3__dvs-3__sec-15AA__subsec-1">
              <num>1</num>
              <content>
                <p>This section applies if:</p>
              </content>
              <paragraph eId="part-3__dvs-3__sec-15AA__subsec-1__para-a">
                <num>a</num>
                <content>

            <heading>Authorisation of conduct under access regime for the purposes of the Competition and Consumer Act 2010</heading>
            <content>
              <p>		For the purposes of subparagraph 51(1)(a)(i) of the <i>Competition and Consumer Act 2010</i>, anything that is done:</p>
            </content>
            <paragraph eId="part-3__dvs-3__sec-15A__para-a">
              <num>a</num>
              <content>
                <p>by a participant in a payment system that is a designated payment system or a special designated payment system (or both) under an access regime; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__dvs-3__sec-15A__para-b">
              <num>b</num>
              <content>
                <p>in accordance with that access regime;</p>
              </content>
              <content>
                <p>is taken to be specified in, and specifically authorised by, this Act.</p>
                <p>Subdivision B—Enforcement of access regimes</p>
              </content>
            </paragraph>

            <num>16</num>
            <heading>Right to ask for directions</heading>
            <subsection eId="part-3__dvs-3__sec-16__subsec-1">
              <num>1</num>
              <content>
                <p>This section applies if a person who has been denied access to a payment system that is a designated payment system or a special designated payment system (or both) considers that the denial of access constitutes, or is attributable (wholly or partly) to, a breach of a provision of an access regime by a participant.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-3__sec-16__subsec-2">
              <num>2</num>
              <content>
                <p>The person may ask the entity that imposed the access regime (whether the Reserve Bank or a nominated special regulator) to use its power under <ref href="#sec-21">section 21</ref> to give a direction to remedy the situation.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-3__dvs-3__sec-17">
            <num>17</num>
            <heading>Right to apply to the Federal Court</heading>
            <subsection eId="part-3__dvs-3__sec-17__subsec-1">
              <num>1</num>
              <content>
                <p>If a person who has been denied access to a payment system that is a designated payment system or a special designated payment system (or both) considers that the denial of access constitutes, or is attributable (wholly or partly) to, a breach of a provision of an access regime by a participant, the person may apply to the Federal Court for an order under subsection (3).</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-3__sec-17__subsec-2">
              <num>2</num>
              <content>
                <p>The person must notify the entity that imposed the access regime (whether the Reserve Bank or a nominated special regulator) of the application to the Federal Court.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-3__sec-17__subsec-2A">
              <num>2A</num>
              <content>
                <p>The entity may apply to the Federal Court to be joined as a party to the proceedings for the order.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-3__sec-17__subsec-3">
              <num>3</num>
              <content>
                <p>If the Federal Court is satisfied that the participant has breached a provision of the access regime, the Court may make all or any of the following orders:</p>
              </content>
              <paragraph eId="part-3__dvs-3__sec-17__subsec-3__para-a">
                <num>a</num>
                <content>
                  <p>an order directing the participant to comply with that provision of the access regime;</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-17__subsec-3__para-b">
                <num>b</num>
                <content>
                  <p>an order directing the participant to compensate any other person who has suffered loss or damage as a result of the breach;</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-17__subsec-3__para-c">
                <num>c</num>
                <content>
                  <p>any other order that the Court considers appropriate.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-3__sec-17__subsec-4">

                <p>The Federal Court may discharge or vary an order made under this section.</p>
              </content>
            </subsection>

          <heading>Standards</heading>

            <heading>Making of standards</heading>
            <subsection eId="part-3__dvs-4__sec-18__subsec-1">

                <p>The Reserve Bank may, by legislative instrument, determine standards to be complied with by participants in a designated payment system if it considers that determining the standards is in the public interest.</p>

                  <p>specify participants or classes of participants to whom the standard does or does not apply; or</p>

                  <p>provide that the standard applies differently in relation to different participants or classes of participants.</p>

                  <p>	(a)	comes into force on the day specified in the determination, which must not be earlier than the day after the determination is registered on the Federal Register of Legislation under the <i>Legislation Act 2003</i>; and</p>

                <num>b</num>

                  <p>continues in force until it is revoked.</p>

                <p>If the Reserve Bank or a nominated special regulator determines a standard, or varies or revokes a standard, it must, as soon as practicable, provide notification under <ref href="#sec-29">section 29</ref>.</p>

                <p>A failure to comply with subsection (6) does not affect the validity of a standard or of the variation or revocation of a standard.</p>

            <heading>Conflicts between standards</heading>

                <p>This section applies if:</p>

                <num>a</num>
                <content>
                  <p>a particular payment system is both a designated payment system and a special designated payment system; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-4__sec-18AA__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>	(b)	the Reserve Bank has, under subsection 18(1), determined a standard (the <b><i>normal standard</i></b><i>) </i>to be complied with by participants in the payment system; and</p>
                </content>
              </paragraph>

            <heading>Authorisation of conduct under certain standards for the purposes of the Competition and Consumer Act 2010</heading>
            <subsection eId="part-3__dvs-4__sec-18A__subsec-1">

                <p>	(1)	For the purposes of subparagraph 51(1)(a)(i) of the <i>Competition and Consumer Act 2010</i>, anything that is done:</p>
              </content>
              <paragraph eId="part-3__dvs-4__sec-18A__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>by a participant in relation to the setting, or charging, of wholesale fees (also known as interchange fees) payable under a payment system to which an interchange fees standard applies; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-4__sec-18A__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>in accordance with that standard;</p>
                </content>
                <content>
                  <p>is taken to be specified in, and specifically authorised by, this Act.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-4__sec-18A__subsec-2">
              <num>2</num>
              <content>
                <p>In this section:</p>
              </content>
              <content>
                <p><b><i>interchange fees standard</i></b> means any of the following standards as amended and in force from time to time:</p>
              </content>
              <paragraph eId="part-3__dvs-4__sec-18A__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>a standard that is known as Standard No. 1, The Setting of Wholesale (“Interchange”) Fees and that was determined by the Reserve Bank on <date date="2002-08-26">26 August 2002</date>;</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-4__sec-18A__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>a standard specified by the regulations for the purposes of this paragraph.</p>
                </content>
              </paragraph>
            </subsection>
          </section>
        </division>
        <division eId="part-3__dvs-5">
          <num>5</num>
          <heading>Arbitration of disputes</heading>
          <section eId="part-3__dvs-5__sec-19">
            <num>19</num>
            <heading>Disputes to which Division applies</heading>
            <content>
              <p>This Division applies to the following kinds of disputes:</p>
            </content>
            <paragraph eId="part-3__dvs-5__sec-19__para-a">
              <num>a</num>
              <content>
                <p>a dispute between 2 or more participants in a designated payment system (that is not also a special designated payment system) that arises out of, or that is otherwise connected with, that system;</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__dvs-5__sec-19__para-b">
              <num>b</num>
              <content>
                <p>a dispute between a person and 2 or more participants in a payment system that is a designated payment system or a special designated payment system (or both) and for which there is an access regime, being a dispute relating to whether the access regime is being complied with.</p>
              </content>
            </paragraph>
          </section>
          <section eId="part-3__dvs-5__sec-20">
            <num>20</num>
            <heading>Arbitration of disputes</heading>
            <subsection eId="part-3__dvs-5__sec-20__subsec-1">
              <num>1</num>
              <content>
                <p>The Reserve Bank may arrange for a dispute to which this Division applies to be settled by arbitration in accordance with this section if:</p>
              </content>
              <paragraph eId="part-3__dvs-5__sec-20__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>it considers that the dispute raises issues related to:</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-5__sec-20__subsec-1__para-i">
                <num>i</num>
                <content>
                  <p>the financial safety of payment systems for participants; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-5__sec-20__subsec-1__para-ii">
                <num>ii</num>
                <content>
                  <p>the efficiency of payment systems; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-5__sec-20__subsec-1__para-iii">
                <num>iii</num>
                <content>
                  <p>the competitiveness of payment systems; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-5__sec-20__subsec-1__para-iv">
                <num>iv</num>
                <content>
                  <p>risk to the financial system; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-5__sec-20__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>the parties to the dispute agree to the Reserve Bank arranging the arbitration; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-5__sec-20__subsec-1__para-c">
                <num>c</num>
                <content>
                  <p>if the dispute is of a kind mentioned in paragraph 19(b)—the dispute relates to whether an access regime imposed by the Reserve Bank under subsection 12(1) is being complied with.</p>
                </content>

                <p>A nominated special regulator in relation to a special designated payment system may arrange for a dispute to which this Division applies to be settled by arbitration in accordance with this section if:</p>

              <paragraph eId="part-3__dvs-5__sec-20__subsec-1A__para-a">
                <num>a</num>
                <content>
                  <p>the dispute is of a kind mentioned in paragraph 19(b); and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-5__sec-20__subsec-1A__para-b">
                <num>b</num>
                <content>
                  <p>the dispute relates to whether an access regime imposed by the nominated special regulator under subsection 12(1A) is being complied with; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-5__sec-20__subsec-1A__para-c">
                <num>c</num>
                <content>
                  <p>the parties to the dispute agree to the nominated special regulator arranging the arbitration.</p>
                </content>

                <p>The arbitration is to be conducted:</p>

                  <p>in the case of an arbitration arranged by the Reserve Bank—by the Governor of the Reserve Bank, or by a person appointed in writing by the Governor to conduct the arbitration; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-5__sec-20__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>in the case of an arbitration arranged by a nominated special regulator—by the head of the nominated special regulator, or by a person appointed in writing by the head of the nominated special regulator to conduct the arbitration.</p>

                <p>The person conducting an arbitration is not subject to any action, claim or demand by, or liable to, any person in respect of anything done, or omitted to be done, in good faith in connection with the arbitration.</p>

            </subsection>
            <subsection eId="part-3__dvs-5__sec-20__subsec-4">
              <num>4</num>
              <content>
                <p>The arbitration must be conducted in accordance with the regulations.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-5__sec-20__subsec-5">

                <p>The fact the dispute is being, or has been, settled by arbitration under this section does not prevent a party to the dispute from bringing an action in a court in connection with the dispute, unless the court otherwise orders.</p>

                <p>The Reserve Bank may give a direction to a participant in a designated payment system if the Reserve Bank considers that:</p>
              </content>
              <paragraph eId="part-3__dvs-6__sec-21__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>the participant has failed to comply with a standard determined by the Reserve Bank under subsection 18(1); or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-6__sec-21__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>the participant has failed to comply with an access regime imposed by the Reserve Bank under subsection 12(1).</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-6__sec-21__subsec-1A">
              <num>1A</num>
              <content>
                <p>A nominated special regulator in relation to a special designated payment system may give a direction to a participant in the special designated payment system if the nominated special regulator considers that:</p>
              </content>
              <paragraph eId="part-3__dvs-6__sec-21__subsec-1A__para-a">
                <num>a</num>
                <content>
                  <p>the participant has failed to comply with a standard determined by the nominated special regulator under subsection 18(1A); or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-6__sec-21__subsec-1A__para-b">
                <num>b</num>
                <content>
                  <p>the participant has failed to comply with an access regime imposed by the nominated special regulator under subsection 12(1A).</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-6__sec-21__subsec-2">
              <num>2</num>
              <content>
                <p>The direction is to require the participant to take specified action, or to refrain from specified action, as the Reserve Bank or the nominated special regulator (as the case may be) considers appropriate having regard to the failure.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-6__sec-21__subsec-3">
              <num>3</num>
              <content>
                <p>The direction must not be inconsistent with any applicable standards and with any applicable access regime (whether or not the standard was determined or the access regime was imposed by the entity giving the direction).</p>

              <content>
                <p>The direction may deal with the time by which, or the period during which, it is to be complied with.</p>
              </content>
            </subsection>

                <p>The direction is to be given by notice in writing given to the participant.</p>
              </content>

                <p>When direction is in force</p>

                <p>The Reserve Bank or the nominated special regulator (as the case may be) may revoke the direction by notice in writing given to the participant if, at the time of revocation, it considers that the direction is no longer necessary or appropriate.</p>

                <p>Contravention of directions</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-6__sec-21__subsec-8">
              <num>8</num>
              <content>
                <p>The participant contravenes this subsection if:</p>
              </content>
              <paragraph eId="part-3__dvs-6__sec-21__subsec-8__para-a">
                <num>a</num>
                <content>
                  <p>the participant does, or fails to do, an act; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-6__sec-21__subsec-8__para-b">

                <p>If a contravention of the direction occurs in circumstances that give rise to the participant committing an offence against subsection (9), the participant commits an offence against that subsection in respect of:</p>

                  <p>the day on which the contravention occurs; and</p>
                </content>
              </paragraph>

            <heading>Conflicts between directions</heading>

                <p>This section applies if:</p>
              </content>
              <paragraph eId="part-3__dvs-6__sec-21A__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>a particular payment system is both a designated payment system and a special designated payment system; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-6__sec-21A__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>	(b)	the Reserve Bank has, under subsection 21(1), given a direction (a <b><i>normal direction</i></b>) to a participant in the payment system; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-6__sec-21A__subsec-1__para-c">
                <num>c</num>
                <content>
                  <p>	(c)	a nominated special regulator has, under subsection 21(1A), given a direction (a <b><i>special direction</i></b>) to a participant<i> </i>in the payment system; and</p>

                <num>d</num>

                  <p>the normal direction is, to any extent, inconsistent with the special direction.</p>

                <p>For the purposes of this Act, the normal direction does not apply to the extent that it is inconsistent with the special direction.</p>

      </part>

        <num>4</num>
        <heading>Regulation of purchased payment facilities</heading>
        <section eId="part-4__sec-22">
          <num>22</num>
          <heading>Holder of stored value must be an ADI or be authorised or exempted under this Part</heading>
          <subsection eId="part-4__sec-22__subsec-1">
            <num>1</num>
            <content>
              <p>A constitutional corporation commits an offence if:</p>
            </content>
            <paragraph eId="part-4__sec-22__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>it is the holder of the stored value of a purchased payment facility; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-22__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>	(b)	it is not an authorised deposit-taking institution, within the meaning of the <i>Banking Act 1959</i>; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-22__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>there is no authority or exemption in force under <ref href="#sec-23">section 23</ref> or 25 that applies to the corporation and the purchased payment facility.</p>

          <num>23</num>
          <heading>Authority to be the holder of the stored value</heading>
          <subsection eId="part-4__sec-23__subsec-1">
            <num>1</num>
            <content>
              <p>A constitutional corporation may apply to the Reserve Bank for an authority to be the holder of the stored value of a class of purchased payment facilities. The application must comply with the applicable requirements determined under <ref href="#sec-27">section 27</ref>.</p>
            </content>
          </subsection>
          <subsection eId="part-4__sec-23__subsec-2">
            <num>2</num>
            <content>
              <p>The Reserve Bank may, by notifiable instrument, grant <role refersTo="#authority">the authority</role> if it is satisfied that the corporation will be able to satisfy its obligations as the holder of the stored value of purchased payment facilities of the relevant class.</p>
            </content>
          </subsection>
          <subsection eId="part-4__sec-23__subsec-4">
            <num>4</num>
            <content>
              <p>The Reserve Bank may, at any time, by notifiable instrument:</p>
            </content>
            <paragraph eId="part-4__sec-23__subsec-4__para-a">
              <num>a</num>
              <content>
                <p>impose conditions, or additional conditions, on <role refersTo="#authority">the authority</role>; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-23__subsec-4__para-b">
              <num>b</num>
              <content>
                <p>vary or revoke conditions imposed on <role refersTo="#authority">the authority</role>.</p>
              </content>
              <content>
                <p>The conditions must be aimed at ensuring the corporation meets its obligations as holder of the stored value of purchased payment facilities of the relevant class.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-4__sec-23__subsec-5">
            <num>5</num>
            <content>
              <p><role refersTo="#authority">The authority</role>:</p>
            </content>
            <paragraph eId="part-4__sec-23__subsec-5__para-a">
              <num>a</num>
              <content>
                <p>	(a)	comes into force on the day specified in the authority, which must not be earlier than the day after the authority is registered on the Federal Register of Legislation under the <i>Legislation Act 2003</i>; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-23__subsec-5__para-b">
              <num>b</num>
              <content>
                <p>continues in force until it is revoked.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-4__sec-23__subsec-6">
            <num>6</num>
            <content>
              <p>The Reserve Bank may, by notifiable instrument, revoke <role refersTo="#authority">the authority</role> if:</p>
            </content>
            <paragraph eId="part-4__sec-23__subsec-6__para-a">
              <num>a</num>
              <content>
                <p>it is no longer satisfied as mentioned in subsection (2); or</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-23__subsec-6__para-b">
              <num>b</num>
              <content>
                <p>it considers that the corporation has contravened a condition of <role refersTo="#authority">the authority</role>; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-23__subsec-6__para-c">
              <num>c</num>
              <content>
                <p>the corporation applies to the Reserve Bank for revocation of <role refersTo="#authority">the authority</role>; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-23__subsec-6__para-d">
              <num>d</num>
              <content>
                <p>the corporation ceases to be the holder of the stored value of any purchased payment facilities of the relevant class.</p>
              </content>
              <content>
                <p>An application for revocation of <role refersTo="#authority">the authority</role> must comply with any applicable requirements determined under section 27.</p>
              </content>
            </paragraph>
          </subsection>
        </section>
        <section eId="part-4__sec-24">
          <num>24</num>
          <heading>Directions on failure to comply with conditions</heading>
          <subsection eId="part-4__sec-24__subsec-1">
            <num>1</num>
            <content>
              <p>The Reserve Bank may give a direction to a corporation that has been granted an authority under <role refersTo="#authority">the authority</role>.<ref href="#sec-23">section 23</ref> if the Reserve Bank considers that the corporation has failed to comply with a condition of </p>
            </content>
          </subsection>
          <subsection eId="part-4__sec-24__subsec-2">
            <num>2</num>
            <content>
              <p>The direction is to require the corporation to take specified action, or to refrain from specified action, as the Reserve Bank considers appropriate having regard to the failure.</p>
            </content>
          </subsection>
          <subsection eId="part-4__sec-24__subsec-3">
            <num>3</num>
            <content>
              <p>The direction may deal with the time by which, or the period during which, it is to be complied with.</p>
            </content>
          </subsection>
          <subsection eId="part-4__sec-24__subsec-4">
            <num>4</num>
            <content>
              <p>The direction is to be given by notice in writing given to the corporation.</p>
            </content>
          </subsection>
          <subsection eId="part-4__sec-24__subsec-5">
            <num>5</num>
            <content>
              <p>The corporation commits an offence if:</p>
            </content>
            <paragraph eId="part-4__sec-24__subsec-5__para-a">
              <num>a</num>
              <content>
                <p>the corporation does, or fails to do, an act; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-24__subsec-5__para-b">
              <num>b</num>
              <content>
                <p>doing, or failing to do, the act results in a contravention of the direction; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-24__subsec-5__para-c">
              <num>c</num>
              <content>
                <p>the doing of the act, or the failure to do the act, occurs at a time when;</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-24__subsec-5__para-i">
              <num>i</num>
              <content>
                <p><role refersTo="#authority">the authority</role> referred to in subsection (1) is still in force; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-24__subsec-5__para-ii">
              <num>ii</num>
              <content>
                <p>the corporation is the holder of the stored value of one or more purchased payment facilities of the class to which that authority applies.</p>
              </content>

                <p>unless subparagraph (ii) applies—on the day on which it is given; or</p>
              </content>
            </paragraph>

                <p>if the instrument giving the direction specifies a later day as the day on which it comes into force—on the day so specified; and</p>

                <p>continues in force until it is revoked.</p>
              </content>
            </paragraph>
          </subsection>

              <p>The Reserve Bank may revoke the direction by notice in writing to the corporation if, at the time of revocation, it considers that the direction is no longer necessary or appropriate.</p>

          </subsection>
        </section>
        <section eId="part-4__sec-25">
          <num>25</num>
          <heading>Exemptions</heading>
          <subsection eId="part-4__sec-25__subsec-1">
            <num>1</num>
            <content>
              <p>	(1)	The Reserve Bank may grant a corporation, or corporations included in a class of corporations, an exemption allowing the corporation, or each corporation in the class, to be the holder of the stored value in respect of purchased payment facilities in a particular class even though the corporation is not an authorised deposit-taking institution, within the meaning of the <i>Banking Act 1959</i>, and does not have an authority under section 23 of this Act that covers those facilities.</p>
            </content>
          </subsection>
          <subsection eId="part-4__sec-25__subsec-2">
            <num>2</num>
            <content>
              <p>The Reserve Bank may be acting on its own initiative or pursuant to an application in granting the exemption. An application for an exemption must comply with the applicable requirements determined under <ref href="#sec-27">section 27</ref>.</p>
            </content>
          </subsection>
          <subsection eId="part-4__sec-25__subsec-3">
            <num>3</num>
            <content>
              <p>The Reserve Bank may grant the exemption if it is satisfied that the corporation, or each of the corporations in the class, will be able to satisfy the obligations of the holder of the stored value of purchased payment facilities of the relevant class.</p>
            </content>
          </subsection>
          <subsection eId="part-4__sec-25__subsec-4">
            <num>4</num>
            <content>
              <p>The exemption is to be granted:</p>
            </content>
            <paragraph eId="part-4__sec-25__subsec-4__para-a">
              <num>a</num>
              <content>
                <p>if it applies to a particular corporation—by notifiable instrument; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-25__subsec-4__para-b">
              <num>b</num>
              <content>
                <p>if it applies to a class of corporations—by legislative instrument.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-4__sec-25__subsec-5">
            <num>5</num>
            <content>
              <p>The exemption:</p>

              <p>The Reserve Bank may require a participant in a payment system (whether or not it is a designated payment system or a special designated payment system) to give the Reserve Bank information relating to the payment system and its participants.</p>

              <p>A person covered by subsection (2) may use or disclose information or documents obtained under, or for the purposes of, this Act if:</p>

                <p>the use or disclosure is for the purposes of this Act; and</p>

              <p>For the purposes of subsection (1), the following persons are covered by this subsection:</p>

              <num>a</num>
              <content>
                <p>the Reserve Bank;</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-26A__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>	(b)	a person who is an officer <i>Reserve Bank Act 1959</i>, except a person mentioned in paragraph (e) of the definition of <b><i>officer</i></b><b> </b>in that subsection;<ref href="#sec-79A__subsec-1">within the meaning of subsection 79A(1)</ref> of the </p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-26A__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>a person who, because of the person’s employment or engagement, or in the course of that employment or engagement, has obtained information or documents under, or for the purposes of, this Act;</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-26A__subsec-2__para-d">
              <num>d</num>
              <content>
                <p>a person prescribed by regulations made for the purposes of this paragraph.</p>
              </content>
              <content>
                <p>Authorised use or disclosure—nominated special regulators</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-5__sec-26A__subsec-3">
            <num>3</num>
            <content>
              <p>A person covered by subsection (4) in relation to a special designated payment system may use or disclose information or documents obtained under, or for the purposes of, this Act if:</p>
            </content>
            <paragraph eId="part-5__sec-26A__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>the use or disclosure is for the purposes of this Act; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-26A__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>in the case of disclosure—the disclosure is to:</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-26A__subsec-3__para-i">
              <num>i</num>
              <content>
                <p>the Reserve Bank; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-26A__subsec-3__para-ii">
              <num>ii</num>
              <content>
                <p>a nominated special regulator in relation to the special designated payment system.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-5__sec-26A__subsec-4">
            <num>4</num>
            <content>
              <p>For the purposes of subsection (3), the following persons are covered by this subsection in relation to a special designated payment system:</p>
            </content>
            <paragraph eId="part-5__sec-26A__subsec-4__para-a">
              <num>a</num>
              <content>
                <p>a nominated special regulator (other than the Reserve Bank) in relation to the special designated payment system;</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-26A__subsec-4__para-b">
              <num>b</num>
              <content>
                <p>the head of such a nominated special regulator;</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-26A__subsec-4__para-c">
              <num>c</num>
              <content>
                <p>a delegate of such a nominated special regulator, or of the head of such a nominated special regulator;</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-26A__subsec-4__para-d">
              <num>d</num>
              <content>
                <p>a person prescribed in relation to such a nominated special regulator by regulations made for the purposes of this paragraph.</p>
              </content>
              <content>
                <p>Protection from liability</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-5__sec-26A__subsec-5">
            <num>5</num>
            <content>
              <p>A person does not commit an offence, and is not liable to any penalty, under any law of the Commonwealth, or any law of a State or Territory, as a result of the person using or disclosing information or documents in accordance with this section.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-5__sec-27">
          <num>27</num>
          <heading>Power to determine requirements for applications</heading>
          <content>
            <p>The Reserve Bank may, by notifiable instrument, determine requirements to be complied with in relation to applications under this Act, including (but not limited to) requirements relating to:</p>
          </content>
          <paragraph eId="part-5__sec-27__para-a">
            <num>a</num>
            <content>
              <p>the means by which an application is to be made; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-5__sec-27__para-b">
            <num>b</num>
            <content>
              <p>the information or documentation that is to be included in or submitted with an application; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-5__sec-27__para-c">
            <num>c</num>
            <content>
              <p>the verification of an application or of information or documentation included in or submitted with it.</p>
            </content>
          </paragraph>
        </section>
        <section eId="part-5__sec-29">
          <num>29</num>
          <heading>Notification obligations</heading>
          <content>
            <p>Notification of determination or variation of standard or imposition or variation of access regime</p>
          </content>
          <subsection eId="part-5__sec-29__subsec-1">
            <num>1</num>
            <content>
              <p>Subsection (2) applies to the following actions taken by the Reserve Bank or a nominated special regulator:</p>
            </content>
            <paragraph eId="part-5__sec-29__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>the imposition of an access regime;</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-29__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>the variation of an access regime;</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-29__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>the determination of a standard;</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-29__subsec-1__para-d">
              <num>d</num>
              <content>
                <p>the variation of a standard.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-5__sec-29__subsec-2">
            <num>2</num>
            <content>
              <p>If this subsection applies to an action, the Reserve Bank or the nominated special regulator (as the case may be) must take reasonable steps to ensure that the participants in the payment system concerned are informed of the action.</p>
            </content>
            <content>
              <p>Notification of revocation of a standard or an access regime</p>
            </content>
          </subsection>
          <subsection eId="part-5__sec-29__subsec-3">
            <num>3</num>
            <content>
              <p>If the Reserve Bank or a nominated special regulator revokes a standard or an access regime, the Reserve Bank or the nominated special regulator (as the case may be) must take reasonable steps to ensure that any participants in the payment system concerned are informed of the revocation.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-5__sec-30">
          <num>30</num>
          <heading>Enforcement of civil penalty provisions</heading>
          <content>
            <p>Enforceable civil penalty provisions</p>
          </content>
          <subsection eId="part-5__sec-30__subsec-1">
            <num>1</num>
            <content>
              <p>Each civil penalty provision of this Act is enforceable under Part 4 of the Regulatory Powers Act.</p>
            </content>

          </subsection>
          <subsection eId="part-5__sec-30__subsec-2">
            <num>2</num>
            <content>
              <p>For the purposes of Part 4 of the Regulatory Powers Act, the following are authorised applicants:</p>
            </content>
            <paragraph eId="part-5__sec-30__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>in relation to subsection 21(10) of this Act—the entity (whether the Reserve Bank or a nominated special regulator) that gave the direction to which the contravention of that subsection relates;</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-30__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>in relation to subsection 26(3B) of this Act—the entity (whether the Reserve Bank or a nominated special regulator) that imposed the requirement to which the contravention of that subsection relates.</p>
              </content>
              <content>
                <p>Relevant court</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-5__sec-30__subsec-3">
            <num>3</num>
            <content>
              <p>For the purposes of Part 4 of the Regulatory Powers Act, each of the following courts is a relevant court in relation to each civil penalty provision of this Act:</p>
            </content>
            <paragraph eId="part-5__sec-30__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>the Federal Court;</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-30__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>the Federal Circuit and Family Court of Australia (<ref href="#dvs-2">Division 2</ref>);</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-30__subsec-3__para-c">
              <num>c</num>
              <content>
                <p>a court of a State or Territory that has jurisdiction in relation to the matter.</p>
              </content>
              <content>
                <p>Extension to external Territories</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-5__sec-30__subsec-4">
            <num>4</num>
            <content>
              <p>Part 4 of the Regulatory Powers Act, as that Part applies in relation to the civil penalty provisions of this Act, extends to every external Territory.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-5__sec-30A">
          <num>30A</num>
          <heading>Enforceable undertakings</heading>
          <content>
            <p>Acceptance of undertakings</p>
          </content>
          <subsection eId="part-5__sec-30A__subsec-1">
            <num>1</num>
            <content>
              <p>The Reserve Bank may accept a written undertaking given by a participant in a payment system (whether or not it is a designated payment system or a special designated payment system) in connection with a matter in relation to which the Reserve Bank (including in its capacity as a nominated special regulator) has a function or power under this Act, the regulations or another legislative instrument made under this Act.</p>
            </content>
          </subsection>
          <subsection eId="part-5__sec-30A__subsec-2">
            <num>2</num>
            <content>
              <p>However, if:</p>
            </content>
            <paragraph eId="part-5__sec-30A__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>the written undertaking is in connection with a matter in relation to which the Reserve Bank has a function or power under this Act, the regulations or another legislative instrument made under this Act; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-30A__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>that function or power is one that the Reserve Bank has other than in its capacity as a nominated special regulator;</p>
              </content>
              <content>
                <p>then the Reserve Bank may accept the undertaking only if doing so would be consistent with the Reserve Bank’s payments system policy (within the meaning of the <i>Reserve Bank Act 1959</i>).</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-5__sec-30A__subsec-3">
            <num>3</num>
            <content>
              <p>A nominated special regulator (other than the Reserve Bank) in relation to a special designated payment system may accept a written undertaking given by a participant in that special designated payment system in connection with a matter in relation to which the nominated special regulator has a function or power under this Act, the regulations or another legislative instrument made under this Act.</p>
            </content>
            <content>
              <p>Withdrawal or variation</p>
            </content>
          </subsection>
          <subsection eId="part-5__sec-30A__subsec-4">
            <num>4</num>
            <content>
              <p>The participant may withdraw or vary the undertaking at any time, but only with the consent of the Reserve Bank or the nominated special regulator (as the case may be).</p>
            </content>
            <content>
              <p>Breach of undertakings</p>
            </content>
          </subsection>
          <subsection eId="part-5__sec-30A__subsec-5">
            <num>5</num>
            <content>
              <p>If the Reserve Bank or the nominated special regulator (as the case may be) considers that the participant who gave the undertaking has breached any of the terms of the undertaking, the Reserve Bank or the nominated special regulator may apply to the Court for an order under subsection (6).</p>
            </content>
          </subsection>
          <subsection eId="part-5__sec-30A__subsec-6">
            <num>6</num>
            <content>
              <p>If the Court is satisfied that the participant has breached a term of the undertaking, the Court may make all or any of the following orders:</p>
            </content>
            <paragraph eId="part-5__sec-30A__subsec-6__para-a">
              <num>a</num>
              <content>
                <p>an order directing the participant to comply with that term of the undertaking;</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-30A__subsec-6__para-b">
              <num>b</num>
              <content>
                <p>an order directing the participant to pay to the Commonwealth an amount up to the amount of any financial benefit that the participant has obtained directly or indirectly and that is reasonably attributable to the breach;</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-30A__subsec-6__para-c">
              <num>c</num>
              <content>
                <p>any order that the Court considers appropriate directing the participant to compensate any other person who has suffered loss or damage as a result of the breach;</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-30A__subsec-6__para-d">
              <num>d</num>
              <content>
                <p>any other order that the Court considers appropriate.</p>
              </content>
              <content>
                <p>Authorisation for the purposes of <ref href="">the Competition and Consumer Act 2010</ref></p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-5__sec-30A__subsec-7">
            <num>7</num>
            <content>
              <p>	(7)	For the purposes of subparagraph 51(1)(a)(i) of the <i>Competition and Consumer Act 2010</i>, the following are taken to be specified in, and specifically authorised by, this Act:</p>
            </content>
            <paragraph eId="part-5__sec-30A__subsec-7__para-a">
              <num>a</num>
              <content>
                <p>anything done by the Reserve Bank or a nominated special regulator under this section;</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-30A__subsec-7__para-b">
              <num>b</num>
              <content>
                <p>the giving, by a participant in a payment system, of a written undertaking to the Reserve Bank or a nominated special regulator under subsection (1) or (3) of this section;</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-30A__subsec-7__para-c">
              <num>c</num>
              <content>
                <p>anything done by the participant in accordance with the terms of that written undertaking.</p>
              </content>
              <content>
                <p>Definitions</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-5__sec-30A__subsec-8">
            <num>8</num>
            <content>
              <p>In this section:</p>
            </content>
            <content>
              <p><b><i>Court</i></b> means:</p>
            </content>
            <paragraph eId="part-5__sec-30A__subsec-8__para-a">
              <num>a</num>
              <content>
                <p>the Federal Court; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-30A__subsec-8__para-b">
              <num>b</num>
              <content>
                <p>the Federal Circuit and Family Court of Australia (<ref href="#dvs-2">Division 2</ref>); or</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-30A__subsec-8__para-c">
              <num>c</num>
              <content>
                <p>a court of a State or Territory that has jurisdiction in relation to the matter.</p>
              </content>
            </paragraph>
          </subsection>
        </section>

          <heading>Protection from civil liability</heading>

          </content>

              <p>A person covered by subsection (2) is not subject to civil liability in respect of an act or omission of the person if:</p>
            </content>
            <paragraph eId="part-5__sec-30B__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>the act or omission is done in good faith:</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-30B__subsec-1__para-i">
              <num>i</num>
              <content>
                <p>in the performance or exercise (or purported performance or exercise) of a function or power under this Act; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-30B__subsec-1__para-ii">
              <num>ii</num>
              <content>
                <p>for the purpose of assisting another person to perform or exercise a function or power under this Act; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-30B__subsec-1__para-b">

                <p>the act or omission relates to a designated payment system.</p>
              </content>
            </paragraph>
          </subsection>

              <p>The following persons are covered by this subsection:</p>

                <p>the Reserve Bank;</p>
              </content>
            </paragraph>

                <p>the act or omission is done in good faith:</p>
              </content>
            </paragraph>

                <p>in the performance or exercise (or purported performance or exercise) of a function or power under this Act; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-30B__subsec-3__para-ii">
              <num>ii</num>
              <content>
                <p>for the purpose of assisting another person to perform or exercise a function or power under this Act; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-30B__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>the act or omission relates to a special designated payment system; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-30B__subsec-3__para-c">
              <num>c</num>
              <content>
                <p>if the act or omission contravenes a direction given by <role refersTo="#minister">the Minister</role> under subsection 11F(1), or a direction given by a delegator as mentioned in subsection 31(3) or 31A(5)—the person attempted in good faith to comply with the direction.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-5__sec-30B__subsec-4">
            <num>4</num>
            <content>
              <p>The following persons are covered by this subsection:</p>
            </content>
            <paragraph eId="part-5__sec-30B__subsec-4__para-a">
              <num>a</num>

                <p>a nominated special regulator (other than the Reserve Bank);</p>
              </content>
            </paragraph>

        </section>

          <heading>Protections from criminal or civil liability do not limit each other</heading>
          <subsection eId="part-5__sec-30C__subsec-1">
            <num>1</num>

              <p>The following provisions do not limit, and are not limited by, each other:</p>
            </content>
            <paragraph eId="part-5__sec-30C__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>subsection 20(3);</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-30C__subsec-1__para-b">

              <num>c</num>

                <p>subsections 30B(1) and (3).</p>

          <subsection eId="part-5__sec-30C__subsec-2">

              <p>The provisions referred to in subsection (1) do not limit, and are not limited by, any other provision of a Commonwealth law that protects a person from criminal or civil liability.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-5__sec-31">
          <num>31</num>
          <heading>Delegation—Reserve Bank</heading>
          <subsection eId="part-5__sec-31__subsec-1">
            <num>1</num>
            <content>
              <p>The Reserve Bank may, by written instrument, delegate all or any of its functions or powers under this Act (including its functions or powers as a nominated special regulator) to a person who holds any of the following offices:</p>
            </content>
            <paragraph eId="part-5__sec-31__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>Governor of the Reserve Bank;</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-31__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>Deputy Governor of the Reserve Bank;</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-31__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>Assistant Governor of the Reserve Bank;</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-31__subsec-1__para-d">
              <num>d</num>
              <content>
                <p>Department Head of the Reserve Bank;</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-31__subsec-1__para-e">
              <num>e</num>
              <content>
                <p>any other prescribed office in the Reserve Bank Service.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-5__sec-31__subsec-2">

              <p>Subject to subsection (2A), the Governor of the Reserve Bank may, in writing, delegate all or any of the Governor’s functions or powers under this Act (including the Governor’s functions or powers as the head of a nominated special regulator) to a person who holds any of the following offices:</p>
            </content>

              <num>a</num>
              <content>
                <p>Deputy Governor of the Reserve Bank;</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-31__subsec-2__para-b">

                <p>Assistant Governor of the Reserve Bank;</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-31__subsec-2__para-c">
              <num>c</num>

                <p>Department Head of the Reserve Bank;</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-31__subsec-2__para-d">
              <num>d</num>

          <heading>Delegation—nominated special regulators</heading>
          <subsection eId="part-5__sec-31A__subsec-1">
            <num>1</num>
            <content>
              <p>A nominated special regulator (other than the Reserve Bank) in relation to a special designated payment system may, by written instrument, delegate all or any of its functions or powers under this Act to:</p>
            </content>
            <paragraph eId="part-5__sec-31A__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>the head of the nominated special regulator; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-31A__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>a person prescribed by the regulations as an eligible delegate in relation to the nominated special regulator.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-5__sec-31A__subsec-2">
            <num>2</num>
            <content>
              <p>Subject to subsection (3), the head of a nominated special regulator (other than the Governor of the Reserve Bank) in relation to a special designated payment system may, in writing, delegate all or any of the head’s functions or powers under this Act to a person prescribed by the regulations as an eligible delegate in relation to the nominated special regulator.</p>

                <p>if the power or function is to be delegated to a person holding, occupying, or performing the duties of, a specified office or position—whether the office or position is sufficiently senior for the person to perform the function or exercise the power; or</p>

              <num>b</num>

                <p>otherwise—whether the person has appropriate qualifications or expertise to perform the function or exercise the power.</p>

                <b>Editorial changes</b>
              </p>
              <p>The <i>Legislation Act 2003</i> authorises First Parliamentary Counsel to make editorial and presentational changes to a compiled law in preparing a compilation of the law for registration. The changes must not change the effect of the law. Editorial changes take effect from the compilation registration date.</p>
              <p>If the compilation includes editorial changes, the endnotes include a brief outline of the changes in general terms. Full details of any changes can be obtained from the Office of Parliamentary Counsel.</p>

                <b>Misdescribed amendments</b>
              </p>
              <p>A misdescribed amendment is an amendment that does not accurately describe how an amendment is to be made. If, despite the misdescription, the amendment can be given effect as intended, then the misdescribed amendment can be incorporated through an editorial change made under <i>Legislation Act 2003</i>.<ref href="#sec-15V">section 15V</ref> of the </p>
              <p>If a misdescribed amendment cannot be given effect as intended, the amendment is not incorporated and “(md not incorp)” is added to the amendment history.</p>
