          <heading>Short title</heading>
          <content>
            <p>		This Act may be cited as the <i>Adelaide Airport Curfew Act 2000</i>.</p>
          </content>
        </section>
        <section eId="part-1__sec-2">
          <num>2</num>
          <heading>Commencement</heading>
          <subsection eId="part-1__sec-2__subsec-1">
            <num>1</num>
            <content>
              <p>Subject to subsection (2), this Act commences at  on the first Sunday after a day to be fixed by Proclamation.</p>
            </content>
          </subsection>
          <subsection eId="part-1__sec-2__subsec-2">
            <num>2</num>
            <content>
              <p>If this Act does not commence under subsection (1) within the period of 6 months beginning on the day on which it receives the Royal Assent, it commences:</p>
            </content>
            <paragraph eId="part-1__sec-2__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>if the first day after the end of that period is a Sunday—at  on that Sunday; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-2__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>otherwise—at  on the first Sunday after the end of that period.</p>
              </content>
            </paragraph>
          </subsection>
        </section>
        <section eId="part-1__sec-3">
          <num>3</num>
          <heading>Definitions</heading>
          <subsection eId="part-1__sec-3__subsec-1">
            <num>1</num>
            <content>
              <p>In this Act, unless the contrary intention appears, the following terms have the meanings set out below:</p>
            </content>
            <content>
              <p><b><i>90</i></b><b><i>-</i></b><b><i>95 noise level rule </i></b>has the meaning given by subsection (3).</p>
              <p><term refersTo="#term-aircraft">aircraft</term> means <def>any machine or craft that can derive support in the atmosphere from the reactions of the air.</def></p>
              <p><term refersTo="#term-airservices-australia">Airservices Australia</term> means <def>the body called Airservices Australia that is established by <ref href="">the Air Services Act 1995</ref>.</def></p>
              <p><term refersTo="#term-australia">Australia</term> includes <def>all the external Territories.</def></p>
              <p><b><i>authorised person</i></b> means:</p>
            </content>
            <paragraph eId="part-1__sec-3__subsec-1__para-a">
              <num>a</num>
              <content>
                <p><role refersTo="#secretary">the Secretary</role> of the Department; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>a person appointed under subsection 22(1); or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>a person included in a class of persons appointed under subsection 22(2).</p>
              </content>
              <content>
                <p><term refersTo="#term-curfew-period">curfew period</term> means <def>a period that starts at  on a day and ends at  on the next day.</def></p>
                <p><b><i>curfew shoulder period</i></b> means:</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>a period of one hour starting at  on a day; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>a period of one hour starting at 5 am on a day.</p>
              </content>
              <content>
                <p><term refersTo="#term-international-aircraft">international aircraft</term> has the meaning given by <def>subsection (2).</def></p>
                <p><b><i>land</i></b>—an aircraft lands when it touches the ground.</p>
                <p><term refersTo="#term-low-noise-heavy-freight-aircraft">low noise heavy freight aircraft</term> means <def>a jet aircraft that: has a maximum take-off weight that is 34,000 kilograms or more; and is being used solely for the purpose of carrying freight; and complies with the maximum noise levels specified in Chapter 3 of the Annex that are applicable to the maximum take-off weight of the aircraft (whether or not the Chapter is expressed to apply to the aircraft); and complies with the 90-95 noise level rule.</def></p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>has a maximum take-off weight that is 34,000 kilograms or more; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>is being used solely for the purpose of carrying freight; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>complies with the maximum noise levels specified in Chapter 3 of the Annex that are applicable to the maximum take-off weight of the aircraft (whether or not the Chapter is expressed to apply to the aircraft); and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-1__para-d">
              <num>d</num>
              <content>
                <p>complies with the 90-95 noise level rule.</p>
              </content>
              <content>
                <p><term refersTo="#term-maximum-take-off-weight-of-an-aircraft">maximum take-off weight of an aircraft</term> means <def>the weight set out in the aircraft’s flight manual as the aircraft’s maximum take-off weight.</def></p>
                <p><b><i>noise level</i></b>, expressed as a figure of EPNdB, means the effective perceived noise in decibels:</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>measured by reference to the test procedures specified in Chapter 3 of the Annex; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>certified in a noise certificate within the meaning of the Air Navigation (Aircraft Noise) Regulations.</p>
              </content>
              <content>
                <p><term refersTo="#term-operator-of-an-aircraft">operator of an aircraft</term> means <def>a person who conducts an aircraft operation using the aircraft.</def></p>
                <p><b><i>take off</i></b>—an aircraft takes off when it leaves the ground.</p>
                <p><term refersTo="#term-the-annex">the Annex</term> means <def>Volume 1 of Annex 16 to the Convention on International Civil Aviation concluded at Chicago on 7 December 1944, as amended and in force from time to time.</def></p>
                <p><term refersTo="#term-week">week</term> means <def>a period of 7 days starting at  on a Sunday.</def></p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-1__sec-3__subsec-2">
            <num>2</num>
            <content>
              <p>	(2)	For the purposes of this Act, an aircraft is an<b><i> international aircraft</i></b> on take-off from, or landing at, Adelaide Airport if:</p>
            </content>
            <paragraph eId="part-1__sec-3__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>the aircraft is being used for an international air service to carry passengers or freight (or both) for hire or reward, to or from the airport; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>one of the following applies:</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-2__para-i">
              <num>i</num>
              <content>
                <p><i>	</i>(i)	the operator of the aircraft has an international airline licence granted under regulations made under the <i>Air Navigation Act 1920</i>;</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-2__para-ii">
              <num>ii</num>
              <content>
                <p>the operator of the aircraft has a permission granted under <ref href="#sec-15D">section 15D</ref> of that Act;</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-2__para-iii">
              <num>iii</num>
              <content>
                <p>the flight in question is covered by a permission under <ref href="#sec-17">section 17</ref> of that Act;</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-2__para-iv">
              <num>iv</num>
              <content>
                <p>the flight in question is covered by a determination under subsection 17(1B) of that Act; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>the aircraft complies with the maximum noise levels specified in Chapter 3 of the Annex that are applicable to the maximum take-off weight of the aircraft (whether or not the Chapter is expressed to apply to the aircraft); and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-2__para-d">
              <num>d</num>
              <content>
                <p>if the aircraft is being used solely for the purpose of carrying freight—the aircraft is not a low noise heavy freight aircraft; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-2__para-e">
              <num>e</num>
              <content>
                <p>for a take-off from Adelaide Airport—the first or second port of call of the aircraft after taking off from Adelaide Airport is outside Australia; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-2__para-f">
              <num>f</num>
              <content>
                <p>for a landing at Adelaide Airport—the last or second last port of call of the aircraft before landing at Adelaide Airport was outside Australia.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-1__sec-3__subsec-3">
            <num>3</num>
            <content>
              <p>	(3)	For the purposes of this Act, a type of aircraft complies with the <b><i>90</i></b><b><i>-</i></b><b><i>95 noise level rule</i></b> if aircraft of that type have a noise level that:</p>
            </content>
            <paragraph eId="part-1__sec-3__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>on take-off:</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-3__para-i">
              <num>i</num>
              <content>
                <p>does not exceed 90 EPNdB; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-3__para-ii">
              <num>ii</num>
              <content>
                <p>if the amount in excess of 90 EPNdB is offset by a maximum noise level on landing that is correspondingly lower than the amount specified in subparagraph (b)(i) for landing noise—does not exceed 92 EPNdB; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>on landing:</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-3__para-i">
              <num>i</num>
              <content>
                <p>does not exceed 95 EPNdB; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-3__para-ii">
              <num>ii</num>
              <content>
                <p>if the amount in excess of 95 EPNdB is offset by a maximum noise level on take-off that is correspondingly lower than the amount specified in subparagraph (a)(i)—does not exceed 97 EPNdB.</p>
              </content>
            </paragraph>
          </subsection>
        </section>

          <num>4</num>
          <heading>Explanation of runway names</heading>
          <subsection eId="part-1__sec-4__subsec-1">
            <num>1</num>
            <content>
              <p>The diagram below shows the runways at Adelaide Airport.</p>
            </content>
          </subsection>
          <subsection eId="part-1__sec-4__subsec-2">
            <num>2</num>
            <content>
              <p>The following runway names have the meanings indicated where they are used in this Act:</p>
            </content>
            <paragraph eId="part-1__sec-4__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>	(a)	<b><i>runway 12</i></b>—this is the name for the runway marked A when used for a take-off to the south-east or a landing from the north-west;</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>	(b)	<b><i>runway 30</i></b>—this is the name for the runway marked A when used for a take-off to the north-west or a landing from the south-east;</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>	(c)	<b><i>runway 23</i></b>—this is the name for the runway marked B when used for a take-off to the south-west or a landing from the north-east;</p>

        <heading>The curfew</heading>

          <num>6</num>
          <heading>Prohibition on taking off or landing during curfew periods</heading>
          <subsection eId="part-2__sec-6__subsec-1">
            <num>1</num>
            <content>
              <p>The operator of an aircraft commits an offence if:</p>
            </content>
            <paragraph eId="part-2__sec-6__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>the operator engages in conduct; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-6__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>the conduct results in an aircraft taking off or landing at Adelaide Airport during a curfew period.</p>
              </content>

                <content>
                  <p>Penalty:	<quantity refersTo="#penaltyUnit">200 penalty units</quantity>.</p>

            <content>
              <p>This Division applies to international aircraft other than international aircraft of a type specified in the regulations.</p>
            </content>
          </section>

            <num>8</num>
            <heading>Quota on movements by international aircraft during curfew shoulder periods</heading>
            <content>
              <p>The regulations may prescribe the maximum number of take-offs and the maximum number of landings by international aircraft that are permitted during the curfew shoulder periods in a week.</p>
            </content>
          </section>

            <num>9</num>
            <heading>Applications to operate international aircraft during curfew shoulder periods</heading>
            <subsection eId="part-3__dvs-1__sec-9__subsec-1">
              <num>1</num>
              <content>
                <p>The operator of an international aircraft may apply to <role refersTo="#minister">the Minister</role> for permission to take-off from, or land at, Adelaide Airport during a curfew shoulder period.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-9__subsec-2">
              <num>2</num>
              <content>
                <p>An application:</p>
              </content>
              <paragraph eId="part-3__dvs-1__sec-9__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>must be in writing; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-9__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>must specify the day and time of the proposed take-off or landing; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-9__subsec-2__para-c">
                <num>c</num>
                <content>
                  <p>must set out the reasons why the applicant thinks the permission should be granted.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-9__subsec-3">
              <num>3</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> may request further information from the applicant that is, in <role refersTo="#minister">the Minister</role>’s opinion, relevant to making a decision whether or not to grant a permission.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-9__subsec-4">
              <num>4</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> may, in writing, grant or refuse to grant permission. However, <role refersTo="#minister">the Minister</role> must not grant permission where to do so would result in more take-offs or landings occurring during a curfew shoulder period than is permitted by regulations made for the purposes of section 8.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-9__subsec-5">
              <num>5</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> may impose conditions on a permission.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-9__subsec-6">
              <num>6</num>
              <content>
                <p>Without limiting subsection (5), a permission is subject to the following conditions:</p>
              </content>
              <paragraph eId="part-3__dvs-1__sec-9__subsec-6__para-a">
                <num>a</num>
                <content>
                  <p>if the permission relates to a take-off—the take-off is from runway 23; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-9__subsec-6__para-b">
                <num>b</num>
                <content>
                  <p>if the permission relates to a landing:</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-9__subsec-6__para-i">
                <num>i</num>
                <content>
                  <p>the landing is on runway 05, unless meteorological conditions require the aircraft to land on another runway; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-9__subsec-6__para-ii">
                <num>ii</num>
                <content>
                  <p>the aircraft does not use reverse thrust greater than idle reverse thrust.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-9__subsec-7">
              <num>7</num>
              <content>
                <p>Application may be made to the Administrative Review Tribunal for review of a decision:</p>
              </content>
              <paragraph eId="part-3__dvs-1__sec-9__subsec-7__para-a">
                <num>a</num>
                <content>
                  <p>to refuse to grant a permission; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-9__subsec-7__para-b">

                  <p>to grant a permission subject to conditions.</p>
                </content>

          <heading>Low noise heavy freight aircraft movements during curfew periods</heading>
          <section eId="part-3__dvs-2__sec-10">
            <num>10</num>
            <heading>Restrictions on movements by low noise heavy freight aircraft during curfew periods</heading>
            <content>
              <p>The regulations:</p>
            </content>
            <paragraph eId="part-3__dvs-2__sec-10__para-a">
              <num>a</num>
              <content>
                <p>may prescribe the maximum number of take-offs and the maximum number of landings by low noise heavy freight aircraft that are permitted during the curfew periods in a week; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__dvs-2__sec-10__para-b">
              <num>b</num>
              <content>
                <p>may prescribe those maximum numbers of take-offs and landings by reference to the types of low noise heavy freight aircraft that may take off and land.</p>
              </content>
            </paragraph>
          </section>
          <section eId="part-3__dvs-2__sec-11">
            <num>11</num>
            <heading>Applications to operate low noise heavy freight aircraft during curfew periods</heading>
            <subsection eId="part-3__dvs-2__sec-11__subsec-1">
              <num>1</num>
              <content>
                <p>The operator of a low noise heavy freight aircraft of a type specified in the regulations may apply to <role refersTo="#minister">the Minister</role> for permission to take off from, or land at, Adelaide Airport during a curfew period.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-2__sec-11__subsec-2">
              <num>2</num>
              <content>
                <p>An application:</p>
              </content>
              <paragraph eId="part-3__dvs-2__sec-11__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>must be in writing; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-2__sec-11__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>must:</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-2__sec-11__subsec-2__para-i">
                <num>i</num>
                <content>
                  <p>specify the day and time of the proposed take-off or landing; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-2__sec-11__subsec-2__para-ii">
                <num>ii</num>
                <content>
                  <p>if the applicant does not know the day and time of the proposed take-off or landing—specify the maximum number of take-offs and landings for which the applicant seeks permission during the curfew periods in a week; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-2__sec-11__subsec-2__para-c">
                <num>c</num>
                <content>
                  <p>must set out the reasons why the applicant thinks the permission should be granted.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-2__sec-11__subsec-3">
              <num>3</num>
              <content>

                <p><role refersTo="#minister">The Minister</role> may impose conditions on a permission.</p>
              </content>
            </subsection>

        </division>

          <num>3</num>
          <heading>Other aircraft movements during curfew periods</heading>
          <section eId="part-3__dvs-3__sec-12">
            <num>12</num>
            <heading>Propeller-driven aircraft under 34,000 kilograms that comply with noise standards</heading>
            <content>
              <p>A propeller-driven aircraft that:</p>
            </content>
            <paragraph eId="part-3__dvs-3__sec-12__para-a">
              <num>a</num>
              <content>
                <p>has a maximum take-off weight of 34,000 kilograms or less; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__dvs-3__sec-12__para-b">
              <num>b</num>
              <content>
                <p>complies with the maximum noise levels specified in Chapter 3, 5 (other than paragraph 5.1.3), 6 or 10 of the Annex that are applicable to aircraft of the class to which the aircraft belongs;</p>
              </content>
              <content>
                <p>may take off or land at Adelaide Airport during a curfew period.</p>
              </content>
            </paragraph>
          </section>
          <section eId="part-3__dvs-3__sec-13">
            <num>13</num>
            <heading>Jet aircraft under 34,000 kilograms that comply with noise standards</heading>
            <subsection eId="part-3__dvs-3__sec-13__subsec-1">
              <num>1</num>
              <content>
                <p>A jet aircraft of a type specified in regulations made for the purposes of subsection (2) may take off or land at Adelaide Airport during a curfew period.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-3__sec-13__subsec-2">
              <num>2</num>
              <content>
                <p>The regulations may specify a type of jet aircraft that:</p>
              </content>
              <paragraph eId="part-3__dvs-3__sec-13__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>has a maximum take-off weight of 34,000 kilograms or less; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-13__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>complies with the maximum noise levels specified in Chapter 3 of the Annex that are applicable to the maximum take-off weight of the aircraft (whether or not the Chapter is expressed to apply to the aircraft); and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-13__subsec-2__para-c">
                <num>c</num>
                <content>
                  <p>complies with the 90-95 noise level rule.</p>
                </content>
              </paragraph>
            </subsection>
          </section>
          <section eId="part-3__dvs-3__sec-14">
            <num>14</num>
            <heading>Take-off when taxi clearance received before start of curfew period</heading>
            <content>
              <p>An aircraft may take off during a curfew period if it received taxi clearance for the take-off before the start of the curfew period.</p>
            </content>
          </section>
        </division>
        <division eId="part-3__dvs-4">
          <num>4</num>
          <heading>Landing on runways other than runway 05</heading>
          <section eId="part-3__dvs-4__sec-15">
            <num>15</num>
            <heading>Landing of aircraft during curfew periods on runways other than runway 05</heading>
            <subsection eId="part-3__dvs-4__sec-15__subsec-1">
              <num>1</num>
              <content>
                <p>An international aircraft that is permitted to land at Adelaide Airport during a curfew shoulder period may land, subject to any conditions imposed under subsection 9(5), on a runway other than runway 05 if the pilot of the aircraft thinks that the meteorological conditions in which the aircraft is to land require it.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-4__sec-15__subsec-2">
              <num>2</num>
              <content>
                <p>A low noise heavy freight aircraft that is permitted to land at Adelaide Airport during a curfew period may land, subject to any conditions imposed under subsection 11(5), on a runway other than runway 05 if the pilot of the aircraft thinks that the meteorological conditions in which the aircraft is to land require it.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-4__sec-15__subsec-3">
              <num>3</num>
              <content>
                <p>If an aircraft lands at Adelaide Airport in the circumstances referred to in subsection (1) or (2), the operator of the aircraft must, <quantity refersTo="#deadline">within 7 days</quantity> after the landing, give to an authorised person, at an address specified in the regulations, a return that states:</p>
              </content>
              <paragraph eId="part-3__dvs-4__sec-15__subsec-3__para-a">
                <num>a</num>
                <content>
                  <p>the date and time of the landing; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-4__sec-15__subsec-3__para-b">
                <num>b</num>
                <content>
                  <p>the runway on which the landing occurred; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-4__sec-15__subsec-3__para-c">
                <num>c</num>
                <content>
                  <p>the aircraft’s registration mark, its operator, and its type; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-4__sec-15__subsec-3__para-d">
                <num>d</num>
                <content>
                  <p>the reasons for landing on a runway other than runway 05, including the wind conditions prevailing at the time; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-4__sec-15__subsec-3__para-e">
                <num>e</num>
                <content>
                  <p>the down wind limits for landing specified in the aircraft’s flight manual.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-4__sec-15__subsec-4">
              <num>4</num>
              <content>
                <p>Airservices Australia must, as soon as practicable after the end of each month, give <role refersTo="#secretary">the Secretary</role> a written report setting out:</p>
              </content>
              <paragraph eId="part-3__dvs-4__sec-15__subsec-4__para-a">
                <num>a</num>
                <content>
                  <p>the number of times (if any) during the month that an international aircraft landed at Adelaide Airport, during a curfew shoulder period, on a runway other than runway 05; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-4__sec-15__subsec-4__para-b">
                <num>b</num>
                <content>
                  <p>the number of times (if any) during the month that a low noise heavy freight aircraft landed at Adelaide Airport, during a curfew period, on a runway other than runway 05; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-4__sec-15__subsec-4__para-c">
                <num>c</num>
                <content>
                  <p>the relevant meteorological conditions on each occasion.</p>
                </content>
              </paragraph>
            </subsection>
          </section>
        </division>
        <division eId="part-3__dvs-5">
          <num>5</num>
          <heading>Emergencies and dispensations</heading>
          <section eId="part-3__dvs-5__sec-16">
            <num>16</num>
            <heading>Aircraft may take off or land in emergencies or if Minister grants dispensation</heading>
            <content>
              <p>An aircraft may take off from, or land at, Adelaide Airport in circumstances that would otherwise contravene <ref href="#sec-6">section 6</ref> if:</p>
            </content>
            <paragraph eId="part-3__dvs-5__sec-16__para-a">
              <num>a</num>
              <content>
                <p>the aircraft is involved in an emergency as described in <ref href="#sec-17">section 17</ref>; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__dvs-5__sec-16__para-b">
              <num>b</num>
              <content>
                <p>the aircraft is taking off from Adelaide Airport in order to resume the flight interrupted by such an emergency; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__dvs-5__sec-16__para-c">
              <num>c</num>
              <content>
                <p>a dispensation granted by <role refersTo="#minister">the Minister</role> under section 18 authorises the take-off or landing, and the take-off or landing is in accordance with any conditions of the dispensation; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__dvs-5__sec-16__para-d">
              <num>d</num>
              <content>
                <p>	(d)	if a national emergency declaration (within the meaning of the <i>National Emergency Declaration Act 2020</i>) is in force—the aircraft is being used for or in connection with the emergency to which the declaration relates.</p>
              </content>
            </paragraph>
          </section>
          <section eId="part-3__dvs-5__sec-17">
            <num>17</num>
            <heading>Emergencies</heading>
            <content>
              <p>An aircraft is involved in an emergency if:</p>
            </content>
            <paragraph eId="part-3__dvs-5__sec-17__para-a">
              <num>a</num>
              <content>
                <p>the aircraft is being used for or in connection with:</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__dvs-5__sec-17__para-i">
              <num>i</num>
              <content>
                <p>a search and rescue operation; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__dvs-5__sec-17__para-ii">
              <num>ii</num>
              <content>
                <p>a medical emergency; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__dvs-5__sec-17__para-iii">
              <num>iii</num>
              <content>
                <p>a natural disaster; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__dvs-5__sec-17__para-b">
              <num>b</num>
              <content>
                <p>the pilot of the aircraft has declared an in-flight emergency; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__dvs-5__sec-17__para-c">
              <num>c</num>
              <content>
                <p>the aircraft has insufficient fuel to be diverted to another airport; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__dvs-5__sec-17__para-d">
              <num>d</num>
              <content>
                <p>there is an urgent need for the aircraft to land or take off:</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__dvs-5__sec-17__para-i">
              <num>i</num>
              <content>
                <p>to ensure the safety or security of the aircraft or any person; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__dvs-5__sec-17__para-ii">
              <num>ii</num>
              <content>
                <p>to avoid damage to property.</p>
              </content>
            </paragraph>
          </section>
          <section eId="part-3__dvs-5__sec-18">
            <num>18</num>
            <heading>Minister may grant dispensations</heading>
            <subsection eId="part-3__dvs-5__sec-18__subsec-1">
              <num>1</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> may grant a dispensation authorising an aircraft to take off from, or land at, Adelaide Airport in circumstances that would otherwise contravene section 6 if <role refersTo="#minister">the Minister</role> is satisfied that there are circumstances justifying the take-off or landing.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-5__sec-18__subsec-2">
              <num>2</num>
              <content>
                <p>A dispensation may be granted subject to conditions including, for example, conditions relating to when the take-off or landing must occur and the runway to be used.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-5__sec-18__subsec-3">
              <num>3</num>
              <content>
                <p>In granting dispensations, <role refersTo="#minister">the Minister</role> must have regard to any matters specified in the regulations.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-5__sec-18__subsec-4">
              <num>4</num>
              <content>
                <p>Without limiting what regulations made for the purposes of subsection (3) may specify, they may specify:</p>
              </content>
              <paragraph eId="part-3__dvs-5__sec-18__subsec-4__para-a">
                <num>a</num>
                <content>
                  <p>what constitutes circumstances justifying take-offs and landings for the purposes of subsection (1); and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-5__sec-18__subsec-4__para-b">
                <num>b</num>
                <content>
                  <p>the conditions to which dispensations should be subject.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-5__sec-18__subsec-5">
              <num>5</num>
              <content>
                <p>	(5)	Subject to subsection (6) and despite paragraph 23(b), and subsection 33(3A), of the <i>Acts Interpretation Act 1901</i>, each dispensation must relate only to one take-off of an aircraft or one landing of an aircraft.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-5__sec-18__subsec-6">
              <num>6</num>
              <content>

        <heading>Provision of information</heading>
        <section eId="part-4__sec-19">
          <num>19</num>
          <heading>Authorised person may require the provision of information</heading>
          <subsection eId="part-4__sec-19__subsec-1">
            <num>1</num>
            <content>
              <p>An authorised person may, by notice in writing given to the operator of an aircraft, require the operator to give the authorised person, <quantity refersTo="#deadline">within 30 days</quantity> of receiving the notice:</p>
            </content>
            <paragraph eId="part-4__sec-19__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>information relating to the noise level of the aircraft; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-19__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>information relevant to determining whether a take-off or landing of the aircraft was permitted by paragraph 16(a) (emergencies).</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-4__sec-19__subsec-2">
            <num>2</num>
            <content>
              <p>An operator commits an offence if:</p>
            </content>
            <paragraph eId="part-4__sec-19__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>the operator is subject to a notice under subsection (1); and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-19__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>the operator engages in conduct; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-19__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>the operator’s conduct contravenes the notice.</p>
              </content>

              <p>In this section:</p>

              <p><b><i>engage in conduct</i></b> means:</p>
            </content>

                <p>do an act; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-19__subsec-4__para-b">
              <num>b</num>
              <content>
                <p>omit to perform an act.</p>
              </content>
            </paragraph>
          </subsection>
        </section>
        <section eId="part-4__sec-20">
          <num>20</num>
          <heading>Provision of false information</heading>
          <content>
            <p>An operator commits an offence if:</p>
          </content>
          <paragraph eId="part-4__sec-20__para-a">
            <num>a</num>
            <content>
              <p>the operator gives information to an authorised person; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-4__sec-20__para-b">
            <num>b</num>
            <content>
              <p>the operator does so reckless as to whether that information is false or misleading in a material particular.</p>
            </content>

          <heading>Delegation</heading>
          <content>
            <p><role refersTo="#minister">The Minister</role> may, in writing, delegate <role refersTo="#minister">the Minister</role>’s powers under section 9, 11 or 18 to:</p>
          </content>

            <num>a</num>
            <content>
              <p><role refersTo="#secretary">the Secretary</role> of the Department; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-5__sec-21__para-b">
            <num>b</num>

              <p>an APS employee in the Department.</p>
            </content>
          </paragraph>
        </section>
        <section eId="part-5__sec-22">
          <num>22</num>
          <heading>Appointments as authorised persons</heading>
          <subsection eId="part-5__sec-22__subsec-1">
            <num>1</num>
            <content>
              <p><role refersTo="#secretary">The Secretary</role> of the Department may appoint an APS employee in the Department, or an employee of Airservices Australia, to be an authorised person for the purposes of this Act.</p>
            </content>
          </subsection>
          <subsection eId="part-5__sec-22__subsec-2">
            <num>2</num>
            <content>
              <p>	(2)	The Secretary of the Department may appoint persons in a class of persons to be authorised persons for the purposes of this Act. The class must consist of persons who are APS employees in the Department or employees of Airservices Australia<i>.</i></p>
            </content>
          </subsection>
          <subsection eId="part-5__sec-22__subsec-3">
            <num>3</num>
            <content>
              <p>An appointment under this section must be in writing.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-5__sec-23">
          <num>23</num>
          <heading>Conduct by directors, employees and agents</heading>
          <subsection eId="part-5__sec-23__subsec-1">
            <num>1</num>
            <content>
              <p>If, in proceedings for an offence against this Act, it is necessary to prove the state of mind of a body corporate in relation to particular conduct, it is enough to show:</p>
            </content>
            <paragraph eId="part-5__sec-23__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>that the conduct was engaged in by a director, employee or agent of the body corporate within the scope of his or her actual or apparent authority; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-23__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>that the director, employee or agent had the state of mind.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-5__sec-23__subsec-2">
            <num>2</num>
            <content>
              <p>Any conduct engaged in on behalf of a body corporate by a director, employee, or agent of the body corporate within the scope of his or her actual or apparent authority is taken, for the purposes of a prosecution for an offence against this Act, to have been engaged in also by the body corporate unless the body corporate proves that the body corporate took reasonable precautions and exercised due diligence to avoid the conduct.</p>
            </content>
          </subsection>
          <subsection eId="part-5__sec-23__subsec-3">
            <num>3</num>
            <content>
              <p>If, in proceedings for an offence against this Act, it is necessary to establish the state of mind of an individual in relation to particular conduct, it is enough to show:</p>
            </content>
            <paragraph eId="part-5__sec-23__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>that the conduct was engaged in by an employee or agent of the individual within the scope of his or her actual or apparent authority; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-23__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>that the employee or agent had the state of mind.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-5__sec-23__subsec-4">
            <num>4</num>
            <content>
              <p>Any conduct engaged in on behalf of an individual by an employee or agent of the individual within the scope of his or her actual or apparent authority is taken, for the purposes of a prosecution for an offence against this Act, to have been engaged in also by the individual, unless the individual proves that he or she took reasonable precautions and exercised due diligence to avoid the conduct.</p>
            </content>
          </subsection>
          <subsection eId="part-5__sec-23__subsec-5">
            <num>5</num>
            <content>
              <p>In this section:</p>
            </content>
            <content>
              <p><b><i>director</i></b>, in relation to a body that:</p>
            </content>
            <paragraph eId="part-5__sec-23__subsec-5__para-a">
              <num>a</num>
              <content>
                <p>is incorporated for a public purpose by a law of the Commonwealth, of a State or of a Territory; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-23__subsec-5__para-b">
              <num>b</num>
              <content>
                <p>is constituted by one or more members;</p>
              </content>
              <content>
                <p>means the member, or any of the members, constituting the body.</p>
                <p><b><i>engage in conduct</i></b> includes fail or refuse to engage in conduct.</p>
                <p><b><i>offence against this Act </i></b>includes the following:</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-23__subsec-5__para-a">
              <num>a</num>
              <content>
                <p>	(a)	an offence against <i>Crimes Act 1914</i> that relates to an offence against this Act;<ref href="#sec-6">section 6</ref> of the </p>

            <paragraph eId="part-5__sec-23__subsec-5__para-b">
              <num>b</num>
              <content>
                <p>	(b)	an offence against <i>Criminal Code</i>.<ref href="#sec-11">section 11</ref>.1, 11.4 or 11.5 of the </p>

              <content>
                <p><b><i>state of mind</i></b>, in relation to a person, includes:</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-23__subsec-5__para-a">
              <num>a</num>
              <content>
                <p>the person’s knowledge, intention, opinion, belief or purpose; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-23__subsec-5__para-b">

                <p>the person’s reasons for the intention, opinion, belief or purpose.</p>
              </content>
            </paragraph>

          <heading>Regulations</heading>

            <p>The Governor-General may make regulations prescribing matters:</p>
