            <p>		This Act may be cited as the <i>Defence Reserve Service (Protection) Act 2001</i>.</p>

          <heading>Commencement</heading>
          <content>
            <p>This Act commences on the 28th day after the day on which it receives the Royal Assent.</p>

              <p>The following is a simplified overview of the Act.</p>
            </content>

              <p>This Act sets out entitlements and prohibitions that apply in relation to people who are rendering, or have rendered, defence service as members of the Reserves. In some cases, the entitlements extend to their dependants.</p>
            </content>
          </subsection>

            <content>
              <p>The kind of defence service rendered by a particular member determines the scope of the prohibitions and entitlements available in relation to him or her: see <ref href="#part-3">Part 3</ref>.</p>
            </content>
          </subsection>
          <subsection eId="part-1__sec-3__subsec-4">
            <num>4</num>
            <content>
              <p><ref href="#part-4">Part 4</ref> contains prohibitions against conduct that discriminates against members in their employment or other work. This Part applies to all types of defence service.</p>
            </content>
          </subsection>
          <subsection eId="part-1__sec-3__subsec-5">
            <num>5</num>
            <content>
              <p><ref href="#part-5">Part 5</ref> sets out the consequences for a member’s employment if he or she was employed when he or she started to render defence service. This Part applies to all kinds of defence service.</p>
            </content>
          </subsection>

            <num>6</num>
            <content>
              <p><ref href="#part-6">Part 6</ref> protects members from having their partnerships dissolved while the members are absent on defence service. This Part applies to all kinds of defence service.</p>

            <num>7</num>
            <content>
              <p><ref href="#part-7">Part 7</ref> requires an education institution to make reasonable adjustments for a member who undertakes defence service.</p>
            </content>
          </subsection>

            <content>
              <p><ref href="#part-8">Part 8</ref> postpones debts that a member (or his or her dependant) is liable to pay and that would otherwise fall due after the member starts rendering:</p>

                <p>defence service as a result of a call out; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-8__para-b">

                <p>Interest accrues on the postponed debts. <ref href="#part-8">Part 8</ref> also stays proceedings in respect of the postponed debts.</p>

              <p><ref href="#part-9">Part 9</ref> protects a member or his or her dependant from bankruptcy proceedings. It applies only if the member has rendered:</p>
            </content>

              <content>
                <p>defence service as a result of a call out; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-9__para-b">

          </subsection>
          <subsection eId="part-1__sec-3__subsec-10">

            <content>
              <p><ref href="#part-10">Part 10</ref> allows for a member who has rendered defence service as a result of a call out to get access to loans and guarantees to enable him or her to resume civilian life after returning from that service.</p>

          </subsection>

              <p><ref href="#part-11">Part 11</ref> deals with enforcement and remedies. <ref href="#part-12">Part 12</ref> deals with minor miscellaneous matters.</p>

          <heading>Act binds the Crown</heading>

              <p>This Act binds the Crown in each of its capacities.</p>
            </content>
          </subsection>

            <num>2</num>
            <content>
              <p>In particular, obligations that this Act imposes on employers or other persons (however described) are imposed on the Crown just as they are imposed on everyone else.</p>
            </content>
          </subsection>

            <content>
              <p>However, this Act does not make the Crown liable to be prosecuted for an offence.</p>
            </content>
          </subsection>

          <heading>Application of Criminal Code</heading>
          <content>
            <p>		The <i>Criminal Code</i> applies to all offences against this Act.</p>

            <p>In this Act, unless the contrary intention appears:</p>
            <p><term refersTo="#term-absent-on-defence-service">absent on defence service</term> has the meaning given by <def><ref href="#sec-24A">section 24A</ref> and subsections 28(3) and (4).</def></p>
            <p><term refersTo="#term-adi-authorised-deposit-taking-institution">ADI (authorised deposit-taking institution)</term> means <def>a corporation that is an ADI for the purposes of <ref href="">the Banking Act 1959</ref>.</def></p>
            <p><term refersTo="#term-australian-education-institution">Australian education institution</term> means <def>an education institution (within the meaning of <ref href="">the Student Assistance Act 1973</ref>) in Australia.</def></p>
            <p><b><i>body administering an Australian education institution</i></b> means:</p>
          </content>
          <paragraph eId="part-2__sec-7__para-a">
            <num>a</num>
            <content>
              <p>the institution (if it is a body corporate); or</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-7__para-b">
            <num>b</num>

              <p>in any other case—the body or other person (including the Crown) who has ultimate responsibility for administering the institution.</p>
            </content>
            <content>
              <p><term refersTo="#term-call-out">call out</term> means <def>an order under <ref href="#sec-28">section 28</ref>, 33, 34, 35 or 36 of <ref href="">the Defence Act 1903</ref>.</def></p>
              <p><term refersTo="#term-civil-penalty-provision">civil penalty provision</term> has the same meaning as <def>in the Regulatory Powers Act.</def></p>
              <p><term refersTo="#term-commission-agent">commission agent</term> means <def>a person who: works for another person as the agent of that other person; and is wholly or partly remunerated by commission.</def></p>

            </content>

              <p><term refersTo="#term-contractor">contractor</term> means <def>a person who contracts to perform work for another person under a contract for services (other than as an employee).</def></p>
              <p><term refersTo="#term-defence-service">defence service</term> means <def>service (including training) as a member of the Reserves.</def></p>
              <p><term refersTo="#term-dependant">dependant</term> has the meaning given by <def><ref href="#sec-9">section 9</ref>.</def></p>
              <p><b><i>employment</i></b> includes:</p>

              <p>appointment or employment by the Commonwealth, a State or Territory; and</p>
            </content>
          </paragraph>

              <p>appointment or employment by an authority of the Commonwealth or of a State or Territory (including a local government body); and</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-7__para-c">

              <p>an apprenticeship; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-7__para-d">
            <num>d</num>
            <content>
              <p>a traineeship arrangement; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-7__para-e">
            <num>e</num>
            <content>
              <p>full-time, part-time and casual work;</p>
            </content>
            <content>
              <p>but does not include:</p>
            </content>
          </paragraph>

              <p>work under a contract for services; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-7__para-g">
            <num>g</num>

              <p>work as a commission agent.</p>

            <content>
              <p><term refersTo="#term-finance-minister">Finance Minister</term> means <def>the Minister administering the Public Governance, Performance and Accountability Act 2013.</def></p>
              <p><term refersTo="#term-financial-arrangement">financial arrangement</term> has the meaning given by <def><ref href="#sec-40A">section 40A</ref>.</def></p>
              <p><b><i>harass</i></b> has a meaning affected by subsection 23A(3).</p>
              <p><term refersTo="#term-hire-purchase-agreement">hire purchase agreement</term> means <def>a contract for the hire of goods where: the hirer has the right or obligation to buy the goods; and the charge that is or may be made for the hire, together with any other amount payable under the contract (including an amount to buy the goods or to exercise an option to do so), is more than the price of the goods; and title in the goods does not pass to the hirer until the option to purchase is exercised. <b><i>land</i></b> includes: buildings and improvements on land; and a legal or equitable estate or interest in land; and a right, power or privilege over, or in relation to, land; and a company title interest in land.</def></p>

          </paragraph>
          <paragraph eId="part-2__sec-7__para-a">
            <num>a</num>
            <content>
              <p>the hirer has the right or obligation to buy the goods; and</p>
            </content>
          </paragraph>

              <p><term refersTo="#term-member">member</term> means <def>a person who is, or has been, a member of a part of the Reserves, but does not include a person called upon to serve in the Defence Force under <ref href="#sec-60">section 60</ref> of <ref href="">the Defence Act 1903</ref>.</def></p>
              <p><b><i>operational service</i></b>:</p>

          </paragraph>

            <num>a</num>
            <content>
              <p>subject to paragraph (d), includes defence service in circumstances involving one or more of the following:</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-7__para-i">
            <num>i</num>
            <content>
              <p>	(i)	war (within the meaning of the <i>Defence Act 1903</i>) or warlike operations;</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-7__para-ii">
            <num>ii</num>
            <content>
              <p>	(ii)	a time of defence emergency (within the meaning of the <i>Defence Act 1903</i>);</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-7__para-iii">
            <num>iii</num>
            <content>
              <p>defence preparation;</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-7__para-iv">
            <num>iv</num>
            <content>
              <p>peacekeeping or peace enforcement;</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-7__para-v">
            <num>v</num>
            <content>
              <p>assistance to Commonwealth, State, Territory or foreign government authorities and agencies in matters involving Australia’s national security or affecting Australian defence interests;</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-7__para-vi">
            <num>vi</num>
            <content>
              <p>support to community activities of national or international significance;</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-7__para-vii">
            <num>vii</num>
            <content>
              <p>civil aid, humanitarian assistance, medical or civil emergency or disaster relief; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-7__para-b">
            <num>b</num>
            <content>
              <p>subject to paragraph (d), includes defence service prescribed by the rules for the purposes of this paragraph; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-7__para-c">
            <num>c</num>
            <content>
              <p>subject to paragraph (d), includes defence service by a member involving:</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-7__para-i">
            <num>i</num>
            <content>
              <p>preparing to render particular operational service covered by paragraph (a) or (b); or</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-7__para-ii">
            <num>ii</num>
            <content>
              <p>decompressing after rendering operational service covered by paragraph (a) or (b); and</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-7__para-d">
            <num>d</num>
            <content>
              <p>does not include defence service prescribed by the rules for the purposes of this paragraph.</p>
            </content>
            <content>
              <p><term refersTo="#term-protected-co-worker">protected co-worker</term> has the meaning given by <def>subsection 23A(5).</def></p>
              <p><b><i>protected period</i></b>, in relation to a member who is rendering, or has rendered, defence service in relation to which Part 5 or Part 8 applies, means the shorter of the following periods:</p>

            <num>a</num>
            <content>
              <p>the period that begins immediately after the day on which the member ceased to render the defence service and that is equal to the length of that service;</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-7__para-b">
            <num>b</num>
            <content>
              <p>the period of 12 months beginning immediately after the day on which the member ceased to render that service.</p>
            </content>
            <content>
              <p><term refersTo="#term-protected-worker">protected worker</term> has the meaning given by <def>subsection 23A(4).</def></p>
              <p><term refersTo="#term-reasonable-adjustment">reasonable adjustment</term> has the meaning given by <def>subsection 38(4).</def></p>
              <p><term refersTo="#term-regulatory-powers-act">Regulatory Powers Act</term> means <def>the Regulatory Powers (Standard Provisions) Act 2014.</def></p>
              <p><term refersTo="#term-reserves">Reserves</term> has the same meaning as <def>in <ref href="">the Defence Act 1903</ref>.</def></p>
              <p><term refersTo="#term-rules">rules</term> means <def>rules made under <ref href="#sec-81">section 81</ref>.</def></p>
              <p><term refersTo="#term-secretary">Secretary</term> means <def>Secretary of the Department.</def></p>
              <p><b><i>start day</i></b> of service to which Part 8, 9 or 10 applies has the meaning given by subsection 13(3).</p>
              <p><b><i>this Act</i></b> includes the rules.</p>

          <heading>Meaning of dependant</heading>
          <subsection eId="part-2__sec-9__subsec-1">
            <num>1</num>
            <content>
              <p>In this Act:</p>
            </content>
            <content>
              <p><b><i>dependant</i></b> of a member who is or was rendering service to which Part 8, 9 or 10 applies (see section 13) means:</p>
            </content>
            <paragraph eId="part-2__sec-9__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>the member’s partner; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-9__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>a person who was wholly or partly dependent on the member for financial support immediately before the start day of the service; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-9__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>a person who became, or becomes, wholly or partly dependent on the member for financial support while the member was or is rendering the service; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-9__subsec-1__para-d">
              <num>d</num>
              <content>
                <p>a person to whom:</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-9__subsec-1__para-i">
              <num>i</num>

                <p>	(i)	a pension is payable under the <i>Veterans’ Entitlements Act 1986</i>; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-9__subsec-1__para-ii">

                <p>	(ii)	compensation is payable under the <i>Military Rehabilitation and Compensation Act 2004</i>;</p>
              </content>

                <p>because of the member’s incapacity or death; or</p>
              </content>

                <p>if the member died while rendering the service—the widow or widower of the member.</p>

                  <p>the third person is a protected co-worker of the employee, commission agent or contractor because of that employment, commission agency or contract.</p>

                <p>Essentially, the Part protects the status and entitlements, such as accrued leave, of members who render the defence service while subject to employment obligations.</p>

            <heading>Meaning of absent on defence service</heading>
            <content>
              <p>		A member who is employed before starting to render defence service is <b><i>absent on defence service</i></b> during any of the following periods:</p>

              <num>a</num>
              <content>
                <p>any period during which the member is travelling from his or her residence to the place at which he or she is required to report for defence service;</p>
              </content>
            </paragraph>

                <p>any period while he or she is rendering defence service;</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__dvs-1__sec-24A__para-c">

                <p>the period (if any) starting immediately after he or she ceases to render that service and ending (subject to subsections 28(3) and (4)) immediately before the earlier of the following times:</p>

                <p>This section applies if a member is employed by a person under a contract of employment that allows the member any type of paid or unpaid leave.</p>

                <p>The employer must not require the member to take the leave concurrently with all or part of his or her absence on defence service.</p>
              </content>
            </subsection>
            <subsection eId="part-5__dvs-2__sec-25__subsec-3">

                <p>Subsection (2) does not apply to the extent that the member agrees to take the leave concurrently with all or part of that absence.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-5__dvs-2__sec-26">
            <num>26</num>
            <heading>Member entitled to be absent during defence service</heading>
            <subsection eId="part-5__dvs-2__sec-26__subsec-1">
              <num>1</num>
              <content>
                <p>A member who is employed before being absent on defence service is entitled to be absent from that employment while the member is absent on defence service.</p>
              </content>
            </subsection>
            <subsection eId="part-5__dvs-2__sec-26__subsec-2">
              <num>2</num>
              <content>
                <p>A period during which the member is absent from that employment while absent on defence service is taken not to be a period of employment under the member’s contract of employment unless this Part provides otherwise.</p>
              </content>
            </subsection>
            <subsection eId="part-5__dvs-2__sec-26__subsec-3">
              <num>3</num>
              <content>
                <p>Subsection (2) does not apply to a period throughout which the member is taking any type of paid or unpaid leave under the member’s contract of employment, as mentioned in subsection 25(3).</p>
              </content>
            </subsection>
            <subsection eId="part-5__dvs-2__sec-26__subsec-4">
              <num>4</num>
              <content>
                <p>This section does not:</p>
              </content>

                  <p>limit the ability of a contract of employment to allow a person any type of paid or unpaid leave; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-5__dvs-2__sec-26__subsec-4__para-c">

                  <p>prevent the termination of a member’s contract of employment in accordance with law for a reason other than an absence mentioned in subsection (1).</p>
                </content>

          <heading>Resuming work after defence service</heading>

            <heading>Applying to resume work after defence service</heading>
            <subsection eId="part-5__dvs-3__sec-27__subsec-1">
              <num>1</num>
              <content>
                <p>A member who is absent from his or her employment while absent on defence service may apply to the employer to resume work under the member’s contract of employment. An application must be in writing (unless the employer waives that requirement).</p>
              </content>
            </subsection>
            <subsection eId="part-5__dvs-3__sec-27__subsec-2">
              <num>2</num>
              <content>
                <p>	(2)	If the contract of employment was terminated in accordance with law while the member was absent on defence service but another employer (the <b><i>new employer</i></b>) is carrying on:</p>
              </content>
              <paragraph eId="part-5__dvs-3__sec-27__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>the business or undertaking in which the member was employed under the contract; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-5__dvs-3__sec-27__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>another business or undertaking which includes that business or undertaking;</p>
                </content>
                <content>
                  <p>the member may apply in writing to the new employer for reinstatement.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-5__dvs-3__sec-27__subsec-3">
              <num>3</num>
              <content>
                <p>The member must apply to the employer or new employer no later than 30 days after ceasing to render defence service.</p>
              </content>
            </subsection>
            <subsection eId="part-5__dvs-3__sec-27__subsec-4">
              <num>4</num>
              <content>
                <p>If an employee is reinstated in employment with a new employer, the contract of employment under which the member was previously employed is novated to the new employer.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-5__dvs-3__sec-28">
            <num>28</num>
            <heading>Employer must allow member to resume work</heading>
            <subsection eId="part-5__dvs-3__sec-28__subsec-1">
              <num>1</num>
              <content>
                <p>As soon as reasonably practicable after receiving an application under <ref href="#sec-27">section 27</ref>, the employer must:</p>
              </content>
              <paragraph eId="part-5__dvs-3__sec-28__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>allow the member to resume work, or reinstate the member in employment, in the same capacity in which the member was employed immediately before the start of the member’s absence on defence service; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-5__dvs-3__sec-28__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>ensure that the member’s terms and conditions of employment (including remuneration) are at least as favourable as those that would have applied to him or her in that capacity but for the service.</p>
                </content>
                <content>
                  <p>Exceptions</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-5__dvs-3__sec-28__subsec-2">
              <num>2</num>
              <content>
                <p>Subsection (1) does not apply if:</p>
              </content>
              <paragraph eId="part-5__dvs-3__sec-28__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>the employer agreed to the resumption or reinstatement, but the member:</p>
                </content>
              </paragraph>
              <paragraph eId="part-5__dvs-3__sec-28__subsec-2__para-i">
                <num>i</num>
                <content>
                  <p>did not make himself or herself available for work as agreed between them; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-5__dvs-3__sec-28__subsec-2__para-ii">
                <num>ii</num>
                <content>
                  <p>did not have a reasonable excuse for not doing so; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-5__dvs-3__sec-28__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>because of changed circumstances since the member was employed (except employing someone else to replace the member):</p>
                </content>
              </paragraph>
              <paragraph eId="part-5__dvs-3__sec-28__subsec-2__para-i">
                <num>i</num>
                <content>
                  <p>it was not within the employer’s power to allow the resumption or reinstatement; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-5__dvs-3__sec-28__subsec-2__para-ii">
                <num>ii</num>
                <content>
                  <p>the employer offered to employ the member in a capacity, and under terms and conditions, that were the most favourable that it was reasonable or practicable to offer him or her.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-5__dvs-3__sec-28__subsec-3">
              <num>3</num>
              <content>
                <p>	(3)	If paragraph (2)(a) applies, the member ceases to be <b><i>absent on defence service</i></b> at the time the member was to have made himself or herself available for work under the agreement mentioned in that paragraph.</p>
              </content>
            </subsection>
            <subsection eId="part-5__dvs-3__sec-28__subsec-4">
              <num>4</num>
              <content>
                <p>	(4)	If paragraph (2)(b) applies, the member ceases to be <b><i>absent on defence service</i></b>:</p>
              </content>
              <paragraph eId="part-5__dvs-3__sec-28__subsec-4__para-a">
                <num>a</num>
                <content>
                  <p>when the employer informs the member that it was not within the employer’s power to allow the resumption or reinstatement, as mentioned in subparagraph (2)(b)(i); or</p>
                </content>
              </paragraph>
              <paragraph eId="part-5__dvs-3__sec-28__subsec-4__para-b">
                <num>b</num>
                <content>
                  <p>if the member accepts the offer mentioned in subparagraph (2)(b)(ii)—when the offered employment starts; or</p>
                </content>

                <num>c</num>
                <content>
                  <p>if the member does not accept the offer—when the member declines the offer, or 30 days after the employer makes the offer, whichever occurs first.</p>

            <heading>Other rights to resume work not affected</heading>

              <p>This Division does not limit any right of a member to resume work or to be reinstated in employment under:</p>

                <p>a contract of employment; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__dvs-3__sec-28A__para-b">

          <heading>Effect of defence service on particular entitlements of members</heading>

            <heading>Which entitlements this Division applies to</heading>

              <p>This Division deals with determining the entitlements of a member, or of someone else arising because of the entitlements of a member, under a contract of employment or otherwise in relation to the following:</p>

                <p>annual leave and leave loadings;</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__dvs-4__sec-29__para-b">

                <p>personal or carer’s leave, including sick leave, family leave, bereavement leave, compassionate leave, cultural leave and other like forms of leave;</p>
              </content>
            </paragraph>

                <p>parental leave, including maternity and adoption leave;</p>
              </content>
            </paragraph>

                <p>This section applies if a member resumes work, or is reinstated in employment, under this Part after rendering continuous full time defence service.</p>

                <p>The entitlements in relation to the member’s employment in respect of the period of the absence on defence service must be no less beneficial than they would have been if the member had been absent on leave without pay from the employment during that period.</p>

                <p>In particular, the continuity of the member’s employment is taken not to have been broken by his or her absence on defence service.</p>

            <subsection eId="part-5__dvs-4__sec-31__subsec-1">

                <p>This section applies if a member resumes work, or is reinstated in employment, under this Part after rendering defence service other than continuous full time defence service.</p>

                  <p>the period of the absence is taken to have been paid service in the employment; and</p>

              </paragraph>

                  <p>the continuity of the member’s employment is taken not to have been broken by his or her absence on defence service.</p>

                <p>If the member is reinstated in employment with a new employer (see subsection 27(2)):</p>

                  <p>the period of employment under the contract of employment with the old employer is taken to have been served under the contract of employment entered into on the reinstatement; and</p>

                  <p>the period of the absence is taken to have been paid service in the new employment; and</p>

                <p>This section applies if an employer has (in accordance with this Part) permitted a member to resume work or reinstated a member in employment.</p>

                <p>During the period that begins immediately after the member resumes work, or is reinstated in employment, and that is equal to the length of the member’s absence on defence service, the employer must not:</p>

                  <p>terminate the member’s employment; or</p>
                </content>
              </paragraph>

                <p>To avoid doubt, this Act does not oblige an employer of a member who is, or has been, absent on defence service to do any of the following in respect of the period of the absence:</p>

                  <p>to pay the member’s remuneration in respect of the employment; or</p>
                </content>

                  <p>to grant the member’s entitlements in respect of the employment (except as provided under this Part); or</p>
                </content>

                  <p>to meet the employer’s obligations under a workers’ compensation law to pay premiums, contributions or similar payments in relation to the member; or</p>

                  <p>	(d)	to meet the employer’s obligations under the <i>Superannuation Guarantee (Administration) Act 1992</i> in relation to the member.</p>

                <p>while the member is rendering defence service.</p>

                <p>requires a body administering an educational institution to make reasonable adjustments required because a member enrolled in a course at the institution is rendering defence service; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-37__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>allows a member to re-enrol in, and resume, a course that was interrupted because the member rendered defence service.</p>
              </content>
            </paragraph>
          </subsection>
        </section>

          <heading>Obligations of body administering education institution</heading>
          <subsection eId="part-7__sec-38__subsec-1">
            <num>1</num>
            <content>
              <p>This section applies in relation to a member who is enrolled in a course at an Australian education institution before starting to render defence service.</p>
            </content>
          </subsection>
          <subsection eId="part-7__sec-38__subsec-2">
            <num>2</num>
            <content>
              <p>The body administering the education institution must make reasonable adjustments to accommodate the member’s defence service.</p>
            </content>
          </subsection>
          <subsection eId="part-7__sec-38__subsec-3">
            <num>3</num>
            <content>
              <p>Without limiting subsection (2), the adjustments required by that subsection could involve any of the following:</p>
            </content>
            <paragraph eId="part-7__sec-38__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>not failing the member;</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-38__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>recognising assessment or practical work undertaken by the member before starting to render defence service;</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-38__subsec-3__para-c">
              <num>c</num>
              <content>
                <p>allowing the member to defer undertaking or completing assessment or practical work;</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-38__subsec-3__para-d">
              <num>d</num>
              <content>
                <p>refunding or crediting fees paid by or for the member.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-7__sec-38__subsec-4">
            <num>4</num>
            <content>
              <p>	(4)	An adjustment is a <b><i>reasonable adjustment</i></b> unless making the adjustment would impose an unjustifiable hardship on the body administering the education institution.</p>
            </content>
          </subsection>
          <subsection eId="part-7__sec-38__subsec-5">
            <num>5</num>
            <content>
              <p>In determining whether a hardship that would be imposed on the body administering the education institution would be an unjustifiable hardship, all relevant circumstances of the particular case must be taken into account, including the following:</p>
            </content>
            <paragraph eId="part-7__sec-38__subsec-5__para-a">
              <num>a</num>
              <content>
                <p>the nature of the benefit or detriment likely to accrue to, or to be suffered by, any person concerned;</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-38__subsec-5__para-b">
              <num>b</num>
              <content>
                <p>the financial circumstances of, and the estimated amount of expenditure required to be made by, the body;</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-38__subsec-5__para-c">
              <num>c</num>
              <content>
                <p>the availability of financial and other assistance to the body.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-7__sec-38__subsec-6">
            <num>6</num>
            <content>
              <p>The burden of proving that something would impose unjustifiable hardship lies on the person claiming unjustifiable hardship.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-7__sec-39">

          <heading>Education institution must re-enrol member etc.</heading>
          <subsection eId="part-7__sec-39__subsec-1A">
            <num>1A</num>
            <content>
              <p>This section applies in relation to a member who:</p>
            </content>
            <paragraph eId="part-7__sec-39__subsec-1A__para-a">
              <num>a</num>
              <content>
                <p>is enrolled in a course at an Australian education institution during all or part of the period he or she is rendering defence service; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-39__subsec-1A__para-b">
              <num>b</num>
              <content>
                <p>does not complete the course before ceasing to render the service; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-39__subsec-1A__para-c">
              <num>c</num>
              <content>
                <p>applies to re-enrol (if necessary) and to resume the course <quantity refersTo="#deadline">within 30 days</quantity> after ceasing to render the service.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-7__sec-39__subsec-1">
            <num>1</num>
            <content>
              <p>The body administering the Australian education institution must not exclude the member from the course, or subject the member to any other disadvantage, because he or she did not complete a requirement of the course or any assessment for the course:</p>
            </content>
            <paragraph eId="part-7__sec-39__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>while rendering the defence service; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-39__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>otherwise because of having rendered the defence service.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-7__sec-39__subsec-2">
            <num>2</num>
            <content>
              <p>The body administering the Australian education institution must:</p>
            </content>
            <paragraph eId="part-7__sec-39__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>allow the member to re-enrol (if necessary) in the course; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-39__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>allow the member to resume the course at a point that the body considers appropriate; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-39__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>ensure that the conditions (if any) on the re-enrolment and resumption are the same as those that would have applied to a person who is not a member.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-7__sec-39__subsec-3">
            <num>3</num>
            <content>
              <p>Subsection (2) does not apply if, because of a change in the nature of courses offered by the institution since the member was previously enrolled:</p>
            </content>
            <paragraph eId="part-7__sec-39__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>it was not reasonable or practicable to allow the member to re-enrol or resume the course in which he or she was previously enrolled; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-39__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>the body administering the institution offered to enrol the member in another course that most closely corresponded to the course in which he or she was previously enrolled; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-39__subsec-3__para-c">
              <num>c</num>
              <content>
                <p>the conditions on the re-enrolment and resumption were the most favourable that it was reasonable or practicable to offer the member.</p>
              </content>
            </paragraph>
          </subsection>

              <p>This section does not limit <ref href="#sec-38">section 38</ref>.</p>

Generally, the liability must have arisen before the start day of the service.</p>

            </subsection>
            <subsection eId="part-8__dvs-1__sec-40__subsec-3">
              <num>3</num>

                <p>The liabilities are postponed for the shorter of the following:</p>
              </content>
              <paragraph eId="part-8__dvs-1__sec-40__subsec-3__para-a">
                <num>a</num>
                <content>
                  <p>the period that begins immediately after the member ceased to render defence service and that is equal to the length of that service;</p>
                </content>
              </paragraph>
              <paragraph eId="part-8__dvs-1__sec-40__subsec-3__para-b">
                <num>b</num>
                <content>
                  <p>the period of 12 months beginning immediately after he or she ceased to render that service.</p>
                </content>
              </paragraph>
            </subsection>

                <p>Interest accrues on the postponed liabilities. This is so regardless of whether the member or dependant had to pay interest in respect of the original liability.</p>

                <p>This Part does not apply to a liability of a member or his or her dependant to make a payment under a financial arrangement if, while liable to make the payment, the member or dependant:</p>

                  <p>becomes bankrupt; or</p>
                </content>
              </paragraph>

                </content>

                  <p>compounds with his or her creditors; or</p>
                </content>
              </paragraph>

              </paragraph>

                  <p>dies and his or her estate is being administered in bankruptcy or insolvency.</p>

                <p>For the purposes of subsection (1), it does not matter whether the bankruptcy, insolvency, assignment or death happened before or after the commencement of this Act.</p>

                <p>This Part does not apply in relation to a liability of a member to make a payment as a trustee or in a representative capacity except to the extent that, in incurring the liability, the member is acting for the benefit of, or on behalf of, persons who are, or who include, the member or one or more dependants of the member.</p>

                <p>Dependant’s liability</p>

            </subsection>

                <p>This Part does not apply in relation to a liability of a member’s dependant to make a payment as a trustee or in a representative capacity except to the extent that, in incurring the liability, the dependant is acting for the benefit of, or on behalf of, persons who are, or who include, the member, the dependant, or one or more other dependants of the member.</p>

            <heading>Liability exists even if payment not yet due</heading>

              <p>		For the purposes of this Part, a person is <b><i>liable to make a payment</i></b> if he or she is obliged to make it, even if the due date for payment has not arrived.</p>

            <heading>Liability may have arisen before commencement of this Act</heading>

              <p>To avoid doubt, a liability to which this Part applies may arise before or after the commencement of this Act.</p>

          <heading>Payments postponed and proceedings stayed</heading>

            <p>Subdivision A—Postponement</p>
          </content>

                <p>The time for making a payment under a financial arrangement to which this Part applies is, by force of this section, postponed in accordance with this Division.</p>

                <p>The time for making a payment of rates to which this Part applies is, by force of this section, postponed in accordance with this Division.</p>

                <p>A time is postponed by this section even if the time had already passed when the member began to render the relevant service.</p>

            </subsection>

                <p>However, this section does not prevent a person from making a payment before the time to which payment is postponed.</p>

            </subsection>

              <p>Payments by instalment</p>
            </content>
            <subsection eId="part-8__dvs-3__sec-50__subsec-1">

                  <p>the payments are to be made by the member or dependant by instalment; and</p>
                </content>

                <num>b</num>
                <content>
                  <p>the first instalment falls due before the end of the member’s protected period;</p>
                </content>
                <content>
                  <p>then:</p>
                </content>
              </paragraph>
              <paragraph eId="part-8__dvs-3__sec-50__subsec-1__para-c">

                <content>
                  <p>the time for paying the first unpaid instalment is postponed so that the payment falls due at the end of the member’s protected period; and</p>

                  <p>the time for paying each later instalment is postponed for a period of the same length as the member’s protected period.</p>

                  <p>the time for making the payment is postponed so that it falls due at the end of the member’s protected period.</p>

                <p>If the person liable to make the payment is a dependant of a member and the dependant dies while the member is rendering defence service, the time for making the payment is postponed so that the payment falls due on the first anniversary of the dependant’s death.</p>

                <p>If a financial arrangement to which this Part applies allows interest to be paid or accepted at a reduced or lower rate if it is paid on or before the due date, interest remains payable at the reduced or lower rate even if (because of this Division) it is not so paid.</p>

            </subsection>

                <p>No interest is payable under any other law on the late payment of rates on land if the payments were postponed under this Division.</p>

            </subsection>

            <heading>Interest payable on postponed payments under a financial arrangement</heading>
            <subsection eId="part-8__dvs-3__sec-53__subsec-1">
              <num>1</num>

                <p>Interest is payable by the member or dependant on a payment under a financial arrangement that is postponed under this Division until the payment is made.</p>
              </content>
            </subsection>
            <subsection eId="part-8__dvs-3__sec-53__subsec-2">
              <num>2</num>
              <content>
                <p>The interest is payable to the person to whom the postponed payments are required to be made.</p>
              </content>
            </subsection>
            <subsection eId="part-8__dvs-3__sec-53__subsec-3">
              <num>3</num>
              <content>
                <p>The rate of the interest is:</p>
              </content>
              <paragraph eId="part-8__dvs-3__sec-53__subsec-3__para-a">
                <num>a</num>
                <content>
                  <p>the rate or rates specified in the financial arrangement concerned before the interest falls due; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-8__dvs-3__sec-53__subsec-3__para-b">

                  <p>if no rate of interest is specified in the financial arrangement—the rate worked out in accordance with the rules as in force at the start of the start day of the member’s defence service.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-8__dvs-3__sec-53__subsec-4">
              <num>4</num>
              <content>
                <p>The interest is payable after the start of the postponement:</p>
              </content>
              <paragraph eId="part-8__dvs-3__sec-53__subsec-4__para-a">
                <num>a</num>
                <content>
                  <p>at the times specified in the financial arrangement for paying interest; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-8__dvs-3__sec-53__subsec-4__para-b">
                <num>b</num>
                <content>
                  <p>if no times are specified or the times specified have passed—at the end of 3 months after the start of the postponement and at the end of each successive period of 3 months after that.</p>
                </content>
              </paragraph>
            </subsection>
          </section>
          <section eId="part-8__dvs-3__sec-54">

            <heading>Interest payable on payment of postponed rates etc. on land</heading>
            <subsection eId="part-8__dvs-3__sec-54__subsec-1">
              <num>1</num>

                <p>Interest is payable by the member or dependant on a payment that is covered by <ref href="#sec-43">section 43</ref>, and that is postponed, until the payment is made.</p>
              </content>
            </subsection>
            <subsection eId="part-8__dvs-3__sec-54__subsec-2">
              <num>2</num>
              <content>
                <p>The interest is payable to the person to whom the postponed payments are required to be made.</p>
              </content>
            </subsection>
            <subsection eId="part-8__dvs-3__sec-54__subsec-3">

              <content>
                <p>The rate of the interest is the rate worked out in accordance with the rules as in force at the start of the start day of the member’s defence service.</p>

            </subsection>

                <p>The interest is payable at the end of each quarter that ends after the start of the postponement.</p>
              </content>
              <content>
                <p>Subdivision B—Proceedings stayed</p>

            <heading>Proceedings stayed but rights not otherwise prejudiced</heading>

                <p>While one or more payments are postponed, all proceedings against the member or dependant concerned that were instituted before the commencement of this Act:</p>
              </content>
              <paragraph eId="part-8__dvs-3__sec-55__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>to enforce the payments; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-8__dvs-3__sec-55__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>in respect of, or because of, non-payment;</p>
                </content>
                <content>
                  <p>are stayed.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-8__dvs-3__sec-55__subsec-2">

                <p>It does not matter how or in what forum the proceedings were instituted.</p>
              </content>
            </subsection>
            <subsection eId="part-8__dvs-3__sec-55__subsec-3">

                <p>Also, while one or more payments are postponed, all remedies against the member or dependant to recover the payments are stayed.</p>
              </content>
            </subsection>

                <p>However, this Division does not:</p>
              </content>
              <paragraph eId="part-8__dvs-3__sec-55__subsec-4__para-a">

                  <p>prejudice or affect any stayed proceeding or remedy; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-8__dvs-3__sec-55__subsec-4__para-b">
                <num>b</num>

                  <p>affect the rights or obligations of anyone;</p>
                </content>
                <content>
                  <p>except so far as is necessary to give effect to this Division.</p>

              </paragraph>

                <p>A court may order that all, or a specified part, of this Division not apply in relation to a particular payment if the court is satisfied that the operation of those provisions would cause hardship or unreasonable loss to someone other than the member or dependant.</p>

                <p>In considering an application for an order, the court may make any interlocutory or final order (including as to costs) that the court considers just, having regard to:</p>
              </content>

                  <p>if the liability arose under a financial arrangement—the terms and conditions of the financial arrangement; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-8__dvs-3__sec-56__subsec-2__para-b">

                <content>
                  <p>the circumstances of the member or dependant; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-8__dvs-3__sec-56__subsec-2__para-c">

                  <p>the circumstances of the other person.</p>
                </content>
              </paragraph>
            </subsection>
          </section>
        </division>
        <division eId="part-8__dvs-4">

          <heading>General matters</heading>
          <section eId="part-8__dvs-4__sec-57">
            <num>57</num>
            <heading>Powers of security holder not affected</heading>
            <content>
              <p>This Part does not affect the power of a security holder under a financial arrangement to which this Part applies to enforce the holder’s rights against the member or dependant if:</p>
            </content>
            <paragraph eId="part-8__dvs-4__sec-57__para-a">
              <num>a</num>
              <content>
                <p>the security holder was, or is, in possession of the security at the start day of the member’s defence service; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-8__dvs-4__sec-57__para-b">
              <num>b</num>
              <content>
                <p>if the security is land—the security holder has appointed or appoints a receiver who, at the start day of the member’s defence service, was, or is:</p>
              </content>
            </paragraph>
            <paragraph eId="part-8__dvs-4__sec-57__para-i">
              <num>i</num>
              <content>
                <p>in possession of the land; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-8__dvs-4__sec-57__para-ii">
              <num>ii</num>

                <p>receiving the rents and profits of the land.</p>

            <heading>Instruments made on or after start day not affected</heading>

              <p>This Part does not prevent or alter the effect of:</p>

                <p>any instrument concerning a financial arrangement to which this Part applies that is made on or after the start day of the defence service of the member concerned; or</p>
              </content>
            </paragraph>

                <p>any thing done under the instrument.</p>
              </content>
            </paragraph>
          </section>
          <section eId="part-8__dvs-4__sec-59">

            <heading>Joint liability</heading>
            <subsection eId="part-8__dvs-4__sec-59__subsec-1">
              <num>1</num>
              <content>
                <p>If a member or his or her dependant is liable jointly with one or more others to make a payment under a financial arrangement, this Part applies to the member’s or dependant’s liability in the same way as it would apply if the member or dependant were solely liable.</p>
              </content>
            </subsection>
            <subsection eId="part-8__dvs-4__sec-59__subsec-2">
              <num>2</num>
              <content>
                <p>However, this Part does not apply to the liability of the other parties who are jointly liable (but who are not members or dependants to whose defence service this Part applies in their own right).</p>
              </content>
            </subsection>
          </section>
          <section eId="part-8__dvs-4__sec-60">

            <heading>Postponement etc. not to be taken into account for purposes of statutes of limitations etc.</heading>
            <content>
              <p>In working out the deadline imposed by a statute of limitations or other Commonwealth, State or Territory law for bringing actions or pursuing other remedies in respect of a liability to which this Part applies, the following periods are not to be taken into account:</p>
            </content>
            <paragraph eId="part-8__dvs-4__sec-60__para-a">
              <num>a</num>
              <content>
                <p>the period while the time for making payments is postponed under this Part;</p>
              </content>
            </paragraph>
            <paragraph eId="part-8__dvs-4__sec-60__para-b">
              <num>b</num>
              <content>
                <p>the period while proceedings, or proposed proceedings, are stayed under this Part.</p>
              </content>
            </paragraph>
          </section>
          <section eId="part-8__dvs-4__sec-61">

            <heading>Certain rights of member or dependant preserved</heading>
            <subsection eId="part-8__dvs-4__sec-61__subsec-1">
              <num>1</num>
              <content>
                <p>The right of a member or of his or her dependant to commence a proceeding, or to enforce a right, exercise a power or pursue a remedy, in relation to a liability to which this Part applies, is not barred during the preservation period:</p>
              </content>
              <paragraph eId="part-8__dvs-4__sec-61__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>by the end of a period of limitation fixed by a Commonwealth, State or Territory law; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-8__dvs-4__sec-61__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>by an instrument with respect to the right.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-8__dvs-4__sec-61__subsec-2">

                <p>The proceeding may be commenced, and the right enforced, power exercised or remedy pursued, at any time before the end of the preservation period.</p>
              </content>
            </subsection>

                <p>It does not matter whether the right arose or arises before or after the commencement of this Act.</p>

        </section>

          <heading>Bankruptcy proceedings against member or dependant not allowed</heading>
          <subsection eId="part-9__sec-63__subsec-1">
            <num>1</num>
            <content>
              <p>During a member’s protected period, a bankruptcy notice must not be issued, and a creditor’s petition must not be presented, in relation to the member or a dependant of the member if the notice or petition relates to a debt that arose before the start day of the relevant defence service.</p>
            </content>
          </subsection>
          <subsection eId="part-9__sec-63__subsec-2">
            <num>2</num>
            <content>
              <p>Subsection (1) does not apply to a person who has leave of a court with jurisdiction in bankruptcy or insolvency to issue the notice or present the petition.</p>
            </content>
          </subsection>

            <content>
              <p>The court must not grant leave unless the court is satisfied that, having regard to all the circumstances of the case (including the conduct and financial position of the member or dependant, and of the applicant), it would be inequitable to refuse to grant leave.</p>

        </section>

          <num>64</num>
          <heading>Orders court may make relating to bankruptcy of member or dependant</heading>
          <subsection eId="part-9__sec-64__subsec-1">
            <num>1</num>
            <content>
              <p>If:</p>
            </content>
            <paragraph eId="part-9__sec-64__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>a creditor presents a bankruptcy petition to a court against a member or his or her dependant; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-9__sec-64__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>the member or dependant satisfies the court that he or she was unable to pay the relevant debts because of circumstances directly or indirectly attributable to the member’s defence service;</p>
              </content>
              <content>
                <p>the court may stay the proceedings under the petition for such time and subject to such conditions as the court thinks fit.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-9__sec-64__subsec-2">
            <num>2</num>
            <content>
              <p>If:</p>
            </content>
            <paragraph eId="part-9__sec-64__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>a court has, on the petition of a creditor, made a sequestration order against a person who is a member or a dependant of a member; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-9__sec-64__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>on application, the court is satisfied that, if the sequestration order is annulled:</p>
              </content>
            </paragraph>
            <paragraph eId="part-9__sec-64__subsec-2__para-i">
              <num>i</num>
              <content>
                <p>the business (if any) of that person will continue to be carried on by the person or on his or her behalf; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-9__sec-64__subsec-2__para-ii">
              <num>ii</num>
              <content>
                <p>there will be a reasonable prospect of that business being carried on successfully;</p>
              </content>
              <content>
                <p>the court may make an order annulling the sequestration order.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-9__sec-64__subsec-3">

            <content>
              <p>	(3)	An order under subsection (2) annulling a sequestration order has the same effect as an annulment of the sequestration order under the <i>Bankruptcy Act 1966</i>.</p>
            </content>
          </subsection>

            <num>4</num>
            <content>
              <p>An order under subsection (2) may be made on such conditions (including the reimbursement of the costs incurred by the petitioning creditor in the bankruptcy proceedings) as the court thinks fit.</p>

          </subsection>

        <heading>Loans and guarantees to returned members</heading>

              <p>This Part applies to service rendered as a result of a call out (see <ref href="#part-3">Part 3</ref>).</p>
            </content>
          </subsection>
          <subsection eId="part-10__sec-65__subsec-2">
            <num>2</num>
            <content>
              <p>Essentially, the Part allows for a member who has rendered defence service to get access to loans and guarantees to enable him or her to resume civilian life after returning from that service.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-10__sec-66">
          <num>66</num>
          <heading>The Chief of the Defence Force may make loans and give guarantees</heading>
          <content>
            <p>To enable a member to resume civilian life after he or she stops rendering defence service, the Chief of the Defence Force may, on behalf of the Commonwealth:</p>
          </content>
          <paragraph eId="part-10__sec-66__para-a">
            <num>a</num>
            <content>
              <p>make a loan to the member; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-10__sec-66__para-b">
            <num>b</num>
            <content>
              <p>guarantee the repayment of a loan to a member and interest on the loan.</p>
            </content>
          </paragraph>
        </section>
        <section eId="part-10__sec-67">
          <num>67</num>
          <heading>Amount of loan or guarantee</heading>
          <subsection eId="part-10__sec-67__subsec-1">
            <num>1</num>
            <content>
              <p>	(1)	The amount of a loan made, or guarantee given, to a member must not be more than the amount (the <b><i>maximum loan amount</i></b>) prescribed by the rules.</p>
            </content>
          </subsection>
          <subsection eId="part-10__sec-67__subsec-2">
            <num>2</num>
            <content>
              <p>If more than one loan is made or guarantee given to a member, the sum of them must not be more than the maximum loan amount.</p>
            </content>
          </subsection>
          <subsection eId="part-10__sec-67__subsec-3">
            <num>3</num>
            <content>
              <p>The rules may make provision for and in relation to the indexation of a maximum loan amount.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-10__sec-68">

          <heading>Terms and conditions of loan or guarantee</heading>
          <content>
            <p>A loan is made, or guarantee given, on the security and terms and conditions that the Chief of the Defence Force determines in writing.</p>
          </content>
        </section>

          <heading>Interest on loan</heading>
          <content>
            <p>Interest is payable on a loan made under this Part, at the rate and under the conditions prescribed by the rules that were in force when the loan was made.</p>
          </content>
        </section>

          <heading>Pre-conditions for loan or guarantee</heading>
          <subsection eId="part-10__sec-70__subsec-1">
            <num>1</num>
            <content>
              <p>The Chief of the Defence Force must not make or guarantee a loan on behalf of the Commonwealth unless:</p>
            </content>
            <paragraph eId="part-10__sec-70__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>the requirements of subsections (2), (3) and (4) are met; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-10__sec-70__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>the Chief of the Defence Force takes into account the matter in subsection (5).</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-10__sec-70__subsec-2">
            <num>2</num>
            <content>
              <p>The member must apply for the loan or guarantee in the form approved, in writing, by the Chief of the Defence Force:</p>
            </content>
            <paragraph eId="part-10__sec-70__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>while the member is rendering service as a result of a call out; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-10__sec-70__subsec-2__para-b">
              <num>b</num>
              <content>
                <p><quantity refersTo="#deadline">within 12 months</quantity> after the member stops rendering that service.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-10__sec-70__subsec-3">
            <num>3</num>
            <content>
              <p>The Chief of the Defence Force must approve the particular purpose for which the loan is made or guarantee given.</p>
            </content>
          </subsection>
          <subsection eId="part-10__sec-70__subsec-4">
            <num>4</num>
            <content>
              <p>The Chief of the Defence Force must be satisfied that the applicant is likely to be able to repay the amount of the loan made or guaranteed within a reasonable period.</p>
            </content>
          </subsection>
          <subsection eId="part-10__sec-70__subsec-5">
            <num>5</num>
            <content>
              <p>In determining whether to make a loan or give a guarantee, the Chief of the Defence Force must take into account the effect of the applicant’s defence service on his or her capacity and opportunities to establish or re-establish himself or herself in civilian life without assistance under this Part.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-10__sec-71">
          <num>71</num>
          <heading>Review by Administrative Review Tribunal</heading>
          <content>
            <p>Application may be made to the Administrative Review Tribunal for the review of a decision to refuse to make a loan or give a guarantee.</p>
          </content>
        </section>
        <section eId="part-10__sec-72">
          <num>72</num>
          <heading>Agreements between the Chief of the Defence Force and States etc.</heading>
          <subsection eId="part-10__sec-72__subsec-1">
            <num>1</num>
            <content>
              <p>	(1)	The Chief of the Defence Force may, on behalf of the Commonwealth, enter into an agreement with a State, a Territory, a State or Territory authority or an ADI (the <b><i>delegate</i></b>) for the delegate to perform those functions of the Chief of the Defence Force under this Part that are specified in the agreement.</p>
            </content>
          </subsection>
          <subsection eId="part-10__sec-72__subsec-2">
            <num>2</num>
            <content>
              <p>If, under an agreement, the delegate makes or guarantees a loan to a member, the delegate may take any security for the loan or guarantee in its own name.</p>
            </content>
          </subsection>
          <subsection eId="part-10__sec-72__subsec-3">
            <num>3</num>
            <content>
              <p>For the purposes of this Part, the Chief of the Defence Force may, on behalf of the Commonwealth, make loans, or give guarantees, to a State or Territory authority or an ADI that is itself making loans or giving guarantees under an agreement.</p>
            </content>
          </subsection>
          <subsection eId="part-10__sec-72__subsec-4">
            <num>4</num>
            <content>
              <p>The Chief of the Defence Force must have the Finance Minister’s consent:</p>
            </content>

                <p>to enter into an agreement mentioned in subsection (1); and</p>
              </content>
            </paragraph>
            <paragraph eId="part-10__sec-72__subsec-4__para-b">

                <p>to make a loan or give a guarantee mentioned in subsection (3).</p>
              </content>
            </paragraph>

                <p>A person who suffers loss or damage because of a contravention of this Act may recover the amount of the loss or damage from the person who contravened this Act.</p>

              <num>3</num>
              <content>
                <p>A court that finds a person guilty of an offence against this Act in relation to another person may order the guilty person to pay compensation to the other person.</p>
              </content>

              <num>4</num>
              <content>
                <p>An interested person may apply to a court for the following in relation to a contravention of this Act:</p>
              </content>

                  <p>an injunction under the Regulatory Powers Act;</p>
                </content>
              </paragraph>

                </content>
              </paragraph>

                  <p>a suspected contravention of a provision of this Act, whether or not a complaint has been made under <ref href="#sec-72B">section 72B</ref>.</p>
                </content>
              </paragraph>
            </subsection>

              <num>2</num>
              <content>
                <p>For the avoidance of doubt, the Chief of the Defence Force is not required to investigate a complaint made under <ref href="#sec-72B">section 72B</ref>.</p>

              <content>
                <p>Subject to this Division, an investigation may be conducted in a way that the Chief of the Defence Force thinks fit, and the Chief of the Defence Force may, for the purposes of an investigation, obtain information from such persons, and make such inquiries, as the Chief of the Defence Force thinks fit.</p>

            <heading>Notice to produce information or documents</heading>

                <p>This section applies if the Chief of the Defence Force reasonably believes that a person is capable of providing information, or producing a document, that is relevant to an investigation under <ref href="#sec-72C">section 72C</ref>.</p>

            </subsection>

              <num>2</num>
              <content>
                <p>The Chief of the Defence Force may, by written notice given to the person, require the person to:</p>
              </content>
              <paragraph eId="part-11__dvs-1B__sec-72D__subsec-2__para-a">

                <content>
                  <p>give to the Chief of the Defence Force any such information; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-11__dvs-1B__sec-72D__subsec-2__para-b">

                  <p>produce to the Chief of the Defence Force any such documents;</p>
                </content>
                <content>
                  <p>within the period and in the manner specified in the notice.</p>
                </content>

                <p>The period specified in the notice must be at least 14 days after the day the notice is given.</p>

            <heading>Conduct of dispute resolution processes</heading>

                <p>A person’s participation in a dispute resolution process may be:</p>
              </content>
              <paragraph eId="part-11__dvs-1C__sec-72K__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>voluntary; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-11__dvs-1C__sec-72K__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>for a compulsory conference—required by a direction given to the person under subsection 72L(3).</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-11__dvs-1C__sec-72K__subsec-2">
              <num>2</num>
              <content>
                <p>Persons engaged in a dispute resolution process must act in good faith in relation to the conduct of that process.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-11__dvs-1C__sec-72L">
            <num>72L</num>
            <heading>Compulsory conferences</heading>
            <subsection eId="part-11__dvs-1C__sec-72L__subsec-1">
              <num>1</num>
              <content>
                <p>	(1)	The Chief of the Defence Force may refer disputes between persons whose interests are affected by a provision of this Act (the <b><i>parties</i></b>) to a compulsory conference for one or more of the following purposes:</p>
              </content>
              <paragraph eId="part-11__dvs-1C__sec-72L__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>advising the parties of their rights and obligations;</p>
                </content>
              </paragraph>
              <paragraph eId="part-11__dvs-1C__sec-72L__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>facilitating discussion between the parties;</p>
                </content>
              </paragraph>
              <paragraph eId="part-11__dvs-1C__sec-72L__subsec-1__para-c">
                <num>c</num>
                <content>
                  <p>identifying issues in dispute;</p>
                </content>
              </paragraph>
              <paragraph eId="part-11__dvs-1C__sec-72L__subsec-1__para-d">
                <num>d</num>
                <content>
                  <p>resolving issues in dispute.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-11__dvs-1C__sec-72L__subsec-2">
              <num>2</num>
              <content>
                <p>In deciding whether to refer parties to a dispute to a compulsory conference, the Chief of the Defence Force may consider the following:</p>
              </content>
              <paragraph eId="part-11__dvs-1C__sec-72L__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>whether a compulsory conference will assist the parties in resolving the dispute;</p>
                </content>
              </paragraph>
              <paragraph eId="part-11__dvs-1C__sec-72L__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>any other courses of action available to the parties to resolve the dispute;</p>
                </content>
              </paragraph>
              <paragraph eId="part-11__dvs-1C__sec-72L__subsec-2__para-c">
                <num>c</num>
                <content>
                  <p>the steps that have been taken by the parties to try to resolve the dispute;</p>
                </content>
              </paragraph>
              <paragraph eId="part-11__dvs-1C__sec-72L__subsec-2__para-d">
                <num>d</num>
                <content>
                  <p>whether the circumstances of the parties require the dispute to be resolved as a matter of urgency;</p>
                </content>
              </paragraph>
              <paragraph eId="part-11__dvs-1C__sec-72L__subsec-2__para-e">
                <num>e</num>
                <content>
                  <p>any other matter that the Chief of the Defence Force considers relevant.</p>
                </content>
                <content>
                  <p>Direction to attend conference</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-11__dvs-1C__sec-72L__subsec-3">
              <num>3</num>
              <content>
                <p>The Chief of the Defence Force may, by written notice given to a person, require the person to attend a compulsory conference.</p>
              </content>
            </subsection>
            <subsection eId="part-11__dvs-1C__sec-72L__subsec-4">
              <num>4</num>
              <content>
                <p>The notice must specify the time and place of the conference, which must not be earlier than 14 days after the day the notice is given.</p>
              </content>
              <content>
                <p>Reimbursement</p>
              </content>
            </subsection>
            <subsection eId="part-11__dvs-1C__sec-72L__subsec-5">
              <num>5</num>
              <content>
                <p>If a person is given a notice under subsection (3), the person is entitled to be paid a reasonable allowance for expenses incurred by the person for transport, meals and accommodation in connection with complying with the notice.</p>

                <p>A person who is given a notice under subsection (3) must comply with the notice.</p>

            <heading>Admissibility of things said in a dispute resolution process</heading>

              <p>Evidence of anything said, or any admission made, during a dispute resolution process under this Division is not admissible:</p>
            </content>
            <paragraph eId="part-11__dvs-1C__sec-72M__para-a">
              <num>a</num>
              <content>
                <p>in any court (whether exercising federal jurisdiction or not); or</p>
              </content>
            </paragraph>
            <paragraph eId="part-11__dvs-1C__sec-72M__para-b">
              <num>b</num>
              <content>
                <p>in any proceedings before a person authorised by a law of the Commonwealth or of a State or Territory, or by the consent of the parties, to hear evidence.</p>
              </content>
            </paragraph>

          <heading>Civil enforcement</heading>

            <heading>Actions for loss or damage</heading>
            <subsection eId="part-11__dvs-1__sec-73__subsec-1">
              <num>1</num>
              <content>
                <p>A person who suffers loss or damage because another person contravenes, or was involved in contravening, a provision of this Act may bring an action in a court of competent jurisdiction to recover the amount of the loss or damage from the other person. This is so even if the other person did not commit an offence (if the contravention is also an offence) or a civil penalty order has not been made against the person (if the provision is a civil penalty provision).</p>
              </content>
            </subsection>
            <subsection eId="part-11__dvs-1__sec-73__subsec-2">
              <num>2</num>
              <content>
                <p>An action mentioned in subsection (1) may be brought by the Chief of the Defence Force on behalf of the person who suffers the loss or damage.</p>
              </content>
            </subsection>
            <subsection eId="part-11__dvs-1__sec-73__subsec-3">
              <num>3</num>
              <content>
                <p>An action under subsection (1) may only be begun within 4 years after the day on which the cause of action arose.</p>
              </content>
            </subsection>
            <subsection eId="part-11__dvs-1__sec-73__subsec-4">

              <content>
                <p>This section does not affect any right or liability that a person has under any other law.</p>
              </content>
            </subsection>
            <subsection eId="part-11__dvs-1__sec-73__subsec-5">

                <p>	(5)	For the purposes of this section, a person is <b><i>involved in a contravention</i></b> if, and only if, the person has:</p>
              </content>
              <paragraph eId="part-11__dvs-1__sec-73__subsec-5__para-a">
                <num>a</num>
                <content>
                  <p>aided, abetted, counselled or procured the contravention; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-11__dvs-1__sec-73__subsec-5__para-b">
                <num>b</num>
                <content>
                  <p>has induced, whether by threats or promises or otherwise, the contravention; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-11__dvs-1__sec-73__subsec-5__para-c">
                <num>c</num>

                  <p>has been in any way, by act or omission, directly or indirectly, knowingly concerned in or party to the contravention; or</p>
                </content>
              </paragraph>

                  <p>has conspired with others to effect the contravention.</p>

                  <p>finds a person guilty of an offence against this Act in relation to another person (whether or not the court imposes a penalty); or</p>

                <p>Part 7 of the Regulatory Powers Act, as that Part applies in relation to the provisions mentioned in subsection (1), extends to every external Territory.</p>

            <heading>Court may make other orders if transaction or proceeding in contravention of this Act</heading>

                <p>A court of competent jurisdiction may make any other order (including a declaratory order) it thinks fit if a person enters a transaction, or brings a proceeding, in contravention of this Act.</p>

                <p>The court may make an order under this section only on application by:</p>
              </content>

              <p>	(1)	This section applies if a provision of this Act provides that a person contravening another provision of this Act (the <b><i>conduct provision</i></b>) commits an offence or is liable to a civil penalty.</p>

              <p>For the purposes of this Act, and the Regulatory Powers Act to the extent that it relates to this Act, a reference to a contravention of an offence provision or a civil penalty provision includes a reference to a contravention of the conduct provision.</p>

          <heading>Delegation</heading>
          <subsection eId="part-12__sec-79__subsec-1">
            <num>1</num>
            <content>
              <p>	(1)	The Chief of the Defence Force may, by signed writing, delegate all or any of his or her powers and functions under this Act (other than under <i>Defence Act 1903</i>).<ref href="#part-10">Part 10</ref>, or <ref href="#dvs-1B">Division 1B</ref>, 1C or 3 of <ref href="#part-11">Part 11</ref>) to an officer (within the meaning of the </p>
            </content>
          </subsection>
          <subsection eId="part-12__sec-79__subsec-2">
            <num>2</num>
            <content>
              <p>The Chief of the Defence Force may, in writing, delegate all or any of the Chief of the Defence Force’s powers and functions under <ref href="#part-10">Part 10</ref>, or <ref href="#dvs-1B">Division 1B</ref>, 1C or 3 of <ref href="#part-11">Part 11</ref>, to:</p>

          <heading>Annual report</heading>

              <p>The Chief of the Defence Force must, as soon as practicable after the end of each financial year, prepare a report on the administration and operation of this Act during that year.</p>

              <p>	(2)	The report must be included in the annual report prepared by the Secretary and given to the Minister under <i>Public Governance, Performance and Accountability Act 2013</i> for the financial year.<ref href="#sec-46">section 46</ref> of the </p>

          <heading>Severability: additional effect of Act</heading>
          <subsection eId="part-12__sec-80__subsec-1">

              <p>Without limiting its effect apart from this section, this Act also has effect as provided by this section.</p>
            </content>
          </subsection>
          <subsection eId="part-12__sec-80__subsec-2">
            <num>2</num>
            <content>
              <p>This Act also has the effect that it would have if its operation were expressly confined to acts or omissions of corporations to which paragraph 51(xx) of the Constitution applies.</p>

          </subsection>
          <subsection eId="part-12__sec-80__subsec-3">
            <num>3</num>
            <content>
              <p>This Act also has the effect that it would have if its operation were expressly confined to acts or omissions taking place in the course of, or in relation to, trade or commerce:</p>
            </content>
            <paragraph eId="part-12__sec-80__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>between Australia and places outside Australia; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-12__sec-80__subsec-3__para-b">

              </content>
            </paragraph>
            <paragraph eId="part-12__sec-80__subsec-3__para-c">
              <num>c</num>

          <heading>Rules</heading>
          <subsection eId="part-12__sec-81__subsec-1">
            <num>1</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> may, by legislative instrument, make rules prescribing matters:</p>
            </content>
            <paragraph eId="part-12__sec-81__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>required or permitted by this Act to be prescribed; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-12__sec-81__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>necessary or convenient to be prescribed for carrying out or giving effect to this Act.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-12__sec-81__subsec-2">
            <num>2</num>
            <content>
              <p>To avoid doubt, the rules may not do the following:</p>
            </content>

              <num>a</num>
              <content>
                <p>create an offence or civil penalty;</p>
              </content>
            </paragraph>
            <paragraph eId="part-12__sec-81__subsec-2__para-b">

                <p>arrest or detention; or</p>
              </content>

If, despite the misdescription, the amendment can be given effect as intended, then the misdescribed amendment can be incorporated through an editorial change made under <i>Legislation Act 2003</i>.<ref href="#sec-15V">section 15V</ref> of the </p>
