        <heading>Short title</heading>
        <content>
          <p>		This Act may be cited as the <i>Measures to Combat Serious and Organised Crime Act 2001</i>.</p>
        </content>
      </section>
      <section eId="sec-2">
        <num>2</num>
        <heading>Commencement</heading>
        <subsection eId="sec-2__subsec-1">
          <num>1</num>
          <content>
            <p>This section and sections 1 and 3 commence on the day on which this Act receives the Royal Assent.</p>
          </content>
        </subsection>
        <subsection eId="sec-2__subsec-2">
          <num>2</num>
          <content>
            <p>Subject to subsection (3), Schedules 1 and 2 commence on a day or days to be fixed by Proclamation.</p>
          </content>
        </subsection>
        <subsection eId="sec-2__subsec-3">
          <num>3</num>
          <content>
            <p>If Schedule 1 or 2 does not commence under subsection (2) within the period of 6 months beginning on the day on which this Act receives the Royal Assent, that Schedule commences on the first day after the end of that period.</p>
          </content>
        </subsection>
        <subsection eId="sec-2__subsec-4">
          <num>4</num>
          <content>
            <p>Item 10 of Schedule 4 commences on a day to be fixed by Proclamation.</p>
          </content>
        </subsection>
        <subsection eId="sec-2__subsec-5">
          <num>5</num>
          <content>
            <p>The remainder of this Act commences on the 28th day after the day on which it receives the Royal Assent.</p>
          </content>
        </subsection>
      </section>
      <section eId="sec-3">
        <num>3</num>
        <heading>Schedule(s)</heading>
        <content>
          <p>Subject to <ref href="#sec-2">section 2</ref>, each Act that is specified in a Schedule to this Act is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this Act has effect according to its terms.</p>

              <p><b><i>AFP authorising officer</i></b> has the meaning given in subsection 15J(3).</p>

              <p>Insert:</p>
              <p><b><i>appropriate authorising officer</i></b>, in relation to a certificate given under section 15M, means:</p>

                <p>if the certificate is given by an AFP authorising officer—any AFP authorising officer; or</p>
              </content>

                <p>if the certificate is given by an NCA authorising officer—any NCA authorising officer.</p>
              </content>
            </paragraph>
          </hcontainer>

            <heading>Subsection 3(1) (definition of authorising officer)</heading>
            <content>
              <p>Repeal the definition, substitute:</p>
              <p><b><i>authorising officer</i></b>, in relation to a controlled operation, has the meaning given in section 15J.</p>

            <num>4</num>
            <heading>Subsection 3(1)</heading>
            <content>
              <p>Insert:</p>
              <p><b><i>Commonwealth offence</i></b>, except in Part IC, means an offence against a law of the Commonwealth.</p>
            </content>

          <hcontainer name="clause" eId="schedule-1__clause-6">
            <num>6</num>
            <heading>Subsection 3(1)</heading>
            <content>
              <p>Insert:</p>
              <p><b><i>illicit goods</i></b> means goods the possession of which is a contravention of a law of the Commonwealth, a State or a Territory.</p>
            </content>

            <heading>Subsection 3(1)</heading>

              <p>Insert:</p>
              <p><b><i>major controlled operation</i></b> has the meaning given in subsection 15J(2A).</p>

            <heading>Concurrent operation of State and Territory laws</heading>
            <content>
              <p>It is the Parliament’s intention that a law of a State or Territory should be able to operate concurrently with this Part unless the law is directly inconsistent with this Part.</p>
            </content>

            <num>17</num>
            <heading>Sections 15H, 15I and 15J</heading>
            <content>
              <p>Repeal the sections, substitute:</p>
            </content>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-15H">
            <num>15H</num>
            <heading>What is a controlled operation?</heading>
            <content>
              <p>		A <b><i>controlled operation</i></b><i> </i>is an operation that:</p>
            </content>
            <paragraph eId="schedule-1__clause-15H__para-a">
              <num>a</num>
              <content>
                <p>involves the participation of law enforcement officers; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-15H__para-b">
              <num>b</num>
              <content>
                <p>is carried out for the purpose of obtaining evidence that may lead to the prosecution of a person for a serious Commonwealth offence; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-15H__para-c">
              <num>c</num>
              <content>
                <p>may involve a law enforcement officer or other person in acts, or omissions to act, that would, apart from subsection 15I(1) or (3), constitute a Commonwealth offence or an offence against a law of a State or Territory.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-15HA">
            <num>15HA</num>
            <heading>Meaning of engage in conduct etc.</heading>
            <content>
              <p>In this Part:</p>
            </content>
            <paragraph eId="schedule-1__clause-15HA__para-a">
              <num>a</num>
              <content>
                <p>a reference to engaging in conduct includes a reference to omitting to act; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-15HA__para-b">
              <num>b</num>
              <content>
                <p>a reference to a person’s conduct includes a reference to the person’s omissions.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-15HB">
            <num>15HB</num>
            <heading>What is a serious Commonwealth offence?</heading>
            <content>
              <p>		For the purposes of this Part, <b><i>serious Commonwealth offence</i></b><i> </i>means an offence against a law of the Commonwealth:</p>
            </content>
            <paragraph eId="schedule-1__clause-15HB__para-a">
              <num>a</num>
              <content>
                <p>that involves theft, fraud, tax evasion, currency violations, illegal drug dealings, illegal gambling, obtaining financial benefit by vice engaged in by others, extortion, money laundering, perverting the course of justice, bribery or corruption of, or by, an officer of the Commonwealth, an officer of a State or an officer of a Territory, bankruptcy and company violations, harbouring of criminals, forgery including forging of passports, armament dealings, illegal importation or exportation of fauna into or out of Australia, espionage, sabotage or threats to national security, misuse of a computer or electronic communications, people smuggling, slavery, piracy, the organisation, financing or perpetration of sexual servitude or child sex tourism, dealings in child pornography or material depicting child abuse, importation of prohibited imports or exportation of prohibited exports, or that involves matters of the same general nature as one or more of the foregoing or that is of any other prescribed kind; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-15HB__para-b">
              <num>b</num>
              <content>
                <p>that is punishable on conviction by imprisonment for a period of 3 years or more.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-15I">
            <num>15I</num>
            <heading>Law enforcement officers etc. not liable for offences committed for purposes of authorised controlled operation</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-15I__subclause-1">
              <num>1</num>
              <content>
                <p>A law enforcement officer who engages in conduct that, apart from this subsection, would constitute a Commonwealth offence or an offence against a law of a State or Territory is not criminally responsible for that offence if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-15I__para-a">
              <num>a</num>
              <content>
                <p>he or she engages in that conduct in the course of duty for the purposes of a controlled operation; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-15I__para-b">
              <num>b</num>
              <content>
                <p>the conduct meets the requirements of subsection 15IB(1).</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-15I__subclause-2">
              <num>2</num>
              <content>
                <p>A person who is not a law enforcement officer and who engages in conduct that, apart from this subsection, would constitute a Commonwealth offence or an offence against a law of a State or Territory is not criminally responsible for that offence if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-15I__para-a">
              <num>a</num>
              <content>
                <p>he or she engages in that conduct for the purposes of a controlled operation; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-15I__para-b">
              <num>b</num>
              <content>
                <p>a law enforcement officer has authorised the person to engage in that conduct; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-15I__para-c">
              <num>c</num>
              <content>
                <p>the conduct meets the requirements of subsection 15IB(2).</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-15I__subclause-2A">
              <num>2A</num>
              <content>
                <p>Subsection (2) does not apply to a person who:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-15I__para-a">
              <num>a</num>
              <content>
                <p>is an informant of a law enforcement officer; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-15I__para-b">
              <num>b</num>
              <content>
                <p>is believed to have been involved, other than for law enforcement purposes, in the criminal activity in respect of which the controlled operation was authorised.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-15I__subclause-3">
              <num>3</num>
              <content>
                <p>The fact that, because of subsection (1) or (2), a person whose conduct is covered by a certificate given under <ref href="#sec-15M">section 15M</ref> is not criminally responsible for an offence does not affect the liability, for that offence or any other offence, of any person whose conduct is not covered by the certificate.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-15I__subclause-4">
              <num>4</num>
              <content>
                <p>	(4)	Subsection (3) applies despite any provision of Chapter 2 of the <i>Criminal Code</i> to the contrary.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-15I__subclause-5">
              <num>5</num>
              <content>
                <p>If:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-15I__para-a">
              <num>a</num>
              <content>
                <p>the importation of goods of a particular kind into Australia is an offence against a law of the Commonwealth; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-15I__para-b">
              <num>b</num>
              <content>
                <p>a person imports goods of that kind into Australia; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-15I__para-c">
              <num>c</num>
              <content>
                <p>because of this section, that person is not liable for an offence against that law in respect of the importation; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-15I__para-d">
              <num>d</num>
              <content>
                <p>that law provides for another consequence, other than that person’s criminal liability, to arise from the importation (for example, forfeiture of the goods);</p>
              </content>
            </paragraph>
            <content>
              <p>this section does not prevent that consequence from arising under that law.</p>
            </content>
            <hcontainer name="subclause" eId="schedule-1__clause-15I__subclause-6">
              <num>6</num>
              <content>
                <p>For the purposes of this section, a member of a police force or other law enforcement agency of a foreign country is taken to be acting in the course of duty to the extent that he or she takes part in the controlled operation in accordance with the instructions given by an Australian law enforcement officer.</p>
              </content>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-15IA">
            <num>15IA</num>
            <heading>Indemnification of law enforcement officers etc.</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-15IA__subclause-1">
              <num>1</num>
              <content>
                <p>The Commonwealth must indemnify a law enforcement officer against any liability (including reasonable costs) the officer incurs because of conduct the officer engages in if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-15IA__para-a">
              <num>a</num>
              <content>
                <p>he or she engages in that conduct in the course of duty for the purposes of a controlled operation; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-15IA__para-b">
              <num>b</num>
              <content>
                <p>the conduct meets the requirements of subsection 15IB(1); and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-15IA__para-c">
              <num>c</num>
              <content>
                <p>the requirements (if any) specified in the regulations have been met.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-15IA__subclause-2">
              <num>2</num>
              <content>
                <p>The Commonwealth must indemnify a person who is not a law enforcement officer against any liability (including reasonable costs) the person incurs because of conduct the person engages in if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-15IA__para-a">
              <num>a</num>
              <content>
                <p>he or she engages in that conduct for the purposes of a controlled operation; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-15IA__para-b">
              <num>b</num>
              <content>
                <p>a law enforcement officer has authorised the person to engage in that conduct; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-15IA__para-c">
              <num>c</num>
              <content>
                <p>the conduct meets the requirements of subsection 15IB(2); and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-15IA__para-d">
              <num>d</num>
              <content>
                <p>the requirements (if any) specified in the regulations have been met.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-15IA__subclause-2A">
              <num>2A</num>
              <content>
                <p>Subsection (2) does not apply to a person who:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-15IA__para-a">
              <num>a</num>
              <content>
                <p>is an informant of a law enforcement officer; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-15IA__para-b">
              <num>b</num>
              <content>
                <p>is believed to have been involved, other than for law enforcement purposes, in the criminal activity in respect of which the controlled operation was authorised.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-15IA__subclause-3">
              <num>3</num>
              <content>
                <p>For the purposes of this section, a member of a police force or other law enforcement agency of a foreign country is taken to be acting in the course of duty to the extent that he or she takes part in the controlled operation in accordance with the instructions given by an Australian law enforcement officer.</p>
              </content>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-15IB">
            <num>15IB</num>
            <heading>Requirements that must be met for the purposes of sections 15I and 15IA</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-15IB__subclause-1">
              <num>1</num>
              <content>
                <p>A law enforcement officer’s conduct relating to a controlled operation meets the requirements of this subsection if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-15IB__para-a">
              <num>a</num>
              <content>
                <p>at the time when he or she engages in that conduct there is in force a certificate given under <ref href="#sec-15M">section 15M</ref> that authorises the operation; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-15IB__para-b">
              <num>b</num>
              <content>
                <p>the conduct is within the nature of the activities covered by the certificate; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-15IB__para-c">
              <num>c</num>
              <content>
                <p>the conduct does not breach any conditions to which the certificate is subject; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-15IB__para-d">
              <num>d</num>
              <content>
                <p>the conduct does not involve intentionally inducing a person to commit a Commonwealth offence, or an offence against a law of a State or Territory, if that person would not otherwise have intended to commit:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-15IB__para-i">
              <num>i</num>
              <content>
                <p>that offence; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-15IB__para-ii">
              <num>ii</num>
              <content>
                <p>an offence of that kind; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-15IB__para-e">
              <num>e</num>
              <content>
                <p>the conduct does not involve the commission of a sexual offence against any person or an offence involving the death of or serious injury to any person.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-15IB__subclause-2">
              <num>2</num>
              <content>
                <p>Any other person’s conduct relating to a controlled operation meets the requirements of this subsection if:</p>
              </content>
            </hcontainer>

                <p>the certificate identifies the person as being permitted to be involved in the operation; and</p>

                <p>the conduct is within the nature of the activities covered by the certificate; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-15IB__para-d">

                <p>the conduct does not breach any conditions to which the certificate is subject; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-15IB__para-e">
              <num>e</num>
              <content>
                <p>the conduct does not involve intentionally inducing a person to commit a Commonwealth offence, or an offence against a law of a State or Territory, if that person would not otherwise have intended to commit:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-15IB__para-i">
              <num>i</num>
              <content>
                <p>that offence; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-15IB__para-ii">

                <p>an offence of that kind; and</p>

            </paragraph>
            <paragraph eId="schedule-1__clause-15IB__para-f">
              <num>f</num>
              <content>
                <p>the conduct does not involve the commission of a sexual offence against any person or an offence involving the death of or serious injury to any person.</p>
              </content>
            </paragraph>

            <num>15IC</num>
            <heading>Effect of sections 15I and 15IA on other laws relating to criminal investigation</heading>
            <content>
              <p>Sections 15I and 15IA do not apply to a person’s conduct that is authorised, or could have been authorised, under a law of the Commonwealth, a State or a Territory relating to:</p>
            </content>
            <paragraph eId="schedule-1__clause-15IC__para-a">
              <num>a</num>
              <content>
                <p>arrest or detention of individuals; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-15IC__para-b">
              <num>b</num>

                <p>searches of individuals; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-15IC__para-c">
              <num>c</num>
              <content>
                <p>entry onto, or searches or inspections of, premises; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-15IC__para-d">
              <num>d</num>
              <content>
                <p>searches, inspections or seizures of other property; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-15IC__para-e">

                <p>forensic procedures; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-15IC__para-f">

                <p>electronic surveillance devices or telecommunications interception; or</p>

            </paragraph>
            <paragraph eId="schedule-1__clause-15IC__para-g">

                <p>identification procedures; or</p>

            </paragraph>
            <paragraph eId="schedule-1__clause-15IC__para-h">

                <p>any other matter concerning powers of criminal investigation.</p>
              </content>
            </paragraph>

          <hcontainer name="clause" eId="schedule-1__clause-15ID">
            <num>15ID</num>
            <heading>Compensation for loss or injury</heading>
            <content>
              <p>Where a person suffers loss or injury as a result of a controlled operation, the Commonwealth is liable to pay to the person who has suffered the loss or injury such compensation as is agreed on between the Commonwealth and that person or, in default of agreement, is determined by action against the Commonwealth in a court of competent jurisdiction.</p>
            </content>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-15J">
            <num>15J</num>
            <heading>Application for certificate authorising a controlled operation—by whom and to whom made</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-15J__subclause-1">
              <num>1</num>
              <content>
                <p>An Australian law enforcement officer may apply to an authorising officer for a certificate authorising a controlled operation.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-15J__subclause-2">
              <num>2</num>
              <content>
                <p>	(2)	Any of the following is an <b><i>authorising officer</i></b> for the controlled operation:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-15J__para-a">
              <num>a</num>
              <content>
                <p>if the operation is a major controlled operation that relates to investigating a serious Commonwealth offence, or a possible serious Commonwealth offence, the investigation of which is within the functions of the Australian Federal Police—<role refersTo="#commissioner">the Commissioner</role> or a Deputy Commissioner;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-15J__para-b">
              <num>b</num>
              <content>
                <p>if the operation is not a major controlled operation but relates to investigating a serious Commonwealth offence, or a possible serious Commonwealth offence, the investigation of which is within the functions of the Australian Federal Police—any AFP authorising officer;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-15J__para-c">
              <num>c</num>
              <content>
                <p>if the operation relates to investigating a serious Commonwealth offence, or a possible serious Commonwealth offence, the investigation of which is within the functions of the National Crime Authority—any NCA authorising officer.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-15J__subclause-2A">
              <num>2A</num>
              <content>
                <p>	(2A)	A <b><i>major controlled operation</i></b> is a controlled operation that is likely to:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-15J__para-a">
              <num>a</num>
              <content>
                <p>involve the infiltration of an organised criminal group by one or more undercover law enforcement officers for a period of more than 7 days; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-15J__para-b">
              <num>b</num>
              <content>
                <p>continue for more than 3 months; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-15J__para-c">
              <num>c</num>
              <content>
                <p>be directed against suspected criminal activity that includes a threat to human life.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-15J__subclause-3">
              <num>3</num>
              <content>
                <p>	(3)	The following are <b><i>AFP authorising officers</i></b>:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-15J__para-a">
              <num>a</num>
              <content>
                <p><role refersTo="#commissioner">the Commissioner</role>;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-15J__para-b">
              <num>b</num>
              <content>
                <p>a Deputy Commissioner;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-15J__para-c">
              <num>c</num>

                <p>a senior executive AFP employee who is a member of the Australian Federal Police and who is authorised in writing by <role refersTo="#commissioner">the Commissioner</role> for the purposes of this paragraph.</p>

            <heading>Transitional provision—pending applications</heading>

                <p>Any application for a certificate authorising a controlled operation:</p>

                <p>that was made before the commencement of this Schedule; and</p>
              </content>
            </paragraph>

                <p>about which a decision was not made before that commencement;</p>

              <p>ceases to have effect on that commencement.</p>

                <p>the operation will be conducted in a way that ensures that, to the maximum extent possible, any illicit goods involved in the operation will be under the control of an Australian law enforcement officer at the end of the operation; and</p>

              <num>f</num>
              <content>
                <p>any unlawful activity involved in conducting the operation will not:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-20__para-i">

                <p>seriously endanger the health or safety of any person; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-20__para-ii">
              <num>ii</num>
              <content>
                <p>cause the death of, or serious injury to, any person; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-20__para-iii">
              <num>iii</num>
              <content>
                <p>involve the commission of a sexual offence against any person; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-20__para-iv">
              <num>iv</num>

                <p>result in loss of, or serious damage to, property (other than illicit goods); and</p>
              </content>
            </paragraph>

                <p>the operation will be conducted in a way that is consistent with the reporting and accountability requirements of this Part; and</p>
              </content>
            </paragraph>

                <p>if a person who is not a law enforcement officer is to be involved in the operation—the role to be assigned to the person could not adequately be performed by a law enforcement officer.</p>
              </content>
            </paragraph>

                <p>If the application complies with this section, the appropriate authorising officer may vary the certificate if he or she is reasonably satisfied that:</p>

                <p>the certificate as varied could have been given under <ref href="#sec-15M">section 15M</ref>; and</p>

                <p>the variation is necessary for:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-15NA__para-i">

                <p>the success of the controlled operation; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-15NA__para-ii">
              <num>ii</num>
              <content>
                <p>the protection of the health or safety of any person; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-15NA__para-iii">

                <p>the protection of property from loss or damage; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-15NA__para-iv">

                <p>ensuring that all those involved in the operation have appropriate exemption under <ref href="#sec-15I">section 15I</ref> and appropriate indemnity under <ref href="#sec-15I">section 15I</ref>A.</p>

                <p>The notice:</p>

                <p>must state that the certificate is terminated; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-15OA__para-b">
              <num>b</num>
              <content>
                <p>must be signed by the AFP authorising officer or NCA authorising officer (as the case requires); and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-15OA__para-c">
              <num>c</num>
              <content>
                <p>must specify the time when the notice is to have effect.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-15OB">

            <heading>Expiry of certificate after 6 months or 3 months</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-15OB__subclause-1">

                <p>A certificate given under <ref href="#sec-15M">section 15M</ref> expires at the end of the period of 6 months after the day on which it was given, unless subsection (2) applies.</p>

            </paragraph>

              <p>Note:	A certificate can also cease to be in force after a time specified in the certificate: see paragraph 15P(3)(a).</p>

              <num>3</num>

                <p>The certificate must be reviewed by a nominated Tribunal member during the last 2 weeks of the period of 3 months after the day on which the certificate was given under <ref href="#sec-15M">section 15M</ref>. The nominated Tribunal member must decide whether the certificate should be in force for 6 months.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-15OB__subclause-4">

                <p>The nominated Tribunal member must not decide that the certificate should be in force for 6 months unless he or she is reasonably satisfied as to all the matters referred to in paragraphs 15M(a) to (h).</p>

                <p>For the purposes of this section, a person is reckless with respect to the existence of the variation, surrender, termination or expiry of a certificate given under <ref href="#sec-15M">section 15M</ref> if:</p>

                <p>having regard to the circumstances known to him or her, it is unjustifiable to take the risk.</p>

              </content>
            </paragraph>

                <p>state the nature of the activities engaged in for the purposes of the operation; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-35__para-d">

                <p>if the operation involved illicit goods, state, to the extent known:</p>

            </paragraph>
            <paragraph eId="schedule-1__clause-35__para-i">

                <p>if the operation involved illicit goods that are narcotic goods:</p>

            </paragraph>

                <p>identify the agency to which any law enforcement officer who, in the course of the operation, had possession of the narcotic goods belonged; and</p>
              </content>
            </paragraph>

                <p>identify, to the extent known, any person (other than a law enforcement officer) who, in the course of the operation, had possession of the narcotic goods; and</p>

            <heading>Annual reports by Ombudsman</heading>

                <p>The Ombudsman must, as soon as practicable after 30 June each year, prepare a report of the Ombudsman’s work and activities under this Division during the preceding 12 months and give copies of the report to the President of the Senate and the Speaker of the House of Representatives for presentation to the Senate and the House of Representatives, respectively.</p>

            </paragraph>

                <p>is in accordance with the authorisation conditions (if any).</p>

            </paragraph>

                <p>An approved person may acquire evidence of, and use, an assumed identity if the acquisition or use is in accordance with:</p>

                <p>directions given by the supervising officer mentioned in the person’s authorisation; and</p>

            <heading>Protection from criminal liability</heading>

                <p>An approved officer, who engages in conduct that, apart from this subsection, would constitute an offence against a law of the Commonwealth, a State or Territory, is not criminally responsible for that offence if:</p>

              <num>a</num>
              <content>
                <p>the officer engages in the conduct in the course of acquiring evidence of, or using, an assumed identity; and</p>
              </content>
            </paragraph>

              <num>b</num>
              <content>
                <p>the officer engages in the conduct in the course of duty; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-15XC__para-c">

                <p>the conduct is in accordance with the authorisation conditions (if any); and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-15XC__para-d">

                <p>the conduct would not constitute that offence if the assumed identity were the officer’s real identity.</p>
              </content>
            </paragraph>

              <p>Example:	This subsection could apply if an approved officer, when using an assumed identity, makes the false representation that he or she is unemployed (but that representation would be true if the assumed identity were real).</p>
              <p>Note:	<ref href="#dvs-5">Division 5</ref> has offences relating to the misuse etc. of assumed identities.</p>

                <p>An approved person who engages in conduct that, apart from this subsection, would constitute an offence against a law of the Commonwealth, a State or Territory, is not criminally responsible for that offence if:</p>

              <content>
                <p>the person engages in the conduct in the course of acquiring evidence of, or using, an assumed identity; and</p>

            <heading>Indemnification of approved officers and persons</heading>
            <hcontainer name="subclause" eId="schedule-2__clause-15XD__subclause-1">

                <p>A Commonwealth participating agency whose authorising person issues an authorisation must indemnify an approved officer against any liability (including reasonable costs) that the officer incurs because of conduct the officer engages in if:</p>

              <num>a</num>
              <content>
                <p>the officer is covered by the authorisation; and</p>
              </content>
            </paragraph>

                <p>the officer engages in the conduct in acquiring evidence of, or using, an assumed identity in the course of duty; and</p>
              </content>
            </paragraph>

                <p>the conduct is in accordance with the authorisation conditions (if any); and</p>
              </content>
            </paragraph>

            <heading>Effect of being unaware of variation or revocation of authorisation</heading>

                <p>If an approved officer’s or approved person’s authorisation has been varied in a way that limits its scope, this Division continues to apply to the officer or person, as if the authorisation had not been varied in that way, for so long as he or she:</p>

              <num>a</num>
              <content>
                <p>is unaware of the variation; and</p>
              </content>
            </paragraph>

                <p>If an approved officer’s or approved person’s authorisation is revoked, this Division continues to apply to the officer or person, as if the authorisation had not been revoked, for so long as he or she:</p>

              <content>
                <p>is unaware of the revocation; and</p>
              </content>
            </paragraph>

                <p>is not reckless with respect to the existence of the revocation.</p>

            </paragraph>

                <p>For the purposes of this section, a person is reckless with respect to the variation or revocation of an authorisation if:</p>

                <p>he or she is aware of a substantial risk that the variation or revocation occurred; and</p>
              </content>
            </paragraph>

                <p>having regard to the circumstances known to him or her, it is unjustifiable to take the risk.</p>
              </content>
            </paragraph>

            <heading>Documents authorising use of skill or qualification</heading>

              <p>Sections 15XC and 15XD do not apply to an approved officer or approved person engaging in conduct if:</p>
              <p>whether or not the officer or person has acquired, as evidence of an assumed identity, a document that establishes that he or she has that skill or qualification.</p>
              <p>Example:	An officer who cannot fly a plane is not authorised to fly even though he or she has acquired a pilot’s licence under an assumed identity.</p>

                <p>a particular skill or qualification is needed to engage in that conduct; and</p>
              </content>
            </paragraph>

                <p>the person does not have that skill or qualification;</p>
              </content>
            </paragraph>

            <heading>Commonwealth authorisations of the acquisition or use of assumed identities</heading>
            <hcontainer name="subclause" eId="schedule-2__clause-15XG__subclause-1">
              <num>1</num>
              <content>
                <p>An authorising person of a Commonwealth participating agency may, if satisfied that it is appropriate to do so, authorise a person to do either or both of the following:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-15XG__para-a">
              <num>a</num>
              <content>
                <p>acquire evidence of an assumed identity from:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-15XG__para-i">
              <num>i</num>
              <content>
                <p>any Commonwealth agency; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-15XG__para-ii">
              <num>ii</num>
              <content>
                <p>any non-government body;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-15XG__para-b">
              <num>b</num>
              <content>
                <p>use the assumed identity.</p>
              </content>
            </paragraph>

                <p>However, the authorising person may only authorise the use of the assumed identity in a foreign country if he or she is satisfied that it is reasonably necessary to do so.</p>
              </content>

                <p>An authorising person of a Commonwealth participating agency may, if satisfied that it is reasonably necessary to do so, authorise a foreign officer to do either or both of the following:</p>

              <content>
                <p>acquire evidence of an assumed identity from:</p>
              </content>
            </paragraph>

                <p>any Commonwealth agency; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-15XG__para-ii">
              <num>ii</num>
              <content>
                <p>any non-government body;</p>

            </paragraph>
            <paragraph eId="schedule-2__clause-15XG__para-b">
              <num>b</num>
              <content>
                <p>use an assumed identity.</p>
              </content>
            </paragraph>

            <heading>State or Territory authorisations of the acquisition or use of assumed identities</heading>
            <hcontainer name="subclause" eId="schedule-2__clause-15XH__subclause-1">
              <num>1</num>

                <p>An authorising person of a State or Territory participating agency may, if satisfied that it is appropriate to do so, authorise a person (other than a foreign officer) to do either or both of the following:</p>
              </content>

              <num>a</num>
              <content>
                <p>acquire evidence of an assumed identity from any Commonwealth agency;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-15XH__para-b">
              <num>b</num>
              <content>
                <p>use the assumed identity.</p>
              </content>
            </paragraph>
            <content>
              <p>Note:	Only a Commonwealth participating agency can authorise a foreign officer to acquire evidence of, or use, an assumed identity: see subsection 15XG(3).</p>
            </content>

                <p>However, the authorising person may only authorise the use of the assumed identity in a foreign country if he or she is satisfied that it is reasonably necessary to do so.</p>

            <num>15XI</num>
            <heading>Contents of an authorisation for an assumed identity</heading>
            <hcontainer name="subclause" eId="schedule-2__clause-15XI__subclause-1">
              <num>1</num>
              <content>
                <p>	(1)	An authorisation to acquire evidence of, and use, an assumed identity must be in writing and signed by the authorising person<i>.</i></p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-2__clause-15XI__subclause-2">
              <num>2</num>
              <content>
                <p>The authorisation must specify:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-15XI__para-a">
              <num>a</num>
              <content>
                <p>the authorising person’s name; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-15XI__para-b">
              <num>b</num>
              <content>
                <p>the date on which the authorisation is given; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-15XI__para-c">
              <num>c</num>
              <content>
                <p>if the person who is authorised to acquire or use the assumed identity is an officer in the authorising person’s participating agency or a foreign officer—that officer’s name; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-15XI__para-d">
              <num>d</num>
              <content>
                <p>if the person who is authorised to acquire or use the assumed identity is not such an officer:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-15XI__para-i">
              <num>i</num>
              <content>
                <p>the name of the person who is authorised to acquire or use the assumed identity; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-15XI__para-ii">
              <num>ii</num>
              <content>
                <p>	(ii)	the name of the officer in the authorising person’s participating agency who will supervise that acquisition or<i> </i>use; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-15XI__para-e">
              <num>e</num>
              <content>
                <p>details of the assumed identity which the authorisation covers; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-15XI__para-f">

                <p>all Commonwealth agencies or non-government bodies who are to be requested to issue evidence of the assumed identity; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-15XI__para-g">
              <num>g</num>
              <content>
                <p>details of each such request; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-15XI__para-h">
              <num>h</num>
              <content>
                <p>the reasons for the need to use the assumed identity; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-15XI__para-i">
              <num>i</num>
              <content>
                <p>whether the assumed identity can be used in a foreign country and the reasons for the need for this use; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-15XI__para-j">
              <num>j</num>
              <content>
                <p>any conditions to which the authorisation is subject, including in relation to use in a foreign country.</p>
              </content>
            </paragraph>

                <p>An authorisation can cover more than one assumed identity.</p>
              </content>
            </hcontainer>
          </hcontainer>

            <heading>When an authorisation is in force</heading>

              <p>An authorisation is in force until it is revoked.</p>
            </content>
          </hcontainer>

            <heading>Variation and revocation of authorisations</heading>
            <hcontainer name="subclause" eId="schedule-2__clause-15XK__subclause-1">

                <p>An authorising person who issues an authorisation, or any other authorising person in the same participating agency, may vary or revoke the authorisation at any time.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-2__clause-15XK__subclause-2">

              <content>
                <p>	(2)	The approved officer or<i> </i>approved person<i> </i>covered by the authorisation must be given a written notice of the variation or revocation.</p>
              </content>
            </hcontainer>

                <p>The notice must state:</p>
              </content>
            </hcontainer>

                <p>the date from which the variation or revocation takes effect; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-15XK__para-b">

                <p>the nature of the variation (if any); and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-15XK__para-c">
              <num>c</num>
              <content>
                <p>the reasons for the variation or revocation.</p>
              </content>
            </paragraph>

            <heading>Authorising person may request agencies and bodies to issue evidence of assumed identities etc.</heading>
            <content>
              <p>An authorising person who issues an authorisation may request an issuing agency that is specified in the authorisation under paragraph 15XI(2)(f) to issue evidence of an assumed identity covered by the authorisation to the approved officer or approved person.</p>
            </content>

            <heading>Requesting Commonwealth agencies to issue evidence of assumed identities etc.</heading>

            <heading>Requesting non-government bodies to issue evidence of assumed identities etc.</heading>
            <content>
              <p>		An issuing agency that is a non-government body that receives a request under <i> </i>may comply with the request, but does not have to do so.<ref href="#sec-15X">section 15X</ref>L</p>
              <p>Note:	Only Commonwealth participating agencies can request non-government bodies to issue evidence of an assumed identity.</p>
            </content>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-2__clause-15XO">
            <num>15XO</num>
            <heading>Cancelling evidence of assumed identities etc.</heading>
            <content>
              <p>		An issuing agency that has issued evidence of an assumed identity because of a request under <i> </i>must cancel the evidence (including by deleting or altering an entry in a record of information) on the written request of:<ref href="#sec-15X">section 15X</ref>L,</p>
            </content>
            <paragraph eId="schedule-2__clause-15XO__para-a">
              <num>a</num>
              <content>
                <p>the authorising person who made the request; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-15XO__para-b">
              <num>b</num>
              <content>
                <p>any other authorising person in the same participating agency.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-2__clause-15XP">

            <heading>Protection from criminal liability</heading>
            <content>
              <p>		An employee in an issuing agency,<i> </i>who engages in conduct that, apart from this section, would constitute an offence against a law of the Commonwealth, a State or Territory, is not criminally responsible for<i> </i>the offence if the employee engages in the conduct in responding to the request in the course of duty.</p>
            </content>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-2__clause-15XQ">
            <num>15XQ</num>
            <heading>Indemnification of issuing agencies etc.</heading>
            <content>
              <p>		A Commonwealth participating agency whose authorising person makes a request under <i> </i>must indemnify:<ref href="#sec-15X">section 15X</ref>L</p>
              <p>against any liability (including reasonable costs) incurred by that employee or agency because of conduct engaged in by the employee if:</p>
            </content>
            <paragraph eId="schedule-2__clause-15XQ__para-a">
              <num>a</num>
              <content>
                <p>an employee of an issuing agency; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-15XQ__para-b">
              <num>b</num>
              <content>
                <p><i>	</i>(b)<i>	</i>an issuing agency;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-15XQ__para-c">

                <p>the employee engages in the conduct in responding to the request in the course of duty; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-15XQ__para-d">

                <p>the requirements (if any) specified in the regulations have been met.</p>
              </content>
            </paragraph>

            <heading>Misuse of assumed identities</heading>

                <p>A person commits an offence if:</p>

            </paragraph>

                <p>in doing so, the person engages in conduct that breaches an authorisation condition.</p>
              </content>
            </paragraph>

            <heading>Disclosing information relating to assumed identities</heading>

                <p>A person commits an offence if:</p>

                <p>the disclosure reveals, or is likely to reveal, that an assumed identity acquired or used by another person is not that other person’s real identity; and</p>

                <p>the disclosure:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-15XS__para-i">
              <num>i</num>

                <p>endangers, or is likely to endanger, the health or safety of any person; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-15XS__para-ii">
              <num>ii</num>
              <content>
                <p>prejudices, or is likely to prejudice, the effective conduct of an operation carried out by any participating agency; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-15XS__para-d">
              <num>d</num>
              <content>
                <p>the assumed identity is or was covered by an authorisation.</p>
              </content>
            </paragraph>
            <content>

            </paragraph>

            <heading>Disclosing real identities during court proceedings etc.</heading>
            <hcontainer name="subclause" eId="schedule-2__clause-15XT__subclause-1">
              <num>1</num>
              <content>
                <p>If the real identity of an approved officer or approved person who is or was covered by an authorisation, might be disclosed in proceedings before a court, tribunal or a Royal Commission or other commission of inquiry, then the court, tribunal or commission must:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-15XT__para-a">
              <num>a</num>
              <content>
                <p>ensure that the parts of the proceedings that relate to the real identity of the officer or person are held in private; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-15XT__para-b">
              <num>b</num>
              <content>
                <p>make such orders relating to the suppression of the publication of evidence given by the court, tribunal or commission as will, in its opinion, ensure that the real identity of the officer or person is not disclosed.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-2__clause-15XT__subclause-2">
              <num>2</num>
              <content>
                <p>However, this section does not apply to the extent that the court, tribunal or commission considers that the interests of justice require otherwise.</p>
              </content>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-2__clause-15XU">
            <num>15XU</num>
            <heading>Keeping and auditing records of assumed identities</heading>
            <hcontainer name="subclause" eId="schedule-2__clause-15XU__subclause-1">
              <num>1</num>
              <content>
                <p>The head of a Commonwealth participating agency must:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-15XU__para-a">
              <num>a</num>
              <content>
                <p>cause appropriate records to be kept:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-15XU__para-i">
              <num>i</num>
              <content>
                <p>while an authorisation is in force; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-15XU__para-ii">
              <num>ii</num>
              <content>
                <p>for at least 12 months after an authorisation has been revoked; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-15XU__para-b">
              <num>b</num>
              <content>
                <p>cause those records to be audited:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-15XU__para-i">
              <num>i</num>
              <content>
                <p>	(i)	at least once every 6<i> </i>months while the authorisation is in force; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-15XU__para-ii">
              <num>ii</num>
              <content>
                <p>at least once in the 6 month period after the revocation of the authorisation.</p>
              </content>
            </paragraph>

                <p>An audit of these records must not be conducted by:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-15XU__para-a">
              <num>a</num>
              <content>
                <p>an authorising person who has issued, varied or revoked an authorisation to which one or more of the records relate; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-15XU__para-b">
              <num>b</num>
              <content>
                <p>an approved officer or approved person who is covered by an authorisation to which one or more of the records relate.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-2__clause-15XU__subclause-2">

                <p>In this section:</p>

            </hcontainer>

              <p><b><i>appropriate records </i></b>means records relating to the operation of this Part as it affects the participating agency, including any authorisations and any variations or revocations of those authorisations under section 15XK.</p>

          </hcontainer>

            <heading>Matters to be reported</heading>
            <content>
              <p>Commonwealth participating agencies must report annually</p>
              <p>must, as soon as practicable after 30 June in each year, prepare and give to the Inspector-General of Intelligence and Security a report for the year ending on that 30 June.</p>
              <p>What reports must include</p>

            </paragraph>

            </paragraph>

                <p>Each other Commonwealth participating agency must, <quantity refersTo="#deadline">within 3 months</quantity> after 30 June in each year, prepare and give to the Minister responsible for the agency a report for the year ending on that 30 June.</p>

              <content>
                <p><role refersTo="#minister">The Minister</role> receiving a report under subsection (2) must table a copy of the report before each House of the Parliament within 15 sitting days of that House after the day on which <role refersTo="#minister">the Minister</role> receives the report.</p>

            <hcontainer name="subclause" eId="schedule-2__clause-15XUA__subclause-4">
              <num>4</num>
              <content>
                <p>An agency’s report must include the following information:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-15XUA__para-a">
              <num>a</num>
              <content>
                <p>the number of authorisations issued by an authorising person from the agency during the year covered by the report;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-15XUA__para-b">
              <num>b</num>
              <content>
                <p>a general description of the activities undertaken by approved officers and approved persons when using their assumed identities during the year covered by the report;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-15XUA__para-c">
              <num>c</num>
              <content>
                <p>a statement whether or not any fraud or other unlawful activity was identified by an audit under paragraph 15XU(1)(b) during the year covered by the report.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-2__clause-15XUA__subclause-5">
              <num>5</num>
              <content>
                <p>Before the report is tabled in the Parliament, <role refersTo="#minister">the Minister</role> must, on the advice of the relevant agency head, remove information from the report if <role refersTo="#minister">the Minister</role> is of the view that its inclusion may:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-15XUA__para-a">
              <num>a</num>
              <content>
                <p>endanger a person’s safety; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-15XUA__para-b">
              <num>b</num>
              <content>
                <p>prejudice an investigation or prosecution; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-15XUA__para-c">
              <num>c</num>
              <content>
                <p>compromise the agency’s operational activities or methodologies.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-2__clause-15XV">
            <num>15XV</num>
            <heading>Concurrent operation of State and Territory laws</heading>
            <content>
              <p>It is the Parliament’s intention that a law of a State or Territory should be able to operate concurrently with this Part unless the law is directly inconsistent with this Part.</p>

            <heading>Regulations</heading>
            <content>
              <p>The Governor-General may make regulations prescribing matters:</p>
            </content>

                <p>required or permitted by this Part to be prescribed; or</p>
              </content>
            </paragraph>

            <num>15YA</num>
            <heading>Definitions</heading>
            <content>
              <p>In this Part, unless the contrary intention appears:</p>
              <p><b><i>child</i></b> means a person who is under 18.</p>
              <p><b><i>child complainant</i></b>, in relation to a proceeding, means a child who is, or is alleged to be, a victim of an offence, of a kind referred to in subsection 15Y(1), to which the proceeding relates. The child need not be involved in the proceeding or the initiation of the proceeding.</p>
              <p><b><i>child witness</i></b>, in relation to a proceeding, means a child (including a child complainant) who is a witness in the proceeding.</p>
              <p><b><i>closed-circuit television</i></b> includes any similar technology specified in the regulations.</p>
              <p><b><i>credibility</i></b> has the meaning given by the <i>Evidence Act 1995</i>.</p>
              <p><b><i>cross-examination</i></b> has the meaning given by the <i>Evidence Act 1995</i>.</p>
              <p><b><i>evidence in chief</i></b> means evidence given in examination in chief within the meaning of the <i>Evidence Act 1995</i>.</p>
              <p><b><i>proceeding</i></b> means a proceeding to which this Part applies under section 15Y.</p>
            </content>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-3__clause-15YB">
            <num>15YB</num>
            <heading>Evidence of sexual reputation</heading>
            <hcontainer name="subclause" eId="schedule-3__clause-15YB__subclause-1">
              <num>1</num>
              <content>
                <p>Evidence of a child witness’ or child complainant’s reputation with respect to sexual activities is inadmissible in a proceeding, unless the court gives leave.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-3__clause-15YB__subclause-2">
              <num>2</num>
              <content>
                <p>The court must not give leave unless satisfied that the evidence is substantially relevant to facts in issue in the proceeding.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-3__clause-15YB__subclause-3">
              <num>3</num>
              <content>
                <p>The evidence is not to be treated as substantially relevant to facts in issue merely because of inferences it may raise as to the child witness’ or child complainant’s general disposition.</p>

              <content>
                <p>If the evidence is admitted, it must not be treated as relevant to the child witness’ or child complainant’s credibility.</p>

              <content>
                <p>This section does not apply if the child is a defendant in the proceeding.</p>
              </content>
            </hcontainer>
          </hcontainer>

            <heading>Evidence of sexual experience</heading>
            <hcontainer name="subclause" eId="schedule-3__clause-15YC__subclause-1">
              <num>1</num>
              <content>
                <p>Evidence of a child witness’ or child complainant’s experience with respect to sexual activities is inadmissible in a proceeding, unless:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-3__clause-15YC__para-a">
              <num>a</num>
              <content>
                <p>the court gives leave; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-3__clause-15YC__para-b">
              <num>b</num>
              <content>
                <p>the evidence is of sexual activities with a defendant in the proceeding.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-3__clause-15YC__subclause-2">
              <num>2</num>
              <content>
                <p>The court must not give leave unless satisfied that:</p>
              </content>
            </hcontainer>

                <p>the evidence is substantially relevant to facts in issue in the proceeding; or</p>
              </content>
            </paragraph>

                <p>if the evidence relates to the credibility of a child witness and is to be adduced in cross-examination of the child—the evidence has substantial probative value.</p>

                <p>The evidence is not to be treated as being substantially relevant to facts in issue merely because of inferences it may raise as to the child witness’ or child complainant’s general disposition.</p>

              <num>4</num>
              <content>
                <p>Without limiting the matters to which the court may have regard in deciding whether the evidence has substantial probative value, it is to have regard to:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-3__clause-15YC__para-a">
              <num>a</num>
              <content>
                <p>whether the evidence tends to prove that the witness knowingly or recklessly made a false representation when the witness was under an obligation to tell the truth; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-3__clause-15YC__para-b">
              <num>b</num>
              <content>
                <p>the period that has elapsed since the acts or events to which the evidence relates were done or occurred.</p>
              </content>
            </paragraph>

              <num>5</num>
              <content>
                <p>This section does not apply if the child is a defendant in the proceeding.</p>
              </content>
            </hcontainer>
          </hcontainer>

            <heading>Leave under this Division</heading>
            <hcontainer name="subclause" eId="schedule-3__clause-15YD__subclause-1">
              <num>1</num>
              <content>
                <p>An application for leave under this Division:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-3__clause-15YD__para-a">
              <num>a</num>
              <content>
                <p>must be in writing; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-3__clause-15YD__para-b">
              <num>b</num>
              <content>
                <p>if there is a jury in the proceeding in question—must be made in the jury’s absence; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-3__clause-15YD__para-c">
              <num>c</num>
              <content>
                <p>must not be determined before the court has considered such submissions and other evidence as it thinks necessary for determining the application.</p>
              </content>
            </paragraph>

                <p>If the court gives leave under this Division, the court must:</p>
              </content>
            </hcontainer>

            <paragraph eId="schedule-3__clause-15YD__para-b">

            <heading>Disallowing inappropriate or aggressive cross-examination</heading>
            <hcontainer name="subclause" eId="schedule-3__clause-15YE__subclause-1">

                <p>The court may disallow a question put to a child witness in cross-examination in a proceeding if the question is inappropriate or unnecessarily aggressive.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-3__clause-15YE__subclause-2">
              <num>2</num>
              <content>
                <p>In considering whether a question is inappropriate or unnecessarily aggressive, the court is to have regard to the child witness’ personal characteristics, including his or her age, culture, mental capacity and gender.</p>
              </content>

          </hcontainer>

            <num>15YF</num>
            <heading>Unrepresented defendants—cross-examination of child complainants</heading>

                <p>A defendant in a proceeding who is not represented by counsel is not to cross-examine a child complainant.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-3__clause-15YF__subclause-2">
              <num>2</num>
              <content>
                <p>A person appointed by the court is to ask the child any questions that the defendant requests the person to ask the child.</p>
              </content>
            </hcontainer>
          </hcontainer>

            <num>15YG</num>
            <heading>Unrepresented defendants—cross-examination of child witnesses</heading>
            <hcontainer name="subclause" eId="schedule-3__clause-15YG__subclause-1">

                <p>A defendant in a proceeding who is not represented by counsel is not to cross-examine a child witness (other than a child complainant), unless the court gives leave.</p>
              </content>
            </hcontainer>

                <p>The court must not give leave unless satisfied that the child’s ability to testify under cross-examination will not be adversely affected if the defendant conducts the cross-examination.</p>

              <content>
                <p>In considering whether that ability will be adversely affected, the court is to have regard to any trauma that could be caused if the defendant conducts the cross-examination.</p>

              <content>
                <p>An application for leave under this section:</p>
              </content>
            </hcontainer>

            <heading>Represented defendants—cross-examination of child witnesses and child complainants</heading>

              <p>A defendant in a proceeding who is represented by counsel is not to cross-examine a child witness or a child complainant except through counsel.</p>
            </content>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-3__clause-15YI">
            <num>15YI</num>
            <heading>Closed-circuit television</heading>
            <hcontainer name="subclause" eId="schedule-3__clause-15YI__subclause-1">
              <num>1</num>
              <content>
                <p>A child witness’ evidence in a proceeding must be given by means of closed-circuit television unless:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-3__clause-15YI__para-a">
              <num>a</num>
              <content>
                <p>the child is at least 16 and chooses not to give evidence by that means; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-3__clause-15YI__para-b">
              <num>b</num>
              <content>
                <p>the court orders that the child is not to give evidence by that means; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-3__clause-15YI__para-c">
              <num>c</num>
              <content>
                <p>the court is not equipped with facilities for evidence to be given by means of closed-circuit television.</p>
              </content>
            </paragraph>
            <content>
              <p>Note:	Section 15YL provides for alternative arrangements if a child witness does not give evidence by means of closed-circuit television.</p>
            </content>
            <hcontainer name="subclause" eId="schedule-3__clause-15YI__subclause-2">
              <num>2</num>
              <content>
                <p>The court must not make an order under paragraph (1)(b) unless satisfied that it is not in the interests of justice for the child witness’ evidence to be given by means of closed-circuit television.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-3__clause-15YI__subclause-3">
              <num>3</num>
              <content>
                <p>This section does not affect the operation of any law in relation to the competence of a person to give evidence.</p>
              </content>
            </hcontainer>
          </hcontainer>

            <num>15YJ</num>
            <heading>Giving evidence by closed-circuit television</heading>
            <hcontainer name="subclause" eId="schedule-3__clause-15YJ__subclause-1">
              <num>1</num>
              <content>
                <p>If the child witness’ evidence is given by means of closed-circuit television from a location outside a courtroom:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-3__clause-15YJ__para-a">
              <num>a</num>
              <content>
                <p>that location is taken to be part of the courtroom in which the proceeding is being held; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-3__clause-15YJ__para-b">
              <num>b</num>
              <content>
                <p>the court may order that a court officer be present at that location; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-3__clause-15YJ__para-c">
              <num>c</num>
              <content>
                <p>the court may order that another person be present with the child:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-3__clause-15YJ__para-i">
              <num>i</num>
              <content>
                <p>to act as an interpreter; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-3__clause-15YJ__para-ii">
              <num>ii</num>
              <content>
                <p>to assist the child with any difficulty in giving evidence associated with a disability; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-3__clause-15YJ__para-iii">
              <num>iii</num>
              <content>
                <p>to provide the child with other support.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-3__clause-15YJ__subclause-2">
              <num>2</num>
              <content>
                <p>An order under paragraph (1)(b) or (c) does not limit the operation of <ref href="#sec-15Y">section 15Y</ref>M.</p>
              </content>
            </hcontainer>

              <num>3</num>
              <content>
                <p>The court may adjourn the proceeding, or a part of the proceeding, to a court or other place that is equipped with facilities for evidence to be given by means of closed-circuit television if:</p>
              </content>

              <num>a</num>
              <content>
                <p>the court is not equipped with facilities for evidence to be given by means of closed-circuit television; or</p>
              </content>
            </paragraph>

              <content>
                <p>the court otherwise considers it appropriate to do so.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-3__clause-15YK">

            <heading>Viewing evidence given by closed-circuit television</heading>
            <content>
              <p>If the child witness’ evidence is given by means of closed-circuit television, the facilities used are to be operated in such a way that the people who have an interest in the proceeding can see the child, and any person present with the child, on one or more television monitors.</p>
            </content>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-3__clause-15YL">
            <num>15YL</num>
            <heading>Alternative arrangements for giving evidence</heading>
            <hcontainer name="subclause" eId="schedule-3__clause-15YL__subclause-1">
              <num>1</num>
              <content>
                <p>If a child witness’ evidence in a proceeding is not to be given by means of closed-circuit television, the court:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-3__clause-15YL__para-a">
              <num>a</num>
              <content>
                <p>must make arrangements in order to restrict contact (including visual contact) that the child may have with any defendant while giving evidence; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-3__clause-15YL__para-b">
              <num>b</num>
              <content>
                <p>may make arrangements in order to restrict contact (including visual contact) that the child may have with members of the public while giving evidence.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-3__clause-15YL__subclause-2">
              <num>2</num>
              <content>
                <p>The arrangements may include either of the following:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-3__clause-15YL__para-a">
              <num>a</num>
              <content>
                <p>using screens;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-3__clause-15YL__para-b">
              <num>b</num>
              <content>
                <p>planning seating arrangements for people who have an interest in the proceeding, including:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-3__clause-15YL__para-i">
              <num>i</num>
              <content>
                <p>the level at which they are seated; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-3__clause-15YL__para-ii">
              <num>ii</num>
              <content>
                <p>the people in the child’s line of vision.</p>

            </paragraph>

                <p>This section does not apply if the child is at least 16 and chooses not to give evidence under the arrangements.</p>

            <heading>Admissibility of evidence given using video recordings</heading>

                <p>The admissibility of the evidence given by video recording is not affected by the fact that it is evidence of previous representations that the child witness made in the interview that was being recorded.</p>

                <p>Evidence given by video recording under <ref href="#sec-15Y">section 15Y</ref>M is not admissible if the court is satisfied that:</p>

                <p>any defendant in the proceeding (other than the child witness if the child is a defendant); or</p>
              </content>

              </content>
            </paragraph>
            <content>
              <p>was not given a reasonable opportunity to listen to and view the recording.</p>

                <p>The court may refuse to admit the whole or part of the contents of a recording adduced as evidence under <ref href="#sec-15Y">section 15Y</ref>M.</p>

            <heading>Adults accompanying child witnesses</heading>

                <p>A child witness may choose an adult to accompany the child while the child is giving evidence in a proceeding (including while giving evidence by closed-circuit television).</p>
              </content>
            </hcontainer>

              <num>2</num>
              <content>
                <p>The adult so chosen may accompany the child as mentioned in subsection (1), unless the court determines that it is not appropriate for the adult to accompany the child.</p>

              <num>3</num>
              <content>
                <p>The court may permit more than one adult to accompany the child if the court considers it in the interests of justice to do so.</p>

              <content>
                <p>An adult accompanying the child under this section must not:</p>
              </content>
            </hcontainer>

                <p>prompt the child or otherwise influence the child’s answers; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-3__clause-15YO__para-b">

                <p>disrupt the questioning of the child.</p>
              </content>
            </paragraph>

                <p>Any words spoken by an adult accompanying the child under this section must be able to be heard by:</p>
              </content>
            </hcontainer>

                <p>the judge; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-3__clause-15YO__para-b">

                <p>if there is a jury in the proceeding—the members of the jury.</p>

            <heading>Exclusion of people from the courtroom</heading>
            <content>
              <p>The court may order that some or all of the members of the public be excluded from the courtroom in which a child witness is giving evidence in a proceeding.</p>
            </content>

            <num>15YQ</num>
            <heading>Warnings etc. not to be given about children’s evidence</heading>
            <content>
              <p>If there is a jury in a proceeding in which a child witness has given or will give evidence, the judge is not to warn the jury, or suggest to the jury in any way:</p>
            </content>

              <num>a</num>
              <content>
                <p>that the law regards children as an unreliable class of witness; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-3__clause-15YQ__para-b">

                <p>that the law requires greater or lesser weight to be given to evidence that is given by closed-circuit television or alternative arrangements under <ref href="#dvs-4">Division 4</ref>; or</p>

              <num>c</num>
              <content>
                <p>that the law requires greater or lesser weight to be given to evidence that is given by a video recording under <ref href="#dvs-5">Division 5</ref>; or</p>

                <p>that the law requires greater or lesser weight to be given to evidence because an adult accompanies the child under <ref href="#sec-15Y">section 15Y</ref>O.</p>

            <heading>Publication identifying child witnesses or child complainants</heading>

                <p>A person commits an offence if:</p>
              </content>

            <paragraph eId="schedule-3__clause-15YR__para-a">
              <num>a</num>

                <p>the person publishes any matter; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-3__clause-15YR__para-b">

                <p>the person does not have the leave of the court to publish the matter; and</p>
              </content>
            </paragraph>

                <p>identifies another person (who is not a defendant in the proceeding) as a child witness or a child complainant in relation to the proceeding; or</p>

            </paragraph>

                <p>is likely to lead to the other person being identified as such a child witness or child complainant.</p>
              </content>
            </paragraph>
            <content>
              <p>Penalty:	<quantity refersTo="#custodialSentence">Imprisonment for 12 months</quantity>, or <quantity refersTo="#penaltyUnit">60 penalty units</quantity>, or both.</p>
              <p>Note:	A defendant bears an evidential burden in relation to the matter in subsection (2) (see subsection 13.3(3) of the <i>Criminal Code</i>).</p>

                <p>The court may give leave to a person to publish the matter.</p>

                <p>In deciding whether to give leave, the court is to have regard to:</p>
              </content>
            </hcontainer>

                <p>any trauma to the child witness or child complainant that the publication could cause; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-3__clause-15YR__para-b">

                <p>any damage to the reputation of the child witness or child complainant that the publication could cause; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-3__clause-15YR__para-c">
              <num>c</num>

                <p>whether the publication is:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-3__clause-15YR__para-i">
              <num>i</num>
              <content>
                <p>for the purpose of supplying transcripts of the proceedings to persons with a genuine interest in the proceedings; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-3__clause-15YR__para-ii">
              <num>ii</num>
              <content>
                <p>for genuine research purposes.</p>
              </content>
            </paragraph>

                <p>Leave may be given after the proceedings have finished. For this purpose, the court need not be constituted by the same judicial officers who constituted the court in the proceedings.</p>

                <p>the official would not allow the person to leave if the person wished to do so;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-15A__para-iii">
              <num>iii</num>

                <p>the official has given the person reasonable grounds for believing that the person would not be allowed to leave if he or she wished to do so; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-15A__para-d">
              <num>d</num>

                <p>none of the following applies in relation to the person:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-15A__para-i">
              <num>i</num>
              <content>
                <p>the official is performing functions in relation to persons or goods entering Australia, and the official does not believe that the person has committed a Commonwealth offence;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-15A__para-ii">
              <num>ii</num>
              <content>
                <p>the official is performing functions in relation to persons or goods leaving Australia, and the official does not believe that the person has committed a Commonwealth offence;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-15A__para-iii">
              <num>iii</num>
              <content>
                <p>the official is exercising a power under a law of the Commonwealth to detain and search the person;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-15A__para-iv">
              <num>iv</num>
              <content>
                <p>the official is exercising a power under a law of the Commonwealth to require the person to provide information or to answer questions; and</p>
              </content>
            </paragraph>

                <p>the person has not ceased to be a suspect under subsection (4).</p>
              </content>
            </paragraph>
