      <p>An Act to establish the Sydney Harbour Federation Trust, and for related purposes</p>
      <p>Preamble</p>
      <p>The Parliament intends to conserve and preserve land in the Sydney Harbour region for the benefit of present and future generations of Australians. The land is being vacated by the Department of Defence and includes land at North Head, Middle Head, Georges Heights, Woolwich and Cockatoo Island. Suitable land with significant environmental and heritage values will be returned to the people of Australia.</p>
      <p>The Parliament intends to establish the Sydney Harbour Federation Trust to manage the land and facilitate its return in good order. The Trust will protect the heritage values of the land.</p>

          <heading>Short title</heading>
          <content>
            <p>		This Act may be cited as the <i>Sydney Harbour Federation Trust Act</i><i> </i><i>2001</i>.</p>
          </content>
        </section>
        <section eId="part-1__sec-2">
          <num>2</num>
          <heading>Commencement</heading>
          <subsection eId="part-1__sec-2__subsec-1">
            <num>1</num>
            <content>
              <p>This Act commences on a day to be fixed by Proclamation.</p>
            </content>
          </subsection>
          <subsection eId="part-1__sec-2__subsec-2">
            <num>2</num>
            <content>
              <p>However, if this Act does not commence by Proclamation within the period of 6 months beginning on the day on which this Act receives the Royal Assent, then this Act commences on the first day after the end of that period.</p>

          </subsection>
        </section>
        <section eId="part-1__sec-3">
          <num>3</num>
          <heading>Definitions</heading>
          <content>
            <p>In this Act, unless the contrary intention appears:</p>
            <p><term refersTo="#term-affected-council">affected council</term> means <def>a council, established under <ref class="unresolved">the Local Government Act 1993</ref> of New South Wales, of the area in which: land mentioned in Schedule 1 or 2; or any other Trust land; is situated.</def></p>

          <paragraph eId="part-1__sec-3__para-a">
            <num>a</num>
            <content>
              <p>land mentioned in Schedule 1 or 2; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-b">
            <num>b</num>
            <content>
              <p>any other Trust land;</p>
            </content>
            <content>
              <p>is situated.</p>
              <p><term refersTo="#term-chair">Chair</term> means <def>the Chair of the Trust.</def></p>
              <p><term refersTo="#term-commonwealth-body">Commonwealth body</term> includes <def>a Department of State, or authority, of the Commonwealth.</def></p>
              <p><term refersTo="#term-commonwealth-member">Commonwealth member</term> means <def>a member who was appointed by the Minister under <ref href="#sec-12">section 12</ref>, other than on the recommendation of New South Wales.</def></p>
              <p><term refersTo="#term-commonwealth-place">Commonwealth place</term> means <def>a place referred to in paragraph 52(i) of the Constitution, other than the seat of government.</def></p>
              <p><term refersTo="#term-executive-director">Executive Director</term> means <def>the Executive Director of the Trust.</def></p>
              <p><term refersTo="#term-finance-minister">Finance Minister</term> means <def>the Minister administering the Public Governance, Performance and Accountability Act 2013.</def></p>
              <p><term refersTo="#term-harbour-land">Harbour land</term> means <def>land in the Sydney Harbour region and includes Sydney Harbour’s river systems, catchment area and North and South Head.</def></p>
              <p><b><i>interest</i></b>, in relation to land, means:</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-a">
            <num>a</num>
            <content>
              <p>a legal or equitable estate or interest in the land; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-b">
            <num>b</num>
            <content>
              <p>a right, power or privilege over, or in relation to, the land.</p>
            </content>
            <content>
              <p><term refersTo="#term-interim-trust">interim Trust</term> means <def>the advisory body known as the interim Trust and established by the Commonwealth to commence planning and public consultation in respect of certain Harbour land.</def></p>
              <p><term refersTo="#term-land">land</term> includes <def>buildings and improvements on the land.</def></p>
              <p><term refersTo="#term-member">member</term> includes <def>the Chair.</def></p>
              <p><term refersTo="#term-plan">plan</term> means <def>a plan prepared under <ref href="#part-5">Part 5</ref> of this Act.</def></p>
              <p><term refersTo="#term-plan-area">plan area</term> means <def>the land covered by a plan under <ref href="#sec-27">section 27</ref>.</def></p>
              <p><term refersTo="#term-public-employee">public employee</term> means <def>a person who is a full-time member, officer or employee of: the Australian Public Service; or the Public Service of a State or a Territory; or an authority of the Commonwealth or a State or a Territory; or local government.</def></p>

          </paragraph>
          <paragraph eId="part-1__sec-3__para-a">
            <num>a</num>
            <content>
              <p>the Australian Public Service; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-b">
            <num>b</num>
            <content>
              <p>the Public Service of a State or a Territory; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-c">
            <num>c</num>
            <content>
              <p>an authority of the Commonwealth or a State or a Territory; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-d">
            <num>d</num>
            <content>
              <p>local government.</p>
            </content>
            <content>
              <p><term refersTo="#term-public-notice">public notice</term> means <def>a notice published: 	(a)	in the <i>Gazette</i>; and in a daily newspaper circulating in the Sydney region; and in a local newspaper circulating in the area concerned.</def></p>

          </paragraph>

            <num>a</num>
            <content>
              <p>	(a)	in the <i>Gazette</i>; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-b">
            <num>b</num>
            <content>
              <p>in a daily newspaper circulating in the Sydney region; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-c">
            <num>c</num>
            <content>
              <p>in a local newspaper circulating in the area concerned.</p>
            </content>
            <content>
              <p><term refersTo="#term-regulatory-powers-act">Regulatory Powers Act</term> means <def>the Regulatory Powers (Standard Provisions) Act 2014.</def></p>
              <p><term refersTo="#term-statement-of-reasons">statement of reasons</term> has the meaning given by <def><ref href="#sec-64B">section 64B</ref>.</def></p>
              <p><term refersTo="#term-trust">Trust</term> means <def>the Sydney Harbour Federation Trust established by <ref href="#sec-5">section 5</ref>.</def></p>
              <p><term refersTo="#term-trust-land">Trust land</term> means <def>any land that: vests in the Trust; and is held by the Trust from time to time for and on behalf of the Commonwealth; under <ref href="#sec-22">section 22</ref>.</def></p>

            <num>a</num>
            <content>
              <p>vests in the Trust; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-b">
            <num>b</num>
            <content>
              <p>is held by the Trust from time to time for and on behalf of the Commonwealth;</p>
            </content>
            <content>
              <p>under <ref href="#sec-22">section 22</ref>.</p>
              <p><b><i>Trust land site</i></b> means:</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-a">
            <num>a</num>
            <content>
              <p>the sites mentioned in Schedules 1 and 2; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-b">
            <num>b</num>
            <content>
              <p>	(b)	land specified in a notice published in the <i>Gazette</i> under subsection 21(2).</p>
            </content>
          </paragraph>
        </section>
        <section eId="part-1__sec-4">
          <num>4</num>
          <heading>Act binds the Crown</heading>
          <content>
            <p>This Act binds the Crown in each of its capacities.</p>
          </content>
        </section>
      </part>

        <num>2</num>
        <heading>Establishment of the Trust</heading>

          <num>5</num>
          <heading>Establishment</heading>
          <subsection eId="part-2__sec-5__subsec-1">
            <num>1</num>
            <content>
              <p>The Sydney Harbour Federation Trust is established by this section.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-5__subsec-2">
            <num>2</num>
            <content>
              <p>The Trust:</p>
            </content>
            <paragraph eId="part-2__sec-5__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>is a body corporate with perpetual succession; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>	(b)	may<i> </i>have a common seal; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>may sue and be sued in its corporate name.</p>
              </content>

                  <p>Note:	The <i>Public Governance, Performance and Accountability Act 2013</i> applies to the Trust. That Act deals with matters relating to corporate Commonwealth entities, including reporting and the use and management of public resources.</p>

          </subsection>
          <subsection eId="part-2__sec-5__subsec-3">
            <num>3</num>
            <content>
              <p>All courts, judges and persons acting judicially must:</p>
            </content>
            <paragraph eId="part-2__sec-5__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>take notice of the imprint of the common seal of the Trust appearing on a document; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>presume that the document was duly sealed.</p>
              </content>
            </paragraph>
          </subsection>
        </section>
        <section eId="part-2__sec-6">
          <num>6</num>
          <heading>Objects</heading>
          <content>
            <p>The objects of the Trust are the following:</p>
          </content>
          <paragraph eId="part-2__sec-6__para-a">
            <num>a</num>
            <content>
              <p>to ensure that management of Trust land contributes to enhancing the amenity of the Sydney Harbour region;</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-6__para-b">
            <num>b</num>
            <content>
              <p>to protect, conserve and interpret the environmental and heritage values of Trust land;</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-6__para-c">
            <num>c</num>
            <content>
              <p>to maximise public access to Trust land;</p>
            </content>
          </paragraph>

              <p>to co-operate with other Commonwealth bodies that have a connection with any Harbour land in managing that land;</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-6__para-f">
            <num>f</num>
            <content>
              <p>to co-operate with New South Wales, affected councils and the community in furthering the above objects.</p>
            </content>
          </paragraph>
        </section>
        <section eId="part-2__sec-7">
          <num>7</num>
          <heading>Functions</heading>
          <content>
            <p>The functions of the Trust are the following:</p>
          </content>
          <paragraph eId="part-2__sec-7__para-a">
            <num>a</num>
            <content>
              <p>to hold Trust land for and on behalf of the Commonwealth;</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-7__para-b">
            <num>b</num>
            <content>
              <p>to undertake community consultation on the management and conservation of Trust land;</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-7__para-c">
            <num>c</num>
            <content>
              <p>to do the things referred to in <ref href="#sec-38A">section 38A</ref> before plans take effect for an area of Trust land;</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-7__para-d">
            <num>d</num>
            <content>
              <p>to develop draft plans in respect of Trust land and any other Harbour land in furthering the objects, and performing other functions, of the Trust;</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-7__para-e">
            <num>e</num>
            <content>
              <p>to rehabilitate, remediate, develop, enhance and manage Trust land, by itself or in co-operation with other institutions or persons, in accordance with the plans;</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-7__para-f">
            <num>f</num>
            <content>
              <p>to make recommendations to <role refersTo="#minister">the Minister</role> on:</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-7__para-i">
            <num>i</num>
            <content>
              <p>plans; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-7__para-ii">
            <num>ii</num>
            <content>
              <p>the proposed transfer of any Trust land;</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-7__para-g">
            <num>g</num>
            <content>
              <p>to promote appreciation of Trust land, in particular its environmental and heritage values;</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-7__para-h">
            <num>h</num>
            <content>
              <p>to provide services and funding to other Commonwealth bodies in furthering the objects, and performing other functions, of the Trust;</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-7__para-i">
            <num>i</num>
            <content>
              <p>anything incidental to or conducive to the performance of its other functions.</p>
            </content>
          </paragraph>
        </section>
        <section eId="part-2__sec-8">
          <num>8</num>
          <heading>Powers</heading>
          <subsection eId="part-2__sec-8__subsec-1">
            <num>1</num>
            <content>
              <p>The Trust has power to do all things necessary or convenient to be done for or in connection with the performance of its functions.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-8__subsec-2">
            <num>2</num>
            <content>
              <p>The Trust’s powers include, but are not limited to, the following powers:</p>
            </content>
            <paragraph eId="part-2__sec-8__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>negotiate with other Commonwealth bodies and with New South Wales and affected councils;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>acquire, hold and dispose of real and personal property;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>enter into agreements with New South Wales and affected councils;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-2__para-d">
              <num>d</num>
              <content>
                <p>accept gifts, grants, bequests and devises made to it;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-2__para-e">
              <num>e</num>
              <content>
                <p>enter into contracts and agreements;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-2__para-f">
              <num>f</num>
              <content>
                <p>form, or participate in the formation of, companies;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-2__para-g">
              <num>g</num>
              <content>
                <p>enter into partnerships;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-2__para-h">
              <num>h</num>
              <content>
                <p>participate in joint ventures;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-2__para-i">
              <num>i</num>
              <content>
                <p>raise money, by borrowing or otherwise, in accordance with <ref href="#sec-63">section 63</ref>.</p>
              </content>
            </paragraph>
          </subsection>
        </section>
        <section eId="part-2__sec-9">
          <num>9</num>
          <heading>Minister may give directions</heading>
          <subsection eId="part-2__sec-9__subsec-1">
            <num>1</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> may give written directions to the Trust in relation to the performance of its functions and the exercise of its powers.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-9__subsec-2">
            <num>2</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> must give the Trust written reasons for the directions.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-9__subsec-3">
            <num>3</num>
            <content>
              <p>The Trust must perform its functions and exercise its powers in a manner consistent with any directions given by <role refersTo="#minister">the Minister</role> under subsection (1).</p>
            </content>
          </subsection>
        </section>
      </part>

        <heading>Constitution of the Trust</heading>
        <section eId="part-3__sec-10">
          <num>10</num>
          <heading>Membership of the Trust</heading>
          <content>
            <p>The Trust consists of:</p>
          </content>
          <paragraph eId="part-3__sec-10__para-a">
            <num>a</num>
            <content>
              <p>the Chair; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-3__sec-10__para-b">
            <num>b</num>
            <content>
              <p>7 other members.</p>
            </content>
          </paragraph>
        </section>
        <section eId="part-3__sec-11">
          <num>11</num>
          <heading>Invitations to NSW to recommend members</heading>
          <subsection eId="part-3__sec-11__subsec-1">
            <num>1</num>
            <content>
              <p>Before initially appointing members to the Trust, <role refersTo="#minister">the Minister</role> must invite New South Wales to recommend persons to be appointed to 2 membership positions.</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-11__subsec-3">
            <num>3</num>
            <content>
              <p>If:</p>
            </content>
            <paragraph eId="part-3__sec-11__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>a vacancy arises in the membership of the Trust; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-11__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>there are not 2 other membership positions held by persons recommended by New South Wales;</p>
              </content>
              <content>
                <p>then <role refersTo="#minister">the Minister</role> must invite New South Wales to recommend persons to be appointed to the vacant membership position.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-3__sec-11__subsec-4">
            <num>4</num>
            <content>
              <p><quantity refersTo="#deadline">Within 2 months</quantity> of receiving the invitation, New South Wales may recommend persons who have experience or knowledge in at least one of the fields listed in subsection 12(2).</p>
            </content>
          </subsection>
        </section>
        <section eId="part-3__sec-12">
          <num>12</num>
          <heading>Appointment of members</heading>
          <subsection eId="part-3__sec-12__subsec-1">
            <num>1</num>
            <content>
              <p>The members of the Trust are to be appointed by <role refersTo="#minister">the Minister</role> by written instrument.</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-12__subsec-2">
            <num>2</num>
            <content>
              <p>A person is not eligible for appointment as a member unless <role refersTo="#minister">the Minister</role> is satisfied that the person has experience or knowledge in at least one of the following fields:</p>
            </content>
            <paragraph eId="part-3__sec-12__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>environment and heritage conservation or heritage interpretation;</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-12__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>Indigenous culture;</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-12__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>land planning and management;</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-12__subsec-2__para-d">
              <num>d</num>
              <content>
                <p>business, financial, property or asset management;</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-12__subsec-2__para-e">
              <num>e</num>
              <content>
                <p>tourism or marketing;</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-12__subsec-2__para-f">
              <num>f</num>
              <content>
                <p>military service;</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-12__subsec-2__para-g">
              <num>g</num>
              <content>
                <p>law.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-3__sec-12__subsec-3">
            <num>3</num>
            <content>
              <p>	(3)	One of the members must be an Aboriginal person, or a Torres Strait Islander, within the meaning of the <i>Aboriginal and Torres Strait Islander Act 2005</i> who is eligible for appointment under subsection (2).</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-12__subsec-3A">
            <num>3A</num>
            <content>
              <p>One of the members must be a person who:</p>
            </content>
            <paragraph eId="part-3__sec-12__subsec-3A__para-a">
              <num>a</num>
              <content>
                <p>is eligible for appointment under subsection (2); and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-12__subsec-3A__para-b">
              <num>b</num>
              <content>
                <p>in <role refersTo="#minister">the Minister</role>’s opinion, provides a local government perspective and experience.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-3__sec-12__subsec-4">
            <num>4</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> must not appoint a person as a member if, immediately after the appointment of the person, more than one-half of the members of the Trust would be public employees.</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-12__subsec-5">
            <num>5</num>
            <content>
              <p>The appointment of a member is not invalid because of a defect or irregularity in connection with the member’s appointment.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-3__sec-13">
          <num>13</num>
          <heading>Terms of office of members</heading>
          <subsection eId="part-3__sec-13__subsec-1">
            <num>1</num>
            <content>
              <p>A member is to be appointed on a part-time basis.</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-13__subsec-2">
            <num>2</num>
            <content>
              <p>A member holds office for the period specified in the instrument of appointment. The period must not exceed 3 years.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-3__sec-14">
          <num>14</num>
          <heading>Acting appointments</heading>
          <content>
            <p><role refersTo="#minister">The Minister</role> may appoint a member to act as the Chair:</p>
          </content>
          <paragraph eId="part-3__sec-14__para-a">
            <num>a</num>
            <content>
              <p>during a vacancy in the office of Chair (whether or not an appointment has previously been made to the office); or</p>
            </content>
          </paragraph>
          <paragraph eId="part-3__sec-14__para-b">
            <num>b</num>
            <content>
              <p>during any period, or during all periods, when the Chair is absent from duty or from Australia, or is, for any reason, unable to perform the duties of the office.</p>
            </content>

          <heading>Additional terms and conditions of appointment of members</heading>

            <p>A member holds office on the terms and conditions (if any) in relation to matters not covered by this Act that are determined by <role refersTo="#minister">the Minister</role>.</p>
          </content>
        </section>
        <section eId="part-3__sec-16">
          <num>16</num>
          <heading>Outside employment of members</heading>
          <content>
            <p>A member must not engage in any paid employment that, in <role refersTo="#minister">the Minister</role>’s opinion, conflicts or may conflict with the proper performance of the member’s duties.</p>
          </content>
        </section>
        <section eId="part-3__sec-17">
          <num>17</num>
          <heading>Remuneration and allowances of members</heading>
          <subsection eId="part-3__sec-17__subsec-1">
            <num>1</num>
            <content>
              <p>A member is to be paid the remuneration that is determined by the Remuneration Tribunal. If no determination of that remuneration by the Tribunal is in operation, the member is to be paid the remuneration that is prescribed.</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-17__subsec-2">
            <num>2</num>
            <content>
              <p>A member is to be paid the allowances that are prescribed.</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-17__subsec-3">
            <num>3</num>
            <content>
              <p>	(3)	This section has effect subject to the <i>Remuneration Tribunal Act 1973</i>.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-3__sec-18">
          <num>18</num>
          <heading>Leave of absence</heading>
          <content>
            <p>The Chair may grant leave of absence to any other member on the terms and conditions that the Chair determines.</p>
          </content>
        </section>
        <section eId="part-3__sec-19">
          <num>19</num>
          <heading>Resignation</heading>
          <content>
            <p>A member may resign his or her appointment by giving <role refersTo="#minister">the Minister</role> a written resignation.</p>
          </content>
        </section>
        <section eId="part-3__sec-20">
          <num>20</num>
          <heading>Termination of appointment of members</heading>
          <subsection eId="part-3__sec-20__subsec-1">
            <num>1</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> may terminate a member’s appointment for misbehaviour or physical or mental incapacity.</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-20__subsec-2">
            <num>2</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> may terminate a member’s appointment if:</p>
            </content>
            <paragraph eId="part-3__sec-20__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>the member:</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-20__subsec-2__para-i">
              <num>i</num>
              <content>
                <p>becomes bankrupt; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-20__subsec-2__para-ii">
              <num>ii</num>
              <content>
                <p>applies to take the benefit of any law for the relief of bankrupt or insolvent debtors; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-20__subsec-2__para-iii">
              <num>iii</num>
              <content>
                <p>compounds with his or her creditors; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-20__subsec-2__para-iv">
              <num>iv</num>
              <content>
                <p>makes an assignment of his or her remuneration for the benefit of his or her creditors; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-20__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>the member is absent, except on leave of absence, from 3 consecutive meetings of the Trust; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-20__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>the member engages in paid employment that, in <role refersTo="#minister">the Minister</role>’s opinion, conflicts or could conflict with the proper performance of the duties of his or her office.</p>

        </section>

        <heading>Trust land</heading>
        <section eId="part-4__sec-21">
          <num>21</num>
          <heading>Vesting by Minister of land in the Trust</heading>
          <subsection eId="part-4__sec-21__subsec-1">
            <num>1</num>
            <content>
              <p>	(1)	The Minister administering the <i>Defence Act 1903</i> must, by notice or notices published in the <i>Gazette</i>, specify that each Trust land site mentioned in Schedules 1 and 2 that is a Commonwealth place is to vest in the Trust in accordance with section 22 on a specified day that is within 4 years of this Act commencing. A notice may deal with a part only of a Trust land site.</p>
            </content>
          </subsection>
          <subsection eId="part-4__sec-21__subsec-2">
            <num>2</num>
            <content>
              <p>	(2)	The Minister may, by notice published in the <i>Gazette</i>, specify that a part of any other Harbour land that is a Commonwealth place is to vest in the Trust in accordance with section 22.</p>
            </content>
          </subsection>
          <subsection eId="part-4__sec-21__subsec-3">
            <num>3</num>
            <content>
              <p>The notice must specify the day from which the land is to vest.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-4__sec-22">
          <num>22</num>
          <heading>Vesting of Trust land</heading>
          <subsection eId="part-4__sec-22__subsec-1">
            <num>1</num>
            <content>
              <p>From the beginning of the day specified in the notice, all right, title and interest that the Commonwealth holds in the land vests in the Trust without any conveyance, transfer or assignment.</p>
            </content>
          </subsection>
          <subsection eId="part-4__sec-22__subsec-2">
            <num>2</num>
            <content>
              <p>The Trust holds the land for and on behalf of the Commonwealth.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-4__sec-23">
          <num>23</num>
          <heading>Minister may make arrangements</heading>
          <subsection eId="part-4__sec-23__subsec-1">
            <num>1</num>
            <content>
              <p>If:</p>
            </content>
            <paragraph eId="part-4__sec-23__subsec-1__para-a">
              <num>a</num>
              <content>
                <p><role refersTo="#minister">the Minister</role> specifies land under section 21; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-23__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>immediately before the land vests in the Trust under <ref href="#sec-22">section 22</ref>, the Commonwealth is a party to an agreement or instrument that relates to the land;</p>
              </content>
              <content>
                <p>then <role refersTo="#minister">the Minister</role> may specify, in writing, the agreement or instrument for the purposes of this section.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-4__sec-23__subsec-2">
            <num>2</num>
            <content>
              <p>An agreement or instrument specified under this section has effect, after the land vests in the Trust, as if:</p>
            </content>
            <paragraph eId="part-4__sec-23__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>the Trust were substituted for the Commonwealth as a party to the agreement or instrument; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-23__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>any reference in the agreement or instrument to the Commonwealth were (except in relation to matters that occurred before the land vested) a reference to the Trust.</p>
              </content>
            </paragraph>
          </subsection>
        </section>
        <section eId="part-4__sec-24">
          <num>24</num>
          <heading>Transfer of Trust land</heading>
          <subsection eId="part-4__sec-24__subsec-1">
            <num>1</num>
            <content>
              <p>The Trust must not sell or otherwise transfer the freehold interest in:</p>
            </content>
            <paragraph eId="part-4__sec-24__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>any land mentioned in Schedule 1; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-24__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>land identified in a plan as having significant environmental or heritage values;</p>
              </content>
              <content>
                <p>unless:</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-24__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>the sale or transfer is to the Commonwealth, New South Wales or an affected council; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-24__subsec-1__para-d">
              <num>d</num>
              <content>
                <p>the instrument under which the sale or transfer occurs includes a condition that the land not be sold or otherwise transferred other than to the Commonwealth, New South Wales or an affected council.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-4__sec-24__subsec-1A">
            <num>1A</num>
            <content>
              <p>A purported sale or transfer of a freehold interest by an instrument that does not comply with paragraph (1)(c) or (d) is not effective.</p>
            </content>
          </subsection>
          <subsection eId="part-4__sec-24__subsec-1B">
            <num>1B</num>
            <content>
              <p>The Trust must not sell or otherwise transfer the freehold interest of any land mentioned in Schedule 2 without the written approval of <role refersTo="#minister">the Minister</role>.</p>
            </content>
          </subsection>
          <subsection eId="part-4__sec-24__subsec-2">
            <num>2</num>
            <content>
              <p>If the Trust agrees to sell or otherwise transfer the freehold interest of any Trust land, then the Trust must seek <role refersTo="#minister">the Minister</role>’s approval, in writing, of:</p>
            </content>

              <num>a</num>
              <content>
                <p>the terms and conditions of the agreement; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-24__subsec-2__para-b">

                <p>the transferee.</p>

            </paragraph>
          </subsection>
        </section>
        <section eId="part-4__sec-25">

          <heading>Lands Acquisition Act not to apply</heading>

            <p>		Part X of the <i>Lands Acquisition Act 1989</i> does not apply to the disposal by the Trust of Trust land or an interest in Trust land.</p>

              <p>Within 2 years of this Act commencing, the Trust must prepare a draft plan in respect of each Trust land site mentioned in Schedules 1 and 2.</p>

              <p>Within 2 years of any other land vesting in the Trust under <ref href="#sec-22">section 22</ref>, the Trust must prepare a draft plan in respect of that land.</p>

              <p><role refersTo="#minister">The Minister</role> may extend the period mentioned in subsections (1) and (2) on application, in writing, by the Trust, provided that the Trust has by public notice informed the public about the application and the reason for the extension of time.</p>

        </section>

          <num>27</num>
          <heading>Plan areas</heading>
          <subsection eId="part-5__sec-27__subsec-1">
            <num>1</num>
            <content>
              <p>A plan must cover at least one Trust land site and must not cover only a part of a site.</p>
            </content>
          </subsection>
          <subsection eId="part-5__sec-27__subsec-2">
            <num>2</num>
            <content>
              <p>A plan may cover any Harbour land that has not vested in the Trust under <ref href="#sec-22">section 22</ref>. However, the plan takes effect in respect of that land only when:</p>
            </content>
            <paragraph eId="part-5__sec-27__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>the plan is approved and notified under this Part; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-27__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>the land vests in the Trust.</p>
              </content>

                  <p>Note:	If the plan has been approved and notified under this Part before the land vests in the Trust, then the plan does not require further notification under <ref href="#sec-34">section 34</ref> when the land eventually vests in the Trust.</p>

          <heading>Content of plans</heading>
          <subsection eId="part-5__sec-28__subsec-1">
            <num>1</num>
            <content>
              <p>A plan must accord with the objects of the Trust.</p>
            </content>
          </subsection>
          <subsection eId="part-5__sec-28__subsec-2">
            <num>2</num>
            <content>
              <p>The plan must accord with principles of ecologically sustainable development.</p>
            </content>
          </subsection>
          <subsection eId="part-5__sec-28__subsec-3">
            <num>3</num>
            <content>
              <p>The plan must contain the following:</p>
            </content>
            <paragraph eId="part-5__sec-28__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>a history and description of the plan area, including an identification of current land uses of the area or parts of the area;</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-28__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>an assessment of the environmental and heritage values of the area;</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-28__subsec-3__para-c">
              <num>c</num>
              <content>
                <p>an assessment of the interrelationship between the plan area and the surrounding region, including other public land in the Sydney Harbour region and other Trust land;</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-28__subsec-3__para-d">
              <num>d</num>
              <content>
                <p>objectives for the conservation and management of the area;</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-28__subsec-3__para-e">
              <num>e</num>
              <content>
                <p>policies in respect of the conservation and management of the area;</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-28__subsec-3__para-f">
              <num>f</num>
              <content>
                <p>an identification of proposed land uses in the area or parts of the area;</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-28__subsec-3__para-g">
              <num>g</num>
              <content>
                <p>an identification of the nature of possible future owners of the area or parts of the area;</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-28__subsec-3__para-h">
              <num>h</num>
              <content>
                <p>guidelines, options (if necessary) and recommendations for the implementation of the plan;</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-28__subsec-3__para-i">
              <num>i</num>
              <content>
                <p>detailed estimates of costs that may be incurred in respect of the area, including costs for remediation, rehabilitation and conservation of the area;</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-28__subsec-3__para-j">
              <num>j</num>
              <content>
                <p>anything else required by the regulations.</p>
              </content>
            </paragraph>
          </subsection>
        </section>
        <section eId="part-5__sec-29">
          <num>29</num>
          <heading>Consultation on proposal to prepare draft plan</heading>
          <subsection eId="part-5__sec-29__subsec-1">
            <num>1</num>
            <content>
              <p>Before preparing a draft plan, the Trust must, by public notice:</p>
            </content>
            <paragraph eId="part-5__sec-29__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>state that it proposes to prepare a draft plan in respect of a specified plan area; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-29__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>invite interested persons to make representations in connection with the proposal by a specified date that is at least one month after the date of publication of the notice; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-29__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>specify an address to which representations may be sent.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-5__sec-29__subsec-2">
            <num>2</num>
            <content>
              <p>A person may make written submissions to the Trust in connection with the proposal not later than the date stated in the notice.</p>
            </content>
          </subsection>
          <subsection eId="part-5__sec-29__subsec-3">
            <num>3</num>
            <content>
              <p>The Trust:</p>
            </content>
            <paragraph eId="part-5__sec-29__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>must take into account any submissions made to it in accordance with subsection (2); and</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-29__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>must take into account any advice or recommendations received from an advisory committee established under <ref href="#part-8">Part 8</ref>; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-29__subsec-3__para-c">
              <num>c</num>
              <content>
                <p>may take into account any other submissions.</p>
              </content>
            </paragraph>
          </subsection>
        </section>
        <section eId="part-5__sec-30">
          <num>30</num>
          <heading>Consultation on draft plan</heading>
          <subsection eId="part-5__sec-30__subsec-1">
            <num>1</num>
            <content>
              <p>The Trust must make a draft plan, that it has prepared, publicly available by electronic or other means.</p>
            </content>

              <p>The Trust must also, by public notice:</p>
            </content>

              <content>
                <p>state that the draft plan has been prepared in respect of a specified plan area; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-30__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>state where the draft plan is made available to the public; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-30__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>invite interested persons to make representations in connection with the draft plan by a specified date that is at least one month after the date of publication of the notice; and</p>
              </content>
            </paragraph>

              <content>
                <p>must take into account any advice or recommendations received from an advisory committee established under <ref href="#part-8">Part 8</ref>; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-30__subsec-4__para-c">
              <num>c</num>
              <content>
                <p>may take into account any other submissions.</p>
              </content>
            </paragraph>
          </subsection>
        </section>
        <section eId="part-5__sec-31">
          <num>31</num>
          <heading>Minister to approve plans</heading>
          <subsection eId="part-5__sec-31__subsec-1">
            <num>1</num>
            <content>
              <p>The Trust must submit a draft plan, together with a written report on:</p>
            </content>
            <paragraph eId="part-5__sec-31__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>its consultations under sections 29 and 30; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-31__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>consultations (if any) with advisory committees established under <ref href="#part-8">Part 8</ref>;</p>
              </content>
              <content>
                <p>to the Minister (the <b><i>Commonwealth Minister</i></b>).</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-5__sec-31__subsec-2">
            <num>2</num>
            <content>
              <p>Before considering the draft plan, the Commonwealth Minister must:</p>
            </content>
            <paragraph eId="part-5__sec-31__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>	(a)	provide a copy of it, together with any relevant material, to a relevant Minister (the <b><i>State Minister</i></b>) of New South Wales; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-31__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>invite the State Minister to provide comments on the draft plan <quantity refersTo="#deadline">within 2 months</quantity>.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-5__sec-31__subsec-3">
            <num>3</num>
            <content>
              <p>In considering the draft plan, <role refersTo="#minister">the Minister</role> must take into account any comments or alterations suggested, within the 2 months, by the State Minister.</p>
            </content>
          </subsection>
          <subsection eId="part-5__sec-31__subsec-4">
            <num>4</num>
            <content>
              <p>The Commonwealth Minister may:</p>
            </content>
            <paragraph eId="part-5__sec-31__subsec-4__para-a">
              <num>a</num>
              <content>
                <p>approve the draft plan without alteration; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-31__subsec-4__para-b">
              <num>b</num>
              <content>
                <p>refer the draft plan to the Trust with either or both of the following:</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-31__subsec-4__para-i">
              <num>i</num>
              <content>
                <p>directions to conduct a public hearing or any other consultations;</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-31__subsec-4__para-ii">
              <num>ii</num>
              <content>
                <p>suggested alterations; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-31__subsec-4__para-c">
              <num>c</num>
              <content>
                <p>reject the draft plan, giving reasons.</p>
              </content>
            </paragraph>
          </subsection>
        </section>
        <section eId="part-5__sec-32">
          <num>32</num>
          <heading>Action on referral by Minister</heading>
          <subsection eId="part-5__sec-32__subsec-1">
            <num>1</num>
            <content>
              <p>If <role refersTo="#minister">the Minister</role> refers a draft plan to the Trust, then the Trust must do the following:</p>
            </content>
            <paragraph eId="part-5__sec-32__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>reconsider the draft plan;</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-32__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>undertake the consultations directed by <role refersTo="#minister">the Minister</role>;</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-32__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>undertake any other consultations as the Trust thinks necessary;</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-32__subsec-1__para-d">
              <num>d</num>
              <content>
                <p>consider any suggestions made by <role refersTo="#minister">the Minister</role>;</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-32__subsec-1__para-e">
              <num>e</num>
              <content>
                <p>if it thinks fit, alter the draft plan.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-5__sec-32__subsec-2">
            <num>2</num>
            <content>
              <p>The Trust must then submit:</p>
            </content>
            <paragraph eId="part-5__sec-32__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>the draft plan; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-32__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>a written report on additional consultations (if any) undertaken under this section;</p>
              </content>
              <content>
                <p>to <role refersTo="#minister">the Minister</role> for approval.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-5__sec-32__subsec-3">
            <num>3</num>
            <content>
              <p>This Part (other than <ref href="#sec-26">section 26</ref>) applies to a draft plan submitted under this section in the same way as it applies to a draft plan submitted under <ref href="#sec-31">section 31</ref>.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-5__sec-33">
          <num>33</num>
          <heading>Rejection of draft plan</heading>
          <subsection eId="part-5__sec-33__subsec-1">
            <num>1</num>
            <content>
              <p>If <role refersTo="#minister">the Minister</role> rejects the draft plan, then the Trust must:</p>
            </content>
            <paragraph eId="part-5__sec-33__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>consider <role refersTo="#minister">the Minister</role>’s reasons; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-33__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>prepare a new draft plan.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-5__sec-33__subsec-2">
            <num>2</num>
            <content>
              <p>This Part (other than <ref href="#sec-26">section 26</ref>) applies to a new draft plan in the same way as it applies to a draft plan submitted under <ref href="#sec-31">section 31</ref>.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-5__sec-34">
          <num>34</num>
          <heading>Notification of plan</heading>
          <content>
            <p>		If a plan is approved by the Minister, then the Trust must, by notice published in the <i>Gazette</i>:</p>
          </content>
          <paragraph eId="part-5__sec-34__para-a">
            <num>a</num>
            <content>
              <p>state that a plan, in respect of a specified plan area or a part of a plan area, has been prepared; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-5__sec-34__para-b">
            <num>b</num>
            <content>
              <p>specify the day on which the plan takes effect for the area or the part of the area; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-5__sec-34__para-c">
            <num>c</num>
            <content>
              <p>state where the plan is made available to the public.</p>
            </content>

          <heading>Commencement and implementation of plans</heading>
          <subsection eId="part-5__sec-35__subsec-1">

              <p>A plan takes effect for the plan area, or the part of the plan area, specified in a notice under <ref href="#sec-34">section 34</ref>, from the beginning of the day specified in the notice.</p>
            </content>

                <p>Note:	Section 27 contains an exception to this rule for land that has not vested in the Trust.</p>

          </subsection>

              <p>The Trust must begin to implement a plan as soon as practicable after it has taken effect for the plan area or the part of the plan area.</p>

          </subsection>
        </section>

          <heading>Amendment to plans</heading>
          <subsection eId="part-5__sec-36__subsec-1">
            <num>1</num>
            <content>
              <p>The Trust may, in writing, prepare an amendment to a plan.</p>
            </content>
          </subsection>
          <subsection eId="part-5__sec-36__subsec-2">
            <num>2</num>
            <content>
              <p>Sections 28 to 35 apply in relation to the preparation of an amendment to a plan in the same way as they apply in relation to the preparation of a draft plan.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-5__sec-36A">
          <num>36A</num>
          <heading>Submissions to be publicly available</heading>
          <subsection eId="part-5__sec-36A__subsec-1">
            <num>1</num>
            <content>
              <p>The Trust must make publicly available, by electronic or other means, submissions made under <ref href="#part-5">Part 5</ref> on:</p>
            </content>
            <paragraph eId="part-5__sec-36A__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>proposals to prepare draft plans; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-36A__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>draft plans; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-36A__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>amendments to draft plans.</p>
              </content>

              <p>However, the Trust is not required to make a submission publicly available if, in the Trust’s opinion, it would significantly damage the environmental or heritage values of Trust land.</p>
            </content>
          </subsection>
          <subsection eId="part-5__sec-36A__subsec-3">
            <num>3</num>
            <content>
              <p>No action or proceeding, whether civil or criminal, lies against a member of the Trust in respect of making a submission publicly available under this section.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-5__sec-37">
          <num>37</num>
          <heading>Commonwealth etc. to act in accordance with plans</heading>
          <subsection eId="part-5__sec-37__subsec-1">
            <num>1</num>
            <content>
              <p>If a plan has been approved and notified for a plan area (even if the plan or a part of the plan has not taken effect in respect of that area), then the Commonwealth, the Trust and other Commonwealth bodies must act in accordance with the plan in carrying out activities in that area.</p>
            </content>
          </subsection>
          <subsection eId="part-5__sec-37__subsec-2">
            <num>2</num>
            <content>
              <p>However, this section does not authorise or require the Commonwealth, the Trust or the Commonwealth body to carry out an activity that it is not otherwise legally able to carry out.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-5__sec-38">
          <num>38</num>
          <heading>Transitional—interim Trust actions</heading>
          <content>
            <p>Anything done, before this Act commences, by the Commonwealth on behalf of the interim Trust in relation to a plan is taken, for the purposes of this Act, to have been done by the Trust.</p>
          </content>
        </section>
        <section eId="part-5__sec-38A">
          <num>38A</num>
          <heading>Transitional—activities before plans take effect</heading>
          <subsection eId="part-5__sec-38A__subsec-1">
            <num>1</num>
            <content>
              <p>Before a plan takes effect for an area of Trust land, the Trust may:</p>
            </content>
            <paragraph eId="part-5__sec-38A__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>determine the way in which the area may be used before the relevant plan takes effect; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-38A__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>use the area in that way; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-38A__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>grant leases and licences over the area in accordance with <ref href="#sec-38B">section 38B</ref>; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-38A__subsec-1__para-d">
              <num>d</num>
              <content>
                <p>carry out maintenance and repair work in the area; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-38A__subsec-1__para-e">
              <num>e</num>
              <content>
                <p>carry out other work in the area to protect the health and safety of persons present there; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-38A__subsec-1__para-f">
              <num>f</num>
              <content>
                <p>carry out other work that will only have a temporary impact on the area.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-5__sec-38A__subsec-2">
            <num>2</num>
            <content>
              <p>The Trust must not carry out, or allow to be carried out, any work other than the work mentioned in paragraphs (1)(d), (e) and (f).</p>
            </content>
          </subsection>
          <subsection eId="part-5__sec-38A__subsec-3">
            <num>3</num>
            <content>
              <p>The Trust must not cause significant damage, or allow significant damage to be caused, by doing things under subsection (1).</p>
            </content>
          </subsection>
          <subsection eId="part-5__sec-38A__subsec-4">
            <num>4</num>
            <content>
              <p>The Trust must not take into account things done under subsection (1) when determining the content of draft plans.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-5__sec-38B">
          <num>38B</num>
          <heading>Transitional—leases and licences granted before plans take effect</heading>
          <subsection eId="part-5__sec-38B__subsec-1">
            <num>1</num>
            <content>
              <p>This section applies to leases and licences granted under <ref href="#sec-38A">section 38A</ref> before a plan takes effect for an area.</p>
            </content>
          </subsection>
          <subsection eId="part-5__sec-38B__subsec-2">
            <num>2</num>
            <content>
              <p>A lease or licence for a fixed term over an area of Trust land:</p>
            </content>
            <paragraph eId="part-5__sec-38B__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>must not be for a term of more than 12 months; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-38B__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>must expire <quantity refersTo="#deadline">within 18 months</quantity> after the vesting of the land in the Trust.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-5__sec-38B__subsec-3">
            <num>3</num>
            <content>
              <p>A period under a lease for a periodic tenancy:</p>
            </content>
            <paragraph eId="part-5__sec-38B__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>must not extend for more than one month; and</p>

              <p>There is to be an Executive Director of the Trust who is to be appointed by <role refersTo="#minister">the Minister</role> on the recommendation of the Trust.</p>
            </content>
          </subsection>

            <content>
              <p>A member of the Trust cannot be appointed as Executive Director.</p>
            </content>
          </subsection>
          <subsection eId="part-6__sec-39__subsec-3">
            <num>3</num>
            <content>
              <p>The appointment of a person as Executive Director is not invalid because of a defect or irregularity in connection with the person’s appointment.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-6__sec-40">
          <num>40</num>
          <heading>Duties of the Executive Director</heading>
          <content>
            <p>The Executive Director is to manage the affairs of the Trust subject to the directions of, and in accordance with policies determined by, the Trust.</p>
          </content>
        </section>
        <section eId="part-6__sec-41">
          <num>41</num>
          <heading>Term of office of Executive Director</heading>
          <subsection eId="part-6__sec-41__subsec-1">
            <num>1</num>
            <content>
              <p>The Executive Director is to be appointed on a full-time basis.</p>
            </content>
          </subsection>
          <subsection eId="part-6__sec-41__subsec-2">
            <num>2</num>
            <content>
              <p>The Executive Director holds office for the period determined by <role refersTo="#minister">the Minister</role> on the recommendation of the Trust. The period must be specified in the instrument of appointment.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-6__sec-42">
          <num>42</num>
          <heading>Acting appointments</heading>
          <subsection eId="part-6__sec-42__subsec-1">
            <num>1</num>
            <content>
              <p>The Trust may appoint a person to act as the Executive Director for a period not exceeding 3 months:</p>
            </content>
            <paragraph eId="part-6__sec-42__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>during a vacancy in the office of Executive Director (whether or not an appointment has previously been made to the office); or</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-42__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>during any period when the Executive Director is absent from duty or from Australia, or is, for any reason, unable to perform the duties of the office.</p>
              </content>

          <heading>Additional terms and conditions of appointment of Executive Director</heading>

              <p>The Executive Director holds office on the terms and conditions (if any) in relation to matters not covered by this Act that are determined by the Trust.</p>
            </content>
          </subsection>
          <subsection eId="part-6__sec-43__subsec-2">
            <num>2</num>
            <content>
              <p>However, the Trust must first request the advice of the Remuneration Tribunal in respect of the remuneration and allowances of the Executive Director.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-6__sec-44">
          <num>44</num>
          <heading>Outside employment of Executive Director</heading>
          <content>
            <p>The Executive Director must not engage in paid employment outside the duties of his or her office except with the approval of the Trust.</p>
          </content>
        </section>
        <section eId="part-6__sec-45">
          <num>45</num>
          <heading>Leave of absence</heading>
          <content>
            <p>The Chair may grant leave of absence to the Executive Director on the terms and conditions that the Chair determines.</p>
          </content>
        </section>
        <section eId="part-6__sec-46">
          <num>46</num>
          <heading>Resignation</heading>
          <content>
            <p>The Executive Director may resign his or her appointment by giving <role refersTo="#minister">the Minister</role> a written resignation.</p>
          </content>
        </section>
        <section eId="part-6__sec-47">
          <num>47</num>
          <heading>Termination of appointment of Executive Director</heading>
          <content>
            <p><role refersTo="#minister">The Minister</role> may, on the recommendation of the Trust, terminate at any time the appointment of the Executive Director.</p>

        </section>

          <num>48</num>
          <heading>Employees</heading>
          <subsection eId="part-6__sec-48__subsec-1">
            <num>1</num>
            <content>
              <p>The Trust may employ any person who it considers necessary for the performance of its functions and the exercise of its powers.</p>
            </content>
          </subsection>
          <subsection eId="part-6__sec-48__subsec-2">
            <num>2</num>
            <content>
              <p>An employee is to be employed on the terms and conditions that the Trust determines.</p>
            </content>
          </subsection>
          <subsection eId="part-6__sec-48__subsec-3">
            <num>3</num>
            <content>
              <p>The Executive Director, on behalf of the Trust, may arrange with <role refersTo="#secretary">the Secretary</role> of any Department of the Australian Public Service, or with a body of the Commonwealth, for the services of officers or employees of that Department or of that body to be made available to the Trust.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-6__sec-49">

          <heading>Consultants</heading>
          <subsection eId="part-6__sec-49__subsec-1">
            <num>1</num>
            <content>
              <p>The Trust may engage persons having suitable qualifications and experience as consultants to the Trust.</p>
            </content>
          </subsection>
          <subsection eId="part-6__sec-49__subsec-2">
            <num>2</num>
            <content>
              <p>The consultants are to be engaged on the terms and conditions that the Trust determines.</p>
            </content>
          </subsection>
        </section>
      </part>
      <part eId="part-7">
        <num>7</num>
        <heading>Meetings of the Trust</heading>
        <section eId="part-7__sec-50">
          <num>50</num>
          <heading>Times and places of meetings</heading>
          <subsection eId="part-7__sec-50__subsec-1">
            <num>1</num>
            <content>
              <p>The Trust is to hold such meetings as are necessary for the efficient performance of its functions.</p>
            </content>
          </subsection>
          <subsection eId="part-7__sec-50__subsec-2">
            <num>2</num>
            <content>
              <p>Meetings are to be held at such times and places as the Trust determines.</p>
            </content>
          </subsection>
          <subsection eId="part-7__sec-50__subsec-3">
            <num>3</num>
            <content>
              <p>The Chair may call a meeting at any time if, in his or her opinion, it is in the public interest for the Trust to consider matters urgently.</p>
            </content>
          </subsection>
          <subsection eId="part-7__sec-50__subsec-4">
            <num>4</num>
            <content>
              <p>The Chair must ensure that at least 4 meetings are held each year.</p>
            </content>
          </subsection>
          <subsection eId="part-7__sec-50__subsec-5">
            <num>5</num>
            <content>
              <p>The Chair must also ensure that:</p>
            </content>
            <paragraph eId="part-7__sec-50__subsec-5__para-a">
              <num>a</num>
              <content>
                <p>at least one of those meetings is held in each 6 month period starting on 1 January or 1 July; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-50__subsec-5__para-b">
              <num>b</num>
              <content>
                <p>that meeting is open to the public.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-7__sec-50__subsec-6">
            <num>6</num>
            <content>
              <p>A decision to meet in private must be recorded in the minutes together with the reasons for so deciding.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-7__sec-51">

          <heading>Notice of meetings</heading>

              <p>Each member is entitled to receive at least:</p>

            </paragraph>

                <p>	(b)	7 days’ written<i> </i>notice of any other meeting of the Trust.</p>

            </paragraph>

              <p>The Trust must also give at least 7 days’ notice to the public of a meeting of the Trust, unless the meeting is an urgent meeting or is not open to the public.</p>

              <p>If the Chair is not present at a meeting, the members present are to appoint a Commonwealth member to preside.</p>

            <p>A majority of the members for the time being holding office constitutes a quorum.</p>

              <p>A question is decided by a majority of the votes of the members present and voting.</p>

              <p>The person presiding at a meeting has a deliberative vote and, if necessary, also a casting vote.</p>

              <p>The Trust must keep minutes of its meetings.</p>

            <num>2</num>
            <content>
              <p>The reasons why the Chair called an urgent meeting under subsection 50(3) must be recorded in the minutes.</p>
            </content>
          </subsection>
          <subsection eId="part-7__sec-54A__subsec-3">
            <num>3</num>
            <content>
              <p>The name of each person who moves or seconds a motion must be recorded in the minutes.</p>
            </content>
          </subsection>
          <subsection eId="part-7__sec-54A__subsec-4">
            <num>4</num>
            <content>
              <p>The minutes must be made publicly available:</p>
            </content>
            <paragraph eId="part-7__sec-54A__subsec-4__para-a">
              <num>a</num>

                <p>by electronic means; and</p>

        </section>

          <heading>Conduct of meetings</heading>
          <content>
            <p>The Trust may, subject to this Part, conduct proceedings at its meetings in accordance with a written code of meeting practice.</p>
          </content>
        </section>
        <section eId="part-7__sec-56">
          <num>56</num>
          <heading>Resolutions without meetings</heading>
          <content>
            <p>If the Trust so determines, a resolution is taken to have been passed at a meeting of the Trust if:</p>
          </content>
          <paragraph eId="part-7__sec-56__para-a">
            <num>a</num>
            <content>
              <p>without meeting, a majority of the members indicate agreement with the resolution in accordance with the method determined by the Trust; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-7__sec-56__para-b">
            <num>b</num>
            <content>
              <p>that majority would have constituted a quorum at a meeting of the Trust.</p>
            </content>
          </paragraph>
        </section>

        <heading>Advisory committees</heading>

          <heading>Community advisory committees</heading>
          <subsection eId="part-8__sec-57__subsec-1">
            <num>1</num>
            <content>
              <p>The Trust must, by writing, establish a community advisory committee in respect of each plan area.</p>
            </content>
          </subsection>
          <subsection eId="part-8__sec-57__subsec-2">
            <num>2</num>
            <content>
              <p>The function of each committee is to provide advice or recommendations to the Trust on matters determined under subsection (6) relating to the relevant plan area.</p>
            </content>
          </subsection>
          <subsection eId="part-8__sec-57__subsec-3">
            <num>3</num>
            <content>
              <p>In providing that advice or making those recommendations, each committee must consider:</p>
            </content>
            <paragraph eId="part-8__sec-57__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>the relevant plan area in the context of the Sydney Harbour region; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-8__sec-57__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>the objects of the Trust and the other provisions of this Act.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-8__sec-57__subsec-4">
            <num>4</num>
            <content>
              <p>Each committee consists of:</p>
            </content>
            <paragraph eId="part-8__sec-57__subsec-4__para-a">
              <num>a</num>
              <content>
                <p>one or more representatives, appointed by the Trust, of the local community and of affected councils; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-8__sec-57__subsec-4__para-b">
              <num>b</num>
              <content>
                <p>any other person appointed by the Trust.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-8__sec-57__subsec-5">
            <num>5</num>
            <content>
              <p>A member holds office for the period specified by the Trust. The period must not exceed 3 years.</p>
            </content>
          </subsection>
          <subsection eId="part-8__sec-57__subsec-6">
            <num>6</num>
            <content>
              <p>The Trust must, after consulting a committee, give written directions to the committee on:</p>
            </content>
            <paragraph eId="part-8__sec-57__subsec-6__para-a">
              <num>a</num>
              <content>
                <p>matters in relation to which the committee is to give advice and recommendations under subsection (2); and</p>
              </content>
            </paragraph>
            <paragraph eId="part-8__sec-57__subsec-6__para-b">
              <num>b</num>
              <content>
                <p>the way in which the committee is to carry out its function; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-8__sec-57__subsec-6__para-c">
              <num>c</num>

                <p>procedures to be followed in relation to the meetings of the committee.</p>
              </content>
            </paragraph>
          </subsection>
        </section>
        <section eId="part-8__sec-57A">

          <heading>The Trust’s obligations to community advisory committees</heading>
          <subsection eId="part-8__sec-57A__subsec-1">
            <num>1</num>
            <content>
              <p>The Trust must provide each community advisory committee with documents and information relevant to matters on which the committee is to give advice or recommendations.</p>
            </content>
          </subsection>
          <subsection eId="part-8__sec-57A__subsec-2">
            <num>2</num>
            <content>
              <p>In making decisions or taking action in respect of a plan area, the Trust must consider any advice or recommendation of the relevant committee.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-8__sec-58">
          <num>58</num>
          <heading>Technical advisory committees</heading>
          <subsection eId="part-8__sec-58__subsec-1">
            <num>1</num>
            <content>
              <p>The Trust may establish one or more technical advisory committees.</p>
            </content>
          </subsection>
          <subsection eId="part-8__sec-58__subsec-2">
            <num>2</num>
            <content>
              <p>The function of a committee is to provide advice and recommendations on any or all of the following matters:</p>
            </content>
            <paragraph eId="part-8__sec-58__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>environmental and heritage matters relating to plan areas;</p>
              </content>
            </paragraph>
            <paragraph eId="part-8__sec-58__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>rehabilitation and decontamination of plan areas;</p>
              </content>
            </paragraph>
            <paragraph eId="part-8__sec-58__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>planning and management of plan areas;</p>
              </content>
            </paragraph>
            <paragraph eId="part-8__sec-58__subsec-2__para-d">
              <num>d</num>
              <content>
                <p>financial arrangements for plan areas.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-8__sec-58__subsec-3">
            <num>3</num>
            <content>
              <p>In making decisions or taking action in respect of Trust land, the Trust must consider any relevant advice or recommendation of a committee.</p>
            </content>
          </subsection>
          <subsection eId="part-8__sec-58__subsec-4">
            <num>4</num>
            <content>
              <p>Each committee consists of persons, appointed by the Trust from time to time, who have considerable qualifications or experience in relation to the matters mentioned in subsection (2).</p>
            </content>
          </subsection>
          <subsection eId="part-8__sec-58__subsec-5">
            <num>5</num>
            <content>
              <p>The Trust may give a committee written directions as to:</p>
            </content>
            <paragraph eId="part-8__sec-58__subsec-5__para-a">
              <num>a</num>

                <p>the way in which the committee is to carry out its functions; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-8__sec-58__subsec-5__para-b">
              <num>b</num>

                <p>procedures to be followed in relation to meetings.</p>
              </content>
            </paragraph>
          </subsection>
        </section>
      </part>

        <heading>Finance</heading>
        <section eId="part-9__sec-59">
          <num>59</num>
          <heading>Appropriation of money</heading>
          <subsection eId="part-9__sec-59__subsec-1">
            <num>1</num>

              <p>There is payable to the Trust such money as is appropriated by the Parliament.</p>
            </content>
          </subsection>
          <subsection eId="part-9__sec-59__subsec-2">
            <num>2</num>
            <content>
              <p>The Finance Minister may give directions as to the amounts in which, and the times at which, money referred to in subsection (1) is to be paid to the Trust.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-9__sec-60">
          <num>60</num>
          <heading>Application of money</heading>
          <subsection eId="part-9__sec-60__subsec-1">
            <num>1</num>
            <content>
              <p>The Trust’s money is to be applied only:</p>
            </content>
            <paragraph eId="part-9__sec-60__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>in payment or discharge of the expenses, charges, obligations and liabilities incurred or undertaken by the Trust in the performance of its functions and the exercise of its powers; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-9__sec-60__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>in payment or discharge of the liability imposed under <ref href="#sec-61">section 61</ref>; and</p>
              </content>
            </paragraph>

                <p>in payment of remuneration and allowances payable under this Act.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-9__sec-60__subsec-2">

              <p>	(2)	Subsection (1) does not prevent investment, under <i>Public Governance, Performance and Accountability Act 2013</i>, of money that is not immediately required for the purposes of the Trust.<ref href="#sec-59">section 59</ref> of the </p>

        </section>
        <section eId="part-9__sec-61">
          <num>61</num>
          <heading>Interim Trust costs etc.</heading>
          <subsection eId="part-9__sec-61__subsec-1">
            <num>1</num>

              <p>If, whether before or after the commencement of this Act, the Commonwealth incurs costs or liabilities in respect of the interim Trust, then the Sydney Harbour Federation Trust must pay to the Commonwealth an amount equal to those costs or liabilities.</p>
            </content>
          </subsection>
          <subsection eId="part-9__sec-61__subsec-2">
            <num>2</num>
            <content>
              <p>The amount may be recovered by the Commonwealth as a debt due to the Commonwealth in a court of competent jurisdiction.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-9__sec-62">

          <heading>Borrowing</heading>
          <subsection eId="part-9__sec-62__subsec-1">
            <num>1</num>
            <content>
              <p>The Trust may, with the approval of the Finance Minister, borrow money from the Commonwealth or persons other than the Commonwealth on terms and conditions that are specified in, or are consistent with, the approval.</p>
            </content>
          </subsection>
          <subsection eId="part-9__sec-62__subsec-2">
            <num>2</num>
            <content>
              <p>	(2)	The Finance Minister may, by written instrument, delegate any of the Finance Minister’s powers or functions under this section to an official (within the meaning of the <i>Public Governance, Performance and Accountability Act 2013</i>) of a non-corporate Commonwealth entity (within the meaning of that Act). In exercising powers or functions under a delegation, the official must comply with any directions of the Finance Minister.</p>

          </subsection>
        </section>
        <section eId="part-9__sec-63">

          <heading>Trust may give security</heading>
          <subsection eId="part-9__sec-63__subsec-1">
            <num>1</num>
            <content>
              <p>The Trust must not give security over any land mentioned in Schedule 1.</p>
            </content>
          </subsection>
          <subsection eId="part-9__sec-63__subsec-2">
            <num>2</num>
            <content>
              <p>However, the Trust may give security over:</p>
            </content>
            <paragraph eId="part-9__sec-63__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>the whole or any part of any other Trust land that is identified as suitable for sale in a plan approved under <ref href="#part-5">Part 5</ref>; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-9__sec-63__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>any other assets;</p>
              </content>
              <content>
                <p>for:</p>
              </content>
            </paragraph>

              <p>The Trust must:</p>

                <p>	(a)	give a draft statement of reasons to any community advisory committee established under <i> </i>relate to the Trust land that is the subject of the proposed lease or licence; and<ref href="#part-8">Part 8</ref> whose functions</p>

              <p>The Trust must:</p>

              <p>In finalising the statement of reasons, the Trust must:</p>
            </content>
            <paragraph eId="part-9__sec-64B__subsec-5__para-a">
              <num>a</num>
              <content>
                <p>consider any comments provided:</p>
              </content>
            </paragraph>
            <paragraph eId="part-9__sec-64B__subsec-5__para-i">
              <num>i</num>
              <content>
                <p>by the community advisory committee under subsection (2); or</p>
              </content>
            </paragraph>
            <paragraph eId="part-9__sec-64B__subsec-5__para-ii">
              <num>ii</num>
              <content>
                <p>during public consultation under subsection (3); and</p>
              </content>
            </paragraph>
            <paragraph eId="part-9__sec-64B__subsec-5__para-b">
              <num>b</num>
              <content>
                <p>include any comments provided by the community advisory committee under subsection (2); and</p>

            </paragraph>

                <p>a proposal that covers the lease or licence has been made under subsection (2); and</p>
              </content>
            </paragraph>

                <p>	(b)	the time for each House to disallow the proposal under <i>Legislation Act 2003</i> has passed and neither House disallowed the proposal.<ref href="#part-2">Part 2</ref> of Chapter 3 of the </p>

              <p>For the purposes of paragraph (1)(a), a proposal covers a lease or licence if:</p>
            </content>
            <paragraph eId="part-9__sec-64C__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>the lessee or licensee, and the land the subject of the lease or licence, was specified in the proposal; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-9__sec-64C__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>the period of the lease or licence does not exceed the maximum period specified in the proposal; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-9__sec-64C__subsec-3__para-c">
              <num>c</num>
              <content>
                <p>the uses of the land permitted by the lease or licence were specified in the proposal.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-9__sec-64C__subsec-4">
            <num>4</num>

              <p>	(4)	In addition to the requirements under subsection 15J(2) of the <i>Legislation Act 2003</i>, the Trust must ensure that the explanatory statement for the proposal includes the statement of reasons prepared under section 64B for the lease or licence covered by the proposal.</p>
            </content>
          </subsection>
          <subsection eId="part-9__sec-64C__subsec-5">
            <num>5</num>
            <content>
              <p>	(5)	The Trust must, as soon as practicable after the proposal is registered on the Federal Register of Legislation under the <i>Legislation Act 2003</i>, publish a notice of this fact on the Trust’s website.</p>

          </subsection>
        </section>

          <num>64D</num>
          <heading>Leases and licences over 25 years—Minister’s approval</heading>
          <subsection eId="part-9__sec-64D__subsec-1">
            <num>1</num>

              <p>The Trust must not, except with <role refersTo="#minister">the Minister</role>’s written approval, enter into a lease or licence over Trust land for a period that is longer than 25 years, and not longer than 35 years.</p>

              <content>
                <p>the objects of the Trust set out in <ref href="#sec-6">section 6</ref>; and</p>
              </content>
            </paragraph>

              <num>b</num>
              <content>
                <p>plans approved under <ref href="#part-5">Part 5</ref>; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-9__sec-64D__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>a proposal that covers the lease or licence under <ref href="#sec-64C">section 64C</ref>.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-9__sec-64D__subsec-3">
            <num>3</num>
            <content>
              <p>In considering whether the terms and conditions of the proposed lease or licence are consistent with the matters in paragraphs (2)(a) and (b), <role refersTo="#minister">the Minister</role> must have regard to the statement of reasons prepared under section 64B for the proposed lease or licence.</p>

          </subsection>
        </section>

          <heading>Liability to taxation</heading>
          <content>
            <p>The Trust is not subject to taxation under a law of the Commonwealth or of a State or a Territory.</p>
          </content>
        </section>

        <heading>Compliance and enforcement</heading>
        <section eId="part-9A__sec-65A">
          <num>65A</num>
          <heading>Simplified outline of Part</heading>
          <content>
            <p>This Part deals with the compliance and enforcement powers of the Trust.</p>
            <p>The Trust may order a person to cease promoting, conducting or carrying out an activity on Trust land, or to do, or not do, specified things in relation to the activity. If a person fails to comply with an order, the Trust may do anything necessary or convenient to give effect to the order, including any work required by the order.</p>
            <p>A person can be given an infringement notice under Part 5 of the Regulatory Powers Act for contravening a strict liability offence provision of this Act or the regulations. A person who is given an infringement notice can choose to pay an amount as an alternative to proceedings being brought against the person for the contravention. If the person does not choose to pay the amount, proceedings can be brought against the person in relation to the contravention.</p>
          </content>
        </section>
        <section eId="part-9A__sec-65B">
          <num>65B</num>
          <heading>Trust may give orders</heading>
          <subsection eId="part-9A__sec-65B__subsec-1">
            <num>1</num>
            <content>
              <p>Subject to this section and to <ref href="#sec-65C">section 65C</ref>, the Trust may order any person engaged in promoting, conducting or carrying out an activity on Trust land:</p>
            </content>
            <paragraph eId="part-9A__sec-65B__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>to cease promoting, conducting or carrying out the activity; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-9A__sec-65B__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>to do, or not to do, such things, in relation to the activity, as are specified in the order and in a way, if any, specified in the order.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-9A__sec-65B__subsec-2">
            <num>2</num>
            <content>
              <p>The Trust may give an order under subsection (1) only if any of the circumstances mentioned in subsection (3) exist.</p>
            </content>
          </subsection>
          <subsection eId="part-9A__sec-65B__subsec-3">
            <num>3</num>
            <content>
              <p>For the purposes of subsection (2), the circumstances are that the Trust reasonably believes that the activity:</p>
            </content>
            <paragraph eId="part-9A__sec-65B__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>contravenes this Act or the regulations; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-9A__sec-65B__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>contravenes a condition of a licence or permit granted to the person; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-9A__sec-65B__subsec-3__para-c">
              <num>c</num>
              <content>
                <p>constitutes, or is likely to constitute, a public hazard or a threat to public health or safety; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-9A__sec-65B__subsec-3__para-d">
              <num>d</num>
              <content>
                <p>is causing, or is likely to cause, pollution or environmental damage, or further pollution or environmental damage, on Trust land or elsewhere.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-9A__sec-65B__subsec-4">
            <num>4</num>
            <content>
              <p>If an order is made under paragraph (1)(a) in respect of an activity, an order may be made under paragraph (1)(b) in respect of the same activity.</p>
            </content>
          </subsection>
          <subsection eId="part-9A__sec-65B__subsec-5">
            <num>5</num>
            <content>
              <p>Without limiting paragraph (1)(b), an order may be given under that paragraph to:</p>
            </content>
            <paragraph eId="part-9A__sec-65B__subsec-5__para-a">
              <num>a</num>
              <content>
                <p>demolish, repair or remove a structure on Trust land; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-9A__sec-65B__subsec-5__para-b">
              <num>b</num>

                <p>collect, remove or dispose of any plant, noxious substance, litter, refuse or waste on Trust land; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-9A__sec-65B__subsec-5__para-c">

                <p>repair any environmental damage on Trust land.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-9A__sec-65B__subsec-6">

              <p>Applications may be made to the Administrative Review Tribunal for review of decisions of the Trust under this section to give an order.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-9A__sec-65C">

          <heading>Form etc. of order</heading>
          <subsection eId="part-9A__sec-65C__subsec-1">
            <num>1</num>
            <content>
              <p>An order given under <ref href="#sec-65B">section 65B</ref> must be in writing.</p>
            </content>
          </subsection>
          <subsection eId="part-9A__sec-65C__subsec-2">
            <num>2</num>
            <content>
              <p>Subject to subsection (3), the order must specify a reasonable period within which the terms of the order are to be complied with.</p>

          </subsection>

              <p>An order may require immediate compliance in circumstances where there is:</p>

                <p>the Trust may do anything necessary or convenient to give effect to the order, including any work required by the order.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-9A__sec-65E__subsec-2">
            <num>2</num>
            <content>
              <p>If the Trust incurs costs because of anything done under subsection (1), the person is liable to pay to the Trust, on behalf of the Commonwealth, an amount equal to so much of those costs as are reasonable.</p>
            </content>
          </subsection>
          <subsection eId="part-9A__sec-65E__subsec-3">
            <num>3</num>
            <content>
              <p>An amount under subsection (2) may be recovered by the Trust as a debt due to the Trust, on behalf of the Commonwealth, in:</p>
            </content>

              <num>a</num>
              <content>
                <p>the Federal Court of Australia; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-9A__sec-65E__subsec-3__para-b">
              <num>b</num>

                <p>the Federal Circuit and Family Court of Australia (<ref href="#dvs-2">Division 2</ref>); or</p>
              </content>
            </paragraph>
            <paragraph eId="part-9A__sec-65E__subsec-3__para-c">
              <num>c</num>
              <content>
                <p>a court of a State or Territory that has jurisdiction in relation to the matter.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-9A__sec-65E__subsec-4">
            <num>4</num>
            <content>
              <p>The Trust may destroy or otherwise dispose of any structure, materials or other thing removed under this section.</p>
            </content>
          </subsection>
          <subsection eId="part-9A__sec-65E__subsec-5">
            <num>5</num>
            <content>
              <p>The Trust may exercise its functions or powers under this section whether or not the person referred to in subsection (1) has been prosecuted for an offence under <ref href="#sec-65D">section 65D</ref>.</p>

          <heading>Infringement notices</heading>
          <content>
            <p>Provisions subject to an infringement notice</p>
          </content>
          <subsection eId="part-9A__sec-65F__subsec-1">

              <p>A strict liability offence against this Act or the regulations is subject to an infringement notice under Part 5 of the Regulatory Powers Act.</p>

              <p>For the purposes of Part 5 of the Regulatory Powers Act, a ranger (within the meaning of the regulations) is an infringement officer in relation to the provisions mentioned in subsection (1).</p>

              <p>Relevant chief executive</p>
            </content>
          </subsection>
          <subsection eId="part-9A__sec-65F__subsec-3">
            <num>3</num>
            <content>
              <p>For the purposes of Part 5 of the Regulatory Powers Act, the Executive Director is the relevant chief executive in relation to the provisions mentioned in subsection (1).</p>
            </content>
          </subsection>
          <subsection eId="part-9A__sec-65F__subsec-4">
            <num>4</num>
            <content>
              <p>The relevant chief executive may, in writing, delegate the powers and functions mentioned in subsection (5) to a Trust officer (within the meaning of the regulations).</p>
            </content>
          </subsection>
          <subsection eId="part-9A__sec-65F__subsec-5">
            <num>5</num>
            <content>
              <p>The powers and functions that may be delegated are the powers and functions of the relevant chief executive under the following provisions of the Regulatory Powers Act:</p>
            </content>
            <paragraph eId="part-9A__sec-65F__subsec-5__para-a">
              <num>a</num>
              <content>
                <p><ref href="#sec-105">section 105</ref> (extension of time to pay amount);</p>
              </content>
            </paragraph>
            <paragraph eId="part-9A__sec-65F__subsec-5__para-b">
              <num>b</num>
              <content>
                <p><ref href="#sec-106">section 106</ref> (withdrawal of an infringement notice).</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-9A__sec-65F__subsec-6">
            <num>6</num>
            <content>
              <p>A person exercising powers or performing functions under a delegation under subsection (4) must comply with any directions of the relevant chief executive.</p>
            </content>
            <content>
              <p>Matters to be included in infringement notices</p>
            </content>
          </subsection>
          <subsection eId="part-9A__sec-65F__subsec-7">
            <num>7</num>
            <content>
              <p>Paragraph 104(1)(c) of the Regulatory Powers Act does not apply in relation to an infringement notice for an alleged contravention of a provision mentioned in subsection (1) involving a vehicle or a vessel (within the meaning of the regulations) if the notice is served in accordance with paragraph 65G(1)(b) of this Act.</p>

          </subsection>
          <subsection eId="part-9A__sec-65F__subsec-8">
            <num>8</num>
            <content>
              <p>Paragraph 104(1)(d) of the Regulatory Powers Act does not apply in relation to an infringement notice for an alleged contravention of a provision mentioned in subsection (1) to the extent that paragraph requires the infringement notice to state the name and contact details of the person who gave the notice.</p>
            </content>
          </subsection>
          <subsection eId="part-9A__sec-65F__subsec-9">
            <num>9</num>
            <content>
              <p>In addition to the matters included in subsection 104(1) of the Regulatory Powers Act, an infringement notice given in relation to an alleged contravention of a provision mentioned in subsection (1) must also include the following:</p>
            </content>
            <paragraph eId="part-9A__sec-65F__subsec-9__para-a">
              <num>a</num>
              <content>
                <p>the ranger identification number (within the meaning of the regulations) of the infringement officer who issued the notice;</p>
              </content>
            </paragraph>
            <paragraph eId="part-9A__sec-65F__subsec-9__para-b">
              <num>b</num>
              <content>
                <p>the contact details of the relevant chief executive;</p>
              </content>
            </paragraph>
            <paragraph eId="part-9A__sec-65F__subsec-9__para-c">
              <num>c</num>
              <content>
                <p>if a vehicle or a vessel (within the meaning of the regulations) was involved in the alleged contravention—the registration number of the vehicle or vessel;</p>
              </content>
            </paragraph>
            <paragraph eId="part-9A__sec-65F__subsec-9__para-d">
              <num>d</num>
              <content>
                <p>any other information that the relevant chief executive considers necessary.</p>
              </content>
            </paragraph>
          </subsection>
        </section>
        <section eId="part-9A__sec-65G">
          <num>65G</num>
          <heading>Infringement notices—serving notices for contraventions involving vehicles or vessels</heading>
          <subsection eId="part-9A__sec-65G__subsec-1">
            <num>1</num>
            <content>
              <p>For an alleged contravention of a provision mentioned in subsection 65F(1) involving a vehicle or a vessel (within the meaning of the regulations), an infringement notice may be served:</p>
            </content>
            <paragraph eId="part-9A__sec-65G__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>personally on a person who appears to be in charge of the vehicle or vessel; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-9A__sec-65G__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>by securely placing the notice on the vehicle or vessel in a conspicuous place; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-9A__sec-65G__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>by posting it to the address of the person who is registered as the owner or operator of the vehicle or vessel; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-9A__sec-65G__subsec-1__para-d">
              <num>d</num>
              <content>
                <p>if a statutory declaration has been given to a Trust officer under the regulations naming a person as being in charge of the vehicle or vessel at the time of the alleged contravention—personally on that person, or by posting it to the address of the person given in the statutory declaration.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-9A__sec-65G__subsec-2">
            <num>2</num>
            <content>
              <p>A person commits an offence of strict liability if:</p>
            </content>
            <paragraph eId="part-9A__sec-65G__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>an infringement notice is placed on a vehicle or vessel under paragraph (1)(b); and</p>
              </content>
            </paragraph>
            <paragraph eId="part-9A__sec-65G__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>the person removes, defaces or interferes with the infringement notice; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-9A__sec-65G__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>the person is not:</p>
              </content>
            </paragraph>
            <paragraph eId="part-9A__sec-65G__subsec-2__para-i">
              <num>i</num>
              <content>
                <p>in charge of the vehicle or vessel; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-9A__sec-65G__subsec-2__para-ii">
              <num>ii</num>
              <content>
                <p>registered as the owner or operator of the vehicle or vessel; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-9A__sec-65G__subsec-2__para-iii">
              <num>iii</num>
              <content>
                <p>authorised to do so by the person in charge of the vehicle or vessel; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-9A__sec-65G__subsec-2__para-iv">
              <num>iv</num>
              <content>
                <p>authorised to do so by the person registered as the owner or operator of the vehicle or vessel.</p>
              </content>
              <hcontainer name="penalty">
                <content>

            </paragraph>
          </subsection>
        </section>
        <section eId="part-9A__sec-65H">
          <num>65H</num>
          <heading>Infringement notices—evidentiary certificates</heading>
          <subsection eId="part-9A__sec-65H__subsec-1">
            <num>1</num>
            <content>
              <p>The Executive Director may sign a certificate that states any of the following in relation to an infringement notice served on a person:</p>
            </content>
            <paragraph eId="part-9A__sec-65H__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>that the amount payable under the infringement notice was not paid by the person within the time specified in the notice;</p>
              </content>
            </paragraph>
            <paragraph eId="part-9A__sec-65H__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>that the Executive Director granted, or refused to grant, an extension of time to the person to pay the amount payable under the infringement notice;</p>
              </content>
            </paragraph>
            <paragraph eId="part-9A__sec-65H__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>that the amount payable under the infringement notice was not paid by the person within the period specified in the extension;</p>
              </content>
            </paragraph>
            <paragraph eId="part-9A__sec-65H__subsec-1__para-d">
              <num>d</num>
              <content>
                <p>that the infringement notice was withdrawn under <ref href="#sec-106">section 106</ref> of the Regulatory Powers Act on a day specified in the certificate.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-9A__sec-65H__subsec-2">
            <num>2</num>
            <content>
              <p>At a hearing of a prosecution for an offence mentioned in an infringement notice, a certificate signed by the Executive Director in accordance with subsection (1) is prima facie evidence of the matters stated in the certificate.</p>
            </content>
          </subsection>
          <subsection eId="part-9A__sec-65H__subsec-3">
            <num>3</num>
            <content>
              <p>A certificate must not be admitted in evidence at a hearing of a prosecution for an offence mentioned in an infringement notice unless:</p>
            </content>
            <paragraph eId="part-9A__sec-65H__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>the person charged with the offence; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-9A__sec-65H__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>a barrister or solicitor who has appeared for the person in relation to the hearing;</p>
              </content>
              <content>
                <p>has, at least 14 days before the certificate is sought to be so admitted, been given a copy of the certificate together with notice of the intention to produce the certificate as evidence in the hearing.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-9A__sec-65H__subsec-4">
            <num>4</num>
            <content>
              <p>A certificate that purports to be signed by the Executive Director is taken to have been signed by the Executive Director unless the contrary is proved.</p>
            </content>
          </subsection>
        </section>

        <heading>Miscellaneous</heading>
        <section eId="part-11__sec-70">
          <num>70</num>
          <heading>Annual report</heading>
          <content>
            <p>		The annual report prepared by the members and given to the Minister under <i>Public Governance, Performance and Accountability Act 2013</i> for a period<i> </i>must also include:<ref href="#sec-46">section 46</ref> of the </p>
          </content>
          <paragraph eId="part-11__sec-70__para-a">
            <num>a</num>
            <content>
              <p>a description of the condition of plan areas at the end of the period; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-11__sec-70__para-b">
            <num>b</num>
            <content>
              <p>the text of all directions, and reasons for directions, given by <role refersTo="#minister">the Minister</role> to the Trust under section 9 during the period.</p>
            </content>
          </paragraph>
        </section>

          <heading>Corporate plan</heading>
          <content>
            <p>		Subsection 35(3) of the <i>Public Governance, Performance and Accountability Act 2013</i> (which deals with the Australian Government’s key priorities and objectives) does not apply to a corporate plan prepared by the members.</p>
          </content>
        </section>
        <section eId="part-11__sec-70A">
          <num>70A</num>
          <heading>Fees for documents</heading>
          <content>
            <p>The Trust may charge a reasonable fee for copies of the following documents:</p>
          </content>
          <paragraph eId="part-11__sec-70A__para-a">
            <num>a</num>
            <content>
              <p>draft plans and plans approved under <ref href="#part-5">Part 5</ref>;</p>
            </content>
          </paragraph>
          <paragraph eId="part-11__sec-70A__para-b">
            <num>b</num>
            <content>
              <p>submissions made under <ref href="#part-5">Part 5</ref> on:</p>
            </content>
          </paragraph>
          <paragraph eId="part-11__sec-70A__para-i">
            <num>i</num>
            <content>
              <p>proposals to prepare draft plans; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-11__sec-70A__para-ii">
            <num>ii</num>
            <content>
              <p>draft plans; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-11__sec-70A__para-iii">
            <num>iii</num>
            <content>
              <p>amendments to draft plans;</p>
            </content>
          </paragraph>
          <paragraph eId="part-11__sec-70A__para-c">
            <num>c</num>

              <p>any other documents made available by the Trust.</p>

        </section>
        <section eId="part-11__sec-71">

          <heading>Exemption from certain State laws</heading>
          <subsection eId="part-11__sec-71__subsec-1">
            <num>1</num>
            <content>
              <p>An excluded State law does not apply, and is taken never to have applied, in relation to:</p>
            </content>
            <paragraph eId="part-11__sec-71__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>the Trust; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-11__sec-71__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>the property (including Trust land) or transactions of the Trust; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-11__sec-71__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>anything done by or on behalf of the Trust.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-11__sec-71__subsec-2">
            <num>2</num>
            <content>
              <p>In this section:</p>

              <p><b><i>excluded State law</i></b> means a law of a State, including a law of a State that is applied to a Commonwealth place<i> </i>by virtue of the <i>Commonwealth Places (Application of Laws) Act 1970</i>, that<i> </i>relates to any of the following matters:</p>

                <p><b><i>law</i></b> means a written law, and includes:</p>

                <p>subordinate legislation; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-11__sec-71__subsec-2__para-b">

          </subsection>
        </section>
        <section eId="part-11__sec-72">

          <heading>Delegation</heading>
          <subsection eId="part-11__sec-72__subsec-1">
            <num>1</num>
            <content>
              <p>The Trust may, by writing, delegate to:</p>
            </content>
            <paragraph eId="part-11__sec-72__subsec-1__para-a">
              <num>a</num>
              <content>
                <p><i>	</i>(a)	the Executive Director; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-11__sec-72__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>an SES employee of the Department; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-11__sec-72__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>a person employed under <ref href="#sec-48">section 48</ref>;</p>
              </content>
              <content>
                <p>all or any of the functions and powers conferred on the Trust by this Act.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-11__sec-72__subsec-2">
            <num>2</num>
            <content>
              <p>The Executive Director must report at least once every 6 months on the exercise of delegated functions and powers.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-11__sec-73">
          <num>73</num>
          <heading>Regulations</heading>
          <subsection eId="part-11__sec-73__subsec-1">
            <num>1</num>
            <content>
              <p>The Governor-General may make regulations prescribing matters:</p>
            </content>
            <paragraph eId="part-11__sec-73__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>required or permitted by this Act to be prescribed; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-11__sec-73__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>necessary or convenient to be prescribed for carrying out or giving effect to this Act.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-11__sec-73__subsec-2">
            <num>2</num>
            <content>
              <p>In particular, the regulations may make provision relating to any of the following:</p>
            </content>
            <paragraph eId="part-11__sec-73__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>conferring functions on the Trust for the purposes of the regulations;</p>
              </content>
            </paragraph>
            <paragraph eId="part-11__sec-73__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>the content of plans;</p>
              </content>
            </paragraph>
            <paragraph eId="part-11__sec-73__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>giving effect to, and enforcing the observance of, plans;</p>
              </content>
            </paragraph>
            <paragraph eId="part-11__sec-73__subsec-2__para-d">
              <num>d</num>
              <content>
                <p>the way in which proposed land uses are identified in draft plans;</p>
              </content>
            </paragraph>
            <paragraph eId="part-11__sec-73__subsec-2__para-e">
              <num>e</num>
              <content>
                <p>services and facilities in, or in connection with, Trust land;</p>
              </content>
            </paragraph>
            <paragraph eId="part-11__sec-73__subsec-2__para-f">
              <num>f</num>
              <content>
                <p>charging of fees by the Trust in respect of services or facilities provided by the Trust in or in connection with Trust land;</p>
              </content>
            </paragraph>
            <paragraph eId="part-11__sec-73__subsec-2__para-g">
              <num>g</num>
              <content>
                <p>protecting and conserving the environmental and heritage values of Trust land;</p>
              </content>
            </paragraph>
            <paragraph eId="part-11__sec-73__subsec-2__para-h">
              <num>h</num>
              <content>
                <p>removing persons unlawfully on Trust land or committing offences against regulations on Trust land;</p>
              </content>
            </paragraph>
            <paragraph eId="part-11__sec-73__subsec-2__para-i">

                <p>regulating conduct of persons on Trust land;</p>
              </content>
            </paragraph>
            <paragraph eId="part-11__sec-73__subsec-2__para-j">

                <p>regulating or prohibiting carrying on any trade or commerce on Trust land;</p>

            </paragraph>
            <paragraph eId="part-11__sec-73__subsec-2__para-k">

                <p>removing unauthorised structures from Trust land;</p>

            </paragraph>
            <paragraph eId="part-11__sec-73__subsec-2__para-l">

                <p>granting or issuing licences, permissions, permits and authorities in respect of Trust land;</p>

            </paragraph>

                <p>the conditions subject to which licences, permissions, permits and authorities are granted or issued;</p>
              </content>
            </paragraph>

                <p>charging of fees by the Trust in respect of such licences, permissions, permits and authorities;</p>
              </content>
            </paragraph>

                <p>penalties for offences against the regulations by way of fines of no more than <quantity refersTo="#penaltyUnit">10 penalty units</quantity>;</p>

              <b>Editorial changes</b>
            </p>
            <p>The <i>Legislation Act 2003</i> authorises First Parliamentary Counsel to make editorial and presentational changes to a compiled law in preparing a compilation of the law for registration. The changes must not change the effect of the law. Editorial changes take effect from the compilation registration date.</p>
            <p>If the compilation includes editorial changes, the endnotes include a brief outline of the changes in general terms. Full details of any changes can be obtained from the Office of Parliamentary Counsel.</p>

              <b>Misdescribed amendments</b>
            </p>
            <p>A misdescribed amendment is an amendment that does not accurately describe how an amendment is to be made. If, despite the misdescription, the amendment can be given effect as intended, then the misdescribed amendment can be incorporated through an editorial change made under <i>Legislation Act 2003</i>.<ref href="#sec-15V">section 15V</ref> of the </p>
            <p>If a misdescribed amendment cannot be given effect as intended, the amendment is not incorporated and “(md not incorp)” is added to the amendment history.</p>
