        <num>1</num>
        <heading>Short title</heading>
        <content>
          <p>		This Act may be cited as the <i>Medical Indemnity Agreement (Financial Assistance—Binding Commonwealth Obligations) Act 2002</i>.</p>
        </content>
      </section>
      <section eId="sec-2">
        <num>2</num>
        <heading>Commencement</heading>
        <content>
          <p>This Act commences on the day on which it receives the Royal Assent.</p>
        </content>
      </section>
      <section eId="sec-3">
        <num>3</num>
        <heading>Definitions</heading>
        <content>
          <p>In this Act:</p>
          <p><term refersTo="#term-insolvency-representative">insolvency representative</term> means <def>any of the following (whether in a representative capacity or a personal capacity): a liquidator or provisional liquidator of the company; a receiver, or receiver and manager, of property of the company; an administrator of the company; an administrator of a deed of company arrangement executed by the company; a trustee or other person administering a compromise or arrangement made between the company and any other person or persons.</def></p>
        </content>
        <paragraph eId="sec-3__para-a">
          <num>a</num>
          <content>
            <p>a liquidator or provisional liquidator of the company;</p>
          </content>
        </paragraph>
        <paragraph eId="sec-3__para-b">
          <num>b</num>
          <content>
            <p>a receiver, or receiver and manager, of property of the company;</p>
          </content>
        </paragraph>
        <paragraph eId="sec-3__para-c">
          <num>c</num>
          <content>
            <p>an administrator of the company;</p>
          </content>
        </paragraph>
        <paragraph eId="sec-3__para-d">
          <num>d</num>
          <content>
            <p>an administrator of a deed of company arrangement executed by the company;</p>
          </content>
        </paragraph>
        <paragraph eId="sec-3__para-e">
          <num>e</num>
          <content>
            <p>a trustee or other person administering a compromise or arrangement made between the company and any other person or persons.</p>
          </content>
          <content>
            <p><b><i>Medical Indemnity Agreement</i></b> means:</p>
          </content>
        </paragraph>
        <paragraph eId="sec-3__para-a">
          <num>a</num>
          <content>
            <p>an agreement, known as an Indemnity Agreement, that is between:</p>
          </content>
        </paragraph>
        <paragraph eId="sec-3__para-i">
          <num>i</num>
          <content>
            <p>the Commonwealth; and</p>
          </content>
        </paragraph>
        <paragraph eId="sec-3__para-ii">
          <num>ii</num>
          <content>
            <p>Australasian Medical Insurance Limited; and</p>
          </content>
        </paragraph>
        <paragraph eId="sec-3__para-iii">
          <num>iii</num>
          <content>
            <p>United Medical Protection Limited; and</p>
          </content>
        </paragraph>
        <paragraph eId="sec-3__para-iv">
          <num>iv</num>
          <content>
            <p>an insolvency representative of both of those companies; or</p>
          </content>
        </paragraph>
        <paragraph eId="sec-3__para-b">
          <num>b</num>
          <content>
            <p>if the agreement has been amended—the agreement as amended.</p>
          </content>
        </paragraph>
      </section>
      <section eId="sec-4">
        <num>4</num>
        <heading>Payments under a Medical Indemnity Agreement</heading>
        <content>
          <p>Australasian Medical Insurance Limited</p>
        </content>
        <subsection eId="sec-4__subsec-1">
          <num>1</num>
          <content>
            <p>The Commonwealth must pay to Australasian Medical Insurance Limited the amounts (if any) required to be paid to it by the Commonwealth under a Medical Indemnity Agreement.</p>
          </content>
        </subsection>
        <subsection eId="sec-4__subsec-2">
          <num>2</num>
          <content>
            <p>The Commonwealth must pay to an insolvency representative of Australasian Medical Insurance Limited the amounts (if any) required to be paid to the insolvency representative by the Commonwealth under a Medical Indemnity Agreement.</p>
          </content>
          <content>
            <p>United Medical Protection Limited</p>
          </content>
        </subsection>
        <subsection eId="sec-4__subsec-3">
          <num>3</num>
          <content>
            <p>The Commonwealth must pay to United Medical Protection Limited the amounts (if any) required to be paid to it by the Commonwealth under a Medical Indemnity Agreement.</p>
          </content>
        </subsection>
        <subsection eId="sec-4__subsec-4">
          <num>4</num>
          <content>
            <p>The Commonwealth must pay to an insolvency representative of United Medical Protection Limited the amounts (if any) required to be paid to the insolvency representative by the Commonwealth under a Medical Indemnity Agreement.</p>
          </content>
          <content>
            <p>Other payments</p>
          </content>
        </subsection>
        <subsection eId="sec-4__subsec-5">
          <num>5</num>
          <content>
            <p>The Commonwealth must pay to a person other than:</p>
          </content>
          <paragraph eId="sec-4__subsec-5__para-a">
            <num>a</num>
            <content>
              <p>Australasian Medical Insurance Limited; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-4__subsec-5__para-b">
            <num>b</num>
            <content>
              <p>an insolvency representative of Australasian Medical Insurance Limited; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-4__subsec-5__para-c">
            <num>c</num>
            <content>
              <p>United Medical Protection Limited; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-4__subsec-5__para-d">
            <num>d</num>
            <content>
              <p>an insolvency representative of United Medical Protection Limited;</p>
            </content>
            <content>
              <p>the amounts (if any) required to be paid to the person by the Commonwealth under a Medical Indemnity Agreement.</p>
            </content>
          </paragraph>
        </subsection>
      </section>
      <section eId="sec-5">
        <num>5</num>
        <heading>Appropriation</heading>
        <content>
          <p>The Consolidated Revenue Fund is appropriated for the purposes of <ref href="#sec-4">section 4</ref>.</p>
        </content>
      </section>
      <section eId="sec-6">
        <num>6</num>
        <heading>Tabling of Ministerial statement about payments</heading>
        <subsection eId="sec-6__subsec-1">
          <num>1</num>
          <content>
            <p>This section applies if, during a particular financial year, one or more payments are made by the Commonwealth to:</p>
          </content>
          <paragraph eId="sec-6__subsec-1__para-a">
            <num>a</num>
            <content>
              <p>Australasian Medical Insurance Limited; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-6__subsec-1__para-b">
            <num>b</num>
            <content>
              <p>an insolvency representative of Australasian Medical Insurance Limited; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-6__subsec-1__para-c">
            <num>c</num>
            <content>
              <p>United Medical Protection Limited; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-6__subsec-1__para-d">
            <num>d</num>
            <content>
              <p>an insolvency representative of United Medical Protection Limited; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-6__subsec-1__para-e">
            <num>e</num>
            <content>
              <p>any other person;</p>
            </content>
            <content>
              <p>under a Medical Indemnity Agreement.</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-6__subsec-2">
          <num>2</num>
          <content>
            <p>As soon as practicable after the end of the financial year, <role refersTo="#minister">the Minister</role> must cause to be prepared a statement about the payments.</p>
          </content>
        </subsection>
        <subsection eId="sec-6__subsec-3">
          <num>3</num>
          <content>
            <p><role refersTo="#minister">The Minister</role> must cause a copy of the statement to be tabled in each House of the Parliament within 15 sitting days of that House after the completion of the preparation of the report.</p>
          </content>
        </subsection>
      </section>
      <section eId="sec-7">
        <num>7</num>
        <heading>Tabling of Medical Indemnity Agreements etc.</heading>
        <content>
          <p>Medical Indemnity Agreements</p>
        </content>
        <subsection eId="sec-7__subsec-1">
          <num>1</num>
          <content>
            <p><role refersTo="#minister">The Minister</role> must cause a copy of a Medical Indemnity Agreement to be tabled in each House of the Parliament within 15 sitting days of that House after:</p>
          </content>
          <paragraph eId="sec-7__subsec-1__para-a">
            <num>a</num>
            <content>
              <p>the commencement of this section; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-7__subsec-1__para-b">
            <num>b</num>
            <content>
              <p>the agreement is entered into;</p>
            </content>
            <content>
              <p>whichever is later.</p>
              <p>Amending agreements</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-7__subsec-2">
          <num>2</num>
          <content>
            <p><role refersTo="#minister">The Minister</role> must cause a copy of an agreement that amends a Medical Indemnity Agreement to be tabled in each House of the Parliament within 15 sitting days of that House after:</p>
          </content>
          <paragraph eId="sec-7__subsec-2__para-a">
            <num>a</num>
            <content>
              <p>the commencement of this section; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-7__subsec-2__para-b">
            <num>b</num>
            <content>
              <p>the amending agreement is entered into;</p>
            </content>
            <content>
              <p>whichever is later.</p>
            </content>
          </paragraph>
        </subsection>
      </section>
      <section eId="sec-8">
        <num>8</num>
        <heading>Contents of Medical Indemnity Agreement</heading>
        <content>
          <p>To avoid doubt, this Act does not, by implication, prevent a Medical Indemnity Agreement from containing provisions relating to matters other than indemnities.</p>
