          <heading>Object of Act</heading>
          <content>
            <p>The object of this Act is to address concerns, including ethical concerns, about scientific developments in relation to human reproduction and the utilisation of human embryos by prohibiting certain practices.</p>
          </content>
        </section>
        <section eId="part-1__sec-4">
          <num>4</num>
          <heading>Operation of Act</heading>
          <subsection eId="part-1__sec-4__subsec-1">
            <num>1</num>
            <content>
              <p>This Act applies as follows:</p>
            </content>
            <paragraph eId="part-1__sec-4__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>to things done, or omitted to be done, by constitutional corporations;</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>to things done, or omitted to be done, in the course of constitutional trade or commerce;</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>to matters within the legislative power of the Commonwealth under paragraph 51(xxix) of the Constitution;</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-1__para-d">
              <num>d</num>
              <content>
                <p>to the Commonwealth and Commonwealth authorities;</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-1__para-e">

                <p>for purposes relating to the collection, compilation, analysis and dissemination of statistics;</p>

                <p>to matters within the legislative power of the Commonwealth under paragraph 51(xxxix) of the Constitution, so far as it relates to the matters mentioned in paragraphs (a) to (e) of this subsection.</p>

            <num>2</num>
            <content>
              <p>In this section:</p>
            </content>
            <content>
              <p><b><i>constitutional corporation</i></b> means a trading, foreign or financial corporation within the meaning of paragraph 51(xx) of the Constitution.</p>
              <p><b><i>constitutional trade or commerce</i></b> means trade or commerce:</p>
            </content>
            <paragraph eId="part-1__sec-4__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>between  and places outside ; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>among the States; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>by way of the supply of services to the Commonwealth or to a Commonwealth authority.</p>
              </content>
            </paragraph>
          </subsection>
        </section>
        <section eId="part-1__sec-5">
          <num>5</num>
          <heading>Act to bind the Crown</heading>
          <subsection eId="part-1__sec-5__subsec-1">
            <num>1</num>
            <content>
              <p>This Act binds the Crown in each of its capacities.</p>
            </content>
          </subsection>
          <subsection eId="part-1__sec-5__subsec-2">
            <num>2</num>
            <content>
              <p>Nothing in this Act renders the Crown liable to be prosecuted for an offence.</p>
            </content>
            <content>
              <p>6</p>
              <p>This Act extends to every external Territory.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-1__sec-8">
          <num>8</num>
          <heading>Definitions</heading>
          <subsection eId="part-1__sec-8__subsec-1">
            <num>1</num>
            <content>
              <p>In this Act:</p>
            </content>
            <content>
              <p><b><i>animal</i></b> does not include a human.</p>
              <p><b><i>chimeric embryo</i></b> means:</p>
            </content>
            <paragraph eId="part-1__sec-8__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>a human embryo into which a cell, or any component part of a cell, of an animal has been introduced; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-8__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>a thing declared by the regulations to be a chimeric embryo.</p>
              </content>
              <content>
                <p><term refersTo="#term-commonwealth-authority">Commonwealth authority</term> means <def>the following: a body corporate established for a public purpose by or under an Act; a company in which a controlling interest is held by any one of the following persons, or by 2 or more of the following persons together: the Commonwealth; a body covered by paragraph (a); a body covered by either of the above subparagraphs.</def></p>

            </paragraph>
            <paragraph eId="part-1__sec-8__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>a body corporate established for a public purpose by or under an Act;</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-8__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>a company in which a controlling interest is held by any one of the following persons, or by 2 or more of the following persons together:</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-8__subsec-1__para-i">
              <num>i</num>
              <content>
                <p>the Commonwealth;</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-8__subsec-1__para-ii">
              <num>ii</num>
              <content>
                <p>a body covered by paragraph (a);</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-8__subsec-1__para-iii">
              <num>iii</num>
              <content>
                <p>a body covered by either of the above subparagraphs.</p>
              </content>
              <content>
                <p><term refersTo="#term-excess-art-embryo">excess ART embryo</term> means <def>a human embryo that: was created, by assisted reproductive technology, for use in the assisted reproductive technology treatment of a woman; and is excess to the needs of: the woman for whom it was created; and her spouse (if any) at the time the embryo was created.</def></p>

            </paragraph>
            <paragraph eId="part-1__sec-8__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>was created, by assisted reproductive technology, for use in the assisted reproductive technology treatment of a woman; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-8__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>is excess to the needs of:</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-8__subsec-1__para-i">
              <num>i</num>
              <content>
                <p>the woman for whom it was created; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-8__subsec-1__para-ii">
              <num>ii</num>
              <content>
                <p>her spouse (if any) at the time the embryo was created.</p>
              </content>
              <content>
                <p><term refersTo="#term-general-licence">general licence</term> has the same meaning as <def>in Part 2 of <ref href="">the Research Involving Human Embryos Act 2002</ref>.</def></p>
                <p><term refersTo="#term-human-embryo">human embryo</term> means <def>a discrete entity that has arisen from either: the first mitotic division when fertilisation of a human oocyte by a human sperm is complete; or any other process that initiates organised development of a biological entity with a human nuclear genome or altered human nuclear genome that has the potential to develop up to, or beyond, the stage at which the primitive streak appears; and has not yet reached 8 weeks of development since the first mitotic division.</def></p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-8__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>the first mitotic division when fertilisation of a human oocyte by a human sperm is complete; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-8__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>any other process that initiates organised development of a biological entity with a human nuclear genome or altered human nuclear genome that has the potential to develop up to, or beyond, the stage at which the primitive streak appears;</p>
              </content>
              <content>
                <p>and has not yet reached 8 weeks of development since the first mitotic division.</p>
                <p><term refersTo="#term-human-embryo-clone">human embryo clone</term> means <def>a human embryo that is a genetic copy of another living or dead human, but does not include a human embryo created by the fertilisation of a human egg by human sperm.</def></p>
                <p><term refersTo="#term-human-sperm">human sperm</term> includes <def>human spermatids.</def></p>
                <p><b><i>hybrid embryo</i></b> means:</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-8__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>an embryo created by the fertilisation of a human egg by animal sperm; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-8__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>an embryo created by the fertilisation of an animal egg by human sperm; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-8__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>a human egg into which the nucleus of an animal cell has been introduced; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-8__subsec-1__para-d">
              <num>d</num>
              <content>
                <p>an animal egg into which the nucleus of a human cell has been introduced; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-8__subsec-1__para-e">
              <num>e</num>
              <content>
                <p>a thing declared by the regulations to be a hybrid embryo.</p>
              </content>
              <content>
                <p><term refersTo="#term-mitochondrial-donation-licence">mitochondrial donation licence</term> means <def>any of the following licences issued under <ref href="#sec-28J">section 28J</ref> of <ref href="">the Research Involving Human Embryos Act 2002</ref>: a pre-clinical research and training licence; a clinical trial research and training licence; a clinical trial licence; a clinical practice research and training licence; a clinical practice licence.</def></p>

            </paragraph>
            <paragraph eId="part-1__sec-8__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>a pre-clinical research and training licence;</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-8__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>a clinical trial research and training licence;</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-8__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>a clinical trial licence;</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-8__subsec-1__para-d">
              <num>d</num>
              <content>
                <p>a clinical practice research and training licence;</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-8__subsec-1__para-e">
              <num>e</num>
              <content>
                <p>a clinical practice licence.</p>
              </content>
              <content>
                <p><term refersTo="#term-mitochondrial-donation-technique">mitochondrial donation technique</term> has the same meaning as <def>in Part 2 of <ref href="">the Research Involving Human Embryos Act 2002</ref>.</def></p>
                <p><term refersTo="#term-nhmrc-licensing-committee">NHMRC Licensing Committee</term> means <def>the Committee established under <ref href="#sec-13">section 13</ref> of <ref href="">the Research Involving Human Embryos Act 2002</ref>.</def></p>
                <p><term refersTo="#term-precursor-cell">precursor cell</term> means <def>a cell that has the potential to develop into a human egg or human sperm.</def></p>
                <p><term refersTo="#term-spouse">spouse</term> includes <def>a de facto partner of the person within the meaning of <ref href="">the Acts Interpretation Act 1901</ref>.</def></p>
                <p><term refersTo="#term-state">State</term> includes <def>the  and the .</def></p>
                <p><term refersTo="#term-woman">woman</term> means <def>a female human.</def></p>

            </paragraph>
          </subsection>
          <subsection eId="part-1__sec-8__subsec-2">
            <num>2</num>
            <content>
              <p>For the purposes of establishing that a human embryo clone is a genetic copy of a living or dead human:</p>
            </content>
            <paragraph eId="part-1__sec-8__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>it is sufficient to establish that the set of genes in the nuclei of the cells of the living or dead human has been copied; and</p>
              </content>

              </content>
            </paragraph>

                <p>includes, but is not limited to, expenses relating to the storage or transport of the embryo.</p>
              </content>
              <content>
                <p><b><i>valuable consideration</i></b>, in relation to the supply of a human egg, human sperm or a human embryo by a person, includes any inducement, discount or priority in the provision of a service to the person, but does not include the payment of reasonable expenses incurred by the person in connection with the supply.</p>

            </paragraph>
          </subsection>
        </section>

          <heading>Offence—creating a human embryo other than by fertilisation, or developing such an embryo</heading>

                <p>in the case of hybrid embryo created by introducing the nucleus of a human cell into an animal egg—for not longer than 14 days.</p>

          <num>23BA</num>
          <heading>Person not liable for conduct purportedly authorised</heading>
          <subsection eId="part-2__sec-23BA__subsec-1">
            <num>1</num>
            <content>
              <p>To avoid doubt, a person is not criminally responsible for a licence offence in respect of particular conduct if:</p>
            </content>
            <paragraph eId="part-2__sec-23BA__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>the conduct by the person is purportedly authorised by a provision of a general licence or a mitochondrial donation licence; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-23BA__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>the licence or the provision is invalid, whether because of a technical defect or irregularity or for any other reason; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-23BA__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>the person did not know, and could not reasonably be expected to have known, of the invalidity of the licence or the provision.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-23BA__subsec-2">
            <num>2</num>
            <content>
              <p>In this section:</p>
            </content>
            <content>
              <p><b><i>general licence</i></b> includes a purported general licence.</p>
              <p><b><i>licence offence </i></b>means:</p>

              <num>a</num>
              <content>
                <p>for a general licence—an offence against <ref href="#sec-22">section 22</ref>, 23, 23A or 23B; or</p>
              </content>

              <num>b</num>
              <content>
                <p>for a mitochondrial donation licence—an offence against <ref href="#sec-12">section 12</ref>, 13 or 15, subsection 20(3), or <ref href="#sec-22">section 22</ref> or 23.</p>

              <content>
                <p><b><i>mitochondrial donation licence</i></b> includes a purported mitochondrial donation licence.</p>
              </content>
            </paragraph>

          <num>23C</num>
          <heading>Regulations under Customs Act</heading>
          <content>
            <p>		The Minister who administers the <i>Customs Act 1901</i> must take all reasonable steps to ensure that regulations are made, within 6 months after the commencement of this section, permitting, subject to appropriate conditions or restrictions, the import and export of human embryonic stem cell lines which have been derived from human embryo clones using practices consistent with Australian legislation.</p>

            <p>This Act is not intended to exclude the operation of any law of a State, to the extent that the law of the State is capable of operating concurrently with this Act.</p>

                <p><role refersTo="#minister">The Minister</role> must cause an independent review of the operation of this Act, in so far as it relates to the use of mitochondrial donation techniques, to be undertaken as soon as possible after the end of:</p>
              </content>
              <paragraph eId="part-4__dvs-1__sec-25__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>	(a)	the period of 7 years starting on the commencement of Schedule 1 to the <i>Mitochondrial Donation Law Reform (Maeve’s Law) Act 2022</i>; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-1__sec-25__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>each subsequent 7-year period.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-4__dvs-1__sec-25__subsec-2">
              <num>2</num>
              <content>
                <p>A review under this section is to be undertaken by persons chosen by <role refersTo="#minister">the Minister</role>, with the agreement of each State.</p>
              </content>
            </subsection>
            <subsection eId="part-4__dvs-1__sec-25__subsec-3">
              <num>3</num>
              <content>
                <p>The persons undertaking a review under this section must prepare and give to <role refersTo="#minister">the Minister</role>, for presentation to the Parliament, a report of the review.</p>
              </content>
            </subsection>
            <subsection eId="part-4__dvs-1__sec-25__subsec-4">
              <num>4</num>
              <content>
                <p>The report must be given to the Minister <quantity refersTo="#deadline">within 12 months</quantity> after the end of the relevant 7-year period.</p>

                  <p>the Commonwealth and the States; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-1__sec-25__subsec-5__para-b">

                  <p>a broad range of persons with expertise in or experience of relevant disciplines;</p>
                </content>
                <content>
                  <p>and the views of the Commonwealth, the States and the persons mentioned in paragraph (b) must be set out in the report to the extent that it is reasonably practicable to do so.</p>

                <p>Before the Governor-General makes regulations under this Act, <role refersTo="#minister">the Minister</role> must be satisfied that:</p>

                  <p>the States have been consulted in relation to the proposed regulations; and</p>

                  <p>the proposed regulations have been prepared having regard to views expressed by the States in those consultations.</p>
