              <p>If a provision covered by item 2 of the table does not commence within the period of 6 months beginning on the day on which this Act receives the Royal Assent, it commences on the first day after the end of that period.</p>

          <heading>Extended operation of Act</heading>
          <content>
            <p>This Act extends to every external Territory.</p>

        </section>

          <num>4</num>
          <heading>Definitions</heading>
          <subsection eId="part-1__sec-4__subsec-1">
            <num>1</num>
            <content>
              <p>In this Act:</p>
            </content>
            <content>
              <p><term refersTo="#term-commonwealth">Commonwealth</term> includes <def>the following: a Federal Court; 	(b)	a Department of the Parliament established under the <i>Parliamentary Service Act 1999</i>; a body (not being a body corporate) established or continued in existence for a public purpose by or under a Commonwealth law, other than a body established by or under: 	(i)	the <i>Australian Capital Territory (Self-Government) Act 1988</i>; or 	(ii)	the <i>Norfolk Island Act 1979</i>; or 	(iii)	the <i>Northern Territory (Self-Government) Act 1978</i>.</def></p>

              <num>a</num>
              <content>
                <p>a Federal Court;</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-1__para-b">

                <p>	(b)	a Department of the Parliament established under the <i>Parliamentary Service Act 1999</i>;</p>

            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>a body (not being a body corporate) established or continued in existence for a public purpose by or under a Commonwealth law, other than a body established by or under:</p>

            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-1__para-i">
              <num>i</num>
              <content>
                <p>	(i)	the <i>Australian Capital Territory (Self-Government) Act 1988</i>; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-1__para-ii">
              <num>ii</num>
              <content>
                <p>	(ii)	the <i>Norfolk Island Act 1979</i>; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-1__para-iii">
              <num>iii</num>
              <content>
                <p>	(iii)	the <i>Northern Territory (Self-Government) Act 1978</i>.</p>
              </content>
              <content>
                <p><term refersTo="#term-commonwealth-authority">Commonwealth authority</term> means <def>a body corporate established or continued in existence for a public purpose by or under a Commonwealth law, but does not include: 	(a)	a corporation registered under the <i>Corporations (Aboriginal and Torres Strait Islander) Act 2006</i>; or 	(b)	an organisation registered or an association recognised under the <i>Fair Work (Registered Organisations) Act 2009</i>; or a body specified in the regulations for the purposes of this paragraph.</def></p>

            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>	(a)	a corporation registered under the <i>Corporations (Aboriginal and Torres Strait Islander) Act 2006</i>; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>	(b)	an organisation registered or an association recognised under the <i>Fair Work (Registered Organisations) Act 2009</i>; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>a body specified in the regulations for the purposes of this paragraph.</p>
              </content>
              <content>
                <p><term refersTo="#term-organised">organised</term> includes <def>directed and supervised.</def></p>
                <p><term refersTo="#term-recreational-drug">recreational drug</term> means <def>a drug consumed voluntarily for non-medicinal purposes and includes alcohol.</def></p>
                <p><term refersTo="#term-voluntary-basis">voluntary basis</term> has the meaning given by <def>subsections (2) and (3).</def></p>
                <p>Meaning of <b>voluntary basis</b></p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-1__sec-4__subsec-2">
            <num>2</num>
            <content>
              <p>	(2)	An individual does work for the Commonwealth or a Commonwealth authority on a <b><i>voluntary basis</i></b> if the individual:</p>
            </content>
            <paragraph eId="part-1__sec-4__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>either:</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-2__para-i">
              <num>i</num>
              <content>
                <p>receives no remuneration for doing the work other than the reimbursement of reasonable expenses incurred by the individual in doing the work; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-2__para-ii">
              <num>ii</num>
              <content>
                <p>receives remuneration for doing the work less than the amount, if any, prescribed or determined in accordance with the regulations; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>does not do the work under a court order.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-1__sec-4__subsec-3">
            <num>3</num>
            <content>
              <p>	(3)	An individual also does work for the Commonwealth or a Commonwealth authority on a <b><i>voluntary basis</i></b> if:</p>
            </content>
            <paragraph eId="part-1__sec-4__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>the individual continues to receive remuneration from the individual’s usual employer while doing the work but receives no other remuneration for doing the work other than:</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-3__para-i">
              <num>i</num>
              <content>
                <p>reimbursement of reasonable expenses incurred by the individual in doing the work; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-3__para-ii">
              <num>ii</num>
              <content>
                <p>remuneration less than the amount, if any, prescribed or determined in accordance with the regulations; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>the work is of a kind that is usually done for the Commonwealth or the Commonwealth authority by persons who either:</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-3__para-i">
              <num>i</num>
              <content>
                <p>receive no remuneration for doing the work other than the reimbursement of reasonable expenses incurred in doing the work; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-3__para-ii">
              <num>ii</num>
              <content>
                <p>receive remuneration for doing the work less than the amount, if any, prescribed or determined in accordance with the regulations; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-3__para-c">
              <num>c</num>
              <content>
                <p>the individual does not do the work under a court order.</p>
              </content>
              <content>
                <p>Acts and omissions of individuals covered</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-1__sec-4__subsec-4">
            <num>4</num>
            <content>
              <p>A reference in this Act to a thing done by an individual includes a reference to the omission by an individual to do a thing.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-1__sec-5">
          <num>5</num>
          <heading>Application</heading>
          <content>
            <p>This Act applies only in relation to civil liability for a thing done by an individual after the commencement of this Act.</p>
          </content>
        </section>
      </part>

        <num>2</num>
        <heading>Protection from civil liability</heading>
        <section eId="part-2__sec-6">
          <num>6</num>
          <heading>Protection from liability</heading>
          <content>
            <p>Protection</p>
          </content>
          <subsection eId="part-2__sec-6__subsec-1">
            <num>1</num>
            <content>
              <p>An individual does not incur civil liability for anything that the individual has done in good faith in doing work for the Commonwealth or a Commonwealth authority if it is work:</p>
            </content>
            <paragraph eId="part-2__sec-6__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>done by the individual on a voluntary basis; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-6__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>organised by the Commonwealth or the Commonwealth authority.</p>
              </content>
              <content>
                <p>Third-party insurance or defamation</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-6__subsec-2">
            <num>2</num>
            <content>
              <p>Subsection (1) does not apply to:</p>
            </content>
            <paragraph eId="part-2__sec-6__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>a liability that is covered by a scheme of compulsory third-party motor vehicle insurance; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-6__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>a liability for defamation.</p>
              </content>
              <content>
                <p>Individual affected by drugs</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-6__subsec-3">
            <num>3</num>
            <content>
              <p>Subsection (1) does not apply if the individual’s ability to carry out the work properly was, at the relevant time, significantly impaired by a recreational drug.</p>
            </content>
            <content>
              <p>Individual acting outside scope of authority or instructions</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-6__subsec-4">
            <num>4</num>
            <content>
              <p>Subsection (1) does not apply if:</p>
            </content>
            <paragraph eId="part-2__sec-6__subsec-4__para-a">
              <num>a</num>
              <content>
                <p>the individual was acting, and knew or ought to have known that he or she was acting, outside the scope of the activities authorised by the Commonwealth or the Commonwealth authority; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-6__subsec-4__para-b">
              <num>b</num>
              <content>
                <p>the individual was acting, and knew or ought to have known that he or she was acting, contrary to instructions given by the Commonwealth or the Commonwealth authority.</p>
              </content>
            </paragraph>
          </subsection>
        </section>
        <section eId="part-2__sec-7">
          <num>7</num>
          <heading>Commonwealth or Commonwealth authority to incur liability</heading>
          <subsection eId="part-2__sec-7__subsec-1">
            <num>1</num>
            <content>
              <p>The Commonwealth or a Commonwealth authority incurs any civil liability that an individual would, except for <ref href="#sec-6">section 6</ref>, incur in respect of a thing done by the individual while doing work for the Commonwealth or the Commonwealth authority.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-7__subsec-2">
            <num>2</num>
            <content>
              <p>Subsection (1) does not apply to a Commonwealth authority if:</p>
            </content>
            <paragraph eId="part-2__sec-7__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>a provision in an Act gives protection to the Commonwealth authority from civil liability; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-7__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>under the provision, the Commonwealth authority would be protected from civil liability in relation to the thing done by the individual.</p>
              </content>
            </paragraph>
          </subsection>
        </section>
        <section eId="part-2__sec-8">
          <num>8</num>
          <heading>Volunteer to assist in defence of actions etc.</heading>
          <content>
            <p>		If the Commonwealth or the Commonwealth authority requests the individual to assist the Commonwealth or the Commonwealth authority in any action, claim or demand relating to a civil liability that the Commonwealth or Commonwealth authority may incur or incurs<i> </i>under section 7, then the individual must comply with the request.</p>
          </content>
        </section>
        <section eId="part-2__sec-9">
          <num>9</num>
          <heading>Certain indemnities to have no effect</heading>
          <content>
            <p>An indemnity given by an individual against a liability that the Commonwealth or a Commonwealth authority incurs under this Act in respect of work done by the individual has no effect.</p>

        </section>
        <section eId="part-2__sec-10">
          <num>10</num>
          <heading>No overriding of Damage by Aircraft Act</heading>
          <content>
            <p>		This Act does not override or limit the operation of the <i>Damage by Aircraft Act 1999</i>.</p>
          </content>
        </section>
        <section eId="part-2__sec-11">
          <num>11</num>
          <heading>Regulations</heading>
          <content>
            <p>The Governor-General may make regulations prescribing matters:</p>
          </content>
          <paragraph eId="part-2__sec-11__para-a">
            <num>a</num>
            <content>
              <p>required or permitted by this Act to be prescribed; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-11__para-b">
            <num>b</num>
            <content>
              <p>necessary or convenient to be prescribed for carrying out or giving effect to this Act.</p>
