          <heading>Short title</heading>
          <content>
            <p>		This Act may be cited as the <i>Terrorism and Cyclone Insurance Act 2003</i>.</p>
          </content>
        </section>
        <section eId="part-1__sec-2">
          <num>2</num>
          <heading>Commencement</heading>
          <content>
            <p>This Act commences on the day on which it receives the Royal Assent.</p>
          </content>
        </section>
        <section eId="part-1__sec-3">
          <num>3</num>
          <heading>Definitions</heading>
          <content>
            <p>In this Act, unless the contrary intention appears:</p>
            <p><term refersTo="#term-apra">APRA</term> means <def>the Australian Prudential Regulation Authority.</def></p>
            <p><term refersTo="#term-australia">Australia</term> includes <def>Norfolk Island.</def></p>
            <p><b><i>body corporate</i></b> for a strata or community title development has the meaning prescribed by the regulations.</p>
            <p><term refersTo="#term-bureau">Bureau</term> means <def>the Commonwealth Bureau of Meteorology.</def></p>
            <p><term refersTo="#term-claims-period-for-a-cyclone-event">claims period for a cyclone event</term> means <def>the period:</def></p>

          <paragraph eId="part-1__sec-3__para-a">
            <num>a</num>
            <content>
              <p>starting on the day, and at the time, specified under paragraph 8F(1)(a) for the cyclone event; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-b">
            <num>b</num>
            <content>
              <p>ending on the day, and at the time, specified under paragraph 8F(2)(c) for the cyclone event.</p>
            </content>
            <content>
              <p><term refersTo="#term-corporation">Corporation</term> means <def>the Australian Reinsurance Pool Corporation established by <ref href="#sec-9">section 9</ref>.</def></p>
              <p><b><i>cyclone</i></b> has the meaning prescribed by the regulations.</p>
              <p><term refersTo="#term-cyclone-event">cyclone event</term> means <def>a cyclone event declared under subsection 8F(1) in relation to a cyclone.</def></p>
              <p><term refersTo="#term-cyclone-reinsurance-contract">cyclone reinsurance contract</term> means <def>a contract of reinsurance that the Corporation enters into as reinsurer under <ref href="#part-2A">Part 2A</ref>.</def></p>
              <p><b><i>cyclone reinsurance scheme</i></b> means:</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-a">
            <num>a</num>
            <content>
              <p>the scheme operated by the Corporation in performing its function under paragraph 10(b) (cyclone and related flood damage reinsurance); and</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-b">
            <num>b</num>
            <content>
              <p>any other activities the Corporation undertakes for the purposes of performing that function.</p>
            </content>
            <content>
              <p><term refersTo="#term-declared-terrorist-incident">declared terrorist incident</term> means <def>an act or acts declared under <ref href="#sec-6">section 6</ref> to be a declared terrorist incident.</def></p>
              <p><term refersTo="#term-eligible-cyclone-loss">eligible cyclone loss</term> has the meaning given by <def><ref href="#sec-8C">section 8C</ref>.</def></p>
              <p><term refersTo="#term-eligible-insurance-contract">eligible insurance contract</term> has the meaning given by <def><ref href="#sec-7">section 7</ref>.</def></p>
              <p><term refersTo="#term-eligible-property">eligible property</term> means <def>the following property that is located in Australia: buildings (including fixtures) or other structures or works on, in or under land; tangible property that is located in, or on, property to which paragraph (a) applies; any other property prescribed by the regulations.</def></p>

          </paragraph>
          <paragraph eId="part-1__sec-3__para-a">
            <num>a</num>
            <content>
              <p>buildings (including fixtures) or other structures or works on, in or under land;</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-b">
            <num>b</num>
            <content>
              <p>tangible property that is located in, or on, property to which paragraph (a) applies;</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-c">
            <num>c</num>
            <content>
              <p>any other property prescribed by the regulations.</p>
            </content>

              <content>
                <p>Note:	Roads, tunnels, dams and pipelines are examples of eligible property.</p>
              </content>
            </authorialNote>
            <content>
              <p><term refersTo="#term-eligible-terrorism-loss">eligible terrorism loss</term> means <def>a loss or liability arising from a declared terrorist incident, but does not include a loss or liability arising from the hazardous properties (including radioactive, toxic or explosive properties) of nuclear fuel, nuclear material or nuclear waste.</def></p>
              <p><b><i>end</i></b>, in relation to a cyclone, has the meaning prescribed by the regulations.</p>
              <p><term refersTo="#term-excess">excess</term> means <def>an amount of an insurance claim that is to be paid or borne by the insured.</def></p>
              <p><term refersTo="#term-finance-minister">Finance Minister</term> means <def>the Minister administering the Public Governance, Performance and Accountability Act 2013.</def></p>
              <p><term refersTo="#term-financial-year-of-a-general-insurer">financial year of a general insurer</term> means <def>a financial year of the insurer determined under <ref href="#sec-323D">section 323D</ref> of <ref href="">the Corporations Act 2001</ref>.</def></p>
              <p><term refersTo="#term-general-insurer">general insurer</term> has the same meaning as <def>in <ref href="">the Insurance Act 1973</ref>.</def></p>
              <p><term refersTo="#term-insurance-business">insurance business</term> has the same meaning as <def>in <ref href="">the Insurance Act 1973</ref>.</def></p>
              <p><b><i>Lloyd’s underwriter</i></b> has the same meaning as in the <i>Insurance Act 1973</i>.</p>
              <p><term refersTo="#term-member">member</term> means <def>a member of the Corporation, and includes the Chair.</def></p>
              <p><b><i>own</i></b>, in relation to property, includes:</p>
            </content>
          </paragraph>

            <num>a</num>
            <content>
              <p>owning the property together with another person or other persons; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-b">
            <num>b</num>
            <content>
              <p>having an insurable interest in the property.</p>
            </content>
            <content>
              <p><term refersTo="#term-pool-insurance-contract">pool insurance contract</term> has the meaning given by <def><ref href="#sec-8B">section 8B</ref>.</def></p>
              <p><term refersTo="#term-reduction-percentage">reduction percentage</term> means <def>a reduction percentage specified in a declaration under <ref href="#sec-6">section 6</ref>, and includes such a percentage as varied under that section.</def></p>
              <p><b><i>reintensify</i></b>, in relation to a cyclone, has the meaning prescribed by the regulations.</p>
              <p><term refersTo="#term-startup-time">startup time</term> means <def>the beginning of 1 July 2003.</def></p>
              <p><b><i>strata or community title development</i></b> has the meaning prescribed by the regulations.</p>
              <p><term refersTo="#term-terrorist-act">terrorist act</term> has the same meaning as <def>in <ref href="">the Crimes Act 1914</ref>.</def></p>
              <p><b><i>unauthorised foreign insurer</i></b> has the meaning prescribed by the regulations.</p>
              <p><b><i>unit</i></b> in a strata or community title development has the meaning prescribed by the regulations.</p>

        </section>
        <section eId="part-1__sec-4">
          <num>4</num>
          <heading>Act extends to things outside Australia</heading>
          <content>
            <p>Unless the contrary intention appears, this Act extends to acts, omissions, matters and things outside Australia.</p>
          </content>
        </section>
        <section eId="part-1__sec-5">
          <num>5</num>
          <heading>Application to the Commonwealth</heading>
          <subsection eId="part-1__sec-5__subsec-1">
            <num>1</num>
            <content>
              <p>	(1)	<i>Defence Service Homes Act 1918</i>, in the same way as Part 2A applies to a general insurer.<ref href="#part-2A">Part 2A</ref> applies to the Commonwealth, when undertaking insurance under <ref href="#part-VI">Part VI</ref> (about the Defence Service Homes Insurance Scheme) of the </p>
            </content>
          </subsection>
          <subsection eId="part-1__sec-5__subsec-2">
            <num>2</num>
            <content>
              <p><ref href="#part-2A">Part 2A</ref> binds the Crown in right of the Commonwealth to the extent provided in subsection (1), but nothing in that Part makes the Crown liable to a pecuniary penalty.</p>
            </content>
          </subsection>
        </section>
      </part>

        <num>2</num>
        <heading>Insurance for terrorism risks</heading>
        <section eId="part-2__sec-6">
          <num>6</num>
          <heading>Declared terrorist incidents</heading>
          <subsection eId="part-2__sec-6__subsec-1">
            <num>1</num>
            <content>
              <p>If <role refersTo="#minister">the Minister</role> is satisfied that, after the startup time:</p>
            </content>
            <paragraph eId="part-2__sec-6__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>a terrorist act has happened in Australia; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-6__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>2 or more related terrorist acts have happened in Australia;</p>
              </content>
              <content>
                <p>then <role refersTo="#minister">the Minister</role> must, by legislative instrument, declare that the act constitutes, or the acts together constitute, a declared terrorist incident for the purposes of this Act.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-6__subsec-2">
            <num>2</num>
            <content>
              <p>A terrorist act cannot be taken into account for the purposes of subsection (1) if <role refersTo="#minister">the Minister</role> is satisfied that it is an act of war.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-6__subsec-3">
            <num>3</num>
            <content>
              <p>A terrorist act that consists merely of a threat of action cannot be taken into account for the purposes of subsection (1) unless <role refersTo="#minister">the Minister</role> is satisfied that the threat resulted in economic loss to a person.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-6__subsec-4">
            <num>4</num>
            <content>
              <p>A terrorist act that consists of threatened action is taken to have happened in Australia if, and only if, the threatened action would happen in Australia.</p>
            </content>
          </subsection>

              <p>A reduction percentage must be specified if <role refersTo="#minister">the Minister</role> considers that, in the absence of a reduction percentage, the total amounts paid or payable by the Commonwealth under section 35 (including amounts not related to the act or acts specified in the declaration) would be more than $10,000 million.</p>

          </subsection>

              <p><role refersTo="#minister">The Minister</role> may, by legislative instrument, vary the reduction percentage, but only by making it smaller. The percentage may be varied more than once.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-6__subsec-9">

            <content>
              <p><role refersTo="#minister">The Minister</role> may delegate his or her powers under this section to:</p>
            </content>
            <paragraph eId="part-2__sec-6__subsec-9__para-a">
              <num>a</num>
              <content>
                <p><role refersTo="#secretary">the Secretary</role> of the Department; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-6__subsec-9__para-b">
              <num>b</num>
              <content>
                <p>an SES employee, or acting SES employee, in the Department.</p>
              </content>
            </paragraph>
          </subsection>
        </section>
        <section eId="part-2__sec-7">
          <num>7</num>
          <heading>Eligible insurance contracts</heading>
          <subsection eId="part-2__sec-7__subsec-1">
            <num>1</num>
            <content>
              <p>	(1)	A contract of insurance is an <b><i>eligible insurance contract</i></b> to the extent that it provides insurance cover for one or more of the following:</p>
            </content>
            <paragraph eId="part-2__sec-7__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>loss of, or damage to, eligible property that is owned by the insured;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-7__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>business interruption and consequential loss arising from:</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-7__subsec-1__para-i">
              <num>i</num>
              <content>
                <p>loss of, or damage to, eligible property that is owned or occupied by the insured; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-7__subsec-1__para-ii">
              <num>ii</num>
              <content>
                <p>inability to use eligible property, or part of eligible property, that is owned or occupied by the insured;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-7__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>liability of the insured that arises out of the insured being the owner or occupier of eligible property.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-7__subsec-2">
            <num>2</num>
            <content>
              <p>A contract covered by subsection (1) is not an eligible insurance contract to the extent to which it is:</p>
            </content>
            <paragraph eId="part-2__sec-7__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>a contract of reinsurance; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-7__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>prescribed by the regulations for the purposes of this subsection.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-7__subsec-3">
            <num>3</num>
            <content>
              <p>A contract of insurance is not an eligible insurance contract if it is made in the course of State insurance not extending beyond the limits of the State concerned.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-7__subsec-4">
            <num>4</num>
            <content>
              <p>This section extends to contracts made before the commencement of this section.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-2__sec-8">
          <num>8</num>
          <heading>Effect of terrorism exclusions in eligible insurance contracts</heading>
          <subsection eId="part-2__sec-8__subsec-1">
            <num>1</num>
            <content>
              <p>A terrorism exclusion in an eligible insurance contract has no effect in relation to a loss or liability to the extent to which the loss or liability is an eligible terrorism loss.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-8__subsec-2">
            <num>2</num>
            <content>
              <p>	(2)	For the purposes of subsection (1), <b><i>terrorism exclusion</i></b> means an exclusion or exception (however described) for:</p>
            </content>
            <paragraph eId="part-2__sec-8__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>acts that are described using the word “terrorism” or “terrorist” or words of similar effect; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>	(b)	other acts (however described) that are substantially similar to terrorist acts as defined in the <i>Crimes Act 1914</i>; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>acts that are described using the word “chemical”, “biological”, “polluting”, “contaminating”, “pathogenic” or “poisoning” or words of similar effect.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-8__subsec-3">
            <num>3</num>
            <content>
              <p>If:</p>
            </content>
            <paragraph eId="part-2__sec-8__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>	(a)	apart from this subsection, an amount (the <b><i>base amount</i></b>) would be payable under the contract, solely because of this section, in respect of a declared terrorist incident; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>a reduction percentage applies to the declared terrorist incident; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-3__para-c">
              <num>c</num>
              <content>
                <p>if the contract was made on or after <date date="2003-10-01">1 October 2003</date>—the insurer is reinsured with the Corporation in respect of the whole or a part of the insurer’s liabilities under the contract that arise solely because of this section;</p>
              </content>
              <content>
                <p>then the base amount is to be reduced by the reduction percentage.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-8__subsec-4">
            <num>4</num>
            <content>
              <p>The Corporation is liable to compensate an insurer for:</p>
            </content>
            <paragraph eId="part-2__sec-8__subsec-4__para-a">
              <num>a</num>
              <content>
                <p>a liability incurred by the insurer under a protected contract, to the extent that the liability arises solely because of this section; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-4__para-b">
              <num>b</num>
              <content>
                <p>expenditure incurred by the insurer in connection with, or arising from, the assessment, management, conduct, rejection, defence or settlement of a claim by the insured, to the extent to which the claim is:</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-4__para-i">
              <num>i</num>
              <content>
                <p>under a protected contract; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-4__para-ii">
              <num>ii</num>
              <content>
                <p>in respect of a liability that arises (or is alleged to arise) solely because of this section.</p>
              </content>
              <content>
                <p>For the purposes of this subsection, <b><i>protected contract</i></b> means an eligible insurance contract that is in force at the startup time or is entered into after the startup time and before 1 October 2003.</p>
              </content>
            </paragraph>
          </subsection>
        </section>
      </part>
      <part eId="part-2A">
        <num>2A</num>
        <heading>Cyclone and related flood damage reinsurance pool</heading>
        <section eId="part-2A__sec-8A">
          <num>8A</num>
          <heading>When cyclone risks must be reinsured with the Corporation</heading>
          <subsection eId="part-2A__sec-8A__subsec-1">
            <num>1</num>
            <content>
              <p>If a general insurer carries on insurance business that includes undertaking liability, under pool insurance contracts, in respect of eligible cyclone losses, the insurer must maintain contracts of reinsurance with the Corporation that:</p>
            </content>
            <paragraph eId="part-2A__sec-8A__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>cover the insurer’s liability, under all pool insurance contracts that it enters into, in respect of all eligible cyclone losses; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2A__sec-8A__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>insure against 100% of the insurer’s liability, under each of those pool insurance contracts, in respect of all eligible cyclone losses.</p>
              </content>

          <subsection eId="part-2A__sec-8A__subsec-2">
            <num>2</num>
            <content>
              <p>Subsection (1) has effect subject to a direction that is in force under <ref href="#sec-38">section 38</ref> and provides for the extent to which risk is to be retained by reinsureds under the relevant contracts of reinsurance.</p>
            </content>
          </subsection>
          <subsection eId="part-2A__sec-8A__subsec-3">
            <num>3</num>
            <content>
              <p>Subsection (1) has effect even if the general insurer has entered into a contract of reinsurance otherwise than with the Corporation.</p>
            </content>
          </subsection>
          <subsection eId="part-2A__sec-8A__subsec-4">
            <num>4</num>
            <content>
              <p>The Corporation may enter into contracts of reinsurance that insure against the reinsureds’ liability, under pool insurance contracts, in respect of eligible cyclone losses arising on and after <date date="2022-07-01">1 July 2022</date>.</p>
            </content>
            <content>
              <p>Exception where premium income is below prescribed threshold in previous financial year</p>
            </content>
          </subsection>
          <subsection eId="part-2A__sec-8A__subsec-5">
            <num>5</num>
            <content>
              <p>Subsection (1) does not apply to a general insurer during a calendar year if the amount worked out under subsection (6) does not exceed the threshold amount prescribed by the regulations.</p>
            </content>
          </subsection>
          <subsection eId="part-2A__sec-8A__subsec-6">
            <num>6</num>
            <content>
              <p>For the purposes of subsection (5), the amount is the total gross written premiums that the reporting standard prescribed by the regulations for the purposes of this subsection would require the general insurer to report to APRA:</p>
            </content>
            <paragraph eId="part-2A__sec-8A__subsec-6__para-a">
              <num>a</num>
              <content>
                <p>in respect of the last financial year of the general insurer that ended before the start of the calendar year referred to in subsection (5); and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2A__sec-8A__subsec-6__para-b">
              <num>b</num>
              <content>
                <p>for a class of direct business consisting of contracts of insurance:</p>
              </content>
            </paragraph>
            <paragraph eId="part-2A__sec-8A__subsec-6__para-i">
              <num>i</num>
              <content>
                <p>that the general insurer enters into as insurer; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2A__sec-8A__subsec-6__para-ii">
              <num>ii</num>
              <content>
                <p>that are wholly or partly pool insurance contracts; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2A__sec-8A__subsec-6__para-iii">
              <num>iii</num>
              <content>
                <p>under which the insurer undertakes any liability in respect of eligible cyclone losses (whether or not the contracts cover other risks) other than eligible cyclone losses arising at a place covered by a determination in force under subsection (7);</p>
              </content>
              <content>
                <p>if such contracts were a distinct class of direct insurance business.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2A__sec-8A__subsec-7">
            <num>7</num>
            <content>
              <p>The Corporation may, by notifiable instrument, determine areas where, in its opinion, the risk of eligible cyclone losses arising is so small as to be negligible.</p>
            </content>
            <content>
              <p>One in, all in rule for exempt general insurer</p>
            </content>
          </subsection>
          <subsection eId="part-2A__sec-8A__subsec-8">
            <num>8</num>
            <content>
              <p>However, if a general insurer enters into a contract of reinsurance with the Corporation that insures against the insurer’s liability under a pool insurance contract in respect of eligible cyclone losses, subsection (5) does not apply to the general insurer while that contract of reinsurance is in force.</p>
            </content>
            <content>
              <p>How this section applies to a Lloyd’s syndicate</p>
            </content>
          </subsection>
          <subsection eId="part-2A__sec-8A__subsec-9">
            <num>9</num>
            <content>
              <p>If a syndicate of Lloyd’s underwriters enter into a contract of reinsurance with the Corporation that insures against their liability under a pool insurance contract in respect of eligible cyclone losses, then, while that contract of reinsurance is in force, subsections (1), (2) and (3) apply to:</p>
            </content>
            <paragraph eId="part-2A__sec-8A__subsec-9__para-a">
              <num>a</num>
              <content>
                <p>the syndicate; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2A__sec-8A__subsec-9__para-b">
              <num>b</num>
              <content>
                <p>each Lloyd’s underwriter who is a member of the syndicate, when acting in that capacity;</p>
              </content>
              <content>
                <p>in the same way as those subsections apply to a general insurer.</p>
                <p>How this section applies to an unauthorised foreign insurer</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2A__sec-8A__subsec-10">
            <num>10</num>
            <content>
              <p>If an unauthorised foreign insurer enters into a contract of reinsurance with the Corporation that insures against the liability of the foreign insurer under a pool insurance contract in respect of eligible cyclone losses, then, while that contract of reinsurance is in force, subsections (1), (2) and (3) apply to that foreign insurer in the same way as those subsections apply to a general insurer.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-2A__sec-8B">
          <num>8B</num>
          <heading>Definition of pool insurance contract</heading>
          <subsection eId="part-2A__sec-8B__subsec-1">
            <num>1</num>
            <content>
              <p>	(1)	A contract of insurance is a <b><i>pool insurance contract</i></b> to the extent (but only to the extent) that:</p>
            </content>
            <paragraph eId="part-2A__sec-8B__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>it provides insurance cover that is of a kind referred to in subsection (2) and also of a kind referred to in subsection (3), whether or not the cover is limited or restricted in any way, and whether or not the contract also provides any other insurance cover; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2A__sec-8B__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>it is prescribed by the regulations for the purposes of this paragraph.</p>
              </content>

                <p>insurance cover in respect of a home building;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2A__sec-8B__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>insurance cover in respect of contents of a home building;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2A__sec-8B__subsec-3__para-c">
              <num>c</num>
              <content>
                <p>if:</p>
              </content>
            </paragraph>
            <paragraph eId="part-2A__sec-8B__subsec-3__para-i">
              <num>i</num>
              <content>
                <p>the insured is the body corporate for a strata or community title development; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2A__sec-8B__subsec-3__para-ii">
              <num>ii</num>
              <content>
                <p>at least 50% of the total floor space of the units in the development is used wholly or mainly for residential purposes;</p>
              </content>
              <content>
                <p>insurance cover in respect of either or both of:</p>
              </content>
            </paragraph>
            <paragraph eId="part-2A__sec-8B__subsec-3__para-iii">
              <num>iii</num>
              <content>
                <p>a building located on land that is included in the development; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2A__sec-8B__subsec-3__para-iv">
              <num>iv</num>
              <content>
                <p>contents of such a building;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2A__sec-8B__subsec-3__para-d">
              <num>d</num>
              <content>
                <p>insurance cover (other than insurance cover of a kind referred to in paragraph (a), (b) or (c)):</p>
              </content>
            </paragraph>
            <paragraph eId="part-2A__sec-8B__subsec-3__para-i">
              <num>i</num>
              <content>
                <p>that is in respect of a building, contents of a building, or both; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2A__sec-8B__subsec-3__para-ii">
              <num>ii</num>

                <p>for which the total of the sums insured does not exceed the amount prescribed by the regulations for the purposes of this paragraph.</p>
              </content>
              <content>
                <p>Terms used in subsection (3) that are defined by the regulations</p>

          <subsection eId="part-2A__sec-8B__subsec-4">
            <num>4</num>
            <content>
              <p>For the purposes of a paragraph of subsection (3):</p>
            </content>

              <p><term refersTo="#term-building">building</term> means <def>a building as defined by the regulations for the purposes of that paragraph.</def></p>
              <p><term refersTo="#term-contents">contents</term> means <def>contents as defined by the regulations for the purposes of that paragraph.</def></p>
              <p><term refersTo="#term-home-building">home building</term> means <def>a home building as defined by the regulations for the purposes of that paragraph.</def></p>
              <p>Exclusion from subsection (3) of buildings owned and managed by government entities</p>
            </content>
          </subsection>
          <subsection eId="part-2A__sec-8B__subsec-5">
            <num>5</num>
            <content>
              <p>Paragraph (3)(a) or (d) does not apply if:</p>
            </content>
            <paragraph eId="part-2A__sec-8B__subsec-5__para-a">
              <num>a</num>

                <p>the insured is a government entity as defined by the regulations for the purposes of this subsection; and</p>
              </content>
            </paragraph>

                <p>the home building or building, as the case may be, is managed by such a government entity (whether or not the same as the one referred to in paragraph (a) of this subsection).</p>

          </subsection>
          <subsection eId="part-2A__sec-8B__subsec-6">
            <num>6</num>
            <content>
              <p>A contract is not a pool insurance contract to the extent that it provides cover of a kind referred to in paragraph (3)(a) or (b) if the contract also provides cover that would be of a kind referred to in paragraph (3)(d) but for the fact that the last-mentioned cover does not satisfy subparagraph (3)(d)(ii).</p>
            </content>
          </subsection>
          <subsection eId="part-2A__sec-8B__subsec-7">
            <num>7</num>
            <content>
              <p>A contract is not a pool insurance contract to the extent that:</p>
            </content>
            <paragraph eId="part-2A__sec-8B__subsec-7__para-a">
              <num>a</num>
              <content>
                <p>it is a contract of reinsurance; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2A__sec-8B__subsec-7__para-b">
              <num>b</num>
              <content>
                <p>it provides insurance cover (other than insurance cover of a kind referred to in paragraph (3)(a) or (b)) to a farm business, including:</p>
              </content>
            </paragraph>
            <paragraph eId="part-2A__sec-8B__subsec-7__para-i">
              <num>i</num>
              <content>
                <p>producing crops or livestock, or produce derived from the crops or livestock; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2A__sec-8B__subsec-7__para-ii">
              <num>ii</num>
              <content>
                <p>secondary processing of, or manufacturing goods from, the crops, livestock or produce, at the place where the crops or livestock are produced; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2A__sec-8B__subsec-7__para-iii">
              <num>iii</num>
              <content>
                <p>the interests of the insured in property used in doing something covered by subparagraph (i) or (ii) of this paragraph; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2A__sec-8B__subsec-7__para-c">
              <num>c</num>
              <content>
                <p>it is prescribed by the regulations for the purposes of this subsection.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2A__sec-8B__subsec-8">
            <num>8</num>
            <content>
              <p>A contract of insurance is not a pool insurance contract if it is made in the course of State insurance not extending beyond the limits of the State concerned.</p>
            </content>
          </subsection>

              <p>Subsections (6) to (8) have effect despite subsection (1).</p>
            </content>
          </subsection>
        </section>
        <section eId="part-2A__sec-8C">

          <heading>Definition of eligible cyclone loss</heading>
          <subsection eId="part-2A__sec-8C__subsec-1">
            <num>1</num>
            <content>
              <p>	(1)	For the purposes of this Act, an <b><i>eligible cyclone loss</i></b> is a loss that satisfies the conditions in subsections (2) and (3).</p>
            </content>
          </subsection>
          <subsection eId="part-2A__sec-8C__subsec-2">
            <num>2</num>
            <content>
              <p>The loss must arise:</p>
            </content>
            <paragraph eId="part-2A__sec-8C__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>from the weather system in relation to which a cyclone event was declared under subsection 8F(1); or</p>
              </content>
            </paragraph>

                <p>without limiting the generality of paragraph (a) of this subsection, from any of the following that is caused by that weather system:</p>

              <num>i</num>

                <p>wind, rain, rainwater or rainwater runoff;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2A__sec-8C__subsec-2__para-ii">
              <num>ii</num>
              <content>
                <p>a storm surge, as defined by the regulations for the purposes of this subparagraph;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2A__sec-8C__subsec-2__para-iii">
              <num>iii</num>
              <content>
                <p>a flood, as defined by the regulations for the purposes of this subparagraph.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2A__sec-8C__subsec-3">
            <num>3</num>
            <content>
              <p>The loss must commence during the claims period for the cyclone event referred to in paragraph (2)(a).</p>
            </content>
          </subsection>
        </section>
        <section eId="part-2A__sec-8D">
          <num>8D</num>
          <heading>Setting reinsurance premiums</heading>
          <content>
            <p>When setting premiums that reinsureds are to pay under cyclone reinsurance contracts, the Corporation is to seek:</p>
          </content>
          <paragraph eId="part-2A__sec-8D__para-a">
            <num>a</num>
            <content>
              <p>to ensure that, over the longer term, premiums paid under such contracts are sufficient to cover or offset:</p>
            </content>
          </paragraph>
          <paragraph eId="part-2A__sec-8D__para-i">
            <num>i</num>
            <content>
              <p>the amounts paid in meeting the Corporation’s liabilities under such contracts (including payments by the Commonwealth under <ref href="#sec-35A">section 35A</ref> in respect of such liabilities); and</p>
            </content>
          </paragraph>
          <paragraph eId="part-2A__sec-8D__para-ii">
            <num>ii</num>
            <content>
              <p>all other amounts applied by the Corporation as mentioned in subsection 34(1), in so far as those amounts may reasonably be regarded as connected with the cyclone reinsurance scheme; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-2A__sec-8D__para-b">
            <num>b</num>
            <content>
              <p>in so far as those premiums are for reinsuring liability under pool insurance contracts that involve medium to high levels of exposure to eligible cyclone losses—to keep the premiums as low as possible while maintaining incentives to reduce and mitigate the risk of eligible cyclone losses; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-2A__sec-8D__para-c">
            <num>c</num>
            <content>
              <p>in so far as those premiums are for reinsuring liability under pool insurance contracts that involve lower levels of exposure to eligible cyclone losses—to keep those premiums at levels comparable to what would be charged by other reinsurers.</p>
            </content>
          </paragraph>
        </section>
        <section eId="part-2A__sec-8E">
          <num>8E</num>
          <heading>Bureau to notify the Corporation when cyclone begins and ends</heading>
          <subsection eId="part-2A__sec-8E__subsec-1">
            <num>1</num>
            <content>
              <p>If the Bureau determines that:</p>
            </content>
            <paragraph eId="part-2A__sec-8E__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>a cyclone exists or has reintensified; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2A__sec-8E__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>the cyclone is likely to affect any part of Australia;</p>
              </content>
              <content>
                <p>the Bureau must notify the Corporation that the cyclone exists or has reintensified, specifying the day and time when, in the Bureau’s opinion, the cyclone began or reintensified, as the case may be.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2A__sec-8E__subsec-2">
            <num>2</num>
            <content>
              <p>If:</p>
            </content>
            <paragraph eId="part-2A__sec-8E__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>the Bureau determines that a cyclone has ended; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2A__sec-8E__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>the cyclone is one about which the Bureau has notified the Corporation under subsection (1);</p>
              </content>
              <content>
                <p>the Bureau must notify the Corporation that the cyclone has ended, specifying the day and time when, in the Bureau’s opinion, the cyclone ended.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2A__sec-8E__subsec-3">
            <num>3</num>
            <content>
              <p>A notification under this section must be given:</p>
            </content>
            <paragraph eId="part-2A__sec-8E__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>as soon as practicable, and in any event within 24 hours, after the Bureau determines as mentioned in subsection (1) or (2), as the case may be; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2A__sec-8E__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>	(b)	in writing sent by electronic communication within the meaning of the <i>Electronic Transactions Act 1999</i>.</p>
              </content>

          <heading>Declarations about cyclone events</heading>
          <subsection eId="part-2A__sec-8F__subsec-1">
            <num>1</num>
            <content>
              <p>If the Bureau notifies the Corporation that a cyclone exists or has reintensified, the Corporation must declare that a cyclone event has begun. The declaration must:</p>
            </content>
            <paragraph eId="part-2A__sec-8F__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>specify the day and time when the cyclone began or reintensified, as notified by the Bureau; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2A__sec-8F__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>state that the claims period for the cyclone event began on that day at that time.</p>
              </content>

                  <p>Note:	If a cyclone ends but then reintensifies, a new cyclone event is declared under this section in relation to the cyclone.</p>

            </paragraph>
          </subsection>

            <num>2</num>
            <content>
              <p>If the Bureau notifies the Corporation that a cyclone has ended, the Corporation must declare that the cyclone event has ended that was previously declared under subsection (1) in relation to that cyclone. The declaration under this subsection must specify:</p>
            </content>
            <paragraph eId="part-2A__sec-8F__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>the previous declaration; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2A__sec-8F__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>the day and time when the cyclone ended, as notified by the Bureau; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2A__sec-8F__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>the day and time when the claims period for the cyclone event ended, or will end, as the case requires.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2A__sec-8F__subsec-3">
            <num>3</num>
            <content>
              <p>The day and time specified under paragraph (2)(c) must be the day and time when the period ends:</p>
            </content>
            <paragraph eId="part-2A__sec-8F__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>that began on the day, and at the time, specified under paragraph (2)(b); and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2A__sec-8F__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>whose duration is prescribed by the regulations for the purposes of this subsection.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2A__sec-8F__subsec-4">
            <num>4</num>
            <content>
              <p>A declaration under this section:</p>
            </content>
            <paragraph eId="part-2A__sec-8F__subsec-4__para-a">
              <num>a</num>
              <content>
                <p>must be made as soon as practicable, and in any event within 24 hours, after the Bureau notifies the Corporation that a cyclone exists, has reintensified or has ended, as the case may be; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2A__sec-8F__subsec-4__para-b">
              <num>b</num>
              <content>
                <p>must be made by notifiable instrument; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2A__sec-8F__subsec-4__para-c">
              <num>c</num>
              <content>
                <p>cannot be varied or revoked; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2A__sec-8F__subsec-4__para-d">
              <num>d</num>
              <content>
                <p>must be published on the Corporation’s website as soon as practicable, and in any event within those 24 hours.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2A__sec-8F__subsec-5">
            <num>5</num>
            <content>
              <p>The validity of a declaration under this section is not affected by:</p>
            </content>
            <paragraph eId="part-2A__sec-8F__subsec-5__para-a">
              <num>a</num>
              <content>
                <p>an error in matter specified in the declaration; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2A__sec-8F__subsec-5__para-b">
              <num>b</num>

                <p>a contravention of subsection (4).</p>

              <p>The Corporation has the following functions:</p>

                <p>to provide insurance cover for eligible terrorism losses (whether by entering into contracts or by other means);</p>

            </paragraph>

                <p>to operate a cyclone and related flood damage reinsurance pool by entering into contracts of reinsurance as reinsurer in accordance with <ref href="#part-2A">Part 2A</ref>;</p>

                <p>any other functions prescribed by the regulations.</p>

            <heading>Powers of Corporation</heading>

              <num>1</num>
              <content>
                <p>The Corporation has power to do all things necessary or convenient to be done for or in connection with the performance of its functions.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-11__subsec-2">
              <num>2</num>
              <content>
                <p>For the avoidance of doubt, the powers of the Corporation include:</p>
              </content>
              <paragraph eId="part-3__dvs-1__sec-11__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>the power to charge premiums in respect of contracts of insurance for which it is the insurer; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-11__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>the power to charge fees for services that it provides in connection with the performance of its functions.</p>
                </content>
              </paragraph>
            </subsection>

            <heading>Appointment of members</heading>

                <p>The members of the Corporation are to be appointed in writing by <role refersTo="#minister">the Minister</role>, on a part-time basis.</p>
              </content>
            </subsection>

                <p>A member holds office for the period specified in the instrument of appointment. The period must not exceed 4 years.</p>

            </subsection>

                <p><role refersTo="#minister">The Minister</role> must not appoint a person as a member unless <role refersTo="#minister">the Minister</role> is satisfied that the person:</p>

                  <p>has suitable qualifications or experience; and</p>
                </content>

                <p>The appointment of a member is not invalid merely because of a defect or irregularity in connection with the member’s appointment.</p>

            <heading>Acting Chair</heading>
            <content>
              <p><role refersTo="#minister">The Minister</role> may appoint a member to act as the Chair:</p>

                <p>during a vacancy in the office of Chair (whether or not an appointment has previously been made to the office); or</p>
              </content>
            </paragraph>

                <p>during any period, or during all periods, when the Chair is absent from duty or from Australia, or is, for any reason, unable to perform the duties of the office.</p>

            <heading>Outside employment of members</heading>
            <content>
              <p>A member must not engage in any paid employment that, in <role refersTo="#minister">the Minister</role>’s opinion, conflicts or may conflict with the proper performance of the member’s duties.</p>

            <num>17</num>
            <heading>Remuneration and allowances of members</heading>
            <subsection eId="part-3__dvs-2__sec-17__subsec-1">
              <num>1</num>

                <p>A member is to be paid the remuneration that is determined by the Remuneration Tribunal. If no determination of that remuneration by the Tribunal is in operation, the member is to be paid the remuneration that is prescribed.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-2__sec-17__subsec-2">
              <num>2</num>
              <content>
                <p>A member is to be paid the allowances that are prescribed.</p>
              </content>
            </subsection>

                <p>	(3)	This section has effect subject to the <i>Remuneration Tribunal Act 1973</i>.</p>

            </subsection>
          </section>

              <p>The Chair may grant leave of absence to any other member on the terms and conditions that the Chair determines.</p>

            <heading>Resignation</heading>
            <content>
              <p>A member may resign his or her appointment by giving <role refersTo="#minister">the Minister</role> a written resignation.</p>

            <heading>Termination of appointment of members</heading>
            <subsection eId="part-3__dvs-2__sec-20__subsec-1">

                <p><role refersTo="#minister">The Minister</role> may terminate a member’s appointment for misbehaviour or physical or mental incapacity.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-2__sec-20__subsec-2">
              <num>2</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> may terminate a member’s appointment if:</p>
              </content>
              <paragraph eId="part-3__dvs-2__sec-20__subsec-2__para-a">

                  <p>the member:</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-2__sec-20__subsec-2__para-i">

                  <p>is entitled to receive notice of meetings of the Corporation; and</p>
                </content>
              </paragraph>

                  <p>may attend any meeting of the Corporation and take such part in the proceedings, not including voting, as the observer thinks fit; and</p>

                  <p>may report to <role refersTo="#minister">the Minister</role> on any matter relating to the cyclone reinsurance scheme; and</p>

                <num>d</num>
                <content>
                  <p>if <role refersTo="#minister">the Minister</role> requests a report on such a matter, must report to <role refersTo="#minister">the Minister</role> on that matter.</p>

                  <p>Appointment of observers</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-2__sec-20A__subsec-2">

                <p><role refersTo="#minister">The Minister</role> may, by written instrument, appoint a representative of APRA or of the Australian Government Actuary to be an observer, on a part-time basis. At most 2 persons may hold office as observers at the same time, of whom:</p>

                <num>a</num>
                <content>
                  <p>at most one may be a representative of APRA; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-2__sec-20A__subsec-2__para-b">

                  <p>at most one may be a representative of the Australian Government Actuary.</p>
                </content>
              </paragraph>
            </subsection>

                <p>The Chair presides at all meetings at which he or she is present.</p>

                <p>If the Chair is not present at a meeting, the members present are to appoint one of their number to preside.</p>

            </subsection>

                <p>A quorum is constituted by a majority of the members for the time being holding office.</p>

                <p>without meeting, a majority of the members indicate agreement with the resolution in accordance with the method determined by the Corporation; and</p>

                <p>that majority would have constituted a quorum at a meeting of the Corporation.</p>

                <p>The Chief Executive is to be appointed in writing by the Corporation on a full-time basis.</p>
              </content>
            </subsection>

                <p>A member of the Corporation cannot be appointed as Chief Executive.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-4__sec-24__subsec-4">

                <p>The appointment of a person as Chief Executive is not invalid merely because of a defect or irregularity in connection with the person’s appointment.</p>
              </content>
            </subsection>
          </section>

            <heading>Duties of the Chief Executive</heading>
            <subsection eId="part-3__dvs-4__sec-25__subsec-1">

                <p>The Chief Executive is to manage the affairs of the Corporation subject to the directions of, and in accordance with policies determined by, the Corporation.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-4__sec-25__subsec-2">

              <content>
                <p>A thing is taken to have been done by the Corporation if it is done in the name of the Corporation, or on behalf of the Corporation:</p>

                  <p>by the Chief Executive; or</p>
                </content>
              </paragraph>

              <p>The Corporation may at any time terminate the appointment of the Chief Executive.</p>

            <heading>Acting appointments</heading>

                <p>The Corporation may appoint a person to act as the Chief Executive for a period not exceeding 3 months:</p>

                  <p>during a vacancy in the office of Chief Executive (whether or not an appointment has previously been made to the office); or</p>

                  <p>during any period when the Chief Executive is absent from duty or from Australia, or is, for any reason, unable to perform the duties of the office.</p>

                  <p>the Chief Executive continues to be absent or unable to perform the duties of the office;</p>
                </content>

                  <p>then <role refersTo="#minister">the Minister</role>, on the recommendation of the Corporation, may appoint a person to act as the Chief Executive.</p>

              <p>The Chief Executive must not engage in paid employment outside the duties of his or her office except with the approval of the Corporation.</p>

            <heading>Leave of absence</heading>

              <p>The Chair may grant leave of absence to the Chief Executive on the terms and conditions that the Chair determines.</p>

            <heading>Resignation</heading>
            <content>
              <p>The Chief Executive may resign his or her appointment by giving the Corporation a written resignation.</p>

                <p>The Corporation may employ such persons as it considers necessary for the performance of its functions and the exercise of its powers.</p>

                <p>An employee is to be employed on the terms and conditions that the Corporation determines in writing.</p>

              <num>1</num>

                <p>The Corporation may engage persons having suitable qualifications and experience as consultants to the Corporation.</p>

            </subsection>
            <subsection eId="part-3__dvs-5__sec-33__subsec-2">
              <num>2</num>
              <content>
                <p>The consultants are to be engaged on the terms and conditions that the Corporation determines in writing.</p>
              </content>
            </subsection>
          </section>

          <heading>Reviewing actuary</heading>
          <section eId="part-3__dvs-5A__sec-33A">
            <num>33A</num>
            <heading>Nomination of reviewing actuary</heading>
            <subsection eId="part-3__dvs-5A__sec-33A__subsec-1">
              <num>1</num>
              <content>
                <p>The Corporation must, in writing, nominate a person as reviewing actuary. The person must be an actuary who:</p>
              </content>
              <paragraph eId="part-3__dvs-5A__sec-33A__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>is a Fellow of The Institute of Actuaries of Australia; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-5A__sec-33A__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>in the opinion of the Corporation, is a fit and proper person, and has appropriate skills, experience or knowledge, to be the reviewing actuary; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-5A__sec-33A__subsec-1__para-c">
                <num>c</num>
                <content>
                  <p>is neither a person employed under <ref href="#sec-32">section 32</ref> nor a consultant engaged under <ref href="#sec-33">section 33</ref>.</p>

            </subsection>
            <subsection eId="part-3__dvs-5A__sec-33A__subsec-2">
              <num>2</num>
              <content>
                <p>The nomination has effect for 3 years, or a shorter period specified in the nomination.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-5A__sec-33A__subsec-3">
              <num>3</num>
              <content>
                <p>The Corporation must, in writing, revoke the nomination if the nominee:</p>
              </content>
              <paragraph eId="part-3__dvs-5A__sec-33A__subsec-3__para-a">
                <num>a</num>
                <content>
                  <p>ceases to be a Fellow of The Institute of Actuaries of Australia; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-5A__sec-33A__subsec-3__para-b">
                <num>b</num>
                <content>
                  <p>becomes a person employed under <ref href="#sec-32">section 32</ref> or a consultant engaged under <ref href="#sec-33">section 33</ref>.</p>

              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-5A__sec-33A__subsec-4">
              <num>4</num>
              <content>
                <p>	(4)	Subsections (2) and (3) do not limit subsection 33(3) of the <i>Acts Interpretation Act 1901</i> (which deals with revocation and variation of instruments).</p>

                <p>Reviewing actuary for first 3 years of cyclone reinsurance scheme</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-5A__sec-33A__subsec-5">

                <p>	(5)	The Corporation must nominate the Australian Government Actuary under subsection (1) as the first reviewing actuary, as soon as reasonably practicable after the commencement of this section. The nomination has effect for 3 years, despite subsection (2) of this section and subsection 33(3) of the <i>Acts Interpretation Act 1901</i>, but subject to subsection (3) of this section.</p>

                <p>Nominations and revocations are not legislative instruments</p>
              </content>
            </subsection>

            <heading>Duties of reviewing actuary</heading>

                <p>The duties of the reviewing actuary are:</p>

              <paragraph eId="part-3__dvs-5A__sec-33B__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>to review the premiums that the Corporation proposes to charge in respect of cyclone reinsurance contracts, and the Corporation’s compliance with <ref href="#sec-8D">section 8D</ref> in setting those premiums; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-5A__sec-33B__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>to review, and report to the Corporation on, each Financial Outlook Report prepared under <role refersTo="#minister">the Minister</role>; and<ref href="#sec-40A">section 40A</ref>, before the Report is given to </p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-5A__sec-33B__subsec-1__para-c">
                <num>c</num>
                <content>
                  <p>to provide advice and reports on actuarial matters, as requested by the Corporation.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-5A__sec-33B__subsec-2">
              <num>2</num>
              <content>
                <p>A report to the Corporation under paragraph (1)(b) must state whether, in the reviewing actuary’s opinion, the Corporation has made all arrangements necessary for the reviewing actuary to conduct the review to which the report relates.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-5A__sec-33B__subsec-3">
              <num>3</num>
              <content>
                <p>If the reviewing actuary has significant concerns about the financial sustainability of the cyclone reinsurance scheme, or the risk management processes of the Corporation, the reviewing actuary must report those concerns to the Corporation as soon as reasonably practicable.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-3__dvs-5A__sec-33C">
            <num>33C</num>
            <heading>Corporation to assist reviewing actuary</heading>
            <content>
              <p>The Corporation must make arrangements to enable the reviewing actuary to perform the duties for which <ref href="#sec-33B">section 33B</ref> provides.</p>

                <p>The Corporation’s money is to be applied only:</p>
              </content>
              <paragraph eId="part-3__dvs-6__sec-34__subsec-1__para-a">

                  <p>in payment or discharge of the expenses, charges, obligations and liabilities incurred or undertaken by the Corporation in the performance of its functions and the exercise of its powers; and</p>
                </content>
              </paragraph>

                <num>b</num>
                <content>
                  <p>in payment of remuneration and allowances payable under this Act.</p>
                </content>
              </paragraph>
            </subsection>

                <p>	(2)	Subsection (1) does not prevent investment, under <i>Public Governance, Performance and Accountability Act 2013</i>, of money that is not immediately required for the purposes of the Corporation.<ref href="#sec-59">section 59</ref> of the </p>

            <num>35</num>
            <heading>Commonwealth guarantee: payments otherwise than under cyclone reinsurance contracts</heading>
            <subsection eId="part-3__dvs-6__sec-35__subsec-1">
              <num>1</num>

                <p>The Commonwealth guarantees the due payment of money that may become payable by the Corporation to any person (other than the Commonwealth) otherwise than in respect of a liability of the Corporation under a cyclone reinsurance contract.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-6__sec-35__subsec-3">
              <num>3</num>
              <content>
                <p>If at any time the Corporation considers it likely that it will be unable to discharge all its liabilities (other than its liabilities under cyclone reinsurance contracts), after taking into account the guarantee under this section, then the Corporation must give <role refersTo="#minister">the Minister</role> a written notice to that effect.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-3__dvs-6__sec-35A">
            <num>35A</num>
            <heading>Commonwealth guarantee: payments under cyclone reinsurance contracts</heading>
            <subsection eId="part-3__dvs-6__sec-35A__subsec-1">
              <num>1</num>
              <content>
                <p>	(1)	The Commonwealth guarantees the due payment of money that may become payable by the Corporation to any person (other than the Commonwealth) in respect of a liability (a <b><i>cyclone loss liability</i></b>) of the Corporation under a cyclone reinsurance contract.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-6__sec-35A__subsec-2">
              <num>2</num>
              <content>
                <p>However, the total of the amounts paid by the Commonwealth under subsection (1) in a financial year must not exceed:</p>
              </content>
              <paragraph eId="part-3__dvs-6__sec-35A__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>unless paragraph (b) of this subsection applies—$10 billion; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-6__sec-35A__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>if an amount is determined for that financial year under subsection (4)—the greatest amount so determined.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-6__sec-35A__subsec-3">
              <num>3</num>
              <content>
                <p>If at any time the Corporation considers it likely that, after taking into account the guarantee under this section, the Corporation will be unable to discharge all its cyclone loss liabilities, the Corporation must give <role refersTo="#minister">the Minister</role> a written notice to that effect.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-6__sec-35A__subsec-4">
              <num>4</num>
              <content>
                <p>If <role refersTo="#minister">the Minister</role> receives a notice under subsection (3), <role refersTo="#minister">the Minister</role> must:</p>
              </content>
              <paragraph eId="part-3__dvs-6__sec-35A__subsec-4__para-a">
                <num>a</num>
                <content>
                  <p>if <role refersTo="#minister">the Minister</role> is not the Treasurer—consult with the Treasurer; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-6__sec-35A__subsec-4__para-b">
                <num>b</num>
                <content>
                  <p>consult with the Prime Minister and the Finance Minister; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-6__sec-35A__subsec-4__para-c">
                <num>c</num>
                <content>
                  <p>determine an amount for a financial year, for the purposes of paragraph (2)(b), that in <role refersTo="#minister">the Minister</role>’s opinion is sufficient to ensure that, after taking into account the guarantee under this section, the Corporation will be able to discharge all its cyclone loss liabilities.</p>

                <p>The validity of a determination under subsection (4) is not affected by a failure to comply with paragraph (4)(a) or (b).</p>

            <heading>Minister may give directions to Corporation</heading>
            <subsection eId="part-3__dvs-7__sec-38__subsec-1">
              <num>1</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> may, by notifiable instrument, direct the Corporation in relation to the performance of its functions and the exercise of its powers.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-7__sec-38__subsec-2">
              <num>2</num>
              <content>
                <p>The directions that may be given under subsection (1) include the following:</p>
              </content>
              <paragraph eId="part-3__dvs-7__sec-38__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>directions requiring the Corporation to pay money to the Commonwealth;</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-7__sec-38__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>directions requiring the Corporation to enter into contracts to borrow money from the Commonwealth;</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-7__sec-38__subsec-2__para-c">
                <num>c</num>
                <content>
                  <p>directions requiring the Corporation to enter into contracts to borrow money from persons other than the Commonwealth;</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-7__sec-38__subsec-2__para-d">
                <num>d</num>
                <content>
                  <p>directions setting premiums that are to be charged by the Corporation in respect of contracts of insurance (except cyclone reinsurance contracts);</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-7__sec-38__subsec-2__para-e">
                <num>e</num>
                <content>
                  <p>directions relating to the extent to which risk is to be retained by reinsureds under contracts of reinsurance that the Corporation enters into as reinsurer.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-7__sec-38__subsec-3">
              <num>3</num>
              <content>
                <p>Without limiting paragraph (2)(a), a direction under that paragraph may require the Corporation to make the following payments to the Commonwealth:</p>
              </content>
              <paragraph eId="part-3__dvs-7__sec-38__subsec-3__para-a">
                <num>a</num>
                <content>
                  <p>payments designed to ensure that sections 35 and 36 do not result in a competitive advantage for the Corporation;</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-7__sec-38__subsec-3__para-b">
                <num>b</num>
                <content>
                  <p>payments in the nature of dividends.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-7__sec-38__subsec-4">
              <num>4</num>
              <content>
                <p>A direction under paragraph (2)(c) cannot require the Corporation to enter into a contract with a particular person.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-7__sec-38__subsec-5">
              <num>5</num>
              <content>
                <p>The Corporation must perform its functions and exercise its powers in a manner consistent with any directions given by <role refersTo="#minister">the Minister</role> under this section.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-3__dvs-7__sec-39">
            <num>39</num>
            <heading>Evidence—Corporation’s seal</heading>
            <content>
              <p>All courts, judges and persons acting judicially must:</p>
            </content>
            <paragraph eId="part-3__dvs-7__sec-39__para-a">
              <num>a</num>
              <content>
                <p>take judicial notice of the imprint of the seal of the Corporation appearing on a document; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__dvs-7__sec-39__para-b">
              <num>b</num>
              <content>
                <p>presume that the document was duly sealed.</p>
              </content>
            </paragraph>
          </section>
          <section eId="part-3__dvs-7__sec-40">
            <num>40</num>
            <heading>Delegation by Corporation</heading>
            <subsection eId="part-3__dvs-7__sec-40__subsec-1">
              <num>1</num>
              <content>
                <p>The Corporation may, by writing, delegate all or any of its powers or functions under this Act to:</p>
              </content>
              <paragraph eId="part-3__dvs-7__sec-40__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>the Chief Executive; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-7__sec-40__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>a person employed under <ref href="#sec-32">section 32</ref>.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-7__sec-40__subsec-2">
              <num>2</num>
              <content>
                <p>However, a power or function under <ref href="#sec-8F">section 8F</ref> (declarations about cyclone events) may only be delegated to:</p>
              </content>
              <paragraph eId="part-3__dvs-7__sec-40__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>the Chief Executive; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-7__sec-40__subsec-2__para-b">
                <num>b</num>

                  <p>a person employed under <ref href="#sec-32">section 32</ref> in a senior executive position.</p>
                </content>
              </paragraph>

        <heading>Miscellaneous</heading>
        <section eId="part-4__sec-40A">
          <num>40A</num>
          <heading>Annual Financial Outlook Report</heading>
          <subsection eId="part-4__sec-40A__subsec-1">
            <num>1</num>
            <content>
              <p>After the end of a financial year beginning on or after <date date="2023-07-01">1 July 2023</date>, the Corporation must prepare and give to the Minister a Financial Outlook Report that sets out the matters prescribed by the regulations.</p>
            </content>
          </subsection>
          <subsection eId="part-4__sec-40A__subsec-2">
            <num>2</num>
            <content>
              <p>The Report must be given to <role refersTo="#minister">the Minister</role> on or before the next 15 October after the end of the financial year.</p>
            </content>
          </subsection>
          <subsection eId="part-4__sec-40A__subsec-3">
            <num>3</num>
            <content>
              <p>The Report must be published on the Corporation’s website within 10 business days after it is given to <role refersTo="#minister">the Minister</role>.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-4__sec-41">
          <num>41</num>
          <heading>Review of Act</heading>
          <content>
            <p><role refersTo="#minister">The Minister</role> must:</p>
          </content>
          <paragraph eId="part-4__sec-41__para-a">
            <num>a</num>
            <content>
              <p>as soon as practicable after <date date="2025-07-01">1 July 2025</date>; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-4__sec-41__para-b">
            <num>b</num>
            <content>
              <p>at least once every 5 years after that day;</p>
            </content>
            <content>
              <p>prepare a report that reviews the need for this Act to continue in operation.</p>
            </content>
          </paragraph>
        </section>
        <section eId="part-4__sec-42">
          <num>42</num>
          <heading>Compensation—constitutional safety net</heading>
          <subsection eId="part-4__sec-42__subsec-1">
            <num>1</num>
            <content>
              <p>If:</p>
            </content>
            <paragraph eId="part-4__sec-42__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>the operation of this Act would result in the acquisition of property otherwise than on just terms; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-42__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>the acquisition would not be valid, apart from this section, because a particular person has not been compensated;</p>
              </content>
              <content>
                <p>the Commonwealth is liable to pay a reasonable amount of compensation to the person.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-4__sec-42__subsec-2">
            <num>2</num>
            <content>
              <p>If the Commonwealth and the person do not agree on the amount of the compensation, the person may institute proceedings in the Federal Court of Australia for the recovery from the Commonwealth of such reasonable amount of compensation as the Court determines.</p>
            </content>
          </subsection>
          <subsection eId="part-4__sec-42__subsec-3">
            <num>3</num>
            <content>
              <p>The Consolidated Revenue Fund is appropriated for the purposes of this section.</p>
            </content>
          </subsection>
          <subsection eId="part-4__sec-42__subsec-4">
            <num>4</num>
            <content>
              <p>In this section:</p>
            </content>
            <content>
              <p><b><i>acquisition of property </i></b>has the same meaning as in paragraph 51(xxxi) of the Constitution.</p>
              <p><b><i>just terms</i></b> has the same meaning as in paragraph 51(xxxi) of the Constitution.</p>
            </content>
          </subsection>
        </section>

          <num>43</num>
          <heading>Regulations</heading>
          <content>
            <p>The Governor-General may make regulations prescribing matters:</p>
          </content>

              <p>required or permitted by this Act to be prescribed; or</p>
            </content>
          </paragraph>
