        <heading>Compensation payments for North Korean internment</heading>
        <section eId="part-2__sec-4">
          <num>4</num>
          <heading>Definitions</heading>
          <content>
            <p>In this Part:</p>
            <p><term refersTo="#term-commission">Commission</term> means <def>the Repatriation Commission referred to in the Veterans’ Entitlements Act 1986.</def></p>
            <p><term refersTo="#term-compensation-payment">compensation payment</term> means <def>a payment under this Part.</def></p>
            <p><term refersTo="#term-designated-war-period">designated war period</term> means <def>the period beginning on 27 June 1950 and ending at the end of 19 April 1956.</def></p>
            <p><term refersTo="#term-eligible-person">eligible person</term> means <def>a person who is eligible for a compensation payment.</def></p>
            <p><b><i>interned</i></b> means:</p>
          </content>
          <paragraph eId="part-2__sec-4__para-a">
            <num>a</num>
            <content>
              <p>confined in a camp, building, prison, cave or other place (including a vehicle); or</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-4__para-b">
            <num>b</num>
            <content>
              <p>restricted to residing within specified limits.</p>
            </content>
            <content>
              <p><term refersTo="#term-north-korean-military-forces">North Korean military forces</term> means <def>air forces, naval forces, land forces or other military forces of North Korea (however described).</def></p>
              <p><b><i>partner</i></b>, in relation to a veteran, means:</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-4__para-a">
            <num>a</num>
            <content>
              <p>a person who is legally married to the veteran; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-4__para-b">
            <num>b</num>
            <content>
              <p>	(b)	a person who is a partner (within the meaning of the <i>Veterans’ Entitlements Act 1986</i>) of the veteran.</p>
            </content>
            <content>
              <p><term refersTo="#term-secretary">Secretary</term> means <def>the Secretary of the Department.</def></p>
              <p><b><i>social security law</i></b> means:</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-4__para-a">
            <num>a</num>
            <content>
              <p>	(a)	the <i>Social Security Act 1991</i>; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-4__para-b">
            <num>b</num>
            <content>
              <p>	(b)	the <i>Social Security (Administration) Act 1999</i>; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-4__para-c">
            <num>c</num>
            <content>
              <p>any other Act that is expressed to form part of the social security law.</p>
            </content>
            <content>
              <p><term refersTo="#term-veteran">veteran</term> means <def>a person covered by <ref href="#sec-6C">section 6C</ref> of the Veterans’ Entitlements Act 1986, in so far as that section relates to item 1 of the table in Schedule 2 to that Act.</def></p>
            </content>
          </paragraph>
        </section>
        <section eId="part-2__sec-5">
          <num>5</num>
          <heading>Eligibility for compensation payment</heading>
          <content>
            <p>Veteran</p>
          </content>
          <subsection eId="part-2__sec-5__subsec-1">
            <num>1</num>
            <content>
              <p>A veteran is eligible for a compensation payment if the following conditions are satisfied:</p>
            </content>
            <paragraph eId="part-2__sec-5__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>the veteran was alive at the beginning of <date date="2003-07-01">1 July 2003</date>;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>the veteran was interned by North Korean military forces at any time during the designated war period.</p>
              </content>
              <content>
                <p>Partner of deceased veteran</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-5__subsec-2">
            <num>2</num>
            <content>
              <p>A person is eligible for a compensation payment in respect of a deceased veteran if the following conditions are satisfied:</p>
            </content>
            <paragraph eId="part-2__sec-5__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>the person was alive at the beginning of <date date="2003-07-01">1 July 2003</date>;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>the veteran died before <date date="2003-07-01">1 July 2003</date>;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>the person was a partner of the veteran immediately before the veteran’s death;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5__subsec-2__para-d">
              <num>d</num>
              <content>
                <p>the veteran was interned by North Korean military forces at any time during the designated war period.</p>
              </content>
              <content>
                <p>One payment only</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-5__subsec-3">
            <num>3</num>
            <content>
              <p>A person is not entitled to more than one compensation payment.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-2__sec-6">
          <num>6</num>
          <heading>Amount of compensation payment</heading>
          <content>
            <p>A compensation payment is a one-off payment of $25,000.</p>
          </content>
        </section>
        <section eId="part-2__sec-7">
          <num>7</num>
          <heading>Claims</heading>
          <subsection eId="part-2__sec-7__subsec-1">
            <num>1</num>
            <content>
              <p>Claims for compensation payments must be made in accordance with procedures determined by <role refersTo="#secretary">the Secretary</role> under subsection (2).</p>
            </content>

                <p>Note:	Compensation payments will be made automatically to those eligible persons the Department is aware of.</p>
              </content>
            </authorialNote>
          </subsection>
          <subsection eId="part-2__sec-7__subsec-2">
            <num>2</num>
            <content>
              <p><role refersTo="#secretary">The Secretary</role> may, in writing, determine the procedures for making claims.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-2__sec-8">
          <num>8</num>
          <heading>Determination of claims</heading>
          <subsection eId="part-2__sec-8__subsec-1">
            <num>1</num>
            <content>
              <p>Claims are to be decided by the Commission.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-8__subsec-2">
            <num>2</num>
            <content>
              <p>A person who is dissatisfied with the Commission’s decision on a claim may apply to the Administrative Review Tribunal for review of the decision.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-2__sec-9">
          <num>9</num>
          <heading>Death of eligible person</heading>
          <content>
            <p>If an eligible person dies or died before receiving a compensation payment, then the payment is to be made to the person’s estate.</p>
          </content>

              <p>Note:	A claim will still be required under <ref href="#sec-7">section 7</ref>.</p>

          </authorialNote>
        </section>
        <section eId="part-2__sec-10">
          <num>10</num>
          <heading>Application of certain provisions of the Veterans’ Entitlements Act 1986</heading>
          <content>
            <p>		The following provisions of the <i>Veterans’ Entitlements Act 1986</i> apply as if this Part were part of that Act:</p>
          </content>
          <paragraph eId="part-2__sec-10__para-a">
            <num>a</num>
            <content>
              <p>subsection 119(1) and sections 128, 208, 213 and 214;</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-10__para-b">
            <num>b</num>
            <content>
              <p>any other provisions of that Act that are incidental to the provisions mentioned in paragraph (a).</p>
            </content>
          </paragraph>
        </section>
        <section eId="part-2__sec-11">
          <num>11</num>
          <heading>Recovery of overpayments</heading>
          <content>
            <p>Any overpayment under this Part may be recovered by the Commonwealth as a debt in a court of competent jurisdiction.</p>
          </content>
        </section>
        <section eId="part-2__sec-12">
          <num>12</num>
          <heading>Exemption from income tax</heading>
          <content>
            <p>Compensation payments are exempt from income tax.</p>
          </content>
        </section>
        <section eId="part-2__sec-13">
          <num>13</num>
          <heading>Assets test</heading>
          <content>
            <p>Veterans’ Entitlements Act 1986</p>
          </content>
          <subsection eId="part-2__sec-13__subsec-1">
            <num>1</num>
            <content>
              <p>	(1)	The value of a person’s assets for the purposes of the <i>Veterans’ Entitlements Act 1986</i> is reduced by any compensation payment received by the person.</p>

            <content>
              <p>Social security law</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-13__subsec-2">
            <num>2</num>
            <content>
              <p>The value of a person’s assets for the purposes of the social security law is reduced by any compensation payment received by the person.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-2__sec-14">
          <num>14</num>
          <heading>Appropriation of Consolidated Revenue Fund</heading>
          <content>
            <p>The Consolidated Revenue Fund is appropriated for the purposes of compensation payments.</p>
          </content>

              <p>Step 1.	Work out the daily provisional payment rate for the primary payment on that day.</p>

              <p>Step 2.	Work out what would have been the daily provisional payment rate (the <b><i>notional rate</i></b>) for the primary payment on that day if both of the following assumptions were made:</p>

              <p>The first assumption is that the adjusted disability pension payable to the person, or the person’s partner, were an excluded amount (see <ref href="#sec-118N">section 118N</ref>A).</p>
              <p>Note:	This will mean the adjusted disability pension will not be treated as income when calculating the notional rate.</p>
              <p>	<i>Second assumption</i></p>
              <p>The second assumption is that, if an amount of rent assistance was included in the primary payment, that amount were reduced (but not to less than nil) by the rent reduction amount.</p>
              <p>	Note:	For <b><i>rent assistance</i></b> and <b><i>rent reduction amount</i></b> see subsection (4).</p>
              <p>Step 3.	Subtract the daily provisional payment rate under step 1 from the notional rate under step 2. The difference is the rate of DFISA on that day.</p>
              <p>DFISA rate where primary payment is compensation affected but not prescribed</p>

              <p>Definitions</p>
              <p><b><i>daily provisional payment rate</i></b> means the provisional payment rate, provisional annual payment rate or provisional fortnightly payment rate referred to in the Rate Calculator used under the Social Security Act to work out the rate of the primary payment, converted to a daily rate by dividing the rate by 364 (for a provisional annual payment rate) or 14 (for a provisional fortnightly payment rate).</p>
              <p><b><i>rent assistance</i></b> has the same meaning as in the Social Security Act.</p>
              <p><b><i>rent reduction amount</i></b> is the amount that would be a person’s income reduction under the Social Security Act if that income reduction were worked out by applying the same income test or ordinary income test that was used under that Act in calculating the person’s primary payment, but applying that test on the basis that the adjusted disability pension payable to the person, or the person’s partner, were the person’s only ordinary income for the purposes of that Act.</p>
              <p>Subdivision C—Special rules for the Social Security Act</p>

                <p>The rate of DFISA on a day that is on or after <date date="2004-09-20">20 September 2004</date> is worked out using method statement 1 in this subsection, unless:</p>

              <p>DFISA paid to person after the person dies</p>
              <p>the following provisions have effect:</p>

              <p>Financial institutions not liable</p>
              <p>the financial institution is, in spite of anything in any other law, not liable to any action, claim or demand by the Commonwealth, the personal representative of the person’s partner or anyone else in respect of the payment of that money to the person.</p>
              <p>Definitions</p>
              <p><b><i>bereavement payment provisions</i></b> of the Social Security Act means the following provisions of that Act:</p>
              <p><b><i>bereavement period</i></b> has the meaning given by subsection 21(2) of the Social Security Act.</p>
              <p><b><i>Social Security Secretary</i></b> means the Secretary of the Department administered by the Minister who administers the Social Security Act.</p>

                <p>a person is qualified for payments under a bereavement payment provision of the Social Security Act in relation to the death of the person’s partner; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-118ND__para-b">
              <num>b</num>
              <content>
                <p>after the person’s partner died, an amount of DFISA to which the partner would have been entitled if the partner had not died has been paid under this Part; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-118ND__para-c">
              <num>c</num>
              <content>
                <p>the Social Security Secretary is not satisfied that the person has not had the benefit of the DFISA amount;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-118ND__para-d">
              <num>d</num>
              <content>
                <p>the DFISA amount is not recoverable from the person or from the personal representative of the person’s partner, except to the extent (if any) that the DFISA amount exceeds the amount payable to the person under the bereavement payment provision;</p>

              <num>e</num>
              <content>
                <p>the amount payable to the person under the bereavement payment provision is to be reduced by the DFISA amount.</p>

            </paragraph>

            </hcontainer>

            </paragraph>

                <p>the amount of DFISA to which the person’s partner would have been entitled if the person’s partner had not died has been paid under this Part into an account with a financial institution within the bereavement period referred to in the bereavement payment provision; and</p>

                <p>adjusted disability pension is payable to a person or a person’s partner; and</p>
              </content>

                <p>a social security pension or social security benefit is payable to the person; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-118NE__para-c">

                <p>the rate of the social security pension or social security benefit is nil; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-118NE__para-d">

                <p>the rate of the social security pension or social security benefit would not be nil if the 2 assumptions (that relate to the adjusted disability pension) referred to in step 2 of method statement 1 in subsection 118NC(1) were made;</p>

              <p>then, for the purposes of the remote area allowance provisions of the Social Security Act, the rate of the social security pension or social security benefit on that day is taken to be greater than nil.</p>

                <p>DFISA bonus is payable to a person if:</p>

                <p>	(a)	on a day (the <b><i>critical day</i></b>) that is on or after 20 September 2004, adjusted disability pension is payable to the person or the person’s partner; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-118NF__para-b">
              <num>b</num>
              <content>
                <p>on the critical day, social security age pension becomes payable to the person; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-118NF__para-c">
              <num>c</num>
              <content>
                <p>on or after the critical day, social security pension bonus is granted to the person in relation to that age pension; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-118NF__para-d">
              <num>d</num>
              <content>
                <p>the adjusted disability pension reduces (including to nil) the amount of that pension bonus.</p>
              </content>
            </paragraph>
            <content>
              <p>Note:	For <b><i>adjusted disability pension</i></b>, <b><i>partner</i></b>, <b><i>social security age pension</i></b> and <b><i>social security pension bonus</i></b> see section 118NA.</p>

                <p>However, DFISA bonus is not payable to the person if, on the critical day, <ref href="#sec-1129">section 1129</ref> of the Social Security Act (financial hardship) applies to the person in relation to that age pension.</p>

            <heading>When DFISA bonus is to be paid</heading>

              <p>DFISA bonus is to be paid on:</p>

                <p>the first pension payday after the social security pension bonus was granted; or</p>
              </content>

                <p>if the Commission considers it is not practicable to pay the DFISA bonus on that payday—the next practicable day.</p>

            </paragraph>

            <heading>Payment of bonus after death</heading>

                <p>This section sets out the only circumstances in which DFISA bonus will be payable after the death of the person concerned.</p>
              </content>
            </hcontainer>
            <content>
              <p>DFISA bonus payable before person dies</p>
              <p>the bonus is payable to the legal personal representative of the person.</p>
              <p>Liability of Commonwealth</p>
              <p>Subdivision B—Amount of DFISA bonus</p>

                <p>If DFISA bonus is paid under subsection (2), the Commonwealth has no further liability to any person in respect of that bonus.</p>

                <p>	(ii)	apart from the adjusted disability pension, a payment (the <b><i>primary payment</i></b>) under a Commonwealth scheme would be payable to the person on that day.</p>

                <p>The regulations may also make provision for and in relation to a payment, or the provision of a non-financial benefit, to the person on a day that is on or after <date date="2004-09-20">20 September 2004</date> if:</p>
