          <p>		This Act may be cited as the <i>James Hardie (Investigations and Proceedings) Act 2004</i>.</p>

        <heading>Commencement</heading>
        <content>
          <p>This Act commences on the day after it receives the Royal Assent.</p>
        </content>

        <heading>Interpretation</heading>
        <content>
          <p>Definitions</p>
        </content>
        <subsection eId="sec-3__subsec-1">
          <num>1</num>
          <content>
            <p>In this Act:</p>
          </content>
          <content>
            <p><term refersTo="#term-abn-60-foundation-limited">ABN 60 Foundation Limited</term> means <def>ABN 60 Foundation Limited (ACN 106 266 611), which may also be known as ABN 60 Foundation Pty Limited.</def></p>
            <p><term refersTo="#term-abn-60-foundation-trust">ABN 60 Foundation Trust</term> means <def>the trust established by the ABN 60 Foundation Trust Deed.</def></p>
            <p><term refersTo="#term-abn-60-pty-ltd">ABN 60 Pty Ltd</term> means <def>ABN 60 Pty Ltd (ACN 000 009 263), which was formerly known as James Hardie Industries Limited.</def></p>
            <p><term refersTo="#term-amaba-pty-ltd">Amaba Pty Ltd</term> means <def>Amaba Pty Ltd (ACN 000 387 342).</def></p>
            <p><term refersTo="#term-amaca-pty-ltd">Amaca Pty Ltd</term> means <def>Amaca Pty Ltd (ACN 000 035 512).</def></p>
            <p><term refersTo="#term-asic">ASIC</term> means <def>the Australian Securities and Investments Commission.</def></p>
            <p><term refersTo="#term-asic-delegate">ASIC delegate</term> has the meaning given by <def>subsection 5(1) of <ref href="">the Australian Securities and Investments Commission Act 2001</ref>.</def></p>
            <p><term refersTo="#term-authorised-person">authorised person</term> means <def>any of the following: ASIC; an ASIC delegate; a person who is exercising, or has exercised, a power under: 	(i)	a warrant issued under <i>Australian Securities and Investments Commission Act 2001</i>; or<ref href="#sec-36">section 36</ref> of the  <ref href="#sec-37">section 37</ref> of that Act; the DPP; a person who has instituted a James Hardie proceeding or caused a James Hardie proceeding to be begun or carried on.</def></p>

            <num>a</num>
            <content>
              <p>ASIC;</p>
            </content>
          </paragraph>
          <paragraph eId="sec-3__subsec-1__para-b">
            <num>b</num>
            <content>
              <p>an ASIC delegate;</p>
            </content>
          </paragraph>
          <paragraph eId="sec-3__subsec-1__para-c">
            <num>c</num>
            <content>
              <p>a person who is exercising, or has exercised, a power under:</p>
            </content>
          </paragraph>
          <paragraph eId="sec-3__subsec-1__para-i">
            <num>i</num>
            <content>
              <p>	(i)	a warrant issued under <i>Australian Securities and Investments Commission Act 2001</i>; or<ref href="#sec-36">section 36</ref> of the </p>
            </content>
          </paragraph>
          <paragraph eId="sec-3__subsec-1__para-ii">
            <num>ii</num>
            <content>
              <p><ref href="#sec-37">section 37</ref> of that Act;</p>
            </content>
          </paragraph>
          <paragraph eId="sec-3__subsec-1__para-d">
            <num>d</num>
            <content>
              <p>the DPP;</p>
            </content>
          </paragraph>
          <paragraph eId="sec-3__subsec-1__para-e">
            <num>e</num>
            <content>
              <p>a person who has instituted a James Hardie proceeding or caused a James Hardie proceeding to be begun or carried on.</p>
            </content>
            <content>
              <p><term refersTo="#term-books">books</term> has the meaning given by <def>subsection 5(1) of <ref href="">the Australian Securities and Investments Commission Act 2001</ref>.</def></p>
              <p><term refersTo="#term-conduct">conduct</term> includes <def>an act or omission.</def></p>
              <p><term refersTo="#term-dpp">DPP</term> means <def>the Director of Public Prosecutions.</def></p>
              <p><term refersTo="#term-event">event</term> includes <def>any happening, circumstance, state of affairs, matter or issue.</def></p>
              <p><term refersTo="#term-james-hardie-group">James Hardie Group</term> means <def>the group of entities consisting of the following: James Hardie Industries NV; ABN 60 Pty Ltd; ABN 60 Foundation Limited; the ABN 60 Foundation Trust; MRCF; the MRCF Trust; MRCF Investments; Amaba Pty Ltd; Amaca Pty Ltd; a body corporate that is, or was, related to a body corporate mentioned in paragraph (a) or (b); 	(k)	a body corporate that is, or was, a related party (<i>Corporations Act 2001</i>) of a body corporate mentioned in paragraph (a) or (b);<ref href="#sec-228">within the meaning of section 228</ref> of the  a body corporate that is, or was, controlled by a body corporate mentioned in paragraph (a) or (b).</def></p>

          </paragraph>

              <p>James Hardie Industries NV;</p>

              <p>	(k)	a body corporate that is, or was, a related party (<i>Corporations Act 2001</i>) of a body corporate mentioned in paragraph (a) or (b);<ref href="#sec-228">within the meaning of section 228</ref> of the </p>

            <num>l</num>
            <content>
              <p>a body corporate that is, or was, controlled by a body corporate mentioned in paragraph (a) or (b).</p>
            </content>
            <content>
              <p><term refersTo="#term-james-hardie-group-restructure-event">James Hardie Group restructure event</term> means <def>an event relating to any of the following: a change to the corporate structure of the James Hardie Group; the transfer of assets or liabilities between entities that are part of the James Hardie Group; any reorganisation of the affairs of any entities that are part of the James Hardie Group; and, without limiting the generality of paragraphs (a) to (c), each of the following is a <b><i>James Hardie Group restructure event</i></b>: the establishment of the MRCF Trust; the registration of MRCF Investments; the registration of MRCF; the registration of ABN 60 Foundation Limited; Amaba Pty Ltd and Amaca Pty Ltd ceasing to be subsidiaries of ABN 60 Pty Ltd and becoming owned and controlled by the MRCF Trust and MRCF Investments; 	(i)	the passing of a resolution by the members of James Hardie Industries Limited on 28 September 2001 in favour of an arrangement under <i>Corporations Act 2001</i>;<ref href="#part-5">Part 5</ref>.1 of the  the approval of that arrangement by the Supreme Court of New South Wales; the issue of partly-paid shares by ABN 60 Pty Ltd to James Hardie Industries NV; the cancellation of those partly-paid shares.</def></p>
            </content>
          </paragraph>
          <paragraph eId="sec-3__subsec-1__para-a">
            <num>a</num>
            <content>
              <p>a change to the corporate structure of the James Hardie Group;</p>
            </content>
          </paragraph>
          <paragraph eId="sec-3__subsec-1__para-b">
            <num>b</num>
            <content>
              <p>the transfer of assets or liabilities between entities that are part of the James Hardie Group;</p>
            </content>
          </paragraph>
          <paragraph eId="sec-3__subsec-1__para-c">
            <num>c</num>
            <content>
              <p>any reorganisation of the affairs of any entities that are part of the James Hardie Group;</p>
            </content>
            <content>
              <p>and, without limiting the generality of paragraphs (a) to (c), each of the following is a <b><i>James Hardie Group restructure event</i></b>:</p>
            </content>
          </paragraph>
          <paragraph eId="sec-3__subsec-1__para-d">
            <num>d</num>
            <content>
              <p>the establishment of the MRCF Trust;</p>
            </content>
          </paragraph>
          <paragraph eId="sec-3__subsec-1__para-e">
            <num>e</num>
            <content>
              <p>the registration of MRCF Investments;</p>
            </content>
          </paragraph>
          <paragraph eId="sec-3__subsec-1__para-f">
            <num>f</num>
            <content>
              <p>the registration of MRCF;</p>
            </content>
          </paragraph>
          <paragraph eId="sec-3__subsec-1__para-g">
            <num>g</num>
            <content>
              <p>the registration of ABN 60 Foundation Limited;</p>
            </content>
          </paragraph>
          <paragraph eId="sec-3__subsec-1__para-h">
            <num>h</num>
            <content>
              <p>Amaba Pty Ltd and Amaca Pty Ltd ceasing to be subsidiaries of ABN 60 Pty Ltd and becoming owned and controlled by the MRCF Trust and MRCF Investments;</p>
            </content>
          </paragraph>
          <paragraph eId="sec-3__subsec-1__para-i">
            <num>i</num>
            <content>
              <p>	(i)	the passing of a resolution by the members of James Hardie Industries Limited on 28 September 2001 in favour of an arrangement under <i>Corporations Act 2001</i>;<ref href="#part-5">Part 5</ref>.1 of the </p>

              <p>the issue of partly-paid shares by ABN 60 Pty Ltd to James Hardie Industries NV;</p>
            </content>
          </paragraph>
          <paragraph eId="sec-3__subsec-1__para-l">
            <num>l</num>
            <content>
              <p>the cancellation of those partly-paid shares.</p>
            </content>

              <p><term refersTo="#term-james-hardie-industries-limited">James Hardie Industries Limited</term> means <def>James Hardie Industries Limited (ACN 000 009 263), which later became known as ABN 60 Pty Ltd.</def></p>
              <p><term refersTo="#term-james-hardie-industries-nv">James Hardie Industries NV</term> means <def>James Hardie Industries NV (ARBN 097 829 895).</def></p>
              <p><term refersTo="#term-james-hardie-investigation">James Hardie investigation</term> means <def>an investigation under Part 3 of <ref href="">the Australian Securities and Investments Commission Act 2001</ref> that relates to any of the following: the financial position of the James Hardie Group; the financial position of an entity that is part of the James Hardie Group; the ability of an entity that is part of the James Hardie Group to meet its liabilities at any time; an event that may affect, or may have affected, the ability of an entity that is part of the James Hardie Group to meet its liabilities at any time; a James Hardie Group restructure event; the appointment of a person as a director of ABN 60 Pty Ltd, ABN 60 Foundation Limited, MRCF, MRCF Investments, Amaba Pty Ltd or Amaca Pty Ltd; the conduct of any person who is, or was, an officer, employee or professional adviser of an entity that is part of the James Hardie Group, if that conduct: may have affected the ability of an entity that is part of the James Hardie Group to meet its liabilities at any time; or related to a James Hardie Group restructure event; or related to the appointment of a person as a director of ABN 60 Pty Ltd, ABN 60 Foundation Limited, MRCF, MRCF Investments, Amaba Pty Ltd or Amaca Pty Ltd; an event referred to in the James Hardie Special Commission of Inquiry report or a James Hardie Special Commission of Inquiry hearing; an event relating to: the James Hardie Group; or an entity that is part of the James Hardie Group; that is prescribed for the purposes of this paragraph.</def></p>

          </paragraph>

            <num>a</num>
            <content>
              <p>the financial position of the James Hardie Group;</p>
            </content>
          </paragraph>
          <paragraph eId="sec-3__subsec-1__para-b">
            <num>b</num>
            <content>
              <p>the financial position of an entity that is part of the James Hardie Group;</p>
            </content>
          </paragraph>
          <paragraph eId="sec-3__subsec-1__para-c">
            <num>c</num>
            <content>
              <p>the ability of an entity that is part of the James Hardie Group to meet its liabilities at any time;</p>
            </content>
          </paragraph>
          <paragraph eId="sec-3__subsec-1__para-d">

              <p>the appointment of a person as a director of ABN 60 Pty Ltd, ABN 60 Foundation Limited, MRCF, MRCF Investments, Amaba Pty Ltd or Amaca Pty Ltd;</p>

          </paragraph>
          <paragraph eId="sec-3__subsec-1__para-g">
            <num>g</num>
            <content>
              <p>the conduct of any person who is, or was, an officer, employee or professional adviser of an entity that is part of the James Hardie Group, if that conduct:</p>
            </content>
          </paragraph>
          <paragraph eId="sec-3__subsec-1__para-i">
            <num>i</num>
            <content>
              <p>may have affected the ability of an entity that is part of the James Hardie Group to meet its liabilities at any time; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-3__subsec-1__para-ii">
            <num>ii</num>
            <content>
              <p>related to a James Hardie Group restructure event; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-3__subsec-1__para-iii">
            <num>iii</num>
            <content>
              <p>related to the appointment of a person as a director of ABN 60 Pty Ltd, ABN 60 Foundation Limited, MRCF, MRCF Investments, Amaba Pty Ltd or Amaca Pty Ltd;</p>
            </content>
          </paragraph>
          <paragraph eId="sec-3__subsec-1__para-h">
            <num>h</num>
            <content>
              <p>an event referred to in the James Hardie Special Commission of Inquiry report or a James Hardie Special Commission of Inquiry hearing;</p>
            </content>
          </paragraph>
          <paragraph eId="sec-3__subsec-1__para-i">
            <num>i</num>
            <content>
              <p>an event relating to:</p>
            </content>
          </paragraph>
          <paragraph eId="sec-3__subsec-1__para-i">
            <num>i</num>
            <content>
              <p>the James Hardie Group; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-3__subsec-1__para-ii">
            <num>ii</num>
            <content>
              <p>an entity that is part of the James Hardie Group;</p>
            </content>
            <content>
              <p>that is prescribed for the purposes of this paragraph.</p>
              <p><term refersTo="#term-james-hardie-material">James Hardie material</term> means <def>the following: records that have been made, kept, or received by the James Hardie Special Commission of Inquiry; 	(b)	books that, after the commencement of this Act, a person takes possession of, or secures against interference, under a warrant issued under <i>Australian Securities and Investments Commission Act 2001</i>, for the purposes of, or in connection with, a James Hardie investigation or a James Hardie proceeding;<ref href="#sec-36">section 36</ref> of the  books that, after the commencement of this Act, ASIC, an ASIC delegate or the DPP requests or requires the production of, or receives, for the purposes of, or in connection with, a James Hardie investigation or a James Hardie proceeding; information that, after the commencement of this Act, ASIC, an ASIC delegate or the DPP requests or requires the provision of, or receives, for the purposes of, or in connection with, a James Hardie investigation or a James Hardie proceeding; other books, or information, relevant to a James Hardie investigation or a James Hardie proceeding that an authorised person receives after the commencement of this Act.</def></p>

              <p>information that, after the commencement of this Act, ASIC, an ASIC delegate or the DPP requests or requires the provision of, or receives, for the purposes of, or in connection with, a James Hardie investigation or a James Hardie proceeding;</p>
            </content>
          </paragraph>
          <paragraph eId="sec-3__subsec-1__para-e">
            <num>e</num>
            <content>
              <p>other books, or information, relevant to a James Hardie investigation or a James Hardie proceeding that an authorised person receives after the commencement of this Act.</p>
            </content>
            <content>
              <p><term refersTo="#term-james-hardie-proceeding">James Hardie proceeding</term> means <def>a proceeding <ref href="#sec-5__subsec-1">within the meaning of subsection 5(1)</ref> of <ref href="">the Australian Securities and Investments Commission Act 2001</ref> that ASIC, an ASIC delegate or the DPP institutes, causes to be begun or causes to be carried on, relating to conduct: engaged in by any of the following: a body corporate that is part of the James Hardie Group; a person who is, or was, an officer, employee or professional adviser of a body corporate that is part of the James Hardie Group; and that relates to a thing that is, has been, or could have been, the subject of a James Hardie investigation.</def></p>
            </content>
          </paragraph>
          <paragraph eId="sec-3__subsec-1__para-a">
            <num>a</num>
            <content>
              <p>engaged in by any of the following:</p>
            </content>
          </paragraph>
          <paragraph eId="sec-3__subsec-1__para-i">
            <num>i</num>
            <content>
              <p>a body corporate that is part of the James Hardie Group;</p>
            </content>
          </paragraph>
          <paragraph eId="sec-3__subsec-1__para-ii">
            <num>ii</num>
            <content>
              <p>a person who is, or was, an officer, employee or professional adviser of a body corporate that is part of the James Hardie Group; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-3__subsec-1__para-b">
            <num>b</num>
            <content>
              <p>that relates to a thing that is, has been, or could have been, the subject of a James Hardie investigation.</p>
            </content>

              <p><term refersTo="#term-james-hardie-special-commission-of-inquiry">James Hardie Special Commission of Inquiry</term> has the meaning given by <def>subsection 3(1) of the Special Commission of Inquiry (James Hardie Records) Act 2004 (NSW).</def></p>
              <p><term refersTo="#term-james-hardie-special-commission-of-inquiry-hearing">James Hardie Special Commission of Inquiry hearing</term> means <def>a hearing held by the James Hardie Special Commission of Inquiry.</def></p>
              <p><term refersTo="#term-james-hardie-special-commission-of-inquiry-report">James Hardie Special Commission of Inquiry report</term> means <def>the Report of the Special Commission of Inquiry into the Medical Research and Compensation Foundation dated September 2004.</def></p>
              <p><term refersTo="#term-legal-professional-privilege">legal professional privilege</term> includes <def>privilege under <ref href="#dvs-1">Division 1</ref> of <ref href="#part-3">Part 3</ref>.10 of <ref href="">the Evidence Act 1995</ref>, or a similar law of a State or Territory.</def></p>
              <p><term refersTo="#term-mrcf">MRCF</term> means <def>Medical Research and Compensation Foundation (ACN 095 924 137).</def></p>
              <p><term refersTo="#term-mrcf-investments">MRCF Investments</term> means <def>Medical Research and Compensation Foundation Investments Pty Ltd (ACN 095 026 837).</def></p>
              <p><term refersTo="#term-mrcf-trust">MRCF Trust</term> means <def>the Medical Research and Compensation Foundation Trust that was established in February 2001.</def></p>
              <p><b><i>professional adviser</i></b> includes:</p>
            </content>
          </paragraph>
          <paragraph eId="sec-3__subsec-1__para-a">
            <num>a</num>
            <content>
              <p>a legal adviser; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-3__subsec-1__para-b">
            <num>b</num>
            <content>
              <p>an accountant; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-3__subsec-1__para-c">
            <num>c</num>
            <content>
              <p>a financial adviser; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-3__subsec-1__para-d">
            <num>d</num>
            <content>
              <p>an auditor; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-3__subsec-1__para-e">
            <num>e</num>
            <content>
              <p>an actuary.</p>
            </content>
            <content>
              <p><term refersTo="#term-professional-confidential-relationship-privilege">professional confidential relationship privilege</term> means <def>privilege under <ref href="#dvs-1A">Division 1A</ref> of <ref href="#part-3">Part 3</ref>.10 of <ref href="">the Evidence Act 1995</ref> (NSW) or a similar law of a State or Territory.</def></p>
              <p><term refersTo="#term-record">record</term> has the meaning given by <def>subsection 3(1) of the Special Commission of Inquiry (James Hardie Records) Act 2004 (NSW).</def></p>
              <p><term refersTo="#term-subsidiary">subsidiary</term> has the meaning given by <def><ref href="#sec-9">section 9</ref> of <ref href="">the Corporations Act 2001</ref>.</def></p>
              <p>Meaning of <b>related to</b></p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-3__subsec-2">
          <num>2</num>
          <content>
            <p>	(2)	For the purposes of paragraph (j) of the definition of <b><i>James Hardie Group</i></b> in subsection (1), the question whether a body corporate is, or was, <b><i>related to</i></b> another body corporate is to be determined in accordance with the principles set out in section 50 of the <i>Corporations Act 2001</i>.</p>

            <p>Meaning of <b>controlled by</b></p>
          </content>
        </subsection>
        <subsection eId="sec-3__subsec-3">
          <num>3</num>
          <content>
            <p>	(3)	For the purposes of paragraph (l) of the definition of <b><i>James Hardie Group</i></b> in subsection (1), the question whether a body corporate is, or was, <b><i>controlled by</i></b> another body corporate is to be determined in accordance with the principles set out in section 50AA of the <i>Corporations Act 2001</i>.</p>

        </subsection>
      </section>
      <section eId="sec-4">
        <num>4</num>
        <heading>Abrogation of legal professional privilege</heading>
        <content>
          <p>Abrogation of privilege for investigations and proceedings</p>
        </content>
        <subsection eId="sec-4__subsec-1">
          <num>1</num>
          <content>
            <p>Legal professional privilege is abrogated in relation to James Hardie material for the purposes of, or in connection with:</p>
          </content>
          <paragraph eId="sec-4__subsec-1__para-a">
            <num>a</num>
            <content>
              <p>a James Hardie investigation; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-4__subsec-1__para-b">
            <num>b</num>
            <content>
              <p>a James Hardie proceeding.</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-4__subsec-2">
          <num>2</num>
          <content>
            <p>Without limiting the generality of subsection (1), a claim of legal professional privilege in relation to James Hardie material does not prevent an authorised person from:</p>
          </content>
          <paragraph eId="sec-4__subsec-2__para-a">
            <num>a</num>
            <content>
              <p>requesting or requiring the production or provision of James Hardie material; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-4__subsec-2__para-b">
            <num>b</num>
            <content>
              <p>exercising a power under:</p>
            </content>
          </paragraph>
          <paragraph eId="sec-4__subsec-2__para-i">
            <num>i</num>
            <content>
              <p>	(i)	a warrant issued under <i>Australian Securities and Investments Commission Act 2001</i>; or<ref href="#sec-36">section 36</ref> of the </p>
            </content>
          </paragraph>
          <paragraph eId="sec-4__subsec-2__para-ii">
            <num>ii</num>
            <content>
              <p><ref href="#sec-37">section 37</ref> of that Act;</p>
            </content>
            <content>
              <p>in relation to James Hardie material; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-4__subsec-2__para-c">
            <num>c</num>
            <content>
              <p>receiving or using James Hardie material;</p>
            </content>
            <content>
              <p>for the purposes of, or in connection with, a James Hardie investigation or a James Hardie proceeding.</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-4__subsec-3">
          <num>3</num>
          <content>
            <p>	(3)	To avoid doubt, <i>Australian Securities and Investments Commission Act 2001</i> does not apply in relation to James Hardie material for the purposes of, or in connection with, a James Hardie investigation or a James Hardie proceeding.<ref href="#sec-69">section 69</ref> of the </p>

            <p>Admissibility of evidence</p>
          </content>
        </subsection>
        <subsection eId="sec-4__subsec-4">
          <num>4</num>
          <content>
            <p>Without limiting the generality of subsection (1), despite:</p>

            <num>a</num>
            <content>
              <p>	(a)	<i>Evidence Act 1995</i>, or a similar law of a State or Territory; and<ref href="#dvs-1">Division 1</ref> of <ref href="#part-3">Part 3</ref>.10 of the </p>

          </paragraph>
          <paragraph eId="sec-4__subsec-4__para-b">
            <num>b</num>
            <content>
              <p>	(b)	paragraph 76(1)(d) of the <i>Australian Securities and Investments Commission Act 2001</i>;</p>

              <p>a claim of legal professional privilege in relation to James Hardie material does not prevent that material from being admissible in evidence in a James Hardie proceeding.</p>

          <content>
            <p>This section does not abrogate or affect any claim of legal professional privilege made by an authorised person in relation to James Hardie material.</p>

        <heading>Application of professional confidential relationship privilege</heading>
        <content>
          <p>Privilege does not apply for proceedings</p>
        </content>
        <subsection eId="sec-4A__subsec-1">
          <num>1</num>
          <content>
            <p>Professional confidential relationship privilege does not apply in relation to James Hardie material for the purposes of, or in connection with, a James Hardie proceeding.</p>
          </content>
          <content>
            <p>Authorised persons not affected</p>
          </content>
        </subsection>
        <subsection eId="sec-4A__subsec-2">
          <num>2</num>
          <content>
            <p>This section does not apply to any claim of professional confidential relationship privilege made by an authorised person in relation to James Hardie material.</p>
          </content>
        </subsection>
      </section>
      <section eId="sec-5">
        <num>5</num>
        <heading>James Hardie material still taken to be privileged for certain purposes</heading>
        <subsection eId="sec-5__subsec-1">
          <num>1</num>
          <content>
            <p>If, apart from <ref href="#sec-4">section 4</ref>, James Hardie material would have been privileged from production in legal proceedings for the purposes of:</p>
          </content>
          <paragraph eId="sec-5__subsec-1__para-a">
            <num>a</num>
            <content>
              <p>	(a)	subsection 42(1) of the <i>Freedom of Information Act 1982</i>; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-5__subsec-1__para-b">
            <num>b</num>
            <content>
              <p>	(b)	subsection 33(2) of the <i>Archives Act 1983</i>;</p>
            </content>
            <content>
              <p>then, for the purposes of that subsection, that material is taken still to be privileged from production in legal proceedings.</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-5__subsec-2">
          <num>2</num>
          <content>
            <p>	(2)	If, apart from <i>Proceeds of Crime Act 2002</i>, then, for the purposes of that subsection, that material is taken still to be privileged from being disclosed or produced in legal proceedings.<ref href="#sec-4">section 4</ref>, James Hardie material would have been privileged from being disclosed or produced in legal proceedings for the purposes of subsection 197(2) of the </p>

        <heading>Law relating to legal professional privilege and professional confidential relationship privilege not otherwise abrogated or affected</heading>

          <p>This Act does not otherwise abrogate or affect the law relating to legal professional privilege or professional confidential relationship privilege.</p>
