          <heading>Short title</heading>
          <content>
            <p>		This Act may be cited as the <i>Age Discrimination Act 2004</i>.</p>
          </content>
        </section>
        <section eId="part-1__sec-2">
          <num>2</num>
          <heading>Commencement</heading>
          <content>
            <p>This Act commences on the day after it receives the Royal Assent.</p>
          </content>
        </section>
        <section eId="part-1__sec-3">
          <num>3</num>
          <heading>Objects</heading>
          <content>
            <p>The objects of this Act are:</p>
          </content>
          <paragraph eId="part-1__sec-3__para-a">
            <num>a</num>
            <content>
              <p>to eliminate, as far as possible, discrimination against persons on the ground of age in the areas of work, education, access to premises, the provision of goods, services and facilities, accommodation, the disposal of land, the administration of Commonwealth laws and programs and requests for information; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-b">
            <num>b</num>
            <content>
              <p>to ensure, as far as practicable, that everyone has the same rights to equality before the law, regardless of age, as the rest of the community; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-c">
            <num>c</num>
            <content>
              <p>to allow appropriate benefits and other assistance to be given to people of a certain age, particularly younger and older persons, in recognition of their particular circumstances; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-d">
            <num>d</num>
            <content>
              <p>to promote recognition and acceptance within the community of the principle that people of all ages have the same fundamental rights; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-e">
            <num>e</num>
            <content>
              <p>to respond to demographic change by:</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-i">
            <num>i</num>
            <content>
              <p>removing barriers to older people participating in society, particularly in the workforce; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-ii">
            <num>ii</num>
            <content>
              <p>changing negative stereotypes about older people;</p>
            </content>
            <content>
              <p>bearing in mind the international commitment to eliminate age discrimination reflected in the Political Declaration adopted in Madrid, Spain on <date date="2002-04-12">12 April 2002</date> by the Second World Assembly on Ageing.</p>

          </paragraph>
        </section>
        <section eId="part-1__sec-4">
          <num>4</num>
          <heading>Simplified outline</heading>
          <content>
            <p>The following is a simplified outline of this Act:</p>
            <p>•	This Act makes it unlawful to discriminate on the ground of age.</p>
            <p>•	This Act has effect subject to certain geographical and constitutional limitations (see <ref href="#part-2">Part 2</ref>).</p>
            <p>•	Discrimination on the ground of age can be direct or indirect (see <ref href="#part-3">Part 3</ref>).</p>
            <p>•	It is unlawful to discriminate on the ground of age in relation to work (see <ref href="#dvs-2">Division 2</ref> of <ref href="#part-4">Part 4</ref>) and certain other areas (see <ref href="#dvs-3">Division 3</ref> of <ref href="#part-4">Part 4</ref>).</p>
            <p>•	It is also unlawful to commit an act of victimisation against another person (see <ref href="#dvs-6">Division 6</ref> of <ref href="#part-4">Part 4</ref>).</p>
            <p>•	It is not unlawful to discriminate on the ground of age if a particular exemption is applicable (see Divisions 4 and 5 of <ref href="#part-4">Part 4</ref>).</p>
            <p>•	It is an offence to do certain things related to age discrimination (see <ref href="#part-5">Part 5</ref>).</p>
            <p>•	Complaints can be made to the Commission about unlawful discrimination (see the definition of <b><i>unlawful discrimination </i></b>in subsection 3(1) of the <i>Australian Human Rights Commission Act 1986</i>, and section 46P of that Act).</p>
            <p>•	Functions are given to the Commission (see <ref href="#part-6">Part 6</ref>).</p>
            <p>•	The Age Discrimination Commissioner is established (see <ref href="#part-6A">Part 6A</ref>).</p>
            <p>•	Provision is made for miscellaneous matters such as delegation, protection from civil actions etc. (see <ref href="#part-7">Part 7</ref>).</p>

        </section>
        <section eId="part-1__sec-5">
          <num>5</num>
          <heading>Definitions</heading>
          <content>
            <p>In this Act:</p>
            <p><b><i>act </i></b>has a meaning affected by section 7.</p>
            <p><b><i>administrative office </i></b>means:</p>
          </content>
          <paragraph eId="part-1__sec-5__para-a">
            <num>a</num>
            <content>
              <p>an office established by, or an appointment made under, a law of the Commonwealth; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-b">
            <num>b</num>
            <content>
              <p>an office established by, or an appointment made under, a law of a Territory; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-c">
            <num>c</num>
            <content>
              <p>an appointment made by the Governor-General or a Minister otherwise than under a law of the Commonwealth or of a Territory; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-d">
            <num>d</num>
            <content>
              <p>an appointment as a director of an incorporated company that is a public authority of the Commonwealth;</p>
            </content>
            <content>
              <p>but does not include:</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-e">
            <num>e</num>
            <content>
              <p>	(e)	an office of member of the Assembly, member of the Executive, or Minister within the meaning of the <i>Australian Capital Territory (Self</i><i>-</i><i>Government) Act 1988</i>; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-f">
            <num>f</num>
            <content>
              <p>	(f)	an office of member of the Legislative Assembly, member of the Council or Minister of the Territory, within the meaning of the <i>Northern Territory (Self</i><i>-</i><i>Government) Act 1978</i>; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-h">
            <num>h</num>
            <content>
              <p>an office or appointment in the Australian Public Service; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-i">
            <num>i</num>
            <content>
              <p>	(i)	an office of a person employed under the <i>Members of Parliament (Staff) Act 1984</i>.</p>
            </content>

            <content>
              <p><term refersTo="#term-age">age</term> includes <def>age group.</def></p>
              <p><term refersTo="#term-chief-executive-medicare">Chief Executive Medicare</term> has the same meaning as <def>in the Human Services (Medicare) Act 1973.</def></p>
              <p><term refersTo="#term-commission">Commission</term> means <def>the Australian Human Rights Commission.</def></p>
              <p><term refersTo="#term-commissioner">Commissioner</term> means <def>the Age Discrimination Commissioner appointed under <ref href="#sec-53A">section 53A</ref>.</def></p>
              <p><term refersTo="#term-commonwealth-employee">Commonwealth employee</term> means <def>a person who: 	(a)	is appointed or engaged under the <i>Public Service Act 1999</i>; or holds an administrative office; or is employed by a public authority of the Commonwealth; or 	(d)	is employed under the <i>Australian Security Intelligence Organisation Act 1979</i><i> </i>or the <i>Commonwealth Electoral Act 1918</i>; or is a member of the Defence Force; or 	(f)	is the Commissioner of the Australian Federal Police, a Deputy Commissioner of the Australian Federal Police, an AFP employee or a special member of the Australian Federal Police (all within the meaning of the <i>Australian Federal Police Act 1979</i>); or 	(g)	is a person employed under the <i>Members of Parliament (Staff) Act 1984</i>.</def></p>

              <p>	(a)	is appointed or engaged under the <i>Public Service Act 1999</i>; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-b">
            <num>b</num>
            <content>
              <p>holds an administrative office; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-c">
            <num>c</num>
            <content>
              <p>is employed by a public authority of the Commonwealth; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-d">
            <num>d</num>
            <content>
              <p>	(d)	is employed under the <i>Australian Security Intelligence Organisation Act 1979</i><i> </i>or the <i>Commonwealth Electoral Act 1918</i>; or</p>
            </content>
          </paragraph>

              <p><b><i>premises</i></b> includes:</p>

              <p>a structure, building, aircraft, vehicle or vessel; and</p>

              <p><term refersTo="#term-president">President</term> means <def>President of the Commission.</def></p>
              <p><b><i>public authority of the Commonwealth</i></b> means:</p>

              <p>a body incorporated, whether before or after the commencement of this Act, for a public purpose by a law of the Commonwealth or a law of a Territory, being a body corporate employing staff on its own behalf; or</p>

              <p>an incorporated company over which the Commonwealth, or a body or authority mentioned in paragraph (a) or (b), is in a position to exercise control.</p>

              <p><term refersTo="#term-registered-charity">registered charity</term> means <def>an entity that is registered under the Australian Charities and Not-for-profits Commission Act 2012 as the type of entity mentioned in column 1 of item 1 of the table in subsection 25-5(5) of that Act.</def></p>
              <p><b><i>services</i></b> includes:</p>

              <p>services relating to banking, insurance, superannuation and the provision of grants, loans, credit or finance; or</p>

          </paragraph>

              <p>services relating to entertainment, recreation or refreshment; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-c">
            <num>c</num>
            <content>
              <p>services relating to transport or travel; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-d">
            <num>d</num>
            <content>
              <p>services relating to telecommunications; or</p>
            </content>

              <p>services of the kind provided by the members of any profession or trade; or</p>

              <p><b><i>State</i></b>, except in subsections 10(10) and (11), includes the Australian Capital Territory and the Northern Territory.</p>
              <p><b><i>Territory</i></b>, except in subsection 10(11) or in paragraph (c) of the definition of <b><i>administrative office</i></b><i> </i>in this section, does not include the Australian Capital Territory or the Northern Territory.</p>
              <p><b><i>this Act</i></b> includes the regulations.</p>

        </section>

          <heading>Age discrimination not to include disability discrimination</heading>
          <content>
            <p>		For the purposes of this Act, a reference to discrimination against a person on the ground of the person’s age is taken not to include a reference to discrimination against a person on the ground of a disability of the person (within the meaning of the <i>Disability Discrimination Act 1992</i>).</p>

          <heading>Meaning of act—omission to act</heading>

            <p>For the purposes of this Act, omitting to do an act is taken to be the doing of an act and a reference to an act includes a reference to an omission to do an act.</p>

          <heading>Commonwealth taken to be employer</heading>
          <content>
            <p>For the purposes of this Act, the Commonwealth is taken to be the employer of all Commonwealth employees.</p>

        <heading>Application and constitutional provisions</heading>

          <heading>Geographical application of Act</heading>

          <heading>Application of Act—constitutional powers</heading>
          <subsection eId="part-2__sec-10__subsec-1">

              <p>In this section:</p>

              <p><b><i>Australia</i></b> includes the external Territories.</p>
              <p><b><i>banking</i></b> has the same meaning as in paragraph 51(xiii) of the Constitution.</p>
              <p><b><i>foreign corporation</i></b> has the same meaning as in paragraph 51(xx) of the Constitution.</p>
              <p><b><i>insurance</i></b> has the same meaning as in paragraph 51(xiv) of the Constitution.</p>
              <p><b><i>limited application provisions</i></b> means the provisions of Divisions 2 and 3 of Part 4 (other than sections 23, 31 and 32).</p>
              <p><b><i>State banking</i></b> has the same meaning as in paragraph 51(xiii) of the Constitution.</p>
              <p><b><i>State insurance</i></b> has the same meaning as in paragraph 51(xiv) of the Constitution.</p>
              <p><b><i>trading or financial corporation</i></b> has the same meaning as in paragraph 51(xx) of the Constitution.</p>

              <p>The limited application provisions have effect as provided in <ref href="#sec-9">section 9</ref> and the following provisions of this section and not otherwise.</p>

            </paragraph>

            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-10__subsec-4">

              <p>Section 22 has effect in relation to discrimination by an authority or body in the exercise of a power under a Commonwealth law to confer, renew, extend, revoke or withdraw an authorisation or qualification.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-10__subsec-5">
            <num>5</num>
            <content>
              <p>This Act has effect in relation to acts done within a Territory.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-10__subsec-6">

            <content>
              <p>The limited application provisions have effect in relation to acts done by, or on behalf of:</p>
            </content>
            <paragraph eId="part-2__sec-10__subsec-6__para-a">
              <num>a</num>
              <content>
                <p>the Commonwealth or the Administration of a Territory; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-10__subsec-6__para-b">
              <num>b</num>

                <p>a body or authority established for a public purpose by a law of the Commonwealth or a law of a Territory;</p>
              </content>
              <content>
                <p>in the exercise of a power conferred by a law of the Commonwealth or a law of a Territory.</p>

            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-10__subsec-7">
            <num>7</num>
            <content>
              <p>The limited application provisions have effect in relation to discrimination against a person on the ground of age to the extent that the provisions:</p>
            </content>
            <paragraph eId="part-2__sec-10__subsec-7__para-a">
              <num>a</num>
              <content>
                <p>	(a)	give effect to the Discrimination (Employment and Occupation) Convention, 1958 adopted by the General Conference of the International Labour Organization on 25 June 1958 (a copy of the English text of which is set out in Schedule 1 to the <i>Australian Human Rights Commission Act 1986</i>); or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-10__subsec-7__para-b">
              <num>b</num>

                <p>	(b)	give effect to the International Covenant on Civil and Political Rights (a copy of the English text of which is set out in Schedule 2 to the<i> </i><i>Australian Human Rights Commission Act 1986</i>); or</p>

                <p>by a foreign corporation, or a trading or financial corporation formed within the limits of the Commonwealth; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-10__subsec-8__para-b">
              <num>b</num>
              <content>
                <p>by a person in the course of the person’s duties or purported duties as an officer or employee of such a corporation.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-10__subsec-9">
            <num>9</num>
            <content>
              <p>Without limiting the effect of subsection (8), the limited application provisions have effect in relation to discrimination:</p>
            </content>
            <paragraph eId="part-2__sec-10__subsec-9__para-a">
              <num>a</num>
              <content>
                <p>by a trading or financial corporation formed within the limits of the Commonwealth; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-10__subsec-9__para-b">
              <num>b</num>
              <content>
                <p>by a person in the course of the person’s duties or purported duties as an officer or employee of such a corporation;</p>
              </content>
              <content>
                <p>to the extent that the discrimination takes place in the course of the trading activities of the trading corporation or the financial activities of the financial corporation, as the case may be.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-10__subsec-10">
            <num>10</num>
            <content>
              <p>The limited application provisions have effect in relation to discrimination in the course of, or in relation to, the carrying on of the business of:</p>
            </content>
            <paragraph eId="part-2__sec-10__subsec-10__para-a">
              <num>a</num>
              <content>
                <p>banking, other than State banking not extending beyond the limits of the State concerned; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-10__subsec-10__para-b">
              <num>b</num>
              <content>
                <p>insurance, other than State insurance not extending beyond the limits of the State concerned.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-10__subsec-11">
            <num>11</num>
            <content>
              <p>The limited application provisions have effect in relation to discrimination in the course of, or in relation to, trade or commerce:</p>
            </content>
            <paragraph eId="part-2__sec-10__subsec-11__para-a">
              <num>a</num>

                <p>between Australia and a place outside Australia; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-10__subsec-11__para-b">

            <paragraph eId="part-2__sec-10__subsec-11__para-c">

                <p>between a State and a Territory; or</p>

                <p>between 2 Territories.</p>

            </paragraph>
          </subsection>
        </section>
        <section eId="part-2__sec-11">
          <num>11</num>
          <heading>Compensation—constitutional safety net</heading>
          <subsection eId="part-2__sec-11__subsec-1">
            <num>1</num>
            <content>
              <p>If:</p>
            </content>
            <paragraph eId="part-2__sec-11__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>the operation of this Act would result in the acquisition of property otherwise than on just terms; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-11__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>the acquisition would not be valid, apart from this section, because a particular person has not been compensated;</p>
              </content>
              <content>
                <p>the Commonwealth is liable to pay a reasonable amount of compensation to the person.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-11__subsec-2">
            <num>2</num>
            <content>
              <p>If the Commonwealth and the person do not agree on the amount of the compensation, the person may institute proceedings in the Federal Court of Australia for the recovery from the Commonwealth of such reasonable amount of compensation as the Court determines.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-11__subsec-3">
            <num>3</num>
            <content>
              <p>In this section:</p>
            </content>
            <content>
              <p><b><i>acquisition of property</i></b> has the same meaning as in paragraph 51(xxxi) of the Constitution.</p>
              <p><b><i>just terms</i></b> has the same meaning as in paragraph 51(xxxi) of the Constitution.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-2__sec-12">
          <num>12</num>
          <heading>Operation of State and Territory laws</heading>
          <subsection eId="part-2__sec-12__subsec-1">
            <num>1</num>
            <content>
              <p>A reference in this section to this Act is a reference to this Act as it has effect because of a provision of sections 9 and 10.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-12__subsec-2">
            <num>2</num>
            <content>
              <p>A reference in this section to a law of a State or Territory is a reference to a law of a State or Territory that deals with discrimination on the ground of age.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-12__subsec-3">
            <num>3</num>
            <content>
              <p>This Act is not intended to exclude or limit the operation of a law of a State or Territory that is capable of operating concurrently with this Act.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-12__subsec-4">
            <num>4</num>
            <content>
              <p>If:</p>
            </content>
            <paragraph eId="part-2__sec-12__subsec-4__para-a">
              <num>a</num>
              <content>
                <p>a law of a State or Territory relating to discrimination deals with a matter dealt with by this Act; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-12__subsec-4__para-b">
              <num>b</num>
              <content>
                <p>	(b)	a person has made a complaint or initiated a proceeding under that law in respect of an act in respect of which the person would, apart from this subsection, have been entitled to make a complaint under the <i>Australian Human Rights Commission Act 1986</i> alleging that the act is unlawful under a provision of Part 4 of this Act;</p>
              </content>
              <content>
                <p>the person is not entitled to make a complaint or institute a proceeding under the <i>Australian Human Rights Commission Act 1986</i> alleging that the act is unlawful under a provision of Part 4 of this Act.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-12__subsec-5">
            <num>5</num>
            <content>
              <p>If:</p>
            </content>
            <paragraph eId="part-2__sec-12__subsec-5__para-a">
              <num>a</num>
              <content>
                <p>a law of a State or Territory relating to discrimination deals with a matter dealt with by this Act; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-12__subsec-5__para-b">
              <num>b</num>
              <content>
                <p>an act by a person that constitutes an offence against that law also constitutes an offence against this Act;</p>
              </content>
              <content>
                <p>the person may be prosecuted and convicted either under that law of the State or Territory or under this Act</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-12__subsec-6">
            <num>6</num>
            <content>
              <p>Nothing in subsection (5) makes a person liable to be punished more than once in respect of the same act.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-2__sec-13">

          <heading>Extent to which Act binds the Crown</heading>
          <subsection eId="part-2__sec-13__subsec-1">
            <num>1</num>
            <content>
              <p>This Act binds the Crown in right of the Commonwealth and of each of the States.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-13__subsec-2">
            <num>2</num>
            <content>
              <p>This Act does not make the Crown in right of the Commonwealth or of a State liable to be prosecuted for an offence.</p>
            </content>
          </subsection>
        </section>

        <heading>Concept of age discrimination</heading>
        <section eId="part-3__sec-14">
          <num>14</num>
          <heading>Discrimination on the ground of age—direct discrimination</heading>
          <content>
            <p>		For the purposes of this Act, a person (the <b><i>discriminator</i></b>) <b><i>discriminates</i></b> against another person (the <b><i>aggrieved person</i></b>) on the ground of the age of the aggrieved person if:</p>
          </content>
          <paragraph eId="part-3__sec-14__para-a">
            <num>a</num>
            <content>
              <p>the discriminator treats or proposes to treat the aggrieved person less favourably than, in circumstances that are the same or are not materially different, the discriminator treats or would treat a person of a different age; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-3__sec-14__para-b">
            <num>b</num>
            <content>
              <p>the discriminator does so because of:</p>
            </content>
          </paragraph>
          <paragraph eId="part-3__sec-14__para-i">
            <num>i</num>
            <content>
              <p>the age of the aggrieved person; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-3__sec-14__para-ii">
            <num>ii</num>
            <content>
              <p>a characteristic that appertains generally to persons of the age of the aggrieved person; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-3__sec-14__para-iii">
            <num>iii</num>
            <content>
              <p>a characteristic that is generally imputed to persons of the age of the aggrieved person.</p>
            </content>
          </paragraph>
        </section>
        <section eId="part-3__sec-15">
          <num>15</num>
          <heading>Discrimination on the ground of age—indirect discrimination</heading>
          <subsection eId="part-3__sec-15__subsec-1">
            <num>1</num>
            <content>
              <p>	(1)	For the purposes of this Act, a person (the <b><i>discriminator</i></b>) <b><i>discriminates</i></b> against another person (the <b><i>aggrieved person</i></b>) on the ground of the age of the aggrieved person if:</p>
            </content>
            <paragraph eId="part-3__sec-15__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>the discriminator imposes, or proposes to impose, a condition, requirement or practice; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-15__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>the condition, requirement or practice is not reasonable in the circumstances; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-15__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>the condition, requirement or practice has, or is likely to have, the effect of disadvantaging persons of the same age as the aggrieved person.</p>
              </content>
            </paragraph>
          </subsection>

                <p>It is unlawful for an employer or a person acting or purporting to act on behalf of an employer to discriminate against an employee on the ground of the employee’s age:</p>

                  <p>in the terms or conditions of employment that the employer affords the employee; or</p>

                <p>It is unlawful for a principal to discriminate against a person on the ground of the person’s age:</p>

                  <p>in the arrangements the principal makes for the purpose of determining who should be engaged as a commission agent; or</p>
                </content>
              </paragraph>

                  <p>in determining who should be engaged as a commission agent; or</p>
                </content>
              </paragraph>

                <p>It is unlawful for a principal to discriminate against a commission agent on the ground of the commission agent’s age:</p>

                  <p>in the terms or conditions that the principal affords the commission agent as a commission agent; or</p>
                </content>

                <p><b><i>commission agent </i></b>means a person who does work for another person as the agent of that other person and who is remunerated, whether in whole or in part, by commission.</p>
                <p><b><i>principal</i></b>, in relation to a commission agent, means a person for whom the commission agent does work as a commission agent.</p>

            <heading>Discrimination against contract workers</heading>
            <subsection eId="part-4__dvs-2__sec-20__subsec-1">
              <num>1</num>
              <content>
                <p>It is unlawful for a principal to discriminate against a contract worker on the ground of the contract worker’s age:</p>
              </content>
              <paragraph eId="part-4__dvs-2__sec-20__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>in the terms or conditions on which the principal allows the contract worker to work; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-20__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>by not allowing the contract worker to work or continue to work; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-20__subsec-1__para-c">
                <num>c</num>
                <content>
                  <p>by denying the contract worker access, or limiting the contract worker’s access, to any benefit associated with the work in respect of which the contract with the employer is made; or</p>

                  <p>if the other person is already working for the principal as a contract worker—the other person’s performance as a contract worker; and</p>

                <p><b><i>contract worker</i></b> means a person who does work for another person under a contract between the employer of the first-mentioned person and that other person.</p>
                <p><b><i>principal</i></b>, in relation to a contract worker, means a person for whom the contract worker does work under a contract between the employer of the contract worker and the person.</p>

            <heading>Partnerships</heading>
            <subsection eId="part-4__dvs-2__sec-21__subsec-1">
              <num>1</num>
              <content>
                <p>It is unlawful for 6 or more persons who are proposing to form themselves into a partnership to discriminate against another person on the ground of the other person’s age:</p>
              </content>
              <paragraph eId="part-4__dvs-2__sec-21__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>in determining who should be invited to become a partner in the partnership; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-21__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>in the terms or conditions on which the other person is invited to become a partner in the partnership.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-4__dvs-2__sec-21__subsec-2">
              <num>2</num>
              <content>
                <p>It is unlawful for any one or more of the partners in a partnership consisting of 6 or more partners to discriminate against another person on the ground of the other person’s age:</p>
              </content>

                <content>
                  <p>in determining who should be invited to become a partner in the partnership; or</p>
                </content>
              </paragraph>

                  <p>in the terms or conditions on which the other person is invited to become a partner in the partnership.</p>

                <p>It is unlawful for any one or more of the partners in a partnership consisting of 6 or more partners to discriminate against another partner in the partnership on the ground of the other partner’s age:</p>

                <content>
                  <p>by denying the other partner access, or limiting the other partner’s access, to any benefit arising from being a partner in the partnership; or</p>

                  <p>by expelling the other partner from the partnership; or</p>
                </content>

                <p>In deciding whether the other person is unable to carry out those requirements because of his or her age, take into account:</p>

                  <p>the other person’s past training, qualifications and experience relevant to the proposed partnership or the partnership; and</p>

                  <p>if the other person is already a partner—the other person’s performance as a partner; and</p>

            <heading>Qualifying bodies</heading>
            <subsection eId="part-4__dvs-2__sec-22__subsec-1">
              <num>1</num>
              <content>
                <p>It is unlawful for an authority or body that is empowered to confer, renew, extend, revoke or withdraw an authorisation or qualification that is needed for or facilitates the practice of a profession, the carrying on of a trade or the engaging in of an occupation to discriminate against a person on the ground of the person’s age:</p>
              </content>
              <paragraph eId="part-4__dvs-2__sec-22__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>by refusing or failing to confer, renew or extend the authorisation or qualification; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-22__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>in the terms or conditions on which it is prepared to confer the authorisation or qualification or to renew or extend the authorisation or qualification; or</p>

                  <p>by revoking or withdrawing the authorisation or qualification or varying the terms or the conditions upon which it is held.</p>

                <p>This section does not make it unlawful for an authority or body to discriminate against a person, on the ground of the person’s age, if the person is unable to carry out the inherent requirements of the profession, trade or occupation because of his or her age.</p>

                <p>In deciding whether the person is unable to carry out those requirements because of his or her age, take into account:</p>

                  <p>the person’s past training, qualifications and experience relevant to the particular profession, trade or occupation; and</p>
                </content>
              </paragraph>

                  <p>if the person is already a member of the profession, carrying on the trade or engaged in the occupation—the person’s performance in the profession, trade or occupation; and</p>

                  <p>all other relevant factors that it is reasonable to take into account.</p>

            <heading>Registered organisations under the Fair Work (Registered Organisations) Act 2009</heading>
            <subsection eId="part-4__dvs-2__sec-23__subsec-1">
              <num>1</num>
              <content>
                <p>It is unlawful for a registered organisation, the committee of management of a registered organisation or a member of the committee of management of a registered organisation to discriminate against a person, on the ground of the person’s age:</p>
              </content>
              <paragraph eId="part-4__dvs-2__sec-23__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>by refusing or failing to accept the person’s application for membership; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-23__subsec-1__para-b">

                  <p>in the terms or conditions on which the organisation is prepared to admit the person to membership.</p>
                </content>
              </paragraph>

                <p>It is unlawful for a registered organisation, the committee of management of a registered organisation or a member of the committee of management of a registered organisation to discriminate against a person who is a member of the registered organisation, on the ground of the member’s age:</p>

                <p><b><i>registered organisation</i></b> means an organisation registered, or an association recognised, under the <i>Fair Work (Registered Organisations) Act 2009</i>.</p>

                <p>It is unlawful for an employment agency to discriminate against a person on the ground of the person’s age:</p>

                </content>

                  <p>in the manner in which it provides the person with any of its services.</p>

                  <p>Exemption for inherent requirements</p>

                <p>This section does not make it unlawful for an employment agency to discriminate against a person, on the ground of the person’s age, if the person is unable to carry out the inherent requirements of the work sought because of his or her age.</p>

                <p>In deciding whether the person is unable to carry out those requirements because of his or her age, take into account:</p>
              </content>

                  <p>the person’s past training, qualifications and experience relevant to the work sought; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-24__subsec-3__para-b">
                <num>b</num>
                <content>
                  <p>all other relevant factors that it is reasonable to take into account.</p>
                </content>

                  <p>Definition</p>

                <p>In this section:</p>
              </content>

                <p><b><i>employment agency</i></b> means any person who, or body that, whether for payment or not, assists persons to find employment or other work or assists employers to find employees or workers.</p>

            <heading>Exemption for youth wages</heading>
            <subsection eId="part-4__dvs-2__sec-25__subsec-1">
              <num>1</num>
              <content>
                <p>This Division does not make it unlawful for a person to discriminate against another person on the ground of the other person’s age, in relation to youth wages:</p>
              </content>
              <paragraph eId="part-4__dvs-2__sec-25__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>in the arrangements made for the purpose of determining who should be offered work; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-25__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>in determining who should be offered work; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-25__subsec-1__para-c">

                  <p>in payment, or offer of payment, of remuneration for work.</p>
                </content>
              </paragraph>
            </subsection>

          <heading>Discrimination in other areas</heading>

            <heading>Education</heading>
            <subsection eId="part-4__dvs-3__sec-26__subsec-1">

              <content>
                <p>It is unlawful for an educational authority to discriminate against a person on the ground of the person’s age:</p>
              </content>
              <paragraph eId="part-4__dvs-3__sec-26__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>by refusing or failing to accept the person’s application for admission as a student; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-3__sec-26__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>in the terms or conditions on which it is prepared to admit the person as a student.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-4__dvs-3__sec-26__subsec-2">
              <num>2</num>
              <content>
                <p>It is unlawful for an educational authority to discriminate against a student on the ground of the student’s age:</p>
              </content>
              <paragraph eId="part-4__dvs-3__sec-26__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>by denying the student access, or limiting the student’s access, to any benefit provided by the educational authority; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-3__sec-26__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>by expelling the student; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-3__sec-26__subsec-2__para-c">
                <num>c</num>
                <content>
                  <p>by subjecting the student to any other detriment.</p>
                </content>
                <content>
                  <p>Exemption for educational institutions established wholly or primarily for students above a particular age</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-4__dvs-3__sec-26__subsec-3">
              <num>3</num>
              <content>
                <p>This section does not make it unlawful to discriminate against a person on the ground of the person’s age in respect of admission to an educational institution established wholly or primarily for students above a particular age, if the person is not above that age.</p>

            <subsection eId="part-4__dvs-3__sec-26__subsec-4">

              <content>
                <p>In this section:</p>
              </content>
              <content>
                <p><b><i>educational authority</i></b> means a body or person administering an educational institution.</p>
                <p><b><i>educational institution</i></b> means a school, college, university or other institution at which education or training is provided.</p>
              </content>
            </subsection>

            <num>27</num>
            <heading>Access to premises</heading>
            <content>
              <p>It is unlawful for a person to discriminate against another person on the ground of the other person’s age:</p>
            </content>
            <paragraph eId="part-4__dvs-3__sec-27__para-a">
              <num>a</num>
              <content>
                <p>by refusing to allow the other person access to, or the use of, any premises that the public or a section of the public is entitled or allowed to enter or use (whether for payment or not); or</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__dvs-3__sec-27__para-b">
              <num>b</num>
              <content>
                <p>in the terms or conditions on which the first-mentioned person is prepared to allow the other person access to, or the use of, any such premises; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__dvs-3__sec-27__para-c">
              <num>c</num>
              <content>
                <p>in relation to the provision of means of access to such premises; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__dvs-3__sec-27__para-d">
              <num>d</num>
              <content>
                <p>by refusing to allow the other person the use of any facilities in such premises that the public or a section of the public is entitled or allowed to use (whether for payment or not); or</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__dvs-3__sec-27__para-e">
              <num>e</num>
              <content>
                <p>in the terms or conditions on which the first-mentioned person is prepared to allow the other person the use of any such facilities; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__dvs-3__sec-27__para-f">
              <num>f</num>
              <content>
                <p>by requiring the other person to leave such premises or cease to use such facilities.</p>
              </content>
            </paragraph>
          </section>
          <section eId="part-4__dvs-3__sec-28">
            <num>28</num>
            <heading>Goods, services and facilities</heading>
            <content>
              <p>It is unlawful for a person who, whether for payment or not, provides goods or services, or makes facilities available, to discriminate against another person on the ground of the other person’s age:</p>
            </content>
            <paragraph eId="part-4__dvs-3__sec-28__para-a">
              <num>a</num>
              <content>
                <p>by refusing to provide the other person with those goods or services or to make those facilities available to the other person; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__dvs-3__sec-28__para-b">
              <num>b</num>
              <content>
                <p>in the terms or conditions on which the first-mentioned person provides the other person with those goods or services or makes those facilities available to the other person; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__dvs-3__sec-28__para-c">
              <num>c</num>
              <content>
                <p>in the manner in which the first-mentioned person provides the other person with those goods or services or makes those facilities available to the other person.</p>
              </content>
            </paragraph>
          </section>
          <section eId="part-4__dvs-3__sec-29">
            <num>29</num>
            <heading>Accommodation</heading>
            <subsection eId="part-4__dvs-3__sec-29__subsec-1">
              <num>1</num>
              <content>
                <p>It is unlawful for a person, whether as principal or agent, to discriminate against another person on the ground of the other person’s age:</p>
              </content>
              <paragraph eId="part-4__dvs-3__sec-29__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>by refusing the other person’s application for accommodation; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-3__sec-29__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>in the terms or conditions on which the accommodation is offered to the other person; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-3__sec-29__subsec-1__para-c">
                <num>c</num>
                <content>
                  <p>by deferring the other person’s application for accommodation or according to the other person a lower order of precedence in any list of applicants for that accommodation.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-4__dvs-3__sec-29__subsec-2">
              <num>2</num>
              <content>
                <p>It is unlawful for a person, whether as principal or agent, to discriminate against another person on the ground of the other person’s age:</p>
              </content>
              <paragraph eId="part-4__dvs-3__sec-29__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>by denying the other person access, or limiting the other person’s access, to any benefit associated with accommodation occupied by the other person; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-3__sec-29__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>by evicting the other person from accommodation occupied by the other person; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-3__sec-29__subsec-2__para-c">
                <num>c</num>
                <content>
                  <p>by subjecting the other person to any other detriment in relation to accommodation occupied by the other person.</p>
                </content>
                <content>
                  <p>Exemption for accommodation provider who is resident etc.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-4__dvs-3__sec-29__subsec-3">
              <num>3</num>
              <content>
                <p>This section does not apply to or in respect of the provision of accommodation in premises if:</p>
              </content>
              <paragraph eId="part-4__dvs-3__sec-29__subsec-3__para-a">
                <num>a</num>
                <content>
                  <p>the person who provides or proposes to provide the accommodation or a near relative of that person resides, and intends to continue to reside on those premises; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-3__sec-29__subsec-3__para-b">
                <num>b</num>
                <content>
                  <p>the accommodation provided in those premises is for no more than 3 persons other than a person mentioned in paragraph (a) or near relatives of such a person.</p>
                </content>
                <content>
                  <p>Definitions</p>

              </paragraph>
            </subsection>
            <subsection eId="part-4__dvs-3__sec-29__subsec-4">
              <num>4</num>
              <content>
                <p>In this section:</p>
              </content>
              <content>
                <p><b><i>accommodation </i></b>includes residential or business accommodation.</p>
                <p><b><i>child</i></b>: without limiting who is a child of a person for the purposes of paragraph (a) of the definition of <b><i>near relative</i></b> in this subsection, someone is the <b><i>child</i></b> of a person if he or she is a child of the person within the meaning of the <i>Family Law Act 1975</i>.</p>
                <p><b><i>de facto</i></b><b><i> </i></b><b><i>partner</i></b> has the meaning given by the <i>Acts Interpretation Act 1901</i>.</p>
                <p><b><i>near relative</i></b>, in relation to a person, means:</p>
              </content>
              <paragraph eId="part-4__dvs-3__sec-29__subsec-4__para-a">
                <num>a</num>
                <content>
                  <p>a parent, child, grandparent, grandchild, brother or sister of the person; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-3__sec-29__subsec-4__para-b">
                <num>b</num>
                <content>
                  <p>the spouse or de facto partner of the first-mentioned person or of a person mentioned in paragraph (a).</p>
                </content>
                <content>
                  <p><b><i>parent</i></b>: without limiting who is a parent of a person for the purposes of paragraph (a) of the definition of <b><i>near relative</i></b> in this subsection, someone is the <b><i>parent </i></b>of a person if the person is his or her child because of the definition of <b><i>child</i></b> in this section.</p>

                <p>	(5)	For the purposes of paragraph (a) of the definition of <b><i>near relative</i></b> in subsection (4), if one person is the child of another person because of the definition of <b><i>child</i></b> in that subsection, relationships traced to or through the person are to be determined on the basis that the person is the child of the other person.</p>

            <heading>Land</heading>
            <subsection eId="part-4__dvs-3__sec-30__subsec-1">
              <num>1</num>
              <content>
                <p>It is unlawful for a person, whether as principal or agent, to discriminate against another person on the ground of the other person’s age:</p>
              </content>
              <paragraph eId="part-4__dvs-3__sec-30__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>by refusing or failing to dispose of an estate or interest in land to the other person; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-3__sec-30__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>in the terms or conditions on which an estate or interest in land is offered to the other person.</p>
                </content>
                <content>
                  <p>Exemption for disposal by will or by way of gift</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-4__dvs-3__sec-30__subsec-2">
              <num>2</num>
              <content>
                <p>This section does not apply in relation to a disposal of an estate or interest in land by will or by way of gift.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-4__dvs-3__sec-31">
            <num>31</num>
            <heading>Administration of Commonwealth laws and programs</heading>
            <subsection eId="part-4__dvs-3__sec-31__subsec-1">
              <num>1</num>
              <content>
                <p>It is unlawful for a person who:</p>
              </content>
              <paragraph eId="part-4__dvs-3__sec-31__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>performs any function or exercises any power under a Commonwealth law or for the purposes of a Commonwealth program; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-3__sec-31__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>has any other responsibility for the administration of a Commonwealth law or the conduct of a Commonwealth program;</p>
                </content>
                <content>
                  <p>to discriminate against another person on the ground of the other person’s age in the performance of that function, the exercise of that power or the fulfilment of that responsibility.</p>
                  <p>Definition</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-4__dvs-3__sec-31__subsec-2">
              <num>2</num>
              <content>
                <p>In this section:</p>
              </content>
              <content>
                <p><b><i>Commonwealth program</i></b> means a program conducted by or on behalf of the Commonwealth Government.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-4__dvs-3__sec-32">
            <num>32</num>
            <heading>Requests for information</heading>
            <content>
              <p>		It is unlawful for a person (the <b><i>first person</i></b>) to request or require another person (the <b><i>other person</i></b>) to provide information (whether by way of completing a form or otherwise) if:</p>
            </content>
            <paragraph eId="part-4__dvs-3__sec-32__para-a">
              <num>a</num>
              <content>
                <p>the information is requested or required in connection with, or for the purposes of, the first person doing a particular act; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__dvs-3__sec-32__para-b">
              <num>b</num>
              <content>
                <p>under <ref href="#dvs-2">Division 2</ref> or this Division, it would be unlawful in particular circumstances for the first person, in doing that act, to discriminate against the other person on the ground of the other person’s age; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__dvs-3__sec-32__para-c">
              <num>c</num>
              <content>
                <p>persons of a different age would not be requested or required to provide the information in circumstances that are the same or not materially different.</p>
              </content>
            </paragraph>

        </division>
        <division eId="part-4__dvs-4">
          <num>4</num>
          <heading>General exemptions</heading>
          <section eId="part-4__dvs-4__sec-33">
            <num>33</num>
            <heading>Positive discrimination</heading>
            <content>
              <p>This Part does not make it unlawful for a person to discriminate against another person, on the ground of the other person’s age, by an act that is consistent with the purposes of this Act, if:</p>
            </content>
            <paragraph eId="part-4__dvs-4__sec-33__para-a">
              <num>a</num>
              <content>
                <p>the act provides a bona fide benefit to persons of a particular age; or</p>
              </content>
              <hcontainer name="example">
                <content>
                  <p>Example 1:	This paragraph would cover a hairdresser giving a discount to a person holding a Seniors Card or a similar card, because giving the discount is an act that provides a bona fide benefit to older persons.</p>
                </content>
              </hcontainer>

                  <p>Example 2:	This paragraph would cover the provision to a particular age group of a scholarship program, competition or similar opportunity to win a prize or benefit.</p>
                </content>
              </hcontainer>
            </paragraph>

              <content>
                <p>the act is intended to meet a need that arises out of the age of persons of a particular age; or</p>
              </content>
              <hcontainer name="example">

                  <p>Example:		Young people often have a greater need for welfare services (including information, support and referral) than other people. This paragraph would therefore cover the provision of welfare services to young homeless people, because such services are intended to meet a need arising out of the age of such people.</p>
                </content>

            </paragraph>
            <paragraph eId="part-4__dvs-4__sec-33__para-c">
              <num>c</num>
              <content>
                <p>the act is intended to reduce a disadvantage experienced by people of a particular age.</p>
              </content>

                  <p>Example:		Older people are often more disadvantaged by retrenchment than are other people. This paragraph would therefore cover the provision of additional notice entitlements for older workers, because such entitlements are intended to reduce a disadvantage experienced by older people.</p>

          </section>
          <section eId="part-4__dvs-4__sec-34">
            <num>34</num>
            <heading>Charities</heading>
            <content>
              <p>This Part does not:</p>
            </content>
            <paragraph eId="part-4__dvs-4__sec-34__para-a">
              <num>a</num>
              <content>
                <p>	(a)	affect a provision (whether made before or after the commencement of this Part) of the governing rules (within the meaning of the <i>Australian Charities and Not</i><i>-</i><i>for</i><i>-</i><i>profits </i><i>Commission Act 2012</i>) of a registered charity, if the provision:</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__dvs-4__sec-34__para-i">
              <num>i</num>
              <content>
                <p>confers benefits for charitable purposes; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__dvs-4__sec-34__para-ii">

                <p>enables such benefits to be conferred;</p>
              </content>
              <content>
                <p>wholly or in part on persons of a particular age; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__dvs-4__sec-34__para-b">
              <num>b</num>
              <content>
                <p>make unlawful any act done to give effect to such a provision.</p>
              </content>
            </paragraph>
          </section>
          <section eId="part-4__dvs-4__sec-35">
            <num>35</num>
            <heading>Religious bodies</heading>
            <content>
              <p>This Part does not affect an act or practice of a body established for religious purposes that:</p>
            </content>
            <paragraph eId="part-4__dvs-4__sec-35__para-a">
              <num>a</num>
              <content>
                <p>conforms to the doctrines, tenets or beliefs of that religion; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__dvs-4__sec-35__para-b">
              <num>b</num>
              <content>
                <p>is necessary to avoid injury to the religious sensitivities of adherents of that religion.</p>
              </content>
            </paragraph>
          </section>
          <section eId="part-4__dvs-4__sec-36">
            <num>36</num>
            <heading>Voluntary bodies</heading>
            <subsection eId="part-4__dvs-4__sec-36__subsec-1">
              <num>1</num>
              <content>
                <p>This Part does not make it unlawful for a voluntary body to discriminate against a person, on the ground of the person’s age, in connection with:</p>
              </content>
              <paragraph eId="part-4__dvs-4__sec-36__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>the admission of persons as members of the body; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-4__sec-36__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>the provision of benefits, facilities or services to members of the body.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-4__dvs-4__sec-36__subsec-2">
              <num>2</num>
              <content>
                <p>In this section:</p>
              </content>
              <content>
                <p><b><i>registered organisation</i></b> means an organisation registered, or an association recognised, under the <i>Fair Work (Registered Organisations) Act 2009</i>.</p>
                <p><b><i>voluntary body</i></b> means an association or other body (whether incorporated or unincorporated) the activities of which are not engaged in for the purpose of making a profit, but does not include:</p>
              </content>
              <paragraph eId="part-4__dvs-4__sec-36__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>a registered organisation; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-4__sec-36__subsec-2__para-b">

                  <p>a body established by a law of the Commonwealth, of a State or of a Territory; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-4__sec-36__subsec-2__para-c">

                  <p>an association that provides grants, loans, credit or finance to its members.</p>
                </content>
              </paragraph>

                  <p>by refusing to offer the annuity, policy or membership to the other person;</p>

                  <p>a Commonwealth Act (or a provision of a Commonwealth Act) relating to superannuation; or</p>

                  <p>a regulation or any other instrument (or a provision of a regulation or instrument) that:</p>

                <p>	(2)	This Part does not make unlawful anything done by an exempt public sector superannuation scheme (within the meaning of the <i>Superannuation Industry (Supervision) Act 1993</i>) in accordance with an Act of the Commonwealth, a State or a Territory, or a trust deed, by or under which the scheme is established.</p>

                <p>This Part does not make unlawful anything done by a person, in direct compliance with any other Commonwealth Act or regulation, during the period:</p>

                  <p>beginning on the day on which this Act commences; and</p>
                </content>
              </paragraph>

                  <p>ending 2 years after that day.</p>

            </subsection>

                <p><b><i>exempted employment program </i></b>means a program, scheme or arrangement that:</p>

                  <p>is conducted by or on behalf of the Commonwealth Government; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-4__sec-41A__subsec-3__para-b">
                <num>b</num>

                  <p>is primarily intended to:</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-4__sec-41A__subsec-3__para-i">

                  <p>improve the prospects of participants getting employment; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-4__sec-41A__subsec-3__para-ii">

                  <p>increase workforce participation; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-4__sec-41A__subsec-3__para-c">

                  <p>meets at least one of the following requirements:</p>

              </paragraph>

                  <p>it is also intended to meet a need that arises out of the age of persons of a particular age, regardless whether the need also arises out of the age of persons of a different age;</p>

                  <p>it is also intended to reduce a disadvantage experienced by people of a particular age, regardless whether the disadvantage is also experienced by persons of a different age;</p>

                <p>This Part does not make it unlawful for a person to discriminate against another person, on the ground of the other person’s age, by taking the other person’s age into account in making a decision relating to health goods or services or medical goods or services, if:</p>

              <paragraph eId="part-4__dvs-4__sec-42__subsec-3__para-a">
                <num>a</num>
                <content>
                  <p>taking the other person’s age into account in making the decision is reasonably based on evidence, and professional knowledge, about the ability of persons of the other person’s age to benefit from the goods or services; and</p>

              <paragraph eId="part-4__dvs-4__sec-42__subsec-3__para-b">
                <num>b</num>
                <content>
                  <p>the decision is not in accordance with an exempted health program.</p>

                  <p>	(a)	the <i>Health Insurance Act 1973</i>, or a regulation or any other instrument made under that Act, to the extent that the thing done relates to:</p>

                  <p>the release of, or the giving of access to, information held by the Chief Executive Medicare; or</p>

                <p><b><i>evidence</i></b> includes medical, clinical and scientific evidence.</p>
                <p><b><i>exempted health program</i></b> means a program, scheme or arrangement that:</p>

                  <p>relates to health goods or services or medical goods or services; and</p>
                </content>
              </paragraph>

                  <p>to the extent that it applies to people of a particular age, is reasonably based on evidence of effectiveness, and on cost (if cost has been taken into account in relation to the program, scheme or arrangement).</p>

                  <p>The evidence of effectiveness mentioned in paragraph (b) is evidence that is reasonably available from time to time about matters (such as safety, risks, benefits and health needs) that:</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-4__sec-42__subsec-6__para-c">
                <num>c</num>
                <content>
                  <p>affect people of the age mentioned in that paragraph (if no comparable evidence is reasonably available from time to time in relation to people of a different age); or</p>

                <num>d</num>
                <content>
                  <p>affect people of the age mentioned in that paragraph in a different way to people of a different age (in all other cases).</p>

                <p>This Part does not make unlawful anything done by a person in relation to the administration of:</p>

                  <p>	(a)	the <i>Migration Act 1958</i>; or</p>
                </content>
              </paragraph>

                  <p>	(b)	the <i>Immigration (Guardianship of Children) Act 1946</i>; or</p>

          <heading>Exemptions granted by Commission</heading>

            <heading>Commission may grant exemptions</heading>

                <p>The Commission may, on application by:</p>

              <num>2</num>

                <p>The Commission may, on application by a person to, or in respect of, whom an exemption from a provision of <ref href="#dvs-2">Division 2</ref> or 3 has been granted under subsection (1), being an application made before the expiration of the period to which the exemption was granted, grant a further exemption from the operation of that provision.</p>
              </content>
            </subsection>
            <subsection eId="part-4__dvs-5__sec-44__subsec-3">
              <num>3</num>
              <content>
                <p>An exemption granted under this section:</p>
              </content>
              <paragraph eId="part-4__dvs-5__sec-44__subsec-3__para-a">

                  <p>may be granted subject to such terms and conditions as are specified in the instrument; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-5__sec-44__subsec-3__para-b">
                <num>b</num>
                <content>
                  <p>may be expressed to apply only in such circumstances, or in relation to such activities, as are specified in the instrument; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-5__sec-44__subsec-3__para-c">
                <num>c</num>
                <content>
                  <p>is to be granted for a specified period not exceeding 5 years.</p>
                </content>
              </paragraph>
            </subsection>

            <heading>Review by Administrative Review Tribunal</heading>
            <content>
              <p>An application may be made to the Administrative Review Tribunal for a review of a decision made by the Commission under <ref href="#sec-44">section 44</ref>.</p>

            <num>46</num>
            <heading>Notice of decisions to be published</heading>
            <subsection eId="part-4__dvs-5__sec-46__subsec-1">
              <num>1</num>
              <content>
                <p>	(1)	The Commission, not later than one month after it makes a decision under <i>Gazette </i>a notice of the making of the decision:<ref href="#sec-44">section 44</ref>, is to cause to be published in the </p>
              </content>
              <paragraph eId="part-4__dvs-5__sec-46__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>setting out its findings on material questions of facts; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-5__sec-46__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>referring to the evidence on which those findings were based; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-5__sec-46__subsec-1__para-c">
                <num>c</num>
                <content>
                  <p>giving the reasons for the making of the decision; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-5__sec-46__subsec-1__para-d">

                  <p>	(d)	containing a statement to the effect that, subject to the <i>Administrative Review Tribunal Act 2024</i>, application may be made to the Administrative Review Tribunal for a review of the decision to which the notice relates by or on behalf of any person or persons whose interests are affected by the decision.</p>

                <p>Any failure to comply with the requirements of subsection (1) in relation to a decision does not affect the validity of the decision.</p>

            <heading>Effect of exemptions</heading>
            <content>
              <p>This Part does not make it unlawful for:</p>
            </content>

                <p>a person who has been granted an exemption from a provision of <ref href="#dvs-2">Division 2</ref> or 3; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__dvs-5__sec-47__para-b">
              <num>b</num>
              <content>
                <p>a person in the employment or under the direction or control of a person who has been granted such an exemption;</p>
              </content>
              <content>
                <p>to do an act in accordance with the provisions of the instrument by which the exemption was granted.</p>

                <content>
                  <p>the first person engages in conduct; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-6__sec-47A__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>the first person’s conduct causes detriment to the second person; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-6__sec-47A__subsec-2__para-c">
                <num>c</num>
                <content>
                  <p>the first person intends that the first person’s conduct cause detriment to the second person; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-6__sec-47A__subsec-2__para-d">
                <num>d</num>
                <content>
                  <p>the detriment is caused without the consent of the second person; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-6__sec-47A__subsec-2__para-e">
                <num>e</num>
                <content>
                  <p>the first person engages in the first person’s conduct because the first person believes that:</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-6__sec-47A__subsec-2__para-i">
                <num>i</num>
                <content>
                  <p>	(i)	the second person has made, or proposes to make, a complaint under the <i>Australian Human Rights Commission Act 1986</i>; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-6__sec-47A__subsec-2__para-ii">
                <num>ii</num>
                <content>
                  <p>	(ii)	the second person has brought, or proposes to bring, proceedings under the <i>Australian Human Rights Commission Act 1986 </i>against any person; or</p>
                </content>

              <paragraph eId="part-4__dvs-6__sec-47A__subsec-2__para-iii">
                <num>iii</num>
                <content>
                  <p>	(iii)	the second person has given, or proposes to give, any information, or has produced, or proposes to produce, any documents to a person exercising or performing any power or function under this Act or the <i>Australian Human Rights Commission Act 1986</i>; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-6__sec-47A__subsec-2__para-iv">
                <num>iv</num>
                <content>
                  <p>	(iv)	the second person has attended, or proposes to attend, a conference held under the <i>Australian Human Rights Commission Act 1986</i>; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-6__sec-47A__subsec-2__para-v">
                <num>v</num>
                <content>
                  <p>	(v)	the second person has appeared, or proposes to appear, as a witness in a proceeding under this Act or the <i>Australian Human Rights Commission Act 1986</i>; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-6__sec-47A__subsec-2__para-vi">
                <num>vi</num>
                <content>
                  <p>	(vi)	the second person has reasonably asserted, or proposes to assert, any rights of the person or the rights of any other person under this Act or the <i>Australian Human Rights Commission Act 1986</i>; or</p>

              </paragraph>
              <paragraph eId="part-4__dvs-6__sec-47A__subsec-2__para-vii">
                <num>vii</num>

                  <p>the second person has made an allegation that a person has done an act that is unlawful by reason of a provision of this Part.</p>

                  <p>Victimisation—threat of detriment</p>

              <num>3</num>
              <content>
                <p>	(3)	For the purposes of subsection (1), a person (the <b><i>first person</i></b>) commits an act of victimisation against another person (the <b><i>second person</i></b>) if:</p>

                <num>a</num>
                <content>
                  <p>the first person makes to the second person a threat to cause detriment to the second person or to a third person; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-6__sec-47A__subsec-3__para-b">
                <num>b</num>
                <content>
                  <p>the first person:</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-6__sec-47A__subsec-3__para-i">
                <num>i</num>

                  <p>intends the second person to fear that the threat will be carried out; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-6__sec-47A__subsec-3__para-ii">
                <num>ii</num>
                <content>
                  <p>is reckless as to causing the second person to fear that the threat will be carried out; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-6__sec-47A__subsec-3__para-c">
                <num>c</num>

                  <p>the first person makes the threat because the first person believes in a matter mentioned in paragraph (2)(e).</p>

                <p>	(4)	For the purposes of subsection (3), a <b><i>threat</i></b> may be:</p>

                  <p>express or implied; or</p>
                </content>
              </paragraph>

                <p>In a proceeding for a contravention of subsection (1) constituted by an act of victimisation covered by subsection (3), it is not necessary to prove that the person threatened actually feared that the threat would be carried out.</p>

                  <p>	(a)	the first person makes to another person (the <b><i>second person</i></b>) a threat to cause detriment to the second person or to a third person; and</p>

                  <p>the first person:</p>

                  <p>the President or the Commission gives the person a notice in writing under subsection 54(2), requiring the person to disclose the source of actuarial or statistical data; and</p>

                <p>to promote an understanding and acceptance of, and compliance with, this Act;</p>

          <heading>Terms and conditions of appointment</heading>
          <subsection eId="part-6A__sec-53B__subsec-1">

              <p><role refersTo="#commissioner">The Commissioner</role> holds office for the period specified in the instrument of appointment.</p>
            </content>
          </subsection>

              <p>A person must not be appointed as the Age Discrimination Commissioner under <ref href="#sec-53A">section 53A</ref> for a period if the sum of the following exceeds 7 years:</p>

                <p>that period;</p>
              </content>
            </paragraph>

              <p><role refersTo="#commissioner">The Commissioner</role> holds office on a full-time basis.</p>

          </subsection>

              <p><role refersTo="#commissioner">The Commissioner</role> holds office on the terms and conditions (if any), in relation to matters not covered by this Act, that are determined by the Governor-General.</p>

          <heading>Remuneration of Commissioner</heading>

If no determination of that remuneration by the Tribunal is in operation, <role refersTo="#commissioner">the Commissioner</role> is to be paid the remuneration that is prescribed by the regulations.</p>

              <p><role refersTo="#minister">The Minister</role> may grant <role refersTo="#commissioner">the Commissioner</role> leave of absence, other than recreation leave, on the terms and conditions as to remuneration or otherwise that <role refersTo="#minister">the Minister</role> determines.</p>

        </section>

          <heading>Outside employment</heading>

            <p><role refersTo="#commissioner">The Commissioner</role> must not engage in paid employment outside the duties of his or her office without <role refersTo="#minister">the Minister</role>’s approval.</p>

          <heading>Resignation</heading>
          <subsection eId="part-6A__sec-53F__subsec-1">

              <p><role refersTo="#commissioner">The Commissioner</role> may resign his or her appointment by giving the Governor-General a written resignation.</p>
            </content>
          </subsection>
          <subsection eId="part-6A__sec-53F__subsec-2">
            <num>2</num>
            <content>
              <p>The resignation takes effect on the day it is received by the Governor-General or, if a later day is specified in the resignation, on that later day.</p>
            </content>
          </subsection>
        </section>

          <heading>Termination of appointment</heading>
          <subsection eId="part-6A__sec-53G__subsec-1">

              <p>The Governor-General may terminate the appointment of <role refersTo="#commissioner">the Commissioner</role> for misbehaviour or physical or mental incapacity.</p>
            </content>
          </subsection>

            <content>
              <p>The Governor-General must terminate the appointment of <role refersTo="#commissioner">the Commissioner</role> if:</p>
            </content>

                <p><role refersTo="#commissioner">the Commissioner</role>:</p>
              </content>
            </paragraph>

              <p>during a vacancy in the office of Commissioner (whether or not an appointment has previously been made to the office); or</p>

              <p>during any period, or during all periods, when <role refersTo="#commissioner">the Commissioner</role>:</p>

              <p>If, for the purposes of this Act, it is necessary to establish the state of mind of a body corporate in relation to particular conduct, it is sufficient to show:</p>

                <p>that the conduct was engaged in by a director, employee or agent of the body corporate within the scope of his or her actual or apparent authority; and</p>
              </content>
            </paragraph>

              <content>
                <p>that the director, employee or agent had the state of mind.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-7__sec-57__subsec-2">
            <num>2</num>
            <content>
              <p>Any conduct engaged in on behalf of a body corporate by a director, employee or agent of the body corporate within the scope of his or her actual or apparent authority is taken, for the purposes of this Act, to have been engaged in also by the body corporate unless the body corporate establishes that the body corporate took reasonable precautions and exercised due diligence to avoid the conduct.</p>
            </content>
            <content>
              <p>Persons other than bodies corporate</p>
            </content>
          </subsection>
          <subsection eId="part-7__sec-57__subsec-3">
            <num>3</num>
            <content>
              <p>If, for the purposes of this Act, it is necessary to establish the state of mind of a person other than a body corporate in relation to a particular conduct, it is sufficient to show:</p>
            </content>
            <paragraph eId="part-7__sec-57__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>that the conduct was engaged in by an employee or agent of the person within the scope of his or her actual or apparent authority; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-57__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>that the employee or agent had the state of mind.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-7__sec-57__subsec-4">
            <num>4</num>
            <content>
              <p>Any conduct engaged in on behalf of a person other than a body corporate by an employee or agent of the person within the scope of his or her actual or apparent authority is taken, for the purposes of this Act, to have been engaged in also by the first-mentioned person unless the first-mentioned person establishes that the first-mentioned person took reasonable precautions and exercised due diligence to avoid the conduct.</p>
            </content>
          </subsection>
          <subsection eId="part-7__sec-57__subsec-5">
            <num>5</num>
            <content>
              <p>If:</p>
            </content>
            <paragraph eId="part-7__sec-57__subsec-5__para-a">
              <num>a</num>
              <content>
                <p>a person other than a body corporate is convicted of an offence; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-57__subsec-5__para-b">
              <num>b</num>
              <content>
                <p>the person would not have been convicted of the offence if subsections (3) and (4) had not been enacted;</p>
              </content>
              <content>
                <p>the person is not liable to be punished by imprisonment for that offence.</p>
                <p>Interpretation</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-7__sec-57__subsec-6">
            <num>6</num>
            <content>
              <p>A reference in subsection (1) or (3) to the state of mind of a person includes a reference to:</p>
            </content>
            <paragraph eId="part-7__sec-57__subsec-6__para-a">
              <num>a</num>
              <content>
                <p>the knowledge, intention, opinion, belief or purpose of the person; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-57__subsec-6__para-b">
              <num>b</num>
              <content>
                <p>the person’s reasons for the intention, opinion, belief or purpose.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-7__sec-57__subsec-7">
            <num>7</num>
            <content>
              <p>A reference in this section to a director of a body corporate includes a reference to a constituent member of a body corporate incorporated for a public purpose by a law of the Commonwealth, of a State or of a Territory.</p>
            </content>
          </subsection>
          <subsection eId="part-7__sec-57__subsec-8">
            <num>8</num>
            <content>
              <p>A reference in this section to engaging in conduct includes a reference to failing or refusing to engage in conduct.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-7__sec-58">
          <num>58</num>
          <heading>Protection from civil actions</heading>
          <subsection eId="part-7__sec-58__subsec-1">
            <num>1</num>
            <content>
              <p>The Commission, <role refersTo="#commissioner">the Commissioner</role> or another member of the Commission, or a person acting for or on behalf of the Commission or <role refersTo="#commissioner">the Commissioner</role> or another member of the Commission, is not liable to an action or other proceeding for damages for or in relation to an act done in good faith:</p>
            </content>
            <paragraph eId="part-7__sec-58__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>in performance or purported performance of any function conferred on the Commission; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-58__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>in exercise or purported exercise of any power conferred on the Commission.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-7__sec-58__subsec-2">
            <num>2</num>
            <content>
              <p>Subsection (3) applies if a submission has been made, a document or information has been given, or evidence has been given, to the Commission or to a person acting for or on behalf of the Commission.</p>
            </content>
          </subsection>
          <subsection eId="part-7__sec-58__subsec-3">
            <num>3</num>
            <content>
              <p>A person is not liable to an action, suit or proceeding in respect of loss, damage or injury of any kind suffered by another person by reason only that the submission was made, the document or information was given or the evidence was given.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-7__sec-59">
          <num>59</num>
          <heading>Unlawful act not basis of civil action unless expressly so provided</heading>
          <subsection eId="part-7__sec-59__subsec-1">
            <num>1</num>
            <content>
              <p>This Act does not confer on a person a right of action in respect of the doing of an act that is unlawful under a provision of <ref href="#part-4">Part 4</ref> unless a provision of this Act expressly provides otherwise.</p>
            </content>
          </subsection>
          <subsection eId="part-7__sec-59__subsec-2">
            <num>2</num>
            <content>
              <p>For the purposes of subsection (1), a reference to an act that is unlawful under a provision of <ref href="#part-4">Part 4</ref> includes a reference to an act that is an offence under a provision of <ref href="#part-5">Part 5</ref>.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-7__sec-60">
          <num>60</num>
          <heading>Non-disclosure of private information</heading>
          <subsection eId="part-7__sec-60__subsec-1">
            <num>1</num>
            <content>
              <p>A person bound by this section because of office, employment or authorisation must not, either directly or indirectly:</p>
            </content>
            <paragraph eId="part-7__sec-60__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>make a record of, or divulge or communicate to any person, any information relating to the affairs of another person acquired by the first-mentioned person because of that person’s office or employment under or for the purposes of this Act or because of that person being or having been so authorised; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-60__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>make use of any such information as is mentioned in paragraph (a); or</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-60__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>produce to any person a document relating to the affairs of another person given for the purposes of this Act.</p>
              </content>

                  <p>Penalty:	<quantity refersTo="#custodialSentence">Imprisonment for 2 years</quantity>.</p>

              </hcontainer>
            </paragraph>
          </subsection>
          <subsection eId="part-7__sec-60__subsec-2">
            <num>2</num>
            <content>
              <p>A person bound by this section because of office, employment or authorisation must not be required:</p>
            </content>
            <paragraph eId="part-7__sec-60__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>to divulge or communicate to a court any information relating to the affairs of another person acquired by the first-mentioned person because of that person’s office or employment under or for the purposes of this Act or because of that person being or having been so authorised; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-60__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>to produce in a court a document relating to the affairs of another person of which the first-mentioned person has custody, or to which that person has access, because of that person’s office or employment under or for the purposes of this Act or because of that person being or having been so authorised;</p>
              </content>
              <content>
                <p>except where it is necessary to do so for the purposes of this Act.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-7__sec-60__subsec-3">
            <num>3</num>
            <content>
              <p>This section does not prohibit a person from:</p>
            </content>
            <paragraph eId="part-7__sec-60__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>making a record of information that is required or permitted by an Act to be recorded, if the record is made for the purposes of or under that Act; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-60__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>	(b)	divulging or communicating information, or producing a document, to any person in accordance with an arrangement in force under <i>Australian Human Rights Commission Act 1986</i>; or<ref href="#sec-16">section 16</ref> of the </p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-60__subsec-3__para-c">
              <num>c</num>
              <content>
                <p>divulging or communicating information, or producing a document that is required or permitted by an Act to be divulged, communicated or produced as the case may be, if the information is divulged or communicated, or the document is produced, for the purposes of or under that Act.</p>

              <p>Subsection (1) does not prevent a person from making a record of, divulging, communicating or making use of information, or producing a document, if the person does so:</p>
            </content>
            <paragraph eId="part-7__sec-60__subsec-4__para-a">
              <num>a</num>
              <content>
                <p>in the performance of a duty under or in connection with this Act; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-60__subsec-4__para-b">
              <num>b</num>
              <content>
                <p>in the performance or exercise of a function or power conferred on the Commission under this Act.</p>
              </content>

              <p>Subsection (2) does not prevent a person from being required, for the purposes of or under an Act, to divulge or communicate information, or to produce a document, that is required or permitted by that Act to be divulged, communicated or produced.</p>

          </subsection>
          <subsection eId="part-7__sec-60__subsec-6">
            <num>6</num>
            <content>
              <p>In this section:</p>
            </content>
            <content>
              <p><b><i>court</i></b> includes any tribunal, authority or person having power to require the production of documents or the answering of questions.</p>
              <p><b><i>person bound by this section because of office, employment or authorisation</i></b> means a person who is, or has at any time been:</p>
            </content>
            <paragraph eId="part-7__sec-60__subsec-6__para-a">
              <num>a</num>
              <content>
                <p><role refersTo="#commissioner">the Commissioner</role> or another member of the Commission; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-60__subsec-6__para-b">
              <num>b</num>
              <content>
                <p>a member of the staff assisting the Commission; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-60__subsec-6__para-c">
              <num>c</num>
              <content>
                <p>a person authorised to perform or exercise any function or power of the Commission or any function or power for or on behalf of the Commission, being a function or power conferred on the Commission under this Act.</p>
              </content>
              <content>
                <p><b><i>produce</i></b> includes permit access to.</p>
              </content>
            </paragraph>
          </subsection>
        </section>
        <section eId="part-7__sec-61">
          <num>61</num>
          <heading>Regulations</heading>
          <content>
            <p>The Governor-General may make regulations prescribing matters:</p>
          </content>
          <paragraph eId="part-7__sec-61__para-a">
            <num>a</num>
            <content>
              <p>required or permitted by this Act to be prescribed; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-7__sec-61__para-b">
            <num>b</num>

              <p>necessary or convenient to be prescribed for carrying out or giving effect to this Act.</p>
