            <p>		This Act may be cited as the <i>Asbestos</i><i>-</i><i>related Claims (Management of Commonwealth Liabilities) Act 2005</i>.</p>

          <heading>Commencement</heading>
          <subsection eId="part-1__sec-2__subsec-1">
            <num>1</num>
            <content>
              <p>Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.</p>

          <heading>Definitions</heading>
          <subsection eId="part-1__sec-3__subsec-1">
            <num>1</num>
            <content>
              <p>In this Act:</p>
            </content>
            <content>
              <p><term refersTo="#term-asbestos-related-claim">asbestos-related claim</term> means <def>a claim for the payment of compensation or damages to a person in respect of an asbestos-related condition suffered by the person or another person arising from a breach of a common law or statutory duty of care by: the Commonwealth; or an entity that was a Commonwealth authority when the breach of the duty of care occurred.</def></p>
            </content>
            <paragraph eId="part-1__sec-3__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>the Commonwealth; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>an entity that was a Commonwealth authority when the breach of the duty of care occurred.</p>
              </content>
              <content>
                <p><b><i>asbestos</i></b><b><i>-</i></b><b><i>related condition</i></b> means:</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>asbestosis; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>an asbestos-induced carcinoma; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>an asbestos-related non-malignant pleural disease; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-1__para-d">
              <num>d</num>
              <content>
                <p>mesothelioma; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-1__para-e">
              <num>e</num>
              <content>
                <p>any other condition that is caused by exposure to asbestos.</p>
              </content>
              <content>
                <p><b><i>claim</i></b>:</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>means a claim or demand of any kind (whether or not involving legal proceedings); and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>includes proceedings of any kind.</p>
              </content>
              <content>
                <p><term refersTo="#term-comcare">Comcare</term> means <def>the body corporate established by <ref href="#sec-68">section 68</ref> of the Safety, Rehabilitation and Compensation Act 1988.</def></p>
                <p><b><i>Commonwealth authority</i></b> means:</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>a body corporate that is established for a public purpose by a law of the Commonwealth or of a Territory (other than the Australian Capital Territory, the Northern Territory or Norfolk Island) that is not a general law allowing incorporation as a company or body corporate; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>a body corporate that:</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-1__para-i">
              <num>i</num>
              <content>
                <p>is incorporated under a law of the Commonwealth or of a State or Territory; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-1__para-ii">
              <num>ii</num>
              <content>
                <p>	(ii)	is a body corporate in which the Commonwealth, or a body corporate covered by paragraph (a), has a controlling interest (within the meaning of the <i>Safety, Rehabilitation and Compensation Act 1988</i>); or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>a body corporate that is declared to be a Commonwealth authority for the purposes of this Act under subsection 4(1);</p>
              </content>
              <content>
                <p>but does not include:</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-1__para-d">
              <num>d</num>
              <content>
                <p>Comcare; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-1__para-e">
              <num>e</num>
              <content>
                <p>the Australian Postal Corporation; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-1__para-f">
              <num>f</num>
              <content>
                <p>Telstra Corporation Limited; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-1__para-g">
              <num>g</num>
              <content>
                <p>a body corporate that is declared not to be a Commonwealth authority for the purposes of this Act under subsection 4(2); or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-1__para-h">
              <num>h</num>
              <content>
                <p>a body corporate that is a subsidiary of a body corporate covered by paragraph (e), (f) or (g).</p>
              </content>
              <content>
                <p><term refersTo="#term-contract-of-insurance">contract of insurance</term> includes <def>a contract which, however expressed and in whatever form, is in substance an indemnity or guarantee.</def></p>
                <p><b><i>court</i></b> (except in section 15) includes:</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>a tribunal; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>any judge or person acting judicially or authorised by law or consent of parties to hear, receive and examine evidence.</p>
              </content>
              <content>
                <p><term refersTo="#term-finance-minister">Finance Minister</term> means <def>the Minister who administers the Public Governance, Performance and Accountability Act 2013.</def></p>
                <p><term refersTo="#term-liability">liability</term> means <def>a liability of any kind (whether actual, potential or contingent) but does not include a liability arising under: a contract of insurance; or a judgment or order of a court that is not stayed or subject to appeal when <ref href="#part-2">Part 2</ref> of this Act commences; or a settlement that takes the form of a written agreement entered into before <ref href="#part-2">Part 2</ref> of this Act commences. <b><i>subject to appeal</i></b>: a judgment or order is subject to appeal until: any applicable time limits for lodging an appeal (however described) against the judgment or order have expired; and if there is such an appeal against the judgment or order—the appeal (and any subsequent appeals) have been finally disposed of. Meaning of <b>subsidiary</b></def></p>

            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>a contract of insurance; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>a judgment or order of a court that is not stayed or subject to appeal when <ref href="#part-2">Part 2</ref> of this Act commences; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>a settlement that takes the form of a written agreement entered into before <ref href="#part-2">Part 2</ref> of this Act commences.</p>
              </content>
              <content>
                <p><b><i>subject to appeal</i></b>: a judgment or order is subject to appeal until:</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>any applicable time limits for lodging an appeal (however described) against the judgment or order have expired; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>if there is such an appeal against the judgment or order—the appeal (and any subsequent appeals) have been finally disposed of.</p>
              </content>
              <content>
                <p>Meaning of <b>subsidiary</b></p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-1__sec-3__subsec-2">
            <num>2</num>
            <content>
              <p>	(2)	For the purposes of this Act, the question whether a body corporate is a <b><i>subsidiary</i></b> of another body corporate is to be determined in the same manner as that question is determined under the <i>Corporations Act 2001</i>.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-1__sec-4">
          <num>4</num>
          <heading>Declarations—Commonwealth authorities</heading>
          <content>
            <p>Body corporate is a Commonwealth authority</p>
          </content>
          <subsection eId="part-1__sec-4__subsec-1">
            <num>1</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> may, by written instrument, declare that a body corporate is, from the time that the instrument is made, a Commonwealth authority for the purposes of this Act if, at that time:</p>
            </content>
            <paragraph eId="part-1__sec-4__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>the body corporate is incorporated under a law of the Commonwealth or of a State or Territory; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>either:</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-1__para-i">
              <num>i</num>
              <content>
                <p>the Commonwealth; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-1__para-ii">
              <num>ii</num>
              <content>
                <p>a body corporate that is established for a public purpose by a law of the Commonwealth or of a Territory (other than the Australian Capital Territory, the Northern Territory or Norfolk Island) that is not a general law allowing incorporation as a company or body corporate;</p>
              </content>
              <content>
                <p>		has a substantial interest (within the meaning of the <i>Safety, Rehabilitation and Compensation Act 1988</i>) in the body corporate.</p>
                <p>Body corporate is not a Commonwealth authority</p>
              </content>

          </subsection>
          <subsection eId="part-1__sec-4__subsec-2">
            <num>2</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> may, by written instrument, declare that a body corporate is not, from the time that the instrument is made, a Commonwealth authority for the purposes of this Act.</p>

          <subsection eId="part-1__sec-4__subsec-3">
            <num>3</num>
            <content>
              <p>	(3)	The Minister must publish a copy of an instrument made under subsection (1) or (2) in the <i>Gazette</i>.</p>
            </content>
          </subsection>
          <subsection eId="part-1__sec-4__subsec-4">
            <num>4</num>
            <content>
              <p>A failure to comply with subsection (3) does not affect the validity of any declaration made under this section.</p>
            </content>
            <content>
              <p>Instruments not legislative instruments</p>
            </content>
          </subsection>
          <subsection eId="part-1__sec-4__subsec-5">
            <num>5</num>
            <content>
              <p>An instrument made under subsection (1) or (2) is not a legislative instrument.</p>
            </content>
          </subsection>
        </section>

        <heading>Transfer of liabilities</heading>

          <num>5</num>
          <heading>Transfer of liabilities to Comcare</heading>
          <content>
            <p>Claims against Commonwealth or authority on or before commencement</p>
          </content>
          <subsection eId="part-2__sec-5__subsec-1">
            <num>1</num>
            <content>
              <p>If an asbestos-related claim was made against the Commonwealth or a Commonwealth authority on or before the commencement of this Part then, on the commencement of this Part:</p>
            </content>
            <paragraph eId="part-2__sec-5__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>a liability of the Commonwealth or <role refersTo="#authority">the authority</role> that relates to the claim ceases to be a liability of the Commonwealth or <role refersTo="#authority">the authority</role> and becomes a liability of Comcare; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>Comcare becomes the successor in law in relation to the liability.</p>
              </content>
              <content>
                <p>Claims against Commonwealth or authority after commencement</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-5__subsec-2">
            <num>2</num>
            <content>
              <p>If an asbestos-related claim is made against the Commonwealth or a Commonwealth authority after the commencement of this Part then, at the time the claim is made:</p>
            </content>
            <paragraph eId="part-2__sec-5__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>a liability of the Commonwealth or <role refersTo="#authority">the authority</role> that relates to the claim ceases to be a liability of the Commonwealth or <role refersTo="#authority">the authority</role> and becomes a liability of Comcare; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>Comcare becomes the successor in law in relation to the liability.</p>
              </content>
              <content>
                <p>Claims against Comcare on or after commencement</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-5__subsec-3">
            <num>3</num>
            <content>
              <p>If, on or after the commencement of this Part, a person could make an asbestos-related claim against the Commonwealth or a Commonwealth authority then:</p>
            </content>
            <paragraph eId="part-2__sec-5__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>the person may make the claim against Comcare; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>if the person makes the claim against Comcare—at the time the claim is made:</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5__subsec-3__para-i">
              <num>i</num>
              <content>
                <p>a liability of the Commonwealth or <role refersTo="#authority">the authority</role> that relates to the claim ceases to be a liability of the Commonwealth or <role refersTo="#authority">the authority</role> and becomes a liability of Comcare; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5__subsec-3__para-ii">
              <num>ii</num>
              <content>
                <p>Comcare becomes the successor in law in relation to the liability.</p>
              </content>
            </paragraph>
          </subsection>
        </section>
        <section eId="part-2__sec-6">
          <num>6</num>
          <heading>Transfer of liabilities from Comcare</heading>
          <content>
            <p>Liabilities may be transferred from Comcare</p>
          </content>
          <subsection eId="part-2__sec-6__subsec-1">
            <num>1</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> may, by written instrument, declare that a liability that ceased to be a liability of a Commonwealth authority and became a liability of Comcare under section 5 ceases to be a liability of Comcare and becomes a liability of:</p>
            </content>
            <paragraph eId="part-2__sec-6__subsec-1__para-a">
              <num>a</num>
              <content>
                <p><role refersTo="#authority">the authority</role>; or</p>
              </content>
            </paragraph>

          <heading>Certain consequences of transfer</heading>
          <content>
            <p>Application of section</p>
          </content>
          <subsection eId="part-2__sec-7__subsec-1">
            <num>1</num>
            <content>
              <p>	(1)	This section applies in relation to a liability that, under <b><i>transferor</i></b>) and becomes a liability of another entity (the <b><i>receiver</i></b>) at a particular time (the <b><i>transfer time</i></b>).<ref href="#sec-5">section 5</ref> or 6, ceases to be a liability of one entity (the </p>

              <p>Contracts of insurance</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-7__subsec-2">
            <num>2</num>
            <content>
              <p>From the transfer time, any contract of insurance to which the transferor was, or was taken to be, a party immediately before the transfer time has effect in relation to the liability as if:</p>
            </content>
            <paragraph eId="part-2__sec-7__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>the receiver were substituted for the transferor as a party to the contract; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-7__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>any reference in the contract to the transferor were (except in relation to things that happened before that time) a reference to the receiver.</p>
              </content>
              <content>
                <p>Conduct of actions, enforcement of judgments etc.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-7__subsec-3">
            <num>3</num>
            <content>
              <p>Without limiting the generality of <ref href="#sec-5">section 5</ref> or 6:</p>
            </content>
            <paragraph eId="part-2__sec-7__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>if, at the transfer time, action is being taken relating to the liability—the receiver must, immediately after the transfer time, take over the conduct of that action; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-7__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>if, at the transfer time, action is being taken relating to the liability before a court—the receiver:</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-7__subsec-3__para-i">
              <num>i</num>
              <content>
                <p>replaces the transferor as a party to the action from the transfer time; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-7__subsec-3__para-ii">
              <num>ii</num>
              <content>
                <p>may, if the receiver thinks it appropriate to do so, apply on or after the transfer time to the court to join any other person as a party to the action; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-7__subsec-3__para-iii">
              <num>iii</num>
              <content>
                <p>may, on or after the transfer time, conduct or settle the action; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-7__subsec-3__para-c">
              <num>c</num>
              <content>
                <p>if, at the transfer time, a judgment relating to the liability has been obtained in favour of the transferor but not enforced—the receiver may take such steps as are necessary to enforce the judgment.</p>
              </content>
              <content>
                <p>Transferor must comply with certain requirements of receiver</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-7__subsec-4">
            <num>4</num>
            <content>
              <p>The transferor must comply with any reasonable requirement of the receiver:</p>
            </content>
            <paragraph eId="part-2__sec-7__subsec-4__para-a">
              <num>a</num>
              <content>
                <p>relating to the conduct of any action in respect of the liability; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-7__subsec-4__para-b">
              <num>b</num>
              <content>
                <p>made for the purposes of assisting the receiver to manage the liability;</p>
              </content>
              <content>
                <p>including a reasonable requirement that the transferor sign any documents.</p>
              </content>
            </paragraph>
          </subsection>
        </section>

        <num>3</num>
        <heading>Finance and administration</heading>
        <section eId="part-3__sec-8">
          <num>8</num>
          <heading>Appropriation in respect of certain liabilities transferred to Comcare</heading>
          <subsection eId="part-3__sec-8__subsec-1">
            <num>1</num>
            <content>
              <p>There is to be paid to Comcare such amounts as are necessary to enable Comcare to discharge any liability that is a liability of Comcare as a result of the operation of this Act.</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-8__subsec-2">
            <num>2</num>
            <content>
              <p>The amounts payable to Comcare under this section are to be paid out of the Consolidated Revenue Fund, which is appropriated accordingly.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-3__sec-9">
          <num>9</num>
          <heading>Money of Comcare</heading>
          <subsection eId="part-3__sec-9__subsec-1">
            <num>1</num>
            <content>
              <p>The Finance Minister may give written directions as to the amounts in which, and the times at which, money referred to in <ref href="#sec-8">section 8</ref> is to be paid to Comcare.</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-9__subsec-2">
            <num>2</num>
            <content>
              <p>A direction made under subsection (1) is not a legislative instrument.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-3__sec-10">
          <num>10</num>
          <heading>Access to records</heading>
          <subsection eId="part-3__sec-10__subsec-1">
            <num>1</num>
            <content>
              <p>	(1)	If Comcare has the function of assuming and managing a liability as a result of the operation of this Act, records (within the meaning of the <i>Archives Act 1983</i>) that:</p>
            </content>
            <paragraph eId="part-3__sec-10__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>are in the possession, custody or control of the Commonwealth or a Commonwealth authority; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-10__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>relate to the liability;</p>
              </content>
              <content>
                <p>must be made available to Comcare by the Commonwealth or <role refersTo="#authority">the authority</role>.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-3__sec-10__subsec-2">
            <num>2</num>
            <content>
              <p>	(2)	This section does not authorise a Commonwealth record (within the meaning of the <i>Archives Act 1983</i>) to be transferred or otherwise dealt with except in accordance with the provisions of that Act.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-3__sec-11">
          <num>11</num>
          <heading>Disclosure of information</heading>
          <content>
            <p>Comcare may require disclosure of information</p>
          </content>
          <subsection eId="part-3__sec-11__subsec-1">
            <num>1</num>
            <content>
              <p>Comcare may, by written notice, require the chief executive officer (however described) of an entity to give Comcare information that:</p>
            </content>
            <paragraph eId="part-3__sec-11__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>the chief executive officer knows or can reasonably acquire; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-11__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>relates to a liability that, under <ref href="#sec-5">section 5</ref>, has ceased to be a liability of the entity and has become a liability of Comcare; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-11__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>the Chief Executive Officer of Comcare believes, on reasonable grounds, it is necessary for Comcare to know in order for Comcare to carry out the function conferred on it by <ref href="#sec-12">section 12</ref>.</p>
              </content>
              <content>
                <p>Requirement to disclose information</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-3__sec-11__subsec-2">
            <num>2</num>
            <content>
              <p>If the chief executive officer (however described) of an entity is given a notice under subsection (1), he or she must ensure that it is complied with as soon as practicable after it is given.</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-11__subsec-3">
            <num>3</num>
            <content>
              <p>The chief executive officer (however described) of an entity is not excused from ensuring that a notice given to him or her under subsection (1) is complied with on the ground that giving information covered by the notice would contravene the provisions of any other enactment.</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-11__subsec-4">
            <num>4</num>
            <content>
              <p>A person is not liable to:</p>
            </content>
            <paragraph eId="part-3__sec-11__subsec-4__para-a">
              <num>a</num>
              <content>
                <p>any proceedings for contravening any other law; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-11__subsec-4__para-b">
              <num>b</num>
              <content>
                <p>civil proceedings for loss, damage or injury of any kind suffered by another person;</p>
              </content>
              <content>
                <p>merely because the person gives information to Comcare to ensure that a notice under subsection (1) is complied with.</p>
              </content>
            </paragraph>
          </subsection>
        </section>
        <section eId="part-3__sec-12">
          <num>12</num>
          <heading>Additional function of Comcare</heading>
          <content>
            <p>In addition to the functions conferred on Comcare under other Acts, Comcare has the function of assuming and managing all liabilities that are liabilities of Comcare as a result of the operation of this Act.</p>
          </content>

          <num>13</num>
          <heading>Directions by Minister</heading>
          <subsection eId="part-3__sec-13__subsec-1">
            <num>1</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> may, by notice in writing given to the Chief Executive Officer of Comcare, give a direction to Comcare with respect to:</p>
            </content>
            <paragraph eId="part-3__sec-13__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>the performance of the function conferred on Comcare by <ref href="#sec-12">section 12</ref>; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-13__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>the exercise of its powers to do anything in connection with the performance of that function;</p>
              </content>
              <content>
                <p>otherwise than in relation to a particular case.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-3__sec-13__subsec-2">
            <num>2</num>
            <content>
              <p>Comcare must comply with a direction given under subsection (1).</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-13__subsec-3">
            <num>3</num>
            <content>
              <p>	(3)	This section does not affect the application of <i>Public Governance, Performance and Accountability Act 2013</i> (which deals with the application of government policy to corporate Commonwealth entities) in relation to Comcare.<ref href="#sec-22">section 22</ref> of the </p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-13__subsec-4">
            <num>4</num>
            <content>
              <p>A notice given under subsection (1) is not a legislative instrument.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-3__sec-14">
          <num>14</num>
          <heading>Consent required for delegation</heading>
          <subsection eId="part-3__sec-14__subsec-1">
            <num>1</num>
            <content>
              <p>	(1)	Comcare must obtain the written consent of the Minister before delegating to a person under <i>Safety, Rehabilitation and Compensation Act 1988</i>:<ref href="#sec-73B">section 73B</ref> of the </p>
            </content>
            <paragraph eId="part-3__sec-14__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>the function conferred on Comcare by <ref href="#sec-12">section 12</ref> of this Act; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-14__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>a power to do anything in connection with the performance of that function.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-3__sec-14__subsec-2">
            <num>2</num>
            <content>
              <p>Subsection (1) does not apply if the person to whom the power is delegated is a member of the staff of, or a consultant to, Comcare.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-3__sec-15">
          <num>15</num>
          <heading>Compensation for acquisition of property</heading>
          <subsection eId="part-3__sec-15__subsec-1">
            <num>1</num>
            <content>
              <p>If the operation of this Act would result in an acquisition of property from a person otherwise than on just terms, the Commonwealth is liable to pay a reasonable amount of compensation to the person.</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-15__subsec-2">
            <num>2</num>
            <content>
              <p>If the Commonwealth and the person do not agree on the amount of the compensation, the person may institute proceedings in a court of competent jurisdiction for the recovery from the Commonwealth of such reasonable amount of compensation as the court determines.</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-15__subsec-3">
            <num>3</num>
            <content>
              <p>The Consolidated Revenue Fund is appropriated for the purposes of this section.</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-15__subsec-4">
            <num>4</num>
            <content>
              <p>In this section:</p>
            </content>
            <content>
              <p><b><i>acquisition of property</i></b> has the same meaning as in paragraph 51(xxxi) of the Constitution.</p>
              <p><b><i>just terms</i></b> has the same meaning as in paragraph 51(xxxi) of the Constitution.</p>
            </content>
          </subsection>
        </section>

          <num>16</num>
          <heading>Regulations</heading>
          <content>
            <p>The Governor-General may make regulations prescribing matters:</p>

              <p>required or permitted by this Act to be prescribed; or</p>
            </content>
