            <p>The objects of this Act are as follows:</p>

              <p>to conserve water supplies by reducing water consumption;</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-b">
            <num>b</num>
            <content>
              <p>to provide information for purchasers of water-use and water-saving products;</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-c">
            <num>c</num>
            <content>
              <p>to promote the adoption of efficient and effective water-use and water-saving technologies.</p>

          </paragraph>

          <heading>Act to bind the Crown</heading>
          <subsection eId="part-1__sec-4__subsec-1">
            <num>1</num>

              <p>This Act binds the Crown in each of its capacities.</p>
            </content>
          </subsection>

            <num>2</num>
            <content>
              <p>This Act does not make the Crown liable to a pecuniary penalty or to be prosecuted for an offence.</p>
            </content>
          </subsection>

          <heading>External Territories</heading>

            <p>This Act extends to every external Territory.</p>

        <heading>Interpretation</heading>

          <heading>Application of the Criminal Code</heading>
          <content>
            <p>		Chapter 2 of the <i>Criminal Code</i> applies to all offences against this Act.</p>
          </content>

          <heading>Definitions</heading>
          <content>
            <p>In this Act, unless the contrary intention appears:</p>
            <p><term refersTo="#term-acquisition-of-property">acquisition of property</term> has the same meaning as <def>in paragraph 51(xxxi) of the Constitution.</def></p>
            <p><term refersTo="#term-affected-person">affected person</term> has the meaning given by <def>subsections 69(2), (3) and (4).</def></p>
            <p><b><i>agency</i></b>:</p>
          </content>
          <paragraph eId="part-2__sec-7__para-a">
            <num>a</num>
            <content>
              <p>in relation to the Commonwealth, includes the following:</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-7__para-i">
            <num>i</num>
            <content>
              <p>	(i)	a non-corporate Commonwealth entity (within the meaning of the <i>Public Governance, Performance and Accountability Act 2013</i>);</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-7__para-ii">
            <num>ii</num>
            <content>
              <p>a body corporate established for a public purpose under a law of the Commonwealth; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-7__para-b">
            <num>b</num>
            <content>
              <p>in relation to a State or a Territory, includes the following:</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-7__para-i">
            <num>i</num>
            <content>
              <p>a Department of State (however described) of the State or Territory;</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-7__para-ii">
            <num>ii</num>
            <content>
              <p>a body corporate established for a public purpose under a law of the State or Territory.</p>
            </content>
            <content>
              <p><term refersTo="#term-applicable-wels-standard">applicable WELS standard</term> has the meaning given by <def><ref href="#sec-32">section 32</ref>.</def></p>
              <p><term refersTo="#term-civil-penalty-order">civil penalty order</term> has the meaning given by <def>subsection 44A(4).</def></p>

              <p>either:</p>

          </paragraph>

              <p>the provision sets out at its foot a pecuniary penalty, or penalties, indicated by the words “Civil penalty”; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-7__para-ii">
            <num>ii</num>
            <content>
              <p>another provision of this Act provides that the provision is a civil penalty provision; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-7__para-b">
            <num>b</num>
            <content>
              <p>the provision is of one of the following kinds:</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-7__para-i">
            <num>i</num>
            <content>
              <p>a subsection, or a section that is not divided into subsections;</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-7__para-ii">
            <num>ii</num>
            <content>
              <p>a subregulation, or a regulation that is not divided into subregulations.</p>
            </content>
            <content>
              <p><term refersTo="#term-commonwealth-department">Commonwealth Department</term> means <def>the Department of State of the Commonwealth that deals with the matters to which this Act relates.</def></p>
              <p><term refersTo="#term-commonwealth-minister">Commonwealth Minister</term> means <def>the Minister appointed to administer the Department of State of the Commonwealth that deals with the matters to which this Act relates.</def></p>
              <p><term refersTo="#term-commonwealth-secretary">Commonwealth Secretary</term> means <def>the Secretary of the Department of State of the Commonwealth that deals with the matters to which this Act relates.</def></p>
              <p><term refersTo="#term-corresponding-state-territory-law">corresponding State-Territory law</term> has the meaning given by <def><ref href="#sec-12">section 12</ref>.</def></p>
              <p><term refersTo="#term-damage">damage</term> includes <def>damage by erasure of data or addition of other data.</def></p>
              <p><term refersTo="#term-evidential-burden">evidential burden</term> means <def>the burden of adducing or pointing to evidence that suggests a reasonable possibility that the matter exists or does not exist.</def></p>
              <p><b><i>evidential material</i></b> means:</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-7__para-a">
            <num>a</num>
            <content>
              <p>in respect of an offence against this Act:</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-7__para-i">
            <num>i</num>
            <content>
              <p>any thing with respect to which the offence has been committed or is suspected, on reasonable grounds, to have been committed; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-7__para-ii">
            <num>ii</num>
            <content>
              <p>any thing as to which there are reasonable grounds for suspecting that it will afford evidence as to the commission of the offence; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-7__para-iii">
            <num>iii</num>
            <content>
              <p>any thing as to which there are reasonable grounds for suspecting that it is intended to be used for the purpose of committing the offence; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-7__para-b">
            <num>b</num>
            <content>
              <p>in respect of a contravention of a civil penalty provision:</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-7__para-i">
            <num>i</num>
            <content>
              <p>any thing with respect to which the civil penalty provision has been contravened or is suspected, on reasonable grounds, of having been contravened; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-7__para-ii">
            <num>ii</num>
            <content>
              <p>any thing as to which there are reasonable grounds for suspecting that it will afford evidence as to the contravention of the civil penalty provision; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-7__para-iii">
            <num>iii</num>
            <content>
              <p>any thing as to which there are reasonable grounds for suspecting that it is intended to be used for the purpose of contravening the civil penalty provision.</p>
            </content>
            <content>
              <p><term refersTo="#term-executive-agency">Executive Agency</term> has the same meaning as <def>in <ref href="">the Public Service Act 1999</ref>.</def></p>
              <p><term refersTo="#term-federal-court">Federal Court</term> means <def>the Federal Court of Australia.</def></p>
              <p><term refersTo="#term-just-terms">just terms</term> has the same meaning as <def>in paragraph 51(xxxi) of the Constitution.</def></p>
              <p><term refersTo="#term-occupier">occupier</term> includes <def>a person who apparently represents the occupier of the premises.</def></p>
              <p><b><i>offence against this Act</i></b> includes:</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-7__para-a">
            <num>a</num>
            <content>
              <p>	(a)	an offence against <i>Crimes Act 1914</i>; and<ref href="#sec-6">section 6</ref> of the </p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-7__para-b">
            <num>b</num>
            <content>
              <p>	(b)	an offence against <i>Criminal Code</i>;<ref href="#sec-11">section 11</ref>.1, 11.4, 11.5, 136.1, 137.1 or 137.2 of the </p>
            </content>
            <content>
              <p>that relates to this Act.</p>
              <p><b><i>participating State or Territory</i></b>: a State or Territory is a <b><i>participating State or Territory</i></b> if there is a corresponding State-Territory law for the State or Territory.</p>
              <p><term refersTo="#term-person-who-has-wels-information">person who has WELS information</term> has the meaning given by <def><ref href="#sec-60">section 60</ref>.</def></p>
              <p><b><i>registered</i></b>: a WELS product is <b><i>registered</i></b> if the product is registered under the scheme formulated under subsection 26(1).</p>
              <p><term refersTo="#term-regulator">Regulator</term> has the meaning given by <def><ref href="#sec-21">section 21</ref>.</def></p>
              <p><b><i>relevant court</i></b> means:</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-7__para-a">
            <num>a</num>
            <content>
              <p>the Federal Court; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-7__para-b">
            <num>b</num>
            <content>
              <p>the Federal Circuit and Family Court of Australia (<ref href="#dvs-2">Division 2</ref>); or</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-7__para-c">
            <num>c</num>
            <content>
              <p>a court of a State or Territory that has jurisdiction in relation to matters arising under this Act.</p>
            </content>
            <content>
              <p><term refersTo="#term-reviewable-decision">reviewable decision</term> has the meaning given by <def>subsection 69(1).</def></p>
              <p><term refersTo="#term-reviewable-state-territory-decision">reviewable State-Territory decision</term> has the meaning given by <def>subsection 17(2).</def></p>
              <p><term refersTo="#term-statutory-agency">Statutory Agency</term> has the same meaning as <def>in <ref href="">the Public Service Act 1999</ref>.</def></p>
              <p><term refersTo="#term-supply">supply</term> has the meaning given by <def><ref href="#sec-7A">section 7A</ref>.</def></p>
              <p><b><i>this Act</i></b> includes regulations, and other legislative instruments, made under this Act.</p>
              <p><term refersTo="#term-water-saving-product">water-saving product</term> means <def>a device, appliance or fitting that: is not a water-use product; and is designed to operate in place of a water-use product.</def></p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-7__para-a">
            <num>a</num>
            <content>
              <p>is not a water-use product; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-7__para-b">
            <num>b</num>
            <content>
              <p>is designed to operate in place of a water-use product.</p>
            </content>
            <content>
              <p><term refersTo="#term-water-use-product">water-use product</term> means <def>a device, appliance or fitting through which, or into which, water flows as part of its normal operation.</def></p>
              <p><term refersTo="#term-wels-account">WELS Account</term> means <def>the special account established by subsection 64(1).</def></p>
              <p><term refersTo="#term-wels-business-premises">WELS business premises</term> means <def>WELS premises that are open to the public on a regular basis.</def></p>
              <p><term refersTo="#term-wels-inspector">WELS inspector</term> means <def>a person appointed under subsection 45(1).</def></p>
              <p><term refersTo="#term-wels-labelled">WELS-labelled</term> has the meaning given by <def>subsection 20(1).</def></p>
              <p><term refersTo="#term-wels-premises">WELS premises</term> means <def>premises used for, or in connection with, the supply of one or more WELS products.</def></p>
              <p><term refersTo="#term-wels-product">WELS product</term> has the meaning given by <def>subsection 18(1).</def></p>
              <p><term refersTo="#term-wels-scheme">WELS scheme</term> means <def>the water efficiency labelling and standards scheme established by this Act and corresponding State-Territory laws.</def></p>
              <p><term refersTo="#term-wels-standard">WELS standard</term> has the meaning given by <def><ref href="#sec-19">section 19</ref>.</def></p>
            </content>
          </paragraph>
        </section>
        <section eId="part-2__sec-7A">
          <num>7A</num>
          <heading>Meaning of supply</heading>
          <subsection eId="part-2__sec-7A__subsec-1">
            <num>1</num>
            <content>
              <p>	(1)	A <b><i>supply</i></b> of a WELS product means a supply of the product in the course of trading or commercial activities, and includes:</p>
            </content>
            <paragraph eId="part-2__sec-7A__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>an offer to supply; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-7A__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>a supply (including a re-supply) by way of sale, exchange, gift, lease, loan, hire or hire-purchase; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-7A__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>a supply as part of the supply of another thing (including as a fitting or fixture).</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-7A__subsec-2">
            <num>2</num>
            <content>
              <p>For the purposes of subsection (1):</p>
            </content>
            <paragraph eId="part-2__sec-7A__subsec-2__para-a">
              <num>a</num>
              <content>
                <p><term refersTo="#term-offer-to-supply">offer to supply</term> includes <def>make available, expose, display or advertise; and</def></p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-7A__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>it is irrelevant whether the supply is:</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-7A__subsec-2__para-i">
              <num>i</num>
              <content>
                <p>for consideration; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-7A__subsec-2__para-ii">
              <num>ii</num>
              <content>
                <p>a wholesale or retail supply.</p>
              </content>
            </paragraph>
          </subsection>
        </section>
      </part>

        <num>3</num>
        <heading>National WELS scheme</heading>
        <section eId="part-3__sec-8">
          <num>8</num>
          <heading>WELS scheme to be a national cooperative scheme</heading>
          <content>
            <p>It is the intention of the Parliament that this Act form a part of a cooperative scheme between the Commonwealth and the States and Territories to provide for national water efficiency labelling and standards.</p>
          </content>
        </section>
        <section eId="part-3__sec-9">
          <num>9</num>
          <heading>Application of this Act</heading>
          <content>
            <p>This Act applies with respect to the following:</p>
          </content>
          <paragraph eId="part-3__sec-9__para-a">
            <num>a</num>
            <content>
              <p>corporations to which paragraph 51(xx) of the Constitution applies;</p>
            </content>
          </paragraph>
          <paragraph eId="part-3__sec-9__para-b">
            <num>b</num>
            <content>
              <p>trade or commerce:</p>
            </content>
          </paragraph>
          <paragraph eId="part-3__sec-9__para-i">
            <num>i</num>
            <content>
              <p>with other countries; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-3__sec-9__para-ii">
            <num>ii</num>
            <content>
              <p>among the States; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-3__sec-9__para-iii">
            <num>iii</num>
            <content>
              <p>between a State and a Territory; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-3__sec-9__para-iv">
            <num>iv</num>
            <content>
              <p>between 2 Territories;</p>
            </content>
          </paragraph>
          <paragraph eId="part-3__sec-9__para-c">
            <num>c</num>
            <content>
              <p>the Commonwealth and agencies of the Commonwealth;</p>
            </content>
          </paragraph>
          <paragraph eId="part-3__sec-9__para-d">
            <num>d</num>
            <content>
              <p>things authorised by the legislative power of the Commonwealth under paragraph 51(xxxix) of the Constitution, so far as it relates to the matters mentioned in paragraphs (a) to (c) of this section.</p>
            </content>
          </paragraph>
        </section>
        <section eId="part-3__sec-10">
          <num>10</num>
          <heading>Relationship between this Act and other Commonwealth laws</heading>
          <content>
            <p>The provisions of this Act are in addition to, and not in substitution for, the requirements of any other law of the Commonwealth.</p>
          </content>
        </section>
        <section eId="part-3__sec-11">
          <num>11</num>
          <heading>State and Territory laws may operate concurrently</heading>
          <content>
            <p>This Act is not intended to exclude or limit the operation of a law of a State or Territory to the extent that the law is capable of operating concurrently with this Act.</p>
          </content>
        </section>
        <section eId="part-3__sec-12">
          <num>12</num>
          <heading>Meaning of corresponding State-Territory law</heading>
          <subsection eId="part-3__sec-12__subsec-1">
            <num>1</num>
            <content>
              <p>	(1)	For the purposes of this Act, <b><i>corresponding State</i></b><b><i>-</i></b><b><i>Territory law</i></b> means a law of a State or Territory:</p>
            </content>
            <paragraph eId="part-3__sec-12__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>whose operation involves the use of determinations made under <ref href="#sec-18">section 18</ref> of this Act; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-12__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>that is declared by the Commonwealth Minister, in writing, to correspond to this Act;</p>
              </content>
              <content>
                <p><term refersTo="#term-and">and</term> includes <def>such a law as amended from time to time.</def></p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-3__sec-12__subsec-2">
            <num>2</num>
            <content>
              <p>A declaration under paragraph (1)(b) is a legislative instrument.</p>
            </content>

          <heading>Commonwealth consent to conferral of functions etc. on the Regulator or inspectors by corresponding State-Territory laws</heading>

            <num>1</num>

              <p>A corresponding State-Territory law may confer functions or powers, or impose duties, on the Regulator.</p>
            </content>

            <content>
              <p>Subsections (1) and (2) do not authorise the conferral of a function or power, or the imposition of a duty, by a corresponding State-Territory law to the extent to which:</p>
            </content>
            <paragraph eId="part-3__sec-13__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>the conferral or imposition, or the authorisation, would contravene any constitutional doctrines restricting the duties that may be imposed on the Regulator or WELS inspectors; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-13__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>the authorisation would otherwise exceed the legislative power of the Commonwealth.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-3__sec-13__subsec-4">
            <num>4</num>
            <content>
              <p>The Regulator or a WELS inspector cannot perform a duty or function, or exercise a power, under a corresponding State-Territory law unless the conferral of the function or power, or the imposition of the duty, is in accordance with an agreement between the Commonwealth and the State or Territory concerned.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-3__sec-14">
          <num>14</num>
          <heading>How duty is imposed by corresponding State-Territory laws</heading>
          <content>
            <p>Application</p>
          </content>
          <subsection eId="part-3__sec-14__subsec-1">
            <num>1</num>
            <content>
              <p>This section applies if a corresponding State-Territory law purports to impose a duty on the Regulator or WELS inspectors.</p>
            </content>

            <content>
              <p>State or Territory legislative power sufficient to support duty</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-14__subsec-2">
            <num>2</num>
            <content>
              <p>The duty is taken not to be imposed by this Act (or any other law of the Commonwealth) to the extent to which:</p>
            </content>
            <paragraph eId="part-3__sec-14__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>imposing the duty is within the legislative powers of the State or Territory concerned; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-14__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>imposing the duty by the law of the State or Territory is consistent with the constitutional doctrines restricting the duties that may be imposed on the Regulator or WELS inspectors.</p>
              </content>

                  <p>Note:	If this subsection applies, the duty will be taken to be imposed by force of the law of the State or Territory (the Commonwealth having consented under <ref href="#sec-13">section 13</ref> to the imposition of the duty by that law).</p>

                <p>Commonwealth legislative power sufficient to support duty but State or Territory legislative powers are not</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-3__sec-14__subsec-3">
            <num>3</num>
            <content>
              <p>If, to ensure the validity of the purported imposition of the duty, it is necessary that the duty be imposed by a law of the Commonwealth (rather than by the law of the State or Territory), the duty is taken to be imposed by this Act to the extent necessary to ensure that validity.</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-14__subsec-4">
            <num>4</num>
            <content>
              <p>If, because of subsection (3), this Act is taken to impose the duty, it is the intention of the Parliament to rely on all powers available to it under the Constitution to support the imposition of the duty by this Act.</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-14__subsec-5">
            <num>5</num>
            <content>
              <p>The duty is taken to be imposed by this Act in accordance with subsection (3) only to the extent to which imposing the duty:</p>
            </content>
            <paragraph eId="part-3__sec-14__subsec-5__para-a">
              <num>a</num>
              <content>
                <p>is within the legislative powers of the Commonwealth; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-14__subsec-5__para-b">
              <num>b</num>
              <content>
                <p>is consistent with the constitutional doctrines restricting the duties that may be imposed on the Regulator or WELS inspectors.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-3__sec-14__subsec-6">
            <num>6</num>
            <content>
              <p>Subsections (1) to (5) do not limit <ref href="#sec-13">section 13</ref>.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-3__sec-15">
          <num>15</num>
          <heading>When a corresponding State-Territory law imposes a duty</heading>
          <content>
            <p>		For the purposes of sections 13 and 14, a corresponding State-Territory law <b><i>imposes a duty</i></b> on the Regulator or WELS inspectors if:</p>
          </content>
          <paragraph eId="part-3__sec-15__para-a">
            <num>a</num>
            <content>
              <p>the law confers a function or power on the Regulator or WELS inspectors; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-3__sec-15__para-b">
            <num>b</num>
            <content>
              <p>the circumstances in which the function or power is conferred give rise to an obligation on the Regulator or WELS inspectors to perform the function or to exercise the power.</p>
            </content>
          </paragraph>
        </section>
        <section eId="part-3__sec-16">
          <num>16</num>
          <heading>No doubling-up of liabilities</heading>
          <subsection eId="part-3__sec-16__subsec-1">
            <num>1</num>
            <content>
              <p>If:</p>
            </content>
            <paragraph eId="part-3__sec-16__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>an act or omission is an offence against this Act and is also an offence against a law of a State or Territory; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-16__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>the offender has been punished for the offence under the law of the State or Territory;</p>
              </content>
              <content>
                <p>the offender is not liable to be punished for the offence under this Act.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-3__sec-16__subsec-2">
            <num>2</num>
            <content>
              <p>If a person has paid, or been ordered to pay, a pecuniary penalty under a law of a State or Territory, the person is not liable to a pecuniary penalty under this Act in respect of the same conduct.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-3__sec-17">
          <num>17</num>
          <heading>Review of decisions under corresponding State-Territory laws</heading>
          <subsection eId="part-3__sec-17__subsec-1">
            <num>1</num>
            <content>
              <p>Application may be made to the Administrative Review Tribunal for review of a reviewable State-Territory decision.</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-17__subsec-2">
            <num>2</num>
            <content>
              <p>	(2)	A decision made by the Regulator in the performance of a function or the exercise of a power conferred by a corresponding State-Territory law is a <b><i>reviewable State</i></b><b><i>-</i></b><b><i>Territory decision</i></b> for the purposes of this section if:</p>
            </content>
            <paragraph eId="part-3__sec-17__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>the law under which the decision was made provides for review by the Administrative Review Tribunal; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-17__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>the decision is declared by the regulations to be a reviewable State-Territory decision for the purposes of this section.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-3__sec-17__subsec-3">
            <num>3</num>
            <content>

              <p>	(1)	The Commonwealth Minister may, by writing, determine that water-use products or water-saving products of a specified kind are <b><i>WELS products</i></b>.</p>
            </content>
          </subsection>

              <p>A determination under subsection (1) must set out, or incorporate by reference, the WELS standard for the products.</p>

          </subsection>

                <p>criteria for rating the products in relation to either or both of the following:</p>

            </paragraph>

                <p>water efficiency;</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-19__subsec-1__para-ii">
              <num>ii</num>
              <content>
                <p>general performance; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-19__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>requirements in relation to communicating such ratings on product labels.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-4__sec-19__subsec-2">
            <num>2</num>
            <content>
              <p>	(2)	The <b><i>WELS standard</i></b> must require the products to be registered for the purposes of specified supplies of the product.</p>
            </content>
          </subsection>
          <subsection eId="part-4__sec-19__subsec-3">

            <content>
              <p>	(3)	The <b><i>WELS standard</i></b> may require one or more of the following:</p>
            </content>
            <paragraph eId="part-4__sec-19__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>that the products comply with specified minimum water efficiency requirements for the purposes of specified supplies of the product;</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-19__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>that the products comply with specified minimum general performance requirements for the purposes of specified supplies of the product;</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-19__subsec-3__para-c">
              <num>c</num>
              <content>
                <p>that the products comply with one or more requirements relating to plumbing imposed by or under a law of a State or Territory, as in force from time to time;</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-19__subsec-3__para-d">
              <num>d</num>
              <content>
                <p>that a specified type of person or body certifies that the products comply with one or more requirements relating to plumbing imposed by or under a law of a State or Territory, as in force from time to time;</p>

              <content>
                <p>that the products be WELS-labelled for the purposes of specified supplies of the product.</p>

        </section>

          <heading>Meaning of WELS-labelled</heading>
          <subsection eId="part-4__sec-20__subsec-1">
            <num>1</num>
            <content>
              <p>	(1)	A product is <b><i>WELS</i></b><b><i>-</i></b><b><i>labelled</i></b> if it is labelled in accordance with requirements set out in the WELS standard for products of that kind.</p>

          </subsection>

              <p>Such requirements may relate to one or more of the following:</p>
            </content>
            <paragraph eId="part-4__sec-20__subsec-2__para-a">

                <p>the characteristics, contents, placement and quality of labels attached to products or displayed on product packaging;</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-20__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>documents or other material used for, or provided in connection with, the supply of the product;</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-20__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>advertising the product.</p>
              </content>
            </paragraph>
          </subsection>
        </section>
      </part>

        <heading>The WELS Regulator</heading>

          <heading>The Regulator</heading>

              <p>The Commonwealth Secretary must, in writing, designate a position in the Commonwealth Department as the position of Regulator.</p>

          <heading>Functions of the Regulator</heading>

            <p>The Regulator has the following functions:</p>
          </content>

            <content>
              <p>to administer the WELS scheme;</p>
            </content>
          </paragraph>
          <paragraph eId="part-5__sec-22__para-b">
            <num>b</num>
            <content>
              <p>to provide information and advice in relation to the WELS scheme;</p>
            </content>
          </paragraph>
          <paragraph eId="part-5__sec-22__para-c">
            <num>c</num>
            <content>
              <p>to undertake or commission research in relation to the WELS scheme;</p>
            </content>
          </paragraph>
          <paragraph eId="part-5__sec-22__para-d">
            <num>d</num>
            <content>
              <p>to monitor and enforce compliance with the WELS scheme;</p>
            </content>
          </paragraph>
          <paragraph eId="part-5__sec-22__para-e">
            <num>e</num>
            <content>
              <p>such other functions as are conferred on the Regulator by this Act or any other law.</p>
            </content>
          </paragraph>
        </section>
        <section eId="part-5__sec-23">
          <num>23</num>
          <heading>Powers of the Regulator</heading>
          <content>
            <p>Subject to this Act, the Regulator has power to do all things necessary or convenient to be done for or in connection with the performance of the Regulator’s functions.</p>
          </content>
        </section>
        <section eId="part-5__sec-24">
          <num>24</num>
          <heading>Arrangements with other agencies</heading>
          <content>
            <p>The Regulator may make an arrangement with an agency of the Commonwealth or of a State or Territory for the services of officers or employees of the agency to be made available to assist the Regulator in the performance of the functions or duties, or the exercise of the powers, of the Regulator.</p>
          </content>
        </section>

          <num>25</num>
          <heading>Delegation</heading>
          <subsection eId="part-5__sec-25__subsec-1">
            <num>1</num>
            <content>
              <p>The Regulator may, by writing, delegate one or more of the Regulator’s powers or functions under this Act to one or more of the following:</p>
            </content>
            <paragraph eId="part-5__sec-25__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>an officer or employee of an agency of the Commonwealth;</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-25__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>an officer or employee of an agency of a State or Territory.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-5__sec-25__subsec-2">
            <num>2</num>
            <content>
              <p>The Regulator may, by writing, delegate one or more of the Regulator’s powers or functions under a corresponding State-Territory law to one or more of the following:</p>
            </content>
            <paragraph eId="part-5__sec-25__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>an officer or employee of an agency of the Commonwealth;</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-25__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>an officer or employee of an agency of a State or Territory.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-5__sec-25__subsec-3">

              <p>However, the Regulator must not delegate a power or function, under subsection (1) or (2), to an officer or employee of an agency of a State or Territory without the agreement of the State or Territory.</p>

              <p>A delegate of the Regulator is, in the exercise of the delegate’s delegated powers and functions, subject to the Regulator’s directions.</p>

        <heading>Registration of WELS products</heading>

          <heading>Registration of WELS products</heading>

              <p>The Commonwealth Minister must, by legislative instrument, formulate a scheme relating to the registration of WELS products.</p>
            </content>
          </subsection>
          <subsection eId="part-6__sec-26__subsec-2">
            <num>2</num>
            <content>
              <p>Without limiting subsection (1), the scheme may make provision for, or in relation to, any of the following:</p>
            </content>
            <paragraph eId="part-6__sec-26__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>applications for registration of WELS products (including renewal of registration);</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-26__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>the information or documents to be provided with applications for registration (including verification by statutory declaration of the information);</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-26__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>	(c)	the fees (other than fees imposed by the <i>Water Efficiency Labelling and Standards (Registration Fees) Act 2013</i>) to be paid in connection with applications for registration, including methods for working out such fees and the circumstances in which fees may be waived or refunded (either in whole or in part);</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-26__subsec-2__para-d">
              <num>d</num>
              <content>
                <p>the grounds for approving or refusing applications for registration;</p>
              </content>
            </paragraph>

                <p>the period of registration;</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-26__subsec-2__para-f">
              <num>f</num>
              <content>
                <p>the requirements to be met in order for WELS products to remain registered;</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-26__subsec-2__para-g">
              <num>g</num>
              <content>
                <p>the consequences for the registration of a product if a WELS standard for the product is varied or replaced;</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-26__subsec-2__para-h">
              <num>h</num>
              <content>
                <p>the suspension and cancellation of registration;</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-26__subsec-2__para-i">
              <num>i</num>
              <content>
                <p>the creation, maintenance and publication of a register of WELS products;</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-26__subsec-2__para-j">
              <num>j</num>
              <content>
                <p>the review of decisions made by the Regulator under the scheme;</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-26__subsec-2__para-k">
              <num>k</num>
              <content>
                <p>other matters in connection with the registration of WELS products.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-6__sec-26__subsec-3">
            <num>3</num>
            <content>
              <p>	(3)	Without limiting subsection 33(3A) of the <i>Acts Interpretation Act 1901</i>, the scheme may make different provision in relation to:</p>
            </content>
            <paragraph eId="part-6__sec-26__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>different kinds of WELS products; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-26__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>different kinds of applications; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-26__subsec-3__para-c">
              <num>c</num>
              <content>
                <p>different kinds of registrations; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-26__subsec-3__para-d">
              <num>d</num>
              <content>
                <p>different circumstances.</p>
              </content>
            </paragraph>
          </subsection>

                <p>This section applies if the Regulator:</p>

                  <p>an offence against this Act; or</p>
                </content>
              </paragraph>

                  <p>a contravention of a civil penalty provision; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-8__dvs-3B__sec-43B__subsec-1__para-b">

                  <p>is satisfied that it would be in the public interest to give the person a notice under this section.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-8__dvs-3B__sec-43B__subsec-2">
              <num>2</num>
              <content>
                <p>The Regulator may give the person a written notice requiring the person, within a specified period, to take specified action directed toward either or both of the following:</p>
              </content>
              <paragraph eId="part-8__dvs-3B__sec-43B__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>remedying the conduct;</p>
                </content>
              </paragraph>
              <paragraph eId="part-8__dvs-3B__sec-43B__subsec-2__para-b">

                  <p>ensuring that the person does not engage, or continue to engage, in such conduct in the future.</p>
                </content>
              </paragraph>
            </subsection>

                <p>A person contravenes this subsection if the person is subject to a requirement under subsection (2) and the person fails to comply with the requirement.</p>

                <p>A person commits an offence of strict liability if the person contravenes subsection (3).</p>

                <p>If a person has engaged, is engaging or is proposing to engage in conduct that constituted, constitutes or would constitute, an offence against this Act or a contravention of a civil penalty provision, the Federal Court may, on the application of the Regulator, grant an injunction:</p>
              </content>

                <num>a</num>
                <content>
                  <p>restraining the person from engaging in the conduct; or</p>
                </content>
              </paragraph>

                  <p>requiring the person to do an act or thing.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-8__dvs-4__sec-44__subsec-2">
              <num>2</num>
              <content>
                <p>On an application, the Court may, if it thinks it appropriate, grant an injunction by consent of all parties to the proceedings, whether or not the Court is satisfied that the person has engaged, is engaging or is proposing to engage in any conduct that constituted, constitutes or would constitute, an offence against this Act or a contravention of a civil penalty provision.</p>
              </content>
            </subsection>
            <subsection eId="part-8__dvs-4__sec-44__subsec-3">
              <num>3</num>
              <content>
                <p>The Court may, if it thinks it desirable, grant an interim injunction pending its determination of an application.</p>
              </content>
            </subsection>
            <subsection eId="part-8__dvs-4__sec-44__subsec-4">
              <num>4</num>
              <content>
                <p>The Court is not to require the Regulator or anyone else, as a condition of granting an interim injunction, to give an undertaking as to damages.</p>
              </content>
            </subsection>
            <subsection eId="part-8__dvs-4__sec-44__subsec-5">
              <num>5</num>
              <content>
                <p>The Court may discharge or vary an injunction it has granted.</p>
              </content>
            </subsection>

                <p>The power to grant or vary an injunction restraining a person from engaging in conduct may be exercised:</p>
              </content>

                  <p>whether or not it appears to the Court that the person intends to engage again, or to continue to engage, in such conduct; and</p>
                </content>
              </paragraph>

                  <p>whether or not the person has previously engaged in such conduct.</p>
                </content>

                <p>The power to grant or vary an injunction requiring a person to do an act or thing may be exercised:</p>
              </content>

                  <p>whether or not it appears to the Court that the person intends to refuse or fail again, or to continue to refuse or fail, to do that act or thing; and</p>

                  <p>whether or not the person has previously refused or failed to do that act or thing and whether or not there is an imminent danger of substantial damage to any person if the person refuses or fails to do that act or thing.</p>

                <p>The Regulator may apply to a relevant court for an order that a person, who is alleged to have contravened a civil penalty provision, pay the Commonwealth a pecuniary penalty.</p>

                <p>The Regulator must make the application within 4 years of the alleged contravention.</p>

                  <p>if the person is a body corporate—5 times the pecuniary penalty specified for the civil penalty provision; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-8A__dvs-1__sec-44A__subsec-5__para-b">
                <num>b</num>
                <content>
                  <p>otherwise—the pecuniary penalty specified for the civil penalty provision.</p>
                </content>
              </paragraph>

                <p>In determining the pecuniary penalty, the relevant court may take into account all relevant matters, including:</p>
              </content>

                  <p>the nature and extent of the contravention; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-8A__dvs-1__sec-44A__subsec-6__para-b">

                <content>
                  <p>the nature and extent of any loss or damage suffered because of the contravention; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-8A__dvs-1__sec-44A__subsec-6__para-c">
                <num>c</num>
                <content>
                  <p>the circumstances in which the contravention took place; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-8A__dvs-1__sec-44A__subsec-6__para-d">
                <num>d</num>
                <content>
                  <p>	(d)	whether the person has previously been found by a court<i> </i>to have engaged in any similar conduct.</p>
                </content>

            <heading>Civil enforcement of penalty</heading>
            <subsection eId="part-8A__dvs-1__sec-44B__subsec-1">
              <num>1</num>
              <content>
                <p>A pecuniary penalty is a debt payable to the Commonwealth.</p>
              </content>
            </subsection>
            <subsection eId="part-8A__dvs-1__sec-44B__subsec-2">
              <num>2</num>
              <content>
                <p>The Commonwealth may enforce a civil penalty order as if it were an order made in civil proceedings against the person to recover a debt due by the person. The debt arising from the order is taken to be a judgement debt.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-8A__dvs-1__sec-44C">
            <num>44C</num>
            <heading>Conduct contravening more than one civil penalty provision</heading>
            <subsection eId="part-8A__dvs-1__sec-44C__subsec-1">
              <num>1</num>
              <content>
                <p>If conduct constitutes a contravention of 2 or more civil penalty provisions, proceedings may be instituted under this Part against a person in relation to the contravention of any one or more of those provisions.</p>
              </content>
            </subsection>
            <subsection eId="part-8A__dvs-1__sec-44C__subsec-2">
              <num>2</num>
              <content>
                <p>However, the person is not liable to more than one pecuniary penalty under this Part in relation to the same conduct.</p>
              </content>
            </subsection>
          </section>

            <heading>Multiple contraventions</heading>
            <subsection eId="part-8A__dvs-1__sec-44D__subsec-1">
              <num>1</num>

                <p>A relevant court may make a single civil penalty order against a person for multiple contraventions of a civil penalty provision if proceedings for the contraventions are founded on the same facts, or if the contraventions form, or are part of, a series of contraventions of the same or a similar character.</p>

              <p>A relevant court may not make a civil penalty order against a person for a contravention of a civil penalty provision if the person has been convicted of an offence constituted by conduct that is the same, or substantially the same, as the conduct constituting the contravention.</p>
            </content>

            <num>44J</num>
            <heading>Criminal proceedings during civil proceedings</heading>
            <subsection eId="part-8A__dvs-2__sec-44J__subsec-1">
              <num>1</num>
              <content>
                <p>Proceedings for a civil penalty order against a person for a contravention of a civil penalty provision are stayed if:</p>
              </content>
              <paragraph eId="part-8A__dvs-2__sec-44J__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>criminal proceedings are commenced or have already been commenced against the person for an offence; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-8A__dvs-2__sec-44J__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>the offence is constituted by conduct that is the same, or substantially the same, as the conduct alleged to constitute the contravention.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-8A__dvs-2__sec-44J__subsec-2">
              <num>2</num>
              <content>
                <p>	(2)	The proceedings for the order (the <b><i>civil proceedings</i></b>) may be resumed if the person is not convicted of the offence. Otherwise:</p>
              </content>
              <paragraph eId="part-8A__dvs-2__sec-44J__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>the civil proceedings are dismissed; and</p>
                </content>
              </paragraph>

                  <p><i>	</i>(b)	costs must not be awarded in relation to the civil proceedings.</p>

              <p>Criminal proceedings may be commenced against a person for conduct that is the same, or substantially the same, as conduct that would constitute a contravention of a civil penalty provision regardless of whether a civil penalty order has been made against the person in relation to the contravention.</p>

            <heading>Evidence given in civil proceedings not admissible in criminal proceedings</heading>

                <p>Evidence of information given, or evidence of production of documents by an individual, is not admissible in criminal proceedings against the individual if:</p>
              </content>
              <paragraph eId="part-8A__dvs-2__sec-44L__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>the individual previously gave the evidence or produced the documents in proceedings for a civil penalty order against the individual for an alleged contravention of a civil penalty provision (whether or not the order was made); and</p>
                </content>
              </paragraph>
              <paragraph eId="part-8A__dvs-2__sec-44L__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>the conduct alleged to constitute the offence is the same, or substantially the same, as the conduct alleged to constitute the contravention.</p>
                </content>
              </paragraph>
            </subsection>

              <content>
                <p>However, subsection (1) does not apply to criminal proceedings in relation to the falsity of the evidence given by the individual in the proceedings for the civil penalty order.</p>

                <p>A person must not:</p>

                  <p>attempt to contravene a civil penalty provision; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-8A__dvs-3__sec-44M__subsec-1__para-b">

                <content>
                  <p>aid, abet, counsel or procure a contravention of a civil penalty provision; or</p>
                </content>
              </paragraph>

                  <p>induce (by threats, promises or otherwise) a contravention of a civil penalty provision; or</p>

                  <p>be in any way, directly or indirectly, knowingly concerned in, or party to, a contravention of a civil penalty provision; or</p>

                  <p>conspire with others to effect a contravention of a civil penalty provision.</p>

                <p>If an act or thing is required under a civil penalty provision to be done:</p>

              <paragraph eId="part-8A__dvs-3__sec-44N__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>within a particular period; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-8A__dvs-3__sec-44N__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>before a particular time;</p>
                </content>
                <content>
                  <p>then the obligation to do that act or thing continues until the act or thing is done (even if the period has expired or the time has passed).</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-8A__dvs-3__sec-44N__subsec-2">
              <num>2</num>
              <content>
                <p>A person who contravenes a civil penalty provision that requires an act or thing to be done:</p>
              </content>
              <paragraph eId="part-8A__dvs-3__sec-44N__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>within a particular period; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-8A__dvs-3__sec-44N__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>before a particular time;</p>
                </content>
                <content>
                  <p>commits a separate contravention of that provision in respect of each day during which the contravention occurs (including the day the relevant civil penalty order is made or any later day).</p>
                </content>
              </paragraph>
            </subsection>
          </section>

            <num>44P</num>
            <heading>Mistake of fact</heading>
            <subsection eId="part-8A__dvs-3__sec-44P__subsec-1">
              <num>1</num>
              <content>
                <p>A person is not liable to have a civil penalty order made against the person for a contravention of a civil penalty provision if:</p>
              </content>
              <paragraph eId="part-8A__dvs-3__sec-44P__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>at or before the time of the conduct constituting the contravention, the person:</p>
                </content>
              </paragraph>
              <paragraph eId="part-8A__dvs-3__sec-44P__subsec-1__para-i">
                <num>i</num>
                <content>
                  <p>considered whether or not facts existed; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-8A__dvs-3__sec-44P__subsec-1__para-ii">
                <num>ii</num>
                <content>
                  <p>was under a mistaken but reasonable belief about those facts; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-8A__dvs-3__sec-44P__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>had those facts existed, the conduct would not have constituted a contravention of the civil penalty provision.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-8A__dvs-3__sec-44P__subsec-2">
              <num>2</num>
              <content>
                <p>For the purposes of subsection (1), a person may be regarded as having considered whether or not facts existed if:</p>
              </content>
              <paragraph eId="part-8A__dvs-3__sec-44P__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>the person had considered, on a previous occasion, whether those facts existed in the circumstances surrounding that occasion; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-8A__dvs-3__sec-44P__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>the person honestly and reasonably believed that the circumstances surrounding the present occasion were the same, or substantially the same, as those surrounding the previous occasion.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-8A__dvs-3__sec-44P__subsec-3">
              <num>3</num>
              <content>
                <p>A person who wishes to rely on subsection (1) or (2) in proceedings for a civil penalty order bears an evidential burden in relation to that matter.</p>
              </content>
            </subsection>

            <heading>State of mind</heading>
            <subsection eId="part-8A__dvs-3__sec-44Q__subsec-1">
              <num>1</num>

                <p>In proceedings for a civil penalty order against a person for a contravention of a civil penalty provision (other than <ref href="#sec-32A">section 32A</ref> or subsection 44M(1)), it is not necessary to prove:</p>

          <heading>Appointment of WELS inspectors</heading>

            <heading>Regulator may appoint WELS inspectors</heading>
            <subsection eId="part-9__dvs-1__sec-45__subsec-1">
              <num>1</num>
              <content>
                <p>The Regulator may, by writing, appoint any of the following as a WELS inspector:</p>
              </content>
              <paragraph eId="part-9__dvs-1__sec-45__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>an officer or employee of an agency of the Commonwealth;</p>
                </content>
              </paragraph>
              <paragraph eId="part-9__dvs-1__sec-45__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>an officer or employee of an agency of a State or Territory.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-9__dvs-1__sec-45__subsec-2">
              <num>2</num>
              <content>
                <p>However, the Regulator must not appoint an officer or employee of an agency of a State or Territory as a WELS inspector without the agreement of the State or Territory.</p>
              </content>
            </subsection>
            <subsection eId="part-9__dvs-1__sec-45__subsec-3">

              <content>
                <p>In exercising his or her powers or performing his or her functions a WELS inspector must comply with any direction of the Regulator.</p>

            <heading>Identity cards</heading>

                <p>The Regulator must issue an identity card to each WELS inspector.</p>
              </content>
            </subsection>
            <subsection eId="part-9__dvs-1__sec-46__subsec-2">

              <content>
                <p>The identity card must:</p>
              </content>
              <paragraph eId="part-9__dvs-1__sec-46__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>be in the form prescribed by the regulations; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-9__dvs-1__sec-46__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>contain a recent photograph of the WELS inspector.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-9__dvs-1__sec-46__subsec-3">
              <num>3</num>
              <content>
                <p>A person commits an offence if:</p>
              </content>
              <paragraph eId="part-9__dvs-1__sec-46__subsec-3__para-a">
                <num>a</num>
                <content>
                  <p>the person has been issued with an identity card; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-9__dvs-1__sec-46__subsec-3__para-b">
                <num>b</num>
                <content>
                  <p>the person ceases to be a WELS inspector; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-9__dvs-1__sec-46__subsec-3__para-c">
                <num>c</num>
                <content>
                  <p>the person does not return the identity card to the Regulator as soon as practicable.</p>
                </content>

                <p>A WELS inspector must carry his or her identity card at all times when exercising powers or performing functions as a WELS inspector.</p>

                <p>A WELS inspector is not entitled to exercise any powers under this Part in relation to premises if:</p>
              </content>
              <paragraph eId="part-9__dvs-1__sec-46__subsec-5__para-a">
                <num>a</num>
                <content>
                  <p>the occupier of the premises has required the WELS inspector to produce his or her identity card for inspection by the occupier; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-9__dvs-1__sec-46__subsec-5__para-b">
                <num>b</num>
                <content>
                  <p>the WELS inspector fails to comply with the requirement.</p>
                </content>
              </paragraph>
            </subsection>
          </section>
        </division>
        <division eId="part-9__dvs-2">
          <num>2</num>
          <heading>Powers of WELS inspectors</heading>
          <section eId="part-9__dvs-2__sec-47">
            <num>47</num>
            <heading>Purposes for which powers can be used</heading>
            <content>
              <p>A WELS inspector may exercise the powers set out in this Division for the following purposes:</p>
            </content>
            <paragraph eId="part-9__dvs-2__sec-47__para-a">
              <num>a</num>
              <content>
                <p>determining whether a person is complying with this Act;</p>
              </content>
            </paragraph>
            <paragraph eId="part-9__dvs-2__sec-47__para-b">
              <num>b</num>
              <content>
                <p>investigating:</p>
              </content>
            </paragraph>
            <paragraph eId="part-9__dvs-2__sec-47__para-i">
              <num>i</num>
              <content>
                <p>a possible contravention of a civil penalty provision; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-9__dvs-2__sec-47__para-ii">
              <num>ii</num>
              <content>
                <p>a possible offence against this Act.</p>
              </content>
            </paragraph>

          <section eId="part-9__dvs-2__sec-48">

            <heading>Inspection powers—public areas of WELS business premises</heading>
            <subsection eId="part-9__dvs-2__sec-48__subsec-1">
              <num>1</num>
              <content>
                <p>For the purposes set out in <ref href="#sec-47">section 47</ref>, a WELS inspector may do one or more of the following in a public area of WELS business premises when the premises are open to the public:</p>
              </content>

                <num>a</num>
                <content>
                  <p>inspect WELS products;</p>
                </content>
              </paragraph>
              <paragraph eId="part-9__dvs-2__sec-48__subsec-1__para-b">

                  <p>purchase any WELS product that is available for sale;</p>
                </content>
              </paragraph>
              <paragraph eId="part-9__dvs-2__sec-48__subsec-1__para-c">
                <num>c</num>
                <content>
                  <p>inspect or collect written information, advertising or any other document that is available, or made available, to the public;</p>
                </content>
              </paragraph>
              <paragraph eId="part-9__dvs-2__sec-48__subsec-1__para-d">
                <num>d</num>
                <content>
                  <p>discuss product features with any person;</p>
                </content>
              </paragraph>
              <paragraph eId="part-9__dvs-2__sec-48__subsec-1__para-e">
                <num>e</num>
                <content>
                  <p>observe practices relating to the supply of products.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-9__dvs-2__sec-48__subsec-2">
              <num>2</num>
              <content>
                <p>Subsection (1) does not affect any right of the occupier of the premises to refuse to allow a WELS inspector to enter, or remain on, the premises.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-9__dvs-2__sec-49">
            <num>49</num>
            <heading>Inspection powers—with consent</heading>
            <subsection eId="part-9__dvs-2__sec-49__subsec-1">
              <num>1</num>
              <content>
                <p>A WELS inspector may enter WELS premises and exercise the powers set out in subsection (3) if the occupier of the premises consents to the entry and the exercise of those powers.</p>
              </content>
            </subsection>
            <subsection eId="part-9__dvs-2__sec-49__subsec-2">
              <num>2</num>
              <content>
                <p>Before obtaining consent, the WELS inspector must inform the occupier that he or she may refuse consent, or withdraw consent, at any time.</p>
              </content>
            </subsection>
            <subsection eId="part-9__dvs-2__sec-49__subsec-3">
              <num>3</num>
              <content>
                <p>For the purposes set out in <ref href="#sec-47">section 47</ref>, a WELS inspector who enters WELS premises in accordance with subsection (1) may do one or more of the following:</p>
              </content>

                <num>a</num>
                <content>
                  <p>search the premises and any thing (including a vehicle) on the premises;</p>
                </content>
              </paragraph>
              <paragraph eId="part-9__dvs-2__sec-49__subsec-3__para-b">
                <num>b</num>
                <content>
                  <p>inspect, examine, take measurements of or conduct tests on any thing on the premises;</p>
                </content>
              </paragraph>
              <paragraph eId="part-9__dvs-2__sec-49__subsec-3__para-c">
                <num>c</num>
                <content>
                  <p>take photographs, make video or audio recordings or make sketches of the premises or any thing on the premises;</p>
                </content>
              </paragraph>
              <paragraph eId="part-9__dvs-2__sec-49__subsec-3__para-d">
                <num>d</num>
                <content>
                  <p>inspect any book, record or document on the premises;</p>
                </content>
              </paragraph>
              <paragraph eId="part-9__dvs-2__sec-49__subsec-3__para-e">
                <num>e</num>
                <content>
                  <p>take extracts from or make copies of any such book, record or document;</p>
                </content>
              </paragraph>
              <paragraph eId="part-9__dvs-2__sec-49__subsec-3__para-f">
                <num>f</num>
                <content>
                  <p>take onto the premises such equipment and materials as the WELS inspector requires for the purposes of exercising powers in relation to the premises;</p>
                </content>
              </paragraph>
              <paragraph eId="part-9__dvs-2__sec-49__subsec-3__para-g">
                <num>g</num>
                <content>
                  <p>operate equipment on the premises for the purposes of gaining access to a document or record relating to one or more WELS products.</p>
                </content>
              </paragraph>
            </subsection>
          </section>
          <section eId="part-9__dvs-2__sec-50">
            <num>50</num>
            <heading>Refusing consent is not an offence</heading>
            <content>
              <p>The occupier of WELS premises does not commit an offence if:</p>
            </content>
            <paragraph eId="part-9__dvs-2__sec-50__para-a">
              <num>a</num>
              <content>
                <p>the occupier refuses to allow a WELS inspector to enter, or remain on, the premises; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-9__dvs-2__sec-50__para-b">
              <num>b</num>
              <content>
                <p>the WELS inspector does not have a warrant to enter the premises.</p>
              </content>
            </paragraph>
          </section>
          <section eId="part-9__dvs-2__sec-51">
            <num>51</num>
            <heading>Inspection powers—with warrant</heading>
            <subsection eId="part-9__dvs-2__sec-51__subsec-1">
              <num>1</num>
              <content>
                <p>A WELS inspector may enter WELS premises and exercise the powers set out in subsection (2) if the WELS inspector has a warrant for the entry.</p>

                  <p>exercise one or more of the powers set out in subsection 49(3);</p>
                </content>
              </paragraph>

                  <p>require any person on the premises to:</p>
                </content>
              </paragraph>

              </paragraph>
              <paragraph eId="part-9__dvs-2__sec-51__subsec-2__para-ii">
                <num>ii</num>
                <content>
                  <p>produce any book, record or document requested by the WELS inspector;</p>
                </content>
              </paragraph>
              <paragraph eId="part-9__dvs-2__sec-51__subsec-2__para-c">
                <num>c</num>
                <content>
                  <p>seize or secure any evidential material on the premises.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-9__dvs-2__sec-51__subsec-3">
              <num>3</num>
              <content>
                <p>A person commits an offence if:</p>
              </content>
              <paragraph eId="part-9__dvs-2__sec-51__subsec-3__para-a">
                <num>a</num>
                <content>
                  <p>the person is required to answer a question or produce a book, record or document under paragraph (2)(b); and</p>
                </content>
              </paragraph>
              <paragraph eId="part-9__dvs-2__sec-51__subsec-3__para-b">
                <num>b</num>
                <content>
                  <p>the person does not answer the question or produce the book, record or document.</p>
                </content>

            <heading>Announcement before entry under warrant</heading>
            <subsection eId="part-9__dvs-2__sec-52__subsec-1">

                <p>A WELS inspector must, before entering WELS premises under a warrant:</p>
              </content>
              <paragraph eId="part-9__dvs-2__sec-52__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>announce that he or she is authorised to enter the premises; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-9__dvs-2__sec-52__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>give any person on the premises an opportunity to allow entry to the premises.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-9__dvs-2__sec-52__subsec-2">
              <num>2</num>
              <content>
                <p>A WELS inspector is not required to comply with subsection (1) if he or she believes on reasonable grounds that immediate entry to the premises is required to ensure that the effective execution of the warrant is not frustrated.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-9__dvs-2__sec-53">
            <num>53</num>
            <heading>Copy of warrant to be given to occupier</heading>
            <subsection eId="part-9__dvs-2__sec-53__subsec-1">
              <num>1</num>
              <content>
                <p>If a warrant in relation to WELS premises is being executed and the occupier of the premises is present at the premises, the WELS inspector must:</p>
              </content>
              <paragraph eId="part-9__dvs-2__sec-53__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>give a copy of the warrant to the occupier; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-9__dvs-2__sec-53__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>identify himself or herself to the occupier.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-9__dvs-2__sec-53__subsec-2">

                <p>The copy of the warrant does not need to include the signature of the magistrate who issued the warrant.</p>
              </content>
            </subsection>
          </section>

            <heading>Occupier must provide inspector with facilities and assistance</heading>

              <p>A person commits an offence if:</p>
            </content>

                <p>the person is the occupier of WELS premises; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-9__dvs-2__sec-54__para-b">
              <num>b</num>

                <p>a WELS inspector enters the premises under a warrant; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-9__dvs-2__sec-54__para-c">
              <num>c</num>
              <content>
                <p>the person does not provide the WELS inspector with all reasonable facilities and assistance for the effective execution of the warrant.</p>
              </content>

            </paragraph>
          </section>

            <heading>Seizing or securing evidential material</heading>
            <subsection eId="part-9__dvs-2__sec-55__subsec-1">
              <num>1</num>
              <content>
                <p>If a WELS inspector seizes or secures evidential material on WELS premises, the WELS inspector must give the occupier of the premises a receipt for the material.</p>
              </content>
            </subsection>
            <subsection eId="part-9__dvs-2__sec-55__subsec-2">
              <num>2</num>
              <content>
                <p>The Regulator may make copies of the material.</p>
              </content>
            </subsection>
            <subsection eId="part-9__dvs-2__sec-55__subsec-3">
              <num>3</num>
              <content>
                <p>The Regulator may examine or test the material, even though that might result in damage or destruction of the material or a reduction in its value.</p>
              </content>
            </subsection>
            <subsection eId="part-9__dvs-2__sec-55__subsec-4">
              <num>4</num>
              <content>
                <p>The Regulator must return or release the material when the first of the following occurs:</p>
              </content>
              <paragraph eId="part-9__dvs-2__sec-55__subsec-4__para-a">
                <num>a</num>
                <content>
                  <p>the material is no longer needed for the purposes for which it was seized or secured;</p>
                </content>
              </paragraph>
              <paragraph eId="part-9__dvs-2__sec-55__subsec-4__para-b">
                <num>b</num>
                <content>
                  <p>the period of 90 days that begins on the day on which the material was seized or secured ends.</p>
                </content>
              </paragraph>
            </subsection>
          </section>
          <section eId="part-9__dvs-2__sec-56">

            <heading>Holding evidential material for more than 90 days</heading>
            <subsection eId="part-9__dvs-2__sec-56__subsec-1">
              <num>1</num>
              <content>
                <p>Despite paragraph 55(4)(b), the Regulator may:</p>
              </content>
              <paragraph eId="part-9__dvs-2__sec-56__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>apply to a magistrate for an order allowing possession or control of evidential material for such further period as is specified in the order; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-9__dvs-2__sec-56__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>if the magistrate makes such an order—so retain possession or control of the material.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-9__dvs-2__sec-56__subsec-2">
              <num>2</num>
              <content>
                <p>In determining the application, the magistrate must allow the owner of the material to appear and be heard.</p>
              </content>
            </subsection>
            <subsection eId="part-9__dvs-2__sec-56__subsec-3">
              <num>3</num>
              <content>
                <p>The magistrate must not make an order allowing possession or control of the material for a further period unless the magistrate is satisfied that the order is necessary for the purposes of prosecuting an offence against this Act.</p>

          </section>

            <heading>Returning evidential material</heading>
            <content>
              <p>If the Regulator cannot, despite making reasonable efforts, locate the owner of evidential material, the Regulator may dispose of the material in such manner as the Regulator thinks appropriate.</p>

                <p>A WELS inspector may apply to a magistrate for a warrant to enter WELS premises.</p>
              </content>

                <p>Issue of warrant</p>
              </content>
            </subsection>
            <subsection eId="part-9__dvs-3__sec-58__subsec-2">

              <content>
                <p>The magistrate may issue the warrant if the magistrate is satisfied, by information on oath or affirmation, that it is necessary to enter the WELS premises for one or more of the following purposes:</p>

                <num>a</num>
                <content>
                  <p>determining whether a person is complying with this Act;</p>
                </content>
              </paragraph>
              <paragraph eId="part-9__dvs-3__sec-58__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>investigating:</p>
                </content>
              </paragraph>
              <paragraph eId="part-9__dvs-3__sec-58__subsec-2__para-i">
                <num>i</num>
                <content>
                  <p>a possible contravention of a civil penalty provision; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-9__dvs-3__sec-58__subsec-2__para-ii">
                <num>ii</num>
                <content>
                  <p>a possible offence against this Act.</p>
                </content>
              </paragraph>
            </subsection>

                <p>However, the magistrate must not issue the warrant unless the WELS inspector or some other person has given to the magistrate, either orally or by affidavit, such further information (if any) as the magistrate requires concerning the grounds on which the issue of the warrant is being sought.</p>

                <p>The warrant must:</p>
              </content>

                  <p>authorise the WELS inspector to enter the premises using such assistance and such force to enter the premises as is necessary and reasonable; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-9__dvs-3__sec-58__subsec-4__para-b">
                <num>b</num>
                <content>
                  <p>state whether the entry is authorised to be made at any time of the day or night or during specified hours of the day or night; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-9__dvs-3__sec-58__subsec-4__para-c">
                <num>c</num>
                <content>
                  <p>specify the day (not more than one week after the issue of the warrant) on which the warrant ceases to have effect; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-9__dvs-3__sec-58__subsec-4__para-d">
                <num>d</num>
                <content>
                  <p>state the purpose for which the warrant is issued.</p>
                </content>
              </paragraph>
            </subsection>

                <p>If, in an urgent case, a WELS inspector considers it necessary to do so, the WELS inspector may apply to a magistrate by telephone, fax or other electronic means for a warrant under <ref href="#sec-58">section 58</ref>.</p>
              </content>
            </subsection>
            <subsection eId="part-9__dvs-3__sec-59__subsec-2">
              <num>2</num>
              <content>
                <p>The magistrate may:</p>
              </content>
              <paragraph eId="part-9__dvs-3__sec-59__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>require communication by voice to the extent that it is practicable in the circumstances; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-9__dvs-3__sec-59__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>make a recording of the whole or any part of any such communication by voice.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-9__dvs-3__sec-59__subsec-3">
              <num>3</num>
              <content>
                <p>Before applying for the warrant, the WELS inspector must prepare an information of the kind mentioned in subsection 58(2) that sets out the grounds on which the warrant is sought.</p>
              </content>
            </subsection>

              <num>4</num>
              <content>
                <p>If it is necessary to do so, the WELS inspector may apply for the warrant before the information is sworn or affirmed.</p>
              </content>
              <content>
                <p>Issue of warrant</p>
              </content>
            </subsection>
            <subsection eId="part-9__dvs-3__sec-59__subsec-5">
              <num>5</num>
              <content>
                <p>If the magistrate is satisfied:</p>
              </content>
              <paragraph eId="part-9__dvs-3__sec-59__subsec-5__para-a">
                <num>a</num>
                <content>
                  <p>after having considered the terms of the information; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-9__dvs-3__sec-59__subsec-5__para-b">
                <num>b</num>
                <content>
                  <p>after having received such further information (if any) as the magistrate requires concerning the grounds on which the issue of the warrant is being sought;</p>
                </content>
                <content>
                  <p>that there are reasonable grounds for issuing the warrant, the magistrate may complete and sign the same warrant that the magistrate would issue under <ref href="#sec-58">section 58</ref> if the application had been made under that section.</p>
                  <p>Obligations of magistrate and inspector once warrant issued</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-9__dvs-3__sec-59__subsec-6">
              <num>6</num>
              <content>
                <p>If the magistrate completes and signs the warrant:</p>
              </content>
              <paragraph eId="part-9__dvs-3__sec-59__subsec-6__para-a">
                <num>a</num>
                <content>
                  <p>the magistrate must:</p>
                </content>
              </paragraph>
              <paragraph eId="part-9__dvs-3__sec-59__subsec-6__para-i">
                <num>i</num>
                <content>
                  <p>tell the WELS inspector what the terms of the warrant are; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-9__dvs-3__sec-59__subsec-6__para-ii">
                <num>ii</num>
                <content>
                  <p>tell the WELS inspector the day on which and the time at which the warrant was signed; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-9__dvs-3__sec-59__subsec-6__para-iii">
                <num>iii</num>
                <content>
                  <p>tell the WELS inspector the day (not more than one week after the magistrate completes and signs the warrant) on which the warrant ceases to have effect; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-9__dvs-3__sec-59__subsec-6__para-iv">
                <num>iv</num>
                <content>
                  <p>record on the warrant the reasons for issuing the warrant; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-9__dvs-3__sec-59__subsec-6__para-b">
                <num>b</num>
                <content>
                  <p>the WELS inspector must:</p>
                </content>
              </paragraph>
              <paragraph eId="part-9__dvs-3__sec-59__subsec-6__para-i">
                <num>i</num>
                <content>
                  <p>complete a form of warrant in the same terms as the warrant completed and signed by the magistrate; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-9__dvs-3__sec-59__subsec-6__para-ii">
                <num>ii</num>
                <content>
                  <p>write on the form the name of the magistrate and the day on which and the time at which the warrant was signed.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-9__dvs-3__sec-59__subsec-7">
              <num>7</num>
              <content>
                <p>The WELS inspector must also, not later than the day after the day of expiry or execution of the warrant, whichever is the earlier, send to the magistrate:</p>
              </content>
              <paragraph eId="part-9__dvs-3__sec-59__subsec-7__para-a">
                <num>a</num>
                <content>
                  <p>the form of warrant completed by the WELS inspector; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-9__dvs-3__sec-59__subsec-7__para-b">
                <num>b</num>
                <content>
                  <p>the information referred to in subsection (3), which must have been duly sworn or affirmed.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-9__dvs-3__sec-59__subsec-8">
              <num>8</num>
              <content>
                <p>When the magistrate receives those documents, the magistrate must:</p>
              </content>
              <paragraph eId="part-9__dvs-3__sec-59__subsec-8__para-a">
                <num>a</num>
                <content>
                  <p>attach them to the warrant that the magistrate completed and signed; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-9__dvs-3__sec-59__subsec-8__para-b">
                <num>b</num>
                <content>
                  <p>deal with them in the way in which the magistrate would have dealt with the information if the application had been made under <ref href="#sec-58">section 58</ref>.</p>
                </content>
                <content>
                  <p>Authority of warrant</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-9__dvs-3__sec-59__subsec-9">
              <num>9</num>
              <content>
                <p>A form of warrant duly completed under subsection (6) is authority for the same powers as are authorised by the warrant signed by the magistrate.</p>
              </content>
            </subsection>
            <subsection eId="part-9__dvs-3__sec-59__subsec-10">

              <content>
                <p>If:</p>
              </content>
              <paragraph eId="part-9__dvs-3__sec-59__subsec-10__para-a">
                <num>a</num>

                  <p>it is material, in any proceedings, for a court to be satisfied that an exercise of a power was authorised by this section; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-9__dvs-3__sec-59__subsec-10__para-b">
                <num>b</num>
                <content>
                  <p>the warrant signed by the magistrate authorising the exercise of the power is not produced in evidence;</p>
                </content>
                <content>
                  <p>the court must assume, unless the contrary is proved, that the exercise of the power was not authorised by such a warrant.</p>
                </content>

          <heading>Giving WELS information to WELS inspectors</heading>
          <section eId="part-9__dvs-4__sec-60">
            <num>60</num>
            <heading>Meaning of person who has WELS information</heading>
            <content>
              <p>		A person is a <b><i>person who has WELS information</i></b> if the Regulator believes, on reasonable grounds, that the person is capable of giving information, or producing books, records or documents, relevant for the purposes of investigating or preventing an offence against this Act or a contravention of a civil penalty provision.</p>
            </content>
          </section>
          <section eId="part-9__dvs-4__sec-61">
            <num>61</num>
            <heading>Regulator may require a person to provide information</heading>
            <subsection eId="part-9__dvs-4__sec-61__subsec-1">
              <num>1</num>
              <content>
                <p>The Regulator may, by written notice, require a person who has WELS information to give to the WELS inspector specified in the notice, and in the manner and within the period specified in the notice:</p>
              </content>
              <paragraph eId="part-9__dvs-4__sec-61__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>such information as is specified in the notice; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-9__dvs-4__sec-61__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>any book, record or document that is specified in the notice.</p>
                </content>
                <content>
                  <p>The period must end not less than 14 days after the notice is given.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-9__dvs-4__sec-61__subsec-2">
              <num>2</num>
              <content>
                <p>	(2)	A notice under subsection (1) must set out the effect of sections 137.1 and 137.2 of the <i>Criminal Code</i>.</p>

                <p>A person commits an offence if:</p>
              </content>

                  <p>the person is required to give information or a book, record or document to a WELS inspector under subsection (1); and</p>
                </content>
              </paragraph>
              <paragraph eId="part-9__dvs-4__sec-61__subsec-3__para-b">

                  <p>the person does not give the WELS inspector the information, book, record or document.</p>
                </content>

                <p>The Regulator may, by written notice, require a person who has WELS information to appear before the WELS inspector specified in the notice, at a time and place specified in the notice:</p>

                <num>a</num>
                <content>
                  <p>to answer any questions put by the WELS inspector; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-9__dvs-4__sec-62__subsec-1__para-b">

                  <p>to produce to the WELS inspector such books, records or documents as are referred to in the notice.</p>
                </content>
                <content>
                  <p>The time must not be earlier than 14 days after the notice is given.</p>

                  <p>when appearing before the WELS inspector, the person does not:</p>
                </content>
              </paragraph>

                  <p>answer a question put by the WELS inspector; or</p>
                </content>
              </paragraph>

                  <p>produce a book, record or document to the WELS inspector as required by notice given under that subsection.</p>

        <heading>Review of decisions</heading>

          <heading>Meaning of reviewable decision and affected person</heading>

              <p>	(1)	Each of the following decisions is a <b><i>reviewable decision</i></b>:</p>

              <p>	(4)	A person whose waiver/refund request is refused is the <b><i>affected person</i></b> for the purposes of a decision referred to in paragraph (1)(c).</p>

          <heading>Notification of decisions and review rights</heading>
          <subsection eId="part-11__sec-70__subsec-1">
            <num>1</num>
            <content>
              <p>The Regulator must, as soon as practicable after making a reviewable decision, cause a notice in writing to be given to the affected person in relation to the decision, containing:</p>
            </content>
            <paragraph eId="part-11__sec-70__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>the terms of the decision; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-11__sec-70__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>the reasons for the decision; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-11__sec-70__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>a statement setting out particulars of the person’s review rights.</p>

          </subsection>
          <subsection eId="part-11__sec-70__subsec-2">

            <content>
              <p>A failure to comply with the requirements of subsection (1) in relation to a decision does not affect the validity of the decision.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-11__sec-71">
          <num>71</num>
          <heading>Internal review</heading>
          <subsection eId="part-11__sec-71__subsec-1">
            <num>1</num>
            <content>
              <p>	(1)	The affected person in relation to a reviewable decision (other than a decision made by the Regulator personally) may apply in writing to the Regulator for review (the <b><i>internal review</i></b>) of the decision.</p>
            </content>
          </subsection>
          <subsection eId="part-11__sec-71__subsec-2">
            <num>2</num>
            <content>
              <p>An application for internal review must be made <quantity refersTo="#deadline">within 30 days</quantity> after the day on which the decision first came to the notice of the applicant, or within such further period (if any) as the Regulator, either before or after the end of that period, allows.</p>
            </content>
          </subsection>
          <subsection eId="part-11__sec-71__subsec-3">
            <num>3</num>
            <content>
              <p>The Regulator must, on receiving an application:</p>
            </content>
            <paragraph eId="part-11__sec-71__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>review the reviewable decision personally; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-11__sec-71__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>cause the reviewable decision to be reviewed by a person:</p>
              </content>
            </paragraph>
            <paragraph eId="part-11__sec-71__subsec-3__para-i">
              <num>i</num>
              <content>
                <p>to whom the Regulator’s power under this section is delegated; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-11__sec-71__subsec-3__para-ii">
              <num>ii</num>
              <content>
                <p>who was not involved in the making of the decision; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-11__sec-71__subsec-3__para-iii">
              <num>iii</num>

                <p>who occupies a position in the Commonwealth Department that is senior to that occupied by any person involved in making the decision.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-11__sec-71__subsec-4">

            <content>
              <p>After the Regulator, or the person mentioned in paragraph (3)(b), has reviewed the reviewable decision, the Regulator or the person may:</p>
            </content>
            <paragraph eId="part-11__sec-71__subsec-4__para-a">
              <num>a</num>
              <content>
                <p>make a decision affirming, varying or revoking the reviewable decision; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-11__sec-71__subsec-4__para-b">
              <num>b</num>
              <content>
                <p>if the decision is revoked—make such other decision as the Regulator or the person thinks appropriate.</p>
              </content>
            </paragraph>
          </subsection>

          <heading>Review of decisions by Administrative Review Tribunal</heading>
          <subsection eId="part-11__sec-72__subsec-1">
            <num>1</num>
            <content>
              <p>Application may be made to the Administrative Review Tribunal for review of the following decisions:</p>

          <num>73</num>
          <heading>Compensation for damage to electronic equipment</heading>
          <subsection eId="part-12__sec-73__subsec-1">
            <num>1</num>
            <content>
              <p>This section applies if:</p>
            </content>
            <paragraph eId="part-12__sec-73__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>as a result of electronic equipment being operated as mentioned in <ref href="#sec-49">section 49</ref>:</p>
              </content>
            </paragraph>
            <paragraph eId="part-12__sec-73__subsec-1__para-i">
              <num>i</num>
              <content>
                <p>damage is caused to the equipment; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-12__sec-73__subsec-1__para-ii">
              <num>ii</num>
              <content>
                <p>the data recorded on the equipment is damaged; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-12__sec-73__subsec-1__para-iii">
              <num>iii</num>
              <content>
                <p>programs associated with the use of the equipment, or with the use of the data, are damaged or corrupted; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-12__sec-73__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>the damage or corruption occurs because:</p>
              </content>
            </paragraph>
            <paragraph eId="part-12__sec-73__subsec-1__para-i">
              <num>i</num>
              <content>
                <p>insufficient care was exercised in selecting the person who was to operate the equipment; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-12__sec-73__subsec-1__para-ii">
              <num>ii</num>
              <content>
                <p>insufficient care was exercised by the person operating the equipment.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-12__sec-73__subsec-2">
            <num>2</num>
            <content>
              <p>The Commonwealth must pay the owner of the equipment, or the user of the data or programs, such reasonable compensation for the damage or corruption as the owner or user agree on.</p>
            </content>
          </subsection>
          <subsection eId="part-12__sec-73__subsec-3">
            <num>3</num>
            <content>
              <p>However, if the owner or user and the Commonwealth fail to agree, the owner or user may institute proceedings in the Federal Court for such reasonable amount of compensation as the Court determines.</p>
            </content>
          </subsection>
          <subsection eId="part-12__sec-73__subsec-4">
            <num>4</num>
            <content>
              <p>In determining the amount of compensation payable, regard is to be had to whether the occupier of the premises, or the occupier’s employees and agents, if they were available at the time, provided any appropriate warning or guidance on the operation of the equipment.</p>
            </content>
          </subsection>
          <subsection eId="part-12__sec-73__subsec-5">
            <num>5</num>
            <content>
              <p>Compensation is payable out of money appropriated by the Parliament.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-12__sec-74">
          <num>74</num>
          <heading>Compensation for acquisition of property</heading>
          <subsection eId="part-12__sec-74__subsec-1">
            <num>1</num>
            <content>
              <p>If:</p>
            </content>
            <paragraph eId="part-12__sec-74__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>apart from this section, the operation of this Act would result in the acquisition of property from a person otherwise than on just terms; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-12__sec-74__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>the acquisition would be invalid because of paragraph 51(xxxi) of the Constitution;</p>
              </content>
              <content>
                <p>then the Commonwealth is liable to pay compensation of a reasonable amount to the person in respect of the acquisition.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-12__sec-74__subsec-2">
            <num>2</num>
            <content>
              <p>If the Commonwealth and the person do not agree on the amount of the compensation, the person may take proceedings in the Federal Court for the recovery from the Commonwealth of such reasonable amount of compensation as the Court determines.</p>
            </content>
          </subsection>
          <subsection eId="part-12__sec-74__subsec-3">
            <num>3</num>
            <content>
              <p>Compensation is payable out of money appropriated by the Parliament.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-12__sec-75">
          <num>75</num>
          <heading>Annual report</heading>
          <subsection eId="part-12__sec-75__subsec-1">
            <num>1</num>
            <content>
              <p>The Regulator must, as soon as practicable after the end of each financial year, prepare and give to the Commonwealth Minister a report on the operation of the WELS scheme during the year.</p>
            </content>
          </subsection>
          <subsection eId="part-12__sec-75__subsec-2">
            <num>2</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> must cause a copy of the report:</p>
            </content>
            <paragraph eId="part-12__sec-75__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>to be tabled in each House of the Parliament within 15 sitting days of the day on which the report is given to <role refersTo="#minister">the Minister</role>; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-12__sec-75__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>to be given to each participating State and Territory.</p>
              </content>
            </paragraph>
          </subsection>
        </section>
        <section eId="part-12__sec-76">
          <num>76</num>
          <heading>Review of operation of WELS scheme</heading>
          <subsection eId="part-12__sec-76__subsec-1">
            <num>1</num>
            <content>
              <p>The Commonwealth Minister must cause an independent review of the operation of the WELS scheme to be undertaken as soon as possible after the fifth anniversary of the commencement of this section.</p>
            </content>
          </subsection>
          <subsection eId="part-12__sec-76__subsec-1A">
            <num>1A</num>
            <content>
              <p>The Commonwealth Minister must cause further independent reviews of the operation of the WELS scheme to be undertaken:</p>
            </content>
            <paragraph eId="part-12__sec-76__subsec-1A__para-a">
              <num>a</num>
              <content>
                <p>within 5 years after the completion of the review referred to in subsection (1); and</p>
              </content>
            </paragraph>
            <paragraph eId="part-12__sec-76__subsec-1A__para-b">
              <num>b</num>
              <content>
                <p>thereafter, within 5 years after the completion of the previous review.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-12__sec-76__subsec-2">
            <num>2</num>
            <content>
              <p>The persons who undertake a review under this section must give the Commonwealth Minister a written report of the review.</p>
            </content>
          </subsection>
          <subsection eId="part-12__sec-76__subsec-3">
            <num>3</num>
            <content>
              <p>The Commonwealth Minister must cause a copy of the report of each review:</p>
            </content>

                <p>in the Commonwealth Minister’s opinion possess appropriate qualifications to undertake the review; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-12__sec-76__subsec-4__para-b">
              <num>b</num>
              <content>
                <p>include one or more persons who are not APS employees.</p>
              </content>
            </paragraph>
          </subsection>
        </section>
        <section eId="part-12__sec-77">
          <num>77</num>
          <heading>Regulations</heading>
          <subsection eId="part-12__sec-77__subsec-1">
            <num>1</num>
            <content>
              <p>The Governor-General may make regulations prescribing matters:</p>
            </content>
            <paragraph eId="part-12__sec-77__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>required or permitted by this Act to be prescribed; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-12__sec-77__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>necessary or convenient to be prescribed for carrying out or giving effect to this Act.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-12__sec-77__subsec-2">
            <num>2</num>
            <content>
              <p>Without limiting subsection (1), the regulations may:</p>
            </content>
            <paragraph eId="part-12__sec-77__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>prescribe fees in respect of matters under this Act; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-12__sec-77__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>prescribe penalties of not more than <quantity refersTo="#penaltyUnit">50 penalty units</quantity> for offences against the regulations; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-12__sec-77__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>declare that specified provisions of the regulations are civil penalty provisions for the purposes of this Act, and prescribe penalties for contraventions of such provisions that do not exceed:</p>
              </content>
            </paragraph>
            <paragraph eId="part-12__sec-77__subsec-2__para-i">
              <num>i</num>
              <content>
                <p>for a body corporate—<quantity refersTo="#penaltyUnit">250 penalty units</quantity>; or</p>
              </content>

              <content>
                <p>in any other case—<quantity refersTo="#penaltyUnit">50 penalty units</quantity>.</p>
