              <p>Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.</p>

          <heading>Definitions</heading>
          <content>
            <p>In this Act, unless the contrary intention appears:</p>
            <p><term refersTo="#term-acma">ACMA</term> means <def>the Australian Communications and Media Authority.</def></p>
            <p><b><i>ACMA official</i></b> means:</p>
          </content>
          <paragraph eId="part-1__sec-3__para-a">
            <num>a</num>
            <content>
              <p>a member; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-b">
            <num>b</num>
            <content>
              <p>an associate member; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-c">
            <num>c</num>
            <content>
              <p>a member of the ACMA staff; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-d">
            <num>d</num>
            <content>
              <p>a person whose services are made available to the ACMA under subsection 55(1).</p>
            </content>
            <content>
              <p><term refersTo="#term-acma-staff">ACMA staff</term> means <def>the staff described in <ref href="#sec-54">section 54</ref>.</def></p>
              <p><b><i>additional functions</i></b>, in relation to the ACMA, has the meaning given by section 11.</p>
              <p><b><i>appointer</i></b> means:</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-a">
            <num>a</num>
            <content>
              <p>for a member—the Governor-General; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-b">
            <num>b</num>
            <content>
              <p>for an associate member—<role refersTo="#minister">the Minister</role>.</p>
            </content>
            <content>
              <p><term refersTo="#term-associate-member">associate member</term> means <def>an associate member of the ACMA.</def></p>
              <p><b><i>authorised disclosure information</i></b> means:</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-a">
            <num>a</num>
            <content>
              <p>information that was given in confidence to the ACMA in connection with the performance of any of the ACMA’s functions or the exercise of any of its powers; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-b">
            <num>b</num>
            <content>
              <p>information that was obtained by the ACMA as a result of the exercise of any of its powers under:</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-i">
            <num>i</num>
            <content>
              <p>	(i)	<i>Broadcasting Services Act 1992</i>; or<ref href="#part-2">Part 2</ref>, 5, 7, 8C, 9E or 13 of the </p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-ia">
            <num>ia</num>
            <content>
              <p>	(ia)	<i>Interactive Gambling Act 2001</i>; or<ref href="#part-3">Part 3</ref>, 4 or 5 of the </p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-ii">
            <num>ii</num>
            <content>
              <p>	(ii)	Chapter 3, 5 or 6 of the <i>Radiocommunications Act 1992</i>; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-iii">
            <num>iii</num>
            <content>
              <p>	(iii)	<i>Telecommunications Act 1997</i>; or<ref href="#part-3">Part 3</ref>, 6, 21, 26 or 27 of the </p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-iv">
            <num>iv</num>
            <content>
              <p>	(iv)	Schedule 3A to the <i>Telecommunications Act 1997</i>; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-v">
            <num>v</num>
            <content>
              <p>	(v)	Part 2 of the <i>Telecommunications (Consumer Protection and Service Standards) Act 1999</i>; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-c">
            <num>c</num>
            <content>
              <p>information that was obtained by the ACMA as a result of the exercise of powers under a provision that:</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-i">
            <num>i</num>
            <content>
              <p>allows the ACMA or an ACMA official to require a person to give information or to produce a document; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-ii">
            <num>ii</num>
            <content>
              <p>is a provision of an Act or a legislative instrument; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-iii">
            <num>iii</num>
            <content>
              <p>is not a provision described in paragraph (b); or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-d">
            <num>d</num>
            <content>
              <p>information that was given in confidence to the ACMA by a government authority of a foreign country.</p>
            </content>
            <content>
              <p><b><i>broadcasting, content and datacasting functions</i></b>, in relation to the ACMA, has the meaning given by section 10.</p>

              <p><b><i>ends</i></b>, in relation to a hearing, inquiry or investigation, has the meaning given by section 4.</p>

              <p><term refersTo="#term-telecommunications">telecommunications</term> means <def>the carriage of communications (as defined in the in <ref href="">the Telecommunications Act 1997</ref>) by means of guided and/or unguided electromagnetic energy.</def></p>
              <p><b><i>telecommunications functions</i></b>, in relation to the ACMA, has the meaning given by section 8.</p>
              <p><b><i>vacancy</i></b>, in relation to the office of a member, has a meaning affected by section 5.</p>

          <num>4</num>
          <heading>When does an inquiry, investigation or hearing end?</heading>
          <subsection eId="part-1__sec-4__subsec-1">
            <num>1</num>

              <p>	(1)	This section defines when an inquiry, investigation or hearing <b><i>ends</i></b> for the purposes of this Act.</p>

          </subsection>

              <p>	(2)	An investigation under <i>Telecommunications Act 1997</i>, or an inquiry or hearing, ends at the end of the day on which the ACMA completes the preparation of a report about the investigation, inquiry or hearing under whichever of the following provisions is applicable:<ref href="#part-2">Part 2</ref>6 of the </p>

                <p>	(1)	The ACMA’s <b><i>additional functions </i></b>are as follows:</p>

                  <p>if a written instruction issued by <role refersTo="#minister">the Minister</role> to do so is in force—to prepare to provide for the management of electronic addressing:</p>

                <num>i</num>
                <content>
                  <p>of a kind specified in the instruction; and</p>
                </content>
              </paragraph>

                  <p>relating to a kind of listed carriage service specified in the instruction;</p>
                </content>
              </paragraph>

              <p>The ACMA has power to do all things necessary or convenient to be done for or in connection with the performance of its functions.</p>

          <heading>Requirements relating to these functions and powers</heading>

            <heading>Minister may give directions to ACMA</heading>
            <subsection eId="part-2__dvs-4__sec-14__subsec-1">
              <num>1</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> may give written directions to the ACMA in relation to the performance of its functions and the exercise of its powers.</p>
              </content>
            </subsection>
            <subsection eId="part-2__dvs-4__sec-14__subsec-2">
              <num>2</num>
              <content>
                <p>However, such a direction can only be of a general nature if it relates to:</p>
              </content>
              <paragraph eId="part-2__dvs-4__sec-14__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>the ACMA’s broadcasting, content and datacasting functions; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-4__sec-14__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>the ACMA’s powers relating to those functions.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-4__sec-14__subsec-3">
              <num>3</num>
              <content>
                <p>	(3)	A direction under subsection (1) must be published in the <i>Gazette</i>.</p>
              </content>
            </subsection>
            <subsection eId="part-2__dvs-4__sec-14__subsec-4">

                <p>The ACMA must perform its functions, and exercise its powers, in a manner consistent with any directions given by <role refersTo="#minister">the Minister</role> under subsection (1).</p>

            <heading>ACMA not otherwise subject to direction</heading>
            <content>
              <p>Except as otherwise provided by or under this or any other Act, the ACMA is not subject to direction by or on behalf of the Commonwealth.</p>
            </content>
          </section>
          <section eId="part-2__dvs-4__sec-16">
            <num>16</num>
            <heading>Consistency with CER Trade in Services Protocol</heading>
            <content>
              <p>		The ACMA must perform its broadcasting, content and datacasting functions, and exercise its powers relating to those functions, in a manner consistent with Australia’s obligations under the CER Trade in Services Protocol (as defined in the <i>Broadcasting Services Act 1992</i>).</p>
            </content>
          </section>
          <section eId="part-2__dvs-4__sec-17">
            <num>17</num>
            <heading>ACMA to consult ACCC in relation to management of electronic addressing</heading>
            <content>
              <p>The ACMA must consult the Australian Competition and Consumer Commission before carrying out an act:</p>
            </content>
            <paragraph eId="part-2__dvs-4__sec-17__para-a">
              <num>a</num>
              <content>
                <p>for the purpose of performing its functions under paragraph 11(1)(a) or (b); and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__dvs-4__sec-17__para-b">
              <num>b</num>
              <content>
                <p>that would, in the ACMA’s opinion, have a significant effect on competition or consumer protection.</p>
              </content>
            </paragraph>

                <p>The Chair and the Deputy Chair must be appointed as full-time members.</p>
              </content>
            </subsection>

                <p>A member, other than the Chair or the Deputy Chair, may be appointed as a full-time member or as a part-time member.</p>
              </content>
            </subsection>

                <p>A part-time member may be assigned by <role refersTo="#minister">the Minister</role>, acting on the ACMA’s advice, on a full-time basis to an inquiry, investigation or hearing. Such an assignment must be in writing.</p>

              <num>5</num>
              <content>
                <p>For the purposes of this Act (except for subsection 31(2) and paragraph 34(5)(b)), a part-time member so assigned is taken to be a full-time member while the assignment is in force.</p>

            <heading>Period of appointment for members</heading>

                <p>A member holds office for the period specified in his or her instrument of appointment. The period must not exceed 5 years.</p>

                <p>A person can be appointed as a member more than once. However, a later appointment must not result in the sum of the person’s periods of appointment exceeding 10 years.</p>

                <p>Extension to complete inquiry, investigation or hearing</p>

            <subsection eId="part-3__dvs-2__sec-21__subsec-3">

                <p>Despite subsections (1) and (2), if a member is conducting, or is part of the panel conducting, an inquiry, investigation or hearing for the ACMA, <role refersTo="#minister">the Minister</role> may, by writing, extend the member’s appointment until the end of the inquiry, investigation or hearing.</p>
              </content>

                <p>For 10 year rule, count associate membership and ABA and ACA membership and associate membership</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-2__sec-21__subsec-4">
              <num>4</num>
              <content>
                <p>	(4)	For the purposes of subsection (2), a <b><i>period of appointment</i></b> includes (in addition to any periods when the person was a member of the ACMA):</p>

                  <p>a period when the person was an associate member of the ACMA; or</p>
                </content>

            <heading>Appointment of associate members</heading>

                <p><role refersTo="#minister">The Minister</role> may appoint as many associate members of the ACMA as he or she thinks fit.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-2__sec-24__subsec-2">
              <num>2</num>
              <content>
                <p>Each associate member is to be appointed by <role refersTo="#minister">the Minister</role> by written instrument.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-2__sec-24__subsec-3">
              <num>3</num>
              <content>
                <p>An associate member may be appointed as a full-time associate member or as a part-time associate member.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-2__sec-24__subsec-4">
              <num>4</num>
              <content>
                <p>An associate member’s instrument of appointment must contain a statement to the effect that the associate member’s appointment relates to 1 or more specified matters, being:</p>
              </content>
              <paragraph eId="part-3__dvs-2__sec-24__subsec-4__para-a">
                <num>a</num>
                <content>
                  <p>an inquiry, investigation or hearing; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-2__sec-24__subsec-4__para-b">
                <num>b</num>
                <content>
                  <p>any other matter that relates to the performance of the ACMA’s functions or the exercise of the ACMA’s powers.</p>
                </content>
              </paragraph>
            </subsection>
          </section>
          <section eId="part-3__dvs-2__sec-25">
            <num>25</num>
            <heading>Period of appointment for associate members</heading>
            <content>
              <p>Period specified in instrument of appointment</p>
            </content>
            <subsection eId="part-3__dvs-2__sec-25__subsec-1">
              <num>1</num>
              <content>
                <p>An associate member holds office for the period specified in his or her instrument of appointment. The period must not exceed 5 years.</p>
              </content>
              <content>
                <p>Total periods of appointment must not exceed 10 years</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-2__sec-25__subsec-2">
              <num>2</num>
              <content>
                <p>A person can be appointed as an associate member more than once. However, a later appointment must not result in the sum of the person’s periods of appointment exceeding 10 years.</p>
              </content>
              <content>
                <p>Reduction if specified inquiry, investigation or hearing ends earlier</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-2__sec-25__subsec-3">
              <num>3</num>
              <content>
                <p>Despite subsection (1), if:</p>
              </content>
              <paragraph eId="part-3__dvs-2__sec-25__subsec-3__para-a">
                <num>a</num>
                <content>
                  <p>an associate member’s instrument of appointment specifies that the appointment relates to a specified inquiry, investigation or hearing; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-2__sec-25__subsec-3__para-b">
                <num>b</num>
                <content>
                  <p>the inquiry, investigation or hearing ends before the end of the period described in subsection (1);</p>
                </content>
                <content>
                  <p>the associate member holds office until the end of the inquiry, investigation or hearing.</p>
                  <p>Extension to complete inquiry, investigation or hearing</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-2__sec-25__subsec-4">
              <num>4</num>
              <content>
                <p>Despite subsections (1) and (2), if an associate member is conducting, or is part of the panel conducting, an inquiry, investigation or hearing for the ACMA, <role refersTo="#minister">the Minister</role> may, by writing, extend the associate member’s appointment until the end of the inquiry, investigation or hearing.</p>
              </content>

                <p>For 10 year rule, count membership and ABA and ACA membership and associate membership</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-2__sec-25__subsec-5">
              <num>5</num>
              <content>
                <p>	(5)	For the purposes of subsection (2), a <b><i>period of appointment</i></b> includes (in addition to any periods when the person was an associate member of the ACMA):</p>
              </content>
              <paragraph eId="part-3__dvs-2__sec-25__subsec-5__para-a">
                <num>a</num>
                <content>
                  <p>a period when the person was a member of the ACMA; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-2__sec-25__subsec-5__para-b">
                <num>b</num>
                <content>
                  <p>	(b)	a period before the commencement of <i>Broadcasting Services Act 1992</i>; or<ref href="#sec-6">section 6</ref> when the person was a member, or associate member, of the Australian Broadcasting Authority that was established by the </p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-2__sec-25__subsec-5__para-c">
                <num>c</num>
                <content>
                  <p>a period:</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-2__sec-25__subsec-5__para-i">
                <num>i</num>
                <content>
                  <p>starting on or after <date date="1997-07-01">1 July 1997</date>; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-2__sec-25__subsec-5__para-ii">
                <num>ii</num>
                <content>
                  <p>ending before the commencement of <ref href="#sec-6">section 6</ref>;</p>
                </content>
                <content>
                  <p>		when the person was a member, or associate member, of the body corporate that was continued in existence by <i>Australian Communications Authority Act 1997.</i><ref href="#sec-14">section 14</ref> of the </p>
                </content>
              </paragraph>
            </subsection>
          </section>
          <section eId="part-3__dvs-2__sec-26">
            <num>26</num>
            <heading>Acting appointments—associate members</heading>
            <content>
              <p><role refersTo="#minister">The Minister</role> may appoint a person to act as an associate member during any period, or during all periods, when an associate member:</p>
            </content>
            <paragraph eId="part-3__dvs-2__sec-26__para-a">
              <num>a</num>
              <content>
                <p>is acting as a member; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__dvs-2__sec-26__para-b">
              <num>b</num>
              <content>
                <p>is absent from duty or from Australia; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__dvs-2__sec-26__para-c">
              <num>c</num>
              <content>
                <p>is, for any reason, unable to perform the duties of the office.</p>
              </content>

            <heading>Associate members to be treated as members for certain purposes in other Acts</heading>

                <p>For the purposes of a reference in an Act other than this Act to a member of the ACMA, an associate member is taken to be a member for all purposes in connection with any inquiry, investigation, hearing or other matter specified in his or her instrument of appointment.</p>

            </subsection>

                <p>Subsection (1) is subject to a contrary intention in the other Act.</p>
              </content>
            </subsection>

        </division>

          <heading>Terms and conditions for members and associate members</heading>
          <section eId="part-3__dvs-3__sec-28">
            <num>28</num>
            <heading>Remuneration</heading>
            <subsection eId="part-3__dvs-3__sec-28__subsec-1">
              <num>1</num>
              <content>
                <p>A member or associate member is to be paid the remuneration that is determined by the Remuneration Tribunal. If no determination of that remuneration by the Tribunal is in operation, the member or associate member is to be paid the remuneration that is prescribed in the regulations.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-3__sec-28__subsec-2">
              <num>2</num>
              <content>
                <p>A member or associate member is to be paid the allowances that are prescribed in the regulations.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-3__sec-28__subsec-3">
              <num>3</num>
              <content>
                <p>	(3)	This section has effect subject to the <i>Remuneration Tribunal Act 1973</i>.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-3__dvs-3__sec-29">
            <num>29</num>
            <heading>Disclosure of interests</heading>
            <subsection eId="part-3__dvs-3__sec-29__subsec-1">
              <num>1</num>
              <content>
                <p>	(1)	A disclosure by a member or associate member under <i>Public Governance, Performance and Accountability Act 2013</i> (which deals with the duty to disclose interests) must be made to the Minister.<ref href="#sec-29">section 29</ref> of the </p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-3__sec-29__subsec-2">
              <num>2</num>
              <content>
                <p>Subsection (1) applies in addition to any rules made for the purposes of that section.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-3__sec-29__subsec-3">
              <num>3</num>
              <content>
                <p>	(3)	For the purposes of this Act and the <i>Public Governance, Performance and Accountability Act 2013</i>, the member or associate member is taken not to have complied with section 29 of that Act if he or she does not comply with subsection (1) of this section.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-3__sec-29__subsec-4">
              <num>4</num>
              <content>
                <p>	(4)	The Chair must inform the Minister if the members of the ACMA agree, in accordance with any rules made for the purposes of <i>Public Governance, Performance and Accountability Act 2013</i>, to a member or associate member doing something that, apart from that agreement, the member or associate member would be prevented by those rules from doing.<ref href="#sec-29">section 29</ref> of the </p>
              </content>
            </subsection>
          </section>
          <section eId="part-3__dvs-3__sec-31">
            <num>31</num>
            <heading>Outside employment</heading>
            <subsection eId="part-3__dvs-3__sec-31__subsec-1">
              <num>1</num>
              <content>
                <p>The Chair must not engage in paid employment outside the duties of the Chair’s office without <role refersTo="#minister">the Minister</role>’s approval.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-3__sec-31__subsec-2">
              <num>2</num>
              <content>
                <p>The other full-time members and the full-time associate members must not engage in paid employment outside the duties of their offices without the Chair’s approval.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-3__dvs-3__sec-32">
            <num>32</num>
            <heading>Leave of absence</heading>
            <subsection eId="part-3__dvs-3__sec-32__subsec-1">
              <num>1</num>
              <content>
                <p>A full-time member or full-time associate member has the recreation leave entitlements that are determined by the Remuneration Tribunal.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-3__sec-32__subsec-2">
              <num>2</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> may grant the Chair leave of absence, other than recreation leave, on the terms and conditions as to remuneration or otherwise that <role refersTo="#minister">the Minister</role> determines.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-3__sec-32__subsec-3">
              <num>3</num>
              <content>
                <p>The Chair may grant another full-time member or a full-time associate member leave of absence, other than recreation leave, on the terms and conditions as to remuneration or otherwise that the Chair determines.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-3__sec-32__subsec-4">
              <num>4</num>
              <content>
                <p>The Chair may grant leave of absence to any part-time member, or part-time associate member, on the terms and conditions that the Chair determines.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-3__dvs-3__sec-33">
            <num>33</num>
            <heading>Resignation</heading>
            <content>
              <p>A member or associate member may resign his or her appointment by giving the appointer a written resignation.</p>
            </content>
          </section>
          <section eId="part-3__dvs-3__sec-34">
            <num>34</num>
            <heading>Termination of appointment</heading>
            <subsection eId="part-3__dvs-3__sec-34__subsec-1">
              <num>1</num>
              <content>
                <p>The appointer must terminate the appointment of a member or associate member if <role refersTo="#minister">the Minister</role> is of the opinion that the performance of the member or associate member has been unsatisfactory for a significant period of time.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-3__sec-34__subsec-2">
              <num>2</num>
              <content>
                <p>The Governor-General must terminate the appointment of all of the members and associate members if <role refersTo="#minister">the Minister</role> is of the opinion that the ACMA’s performance has been unsatisfactory for a significant period of time.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-3__sec-34__subsec-3">
              <num>3</num>
              <content>
                <p>The appointer may terminate the appointment of a member or associate member for misbehaviour or physical or mental incapacity.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-3__sec-34__subsec-4">
              <num>4</num>
              <content>
                <p>The appointer may terminate the appointment of a member or associate member if:</p>
              </content>
              <paragraph eId="part-3__dvs-3__sec-34__subsec-4__para-a">
                <num>a</num>
                <content>
                  <p>the member or associate member:</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-34__subsec-4__para-i">
                <num>i</num>
                <content>
                  <p>becomes bankrupt; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-34__subsec-4__para-ii">
                <num>ii</num>
                <content>
                  <p>applies to take the benefit of any law for the relief of bankrupt or insolvent debtors; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-34__subsec-4__para-iii">
                <num>iii</num>
                <content>
                  <p>compounds with his or her creditors; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-34__subsec-4__para-iv">
                <num>iv</num>
                <content>
                  <p>makes an assignment of his or her remuneration for the benefit of his or her creditors; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-34__subsec-4__para-b">
                <num>b</num>
                <content>
                  <p>	(b)	the member or associate member fails, without reasonable excuse, to comply with <i>Public Governance, Performance and Accountability Act 2013</i> (which deals with the duty to disclose interests) or rules made for the purposes of that section.<ref href="#sec-29">section 29</ref> of the </p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-3__sec-34__subsec-5">
              <num>5</num>
              <content>
                <p>The appointer may terminate the appointment of a full-time member or full-time associate member if:</p>
              </content>
              <paragraph eId="part-3__dvs-3__sec-34__subsec-5__para-a">
                <num>a</num>
                <content>
                  <p>the member or associate member is absent, except on leave of absence, for 14 consecutive days or for 28 days in any 12 consecutive months; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-34__subsec-5__para-b">
                <num>b</num>
                <content>
                  <p>the member or associate member engages, without the approval required by <ref href="#sec-31">section 31</ref>, in paid employment outside the duties of his or her office.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-3__sec-34__subsec-6">
              <num>6</num>
              <content>
                <p>The appointer may terminate the appointment of a part-time member if the member is absent, except on leave of absence, from 3 consecutive meetings of the ACMA.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-3__sec-34__subsec-7">
              <num>7</num>
              <content>
                <p>The appointer may terminate the appointment of a part-time associate member if the associate member is absent from 3 consecutive meetings of the ACMA except on leave of absence. However, the only meetings that are to be taken into account for this purpose are meetings:</p>
              </content>
              <paragraph eId="part-3__dvs-3__sec-34__subsec-7__para-a">
                <num>a</num>
                <content>
                  <p>that the associate member was entitled to attend (see <ref href="#sec-40">section 40</ref>); and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-34__subsec-7__para-b">
                <num>b</num>
                <content>
                  <p>about which reasonable efforts were made to inform the associate member (see paragraph 37(b)).</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-3__sec-34__subsec-8">
              <num>8</num>
              <content>
                <p>If <role refersTo="#minister">the Minister</role> is of the opinion that the members have failed to comply with section 56 or 57, the Governor-General may terminate the appointment of all members or particular members.</p>
              </content>
            </subsection>

            <heading>Other terms and conditions</heading>
            <content>
              <p>A member or associate member holds office on the terms and conditions (if any) in relation to matters not covered by this Act that are determined by the appointer.</p>

          <heading>Meetings</heading>

            <heading>Times and places of meetings</heading>
            <subsection eId="part-4__dvs-1__sec-36__subsec-1">
              <num>1</num>
              <content>
                <p>The ACMA is to hold such meetings as are necessary for the efficient performance of its functions.</p>
              </content>
            </subsection>
            <subsection eId="part-4__dvs-1__sec-36__subsec-2">
              <num>2</num>
              <content>
                <p>Meetings are to be held at such times and places as the ACMA decides. This subsection has effect subject to subsections (3) and (4).</p>
              </content>
            </subsection>
            <subsection eId="part-4__dvs-1__sec-36__subsec-3">
              <num>3</num>
              <content>
                <p>The Chair may call a meeting at any time.</p>
              </content>
            </subsection>
            <subsection eId="part-4__dvs-1__sec-36__subsec-4">
              <num>4</num>
              <content>
                <p>The Chair must call a meeting if requested to do so in writing by:</p>
              </content>
              <paragraph eId="part-4__dvs-1__sec-36__subsec-4__para-a">
                <num>a</num>
                <content>
                  <p><role refersTo="#minister">the Minister</role>; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-1__sec-36__subsec-4__para-b">
                <num>b</num>
                <content>
                  <p>at least 2 other members.</p>
                </content>
              </paragraph>
            </subsection>
          </section>
          <section eId="part-4__dvs-1__sec-37">

            <heading>Notice of meetings</heading>
            <content>
              <p>Reasonable efforts must be made to inform the following people about proposed meetings of the ACMA:</p>
            </content>
            <paragraph eId="part-4__dvs-1__sec-37__para-a">
              <num>a</num>
              <content>
                <p>the members;</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__dvs-1__sec-37__para-b">
              <num>b</num>
              <content>
                <p>if the agenda for the proposed meeting mentions a matter connected with an inquiry, investigation, hearing or other matter specified in 1 or more associate members’ instruments of appointment—that associate member, or each of those associate members.</p>
              </content>
            </paragraph>
          </section>

            <heading>Presiding at meetings</heading>
            <subsection eId="part-4__dvs-1__sec-38__subsec-1">
              <num>1</num>
              <content>
                <p>The Chair presides at all meetings at which he or she is present.</p>
              </content>
            </subsection>
            <subsection eId="part-4__dvs-1__sec-38__subsec-2">
              <num>2</num>
              <content>
                <p>If the Chair is not present at a meeting, the Deputy Chair presides.</p>
              </content>
            </subsection>
            <subsection eId="part-4__dvs-1__sec-38__subsec-3">
              <num>3</num>
              <content>
                <p>If neither the Chair nor the Deputy Chair is present at a meeting, the members present must appoint 1 of themselves to preside.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-4__dvs-1__sec-39">
            <num>39</num>
            <heading>Quorum</heading>
            <subsection eId="part-4__dvs-1__sec-39__subsec-1">
              <num>1</num>
              <content>
                <p>At a meeting of the ACMA, a quorum is constituted by a majority of the members.</p>
              </content>
            </subsection>
            <subsection eId="part-4__dvs-1__sec-39__subsec-2">
              <num>2</num>
              <content>
                <p>However, if:</p>
              </content>
              <paragraph eId="part-4__dvs-1__sec-39__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>	(a)	rules made for the purposes of <i>Public Governance, Performance and Accountability Act 2013</i> prevent a member from participating in the deliberations, or decisions, of the ACMA with respect to a particular matter; and<ref href="#sec-29">section 29</ref> of the </p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-1__sec-39__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>when the member leaves the meeting concerned there is no longer a quorum present;</p>
                </content>
                <content>
                  <p>the remaining members at the meeting constitute a quorum for the purpose of any deliberation or decision at that meeting with respect to that matter.</p>
                </content>
              </paragraph>
            </subsection>
          </section>
          <section eId="part-4__dvs-1__sec-40">
            <num>40</num>
            <heading>Participation etc. by associate members at meetings</heading>
            <subsection eId="part-4__dvs-1__sec-40__subsec-1">
              <num>1</num>
              <content>
                <p>An associate member is entitled to attend, and participate in discussions at, a meeting of the ACMA while the meeting is considering a matter connected with an inquiry, investigation, hearing or other matter specified in the associate member’s instrument of appointment.</p>
              </content>
            </subsection>
            <subsection eId="part-4__dvs-1__sec-40__subsec-2">

              <content>
                <p>	(2)	Subsection (1) has effect subject to rules made for the purposes of <i>Public Governance, Performance and Accountability Act 2013</i>.<ref href="#sec-29">section 29</ref> of the </p>

                <p>At a meeting of the ACMA, a question is decided by a majority of the votes of the following people present and voting:</p>

              <paragraph eId="part-4__dvs-1__sec-41__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>the members; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-1__sec-41__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>if the question relates to a matter connected with an inquiry, investigation, hearing or other matter specified in the instruments of appointment of 1 or more associate members—that associate member, or each of those associate members.</p>
                </content>
              </paragraph>
            </subsection>

                <p>The person presiding at a meeting has a deliberative vote and, if necessary, also a casting vote.</p>

              <p>The ACMA may, subject to this Division, regulate proceedings at its meetings as it considers appropriate.</p>

            <heading>Decisions without meetings</heading>

                <p>A decision is taken to have been made at a meeting of the ACMA if:</p>
              </content>
              <paragraph eId="part-4__dvs-2__sec-44__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>without meeting, a majority of the members indicate agreement with the proposed decision in accordance with the method determined by the ACMA under subsection (2); and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-44__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>all the members were informed of the proposed decision, or reasonable efforts were made to inform all the members of the proposed decision.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-4__dvs-2__sec-44__subsec-2">
              <num>2</num>
              <content>
                <p>Subsection (1) applies only if the ACMA:</p>
              </content>
              <paragraph eId="part-4__dvs-2__sec-44__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>has determined that it applies; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-44__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>has determined the method by which members are to indicate agreement with proposed decisions.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-4__dvs-2__sec-44__subsec-3">
              <num>3</num>
              <content>
                <p>	(3)	Paragraph (1)(a) does not apply to a member who is prevented by rules made for the purposes of <i>Public Governance, Performance and Accountability Act 2013</i> from deliberating on the proposed decision.<ref href="#sec-29">section 29</ref> of the </p>

              <num>4</num>
              <content>
                <p>For the purposes of a particular proposed decision, this section applies to an associate member as if the associate member were a member, if that proposed decision relates to a matter connected with an inquiry, investigation, hearing or other matter specified in the associate member’s instrument of appointment.</p>

            <heading>Record of decisions</heading>
            <content>
              <p>The ACMA must keep a record of decisions made in accordance with <ref href="#sec-44">section 44</ref>.</p>

          <heading>Divisions</heading>

            <heading>Divisions</heading>
            <subsection eId="part-4__dvs-3__sec-46__subsec-1">
              <num>1</num>
              <content>
                <p>The ACMA may establish 1 or more Divisions. If the ACMA establishes a Division, the ACMA must:</p>
              </content>
              <paragraph eId="part-4__dvs-3__sec-46__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>determine the kinds of matters the Division can deal with; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-3__sec-46__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>ensure such a determination is in force at all times while the Division continues to exist.</p>
                </content>

                    <p>Note:	A Division cannot perform any of the ACMA’s functions, or exercise any of the ACMA’s powers, other than those delegated to the Division under <ref href="#sec-50">section 50</ref>.</p>

                <p>The ACMA may:</p>
              </content>
              <paragraph eId="part-4__dvs-3__sec-46__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>dissolve a Division; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-3__sec-46__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>revoke, vary or substitute a determination under subsection (1).</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-4__dvs-3__sec-46__subsec-3">
              <num>3</num>
              <content>
                <p>A Division must consist of at least 3 members as chosen from time to time by the ACMA. If the Chair is not chosen, the Chair may elect at any time to be in the Division.</p>
              </content>
            </subsection>
            <subsection eId="part-4__dvs-3__sec-46__subsec-4">
              <num>4</num>
              <content>
                <p>A Division can also include 1 or more associate members as chosen from time to time by the ACMA if, for that associate member, or for each of those associate members, the kinds of matters the Division can deal with include a matter connected with an inquiry, investigation, hearing or other matter specified in the associate member’s instrument of appointment.</p>
              </content>
            </subsection>
            <subsection eId="part-4__dvs-3__sec-46__subsec-5">
              <num>5</num>
              <content>
                <p>A member or associate member can be in more than 1 Division.</p>
              </content>
            </subsection>
            <subsection eId="part-4__dvs-3__sec-46__subsec-6">
              <num>6</num>
              <content>
                <p>Subject to the Chair’s right of election under subsection (3), the ACMA may remove a member or associate member from a Division.</p>
              </content>
            </subsection>
            <subsection eId="part-4__dvs-3__sec-46__subsec-7">
              <num>7</num>
              <content>
                <p>A Division can decide a matter:</p>
              </content>
              <paragraph eId="part-4__dvs-3__sec-46__subsec-7__para-a">
                <num>a</num>
                <content>
                  <p>at a meeting of the Division (see <ref href="#sec-47">section 47</ref>); or</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-3__sec-46__subsec-7__para-b">
                <num>b</num>
                <content>
                  <p>in accordance with <ref href="#sec-48">section 48</ref>.</p>
                </content>
              </paragraph>
            </subsection>
          </section>
          <section eId="part-4__dvs-3__sec-47">
            <num>47</num>
            <heading>Meetings of a Division</heading>
            <subsection eId="part-4__dvs-3__sec-47__subsec-1">
              <num>1</num>
              <content>
                <p>Subject to subsection (2), the following provisions apply in relation to meetings of a Division:</p>
              </content>
              <paragraph eId="part-4__dvs-3__sec-47__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>	(a)	a member in the Division may call a meeting by giving notice of the meeting to the other members<i> </i>in the Division;</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-3__sec-47__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>a quorum at a meeting is a majority of the members for the time being in the Division;</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-3__sec-47__subsec-1__para-c">
                <num>c</num>
                <content>
                  <p>if:</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-3__sec-47__subsec-1__para-i">
                <num>i</num>
                <content>
                  <p>	(i)	rules made for the purposes of <i>Public Governance, Performance and Accountability Act 2013</i> prevent a member in the Division from participating in the deliberations, or decisions, of the Division with respect to a particular matter; and<ref href="#sec-29">section 29</ref> of the </p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-3__sec-47__subsec-1__para-ii">
                <num>ii</num>
                <content>
                  <p>when the member leaves the meeting concerned there is no longer a quorum present;</p>
                </content>
                <content>
                  <p>the remaining members at the meeting constitute a quorum for the purpose of any deliberation or decision at that meeting with respect to that matter;</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-3__sec-47__subsec-1__para-d">
                <num>d</num>
                <content>
                  <p>	(d)	the members<i> </i>present at a meeting must appoint 1 of themselves to preside at the meeting;</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-3__sec-47__subsec-1__para-e">
                <num>e</num>
                <content>
                  <p>a question at a meeting is decided by a majority of the following people in the Division present and voting:</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-3__sec-47__subsec-1__para-i">
                <num>i</num>
                <content>
                  <p>the members in the Division; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-3__sec-47__subsec-1__para-ii">
                <num>ii</num>
                <content>
                  <p>if the question relates to a matter connected with an inquiry, investigation, hearing or other matter specified in the instruments of appointment of 1 or more associate members in the Division—that associate member, or each of those associate members;</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-3__sec-47__subsec-1__para-f">
                <num>f</num>
                <content>
                  <p>the person presiding at a meeting has a deliberative vote and, if necessary, also a casting vote.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-4__dvs-3__sec-47__subsec-2">
              <num>2</num>
              <content>
                <p>Subject to subsection (3), a Division may determine its own rules relating to meetings, including (for example) rules about the following:</p>
              </content>
              <paragraph eId="part-4__dvs-3__sec-47__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>calling of meetings;</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-3__sec-47__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>notice of meetings;</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-3__sec-47__subsec-2__para-c">
                <num>c</num>
                <content>
                  <p>presiding at meetings;</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-3__sec-47__subsec-2__para-d">
                <num>d</num>
                <content>
                  <p>how decisions are made at meetings, including quorum requirements and voting entitlements and procedures.</p>
                </content>
                <content>
                  <p>The rules that the Division determines displace the rules that would otherwise apply under subsection (1), to the extent of any inconsistency.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-4__dvs-3__sec-47__subsec-3">
              <num>3</num>
              <content>
                <p>A Division cannot:</p>
              </content>
              <paragraph eId="part-4__dvs-3__sec-47__subsec-3__para-a">
                <num>a</num>
                <content>
                  <p>	(a)	determine rules that purport to exclude the operation of, or that are inconsistent with, rules made for the purposes of <i>Public Governance, Performance and Accountability Act 2013</i>, or any provision of this Act (other than subsection (1) of this section); or<ref href="#sec-29">section 29</ref> of the </p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-3__sec-47__subsec-3__para-b">
                <num>b</num>
                <content>
                  <p>determine rules under which an associate member would be allowed to vote on a question that does not relate to a matter connected with an inquiry, investigation, hearing or other matter specified in the instrument of appointment of the associate member.</p>

              <p>A Division must:</p>

                <p>keep minutes of its meetings; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__dvs-3__sec-49__para-b">
              <num>b</num>
              <content>
                <p>keep a record of decisions made in accordance with <ref href="#sec-48">section 48</ref>.</p>
              </content>
            </paragraph>

        </division>

          <heading>Delegations</heading>
          <section eId="part-4__dvs-4__sec-50">
            <num>50</num>
            <heading>Delegations by ACMA to a Division</heading>
            <subsection eId="part-4__dvs-4__sec-50__subsec-1">
              <num>1</num>
              <content>
                <p>The ACMA may, by writing, delegate to a Division any or all of the ACMA’s functions and powers so far as they relate to the kinds of matters the Division can deal with.</p>
              </content>
            </subsection>
            <subsection eId="part-4__dvs-4__sec-50__subsec-2">
              <num>2</num>
              <content>
                <p>A certificate:</p>
              </content>
              <paragraph eId="part-4__dvs-4__sec-50__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>stating any matter with respect to the performance of a delegated function or exercise of a delegated power; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-4__sec-50__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>signed by:</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-4__sec-50__subsec-2__para-i">
                <num>i</num>
                <content>
                  <p>a member in the Division; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-4__sec-50__subsec-2__para-ii">
                <num>ii</num>
                <content>
                  <p>an associate member who participated, or could have participated, in the making of the Division’s decision to perform the delegated function or exercise the delegated power;</p>
                </content>
                <content>
                  <p>is prima facie evidence of the matter.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-4__dvs-4__sec-50__subsec-3">
              <num>3</num>
              <content>
                <p>A document purporting to be a certificate mentioned in subsection (2) is taken to be such a certificate and to have been duly given unless the contrary is established.</p>
              </content>
            </subsection>

          <section eId="part-4__dvs-4__sec-51">

            <heading>Delegations by ACMA to others</heading>
            <subsection eId="part-4__dvs-4__sec-51__subsec-1">
              <num>1</num>
              <content>
                <p>Subject to subsection (2) and <ref href="#sec-53">section 53</ref>, the ACMA may, by writing, delegate any or all of its functions and powers to:</p>
              </content>
              <paragraph eId="part-4__dvs-4__sec-51__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>a member; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-4__sec-51__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>an associate member, if the delegated function or power relates to a matter connected with an inquiry, investigation, hearing or other matter specified in the associate member’s instrument of appointment; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-4__sec-51__subsec-1__para-c">
                <num>c</num>
                <content>
                  <p>a member of the ACMA staff; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-4__sec-51__subsec-1__para-d">
                <num>d</num>

                  <p>a person whose services are made available to the ACMA under subsection 55(1).</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-4__dvs-4__sec-51__subsec-2">
              <num>2</num>
              <content>
                <p>The ACMA may only delegate a power to make, vary or revoke an instrument that is a legislative instrument to a person under this section if:</p>
              </content>
              <paragraph eId="part-4__dvs-4__sec-51__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>the delegation is only for the purposes of one or both of the following:</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-4__sec-51__subsec-2__para-i">
                <num>i</num>
                <content>
                  <p>giving effect to a policy or a decision of the ACMA;</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-4__sec-51__subsec-2__para-ii">
                <num>ii</num>
                <content>
                  <p>	(ii)	making changes of the kinds referred to in each paragraph of subsection 15X(2) of the <i>Legislation Act 2003 </i>(about editorial changes) to instruments made under that power; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-4__sec-51__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>if the delegation is for the purposes of giving effect to a policy or a decision of the ACMA—having regard to what would be required, necessary or convenient to give effect to the policy or decision, the ACMA is satisfied that it is appropriate for a delegate to exercise the power; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-4__sec-51__subsec-2__para-c">
                <num>c</num>
                <content>
                  <p>the person is:</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-4__sec-51__subsec-2__para-i">

                  <p>a member; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-4__sec-51__subsec-2__para-ii">

                  <p>a person holding, or performing the duties of, an office or position that is at a level equivalent to that of an SES employee.</p>

                <p>Subject to subsection (1A) and <ref href="#sec-53">section 53</ref>, a Division may delegate all or any of the functions and powers delegated to it under <ref href="#sec-50">section 50</ref> to:</p>
              </content>
              <paragraph eId="part-4__dvs-4__sec-52__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>a member; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-4__sec-52__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>an associate member, if the delegated function or power relates to a matter connected with an inquiry, investigation, hearing or other matter specified in the associate member’s instrument of appointment; or</p>
                </content>
              </paragraph>

                <num>c</num>
                <content>
                  <p>a member of the ACMA staff; or</p>
                </content>
              </paragraph>

                <p>The delegation continues in force despite a change in the membership of the Division.</p>
              </content>
            </subsection>
            <subsection eId="part-4__dvs-4__sec-52__subsec-3">
              <num>3</num>
              <content>
                <p>The delegation may be varied or revoked by the Division (whether or not there has been a change in the membership of the Division).</p>
              </content>
            </subsection>
            <subsection eId="part-4__dvs-4__sec-52__subsec-4">

              <p>	(1)	A corporate plan prepared by the Chair under <i>Public Governance, Performance and Accountability Act 2013</i> must include details of such other matters (if any) as the Minister requires.<ref href="#sec-35">section 35</ref> of the </p>

              <p>The Forum’s function is to assist the ACMA to perform the ACMA’s functions in relation to matters affecting consumers.</p>

              <p>	(1)	An ACMA official may disclose authorised disclosure information to a Royal Commission (within the meaning of the <i>Royal Commissions Act 1902</i>).</p>

              <p>The Chair may, by writing, impose conditions to be complied with in relation to authorised disclosure information disclosed under subsection (1).</p>

              <p>An instrument made under subsection (2) that imposes conditions relating to one particular disclosure identified in the instrument is not a legislative instrument.</p>

              <p>An ACMA official authorised by the Chair, in writing, for the purposes of this section may disclose authorised disclosure information to any of the following authorities if the Chair is satisfied that the information will enable or assist <role refersTo="#authority">the authority</role> to perform or exercise any of its functions or powers:</p>

                <p>an authority of a foreign country responsible for regulating matters relating to the provision of gambling services;</p>

                <p>	(q)	a non-corporate Commonwealth entity (within the meaning of the <i>Public Governance, Performance and Accountability Act 2013</i>) not otherwise covered by this subsection that is responsible for enforcing one or more laws of the Commonwealth.</p>

          </subsection>
          <subsection eId="part-7A__sec-59D__subsec-1A">
            <num>1A</num>
            <content>
              <p>Subsection (1) does not authorise the disclosure of information to an authority mentioned in paragraph (1)(ga) or (p) unless the information relates to:</p>
            </content>
            <paragraph eId="part-7A__sec-59D__subsec-1A__para-a">
              <num>a</num>
              <content>
                <p>a prohibited interactive gambling service; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-7A__sec-59D__subsec-1A__para-b">
              <num>b</num>
              <content>
                <p>a regulated interactive gambling service.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-7A__sec-59D__subsec-2">
            <num>2</num>
            <content>
              <p>The Chair may, by writing, impose conditions to be complied with in relation to authorised disclosure information disclosed under subsection (1).</p>
            </content>
          </subsection>
          <subsection eId="part-7A__sec-59D__subsec-3">
            <num>3</num>
            <content>
              <p>An instrument made under subsection (2) that imposes conditions relating to one particular disclosure identified in the instrument is not a legislative instrument.</p>
            </content>
          </subsection>
          <subsection eId="part-7A__sec-59D__subsec-4">
            <num>4</num>
            <content>
              <p>Otherwise, an instrument made under subsection (2) is a legislative instrument.</p>
            </content>
          </subsection>
        </section>

          <heading>Disclosure of information that relates to the affairs of a carrier or carriage service provider</heading>
          <subsection eId="part-7A__sec-59DA__subsec-1">
            <num>1</num>
            <content>
              <p>An ACMA official authorised by the Chair, in writing, for the purposes of this section may disclose authorised disclosure information if:</p>
            </content>
            <paragraph eId="part-7A__sec-59DA__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>the authorised disclosure information relates to the affairs of a carrier or carriage service provider; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-7A__sec-59DA__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>the authorised disclosure information relates to any of the following matters:</p>
              </content>
            </paragraph>
            <paragraph eId="part-7A__sec-59DA__subsec-1__para-i">
              <num>i</num>
              <content>
                <p>customer complaints;</p>
              </content>
            </paragraph>
            <paragraph eId="part-7A__sec-59DA__subsec-1__para-ii">

                <p>customers experiencing financial hardship;</p>

              <p>An ACMA official authorised by the Chair, in writing, for the purposes of this section may disclose summaries of authorised disclosure information if:</p>

                <p>the authorised disclosure information relates to the affairs of a carrier or carriage service provider; and</p>
              </content>

              <num>a</num>
              <content>
                <p>the authorised disclosure information relates to the affairs of a carrier or carriage service provider; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-7A__sec-59DA__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>the statistics relate to any of the following matters:</p>
              </content>
            </paragraph>
            <paragraph eId="part-7A__sec-59DA__subsec-3__para-i">
              <num>i</num>
              <content>
                <p>customer complaints;</p>
              </content>
            </paragraph>
            <paragraph eId="part-7A__sec-59DA__subsec-3__para-ii">

              <p><role refersTo="#minister">The Minister</role> may, by legislative instrument, determine one or more matters for the purposes of subparagraphs (1)(b)(x), (2)(b)(x) and (3)(b)(x).</p>

              <p>Subsection (5) does not, by implication, limit what can be disclosed under a provision of this Part other than this section.</p>

              <p>Subsections (1), (2) and (3) do not authorise the disclosure of anything that is likely to enable the identification of an end-user of a carriage service.</p>

          <heading>Disclosure of information that relates to the Scams Prevention Framework</heading>
          <content>
            <p>An ACMA official authorised by the Chair, in writing, for the purposes of this section may disclose authorised disclosure information if the disclosure:</p>

            <num>a</num>
            <content>
              <p>is to:</p>
            </content>
          </paragraph>
          <paragraph eId="part-7A__sec-59DB__para-i">

              <p>	(i)	an SPF regulator (within the meaning of the <i>Competition and Consumer Act 2010</i>); or</p>
            </content>
          </paragraph>

              <p>the operator of an SPF EDR scheme (within the meaning of that Act); and</p>

              <p>is for the purposes of the operation (including enforcement) of the SPF provisions (within the meaning of that Act).</p>

          <heading>Disclosure with consent</heading>

              <p>An ACMA official may disclose authorised disclosure information that relates to the affairs of a person if:</p>

                <p>the person has consented to the disclosure; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-7A__sec-59E__subsec-1__para-b">

                <p>the disclosure is in accordance with that consent.</p>

              <p>For the purposes of this section, an ACMA official is taken to disclose information if the information is published by the ACMA:</p>

              </content>

              <num>a</num>

                <p>summaries of authorised disclosure information that are not likely to enable the identification of a person; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-7A__sec-59G__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>statistics derived from authorised disclosure information that are not likely to enable the identification of a person.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-7A__sec-59G__subsec-2">

              <p>For the purposes of this section, an ACMA official is taken to disclose summaries or statistics if the summaries or statistics are published by the ACMA:</p>

                <p>provide that the Chair may, by writing, impose conditions to be complied with in relation to the disclosure of authorised disclosure information in those circumstances.</p>

              <p>The Chair may, by writing, delegate to a member any or all of the Chair’s functions and powers under:</p>

        <heading>Other matters</heading>
        <section eId="part-8__sec-60">
          <num>60</num>
          <heading>Charges relating to ACMA’s expenses</heading>
          <subsection eId="part-8__sec-60__subsec-1">
            <num>1</num>
            <content>
              <p>The ACMA may, by written instrument, make determinations fixing charges for:</p>
            </content>
            <paragraph eId="part-8__sec-60__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>services provided by the ACMA; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-8__sec-60__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>any matter in relation to which expenses are incurred by the ACMA under:</p>
              </content>
            </paragraph>
            <paragraph eId="part-8__sec-60__subsec-1__para-i">
              <num>i</num>
              <content>
                <p>this Act; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-8__sec-60__subsec-1__para-ii">
              <num>ii</num>
              <content>
                <p>	(ii)	the <i>Telecommunications Act 1997</i>; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-8__sec-60__subsec-1__para-iii">
              <num>iii</num>
              <content>
                <p>	(iii)	the <i>Telecommunications (Consumer Protection and Service Standards) Act 1999</i>; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-8__sec-60__subsec-1__para-iv">
              <num>iv</num>

                <p>	(iv)	the <i>Radiocommunications Act 1992</i>; or</p>

              <p>A charge fixed under subsection (1) must not be such as to amount to taxation.</p>
            </content>
          </subsection>
          <subsection eId="part-8__sec-60__subsec-3">
            <num>3</num>
            <content>
              <p>For the purposes of recovering all or part of the ACMA’s expenses relating to the performance of its functions under paragraph 11(1)(a) or (b), the ACMA may charge a person an amount that has been:</p>
            </content>
            <paragraph eId="part-8__sec-60__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>agreed with the person; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-8__sec-60__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>worked out under an agreement with the person.</p>
              </content>

        </section>

          <heading>Charges are payable to the Commonwealth</heading>
          <content>
            <p>If <ref href="#sec-60">section 60</ref>, or a provision of another Act, authorises the ACMA to fix a charge (however described), that charge is payable to the Commonwealth.</p>

        </section>
        <section eId="part-8__sec-62">
          <num>62</num>
          <heading>ACMA’s expenses include related Commonwealth expenses</heading>
          <content>
            <p>A reference in <ref href="#sec-60">section 60</ref>, or a provision of another Act, to an expense (however described) incurred by the ACMA in relation to a thing, includes a reference to an expense incurred by the Commonwealth in relation to the thing.</p>
          </content>
        </section>
        <section eId="part-8__sec-62A">
          <num>62A</num>
          <heading>Proceedings in the name of the ACMA</heading>
          <subsection eId="part-8__sec-62A__subsec-1">
            <num>1</num>
            <content>
              <p>Proceedings brought by the Commonwealth in relation to the functions or powers of the ACMA may be brought in the name of the ACMA.</p>
            </content>

              <p>Proceedings brought against the Commonwealth in relation to the functions or powers of the ACMA may be brought against the Commonwealth in the name of the ACMA.</p>

          </subsection>
        </section>
        <section eId="part-8__sec-62B">
          <num>62B</num>
          <heading>Decisions relating to the Commonwealth etc.</heading>
          <subsection eId="part-8__sec-62B__subsec-1">
            <num>1</num>
            <content>
              <p>The fact that the ACMA does not have a legal identity separate from the Commonwealth does not affect the performance of the ACMA’s functions in making, or the exercise of the ACMA’s powers to make, decisions relating to:</p>
            </content>
            <paragraph eId="part-8__sec-62B__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>the Commonwealth; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-8__sec-62B__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>any authority of the Commonwealth that is not a body corporate.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-8__sec-62B__subsec-2">
            <num>2</num>
            <content>
              <p>This section does not apply to decisions relating to bringing proceedings against the Commonwealth or such an authority.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-8__sec-63">
          <num>63</num>
          <heading>Chair not subject to direction by ACMA on certain matters</heading>
          <content>
            <p>		The Chair is not subject to direction by the ACMA in relation to the Chair’s performance of functions, or exercise of powers, under the <i>Public Governance, Performance and Accountability Act 2013</i> or the <i>Public Service Act 1999</i>.</p>
          </content>
        </section>
        <section eId="part-8__sec-64">
          <num>64</num>
          <heading>Definitions determination</heading>
          <subsection eId="part-8__sec-64__subsec-1">
            <num>1</num>
            <content>
              <p>The ACMA may make a written determination defining 1 or more expressions used in specified instruments, being instruments that are made by the ACMA under 1 or more specified laws of the Commonwealth.</p>
            </content>
          </subsection>
          <subsection eId="part-8__sec-64__subsec-2">
            <num>2</num>
            <content>
              <p>If <role refersTo="#minister">the Minister</role> is authorised to make an instrument under a law specified in a determination under subsection (1), the instrument may make provision for or in relation to a matter by applying, adopting or incorporating, with or without modification, the provisions of a determination under subsection (1) as in force from time to time.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-8__sec-65">
          <num>65</num>
          <heading>Determinations may define expressions by reference to other instruments</heading>
          <subsection eId="part-8__sec-65__subsec-1">
            <num>1</num>
            <content>
              <p>Without limiting the powers of the ACMA to make determinations under subsection 64(1), a determination under that subsection may define an expression used in a specified instrument by applying, adopting or incorporating (with or without modifications) matter contained in any other instrument or writing whatever:</p>
            </content>
            <paragraph eId="part-8__sec-65__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>as in force or existing at a particular time; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-8__sec-65__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>as in force or existing from time to time;</p>
              </content>
              <content>
                <p>even if the other instrument or writing does not yet exist when the determination is made.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-8__sec-65__subsec-2">
            <num>2</num>
            <content>
              <p>A reference in subsection (1) to any other instrument or writing includes a reference to an instrument or writing:</p>
            </content>
            <paragraph eId="part-8__sec-65__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>made by any person or body in Australia or elsewhere (including, for example, the Commonwealth, a State or Territory, an officer or authority of the Commonwealth or of a State or Territory or an overseas entity); and</p>
              </content>
            </paragraph>
            <paragraph eId="part-8__sec-65__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>whether of a legislative, administrative or other official nature or of any other nature; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-8__sec-65__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>whether or not having any legal force or effect;</p>
              </content>
              <content>
                <p>for example:</p>
              </content>
            </paragraph>
            <paragraph eId="part-8__sec-65__subsec-2__para-d">
              <num>d</num>
              <content>
                <p>regulations or rules under an Act; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-8__sec-65__subsec-2__para-e">
              <num>e</num>
              <content>
                <p>a State Act, a law of a Territory, or regulations or any other instrument made under such an Act or law; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-8__sec-65__subsec-2__para-f">
              <num>f</num>
              <content>
                <p>an international technical standard or performance indicator; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-8__sec-65__subsec-2__para-g">
              <num>g</num>
              <content>
                <p>a written agreement or arrangement or an instrument or writing made unilaterally.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-8__sec-65__subsec-3">
            <num>3</num>
            <content>
              <p>Nothing in this section limits the generality of anything else in it.</p>
            </content>
          </subsection>
          <subsection eId="part-8__sec-65__subsec-4">
            <num>4</num>
            <content>
              <p>	(4)	Subsection (1) has effect despite anything in the <i>Acts Interpretation Act 1901</i>.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-8__sec-66">
          <num>66</num>
          <heading>Person not to use protected name or protected symbol</heading>
          <subsection eId="part-8__sec-66__subsec-1">
            <num>1</num>
            <content>
              <p>A person commits an offence if the person:</p>
            </content>
            <paragraph eId="part-8__sec-66__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>uses in relation to a business, trade, profession or occupation; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-8__sec-66__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>uses as the name, or as part of the name, of any firm, body corporate, institution, premises, vehicle, ship or craft (including aircraft); or</p>
              </content>
            </paragraph>
            <paragraph eId="part-8__sec-66__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>applies, as a trade mark or otherwise, to goods imported, manufactured, produced, sold, offered for sale or let on hire; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-8__sec-66__subsec-1__para-d">
              <num>d</num>
              <content>
                <p>uses in relation to:</p>
              </content>
            </paragraph>
            <paragraph eId="part-8__sec-66__subsec-1__para-i">
              <num>i</num>
              <content>
                <p>goods or services; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-8__sec-66__subsec-1__para-ii">
              <num>ii</num>
              <content>
                <p>the promotion, by any means, of the supply or use of goods or services;</p>
              </content>
              <content>
                <p>either:</p>
              </content>
            </paragraph>
            <paragraph eId="part-8__sec-66__subsec-1__para-e">
              <num>e</num>
              <content>
                <p>a protected name, or a name so closely resembling a protected name as to be likely to be mistaken for it; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-8__sec-66__subsec-1__para-f">
              <num>f</num>
              <content>
                <p>a protected symbol, or a symbol so closely resembling a protected symbol as to be likely to be mistaken for it.</p>
              </content>
              <hcontainer name="penalty">
                <content>
                  <p>Penalty:	<quantity refersTo="#penaltyUnit">30 penalty units</quantity>.</p>
                </content>
              </hcontainer>
            </paragraph>
          </subsection>
          <subsection eId="part-8__sec-66__subsec-2">
            <num>2</num>
            <content>
              <p>Subsection (1) does not apply if the ACMA consents in writing to the use or application of the name or symbol.</p>
            </content>

              <p>Nothing in subsection (1), so far as it applies in relation to a protected name or in relation to a protected symbol, affects rights conferred by law on a person in relation to:</p>
            </content>
            <paragraph eId="part-8__sec-66__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>	(a)	a trade mark that is registered under the <i>Trade Marks Act 1995</i>; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-8__sec-66__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>	(b)	a design that is registered under the <i>Designs Act 2003</i>;</p>
              </content>
              <content>
                <p>and was registered under the <i>Trade Marks Act 1995</i> or the <i>Designs Act 1906</i> immediately before 11 May 2004 in relation to the name or symbol.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-8__sec-66__subsec-4">
            <num>4</num>
            <content>
              <p>Nothing in this section, so far as it applies to a protected name or in relation to a protected symbol, affects the use, or rights conferred by law relating to the use, of the name or symbol by a person in a particular manner if, immediately before <date date="2004-05-11">11 May 2004</date>, the person:</p>
            </content>
            <paragraph eId="part-8__sec-66__subsec-4__para-a">
              <num>a</num>
              <content>
                <p>was using the name or the symbol in good faith in that manner; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-8__sec-66__subsec-4__para-b">
              <num>b</num>
              <content>
                <p>would have been entitled to prevent another person from passing off, by means of the use of the name or the symbol or a similar name or symbol, goods or services as the goods or services of the first-mentioned person.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-8__sec-66__subsec-5">
            <num>5</num>
            <content>
              <p>	(5)	Subsection (1) does not apply to a person who uses or applies a protected name or a protected symbol for the purpose of labelling customer equipment or customer cabling in accordance with <i>Telecommunications Act 1997</i> or equipment rules made under the <i>Radiocommunications Act 1992</i>.<ref href="#sec-407">section 407</ref> of the </p>
            </content>
          </subsection>
          <subsection eId="part-8__sec-66__subsec-6">
            <num>6</num>
            <content>
              <p>	(6)	The prosecution bears the evidential burden, and the legal burden, in relation to the matters in subsections (3), (4) and (5) (despite subsection 13.3(3) of the <i>Criminal Code</i>).</p>
            </content>
          </subsection>
          <subsection eId="part-8__sec-66__subsec-7">
            <num>7</num>
            <content>
              <p>In this section:</p>
            </content>
            <content>
              <p><b><i>customer cabling </i></b>has the same meaning as in the <i>Telecommunications Act 1997</i>.</p>
              <p><b><i>customer equipment</i></b> has the same meaning as in the <i>Telecommunications Act 1997</i>.</p>
              <p><b><i>protected name</i></b> means:</p>
            </content>
            <paragraph eId="part-8__sec-66__subsec-7__para-a">
              <num>a</num>
              <content>
                <p>“ACMA”; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-8__sec-66__subsec-7__para-b">
              <num>b</num>
              <content>
                <p>“Australian Communications and Media Authority”.</p>
              </content>
              <content>
                <p><b><i>protected symbol</i></b> means an official symbol of the ACMA, the design of which is prescribed in the regulations.</p>
              </content>
            </paragraph>
          </subsection>
        </section>
        <section eId="part-8__sec-67">
          <num>67</num>
          <heading>ACMA to maintain Register of policy notifications and Ministerial directions</heading>
          <subsection eId="part-8__sec-67__subsec-1">
            <num>1</num>
            <content>
              <p>The ACMA is to maintain a Register in which the ACMA includes:</p>
            </content>
            <paragraph eId="part-8__sec-67__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>all directions given to the ACMA under this Act or any other Act; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-8__sec-67__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>	(b)	the contents, immediately before the commencement of <i>Australian Communications Authority Act 1997</i>.<ref href="#sec-6">section 6</ref> of this Act, of the register maintained under <ref href="#sec-56">section 56</ref> of the </p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-8__sec-67__subsec-2">
            <num>2</num>
            <content>
              <p>The Register may be maintained by electronic means.</p>
            </content>
          </subsection>
          <subsection eId="part-8__sec-67__subsec-3">
            <num>3</num>
            <content>
              <p>A person may, on payment of the charge (if any) fixed by a determination under <ref href="#sec-60">section 60</ref>:</p>
            </content>
            <paragraph eId="part-8__sec-67__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>inspect the Register; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-8__sec-67__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>make a copy of, or take extracts from, the Register.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-8__sec-67__subsec-4">
            <num>4</num>
            <content>
              <p>For the purposes of this section, if the Register is maintained by electronic means, a person is taken to have made a copy of, or taken an extract from, the Register if the ACMA gives the person a printout of, or of the relevant parts of, the Register.</p>
            </content>
          </subsection>
          <subsection eId="part-8__sec-67__subsec-5">
            <num>5</num>
            <content>
              <p>If a person requests that a copy be provided in an electronic form, the ACMA may provide the relevant information:</p>
            </content>
            <paragraph eId="part-8__sec-67__subsec-5__para-a">
              <num>a</num>
              <content>
                <p>on a data processing device; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-8__sec-67__subsec-5__para-b">
              <num>b</num>
              <content>
                <p>by way of electronic transmission.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-8__sec-67__subsec-6">
            <num>6</num>
            <content>
              <p>In this section:</p>
            </content>
            <content>
              <p><b><i>data processing device</i></b> means any article or material (for example, a disk) from which information is capable of being reproduced, with or without the aid of any other article or device.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-8__sec-67A">
          <num>67A</num>
          <heading>Liability for damages—public warning notices</heading>
          <content>
            <p>None of the following:</p>
          </content>
          <paragraph eId="part-8__sec-67A__para-a">
            <num>a</num>
            <content>
              <p>the Commonwealth;</p>
            </content>
          </paragraph>
          <paragraph eId="part-8__sec-67A__para-b">
            <num>b</num>
            <content>
              <p>the ACMA;</p>
            </content>
          </paragraph>
          <paragraph eId="part-8__sec-67A__para-c">
            <num>c</num>
            <content>
              <p>an ACMA official;</p>
            </content>
            <content>
              <p>is liable to an action or other proceeding for damages for, or in relation to, an act or matter done in good faith in the exercise, or purported exercise, of the ACMA’s power under <i>Radiocommunications Act 1992</i>.<ref href="#sec-284N">section 284N</ref> of the </p>
            </content>

          <heading>Regulations</heading>
          <content>
            <p>The Governor-General may make regulations prescribing matters:</p>
          </content>
          <paragraph eId="part-8__sec-68__para-a">
            <num>a</num>
            <content>
              <p>required or permitted by this Act to be prescribed; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-8__sec-68__para-b">
            <num>b</num>

              <p>necessary or convenient to be prescribed for carrying out or giving effect to this Act.</p>

              <p>The legislation history in endnote 3 provides information about each law that has amended (or will amend) the compiled law. The information includes commencement details for amending laws and details of any application, saving or transitional provisions that are not included in this compilation.</p>
              <p>The amendment history in endnote 4 provides information about amendments at the provision (generally section or equivalent) level. It also includes information about any provision of the compiled law that has been repealed in accordance with a provision of the law.</p>

                <b>Editorial changes</b>
              </p>
              <p>The <i>Legislation Act 2003</i> authorises First Parliamentary Counsel to make editorial and presentational changes to a compiled law in preparing a compilation of the law for registration. The changes must not change the effect of the law. Editorial changes take effect from the compilation registration date.</p>
              <p>If the compilation includes editorial changes, the endnotes include a brief outline of the changes in general terms. Full details of any changes can be obtained from the Office of Parliamentary Counsel.</p>
              <p>
                <b>Misdescribed amendments</b>
              </p>
              <p>A misdescribed amendment is an amendment that does not accurately describe how an amendment is to be made. If, despite the misdescription, the amendment can be given effect as intended, then the misdescribed amendment can be incorporated through an editorial change made under <i>Legislation Act 2003</i>.<ref href="#sec-15V">section 15V</ref> of the </p>
              <p>If a misdescribed amendment cannot be given effect as intended, the amendment is not incorporated and “(md not incorp)” is added to the amendment history.</p>
