            <p>		This Act may be cited as the <i>Protection of the Sea (Harmful Anti</i><i>-</i><i>fouling Systems) Act 2006</i>.</p>
          </content>

          <heading>Commencement</heading>
          <subsection eId="part-1__sec-2__subsec-1">
            <num>1</num>

              <p>Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.</p>

A Proclamation must not specify a day that occurs before the day on which the Convention enters into force for Australia.

If the provision(s) commence in this way, the Minister must announce by notice in the Gazette the day on which the provision(s) commenced.

          <heading>Definitions</heading>
          <content>
            <p>In this Act:</p>
            <p><term refersTo="#term-anti-fouling-certificate">anti-fouling certificate</term> means <def>a certificate issued under <ref href="#sec-10">section 10</ref>.</def></p>
            <p><term refersTo="#term-australia">Australia</term> includes <def>the external Territories.</def></p>
            <p><term refersTo="#term-australian-law">Australian law</term> means <def>a law of the Commonwealth or of a State or Territory.</def></p>
            <p><b><i>Australian ship</i></b> means:</p>
          </content>

            <num>a</num>
            <content>
              <p>	(a)	a ship registered, or required to be registered, under the <i>Shipping Registration Act 1981</i>; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-b">
            <num>b</num>
            <content>
              <p>	(b)	an unregistered ship that has Australian nationality under the <i>Shipping Registration Act 1981</i>.</p>
            </content>
            <content>
              <p><term refersTo="#term-australian-shipping-facility">Australian shipping facility</term> means <def>a shipping facility in Australia or in Australia’s exclusive economic zone.</def></p>
              <p><term refersTo="#term-authority">Authority</term> means <def><ref class="unresolved">the Australian Maritime Safety Authority established by the Australian Maritime Safety Authority Act 1990</ref>.</def></p>
              <p><term refersTo="#term-complies-with-the-anti-fouling-requirements">complies with the anti-fouling requirements</term> has the meaning given by <def><ref href="#sec-4">section 4</ref>.</def></p>
              <p><b><i>conduct</i></b>, in relation to an offence, has the same meaning as in the <i>Criminal Code</i>.</p>
              <p><term refersTo="#term-convention">Convention</term> means <def>the International Convention on the Control of Harmful Anti-fouling Systems on Ships, done at London on 5 October 2001.</def></p>
              <p><term refersTo="#term-designated-external-surface">designated external surface</term> means <def>any part of the hull or external parts or surfaces. For this purpose, hull or external parts or surfaces has the same meaning as in the Convention.</def></p>
              <p><term refersTo="#term-engage-in-conduct">engage in conduct</term> has the same meaning as <def>in the Criminal Code.</def></p>
              <p><term refersTo="#term-exempt-platform">exempt platform</term> means <def>any of the following (within the meaning of the Convention): a fixed or floating platform; a floating storage unit; a floating production, storage and off-loading unit.</def></p>

              <p>a fixed or floating platform;</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-b">

            <content>
              <p>a floating storage unit;</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-c">
            <num>c</num>
            <content>
              <p>a floating production, storage and off-loading unit.</p>
            </content>
            <content>
              <p><term refersTo="#term-foreign-convention-law">foreign Convention law</term> means <def>a law of a foreign country that gives effect (wholly or partly) to the Convention.</def></p>
              <p><term refersTo="#term-foreign-ship">foreign ship</term> means <def>a ship that is not an Australian ship.</def></p>
              <p><term refersTo="#term-gross-tonnage">gross tonnage</term> has the same meaning as <def>in the Convention.</def></p>
              <p><term refersTo="#term-hafc-short-for-harmful-anti-fouling-compound">HAFC (short for harmful anti-fouling compound)</term> means <def>an organotin compound that acts as a biocide in an anti-fouling system, or cybutryne. For this purpose, organotin compound, biocide and anti-fouling system have the same meaning as in the Convention.</def></p>
              <p><term refersTo="#term-inspector">inspector</term> has the meaning given by <def><ref href="#sec-16">section 16</ref>.</def></p>
              <p><term refersTo="#term-international-voyage">international voyage</term> has the same meaning as <def>in the Convention.</def></p>
              <p><term refersTo="#term-length">length</term> has the same meaning as <def>in the Convention.</def></p>
              <p><term refersTo="#term-marine-order">Marine Order</term> has the meaning given by <def><ref href="#sec-24">section 24</ref>.</def></p>
              <p><term refersTo="#term-master">master</term> means <def>the person having command or charge of the ship, but does not include a person exercising powers under an Australian law.</def></p>
              <p><b><i>offence against this Act</i></b> includes:</p>

            <content>
              <p>an offence against the regulations; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-b">
            <num>b</num>
            <content>
              <p>	(b)	an offence against Chapter 7 of the <i>Criminal Code</i> that relates to this Act or the regulations.</p>
            </content>
            <content>
              <p><term refersTo="#term-owner">owner</term> includes <def>the operator.</def></p>
              <p><term refersTo="#term-pre-2003-exempt-platform">pre-2003 exempt platform</term> means <def>an exempt platform that was constructed before 1 January 2003 and has not been in dry dock on or after that date.</def></p>
              <p><term refersTo="#term-pre-2023-exempt-platform">pre-2023 exempt platform</term> means <def>an exempt platform that was constructed before 1 January 2023 and has not been in dry dock on or after that date.</def></p>
              <p><term refersTo="#term-prescribed">prescribed</term> means <def>prescribed by the regulations.</def></p>
              <p><term refersTo="#term-regulations">regulations</term> includes <def>Marine Orders.</def></p>
              <p><term refersTo="#term-ship">ship</term> has the same meaning as <def>in Article 2 of the Convention, but does not include a ship that is being used for non-commercial purposes by: the Commonwealth, a State or a Territory; or the government of a foreign country.</def></p>

            <num>a</num>
            <content>
              <p>the Commonwealth, a State or a Territory; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-b">
            <num>b</num>
            <content>
              <p>the government of a foreign country.</p>
            </content>
            <content>
              <p><b><i>shipping facility</i></b> means:</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-a">
            <num>a</num>
            <content>
              <p>a port; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-b">
            <num>b</num>
            <content>
              <p>a shipyard; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-c">
            <num>c</num>
            <content>
              <p>an offshore terminal;</p>
            </content>
            <content>
              <p>within the meaning of the Convention.</p>
              <p><b><i>survey authority</i></b> means:</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-a">
            <num>a</num>
            <content>
              <p><role refersTo="#authority">the Authority</role>; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-b">
            <num>b</num>
            <content>
              <p>a body corporate approved by <role refersTo="#authority">the Authority</role> under section 5.</p>
            </content>
          </paragraph>
        </section>
        <section eId="part-1__sec-4">
          <num>4</num>
          <heading>Definition: compliance with anti-fouling requirements</heading>
          <content>
            <p>		A ship <b><i>complies with the anti</i></b><b><i>-</i></b><b><i>fouling requirements</i></b> if, and only if:</p>
          </content>
          <paragraph eId="part-1__sec-4__para-a">
            <num>a</num>
            <content>
              <p>it has no HAFC applied on any designated external surface; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-b">
            <num>b</num>
            <content>
              <p>each HAFC that is applied on any designated external surface has a coating that forms a barrier to the HAFC leaching into the water; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-c">
            <num>c</num>
            <content>
              <p>for a ship that has cybutryne applied on a designated external surface—neither of the following has occurred:</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-i">
            <num>i</num>
            <content>
              <p>the first scheduled renewal of the ship’s anti-fouling system after <date date="2023-01-01">1 January 2023</date>;</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-ii">
            <num>ii</num>
            <content>
              <p>the day that is 60 months after the last application of cybutryne to the ship before <date date="2023-01-01">1 January 2023</date>.</p>
            </content>
          </paragraph>
        </section>
        <section eId="part-1__sec-5">
          <num>5</num>
          <heading>Approving a body corporate approved as a survey authority</heading>
          <subsection eId="part-1__sec-5__subsec-1">
            <num>1</num>
            <content>
              <p><role refersTo="#authority">The Authority</role> may, in writing, approve a body corporate as a survey authority.</p>
            </content>
          </subsection>
          <subsection eId="part-1__sec-5__subsec-2">
            <num>2</num>
            <content>
              <p>An approval made under subsection (1) is not a legislative instrument.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-1__sec-6">
          <num>6</num>
          <heading>Scope of Act</heading>
          <subsection eId="part-1__sec-6__subsec-1">
            <num>1</num>
            <content>
              <p>This Act applies to every external Territory.</p>
            </content>
          </subsection>
          <subsection eId="part-1__sec-6__subsec-2">
            <num>2</num>
            <content>
              <p>This Act extends to acts, omissions, matters and things outside Australia (unless the contrary intention appears).</p>
            </content>
          </subsection>
        </section>
        <section eId="part-1__sec-7">
          <num>7</num>
          <heading>Act to bind Crown</heading>
          <subsection eId="part-1__sec-7__subsec-1">
            <num>1</num>
            <content>
              <p>This Act binds the Crown in each of its capacities.</p>
            </content>
          </subsection>
          <subsection eId="part-1__sec-7__subsec-2">
            <num>2</num>
            <content>
              <p>This Act does not make the Crown liable to be prosecuted for an offence.</p>
            </content>
          </subsection>
          <subsection eId="part-1__sec-7__subsec-3">
            <num>3</num>
            <content>
              <p>Subsection (2) does not affect any liability of any employee or agent of the Commonwealth or of a State or Territory to be prosecuted for an offence.</p>
            </content>
          </subsection>

          <heading>HAFC not to be applied to a ship</heading>
          <content>
            <p>Ordinary offence: applying an HAFC</p>
          </content>
          <subsection eId="part-2__sec-8__subsec-1">
            <num>1</num>
            <content>
              <p>A person commits an offence if:</p>
            </content>
            <paragraph eId="part-2__sec-8__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>the person engages in conduct; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-1__para-b">
              <num>b</num>
              <content>

          <heading>Lapsing of anti-fouling certificates</heading>
          <subsection eId="part-3__sec-11__subsec-1">
            <num>1</num>

              <p>An anti-fouling certificate ceases to be in force if the ship ceases to be an Australian ship.</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-11__subsec-2">
            <num>2</num>
            <content>
              <p>An anti-fouling certificate ceases to be in force if:</p>
            </content>
            <paragraph eId="part-3__sec-11__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>since the certificate was issued or last endorsed, any coating or treatment is applied to any designated external surface of the ship; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-11__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>after the coating or treatment is applied, the ship is taken to sea without the certificate having been endorsed in respect of the coating or treatment.</p>

          <heading>Cancellation of anti-fouling certificates</heading>
          <subsection eId="part-3__sec-12__subsec-1">
            <num>1</num>
            <content>
              <p><role refersTo="#authority">The Authority</role> may cancel an anti-fouling certificate that is in force in respect of an Australian ship if <role refersTo="#authority">the Authority</role> has reason to believe that:</p>

              <content>
                <p>the ship does not comply with the anti-fouling requirements; or</p>
              </content>
            </paragraph>

                <p>the anti-fouling certificate was issued or endorsed upon false or erroneous information.</p>

            </paragraph>

              <p><role refersTo="#authority">The Authority</role> may cancel an anti-fouling certificate under subsection (1) whether or not the certificate was issued by <role refersTo="#authority">the Authority</role>.</p>

                <p>require the certificate to be given to a specified person; and</p>
              </content>

                <p>notice of the happening is not given in accordance with the regulations <quantity refersTo="#deadline">within 7 days</quantity> after the happening;</p>

        <heading>Inspection and enforcement powers</heading>

          <heading>Inspectors and identity cards</heading>
          <subsection eId="part-4__sec-16__subsec-1">
            <num>1</num>
            <content>
              <p>	(1)	Each of the following persons is an <b><i>inspector</i></b> for the purposes of this Act:</p>
            </content>
            <paragraph eId="part-4__sec-16__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>a person appointed by <role refersTo="#authority">the Authority</role> under subsection (2);</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-16__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>	(b)	an inspector within the meaning of the <i>Navigation Act 2012</i>;</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-16__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>a member, or special member, of the Australian Federal Police.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-4__sec-16__subsec-2">
            <num>2</num>
            <content>
              <p><role refersTo="#authority">The Authority</role> may, in writing, appoint appropriately qualified persons as inspectors.</p>
            </content>
          </subsection>
          <subsection eId="part-4__sec-16__subsec-3">

              <p><role refersTo="#authority">The Authority</role> must issue an identity card to each inspector appointed under subsection (2). The card must incorporate a photograph of the inspector.</p>

          </subsection>

              <p>A person commits an offence if:</p>
            </content>
            <paragraph eId="part-4__sec-16__subsec-4__para-a">

                <p>the person has been issued with an identity card; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-16__subsec-4__para-b">
              <num>b</num>

                <p>the person ceases to be an inspector; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-16__subsec-4__para-c">

                <p>the person does not immediately return the identity card to <role refersTo="#authority">the Authority</role>.</p>

              <p>A person to whom an identity card has been issued under subsection (3) must carry the card at all times when exercising powers or performing functions as an inspector under this Act.</p>

              <p>In this section:</p>
            </content>
            <content>
              <p><b><i>appropriately qualified</i></b> means having such training or experience as may be prescribed for the purposes of this definition.</p>

          </subsection>
        </section>
        <section eId="part-4__sec-17">
          <num>17</num>
          <heading>Inspection of ships</heading>
          <subsection eId="part-4__sec-17__subsec-1">
            <num>1</num>
            <content>
              <p>An inspector may exercise the powers under this section in relation to a ship in an Australian shipping facility for the purpose of ascertaining:</p>
            </content>
            <paragraph eId="part-4__sec-17__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>whether this Act and the regulations are being complied with in respect of the ship; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-17__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>whether the Convention is being complied with in respect of the ship; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-17__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>whether a foreign Convention law is being complied with in respect of the ship.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-4__sec-17__subsec-2">
            <num>2</num>
            <content>
              <p>The inspector may do any of the following:</p>
            </content>
            <paragraph eId="part-4__sec-17__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>go on board the ship with such assistants and equipment as the inspector considers necessary;</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-17__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>require the master of the ship to take such steps as the inspector directs to facilitate the boarding;</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-17__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>examine, and take samples of, any substances on board the ship or on any designated external surface of the ship;</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-17__subsec-2__para-d">
              <num>d</num>
              <content>
                <p>inspect any part of the ship or its machinery or equipment;</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-17__subsec-2__para-e">
              <num>e</num>
              <content>
                <p>require the master of the ship to take such steps as the inspector directs to facilitate the inspection of any part of the ship or its machinery or equipment;</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-17__subsec-2__para-f">
              <num>f</num>
              <content>
                <p>open, or require the master of the ship to cause to be opened, any hold, compartment or receptacle in or on board the ship and inspect the contents of any hold, compartment or receptacle in or on board the ship;</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-17__subsec-2__para-g">
              <num>g</num>
              <content>
                <p>require the master of the ship to produce:</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-17__subsec-2__para-i">
              <num>i</num>
              <content>
                <p>any certificate, declaration, endorsement or record that is required by this Act or the regulations to be carried on the ship; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-17__subsec-2__para-ii">
              <num>ii</num>
              <content>
                <p>any other documents, records or books relating to the ship or its cargo that are carried on the ship;</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-17__subsec-2__para-h">
              <num>h</num>
              <content>
                <p>make copies of, or take extracts from, any such documents, records or books;</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-17__subsec-2__para-i">
              <num>i</num>
              <content>
                <p>require the master of the ship to certify that a true copy or extract made by the inspector under paragraph (h) is a true copy of the original;</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-17__subsec-2__para-j">
              <num>j</num>
              <content>
                <p>take photographs (including video recordings) of the ship or of equipment, or anything else, in or on board the ship;</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-17__subsec-2__para-k">
              <num>k</num>
              <content>
                <p>require a person to answer questions.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-4__sec-17__subsec-3">
            <num>3</num>
            <content>
              <p>This section does not authorise an inspector to exercise powers in a manner inconsistent with the Convention.</p>
            </content>
          </subsection>
          <subsection eId="part-4__sec-17__subsec-4">
            <num>4</num>
            <content>
              <p>A person must not fail to comply with a requirement made of the person by an inspector under this section.</p>
            </content>

          <heading>Detention of ships</heading>
          <subsection eId="part-4__sec-18__subsec-1">
            <num>1</num>
            <content>
              <p><role refersTo="#authority">The Authority</role> may detain a ship in an Australian shipping facility if <role refersTo="#authority">the Authority</role> has reasonable grounds for believing that an offence against this Act has been committed in respect of the ship.</p>
            </content>
          </subsection>
          <subsection eId="part-4__sec-18__subsec-2">
            <num>2</num>
            <content>
              <p>The ship must be released immediately if:</p>
            </content>
            <paragraph eId="part-4__sec-18__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>security is provided in accordance with subsection (3); or</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-18__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>all proceedings that have been instituted in respect of the offence have been discontinued; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-18__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>all such proceedings have been concluded (whether or not any appeal is pending) without any person being convicted of an offence or being found liable to pay an amount of money; or</p>
              </content>
            </paragraph>

                <p>all such proceedings have been concluded, and all penalties and other amounts of money, and all costs and expenses ordered to be paid, in respect of the offence have been paid; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-18__subsec-2__para-e">
              <num>e</num>
              <content>
                <p><role refersTo="#authority">the Authority</role> forms the belief that the offence did not occur, or did not occur as a result of actions in relation to the ship; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-18__subsec-2__para-f">
              <num>f</num>
              <content>
                <p><role refersTo="#authority">the Authority</role> determines for any other reason that the ship should be released.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-4__sec-18__subsec-3">
            <num>3</num>
            <content>
              <p>Security referred to in subsection (2) must:</p>
            </content>
            <paragraph eId="part-4__sec-18__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>be provided in a form acceptable to <role refersTo="#authority">the Authority</role>; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-18__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>be an amount that, in <role refersTo="#authority">the Authority</role>’s opinion, is equivalent to the maximum amount of all penalties, other amounts of money, costs and expenses that could be payable by the master and owner of the ship in respect of the offence.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-4__sec-18__subsec-4">
            <num>4</num>
            <content>
              <p>If the ship leaves the shipping facility while it is under detention, then the master and owner each commit an offence.</p>
            </content>

          <num>19</num>
          <heading>Compensation for undue detention or delay</heading>
          <subsection eId="part-4__sec-19__subsec-1">
            <num>1</num>
            <content>
              <p>If a ship is unduly detained or delayed under this Act, then <role refersTo="#authority">the Authority</role> is liable to pay the owner reasonable compensation for any loss or damage suffered by the owner as a result of the undue detention or delay.</p>
            </content>
          </subsection>
          <subsection eId="part-4__sec-19__subsec-2">
            <num>2</num>
            <content>
              <p>If <role refersTo="#authority">the Authority</role> and the owner are unable to agree on the amount of the compensation, then the owner may institute proceedings in the Federal Court of Australia for such reasonable compensation as the Court determines.</p>
            </content>
          </subsection>
          <subsection eId="part-4__sec-19__subsec-3">
            <num>3</num>
            <content>
              <p>In this section:</p>

            <content>
              <p><b><i>unduly detained or delayed</i></b> has the same meaning as in Article 13 of the Convention.</p>

        <heading>Miscellaneous</heading>
        <section eId="part-5__sec-20">
          <num>20</num>
          <heading>Service of documents on master or owner of ship</heading>
          <subsection eId="part-5__sec-20__subsec-1">
            <num>1</num>
            <content>
              <p>A document to be served on the master or owner of a ship under this Act, or in respect of an offence against this Act, may be served on the agent of the ship instead.</p>
            </content>
          </subsection>
          <subsection eId="part-5__sec-20__subsec-2">
            <num>2</num>
            <content>
              <p>A document served on the agent of a ship under subsection (1) is taken to have been served on the master and owner of the ship.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-5__sec-21">
          <num>21</num>
          <heading>Time limit for prosecution of offences</heading>
          <subsection eId="part-5__sec-21__subsec-1">
            <num>1</num>
            <content>
              <p>Subject to subsection (2), a prosecution for an offence against this Act may be brought at any time.</p>
            </content>
          </subsection>
          <subsection eId="part-5__sec-21__subsec-2">
            <num>2</num>
            <content>
              <p>If the prosecution relates to an offence involving a foreign ship:</p>
            </content>
            <paragraph eId="part-5__sec-21__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>the prosecution must not be brought more than 3 years after the commission of the offence; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-21__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>the prosecution must be suspended if, under paragraph 1 of article 228 of the Law of the Sea Convention, it is required to be suspended; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-21__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>the prosecution must be terminated if, under paragraph 1 of article 228 of the Law of the Sea Convention, it is required to be terminated.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-5__sec-21__subsec-3">
            <num>3</num>
            <content>
              <p>In this section:</p>

              <p><b><i>Law of the Sea Convention</i></b> means the United Nations Convention on the Law of the Sea, done at Montego Bay on 10 December 1982.</p>

          <heading>Evidence of terms of the Convention</heading>
          <subsection eId="part-5__sec-22__subsec-1">
            <num>1</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> may issue a certificate stating that a document set out in, or annexed to, the certificate sets out the terms of the Convention.</p>
            </content>
          </subsection>
          <subsection eId="part-5__sec-22__subsec-2">
            <num>2</num>
            <content>
              <p>Such a certificate is prima facie evidence of the matters so certified.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-5__sec-23">
          <num>23</num>
          <heading>Evidence of analyst</heading>
          <content>
            <p>Authority may appoint analysts</p>
          </content>
          <subsection eId="part-5__sec-23__subsec-1">
            <num>1</num>
            <content>
              <p><role refersTo="#authority">The Authority</role> may, in writing, appoint appropriately qualified persons to be analysts for the purposes of this Act.</p>
            </content>
            <content>
              <p>Analyst may issue certificate</p>
            </content>
          </subsection>
          <subsection eId="part-5__sec-23__subsec-2">
            <num>2</num>
            <content>
              <p>An analyst appointed under subsection (1) may issue a certificate setting out, in relation to a substance, one or more of the following:</p>
            </content>
            <paragraph eId="part-5__sec-23__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>when and from whom the substance was received by the analyst;</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-23__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>what labels or other means of identifying the substance accompanied it when it was received by the analyst;</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-23__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>what container the substance was in when it was received by the analyst;</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-23__subsec-2__para-d">
              <num>d</num>
              <content>
                <p>a description of the substance received by the analyst;</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-23__subsec-2__para-e">
              <num>e</num>
              <content>
                <p>that he or she has analysed or examined the substance;</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-23__subsec-2__para-f">
              <num>f</num>
              <content>
                <p>the date on which the analysis or examination was carried out;</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-23__subsec-2__para-g">
              <num>g</num>
              <content>
                <p>the method used in conducting the analysis or examination;</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-23__subsec-2__para-h">
              <num>h</num>
              <content>
                <p>the results of the analysis or examination.</p>
              </content>
              <content>
                <p>Certificate admissible in proceedings for offence</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-5__sec-23__subsec-3">
            <num>3</num>
            <content>
              <p>The certificate is admissible in any proceeding for an offence against this Act as prima facie evidence of:</p>
            </content>
            <paragraph eId="part-5__sec-23__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>the matters in the certificate; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-23__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>the correctness of the results of the analysis or examination.</p>
              </content>
              <content>
                <p>Restriction on admissibility of certificate</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-5__sec-23__subsec-4">
            <num>4</num>
            <content>
              <p>A certificate must not be admitted in evidence under subsection (3) in proceedings for an offence unless:</p>
            </content>
            <paragraph eId="part-5__sec-23__subsec-4__para-a">
              <num>a</num>
              <content>
                <p>the person charged with the offence; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-23__subsec-4__para-b">
              <num>b</num>
              <content>
                <p>a barrister or solicitor who has appeared for the person in those proceedings;</p>
              </content>
              <content>
                <p>has, at least 14 days before the certificate is sought to be so admitted, been given a copy of the certificate together with reasonable notice of the intention to produce the certificate as evidence in the proceedings.</p>
                <p>Document taken to be a certificate unless contrary established</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-5__sec-23__subsec-5">
            <num>5</num>
            <content>
              <p>A document purporting to be a certificate referred to in subsection (2) is taken to be such a certificate and to have been duly given unless the contrary is established.</p>
            </content>
            <content>
              <p>Analyst may be called to give evidence</p>
            </content>
          </subsection>
          <subsection eId="part-5__sec-23__subsec-6">
            <num>6</num>
            <content>
              <p>If the certificate is admitted in evidence, the person charged may require the analyst to be called as a witness for the prosecution and the analyst may be cross-examined as if he or she had given evidence of the matters stated in the certificate.</p>
            </content>
          </subsection>
          <subsection eId="part-5__sec-23__subsec-7">
            <num>7</num>
            <content>
              <p>Subsection (6) does not entitle a person to require an analyst to be called as a witness for the prosecution unless:</p>
            </content>
            <paragraph eId="part-5__sec-23__subsec-7__para-a">
              <num>a</num>
              <content>
                <p>the prosecutor has been given at least 5 days notice of the person’s intention to require the analyst to be so called; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-23__subsec-7__para-b">
              <num>b</num>
              <content>
                <p>the court, by order, allows the person to require the analyst to be so called.</p>
              </content>
              <content>
                <p>Evidence in support, or rebuttal, of matter in certificate to be considered on its merits</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-5__sec-23__subsec-8">
            <num>8</num>
            <content>
              <p>Any evidence given in support, or in rebuttal, of a matter stated in a certificate issued under subsection (2) must be considered on its merits. The credibility and probative value of the evidence is neither increased nor diminished because of this section.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-5__sec-24">
          <num>24</num>
          <heading>Orders</heading>
          <content>
            <p>		The Authority may, by legislative instrument, make orders (<b><i>Marine Orders</i></b>) on any matter on which regulations may be made. However, orders cannot impose penalties for contraventions of the orders.</p>
          </content>
        </section>
        <section eId="part-5__sec-25">
          <num>25</num>
          <heading>Regulations</heading>
          <content>
            <p>The Governor-General may make regulations prescribing matters:</p>
          </content>
          <paragraph eId="part-5__sec-25__para-a">
            <num>a</num>
            <content>
              <p>required or permitted by this Act to be prescribed; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-5__sec-25__para-b">
            <num>b</num>
            <content>
              <p>necessary or convenient to be prescribed for carrying out or giving effect to this Act;</p>
            </content>
            <content>
              <p>and, in particular:</p>
            </content>
          </paragraph>
          <paragraph eId="part-5__sec-25__para-c">
            <num>c</num>
            <content>
              <p>for and in relation to giving effect to the Convention, other than provisions of the Convention to which effect is given by a provision of this Act; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-5__sec-25__para-d">
            <num>d</num>
            <content>
              <p>prescribing penalties not exceeding <quantity refersTo="#penaltyUnit">30 penalty units</quantity> for a contravention of the regulations.</p>
